I congratulate the hon. Member for Warwick and Leamington (Matt Western) on securing this important debate on local authority housing. It is a pleasure to speak in it. I appreciated his thoughtful speech and I was even sympathetic to his yearning for a return to the Macmillan era—although I am not quite sure how far he would go in that regard. He raises a number of important issues and I will try to address them in turn. He omitted one or two others and I might seek to address those as well.

The reality is that in the last year 217,000 new homes have been delivered, the highest level for all but one of the last 30 years. The hon. Gentleman referred to the financial crash, which clearly had a big impact on the housing market. I think he will be relieved to note that, this month, the national data for the last year showed the number of new build starts and completions at their highest level since 2007. That is good news and positive for homebuyers up and down the country. He also referred to the record of the previous Labour Government on council homes. As my hon. Friend the Member for Filton and Bradley Stoke (Jack Lopresti) mentioned, under this Government, over 10,000 new local authority homes have been built. That is triple the number under the entire 13-year period of the previous Government.

None the less, I accept the premise of the hon. Gentleman’s speech and the restlessness to do much, much more. There is no escaping the fact that we have a housing crisis. He focused on council housing, but we have to build more homes across the board. Providing good-quality and affordable homes for people who need them is an absolute top domestic priority for this Government.

As the chair of the board of Walsall Housing Group, I feel almost affronted by the idea of housing associations not getting a mention. In 2016-17, I believe that there were 47,000 starts for new homes built by housing associations. WHG is celebrating its 15th birthday this week. Over that period, it will have built or acquired 2,000 new homes, but more importantly perhaps, it will have spent £700 million on modernising its existing stock.

I wish a happy birthday to my hon. Friend’s housing association, and I commend housing associations and local authorities up and down the country that have the ambition to get the homes built. We will do our bit as central Government, whether that is on planning reform or infrastructure funding, but we need local authorities to be up for this challenge, so I commend him for the work that he and his housing association are doing.

Since 2010, we have delivered over 357,000 new affordable homes, including over 128,000 homes at social rent. The hon. Member for Warwick and Leamington will know that, between 1997 and 2010, the number of social homes for rent fell by 420,000 and waiting lists rocketed by 70%.

Would the Minister address the issue of what “affordable” means? What would he say to my constituent, Tracey, who could not move into a brand new London and Quadrant property where she needed it? She said, “Siobhain, I can’t move in there. Me and my partner work but we can’t afford the £1,000 a month rent.”

I say to the hon. Lady and her constituents across the board that we are absolutely restless to create more affordable homes so that they can realise their dream of home ownership. I encourage her and her party not to vote against cutting stamp duty for first-time buyers. I do not think that doubling council tax would be the answer, but I share her aspiration to help precisely those people to realise the dream of home ownership. We will be straining every sinew to make sure that that happens.

That is why we have announced a package of measures to help local authorities to build additional affordable homes for their local communities. The autumn Budget provided a further boost with the announcement that local authority housing revenue account borrowing caps will be increased by £1 billion, as was mentioned both by the hon. Member for Warwick and Leamington and the hon. Member for Stroud (Dr Drew). That is good news; it is something on which we are making progress. Local authorities will be able to bid for increases in their caps from 2019-20, up to that total of £1 billion by the end of 2021-22. Again, it will be for local authorities in areas of high affordability pressure, where authorities are ready to start building, but the decision should be welcome news. I hope that the hon. Member for Warwick and Leamington will take that back to his local authority.

The increase shows that we have listened to local authorities and hon. Members across the House who asked for it. It will come on top of the £3.5 billion-worth of borrowing headroom that is already available to local authorities across England. We will release information shortly about how councils can apply for an increase in their local housing revenue account cap. I am keen to see local authorities, wherever they are across the country and irrespective of where they are across the political divide, take up the opportunity to bid. I hope that local MPs will get on board and back them and that we can have a broader cross-party approach to this. I want to see that programme well subscribed, so I encourage all local authorities to think about how the additional borrowing can help them to deliver more council homes for their local community.

Why do the Government not consider removing the cap altogether?

We have raised the cap by £1 billion. If we are going to go further, we need to take a more balanced approach and make sure that we are fiscally responsible, as well as giving the leverage and flexibility to local authorities, but we do keep the position under review. Therefore, I recommend that the hon. Gentleman supports his local authority in any bids that it puts forward. I say that to all hon. Members across the House.

On top of that, we recently announced an extra £2 billion to deliver new affordable housing for social rent, taking our total investment in the affordable homes programme to £9 billion over the period 2016-21. The chief executive of the National Housing Federation, David Orr, has described this extra money as

“a watershed moment for the nation.”

Local authorities, as well as housing associations, which my hon. Friend the Member for Walsall North (Eddie Hughes) referred to, will be able to bid for this money, which will go where it is needed most, and particularly to areas of acute affordability pressures. Again, we will be releasing information shortly about the programme. I encourage local authorities and housing associations to bid and local MPs to get behind it.

In addition, we are giving local authorities more certainty over their rental income to 2025. We are setting a longer-term rent deal for local authorities, enabling them to increase rents by up to CPI plus 1% for five years from 2020. That will provide local authorities with extra oomph and greater confidence in their approach; enable increased future rental income to underpin future house building plans; and—we hope and are confident—give local authorities greater reassurance and confidence to build more homes more quickly, and to do so in a way that benefits local communities. All of this—the rent certainty, the additional HRA borrowing, the billions for new affordable housing—affirms our commitment to ensuring extra council housing built to scale, as does our commitment, of course, to giving councils the tools, flexibility and leverage to do the job.

The Minister is rightly highlighting, as all speakers have done, the importance of council housing, and he is also emphasising the strong support the Government are giving to councils in that respect. As my hon. Friend the Member for Walsall North (Eddie Hughes) made clear, however, a range of models and types of housing are important in the provision of social and affordable housing. Does the Minister agree that the forthcoming social housing Green Paper is a good opportunity to look at that mix and how we deliver social housing in the round?

My hon. Friend is absolutely right. We are not dogmatic about the vehicle or the form. The nature of the demand will be different from area to area, depending on the demographics and geographic locality, and we need the flexibility to provide the right housing at scale to meet the individual needs of local communities.

Under the reinvigoration of right to buy in 2012, local authorities were allowed, for the first time, to keep the receipts from additional sales to fund new affordable housing. The hon. Members for Warwick and Leamington and for Stroud both made that point. Overall, councils have risen to the challenge and used their receipts to deliver new homes. Warwick District Council, for example, has demonstrated a commitment to building replacement homes and is working hard to ensure that delivery is on time. In fact, I prised out the local data for the council because I knew the hon. Member for Warwick and Leamington would wish to applaud it: 33 of its 110 additional sales needed to have been replaced by now, under the three-year deadline, but it has started or required 87 replacements, so is more than meeting the one-for-one commitment locally. I know that he will want to applaud the council for taking a lead in that regard.

I just want to clear up a point that the hon. Member for Warwick and Leamington (Matt Western) made. He said that houses purchased through right to buy had fallen into the hands of others. Given that the policy was introduced in 1980—38 years ago—and given that the right to buy goes hand in hand with the right to sell, it is perhaps not surprising that some have been sold on. We are, I hope, about to enjoy a trial of voluntary right to buy in the west midlands, and I am hoping that the Minister could perhaps touch on that.

My hon. Friend makes some important points. I am looking forward to the midlands pilot of the housing association voluntary right to buy scheme and to renewing and reinvigorating our commitment to right to buy in that sector.

We have been consulting with local authorities and housing associations on their views, and those will be fed into the social housing Green Paper. Of course, the measures I have already announced will also help to make a difference in enabling councils to deliver new homes.

Helping local authorities to increase council housing is, of course, only part of the story. That is probably where I differ slightly from the hon. Gentleman. We are also implementing a range of other measures to increase the supply of homes across the board. Whether those homes are for rent or for ownership, and whatever the sector, it is the overall supply of new homes that will reduce unaffordability over time if we get it right.

To ensure that we could deliver that, housing was front and centre of the autumn Budget, which made available more than £15 billion of new financial support for house building over the next five years, bringing the total support for housing to at least £44 billion over the period. That was the biggest budget for housing in decades. More money was announced for infrastructure: we almost doubled investment in the housing infrastructure fund to £5 billion and promised an additional £400 million to regenerate rundown areas. As the hon. Gentleman probably knows, Warwickshire has benefited from both the viability funding and the forward funding—millions of pounds for extra infrastructure to help authorities to build those extra homes so that we do not just build more homes, but build up our communities. We also gave more help to small and medium-sized builders.

On planning reform, we have revised the national planning policy framework, which has gone out to consultation. That will help us to focus local authorities and developers on the delivery of housing, The review panel chaired by my right hon. Friend the Member for West Dorset (Sir Oliver Letwin) will report in time for the next Budget. It will present proposals to address the issue of build-out rates, and the need to ensure, when developers are given planning permission, that the homes are built. Planning applications and permissions should not be the start of some endless haggle with local authorities which leaves communities understandably frustrated.

We are taking action on all fronts. We are providing significant new funding, reforming the system and working with local authorities. I think the hon. Gentleman himself made the point that this is a team effort. I have already mentioned the Green Paper on social housing, but I think it worth emphasising that we should look at not just the volume but the quality of the social housing that we are delivering. We should also consider the relationship between landlord and tenant, and, indeed, the stigma that has arisen in relation to social housing. My experience of meeting social tenants is that they work hard, take pride in their communities, and want to be treated independently and with some respect. We must ensure that we get that right as well. The Green Paper will be informed by the views of the tenants whom we have been meeting in recent months, in the Grenfell area—which was, of course, the catalyst for the Green Paper—but elsewhere in the country as well. Even in the limited time in which I have had this job, I have been down to Basingstoke as well as to North Kensington.

We are grateful to the large number of tenants who have shared their views and fed in their experiences. Those people and their communities remain our guiding light—our lodestar if you like, Madam Deputy Speaker—as we take forward our proposals. I look forward to working with the hon. Gentleman, and with others in all parts of the House, to ensure that we deliver the safe, secure, affordable homes that the country and local communities need.

That the Committee has considered the draft Insolvency of Registered Providers of Social Housing Regulations 2018.

It is an enormous pleasure and an honour to serve under your chairmanship, Mr Evans.

The regulations were laid before the House on 7 February 2018. Increasing the supply of homes is a top priority for the Government, and that includes increasing the number of homes for social and affordable rent to help people access decent housing in which to build and improve their lives. Since 2010, we have delivered more than 357,000 new affordable homes, including 257,000 affordable homes for rent. The Prime Minister recently announced an extra £2 billion of funding for affordable housing, which will increase the overall affordable homes programme budget to more than £9 billion. The new funding will support councils and housing associations to build more affordable homes where they are needed most—where families are struggling with rental costs and some are at risk of homelessness. Only last week, the Chancellor announced a further £1.67 billion to provide an extra 26,000 homes to further boost affordable housing in London.

Housing associations are a key part of the delivery of those new homes. Three things enable housing associations to borrow cheaply: a stable operating environment, a robust regulatory framework and the fact that there has been no default in the sector that has resulted in loss to lenders or investors. Insolvencies in the sector are rare. To date, there has only been one insolvency since the moratorium arrangements were introduced back in 1996. Both lenders and providers value very highly the no loss on default record of the sector, meaning that no lender has lost money in the event of a housing association insolvency. It is vital that we maintain that robust financial regime so that housing associations continue to deliver the homes we need.

We also want to protect tenants so that their homes are not put at risk should any landlord get into difficulty. That is why, in the Housing and Planning Act 2016, we introduced a special administration regime for the social housing sector. The regime will give the Secretary of State the power to apply to the court to appoint a housing administrator in the event of a private registered provider being at risk of insolvency proceedings. In introducing those changes, we were responding to concerns that the existing moratorium provisions were not suitable for modern, large, developing and complex housing associations that might conceivably get into financial difficulty. Although financial failure is extremely rare, the housing association sector has changed significantly in recent years. The level of private finance has grown from £48 billion in 2012 to £70 billion last year.

Having introduced the main provisions in the 2016 Act, the regulations extend the housing administration framework in that Act to registered societies and charitable incorporated organisations. For those who are unfamiliar with those terms, a registered society is defined in the 2016 Act as having the same meaning as in the Co-operative and Community Benefit Societies Act 2014. It is a particular type of legal entity. Registered societies include co-operative societies, community benefit societies and pre-commencement societies registered before August 2014. They need to be registered with the Financial Conduct Authority. A charitable incorporated organisation is defined within the 2016 Act as a charitable incorporated organisation within the meaning of part 11 of the Charities Act 2011. Again, it is a particular type of legal entity. There are four main types of charitable structure: the incorporated organisation, the charitable company, which is limited by guarantee, the unincorporated association and the trust.

Due to drafting complexities, the provisions in the 2016 Act apply only to those housing associations that are companies. That is the key reason we are here today. There are 1,483 non-local authority private registered providers of social housing in England, providing 2.6 million homes; 885 charitable incorporated organisations with more than 2 million properties; 336 companies with 380,000 properties; and 262 registered societies with more than 95,000 properties.

A further piece of legislation will be needed before the special regime can be enacted: a statutory instrument setting out the rules that apply to administrators’ conduct of a housing administration. That will follow the negative procedure.

Under the law at the moment, where a housing association gets into financial difficulty and steps are taken towards entering a formal insolvency procedure, a 28-day moratorium begins that restricts creditors’ ability to enforce their security during that period. If the regulator cannot reach a solution with creditors during that 28-day period, or during an extension, creditors are able to call in loans and seek to recover their debts through the sale of assets, which can include social housing stock.

At least in theory, that could lead to a fire sale of social housing, meaning the stock would no longer be regulated and tenants would lose the protections of the social sector, including rent regulation. Therefore, the 2016 Act gives the Secretary of State, or the regulator of social housing with the Secretary of State’s consent, the power to apply to the court to appoint a housing administrator. The administrator would manage the affairs, the business and the property of the registered provider of social housing for the duration of the housing administration.

I apologise for interrupting the Minister in mid-flow. I am not sure if it is the same in the rest of the country, but in London we are seeing a wave of amalgamations and takeovers of the smaller housing associations, apparently driven by Government policy, whether deliberate or unintentional. Is that part of the overall scheme? Does that fit into the protection that the Government are trying to introduce in terms of insolvency, or is that totally separate?

The hon. Gentleman makes an important point. One reason we are introducing these regulations is precisely because the housing association sector has changed. That does include some of the mergers and acquisitions—the consolidations—that we have seen with housing associations. It is ultimately a balance, but there is a real benefit to housing associations realising economies of scale in the way he has described, because that has a stimulus factor on the supply of new homes, which must be a plus.

Equally, as a responsible Government, we want to be mindful of any risks involved. The regulations can certainly be seen as ensuring that we have a strong regulatory regime in place so that we glean the benefits of the behaviour that the hon. Gentleman described, but also ensure that we mitigate the risk as best we can.

As with any administration regime, the main objective would be to rescue the organisation or return money to creditors. The crucial difference is that a housing administrator would also have a second important objective, which is to retain as much of the social housing as possible within the regulated sector. I think that goes to the point the hon. Gentleman alluded to. In addition, a housing administrator would not be constrained by a 28-day timeframe and would have the time to investigate the business and find the best solution possible in order to meet the objectives. We are ensuring that the process is flexible enough and specific to the housing association sector.

I thank the Minister for giving way and apologise for interrupting his speech. The hon. Member for Poplar and Limehouse raised the issue of amalgamations taking place. Something else being encouraged by the Government is for housing associations to borrow more money and, therefore, stretch their capability to pay down their bills and debts. I seek the Minister’s reassurance that, in the extremely rare event that a housing association were to go bankrupt or become insolvent, the tenants would be absolutely protected from losing their homes and from savage rent rises if the homes were sold in the private sector.

I thank my hon. Friend and, I think, vice-chairman of the Housing, Communities and Local Government Committee for his intervention. He makes an important point. As with the point made by the hon. Member for Poplar and Limehouse, my hon. Friend is right to raise this perfectly legitimate issue. The very reason for bringing in the regulations, which build on the primary legislation, is to ensure that we protect those social tenants in the way he described. The details of the regulations are technical and complex, but they hopefully serve precisely the objectives that the two hon. Members, who are from across the political divide, rightly raised. As with any administration regime, the main objective will be to rescue the organisation or to return money to its creditors. However, as I have said, it is crucial to protect the social tenants as well.

Turning to the specifics of the regulations, they extend the housing administration framework in the 2016 Act to registered societies and charitable incorporated organisations. They are complex but, simply put, they give effect to two schedules that apply certain provisions of the Insolvency Act 1986—with necessary modifications, of course—to registered societies and charitable incorporated organisations. To illustrate the nature of those modifications, they involve things such as modifying the Insolvency Act where it uses “administrator” so that it would read “housing administrator”, for where the court has appointed a housing administrator. They are quite technical changes and adaptations, but none the less significant ones, for this sector.

We carried out an informal consultation with representatives from insolvency practitioners, valuers, UK Finance and private registered providers and lenders prior to the introduction of the 2016 Act and again before laying the regulations. That group represented the organisations that have the main interest in housing administration, and they are keen to have this regime in place. It is important to say that the housing associations and the lenders and creditors—both sides—think this is an important piece of legislation to have in place. A fuller public consultation was not carried out due to the technical nature of the regulations and because the process of housing administration will only be required in the event of a housing association facing insolvency, which, as I have said, is an extremely rare contingency, but none the less one that we want to cater for.

The regulations apply to the whole of the UK. We want the regime to cover social housing stock in England, including any stock held by housing associations registered with the social housing regulator for England but that, as legal entities, are registered in devolved Administrations. To be clear, the provisions in the 2016 Act and in the draft regulations will only apply if there are English properties at risk from a housing association becoming insolvent. However, if, for example, a Scottish housing association had properties in England at risk from an insolvency, this housing regime would apply to that particular housing association.

These are important regulations in continuing to safeguard investment in social housing and, critically, protection for tenants. I commend them to the Committee.

We have had a good debate with some interesting technical interventions, and I am grateful to hear from hon. Members with a great deal longer experience of the sector than I have. The hon. Member for Rochdale made some kind remarks at the beginning and I appreciate his support of the regulations. He asked three specific questions, which I will endeavour to answer as best I can.

First, the hon. Gentleman asked how objective 1 and objective 2, as I described in the regulations, interact. Objective 1 is to rescue the business and service the creditors. Objective 2 is to look after housing, including social tenants. It is right that in one sense, the overriding objective 1 takes precedence over objective 2, because it is an insolvency proceeding. As a result, the housing administrator cannot do anything that results in a worse distribution to the creditors.

In all cases to date, the creditors have recognised that it was of the best value to them to save the properties in the sector. Having a social housing regulator and a specific regime for insolvency proceedings in the sector ensures that objective 2 shapes and influences the way in which objective 1 is delivered, which will provide materially greater protection for social tenants. If I understood correctly, that was key to what the hon. Gentleman was getting at.

The hon. Gentleman asked about lenders’ responsibility and due diligence, which is an important point. It is crucial that lenders take the initiative and ensure that their due diligence is in place, not only in relation to commercial transactions but in the social housing sector.

There has been a swathe of new regulation since the financial crash. I do not think it is a zero-sum game—I know the hon. Gentleman was not suggesting it was—and we need to do both. The protections in relation to due diligence and the regulation of lenders are in place, and lenders support the extension of the 2016 Act through the regulations. We can do both of those things, and that will create an increased tier of protection for tenants.

The hon. Gentleman asked about the lessons learned from Cosmopolitan, and the previous report commissioned by my Department. The Cosmopolitan Housing Group was a large private registered provider of social housing. It owned or was managing more than 13,000 homes in the north-west. It had serious financial difficulties, as described by the hon. Gentleman, in part as a result of its involvement in non-social housing activity. None the less, the regulator at the time, the Homes and Communities Agency, carried out intensive regulatory engagement with Cosmopolitan to resolve the situation. That engagement concluded with Cosmopolitan being taken over by Sanctuary Housing, which was a large and more financially robust provider. The specific situation was dealt with, and afterwards, in terms of the lessons learned—the crux of what the hon. Gentleman was getting at—the Homes and Communities Agency carried out an independent review of its handling of the Cosmopolitan case. As best as possible in the aftermath of such a financial challenge, lessons have been learned. I certainly agree with the hon. Gentleman that prevention is better than cure, and that is what the regulations will help achieve.

Can we be clear, though? In the end, it is the regulator who acts as the public eyes and ears with respect to the housing associations, to make sure that their behaviour is consistent with common sense and prudence. Are we certain that the regulator has the capacity to do that? That is not a malicious question. These are new duties on the regulator, but the general duty to cover the extraordinary range of different types of housing associations is a real one. It is important that we know that the regulator has both the competence and the capacity. I am confident in the competence, but I do not know about the capacity.

That is a perfectly legitimate question. Of course, the regulations are partly about making sure that the regulator has the capacity and the legal powers to deal with the whole sector. I hope that was addressed in my opening remarks.

The hon. Member for Poplar and Limehouse spoke about the history of housing associations in his constituency with great knowledge and insight. He also spoke about the pressures on rent. I accept that, particularly in London and urban areas. In the past year, we have seen 217,000 new homes delivered, which is the highest number in all but one of the past 30 years. That is important not just if someone wants to own their own home, but because supply is a key factor in bringing down the affordability of rent. There is other proposed legislation coming down the pipeline on the quality of rented accommodation as well.

The hon. Gentleman asked whether this is a protective measure. It is. It cannot be entirely dislocated from what is happening in the social sector and the evolution of that sector, so I suppose it is a response to both the regulatory gap and the evolving nature of the sector, making sure that as it grows and the structure of the sector changes, and we see the dividends in terms of supply and the economies of scale that build up, we also make sure that we have a careful safety net in place. Hopefully that is the right balance and the prudent course to take.

In conclusion, I say again that we imagine that the occasions when this legislation would be necessary, if ever, will be very rare. The introduction of the regime reflects the nature and the scale of the sector, which has changed and will continue to change. It is not a commentary on the state of the sector as it currently stands. Housing associations continue to be key partners in fixing the broken housing market that this Government are absolutely dedicated to addressing. It is right that we ensure the regulator has the tools and the capacity to do the job to maintain lender confidence and to protect tenants as far as possible should a potential insolvency occur.

My constituents, some of whom have been on the wrong end of aggressive behaviour by Persimmon, are concerned to know that since Help to Buy was introduced, the biggest private house builders have increased house prices by up to 10%, with almost all of that banked as profit and much of it paid out in senior managers’ enormous bonus payments. Should not the Secretary of State and his ministerial colleagues be doing more to tame the aggressive behaviour of developers such as Persimmon, rather than subsidising them through Help to Buy?

It is good news that Help to Buy has helped more homes to get built. It has contributed to about 14% of new build since 2015. I personally share some of the hon. Gentleman’s concerns about executive pay, but I gently remind him that it was this Government who introduced the corporate governance reforms in August, including to make sure that there is greater transparency and greater shareholder grip over directors’ pay.

The Minister will know that some 10% of those on the Help to Buy scheme earn over £80,000 a year. Even in London, they are people who can afford to buy without this taxpayer subsidy. In the light of the Secretary of State’s earlier comments about responsibility to the taxpayer, will he contrast the poorest homeowners who will lose help with mortgage interest with these heavily subsidised, well-off people up and down the country?

I think that some factual clarification would help the hon. Gentleman, because four out of five of those benefiting from Help to Buy have been first-time buyers, and three out of five households benefiting from Help to Buy had combined incomes of £50,000 or less. We are on their side; it is a shame that Labour is not.

I thank the Minister for that answer. Charnwood Borough Council—for the sake for disclosure, I should say that my husband is the leader, although I refuse to call him that—has planning permissions for 10 years of housing, but the difficulty is getting the developers to start building. If that does not happen, that affects the five-year land supply, which leaves other sites vulnerable to development. Will the Minister tell the House what the Government are planning to do to speed up delivery by developers on planning permissions they already have?

The good news is that, in 2017, we saw 160,000 new homes registered to be built, which is the highest number since the financial crash. My right hon. Friend is right about speed. The NPPF will help to deliver that through the housing delivery test, and my right hon. Friend for West Dorset (Sir Oliver Letwin) is reviewing build-out rates.

Yes, but let us look at this consultation from last week. According to the Government, neighbourhood plans can be overturned by local councils above them, and—above them—local council plans can be overturned by the Secretary of State and his faceless bureaucrats. What is wrong in this country with freedom and democracy, with local people making the decisions effectively, fairly and democratically? Is this Joe Stalin or English democracy that this Government are forcing upon us?

For all that thunder and lightning, we are investing £23 million to support neighbourhood planning groups. I gently remind the hon. Gentleman that 94% of councils have published local plans, compared with 32% when Labour left office. The previous Labour Government wantonly failed to deliver on encouraging the take-up of local plans, where this Government have succeeded.

Talking of planning ahead, two councils in Somerset—Taunton Deane Borough Council and West Somerset Council—are waiting to form a single council. Last week I attended a meeting of the Eaton Park residents association as part of the consultation on Stoke-on-Trent’s joint local plan. They are aghast at proposals to use the greenfield site of Berryhill Fields, while brownfield sites are left unlooked at. When it comes to looking for new housing development sites, what can the Minister say to ensure that those residents know that brownfield sites will always be chosen over greenfield sites?

For the record on the hon. Gentleman’s figures, local authorities have built over 10,000 homes since 2010-11 compared with under 3,000 in the 13 years of the last Labour Government. We are restless to do much more, and that is why we are raising the housing revenue account borrowing cap by up to £1 billion to make sure that we spur local house building as far and as wide as we can.

It is a good question, and probably one for a symposium with everyone from developers to planners. The reality is that we want to see a stabilisation in house prices. We need to build more homes and deal with some of the demand issues that have been raised. There is no single answer; we have to yank every lever at our disposal 20% or 30% harder.

Two weeks ago, I asked the Department for the number of houses that will not be built because of land banking, and the answer came back:

“The Department does not hold the requested information.”

How can the Minister crack down on land banking if he has no information? I believe that the Minister does have that information, and I urge him to publish it so that he can monitor the builders and we can monitor his performance.

I welcome that scrutiny. It is very difficult to establish a negative in the way the hon. Gentleman suggests, but I can reassure him, first, that we have the housing delivery test in the NPPF, which will focus local authorities and developers on the delivery of new homes, and, secondly, that there is the review by my right hon. Friend the Member for West Dorset (Sir Oliver Letwin) of build-out rates, which will squarely address the point he is concerned about.

The current definition of affordable housing, introduced by the coalition Government, is set at 80% of local market rate, but when house prices are spiralling out of control, as they are in my constituency, this definition of affordable housing is a cruel joke to those on low or median income. Will the Secretary of State commit to replacing this absurd definition so that housing can be genuinely affordable to my constituents?

I understand the issue the hon. Lady raises. I would just say that the numbers on social housing waiting lists are down by half a million since 2010, and the number of affordable homes in total, including social housing, is higher in the last seven years than in the last seven years of the last Labour Government. However, we are anxious to do even more. I am not sure that fiddling with the criteria for how these things are measured is the answer. We need to build more homes across the board and I welcome the hon. Lady’s support in that regard.

The county council is broadly supportive of the Government’s consultation, but does the Minister agree that the overall funding formula needs to be looked at in detail, because if the baseline is not addressed Leicestershire will still be falling behind other county councils?

T8. A recent report by the Campaign to Protect Rural England says that viability assessments favour large developers over small developers and cut the number of affordable homes by 50%. Will the Minister take the strongest possible action to make sure that small and medium-sized enterprises compete on a level playing field with large developers, and that developers provide homes for those most in need?

Friend is absolutely right, and through our planning reforms we are putting far more rigour into the system so that plans are clear about the obligations expected for infrastructure and affordable houses, and also so that developers can be properly held to account in meeting those aspirations and commitments.

T10. With High Speed 2 set to displace a number of tenants living in social housing in my constituency, will my hon. Friend consider whether the Rent Act 1977, which obliges councils to rehouse council tenants whose homes are subject to compulsory purchase orders, will need amending to reflect the fact that the majority of social housing stock is now owned by housing associations rather than local authorities?

I entirely understand my hon. Friend’s concerns, but I hope that I can give her some reassurance. I do not think that there is any need to amend the 1977 Act because local authorities are already obliged, through the Housing Act 1996, to consider those in need of social housing, so local authorities will make appropriate nominations to housing associations or offer tenancies in their own stock.

When are we likely to get a decision on the fantastic plans for expansion at the Mall at Cribbs Causeway in my constituency? With the greatest of respect, I do not know why the Secretary of State is taking so long, because I do not know what there is not to like about thousands of new permanent jobs, more housing and better transport infrastructure.

It is an honour to serve under your chairmanship, Mr Streeter. I pay tribute to the hon. Member for Croydon North (Mr Reed) for securing this debate and speaking powerfully about the situation his constituents find themselves in. I am very grateful for the contributions of Members from all parts of the House. I will try to address as many of them as possible in the limited time available.

Before I address squarely the issues facing residents in Croydon and people in other residential buildings we have heard about today that have rightly been raised, I want to give a little bit of wider context. The fire at Grenfell Tower was a terrible tragedy—a tragedy that should not happen in 21st-century London or anywhere in this country. The Government are committed to learning the lessons from Grenfell and ensuring that nothing like that can ever happen again. Like the hon. Member for Lincoln (Karen Lee), I have been down there and seen the devastation. I have talked to residents of the Lancaster West estate. I am personally committed to learning the lessons.

Immediately after the fire, the Department set up a building safety programme with the aim of ensuring that all high-rise residential buildings are safe from the threat of fire and crucially, as Members have rightly said, that residents can feel safe and can rest assured in their homes. To support that, the Secretary of State appointed an expert panel to ensure that the necessary steps are taken to ensure the safety of residents of high-rise buildings. We have consistently relied on that expert advice, because the issue of public safety is central to what we need to achieve.

Through screening tests, we swiftly identified social housing blocks and public buildings with unsafe cladding. Working with the expert panel, the Government provided advice to building owners on the interim measures that they should put in place to ensure the safety of their residents. Of course, that depends on the individual property, as hon. Members have rightly said, but interim measures can include warden systems, measures to prevent the spread of fire to or from car parks, and all sorts of other things. All the affected social sector buildings that have been identified have those measures in place. We are confident that that addresses the immediate issue of safety for residents. I do not think that that should be elided or confused with the wider remediation efforts that, quite rightly, also need to take place. We can give that assurance to residents.

At the same time, we tested different combinations of cladding and insulation to see which met the building regulations guidance. We published consolidated advice last autumn confirming the results of those tests, with advice for building owners, as the hon. Member for Hammersmith (Andy Slaughter) discussed. Since then, we have been working with building owners and the industry to support remediation work. The hon. Gentleman suggested that the Government have not provided clear guidance on the materials for remediation. Actually, the expert panel published advice on 5 September, and further advice was published in December, including an information note for building owners. The Building Research Establishment has also published a catalogue of past BS 8414 tests to assist building owners choosing compliant materials. I hope that that gives the hon. Gentleman some reassurance.

We have been working with local authorities to help them identify private residential buildings with similar cladding, and to ensure that they, too, are made safe. At the same time, as hon. Members know, we have asked Dame Judith Hackitt to undertake an independent review of building regulations and fire safety, to ensure that buildings are safe in the future, in recognition of the clear flaws that have been discovered in relation to the previous system. We welcomed her interim report, which was published in December, and have committed to implementing all her recommendations.

The suggestion that we are sitting on our hands, that we have not looked at this matter soberly, properly and carefully, or that we are not taking action is quite wrong, as the action in relation to Dame Judith’s review illustrates. We look forward to the publication of the final report later in the spring. Obviously it is a detailed piece of work, which needs to be done carefully and properly.

The hon. Members for Croydon North and for Hammersmith asked about the role of desktop studies. We will consult on that shortly in response to the recommendations from the Hackitt review, so we are already taking some of the findings forward. The hon. Members for Greenwich and Woolwich (Matthew Pennycook) and for Croydon North mentioned the tragic Lakanal House fire in Camberwell in 2009. Just for the record, and as a matter of balance in today’s debate, it is right to point out that the shadow Housing Minister, the right hon. Member for Wentworth and Dearne (John Healey), refused extra funding for fire safety measures when he was the Housing Minister, because he did not deem them necessary. I am not saying that to score political points. [Interruption.] I am making the argument—

I am saying it for balance. Any hon. Member in the post of Minister would look at the matter carefully and responsibly, and take the expert advice. That is what the right hon. Gentleman did, and that is what we have done.

Let me turn to some of the specific points that have been raised today, starting with the identification of buildings with unsafe cladding. We believe that we have identified all affected social housing blocks and public buildings, and interim measures are in place as and where necessary, suitable to the individual buildings, as I have described. With regard to private sector buildings, the Government made the testing facility at the Building Research Establishment available free of charge. We continue to urge all building owners to submit samples for testing if they think that there is any reason to believe that they may be unsafe because of cladding.

In addition, the Secretary of State wrote to local authorities in August asking them to identify privately owned buildings with potentially unsafe cladding. It is their statutory responsibility to do so. The majority of local authorities recognised the urgency of that work, and provided relevant information. We are very grateful for all their hard work, and I pay tribute to the hon. Member for Slough (Mr Dhesi), who talked about some of the good work that has been done by his local authority.

This is not a straightforward task. We have been in continual dialogue with local authorities ever since that point. The collaboration is close and constant, and it continues. In fact, an event is taking place a few hundred yards from here as we speak, bringing together the Ministry and its experts, local authorities, officials and the fire and rescue service to discuss best practice.

In response to the question asked by the hon. Members for Manchester Central (Lucy Powell) and for Slough, just last week we announced a financial support package of £1 million to assist the most affected local authorities in identifying private high-rise buildings with potentially unsafe cladding. We are also looking at the statutory guidance and the statutory operating directions for local authorities in their relationship with those private sector building owners. Those measures will reinforce local authorities in carrying out that work. I assure hon. Members that as soon as we are notified of buildings with potentially unsafe cladding, we will work with the owners and the relevant fire and rescue service to ensure that those interim measures are put in place.

I want to address not just the points that the hon. Lady has made, but those made by all hon. Members in the debate.

The Government have been very clear that the remediation should be done as swiftly as possible, but it must be done properly—precisely because we are talking about the long-term public safety of residents. Let us be clear: the remediation of buildings with aluminium composite material cladding is a complex process. It involves major construction work that needs to be planned, consulted on, and carried out professionally and carefully.

Planning alone can take up to a year. It is not just a case of ripping down the cladding then deciding what to do next. I am encouraged that remediation is already under way in 58% of affected social housing buildings, and that seven have finished their remediation work already. Clearly, there is a long way to go, but that is significant progress. At least one or two hon. Members in today’s debate seemed to be blithe about the work that is under way, how difficult it is, and how important it is to do it properly.

Let me turn to the issue of funding.

I am not going to; I will address the direct questions asked by the hon. Member for Croydon North and others about funding. In the social sector, all the local authorities and housing associations that we have spoken to have indicated that they are choosing not to pass on the costs of essential remediation to individual flat owners within their buildings. We will also consider financial flexibilities for local authorities to fund essential fire safety works to buildings that they own. We have not yet declined a single request. We are taking this very seriously, and have engaged in protracted dialogue with those people who have come to us.

In the private sector, of course, the allocation of responsibility depends on the terms of the leasehold arrangements, as qualified by general law. The determination of the legal position will obviously need to be settled ultimately by a court. Proceedings are under way in the constituency of the hon. Member for Croydon North, as I am sure he knows. I took the point that my hon. Friend the Member for Hendon (Dr Offord) made: that it cannot be right for a Minister to pre-empt or prejudge the legal determination of a relationship, where it is not only spelled out in the leasehold arrangement, but qualified by general law.

In some cases, the costs fall, in practice, to landlords or building owners; it may be clearer in some leases than in others. Where the costs do not fall to landlords or building owners as a matter of strict law, we continue to urge those with responsibility to follow the lead of the social sector. We urge those private companies to do the right thing, and not to attempt to pass the costs on to residents. They can meet some of those costs—hon. Members asked about this—through alternative routes such as insurance claims, warranties or legal action. It is rightly for them to pursue those avenues. They have the financial means, the relationship—legal or otherwise—and the wherewithal to do so. The Secretary of State and I have been clear about that in direct conversations, including with those who own the property in the constituency of the hon. Member for Croydon North. Where building owners are seeking to pass on remediation costs to leaseholders, it is important that leaseholders are able to get specialist advice. The Government have provided free legal advice and support through a range of measures, including the Leasehold Advisory Service, or LEASE—a free and tailored service.

In the time available, I hope that I have illustrated not just the complexity of the challenge that we face across the private and social sectors, but the Government’s concerted effort to deal with the immediate issue of public safety and to ensure that the allocation of responsibility sits in the right place, which in our view is with the building owners.

It is a privilege to serve under your chairmanship, Mr Owen. As is the custom, I congratulate the hon. Member for Hammersmith (Andy Slaughter) on securing this debate. We have sparred many times on justice matters, and I look forward to an equally rigorous friendship on housing issues. He takes a close interest in those issues and I know how tenaciously he makes his case for his constituents and on matters of principle. I pay tribute to the residents who have come to listen to him and to hear the different views on this important matter.

I take note of all the hon. Gentleman’s points regarding the merits or otherwise of the development of the Earl’s Court and West Kensington area. He will know that the Secretary of State for Housing, Communities and Local Government has been asked to make a decision on two specific matters submitted for his determination. The determination requests are currently being considered in the Department. The hon. Gentleman made some specific requests that I want to address clearly. As a lawyer and an assiduous local MP, he will know that that process precludes me, for legal and propriety reasons, from commenting specifically on the regeneration proposals for the Earl’s Court and Kensington area. As he knows, to do so would prejudice the very decision making he is calling for. Notwithstanding those limits, in his usual deft way he has highlighted his concerns over the Earl’s Court project while also raising—the shadow Minister did this, too—wider issues relating to social housing and the place for regeneration within that. I will say as much as I conceivably can.

Members will know that social housing is a priority for this Government. Last year we announced a review to examine the issues affecting social housing. To help inform the Green Paper we have spoken directly with 1,000 people who live in social housing, as well as with more than 7,000 people through online surveys. Notwithstanding the fact I have only been in this post for a short time, I have been to two workshops this year in Basingstoke and for Lancaster West residents in north Kensington. I hope that reassures the hon. Member for Kensington (Emma Dent Coad). Those workshops and the wider feedback have made a profound impression on me. We have an important opportunity to look afresh at the sector. A lot of the wider points that Members have made will feed into, touch on and resonate with some of the issues we will be grappling with. We will publish the Green Paper this year for consultation, and I look forward to engaging with all Members at that point on those wider policy issues as we strive to get the best out of the social housing sector.

More broadly, the Government are increasing the supply of homes and implementing policies that help people to access housing, whether they are renting or looking to buy in whichever sector, private or social. In 2016-17, which is the last year for which we have full figures, nearly 220,000 net additional homes were delivered. There were more than 41,000 affordable housing completions, which was up 27% on the previous year. We saw nearly 145,000 completions on the Help to Buy equity loan scheme by the end of September 2017.

Building affordable homes is a top priority for this Government. Since 2010, we have delivered more than 357,000 new affordable homes. In relation to the specific issues raised by the hon. Member for Hammersmith, about one quarter of those homes have been delivered in London. The Prime Minister recently announced an additional £2 billion of funding for affordable housing. That will increase the affordable homes programme budget to more than £9 billion. The new funding will support councils and housing associations to build more affordable homes where they are needed most: where families are struggling with rental costs and some may be at risk of homelessness.

The shadow Minister raised the issue of affordable housing in the wider context, and the hon. Member for Hammersmith made a number of political points. I hope both will forgive me for pointing out a few basic undeniable facts about affordable homes in Hammersmith and Fulham. Affordable home delivery in Hammersmith and Fulham in 2016-17 was 28% of the level of the last year of the previous Conservative administration. In the same year, Hammersmith and Fulham delivered 15% of the affordable housing that Wandsworth delivered. I note that as a matter of balance with the account of the borough given today by Members. It is worth putting it in some perspective. Nevertheless, across the political aisles and across the country—the issue is most acute in relation to London, where there is a serious housing shortage and high demand—I think we all are clear about our ambition and restlessness to go much further.

At the autumn statement in 2016, we agreed a record-breaking £3.15 billion package of funding for affordable housing in London to deliver at least 90,000 new affordable homes by March 2021. In addition, London will also get a share of the extra £3.4 billion investment in the affordable homes programme announced recently. Since 2010, we have delivered more than 357,000 new affordable homes, and about one quarter of them have been in the capital.

As London struggles to build enough homes to keep pace with demand, attention is naturally turning to the broader options regarding the regeneration of housing estates. Estate regeneration done the right way can create new improved homes and communities for the people who live there. It can increase the supply and quality of homes through densification and design. Those two can be viewed as a win-win, rather than a zero-sum game. Savills has estimated that in London there is capacity to provide more than 54,000 additional homes using a street-based model. The Government published a new estate regeneration national strategy in December 2016, which supports local partners to improve how they do estate regeneration in partnership with residents to drive better quality housing, local growth and wider opportunities for the residents of local communities.

To give some examples of good practice, in the north Solihull area of Birmingham, a focus on education with the local community infrastructure amenities has led to an increase in educational standards. The regeneration set out to change the lives of 40,000 people by building new homes of mixed tenure, developing new state-of-the-art schools and creating new village centres with improved health and enterprise facilities. The best estate regeneration schemes make the community central to the project.

The Spirit Quarters redevelopment in Coventry is a resident-led scheme. They have set up three social enterprises: a community café, a neighbourhood centre and a business centre. In addition to the physical transformation, there have been improvements in many social and economic outcomes. Overall, reported crime in the area is down by almost 20% and the number of residents claiming jobseeker’s allowance has reduced by 44%. The percentage of students leaving school with five or more GCSEs at grades A* to C has increased from 5% to 33%. Those are all incredibly positive outcomes.

The issue of tenant participation has been raised by hon. Members. Residents are clearly key partners in any regeneration scheme. They should have opportunities to participate from the start, developing the vision, design, partner procurement and delivery. Working with residents can help to build trust and consensus on regeneration. I have said this numerous times since taking on this portfolio: we need to build more homes, but we also need to build up stronger communities, too,

It is particularly important that residents have the opportunity to express their views on the final options for regeneration, whether as individuals or through the democratic process more generally. The way that is done should be agreed locally. That is the template for the national policy that we put out. The regeneration should have the support of a majority of the residents whose lives will be directly affected. At the Wornington Green estate in north Kensington, support for the regeneration was helped by early and ongoing conversations with residents. It included a resident steering group, regular outreach, independent advice and advocacy, regular public meetings, and training for residents.

It is important to set out a clear set of commitments about how the regeneration process will work and what housing options are available. Providing security and confidence through a charter early on is one option for helping to establish trust and foster positive discussions about the scheme. All existing council and housing association tenants, whether on a lifetime or fixed-term tenancy, should have the option to return to the estate. It is a legal requirement for leaseholders to be compensated if their home is demolished. However, we expect that schemes will go further and offer leaseholders a package that enables them to stay on the estate or at least close by.

It is important that home purchase options are made available. Residents should be given the opportunity to change tenure if they so wish. Regeneration can help first-time buyers get a foot on the housing ladder and provide opportunities for tenants to own their homes. Shared ownership has an important role to play in helping those who aspire to home ownership but cannot afford to buy. For example, residents of the Rayners Lane estate in Harrow have been guaranteed the right to remain in affordable housing on the estate, with the extra 260-plus homes creating a vibrant mixed-tenure community through the introduction of outright sale and shared ownership. All of that requires strong leadership from local authorities.

Our strategy highlights the importance of devolution and the leadership role of local authorities working with their communities to support estate regeneration. We have seen good examples of that type of strategic leadership and co-operation. Notwithstanding the criticisms that have been made, I hope we will not throw the baby out with the bathwater and lose sight of the good examples and the positives.

Combined authorities in the Tees valley, the west midlands and Greater Manchester are now tackling housing and regeneration alongside transport, infrastructure and skills as they take a more holistic approach. Strategic regeneration plans can act as the catalyst for delivering place-based services and infrastructure through, for example, new community hubs and schools that service the areas being regenerated.

Opposition Members have sometimes accused me of focusing too much on London and the capital. However, the regeneration of Anfield in north Liverpool has focused not only on housing, but on the place as a whole, including the commercial offer and the wider infrastructure. Your Housing association, Liverpool football club and Liverpool City Council created a partnership that enabled them to consider the needs of the community across the whole Anfield area. That was important and is a good example of the strong joint partnership and long-term community engagement that has transformed Anfield into a place where people want to live.

I appreciate the tone of the Minister’s speech and what he said about not giving a view on the regeneration scheme. However, may I press him a little on two points? First, if he cannot say what his position is, can he indicate—this is not unreasonable after two years—when there is likely to be a decision on the right to transfer? Secondly, there are many regeneration schemes, but so many of them involve a reduction in the number of social rented homes. When we have a new deal for Earl’s Court and West Kensington, will he agree to work with the other players there to ensure that we preserve and enhance the existing community?

The hon. Gentleman has made his point in a constructive and reasonable way. I appreciate his frustration on the time issue. After the length of time and all the issues that have been churned over, no one will say this has been done in a rushed way, but we need to take the time required to get the decision right. I cannot give him a specific timeframe, but we will move as expeditiously as we can. I certainly will take back to the Department the point that he has made.

On the wider question, we have an opportunity through the social housing Green Paper. We will collate the extraordinarily wide range of feedback we have had. We will put that into the proposals through a Green Paper for consultation. I look forward to working with the hon. Gentleman and hearing from him at that stage.

In conclusion, I want to make sure this debate does not lose sight of the fact that local regeneration can offer enormous scope to build more homes and at the same time build up our local communities, which, whatever side of the political argument we sit on, is the shared objective. It requires ambition from local authorities, which many are providing. It also requires that residents have a strong voice in the process to shape the local plan, and support from central Government, which London and many other communities are receiving, not least with the recent homes infrastructure funding that has been made available. It also requires strong leadership to carry local communities with us.

I congratulate my hon. Friend the Member for Tewkesbury (Mr Robertson) on securing the debate. He made some powerful points about the supply of new homes, the type of stock and the wider issues about affordability. They were tenaciously made and duly noted by the Government. I also pay tribute to my predecessor, my hon. Friend the Member for Reading West (Alok Sharma), for the sterling job that he did. I know that he will take that energy and focus into the Department for Work and Pensions.

Today, we have had a thoughtful and very well-informed debate, with valuable insights from hon. Members across the House representing a range of communities, whether those are urban, rural or suburban communities like my own. Building the homes that Britain needs is one of the great social challenges of our generation—a national mission—but we must carry local communities with us. We have heard a lot about that today. From my point of view, I see that dual mission not as a zero-sum game, but as two sides of the same coin. We must get an effective set of outcomes that work not only for the country, but for communities.

The most recent data from the English housing survey shows that the proportion of households owning their own home has steadily declined since 2003 to its current level. It stabilised around 2013 and has remained broadly stable since. We are therefore at a crossroads. It is time to turn this challenge into an opportunity and grasp it with both hands.

There are some positive signs. Last year, we saw 217,000 homes delivered, the highest number in all but one of the last 30 years. Just last week, the Halifax survey showed that the number of first-time buyers in 2017 was the highest in 10 years—since the financial crash—while the National House Building Council survey showed the highest number of new homes registered to be built since the financial crash. That, though, must be the point of departure, not the point of arrival. We need to deliver in the region of 300,000 homes each year, if we are to provide the homes Britain needs and make them more affordable—for the nurse, for the teacher, for those young families on low and middling incomes trying to get on to the housing ladder.

This is not just about those who are buying, of course: increasing the supply of new homes is vital for bringing down the cost of renting, too. The Government have an ambitious plan and we are restless to get more homes built. There is no silver bullet, as hon. Members pointed out. There are just various pieces of the jigsaw puzzle and we must be assiduous in putting them all together. The first policy lever is the national planning policy framework. I am pleased to say that we will be consulting on changes to the NPPF to reduce obstacles to home building. In that context, I listened carefully to the range of concerns raised by hon. Members across the House.

I will not pre-empt publication, but as the House will know from the Secretary of State’s statement, we intend to consult on changes, for example, to density to free up local authorities to build perhaps one or two storeys higher—whether apartments, terraced homes or other designs—if that is in keeping with their local area and in accordance with what local constituents and communities want. That will provide greater flexibility in towns and urban areas, where demand is particularly high. The points about regional variations in demand and affordability were well made by hon. Members across the House. We want to encourage homes to be built—we want to clear away those obstacles—and to promote local design, buy-in and support for this national mission. We will therefore publish a revised draft of the NPPF and launch our consultation by Easter.

I want to be clear on one issue on which feelings always run high—I know from my own local experience how important it is: the green belt, which is cherished by hon. Members and their constituents and communities. Our NPPF makes it clear that most new building on green-belt land is inappropriate and should be refused planning permission, except in very specific circumstances, and only in exceptional circumstances may a local authority alter the green-belt boundary, after consulting local people and submitting a revised local plan for formal examination. Broadly, since 1997, the proportion of green-belt land has stayed relatively steady at 13%.

There is a broader point here about home building and the overriding need to carry local communities with us, whether rural, suburban or urban communities. That is why last week the Government announced the first wave of money being allocated from the homes infrastructure fund. Last week alone, we targeted £866 million of investment, or 133 local housing projects, from London to Manchester, Cornwall to County Durham, to unlock building capacity for up to 200,000 new homes. We recognise we need more homes, but we also know that communities worry about new developments —my hon. Friend the Member for Witney (Robert Courts) made this point very well—and ask some reasonable questions: what will it mean for congestion on the roads, and what will it mean for pressures on schools and local NHS services? There is certainly a link with pressures from immigration. Once we have left the EU, we will have greater scope and control over that to get the balance right.

The Government hear those concerns loud and clear. That is what the homes infrastructure fund helps to address. We will be having a further round of funding in about a month’s time to deal with bigger infrastructure projects. The key is that, by investing in local authority-led projects in areas where demand is greatest, we can build not just more homes but stronger communities at the same time, which is crucial to the strategy the Government have presented.

I come now to the next public policy lever that we must yank even harder to speed up the rate of building—the shadow Minister and Members on the Conservative Benches made this point. There is, I think, a cross-party consensus on the objective, although whether there is such a consensus on the means is another question. The point was made very well by my hon. Friend the Member for Harborough (Neil O’Brien) and also by the hon. Member for City of Durham (Dr Blackman-Woods).

Let me put this in context. In the year ending March 2017, 304,000 planning permissions for new homes were granted, an increase of 15% on the previous year and of 70% on five years ago. The latest figures—which, admittedly, date from 2016—show that detailed planning permission was granted to 684,000 homes that had not been completed.

The Government’s position is clear: new homes should be built as soon as possible once planning permission has been granted. Our housing White Paper contains a range of proposals to tackle issues that delay or prevent the building out of developments. They include proposals to give local authorities stronger tools with which to ensure that sites with planning permission are built out, to provide more transparent data on housing delivery and to tackle delays associated with, in particular, pre-commencement conditions.

My right hon. Friend the Member for West Dorset (Sir Oliver Letwin) is leading a review of the gap between the number of planning permissions being granted and the new homes actually delivered, with a view to reducing it. The review panel will make its recommendations for closing the gap and will report on its findings later this year. We want to establish what more can be done to ensure that developers cannot wriggle out of commitments to build more affordable homes in the right places, after planning permission has been granted. That is another important piece of the jigsaw: another important element of the strategy that we are presenting today.

Members across the House made the point that Governments must lead by example. This is not really about a private sector monopoly; the state has a role to play. That argument was made especially clearly and saliently by the hon. Member for Chesterfield (Toby Perkins). Releasing more surplus public sector land to boost the supply of new homes is obviously a powerful way of achieving our goal. We will be pressing Whitehall Departments to release more of that surplus public sector land, with a view to generating a further 160,000 new homes. Homes England can help them by providing expertise and targeted investment.

Let me return to the objectives to which I referred at the beginning of my speech. The release of public sector land offers opportunities to provide less expensive homes for essential public sector workers such as nurses, teachers and police officers.

I know that the hon. Lady has a great deal of experience in this regard and she is right. I suspect that what is needed is a mixture of coaxing and cajoling, carrot and stick. We must try to ensure that there is a win-win. However, it seems to the Government, and certainly to me, that there is a huge opportunity not just to build more affordable homes, but to control the process to ensure that those homes are for key workers on low and middle incomes.

We have heard a range of excellent speeches. I shall try to do justice to as many as possible in the time available. The hon. Member for Halton (Derek Twigg) raised the issue of funding and, in particular, the issue of the homes infrastructure fund. As I have said, we want to encourage the building of more homes, but we know how important it is to provide the infrastructure that will enable us to carry communities with us.

May I press the Minister on that, if he does not mind? Halton Borough Council is saying that, because the brownfield land is either contaminated or has already been allocated and used, there are exceptional circumstances to build on the green belt. My constituents do not agree and nor do I. Can the Minister tell me whether that is correct? May I also ask whether he is going to do anything about developers who build on green belt before all the brownfield land has been used?

The national planning policy framework makes it very clear that building on the green belt must be the last resort. Well disposed as I am towards the hon. Gentleman, he will not tempt me to start commenting on individual plans or planning applications, but I can tell him, in relation to his own local authority, that we did not have a bid for the homes infrastructure fund and we want the bids to be locally driven. Then we will look on them as sympathetically as possible—in accordance, obviously, with a set of criteria—to maximise the output.

Does my hon. Friend understand that, for smaller authorities such as Isle of Wight Council, which is just about the smallest county council in Britain, it is difficult because we do not have the capacity always to know how the central Government system works? Therefore, we lose out when it comes to applying for some of these funds.

I listened to my hon. Friend’s passionate, tenacious and articulate speech on behalf of the Isle of Wight. I am happy to look again at whether we can provide any support in relation to the bidding process, but we are in a Catch-22 because we will be criticised for imposing ideas on local communities—particularly the smaller ones—if we do not allow bids to be community-driven and led. However, let us take that forward and see whether we can work together.

I cannot tell my hon. Friend the Member for Grantham and Stamford (Nick Boles) how fantastic it was to see him in the Chamber, back in fine fettle, setting the housing market in context. As usual, he is a one man walking ideas factory, offering ideas that I am already in part looking at trying to take forward. He made a powerful case for the national mission to build more homes and for trying, as we—I emphasise this—carry communities with us, to think in radical terms to get this job done.

The hon. Member for Coventry South (Mr Cunningham) made some important points about the green belt. My right hon. Friend the Member for Arundel and South Downs (Nick Herbert) brought his experience directly from a local public inquiry to inform the debate at the national level. He also raised the issue of equality of arms between developers and local communities, an important point well made.

I am going to make some progress as I need to allow two minutes for the wind-up, otherwise it would be frowned upon by Madam Deputy Speaker.

My hon. Friends the Members for Hazel Grove (Mr Wragg) and for Bolton West (Chris Green) talked about the need to prioritise brownfield over green spaces. That is already in the NPPF of course. We will look at whether we need to reinforce that message. My right hon. Friend the Member for Forest of Dean (Mr Harper) made important points about finance, but also about the geographical differences in the housing challenge we face. He made those points well. My hon. Friend the Member for North East Derbyshire (Lee Rowley) also talked about having a tailored approach to different regions and communities. That point was well made.

The hon. Member for Bath (Wera Hobhouse) spoke about the reality that a lot of affordable housing is not that affordable and is still costly. We clearly need to look at that both in this context and in the social housing Green Paper. The hon. Member for Mitcham and Morden (Siobhain McDonagh) spoke with passion and conviction. She is right that we need to address this at many levels. I like the sound of some of her ideas and look forward to having that cup of tea with her and seeing how we can take them forward.

This Government’s mission is to reverse the decline in home ownership and revive the dream of Britain as a property-owning democracy. We must revive that dream for the key workers and for those on low and middle incomes striving to get on to the first rung of the housing ladder. Above all, we must deliver the homes we need for the next generation. We must build the homes Britain needs in the right way and in the right places. That is a great challenge, but an even greater opportunity, and one we must seize with both hands.

I thank the Minister and all the Members who have contributed to this debate; as I anticipated, it was heavily subscribed. Members raised points from their own constituencies, which was perfectly correct. That gave a good flavour to the debate, which has given the Minister a lot of good ideas—and maybe a few headaches as well.

In winding up, I want to pick up where the Minister finished. I entirely agree with him: one of my favourite Margaret Thatcher policies was that on home ownership. She extended home ownership to so many people who previously would not have had the chance to own their own home. I am absolutely with the Minister and the Government in their desire to increase the number and percentage of people who own their own home.

I am pleased that the Minister recognised that housing supply is not the one silver bullet. Indeed there is no silver bullet. I stress that the building of more and more and more houses will not necessarily lead to greater affordability. There is not an easy answer, but we must work even harder to make sure that we achieve what I think all Members want.

I certainly will contribute to the discussions on the planning guidance. I ask for further clarification, however, on the green belt and unmet housing need. As I said earlier, the Government have stated in planning guidance in the past that unmet housing need is unlikely to outweigh harm to the green belt in importance. The Government must be a little clearer on that as we move forward.

(Urgent Question): To ask the Secretary of State for Housing, Communities and Local Government if he will make a statement on the implications of the withdrawal of the Building Research Establishment’s safety test results for insulation materials used on Grenfell Tower.

I wish to respond to the right hon. Gentleman’s question and the decision by the Building Research Establishment to withdraw a building cladding safety test from its website.

The BRE was contacted by the insulation manufacturer, Celotex, after it identified anomalies between the specification for a particular cladding system it had submitted for testing and the actual system tested. It was alerted to the issue last week, and we were informed by the BRE last Wednesday. As a result, the BRE has withdrawn the classification report relating to that specific test, which was carried out in 2014. That is clearly the right thing to do. The cladding system in question included a fibre cement board, rain screen and Celotex RS5000 insulation. Celotex will now schedule a retesting of that system as soon as possible, as detailed in the relevant test report. It is important to make it very clear that this was not a test of the aluminium composite material cladding system that was widely reported and understood to have been present on Grenfell Tower, and it would be wrong to conflate the two.

In the meantime, we understand that Celotex is contacting all its customers who have used this material. We have published advice for building owners on the fire safety of cladding and insulation materials, including this type of insulation, and that advice still stands. As it makes clear, building owners should take professional advice on any further action they think might be necessary, reflecting their buildings’ particular circumstances. More broadly, we continue to expect building owners to progress any necessary remedial works and, where necessary, to implement interim fire safety measures to make sure that residents and their buildings are kept safe.

The Government’s fire testing system is in chaos, yet the Minister offers no fresh advice, let alone fresh action, to deal with the problems. More than seven months on from the Grenfell Tower fire, only three out of 300 high-rise blocks confirmed to have unsafe cladding have had it removed or replaced, so thousands of families across the country are still living in homes that are not safe, and other privately owned blocks with the same suspect cladding have not even sent it for testing, despite the Government’s saying they should back in August.

On Friday, the Government’s test centre, the BRE, was asked to withdraw the 2014 safety test results that approved the insulation materials on Grenfell Tower. How many other residents are living in how many other high-rise blocks with that same insulation, which now has an invalid approval? Are any other BRE tests similarly flawed? In particular, is the Government’s own testing programme sound? The industry is now saying that Government-commissioned cladding and insulation tests used different standards from those in official guidance, with cavity barriers three times more fire-resistant. Is this the case? What does the Minister say to insurers and landlords who tell residents that the Government’s tests are not sufficient to show they breach building regulations, despite what the Secretary of State has said, and that therefore they will pay no removal or replacement costs, leaving leaseholders liable to foot the full bill?

Seven months on from Grenfell, the national testing regime is in tatters. After this national disaster, people look to national leaders for action. Only Ministers can act to make sure that all high-rise buildings are tested, that all tests are sound and that all dangerous cladding or insulation is removed. When will the Government sort this out?

I am somewhat disappointed that from this case and the detailed specifications that need to be retested, the right hon. Gentleman has jumped to conflate a much wider range of issues relating to Grenfell. I think that he has done it deliberately, and it is not a responsible thing to do. [Interruption.] Let me now answer his questions directly—and perhaps the hon. Member for Great Grimsby (Melanie Onn) would like to listen rather than commenting without understanding the facts.

The right hon. Gentleman asks why there was no new advice. There is no new advice because the existing advice is sound. He said that there had been no action. I gave details of the very specific action that has been taken in relation to Celotex. Indeed, on first hearing of this, I ensured at director level in my Department that the managing director of Celotex was contacted. We understand how seriously the company takes the testing issue, and we understand that it will act as soon as reasonably possible to have the product retested. I know the right hon. Gentleman would not suggest that that should be done in a rushed way. We want it to be done correctly, properly and responsibly, so that we understand and can give the reassurances for which he fairly asked.

The right hon. Gentleman suggests that homes were not safe. He already knows that as part of the building safety programme, inspectors have identified 284 buildings with cladding that does not comply with the requirements in the regulation, and the fire service has visited every one of those buildings. There are interim measures in place, including measures relating to car parks and ensuring that fire wardens are present, so that we can confidently say that every home is safe.

The right hon. Gentleman asks why the renovations had not been conducted more quickly. We need to engage with construction services responsibly to ensure that the renovations are carried out correctly, accurately and in a way that can reassure tenants and the wider public, and that obviously cannot be done in a hurry. We have reviewed the advice regularly, and it remains sound. We are taking every action that is necessary, both in relation to this case—which was the pretext on which the right hon. Gentleman based the urgent question —and in relation to the sensitive and important wider issue of housing and cladding as it affects local authority and housing association tower blocks and those in the private sector. That is exactly what the public would expect.

May I ask him how many local authorities have sought financial flexibilities to help with essential fire safety work, and whether he can confirm that no requests for such flexibilities have been turned down?

I have had personal conversations with local authorities that have been affected. We have made it clear that carrying out the necessary remedial works is the responsibility of the building owner, whichever sector it is in, but that when they need financial support or flexibility, they can come to us. The Minister has accused the right hon. Member for Wentworth and Dearne (John Healey) of conflating issues relating to Grenfell. If the Government wanted to keep the House informed and if they were on top of the situation, the Minister would have made a statement rather than our having to rely on an urgent question. The Government promised to keep the House updated on all developments associated with Grenfell, and they have failed badly in that respect.

What steps have been taken to establish how many properties may be affected by the loss of a certificate for this product, and how many other products may be affected in the same way? What investigations will the Government undertake to determine how the wrong information could be supplied to BRE and how tests could have proceeded on the basis of that wrong information? How will the Government ensure in future that correct end-to-end processes—from start to finish—are followed properly and that safe materials are installed in buildings? Will the Government consider giving BRE a wider role, involving more than just carrying out fire tests? How will the fire testing regime feed into future design and product specification? There needs to be a circular procedure. Given that BRE and Celotex seem to be blaming each other, when will the Government get a grip and take a lead?

The reason why it is a conflation of the two issues is that the system that was tested in a way that has been found to have been flawed is not the same system that is widely understood to have been the one used in relation to Grenfell. We have no expectation or reason to believe that there is a fire safety issue as a result of this flawed testing, but the responsible thing to do is make sure it is retested as swiftly as possible; then we will know the facts and we can give advice. But if any building owner, let alone tenant, has any concern or question in relation to their property, the existing advice about how to get it tested as soon as possible and take interim measures to protect the property stands; that is the most important thing. There should be no suggestion in this House—on either side—that those living in their homes are anything other than perfectly safe if they followed that important guidance.

Residents want to know that their safety is paramount, and they want clear information on what is a complex issue, so does my hon. Friend agree that it is irresponsible for others to draw a connection between the recent coverage about Celotex and the Government’s building safety programme? Does he agree that this must not distract from the vital work of making the buildings meet the required standards in London and across the country?

My hon. Friend is right. It is perfectly reasonable to ask questions about how the Celotex case happened, and in relation to the firm and BRE and the action we have taken, it is clear what needs now to be done as soon as possible to get that retesting done, to make sure those questions are answered. The leap into the wider Grenfell issue is deeply sensitive, and a wholesale programme on that is under way to make sure, first, that the interim measures are taken, so that people are safe in their homes; secondly, that the renovations are made, so that we have the proper cladding and systems in place around those buildings; and thirdly, in relation to the wider review of building regulations undertaken by Dame Judith Hackitt, that we learn the wider lessons for building regulation. That is the responsible thing to do. My hon. Friend talked about leadership; we are providing it.

We are taking the technical advice, we are making sure we have the interim measures in place and we are making sure that the renovations that need to be done to keep those tower blocks safe are done as soon as possible, although that takes time because that requires construction services that have to be contracted. We are making sure that all that work is done. As I have said in relation to the wider question of building regulation, the review conducted by Dame Judith Hackitt will make sure that all those lessons are learned. We have already had the interim report. We have accepted those recommendations and we look forward to the full report.

There are leaseholders living in blocks all over the country, including One Brewery Wharf and Quay One in my constituency, who, having discovered that their homes are covered in unsafe cladding, now face the prospect of having to pay for its replacement, and they are facing difficulties in remortgaging and selling their properties. Since the Secretary of State’s urging freeholders to do the decent thing and pay is not working, what are the Government now going to do to ensure that the recladding of those blocks takes place without the cost falling on leaseholders, who are entirely blameless in this matter?

The right hon. Gentleman has raised a number of points. First, he talked about cladding that might be unsafe. He did not specify which, but any concerns can be sent to the Building Research Establishment for sampling. We can get that checked in the right way.

In relation to the issue between freeholders and leaseholders, we have been clear all along that it is for the owner of the property to conduct the required renovation and to bear the cost. On local authorities, wherever financial flexibility is required, they can come to us. We have not said no to one yet. Housing associations should go to the regulator. In relation to private sector landlords, we have made it very clear that we believe they should bear the cost. It will depend on the specific leases, and of course the legal question of whether costs are being unreasonably handed over to tenants can be determined by the first-tier tribunal. That is a legal issue and we cannot interfere in that, but morally, we know that there are plenty of freeholders in the private sector who should be doing just as local authorities and housing associations are doing, and who should not be passing on any unreasonable cost to leaseholders or tenants.

It is interesting to contrast some of the comments made at the Opposition Dispatch Box today with the reactions of that individual to previous issues when he was a Minister. Will the Minister tell me what is being done to ensure that social housing tenants will be listened to in future? That is one of the big things that has come out of this. People put forward their concerns, but they were just not listened to, even by those who were supposed to be representing them.

My hon. Friend makes a broader point. We have two important streams of work under way to ensure that lessons are learned. The first relates to building regulations. We have had the interim report from the Hackitt review and we look forward to the full report. We are also conducting a series of workshops for social housing tenants across the country. We have held something like 100 events, and I have attended two of them, in Basingstoke and in relation to Grenfell. That is the right way to proceed. We must ensure that we listen to social tenants with an open mind and an open heart, and that we learn the lessons as we take forward our reform proposals.

The Minister has said that no local authority has been refused assistance when it has asked for help to keep its tenants safe. He will know that Birmingham City Council requires £31 million to ensure that its tenants are kept safe. It has asked the Government for £19.4 million towards that. Will the Government agree to provide it?

The Minister says that he is “in conversation” with a number of councils. After Grenfell, the Secretary of State said that he would leave no stone unturned and take every precaution in relation to anyone living in a building with similar cladding. On 22 June, the Prime Minister said that every resource would be made available. Why is the Minister still “in conversation”? Why is he not providing the funds? Why is it possible that there could be another Grenfell in this country tonight?

I have to say to the right hon. Gentleman that using that kind of language on an issue that we are all trying to grapple with is quite irresponsible. We have offered the financial flexibility—[Interruption.] He can point his finger in a jabbing manner all he likes, but we are taking this forward as effectively as we can. Some of the technical issues cannot be addressed overnight. We need to get this right and not act in haste. We have made sure that the interim arrangements are in place so that no one sleeping in their home at night is unsafe. The wider renovations will take time to get right because this is a complex technical undertaking.

As one who served for 31 years in the fire service, I realise the urgency following the events at Grenfell. I should like to compliment South Ayrshire Council, which retrofitted all its high-rise flats some 10 or 12 years ago. I take comfort from that. We are aware of Dame Judith Hackitt’s interim report. It is a good report; it is frank and open. Does the Minister intend to drive forward some of the recommendations that she has made, rather than waiting until the publication of the final report? Surely there are things that we can do now and I ask him to identify which ones they are.

I congratulate my hon. Friend’s local authority on being on the front foot. We encourage all local authorities to do their best to ensure that they address such issues in the same way. As for the Hackitt review, we have accepted every single one of the interim recommendations. We obviously want to consider the final report carefully, but the swift action and decisiveness that he wants are already under way.

The fire risk is obviously the single most important issue, but there are others. Local authorities such as mine are in the process of removing cladding. In one estate alone, the removal, the fire watch and the replacement will cost £6.5 million. Will the Minister assure me that the confusion over the tests will not mean that any local authority, private provider or housing association will face a delay in the decision making on the replacement of cladding? If they do, will the Government ensure that any interim costs, such as to cover waking watch or damage to buildings from water penetration when cladding is removed, will be fully met by the Government?

The Government are guilty of inexcusable delay. Acting upon the advice of the West Midlands fire service, Birmingham City Council wants to carry out extensive works to 213 tower blocks containing 10,000 households. As my hon. Friend the Member for Birmingham, Northfield (Richard Burden) said, the council has put specific proposals to the Government and has repeatedly asked for a reply—not one peep, not one penny. The Government are treating the city and worried tenants with utter contempt. When will there be a response so that the necessary works can start straightaway?

We are in constant dialogue, so the suggestion that the council has not heard a peep out of the Government is not accurate or responsible. I will chase up the hon. Gentleman’s specific question and ensure that we get a resolution as swiftly as possible. We are having detailed conversations. We often ask further questions of local authorities and they come back with the specifications. We then know how to get the issue resolved properly.

I fear that the Minister has been misadvised. Government guidance in paragraph 12.7 of approved document B still permits the use of cladding with a polyethylene core, which industry experts advise is dangerously combustible. It is still being put on buildings today, including on one block in Lewisham, because Ministers have consistently ignored professional advice from the building industry. Hundreds of other buildings across the country are affected, and an average of one fire a month is already being linked to such cladding. When will the Minister issue clear advice on what action should be taken in all circumstances where limited combustibility cladding is in place? When will he order its immediate removal from every residential block where it is present, which includes Citiscape in Croydon?

The hon. Gentleman is wrong to suggest that we have not taken the expert advice. We have consistently done that and have acted on it, but I am happy to look again at the material he mentioned. I have been involved in relation to the Citiscape case in Croydon and we have made it clear to the freeholder there, just as we have done everywhere else, that there is a moral case for avoiding any unreasonable costs to leaseholders or tenants. The leaseholders and tenants also of course have the option of going to the first-tier tribunal to settle an issue legally, and it would be wrong for Ministers to interfere in that process.

The hon. Gentleman is right that the flexibility relates to local authorities’ borrowing. Quite how that should be done will depend on the individual circumstances of particular local authorities, but we are willing to discuss that. As I mentioned earlier, we are yet to decline a request, so the support is there.

The New Capital Quay development in my constituency is just one of hundreds of private freehold developments across the country where cladding has failed and where the freeholder in question—Galliard Homes in this case— has washed its hands of all responsibility for interim fire safety measures and remedial works. Does the Minister agree that it cannot be right for leaseholders to pick up the full costs in such cases? Will he urgently set up a working party to consider the matter and give proper guidance as to who is liable under the law for the costs on such developments?

It is not just in relation to local authorities and housing associations that the freeholder is responsible for renovations; it is also the case for private landlords. The question of the allocation of responsibility for funding and financing the renovation is partly determined by the terms of the leasehold arrangement, but my understanding is that, as a matter of general law, a freeholder cannot pass unreasonable costs over to leaseholders. There is always recourse to the tribunal and we know plenty of leaseholders have taken such action. We have been very clear that, morally, such costs should not be passed on to leaseholders.

At the last Housing, Communities and Local Government Question Time, my hon. Friend the Member for City of Durham (Dr Blackman-Woods) and I both asked about the review of technical documents. We did not get an answer. To be clear, we are talking not about the Hackitt review, which is doing some good work on the wider issue, but about individual types of cladding and what document B says. We cannot go ahead with the replacement of cladding —we may still put up partially combustible materials on those buildings. The review of technical documents has not yet started.

As ever, Mr Hollobone, it is a great pleasure to serve under your chairmanship. I congratulate my hon. Friend the Member for Mid Norfolk (George Freeman) on securing the debate. He spoke forensically about the issue and eloquently about his constituency. He highlighted the importance of neighbourhood planning, which has been giving people real power to shape the development of their communities since its introduction in 2011.

I am pleased to have the opportunity to respond to points raised in the debate and take up the generous offer from my right hon. Friend the Member for East Devon (Sir Hugo Swire) to listen carefully to concerns. Hon. Members will know that, given the Department’s role in determining certain planning issues, I cannot comment on the detail of individual plans or planning cases. However, I can talk about the practice, the framework and the parameters that create the principles guiding the relationship between neighbourhood plans, local authorities and central Government strategy. I hope also to address the interesting points made by the hon. Member for Stroud (Dr Drew).

I know that many hon. Members have been directly involved in encouraging and supporting communities in their constituencies to take up neighbourhood planning; I recognise the role that MPs play in the process. I assure all hon. Members that we continue to support the principle of neighbourhood planning and that we are already looking at teething issues and wrinkles to be ironed out. In September, we announced our largest ever support package for neighbourhood planning: a £22.8 million programme that will start in April and provide communities with the help and resources that they need to develop plans up to 2022.

Before I address the important points raised by my hon. Friend the Member for Mid Norfolk, it is worth reminding ourselves of the wider national context and the big picture on housing. In order to meet demand, we have to deliver 300,000 homes every year by the mid-2020s. We have to provide the homes that Britain needs, but we also have to make them affordable for real people on low and middle incomes. As hon. Members have said, we have to build a lot more of the right homes in the right places. I take that point. There were 217,000 net additions to the housing supply last year. That was the highest level in a decade—an increase of approximately 70% on what was achieved in 2009-10—so there are positive signs, but there is still a long way to go.

We need to be mindful of how we tailor the vehicle, both in the context of local democratic affairs—points were raised today about carrying communities with us—and with respect to the overarching national demand and our mission to build the homes that the next generation needs.

It is absolutely crucial that local authorities play their role by producing up-to-date local plans and identifying a five-year supply of deliverable housing sites. Local plans and a five-year supply of housing sites can provide clarity for communities and for developers who want to do things the right way regarding where new homes should be built. That means that development is planned and is not the result of speculative applications. I have taken on board the points made by my right hon. Friends the Members for Mid Sussex (Sir Nicholas Soames) and for Arundel and South Downs (Nick Herbert) about some developers. I emphasise “some” developers; let us not tar all developers with the same brush, because, as I think hon. Members have said, there is good practice, but there is some bad practice as well.

As of today, 26 authorities are still to publish a local plan and 131 local authorities have a local plan that is older than five years. So, the big picture is that overall we are doing quite well, but there are certainly areas and pockets where we need to do better. My right hon. Friend the Secretary of State for Housing, Communities and Local Government has written to 15 authorities, giving them until the end of this month to justify why they do not have a plan in place and why the Government should not intervene. He has put other authorities on notice, explaining that a consistent failure to make sufficient progress in that regard cannot be tolerated indefinitely.

I turn to neighbourhood plans. They are, of course, voluntary. They rely on the enthusiasm and the hard work of local people, and, in the round, local communities. They are a powerful set of tools for communities to say where development—such as homes, shops and offices—should go, what it should look like, and what facilities should be provided. I pay tribute to my hon. Friend the Member for Henley (John Howell), who, as neighbourhood planning champion, has championed the cause of the right kind of local plans.

Neighbourhood plans undergo consultation, independent examination and the community referendum before coming into force as part of the development plan for their area. I take the point that was made by the hon. Member for Stroud about referendums, even though I was probably on a different side from him in our recent, bigger referendum. In this context, however, referendums are important, because they ensure that neighbourhood plans have genuine support and, as a result, some clout and some force. Their status as part of the development plan is very important, because planning applications must be determined in accordance with the development plan unless material considerations indicate otherwise.

Since the introduction of neighbourhood planning by the Localism Act 2011, 2,300 communities have begun the process of shaping the future of their area. I think that about 17 of those are within the constituency of my hon. Friend the Member for Mid Norfolk, and I recognise the local initiative that goes into such local plans. I also understand the point that he made about encouraging and not stifling that initiative, which is crucial.

Does my hon. Friend accept that the undermining of a referendum by failing to observe what the referendum has decided is, in its own way, just as damaging at a local level, in relation to a neighbourhood plan, as it would be at a national level if a decision made in a national referendum was not observed by the authority concerned?

My right hon. Friend makes a powerful point, and he is tempting me to muddy the waters of this debate in a typically mischievous way. I will accept that if we argue for the principle of democracy through a referendum and say that the result of the referendum needs to be delivered, and we then put in place a system of local referendums—often, people care even more about the issues in such referendums than they do about those in national referendums, because the issues relate to people’s local environment or their quality of life—it is important to make sure that they are respected.

We endeavour to continue to make the neighbourhood planning process stronger and simpler, to ensure that it is attractive to even more communities. This week, for example, we are implementing powers in the Neighbourhood Planning Act 2017. Those reforms make it easier for communities to keep their neighbourhood plans up to date as local circumstances change—they will change from time to time—and ensure that neighbourhood planning groups are made aware of local planning applications.

Other important reforms set out in the Act came into force last July. Those reforms require decision takers to respect neighbourhood plans earlier in the process, following a successful referendum. There will be further reforms this July, requiring local authorities to set out their policies on supporting neighbourhood planning groups.

I take this opportunity to welcome another neighbourhood planning success. The 500th successful neighbourhood planning referendum has just taken place; they are clearly catching on, notwithstanding the point that the hon. Member for Stroud made. That is quite an important milestone, which was reached by communities in Leeds, Suffolk and Lincolnshire. Those three communities are very different from each other, to touch on the point that the shadow Minister, the hon. Member for City of Durham (Dr Blackman-Woods), made. However, they all went to the polls on the same day, and between them they allocated land for employment, homes and local green spaces; those things can come together. Those plans are now the starting point for determining planning decisions.

Our planning policy is clear that where a planning application conflicts with a neighbourhood plan that has been brought into force, planning permission should not normally be granted. However, we recognised in 2016 that, in some cases, neighbourhood plans were being undermined because the local planning authority could not demonstrate a five-year land supply of deliverable housing sites, which is one of the key issues. That meant that even recently adopted neighbourhood planning policies were not being given enough weight in determining planning applications. I know that that is the crux of the experience of my hon. Friend the Member for Mid Norfolk, and the point that he wanted to make in this debate.

Communities who had worked hard to put their neighbourhood plan in place were left frustrated as decisions went against the plan, despite their having done everything that was asked of them. As hon. Members have argued, that can only undermine confidence in the referendum process and the localism agenda. Seeking to remedy that, we issued a written ministerial statement in December 2016 to ensure that national planning policy provided additional protection to precisely those communities. The change that was made protects neighbourhood plans that are less than two years old and that allocate sites for housing, as long as the local planning authority has more than three years’ supply of deliverable housing sites.

We will take forward that protection in the updated national planning policy framework, which will be published for consultation before Easter—I think there was a question earlier about its publication. I suspect that that will be the beginning of the dialogue and the debate, not the end of them.

The national planning policy framework will be amended to give local authorities the opportunity to have their housing land supply agreed on an annual basis, and fixed for a one-year period. I hope that that gives some reassurance. Through these new policies, alongside the tough action to get local plans in place, we hope to ensure that we get the right homes in the right places. That is the delicate line that we seek to tread here.

I should just say a few words about neighbourhood plan examinations, because of the significant legal weight afforded to neighbourhood plans. The plans need to be carefully examined in a fair and transparent way. If we had longer today, I would go into the matter in more detail. Effectively, the examinations are the check that, once passed, allows the referendum to proceed, which gives real force to the localism agenda in this sector.

I am conscious of the time that I must give my hon. Friend the Member for Mid Norfolk to allow him to wind up this debate. I appreciate that important issues have been raised today, whether they are in rural, urban or suburban constituencies, and I understand how deeply felt are the concerns about them. We will continue to protect neighbourhood plans in national policy, and decision takers—whether that is the local authority, the planning inspector or the Secretary of State himself—must respect that national policy.

I beg to move,

That the Committee has considered the draft Community Infrastructure Levy (Amendment) Regulations 2018.

It is a pleasure to serve under your chairmanship, Ms McDonagh. The draft regulations were laid before the House on Wednesday 13 December 2017. If approved, they will help to ensure that contributions to the community infrastructure levy are calculated in line with the original policy intent.

The Community Infrastructure Levy Regulations 2010, which came into force in April 2010, enable local planning authorities and the Mayor of London to raise a levy on new development in their areas. The CIL can be used to fund a wide range of infrastructure to support the development of the area where it is collected. Local authorities raised at least £240 million through the CIL in 2016-17 to help fund local infrastructure, and the Mayor of London’s CIL raised £381 million towards Crossrail by 2016-17. As I said, that money can be used to fund a wide range of infrastructure that is needed as a result of development, including safer roads schemes, flood defences, preservation of green spaces and even leisure centres.

The draft regulations will strengthen the Government’s original intention regarding the relationship between the obligation to pay CIL and amendments to planning permissions. As hon. Members will know from their constituencies, amendments to developments are often made using what is known as a section 73 permission under the Town and Country Planning Act 1990. Those permissions are used to make minor but material adjustments to large-scale, long-term developments. For example, a developer might seek permission to build a different type of flat from the one that was originally permitted, perhaps because of shifts in demand, in the needs of the community or, indeed, in viability.

The draft regulations make clear that any new CIL should be charged only on the change to the development made through the section 73 permission, not on the whole project. In addition, indexation should be applied only to that particular change, not to the entire development. To be clear, the draft regulations relate only to developments that were permitted prior to the CIL coming into force, and they apply only when such developments are amended after the CIL was introduced. That means that a developer will not be double-charged on work that was permitted before the levy was introduced in the area. However, they will be liable to pay the levy on any changes to their planning permission that have the effect of increasing the development’s impact on infrastructure.

We think that is the right balance. Without this amendment, developers could end up facing CIL charges that are not just double but multiples of—possibly six times—what the Government intended. If approved, the draft regulations will strengthen the Government’s policy intent and ensure that the CIL works fairly and does not hold back vital developments. They have been widely welcomed by organisations including Wandsworth Borough Council and Peabody housing association, and by affected planning consultants and developers.

The draft regulations will provide additional clarity to ensure that the 2010 regulations operate as originally intended. If approved, they will ensure that the CIL continues to help fund vital infrastructure in local communities without impeding development. I commend the draft regulations to the Committee.

We have had some very insightful and thoughtful contributions. I thank the shadow Minister for her kind words and look forward to working with her in the future on CIL and on many other housing matters.

My first point in relation to her comments is that CIL should be charged only on changes to development and the indexation. That is the only way these regulations will bite. They will not affect the rate, which I think is the technical point that she raised.

I do not think my point was about the overall rate of CIL; it was about the rate of indexation. I thought the purpose of the SI was to ensure that the same rate of indexation is used, rather than to change the overall CIL.

I thank the hon. Lady for that clarification. I think we are agreed on that point. There has been no change to the rate. The indexation applies to the specific change; it does not apply to pre-CIL matters or applications.

The lack of clarity relates to an application originally brought by Peabody, a registered provider of affordable housing, and a judicial review involving Wandsworth Borough Council. I make that point because we are trying to ensure that the original intention of the 2010 regulations is enforced. Those regulations almost invariably have been properly applied by local authorities, in accordance with the original intention, and accepted by developers. That case is a fairly isolated incident of the wrong interpretation being applied. None the less, for the sake of developers, local authorities and communities, we want to ensure that there is proper legal certainty.

My hon. Friend the Member for Bosworth raised the issue of CIL’s application to the whole country rather than just to London. I hope that I made this point in my opening remarks, but I am happy to reaffirm it: in the wider country, £240 million was raised through CIL last year. CIL is certainly not just a metropolitan or London-centric issue; it applies to the whole country. We are trying to ensure that, where there is much-needed homebuilding, infrastructure is provided, too. CIL is an important contribution to that, certainly not just in London.

My hon. Friend also asked about section 106. That is, in effect, the negotiated contribution that a developer makes, bearing in mind the infrastructure that is required and the viability of the development. The distinction is that that is agreed, whereas CIL is, in effect, levied, but both are critical. We want to ensure that we provide the homes we need in the places we need them, with the necessary infrastructure and funding.

The hon. Member for Bassetlaw, in his usual tub-thumping way, criticised the legislation. He made some perfectly reasonable points. I gently point out to him that the primary legislation for CIL was passed under the last Labour Government, but in the spirit of co-operation, if he has any further ideas or thoughts about the legislation or its application to his constituency, he should feel free to write to me.

CIL’s introduction, and the regulations that came with it, came in 2012. It was raised first with the Chancellor at the Treasury Sub-Committee, and then in the House by me and the Minister’s colleague—I cannot remember where he is from, but his first name is Richard and his surname is rashers of pork that are eaten on a morning. He is a very good man, and he and I campaigned to get the CIL down to something rational. I want to know about my constituent who is putting in his own money to do up a derelict property and is getting taxed for the privilege. That does not seem to be the intended consequence, but it is the fact of the matter. That is not good news for someone who is trying to invest.

I apologise—the hon. Member for Harrow West raised a local case. There are two points. Of course, I sympathise with the kind of situation he described in his constituency. We are absolutely not going soft on developers, although, frankly, I am not really sure I buy into that whole hard-soft idea. We want a smooth, streamlined approach with maximum legal certainty so that we can provide the homes we need, and with respect for local democracy in our local communities, while ensuring that we get the targeted investment to support the infrastructure that goes with housing. That is how we carry constituencies with us, whether it is his, mine or any other across the country, as we go through that vital national mission of building the homes we need.

I am grateful to the Minister for giving way. He is being very generous. I and all of us on the Opposition Benches accept that this is all about legal certainty, but will the Minister also accept that the outcome is likely to be a reduction in the amount of CIL levied?

I thank the hon. Lady. I tried to address that earlier. Almost all the cases where the regulations were applied were in accordance and consistent with the original intentions of the regulations. What we are really responding to is that one isolated case. I suspect that if there is any impact on revenue, it will be negligible. That also has to be countervailed against the risk of having uncertain regulations, with all the litigations that would ensue if we did not straighten this out.

As the hon. Member for City of Durham said, the draft regulations are necessary to provide clarity and certainty. They will help to ensure that developers have the certainty required to continue to deliver the homes we need, and that local councils can continue to collect the funding for the vital infrastructure to support them. That is not about going soft on developers; it is about ensuring that we have a constructive relationship that builds the homes that this country needs.

Most development impacts on or benefits from infrastructure. It is right and fair that those who benefit from the uplift in values created by a new development should share some of that gain with the local community. I suspect that that is something we believe on a cross-party basis in this House, and I also believe that it is right for development permitted before CIL came into force to be treated fairly. I commend the draft regulations to the Committee.

More than 119,000 affordable homes have been delivered in rural communities since 2010. Homes England has invested £142 million in the rural affordable homes programme schemes in the past four years, which is around 9% of total spend.

I very much welcome those figures on affordable homes. There are redundant farm building sites, which could be classed as brownfield sites. If they were, that would release a lot more land for affordable homes. Will the Minister consider that, please?

My hon. Friend is absolutely right: we have introduced a requirement for each local authority to publish registers of brownfield land. More than 90% of local authorities have done so, and the information to date suggests that nearly 16,500 brownfield sites covering 26,000 hectares have already been identified in England alone.

As well as helping rural areas, what is the Minister going to do for places such as Birmingham? How will he respond to the council’s request for additional assistance with the provision of new homes, essential maintenance on existing properties and the discharge of statutory obligations, such as health and safety and annual gas inspections?

Since 2010, we have delivered more than 370,000 new affordable homes, but of course we are ambitious to do more—working with housing associations and local mayors such as Andy Street. Of course, we have raised the housing revenue account borrowing cap for local authorities to give them greater flexibility.

One of the best ways to provide more affordable homes to rent in rural and, indeed, urban areas is through the provision of more co-operative housing. What further co-operative housing initiatives are the Minister and his Department thinking of pursuing?

The hon. Gentleman is right, and a lot of social housing is of a co-operative nature. It particularly depends on any given community’s specific needs, which are often for the local authorities to help to identify. Local authorities in rural areas need to focus on the particular needs of their communities. For example, some areas have rural exception sites, which provide long-term protection for affordable homes in rural areas.

My hon. Friend is right to raise this issue. The community housing fund was worth £60 million in its first year. In the context of the Budget in November, we announced that it would be continuing for a further three years. That includes capital and revenue funding, and it is part of the Government’s drive to support community groups bringing forward home-build projects.

We are not going to take on Labour’s plans in this area or any other, because frankly they are not sustainable. We are going to increase the affordable homes budget to £9 billion up to 2021. We are restless to deliver more affordable homes, including for social rent. The hon. Gentleman may like to know that in the past year there were 1,100 new housing starts in Manchester, and we are talking to the Mayor of Manchester about the housing deal, which will include a social housing component.

Whichever way Ministers try to present the figures, the number of genuinely affordable social homes built with public sector grants on their watch is pitiful. If the Minister will not accept Labour’s policy, will he accept the recommendation of the Treasury Committee by lifting the borrowing cap on councils’ housing revenue accounts completely to enable councils to build desperately needed council homes—or will he confirm that only a Labour Government will take the action that we need on council housing?

The record speaks for itself. We have delivered 357,000 more affordable homes since 2010—more than in the preceding seven years under the previous Labour Government. We are raising the cap; we did that in the last Budget. We are also creating a stable financial envelope for local authorities and housing associations with long-term rent deals: the settlement is CPI plus 1%. That is the sustainable way to drive home building in this country.

My hon. Friend is absolutely right. In the 2015 autumn statement, the Chancellor set out our aim to release enough Government land by 2020 for 160,000 extra homes to be built. The Government are providing local authorities with money to help to facilitate that. I met Nick Walkley, the CEO of Homes England, last week to make sure that we get cracking on this top priority.

My hon. Friend is absolutely right. We delivered 217,000 new homes last year, which is 50% more than the last year of the last Labour Government. We want to get that level up to 300,000. We have planning reform, release of public sector land and targeted funding to achieve that, which is crucial for key workers, the next generation and those on low and middle incomes.

We have, of course, raised the cap by £1 billion. It needs to be done in a responsible way, because we have to consider the amount of debt that has been taken on, but we will keep it under review. That is one aspect of the huge drive towards building the extra homes we need. I have talked about some of those issues, including targeted funding and release of public sector land. We want to make sure that we get up to the annual target of 300,000 as soon as possible.

T8. I find the level of rough sleeping in Chesterfield and across the country deeply humiliating as an MP, and it infuriates and disgusts my constituents. I am delighted that the new Housing Minister has agreed to work with me to improve tenant safety in respect of carbon monoxide poisoning. Does he agree with the National Landlords Association and Headway, a brain injury charity, that more needs to be done to protect the public at large from death or injury through carbon monoxide poisoning?

T10. Gateshead Council, of which I am a member, has seen its Government funding cut by 52% since 2010. Fifty per cent. of its budget is spent on vulnerable children and adult social care and demand is rising. With over 90% of our properties in council tax bands A to C, the social care precept does not go near addressing the shortfall. Will the Secretary of State urgently address the shortfall in funding for children and adult social care in Gateshead and elsewhere now, and will he produce a truly fair—
