I beg to move, That the Bill be now read a Second time.

I well understand why so many Members were in the House to hear the application for a debate under Standing Order No. 24 made by the hon. Member for Walthamstow (Stella Creasy). I am sure that I speak for Members in all parts of the House in thanking her for giving us all an opportunity to discuss that important and urgent matter.

Nature, as we know, has the capacity to awe and to inspire, and there are few more awe-inspiring examples of nature than the African elephant. It is a remarkable, keystone species: an icon which, for many of us, sums up nature at its most impressive, transformational and powerful. It is an important species not just because of what it symbolises, and not just because of the economic impact of tourism on Africa, but because it is indeed a keystone species on which the health, biodiversity and resilience of Africa’s economy depends.

My right hon. Friend is making a fantastic start to his speech. It is estimated that some 20,000 African elephants are being poached every year, the equivalent of about 55 a day. Does that not mean that it is important for us to pass the Bill as soon as possible?

My hon. Friend has anticipated exactly the point that I wanted to make. It is critical that, in appreciating the importance of the African elephant, we also appreciate the scale of the threat that the species now faces. My hon. Friend is absolutely right: given that 20,000 African elephants are being slaughtered every year in a drive by poachers to secure their tusks for criminal gain, we face a remarkable onslaught against the species—an onslaught that is devastating communities and upending economies, and also poses an existential risk to the African elephant. Unless action is taken to interdict the poachers and reduce the demand for ivory, it is possible that, on our watch—on the watch of our generation—the African elephant will meet extinction. I think that, as was well said by my right hon. and noble Friend Lord Hague of Richmond, it would be impossible for any of us to face our children and grandchildren and say that we had the opportunity to take steps, legislative and otherwise, to safeguard this magnificent animal, and failed to act.

The Bill gives us in the United Kingdom an opportunity to play our part and to show leadership. We have been invited to show that leadership by the countries at the sharp end. More than 30 African nations have asked us, and others, to do what we can to stop the poaching, to end the trade in ivory, and to restore balance and health to their nations by supporting their efforts to ensure that the African elephant can survive in the future.

I thank my hon. Friend for his support. There will be an opportunity in Committee to consider whether the scope of the Bill is absolutely as it should be. A number of Members have previously indicated their interest in extending its scope to other forms of ivory, such as narwhal horns, and there will indeed be an opportunity to debate precisely that matter in Committee.

I thank the right hon. Gentleman for giving way. I certainly welcome the introduction of this Bill, but would he care to comment on the actions of his friend President Trump, whose Administration in March lifted the US’s ban on importing body parts of elephants shot by trophy-hunters? Will the right hon. Gentleman take the opportunity now to condemn without reservation the reversal of that Obama-era regulation?

I absolutely will, because it is incumbent on all of us across the globe to take action. The specific request from African nations could not be clearer, so it is incumbent on us in the United Kingdom, countries in the far east—which often constitute the biggest market for ivory—and also countries like the United States, which has a distinguished global leadership role, to take action; it is incumbent on all of us to play our part as well.

I think there is an appreciation across the House of the importance of the elephant as a species. I mentioned earlier that it is a keystone species: if it were not for the elephant we would not have the means by which we maintain balance in the savannahs and grasslands of Africa. That is in the nature of the role the elephant plays, by the way in which it feeds and—without wanting to go into too much detail in the House—the way in which it excretes. It is important that we make sure that the elephant survives, because without it savannah and grassland would not survive, and without it we would not have species like zebra or like antelope, and without them we would not have the magnificent predators—the charismatic megafauna, the lions and others which feed on those creatures. So by removing the elephant we would not just see one of the most iconic, beautiful and awe-inspiring species with which we share this planet disappear; we would also unloose upon Africa a cascade effect of environmental degradation and damage that I think none of us could possibly countenance.

My right hon. Friend is making a very important point about the pyramid of biodiversity that is protected when one protects the megafauna at the top, but does he agree that conservation of the elephant is essentially a human interface that we have to get right, and that organisations such as the Northern Rangelands Trust in Kenya have been extraordinarily successful in making sure that local people see the value of wildlife? We can assist in that through our role as an international mediator, although we are not a range state.

My right hon. Friend, who played an immensely distinguished role as a Minister in the Department for Environment, Food and Rural Affairs in leading on the defence of biodiversity and support for wildlife, is absolutely right. As well as acknowledging the role that elephants play as an iconic species in their own right and as a keystone species in guaranteeing biodiversity, the successful co-existence of elephants alongside man is a sign of an effective and functioning nation in Africa which is on the right path for the future. It has been so encouraging that enlightened leadership across African nations recognises the vital importance of ensuring that man and the elephant can live alongside one another in appropriate harmony.

It is also the case, of course, that there are forces within African nations that can see in the ivory trade an opportunity to make money, to feed organised crime and to support terrorist and other activity, and it is precisely because ivory poaching and the illegal wildlife trade sustain organised crime and subsidise terror that it is in the interests of all of us who not only want to protect nature and biodiversity, but want to see human societies and other states flourish, to take action to stamp out this crime, and that is what this Bill seeks to do.

I welcome the Ivory Bill and the way in which the Secretary of State is putting forward the case for the elephant, but does he agree that one of the difficulties is that if we do things unilaterally they are unlikely to be as effective as if the whole world acts together? Therefore, if we look at the various measures that different parts of the world are taking, for instance the exemption for certain types of ivory from China or the different rules in different parts of Europe, we see that there is a real opportunity for a group like the G20 to harmonise the rules—which musical instruments are going to be exempted and so on—across the world.

Yes, I absolutely take my hon. Friend’s point. It is important that we co-operate, and one of the things this country will be doing is hosting the illegal wildlife trade summit in October. My right hon. Friend the Foreign Secretary has already been working with other countries, including by visiting Argentina, as the leader of the G20, just two weeks ago, in order to ensure there is the maximum possible buy-in. I had the opportunity myself to talk to a variety of representatives of different nations at the United Nations just a couple of months ago in order to ensure there is that effective co-ordination.

However, there can sometimes be a tendency—I know my hon. Friend the Member for Gloucester (Richard Graham) would not succumb to this—to say, “We need to wait for others to act before we act ourselves.” In so doing, we fail sometimes to act with the urgency, and to show the degree of leadership, that will encourage others to follow. It is absolutely right to acknowledge the leadership shown by the Chinese Government and others in seeking to close their markets to ivory, but this is an opportunity, in this place and at this time, for our generation to show leadership as well. And the leadership we want to show is to specifically ensure that we reduce demand for ivory in this country and globally.

I welcome this Bill and declare an interest as chair of the all-party group on Kenya. Does my right hon. Friend recognise that this is long overdue? In 1989, under the leadership of Dr Richard Leakey, President Moi burnt about 20 tonnes of tusks in order to draw the world’s attention to this pillage of the African elephant. It has gone on for far too long; the population in the Selous in Tanzania has gone down from 55,000 to 15,000 in a decade.

I thank my hon. Friend for his campaigning in this area; few people know more about, or are more effective advocates on behalf of, Africa and other developing nations than my hon. Friend. He is absolutely right that African leaders have been showing leadership for a generation on this, and it is important that we do our bit now.

I want, too, to give a particular vote of thanks to those of my colleagues in this House and another place who have shown leadership on this issue. I have mentioned Lord Hague of Richmond; as Foreign Secretary he outlined the case for action, and indeed worked with the Duke of Cambridge in order to secure international support for action. It is also the case that my right hon. Friends the Members for North Shropshire (Mr Paterson) and for South Northamptonshire (Andrea Leadsom) when they were Secretaries of State in this Department laid the groundwork for the legislation we are now introducing. It is also the case that across this House, in every party, there have been campaigners who have consistently and relentlessly pressed the case for action and we would not be here without their endeavours. We also would not be in a position to introduce this legislation were it not for the fact that outstanding work has been done by a series of non-governmental organisations—WWF, Tusk Trust and others—and also, critically, without support from the public. When we launched a consultation on the need to take action, there were more than 70,000 responses. That is a clear indication of the extent to which the public want us to act, and the overwhelming majority of those responses were in favour of urgent action. We need urgent action because we know that the maintenance of a legal trade in ivory allows illegal activities to pass without effective countering.

The Secretary of State gave a long list of those he wants to praise for their involvement in this, but will he join me in praising the rangers who do the work on the ground trying to defend elephants, rhinos and other animals against poachers? It is estimated that over 100 rangers a year lose their lives in violence because of the work they do.

The hon. Lady makes an important point: the bravery and determination of those who do this work is outstanding. In countries such as Gabon individuals risk their lives to save elephants and safeguard the animals they love in a country to which they are deeply attached, and as it goes in Gabon it goes in many others countries as well.

The hon. Lady’s intervention also gives me an opportunity to thank our own armed services. As the Defence Secretary pointed out, only last week we dispatched more trained military personnel to support the work of rangers on the ground. That capacity of a country like ours to work together and use our expertise alongside the commitment of those from African nations will help us turn the tide and beat back the poachers.

Among the tens of thousands of people who responded to the consultation were my constituents, Susie Laan and Louise Ravula, who are part of a small but effective organisation called Two Million Tusks, representing the million elephants slaughtered in the past 100 years. They did some original research that showed that, in 72 auction houses covering 180 lots of ivory, 90% of the sales of those lots were unable to prove the provenance—in other words, the dating to pre-1947—of the ivory, which is a legal requirement for the sale of ivory at the moment. Does my right hon. Friend agree that that research proves that we need a pretty comprehensive ban if we cannot tell the date of the product being sold?

My right hon. Friend makes the next important point in the chain of argument for legislation. Yes, we have restrictions at the moment, but they do not work. The existence of the current legal market allows illegally obtained ivory to pass as legally acceptable ivory or worked ivory for sale. In effect, that means that criminal organisations and those who are driven by the significant profits to be made by selling ivory into markets where there is a demand can use the weakness of the existing provision to pass illegal material off as legal. That is why we need to act.

The need to act, to be more precise and to change the burden of expectation is critical in the minds of all those who responded to the consultation and of those African and other leaders who are pressing action on us. They want to ensure that we take steps to communicate to the world that ivory should not be sold, trafficked or displayed in a way that encourages anyone to think that African elephant ivory is a good of ostentation that someone could derive pleasure from demonstrating their wealth by acquiring. The whole point about the trade in elephant tusks is that it is abhorrent and involves unspeakable cruelty, and every possible step needs to be taken to stop it.

My right hon. Friend will perhaps know that there was a debate in Westminster Hall on the fur trade earlier this afternoon. During that debate, the point was made very clearly that one of the reasons why that vile trade should stop was that there was no need for it. Is that not also the case for ivory? There is no need for it.

My hon. Friend makes absolutely the right point. There is no need for it. This trade has been driven by a belief that, as a result of goods being worked or fashioned in ivory, they have a merit or a capacity to confer on their owner some sort of status. That is completely inappropriate. I sense that there is a recognition across the House that we need to send a message through this legislation and that, through its effective operation, we can end that trade.

Does the Secretary of State agree that it is important, particularly in the context of the online trade in ivory, to have strict enforcement provisions to ensure that we can follow up our good intentions with practical effects?

I absolutely agree. The Bill is designed to ensure that we have appropriate ways of guaranteeing effective enforcement, including appropriate penalties. There will be civil and criminal penalties, if the Bill is passed, and those who break the law will face fines of up to £250,000 and criminal sanctions as well. That is only right if the deterrent effect is to be sufficient to ensure that people are not tempted to engage in the perpetuation of this evil trade.

One critical point that was made during the consultation was that, while those in the antiques and art markets are determined to do everything they can to close down the loopholes and to end the illegal trade that has contributed to poaching in Africa, there is an acknowledgement worldwide that there need to be some exemptions. Those exemptions must reflect decisions that have been made by past generations on the use of ivory and the way in which it has been deployed for artistic or cultural reasons in order to produce certain specific artefacts at specific times that have a particular value.

During the consultation, we looked specifically at exemptions for portrait miniatures. These are tiny but, in historical and cultural terms, hugely significant examples of fine portrait work from the 17th and 18th centuries, and they are valuable not because they are painted on ivory but because they are examples of exquisite artistic endeavour. Similarly, we except that there may be a range of items, including furniture, that are of genuine aesthetic merit and of which ivory forms only a small component. We propose to exempt items with a de minimis content of ivory, which no one is buying and selling because of the ivory but of which the ivory is an integral part.

Another exemption that we propose to introduce is for musical instruments. In the past, pianos, bagpipes and other musical instruments including violins required a proportion of their overall composition be ivory. There are now replacements available, so we no longer need to use ivory in any of those instruments, but will continue to respect the needs of the musical sector to have access to—and to be able to sell and buy—historically significant musical instruments from the past.

Would the Secretary of State accept that his commentary ought to be slightly amended, because we do not all recognise that historic ivory should be kept? Some of us think that this is an excuse for a continuation of the trade and that it creates loopholes and opportunities for those who wish to poach to masquerade their products as historic ivory. In fact, a bit like collections of shrunken heads, certain things were done by past generations, but in today’s more enlightened world, we do not need to keep those things. Some of us would rather see all ivory banned.

The hon. Gentleman makes a powerful point and he is absolutely right. This is one of the reasons why we are introducing this legislation. There are occasions on which people attempt to pass off as works of artistic or cultural significance items that do not have that significance. They attempt to exploit a loophole and create an excuse or an opportunity to carry on this wicked trade. That is why the exemptions are so tightly drawn, and it is also why the onus is on any individual who wishes to sell an item to prove that it meets the stringent criteria. That switch changes the obligation and places it on the seller.

In the past, it was possible for someone to say—perhaps not genuinely—that they had no idea, and that they thought the item in question was artistically worked and of appropriate provenance and an appropriate age. They could say, “I had no idea. I am terribly sorry.” Those loopholes, excuses and opportunities will end with this legislation, because individuals will have to pay in order to demonstrate that the item they wish to sell meets one of the criteria. This will be a matter that we can debate in Committee, and of course we are now living in more enlightened times, but I believe that some items fashioned in ivory reflect the historical, cultural or artistic importance of a particular period or artistic movement and that we need to respect that, using a clearly high threshold.

I have mentioned that there will be exemptions for portrait miniatures, for musical instruments and for items such as furniture of which ivory forms only a small part. There is one other area. If an item is of truly outstanding historical or cultural significance, and if, for example, a museum wishes to ensure that an item of such significance can be bought and appropriately displayed, that will still be possible if the appropriate steps are recognised and met.

I fear that I may be talking myself on to the Bill Committee, but my right hon. Friend has just used the phrase “outstanding historical”. Clause 2, which—I hope he will accept that I make these remarks in good faith—needs some further work and clarity, refers to “outstanding artistic etc value” and puts a huge amount of weight on the Secretary of State in appointing advisers and issuing guidance. The country would breathe easy with my right hon. Friend taking those decisions, but “outstanding artistic” is a broad definition that means all things to all men—beauty is in the eye of the beholder. Will my right hon. Friend commit to thinking in Committee about how the wording can be clarified to give certainty to those with an interest in this area?

I absolutely take that point on board. We want to ensure that individuals with sufficient expertise from organisations such as the Victoria and Albert Museum are in a position to provide a guarantee of the provenance and significance of the work. It is in no way our intention simply to say that something should be exempt either because of its apparent antiquity or because someone happens to consider it to be of aesthetic merit; we want to ensure that an academically rigorous process is undertaken to ensure that an item’s provenance can be guaranteed and that its aesthetic merit and its dating can be put beyond doubt.

Will the Secretary of State comment on the National Wildlife Crime Unit, which is key to tackling the illegal trade in wildlife and wildlife body parts? It is funded by DEFRA and the Home Office to the tune of £136,000 each a year—a paltry £272,000 a year in total. Will the unit’s funding be increased given the potential for free trade deals—if and when Brexit happens—and the danger that the UK could become a back door for body parts from third countries under the guise of free trade?

It is no part of this Government’s intention—I hope that this will be the same for any future Government—to use any trade deals to erode or undermine appropriate protections for animal welfare and environmental standards. I cannot see how any Government would want to weaken the protections that we intend to place on the statute book through this legislation to end this abhorrent trade.

The hon. Lady rightly pays tribute to the work of the NWCU, and in the run-up to the illegal wildlife trade summit this October we will be looking not just to ensure that we can continue to staff the unit and support the officers who work in this field adequately, but to ensure that we go even further. As several Members have already acknowledged, this legislation, important as it will be, is not enough in itself to ensure that we can effectively counter the poachers and to ensure that the precipitous decline in elephant numbers is at last halted and reversed. The global leadership that I hope other nations will join us in showing at the October summit is critical to maintaining momentum in dealing with this trade. The commitment of not just our armed services, but the rangers referred to by the hon. Member for Bristol East (Kerry McCarthy) and others is also critical. It is also important that we continue generously and effectively to fund international development work in African nations to ensure that people can move towards a sustainable economic future so that the temptation that some may have to connive with or work alongside poachers is removed as well.

In contemplating our ambition to ensure that the African elephant survives and that Africa flourishes, it is critical to recognise that the legislation is not enough on its own. However, without this legislation, we will fail to provide the required leadership on the global stage, we will fail to play our part in ensuring that we close down this wicked trade, and we will fail to acknowledge that the United Kingdom has had its position as a global hub for trade and a centre of excellence in the arts and antiques market used and abused in the past by those who want to continue criminal activity. The responsibility to legislate, with appropriate considerations for exemptions and enforcement, but at pace and with determination, falls on theHouse at this time, which is why I commend the Bill to the House.

Today, the Government published their consultation on a clean air strategy. At the most fundamental level, our health and prosperity depend on the health of the planet on which we live. From the air we breathe to the water we drink, the food we eat and the energy which powers our homes and businesses, we need to ensure we have a healthy and sustainable environment.

Nowhere is this more true than in the case of air quality. Air pollution is a major public health risk ranking alongside cancer, heart disease and obesity. It causes more harm than passive smoking.

This clean air strategy sets out the case for action and demonstrates this Government’s determination to improve our air quality. Leaving the EU provides us with an excellent opportunity to be even more ambitious about achieving cleaner air for the health of the nation, and for our environment and the biodiversity it sustains. We want to do all that we can to reduce people’s exposure to pollutants such as nitrogen oxides, ammonia, volatile organic compounds, particulate matter and sulphur dioxide.

Air pollution has improved since 2010, but we recognise that there is more to do. This comprehensive clean air strategy sets out how we will tackle all sources of air pollution, making our air healthier to breathe, protecting nature and boosting the economy.

Government must act to tackle air pollution which shortens lives. We are already acting to reduce concentrations of nitrogen dioxide (N02) around roads from cars, but vehicles are not the only source of toxic emissions. Air pollution is a result of the way we currently generate power, heat our homes, produce food, manufacture consumer goods and power transport. Better, cleaner technologies and simple changes in behaviour will tackle the pollution that claims lives.

The new strategy is a key part of our 25-year plan to leave our environment in a better state than we found it. It sets out the comprehensive action that is required from across all parts of government and society to meet the challenge. By 2025, we will halve the number of people living in locations where concentrations of particulate matter are above the World Health Organisation guideline limit of 10 ug/m3, protecting public health.

Through the introduction of new primary legislation, we will introduce a stronger and more coherent legislative framework for action to tackle air pollution, giving local government new powers to take decisive action in areas with an air pollution problem.

We are investing £10 million in improving our modelling, data and analytical tools to give a more precise picture of current air quality and the impact of policies on it in future. Alongside this, we will seek ways to support further investment in research and innovation, in partnership with UKRI, which will help the UK become world leaders in clean technology and secure further emissions reductions.

From farming to consumer products, a large range of other day-to-day practices, processes and products produce harmful emissions. Of particular concern is burning wood and coal to heat a home, which contributes 38% to harmful particulate matter emissions. It is why we will ensure only the cleanest fuels will be available for sale and only the cleanest stoves will be available to buy and install.

For the first time, the Government will take concerted action to tackle ammonia from farming by requiring and supporting farmers to invest in the infrastructure and equipment that will reduce emissions. The agriculture sector accounts for 88% of UK emissions of ammonia, and action by farmers can make a big difference in reducing the impacts of excess nitrogen on sensitive habitats and reducing the overall background levels of particulates in the atmosphere.

Government cannot act alone in tackling air pollution, and our strategy sets out how we will work with businesses, farmers and industry to implement lasting solutions to reduce air pollution, and the importance of each of us taking action and playing an important role in cleaning up our air for the next generation.

These actions will, we hope, ensure that this country is recognised as the leading global champion of cleaner air for the next generation.

Mr Speaker, thank you for granting this urgent question.

Air pollution is the greatest environmental threat to human health in this country and the fourth biggest public health killer after cancer, obesity and heart disease. Today marks the publication of the latest stage in this Government’s determined efforts to reduce and reverse the impact of air pollution on our health and on our natural environment. Our clean air strategy consultation, published today, outlines steps that we can all take to reduce the emission of harmful gases and particulate matter from all the sources that contribute to polluted air.

It is important to recognise, as I know my hon. Friend the Member for Tiverton and Honiton (Neil Parish) does, that air pollution is generated by a wide variety of sources—from the fuel used for domestic heating to the application of fertilisers on agricultural land, and from the use of chemicals in industry to sea, rail, air and road transport. The strategy published today outlines specific steps that we can take to reduce the use of the most polluting fuels, to manage better the use of manures and slurries on agricultural land, and to ensure that non-road mobile machinery is effectively policed, among other measures.

My hon. Friend asks specifically about urban transport pollution. Last year, the Government published their UK plan for tackling roadside nitrogen dioxide concentrations. The plan allocated over £3 billion to help to reduce harmful NOx emissions, including £475 million to local authorities to enable them to develop their own air quality plans. Since then we have been working with local authorities to help them to deliver specific solutions. We have also issued ministerial directions to 61 local authorities to ensure that they live up to their shared responsibilities.

Our plan committed us to phasing out the sale of conventional diesel and petrol cars by 2040 and taking them off the road altogether by 2050. This is more ambitious than any European Union requirement and puts Britain in the lead among major developed economies. Alongside that commitment we are dedicating £1.5 billion to the development of zero and ultra-low emission vehicles, including support for new charging points across the country.

We were of course helped in the preparation of our clean air strategy by the excellent report produced earlier this year by the Chairs of the Select Committee on Health, the Select Committee on Transport and the Select Committee on Environment, Food and Rural Affairs. In their excellent report on air quality, the joint Select Committees recommended introducing a new clean air Act. We will indeed be introducing primary legislation to clean up our air. They suggested that we initiate a new health campaign. As the Secretary of State for Health has emphasised, we will be introducing a personal messaging system to ensure that those most at risk receive the information that they need about pollution risks.

It was also recommended that we place health and environment, rather than simply technical compliance, at the centre of our strategy. We do that with ambitious new targets that match World Health Organisation metrics on improving air quality. Of course, we were also asked to reduce emissions from tyres and braking—the so-called Oslo effect—and today we have announced action to work with manufacturers to do just that.

Emissions have fallen consistently since 2010, and my predecessors in this role are to be commended for the action that they have taken, but today’s strategy marks the most ambitious steps yet to accelerate our progress towards cleaner air. I commend the strategy to the House.

I thank the Secretary of State very much for publishing the clean air strategy today. I know that he feels very passionately about this and works very strongly to get our air cleaner in this country. I also welcome the proposals for improving air quality. That demonstrates progress. However, I am concerned that the strategy is not as wide-ranging as it could be. I welcome the fact that we seem to be cleaning up our wood-burning stoves. We also need to deal with agricultural pollution but, in particular, we need to deal with the hotspots in our inner cities.

The strategy says that, to reduce particulate emissions from tyre and brake wear, the Government will work with international partners to develop new international regulations for particulate emissions from tyres and brakes through the United Nations Economic Commission for Europe. I very much welcome that, but is it adequate? To cut the levels of particulate matter from vehicles, the Government should reduce the need for private vehicles in congested urban areas by improving public transport and by making sure that public transport is much cleaner. We have done a lot in London but we need to do much across the rest of our cities in this great country.

It is not clear that the Government have taken on board our report’s key finding that Departments are not necessarily working together effectively. This is not a criticism of the Secretary of State; it is very much to say that we need to work more with Transport to deliver many of the solutions.

Will the Secretary of State support our calls for conventional petrol and diesel engine cars to be phased out by 2040? Will he offer more support and resources to local councils to improve their air quality so that this can be tackled at a local level as well as a national level? Can we be sure that all the monitoring systems through DEFRA and through local authorities actually work?

I welcome the fact that there will be new powers for the Transport Secretary to compel manufacturers to recall vehicles for any failures in their emissions control systems and to make tampering illegal. I still continue to ask why Volkswagen has got away with what it did and why we did not do enough to make sure that it was brought to book. That is not you, Secretary of State—that is the Transport Secretary. However, can the Secretary of State offer more support for cleaner fuels that consumers can use in vehicles, especially bioethanol—E10—in petrol? That is good not only for the environment but for farmers who supply the wheat that makes the bioethanol in the first place.

As you have indicated, Mr Speaker, I think we are all admiring of the Select Committee Chair for managing to pack into his allotted time so much that was useful. I will do my very best to reply appropriately.

My hon. Friend is quite right to draw attention to the way in which tyres and brakes generate particulate matter that finds its way into the air and contributes to air pollution. We will be working with manufacturers, exactly as he says, in order to deal with this method of pollution. He is also right that particulate matter is a particular problem with regard to public health. One of the biggest generators of particulate matter is domestic wood burning and coal burning. The clean air strategy goes further than ever before in making sure that we can deal with both those means of generating particulate matter.

My hon. Friend asks that we improve public transport. Specifically with regard to NOx emissions, the diesel vehicles on which so many rely for public transport—buses and so on—do need to be modernised. We work with local authorities to ensure that there is appropriate retrofitting of these vehicles so that the diesel emissions that contribute to poor air quality can be effectively dealt with. We are spending £475 million with local authorities to ensure that they can have bespoke solutions. That can involve the retrofitting of public transport. It can also involve engineering solutions to bring down the concentration of harmful emissions in particular areas.

My hon. Friend makes a point about the 2040 target. I completely agree that it is important to hit that target. He also draws attention to the fact that some motor manufacturers, in effect, attempted to get around regulations in order to produce vehicles for sale that did not meet the requirements for air quality that we would all want to see. We can all reflect on the way in which the regulation, which was of course fixed at EU level, did not work effectively. There has been reference, and I know there will be subsequent reference, to the court cases that have found a number of EU countries, including Britain, to be in breach of EU law on this matter. The truth is that one of the reasons Britain and other countries are in breach of EU law is that there are vehicles on our streets that had technical compliance with EU rules but, in terms of real-world emissions, were not fit for our use.

What we needed from the Government today was a comprehensive clean air strategy to show that they are really serious about tackling this public health emergency, but what we have instead is yet another consultation, which has a focus on emissions from agriculture and wood burning and is weak on cutting roadside pollution from diesel vehicles. It is worth remembering that, since the general election, there have been 25 DEFRA consultations and not one piece of primary legislation delivered.

We know that air pollution is responsible for at least 40,000 premature deaths every year. We know that it is particularly harmful to our children and our vulnerable elderly people. Effective national action must be taken to address the emissions from road transport that are contributing to illegal and harmful levels of pollution. The UK is currently routinely responsible for exceeding the legal levels of pollution. Today’s strategy states that the Government aim to halve the number of people living in unsafe levels of pollution by 2025, but that is simply not good enough. If today’s announcement is the extent of their ambition, it poses a serious question about whether this Conservative Government can really be trusted with our environment and with dealing with illegal air pollution after the UK leaves the EU.

The strategy still does not legally provide for a network of mandatory clean air zones, which DEFRA’s own analysis shows is the quickest and most cost-effective way to bring NOx levels down to legal levels. Yet again, we see more shunting of new responsibilities on to our cash-strapped local authorities, which have been cut to the bone by the Government’s unrelenting austerity agenda. All the new promises we have heard today will mean very little if local councils do not have the money or the resources to implement them.

The Government say time and again that they are committed to this being the first generation to leave the environment in a better state than we inherited it in, but I see no evidence of actual action being taken to deliver that. Anything being mooted by the Government on tackling air pollution will be effective only if there is a serious and independent environmental regulator after Brexit to hold the Government to account, but the Government’s recently announced environment watchdog has been roundly condemned as entirely toothless.

Labour has been calling for primary legislation on air quality since the last election. This Government only ever take action on illegal air pollution when they have been held over a barrel in the courts. I remind the House that there have been three legal challenges and a referral to the European Court of Justice. When will the Government treat this issue with the seriousness that it deserves? The time for half-measures and public consultation has to end. We need real action now to tackle this public health emergency.

I thank the hon. Lady for her points. She asks for a comprehensive strategy. That is what we have produced today. She specifically refers to our target to ensure that half of the population live in areas that meet World Health Organisation standards for air quality by 2025. What she omitted to tell the House is that this Government are putting forward a more ambitious aspiration for the cleanliness of our air than any other Government in a developed nation. It seems that, in her desire to be grudging, she failed to share with the House the detail of our ambition.

The hon. Lady asked about clean air zones. Clean air zones can be implemented by local authorities if they believe that that is the right solution. We on the Government Benches believe in the “local” in local government. It is right for local authorities to make an appropriate decision, depending on the circumstances in that area. A one-size-fits-all approach imposed from the centre may be appropriate in the Marxist-Leninist world of the Corbynistas, but we believe that it is appropriate to work with local authorities and metro Mayors. When necessary, we will apply ministerial directions, but it is appropriate to have the right approach for each individual area.

The hon. Lady asked about primary legislation. Let me remind her that a Labour Government were in place for 13 years, and how many pieces of primary legislation did they bring in on air quality? How many? It was a Conservative Government who brought in the Clean Air Act 1956 and a Conservative Government who brought in clean air legislation when John Major was Prime Minister, but when Labour was in power, we did not have clean air Acts—we had dirty diesel subsidies.

It was the Labour Government who introduced a deliberate ramping up of the number of diesel cars on our streets. We had a confession recently from none other than the hon. Member for Brent North, a man to whom I always pay close attention. Barry Gardiner admitted—it is perhaps not the first confession he will be making this week—that there is “absolutely no question” that the decision the Labour Government took on diesel was “the wrong decision” and:

“Certainly the impact of that decision has been a massive problem for public health in this country.”

Until we have an apology from those on the Labour Front Bench for the errors that they made, we will take their words on air pollution for the hot air that they manifestly are.

The clean air strategy rightly sets out the compelling case for action to reduce public exposure to air pollution in order to save lives and improve the quality of life for many. We also know that there is a compelling case to get Britain moving and get us out of our cars, and that cycling and walking, even where there is a lot of traffic, exposes people to less air pollution than driving. Does the Secretary of State share my disappointment that there is only a single paragraph in the strategy on active travel? I urge him to go further by strengthening measures to get people out of their cars and, where possible, on to their bikes and walking for their benefit.

My hon. Friend makes a vital point. Today’s strategy deals with a number of sources of air pollution, and I commend my right hon. Friend the Secretary of State for Transport for showing leadership on precisely the area that she draws attention to. We have spent £1.2 billion on a cycling and walking investment strategy. When my colleague the right hon. Member for Uxbridge and South Ruislip (Boris Johnson) was Mayor of London, he introduced a cycle lane network across the capital, which has contributed hugely to an increase in the number of people cycling across the capital. I absolutely believe that we need to have a switch away from an over-reliance on traditional internal combustion engines, towards new modes of transport, and part of that is making sure that we can cycle and walk wherever possible.

In Scotland we have achieved progressively clean air over recent years through increasingly strict control of industrial emissions, tighter fuel and emissions standards for road vehicles and control of smoke from domestic premises. However, after going to court numerous times, the UK Government are not taking serious action. They are just dragging their feet by announcing yet another consultation. As has just been said, the Secretary of State has issued more than 25 consultations since the 2017 general election, but none has yet produced new laws.

The Government’s own research shows that clean air zones are the most effective solution to air pollution, so why are they ignoring their own advice? Surely they should follow the Scottish National party Government, who are funding low emission zones to take the most polluting vehicles out of the most polluted areas of Scotland. The Health Secretary has said that

“Air pollution is contributing to a national health crisis.”

Why is the Environment Secretary ignoring his own Cabinet colleagues and not taking serious action now?

I am grateful to the hon. Gentleman for his comments. He makes the point about the number of consultations we have brought forward. Call me old-fashioned, but I think it is appropriate to consult before one legislates. I think it is absolutely right to make sure that we take account of the views of the citizens of this country and interested parties before moving to legislate. However, I note that in his demand for us to legislate was implicit Scottish National party support for the laws that we will bring forward. I will bank that kind offer of support from the SNP for the legislation that we will feel necessary to bring forward in due course.

The hon. Gentleman says that the Scottish Government have shown leadership on this issue. Indeed, I am happy to acknowledge that there are members of the Scottish Government, whether it is Roseanna Cunningham or others, who take an approach to the environment that dovetails with our own, and I enjoy working with them. The hard work behind the scenes that both Governments exhibit to improve our environment is sometimes not reflected in the exchanges we have on the Floor of the House, so I want to take this opportunity to thank the Scottish Government for the work that they do behind the scenes to advance our shared environment. It is vital, as we leave the European Union, that there is effective working across the four constituent parts of the United Kingdom to achieve the goals that we all share.

Is the Secretary of State aware that there is action he could take now that would not cost the Government money and would not require him to legislate further? Regulation 98 of the Road Vehicles (Construction and Use) Regulations 1986 states that it is already an offence to leave an engine idling when stuck in traffic or at traffic lights. Is he aware of Westminster City Council’s “Don’t Be Idle” campaign? Why do we not put some beef behind that campaign, spread it across the country and do something now that would really help, would not cost money and would make a big difference?

My hon. Friend is absolutely right. The phenomenon of idling engines—often, ironically, outside the very schools whose children we most want to protect from deteriorating air quality—does require action to be taken. I commend my hon. Friend for pointing out the leadership shown by Westminster, among many other councils, and I believe we need a wider application of the already existing powers that local authorities have to deal with this.

Our joint Select Committees report called for ambitious, co-ordinated cross-departmental action, yet there is virtually nothing in the Secretary of State’s new strategy to tackle the impact of road traffic. As the Chair of the Health Committee, the hon. Member for Totnes (Dr Wollaston) has said, modal shift gets two paragraphs and active travel just three sentences. He has clearly rejected a ban on diesel and petrol cars before 2040. Can he point to a single measure or funding pot that he is announcing today that will better align urban planning, public transport and fiscal incentives, as our Committees recommended?

It is important to realise that there was widespread recognition in the report produced by the hon. Lady and other Select Committee Chairs that road transport was simply one of the sources of air pollution. In this strategy, we are complementing what was already announced last year in our roadside NOx emissions strategy, with action on ports, air travel and trains, which is a signal of the determined efforts we are taking across the Government to deal with all the sources of air pollution.

The hon. Lady says that we should move faster than to get rid of internal combustion engines by 2040, but I have to say to her that no other major developed economy is taking that step. We need to take a balanced approach towards setting a firm deadline for moving away from conventional petrol and diesel engines, while also providing industry with the time to adjust.

I know that my right hon. Friend is one of the most responsible dwellers in the New Forest. He would never burn wet wood or coal with a high level of bitumen; only the driest and most parched twigs will find their way on to his fire and he will use only the appropriate and less smoky coal. I also know that he lives in one of the most beautiful parts of rural Hampshire, and as a result any emissions he generates are unlikely to form a particularly toxic cloud.

Over the past 30 years, the cost of motoring has fallen by 20%, while the cost of bus travel has risen by 64%. Will the Secretary of State do what he can to reverse those figures? Will he look in particular at the situation in Brighton and Hove? He has written to me about my concern that data on NO2 exceedances in the city are not being taken properly into account by the Government. Does he acknowledge that we have such exceedances in our city, and if so, will he look again at our grounds for appealing the decision not to award us money from the clean bus technology fund?

Absolutely. I will look at that decision. I recognise that it is important to have accurate measuring of exceedances, but as the hon. Lady will acknowledge, one of the reasons why we have them is that the current Euro 6 diesel cars have been found to emit six times the lab test limit on average, and the new regulations that have come into effect do not accurately ensure that we can bring down exceedances to the level that we both want to see.

I appreciate that my right hon. Friend is a friend, rightly, of the bees and of the fish, but he also needs to be a friend of hard-pressed motorists. The fact is that, as he acknowledged, diesel motorists were told by the previous Government to buy such cars, and his plans will give a green light to many local authorities up and down the country to whack taxes on to diesel car owners. Will my right hon. Friend look at this again? It has happened in London, and motorists are taxed far too heavily, so will he change these plans?

My right hon. Friend has been a consistent champion of small businesses and of those who rely on diesel vehicles to provide the services on which we all, more broadly, rely. As the nature of the debate in the House indicates, a balance needs to be struck. That balance is between recognising that there is an appropriate place in the next couple of decades for diesel as part of the transport mix—where either the private sector or local authorities can find support for a scrappage scheme, we will of course endorse and do what we can to facilitate that—and, as well as making sure that small business can thrive, ensuring that our children, critically, are protected from the greatest concentrations of pollution that we find in some urban areas.

The Secretary of State is right that local authorities have a big role to play in this, but they could do an awful lot more if they had the resources. Central Government have an even bigger role to play. In Tinsley in my constituency, NO2 levels are regularly above safe limits because it is next to the M1 motorway, which is a central Government responsibility. What are the Government going to do about that, apart from adding an extra lane to the motorway? In Sheffield city centre, the pollution hotspot is around Sheffield station because of diesel trains, yet this Government have just cancelled the electrification of the midland main line. When are we going to get some joined-up government on this matter?

I am a great admirer of the hon. Gentleman for all the work he has done both to ensure that the case for appropriate support for local government is made and to ensure, when it comes to planning, that we all take a thoughtful approach that takes the environment into account. However, there is one more thing he could do, which is to have a word with his Labour colleagues on Sheffield City Council and ask them to stop the tree felling campaign in which they are engaged. If we want to deal effectively with air pollution, one of the things we can do is to continue to ensure that trees—they not only act as a source of beauty and natural wonder but contribute to the fight against air pollution—are allowed to survive, rather than being chopped down by a council that is, I am afraid, in thrall to its own officers.

A properly targeted diesel scrappage scheme would enable us to get rid of the most polluting cars on our streets, and if it was properly targeted it could be done without hammering those people on the lowest incomes. Will my right hon. Friend commit to pressing the Treasury to agree to such a scheme, because ultimately it will have to do so?

My hon. Friend makes a very good point. The success of any scrappage scheme depends on effective targeting. What we cannot do—it would be irresponsible—would be to use public money to subsidise people who are already making a choice to get rid of a particular vehicle. The deadweight cost associated with that would not be money appropriately spent. He makes the very good point that if we can effectively target such vehicles and find the individuals whom we can incentivise to move towards a green and more sustainable method of transport, we should of course support such measures. I am entirely open-minded about any proposals that might come forward, whether from metro Mayors, local authorities or others.

Has the Secretary of State noted the very striking finding in our joint Committees report that the fumes and pollution inside a vehicle are 10 times worse than those outside a vehicle? As part of the public information campaign that he has just announced, will he ensure that it is directed at parents who drive their children to school, thinking they are protecting them when they are actually doing them much more harm than if they walked or cycled, as well as exposing other people’s children and families to more pollution and congestion?

Absolutely spot on. I am very grateful to the right hon. Gentleman for making that point. All of us need to know more about the sources of air pollution, and he is absolutely right. I did not appreciate that until the Select Committees brought it to my attention, and I am grateful to him for bringing it to the attention of a wider audience today.

We have devoted £1.5 billion overall to supporting the growth of zero and ultra-low emissions vehicles, including a wider network of charge points, but I think there is more that we can do. One of the things I will be exploring with my right hon. Friends the Secretaries of State for Transport and for Housing, Communities and Local Government is how we can do everything possible—both in planning and in the legislation that the Under-Secretary of State for Transport, my hon. Friend the Member for Hereford and South Herefordshire (Jesse Norman), is bringing forward—to build on the leadership that my hon. Friend has shown.

Everyone has the right to clean air, including people in villages such as North Hinksey and market towns such as Abingdon in my constituency, yet those places have hotspots, and those sorts of conurbations are not mentioned at all in the clean air strategy. Will the Secretary of State confirm that his ambitions extend to smaller conurbations, not just cities?

The hon. Lady makes a good point. There are concentrations of poor air quality not just in our major cities but in other areas. There can be a combination of factors, including roadside emissions and emissions from domestic heating. Critically, as my hon. Friend the Member for Tiverton and Honiton (Neil Parish), the Chair of the Environment, Food and Rural Affairs Committee, acknowledged, sometimes emissions also come from agriculture. The strategy commits us to providing support for all those sectors, to move towards a cleaner future.

In my constituency, the badly thought through planning policy of the failing Labour council is failing properly to take into account the critical issue of air quality. How will today’s announcement improve my constituents’ lives, given that at the moment they are at the mercy of a failing Labour local authority?

The powers envisaged in the consultation will allow local authorities to act on everything, from unwise choices made about domestic heat generation to making sure that some of the diesel machinery involved in construction and for other purposes is appropriately licensed and controlled. I note that, following recent local election results, it seems that the leadership shown by my hon. Friend has been recognised by voters in his constituency, who have moved away from their previous allegiance.

On secondary generators and other generators of emissions, we are giving local authorities and others powers to deal with the consequences of poor air quality as a result of their deployment.

More broadly, on hydrogen and other vehicles, the Department for Transport is neutral about future technologies but supportive of the investment required to ensure that a suitable range of technologies is available. One of the key features of the legislation being brought forward by my hon. Friend the Under-Secretary of State for Transport, which originated under the leadership of my right hon. Friend the Member for South Holland and The Deepings (Mr Hayes), is to facilitate precisely the type of innovation that the hon. Gentleman alludes to.

The Secretary of State has repeatedly told the House that the UK leads the way in phasing out combustion engines by 2040, but he must keep up to date with current events in the German Bundesrat, which has already passed legislation for them to be phased out in Germany by 2030. We also believe that in China combustion engines will be phased out by 2030. That makes our policy a laughing stock in the world.

Manufacturers, retailers and users of them in the UK will be listening very carefully to what he has to say. Such stoves are an important part of domestic heating.

I commend to the Secretary of State the clean air Bill proposed by my colleague Simon Thomas in the National Assembly for Wales. In the spirit of the decentralised approach that he proposes, what consideration have the British Government given to devolving vehicle excise duty and fuel taxes to Wales, so that the Welsh Government can have a revenue stream to implement alternative transport solutions?

I am all in favour of devolution, but any questions about vehicle excise duty or taxation are properly a matter for my right hon. Friend the Chancellor of the Exchequer. However, I met Simon Thomas and some of his colleagues from the Welsh Assembly a couple of weeks ago. I was hugely impressed by the work that they are doing, and I would like to work closely with the Assembly and the hon. Gentleman’s colleagues.

My hon. Friend makes a good point. We are investing £1.5 billion, but it is also important for us to reflect on where people are likely to find themselves at particular times of the year—now and in years to come. One of the things that many of us will be doing this coming bank holiday weekend will be visiting beautiful English seaside resorts such as Torbay. It is important that, as they move towards cleaner and greener forms of transport, people have the opportunity to enjoy the natural beauty of the southern riviera without polluting the air at the same time.

On the subject of natural beauty, Hull was one of 49 UK towns and cities that failed World Health Organisation standards for air pollution.

What discussions has the Secretary of State actually had with the Transport Secretary about the scrapping of rail electrification schemes and his championing of bimodal trains which, as I understand it, will still pollute the air?

The use of dirty coal to generate electricity in our country plummeted by 25% last year, and such generation now stands at less than 7% of the overall energy mix. Will my right hon. The Government are in the dock at the European Court of Justice for the premature deaths of 40,000 people a year. As we approach Brexit, is it not time that we had a clean air Act with the focus and priority to deliver the standards and enforcement institutions that we enjoy in Europe? We should at least match the 2030 targets for the Netherlands, Ireland and Germany so that we do not end up being the dirty, coughing man of Europe.

I am grateful to the hon. Gentleman for his point. He has been in the lead among Members in pressing for primary legislation, and we acknowledge the need for such legislation in the strategy. I know the point that the hon. Gentleman is trying to make—it was also made by the hon. Member for Norwich South (Clive Lewis)—but it is important to remind the House that the vote in the Bundesrat was non-binding. What we have in this country are binding commitments that we are determined to meet, and that is a significant contrast.

I am sure that the Environment Secretary gets very frustrated with the Treasury dragging its feet on some of the initiatives he wants to push forward. It was recently reported that the £400 million plan for electric car charging infrastructure is being held up by the Treasury because it has not even recruited somebody to be in charge of the private sector investment element—it says it will recruit this summer—so will he please put a rocket under the Treasury and tell it that while people want to buy electric cars, they will not do so unless the infrastructure is in place?

I am grateful to the hon. Lady for trying to present the issue in the way she did. The truth is that I cannot think of anyone in this House, apart from possibly my right hon. Friend the Member for South Holland and The Deepings, who is cleaner—keener, rather—on investment. [Laughter.] He is very clean. Cleanliness is next to godliness. I do not think there is anyone in this House who is keener on moving towards ultra low emission vehicles than the Chancellor of the Exchequer. As Transport Secretary and in his current role, he has led efforts across the Government to make sure we are moving in the right direction. I do not think it is at all fair to criticise him or the Treasury in that regard.

I declare an interest as the owner of two very efficient renewable fuel-burning wood stoves. On traffic emissions, it was recently discovered that the monitoring equipment in Shoreham high street had been broken for several years, which might explain the fact that Shoreham’s air quality is always deemed to be good. Volunteers have now had to carry out those tests. If we are to be serious about the quality of the air, may we put a duty on local authorities to properly maintain accurate and reliable equipment?

We have been working with not just the Department for Transport, but the Department for Business, Energy and Industrial Strategy, to ensure that we can make Britain the most attractive home for new technologies. It is striking that great British inventors such as Sir James Dyson have dedicated themselves to ensuring that Britain can compete with competitors such as Elon Musk’s Tesla to provide the right technology for clean, green, effective and sustainable transport in the future.

The clean air strategy says that during the transition to zero emission vehicles

“we will ensure the cleanest conventional vehicles are driven on our roads.”

The Secretary of State will know that most people buy second-hand cars, not new ones. Under changes introduced by this Government, vehicle excise duty rates for used cars registered after March 2017 make no distinction whatever between those that produce lower levels of carbon dioxide and pollutants that are harmful to air quality, and those that produce higher emissions. How is that compatible with a promise to ensure that the cleanest conventional vehicles are driven on our roads?

It is the case that the increase in vehicle excise duty on new cars is helping to contribute to ensuring that local authorities receive the money they require to have appropriate clean air strategies. I think that any keen student of the second-hand car market would recognise that the value and resale value of diesels has fallen, reflecting the fact that people know that they need to move away from that polluting form of transport.

With a characteristic mix of insight and eloquence, the Secretary of State has once again made the case for extending the electric charging infrastructure, thereby addressing one of the reasons why people do not buy electric cars. He will know that when we debated these matters in the House—he paid tribute to my pioneering of that legislation—one of the reasons for local authorities’ frankly inconsistent application regarding on-street parking was that the guidance was not strong enough. Will he now ensure that all local authorities make provision for electric charging infrastructure on streets?

If I might just add, Mr Speaker, I initiated a competition as Minister for the design of such infrastructure. Will the Secretary of State reinvigorate that competition so that the charging infrastructure is one day as iconic as the pillar box or a Gilbert Scott telephone box?

My right hon. Friend makes two very important points. On the first point, we absolutely need to make sure that the infrastructure is there, and his second point is also important. One of the reasons why we cherish the environment is natural beauty. When we think about the steps we take to safeguard and enhance natural beauty, we should think about man’s contribution to making sure that the aesthetics around us reflect the best of us. The best of us is, of course, exemplified by my right hon. Friend the Member for South Holland and The Deepings.

We have specific arrangements with the Mayor of London to ensure we can help him to meet his ambitions. I saw the Mayor last night. I do not expect him to endorse everything in this package, but I find his constructive approach to working with central Government to improve air quality heartening. We will continue to work with him. A little while back the Mayor himself said that while resolving road emissions was critical to improving air quality, there are many other things that the Government are required to do. It was partly a result of what the Mayor said that we brought forward the strategy today.

One thing we have done is to work with the academic community. Indeed, I met some of its members yesterday at Imperial College, one of our best universities, to look at the impact of the steps we are already taking to improve public health and to save money for the Exchequer. By definition, that work is publicly available to all. I take on board the hon. Lady’s point. We are bringing forward primary legislation. We can use the model that has been constructed to see how different impacts could be generated by different policies, and I look forward to sharing those results with her.

Emissions from road traffic cause the majority of air pollution in my constituency. Given that the M4 and traffic related to Heathrow are outside the purview of the London Mayor and the London Borough of Hounslow, how exactly will the Government ensure that post-Brexit regulatory regimes will have the same powers as their current European equivalents?

Hope Street in my constituency has long been acknowledged as one of the most polluted streets in Scotland, so I am sure that the Secretary of State will have been as glad as I was to see that Councillor Anna Richardson is bringing forward a low emission zone in Glasgow as one of the first acts of the SNP city government. One of the inhibitors to the success of low emission zones is of course haulage and bus transport. Will he tell us a bit more about what conversations he has had with those industries about progressing to more environmentally friendly vehicles?

We have been keen to make sure, certainly when it applies to buses and public transport, that we make money available to local authorities for appropriate retrofitting. Hauliers recognise that there will need to be a shift. One of the things we need to do—my right hon. Friend the Secretary of State for Transport is doing this—is to make sure that we can move to a more efficient method of haulage in the future.

I was pleased that the Secretary of State raised electric vehicles in his opening remarks, as I have been pursuing this issue since I came to this place. I have created a nine-point plan, which I raised with the Minister for Energy and Clean Growth and more recently with the roads Minister in a debate on electric vehicles in Westminster Hall. The ideas include matching Joint Air Quality Unit funding with Office for Low Emission Vehicles funding and getting three-phase electric points. Will the Secretary of State meet me to discuss all nine points of my plan?

It is this Government’s ambition to ensure we leave our environment in a better state than we inherited it. It is our aim not just to protect and conserve but also to enhance and restore habitats and landscapes. The recently published flagship 25-year environment plan sets out the scale of our future ambition. The environmental principles and governance consultation document that we have published today outlines proposals to help deliver on this, including a new, ambitious Environmental Principles and Governance Bill.

For many who care deeply about the environment, and have fought for its protection over several decades, our membership of the European Union (EU) has coincided with increased awareness of environmental concerns and improved mechanisms to safeguard the natural world. We want to ensure that the new mechanisms we put in place as we leave the EU do not just maintain, but also strengthen protection for the environment.

Our new Environmental Principles and Governance Bill is designed to create a new, world-leading, independent environmental watchdog to hold Government to account on our environmental ambitions and obligations once we have left the EU. When the UK leaves the EU, we will no longer be under the jurisdiction of the EU institutions which currently provide oversight and enforcement of many of our environmental laws. The new body will ensure that environmental standards are upheld after we leave the EU, holding Government to account for their delivery.

In order to ensure we have robust environmental governance systems in place, we propose that the new body should have three main functions: providing independent scrutiny and advice; responding to complaints; and enforcing Government’s delivery of environmental law where necessary. However, we are consulting on what functions and powers the new body should have specifically, and would welcome a wide range of stakeholders’ views on this subject.

The new Environmental Principles and Governance Bill will also establish a new, comprehensive, statutory environmental principles policy statement. The current system of EU environmental legislation is underpinned by a number of “environmental principles”, such as sustainable development, the precautionary principle and the polluter pays principle. Although these principles are already central to Government environmental policy, they are not set out in one place beside the EU treaties.

The consultation is exploring the scope and content of a new statement on environmental principles in order to underline our commitment that environmental protection will be enhanced, not diluted, as we leave the EU. We are consulting as to whether the environmental principles themselves should be listed in the Environmental Principles and Governance Bill, in addition to the policy statement. It will be a statutory requirement for Government to have regard to the policy statement as they interpret the environmental principles. We also propose to give the new environmental body the function and powers to scrutinise application of the policy statement, periodically advising Government on possible improvements and taking action to ensure application, if necessary.

This consultation is concerned with environmental governance in England and reserved matters throughout the UK, for which the UK Government have responsibility. However, we are exploring with the devolved Administrations whether they wish to take a similar approach. We would welcome the opportunity to co-design proposals with them to ensure they work across the whole UK, taking account of the different government and legal systems in the individual home nations.

There are regular discussions between Ministers about the benefits of leaving the EU, including for the UK’s food and drink industry. We are committed to helping our farmers to grow more, sell more and export more great British food and drink. The Government have made good progress this year on opening access to global markets, and we also have the opportunity to harness the food and drink sector’s ambitious plans for increasing exports as part of a sector deal under our industrial strategy.

This week, the chief executive of the National Farmers Union warned against selling out agriculture for simple ideology. Does not the Secretary of State accept that the unilateral decision to withdraw from the customs union and single market was based purely on ideology? When is he going to stop the platitudes and the mild assurances, and accept that that ideological decision threatens to destroy the future of agriculture in these islands?

I am grateful to the hon. Gentleman for his question. I have to say that the discussions about the benefits of leaving the EU that I undertake with my Cabinet colleagues go long into the night, often fuelled and sustained by glasses of fine Scotch whisky and smoked salmon from parts of that beautiful country. One of the things we appreciate is that the appetite for smoked salmon, whisky and Scottish and British produce is growing faster outside the European Union than it is within it.

Scotland produces some of the finest food and drink, which is exported around the world. That allows us to punch well above our weight in terms of balance of payments, and it is based on our valued Scottish brand. What steps is the Secretary of State taking to protect Scotland the brand to ensure that our reputation for quality food and drink is enhanced during and after the Brexit process?

That is a very constructive contribution, because Scotland is a very powerful brand. I mentioned whisky and smoked salmon, and it is the case that the high-quality food producers of Scotland—from those who are responsible for beef in the north-east of Scotland to those who are responsible for the wonderful organic carrots and potatoes of Aberdeenshire—are individuals who work incredibly hard, and it is my desire to champion them. That is why I am just a little bit sad that the First Minister of Scotland has decided not to collaborate with the UK Government to make sure that we have effective UK-wide frameworks so that we provide a firm platform for future exports and growth.

There is growing demand for dairy products, and not just in the middle east and south Asia, as we have also had a very successful drive to increase sales of organic milk to the United States of America. Our dairy farmers do an amazing job and the opportunities for their quality products—yoghurt, cheese and others—to be sold worldwide will only increase as we leave the EU.

I have already met, and hope to meet again very shortly, Ministers in the Irish Government to ensure that we have a shared approach across these islands and that trade can continue to flow with as little friction as possible, but our success will require good will on every side. I therefore look forward to visiting Ireland in the week after next to talk to its Agriculture Minister and those directly involved in trade.

Friend will understand that, whether potatoes are grown in the Mearns or in the March fens, they must all be grown under common UK regulations; otherwise we risk damaging the UK internal market. My hon. Friend makes an absolutely brilliant point. Recently, the Chancellor of the Duchy of Lancaster has been negotiating with devolved Administrations to ensure that, as we leave the European Union, we can have a successful internal market in the United Kingdom. Agreement has been reached with the Welsh Government. Mark Drakeford, the Labour Minister, has shown a degree of flexibility and taken a constructive approach, which is in stark contrast to that of the Scottish Government and the First Minister of Scotland, who has put a narrow ideological pursuit of separation ahead of the interests of the people of Scotland—and not for the first time, either.

Many agricultural unions in Wales have expressed concern about clarity relating to the future arrangements for common frameworks. Do the UK Government intend to apply the Barnett formula to any funding allocated to Wales in the future?

I do not think that anyone disagrees that there might be a need for common frameworks, but I do not think they would disagree either that democratic decisions by democratically elected Parliaments are artificial barriers, so will the Secretary of State guarantee that no frameworks will be imposed across the UK without the democratic consent of the Scottish Parliament and the Welsh Assembly?

That is a good try, but the hon. Gentleman knows that the stark contrast between the constructive approach of the Labour Administration in Cardiff and the obstructive approach of the nationalist Administration in Holyrood does not redound to the credit of the Scottish National party. The truth is that the SNP has only one policy, which is separation. Everything else is tactics and they are prepared to throw Scottish farmers under the bus—[Interruption]—or, indeed, the bandwagon in their desperate desire to elevate the destruction of the United Kingdom above the creation of wealth for the people of Scotland.

I was delighted to be able to be present at the Countryside Alliance’s “Rural Oscars” awards in the Cholmondeley Room of the House of Lords yesterday. A number of the local businesses that do so much to help local food economies and to sustain and champion local food production were celebrated for their outstanding work, and I was pleased that businesses from across England and Wales were celebrated in that way.

My constituency has a long coastline and, unfortunately, a large amount of plastic pollution, like the rest of our island nation. The coastal communities of Gower are working hard to gain plastic-free status, and thanks to an active community councillor, Susan Rodaway, beach cleans are taking place across the constituency. Will the Government heed the call of the Environmental Audit Committee and introduce a coastal clean-up fund to support the removal of plastic waste from our beaches and seas?

I know the hon. Lady’s constituency, and I know what a beautiful coastline it has. The beach at Rhossili bay in particular is one of the most iconic landscapes in the United Kingdom, and we need to do absolutely everything we can to free those landscapes and our marine environment from litter. I will look at her request. I understand that funding for these matters is devolved, but of course all the nations of the United Kingdom can work together to keep our seas and our beaches cleaner.

This week, the European Parliament’s PECH Committee adopted a report that would make the UK’s access to the EU market for fishery and aquaculture products dependent on EU vessels’ access to British waters and on the application of the common fisheries policy. That is unacceptable, so will the Secretary of State confirm the Government’s commitment that the UK will become an independent coastal state at the end of the implementation period, free from the CFP?

A cruel wind may be blowing for the thousands of cat owners who put protective fencing in place to stop their much-loved pets joining the hundreds of thousands that are killed by cars on our roads each year. I am grateful to my right hon. Friend for raising both cat welfare and invoking the spirit of T. S. Eliot. At the beginning of “The Waste Land”, T. S. Eliot wrote:

“April is the cruellest month”.

But this April will not be a month in which cruelty towards any living thing will be tolerated. We want to introduce legislation to ensure that the use of shock collars as a means of restraining animals in a way that causes them pain is adequately dealt with.

My right hon. Friend raises another important point in that containment fences can play a valuable role in ensuring that individual animals, dogs and cats, can roam free in the domestic environment in which they are loved and cared for. Several submissions have been made to our consultation on the matter. I know that my right hon. Friend cares deeply about the welfare of domestic pets and other animals, and he and others have made representations that we are reflecting on carefully.

I think we can all agree that we have great British food and great British farming, but we also have a processing industry that is 13% of our manufacturing sector. Last week, the Secretary of State told my Committee that the agriculture Bill is no longer urgent as we have agreed a transition period with the EU. Farmers are the bedrock of Britain’s food industry, but if the European Communities Act 1972 is repealed in March 2019, what is the legal basis on which he will continue to make farm payments? I am grateful to my hon. Friend for raising this issue. We are consulting at the moment on how we can improve food labelling to ensure that we can provide consumers with greater choice, but it is also important to bear in mind that freedom of religious worship and practice is a core virtue of the United Kingdom. Although I believe very strongly in improving animal welfare standards, I also believe that we should show appropriate respect towards those individuals, from whatever faith background, who want to ensure that the meat they eat is prepared in accordance with their religious traditions.

Last weekend more than 35,000 volunteers collected 65 tonnes of plastic waste from 571 beaches across the United Kingdom, organised by Surfers Against Sewage. Will the Secretary of State join me in congratulating and thanking all those volunteers, and does he agree that we now have a grassroots unstoppable people’s movement determined to rid our coast of plastic waste?

Thank you, Mr Speaker, for this opportunity to update the House. I begin by paying tribute to the hard work of the Ministers and especially the civil servants in our country’s negotiating team, who this weekend concluded an agreement on the nature and length of the implementation period, which will help us to prepare for life after Brexit. Taskforce 50, on behalf of the EU, and our own team of dedicated civil servants secured an agreed text, which will now go to the March Council of the European Union at the end of this week, and after that the Prime Minister will update the House on Monday.

The House will be aware that there are important legal and technical questions relating to fisheries management, which means that it occupies a special position in these negotiations. Both the EU and our own negotiators were always clear that specific arrangements would have to be agreed for fisheries.

Our proposal to the EU was that, during the implementation period, we would sit alongside other coastal states as a third country and equal partner in annual quota negotiations. We made that case after full consultation with the representatives of the fisheries industry. We pressed hard during negotiations to secure this outcome, and we are disappointed that the EU was not willing to move on this.

However, thanks to the hard work of our negotiating team, the text was amended from the original proposal, and the Commission has agreed amendments to the text that provide additional reassurance. The revised text clarifies that the UK’s share of quotas will not change during the implementation period, and that the UK can attend international negotiations. Furthermore, the agreement includes an obligation on both sides to act in good faith throughout the implementation period. Any attempts by the EU to operate in a way that harmed the UK fishing industry would breach that obligation.

These arrangements will of course only apply to negotiations in December 2019. We are at the table as a full member state for negotiations in December 2018 and, critically, in December 2020 we will be negotiating fishing opportunities as a third country and independent coastal state—deciding who can access our waters and on what terms for the first time in over 40 years.

It is important that we use this transition period to ensure that we can negotiate as a third country and independent coastal state in 2020 to maximise the benefits for our coastal communities, ensure that we can control who accesses our waters and on what terms, and ensure that we manage our marine resources sustainably. We are already looking at a range of data to support consideration of future fishing opportunities, including the nature of catches and zonal attachment of stocks in the UK exclusive economic zone.

There is a significant prize at the end of the implementation period, and it is important that all of us in every area accept that the implementation period is a necessary step towards securing that prize. For our coastal communities, it is an opportunity to revive economically. For our marine environment, it is an opportunity to be managed sustainably. It is critical that all of us, in the interests of the whole nation, keep our eyes on that prize.

I thank the Secretary of State for that answer. The problem he has, of course, is that as recently as two weeks ago, the Prime Minister did not see this as a necessary step. I have to tell him—if he does not already know it—that the mood in fishing communities today is one of palpable anger. This is not what they were promised. The basic question that the Secretary of State has to answer today is: if the Government can let us down like this on the deal for the transitional period, how do we know they will not do it again when it comes to the final deal? When it comes to it, will they trade away access to waters for access to markets or anything else?

The House also needs to hear today how this bizarre arrangement is going to work in practice. The EU deal with Norway and the Faroes on mackerel is due to expire at the end of this year. We had thought that it would be rolled over for 12 months. Will that still be the case, and what barrier will there be to the EU Commission agreeing another bad deal for our pelagic fleet? With regard to the operation of a discard ban, the Secretary of State should know that British boats have a particular problem with hake as a choke species. That is a problem for our fleet and for nobody else. Does he really expect that the other 27 member countries are going to come up with a solution to something that is a problem only for us and not for them?

It is reported that the Government Chief Whip told his Back Benchers yesterday that

“it’s not like the fishermen are going to vote Labour”.

If that is true, it betrays a certain attitude. The Secretary of State should not be complacent: he should not take it for granted in the future that they will be voting Tory either.

I am very grateful to the right hon. Gentleman for his very fair and detailed comments. The first thing I will happily acknowledge is that there is disappointment in fishing communities. As someone whose father was a fish merchant and whose grandparents went to sea to fish, I completely understand how fishing communities feel about the situation at the moment, and I share their disappointment.

Secondly, the right hon. Gentleman asked about future negotiations and the role that we will play. There is a unique 12-month period, leading up to the December Council at the end of 2019, when the EU will argue on the UK’s behalf, but the UK will be there, as part of the delegation and consulted, in order to ensure that all the legitimate interests that the right hon. Gentleman raises are fairly represented.

The right hon. Gentleman also raised the whole question of the discard ban and choke species. The truth is that every single fishing nation is affected by the discard ban and choke species, and that we operate collectively with our neighbours to ensure that we have the correct means of marine conservation, because unless we have a system that involves choke species and a discard ban, we can have the overfishing that in the past has sadly led to an unhappy outcome for fishing communities.

The final point I would make is that of course no one takes anyone’s votes for granted—certainly not the votes of those who work so hard to ensure that we have food on our plates—but I would say one thing. The only party in this House actually committed to leaving the common fisheries policy is the Conservative party—I should say in fairness that our colleagues in the Democratic Unionist party share that position as well. It is critically important that we all ensure that leaving the common fisheries policy at the end of 2020 enables us all to ensure that the communities the right hon. Gentleman represents in Orkney and Shetland, and the communities we all have the honour of representing, benefit from the new freedoms that that will bring.

I know that the Secretary of State knows that 45 years ago the fishermen felt they had a very bad deal. They want their fishing rights back. Can he reassure me that, as we have this interim deal, we can register ourselves as an independent coastal state, so that on 1 January 2021 we have complete control of our waters?

Yes, my hon. Friend, the Chairman of the Select Committee on Environment, Food and Rural Affairs, is absolutely right. One of the critical things we can do is make sure, not just from 1 January 2021 but in December 2020, that we are negotiating as an independent coastal state. We will be able to join the regional fisheries management organisations in advance of the December 2020 negotiations—organisations that any independent coastal state has to be part of to secure fishing opportunities and ensure that the marine environment is adequately protected.

I am grateful to the right hon. Member for Orkney and Shetland (Mr Carmichael) for securing this urgent question and to the Secretary of State for his response. However, I am afraid I still have several questions.

The Secretary of State, alongside the Fisheries Minister, has asserted time and time again that the UK would take back absolute control of our waters from day one of leaving both the European Union and the 1964 London fisheries convention. However, following announcements made in the last 48 hours, we now know that the rest of the Government has been having very different conversations with the EU27. The announcement made by the Secretary of State for Exiting the European Union and the EU’s chief negotiator Michel Barnier, ahead of formal phase two negotiations, made it clear that the UK would continue to be part of the common fisheries policy for the duration of a 21-month post-Brexit transition period, extending up to 2020.

The announcement that Britain’s share of the total allowable catch will remain unchanged during the transition period contradicts all other previous Government statements in relation to post-Brexit fisheries, and it is understandable that many coastal MPs and fishing communities feel so angry and let down. The Government’s failure to meet their previously stated aims through negotiations is one that now requires greater explanation and examination on the Floor of the House. The Government must be absolutely clear about who is leading the negotiations on fishing and what their position is. Have the Government failed to secure their desired position, as advocated by the Secretary of State and the Fisheries Minister, or was that never the position of our negotiating team and the rest of the Cabinet? If that red line has moved, can the Secretary of State tell the House whether there has been an exchange, and if so, what was secured instead?

Less than a month ago, in a Westminster Hall debate on the UK’s fisheries policy secured by the hon. Member for North Cornwall (Scott Mann), I asked the Fisheries Minister whether he had seen the draft proposals from the European Parliament’s Committee on Fisheries—the PECH Committee—and what the Government’s response was. He informed me that

“at the end of the day, it does not really matter what the European Union asks for, but what we are prepared to grant it.”—[Official Report, 27 February 2018; Vol. 636, c. 314WH.]

With that in mind, can the Secretary of State now be explicit in outlining what the Government are prepared to grant the EU in relation to fisheries? Can he also inform the House what the transition arrangement with the EU will mean for the London convention?

The Secretary of State will have seen the comments from the less-than-satisfied representative fishing organisations and the bold statements—and actions—of his own Back Benchers. Any post-Brexit fisheries policy must be rebalanced to work for our coastal communities and have a sustainable approach at its very core. What we need now from the Government is a move away from the chaotic approach we have seen this week and, instead, honesty and clarity about their negotiating position and exactly what that means for the fishing industry.

I am grateful to the hon. Lady for her questions. The first thing to make clear is that we are leaving the London fisheries convention, and we will be fully out of the convention, as we will be out of the common fisheries policy, by the time the implementation period ends.

However, it is also important to recognise, as the hon. Lady mentioned, that our share of the total allowable catch during the implementation period, including 2019, will not be altered. That is a protection for all those who want to make sure that we have the stability required to prepare for the additional opportunities that will come at the end of the implementation period.

The critical point remains that the dividing line—I hesitate to say it is a red line—between the Government and their supporters and the Government’s critics is that we believe that, when we leave the European Union, we should leave the common fisheries policy. It is not the position of any other political party in this House that we should leave the common fisheries policy and take advantage of the opportunities that accrue. In that regard, the comments of my hon. Friend the Minister for Agriculture, Fisheries and Food about the capacity of the UK to say what it will and will not accept refer clearly and unambiguously to what will occur after the implementation period ends and we are an independent coastal state outside the European Union.

Thank you, Mr Speaker, for granting this urgent question, which is in a very similar vein to the one I submitted. That shows the level of interest in this subject on both sides of the House.

The Secretary of State will understand that there is no way I can sell this deal in the transitional period as anything like a success to fishing communities in Moray, Scotland or the UK. However, will he confirm that, when we leave the common fisheries policy in 2020, we will have full control over fish stocks and vessel access, because fishing communities that feel let down and angered by the Government at the moment need that guarantee?

I entirely understand my hon. Friend’s point. I think people not just in Buckie and Portsoy but across the north-east of Scotland—indeed, across the United Kingdom—will be disappointed that the proposal we sought to ensure would apply for 2019 does not apply for that year. However, it is important to recognise that this is a 12-month additional extension to the maintenance of the EU acquis and that we accept that the greater prize, which my hon. Friend is quite right to remind the House of, is available only if we ensure that we leave the common fisheries policy, take back control and make it absolutely clear to other countries that access and quotas will be in our hands.

It is a big concern with the Conservatives that it is always somebody else’s fault. When the Conservatives took us into the common fisheries policy, Scotland’s fishermen were described as expendable, so they are used to Scottish Tory sell-outs. But, given the matter of days involved here, even Scotland’s fishermen will be surprised at how quickly this one was turned around.

Will the Minister tell me at what point our fishermen became a bargaining chip, or has that been the case all along? Does he agree that we are now in the worst of all worlds, because we are in the common fisheries policy but we have no say? Will he tell me why, over the years, when the SNP has proposed changes to bring greater control over fishing policies, those have been rejected? Does he agree that that is because fishing is a big industry in Scotland and important to the Scottish Government, but it means nothing at Westminster?

Psychologists have a phenomenon called projection. It means that when someone describes someone else, they are really talking about themselves. It is very interesting that the Scottish National party spokesman should talk about people always blaming somebody else and things always being somebody else’s fault. As members of a party that has raised grievance to an art form, SNP Members have a damn cheek making that case. They have a particular cheek in this case, because it is the stated policy of the Scottish National party to stay in the European Union, to stay in the single market, to stay in the customs union and to stay in the common fisheries policy. The ones who are committed to giving Scottish fishermen, and indeed all fishermen across the United Kingdom, a brighter future by leaving the CFP are the Conservative party and this Government. I think that the 90 seconds of concentrated—I do not know what the word is, but it is probably unparliamentary, Mr Speaker—cant that we have just heard from the hon. Gentleman will be met with the derision it deserves.

I completely understand my right hon. Friend’s feelings on this matter. I just want to reassure him that our negotiating team negotiated hard, in good faith and armed with the support of our fisheries industry to try to get the best possible deal. We did not get everything we wanted, but it is the view of this Government and, I think, the majority of people in this House that we need to make sure that this implementation period succeeds so that we can grab the greater prize that Brexit provides at the end of it.

I congratulate the right hon. Member for Orkney and Shetland (Mr Carmichael) on securing this urgent question, on the same subject I also submitted one this morning.

The truth is that the Tories are treating this industry as expendable. The Secretary of State talked about revival, but the industry cannot revive based on the status quo that the Government have delivered on the CFP. Does he understand why my constituents will see this as a total sell-out, with us not even having a say at the negotiating table for the next two years?

It is certainly not the case that anyone on the Government side of the House regards fishing communities or the fishing industry as expendable. That is why we are investing more in the Centre for Environment, Fisheries and Aquaculture Science—our top-level marine scientific advisory body. It is why we are investing more in the Marine Management Organisation, which will be responsible for making sure that our fisheries industry is effective. It is why we are investing more in fisheries protection vessels to ensure that the sea of opportunity that comes outside the CFP can be properly taken advantage of.

The idea that we do not care about fisheries and that we are not investing in their future is, I am afraid, simply not true. The hon. Lady may express disappointment, and I express disappointment that we did not secure everything we wanted in these negotiations, but it is vital that we all focus on the bigger prize ahead of us. I completely understand why some people in the House —I exempt the hon. Lady—want to make partisan points, but, honestly, the future of our fishing industry is bigger than that.

The big prize that we have secured is an implementation period that allows us as a country to prepare for all the benefits that Brexit will bring. I campaigned with my hon. As the Secretary of State well knows, meetings of the Fisheries Council tend to go on into the early hours, when they reach decisions on quota and catch. Will he clarify whether, under the terms of the transitional agreement, Britain will have the possibility of being in the room when those decisions are made, or does article 125 of the draft agreement mean that we will only be able to provide comments? If we can only provide comments, what impact does he expect those comments to have when final decisions are taken in the meeting itself?

It is clear that we will be consulted, and not just in a perfunctory way. The scientific advice and evidence that our top-level marine scientists generate will shape and frame the negotiations. I should say that it is only for one year—in December 2019—that we will be in that position. The principle of the European Union operating in good faith towards the UK is one that I take seriously, because if the European Union were to act in a way in that one year that demonstrated bad faith, then, apart from the mechanisms that police the withdrawal agreement and the implementation period, it would also be the case that Britain, having taken back control of its waters, might be in a position to be less generous than the EU would want us to be.

The economies of Cleethorpes and the adjoining town of Great Grimsby have never fully recovered from what local people see as a betrayal in the original negotiations to enter the EU. Since then, successive Governments have not given sufficient attention to coastal communities. Will the Secretary of State assure me that his and other Departments will give greater support to such communities, particularly now that they have to wait that little bit longer before the benefits of leaving the CFP become fully evident?

My hon. Friend is exactly right in two areas. First, we are waiting a little longer before we can properly take advantage of being outside the common fisheries policy. Secondly, there has been an historical neglect not just of the fishing industry, but of coastal communities. This Government have sought to reverse that trend through the coastal communities fund and the investment that I mentioned earlier. It is vital that we recognise that the challenges that coastal communities face—the decline of fishing has been one of them—require intervention from all Departments to ensure that the people whom my hon. Friend represents so well have a brighter future.

I must declare an interest. My daughter, Lisa Roberts, and her partner, Shaun Williams, bought a fishing vessel last year, and they are ambitious and excited at the start of their business venture. However, what the Minister proposes means that they now face a maelstrom of perishable foodstuffs held up at customs, continued pressure on seafood species and no say over quotas for alternative catches. In what way has he not used the fishermen and women of Wales as Brexit bait?

Coming from a family with a fishing heritage, as I mentioned earlier, I know both the risks and the rewards that come from pursuing fishing opportunities. In her admittedly eloquent question, she conflated a variety of issues relating to customs, total allowable catch, quotas and trading opportunities. Let me make it clear that when it comes to the future negotiations, negotiations over trade should be entirely separate from negotiations over fishing access and opportunities.

When will the Secretary of State explain article 157 of the draft agreement that was discussed between the Secretary of State for Exiting the European Union and Michel Barnier? It sets out a new joint committee between the EU and the UK for deciding all matters relating to the transition period, including fisheries and citizens’ rights—absolutely everything—but gives Parliament no power whatsoever to have any say on any of those issues. Having heard about the Secretary of State’s decision today, how can Parliament have a voice during the transition period?

The one thing that I would say is that the draft agreement covers a wide variety of issues, and he alludes to an important one. Like many fishermen across Scotland, I feel badly let down by this deal, because we are not going to be taking control of our waters as quickly as we had hoped. Will my right hon. Its chief executive, Bertie Armstrong, has been an extremely effective advocate on the industry’s behalf, and his response today, balancing the disappointment felt by many with the determination to ensure that we get absolutely the right deal at the end of the process, was constructive. That approach was reflected in my hon. Friend’s question, and it is absolutely the case that we will seek to secure the opportunities that the Scottish Fishermen’s Federation and other bodies want to secure.

I have enormous respect and affection for the right hon. Gentleman—[Interruption.] The fact that he is not right honourable does not diminish the respect or affection that I have for him. My point is that it is the Scottish National party’s policy to remain in the single market and the common fisheries policy. I thank the Secretary of State for his statement, but he will remember his visit to Newlyn, where he heard of significant multimillion-pound plans to invest in the harbour to make it ready for this new dawn of fishing. I hate to prolong the point, but will he categorically confirm that who fishes in UK waters from 2021 will be our decision? Will he confirm that we will regain that control? Will the Government announce a fund to improve and enhance our vessels, our ports and our processing plants to prepare for that day?

I enjoyed my visit to Newlyn, and I am grateful to my hon. Friend for his work on the behalf of his constituents—he is untiring. The first paragraph of article 125 of the draft agreement makes it clear that we will fix fishing opportunities for the duration of the implementation period. Given that the implementation period ends in December 2020, the December 2020 Council and negotiations that fix fishing opportunities for 2021 and beyond are not covered by the agreement, so I can give him the reassurance that I hope he and his constituents seek.

Unlike some of those who have been trying to work themselves into a lather about this decision, the Secretary of State and I canvassed support to leave the common fisheries policy and the EU in its totality. I remember the promises that were made when we visited Aberdeen, and many people will be alarmed and concerned about the draft agreement. He has said that the EU will act in good faith during the transition period and not seek to undermine existing fishing communities. Given its record to date in the negotiations, how can he be sure that legislation, directives and rules will not be put in place further to undermine the fishing industry, leaving nothing to negotiate for at the end of the transition period?

My right hon. Friend has been a consistent campaigner to leave the EU and the CFP. The role that he plays on the Exiting the European Union Committee, as a champion for those who have always argued for that, is exemplary. I strongly sympathise with the concerns that people express about the past record of Governments on the fishing industry. What I would say is that the opportunities that will exist after we leave are considerable, and it is only one year—December 2019—when we will rely on that good faith provision with respect to fisheries. As I mentioned in response to questions from Labour colleagues, if the EU were to choose to act in a way in that year that was against our interests, the consequences that would follow for all would not be happy.

For decades, EU trawlers have plundered our waters and fished in ways that have caused damage to our marine environment. It seems that the Scottish Government are prepared to accept that situation in perpetuity—[Interruption.] Indeed, we have heard comments that they do not trust the EU for a year; I am afraid I have not trusted the EU in its negotiation strategies over the fisheries policy for a very long time. Can the Secretary of State confirm that we will have greater control not only of our fisheries, but of our fishing processes, which have been so damaging to the marine environment and which a lot of us would be very glad to see an end of?

My hon. Friend makes two very important points. Yes, it is not just the case that the fishing industry benefits by being outside the CFP; our marine environment also benefits. She also makes a very important point about the Scottish Government. They want to keep us in the common fisheries policy and deny Scottish fishermen the opportunities of leaving the CFP. The paradox is that Conservative Fisheries Ministers have been very successful in the common fisheries policy in negotiating more sustainable catches. In the Secretary of State’s 25-year environment plan, he talks about all fish stocks being recovered to and maintained at levels that can produce the maximum sustainable yield, which is an exact replica of the EU common fisheries policy. However, in that plan, he neglects to mention the linked application of the precautionary principle to fisheries management. Can he reassure the House that in the future fisheries Bill, there will be no return to the bad old days of days at sea or fishing effort?

A number of very important points were raised in that question. First, yes, previous Fisheries Ministers in this Government—in particular, my right hon. Friend the Member for Newbury (Richard Benyon)—have done an outstanding job on improving the common fisheries policy and in making a bad situation better. Secondly, the hon. Lady is absolutely right that in the 25-year environment plan, there is an absolute commitment to ensuring that we follow the science, so that we have the best approach towards making sure that fish stocks are healthy and sustainable in future.

On the broader point about the precautionary principle, it is clear that during the time that we have been in the European Union, although a number of things have worked against the environmental interests of this country and our marine environment, the precautionary principle properly applied can be a very powerful tool to ensure that our environment is protected and enhanced. We will be saying more in due course about the environmental principles that have evolved during our time in the EU and the means by which we will hold the Government to account to keep in line with those principles.

Today is St Cuthbert’s day, so it is right to celebrate the wonderful seafood of Northumberland, from Craster kippers to Lindisfarne oysters, which are enjoyed by my constituents and exported all over the world. However, should the coastal communities that depend on them ever have believed that a Tory party funded by the City would prioritise a deal on fishing as highly as a deal on finance?

It is St Cuthbert’s day, and I believe that on this day, St Cuthbert was given a gift of fish to sustain him, so it is a day that is resonant for a number of reasons. One thing I would say is that it is a Conservative Government who have been investing in the Centre for Environment, Fisheries and Aquaculture Science, the Marine Management Organisation and all the steps required to ensure that we can take advantage of the opportunities that arise when we leave the CFP. It is also a Conservative Government who have been investing in fisheries protection vessels to ensure that the hon. I share the disappointment of north-east fishermen that the transition deal falls short of what they had hoped for. Can the Secretary of State guarantee that on 1 January 2021, we will leave the common fisheries policy, take back control of our waters and set our own fisheries management policies and our quotas? Will he look at including that in the fisheries Bill, and does he share the concern that I and the Scottish Fishermen’s Federation have that the Scottish National party Scottish Government would keep us in the common fisheries policy in perpetuity and that that would sell Scotland’s fishermen out in perpetuity?

The hon. Lady asks a very direct question. That absolutely was the case. We had an immensely hard-working team of officials who negotiated incredibly hard on our behalf. They were in constant touch with Ministers every step of the way, and they encountered intransigence on the part of the EU, which was disappointing—I make no bones about it—but one thing that cannot be faulted is the hard work, mastery of detail and determination of the civil servants in DExEU and DEFRA to get the very best deal for Britain, and I will not hear a word said against them.

I am the daughter of a man who was a member of the Grimsby deep-sea fishing fleet in the late 1950s, so I know that it is one of the hardest jobs in the world. That does not stop me understanding, however, that the processing side of the industry is incredibly important to coastal communities such as Grimsby and Peterhead. On that basis, will the Secretary of State guarantee that the processing side of the fishing industry will not be sacrificed to other priorities in trade deal negotiations?

The discards ban is necessary to ensure responsible management of all species, but we are working on how to apply it in a way that ensures that the legitimate concerns the hon. Gentleman raises on behalf of his constituents are properly addressed.

The Secretary of State will not be surprised to learn that fishermen in mid-Cornwall feel very disappointed, and in some cases angry, at yesterday’s announcement. When he visits Devon, will he come that little bit further and meet the fishermen of Cornwall as well, and in doing so will he lay out very clearly that the implementation period will affect only one year’s quota negotiations, that their quotas will be protected during that time and that at the end of the transition period we will take back control of our fishing waters?

In defence of this negotiating debacle, the Secretary of State says the Government always knew there would be important legal and technical questions to be resolved. If so, why less than 10 days ago did he and Ruth Davidson promise fishermen across the UK that we would be leaving the CFP in March 2019?

It is the case that important questions need to be resolved, but the one thing the SNP is promising is that we will never leave the CFP. It is instructive that in so many of their questions SNP Members talk about Ruth Davidson but never about a single fisherman, species or community; they only attack the leader of the Scottish Conservatives. Why? They’re feart.

In my constituency on Friday, the talk of the day was: let us never negotiate out of fear, but let us never fear to negotiate. In ’74, when we joined the Common Market, Edward Heath sold the fishing sector for a bowl of pottage. In 2018, can the Secretary of State give an absolute guarantee that the fishing sector in Portavogie, in my constituency, and also at Ardglass and Kilkeel, has not been and will not be sold out by a transitional arrangement that leaves the EU in control of fishing policy?

My right hon. Friend is absolutely right to highlight the prize of agreeing an implementation period. How will the UK’s voice be heard and respected in the annual quota allocation for 2020?

I hope that my hon. Friend will be reassured to know that in 2020 the UK will be negotiating as an independent coastal state. [Interruption.] The negotiations in 2019 will take place on the basis that we will be consulted and that our science will be part of the process by which arrangements are reached, and of course the good faith provisions and other arrangements and guarantees I discussed earlier will be there to safeguard UK interests for that limited 12-month period.

The quotas for 2020 will now be set by the EU after some consultation with the British Government. Now that the ball has been handed back to the EU, what guarantees can the Secretary of State give to the industry that he will get the ball back?

My hon. Friend reasserts the vital point that were the EU for any reason in 2019 to behave contrary to our long-term interests, it would also be contrary to its long-term interests. I agree that the opportunities available to us after the transition deal are critical and that we must secure them. That has meant accepting a sub-optimal outcome in the deal, but it is only for an additional 12 months, and we must keep our eyes on the prize.

Far from providing “a sea of opportunity”—to use the Secretary of State’s own words—all this deal does is underline, as the Heath, Thatcher and Major Governments did before, that the Tories are happy to throw Scotland’s fishing industry over the side. Is it not time that he and his Scottish Tory sprats were also discarded?

Again, I note that questions from the Scottish nationalist Benches have contained more mentions of the Scottish Tory leader and bad puns than adherence to either science or economics. The SNP will have to do better than name calling and joke making if it is ever to be taken seriously as a defender of the interests of Scottish fishermen.

All fishing communities up and down the nation will have hanging their heads in shame at this disgraceful discussion so far. The list of Tory sell-outs is endless: in the 1970s, Ted Heath said that fishermen were expendable; in the ’80s, Margaret Thatcher signed up to the original doomed common fisheries policy and consigned our fishermen to decades of mismanagement; while John Major signed up to a revised CFP that had scrapping vessels and destroying livelihoods at its very heart. Given this continual betrayal, can the Secretary of State honestly say that things will be any different post-Brexit?

Absolutely. I have enormous respect and affection for the hon. Gentleman, who I think is a great campaigner, but I must respectfully point out that, although I do not doubt his passion and commitment, the platform on which his party stands would keep us imprisoned in the CFP, as opposed to opening us up to the opportunities that exist outside, which we and our friends in the Democratic Unionist party support.

I make it five Conservative Scottish MPs who have asked for the same promise from the Secretary of State, but he has been so obsessed with his #SNP line that he has not given that guarantee. Is this not the Secretary of State who promised that Scotland could have devolved power over immigration if we left the EU, and was that promise not worthless? Is this not the same Secretary of State who promised, barely a week ago, that we would definitely leave the CFP in March 2019, and was that promise not worthless? Is it not the case that any promise he makes in the future to the people of Scotland will be just as worthless as his promises in the past?

It was the promise the SNP made to keep us in the CFP and the EU that was comprehensively rejected at the ballot box by the votes of people in north-east Scotland and in fishing communities. I am afraid that Scotland faces a simple choice: does it remain within the EU and CFP under the SNP, or will it be liberated, as will be the case if this Government have their way? On that choice so much hangs, including the future of the SNP.

Again, it just goes to show that at any negotiating table we want someone who will stand up for the issues that matter. Be it Brexit or the CFP, Scotland and Scotland’s fishing community are expendable once again in the eyes of the UK Government. At what stage did the Secretary of State know that fisheries would be a bargaining chip, and what did the Government secure in return?

Both sides—both the UK and the EU—made it clear that fisheries would have to be handled separately from many of the other issues that would be addressed during the implementation period, and it was always clear that we would have to have specific arrangements. One of the things that are different about fisheries is that even before the implementation period ends, we will be operating independently outside the constraints of the European Union. It is also the case that, having secured the capacity to operate independently in December 2020, we will be in a position to secure the larger prize of life outside the common fisheries policy, a prize that the SNP rejects.

We know that Heath was the one who said that Scottish fishermen were expendable, and Thatcher was the one who took us into the CFP. We talk about fish quotas. Just this morning, on Radio Scotland, Niels Wichmann, the head of the Danish Fishermen’s Association, said:

“Britain has never ever challenged the quota shares that we have used every year in the annual negotiations”.

It does not matter whether we are in the CFP or not; the UK Government cannot be trusted. Does the Secretary of State agree with that?

I have suggested several times over the years, including in the Chamber, that only when all the fishing waters of Europe have been returned to their own countries will the fish stocks and fishing industries of Europe be saved, and that the UK must lead the way in that process. Will the Government now publicly urge the complete abolition of the common fisheries policy, which has been such an unmitigated disaster?

My admiration for the hon. Gentleman knows almost no bounds. He is right: the common fisheries policy has been bad not just for Britain, but for fish throughout the European Union. My only hope is that he will not only have an opportunity to see our shared ambition for a Britain outside the European Union fulfilled, but will be able to persuade socialist and progressive colleagues across the European continent to reform their own governance in a way that is genuinely liberating, as he has long advocated.

As I look across at the faces of the Scottish Tories who are once again witnessing the United Kingdom Government betraying Scottish fishing communities, never has the phrase “done up like a kipper” seemed more appropriate. Can the Secretary of State explain to the bewildered fishing communities in my constituency why he has signed them up to what he described nine months ago as the “disastrous” common fisheries policy for a further two years, on worse terms than they are currently experiencing?

Listening to yet another Scottish National party spokesman denying the reality of the SNP’s adherence to the common fisheries policy and attempting to cover it up with a weak pun, I felt that I was witnessing yet another audition for someone to appear on Alex Salmond’s rt.com talk show. It is the combination of bad taste and poor humour that has been exhibited by so many on those Benches.

I am publishing today the first consultation on a wholly domestic agriculture policy in nearly half a century. “Health and Harmony: The future for food, farming and the environment in a Green Brexit” sets out our ambitions for farming in England and seeks the views of all readers on its proposals.

Leaving the European Union marks an unprecedented opportunity for fundamental reform of agriculture in the United Kingdom. The farmed environment is a source of food that nourishes the body and a landscape that nourishes the soul. We want an agricultural policy that values not only the great British food farmers produce but also the unique public goods that farming, horticulture and forestry provide.

We believe these proposals could work for the whole of the UK, but we recognise that devolution provides each administration with the powers to decide its own priorities. We will continue to work closely with the devolved administrations to establish common frameworks, where these are necessary, in order to enable the functioning of the UK internal market or so that the UK can negotiate, enter into and implement new trade agreements. Overall, it is the Government’s expectation that the process will lead to an increase in decision-making powers for each of the devolved administrations.

UK farmers and land managers have operated within the constraints of the Common Agricultural Policy (CAP) for decades. While the CAP has pioneered some of the world’s first agri-environment schemes, which have helped to protect our wildlife and habitats, it remains flawed. Paying land owners for the amount of agricultural land they have creates an unjust, inefficient system that can drive perverse outcomes. The bureaucratic structure of the CAP has constrained our ability to deliver genuine improvements to our countryside and natural environment.

We now have an opportunity to transform agricultural policy. Our proposals are underpinned by the ambitions we have set out in the Government’s 25-year environment plan, so that we leave the environment in a better state than we found it for future generations. We want to incentivise methods of farming that improve soil health, create new habitats for wildlife, increase biodiversity, reduce flood risk and better mitigate climate change and improve air quality by reducing agricultural emissions.

Good environmental land management has benefits beyond improving the natural landscape. Human life can be enriched by a deeper connection to our countryside, be it through the air we breathe or access to public footpaths. Farmed animals are also an integral part of our countryside. We have a responsibility to maintain their health and welfare throughout their life and we want to safeguard the welfare of our livestock, building on our existing reputation for world leading standards.

We are proud to have some of the most productive and innovative farmers in the world. Leaving the EU presents a huge opportunity for UK agriculture to increase its competitiveness. This paper proposes various methods by which the industry could achieve this, including developing the next generation of food and farming technology, adopting the latest agronomic techniques, reducing the impact of pests and diseases, investing in skills and equipment, and collaborating with other farmers and processors. We will ensure that in future public money is paid for public goods—principally environmental enhancement, but these could also include improving productivity, providing public access to farmland and the countryside, enhanced welfare standards for livestock and measures to support the resilience of rural and upland communities.

In England, direct payments will continue during an “agricultural transition”. So that we can support farmers to prepare for change, we will need to redistribute some existing funds. To do this, we propose to apply reductions to farmers’ direct payments, starting with the largest landowners, to free up money to pilot environmental land management schemes and to help farmers unlock their full potential for sustainable production.

We recognise that some sectors may find it more difficult than others to adapt—for example, those located in the most remote, wild and beautiful parts of England. The upland way of life, the unique food produced, and the great art and literature that these landscapes have inspired attract visitors from around the world. In this paper, we ask how these rural communities can be supported for new generations and what the right support should be during the transition and into the future.

For the first time in more than 40 years, the UK will also have its own trade policy. We want to maximise our trade opportunities globally and across all countries—both by boosting our trading relationships with old friends and new allies, and by seeking a deep and special partnership with the EU. We are proud to have some of the highest animal welfare standards in the world. Maintaining and enhancing our high standards of food safety, animal welfare and environmental protection will remain paramount.

We will introduce an Agriculture Bill that moves away from the CAP, providing us with the ability to set out a domestic policy that will stand the test of time.

This consultation marks the exposition of a new settlement for agriculture. As we leave the European Union, this is an historic chance to do something economically sound, socially just, and environmentally essential.

Five years into the current bTB strategy, drafted in 2013 and published a year later, the time is right to review progress on the various elements of the strategy. I envisage further reviews will take place at five-yearly intervals in the future.

The purpose of the review is to consider progress made to date and what further actions might need to be prioritised now in order to ensure we maintain progress towards our target of becoming officially TB free after 25 years.

Bovine TB is a slow-moving insidious disease which presents major challenges. It can be difficult to detect; it can be harboured in the wildlife population; no vaccine is fully effective and none of our diagnostic tests are perfect. The review will be forward looking. Its aim is to identify what actions we could take now to ensure that other elements of the strategy, such as cattle vaccination or improved genetic resistance, are ready to deploy at later phases of the strategy.

We now have over 20 cull zones that are operational and we envisage additional ones for 2018. Although it is too early to make definitive conclusions, early analysis suggests that the first two cull zones are seeing the anticipated impact in terms of reduced incidence of the disease. However, we do need to consider what further steps or actions should follow the conclusion of each four-year cull. After all, none of us wants to be culling badgers forever. The review will therefore also consider such issues.

The review will be led and overseen by an external chair and I am delighted that Professor Sir Charles Godfray has agreed to take on this role. Professor Godfray is a population biologist with interests including ecology and epidemiology, currently based at the University of Oxford where he is director of the Oxford Martin School. He is also a fellow of the Royal Society. He chaired the independent scientific review of the randomised badger control trial, and is chair of DEFRA’s Science Advisory Council.

The chair will be supported by a small working group, membership of which will be confirmed in due course. The chief veterinary officer and the director of animal and plant health will provide oversight within the Department.

The review is expected to commence in March and to be completed by the end of September 2018. The findings will be submitted to DEFRA Ministers for consideration with a final report published in due course.

As well as this work, DEFRA has launched a consultation on the principle of allowing badger control in the low-risk area to enable rapid action to tackle outbreaks at the local level where there is evidence of infection in badgers linked with infection in cattle, and to help preserve the area’s low disease incidence. Any decision on whether or not to implement badger control in the low-risk area will be taken by the Secretary of State following the consultation, once all the responses have been considered alongside relevant scientific evidence and veterinary advice.

The terms of reference for the review and the consultation have been published on the gov.uk website and placed in the Libraries of both Houses.

On 11 January, the Government published our 25-year environment plan, which states our ambition to eliminate all avoidable plastic waste. We have already banned microbeads in personal care products, we are removing single-use plastics from Government estate offices, we are exploring a reward and return scheme, and we welcome the introduction by retailers of plastic-free aisles. We are also investigating how we can develop our producer responsibility scheme to give producers more incentives to design more resource-efficient products.

I thank the Secretary of State for his answer. Hayling Island beach has been recognised for its clean coastline by being awarded a blue flag for the past 26 years, partly because it is plastic-free. Will the Secretary of State congratulate Havant Borough Council and local residents, and continue to support coastal communities to keep coastlines plastic-free?

When I had the opportunity to visit his constituency and its coastline last year, I saw his commitment to our marine environment. It is vital that colleagues such as my hon. My hon. Friend makes an important point. She has made determined efforts in not just this Parliament but the European Parliament to make recycling easier for all. We are exploring how we can better co-ordinate efforts at a local level to ensure that more material is recycled and, indeed, that more recyclable material is used.

On a visit to Bywaters recycling centre in Bow yesterday, I saw the amazing work that the waste industry is doing to tackle our waste and heard about some of the challenges it faces. I was told that the Chinese ban on imports of UK waste has caused the price of recycled paper to fall from £100 a tonne to £20 a tonne, and I presume that the same can be said for plastic. That will have an impact on the viability of councils’ recycling contracts and will feed through to council tax bills. Does the Secretary of State agree that we can tackle the problem by setting long-term targets for the waste industry, such as the 65% target by 2035 that has been suggested by the EU?

Setting appropriate targets is absolutely part of this. One of the challenges of the EU’s target is that, because weight is such an important component in how the EU measures recycling, it does not always incentivise quite the right behaviour. Even though the EU has made important strides, I am glad that our own Government have gone further by ensuring that we tackle the scourge of single-use plastics.

The UK is in a unique position to tackle plastic waste in the world’s oceans due to the number of our overseas territories. Will the Secretary of State be speaking to those overseas territories to develop a comprehensive strategy in this area?

Well—[Interruption.] It was a very good question. The hon. Gentleman always asks very good questions, whether in this House or elsewhere, and he also writes very good books. He makes an important point, and the Under-Secretary of State for Environment, Food and Rural Affairs, my hon. Friend the Member for Suffolk Coastal (Dr Coffey), will be meeting representatives of the overseas territories next month. He is right that there is more work to do on the network of marine protected areas around many of our overseas territories, and he is right to encourage us.

12. Primary school pupils at Oxley Park Academy in my constituency have launched a campaign to replace plastic straws with environmentally friendly alternatives. Will the Secretary of State commend their initiative and, if I send him the details, will he take on board their suggestions?

I absolutely commend the pupils’ initiative. The next generation often puts some of us to shame in its commitment to ensure that we have a more sustainable approach towards the environment. There is another youngster who has been leading the charge against plastic straws: the relatively newly installed editor of London’s Evening Standard, whose “The Last Straw” campaign has been instrumental in ensuring that commercial organisations ban plastic straws. He is a relatively new entrant to my profession of journalism and I commend him on his promising start.

I commend the Secretary of State for the publication of the environmental strategy, which is an important and significant step, but there are still opportunities to do more. Will he tell the House why he allowed 25 years in the strategy for the elimination of non-essential plastics? If they are non-essential, surely we can do better than that.

I have enormous respect for the right hon. Gentleman. The nature of the 25-year plan was a recommendation of the Natural Capital Committee and, as he knows, it covers a wide range of issues. The Government are bringing forward more demanding and more ambitious targets to reduce single-use plastics, but he is right to encourage the Government, and all of us, to do more.

I wish you, Mr Speaker, and the Minister a happy Burns day. In Scotland, there is discussion about a plastic bottle return scheme. What discussions has my right hon. Friend had with his counterparts in the Scottish Government to ensure that a system can effectively work while preventing English bottles from being paid for by the Scottish Government, and vice versa?

I thank my hon. Friend for her question. On the subject of Burns day, I recently had discussions with the Under Secretary of Agriculture for Trade and Foreign Agricultural Affairs at the US Department of Agriculture to see whether he could lift the ban on haggis. Although the American President has many faults, he has one virtue: he has a Scots mum. On that basis, I hope he may listen sympathetically.

On the equally important issue of the deposit return scheme, we will be working with devolved Administrations to ensure that we have a UK-wide approach wherever possible.

Mr Speaker, I am sure that you would agree that plastic pollution is one of today’s great environmental challenges. The Secretary of State has mentioned the importance of recycling a number of times, so I am concerned by reports that the Government have been opposing the new EU targets. Will the Secretary of State explain why the Government are opposing the new recycling targets?

We are anxious to make sure that, across the EU, we have the right targets. One of the flaws with the EU system, as I acknowledged earlier, is that because of its reliance on measuring through weight, it sometimes incentivises the wrong approaches. I am confident that our own country has gone further than the European Union has requested or suggested on everything from banning microplastics to looking at taxes on single-use plastics and, indeed, introducing the charge on plastic bags. In all those areas we have shown that we have gone further and faster than the EU, and of course that is the Government’s ambition for a truly green Brexit.

More than 200 Members signed my letter on what the supermarkets could do to improve their recycling so that they meet the targets that my hon. Friend the Member for Workington (Sue Hayman) mentioned. Which supermarkets has the Secretary of State personally spoken to in order to bring them in line with Iceland, which is apparently the leader in this area?

That letter was excellent, if I may say so. I have talked to not only Iceland, but Marks and Spencer, Waitrose, Tesco and Sainsbury’s. We had a roundtable before Christmas at which those retailers and others made a shared commitment to ensure that we reduce the demand for plastic, that fewer plastics are used, and that those plastics that we have more of are recycled or recyclable. A commitment was also made to work with local government to make it easier for all to recycle.

When I was doing my family shopping at Asda in Wrexham last weekend, I noticed the appalling amount of plastic packaging on meat products, which seems to be in place for the ease of the supermarkets rather than that of their customers. Will the Secretary of State please raise the issue of packaging with the supermarkets?

I absolutely will, but while I have no wish to undermine Asda, which is an admirable retailer, I find that when buying meat, the best thing to do is to go to one’s local butcher, buy locally and invest in the local economy.

My hon. Friend makes an excellent point. Water UK’s initiative is wholly welcome. The idea of a nationwide network of refill stations is absolutely right. The decline of public water fountains marked a deeply regrettable trend, so I am glad that they are making a comeback.

Some 480 billion plastic bottles were sold globally in 2016. If we want to address one of the key issues, it has to be plastic bottles. What discussions has the Secretary of State had with the companies to reduce the number of bottles or to have them reused—whatever the case may be?

We have discussed with industry bodies representing a variety of manufacturers and with retailers everything that we can do to reduce such use. The hon. Gentleman is absolutely right. The world’s conscience has been awoken to the scourge of plastic in our oceans by the crusading work of documentary makers such as David Attenborough, and also by an increasing awareness of how important it is that we tread more lightly on our planet. The leadership that the hon. Gentleman has been showing in Northern Ireland is exemplary.

We are taking a series of measures to reduce the amount of plastic entering the sea. Our plastic bag charge has led to 9 billion fewer single use bags being used in England. Our microbead ban, which comes into force this month, is one of the toughest in the world, but of course we need to work internationally through forums such as the UN, the G7 and the G20.

As the Secretary of State is aware, on 6 February I will be hosting an event in Parliament, together with Sky TV, as part of its ocean rescue campaign, inviting Members of Parliament to pledge to reduce the amount of plastic that they use in this place. Does he agree that it is important that Members take a lead and set an example on this issue, and will he join me in encouraging them to come to that event and to commit to cut the amount of plastic used here?

It is an excellent campaign that Sky has been running, and it is lucky to have my hon. Friend playing such a prominent role, as he has been an outstanding environmental campaigner on this issue for many years. Yes, there is a commitment that we can all make. I also know that the Under-Secretary of State, my hon. Friend the Member for Suffolk Coastal (Dr Coffey), has written to my hon. Friend the Member for Mole Valley (Sir Paul Beresford), the Chair of the Administration Committee, to see what the House can do to ensure that we reduce the amount of single use plastic on the parliamentary estate.

The Welsh Labour Government are the third best in the world for recycling, far exceeding their targets this year alone. I am sure that the Secretary of State will join me in congratulating them on that. Can he clarify his position on recycling? He talks a good talk but does little to demonstrate action and is in danger of missing vital EU targets.

I am happy to praise the Welsh Labour Government on this occasion—there are all sorts of things that Labour in Wales gets wrong, but on recycling I think it is only fair that we say well done. More broadly, it is really important that we all do more, and I want to thank you, Mr Speaker, for the commitment that you have shown with regard to the parliamentary estate. Of course we can do more; I can do more. The critical point is that when people are doing the right thing, as they are in Wales, we should applaud them.

The House will have heard the very sad news earlier this month that the Nancy Glen, a fishing vessel, was lost off the west coast of Scotland while fishing in Loch Fyne. Two fishermen lost their lives. The Clyde Fishermen’s Association is running an appeal to raise money to recover their bodies and support their families. We all know the inherent risk in fishing. The DEFRA Ministers, on behalf of the whole House, would like to thank all those who risk their lives every day to ensure that we can eat fresh fish. Our hearts go out to the families so sadly affected by this tragedy.

I thank my right hon. Friend for what he has said. Can he assure constituents right across the United Kingdom that the new UK-wide frameworks that will be brought in as a result of our leaving the European Union will work for all farmers, whether arable, livestock, dairy or hill, and wherever they live in the UK, whether in England, Scotland, Wales or Northern Ireland?

I am delighted that Doddington has been granted permission for 600,000 trees to be planted as part of our future environment plan. This is the largest planting scheme in England for a generation. Doddington is a great example of modern mixed forestry, but we need to ensure that this is not the end but the beginning. It is vital that the Forestry Commission supports those who want to plant more trees for reasons such as supporting sustainable river basins. I hope that the Secretary of State will undertake to make sure that this happens. I would be delighted if he would come and visit.

I am very grateful to my hon. Friend. Yes, the Doddington North Moor development will be hugely welcome, not just in ensuring that we have more woodland cover but in providing a valuable habitat for the red squirrel—a native species that I think we all want to see better protected. We will be working with landowners, the Forestry Commission and others to ensure that there is more forest cover in the years ahead.

Access to banking and other services is vital for the future of rural communities. I commend the Press and Journal newspaper for the campaign that it has been running, which has been enthusiastically backed by my hon. Friends the Members for West Aberdeenshire and Kincardine (Andrew Bowie), for Banff and Buchan (David Duguid) and for Aberdeen South (Ross Thomson). All those fine Scottish Conservative colleagues have been leading this campaign. The Scottish Government have a responsibility to do more with regard to safeguarding the interests of Scottish farmers, and it has fallen to Scottish Conservative colleagues to be in the lead in the campaign. I understand the Secretary of State’s concerns about what happens to plastic waste once it has been used, but does he agree that its use by retailers in particular gives consumers the widest possible choice and prevents food waste? It is important that any measures that we introduce do not reduce consumer choice and do not cause more of our food to be wasted.

My hon. Friend makes a very important point. Although we need to reduce demand for plastic and increase recycling, plastic does have a role to play in the preservation of fresh produce and in helping us to tackle food waste, which is in itself an environmental and economic mistake.

T6. Across Dulwich and West Norwood this winter we have once again seen a huge number of Thames Water leaks, many of them at sites where there have previously been repeated leaks. Last year, Thames Water reported operating profits of £650 million. It has a corporate structure involving offshore companies. The chair of Ofwat has highlighted the“urgent need for…a step change in the way”Thames “operates and behaves.” Will the Secretary of State tell my constituents when they can expect to see a winter without the disruption caused by an organisation that is clearly not fit for purpose?

As the Secretary of State said, it is vital that we educate our young people about the dangers of plastics in the seas in particular. Will he join me in congratulating Alfie from New Waltham Academy in my constituency, who has done so much to promote this issue? When he visits the area in the not too distant future to meet the fishing and seafood community, as I know he intends to, will he perhaps visit the academy?

In reference to air pollution, not a single area of London meets the World Health Organisation standards for the damaging type of particle known as PM2.5, and 95% of the capital exceeds the guidelines by at least 50%. The clean air action to which the Minister referred needs resourcing. When will the Government, instead of passing the buck to local and regional authorities, put some money on these fine words?

When we think of admiration and respect, it is the admiration and respect due to my right hon. Friend. He has been an outstanding Minister and a fantastic constituency Member for the Derbyshire Dales, which is one of the most beautiful parts of England. He is absolutely right that, building on the speech I gave to the Oxford farming conference, more needs to be said and done to outline the framework for farming in the future. I hope to do so at the National Farmers Union conference, when I can celebrate our farmers, who are the best in the world.

My right hon. Friend the Member for Loughborough (Nicky Morgan) makes an admirable point. I hope to visit her constituency and others to see the wonderful work that has been done. A comment was made from a sedentary position by the hon. Member for Bishop Auckland (Helen Goodman), and I am very happy to acknowledge that leadership has been shown by Labour politicians as well. [Interruption.] Forgive me, it was the hon. Member for Wakefield (Mary Creagh). Labour speaks with one voice on this matter—though not on any others. Coalfield communities have been helped on their journey towards revival by the investment in woodland cover, and my right hon. Friend the Member for Loughborough has been a hugely effective champion of that.

It is this Government’s ambition to leave our environment in a better state than we found it. We have made significant progress but there is much more to be done. The 25-year environment plan that we have published today outlines the steps we propose to take to achieve our ambition.

Environment is—at its roots—another word for nature, for the planet that sustains us, the life on earth that inspires wonder and reverence, the places dear to us we wish to protect and preserve. We value those landscapes and coastlines as goods in themselves, places of beauty which nurture and support all forms of wildlife.

Respecting nature’s intrinsic value, and the value of all life, is critical to our mission. For this reason we safeguard cherished landscapes from economic exploitation, protect the welfare of sentient animals and strive to preserve endangered woodland and plant life, not to mention the greening of our urban environments.

But we also draw from the planet all the raw materials we need to live—food, water, air and energy for growth. So protecting and enhancing the environment, as this plan lays out, is about more than respecting nature. It is critical if the next generation is to flourish, with abundant natural resources to draw on, that we look after our and their inheritance wisely. We need to replenish depleted soil, plant trees, support wetlands and peatlands, rid seas and rivers of rubbish, reduce greenhouse gas emissions, cleanse the air of pollutants, develop cleaner, sustainable energy and protect threatened species and habitats.

Previous Governments, here and in other nations, have made welcome strides and driven environmental improvement. Yet as this 25-year plan makes clear, there is much more still to do. We must tread more lightly on our planet, using resources more wisely and radically reducing the waste we generate. Waste is choking our oceans and despoiling our landscapes as well as contributing to greenhouse gas emissions and scarring habitats. The success of the 5p plastic bag charge in reducing the use of carrier bags by 85% shows the difference which Government action can make, and demonstrates that protecting our environment is a job for each one of us. The plan outlines ways to reduce the use of plastics that contribute to pollution, and broader steps to encourage recycling and the more thoughtful use of resources. Over the lifetime of this plan, we want to eliminate all avoidable plastic waste.

The Government’s clean growth strategy—the sister document to this environment plan—sets out how we will deliver the clean, green growth needed to combat global warming. We will do what is necessary to adapt to the effects of a changing climate, improving the resilience of our infrastructure, housing and natural environment.

Population growth and economic development will mean more demand for housing and this Government are committed to building many more homes. However, we will ensure that we support development and the environment by embedding the principle that new development should result in net environmental gain—with neglected or degraded land returned to health and habitats for wildlife restored or created.

Most of our land is used, however, for agriculture not housing. The new system of support that we will bring in for farmers—true friends of the earth, who recognise that a care for land is crucial to future rural prosperity—will have environmental enhancement at its heart.

We will support farmers to turn over fields to meadows rich in herbs and wildflowers, plant more trees, restore habitats for endangered species, recover soil fertility and attract wildlife back. We will ensure broader landscapes are transformed by connecting habitats into larger corridors for wildlife, as recommended by Sir John Lawton in his official review. Our plan for a new northern forest, to which we are contributing more than £5 million, will be accompanied by a new review of national parks and areas of outstanding natural beauty. Planting more trees provides not just new habitats for wildlife—it also helps reduce carbon dioxide levels and can reduce flood risk. We will work with nature to protect communities from flooding, slowing rivers and creating and sustaining more wetlands to reduce flood risk and offer valuable habitats.

Beyond our coastlines, we must do more to protect the seas around us and marine wildlife. Leaving the EU means taking back control of the waters around these islands. We will develop a fishing policy that ensures seas return to health and fish stocks are replenished. We will also extend the marine protected areas around our coasts so that these stretches of environmentally precious maritime heritage have the best possible protection.

Internationally, we will lead the fight against climate change, invest to prevent wildlife crime, pursue a ban on sales of ivory, and strengthen partnerships to tackle illegal wildlife trade beyond borders, including investigating the feasibility of an anti-poaching taskforce.

We will underpin all this action with a comprehensive set of environmental principles. To ensure strong governance, we will consult on plans to set up a world-leading environmental watchdog, an independent, statutory body, to hold Government to account for upholding environmental standards. We will regularly update this plan to reflect the changing nature of the environment.

While this 25-year environment plan relates only to areas for which Her Majesty’s Government are responsible, we will continue to work with the devolved Administrations on our shared goal of protecting our natural heritage.

These actions will, we hope, ensure that this country is recognised as the leading global champion of a greener, healthier, more sustainable future for the next generation.
