I thank the hon. Member for Edinburgh West (Christine Jardine) for securing this debate on an important subject. I know that she has had personal experience of the issue, which is very close to her heart. I thank her very much for sharing that with us. I also thank the hon. Member for Strangford (Jim Shannon), who spoke movingly and eloquently about his own experiences with bereaved children. I know that many of us here will have experienced that and we share that profound sympathy for anyone going through bereavement.
The Government take the issue of supporting children and young people very seriously. As the hon. Member for Edinburgh West rightly pointed out, different elements of that support fall across Whitehall. I have a particular responsibility for children’s social services, which the hon. Member mentioned in her speech. Responsibility for responding to the needs of bereaved children ranges across the Department of Health and Social Care and the Home Office, and I will touch on that in my response. I should point out that the provision of support for bereaved children in Scotland is primarily a matter for the Scottish Government, and I am grateful to the hon. Member for Glasgow North West (Carol Monaghan) for her contribution. My response will primarily focus on support provided in England, however, and I will reference the figures and policies that apply to England.
Losing a parent is heart-wrenching experience for anyone. I have experienced that as an adult, but it is profoundly disturbing for children to lose a parent. I welcome the work of Winston’s Wish—funnily enough, my father was called Winston—and that of many other people. How families, children and young people respond to the loss of a loved one is very personal to them. As a Government we recognise the deep impact that bereavement can have on a child’s life and the far-reaching consequences it may have on their mental health, which has been touched on, their wellbeing and their academic performance, which might require additional support.
The hon. Member for Edinburgh West is right that there are no official statistics that record the number of bereaved children in the UK. The Childhood Bereavement Network—it too has been mentioned and I welcome its work on the issue—has estimated that 26,900 parents die each year in the UK, leaving approximately 46,300 dependent children aged zero to 17. Those figures are based on sources such as the census and mortality statistics in the absence of other data, so they can provide only a rough estimate.
Not all children will need access to services when they experience bereavement, which is largely testament to the wider family network support that so many children receive. Where additional support is needed, the Government are committed to ensuring that it is provided. It is important that we draw on all arms of Government, including the Department of Health and Social Care, to provide mental health support and services, as well as many other Government Departments working on programmes for families, which includes the Department for Work and Pensions and the Department for Levelling Up, Housing and Communities, to ensure that we provide that joined-up support.
We are always looking at how we can improve support for bereaved children. As a result, the Government are committed to ongoing engagement with the voluntary sector and across Government to assess how we can provide further support for children who have been bereaved. Before coming to the issue of the register, I want to set out some of that support. One of the most important ways we can support bereaved children is through providing support for their family. Early help services play a pivotal role in supporting families, and can be used in some cases to support children through bereavement.
We have taken a number of actions to prioritise such services. “Stable Homes, Built on Love”, published earlier this year, sets out our bold and ambitious plans to reform children’s social care. Family help reforms are central to delivering our vision of a reformed system, will provide effective and meaningful support for families and will feature multi-disciplinary teams, bringing all those different partners together to meet the whole needs of a family. We are providing more than £45 million of additional funding to pathfind family help.
That builds on our wider support for families, including the £695 million supporting families programme, which this year sees its 10th anniversary. It has helped more than 650,000 vulnerable families by supporting the whole family to achieve positive and sustainable outcomes. The Government have also invested more than £300 million to establish family hubs and transform Start for Life services in 75 local authorities. Those family hubs will provide mental health support for parents and young people, with guidance on where to reach more access to mental health and emotional wellbeing support. Further, the statutory guidance, “Working Together to Safeguard Children”, is clear that local areas should have a comprehensive range of effective evidence-based services in place to address needs early.
I want to turn to mental health support, which has been rightly mentioned today. Hon. Members will be aware that that falls under the Department of Health and Social Care, but we are looking at expanding the help that young people can get in schools via the Department for Education. We are expanding specialist mental health support by investing an additional £2.3 billion a year into mental health services by 2023-24, so that 345,000 more children and young people a year will be accessing mental health support by then.
In schools, we are introducing mental health support teams, which will offer support to children experiencing common mental health issues such as anxiety and low mood, and will offer smoother access to external specialist support that we know can be so helpful. They cover 26% of pupils in England, a year earlier than originally planned. That will increase to 399 teams, covering about 35% of pupils, by April 2023, with more than 500 planned to be up and running by 2024.
More than 11,700 schools and colleges have received senior mental health lead training grants so far, which includes more than six in 10 state-funded secondary schools, backed by £10 million this year. In May 2021, £7 million was invested in our wellbeing for education recovery programme, building on the success of our 2020-21 £8 million wellbeing for education return programme. More than 14,000 state-funded schools and colleges in England benefited from the two programmes, which provided free expert training, support and resources for staff dealing with children and young people experiencing additional pressures from covid-19, which included a focus on supporting pupils with bereavement.
We have announced £1.3 billion recovery premium funding for the 2021-22 and 2023-24 academic years for schools, which on top of pupil premium can be used to support pupil mental health and wellbeing. That can include counselling and other therapeutic services. As part of the support we offered in response to the covid-19 pandemic, we have provided a list of resources for schools to draw on in supporting pupils’ mental health and wellbeing, which includes signposting to the Childhood Bereavement Network, Hope Again, and resources from the Anna Freud Centre.
Bereavement is also considered in our thinking on the mental health and wellbeing part of the relationships, sex education and health curriculum, so that can be taught in schools. We are all aware that attendance is an issue post pandemic, and it is in our minds that bereaved pupils might find it harder than others to attend school, and to think about how schools and partners should work together with pupils, parents and carers to remove any barriers.
As the hon. Member for Edinburgh West is aware from our recent meeting, responsibility for the registry of bereaved children sits primarily with colleagues from the Home Office. The Home Office has recently confirmed there are no plans to change the law in that respect, but I would encourage the hon. Member to continue having such conversations with the Under-Secretary of State for the Home Department, my hon. Friend the Member for Derbyshire Dales (Miss Dines), who is the Minister responsible for safeguarding. Everyone will agree that support for bereaved children is incredibly important. I know the hon. Member has already had some good conversations, and there is a lot of sympathy for the work that she talks about. I look forward to working with her, and continuing to talk about how we can best support children who have experienced profound loss, across the whole of Government.
I thank the hon. Member for her eloquent and emotional speech, and for securing a debate on this important subject. Loss, and other traumatic experiences, have a profound impact on children, and I pay tribute to the children and their families who are dealing with unimaginable grief. The Government are committed to providing support through early help services as required. That is more effective in promoting the welfare of children than reacting later, as has been mentioned. It is a pleasure to serve under your chairmanship, Mr Sharma. First, I congratulate the hon. Member for Swansea West (Geraint Davies) on securing a debate on this incredibly important subject. It is wonderful to see so many people in agreement about what is needed, and to have seen the expertise on show today. I hope people can see from our SEND and alternative provision improvement plan the seriousness of the Government in trying to respond to the needs of children with special educational needs and disabilities across the country.
The hon. Member rightly talked about the importance of early language, which we know feeds into children’s overall learning and literacy. He talked about the importance of education and health working together, and I am pleased to say that we jointly published that report, and that the Department of Health is very much working hand in glove with us on the plans. He also spoke about the importance of all-teacher training, which is crucial, early identification and getting a diagnosis, and recruitment and retention. I confirm that I would be delighted to meet with him, and we will talk about dates. I shall touch on some of those subjects in my speech.
I have had the privilege to meet some of the galaxy of professionals, as the hon. Gentleman said, who support children and young people with SEND. Whether they are in early years, schools, colleges, health and care settings, or specialist and alternative provision, those are some of the best visits that I do; it is a joy to meet a group of people who are so dedicated, skilled and passionate about meeting the needs of their children and young people. Hon. Members mentioned investment in the specialist workforce a number of times, and I am keen to engage with all the charities and organisations that have expertise in this issue as we take our plans forward to the next stage.
The SEND and alternative provision improvement plan is meant to support the entitlement set out in 2014 through a much clearer local and national focus on the strategy for how we can plan to meet those needs, whether that is through best practice guides for teachers or local inclusion plans, which mean that each area will have to assess and work out how to meet those needs. The funding has increased by more than 50% over the last few years. The idea is that all those parts of the system will be looked at and will hopefully work better together to meet rising need, improve access and build confidence in the system. A number of Members talked about the fact that there is not enough alternative provision, that there is not enough early years support or that there is something specific in their area such that needs are not being met. I hope that the whole system change that we have set out will go a long way to addressing those issues.
Through our consultation process, we heard too many stories from families who are frustrated by the system and battling to access specialist support. We also heard that reform is not possible without a strong, capable workforce with a specialist skillset. I want to assure everyone that we have taken those comments on board and are working hard to make the reforms a reality.
I want first to talk about the specialists who work so hard to provide extra support. They will be key to ensuring that we can do what we need to do for these young people. The right hon. Member for Hayes and Harlington (John McDonnell) rightly mentioned the importance of educational psychologists and children getting through the EHCP process. He mentioned that educational psychologists can provide professional advice to children and young people and drive better life outcomes. I completely agree with his emphasis on them. He is also right that I used to be a Treasury PPS; I had fewer opportunities to agree with him then, so it is nice to be able to do so today. We have announced an additional £21 million to train more educational psychologists. We increased the number of people coming through the system in 2020 and, because of the training time, some of those people are coming through now. He is right that this issue will be crucial in ensuring that we can meet needs.
It is also important—I will touch on this later—to improve broader teacher confidence. In the case of something such as speech and language support, if we had better confidence and evidence-based interventions in mainstream settings, we would have a reduced need for educational psychologists and EHCPs.
All of us will assist the Minister through representations to the Treasury about the required early investment that eventually saves money further downstream. I am happy to engage in any lobbying of Treasury Ministers to get that message across, as some of them have not yet fully grasped it.
I thank the right hon. Gentleman, but I would slightly disagree with him. When I was in the Treasury in 2019, I worked on the increase, which we are starting to see, in the high needs funding block, which has gone up by 50%. There is also the £2.6 billion that we are spending on specialist places and the £20 million, which I have mentioned, that we have set out for educational psychologists. We have backed a lot of reforms with funding over the past few years, but I will gladly work with him on anything in this area.
We have also committed to working with the Department of Health on a joint approach. The hon. Member for Swansea West talked about engaging with the specialist sector in health, and we are definitely planning to do that. We do not want to reinvent the wheel; we want to work with people who have expertise in this area.
Access to speech and language therapy has rightly been mentioned. I know the hon. Member for Swansea West has a deep expertise in that, and I am particularly passionate about it. In the improvement plan, we announced that we will partner with NHS England to include early language and support for every child pathfinders within our £70 million change programme. My hon. Friend the Member for North West Norfolk (James Wild) mentioned meeting to discuss that, and I would be delighted to do so. The plan for those pathfinders is that they will trial new ways of working to better identify and support children with speech and language communication needs. We are also looking at family hubs. We have support for Nuffield early language intervention in primary schools, and we are putting support in place with home learning environments. In 2020, there were 620 acceptances to speech and language therapy programmes in England. That was an increase of 28% from 2019. We are working with the NHS on a long-term plan, which will look at therapists, and we are also working on the steering group that we will set up this year.
On the mainstream workforce, my hon. Friend the Member for Wantage (David Johnston), whom I am meeting later today to discuss this issue, rightly said that inclusive schools make for an inclusive society. We will be looking at the initial teacher training framework and early career framework, but, importantly, we are setting out best practice guides, starting with autism, mental health and wellbeing and early language, to ensure that the wider workforce all have that specialist ability as well. It is really important to understand different conditions and what can be done.
Members have mentioned that we are introducing the new SENDCO NPQ, which will replace the existing qualification That will be Ofsted and Education Endowment Foundation assured. Members, including the hon. Member for York Central (Rachael Maskell), have mentioned teaching assistants. The Chair of the Education Committee, my hon. Friend the Member for Worcester (Mr Walker), mentioned his sister. Teaching assistants are vital. We are starting a research project to develop our evidence base on current school approaches, demand and best practice.
Our specialist schools face a challenge because they must have very large numbers of teaching assistants to provide individual support for pupils, so when funding increases to reflect pay awards in the teaching space, it does not keep pace with the increases for teaching assistants. In her conversations with the Treasury, will the Minister ensure that it understands that specific challenge and ensure that, as we see the welcome rise in the living wage, our specialist education sector is supported with the cost of that? They are very real costs and are needed.
I will happily go away and look at that, but I would also make a point on the additional funding we have put into the mainstream sector so that it can cope with all sorts of rises in demands and costs.
As well as setting out best practice guides, we are training 5,000 early years special educational needs co-ordinators to help with early identification. One thing I have found from early-years settings is that there is a real desire to know more about this area. That is very welcome.
A couple of Members mentioned the transition stage into adulthood. I have visited some excellent places recently, including Weston College, which is a centre for excellence, and the Orpheus Centre in my own constituency, which is trying to build that sense of independence in our young people as they reach adulthood. We have also heard mention of teachers of the deaf, and I am really delighted that we have been working with the National Deaf Children’s Society to deliver that apprenticeship, which will be very helpful, particularly because it attracts levy funding.
I would like to turn briefly to mental health, which has been a real challenge. We have been working very closely with the NHS on this. It is investing a lot of money for hundreds of thousands of extra children. We know this is a difficult area, which is why one of our first best-practice guides will be on this topic. We will also roll out mental health support teams in schools.
In mental health diagnosis, it is often thought that someone has a mental health problem when, in fact, they have a speech and language problem. Will the Minister think about ensuring that, when these assessments are made, particularly when people are actually incarcerated, speech and language therapists are on hand to ensure that there is no misdiagnosis?
I will happily look at that, and raise it in my conversations with Health. That is quite right. There are lots of other issues as well, particularly autism in girls. A mental health challenge is often diagnosed when, actually, if the underlying autism were addressed, outcomes for young people would be improved.
I will close on this, so that the hon. Member for Swansea West has enough time. I am sure he will want to say quite a lot. Improving access to the right professionals, whether they are teachers, teaching assistants or the specialists we have talked a lot about today is a key part of our plans for reform. I thank everyone who has brought this matter forward for their detailed stories.
I was hoping the Minister might deal with this—I requested that she share conclusions in relation to the mainland with the relevant Department and with the Minister back home.

Commons ChamberWith permission, I will make a statement on our progress to improve outcomes for children and young people with special educational needs and disabilities or in alternative provision in England. For those with special educational needs and disabilities, many schools and councils are doing a brilliant job. I have met many wonderful teachers who are unbelievably passionate about supporting children to be happier, more confident and better prepared for adulthood. However, too often our children and young people do not get the support they need and their parents have lost trust in the system. Our special educational needs and disabilities and alternative provision Green Paper set out proposals to deliver a more inclusive system, and I give credit to my predecessors, particularly my hon. Friend the Member for Colchester (Will Quince) and my right hon. Friend the Member for Chelmsford (Vicky Ford), for the work they have put into this area.
I would like to put on record my thanks to the thousands of people who responded to the Green Paper consultation, and to the parents, children and young people who shared their experiences with us. Most people agreed that the experiences and outcomes of children and young people vary significantly around the country. We heard too many stories of families who were frustrated by the system, and who were battling to access specialist education, health or care services, including mental health services. I assure the House that we have taken those contributions and comments on board.
On Thursday, we published the “Special Educational Needs and Disabilities and Alternative Provision Improvement Plan” jointly with my right hon. Friend the Secretary of State for Health and Social Care. The plan sets out the next steps that we will take to deliver a more positive experience for children and families. Our mission is threefold. First, we want every child and young person to enjoy their childhood, and feel well prepared for their next step, whether that is into employment, higher education or adult services. Secondly, we know that the system has lost the confidence of parents and carers. We need to regain their trust by improving the support that is ordinarily available. Finally, we have increased the high-needs budget by over 50% in the past four years; we now need to make sure that the funding is being well spent.
We will establish a single national system that delivers for every child and young person with special educational needs and disabilities from birth to age 25. To do that, we will develop new national special educational needs and disabilities and alternative provision standards, which will cover early years, school, and post-16 provision. The standards will set out what types of support should be available, and who, according to the best possible evidence, should be responsible for making sure that it is. That will include clarifying the types of support that should ordinarily be available in mainstream settings, so that families can have confidence and clarity about how their children’s needs will be met. We will develop new practice guides to support frontline professionals in implementing evidence-based best practice. We will start by building on best practice, including on early language support, autism and mental health and wellbeing.
To deliver for children and their families locally, we will establish local SEND and AP partnerships. They will support local authorities in producing, together with families, local inclusion plans that are in line with the national standards. Those plans will set out how good-quality alternative provision will be made available. In our new approach to AP, instead of it being a permanent destination, it will be used as an intervention, in order to support those who may feel anxious, or struggle with their behaviour, in mainstream school. This system will mean that more children and young people have their needs met effectively in mainstream settings. That will reduce the reliance on education, health and care plans for accessing support.
Early intervention is crucial. That is why we are training thousands more early years special educational needs co-ordinators and 400 more educational psychologists, who will be able to identify children who need support, and to provide expert advice. We will ensure that children and young people who require an education, health and care plan or specialist provision will get prompt access to the support that they need, within a less adversarial system. We will introduce new standardised EHCPs, and will support local authorities in increasing their use of digital technology, so that the process is easier and quicker for families. By providing a tailored list of settings that are able to meet the needs set out in an EHCP, we will ensure that families can express an informed preference for a placement, so that children and young people can get the right support in the right setting. We will continue to work closely with families and local authorities as we test this proposal.
It is crucial to have the right school places in an area. We will invest £2.6 billion by 2025 in new special and alternative provision places, and in improving provision, including by opening 33 new special free schools; a further 49 are already in the pipeline. We will shortly launch competitions to run these schools.
I am determined to ensure that all children and young people progress to the next stage of life with confidence and optimism, so we will publish guidance on ensuring effective transitions between all stages of education, and an effective transition into employment and adult services. To improve transitions into employment, we are investing in supported internships; we aim to double the capacity of the programme between 2022 and 2025. We will also continue to work with the Department for Work and Pensions on the introduction of the adjustments passport, so that employers know what support young people require.
I know that the whole House will wish to join me in thanking everyone who works so hard to deliver for children and young people with SEND or in alternative provision. Honestly, some of the most inspirational visits that I go on involve meeting them. For our reforms to succeed, we need a strong, confident workforce with robust leadership, and access to specialists where needed. We will deliver a new leadership-level national professional qualification for special educational needs co-ordinators, so that this key part of the workforce receives high-quality, evidence-based training. We are also extending the alternative provision specialist taskforce pilot programme, which co-locates a diverse specialist workforce in alternative provision schools.
Informed by a stronger evidence base, we will take a joint approach to workforce planning with the Department of Health and Social Care, and we will establish a steering group this year to drive this work forward. We will also partner with NHS England to trial new ways of working to better identify and support children with speech, language and communication needs in early years and primary schools. Meeting children’s social, emotional and mental health needs is also a crucial aspect of strong special educational needs provision. Our school and college mental health support teams will be expanded to around 400 operational teams later this year, covering around 35% of pupils in England, and it will reach around 500 operational teams by 2024.
I began by saying that we had to regain parents’ trust, and I know that part of this means strengthening accountability across the board so that everyone is held to account for supporting children and young people. The new Ofsted and Care Quality Commission area SEND inspection framework now focuses on the experience of children and young people with SEND or in AP. Going forward, Ofsted, the Care Quality Commission and the Department for Education will provide oversight and ongoing monitoring of reforms, including delivery in line with the local inclusion plans. From this autumn, parents will be able to monitor the performance of their local systems through the establishment of local and national inclusion dashboards. Where there are disagreements about an individual’s special educational needs provision or support, we will make it clearer how concerns and complaints should be dealt with by local areas. We will also strengthen the quality of mediation and test different approaches for resolving disputes earlier.
So that all children and young people can access the support they need to fulfil their potential, we must put the system on a stable and sustainable financial footing. We secured £2 billion a year in additional schools funding in the autumn statement from this April, of which £400 million has been earmarked for SEND and AP. We are working with local authorities to address deficits through our delivering better value and safety valve programmes. Parents told us that some reforms would need careful consideration, so I am pleased to announce that a £70 million change programme will fund up to nine regional expert partnerships to design and test our reform proposals in collaboration with parents. To get this under way, we are today launching the tender for the programme’s delivery partner.
Oversight of reform will be provided through a new national special educational needs and disabilities and alternative provision implementation board, jointly chaired by myself and the Under-Secretary of State for Health and Social Care, my hon. Friend the Member for Lewes (Maria Caulfield), who is the Minister responsible for mental health and the women’s health strategy. Delivering for children and young people is of the utmost importance. My priority is to make sure that every single child and young person can access the support they need to make the most of their lives. I commend this statement to the House.

“Every family in the country with anyone with special educational needs will have felt at times like they’re battling the system…you’re fighting for it, fighting for support.”
This is how the Education Secretary spoke about the SEND system last week, and I know that her words will chime with many parents and families across the country. So my question to the Minister today is this: does she really believe this plan is good enough? Does she truly believe it will shift the dial and end the fight for support, end the battle for places at special schools and end the scandal that sees so many children with special educational needs held back?
I know there is support right across this House for action to improve the lives of children and young people, yet in the words of the Children’s Commissioner, the plan the Government have set out risks seeing
“more years of children being fed”
into a “vicious cycle” of poor outcomes. Much of the substance in this plan will not even come into effect until 2025 or even 2026, at best six years after the review was announced. New national standards, new special school places, new standardised digital education, health and care plans—none of this will be coming online until a further 300,000 children with SEND have left secondary school. So can the Minister say what the Government are doing right now for the children in the system today? How can parents, carers, and families be better supported now for the children whose needs are currently going unmet?
I welcome the fact that the Minister has listened to Labour’s call for a focus on the early years. Identifying children’s needs early is vital and the evidence could not be clearer, yet over 5,000 early years childcare providers have closed since August 2021. I am proud of Labour’s record in Government: the network of life-changing children’s centres we delivered across the country. The Minister’s Government closed over 1,300 children’s centres, and now, 13 years on, why on earth do Ministers expect parents to be grateful for the promise of the much more limited family hubs?
The plan sets the aim of reducing the number of children with education, health and care plans. Reducing EHCPs through improving support in mainstream schools and getting better support in place early would be welcome, but it must not simply be seen as a means of reducing costs within the system. Which of the proposals discussed will reduce the need for EHCPs, and how will they be delivered? Will the Minister provide reassurance to parents, already facing an adversarial system, that an EHCP will not become more difficult to obtain for children who do need that level of support?
I want to thank the thousands of staff working every day to support young people with special educational needs and disabilities. School support staff are frequently working with children with the most complex needs, yet all too often they are not given the training or recognition they need and deserve. Meanwhile, less than half of teachers feel that they receive sufficient training to support pupils with SEND. I am sure the Minister will point to the promised new practice guides, again, sadly, not due until 2025, but can she today go further and tell us when all school staff working with children with additional needs will receive greater support?
The plan talks about accountability within the system. After 13 years of Conservative Governments, we hear time and again about the same problems: “significant weaknesses” in local services for pupils with SEND; health services disengaged; families bounced from pillar to post, unable to access the support they need. This is a national pattern of failure that requires a national response. When do the Government intend to get their own House in order?
Parents, providers and all people working in the system to support children and young people are already asking whether Labour will stand by the direction of travel set out in this plan, because while it is right to test policies to ensure they work, this plan is symptomatic of a Government who have simply given up, and who are governing through a mixture of distraction and delay, pushing the tough decisions to the other side of the election. So, I say to all parents, carers and children with additional needs, “Labour wants to work with you to get this right and deliver the system that you have rightly been calling for over so many years, and to enable every child and every young person to achieve and thrive.”
I would like to come back on some of those points.
First, on the ambition of the reforms, these are systemic reforms: we are looking at every single part of the system and addressing a lot of the challenges that providers and parents talk about. Communications with councils comes up a lot with parents, for example, and we are setting out a new standard on that. On timeliness of EHCPs, we are working on joint-partnership working with health providers and local councils so that they can deliver on that. On teachers, we are talking about training as well. So, yes, I do think this is an ambitious set of reforms and that it will improve people’s lives.
On the timeline, we have not waited for the publication of the improvement plan. Not only have we increased the amount of funding for the high needs block by over 50% in the last four years, but we have also taken schools funding to historic record real-time highs, so anyone who is in mainstream funding can also get additional support.
We have also set out £2.6 billion on a capital programme to increase the number of specialist places. We set out 33 new pre-schools last week, but we have already built 92 and there are 49 in the pipeline with seven due to open in September. We have also set out funding on educational psychologists. So there is much that we have already started to do, and we have not waited for the improvement plan. When setting out steps like national standards, however, it is important that we consult and take time to get it right.
The hon. Lady mentioned teacher training. We are going to review both initial teacher training and the early careers framework, which will work in tandem with our best practice guides to make sure that all teachers have the best possible evidence base to work from.
Lastly, accountability is something that we have been baking into the system for a while. We have put forward a new area inspection framework. Again, that brings in all the partners, because we know that education is as important as health. We will have a new social care inspector on those area inspections for the first time. In 2019, we changed the standards for schools so that a school cannot be considered good or outstanding unless it gets good outcomes for its special educational needs children. We are looking at all those points of accountability to ensure that the system works as well as possible.

Thank you, Madam Deputy Speaker. I pay tribute to the Under-Secretary of State for Education, my hon. Friend the Member for East Surrey (Claire Coutinho), and the Minister for Health and Secondary Care, my hon. Friend the Member for Colchester (Will Quince), for all the detailed work they have done in this area. There is much to be welcomed in the improvement plan. The aspiration in the foreword to
“deliver a more dignified experience for children and young people with SEND and to restore families’ confidence in the system”
must be one that colleagues from all parts of the House can agree with.
Important strides are being taken to invest in new capacity where it is needed. In that vein, I warmly welcome the announcement of a new all-through autism school in south Worcestershire. I have long supported and campaigned for that, as has my hon. Friend the Member for West Worcestershire (Harriett Baldwin).
Does my hon. Friend the Minister agree that, to maximise opportunities for children with SEND, we must get the right support for inclusion in mainstream schools, early identification of need and the right specialist provision where it is needed? With that in mind, I urge her to continue to work with Worcestershire Children First to ensure that we can meet the increasing level of need in early years and primary in my neck of the woods.
I would also say that implementation is crucial. We have a strong plan, but getting the implementation right will be very important. With that in mind, will my hon. Friend agree to give evidence to the Select Committee when we look further into these issues in the near future?
I thank my hon. Friend for that question. He is absolutely right that getting the right provision in mainstream is the key to success, particularly in respect of early identification, so that needs do not escalate, as we know they so often do if people do not get the help that they need at the right time. I welcome the new specialist provision that my hon. Friend will have in Worcestershire. I know that he has campaigned long and hard on that. I would also be delighted to give evidence to the Education Committee.
The goal must be to ensure that every child with a special educational need or disability gets the support that they need now—not in a year or in two or three years’ time—in order for them to achieve their potential. The curriculum framework for children and young people with vision impairment provides a framework of support to those children to access the curriculum and develop the broad range of skills that are necessary to learn alongside their peers and live independently. The curriculum also involves developing life skills for visually impaired children and young people. Will the Government agree to include that new curriculum framework for children living with sight loss in their new standards, or the soon-to-come code of conduct, and draw on the vast knowledge from within the sight-loss sector?
I thank the hon. Lady for her question. As we set out national standards and best practice guides, we will be trying to work with the best possible evidence from all providers to ensure that we have those included. We have also set out a new apprenticeship, with the Institute for Apprenticeships and Technical Education, for teachers of children with sensory impairment. That may be an area that we can collaborate further on.
I congratulate the Minister, her predecessor, my hon. Friend the Member for Colchester (Will Quince), and the Secretary of State for Education on an excellent paper. I would press her further on the initial teacher training review. When will that conclude? That is obviously crucial. Early identification is at the centre of this review. Early identification of neurodiverse conditions—including, for example, dyslexia —is critical, so what tangible action will we see for better screening and better early identification so that every neurodiverse child can reach their potential, and we can support all children to succeed?
I thank my right hon. Friend for that question. Obviously, he has been a doughty campaigner on the issue of dyslexia, and he has had many constructive conversations with me about the issue. On initial teacher training, we will be working at pace to get that right. On early identification, one thing that will really help is that we are setting out a best practice guide on early speech and language support. Coupled with the phonics test, I think that will be effective in working out which children are struggling with their reading, so that we can get the best support in place as quickly as possible.
This is quite a confession from the Minister after 13 years of Tory Government. In my constituency, children have waited months, if not years, for an education, health and care plan. Children are waiting three years for an autism diagnosis. There is parental anxiety over schools that do not have the right provision for their children, and anger that special needs children are excluded for misbehaving and left at home with no support. In one case, a teenager with a maturity age many years younger was left to cope in mainstream—they don’t! Does the Minister really think that parents trust her and her failing Government to get it right this time?
I am not sure I would like to thank the hon. Gentleman for that particular question, but I understand the frustration parents feel. It is something I have talked to lots of parents about since I became an MP, as I am in an area that has seen a huge rise in need. That is something the system is facing. The Conservative Government enhanced parents’ rights through the Children and Families Act 2014. We are seeing a huge rise in needs and we are setting out plans to deal with that. One thing that I think will help in particular—he mentions cases of children who are struggling in the system to find a place—are the local inclusion plans and partnership working. We will look at every single part of the system to ensure that we can assess needs and that there is suitable provision for all children and young people.
I refer Members to my registered interests. I thank my hon. Friend for what is both a detailed and serious piece of work that identifies the issues that remain in the special educational needs and disabilities and alternative provision system. She will know that I took the original reforms through in 2014 in the Children and Families Act. The legislative framework still holds together well, but as the Chairman of the Select Committee said, this is a lot to do with the implementation and the experience on the ground, not least when it comes to the role of health in bringing EHCPs together, especially in mainstream schools. To that end, can she say a little more about how she will make health bodies comply with their statutory duties, and about any greater powers that the Health Secretary may have to take robust action where children’s needs are not being met, both within the current legislative framework and in any future national standards? It is so important that this is done with parents and children, not to them.
I thank my hon. and learned Friend for everything he has done on children’s policy in his time in government. He is absolutely right that we must make sure the health sector is also held accountable. One thing we have done is to change the area inspection framework, as I mentioned, which means that for the first time we will have a social care inspector looking at the health element. The Health and Care Act 2022 requires every integrated care board to have a named person accountable for SEND, which will take on the statutory responsibilities from clinical commissioning groups.
The implementation plan will not work if the workforce is not in place. As we know, to be able to achieve an EHCP, the workforce needs to be in place and it takes many years to train. Those professionals are not there currently, so how will the Minister ensure that the workforce is in place not just in the health pathway but in the school? The experience I am seeing in a particular multi-academy trust in York is that it is laying off the staff who would take responsibility for those children, as opposed to providing the therapeutic environment that children so need.
The hon. Lady is absolutely right that specialist support is really important. We are working with the Department of Health and Social Care on specialist health support, whether that is occupational therapists or speech and language therapists, but we are also training educational psychologists and changing the special educational needs co-ordinator training. More importantly, we want all teachers to be trained in SEN. That is why we are looking at initial teacher training and the early careers framework. A huge proportion of the school population now has an SEN and we need everybody to be trained in it.
I welcome the Government’s new improvement plan on special educational needs and disabilities. I recently held an autism roundtable in Stafford to discuss the pressures parents are facing with gaps in support locally. What new support will now be available for parents of children with special educational needs?
I thank my hon. Friend for that question and for meeting me when she pressed me on this issue. We will be putting lots of things in place for parents, but in particular we will be ensuring that a specialist workforce is in place, that increased funding is going into schools and that there is better communication from councils, which is one of the new standards we will be bringing in. Hopefully, all that will help give parents confidence in the system. On the particular challenge with EHCPs, we will be streamlining and digitising them, which will hopefully help parents with the bureaucracy of trying to get their children the support they need.
Alongside my hon. Friend the Member for Barnsley Central (Dan Jarvis), I recently held a meeting with parents of children with special educational needs. They raised a number of issues, including having to wait years for support, a lack of psychologists available and a lack of specialist school places. Barnsley has one of the highest numbers of EHCP plans in the country. I therefore welcome a number of the proposals in the statement, but how many young people with SEND will have left formal education before the plans come into effect? May I press the Minister again on what resources are available to help people now?
As I mentioned, we have been increasing the budget, the high needs block, for the last four years. We have also set up further funding for schools, which will be going into the system. On specialist provision, as I said we have 92 new free special schools, with 49 in the pipeline and seven opening in September. We have also announced a further 33.
I warmly welcome more resource and better service in this crucial area. Where new schools are being considered, will the Minister ensure that local MPs are properly consulted, because there will be a lot of local public interest in the location, the style of development and the impact on existing provision?
I thank my right hon. Friend for that question. Yes, I am happy to discuss with him the school—I think there might be two—coming forward in his area.
This plan comes three years after the SEND review was launched. Given that most of the national standards will not be published until late 2025, the new EHCP template will not be rolled out until 2025, the cross-departmental steering group will not complete its work until 2025 and no new primary legislation will be proposed until at least 2025, what message would the Minister like to give to the parents and children in my constituency and right across the country who have already been waiting too long and fighting far too hard to access the support they need and are entitled to?
We have not waited for the improvement plan to take action. Not only have we increased the overall budget for the high needs block by 50% in the last four years; we have increased school funding to record highs, we are bringing online more educational psychologists and we are building more specialist school places. All that work is under way. We are improving speech and language in primary school, and we are now looking at what we can do in the early years. All that stuff is under way. We are trying to make sure we can take forward standards in a way that works. We will consult heavily with parents and carers. It is really important to get that right, but there is much action we have been taking already.
Like many right hon. and hon. Members, I have met and got to know families who have children with special educational needs and disabilities. The difficulties those families face in finding the right educational support in the right location can be frustrating and tortuous, as the Minister will know. For too long, the most vulnerable children in Selby have had to travel long distances to find the education they need. As she will know, there has been discussion for some time about a new SEND facility in Selby. I welcome her plan and I know she is passionate about this area. Can she inform me, and the families and children in the Selby district and North Yorkshire, when such a facility will be delivered?
My right hon. Friend has long campaigned for this kind of facility in Selby. I would be happy to meet him to talk further about the details. We are setting out a lot more special free schools in different areas. For those who have not got one in the recent tranche, we will, I am sure, set out more in due course, but we will also be setting out local inclusion plans, which will mean that every area has to assess and meet the needs of its children.
I declare an interest as chair of the all-party parliamentary group on special educational needs and disabilities. I also have attention deficit hyperactivity disorder, dyspraxia and dyslexia, so I speak with some experience of difficulties in school. I am concerned about the national standards, which I welcome, but we need to ensure that personalisation is not lost in the process and that there is not a levelling down of standards where they are currently good. I am also concerned that mental health support needs to be accessible for every single child with SEND. Can the Minister reassure me?
The hon. Lady is absolutely right that national standards should not be levelled down but there should be a minimum. Across the country, there is huge variability. Some schools, colleges and early years settings do things incredibly well, and we want to ensure that we use the best evidence and make things as transparent as possible. On mental health, we are rolling out support in schools, and we are working closely with the Department of Health and Social Care on child and adolescent mental health services.
I welcome the measures to help children with special educational needs and their families, particularly the focus on speech and language therapy, which I have discussed with the Minister. Will she consider Norfolk and Waveney as one of the early language support pathfinder areas, and may I encourage her to accelerate these reforms and good ideas?
My hon. Friend has had constructive conversations with me about speech and language therapy. I am delighted that we are rolling out pathfinders, and I would be happy to discuss his options in Norfolk further.
The Disabled Children’s Partnership will tomorrow publish its new research report, which shows that just one in five parents reports that they receive the support needed to enable their disabled child to fulfil their potential. That is no surprise considering that it can take up to a year for a case to be heard at tribunal, which delays access to the crucial support that those families desperately need. What are the Government doing to speed up the process, to ensure that every child receives the support to which they are entitled in a timely manner?
The hon. Lady is right that too many families are waiting too long. There has been a huge rise in need. We have put elements in place to help: the workforce strategies will ensure specialist provision; the local inclusion plans will ensure that each area is assessing and can meet needs; and the inspection framework will look at health partners, their roles and what they are delivering, so that all children and families can feel confident that the local area will meet their needs.
Too many desperate parents have been seduced by glossy brochures and slick salesmanship to engage in the adversarial process that the Minister mentioned, and to send their children to settings that are often far from home and where the profit motive of their venture capital owners sometimes takes precedence over education delivery. Does she agree that today’s announcement means that more children will receive education that meets their needs closer to home, which will be more cost-effective for the taxpayer?
I have seen a range of provision, including some private provision that is absolutely excellent, but I agree that too many children have to go outside of county to get the specialist provision that they need. Our plan will ensure that each area must assess its local needs and put the specialist provision in place if there is demand for it, so that people can get help on their doorstep, which is good for them and their families.
I welcome the Minister’s undertaking that, “we now need to make sure that the funding is being well spent.” I do not think that that has always been the case in Devon. I have a constituent whose son’s placement in a special school has become unviable, but the child is still on the school roll and the funding connected to his placement is being held in limbo. Will the Minister commit to ensuring that SEND assessments happen in a reasonable timeframe and that the funding follows the child?
In the new area SEND inspection framework, timeliness will be assessed, which it was not previously. The educational psychologists that we are bringing on stream will help to speed up the assessments, as will our other specialist workforce plans.
Stroud district families of children with special educational needs are exhausted from battling. Schools raise SEND all the time, so more power to the Minister’s elbow for the welcome systemic changes she is trying to work through. I would like to hear more about the Department’s work with local authorities, because it is the day-to-day experiences that are exhausting many parents, in councils all over the country of all different colours. Getting back to people, managing expectations and giving advice about delays all need to work better, because they are causing additional stress for families who absolutely do not need it.
My hon. Friend is passionate about this area. She is absolutely right, and I have heard from parents in my area and across the country that it is the daily grind of poor communication that can wear them down. We will set out more guidance and training for SEN caseworkers in councils, and better communication standards, to stop that happening to parents.
The Children and Families Act 2014 set out national standards in legislation, but families, parents and guardians of children with special educational needs and disabilities in Slough regularly lament that they feel completely let down because even those legislative safeguards have failed to provide support for children and young people. After so many years of failures, why does the Minister think that announcing new standards and a plan with no legislative underpinning will deliver better outcomes?
A combination of plans within the strategy will support that. We have seen an increase in need and better awareness of different conditions, so the national standards will bring together the best evidence so that people’s needs are met consistently and at a high quality across the country. On accountability, we have improved the area inspection framework by recognising that we need to bring in not just education and councils but health partners.
My hon. Friend the Minister will recognise that one of the greatest causes of strain and stress in the system is the assessment process. I welcome much that is in this plan, including funding for additional educational psychologists, but they will not be present in the system for some time. More urgently, what can we do to accelerate the assessment process so that children in need can take advantage of all the good things that she has described?
There are two things: increasing the number of educational psychologists, which will improve the ability to get a diagnosis quickly; and ensuring that identification happens in schools or early years. If we can catch things early, we can treat them and make sure that people get the right support so that they do not escalate. Too often, people do not have their needs met and they escalate into a crisis. That will help children and young people to get the exact support that they need earlier on.
I want to give a voice to Oliver, who has high-functioning autism and an EHCP plan in place. The fundamental issue is that the resources have not followed—there has been a lack of specialist provision in the area, and the local authority talks about a lack of resources. Will the Minister meet me to discuss that particular case?
If the hon. Gentleman’s constituent has an EHCP plan and resources have been set out, they should be delivered. In the case of autism, we need to ensure that people are properly supported; it is one of the areas that has risen greatly over the last few years, and I am passionate about ensuring that we have everything in place. I will be happy to look at meeting him.
I welcome the focus on ensuring that general, non-specialist teachers have a better understanding of new neurodiverse conditions. Many young people with learning disabilities are in the mainstream setting and have teachers who understand that neurodiverse people think differently. When it comes to diagnosis, can we please push harder, because so many of my constituents still cannot get an assessment for their kids and are having to go privately?
More generally, could we do a national campaign to encourage employers to do more to hire neurodiverse individuals? This is not about virtue signalling; neurodiverse people are among the great minds—the unconventional, creative thinkers—so the more we can do on that, the better. Neurodiversity week is coming up; I am not usually a fan of such weeks, but on this occasion I think we should put rocket boosters up it.
My hon. Friend has been a brilliant campaigner and has shown me around some brilliant special schools in his patch, such as the Sir Bobby Robson School. He is absolutely right to recognise neurodiverse people’s opportunities and the benefits that they bring. When I was Minister for disabled people, I saw lots of employers champing at the bit to hire neurodiverse people because of the brilliant skillsets that they draw on. I would be happy to look at what we can do further on the matter.
I thank the Minister very much for her detailed and helpful statement on special educational needs, which builds on a previous statement about the Stable Homes, Built on Love programme. It is important that that is a key foundation.
With more children struggling to integrate into multi-ability groups, and with funding pressures affecting the ability to provide classroom assistance, does the Minister agree that it is time for an overhaul of the system and that a pupil-focused approach is required? In the meantime, what can be done to stop capable children falling through the gaps? Will the Minister consult the Northern Ireland Department of Education on taking these ideas forward?
I would be happy to discuss any matters in this area that the hon. Gentleman would like to talk about. He is absolutely right that we must get the support right, with a focus on pupils. It is about early identification, flexibility and ensuring that each child and young person gets the support that they need to thrive in an educational environment.
SEND provision is one of the most critical issues in education in Oxfordshire. Exasperation is frequently expressed by parents who are frustrated by Oxfordshire County Council’s processes. I welcome the extra 50% in funding since 2019, but what is the Minister doing to work with local authorities to ensure that we cut through the bureaucracy, get people assessed and give help where it is needed?
My hon. Friend is absolutely right. I have heard from a lot of parents about their frustrations. We will streamline and standardise the EHCP process to make it much simpler for parents to deal with. To improve access to diagnosis, we are increasing the number of educational psychologists. We are also trying to raise standards in schools so that early identification can happen even in mainstream settings.
I was thrilled last week to receive notification from the Minister that the Department will fund a new SEND school in Bracknell for pupils with autistic spectrum disorder at key stages 1 to 5. That will be massive locally, so I thank her very much.
Having fought for improved SEND provision since becoming an MP, I know the importance of today’s announcement. Again, I am thrilled and I thank the Minister, but may I politely point out that diagnosis is really important? We have to fix CAMHS as well.
My hon. Friend has long campaigned for extra specialist provision in Bracknell, so I am delighted that that is happening. He is absolutely right that diagnosis is important, which is why we are increasing the number of educational psychologists. We will work closely with the Department of Health and Social Care on CAMHS and will ensure that we are rolling out mental health support in schools.
Carers and parents of those who need SEND and alternative provision are often battling against the system. Their children are their heart and soul, so it is heartbreaking to find that they cannot get provision and support when they need it or that they face reams of forms: it makes their life, which is already difficult, even harder. Will my hon. Friend confirm that we will put those who are helping children who need support at the heart of our approach, and that we will not create more bureaucracy? We must not just cut the red tape, but get rid of it forever.
I hold very near my heart the plight of parents who are struggling with the system. They know that their child gets only one shot at education; it is very stressful for them, and it can be heartbreaking when they feel that specialist support is not there. We will streamline the EHCP process and try to make it easier—we want them to spend more time with their children rather than doing paperwork. We are also trying to ensure that everything in the system is available so that they can get the specialist support they need.
How closely is the Department for Education working with the Department of Health and Social Care? In Westminster Hall on 6 February, as my hon. Friend may be aware, there was a very constructive debate about ADHD at which it emerged that a bottleneck is being caused by a lack of psychiatrists to make the initial diagnosis. Will she say a little more about the resources that may be made available on the health side for her educational project?
We are working so closely with the health Department that it has jointly published the report with us. We will also be working with it on a joint steering group. My right hon. Friend is absolutely right about diagnosis, which is why we are increasing the number of educational psychologists in the system. I know that the health Department takes the matter seriously, including by looking at what can be done to improve autism diagnostic pathways.
I commend the Minister for her statement: it is really refreshing to know that she has such a passion for understanding the situation, especially the fact that alternative provision is an intervention and not a destination. I thank her for meeting me to discuss issues in local children’s services and for the important announcement of a special free school in North East Lincolnshire, of which Grimsby forms part. Does she agree that this is part of levelling up for children, parents and young people with jobs and opportunities? Will she work with me on how we can advertise and promote the jobs and careers available in special educational needs?
My hon. Friend has huge personal experience in improving the skills and life chances of children and young people. She is absolutely right that this is about levelling up, which means helping people to live the best lives they can, get the best employment opportunities they can, and enjoy their adulthood. I would be absolutely delighted to meet her to discuss the matter further.
I thank my hon. Friend for her statement, which I am sure will provide some reassurance to many of my constituents who have voiced their frustration with the whole SEND system. Dorset Council does its best, but problems have been identified in diagnosis prior to SEND support, particularly for those with autism.
On a related matter, we were delighted to hear that a special school for 14 to 19-year-olds was due to open on Portland in September this year, but now there is to be no sign of it until September next year. We are all nervous that somehow it may disappear. May I meet the Minister to discuss it and, hopefully, to confirm that it will come next September?
My hon. Friend is absolutely right about diagnosis. Autism is one of the areas in which need has most risen. We will work with the NHS on new autism diagnostic pathways, as well as increasing the overall number of educational psychologists in the system so that people can get a diagnosis as early as possible. I would be delighted to meet him about his local specialist school.
As another dyspraxic MP in this House, and one whose handwriting closely resembles Guy Fawkes’s confession note, I warmly welcome the Minister’s statement. In Bassetlaw we have some outstanding specialist provision at St Giles School in Retford, as well as many excellent examples of mainstream provision and some very dedicated and hard-working staff, but SEND support for pupils varies across the country. Does the Minister agree that working to equalise that support and ending the postcode lottery is vital to levelling up SEND provision and increasing parental choice?
My hon. Friend is absolutely right. I have seen some areas and schools doing unbelievably brilliant work, and some areas that are not doing so well. We want to reduce that variation and ensure that we use the best possible evidence all the way through the system so that there is much more consistency and choice for parents.
I welcome the alternative provision implementation plan that the Minister has outlined, particularly the focus on early intervention. As she knows, many of the children who end up in alternative provision are those most at risk of being involved in the criminal justice system in future. A particular concern that has been raised with me as chair of the all-party parliamentary group on school exclusions and alternative provision is the short-term nature of funding in the system. AP places are often called on at the very last minute when a child is excluded from school. Could the Minister say a little more about what her announcement today will mean for the commissioning contracts that are in place?
I am passionate about alternative provision: it is where some of our most vulnerable at-risk young people go, so we want to ensure that it is of really high quality. We will bring out new standards for it, which will be included in the Ofsted area framework for the first time, and we will look at how it is funded. Importantly, the local inclusion plans that we will set out will look at all parts of the system so that whether someone is in AP or struggling in mainstream, we can ensure a place for them and ensure that they are properly supported.
I congratulate my hon. Friend on the measures that she has announced. They include provision for a new and much-needed school in Darlington, which is warmly welcomed. May I put on record my thanks to Councillors Jonathan Dulston and Jon Clarke for the work that they have done in this regard, along with parents and carers in my community? May I also ask my hon. Friend what assessment she has made of whether this additional provision in Darlington will meet all unmet need, and what more can be done to speed up the woefully inadequate waiting times for CAMHS assessments by Tees, Esk and Wear Valley NHS Trust?
I am delighted that my hon. Friend is to have that specialist school. He has raised the subject with me on many occasions. We will work closely with the Department of Health and Social Care on the entirety of the plan, but we are looking at mental health support in schools as well.
I welcome the announcement of the SEND improvement plan. I was also delighted when, in August 2020, the Government announced £17 million of funding for a new SEND school in my constituency. Six months ago it was given the green light for planning, but there now appears to be a delay owing to a change of contractors. These things really matter, and we need to speed them up. Will my hon. Friend agree to look into the situation and find out what is going on, so that we can avoid any further delays and get on with completing this new and brilliant provision?
I know that my hon. Friend is passionate about SEN support in Cheadle, a subject that she has raised with me numerous times. I should be delighted to meet her and discuss it further, and I will certainly raise it in the Department.
As a number of us know from our mailboxes and surgeries, many parents face an uphill battle against the bureaucracy and, often, the postcode lottery of SEND provision. That is why I was so happy to receive an email from my hon. Friend last week with the news that we were to have a brand-new free school with SEND provision in south Birmingham. Will she join me in calling on anyone who is passionate and ambitious about young people in Birmingham to step forward and consider submitting a bid to be the sponsor body for the new school?
My hon. Friend has raised this issue with me many times, and I am pleased that we will be able to end the postcode lottery by reducing that variation while also improving the specialist education provision in south Birmingham.
I welcome the statement. I should probably declare an interest, as the husband of a senior learning support teaching assistant.
Sinkholes are making playgrounds unusable in one pupil referral unit, windows are being locked owing to fumes from a petrol station built next door to another, and there is widespread use of unregistered alternative provision. My Labour council has long ignored the needs of children who are unable to attend mainstream schools and who, like all children, need to be given opportunities. Its recent alternative provision building programme ignored west Cumbria entirely. I have supported a bid as part of the recent programme—the results will be announced later in the year—for an AP free school to be built in my constituency. May I ask the Minister to help me to give these kids a chance by enabling AP schools to be built outside the control of the council, which sees them only as a problem to be managed rather than as youngsters who need to be nurtured?
I thank my hon. Friend for everything he has done in his area for alternative provision, which he clearly cares about. AP schools are important because they are where some of our most vulnerable young people go, and we need to ensure that they are of the highest possible standard. I look forward to seeing my hon. Written StatementsToday, I am proud to announce publication of the “Special Educational Needs and Disabilities (SEND) and Alternative Provision (AP) Improvement Plan”. This is a joint publication with my right hon. Friend the Secretary of State for Health and Social Care. This plan sets out the next steps we will take to deliver a more positive experience for children, young people and families.
Our “Special Educational Needs and Disabilities and Alternative Provision Green Paper”, published in March 2022, set out proposals to deliver a more inclusive system. What we heard through the consultation on the proposals set out in the Green Paper—particularly from parents and families—gives us confidence to establish a new national SEND and alternative provision system with the mission to:
fulfil children’s potential: children and young people with special educational needs and disabilities or attending alternative provision will enjoy their childhood, achieve their goals and be well prepared for adulthood and employment;
build parents’ trust: parents and carers experience a fairer, easily navigable system (across education, health and care) that restores their confidence that their children will get the right support, in the right place, at the right time;
provide financial sustainability: local leaders make the best use of record investment in the high needs budget to meet children and young people’s needs and improve outcomes, placing local authorities on a stable financial footing.
The improvement plan sets out that we will establish a single national system that delivers for every child and young person with special educational needs and disabilities from birth to age 25 so that they enjoy their childhood, achieve good outcomes, and are well prepared for their next step, whether that is employment, higher education or adult services.
To deliver consistent experience regardless of the school a child attends, where they live or their family background, we will develop new national special educational needs and disabilities and alternative provision standards, covering early years, school, and post-16 provision, setting out what types of support should be available and who should be responsible for making sure this happens, based on the best possible evidence. This will include clarity on the types of support that should be ordinarily available in mainstream settings. This will give families confidence and clarity on how their children’s needs will be met.
New practice guides, based on the best available evidence, will equip frontline professionals to identify needs early, accurately, and consistently so that the right support can be put in place. We will give families greater confidence that their child will be supported to fulfil their potential through improved mainstream provision in their local setting.
A few weeks ago I launched “Stable Homes, Built on Love”, an implementation strategy and consultation which sets out our plans to transform children’s social care. We have worked closely to ensure that these two sets of reforms lock tightly together, putting families at the heart of the system of help and support.
We are building a confident, expert workforce across education, health and care to ensure children get the early support they need to fulfil their potential. We will introduce a new special educational needs co-ordinator national professional qualification for schools to give these vital staff with the knowledge, training and practical skills to support children with special educational needs. We are also already offering training for up to 5,000 new early years special educational needs co-ordinators.
We are also investing £21 million to train 400 educational psychologists to provide expert advice on supporting individual needs. We will extend funding, by up to an additional £6 million, for specialist taskforces which work directly in alternative provision schools and include for example mental health professionals, family workers, and speech and language therapists.
We are delivering a new approach to alternative provision, so it is used as an intervention for young people to stay in or return quickly to mainstream, instead of being a destination. Alternative provision settings will need to follow the new national standards, which will set out how the new approach should be delivered, and will form a critical part of local partnerships and inclusion plans.
We want children and young people who need an education, health and care plan or specialist provision, to get prompt access to the support they need, within a less adversarial system. We will reduce bureaucracy through new standardised education, health and care plans and promoting the use of digital technology.
I appreciate how crucial it is to have the right school places within the local area. To that end we are investing £2.6 billion between now and 2025 to fund new special and alternative provision places and improve existing provision. I can now announce we are opening 33 new special free schools, with a further 49 in the pipeline, and we will shortly be launching competitions to run those schools.
To support young people into employment, we will invest £18 million to double the capacity of the supported internships programme and continue to work with the Department for Work and Pensions on the introduction of the adjustments passport so that employers know what support young people require. New guidance to support effective transitions, including into employment, will mean that young people are supported from day one.
I know how important it is that accountability is strengthened across the system so that everyone is held to account for delivering for children and young people with special educational needs or who require alternative provision. My Department will have a role in reviewing new local inclusion plans and will offer support and challenge where necessary. New Ofsted and Care Quality Commission Area SEND inspections, launched in January of this year, will have a greater focus on the outcomes and experiences of children, young people and families.
We will test our key reforms, such as national standards, through the creation of up to nine regional expert partnerships through our £70 million Change Programme. This will help build a strong evidence base to inform future funding and legislation and allow us to guard against unintended consequences.
Oversight of reform will be provided through a new National Special Educational Needs and Disabilities and Alternative Provision Implementation Board jointly chaired by me and the Under-Secretary of State for Health and Social Care, my hon. Friend the Member for Lewes (Maria Caulfield), who is the Minister responsible for mental health and the women’s health strategy.

Commons ChamberWe support the right of parents to educate their children at home, provided that is suitable. We know that there has been a rise in the number of children off-rolling since the pandemic. We remain committed to introducing local authority registers and will legislate for these as soon as possible.
An increasing number of children are being educated at home, partly as a legacy of the covid pandemic. I am sure that many of those children are receiving a good education. However, local authorities still have a duty to ensure that resident children are receiving a suitable education. It is essential that local authorities are notified of children who are being educated at home, but at the moment there is no legal obligation for them to be notified by the parents. Given that we are talking about those children’s futures, will the Secretary of State ensure that any form of register is introduced sooner, rather than later?
The hon. Lady is right, and this is an issue that the Government take very seriously. The Minister for Schools and the Children’s Commissioner for England recently chaired a roundtable on children missing in education, and we are engaging with local authorities and building a clearer picture through use of data, as well as establishing better attendance data across schools and trusts. We are committed to legislating at the earliest possible opportunity.
I welcome my hon. Friend’s answer but, as she will know, having a statutory register of children not in school has been a very long-standing recommendation of the Select Committee. I believe that recommendation is supported across the House, so can I urge her to make sure that legislation comes forward at the first available opportunity, delivering on what I think the Secretary of State has already said is her top legislative priority?
I thank my hon. Friend for his question. This is a really important area. As I have said, we are working in the interim to do a lot of things regarding data to make sure that we can keep track of attendance. We are seeing what we can do in the meantime, but I absolutely commit to legislating at the earliest possible opportunity.
We spend close to £11 billion on children’s services, helping some of our most vulnerable children through challenging times. In addition, we recently set out an ambitious package of reforms, the “Stable Homes, Built on Love” strategy, backed by £200 million, and our improvement and intervention programme is working, with 58% of local authorities now rated as good or outstanding by Ofsted, compared with 36% in 2017.
Given the issues surrounding Devon’s children’s services, is it possible to look for a granular solution that recognises the differences between the more urban south and the rural north of the county; one in which more localised solutions such as the northern opportunity area can be considered, as well as expediting the Government’s promised funding safety valve?
I thank my hon. Friend, who has raised this issue consistently on behalf of her constituents. It is important that we see an improvement in children’s services in Devon, and I recently met the council leader and the chief executive to stress how important that is to us. Nothing is off the table, and I reassure my hon. Friend that the safety valve case remains open and still under discussion.
I represent a cross-borough constituency, so unfortunately I have to see two of everything, deal with two of everything, and experience two of everything. The differences between the children’s services of my two local authorities could not be more stark. I appreciate that the Minister has said that children’s services have improved, but how do we get those councils that are stuck in a rut to improve far more quickly, so that children in both parts of my constituency have the best life chances?
I thank the hon. Gentleman for his question. That is exactly what our reforms are hoping to do. We have set out things such as a new national framework and are looking at things like the agency cap. [Interruption.] Somebody has just mentioned our record; as I have just said, in recent years we have managed to increase the number of local authorities rated as good or outstanding from 36% to 58%, and we will continue to do everything we can to improve that.
This is an area that the Secretary of State, given her former role in the Department of Health and Social Care, and I, as a former Minister for disabled people, take seriously. Getting our educational offer right for children with special educational needs and disabilities is hugely important, and I will be responding to the SEND and alternative provision Green Paper within the next week.
At my surgery, I met a constituent who is a teacher at a SEND school. She broke down in tears as she told me how they are struggling to support their pupils because their budgets are stretched to breaking point. In Lewisham, increased need is costing £5 million a year more than the council’s SEND budget. When next week—if I heard that right—will the Government finally follow up on their Green Paper and publish their plans to fix this mess? Those vulnerable children and their families need proper support.
I will be responding to the SEND and AP Green Paper within the next week. We have increased funding massively in this area—it is up by 50% in the past three years. I struggle to think of another area of government that has risen that fast. This is about spending well and making sure that all the pupils who need help can get it as soon as possible.
We struggle with SEND provision in Cheshire, both in terms of special school places and support for children in school. Can the Minister outline the steps that the Government have taken to increase provision to build on the upcoming expansion of Springfield School in my constituency, and also join me in congratulating the school on its amazing achievement of being named school of the year last year in the national schools awards?
I join my hon. Friend in congratulating Springfield School on its outstanding achievement—he has often bent my ear about the head, Lisa Hodgkison, and the tremendous work she is doing there. We are investing £2.6 billion to increase the number of specialist school places across the country.
Improving parents’ access to affordable childcare is a Government priority. We are working with the Department for Work and Pensions and His Majesty’s Revenue and Customs to deliver the childcare choices campaign to raise awareness among parents and providers of the Government-funded subsidies available to support families.
With the Budget coming up, will the Government look at how reducing the cost of childcare could help productivity by supporting women who want to go back into the workplace and bringing back over-50s who may have retired early partly to look after grandchildren?
My right hon. Friend is right that childcare is about supporting women and parents into the labour market. We want to support families and are exploring options to achieve this. The Government have delivered a huge amount on childcare, including doubling the 15-hour entitlement for working parents of three to four-year-olds to 30 hours and introducing 15 free hours for disadvantaged two-year-olds.
On Saturday, I met a constituent who was about to return to work from her maternity leave after having her second child. Her childcare costs for a three-year-old and a one-year-old will be £2,700 a month. Spiralling childcare costs are an unbearable cost of living pressure for many families, so what discussions has the Minister had with the Treasury about tackling this unsustainable pressure, and can parents and providers expect to see the urgent change that is needed in the forthcoming Budget?
I thank the hon. Lady for her question. I understand that it is a challenging time with the cost of living and with childcare. I would say it is the Conservative Government who have done the most of any party to expand hourly entitlements. We expanded the hours for three to four-year-olds, we have introduced 15 hours for disadvantaged two-year-olds, we have introduced the holidays and activities fund—by the way, 70% of those participating in 2021 said that they had never been to anything like that before—and we have doubled the number of families in recent years who have taken up tax-free childcare.
I am so sorry to hear about the position of Keya. There are things we are doing, including increasing access to specialist school spaces and improving the offer in schools, and I will be setting out more detail within the next week.
My hon. Friend is passionate about securing an excellent education for all his residents. The funding will help many children in mainstream education, but with dyslexia early identification and teacher training is key. I will be setting out more details in the response to the special educational needs and disabilities and alternative provision Green Paper.
Is the Secretary of State and her Department aware of the severe financial crisis engulfing the University of East Anglia, one so severe that the vice-chancellor has today resigned? This will have a dramatic impact on the regional economy. We could be looking at up to £45 million-worth of projected debt and 30% job losses. As such, will the Secretary of State or the Minister agree to meet me and a delegation from the University of East Anglia to discuss this most critical issue as soon as possible?
According to the Department’s own figures, in 2022, 5,400 children’s social workers left the profession. That is 9% up on the previous year. What are Ministers doing to address this crisis in retention and recruitment in children’s social work?
I agree with the hon. Gentleman that recruitment and retention is key. We set out plans in our reforms a couple of weeks ago, including looking at what we are doing on agency workers, An additional £3.2 billion was set out in the autumn statement to go into adult and children’s social care.
I was pleased when a new construction and engineering skills centre was built on Chartmoor Road in Leighton Buzzard, but it has failed to deliver. We need 1 million engineers and a quarter of a million construction workers. Will the Department ensure it keeps an eye on such projects so that they deliver for the people who need them?
Does my right hon. Friend agree that it is important that families with first-hand experience of special educational needs—such as my constituents the Murphy family, who are in the public gallery—have the opportunity to have a say directly and influence SEN policy and provision, given decisions will affect them on a daily basis?
I welcome the Murphy family—hello! Co-production is incredibly important; that is how we have designed our response to the SEN paper. We will continue to consult at every opportunity.
We know from leaked Government documents that there is a £13 billion backlog in school repairs. Some cases are deemed to pose a risk to life. Is the Schools Minister aware of any school buildings that are at risk of collapse?
Is there a danger that the Government’s proposed legislation on freedom of speech in universities could be weakened or undermined by a requirement first to exhaust internal processes of appeal, which can be protracted?
We have sent the Higher Education (Freedom of Speech) Bill back to the Lords with the tort unamended. We will continue to look at everything we can do to make sure that the Bill is as strong as possible.

It is pleasure to serve under your very welcome chairmanship, Ms Fovargue. I congratulate the hon. Member for Brentford and Isleworth (Ruth Cadbury) on securing a debate on this important subject. It is genuinely a pleasure to come to these debates. I see the faces who come here regularly, who bring interesting information, and I genuinely like taking part in these debates.
I know how important the early years are. I have worked on families policy for a long time. Not only are the early years crucial for children’s development, we also want families to benefit from the childcare support they are entitled to, both from a cost of living perspective and in enabling parents to work. I spend a lot of my time visiting the sector, and I recognise that it is a challenging time. It has been a privilege to spend so much time there. I am always impressed by the dedication of staff, who work absolutely tirelessly to give our children the best start in life. It is a credit to them and this country that 96% of providers are rated as good or outstanding. My hon. Friend the Member for North Swindon (Justin Tomlinson) mentioned Becky at Imagination Nursery. It was just wonderful to see the dedication of Becky and her wider staff, and the brilliant environment that I know his daughter is enjoying.
I will start by talking about funding, which has been mentioned multiple times. It is fair to say that it was a Conservative Government who increased funding. Not only did we expand the offer for three to four-year-olds, we also introduced a specific offer for disadvantaged two-year-olds. We have also looked at other things to give wider support, such as family hubs or holiday activity schemes, which I will talk more about later.
We have invested more than £3.5 billion in each of the last three years on our early education entitlement. We know that the sector, like many sectors in the country, is facing economic challenges. We announced additional funding of £160 million in 2022-23, £180 million in 2023-24 and £170 million in 2024-25, compared with the ’21 settlement, for local authorities to increase the hourly rates paid to childcare providers. I want to assure everyone that we continue to look at the matter. How we can improve the cost, choice and availability of childcare is important to me and to the Government.
As well as supporting families, it is also important that we help early years providers continue to do what they do best, which is educating and developing young children. From 2023-24, we are investing an additional £20 million in early years, on top of the £180 million announced at the spending review, to help with national living wage costs. These funding increases will take place across England, so I am pleased to say that in the constituency of the hon. Member for Brentford and Isleworth, the funding rate for two-year-olds will increase by 10% to £6.92, up by 63p per hour. We have also announced an additional £10 million for maintained nursery schools’ supplementary funding from 2023-24 and are introducing a minimum and maximum hourly rate that local authorities can receive for their maintained nursery schools to create a fairer distribution of the funding.
I want to talk about families. We know that childcare is a key concern, as ably raised by many hon. Members today. We recognise that cost of living pressures are affecting families across the country and we have been looking at a range of measures to directly support households. One of our key areas of support has been the 30 hours’ free childcare entitlement. It was introduced in 2017 and has helped countless working parents. Nearly 350,000 children were registered for a place in January 2022, which saved those families up to £6,000 per child per year. That is making a real difference. Our 2021 childcare and early years survey of parents found that 73% of parents reported having more money to spend since they started using the 30 hours and 38% thought that without those 30 hours, they would be working fewer hours. We also remain committed to that universal 15 hours of free early education, which is helping more than 1 million children this year.
Government support for childcare is not just for three to four-year-olds. In 2013, the coalition Government introduced 15 hours of free childcare for disadvantaged two-year-olds and in January 2022, 72% of eligible two-year-olds were registered for a free early education place and more than 1.2 million children have benefited since its introduction. I think I heard the hon. Member for Edinburgh West (Christine Jardine) say earlier that the take-up in Scotland was about 46%. Clearly, we want to do more and I urge all hon. Members to encourage all their constituents to take up places where possible. In September 2022, we also extended eligibility for the entitlement to children in households where no recourse to public funds applies.
On the low-income household point mentioned by my hon. Friend the Member for Leigh (James Grundy), we have introduced two things. The first is the holiday activity fund schemes, and the data that shows children using the scheme for the first time and saying that that is the first time they have accessed some kind of activity scheme in the holidays has been buoying. The second is family hubs, about which I am passionate and on which I worked before becoming a Member of Parliament. We are rolling them out to 75 local authorities in the most disadvantaged parts of the country. I have visited several of them and they are doing very good things.
My hon. Friend the Member for North Swindon and the hon. Member for Brentford and Isleworth mentioned another matter that is, again, dear to my heart: SEN. I see more of that when I go to nurseries, and when I talk to providers, they are worried about both the aftermath of the pandemic and having the right skillset to make sure they deliver for those children. We are training 5,000 early years staff to be special educational needs co-ordinators and I will also bring forward SEN reforms in the near future that will help with setting out what people can do. Recently, I was talking to Julian Grenier at Sheringham Nursery School and looking at some of its schemes, such as talking time, which will help with some of the speech and language challenges that have come out in the aftermath of the pandemic. It is an area that is very important to me.
It is crucial that as well as being affordable, childcare is easily accessible. We constantly monitor the sufficiency of childcare places and at the moment, local authorities report that they are fulfilling their duty to ensure sufficient childcare. However, we continue to monitor that carefully. I acknowledge that one of the things I hear a lot when I talk to providers is the challenge around recruitment and retention, and I am keen to focus on that.
My hon. Friend the Member for Stroud (Siobhan Baillie) also mentioned childminders. The majority of people that have come out of the system are childminders. I have been very privileged to shadow childminders and see the work that they do. Often, people do not realise that their outcomes are just as good as those of nurseries. They do a tremendous job and it is important to me to look at the reasons that they are leaving.
The majority of early years childcare places in England are provided by private, voluntary and independent group-based providers. I pay huge tribute to their work. The hon. Member for Upper Bann (Carla Lockhart) gave a very moving tribute to her children’s own childcare providers. I can see her smiling now at the work that they do. I reiterate my thanks to those in the sector. They work so hard day in, day out in challenging circumstances to ensure that they provide children with the best start in life.
I thank the hon. Member for Brentford and Isleworth for securing the debate. The early years sector is an integral part of our economy and education system, so my Department treats any changes to the system carefully. Our childcare offer is co-ordinated with other Departments to give parents a range of options, depending on whether they want to receive childcare in a formal, nursery-style setting or from a childminder in a home.
On that point, I think the Minister is starting to talk about one of the challenges: where money has been set aside for childcare, but has not been spent. She spoke earlier about the not-100% take up from those who are entitled. Since the scheme began to give parents 20% off their childcare costs, an average of £2 billion to £3 billion a year has gone unclaimed. Given that it started in 2017, we are talking about a possible £17 billion that could go into tackling these challenges with the cost of childcare. Before she sits down, what conversations has the Minister had with the Treasury about getting our £17 billion of tax that parents have paid into the system back, so we can put it into paying those who care for our children properly?
The hon. Lady will know that underspends in government do not sit there and pile up; there is not £17 billion in a pot somewhere that has not been used. It has gone into lots of things, whether that is increasing hourly rates or the massive overall increase to the education budget of £2 billion over the next two years alone.
I talk to the Treasury regularly about tax-free childcare. I agree that it is not used enough. Many parents could be benefiting and we want them to benefit. We started the childcare choices campaign last year. The uptake of tax-free childcare has actually been quite good. I think it is about 30% from memory, but I will go away and double-check the figures. Of course, we need to do more and, of course, I would love to see more parents use that.
Finally, I reassure all Members present that my Department continues to evaluate what more can be done to help parents access a childcare place that not only suits their working arrangements and family circumstances, but gives their children the best possible start in education. I look forward to working with the hon. Member for Brentford and Isleworth in the future to hear her further thoughts about making our childcare system the best it can be.

Commons ChamberI am delighted that my hon. Friend the Member for Mansfield (Ben Bradley) has secured this debate to cover the important topic of reopening school sports facilities. I know he has been a long-standing, passionate campaigner in this area and has been speaking about it ever since he came into Parliament. The wellbeing of children, both mental and physical, is a priority for this Government, and we know that schools have a critical role to play. Mental health and physical health are inextricably linked, and the value of participating in sport and doing regular exercise is well known—we all see that all the time. It is important that children understand that good physical health contributes to good mental wellbeing. Sport and physical activity are an essential part of a healthy and happy life, which benefits us as individuals and makes sure that we can stay healthy in our older age.
Sport also has the power to bring communities closer together, increasing engagement between different people and helping to tackle issues such as loneliness. I am passionate about community spaces and I welcome my hon. Friend’s comments on that. It is wonderful that members of the community can take part in different things on school premises, because we get a general sense of engagement and togetherness.
My hon. Friend the Member for Mansfield was talking about state schools, aided schools and academies. Does the Minister recognise that many independent schools recognise their responsibility to the wider community and have people coming to use their facilities? Does she further agree that Labour’s curmudgeonly plan to charge VAT on those schools might jeopardise that very community-minded spirit that many independent schools have?
I thank my right hon. Friend for that, and he is of course right in what he says; I have seen lots of examples of independent schools being real hubs in their communities and bringing lots of people together. I also have a personal viewpoint on this, because a lot of independent schools are specialist schools and are providing amazing provision to children with special educational needs—I have seen some of them in action.
We know that covid-19 restricted the amount of sport that schools could offer during and after the school day. It is important that we help not just to get things back on track, but to lay the groundwork for going further and increasing physical activity and participation in sport. The chief medical officers recommend that children should take part in 60 minutes of physical activity a day. The latest annual data from the “Active Lives Children and Young People” survey, released in December, has been encouraging. It shows that the proportion of children who are active has increased by 2.6% compared with the previous academic year, bringing activity levels back in line with the pre-pandemic numbers.
Fundamental to an active community is having sufficient sports facilities of the right quality. That is why the Government are investing £230 million between 2022 and 2025 in improving community sports facilities across all four home nations.
The Minister was making a point about children’s participation in sport, particularly in schools. Does she share my concern that over the past 10 years some 40,000 hours of physical education have been lost in secondary schools? Will she update the House on what her Department’s progress is in delivering the commitment the Prime Minister made to the Lionesses last year, after their spectacular win in the Euros, to have two hours of PE per week as a minimum in every school across the country and to involve Ofsted in inspecting sport in schools?
The Prime Minister and many other people in the Government are passionate about children’s access to PE. I will come on to some of the sport strategies we are looking at and set them out in further detail.
The Government also support physical activity and sport outside the school term. The £200 million a year we are spending on the holiday activities and food programme, which is delivered by local authorities in England, has been a tremendous way to increase access. Some of the figures I have looked at on children accessing holiday activities who have never done anything like that before are really quite heartwarming.
Alongside community facilities, facilities on school sites represent an important resource for pupils and their families. Although schools may need support with the logistics of opening up their facilities—my hon. Friend the Member for Mansfield spoke to some of them—the phase 3 funding we have set out will allow them to ensure that their facilities are more easily accessible to families, other community users and local clubs, while remaining secure. Since October 2019, the Department for Education has provided £11.7 million to schools to support them to make best use of their sports facilities beyond the core school day and to start to reopen them after the pandemic.
In phase 2 of the Opening School Facilities programme, over 280,000 young people were supported to take part in over 60 types of extracurricular sports and physical activities, including traditional sports such as football and tennis, and new activities such as BMX and skateboarding. The Department will also be providing further investment support to schools to open their sports facilities in the evening, at weekends and during the holidays by funding phase 3 of the programme with up to £57 million over three years. As well as providing practical support and advice, phase 3 will also support schools to create new partnerships with national governing bodies and local sport providers to broaden the extracurricular opportunities available to their pupils, as well as providing a benefit to the wider community.
With that, I would like to thank everyone who has taken part in today’s debate, and in particular my hon. Friend the Member for Mansfield, who I know will continue to press on this issue.
Before the Minister sits down, will she allow me to highlight a point about extracurricular sport? I am really grateful for the update, because I was not aware of the detail of the Opening School Facilities programme. It sounds really positive. I recently met the Schools Minister to talk about trying to get sportspeople into schools and into teaching. We spoke with my hon. Friend the Member for North Swindon (Justin Tomlinson) about the Professional Footballers Association and trying to get academy footballers into primary teaching. So often, it is the people with that experience who will then stay after school and run sports in communities. My hon. Friend gave examples of people who run the holiday activities fund programme because of their coaching background. I urge the Minister to have a look at that scheme, and to encourage the Department to bring it forward. Opportunities to get sportspeople into schools will really help us to deliver on that kind of provision as well.
I thank my hon. Friend. I would be delighted to look at that scheme and see what more we can do. The teachers I have met who come from a sporting background bring, as he says, so much enthusiasm to their role.

“Freedom is a fragile thing…it must be fought for and defended constantly by each generation”.
Ronald Reagan said those words in 1967. More than 50 years later, our generation is facing our own battle for freedom: the freedom to express our opinions and debate controversial ideas without fear or favour. Ironically, this is happening in our universities, which traditionally have been the very institutions that have challenged prevailing wisdom, from the effects of smoking to the theory of evolution and our understanding of climate change. That is why I am delighted to be here today to discuss the Higher Education (Freedom of Speech) Bill.
First, I thank my predecessors for all their work in taking the Bill through the House last year, and my ministerial colleagues for their efforts in the other place. This is a contentious subject matter, and I know they have spent many hours thoughtfully considering the points that have been raised on all sides throughout the Bill’s passage. I am pleased that, after discussions, noble peers have now agreed that there is an issue to address, as the noble Lord Collins of Highbury acknowledged on Report. I am grateful to peers for their careful consideration of the Bill.
Today, I ask my hon. Friends and hon. Members to consider the amendments made in the other place. I will address each set of amendments individually, beginning with the statutory tort, which provides a means by which individuals can seek redress through the courts if they believe that certain duties in the Bill have been breached. This measure will be critical to stimulating the cultural transformation that we need. I am grateful to Baroness Barran and Earl Howe for leading debate about the tort in the other place. In the end, the other place voted in favour of amendment 10 to remove the clause containing the tort from the Bill.
I assure the House that we heard very clearly the strength of feeling about the tort. Those feelings have rightly set the context for careful deliberation about the Government’s position now. I have spoken at length to leaders and academics in the higher education sector. I stand firm in my belief that the tort is an essential part of the Bill, and I disagree with its removal.
The Minister will forgive me if she is coming to this point, but as a Liberal I believe passionately in freedom of speech, as I believe does she. The clause to allow statutory tort was removed by a Conservative former Universities Minister in the other place, with cross-party support. Does she agree that, rather than supporting and encouraging free speech, we risk inhibiting it? Cash-strapped student unions may not invite particular speakers for fear of legal proceedings that they would not be able to defend. Does she agree that she is actually working counter to her own values and beliefs?
Having spoken to many academics and people in universities at the moment, I firmly disagree. They are the people who would like that sort of protection. They think it would give them a legal backstop to the duties that we are placing otherwise in the Bill. Let me reassure the hon. Lady that the Government do not want providers being taken to court without good reason and being forced to defend themselves against unmeritorious or vexatious claims. We do not expect that to happen. The tort has always been considered a backstop.
The vast majority of complaints should be resolved through the new, free-to-use Office for Students complaints scheme, or through the Office of the Independent Adjudicator for Higher Education. In practice, we expect its use to be relatively rare, but it is crucial because it will offer complainants an opportunity to bring a case where they feel that their complaint has not been resolved to their satisfaction by the OfS or the OIA. It will be useful on the rare occasions where a provider, for some reason, fails to comply with the recommendations made by the OfS or the OIA.
The problem with the tort clause is that it also applies to student unions and student associations, which were always free to invite people that they wish to invite along. Conservative clubs only invited Conservative MPs. They did not have free speech in the club per se; they were Conservative-minded and they did not necessarily invite Labour-minded people. But within the student union and the university as a whole, students were free to have clubs and societies that might be Labour clubs, Marxist clubs, further right clubs or whatever mix they wanted. That is enshrined in the Education Act 1994 and the judgment of Baldry v. Feintuck. The danger is that the tort affects those clubs and will have a chilling effect on student unions, which might say that it is easier for those clubs not to exist, and they will therefore fall out of regulation—
Order. If the hon. Gentleman wishes to make a speech, he should put his name in. That was not an intervention.
Respectively, I disagree with the hon. Gentleman. I do not think that would be the case. The Government are committed to strengthening the protection for lawful freedom of speech on campus, as set out in our manifesto. If providers fail in their duty to take steps to secure freedom of speech within the law, individuals who have suffered as a result should be able to secure real remedies, including by means of civil proceedings. For all those reasons, our position is that the tort should be reinstated in its original form for further consideration in the other place.
Amendment 3 was tabled in the other place by the noble Lord, Lord Collins of Highbury, and received support from all sides. It will prohibit higher education providers and their constituent colleges from entering into non-disclosure agreements with staff members, students and visiting speakers in relation to complaints of sexual misconduct, abuse or harassment or other forms of bullying or harassment. I believe that Members on both sides of the House will welcome the inclusion of this provision in the Bill. It can never be right to force a victim of sexual misconduct, bullying or harassment to remain silent, denying them the right to talk about what has happened to them even with their family or close friends. This does not come down to politics, in my view; it is about doing what is right.
I will not, as I have to make some progress.
It is impossible to understand the full extent of this practice—by definition, NDAs too often remain hidden from view—but a 2020 BBC investigation found that nearly a third of universities had used NDAs to deal with student complaints. I agree with those in the other place, who proposed and supported the amendment, that we cannot allow this practice to continue.
Many institutions have already signed up to a voluntary pledge rejecting the use of NDAs in such circumstances. That pledge was launched by the previous Minister for Higher and Further Education and now the Secretary of State for Science, Innovation and Technology, my right hon. Friend the Member for Chippenham (Michelle Donelan), together with Can’t Buy My Silence. However, many institutions have not done so, despite strong encouragement from the Government. This amendment builds on the strong foundation of the Government’s work in this area over the last year and brings a legislative means to end this abhorrent practice for good.
It is important to appreciate that this is not a total ban on the use of NDAs. There are some circumstances where an NDA is appropriate—for example, to protect intellectual property or commercially sensitive information —but as I said, using NDAs to silence victims of this type of conduct is entirely wrong. I therefore wholeheartedly support this amendment. Not only is it vital for the welfare and wellbeing of victims, but by enabling them to speak out and provide information to others about their experiences, it will extend protections to students and others on campus.
I will now speak to the group of amendments concerning the definition of freedom of speech. There was much debate in the other place about whether the Bill would benefit from a more expansive definition of freedom of speech, and peers subsequently agreed a number of Government amendments to that effect: amendments 1, 2, 4, 5, 8 and 9.
Amendment 4 amends the provision in new section A1(11) of the Higher Education and Research Act 2017, inserted by the Bill, which previously set out what freedom of speech in the Bill includes. The amendment refers to the freedom
“to impart ideas, opinions or information… by means of speech, writing or images (including in electronic form)”.
That wording is derived from article 10(1) of the European convention on human rights and is also used in the Bill of Rights Bill. There is also a reference to article 10(1) of the ECHR, as incorporated by the Human Rights Act 1998. The drafting is deliberate in reflecting that freedom of speech in the Bill has broader application than freedom of speech in article 10, because students’ unions are not public authorities and are not subject to the ECHR.
The other amendments are consequential on amendment 4. For example, where previously the Bill referred to “ideas or opinions” in certain provisions, to achieve consistency, those references need to be changed to “ideas, beliefs or views”. These consequential amendments do not change the meaning of the original drafting.
There are also minor and technical amendments made by the Government to the Bill. Amendments 6, 7 and 12 clarify that the term “members” in the Bill does not include a person who is a member solely because of having once been a student of a provider or constituent institution. The term “members” is intended to include those who are not technically staff but are closely involved in university life—in particular, members of the governing councils of universities and also retired academics who are emeritus professors.
However, it became apparent from debate in the other place that some universities and colleges treat their students as members for life—for example, the University of Cambridge. As a result, the Government tabled these amendments to clarify that alumni of providers and colleges are not covered by the Bill. It is not our intention that providers and colleges should have duties that extend so widely, even to people who have no current relationship with them other than as ex-students. These amendments do not affect the position where a current student’s freedom of speech is wrongly infringed, in so far as they may still make a complaint about that even after they have left university.
Finally, amendment 11 distinguishes between new functions imposed on the OfS by the Bill. It will amend the power in new section 69A(2) of the Higher Education and Research Act 2017, inserted by the Bill, so that it refers to “how to support” freedom of speech and academic freedom, rather than “the promotion” of these values. The original drafting replicates section 35 of the Higher Education and Research Act 2017 about identifying good practice relating to the promotion of equality of opportunity.
However, that wording might lead to confusion that this power relates to the new duty on providers and colleges to promote the importance of freedom of speech and academic freedom that is in new section A3 of the 2017 Act, inserted by clause 1 of the Bill. I can confirm that it does not. The OfS will have a duty under section 75 of the Higher Education and Research Act to give guidance on how to comply with the duty under section A3. There is no overlap with section 69A(2). Accordingly, section 69A(2) is different, providing the OfS with a general power to disseminate good practice and advice on how to support freedom of speech and academic freedom. The amendment makes that distinction clear.
I hope my words today have provided clarity and reassurance on the amendments made in the other place. Once again, I thank Members of the other place for the time and scrutiny they gave to the Bill. Our opinions on the statutory tort differ, though, as I still firmly believe it is an essential part of the Bill and an integral part of ensuring that freedom of speech is properly protected in our universities.
I thank all Members for their contributions and particularly eloquent representations. They have shown how important it is to the wellbeing of our society that we can agree to disagree, that we can debate controversial and unpopular ideas, and that we recognise that the only way to change people’s minds is to win arguments, not to silence them.
I have listened to the concerns about the tort. Those who speak about a chilling effect speak as if there is not already a chilling effect on campus. That is why we think it is such a vital legal backstop. The hon. Member for Warwick and Leamington (Matt Western) made the astonishing if not surprising claim that the Bill is not needed at all. He may wish to speak to his party colleague the noble Lord Collins of Highbury, who has said that, through the dialogue and discussions that he has had as the deputy Leader of the Opposition in the other place, he accepts the need for the Bill. I suggest that the hon. Gentleman has those discussions himself.
I am sure that Hansard will have recorded that when I used the word “otiose”, I was talking about the tort.

Commons ChamberAll children, no matter their special educational need or disability, deserve the right support to be able to succeed. We will be publishing a full response to the SEND and alternative provision Green Paper in an improvement plan early this year, and we continue to work closely with children, families and education, healthcare and local government sectors on this very important issue.
Today is Blue Monday, and I am sure that both you, Mr Speaker, and the Education Secretary will be pleased to know that, following our event last year, the band New Order and the charity CALM—the Campaign Against Living Miserably—have teamed up together today to urge people not to hold back from seeking help with their mental health if they need it. However, as we discussed at that event, too many children are facing unconscionable delays in getting assessed and in getting support. Too many children risk being damaged for life as a result, so will the Minister please get a move on and bring forward the response to the SEND review consultation? Children should not have to wait any longer.
I can assure the hon. Lady that we are working incredibly hard, and we will be publishing a response imminently. In the meantime, we are rolling out training on mental health to all schools across the country, and I am working very hard with my counterparts at the Department for Health and Social Care to make sure that, when we look at the proposals on SEND, they are brought fully into the picture as well.
Many parents in Oxfordshire are unhappy with the county council for a variety of reasons—from emails that are never answered, to education, health and care plans that come back with wrong child’s details, to long delays in receiving EHCPs. My hon. Friend will know that many parents want an EHCP because it has become the only way to get support for their children, though this might not have been necessary had they received support from the school at an earlier stage. What steps is she taking to address this?
My hon. Friend has raised this issue with me several time. One key part of the reforms set out in the SEND Green Paper will be clear standards about what help children with different SEND needs should be getting at school. That will give parents greater transparency and accountability regarding what their child should reasonably get, and also means that children will get the early help that my hon. Friend so rightly talks about.
The Minister will be aware that Devon’s children’s services have been failing for many years, with special educational needs a particular problem. Following the latest inspector’s damning report, the county council has belatedly appointed a new head of children’s services. Will the Minister make clear to the political leadership of Devon County Council that if things do not improve quickly, she will have no hesitation in stripping Devon of its responsibility for children’s services?
We work with all areas that are struggling to provide SEND services through our regions group work, our delivering better value programmes, and our safety valve programmes. I will, of course, look at the issue carefully, and we always step in and act when we need to.
One of the best ways in which young people with SEND can be supported is by remaining in the local area to be educated. That is why I am delighted that, thanks to a significant amount of Government investment, Middlehurst School, which is currently sitting empty, is now being built to create 80 new SEND school places. Will my hon. Friend congratulate Councillor Janine Bridges from Stoke-on-Trent City Council on that amazing work, and will she pledge to come and open that school when it is ready, hopefully at the end of this year?
I absolutely commend the work of Councillor Janine Bridges. It sounds as if she is doing a tremendous job to increase the number of places for SEND children. I would also be delighted to come and see whether I can open the school.
As set out in our special educational needs and disabilities and alternative provision Green Paper published in March, our ambitious alternative provision reforms will keep all children in AP with the right support in the right setting at the right time. Our reforms will enable children with medical needs or behaviour that present barriers to learning to have the support, skills and confidence they need to thrive.
I am grateful to my hon. Friend for that answer. Many of the children I have met in the youth justice system have been excluded from mainstream schools and instead sent to alternative provision. Standards are often very good, but sadly that is far from always the case. Indeed, the Youth Justice Board, on which I used to sit, said:
“An improvement in standards and practice across alternative provision is needed.”
What action is the Minister taking to ensure that alternative provision is not a dumping ground for difficult pupils who mainstream schools want to exclude, and that, by contrast, there is always high-quality teaching and welfare support in AP?
My hon. Friend is a passionate believer in youth justice—in fact, I think that is what we spoke about the first time we met—and he is right to be concerned about this area. There are some great AP settings—I was talking to Mark Vickers of Olive Academies recently—but we know that some settings are delivering very poor outcomes for young people. I am really excited about our proposals on AP. I think they will be transformational and I am happy to discuss them further with my hon. Friend.
Funding for alternative provision for children who are unwell peters out after the age of 16. There was no mention of colleges in last November’s autumn statement. I spoke to a constituent in Devon this morning whose son has been diagnosed with Hodgkin’s lymphoma and is unable to get the online tuition he needs from our local college. When will colleges receive additional revenue funding so they are able to afford alternative provision for children diagnosed with illnesses like my constituent?
As part of the reforms we are setting out, we will develop a bespoke national alternative framework that will include looking at standards and sustainable post-16 destinations. I am happy to discuss that further with the hon. Gentleman once we publish our proposals.
Maintained nursery schools make an invaluable contribution to improving the lives of disadvantaged children. We are investing an additional £10 million in their supplementary funding from 2023-24, taking the total to approximately £70 million. We are reforming the distribution of the funding to make it fairer, ensuring that all authorities with maintained nursery schools receive supplementary funding.
I warmly welcome that extra funding, because it means for the first time that maintained nursery schools in Barnet will get a share of the supplementary funding. Will the Minister join me in welcoming that funding and express her strong support for the maintained nursery school sector in the future?
My right hon. Friend has consistently and passionately campaigned for the maintained nursery school sector. I agree that it is doing an excellent job, not only in supporting some of the most disadvantaged children, but in sharing expertise and knowledge with other providers.
Sadly, Midford Road Nursery in my constituency was forced to close its doors. Staff shortages were the major reason. Many nurseries in Bath face similar problems, and parents struggle to find alternatives. What advice would the Minister give to parents in Bath who are struggling to find a nursery?
We have increased the funding set out for early years by about half a billion pounds since 2020-21. I agree that workforce is an issue; we are looking at recruitment and retention very carefully and will be setting out proposals as and when we can.
Order. May I suggest that the hon. Gentleman knows this is topical questions? You cannot just go on and on. We have to get through the questions for everyone’s sake.
I commend Hayley for the work she does. Access to educational psychologists is of paramount importance so that people can get an early diagnosis. We are funding an additional 600 educational psychologists —200 in 2023 and 400 in 2024.
Thank you, Mr Speaker. There was no answer there, even though the schools Minister said we would see this data last year.
Conservative Members have described their childcare policy as “crazy” and “unnecessarily expensive”, and said that they should “get on” with reforming it. I agree, which is why the next Labour Government will deliver a modern childcare system from the end of parental leave to the end of primary school. If even the Secretary of State’s own colleagues can see the case for change, why can’t she?
The hon. Lady will find that when Labour was in power for 13 years it did nothing on this issue and that it was the Conservative Government who expanded the offer for two, three and four-year-olds for parents. I would love to see the costings of her proposals because I think she is proposing yet more pie in the sky for parents. However, we take this issue seriously and we are committed to increasing the flexibility and affordability of childcare for parents.
I hope that the 9,000 children will see progress. Not only have we increased the overall funding for SEND by about 50% since 2019, but we are increasing the number of specialist school places. In the reforms, we will be setting out national standards, which I hope will also improve their educational experience.
I can tell the hon. Lady that the high needs funding for Barnsley has increased by 12% year on year for 2023-24 and it will be more than £40 million in total. It will also receive £7 million for high needs provision capital from 2023-25 to increase the number of places.
I am really exercised about this issue. I speak to parents of children with SEND all the time, and I do think that they find the experience very adversarial. I will be setting out more details in the implementation strategy shortly, but this is something that I care very passionately about.
The current national school breakfast programme reaches only one quarter of the children living in areas with high levels of deprivation in England. Labour has set out our universal free breakfast offer, which will mean that no child will be too hungry to learn. When will the Government join the Labour party in that commitment?
I thank my right hon. Friend for his collaborative approach in the meeting that we had last week. Absolutely, early identification is key, and we have been looking very carefully at that and at teaching training in the implementation plan that I will be setting out shortly.
On new year’s eve, the care community lost a highly respected dear friend and true advocate. Ian Dickson spent his entire life making a difference to children in care and urging Governments to listen to them. The care review does not have all the answers, so will the Minister please implement the recommendations of the pioneering care experienced conference, in which Ian played a leading role?
I pay tribute to Ian’s work. I would love to look at that in more detail and speak to the hon. Lady further about what we can take forward.
We all visit many schools, and the latest for me was Chilton Academy where I talked about its Go Well support. We all talk about funding, but the biggest thing about funding is not just the amount, but its visibility and extended timelines. Can the Minister please explain what can be done to make sure that the schools know earlier and for longer what money they will have available?
I do indeed congratulate that team; that is quite a hard thing to do and it is brilliant that they have been able to get that recommendation.
The Government take the safety of schools very seriously, as the Minister said in response to an earlier question, so will Ministers reconsider mandating the fitting of sprinklers in new-build schools to minimise the risk posed by fires to buildings, equipment, pupils’ school work and people?

It is a pleasure to serve under your chairmanship, Mr Hosie. I thank everybody for coming to this end-of-term debate, and for their continued presence in all of the debates we have had on this important subject. I congratulate the hon. Member for Slough (Mr Dhesi) on securing the debate today.
I know how crucial early years are for children’s development and for their parents to get into work. I also recognise that this is a critical time for the sector and I put on the record my thanks for the dedication of the staff in settings across the country, who are working tirelessly to give our children the best start in life.
I have been privileged to go on so many fantastic visits in my time in this role. Just this week, I went to see a childminder in action and was reminded of the brilliant developmental work that they do. Last week, I was with my hon. Friend the Member for Ruislip, Northwood and Pinner (David Simmonds) at Harefield Infant School, speaking to the headteachers there about the way they work with the local children’s centre. It was excellent to see that provision in place. I also recognise the quality of their work. Some 97% of our early years settings are good or outstanding, something of which we can be very proud. That comes down to the dedication of all the workers in those settings.
To give our children the best start in life, we have invested more than £3.5 billion in each of the last three years on our early education entitlements for two to four-year-old children and more and wider offers. We know that the sector is facing economic challenges, similar to the challenges that people are facing up and down the country. We have already announced additional funding of £160 million in 2022-23, £180 million in 2023-24 and £170 million in 2024-25, compared with the 2021-22 financial year. I assure everyone that improving the cost, choice and availability of childcare for working parents is very important to this Government and very important to me.
As well as providing support for families, the sector is facing difficult challenges. That is why we want to give providers help to continue what they do best—educating and developing young children. One of the things we are doing is making sure that we are investing in the workforce.
I am not entirely familiar with that figure. Perhaps we can discuss it after the debate and I can come back to him with a fuller answer. As I have said, over the last five years, we have spent £20 billion on early years. Not only are we supporting the sector with the money that I have set out today but we are also supporting it with energy support. I know from talking to lots of people in the industry that one of the things they are worried about is energy bills. We have set out significant relief over the winter to help with that issue.
Funding increases are taking place across England. In the constituency of the hon. Member for Slough, I am glad to say that the hourly funding rate for two-year-olds will increase by 62p to £6.87 an hour, and the rate for three and four-year-olds will increase by 6p to £6.27. We have also already announced an additional £10 million for maintained nursery schools supplementary funding from 2023-24. We are introducing a minimum and maximum hourly rate that a local authority can receive for their maintained nursery schools supplementary funding, to create a fairer distribution of that funding. The minimum rate will be set at £3.80 in 2023-24. Slough is one of the local authorities that will benefit from this new minimum hourly rate.
As well as increasing our support to providers, we also want families to benefit from the childcare support they are entitled to, saving them money and helping to give their children the best start in life. We know that childcare is a key concern for parents and recognise that cost of living pressures are impacting families across the country, which is why we are committed to improving and refining the offers that we have in place. We have also put many direct cost of living measures in place, from furlough to energy support relief, and direct family household support this year as well.
One of our key areas of support is the 30 hours free childcare entitlement, a Conservative commitment introduced in 2017, which has helped hundreds of thousands of working parents get back into the labour market, with nearly 350,000 children registered for a place this year. The entitlement saves those families up to £6,000 per child per year. That offer of 30 hours of free childcare is making a real difference to the lives of eligible working families. In our 2021 childcare and early years survey of parents we found that 73% of parents reported having more money to spend since they used their 30 hours and 38% thought that without the 30 hours they would be working fewer hours.
I acknowledge the huge benefit that has for parents, especially those getting back into work, but we have a real issue with providers, because the gap between the funding and the cost to providers is around £2 per hour for those voucher places. Nurseries in Leeds have closed because of that funding gap and others are under severe pressure. What will the Minister do to ensure that those nurseries can survive and thrive, not just at a price to the provider because the vouchers are in place?
As of last year, we had set out half a billion pounds of extra funding to go into the sector. We have also set up energy support, as I mentioned, which will help with the increased costs, which we know lots of providers are facing this winter. Of course I will continue to look at everything that I can do in this area and I am committed to ensuring we can make this work.
The last year for which we have figures available shows that a total of £62 million in unspent funds was ringfenced within the dedicated schools grant for early years. That is money that the Government have made available that cannot be spent because the funding formula means that a council, for example, cannot reallocate it to increase the funding rate to its local settings and it can be spent only in accordance with the constraints of the national funding formula. While that would not go all the way towards bridging the gap, will the Minister consider looking again at the funding formula regulations, so that local discretion could allow funds that are already allocated to be redistributed in a way that might help address some of the policy issues that she has outlined?
As ever, my hon. Friend makes a detailed and interesting point that I will take away. I will look at the underspend and see what can be done, and I will come back to him as soon as I can.
In addition to the 30 hours, we remain committed to continuing the universal 15 hours of free early education, which this year helped over 1 million children get a positive start to their education.
Government support for childcare is not limited to three and four-year-olds. In 2013, the Conservative- led coalition Government introduced 15 hours of free childcare for disadvantaged two-year-olds. Some 72% of disadvantaged two-year-olds were registered for a free early education place in January 2022, and over 1.2 million children have benefited since its introduction.
Following a consultation in May 2022, we extended eligibility for this entitlement to children in no recourse to public fund households; that was first implemented in September this year. I urge all hon. Members to encourage families from lower income backgrounds to take up that generous offer. Children who take it up do better at school and it gives them vital skills that set them up for life.
I recognise that childcare must be accessible to parents as well as affordable. That is why the Government continue to monitor the sufficiency of childcare to ensure that childcare places are easily available. The key measure of sufficiency is whether the supply of available places is sufficient to meet the requirements of parents and children. Ofsted data shows that the number of places offered by providers in the early years register has remained broadly stable since 2015.
Under section 6 of the Childcare Act 2006, local authorities are responsible for ensuring
“that the provision of childcare…is sufficient to meet the requirements of parents in their area”.
The Department has regular contact with each local authority in England, and if a local authority raises concerns about sufficiency issues we will, of course, support it with any specific requirements. We are currently seeking to procure a contract that will provide reactive and proactive support to local authorities in fulfilling their childcare sufficiency duties.
The majority of early years childcare places— 68% in England—are provided by private, voluntary and independent group-based providers who continue to provide high quality childcare for families. The number of places, as I said, has remained broadly stable, and 96% of those early years childcare providers are rated good or outstanding. That is testimony to the many people who work in that brilliant sector.
Once again, I thank the hon. Member for Slough for securing the debate. The early years sector is an integral part of our economy and education, so my Department treats any changes to the system carefully. Our childcare offer is co-ordinated with other Departments to allow parents a range of options, depending on whether they want their children to receive childcare in a formal, nursery-style setting or from a childminder in a home.
Finally, I reassure the hon. Gentleman, and all hon. Members present, that my Department continues to evaluate what more can be done to help parents access a childcare place that not only suits their working arrangements or family circumstances but gives their child a positive start to their education. I look forward to working with him in future to hear his further thoughts on making our childcare system the best it can be.
