Commons ChamberMay I join others, Mr Speaker, in thanking you and your chaplain for your service to the House? You have been particularly kind in enabling me to raise from the Back Benches many issues that really matter to my constituents, and I am profoundly grateful.
The Government have introduced a range of measures to improve animal welfare, including a rigorous ban on the ivory trade and mandatory CCTV in all slaughterhouses. We are considering proposals to tighten the welfare rules for animals in transit, including a ban on unnecessary and excessively long journeys to slaughter.
We will be pressing ahead with the Animal Welfare (Sentencing) Bill so that horrific crimes like that can meet with the appropriate punishment. We are consulting on compulsory microchipping for cats to ensure that lost pets can be reunited with their owners, and we have also banned third party sales of kittens and puppies.
One way of preventing animal cruelty would be to tighten the law on illegal foxhunting. Will Ministers undertake to introduce a system of monitoring before the foxhunting season starts in order to find out just how many illegal killings are taking place, so that we know how to address the problem?
As my right hon. Friend the Minister of State has said, we believe that it is crucial for all our laws to be properly enforced, including the Hunting Act, and we will continue to engage with the appropriate authorities to ensure that that is the case.
That is very kind of you, Mr Speaker. I will save my tribute for the right time, in due course.
Unfortunately, as colleagues with rural constituencies may know, at this time of the year there is a steep rise in the number of abandoned horses as winter approaches. A couple of weeks ago I personally dealt with four abandoned ponies, including two foals barely weaned at 12 weeks. They were in a terrible condition: their feet had never been trimmed, their ribs were showing, and they had lice and mites. I had to get them rehomed.
I welcome the Government’s proposals to take a tougher line with those who abuse animals in this way, but can my right hon. Friend reassure me—gently, given the problem with her voice today—that the Government will support the police and local authorities in taking action and enforcing the law on these criminals?
I can of course give my right hon. Friend that assurance. This is a worrying problem, and we are keen to engage with the charities that are involved in trying to address the issue. I wish her well in her retirement and thank her for that question.
There is cross-party support for increasing prison sentences for those who hurt and cruelly kill animals, but Ministers have dithered and delayed over the Animal Welfare (Sentencing) Bill. Even in this divided Parliament, and even at this late stage, there is still a chance to get that Bill on the statute book before the election. Labour backs the Bill, the Secretary of State’s own Back Benchers back the Bill and the public back the Bill, so will she give a commitment that she will use every effort to get it on the statute book before the general election is called?
I can give the hon. Gentleman the assurance that, when a Conservative Government are returned to serve in this House, the Animal Welfare (Sentencing) Bill will be back on the agenda and we will get it on the statute book.
To tackle plastic pollution, we have introduced a world-leading microbeads ban, reduced single-use plastic bag usage by 90% in the main supermarkets, and launched the Commonwealth Clean Ocean Alliance to tackle the issue globally. We also have a widespread package of measures on plastic pollution in our Environment Bill.
I thank you, Mr Speaker, for your tremendous support for Back Benchers throughout this House during your time in the Chair. I also thank Becki Woolrich, who founded Stafford Litter Heroes, for all that she and her colleagues have done. By this weekend, they will have collected more than 2 tonnes of litter from the area in a very short time. We should pay great tribute to volunteers like them.
There are 5,000 items of marine plastic pollution per mile of beach in the UK. The amount of plastic produced globally has increased from 1.5 million tonnes in 1950 to 320 million tonnes a couple of years ago. It is clear that we need to produce less plastic, not more, so will my right hon. Friend explain what we are doing to ensure that as much plastic is recycled as possible and that that happens here in the UK? Plastic should not be shipped overseas for other people to deal with.
My hon. Friend is correct: current levels of plastic pollution are intolerable, and the Government are determined to tackle them. We will be introducing a system to incentivise plastic packaging producers to use more recyclable material, but also less material in general. We will be banning plastic stirrers and cotton buds. We are introducing a deposit return scheme on drinks containers. We will also be introducing more consistent recycling to help everyone to recycle more to tackle the terrible problem of plastics pollution.
Plastic was rare when I was brought up in the 1950s, so is it possible for the Government to set targets to get us back to those low levels? Recycling just delays the amount of plastic going into the environment.
Our Environment Bill provides the opportunity for future Governments to set targets on the use of resources and recycling. Reducing the need for single-use plastics is an important part of this, but recycling will also be a crucial part in reaching our goal of eliminating avoidable plastic waste in the coming years. That is why we are seeking to increase the amount of plastic that is recyclable and is recycled.
May I, too, wish you all the best, Mr Speaker? May I also thank you for teaching me the value of patience and for helping me have considerable exercise for my knees during my time in this Chamber?
Is my right hon. Friend aware that my constituent Nik Spencer has invented an incredible, groundbreaking piece of technology that would eliminate the need for plastic waste entirely if it is commercially adopted, because it converts plastic waste in the home into energy? If, as I very much hope, we are returned to government, will she agree to meet me to see how we can stimulate and incentivise technologies such as this machine, so that we can tackle plastic pollution at its source?
Yes, I can give my hon. Friend that assurance. I fully agree that technology is going to be crucial if we are to address the concerns that have been expressed in the House today about plastics.
Thank you, Mr Speaker, for making me feel welcome in the short time I have been here so far.
After “The Blue Planet” and other television programmes, after the in-depth investigations by Friends of the Earth and others, after the mass campaigning by schoolchildren all over the world to prevent plastics in our oceans and after the verdict against a major British company for exporting unsorted waste, can the Secretary of State explain to me why there was nothing in the Environment Bill to tackle waste once it has left this country or to ensure that material collected in good faith for recycling is actually recycled?
The Government are absolutely determined to crack down on any unlawful waste exports and to ensure that waste that is exported is dealt with appropriately. I wish to emphasise that this Government are doing more or less more than any other Government in the world on this, including by making real progress in ensuring that we protect 4 million sq km of the world’s oceans by the end of next year.
Clause 20(2) of the Environment Bill places a duty on the Office for Environmental Protection to
“have regard to the need to act…transparently.”
It must publish key documents, such as its strategy, annual report and accounts, and lay them before Parliament.
The concept of the OEP has been touted by the Government as an independent watchdog, yet it will be funded by the Government and its chair will be appointed by the Government. Surely the Secretary of State will agree that at the very least the relevant Select Committee should play a key role in the appointment of the chair and the non-executive members of the board.
I assure the hon. Lady that the Environment, Food and Rural Affairs Committee and the Environmental Audit Committee will play a key role in the pre-appointment scrutiny of the OEP chairman. I also assure her that the OEP will have a multi-year funding settlement and that Ministers will be required to safeguard its independence. In many ways, the departmental structure will be broadly similar to the Equality and Human Rights Commission, which has clearly demonstrated its total independence from the Government. I am sure we will see that same determination from this powerful new environmental watchdog.
I was very sorry to have to miss your visit to the SNP group the other day, Mr Speaker. I shall take this opportunity to thank you for everything you have done—for your doughty defence of democracy and particularly your support for lesbian, gay, bisexual and transgender rights and for Back Benchers’ interests. I wish you and your beautiful family all the very best for the years ahead. May I also commend the two gentlemen to your left—stage left, as we used to say—Mr Peter Barratt and Mr Ian Davis, who I know have offered you such valuable support over years?
Let me begin my question by saying happy non-Brexit day to the Government Front-Bench team. Will the Secretary of State tell us whether the Scottish Government support the proposals on the OEP? Were they consulted on them?
There was extensive work between the UK Government and the Scottish Government on the Environment Bill, including the clauses on the OEP. We are grateful that, as a result of that work, large elements of the Bill will apply in Scotland. I understand that the Scottish Government intend, I hope, to create a body that is broadly similar to the OEP, to manage the scrutiny of environmental matters where they are devolved in Scotland.
May I join the tributes to you, Mr Speaker? I thank you for your comradeship in opposition, when you were a spokesman with me in various Departments, and for your encouragement in respect of the Animal Welfare (Service Animals) Act 2019—[Hon. Members: “Hear, hear.”] Thank you.
I congratulate my right hon. Friend on steering Finn’s law through Parliament. The Government remain absolutely committed to tougher sentences for animal cruelty offences, and we intend to bring the Bill back to the House as soon as possible.

My right hon. Friend will know that the supporters of the Animal Welfare (Service Animals) Act 2019 were also keen to improve the maximum sentences and to see them go up. Can she confirm that that will be a top priority for any incoming Conservative Government?

Oh Mr Speaker, I do not know what to say. I am going to miss this. Thank you for everything you have done for Back Benchers.
The Secretary of State says that the Animal Welfare (Sentencing) Bill is going to come back to the House as soon as possible; that could be Monday. There is cross-party agreement on this short Bill, and as the Labour DEFRA Whip I have the permission of our shadow Secretary of State to say that we support the Bill, we could crack on, and it could be done and on the statute book before Dissolution. Even at this late stage, why will she not put it on the Order Paper for Monday or Tuesday?
I can reassure the hon. Lady that a Conservative Government will put this Bill on the Order Paper very soon after we are re-elected to serve this country.
Waste crime blights local communities and the environment, and we are committed to tackling it. We have given the Environment Agency £60 million extra to tackle waste crime since 2014. The Environment Bill takes forward a number of commitments on preventing, detecting and deterring waste crime.
Fly-tipping is a scourge in many communities across North Warwickshire and Bedworth, and it costs councils and local landowners hundreds of thousands of pounds to clear up, but it is often unwittingly facilitated by householders failing to ask whether a valid waste licence is in place. What steps can householders take to check that there is a valid licence, so that they do not unwittingly become the recipient of a fine themselves?
Householders can check using the carrier’s business name or registration number, which the carrier should be able to give them on request, and they have the opportunity to check those against the details on the Environment Agency website, or by ringing the Environment Agency helpline.
I would like to say, Mr Speaker, what a pleasure it has been to serve under your speakership during my time in Parliament.
Recently, I went out with members of the National Farmers’ Union in my constituency and was horrified to discover a spate of fly-tipping of very dubious materials that then need to be checked by the landowner. The landowner has a responsibility to check out the hazardous nature of the materials and then to dispose of them safely. This is putting much additional pressure on farmers and rural communities. What can the Government do to support those rural communities and the police forces who continue to be under significant pressure to address this spate of fly-tipping?
I share the hon. Gentleman’s concerns. Fly-tipping is completely unacceptable, and it is blighting life in rural areas, in suburban areas, such as my constituency, and in urban areas. One thing the Environment Bill will do is facilitate the introduction of electronic waste-tracking, which should assist the law enforcement authorities to crack down on this unacceptable crime.
One of your predecessors, Mr Speaker, congratulated me on always addressing the Chair. If I may say so, it has been my particular privilege to address the Chair when you are in it, and, if I may also say so, those who stand beside it have always gone to extraordinary lengths to be helpful.
The New Forest is being desecrated by people fly-tipping. Will my right hon. Friend have a word with her colleagues in the Ministry of Justice to ensure that we are more robust with respect to punishments—perhaps garrotting perpetrators with their own intestines?
I am not sure that I could go quite that far. Certainly, in providing extra resources for the Environment Agency, we are absolutely determined to crack down on this deeply antisocial crime. I hope the courts will view it seriously and inflict appropriate punishment.
I thank the right hon. Gentleman. The word “inimitable” could have been invented to describe him, and that is supposed to be the warmest compliment. I genuinely appreciate what he said.
May I join others in expressing the hope that no circumlocutory measures will be put in place to try to restrict your perorations post your retirement, during the next stage in your career?
May I ask the Minister to liaise with the Northern Ireland authorities to ensure that action is taken on the huge waste dump at Mobuoy, outside Londonderry, to ensure that restrictions are put in place and that we pursue those responsible?
I am happy to engage with the Northern Ireland authorities on that important question.
Since the last EFRA oral questions, the Government have: introduced a major Environment Bill; committed to plant 1 million trees in Northumberland; pledged £11.6 billion for climate measures abroad; published proposals to restrict the import of hunting trophies from endangered animals; banned the sale of primates as pets; and introduced cat microchipping. We have made clear our determination to improve the welfare of live animals in transport, with a view to choking off live exports for slaughter or fattening. I have also had the chance to make visits around England, Wales, Scotland and Northern Ireland to talk to farmers, fishermen and those involved in the food sector.
May I join colleagues in thanking you for your help, Mr Speaker? I am going to once again try to avoid your eye while I ask what should be a very short question.
Blaydon Quarry landfill site in my constituency causes a huge nuisance for the communities surrounding it, particularly from the regular bad smells, as residents tell me there are at the moment. I think it is time for the site to be closed—safely. Will the Secretary of State join me in that call and put an end to the absolute misery caused to local residents by this landfill site?
It is worrying to hear the reports of the odour from the site. I understand that an odour suppression system has now been installed in the waste tipping bay and that further engineering works are under way to try to tackle the problem. I can assure the hon. Lady that the Environment Agency continues to take this issue very seriously and is working with the community and the local authority. Earlier this year, it took regulatory action preventing the site from accepting waste until remedial work has been undertaken.

Pagham Harbour in my constituency is one of the best places to see wildlife in the UK, covering 600 hectares of salt marshes, mudflats, reed beds and lagoons. It is an important natural store of carbon and it absorbs up to 310 tonnes per hectare. What steps is my right hon. Friend taking to ensure that carbon-rich natural habitats are protected to improve biodiversity and help us to reach net zero by 2050?
Protecting nature is a key part of the Environment Bill. It supports the nature recovery network envisaged by our 25-year environment plan. I pay tribute to my hon. Friend for the work that she has done in relation to this wonderful site. She is right to say that nature-based solutions, with natural storage of carbon in such locations, will form a key part of becoming a net-zero economy.
We will do exactly that, because the Environment Bill has a really strong package of measures to respond to the grave public concern about plastics pollution. The public are determined to tackle this issue, and so are the Conservative Government.
Thank you, Mr Speaker, for your kindness in calling me today, for your broader kindnesses to all of us and for all your service from the Chair.
I want to raise an issue again that I know is also of concern to you, Mr Speaker. Ministers know that HS2 and its construction will affect a good deal of farmland. They will also be aware, I hope, that HS2 Ltd has not been as effective as it should have been either in providing full and timely financial compensation for land lost or in making the practical arrangements necessary to allow farmers to farm properly the land they have left. Will my right hon. Friend and her colleagues please make sure they engage with colleagues at the Department for Transport to ensure that the financial and psychological consequences for the farmers affected by HS2 are properly mitigated, if this project is to continue?
Of course I am happy to give a commitment to engage with colleagues in the DFT on these important matters. It is of course vital that HS2 Ltd does all it can to ensure that it meets its obligations in a timely way in relation to farming and environmental concerns.

Written StatementsDEFRA has wide and hugely important objectives: to protect and enhance our natural environment, to lead the world in food, farming and fisheries, to deliver a safe and ambitious departure from the EU, and to be an outstanding organisation. This means we play a major role in people’s day-to-day lives, from the food we eat to the air we breathe, and the water we drink.
I would like to update the House on some of DEFRA’s key domestic achievements since 2010, which have been delivered whilst maintaining the highest standards of preparedness for EU Exit.
On the natural environment, we have:
Produced a 25-year environment plan setting out how the Government will achieve the aim of being the first generation to leave the environment in a better state than we found it. In 2019 we published the first 25-year environment plan progress report with 90% of the plan’s actions delivered or being progressed.
Introduced the first Environment Bill in 20 years, setting out a domestic framework for environmental governance and legally binding long term targets as the UK leaves the European Union. This is a vital step towards delivering the 25-year environment plan.
Improved or created 16,000 acres of water dependent habitat, creating 2,700 acres of intertidal habitat and improving 380 miles of river habitats
Published Julian Glover’s “Landscapes Review of National Parks and Areas of Outstanding Natural Beauty”, setting out how we can fulfil the vision for our finest landscapes to be places of natural beauty.
Announced £60 million to help plant new woodlands and urban trees to help meet the Government target to plant 11 million rural trees and 1 million urban trees by 2022, announced the creation of a Northern Forest and Northumberland Forest, and appointed a tree champion to drive tree planting rates.
Trees are an important carbon sink for the UK as we aim to meet our target of net zero greenhouse gas emissions by 2050, with the UK the first major economy to legislate for this in July 2019. We have made a strong start, planting over 16 million trees since 2010.
We have cleaned up the air: since 2010 toxic emissions of nitrogen oxides are down 29%, sulphur dioxide emissions are down 62%, and fine particulate matter emissions are down 10%.
Announced funding for the restoration of 6,498 hectares of degraded peatland, much of this in the uplands, allocating £10 million to 62 sites across England. Peatlands are the UK’s largest terrestrial carbon store.
Designated the third tranche of 41 new marine conservation zones, marking the most significant expansion of England’s “blue belt” of protected areas to date and protecting UK waters.
Committed to protect 30% of the world’s oceans by 2030 and created a global alliance with 10 countries signing up to the UK led initiative to protect at least 30% of the world's ocean and its wildlife.
Launched a review into highly protected marine areas, sea life, and marine habitats as well as publishing an updated marine strategy showing progress towards good environmental status.
Launched the clean air strategy which the World Health Organisation praised as “an example for the rest of the world to follow”. It will tackle all sources of air pollution, making our air healthier to breathe, protecting nature and boosting the economy.
Implemented a ban on plastic straws, stirrers and cotton buds from April 2020, to reduce plastic waste, and led a Commonwealth clean oceans alliance with half of the Commonwealth to tackle marine plastics.
In 2018 we introduced a microbeads ban to prevent these harmful pieces of plastic entering the marine environment.
Launched and published responses to consultations on the reform of the waste system, including on extended producer responsibility for packaging, a deposit-return scheme for drinks containers, consistency in recycling, and tax on plastic packaging containing less than 30% recycled content.
Committed to reintroducing formerly native species, including iconic species such as the white tailed eagle and beavers, where there are clear environmental and socio-economic benefits,
On food, farming and fisheries, including improving animal and plant health, we have:
We are replacing the restrictive rules of the EU’s common agricultural policy, freeing farmers to seize the opportunities offered by Brexit. Instead we are introducing an ambitious new environmental land management scheme which will allow us to reward the farmers and land managers who protect our environment.
Protected allergy sufferers through “Natasha’s Law”, requiring food businesses to include full ingredients labelling on pre-packed for direct sale.
Protected service animals through “Finn’s Law”, which makes it an offence to cause unnecessary suffering to service animals.
Introduced “Lucy’s Law” ensuring that puppies and kittens are born and reared in a safe environment, with their mother, and sold from their place of birth.
Delivered the Ivory Act 2018, introducing one of the world’s strongest bans on ivory to prevent commercial activities involving ivory in the UK that could directly or indirectly fuel the poaching of elephants. We have also launched a call for evidence on extending a ban to a range of animals including hippopotamus, walruses and narwhals, and are consulting on banning imports from trophy hunting of endangered species.
Commissioned the bovine tuberculosis strategy review, published in 2018, on the Department’ strategy for achieving officially bovine tuberculosis free status in England by 2038.
Created a stronger future for farming with new markets for British farming products opening across the world. Markets for British beef and lamb worth £127 million over five years have been opened in Japan and in 2018, China lifted the ban on British beef worth £250 million in the first five years, which had been in place since 1996. A deal has also been secured to enable UK exports of seed potatoes to China; the seed potato export market as a whole is worth an annual £90 million to the UK.
Published the “Sustainable Fisheries for Future Generations” White Paper as part of our goal to promote a more competitive, profitable and sustainable fishing industry across the whole of the UK, and setting a gold standard for sustainable fishing around the world in addition to announcing £37.2 million of extra funding to boost the UK fishing industry.
We have also carried out our duties on domestic emergencies, including leading the response following the Salisbury attack. We are investing £2.6 billion in protecting people against flooding. This will fund over 1,000 flood defence schemes with 300,000 homes better protected, and improve protection to 690,000 acres of agricultural land, 279 miles of railway and over 5,000 miles of highways by 2021. Additionally, between 2015 and 2020 we will be spending over £1 billion on the maintenance of flood defence assets. This is a real terms increase in spending compared to the £812 million spent in the previous five years.
DEFRA will continue to pursue this ambitious agenda over the coming months and years, making further progress both domestically and through seizing the opportunities that leaving the EU will present.

Commons ChamberI beg to move, That the Bill be now read a Second time.
This is a Government who recognise the profound importance of the great environmental challenges of our time. We are the first Government to set the goal that this generation should leave the natural environment in a better state than it was bequeathed to us. This is the first Government to make a legally binding commitment to become a net zero carbon economy. We have cut greenhouse gas emissions by 25% since we returned to office, while growing the economy at the same time. We have pledged more funds than ever before to help the developing world reverse the decline of nature and tackle climate change. We are determined to respond to the grave public concern about these threats, so a new Cabinet Committee will co-ordinate work on climate change across Government, under the chairmanship of the Prime Minister.
Our action is guided by the mounting scientific evidence of the inextricable link between climate and nature. Wildlife habitats are crucial carbon storage systems. Protecting those forests, peatlands and natural open spaces is vital if we are to have any chance of averting disastrous climate change.
I thank the Secretary of State for giving way. Will she confirm that it is Government policy that green belt land should be built on only in extenuating circumstances? The proposals to build on the green belt in Radcliffe, Unsworth and Simister in my constituency will devastate entire green belt areas and completely destroy the character of the village of Simister. Does she agree that that is not acceptable in any community?
I agree that it is vital that we protect our green belt and that green belt rules are abided by. The Government are absolutely determined to defend the green belt as part of our environmental policy.
I am very grateful to my right hon. Friend. This is a very welcome Bill, which builds on much good work that the Government have already done. Does she recognise, however, that in suburban parts of London, like hers and mine, there remains a concern about particulate pollution? Will she consider, as the Bill progresses, what more we can do to strengthen the fight against particulate pollution—for example, by seeking to strengthen our commitment by joining the World Health Organisation guidelines on particulate pollution by 2030?
My hon. Friend will be aware that clause 2 sets out the ambition to set a legally binding target on fine particulate pollution, responding to exactly the concerns of his constituents—and indeed of mine in Chipping Barnet.
Planting more trees would make a great contribution to a more beautiful environment and have other good consequences. Will my right hon. Friend say a little about how that can be done, and can some of them come to Wokingham, please?
The Government have been involved in planting about 15 million trees, but we are determined to expand the programme because trees are crucial storage mechanisms for carbon and we will never get to net zero unless we plant a lot more.
My constituents, who, like me, care about nature, are absolutely delighted with the Bill. I am thrilled to be able to support it, particularly for rural communities blighted by fly-tipping. However, will my right hon. Friend watch out for the water abstraction element? It seems uncharacteristically mean.
I am grateful to my hon. Friend for his praise for the determination expressed in the Bill to protect nature and reverse the decline in biodiversity. We will listen carefully to his concerns and those of his constituents with regard to water abstraction to ensure that the Bill’s provisions are implemented in a way that is sensible, proportionate and fair.
I thank my right hon. Friend for giving way. Windsor is a beautiful constituency with a lot of active people campaigning on the environment. One of our biggest bugbears is Heathrow airport and any expansion of it. Will she confirm that the Bill contains measures on fine particulates that could well have an impact on Heathrow’s ability to expand?
It will certainly be vital for the expansion programme at Heathrow, if it goes ahead, to comply with the exacting environmental requirements that have already been placed on it. Naturally enough, it will also have to comply with any new requirements introduced to meet the target on fine particulate pollution, to which we are committed.
We have all received briefs from the Countryside Alliance and various other countryside bodies. They are very clear that the countryside is a place of great beauty and a habitat for wildlife. It is also a place of work and is home to millions of people. Will the Government ensure that the farming community, who own the land, look after the land and have managed it for years, will continue to do so, and that any new legislation will not disadvantage them?
We believe we can support farmers in their environmental stewardship and in caring for our natural environment through our replacement for the common agricultural policy. That will allow us to go further and faster in providing support for farmers conducting their crucially important role in protecting our natural environment.
I thank the Secretary of State for giving way. For everybody’s constituents, including mine in Gedling, the Bill is very important. It contains a lot of very welcome measures. If we are to have an election in the next few weeks, will she look at what can be done to preserve those measures so that they are not lost? I know that that is a matter of process, but it is extremely important to all of us and our constituents.
I agree that this landmark proposed legislation needs to continue regardless of when Parliament dissolves for a general election. It is vital that the Bill comes back to the House as soon as possible to ensure that we can embed in legislation the important protections it contains.
I will take one more intervention and then I will make some progress.
I am very grateful to the Secretary of State for giving way. I was encouraged by her answer on Heathrow. She and I were on the same side of this argument for many years. I wondered whether we still agree. In 2017, she said,
“this is a hugely expensive project and one that will create significant economic damage.”
Her constituents and my constituents agree. Does she still agree with those words today?
As the hon. Lady points out, my reservations about the Heathrow expansion are on the record for everyone to read. The fact is that the House has voted by a large majority to give outline planning permission to this project. It is now for the scheme’s promoters to demonstrate that they can come up with a scheme that meets the exacting conditions on the environment that Parliament has set.
I am very grateful to my right hon. Friend for allowing me to intervene. Like many Members, I am one of a team of species champions, each representing an individual species that is in some way endangered. Does she agree it is very important that, as we tackle the housing challenge, we ensure developers build houses and create estates in a way that is sustainable for the surrounding countryside and allows those who move into such areas to live side by side with nature in the neighbouring area? Otherwise, we will lose more of the species that are so valuable to us.
My right hon. Friend is absolutely right and that is a core aim of the Bill: to ensure we deliver the homes we need in a way that safeguards our environment and nature.
I have taken a lot of interventions and I need to make some progress.
We are determined to seize the environmental opportunities that come with leaving the EU, including: the opportunity to create a better, more sustainable means of managing our fish stocks and a fairer deal for the communities who have lost out under the common fisheries policy; and the opportunity to support our farmers to cut emissions and pollution, and protect nature with a new system of farm support based on public money for the public goods.
The Bill will help us to realise the bold vision set out in our 25-year environment plan for urgent meaningful action across society towards long-term environmental targets, so that global Britain can go further and faster for our natural environment. Nine consultations underpin the proposed legislation. They received over 400,000 responses. Over half the Bill’s measures extend beyond England. I want to thank the devolved Administrations for working with us on the Bill, so that we can benefit the environment right across our United Kingdom.
The Bill will enshrine environmental principles in UK law for the first time, ensuring that the environment will be placed at the centre of Government decision making. The following principles are on the face of the Bill: the polluter should pay; harm should be prevented or rectified at source; the environment should be taken into consideration across Government policy; and a precautionary approach should be taken.
Would my right hon. Friend like to congratulate the Isle of Wight on becoming, earlier this year, a part of UNESCO’s biosphere network? Will she work with me to ensure that our precious landscape, both on the Island and elsewhere in the UK, is increasingly protected under the Bill to make sure we do not lose it?
I do indeed pass on my congratulations on that tremendous achievement.
Clauses 1 to 6 require the Government to set legally binding, long-term evidence-based targets to deliver significant environmental improvement in resource efficiency and waste reduction, biodiversity, air quality and water. We will become the first country in the world to do this. Future Governments will be required to publish plans to meet the targets that they have set themselves, reviewing milestones every five years and making existing targets more demanding or setting new ones if they fall short. All future Governments will be required to report annually on progress on delivering an environmental improvement plan.
Order. Before the Secretary of State gives way to the plethora of people who wish to intervene, at present the number of people who wish to speak means that speeches will be limited to between three and four minutes. If people intervene and take more time during the Secretary of State’s speech, that time limit will go down significantly.
I will take a point of information from the hon. Member for Westminster North (Ms Buck).
I thank the Secretary of State very much. On air quality, will she join me in congratulating the Mayor of London on the success of the ultra low emission zone, which has seen such a dramatic fall in polluting vehicles moving into inner London? Is she also conscious of the fact that 83% of reporting zones across the country are still in breach of air pollution limits? However much she tells us that the Government will be doing better, does she recognise just how scandalously short we have fallen in recent years? We have very serious doubts about what the Government are—
Order. We cannot have this, because the hon. Lady has just spoken for half as long as most people who wait here till 10 o’clock will get.
I will take the hint and make progress, Madam Deputy Speaker, but I reassure the hon. Member for Westminster North that we have made significant advances in cleaning up air quality across the country. There are still significant issues with roadside exceedances. There is more that we need to do and that is why the Bill will set out those demanding targets.
No, I will make some progress.
I want to highlight clause 2, which contains one of the most ambitious elements of the legislation: namely, a duty to set a legally binding target for PM2.5 fine particulate matter. As Members will be aware, this pollutant has the most significant impact on human health. Poor air quality is the biggest environmental threat to public health. It is shortening lives and causing illness, and this Government are determined to step up our efforts to clean up the air that we breathe—an issue that I know concerns my constituents in Chipping Barnet, and I am sure that that view is shared by many across our nation.
Many of our constituents will be so relieved to hear the House discussing a positive piece of legislation. As a former public health Minister, I know that our clean air strategy was described by the WHO as an
“example for the rest of the world to follow.”
Will the Secretary of State say a word about how the Bill will enable and help local government to meet their responsibilities in improving air quality across the country?
My hon. Friend is absolutely right: we will not be able to succeed in our ambition to clean up our air quality without strong action by local government. There are important provisions in the Bill to help local government to address air quality challenges, for example, in relation to domestic burning.
For the sake of Back Benchers’ speeches later on, I will have to make some progress. Just as this nation acted successfully to curb the air pollution dangers of the past, we now need to address this major environmental harm that we face in the modern era.
Clauses 19 to 38 will establish the Office for Environmental Protection as a powerful new independent watchdog on the environment. It will provide expert independent advice to Government on environmental plans; scrutinise policy and progress; investigate if public authorities fail to live up to their commitments on the environment; and, where necessary, take enforcement action. The OEP will have a role in enforcing climate change law as well, complementing the functions of the much respected Committee on Climate Change. This addition to the Bill was one for which both the Environment, Food and Rural Affairs Committee and the Environmental Audit Committee called. As a non-departmental public body, the OEP will be independent of ministerial control. It will have a free-to-use complaints system for the public, and multi-year funding settlements will give it financial stability.
The second half of the Bill will empower environmental improvement across a range of sectors, encouraging businesses to innovate and invest in meeting the crucial environmental challenges that we face as a nation, and creating additional powers for local government on waste, nature, air quality and water. I think everyone in the House would agree that we need greater efficiency in the way we treat resources and waste. Our constituents are fed up with litter and fly-tipping and appalled by plastic pollution. This legislation will help us to crack down on the blight of waste crime and fly-tipping that costs the taxpayer over £600 million every year. It contains a powerful new set of measures to tackle plastic waste.
Does my right hon. Friend agree that making the producers responsible for the plastic that they make will drive a step change in ensuring that products are no longer just chucked away, but are made to last and be repaired and recycled, bringing an end to this plastic pollution nightmare?
My hon. Friend is absolutely right that the extended producer responsibility provisions in the Bill will help to deliver the results for which she is calling.
Our “Future of the Sea” report estimates that 12 million tonnes of plastic are currently entering the ocean and that that could treble by 2025. Our constituents are demanding change. We must act to address the shocking levels of plastic in the marine environment, and the Bill will make it easier to reuse and recycle so that we build a more circular economy at home to conserve and better use our precious natural resources.
Clause 49 grants the power to set up a deposit return scheme for products such as drinks containers. Clause 50 enables the plastic bag charge to be extended to other items—the charge has seen bag use drop by 90% since its introduction. We believe that these provisions will be widely welcomed by many who want concerted action to tackle the tragedy of plastics pollution. The suite of measures on plastics in the Bill is further strengthened by powers to make those who produce plastic packaging pay for its whole lifetime cost, including disposal. This will incentivise a switch to more sustainable forms of packaging and, crucially, provide an income stream to fund improvements to the way we tackle waste and recycling. Stronger standards for a wide range of products and clearer labelling will enable consumers to identify more sustainable products. A consistent set of materials will be collected from every household and business to help us all to recycle more, and the Bill also includes measures to encourage businesses to waste less food and help to ensure that surpluses reach those who need them.
I am a very old-fashioned man, and I come from an age when we mended things if they broke. I hope that my right hon. Friend agrees that the Bill will encourage people to go back to the days when we actually fixed things rather than threw them away at the end of use.
That is one of the outcomes that we hope the Bill will help to deliver.
As well as wide-ranging plans on plastics, the Bill has at its heart an extensive package to protect nature. The net gain provisions in schedule 15 will make a 10% boost for biodiversity a compulsory part of plans for new development. I believe that this will generate tens of millions for investment in nature and give more people better access to green space.
I am quite sure that the right hon. Lady, as a former Secretary of State for Northern Ireland, will be deeply concerned that we have no functioning Assembly and have not had one for almost three years. If we do not have the Assembly restored in the forthcoming weeks, will she commit to extending much more of this—I use her word—“landmark” Environment Bill to Northern Ireland? Many people in Northern Ireland would be very pleased if she could make that commitment.
I cannot give that commitment today, but we work very closely with the Northern Ireland civil service, and the hon. Lady will be aware that many provisions in the Bill are ready to apply to Northern Ireland; for the moment, they need Ministers to switch them on. We will continue to keep the question of governance under review, and I would love to see many more of these measures extended to Northern Ireland, but we have to respect the constitutional settlement.
No, I am going to make some progress.
The Government have already strengthened the protections for ancient woodlands, veteran trees and irreplaceable habitats, and the Bill helps us to go further. Schedule 16 will help to combat illegal deforestation. We are also legislating to give communities a say when local authorities plan to remove treasured trees from urban and suburban streets.
On the subject of engaging communities, will the Secretary of State take note of a recent report from the Environmental Audit Committee, on which I sit, on invasive species which calls for an army of volunteers across this country to help identify invasive species so we can help to eradicate them?
I agree that volunteers getting involved in the fight against invasive species is very productive. There is an example in my own constituency, where a group is helping to remove invasive species from Pymmes Brook.
The Bill will strengthen and improve the duty on public authorities to make sure that the way they carry out their functions both conserves and enhances biodiversity and enables landowners to enter voluntary conservation covenants with responsible bodies, such as charities, that would bind subsequent owners of the land to sustainable stewardship long into the future. It also provides an important statutory underpinning for the nature recovery network we outlined in our 25-year plan—for example, by mandating the creation of local nature recovery strategies to map nature-rich habitats.
As chair of the all-party group on ocean conservation, I want to thank the Secretary of State on behalf of all of us who care about our seas for the measures in the Bill to reduce plastic waste. We also welcome the additional powers to hold water companies to account. Can she confirm that these extra powers will help to reduce the number of sewer overflows during heavy rain and hold water companies to account if they fail to reduce and eventually eradicate them?
My hon. Friend is right that the Bill contains measures that will make it easier to maintain the pressure on water companies to do more to combat pollution. We want them to do better when it comes to tackling these completely unacceptable instances of sewer overflows and pollution.
No, I am going to wind up now.
Clean, safe and abundant water for all is a fundamental focus of this Bill. The provisions in part 5 will improve the way companies operate to meet current and future demand, help to ensure improved, long-term water resources, help with wastewater planning and enable more resilient solutions to drought and flooding.
In conclusion, just as the Bill seeks to put nature and climate at the heart of government decision making, so the Government are placing these environmental goals at the heart of our efforts to relieve poverty around the world. We are doubling our international climate finance funding and investing £220 million to protect international biodiversity. Working with overseas territories, we are on track to protect over 4 million sq km of the ocean by the end of 2020, and we are leading a global ocean alliance determined to protect at least 30% of the ocean in marine protected areas by 2030.
As we look ahead to co-hosting COP 26, we want this country to lead the global ambition for international targets on climate, ocean and biodiversity. I hope that in years to come people will look back on 2020 as a turning point—as a time when we came together, both nationally and internationally, to start to reverse the disastrous erosion of nature and wildlife. There can be no doubt that reversing the tragedy of biodiversity loss is a massive task, but the Bill sets up a vital framework to enable that process of recovery to accelerate. It is a truly landmark piece of legislation, enshrining environmental principles in law, requiring this Government and their successors to set demanding and legally binding targets and creating a world-leading environmental watchdog to hold them to account.
In my maiden speech in this House, I extolled the beauty of the open spaces of my Chipping Barnet constituency. I emphasised the crucial importance I placed on protection of the green belt and our natural environment. Fifteen years on, I remain convinced that there can be few things more important for a Member of this House than to be able to say that in their time in elected office they played a part in conserving the stunning landscapes, wildlife and natural habitats of this great country. In its 232 pages, its 130 clauses and its 20 schedules, the Bill will help us all to do that. I commend the Bill to the House.

Commons ChamberIt is a great honour to open today’s debate on Her Majesty’s Gracious Speech. A cornerstone of the legislative programme set out in that speech is a landmark Environment Bill. The Bill will help us to make good our pledge to bequeath the environment in a better state than it was left to us, and it will play a crucial part in our efforts to meet the commitment made to reach net zero carbon emissions by 2050.
Leaving the EU is an historic opportunity for us to set our own course, and this Government are determined that this will include stepping up action to address both climate change and the decline of nature and biodiversity. These hugely important environmental issues of our time are two sides of the same coin; we cannot protect biodiversity without stabilising the climate, and we cannot tackle climate change without saving the wildlife and habitats that provide crucial life-giving carbon sinks. The trees, plants and peatlands that make up nature’s very own carbon capture technology will become ever more important as we strive to bear down further on emissions to meet the net zero target.
Judging by the Secretary of State’s voice, I think she is suffering from the same ailment as I am: a throat or chest infection.
Does the Secretary of State acknowledge the commitment by the National Farmers Union and the Ulster Farmers Union, which I am a member of back home—I declare that interest—to achieving net carbon zero by 2045, and does she recognise that that commitment by the NFU can make things happen? It is very helpful in trying to achieve the target that Europe wants, we want and everybody else wants.
Order. Before the Secretary of State comes back in, let me say that there is a lot of pressure on time this afternoon, so I urge hon. Members to make short interventions.
I am grateful to the hon. Gentleman for his intervention. He correctly points out that the NFU has suggested going further and faster in meeting the net zero target in relation to farming, and I very much welcome that ambition, which is in tune with the reforms to farm support that I will come to in a moment.
The Secretary of State mentioned that trees are a natural carbon sink. The Scottish Government have a target of 10,000 hectares of tree planting per annum, which they are currently exceeding. The UK Government’s figure works out at an average of 5,000 hectares per year, and they are only delivering a third of that. Last year, 84% of trees planted in the UK were planted by the Scottish Government; when are the UK Government going to catch up?
The UK Government have a strong record of protecting nature and biodiversity, and we will continue to build on that with the Environment Bill that I am talking about.
The trees, plants and peatlands that make up nature’s own carbon capture technology are crucial in meeting the net zero target, and I welcome the opportunity today to reiterate the Government’s determination to address the two massive environmental challenges of nature recovery and climate change. We were the first major developed economy to make the historic commitment to meeting net zero, and we are taking action right across government to deliver on our climate commitments. The Cabinet Committee announced today will co-ordinate that work under the chairmanship of the Prime Minister, demonstrating his personal determination to safeguard the environment.
The Secretary of State is right to talk about the importance of biodiversity and climate change. On the last point she made about the Committee chaired by the Prime Minister, can she assure the House that the devolved Administrations will be part of this, so that we do not have England-only legislation on climate change but we have it right across the United Kingdom and so that we are working unitedly?
Without going into the details of the make-up of that Committee, I can assure the hon. Gentleman that the UK Government will continue to work closely with all the devolved Administrations on these hugely important tasks for us.
I am going to make some progress.
We are a country that has shown that economic and environmental success can go hand in hand. We have cut our emissions by more than 40%—faster than any other G20 country—while growing our economy by more than two thirds. That includes a 25% cut in greenhouse gas emissions since the Conservatives returned to office in 2010.
I thank the Secretary of State for giving way; she is making a powerful speech and being very generous with her time. Will she support my call that we introduce a net zero test so that we can ensure that at every fiscal event—Budgets and comprehensive spending reviews—we are investing to deliver, and perhaps we could get the Office for Budget Responsibility to scrutinise that so that everyone has confidence, as I do, that the Government are absolutely committed to delivering net zero?
My hon. Friend makes an interesting suggestion, which I will consider carefully, and we might of course return to it when the Environment Bill is debated in Committee.

I am going to make a little more progress.
Only six years ago, 40% of our electricity came from coal; now that figure is less than 5%. In 2018, more than a third of our electricity was generated by renewables, and earlier this year the UK went a whole fortnight without using electricity generated from coal, the first time this has happened since the industrial revolution. We have the largest installed offshore wind capacity in the world, and annual support for renewables will be over £10 billion by 2021.
I am grateful for the opportunity just to say how wholeheartedly I support my right hon. Friend in what she is doing, particularly in the environmental space. Does she agree that the ability to take the leadership that the UK has demonstrated in so many areas to the rest of the world in the absolutely critical conference of the parties next year will help us to sell the benefits of the green transition and persuade every other country in the world to lift their eyes to the green prize?
My right hon. Friend makes a hugely important point, and I wholeheartedly agree and will return to it in a few moments.
We have committed to building on the record of success I have outlined, and we will accelerate the low-carbon growth that already provides more than 400,000 jobs in the United Kingdom. For example, we are supporting clean growth with investment of more than £3 billion in research and development. As we look ahead to the date when we end the sale of new petrol and diesel cars, we are generating £2.7 billion in exporting ultra-low emission vehicles. One in five battery electric cars sold in Europe was built right here in this country.
A decade on from the landmark Climate Change Act 2008, which enshrined ambition in law and marshalled action across society, we are forging ahead with legislation for the second great environmental task: nature recovery.
To go back to the number of low-carbon jobs in the UK, does the Secretary of State agree that more could be created if the licensing process for contracts for difference auctions looked not only at price, but at quality and value added in the use of local supply chains? That would help to get preferential treatment for UK companies.
We will certainly look at all the options to create low-carbon jobs, including the ideas that the hon. Gentleman speaks about.
Just as the Climate Change Act set a path to reducing carbon emissions, so our Environment Bill will embed environmental principles at the heart of Government decision making. It will mandate the Government to set ambitious, legally binding targets on the pressing environmental concerns that we face as a nation, including air quality, water, resource efficiency, waste reduction and safeguarding nature and habitats.
On waste reduction, the Secretary of State will know that plastic is one of the big sources of pollution in our natural environment—particularly in our seas, but also on land. What pressure is she therefore applying to the manufacturers of soft drinks to move away from plastic, particularly single-use plastic?
The hon. Gentleman is right to highlight the pressing concerns about single-use plastic. The Bill contains a number of provisions designed to cut down on avoidable plastic waste, which I will address in more detail in a moment. It includes the potential for the charges that apply to plastic bags to be extended to other plastics; it also includes better labelling to ensure that people are clear about whether the products that they buy are reusable or recyclable. It will help people to understand the best way to recycle by introducing a consistent approach to kerbside recycling, to increase the proportion of plastic that is recycled rather than ending up in landfill. We fully recognise the enthusiasm across our nation for tackling avoidable plastic waste, and our Environment Bill sets out a range of measures to help us to meet that challenge.
In Wales, we have the third-best recycling rate in the world, but that recycling ends up across the oceans in other countries. Does the Secretary of State agree that what is actually needed is wholesale reform of the whole waste hierarchy to put pressure on our producers to ensure that they hold responsibility not only for what they produce, but for how they clear up at the end of the lifecycle?
I agree that we need a real step change in moving to a much more circular economy, and I believe that our Bill will set us on that path. We are also funding programmes around the world to encourage a move to a more circular economy and more recycling across the world.
I am grateful to the Secretary of State for being very generous in giving way. She mentions the targets that her Government have set. She will know that research has just come out that shows that the UK Government are set to miss their legally binding targets of reducing emissions by 51% by 2025. I am very concerned that there are no targets on carbon reduction as part of their strategy. Will the Government introduce any? Surely they are the most important thing we need.
We are already subject to rigorous legal obligations in relation to our carbon budgets, and we are showing real progress towards meeting them.
Our Environment Bill will mandate setting ambitious targets rooted in science. A powerful new independent watchdog will be created to hold the Government to account on meeting the targets that we set. From a free-to-use complaints system to the authority to instigate and undertake investigations and the power to take the Government to court if necessary, the new office for environmental protection will have real teeth.
I want to take the Secretary of State back to the Environment Bill for two seconds, because it is important to set targets but even more important to have deadlines for meeting them. She will be aware of concerns raised today that there is a major loophole in the Bill that will essentially give the Government nearly two decades to meet the legally binding future environmental targets. Will she comment on those concerns? It is all very well setting targets by 2022, but not having to meet them for 15 years seems absurd.
I can reassure the hon. Lady by drawing her attention to clause 10, which provides for interim targets. The OEP will also have the authority to hold the Government to account on our progress towards meeting long-term targets.
Taking on board the recommendations of the Select Committee on Environment, Food and Rural Affairs and of the Environmental Audit Committee, the Bill extends the OEP’s proposed remit to climate change. More than half the Bill’s measures will apply beyond England, helping the environment across our Union from Shetland to the Scilly Isles. Measures requiring developers to deliver a net gain for biodiversity will provide millions of pounds to boost nature and access to open green spaces.
My right hon. Friend is being very generous with her time. As a member of the Environmental Audit Committee, I am pleased to hear that she has taken some of our recommendations on board. When she looks at improving water quality, will she consider whether there is a role for Ofwat? Its periodic reviews of water companies’ charging regimes should be linked to improvements in water quality in our rivers as a means of encouraging savings to customers.
I assure my right hon. Friend that Ofwat and the Environment Agency work together closely in their complementary roles in regulating the water industry. Ensuring that the water companies play their part in protecting the environment is vital. Our Environment Bill will help us to maintain and increase the pressure on water companies to cut down on pollution and improve their record on water quality and the natural environment.
The local nature recovery strategies in the Bill will help to join up the network of habitats that the Government committed to delivering as part of our 25-year environment plan. We will boost recycling and cut down on avoidable plastic waste and litter by ensuring that businesses pay the whole cost of the packaging that they produce, including disposal.
The Secretary of State makes a good point about plastic waste. Does she agree that plastic waste getting into the wrong place and causing litter is an issue created by people and consumers, not by manufacturers and businesses?
That is, of course, the case. I would always urge everyone not to drop litter; it is an eyesore that blights our communities and open spaces, and we are determined to tackle it. The Environment Bill includes significant new powers to crack down on fly-tipping and waste crime—those deeply antisocial crimes.
A range of measures in the Bill will help to ensure that more of the items that we consume are reusable, reparable or recyclable to help us to create the circular economy about which I was asked earlier. The Bill includes the power to create deposit return schemes for drinks containers and an extension of charging schemes for certain types of single-use plastic. We want to replicate the success of the plastic bag charge, which has led use to plummet by 90%—a great illustration of the enthusiasm and commitment of so many people to addressing the tragedy of plastics pollution in our oceans.
In more general terms, looking beyond the Environment Bill that we will have next week, can the Secretary of State give a cast-iron guarantee from the Dispatch Box that if we were to leave the European Union, the UK’s environmental protections, regulations and laws would be better than those we currently enjoy as a member state of the European Union?
We are actually setting out a much more demanding programme for the environment than we would be required to undertake under EU law. We are proposing to go further and faster than EU laws, and as an illustration of that—
Will the Secretary of State give way?
No; I want Back Benchers to have all the time they need, so I will have to cut down on the points of information.
We will, for example, go further and faster than ever before on air quality, because we will be setting a legally binding target on PM2.5 fine particulate matter. Poor air quality is the biggest environmental threat to public health, and particulate pollution is the most damaging of all. Real progress has been made, but we need to do more if we are to ensure that children growing up today can live longer healthier lives. This Bill will drive that forward.
The UK is home to scientific excellence that has made us world leaders in environmental innovation, from Kew’s millennium seed bank to climate-resilient crops, but as well as backing the science and research that we need to protect our environment, we are also embracing nature-based solutions to tackle climate change. We have recently announced that we will plant 1 million trees to create three new forests in Northumberland, in addition to the 11 million to which we are already committed. We are restoring almost 6,500 hectares of peat land. That is our biggest carbon store, and it is home to some of our most threatened and fastest declining bird species, including the golden plover and the curlew. Through our agriculture Bill, we will seize this once-in-a-generation chance to combine support for our hard-working, brilliant farmers with support for our natural environment.
My right hon. Friend will be aware that the previous Agriculture Bill, which fell at Prorogation, struck a neat balance between the interests of farming and the interests of the environment, with both sides being broadly supportive. Can she confirm this afternoon that it is going to be broadly the same direction of travel for the new agriculture Bill?
Yes, we would certainly envisage broadly the same direction of travel for the agriculture Bill when it is reintroduced. We very much value the input that Parliament previously provided, and all the fundamentals of the previous Agriculture Bill will remain intact.
Outside the EU, we can and will replace the common agricultural policy with a system that not only helps farm businesses to be more resilient, more productive and more internationally competitive but rewards environmental stewardship. From heathlands to hedgerows and from soils rich in carbon to better biodiversity, our farmers will be properly rewarded with public money for the public goods they provide. Breaking free of the CAP means that we can support a range of vital goals, including clean air and water, landscapes protected from floods, thriving plants and wildlife, and reduced carbon emissions and pollution. Brexit also means regaining control of our waters, so that we can manage our fish stocks sustainably, support our marine environment and give our fishing communities a much fairer deal than they have ever had from the common fisheries policy.
We are taking more action on climate change globally than any of our predecessors. We know that 70% of the world’s poorest people are directly reliant on the natural environment for their livelihoods We therefore believe that climate and nature programmes should be at the heart of our efforts to relieve poverty around the world. That is why the Prime Minister announced at the UN in September that we will double our international climate finance funding to at least £11.6 billion in the period up to 2025. He has confirmed £220 million of investment to protect international biodiversity and help to halt its decline. We share the grave public concern felt about plastics pollution in our oceans, and we are investing up to £70 million to fund global research to develop circular economies for waste around the world, working across the Commonwealth to keep plastics out of our ocean.
We are custodians of the fifth largest marine estate in the world, and we are on track to protect more than half of our UK and overseas territories waters by 2020, with a further £7 million recently announced to expand still further our highly successful blue belt programme. We are calling on the world to protect at least 30% of the ocean in marine protected areas by 2030, and 10 nations have already signed up to our new global ocean alliance. We are determined to make this happen.
Whatever our views on the climate protests, there can be no doubt that we as a nation find ourselves at a crucial turning point, and 2020 needs to be the year when the international community pulls together to agree time-bound, measurable and demanding environmental targets. We need targets for protecting biodiversity on land and in our ocean to help us to meet our climate objectives and tackle the tragedy of plastics pollution. That is what we will be asking for, as aspiring co-hosts of the crucial COP 26 conference in Glasgow next year, as we make nature-based solutions and biodiversity a central focus of our efforts to tackle the climate crisis at home and abroad.
In conclusion, the Government have one of the strongest records in the world on environment and climate issues. As the evidence becomes ever stronger, we are determined to escalate the UK’s response to the climate and nature crisis, both domestically and internationally. We believe that the Environment Bill published this week will be a big step forward in turning the tide on the degradation of nature and the natural environment. Combined with our legislation on fisheries, farming and improving the welfare of animals, this is a powerful reform package that will change things for the better in this country for decades to come.
There can be no doubt that we face a daunting task if we are to live up to our commitment to leave young people with a better natural inheritance than was bequeathed to us. We need a green economic revolution every bit as profound and far-reaching as the industrial revolution that this country once led. If we work together across the House and get this ground-breaking legislation on the statute book, we can lead global efforts to find solutions that work for climate, for nature and for people. I am happy to commend the Gracious Speech to the House.

Written StatementsToday, I am introducing the Environment Bill into the House of Commons, which will play a crucial role in delivering on the Government’s goal that this will be the first generation to leave our environment in a better state than we found it.
The case for tackling biodiversity loss and climate change is clear. The accelerating impact of climate change in this country, and around the world, is of profound public concern, as is the damage to nature with species loss, habitat erosion and the disappearance of cherished wildlife.
The Environment Bill, building on the vision set out in the 25 year environment plan, will help to manage the impact of human activity on the environment, create a more sustainable economy, and enhance well-being and quality of life.
A key aim of the Bill is to engage and empower citizens, local government and businesses to deliver environmental outcomes and create a positive legacy for future generations. It will also support recent legislation on reaching net zero carbon emissions by 2050 by reducing waste, improving air and water quality, and restoring habitats to allow plants and wildlife to thrive.
The Bill will transform our environmental governance by creating a new, world-leading system tailored to a UK context once we leave the EU. It will introduce new statutory cycle of monitoring, planning and reporting on the environment, coupled with a framework to set long-term legally binding targets, on biodiversity, air quality, waste and resource efficiency, and water. This will deliver significant environmental improvement and ensure that the Government can be held to account for their actions.
This new framework will ensure that environmental principles are embedded in Government decision making and policy development.
A new public body—the Office for Environmental Protection (OEP)—will act as an independent watchdog. The OEP will provide scrutiny and advice, and enforce the delivery of environmental law “including on climate” by public authorities where necessary.
Together, these measures form a robust framework which will maintain and enhance our environmental standards as we leave the EU. They will enable the UK to take a global lead on environmental concerns such as nature recovery and the protection of biodiversity.
The Environment Bill takes action to address some of the biggest environmental priorities of our age: air quality, nature recovery, waste and resource efficiency, and water resource management. For example, mandatory biodiversity net gain principles will ensure that new developments enhance biodiversity in conjunction with local nature recovery strategies which will help restore wildlife rich habitats to enable ecosystems to recover and thrive.
The Bill strengthens the ability for local authorities to tackle air quality issues. It will also require Government to set a legally-binding target for the pollutant with the most significant impact on human health, fine particulate matter. The Bill improves water company planning for future water supply and wastewater and drainage networks, enabling more resilient solutions to drought and flooding in a changing climate.
Extended producer responsibility and powers to set resource efficiency standards will drive a shift in the market towards products that can be more easily recycled, re-used and repaired. This, and other measures in the Bill, will play a significant part in addressing public concern about plastics waste and pollution.
This Environment Bill is a landmark commitment to protecting and improving the environment for future generations. It grasps opportunities created from leaving the European Union and I hope that it will deliver a step change in environmental protection and recovery.

Written StatementsToday I am notifying the House about recent announcements I have made on measures to enhance the welfare and protection of animals. These include proposals to address long journeys for live animals that are being transported for slaughter, and to restrict the import and export of hunting trophies.
First, I have announced that we will consult on improving animal welfare in the transport of live animals. Last year DEFRA issued a call for evidence in relation to future standards on welfare in transport, followed by commissioning external research, and inviting the farm animal welfare committee to conduct a review and make recommendations.
I welcome the farm animal welfare committee’s recommendations that live animal journeys should be minimised and that animals for slaughter should not be transported longer distances if suitable alternatives are available. FAWC’s report will inform a public consultation on this issue, which will be published in due course. The consultation is intended to take forward our manifesto commitment on restricting the live export of animals for slaughter.
Secondly, I recognise the concerns that have been expressed regarding the welfare of primates kept as pets, given the complex needs of these animals. Therefore, we will issue a call for evidence to better understand:
the scale of ownership of primates as pets,
how they are acquired, and
the merits and impacts of potential restrictions on ownership, sale, breeding and trade.
The call for evidence will be published in due course.
Thirdly, we will issue a call for evidence on compulsory microchipping for pet cats. Evidence will be sought on the benefits and impacts of subjecting cats to similar measures to those currently required under the rules on compulsory dog microchipping. The call for evidence will be published in due course.
Fourthly, we will launch a consultation on banning the import and export of trophies from the hunting of endangered species. This follows the introduction of the UK’s world-leading ivory ban in December 2018. A roundtable on trophy hunting was held in May 2019, with all sides of this debate represented. The views raised during those discussions will inform the proposed consultation on further restrictions on the import and export of hunting trophies. The consultation will be published in due course.
Alongside these measures, I have announced plans to create a new forest project in Northumberland to help improve our natural environment and respond to climate change.
Trees and forests need to play a vital part in our response to climate change. To start an ambitious new Northumberland forest, the Government have announced their commitment to create three new forests in the county, with up to 1 million trees to be planted in the period up to 2024.
We expect planting to begin next year to coincide with the COP26 conference. The Government will set up a new forestry partnership for Northumberland to help identify sites for afforestation and provide a forum to bring local stakeholders together to help take the project forward.
We expect these plans to pave the way for further woodland creation partnerships elsewhere in the country.

Written StatementsThis summer saw significant rainfall that unfortunately impacted several communities. In June, properties and farmland were flooded after the River Steeping broke its banks leading to a quick response from the Environment Agency supported by the RAF. At the end of July there was significant rainfall which led to flooding in several communities. The flash flooding in North Yorkshire saw homes, businesses and farms affected as well as causing damage to roads and bridges resulting in travel disruption. On 1 August further heavy rainfall led to the spillway of Toddbrook Reservoir experiencing damage. This did not lead to a breach of the dam itself, but to ensure the safety of Whaley Bridge, a decision was taken by the local resilience forum to evacuate 1,500 people until the authorities could be assured there was no ongoing risk. The local community responded with grace and patience despite the disruption this caused to their daily lives, which we are grateful for. Recovery continues in both North Yorkshire and Wainfleet, where the local authorities are working with those affected.
In Whaley Bridge, everyone was able to return home within a week. The Canal and River Trust, supported by the EA, fire service, voluntary organisations, contractors and the RAF worked to reduce the water levels in the reservoir and shore up the damaged spillway with over 500 one-tonne bags of aggregate to effect a temporary, but stable, repair. COBRA engaged a panel of experts, led by GO-Science, to review and advise on the engineers’ safety report and immediate management of the reservoir, before the local resilience forum made the decision to end the evacuation.
A plan is in place to ensure the water levels are monitored and remain at safe levels until full repairs are completed. As the body responsible for Toddbrook Reservoir, the Canal and River Trust (CRT) is now fully assessing the damage and identifying the most appropriate long-term repairs to provide confidence in the long term safety of this dam. As the regulator, the EA will assess the proposals. My officials in DEFRA will also work with the CRT as they consider the long term future of the reservoir taking into account both the views of the local community and their legal obligations.
I wish to thank the Whaley Bridge residents displaced from their homes for their forbearance and patience in difficult circumstances. I also want to recognise and thank the emergency services, local authorities, the Environment Agency, our servicemen and women, contractors and the very many volunteers who responded in all of these situations to both mitigate the immediate impacts or risks and support those who were affected.
On 10 August the Government announced a £5.25 million package of support for these communities which included support to the local authorities for the extra costs, funding for bridge repairs and support to farmers for any uninsurable costs.
We have an excellent reservoir safety record in this country, but it is important that we learn from this incident to ensure such infrastructure, and the legislation that governs it, is and remains fit for purpose. To that end, I am commissioning an independent review which will investigate what might have led to the damage, whether there was anything that could have prevent or predicted it and identify any lessons learned. This review will supplement the future report from the Canal and Rivers Trust into their assessment of the factors that led to the damaged spillway.
Any lessons learned will be shared with other reservoir owners to inform their inspection and maintenance regimes, to be used to make recommendations to Ministers to update the implementation of current regulations, including inspection guidance, and/or to suggest any changes required to current reservoir safety legislation. I am expecting an interim report by the end of the year.
In advance of this piece of work the Environment Agency, as the regulator for reservoir safety, have contacted the operators of over 2,000 reservoirs since the Toddbrook incident requesting that all operators check that there are no safety concerns. The EA has identified eight reservoirs that have concrete spillways with some similarity to Toddbrook Reservoir and has followed up directly with the owners of these eight reservoirs to secure additional inspections. At this stage there is no indication of any concerns with any of these eight reservoirs. The EA is also carrying out inspections of their own reservoirs directly, and the Department is writing to reservoir owners and the local resilience forums to ensure they have up to date flood and evacuation plans in place.
Climate change and population growth mean that the risks from flooding and coastal erosion are increasing. That is why Government are looking to update the flood and coastal erosion policy framework to ensure that we can continue to manage these risks effectively into the future. By the end of 2019, the Government will set out their policies to better prepare the country for flooding and coastal erosion in a Government policy statement on flooding and coastal erosion. The Government will also set out plans for a step change in broader infrastructure investment through the publication of a national infrastructure strategy later in the autumn. Informed by this Government policy, the Environment Agency will update its national strategy for flood and coastal erosion risk management.

Our priority is preventing plastic waste from entering the environment in the first instance. The resources and waste strategy sets out our plans to eliminate avoidable plastic waste, including measures to tackle certain single-use plastic items. This week we published Government responses to consultations on measures that include making recycling easier and ensuring that producers pay the full cost of managing their packaging waste responsibly.
I congratulate my right hon. Friend on her new role.
Pupils from Kings Road Primary School and the Bishops’ Primary School in Chelmsford want to do more to reduce single-use plastic. I have obviously given them copies of “Vicky’s Guide to Going Green”, but what top tips would my right hon. Friend like to share?
There are many top tips in our 25-year environment plan, and I commend my predecessor, my right hon. Friend the Member for Surrey Heath (Michael Gove), for his world-leading work on this matter. A key message to get across to all the schoolchildren around the country who want to take part in tackling plastic waste is: don’t drop litter.
I also congratulate my right hon. Friend on her appointment. Will she join me in congratulating the students from the National Citizen Service I met at Roots Hall in Southend on Monday, who, inspired by David Attenborough, are right at this very minute picking plastic from our beautiful coastline in Southend?
I thank my hon. Friend for his question. Both questions illustrate that there is a real attitude out there among the public that they want to be part of resolving this urgent problem. The Government will continue to support organisations such as the National Citizen Service to engage young people and ensure that they are playing a part in the Government’s determination to address this problem because people are concerned about it.
Nearly 40 million plastic bottles are used in the UK every day, but the Government’s bottle return scheme does not kick in for four years. Why so long?
We have gone further than any other Government in history on tackling plastic waste. I acknowledge the concern felt about the matter that the hon. Gentleman has raised. We will always try to move as fast as we can to ensure that we are taking the most effective action possible, but we also need to take time to ensure that we get it right. I assure him that I will be working hard to ensure that this action is delivered as soon as possible.
I welcome the new Secretary of State to her place.
On 1 May, this House unanimously supported Labour’s declaration of an environment and climate emergency. The Center for International Environmental Law predicts that plastics will contribute to 13% of global carbon emissions by 2050 if no action is taken, yet the Government’s plans do not envisage that extended producer responsibility for packaging will come into force before 2023 or that a 75% recycling rate will be achieved before 2030. Does the Secretary of State accept that the emergency requires much faster action?
I look forward to working with the shadow Front Benchers on these issues. We have gone further and faster than the previous Labour Government with radical changes, including the plastic bag tax and our plans to ban plastic stirrers and other plastic products. We are a world-leading country on this issue, and we will continue to be so because we are determined to tackle the problem.
The Government will be working through the Waste and Resources Action Programme and with industry on developing an ambitious new phase of the sustainable clothing action plan. We are planning to develop regulatory standards and labels to support durable, repairable and recyclable products; consult on an extended producer responsibility scheme; and support innovation in textile recycling. We are also increasing the transparency of reporting required on modern slavery, and continuing to prioritise the enforcement of national minimum wage legislation.
I welcome the Secretary of State to her place, but the announcements she has just made will not go far enough to tackle the fast fashion epidemic, which is being promoted by shows such as “Love Island”. It may be bikini weather outside, but when bikinis are being sold for £1 on fast fashion websites, it is clear that workers are not getting what they need. When is she going to bring in extended producer responsibility and ban clothing from landfill?
First, I very much look forward to working with the hon. Lady’s Environmental Audit Committee on these and other matters. I very much hope to appear in front of the members of her Committee when there is time in their diary.
The hon. Lady raises very important points. I think there is real consensus across the House that we need action. The Government have a credible plan, which we are delivering. As I said in response to earlier questions, we need to ensure that we get this right. I can assure her that we will be moving towards solutions on these problems in response to public concern.
Does the Secretary of State agree with me that fashion provides very important livelihoods for people in low-income countries around the world? As we, rightly, address the question of sustainability, we must never throw away their livelihoods, which are so important. In fact, we must seek to ensure that those livelihoods are improved.
With all these matters, our goal should be to pursue both prosperity and environmental sustainability at the same time. My hon. Friend makes a very valid point that in taking forward our new regulatory structures to tackle this problem, we must also take into account the impact on developing countries and the interests of people on low incomes.
I welcome the Secretary of State to her place. As we have heard, fast fashion has a negative impact on our environment. The Secretary of State mentioned environmental sustainability, but she repeatedly voted against measures to protect the environment and tackle climate change. How can we trust her to deliver the transformative change that we need to tackle the climate and environmental emergency we all face? Will she confirm that net zero is still the Government’s target, and if so, will she commit to taking the necessary steps that she previously voted against?
I do not know whose voting record the hon. Lady has been looking at, but it does not sound like mine. The Government are doing more on climate change than ever before, and we are one of the first developed countries in the world to commit to the net zero target—not something that our Labour predecessors were prepared to do. I have backed, with enthusiasm, a succession of vital measures taken by the Government—for example, to ensure that more of our electricity is generated by renewables than ever before.
I am delighted to have been asked to take up the outstanding work previously begun by my right hon. Friend the Member for Surrey Heath (Michael Gove), and the team of dedicated public servants at the Department for Environment, Food and Rural Affairs, and its agencies. I look forward to working to deliver the Government’s historic commitment to hand on the natural environment in a better state than we found it, by driving up animal welfare, championing and supporting our country’s fantastic food, farming and fisheries, and ensuring that we seize the opportunities offered by Brexit.
I warmly welcome the Secretary of State to her role. My constituency has some of the best vineyards in the country, and places such as Breaky Bottom, Ridgeview and Rathfinny produce award-winning English sparkling wine. What steps will the Secretary of State take to promote English sparkling wine at home and abroad, and may I invite her to visit one of those vineyards to taste that wine for herself?
I would be delighted to take up the invitation to do a little tasting of the fantastic wines to which my hon. Friend refers. The GREAT campaign has a strong focus on the brilliant high-quality food we produce in this country. In June, English sparkling wine was promoted at various events in Japan, and the campaign plans to return there in September and October. In August and September we will support Wine GB at events in the United States.
I welcome the Secretary of State to her new position. When will we welcome back the Agriculture Bill and the Fisheries Bill? It is about time we saw them. We last saw them seven months ago, and we need them back.
As the hon. Gentleman will know, such matters are in the hands of the Leader of the House and the official channels, so he might wish to raise the matter during the business question. I assure him that we wish to press ahead with these matters as soon as we are able to do so. This Government are getting on and delivering on their priorities, including the environment.
In July, we published the Government’s response to the consultation on consistency in household and business recycling collections in England. The response sets out plans to legislate to ensure consistency between local authorities, which is vital to ensuring that we raise recycling rates, and to people having a consistent picture and a better understanding of the most effective ways to recycle.
Mansfield and Warsop are full of animal lovers, as is the rest of the UK. News of tougher sentencing for animal abuse is very welcome. What steps will the Department take, perhaps working with charities such as Battersea and others, to make sure that everybody is aware of the new sentencing rules, so that animal cruelty can be prosecuted as robustly as possible?
I thank my hon. Friend for his question. He makes a very good point. It is not enough just to change the law; we need to make sure there is a greater awareness of the changes that I hope are soon to be implemented. I would like to take this opportunity to pay tribute to the coalition of charities that campaigned so hard for the proposed legislation, which will shortly come back to the House, to ensure that we raise the maximum sentences for animal cruelty.
In private, the Government are apparently briefing local resilience forums about the impact of a no-deal Brexit on food supply and food prices, and are predicting mass disruption. Will the Secretary of State confirm whether that is true, and will she stop keeping people in the dark? Will she publish this information, so all of us can see whether there are adequate contingencies in place?
On Saturday, I met impassioned climate change activists Cliff Kendall and Donna Tyrelli. Cliff Kendall is on hunger strike to protect the environment. They suggest that the average household can reduce its energy bills by more than £250 a year by switching to renewable energy suppliers. What steps is the Department taking to educate households about such green initiatives that help to cut the cost of living?
There is a range of programmes under way to encourage people to switch, both to ensure that they get value for money and to talk up the advantages of moving to a more sustainable electricity supply. I will certainly be taking a personal interest in these matters in my new role.
Improving the energy efficiency of our homes is one of the best ways to tackle climate change, yet since 2012 there has been a 95% fall in home insulation programmes. What has gone wrong?
The Government have a strong record on climate change, but I acknowledge that we need to do more to ensure that people are able to insulate their homes. We will be working on that in the months ahead.

I wish to thank Members who co-sponsored this Bill, those who were selected for the Committee and all the other Members and supporters, such as the hon. Member for Halifax (Holly Lynch) who has been very supportive but who is currently on maternity duty. They have been great supporters of this small but important change in the law, popularly known as Finn’s law. I also thank all those who have campaigned for this measure, including PC Dave Wardell, Sarah Dixon of the Finn’s law campaign, many animal charities, the media, including the “Today” programme, The Sun and the Daily Mirror, all police and crime commissioners, including David Lloyd from Hertfordshire, and mayors such as Andy Burnham. I am grateful to the Administration Committee for agreeing that Finn could attend the various stages of the Bill accompanied by PC Wardell and Sarah Dixon. I thank my Whip, my hon. Friend the Member for Castle Point (Rebecca Harris), who has championed the Bill and helped me a great deal with this. I also thank you, Mr Speaker, for your advice early on in the proceedings when you told me to keep persisting and perhaps I would get there, and it looks as though I may, so thank you very much.
This Bill, which received a Second Reading on 6 July last year and passed Committee on 16 January, arises from events that I explained to the House in my ten-minute rule Bill application on 5 December 2017. My constituent PC Dave Wardell is a police dog handler from Buntingford in my constituency where he lives with his family and Finn, now a retired police dog. On Wednesday 5 October 2016, PC Wardell and Finn were on duty in Stevenage when a robbery suspect ran off and they followed. The suspect was found hiding in a garden when a light came on. PC Wardell called, “Stop! Police!” but the suspect started to jump up a fence. Finn took hold of his lower leg to restrain him. The man lunged at Finn with a 10-inch bladed hunting knife and stabbed him right through the chest several times. He then turned his attention to PC Wardell. Finn intervened to save PC Wardell as the blade was aimed at his face. Finn put himself in the way to save the officer, and PC Wardell received a hand wound, but the dog received serious head wounds as well as the chest injuries. PC Wardell believes that Finn saved his life.
As other officers arrived, the suspect was apprehended. Finn was badly injured, bleeding and was taken to the vet and then on to a specialist vet. He was in a terrible shape with his lungs punctured in four places and yet he was licking his handler’s hand wound. Finn had a four-hour operation to save his life. The vet commented on his strength and bravery. PC Wardell slept downstairs with Finn for the next four weeks, and I think we are all pleased that Finn made a remarkable recovery. After 11 weeks, he was ready to go back to work with PC Wardell. On his first shift, on 22 December 2016, they arrested a fleeing suspect on their first outing.
Finn is one of the most successful police dogs that Hertfordshire police has known. He has won national recognition for his bravery: Action Animal of the Year; Hero Animal of the Year; and the PDSA gold medal, which is known as the animals’ George Cross. However, when it came to charging the offender, it became clear that there is a problem with the law. For the assault on the officer, it was a straightforward offence of assault occasioning actual bodily harm, but there were two potential charges for the injuries to Finn himself—either causing “unnecessary suffering” to an animal under section 4 of the Animal Welfare Act 2006, or section 1 of the Criminal Damage Act 1971. Neither offence properly provides for the criminality involved in the attack on Finn. In the event, an offence of criminal damage was brought, but this treated Finn as though he were simply a piece of police property that had been damaged—a bit like a police radio or something of that sort.
May I thank My right hon. and learned Friend for his persistence in introducing this Bill and say how strongly I support it? He is making the compelling case that treating these animals in the criminal justice system as items of property is entirely unjust, and it does not reflect their bravery and service.
I entirely agree with my right hon. Friend my right hon. Friend the Minister for Policing and the Fire Service, who was here a moment ago, told me that he thought it was unpalatable to think of police animals as equipment. In addition, the penalty for criminal damage is largely determined by the value of the property that is damaged, and a seven-year-old police dog who is close to retirement is simply not worth much money. And so it proved at court, where no separate penalty was imposed on Finn’s attacker for the attack on Finn.
The offence under section 4 of the Animal Welfare Act is potentially a better route, but there are two problems with it. First, the maximum penalty is only six months’ imprisonment. After a consultation, happily the Government have committed to increasing that to five years, and that has been widely welcomed. I pay tribute to the campaigners who have pressed for that, including Battersea Dogs and Cats Home, which is also a strong supporter of this measure. The Government’s commitment to a maximum penalty of five years clearly represents a great improvement.
Secondly, there is a difficulty with the application of section 4(3)(c)(ii) of the Animal Welfare Act, which sets out that various factors must be taken into account in deciding whether the infliction of suffering on an animal can be considered unnecessary—those factors include the protection of a person or property—and currently contains no reference to the role of service animals. Clearly, the mission of a service animal is to restrain a suspect or to use its physical presence to support the actions of an officer in accordance with his or her duty, but there is no reference to that in the Act. We have heard from police dog handlers, prosecutors and all the police and crime commissioners in the country that there is concern that the provision allows defendants to argue that they are justified in applying force against a service animal in self-defence, rendering the force necessary. That has apparently been an issue in deciding not to prosecute for the offence under the Animal Welfare Act.

Given the huge importance of trees to our environment and our quality of life, does the Minister agree that we must ensure that the planning system protects protected trees and woodland wherever it can when new development is being considered?
