I beg to move,

That the Committee has considered the draft Police and Criminal Evidence Act 1984 (Codes of Practice) (Revision of Code A) Order 2022.

It is a pleasure, as always, to serve under your chairmanship, Mrs Latham. The order was laid in draft before Parliament on 13 October and will bring into effect a revised code of practice issued under section 66 of the Police and Criminal Evidence Act 1984. This is PACE code A, which governs the exercise by police officers of powers to stop and search a person without first arresting them.

For England and Wales, PACE sets out the core powers of the police to prevent, detect and investigate crime. The exercise of those powers is subject to codes of practice, or PACE codes, which the Secretary of State is required to issue and which put in place important procedural safeguards.

We propose to amend PACE code A, on police powers to stop and search individuals subject to serious violence reduction orders, which I shall refer to henceforth as SVROs. Inserted into the sentencing code by the Police, Crime, Sentencing and Courts Act 2022, SVROs are civil orders that give the police powers to stop and search individuals convicted of a knife offence where the court makes an SVRO. To be clear, an SVRO is handed down by a court only after someone has been convicted of a knife crime.

The Government are determined to crack down on knife crime, which is why SVROs were introduced. An SVRO allows the police to search a person who is the subject of such an order without suspicion, but I re-emphasise to the Committee that they apply only to people who have been convicted of a knife offence when the court has made an order in the interests of public safety. They are designed to deter habitual knife carriers from reoffending, as well as to protect the public, who might otherwise be the victims of knife crime and knife attacks.

It is vital that we build an understanding of how SVROs work in practice, so they will be piloted in four areas: the West Midlands, Merseyside, Sussex and Thames Valley police force areas. The pilot will be independently evaluated before a decision is made about whether to roll the powers out. I should pause to pay tribute to my right hon. Friend the Member for North West Hampshire who, as Policing Minister, did a huge amount of work to develop this concept. I see that serendipitously he is a member of the Committee today.

We have proposed the revisions to PACE code A to ensure proper guidance and safeguards on the use of the new stop-and-search power during the pilot. We ran a statutory consultation over six weeks on the proposed revisions, which introduce a new temporary annex G that deals with searches in relation to SVROs. In particular, the new annex highlights that the power does not require officers to have prior reasonable grounds but that its use must not be based on prejudice, that searches can be conducted only on those subject to an SVRO—to emphasise the point again, that means people who have been convicted of a knife crime and in respect of whom the court has decided that an SVRO is appropriate—and that officers should seek to confirm the identity of the individual to make sure they do not search somebody as a result of mistaken identity.

The revision to the code outlines that the use of the power, like all other stop-and-search powers, is discretionary. Officers are not obliged or compelled to search the person, but they are expected to use their judgment when choosing when to search using the SVRO. The annex will apply for 24 months plus an additional six-month transition period, although if we can draw conclusions sooner, which I hope we might be able to, we might come back to the House and shorten the pilot.

The Minister is touching on the point that I wanted to raise with him. Given the issues of disproportionality, such as in respect of ethnicity and gender, would he consider it useful to have a review at the six-month point? Two years is quite a long time for problems to develop; what are his thoughts on having a six-month point at which to look at the data?

I thank the hon. Lady for her question. Six months is quite a short time: we have to wait for the court to make the orders—this will apply only when the orders are made—and then we will have to wait to see what happens on the streets thereafter. My instinctive view is that 24 months is a long time and it would be good to draw lessons sooner, in part in case any issues such as those she mentioned arise, and in part because if this measure does work, as I hope and expect it will, we want to roll it out as quickly as possible. I do not want to commit to a six-month review, because that is a short period, but I do indicate flexibility: if we can draw conclusions faster than 24 months, we definitely should do, for the two different reasons the hon. Lady and I have mentioned.

The amendments to the code also outline the territorial extent of the use of the powers, which is across all of England and Wales. However, the intention at first is that the SVROs will be issued only in the four pilot areas that I mentioned. Of course, if someone receives an SVRO in one of the four areas but goes somewhere else, clearly the order will still apply if they leave the particular area concerned.

On the question of disproportionality, which the hon. Member for Wirral West touched on a moment ago, and its impact on particular communities, our aim is that the orders will enable police to take a more targeted approach, because by definition they will be using the powers only in relation to people who have been convicted of a knife offence and where the court has deemed it necessary to make an SVRO. That is very targeted.

I served for 12 years as a magistrate, before coming to this place, and I was involved in imposing other types of civil orders, such as antisocial behaviour orders. There are strict criteria. Will the Minister say anything—in Committee or subsequently—about the factors that a court will take into consideration when deciding whether to impose an SVRO? That might provide reassurance to any people with doubts. My experience is that courts take such matters extremely seriously before imposing an order of this type.

I thank my hon. Friend for his intervention and pay tribute to his work over so many years as a magistrate, and as a director of Her Majesty’s Prison and Probation Service, if memory serves me correctly. His experience is valuable in debates such as this. It is for the court to decide whether to give an SVRO following conviction, based on its assessment of the risk that the individual poses to the community. If the court is concerned that the risk to the community is ongoing because someone is thought to be a habitual knife-carrier or otherwise a risk to the public, it has the option of issuing an SVRO.

This is an important measure because knife crime affects many individuals, many parts of the country and many communities. Typically, a knife is used in between 200 and 300 homicides per year, significantly contributing to the homicide rate, and many serious injuries are caused by knives. Both the shadow Minister and I have tragically seen that in our own borough of Croydon, sadly on a rather too frequent basis. I hope that the SVROs, if successful and rolled out, will help to stop such tragedies.

The revised code of practice was laid before Parliament with the draft order and an explanatory memorandum. Subject to the order being approved by both Houses, the revised code will come into force on 17 January 2023. That date, I should highlight, is not a fixed date for the commencement of the SVRO pilot—it will not start on that day. We are looking to ensure that all the relevant secondary legislation is in place so that the pilot can commence relatively early in 2023.

I feel strongly that this is an extremely important set of powers that will enable the police, on a very targeted basis, to search people who have a history of carrying knives. That will protect our community, and in particular it will protect communities who may be searched disproportionately, because they are, sadly, also disproportionately victims of these offences. It is to protect that community and others that we are introducing the measures. I commend the order to the Committee.

I thank the shadow Minister—my constituency neighbour—for the support of the Opposition, or the lack of opposition, that she offered. She asked about knife crime prevention orders, the pilot for which is concluding shortly in a number of force areas, including that of the Metropolitan police. It was delayed somewhat because of covid, as I am sure Members will understand. When it concludes the pilot will be evaluated and, if it works, rolled out more widely.

It is worth mentioning that knife crime prevention orders are only one element of our work against knife crime, which, as recorded by the police, has dropped about 10% in recent years. Chief constables are directing many of the extra officers—so far about 15,000—towards fighting knife crime. We have a number of initiatives designed to do that, including violence reduction units, the grip policing programme, which targets knife crime hotspots, and other initiatives. Collectively, they are receiving £130 million of funding this year. There is, then, a lot of work going on in respect of knife crime, and I again pay tribute to my predecessor but three, my right hon. Friend the Member for North West Hampshire, for initiating those programmes. They are beginning to work.

On the question about territorial application and what happens outside the four pilot areas, we would expect police forces in the four pilot areas to share information with other force areas in case a person turns up there. The vehicle for doing that is most likely to be the police national computer, which holds data of that kind.

The shadow Minister asked about disproportionality, which comes up a lot. We do not have time to debate it exhaustively, but I will say that young black people are 24 times more likely to be murdered using a knife than those from other communities. That community has a disproportionate number of victims and it is with their safety particularly in mind that we are trying to fight knife crime. When evaluating questions of disproportionality, it is also important to consider the geographical areas where knife crime occurs, because it is not spread evenly around the country.

We will evaluate the pilot carefully. As the shadow Minister suggested, there is an independent evaluator called Ecorys, which will be gathering the data necessary to assess the impact of the orders viewed in the round. Once we have considered that, we will lay a report before Parliament so that it can consider and debate its findings and reach a view. I hope I have addressed the shadow Minister’s questions.

This is an important initiative. It is not a silver bullet—it will not fix knife crime on its own—but it is an important part of the Government’s work to fighting this terrible type of crime that is taking so many young lives on our streets.

Equipment Theft (Prevention) Bill

It is a genuine pleasure to follow the hon. Member for Milton Keynes North (Ben Everitt), who has shared some of his insight and expertise, having clearly spent a great deal of time working on a farm in a previous life—I am curious about the notion of Fabergé egg farms and the potential for expansion there. In all sincerity, I congratulate the hon. Member for Buckingham (Greg Smith) on bringing forward this private Member’s Bill and on comprehensively and convincingly setting out the case for it today.

Having considered the hon. Gentleman’s Bill and having listened carefully to his arguments, the Opposition are inclined to agree that his proposals would have a strong impact on mitigating against quad bike and all-terrain vehicle theft. That form of criminality has blighted rural and more urban communities for too long, either because of the initial theft or the illicit and antisocial use of such vehicles thereafter in constituencies across the UK.

As outlined, the Bill seeks to mandate the fitting of forensic markings and an immobiliser on all quad bikes and all-terrain vehicles sold in the UK, which would solve a specific problem. If enacted, the Bill provides the scope for those measures to be expanded further. It would be a welcome tool to support the police in deterring such thefts, finding stolen goods and supporting agricultural and land workers who need that kit to do their jobs and undertake the incredibly valued work that has been discussed.

Rural crime has been a priority. My hon. Friend the Member for Croydon Central (Sarah Jones), who is a fellow shadow Home Affairs Minister with responsibility for policing, has visited a number of rural crime initiatives, such as Operation Hawkeye in Northumberland, where efforts to disrupt poaching recovered £850,000-worth of property and arrested 65 people. From my experience of my Halifax constituency, which takes in urban and rural areas, quad bike and all-terrain vehicle theft and subsequent misuse is a massive and sustained challenge.

Last month, I was frustrated to hear that Todmorden junior football club, just down the Calder valley, was subject to a serious act of vandalism. One of its pitches was left badly scarred and unplayable by someone repeatedly driving a quad bike over it. Louise Leeming, the club’s welfare officer, said:

“They’ve completely trashed it, you can’t play on it. The council spent an absolute fortune repairing it and they”—

the vandals—

have just destroyed it.”

At a time when council funding is, frankly, being decimated, it is reprehensible that an individual would flagrantly seek to damage a much-needed facility for local children.

That is just the tip of the iceberg, however. Locally, in October, as part of Operation Heelfield, officers executed a section 26 warrant to arrest a Halifax man on suspicion of burglary after a recently stolen Yamaha Kodiak quad bike was found in his garage. In March, two quad bikes were seized by police after two males, who had been involved in using them antisocially, had abandoned them. That formed part of Operation Hedgeson, which was carried out by the Halifax neighbourhood policing team to pursue, catch and convict those responsible for causing a nuisance in our communities through their antisocial and dangerous behaviour on and off the roads with such quad bikes and ATVs.

Unfortunately, such stories are not surprising and occur far too often. According to statistics released by NFU Mutual, in 2021, West Yorkshire had the third-largest number of quad bike thefts in the country. As the hon. Gentleman said, estimates suggest that nationwide, between 900 and 1,200 quad bikes are stolen every year, and many end up circulating back on to the market in some way. An NFU Mutual crime report estimated that in 2021, rural theft cost the UK £40.5 million.

I am sure that hon. Members will join me in paying tribute to our local policing teams, who work incredibly hard to try to get ahead of the criminals in getting a grip on and tackling this problem, but they simply do not have the requisite resources or toolkit to completely clamp down on such crime. The Bill, if introduced, would be a formidable starting point, but there are no two ways about it: the underfunding and under-resourcing of our police forces have undermined their capabilities for more than a decade. Analysis carried out by the Labour party, which studied the budgets of all 43 police forces in England and Wales, found that, in 2021, police budgets were £1.6 billion down in real terms on when the Conservatives came to power in 2010. In August this year, the National Police Chiefs’ Council said in a statement that crime detection and charge rates had dropped following austerity measures and a fall in police numbers since 2010. Its spokesperson said:

“Detection and charge rates for a range of crimes have fallen over the past five years.”

The shadow Minister is talking about policing figures and theft. Would she like to join me in welcoming the fact that, since March 2010—when Labour left office—theft figures have fallen by 46%, according to the crime survey for England and Wales, from 4.99 million theft offences to 2.69 million?

I would be really interested to see the details of those figures. I am sorry to say that detection rates, charge rates and prosecution rates are all going in the wrong direction under this Government. I gave a quote from the National Police Chiefs’ Council. If the Minister wants to take that up with the council, he can certainly do that. Its spokesperson said:

“Detection and charge rates for a range of crimes have fallen over the past five years…This has been impacted by austerity and the loss of thousands of police officers and staff, increasing complexity of policing and crime, growing demand related to mental ill health and impact of backlogs in the court system.”

I am grateful to the shadow Minister for giving way again. I suppose she will not get many interventions from her own side, looking at the empty Opposition Benches, so I am happy to fill the gap. She mentioned police officer numbers. Would she like to join me in welcoming the fact that, come March next year—just four months’ time—when the police uplift programme is completed and 20,000 extra officers have been recruited, we will have about 149,000 police officers, which is more than at any time in the country’s history?

I thank Members on this side of the House for joining us today—the Benches opposite are disappointingly empty, I must say—to discuss this extremely important Bill. Let me begin by congratulating, strongly and warmly, my hon. Friend the Member for Buckingham (Greg Smith) on the eloquent way in which he presented it and on the persistent manner in which he developed it, over a long period—indeed, as some Members have pointed out, during the time spent by several of my predecessors in this role. He has made a compelling case for it today, and I can confirm straightaway that the Government fully support it. We will do all we can do ensure that it is on the statute book as quickly as possible, and is then implemented in full.

We believe that the Bill will provide an important additional tool to help the police to drive down crime, but of course this is by no means the only action we are taking in that regard. As I said earlier in an intervention on the shadow Minister, we are on track to recruit an extra 20,000 police officers by March next year—in just a few months’ time—when we will have about 149,000, a record number. Never in our country’s history will we have seen more police officers serving our constituents. As I also said earlier, the crime of theft has fallen by 46% since Labour left office. That is a track record of which I think Conservative Members, and the Government more widely, can be extremely proud.

This is a well-constructed Bill. It covers the theft of agricultural ATVs and equipment but also, potentially, wider categories, as a number of Members have pointed out. We expect it to lead to a significant decrease in the theft of such vehicles and equipment, as a result of, for instance, the requirement for immobilisers to be installed in newly sold ATVs and the requirement for forensic markings to be made standard. Those measures will make it much harder for criminals to sell on stolen material, and we believe they will serve as a strong deterrent.

As we have heard during the debate, the theft of agricultural vehicles from farmers can cause severe disruption to their work—work that is important not only to them, their families and their livelihoods but to the whole country, because it feeds us, our families and our constituents as well. It is therefore essential to ensure that they are protected. I was pleased to hear my hon. Friend the Member for Buckingham describe the widespread support that the Bill has received from interested parties, including the National Farmers Union and NFU Mutual.

The principle of the Bill is very important. The Government expect manufacturers to play their full part in protecting items from theft. Unfortunately, my predecessors did not have as much assistance as they would have wanted from parts of the manufacturing sector, which is why the Bill is so important.

The Bill will help to mitigate the significant effects felt by the agricultural community. As we have heard, about 900 quad bikes and all-terrain vehicles are stolen every year, which is simply unacceptable. NFU Mutual’s 2022 rural crime report said that the total cost of insurance claims due to the theft of agricultural vehicles—of course, that includes more than just ATVs—last year was £9.1 million. It is therefore extremely important that we take action in this area.

My hon. Friend said in his excellent speech that despite the technological advancements made across the ATV market, the inclusion of basic security features such as those that we have discussed has been much slower, despite the exhortations of some of my predecessors. The fitting of immobilisers and forensic markings as standard is an inexpensive and straightforward measure. We have assessed the cost of those two things and it is very reasonable at under £200 per machine, which is a small fraction of the typical cost of such machines. That modest cost is far outweighed by the benefits of reducing the thefts that we are tragically seeing.

I would like to spend a moment talking to some of the points raised in the various excellent speeches made by Government Members. I should say that the shadow Minister’s speech was excellent as well, apart from the slightly incomplete comments on crime, which has of course been going down, as the crime survey for England and Wales points out, to say nothing of the record police numbers that we will soon receive.

My hon. Friend the Member for Loughborough (Jane Hunt) talked about expanding the Bill’s provisions not just to other agricultural equipment but to other equipment used by tradespeople, builders, craftsmen and so on. My hon. Friend the Member for Hastings and Rye (Sally-Ann Hart) also made that point eloquently, as did my hon. Friends the Members for Gedling (Tom Randall) and for Clwyd South (Simon Baynes).

I draw the House’s attention to clause 1(2), which sets out the kind of equipment that might be subject to the provisions that we have been discussing. In subsection (2)(a), we have mechanically propelled vehicles for use off-road. Subsection (2)(b) talks about

“other equipment designed or adapted primarily for use in agricultural or commercial activities.”

Of course, working as a builder or tradesperson would qualify as commercial activity. It will be open to the Secretary of State to make regulations in due course covering not just agricultural vehicles, all-terrain vehicles and so on, but the equipment used by builders and tradespeople that hon. Members, including my hon. Friend the Member for Southend West (Anna Firth), have talked about.

Having heard what hon. Members said, what I can take back to the Department is that we should be looking at making regulations in those areas as well, certainly at some point. We may start with ATVs and agricultural vehicles and then move on. Those points were extremely well made, and they have certainly been heard by me and the Department.

A number of hon. Members made other good points, not least my hon. Friends the Members for Milton Keynes North (Ben Everitt)—he spoke second from the Back Benches—and for Southend West. There was also an intervention from my right hon. Friend the Member for East Yorkshire (Sir Greg Knight)—who I do not think is in his place at the moment—about recording and ensuring that proper databases hold information on serial numbers and so on.

Again, I draw the House’s attention to clause 2, in particular subsections (2) and (3). The regulations that the Secretary of State can make may specify the kind of information that must be recorded. Subsection (2)(c) makes it clear that that includes the markings with a unique identifier. Subsection (3) specifies not just when the information is recorded and how long it must be kept, but the form in which it must be kept. Reference was made to storing that information online, so that it survives even if the business does not or it moves on. Subsection (3)(c) is very specific that that may include an online system—that is on line 25 of page 2 of the Bill.

Having listened to what Members have said today, I can say that making sure that the regulations also specify online information storage is a particularly important point. A few points have come out of this debate that will, genuinely, influence and change the way that we think about the regulations implementing the Bill once it becomes law, which I hope will happen as quickly as possible.

I also thank my hon. Friends the Member for Barrow and Furness (Simon Fell) and the Member for Leigh (James Grundy)—who talked about his family farm, the Grundy farm—for their extremely vivid descriptions of the impact that these crimes have on rural communities.

This is an extremely well-constructed piece of legislation. It clearly commands the support of everyone who has spoken on it and of the Opposition. I thank the shadow Minister for expressing her support for the Bill. Most of all, Mr Deputy Speaker, I wish to conclude by thanking, once again, my hon. Friend the Member for Buckingham for the work that he has done in developing the Bill so carefully and so thoughtfully, through so many different Ministers in recent months. He is doing the House, his constituents and the whole country a great service by bringing this Bill forward, and I put on record my thanks to him for everything that he has done.

Let me start by thanking the hon. Member for Brent Central (Dawn Butler) for her question. The report written by Nazir Afzal OBE makes for deeply troubling reading. The behaviour uncovered is totally unacceptable. The London fire commissioner, Andy Roe, commissioned this review due to his significant concerns about the culture in his own service. The review also followed the tragic suicide of Jaden Matthew Francois-Esprit, a trainee firefighter. I know that colleagues will share my sadness and shock at the testimony of those who shared their experiences, as outlined in the review. I pay tribute to them for their courage.

I wish to assure the House that the Government have taken, and continue to drive, action in this area. Through the introduction of the independent inspection of fire and rescue services, we have highlighted issues with the culture in the fire service, and it is clear that these are not confined to the London Fire Brigade. That is why we published the fire reform White Paper in May, which set out proposals to reform the way that fire services support and value their people. At the heart of the White Paper are plans to improve culture and professionalism, and put ethics at the heart of the service.

Furthermore, the Government have funded a number of important change programmes in the fire sector. We have supported the creation of a new code of ethics for fire and rescue services, setting out clear national expectations for standards of behaviour. The fire standards board, which the Home Office funds, has produced a fire standards code to support the code of ethics, as well as a specific safeguarding standard, supported by guidance from the National Fire Chiefs Council. It will shortly publish new fire standards on leadership, addressing issues such as those raised by this deeply disturbing report.

I welcome the fact that the London fire commissioner has committed to addressing and implementing all 23 recommendations in full and note that the National Fire Chiefs Council has also committed to considering the report carefully. Through the White Paper and otherwise, the Government will continue to press to eliminate the appalling behaviour that this shocking report uncovered.

Nazir Afzal has found institutional misogyny, racism and discrimination in the fire service. His report is based on the testimony of 2,000 members and contains 23 recommendations, including the introduction of body-worn video by firefighters, an historic review of complaints about racism, misogyny and bullying, and secure facilities for all women.

As the Minister said, the report comes after the death of Jaden Francois-Esprit, a trainee at Wembley fire station, in my constituency in the London Borough of Brent. Two years ago, Jaden took his own life, aged just 21. My condolences go out to his family and friends. Jaden was teased about every little thing, even the Caribbean food he brought in for lunch, and he made 16 requests to be transferred to another station. Nazir Afzal’s report said:

“Jaden’s position was not unique. We have spoken to others that are equally isolated and harbouring suicidal thoughts.”

I know some Government Members will accuse the report of being too woke or promoting wokery, but let me highlight some of the incidents. Female firefighters were found to have been groped and beaten, and had their helmets filled with urine and their clothes violated with semen. Some male firefighters who visited women’s homes for safety visits would go through drawers looking for underwear and sex toys. A black firefighter had a noose put on his locker, and a Muslim firefighter had bacon and sausages stuffed in his pockets and a terrorist hotline sign posted on his locker. If being more woke will stop this behaviour, then I think we are not woke enough.

As the chair of London Labour MPs, I spoke to London fire commissioner Andy Roe, and he is determined to sack every single firefighter who is misogynistic, racist or homophobic at work, and that sends a strong message. I need to know what strong message the Government will send. We cannot bring back Jaden, whose life was lost, but the Government can make sure that other young people, who are starting out on their career in the London Fire Brigade, are not met with the same experience, but with consideration and acceptance by a service that is alert and awake to bullying and discrimination.

The Government must lead the call for change and tackle structural and systemic discrimination in all our old institutions, and understand that being woke is a good thing. That would be a fitting legacy to Jaden.

I completely agree with the hon. Lady that the behaviour and the incidents that she just enumerated that were uncovered by the report are completely unacceptable. They have no place in any modern public service, whether that is the fire service or anywhere else. I am sure the whole House will join her and me in condemning that sort of behaviour unreservedly.

I spoke to London fire commissioner Andy Roe on Friday to set out my strong feelings that this behaviour is totally unacceptable and needs to completely end. As the hon. Lady said, he has committed to implementing all 23 of the report’s recommendations, including, importantly, outsourcing the complaints service, so that complaints are dealt with externally to the London Fire Brigade, and going back and looking again at all the complaints made over the last five years, to make sure they have been properly investigated—clearly, in many cases they have not been. He committed to ensuring that anyone found guilty of the sort of behaviour that she outlined from the report will be removed from their position. As I say, the behaviour that has been uncovered is totally unacceptable, and I am sure the whole House will join in condemning it.

I welcome my right hon. Friend’s statement and agree that there is absolutely no place for racism or bullying in our society or any of our public services. Will he outline what he might also be doing to ensure that disciplinary measures are dealt with in a timely manner? There was a disciplinary issue in my local police force, as opposed to fire service; that was dealt with well, but it took three years. Will my right hon. Friend try to ensure that such cases will be dealt with in a more timely manner in future, whether in the fire service or police force?

My right hon. Friend is right about timeliness; that is one of the reasons why the London Fire Brigade Commissioner has said that he will be outsourcing the handling of complaints: to make sure that they are dealt with faster. Things work a bit differently at the police force, but there is an issue with timeliness. A number of police officers, including both the Commissioner and Deputy Commissioner of the Metropolitan Police have raised the issue with me as well. We are looking at a number of ways of speeding up the process, including potentially through legislation. I completely recognise what my right hon. Friend has said and we are actively working on that at the moment.

Here we have an urgent question on shocking standards in the fire service, and we have a statement later on appalling conditions in Manston. The Home Secretary is not here for either of those—why not? Where is she?

The report is grim: firefighters huddled around a screen watching porn; putting bacon in the sandwich of a Muslim colleague; and hanging a noose around the locker of a black co-worker—a pack mentality and systematic failure to stamp it out. Some 2,000 firefighters in London have told their story, thanks in large part to Linda Francois, the mother of Jaden, who tragically lost his own life. She campaigned for this report, and we welcome the immediate action that Andy Roe, the commissioner, is taking.

However, these shocking findings are not news to anyone. The Government have been put on notice time and again about cultural failings in our fire service. In 2015, an independent review in Essex found dangerous and pervasive bullying; in 2018, the inspectorate found failings in culture, values and the grievance process; in 2019 the inspectorate warned of an unchecked, toxic culture in many services; and in 2021, it found that change was urgently needed.

What was the Government’s response? It was a haemorrhaging of the budget on training, ignoring the warnings from the inspectorate and playing politics with our fire service. We have repeatedly said that when it comes to police failures we have had enough of the Home Office sitting back and leaving things to individual forces. Will the Minister immediately commission a fundamental review of national standards and culture in our fire service? Will he agree, now, to publishing national statistics on misconduct and will he today commit to national professional standards?

There were 11,000 fires across London alone last year. Our brave firefighters run into danger every day. We must expect the best from all of them and stamp out this culture of misogyny and racism. The Government must end their complacency and act.

I assure the hon. Lady that there is not any complacency. She should be aware—I am sure she is—of the White Paper published just a few months ago setting out a range of measures to tackle shocking cultural issues such as those we have heard discussed this afternoon.

The hon. Lady asked about national standards. As I said in my opening comments, the Fire Standards Board is in the process of publishing a number of standards that will be publicly available and that we will expect fire services to abide by. Those, of course, will be inspected against. She asked about issues outside the London Fire Brigade. I agree that those need attention, and we will be discussing with His Majesty’s inspectorate of constabulary and fire and rescue services what work it can do to look at behavioural and cultural issues such as these across the whole country.

Obviously, we will respond to the White Paper consultation shortly. In the meantime, we will of course be working with Commissioner Andy Roe, who I spoke to on Friday, about the issue. As the report relates to London, I will also be in touch with the Mayor of London, Sadiq Khan, who of course has responsibility for oversight of the London Fire Brigade.

May I remind the Minister that the Mayor, the Greater London Assembly and the fire services inspectorate ought to have known and done things about this situation years and years ago? Were all these incidents unknown to them? If they were reported, what did they do about them?

Through the Minister, I say to those looking after our great services in London and around the country that they need to be able to answer this question: when will the colour of someone’s skin be as important but no more than the colour of their eyes or hair?

I completely agree with the Father of the House’s last comment about the importance of complete equality, whether based on gender, ethnicity or anything else. Everybody should be treated equally and everybody should have exactly the same opportunity. In relation to the work of the inspectorate, one of the reasons the consultation was published a few months ago was in response to concerns previously raised. The Mayor of London, Sadiq Khan, has oversight responsibility for the London Fire Brigade, as my hon. Friend pointed out, and I will raise these issues with him as well.

I agree with the Select Committee Chair that this is a vitally important issue. We expect leadership from the entire fire system, including the chair of the National Fire Chiefs Council. She mentioned the question of report publication, and I think she said it intended to publish in April 2023. I am happy to take that away and raise it with the NFCC. I am sure she probably expressed a view in the Committee that it should be published sooner.

Confidence in our emergency services is built on trust—trust that they will be there for people in their moment of need and do everything possible to help them, and trust that no matter what they look like or who they are, they will be treated with respect. Sadly, this report brings that trust into question. In moments such as this, my Vauxhall constituents will need confidence in their emergency services, yet when they hear the shocking reports about the fire brigade, soon after revelations about the police, they might question whether there is a wider cultural problem in our services. I salute the 2,000 firefighters who came forward, but recent scandals in the police and fire service reveal the importance of having a strong whistleblowing procedure. Will the Minister say from the Dispatch Box whether he will commission a national review of standards and culture to ensure that no one is afraid to come forward to raise this abuse?

The hon. Lady is right to say that constituents, regardless of their background, should be able to have full confidence in the service, and that is why I think the Commissioner of the London Fire Brigade rightly said that he will implement all 23 recommendations to deliver that. It is worth saying on that point that on a daily basis firefighters across the country put their lives at risk to keep us safe. While being appalled by this report and absolutely determined to make sure there is substantial change, we should keep in mind at the same time that firefighters are putting their lives at risk daily. In terms of her question about whistleblowing, that is something we can take away and consider. Whistleblowing should be available. Firefighters from all backgrounds should be able to raise issues when they encounter them, and it is vital to make sure that those channels exist, so that is something I will take away.

As we have already heard, some of the report’s findings are utterly shocking. I agree with the Minister, however, that many firefighters are out there across the capital, not least in Twickenham fire station, putting their lives on the line every day to protect us all. Can I clarify a couple of his previous answers? Does he agree with Nazir Afzal’s recommendation that we need a national inquiry into the culture of a number of public bodies? Londoners’ faith in many of our public services has been shaken, because the findings of this report are reminiscent of what we found in the Metropolitan police.

In terms of the fire service nationally, as I said, His Majesty’s inspectorate of constabulary and fire and rescue services obviously has a role to play. I will be raising that issue with the inspectorate to make sure that it is looking at it. I can speak only for police and fire, but I am sure that ministerial colleagues will want to ensure that such issues are rapidly dealt with for other public services. On a point of clarification, when I said a moment ago that an organisation had not yet issued a statement, I was referring to the union—the Fire Brigades Union.

Although I congratulate the LFB on having the courage to have Nazir Afzal in to do his work and to find these distressing and troubling conclusions—in the Minister’s words—what is to say other forces and institutions are not afflicted by or riddled with the same unacceptable behaviour? As the hon. Member for Twickenham (Munira Wilson) said, examples have been found in the Met police that are way more than just the odd bad apple. What advice does the Minister have for employees elsewhere, who are forced to suffer in silence and hide in the shadows in their workplaces, so that this never happens again anywhere?

It is a good question, which comes back to the whistleblowing point that the hon. Member for Vauxhall (Florence Eshalomi) raised. It is vital that anyone in any public service, whether fire, police or anything else, can raise concerns—or more than concerns, in the case of the shocking examples that we have heard—and that they are taken seriously, treated confidentially and properly investigated. It is right that the fire brigade is appointing an external organisation to look at the complaints going back more than five years. Every public sector organisation needs to make sure that proper whistleblowing channels are available so that nobody’s concerns get ignored or overlooked.

London is one of the most diverse cities in the world, which we should all be proud of, yet many Londoners listening to this, and those who have heard about and read the report, will have no confidence in our fire service with its racist and misogynist culture. Will the Minister commit to ensuring that firefighters wear body-worn video cameras when they enter families’ homes? Confidence will be very low and we need to ensure that we are working not only for all our constituents but for those people who are watching and may not believe that we are doing our job.

I thank the hon. Lady for her question. On confidence, the commissioner of the London Fire Brigade has committed to implementing all 23 recommendations. From memory, one of those is to introduce body-worn cameras, so I believe that is something that the London Fire Brigade intends to introduce. It is vital that the public have confidence in our firefighters, who work bravely on a daily basis to keep us safe. The public must understand, however, that they do that without any bias or prejudice, which is why it is critical to implement the recommendations.

The circumstances and findings of the report are appalling, and troubling for those of us who have worked closely with the London Fire Brigade in the aftermath of the Grenfell fire, particularly on product and building safety. Poorer and ethnic minority communities are more at risk, so what will the Government do as part of their response to Grenfell in the light of that? I am also now totally confused about where the Government are on a national inquiry. Yesterday, the Transport Secretary said that he did not want people

“setting up inquiries all over the place.”

Will the Minister confirm from the Dispatch Box that there will be a national inquiry?

No: to be completely clear, for I think the third time, I have said that I will ask His Majesty’s inspectorate of constabulary and fire and rescue services to take a look at these issues. It obviously inspects the 44 fire and rescue services and the 43 police forces regularly. It can also—if it chooses, because it is independent of course—conduct thematic reviews on issues such as this, and I will be raising the issue with it.

I would say, with great respect, that the reports have not been ignored. As I have said already, a White Paper was published just a short while ago with a number of very detailed and specific recommendations designed to address precisely these kinds of issues, so with respect, I do not accept the characterisation the hon. Lady has set out. Clearly, from this report, urgent action is needed in London, and that is why the 23 recommendations will be implemented in full. I think the commissioner, Andy Roe, has accepted that. I will be discussing the issue with the Mayor of London’s office as well.

This feels depressingly familiar from the many times that Ministers came to this House to reassure us about the culture of the Metropolitan police. Would it not save the Minister and us a great deal of time if he were to agree to the recommendation in the report of a national review, supported by the Labour party, rather than having to come back time and again to repeat these excuses and say there is no complacency, when actually this toxic culture is not being dealt with at local level?

On the right hon. Member’s first point, as I said in response to the hon. Member for Brentford and Isleworth (Ruth Cadbury) a moment ago, the Government did bring forward a White Paper with a number of quite important reform recommendations designed to address precisely these kinds of issues. There is a huge amount of work going on in relation to misconduct, which we have debated in this House before, including in the police. Of course, action is now taking place specifically in London on the fire service, and I will be discussing these issues with the Mayor of London, who has responsibility for fire in London.

It is a sad fact that in Britain in 2022 we will all come across ignorant people who judge others not by what is in their head and in their heart, but by the colour of their skin, their sexuality or their religion. Unchallenged in any organisation, that is deeply damaging and divisive, and it leads to the problems we have seen in this report. Does the Minister agree with me that this is a failing not only of management, but of the Fire Brigades Union, which should have looked after the interests of all its members?

I think all those responsible for the conduct of the London Fire Brigade need to take responsibility for what has happened. Culture does not come from any one place; it develops in an entire system. That is why I think system-wide change is needed, so I do agree with the point my hon. Friend makes. The 23 recommendations are a starting point, but everyone needs to contribute to changing culture to make sure that gender, race and other characteristics play no part whatsoever in the way somebody is treated.

It is a pleasure to serve under your chairmanship, Sir Christopher. I thank my hon. Friend the Member for Wyre Forest (Mark Garnier) for securing this important debate. I put on record my thanks to his local radio station, BBC Hereford & Worcester, for its tireless and energetic campaigning and investigative journalism in this area. As my hon. Friend said, work by local radio stations, such as BBC Hereford & Worcester, is extremely important in raising those issues and drawing them to the attention of local Members of Parliament, and, through them, the Government.

The Government share the concerns that hon. Members have raised about the use of nitrous oxide. We are very conscious about its growing levels of use recreationally, particularly by younger people aged between 16 and 24. We are concerned about the effect it has on people’s physical and mental wellbeing. Often, drug consumption can have effects that take quite a long time to manifest For example, we know long-term cannabis consumption can lead to psychosis and psychotic episodes, but it takes quite a long time for that to manifest. With any sort of psychoactive substance there can be effects that are not immediately obvious, and only after the passage of time do they become clear.

This is a slight change of topic, but in Coventry we have had young people paralysed due to the neurological effects of this particular drug. Would the Minister speak to his counterpart in the Department of Health and Social Care about running a public health campaign to raise awareness about the effects of this drug?

The hon. Lady is right to point to the need to elevate public awareness. All too often we find that people make an assumption about something that, on the face of it, appears relatively innocuous but can in fact have serious effects, either over time, as in the case of cannabis and psychosis, or if consumed in excessive quantities. The point my hon. Friend the Member for Wyre Forest made about very large cannisters is concerning. The point she makes about people ending up paralysed by consuming huge amounts of this stuff is deeply concerning. I will write to my colleagues in the Department of Health and Social Care conveying exactly that suggestion. I think it is a good idea. It may be worth her raising it directly with Health Ministers, but I will certainly write on that point.

That is absolutely the right suggestion. With the public health campaign, could the Minister also speak to his counterparts in the Department for Education to make sure there is that connection between health and education, so that young people are receiving that information early?

I can see my job list growing with every passing minute of this debate. I am happy to raise that with Department for Education colleagues. Education is important so that young people understand the risks they are running when they take nitrous oxide. We support an organisation called Every Mind Matters, which is an online resilience-building resource aimed particularly at 11 to 16-year-olds and provides them with information to make informed choices. Raising concerns about these drugs is important. Children obviously get taught about it in schools through relationships, sex and health education. That teaching became compulsory in schools from September 2020, so part of the curriculum is set aside for messaging of the kind that the hon. Member for Lewisham East (Janet Daby) pointed to.

Let me turn to some of the questions raised by my hon. Friends the Members for Wyre Forest, for Redditch (Rachel Maclean) and for Worcester (Mr Walker) about the legal framework and where we are with that. As my hon. Friend the Member for Wyre Forest said, nitrous oxide is currently controlled under the Psychoactive Substances Act 2016 rather than the Misuse of Drugs Act 1971, and there are provisions in the 2016 Act that control the supply of it but do not criminalise possession. It is an offence to supply nitrous oxide if the person supplying it knows or is reckless as to whether it will be used for its psychoactive effect. There is a legal duty on the supplier not to act recklessly in supplying it.

I was very interested by the example my hon. Friend the Member for Wyre Forest gave about an online company who were in his words acting as a “wholesaler” of this drug. He thinks it is not for legitimate purposes to do with whipped cream or other related commercial applications, but for use in a psychoactive context. He says the website sells it in forms of packaging that would appear to suggest it would be used for psychoactive effect, and there is content on the website pointing in the same direction, including suggesting people can take vitamin B12 supplements to counter the effect the nitrous oxide has. That all points to the fact that they may be supplying it for psychoactive purposes, not legitimate commercial purposes.

I have not seen the website, but were that the case, it would strike me that it probably would be reckless. The company acting in the way he describes would be acting recklessly as to whether or not it is being use to psychoactive effect. In fact, in some ways, the company might be implicitly encouraging it, considering the content he describes. I think my hon. Friend would have a case to refer that website to the police, drawing their attention to the provisions I pointed to. There might be grounds for investigation and prosecution under the law as it stands today for the reasons I just set out.

I am very grateful to the Minister for making that clear. He is right. Where there is concern about these things, the website should be referred. I have come across similar cases in relation to even more dangerous substances. He will know about some of the debates we have had previously about DNP—or 2,4-Dinitrophenol—which is a highly toxic and deadly substance, sometimes mis-sold as a slimming aid or exercise supplement. Does the Minister agree that we need stronger powers to ensure we can take action against websites that sell these substances, because I am concerned.

I have seen cases and cases have been raised by my constituents where drugs that can literally kill people, simply through being ingested, are being mis-marketed, or marketed in a way my hon. Friend the Member for Wyre Forest (Mark Garnier) described—where it explicitly says, “This is not the use for it,” but then goes on to imply that someone can buy it and use it for all those things. That is very, very dangerous, particularly for young people to whom these things are targeted. Can I urge him to take more action?

Yes, I think that is a very important point. Where the substance concerned has a psychoactive effect, it will fall under the Psychoactive Substances Act 2016, and where people are supplying it recklessly in the way that my hon. Friend the Member for Worcester just described, there is basis for action. If there is no psychoactive effect but the substance has some other adverse medical effect, that would obviously not fall within the purview of that Act, but such substances are regulated separately through the Medicines and Healthcare products Regulatory Agency and other regulators, who can make regulations to restrict supply. If there is evidence that there is misuse of substances that are legal, either tightening that regulation or having them reviewed by the Advisory Council on the Misuse of Drugs is the right way to go. If my hon. Friend has particular examples, he should write to me and I would be happy to take them up.

Thank you. That is very helpful, Sir Christopher; that was the clarification I was seeking, alongside your more metaphysical point about the pressing nature of time in general.

I return to the questions on the Advisory Council on the Misuse of Drugs. As my hon. Friend the Member for Wyre Forest eloquently and accurately put it, this matter was referred to the ACMD by the Home Secretary in September of last year, 12 or 13 months ago. We have not yet received its report. The Home Office has raised the matter. The ACMD is independent of Government so cannot be compelled, but it would be proper to draw its attention to this debate and the concerns that have been expressed from both sides on the issue, to make sure that it is aware of the strong parliamentary interest in this matter. That would be a proper and reasonable thing to do without trespassing on its independence. I agree with my hon. Friend that the issue needs to be looked at urgently.

Generally, the Government follow the advice of the ACMD because it has the medical expertise, although we are not obliged to do so. It is within that organisation’s power to make a recommendation on how the drug should be classified. If it were to give advice that it thought the drug sufficiently damaging, it would be open to the Government to reclassify and bring it within the remit not of the 2016 Act but of the Misuse of Drugs Act 1971, at which point it would become a prohibited drug and would fall into class A, B or C. The Government take the ACMD’s recommendations very seriously because it is the expert in this area.

Will the Minister enlighten us, for the benefit of those of us not quite familiar with the role of this body? Does its recommendations include providing changes to the law and legal frameworks such as making it illegal to possess those substances in a public place, as I referred to earlier? How would that be enforced, based on those recommendations?

The Advisory Council on the Misuse of Drugs principally makes recommendations about how harmful a particular drug is and therefore how it should be classified under the Misuse of Drugs Act 1971. That is the advice we have sought in this case. The consequences that then flow from classification are matters for Parliament to legislate; they are set out in law. There are obviously different criminal penalties depending on whether a drug is in class A, B or C, and there are different penalties for possession versus supply. The advice we are seeking is essentially medical advice on just how damaging the drugs are and therefore which regime they should fall within. I will convey to the ACMD how pressing Members of Parliament feel the issue is, quite rightly. The points raised have been very powerful and well articulated. I will undertake a third action to go and do that. This is an important issue, about which we are concerned.

I add a point before closing about the powers that local authorities have. One or two Members mentioned the associated antisocial behaviour and littering. There are powers available under the Anti-social Behaviour, Crime and Policing Act 2014 and other legislation to make various forms of order in this area, including orders on antisocial behaviour and dispersal. We also have public space protection orders, which are available to local councils to stop individuals or groups committing antisocial behaviour in a public space; such behaviour would clearly fall into that remit. Following consultation by councils with the police or the local PCC, councils can issue a PSPO, which would effectively prevent the activities taking place in a particular area. If there are Members who feel there is a problem in a particular location, I would suggest they get their local council to use PSPOs as an immediate measure and way of taking action. I thank my hon. Friend the Member for Wyre Forest for the opportunity to speak on this important issue.

I beg to move,

That the Committee has considered the draft Police, Crime, Sentencing and Courts Act 2022 (Offensive Weapons Homicide Reviews) Regulations 2022.

It is, as always, a huge pleasure to serve under your chairmanship, Mr Robertson. Reducing homicide and tackling serious violence is a top Government priority. We must use every tool at our disposal to stop lives being lost to serious violence.

Offensive weapons homicide reviews were introduced by the Police, Crime, Sentencing and Courts Act 2022 to support local agencies to work together to identify lessons, thereby preventing future deaths. The Act places a duty on the relevant review partners, including the police, to conduct an offensive weapons homicide review in certain circumstances where a person aged over 18 has died and an offensive weapon was used in their murder.

We intend to pilot the new reviews for a period of 18 months, beginning early next year, in specified areas in London, the west midlands and Wales, to ensure that they have been properly designed before any national roll-out. In essence, the draft regulations set up the pilots and provide that the relevant review partners will be the local authority, the police and, in England, the integrated care board, or, in Wales, the local health board, from the area where the death occurs or, where the location of the death is not known, where the body is found. The regulations will provide them with the detail they need to establish when a review must be carried out.

The draft regulations clarify that not every homicide involving an offensive weapon will require a review. It will be necessary for one or more of the review partner agencies to have, or to be reasonably expected to have, relevant information about the circumstances or background to inform the review. It will be necessary for the body, or part of the body of the person who died, to have been located, and for the identity of the victim or a suspected perpetrator to be known. That will ensure that resources are directed at cases where lessons can genuinely be learned to help prevent future homicides.

The regulations will allow the Secretary of State to direct which partners are the relevant ones to conduct a review should there be any uncertainty. We do not expect the power to be used often, but it is important to ensure that there are no instances where no one is responsible for leading the review.

The draft regulations also make it clear that a review is not required where the death is a

“death or serious injury matter”

within the meaning of section 12(2A) of the Police Reform Act 2002, thereby excluding deaths caused by a police officer in the course of their duties, which are investigated by the Independent Office for Police Conduct as a matter of routine.

It is worth saying that a number of homicides are already subject to a review, including where a person under 18 dies, a vulnerable adult dies, a person dies due to domestic violence, or someone in receipt of mental health care commits homicide. Those homicides are already subject to review proceedings such as those we are establishing in the draft regulations, which also allow the review partners to delegate, where appropriate.

As I am sure the Committee will agree, homicide and serious violence cause terrible suffering. We are determined to do all we can to drive down such crimes. The draft regulations, in supporting the introduction and piloting of new offensive weapons homicide reviews, will deepen our understanding of what lies behind such homicides and, we hope, better inform measures to prevent them in future.

Finally, I assure the Committee that we are concerned not to impose an excessive administrative, regulatory or financial burden on the police and the other review partners. In designing the statutory guidance setting out how the reviews are to be conducted, we will therefore ensure that they are light-touch and impose the minimum of regulatory burden and that the reports do not turn into massive encyclopaedias, but are concise and brief, so that we do not create additional burdens on already quite heavily stretched public and emergency services. However, the reviews will add to our understanding of offensive weapon-related homicides, and I commend the draft regulations to the Committee.

There are a few points to respond to there. I start with those raised by the hon. Member for Croydon Central, who is the shadow Minister and my constituency neighbour. She made some observations about violent crime in general. As she said, knife crime has been on a declining trajectory for the past few years, which is welcome. We are focused on the most serious forms of violent crime, and there have been reductions there as well, compared with 2019—the last pre-pandemic year. We are investing heavily in the policing response through the Grip investment, which aims to heavily police hotspot areas. We are also trying to address the causes of violent crime, particularly knife crime, via violence reduction units and violence reduction partnerships, which have been successful in many parts of the country. The Metropolitan police have been well funded in that area.

I take the shadow Minister’s point about needing to make sure the reviews are done properly. I was not suggesting that we would sacrifice quality; my point was that sometimes reports and reviews conducted by public bodies turn into sprawling, bureaucratic monsters. They go way beyond the point of adding actual value and impose a lot of costs, time and everything else on those organisations. We will make the reviews as concise as they can be, while drawing proper conclusions. I do not want them to turn into a bureaucratic Hydra that consumes money and resources beyond the point where it adds value. My observation as a Minister for the last few years is that, when we launch reviews or investigations, they sometimes grow to the point where they consume huge amounts of money and time without adding value. I do not want that to happen here, given how constrained budgets are in local authorities, the police and local health organisations. That is a really important point.

Speaking of money, the shadow Minister asked whether the funding for the pilot is additional or whether we will ask the review partners to absorb it from an existing budget. I can confirm that the £2.1 million is additional; it is extra money that is being provided specifically for this purpose. It will not detract from existing operational budgets. The extra money is still taxpayer funded; it is still money that our constituents are having to fund.

The shadow Minister asked where the estimate of 72 reviews comes from. It derives from taking the limited geographic areas in which the pilots are being conducted and applying them to the expected national numbers—we will scale those numbers down to give us the numbers for just those areas. Nationally, there are around 700 homicides per year. In 2021, there were 692. Some 235 of those met the criteria for the existing homicide reviews that we discussed earlier—for example, domestic homicide or the homicide of someone under the age of 18. There are 457 homicides nationally that do not meet the existing criteria. Of those, 222 involve an offensive weapon and will therefore be in the scope of these reviews. Looking at that over an 18-month period and scaling it down for the pilot areas, we get to the numbers that the shadow Minister outlined.

That point also answers a question asked by my hon. Friend the Member for Windsor. These reviews will not cover every single homicide. However, between them and the existing reviews, based on the numbers I just gave, reviews will apply to 457 or so homicides—around two thirds. There will still be some homicides for which reviews do not apply.

The shadow Minister also asked which review takes priority if, for example, a homicide is both domestic and involves an offensive weapon. The answer is that the existing homicide review mechanisms will take priority. If there is a domestic homicide involving an offensive weapon, a domestic homicide review will take place. I hope that that answers the shadow Minister’s questions.

My hon. Friend the Member for Redditch asked some further questions. I take this opportunity to pay tribute to the fantastic work she did on many issues—particularly violence against women and girls and domestic violence—during her time as the Minister for Safeguarding at the Home Office. She has left a strong legacy for her successor. She asked about a review into domestic homicide reviews to see whether they can be further improved. That work is ongoing internally. A consultation will open in the early part of 2023 and will be completed by the end of 2023. I hope that that gives her the clarity she was asking for. On the domestic homicide sentencing review, that is, as my hon. Friend said, with our colleagues in the Ministry of Justice, so I am afraid I cannot provide an answer to the questions that she raised, but MOJ Ministers will be able to do so.

Turning finally to my hon. Friend the Member for Windsor (Adam Afriyie), I think I have addressed one of his questions. He rightly drew attention to the fact that we are adopting a pilot approach rather than just going for a national roll-out. He made the good point that, all too often, Government and local authorities do things on a blanket basis without having tested them first. Where there are significant cost, public policy and resource implications, it is worth making sure that whatever measure is proposed—whether this or something else—actually works, is proportionate and has been carefully set up before pressing the button and making it national. That approach works here and in other contexts.

My hon. Friend asked about delegation. There is an ability to delegate to appropriate third parties. For example, if the relevant review body, such as the local police, wants, for resource reasons, to get somebody else to conduct the review, such as an expert of some kind, they have the ability to do that, but they are responsible for ensuring that that is a suitable person with the relevant expertise and capability.

It is also worth saying that the whole thing is overseen by an oversight board, as the shadow Minister referenced in her remarks. We are in the process of appointing a chair and possibly one additional member for the pilot—we do not need to appoint an entire board if it is just a pilot. We will appoint just those two people initially, and they will make sure that these reports are publicly published and are available to the Home Office and that lessons get learned, as appropriate.

I thank my right hon. Friend the Minister very much for responding in such detail to my comments, but I am a little concerned about the timeline he set out for the review of how the domestic homicide review process works—after all, the proportion of homicides that are domestic homicides is pretty large. I can see his officials in the box, and I distinctly remember having detailed discussions about this work when I had the privilege of serving in the Home Office. I am concerned to see how long this process will now take, and I am sure that my right hon. Friend, like me, whenever he is presented with a timeline by his officials, will say, “Why can’t this be done quicker? What is the delay? Can we speed this up so that we can get justice for these victims?” I would be grateful if he agreed to meet me, so that we can discuss this in a bit more detail.

The Government are determined to reduce neighbourhood crime, and I am pleased to report that, since 2019, neighbourhood crime has reduced by about 20%. It is up to chief constables to decide on the level of PCSOs that they choose to recruit, but as the House will be aware, we are in the process of hiring an extra 20,000 police officers, after which we will have a record number of uniformed officers serving.

Police community support officers have a vital role to play in tackling neighbourhood crime and building trust and confidence in policing at a community level, because they are often the most visible officers to our communities. Will the Minister therefore confirm how many fewer officers are assigned to neighbourhood roles in England and Wales today compared with 2010? How long does he expect it to take until police officer and staff numbers in neighbourhood roles reach the same number again?

I can confirm that neighbourhood crime is about 20% lower than in 2019, as I said a moment ago. I can confirm that after the 20,000 officers have been recruited in April next year, we will have a record number of uniformed officers serving in this country. I can also confirm that the Metropolitan police area, which includes the hon. Lady’s constituency, the shadow Policing Minister’s constituency and my own, already has a record number of uniformed officers.

In the London Borough of Brent, 320 hours of safer neighbourhoods teams’ police time has been abstracted in the past three months. The figures are not routinely made public, but it is important for communities to have access to that information because they need to know that their safer neighbourhoods teams are there to act for them. Will the Home Secretary undertake to publish abstraction figures as a matter of routine?

Such operational matters are for the police, but I share the hon. Gentleman’s concern about the level of abstraction owing to the unjustified Just Stop Oil protests. In October and early November, about 11,000 Metropolitan police officer shifts were lost as a result of having to police those outrageous and unnecessary protests. That is a matter of concern, and that is why it is so important that we see an end to these protests as soon as possible.

I usually get very positive feedback about Chelmsford’s pubs, clubs and nightclubs, but in recent weeks there has been a flurry of emails and comments on social media about suspected spiking incidents at one establishment. I have been in touch with our excellent city centre policing team, who are among the hundreds more police we have had in Essex in the past five years. Will the Minister join me in encouraging all those who think they may have been victims of spiking to come forward and report the incidents to the police so that the perpetrators can be caught and held to account?

Neighbourhood policing and PCSOs should be at the heart of communities, providing proactive policing to keep communities safe, yet after cutting thousands of neighbourhood police officers from our streets, the Tories have cut 8,000 PCSOs. Labour has made a commitment to hire thousands more PCSOs as part of a fully funded neighbourhood policing programme. Will the Minister match that commitment, or will further cuts be coming after Thursday’s Budget?

The Government have taken a dual approach to tackling serious violence, combining tough enforcement with programmes steering people away from crime. Since 2019, we have invested £170 million in the areas most affected by violence to boost the police response, and we have invested a further £170 million in developing violence reduction units to tackle the root causes of violent crime. These programmes together have been assessed as preventing 49,000 violent offences in their first two years.

Harrow is, generally speaking, a safe borough in which to live, but we have seen an 18% increase in knife crime this year. There were 41 major incidents last month, and only last week there was a major incident in which three people were stabbed and put into hospital. Does my right hon. Friend agree that what is needed is not just extra police officers, but apprehending people who carry knives, punishing them by taking them to court and imprisoning them so they cannot cause damage to other people?

I agree with my hon. Friend that a robust police response is essential, as is the courts making robust use of the two-strikes rule requiring a mandatory prison sentence on a second conviction for possessing a bladed article. Those are very important, and I am happy to look with him at how they are working and whether they need to be pushed a bit further. I am sorry to hear about the knife crime statistics in Harrow. Nationwide, knife crime, or knife-enabled crime, is down about 9% compared with pre-pandemic levels. If my hon. Friend feels that more needs to be done in his area, I would be happy to discuss it with him.

The two-strikes strategy is not something we have done in Milton Keynes. The Home Secretary has heard about Operation Deter, under which people caught with a knife in Milton Keynes will spend time behind bars. Along with the right legislation and the right policing strategies, such as Operation Deter, we need to work with local communities. Will my right hon. Friend join me in welcoming the Knife Angel to Milton Keynes as we work with communities to raise awareness of the consequences of knife crime?

A couple of weeks ago, I watched film from a security camera in Stockton showing two men; one used a chainsaw to cut through the door of a house while the other set about smashing all the windows in a bid to get to the resident. Who knows what would have happened if they had got in? That is another example of terrifying attacks by dangerous, organised criminals determined to silence our communities as they fight to control their illegal drug businesses on Teesside. The Government love to spin a story about police recruitment, but will Cleveland police ever get back the hundreds of police officers cut since 2010 and the resources needed to protect our communities and catch these criminals?

I also met the chief constable, Mark Webster, just a week ago. The hon. Gentleman mentions resources, and of course Cleveland this year is receiving an extra £7.8 million compared with what it received last year and it has been allocated 239 extra officers as part of the police uplift programme, 197 of whom are already in post.

In September, I asked a then Home Office Minister why it is still legal for anyone aged 18 and over to walk into a shop and buy a machete. I was told, because the incidence of the use of machetes on our streets is increasing, that the serious weapons review is looking at this matter. Will this Minister tell us when that will be concluded and when the Government will act to ban the sale of machetes in this country?

I thank the right hon. Gentleman for his question and I have a lot of sympathy for the point he is making. In the two or three weeks since I have been in this position, I have met the Met’s Deputy Assistant Commissioner McNulty, who has particular expertise in this area and is the National Police Chiefs’ Council lead on this topic. He has made a number of interesting proposals that are consistent with what the right hon. Gentleman just suggested. I am studying those carefully and sympathetically, and hope to have more to say on this topic in the near future.

Drug control seeks to strike a balance between preventing criminality on the one hand and allowing access for legitimate use, such as medicines development, on the other. The Government are guided in their decisions by the Advisory Council on the Misuse of Drugs as a well-established process for taking these decisions, and of course we follow the expert advice.

Psilocybin should never have been designated a schedule 1 substance, but this position by the Home Office has become even more untenable following publication this month of the largest multi-site phase 2b trial of psilocybin for treatment-resistant depression. The study found rapid and enduring reductions in depression symptoms on a 25 mg dose. The further, very promising research in the UK is being severely hindered by psilocybin’s schedule 1 status and the prohibitive associated costs for our academic researchers. Will the Home Secretary finally commit to rescheduling psilocybin and related compounds to schedule 2, to allow more research into mental health treatment paradigms that could see a happier, healthier and more productive country and a growth boom for our science, innovation and pharmacology sectors?

The drug to which the hon. Lady refers is an MDMA-based medicine. The Advisory Council on the Misuse of Drugs is currently considering the barriers to legitimate research that are posed by controlled drugs. Once we have had its advice on the topic, including the implications for psychedelic drugs, such as MDMA and psilocybin, we will obviously take an appropriate decision in relation to research. In relation to more widespread availability, we will follow the decisions made by the Medicines and Healthcare products Regulatory Agency and the National Institute for Health and Care Excellence before reaching any such decision ourselves.

T3. We have 8,000 fewer PCSOs, 6,000 fewer neighbourhood police officers, and people can see for themselves that there are fewer uniformed officers on our streets. No doubt the Home Secretary will deny yet again that the Government have cut police. In the vain hope that the public might be reassured by something that this Government say, I will ask again: will she commit to matching Labour’s plan to recruit 13,000 more neighbourhood police officers? No more smoke and mirrors: yes or no?

When 172 men, women and children who were asylum applicants in Acton were bussed suddenly to Ashford in Kent, 80 miles away from their schools, NHS networks and faith communities, it made the TV news. It happened because the private provider of hotel accommodation wanted it back. Will the Home Secretary look into that case, because there is a human cost to uprooting families at the drop of a hat, as well as the waste of taxpayer money in shifting people from hotel to hotel when they could be contributing and paying in if they were processed faster?

Last week, the new Met Police Commissioner Sir Mark Rowley came to Twickenham to meet community representatives. He said that one of the biggest pressures facing his officers is dealing with large numbers of mental health cases; sometimes, multiple officers are spending entire shifts with people in mental health crisis because the NHS does not have a bed for them. Will the Minister outline what his Department is doing to work with the NHS to ensure that provision is in place so that officers can be out dealing with burglaries and catalytic converter theft, which is what my constituents are worried about?

The hon. Lady makes an important and valid point. I had a similar conversation with Sir Mark a couple of weeks ago and I was out with officers in my borough of Croydon the week before last where the emergency response team told a similar story. Sir Stephen House is looking at this topic as part of his review into police productivity, but I also plan to have discussions with colleagues across Government, including in the Department of Health and Social Care and NHS England, to find out what more we can do. The issue that she raises is certainly real.

It is vital that our police forces draw on the best talent in our communities, including people who excel outside the classroom. Following our discussions, can the Home Secretary update the House on future plans for entry routes into policing?

In Batley and Spen, we continue to face serious problems of antisocial behaviour, reckless driving and dangerous parking. Ultimately, behaviour change is key, but in the short term, neighbourhood police and local councils need the resources to catch and punish those who show no respect to our communities. When will the Government properly invest in neighbourhood policing, and when will they stop cutting already stretched council budgets so that councils can use their power to tackle dangerous parking?

Council budgets are obviously a matter for the Department for Levelling Up, Housing and Communities, and they will be set out in the local government funding settlement in a few weeks’ time. When it comes to police budgets, which are the Home Office’s responsibility, as I have said once or twice already, the budget this year is £1.1 billion higher than it was last year—it stands now at £16.9 billion—and by April next year, when the police uplift programme is complete, we will have more uniformed police officers recruited than at any time in our country’s history.

The Government recognise that the majority of people drink at lower-risk levels and enjoy alcohol as part of socialising both at home and out and about. However, we also recognise that alcohol related harms remain of concern and need to be addressed.



The Government believe that the Licensing Act 2003 sets out a clear and effective legislative framework to regulate licensable activities nationally balanced with considerable local autonomy allowing areas to develop their own localities and economies based on their unique character and needs. We keep the Act under review and continue to work closely with licensing practitioners to ensure the regime remains fit for purpose and meets emerging challenges such as new digital technologies. There is a considerable body of good practice around implementation of the licensing regime for areas to draw on where needed.



We are taking forward an ambitious programme of work to tackle alcohol-related harms including the biggest reform of alcohol duties for over 140 years, the introduction of the alcohol abstinence monitoring requirement and alcohol monitoring on licence, and a strong programme of work to address alcohol-related health harms and their impact on life chances.



We welcome this follow up report from the Committee and have given careful consideration to all of the additional recommendations.

I thank my constituency neighbour, the hon. Member for Croydon Central (Sarah Jones), the shadow Minister, for her question on this extremely important topic. The report published yesterday by His Majesty’s inspectorate of constabulary and fire and rescue services makes for deeply troubling reading. The inspection was commissioned by the previous Home Secretary, my right hon. Friend the Member for Witham (Priti Patel), following the horrific murder of Sarah Everard by a then serving officer, as well as the emergence of wider concerns about policing culture.

The report concludes that it has been far

“too easy for the wrong people both to join and to stay in the police.”

The inspectorate found that on too many occasions vetting was not thorough enough and that in some cases it was inadequate. The Government take the view, as I am sure Members from across the House do, that that is unacceptable. It is particularly unacceptable and disappointing to hear about these vetting failures given that the Government have provided very substantial additional funding to fund the extra 20,000 police officers and additional resources for the police more widely.

The inspectorate concluded that, although the culture has improved in recent years, misogyny, sexism and predatory behaviour towards female officers and staff members “still exists” and is too high in many forces. That is shameful and must act as a wake-up call. That sort of disgraceful conduct undermines the work of the thousands—the vast majority—of decent, hard-working police officers who perform their duties with the utmost professionalism. More damagingly, it undermines public trust. This matters a great deal to all of us, which is why my right hon. and learned Friend the Home Secretary has made it clear that things must change.

Since the report was published yesterday, we have been studying it carefully; this has been my first week in this position, but I have been studying it carefully. It contains 43 recommendations: three for the National Police Chiefs’ Council; nine for the College of Policing; 28 for chief constables and three for the Home Office. The Home Office will most certainly be implementing those three recommendations. The NPCC said in a statement yesterday that it expects police to act on their recommendations urgently. That is most certainly my expectation as well: all of these recommendations will be acted on as a matter of urgency.

We should keep it in mind that the vast majority of police officers are hard-working and dedicated. They put themselves at risk to keep us safe, and we should pay tribute to the work that the vast majority of officers do on our behalf. The report has uncovered obviously unacceptable behaviour and we expect the recommendations to be implemented urgently.

I welcome the Minister to his place. However, I have to say that I am disappointed that the Government are not taking more responsibility and leading from the front following such a grim report.

Yesterday’s report is 160 pages of failure—failure to bar the wrong people from joining the police; failure to get rid of them; failure to protect female staff and officers, and failure to protect the public. A lack of proper action to root out racism, misogyny and serious misconduct means that some communities do not trust the police.

This is by no means the first time that serious failings and horrific examples of unacceptable behaviour have been exposed. After the murder of Sarah Everard by a serving officer, the Opposition came to this place and called for change. After the horrific murders of Bibaa Henry and Nicole Smallman, we came to this place and called for leadership. After the shameful case of Child Q, we came to this place and called for reform. After the shocking Charing Cross station report, we came to this place and demanded action. After the Stephen Port inquiry, we came to this place and called for reform. If the Government had acted and led from the front, we could have stopped people being harmed. Leadership must come from the top.

Yesterday, we learned that Metropolitan police officers had been sentenced to prison after sharing racist, homo- phobic and misogynistic WhatsApp messages. For years, there had been warnings—for example, from the independent inspectorate—about serious problems in the police misconduct system, including long delays, lack of disciplinary action, disturbing and systematic racial disparities and lack of monitoring.

We have heard anecdotal evidence of forces expediting the vetting process to meet the Government’s recruitment targets. What does the Minister know about that? What is he doing to ensure that it does not happen? Will the Minister confirm that the roles of police staff, who do a lot of the vetting work and have been subject to cuts, will be protected so that forces can introduce the right systems? Will the Minister follow Labour’s lead and introduce mandatory safeguards and professional standards, led from the top, into every police force in the country to keep everybody safe?

I thank the hon. Lady for her initial remarks and for her questions.

The Government have taken action. Indeed, the report we are debating was commissioned by the former Home Secretary directly in response to the issues that were raised. The fact that those issues have seen the light of day is thanks to that Government response. The Angiolini inquiry is also under way for exactly the same reason. We work closely with operational policing colleagues to ensure that the issues are properly addressed. I discussed the issues with Mark Rowley, the Metropolitan Police Commissioner, a few days ago, before the report was published.

As for ensuring that there are adequate resources for vetting and related purposes, the spending review settlement that the police currently receive has meant an additional £3.5 billion since 2019 over the three years of the police uplift programme, not just to pay the salaries of extra police officers but to provide the support and resources required to ensure that they are properly trained and integrated.

The hon. Lady was right to ask about professional standards, which are extremely important. In 2017, national vetting standards were set out in statutory guidance, which the College of Policing published. The report recommends updating some elements of that. Misconduct procedures are set out in statute. We expect the recommendations about improving those areas to be implemented, and we expect police forces around the country to ensure that the report’s recommendations are fully implemented.

Most serving and retired police officers will feel as aggrieved as everybody else that a small number have been allowed to get away with bad things for too long.

For seven years in this House, working directly with Ministers and the Metropolitan police, I have been pursuing the case of the injustice to Sergeant Gurpal Virdi. I do not expect the Minister to know it, but does he understand that confidence can be restored only when lessons are learned, and that this is a good case to look at?

After reading the book, “Behind the Blue Line”, may I recommend that Home Office and Justice Ministers meet me with Gurpal Virdi, Matt Foot, his solicitor, the Crime Prosecution Service and the Independent Office for Police Conduct to review what went wrong, what should be put right and how the matter will be reviewed?

I do agree that the vast majority of police officers, who are hard-working, brave and decent people, will share this House’s shock at the contents of the report. We should keep it in mind, as I say, that the vast majority of police are hard-working, brave and decent people. I welcome the Minister to his place. The report contains very disturbing instances of sexism and harassment perpetrated against women within the police and among the general public, and the systematic failures that contributed to that. The Select Committee has just started an inquiry into police priorities. I want to invite individuals with experience of sexism and abuse within the police and of the systems that failed them to come forward and share those experiences with the Committee. On the specific issues in this report, can the Minister just say whether it is acceptable that police forces are not required to hold face-to-face interviews with candidates or to obtain their employment and character references? How can that be correct and right when the police service has such a pivotal role to play in law and order in this country?

I thank the right hon. Lady for her question. I strongly welcome the work that her Committee is doing in this area; it is very good that she is doing that. The issue that she raises around misogyny is a serious one. The report finds that progress has been made, but that there is a great deal more to do. I look forward to listening carefully to the recommendations that her Committee makes after it has conducted its own investigation. I think that 35% of officers are now female, which is a record figure—it has never been higher than that—and that an even higher proportion of recent recruits are female, which will hopefully add to the need to improve the culture. The training standards in the Policing Education Qualifications Framework do now include training around bias, tackling prejudice and discrimination, protecting people and looking after people with protected characteristics, but, clearly, there is a lot more to be done.

In relation to the vetting process and some of the issues that the right hon. Lady touched on at the end of her question, there are specific recommendations about them among those 43 items in yesterday’s report, and we expect police forces to adopt all of them.

I thank the Minister and the previous and current Home Secretary for the leadership that they are showing on this issue, but, clearly, the report makes deeply worrying reading. Obviously, the vast majority of police officers are dedicated and professional, but there are some wrong’uns who are serving in our forces. For example, is it right that male officers are viewing pornography at work on suspects’ phones? Is it right that they are engaging in “booty patrol”, where they are stopping attractive young women who they see driving in cars? When will the Minister come forward with the Government’s response so that women and girls across our country can feel safe and have their trust and confidence in the police restored?

All of the things that my hon. Friend describes are clearly completely unacceptable. No female officer or female member of the public should experience the things that she has just described. We do expect urgent action to be taken on these areas. The issues that she referenced are included in the 43 recommendations, and we expect implementation of those to be undertaken as a matter of urgency.

Much has been said at the Government Dispatch Box about the need for integrity, but that has to extend not only to police recruits but to those who purport to govern them. Given that the Tory police and crime commissioner of Cleveland, Steve Turner, has admitted to handling stolen goods from his employer, it cannot be that candidates for such positions who do not disclose their criminally dishonest pasts are able to stand for office or continue in office once such matters come to light. Does the Minister agree?

With over 100,000 police officers serving in England and Wales, it is important that everyone in this House accepts that they will be as outraged as we are with the contents of the HMI report. Those police officers will be out on our streets on Saturday night, and the vile individuals identified in the report have made their job of keeping us safe harder. Because they do not have a voice and we do, I rise to say that I stand with our hard- working police officers. I stand with our police officers in Lancashire. They are doing a good job of keeping us safe, and they will be as disgusted as we are.

My right hon. Friend is absolutely correct. The vast majority of police officers are decent, hard-working and brave people who put themselves at risk to keep us safe, and they will share our horror at these findings.

As many know, I was a police officer, joining Lothian and Borders police in 1999. I will not pretend that I do not recognise some of the elements of the culture described in the report, but I am concerned that policing by consent, which is the central tenet of policing in the UK, is threatened by reports such as this one. Scotland is not immune—the Minister mentioned Dame Elish Angiolini, who has carried out a similar report in Scotland. We need to sort out the vetting, but I have a real concern that there are people serving in the police force today who should not be there. What actions is the Minister taking to ensure that all forces do that? Given that the picture is quite fractured, with 43 forces, does the IOPC have a role in ensuring that that work is expedited?

I thank the hon. Lady for her question and for her service as a police officer in Scotland. She is right to point out that this is not just about vetting on entry; it is also about conduct while in office. The recommendations touch on this matter, including in relation to the Home Office and the rule 13 processes around people who are still on probation. I have only been in post for a week, but I do think that making sure that misconduct allegations and wider performance issues are acted on quickly merits further attention, and it is something I will look into.

The significance and seriousness of the report should not be understated, but does my right hon. Friend recognise that the vast majority of police officers are honourable, hardworking and dedicated public servants? Can he assure us that he will take the strongest action to follow through and deliver on the recommendations, but that he will also show and give the greatest confidence to those honourable police officers who are public servants and who work daily to keep us safe?

This Government and, I am sure, all Members on both sides of the House, stand with and behind the vast majority of police officers, who work hard to keep us safe, often putting themselves in danger to do so. There is already a process of periodic re-vetting of serving police officers. One of the 43 recommendations in the report published yesterday is to do that re-vetting more frequently, and that is with police chiefs as we speak.

It is vital that lessons are learned, and I thank the Minister for confirming that the recommendations in the report will be delivered in full, but does he agree that 99.9% of our police officers in this country do a brilliant job in keeping our communities safe, and that it would be a grave mistake if those who oppose the police for political reasons were to jump on the report as a way to undermine public confidence in the work the police do?

I agree that the vast majority of police are hard-working, decent and brave. I have not heard any Member attempting to exploit the report today, and I am sure that no Member of this House would do so. I am also sure that all of us will stand with our brave officers who are doing a good job while ensuring that appropriate action is taken where urgent improvement is needed.

When this urgent question was heard in the other place yesterday, the Minister in the Lords pushed responsibility for standards and reform on to individual police chiefs in individual forces. We know there is a clear postcode lottery with police standards, which is letting the public down. Does this Minister accept that that is wrong and that there must also be leadership from the top at the Home Office too?

Of course I agree that leadership is important, including setting clear standards and, for example, ensuring that those statutory guidelines were put in place in 2017. Leadership is important, and I believe this Home Secretary and the previous Home Secretary, who commissioned this report and the Angiolini review in the first place, have discharged those responsibilities. The hon. Gentleman is also right to allude to the fact that the police are rightly operationally independent; we must ensure that the institutions and structures are right, that police chiefs are supported as necessary, and that the College of Policing is setting the right standards. That is what many of the recommendations in this report seek to do.

Jonathon Cobban and Joel Borders were serving police officers in Hounslow. Yesterday, they were sentenced to 12 weeks in prison for sharing the vilest misogynistic, racist, ableist and homophobic messages in a WhatsApp group that also included Wayne Couzens and others. In court, they showed no remorse. All those officers had been transferred in from the Civil Nuclear Constabulary to fill gaps in the Met. Is the Minister aware of a wider problem of officers being transferred between forces without any real vetting or suitability checks at the time of their transfer, and what is he doing about it to ensure not only that it does not happen again, but that all officers currently serving in the Met are fully vetted and, if they are found to have issues, are sacked from serving in any police force again?

I share the hon. Lady’s horror at the case she describes, which was heard in her local area. It is a truly shocking case. On the question of transfers, one reason for the police uplift programme, hiring the extra 20,000 officers, is to ensure that there are no gaps that need to be filled. There are important recommendations among the 43 that address the question of vetting. On her point about checking the existing cadre of officers, I draw attention again to the point I made a few minutes ago about the regular rolling process of rechecking, which the report also refers to.

This is a sad saga of Government and police management failure. Understandably, there will likely be increased vetting after this important report, so by when will all the additional 20,000 police officers promised so long ago actually be in post?

Of the extra 20,000 officers, just over 15,000 were in post by 30 September this year. The information I have been provided with in the last week—my first week in this post—is that by the end of March 2023, in four or five months’ time, all 20,000 will have been recruited as planned.

This issue starts at the very top, and we have missed many opportunities to tackle it. It was also exacerbated by the incredible decision of the Conservatives to cut 21,000 police officers. Now we have a mad dash to try to backfill those gaps in the service. Can the Minister assure us that no lax vetting has been involved in filling those gaps, and what will he do to go back and re-vet those officers to ensure that they are of the highest standard?

The report made it clear that there have been problems with vetting—that is one of its key and troubling findings. There is a programme of automatic re-vetting of officers on a periodic basis, and one of the report’s recommendations is that that should be done more frequently, for the reasons the hon. Gentleman sets out. More broadly, officer numbers did go down shortly after 2010, owing to the catastrophic economic circumstances at the time, but they are now going up rapidly and by March of next year, as I said a second ago, we will have a record number of police officers—at no point in this country’s history have we had more officers on the books than we will have by March next year. In fact, my understanding is that in the force area covering his constituency and mine there are already a record number of Metropolitan police officers. Never in the Met’s history have there been more police officers on its books than there are today.

I thank the Minister for his response to the questions that have been asked. I also want to put on the record my thanks to the many police officers who are above reproach and do a wonderful and very courageous job; it is important to say that before asking questions. It is disturbing to learn in this report that petty theft or assault charges were either ignored or not found out in the vetting procedure, which tells us just how broken the system is. What has been done to fix that and to ensure that the past record of people of both genders is known, decisions are made in the best interests of the force and every action is taken to restore the general public’s confidence and trust? That is really important.

I thank the hon. Member for his question, and I agree with his comments at the beginning. We should keep in mind in this debate, both in the House and publicly, that the vast majority of police officers are decent, hard-working and brave people putting their own safety at risk to keep us safe; we should never lose sight of that fact. I share his concern about the vetting issues that we have discussed, and there are recommendations to improve those. Where applicants have served a custodial sentence or signed the sex offenders register, there is currently an absolute prohibition on them being recruited as police officers, and where they have a criminal conviction of any kind, there is a presumption against their recruitment. That is a rebuttable presumption, so they can make representations, but the presumption is that they will not be hired. Clearly, we need to ensure that that information is always known and always considered, and there are recommendations in yesterday’s report to ensure that that happens.

I beg to move,

That the Committee has considered the draft Football Spectators (Relevant Offences) Regulations 2022.

It is a pleasure, as always, to serve under your chairmanship, Mrs Murray. I expect many members of the Committee will be aware of the recent concerns about football-related violence, disorder and antisocial behaviour. In fact, the 2021-22 season saw arrests far higher than in any of the previous seven seasons. The increase in that year followed a long-term downward trend, but is none the less a matter of significant concern. A particularly low point came during the Euro 2020 tournament, where we saw not only horrendous and unacceptable racist abuse directed at some England football players but serious incidents in the vicinity of Wembley stadium, particularly on the day of the final in July 2021.

Baroness Casey, in her review of those events, found numerous infractions, one of which was the blatant use of cocaine by some football fans in front of other law-abiding citizens, including young children. That is completely unacceptable. A recent study found cocaine traces on nearly all tested toilet cisterns at major football grounds, and the police have carried out match day operations to seize drugs at football matches and to arrest individuals. Unfortunately, the trend of using and supplying cocaine at football matches continued into the 2021-22 season, during which, according to police data, there were over 140 reported arrests for drug offences.

The police have been clear that they have seen an increase in drug-fuelled disorder across all forms of regulated football matches. Cocaine, which is a matter of particular concern, is a class A drug. It is highly harmful and often leads to extremely disorderly behaviour. The trend of detection of cocaine use at football matches is extremely worrying. We have therefore taken the necessary steps to lay this instrument, which will see all those who attend football matches and who supply or use class A drugs subject, or potentially subject, to football banning order proceedings upon conviction.

Football banning orders are an appropriate and effective tool to help to combat football-related disorder. In addition to a regular criminal conviction and whatever sentence may get passed, football banning orders can be used to ban the individual from attending regulated football matches for between three and 10 years. That will obviously prevent troublemakers from continuing to attend football matches, and will provide an extremely strong deterrent. We are determined, alongside the police, to drive down football-related violence and disorder, and this instrument is an extremely important part of that work. I commend the draft regulations to the Committee.

I beg to move,

That the Committee has considered the Alcohol Licensing (Coronavirus) (Regulatory Easements) (Amendment) Regulations 2022 (SI. 2022, No. 978).

It is a pleasure to serve under your chairmanship, Mr Pritchard, I think for the first time. This is a simple measure that I hope Members on both sides of the Committee will be able to support. It is part of the package of measures introduced by the Government to support the hospitality industry during and immediately after the coronavirus period. Those measures included eat out to help out, and of course the coronavirus job retention scheme, sometimes known as furlough. Some of the changes were introduced through the Business and Planning Act 2020. Those measures, which were designed to assist the hospitality sector, included making obtaining a pavement licence quicker and easier for those businesses wishing to set up on pavements. Parliament has already agreed to extend those measures, which will continue until September next year.

One of the complementary measures concerned alcohol licensing. It provided 38,000 licensed premises with a temporary off-sales permission that extended their on-sales licence so that they could sell alcohol for consumption off the premises as well as on them. It was designed to help businesses—bars and pubs particularly—that were struggling through coronavirus. Of course, we hope that coronavirus as a medical pandemic is largely behind us—although it is not completely so—but the financial implications are still with many businesses, including those in the hospitality sector. To support that sector a little further as businesses continue to recover from the coronavirus pandemic, the instrument simply extends the provisions that I described a moment ago, allowing on-licence premises to sell alcohol for consumption off the premises for a further year, until 30 September 2023. We consulted the National Police Chiefs’ Council about that, and the view of the police is that the extension of off-sales licences that I have just described has not caused any increase in crime or disorder.

In terms of timeframes beyond the one year that we are debating, the Government intend to consult publicly about what the long-term arrangements might look like in England and Wales. That will happen in the course of the coming year, and be concluded in advance of 30 September next year, when this extension comes to an end. Everybody who has an interest in this—the licensed sector, local authorities, the police, the public and Members of Parliament—can express their views about how it should continue in the longer term. I hope that members of the Committee will join me in supporting this measure, which will assist pubs, bars and other hospitality outlets in all our constituencies. I commend the regulations to the Committee.
