(Urgent Question): To ask the Prime Minister if he will make a statement on what new financial and other obligations apply to the UK in the EU-Turkey agreement.

Agreements reached in principle at the EU-Turkey summit on Monday represent a basis on which in future all migrants who arrive in Greece could be returned to Turkey. That would, if implemented, break the business model of the people smugglers, and end the link between getting in a boat and getting settlement in Europe. That is something that the Prime Minister and the Government have been arguing for nearly a year.

The agreement would not impose any new obligations on the United Kingdom in respect of either resettlement or relocation. As we are not members of the Schengen area, we are able to maintain our own border controls and make our own decisions on asylum. Nor would the United Kingdom be obliged to resettle any additional refugees. We are already resettling 20,000 of the most vulnerable Syrians directly from the region through our own national scheme. We will not be part of the process of liberalising visas—that is a matter for Schengen countries—and we will still require visas for Turkish citizens to visit Britain.

The European Union also agreed on Monday to consider in due course extending the current financial support to help Turkey. There are currently no formal proposals for further funding on returns, and we will wait to see any proposals before commenting. We have already agreed to pay our £250 million share of the existing €3 billion Turkey refugee facility, and I made a written ministerial statement about that earlier this week. This builds on our existing £1.1 billion bilateral support for the Syria crisis and the additional bilateral commitment that we made at the recent London conference on Syria. The Turkey refugee facility is designed to provide immediate humanitarian support and also to fund the schools, hospitals and housing required over the longer term to support refugees and the communities that host them.

The agreement at the EU-Turkey summit on Monday will ensure that the €3 billion commitment agreed at last November’s EU-Turkey summit is properly and expeditiously disbursed. Intensive work will take place over the coming week with the aim of reaching final agreement at the next European Council on 17 and 18 March, after which my right hon. Friend the Prime Minister will make a statement to the House as usual.

One of the reasons why I asked for this urgent question was that the statement from the EU Heads of State or Government issued yesterday makes it very clear that the visa liberalisation applies to all member states of the European Union, not just the Schengen area. I quote from the official document, which says that the EU Heads of State or Government agreed

“to accelerate the implementation of the visa liberalization roadmap with all Member States with a view to lifting the visa requirements for Turkish citizens at the latest by the end of June 2016”.

Will the Minister therefore be seeking clarification and amendment to this statement, given that he told us that these visa requirement waivers will not apply to all member states, or will he negotiate some kind of opt-out to make it very clear that those waivers will not do so? It will obviously be a matter of concern if the text issued from the Heads of State or Government meeting is at variance with the clear statements that we have been getting from Ministers here and through the media in the past few hours.

Secondly, I am surprised that the Minister has not mentioned that there was an agreement to an accelerated process to get Turkey to join the European Union as a full member, so will he comment on the United Kingdom’s position on the pace of the proceedings to get Turkey into the European Union, on what arrangements, if any, he thinks will need to be made when Turkey joins over freedom of movement, on whether there would need to be transitional arrangements, and on whether Britain would wish to be part of the freedom of movement area without proper transitional arrangements and protections?

Thirdly, I find it curious that we still do not know what we might be paying. If our share of the €3 billion is £250 million, plus the contribution that we have made through the EU budget, presumably we are looking at more than £250 million on top of that if the sum is doubled from €3 billion to €6 billion, because I presume that that will also be a levy on the member states. This should be properly reported to the House of Commons because it is an additional contribution to the EU, on top of the normal budget.

Let me respond to my right hon. Friend’s three questions. We already have an opt-out from Schengen; that is written into the treaties. Similar arrangements apply to Ireland and Denmark in slightly different respects. The legal measure that would be used for any liberalisation of visa arrangements for Turkey would be a Schengen measure that would be brought forward under the appropriate treaty base, so it would not apply to the United Kingdom, Denmark or Ireland. I made it clear in my initial response to my right hon. Friend that the Government do not intend to liberalise our visa arrangements with Turkey.

On my right hon. Friend’s second point, it has of course been the policy of successive British Governments, including the one in which he served with such distinction, to support the eventual accession of Turkey to EU membership. That is not going to happen in the near future. The statement of the Heads of State or Government said on Monday that they would prepare for the decision on the opening of new chapters in the accession negotiations as soon as possible. To open a chapter such as chapter 23, which deals with the rule of law, might well be very helpful to strengthen the dialogue that we shall be having with Turkey about the rule of law, human rights and the standards that are expected of candidate members of the European Union but, again, no agreement has yet been reached on any aspect of opening new chapters, and many member states will have their views about that.

On my right hon. Friend’s point about Turkish accession—or any new member’s accession—and freedom of movement, the Government have said repeatedly that we will not agree to any further EU enlargement unless we first have in place new arrangements for transitional controls on freedom of movement so that we do not take on the risk, as we did in 2004, of very large movements of people in the aftermath of a new accession. Every decision to do with EU membership requires unanimity, so every country has a veto on every such step.

Thirdly, my right hon. Friend asked about finance. As I said, there are no formal proposals on the table. There is an ongoing negotiation at EU level in which there are many different moving parts. My right hon. Friend the Prime Minister will make a statement after the European Council next week, but the refugee facility agreed last year is budgeted for and is causing the Commission to reprioritise its various spending programmes, which seems a sensible thing for it to do.

The countries of the middle east and the European Union are now confronted by the biggest refugee crisis since the end of the second world war. In the past 12 months alone, more than 1 million people have entered the EU by sea, mostly from Turkey to Greece. Does the Minister agree that the only way to deal with the crisis is to work with our European neighbours and other countries affected in the region, including Turkey? We welcome the fact that European nations are working together to try to find a solution, rather than having a situation of individual countries trying to find individual solutions to what is clearly a collective challenge.

We must recognise that we all have a responsibility to ensure that the language that we use reflects the fact that we are talking about fellow human beings in the most difficult of circumstances. Does the Minister therefore agree that it was deeply irresponsible of the Prime Minister to refer to people who are frightened, tired and fearful—families, vulnerable women, children and old people—as a “bunch of migrants”?

Does the Minister agree that the only way to reduce the overall flow of refugees is to tackle its root cause: the slaughter of the Syrian civil war? It would therefore be helpful if he could give us his latest assessment of progress with the ceasefire. The EU and Turkey say that they have agreed the broad principles of a plan to ease the migration crisis. How many of the promised 20,000 Syrian refugees have we settled? What additional financial contribution will the UK be making? When does the Minister expect any additional payments to be made? Can he set out how that money will break the business model of the smugglers exploiting the most vulnerable in the most dangerous way? How will we ensure that the money will be spent on what it was intended to be spent on? Who is monitoring this, and how? With the threat of conflict and climate change across the world, does the Minister agree that this shows exactly why we need to work together internationally, including by being a member of the EU, rather than walking away from our shared interests and responsibilities?

I agree with the hon. Lady that it is in this country’s interests, and in the interests of every European country, that we put together a determined and coherent response to the crisis. I also agree that no single European country—not Greece, Germany, the UK or anyone else—can solve this human tragedy, or stop the wicked work of the people traffickers who are exploiting it, on its own.

The hon. Lady asked about the ceasefire in Syria. The latest information indicates that it is holding, but it is not holding perfectly—that will be no surprise to any Member. The Prime Minister, along with other European leaders, had a conference call with President Putin a few days ago to take stock of how things now look, and to urge him to work towards a political settlement and a political transition in Syria, which we continue to believe represents the long-term answer to try to rebuild that country and to give people hope that they can have a safe and secure life there.

The hon. Lady asked how the business model of the people traffickers would be harmed by the agreement reached last week. One key element of the deal—I emphasise again that it is yet to be finalised—would be that somebody who went in a boat and was intercepted or processed having reached one of the Greek islands would face being sent back to Turkey. They would then be put to the back of the queue for legal resettlement, so the incentive for people to entrust their safety to the people carriers would be removed.

The hon. Lady asked about the number of arrivals in this country under the Syrian refugee resettlement scheme. The number is now running at more than 1,000, so this is going on track and much as we had planned. I ought to recognise the role that the devolved Administrations and local authorities of all political colours have played in trying to make the scheme successful, and in making the process as easy as possible for the people whom we are trying to help.

My right hon. Friend correctly says that there is no obligation on the United Kingdom to take in extra migrants under the deal, but will he confirm that, once any of the 1 million migrants who have come to Europe in the past year and the 1 million who are expected are given EU citizenship, they will all technically have a right to come to the United Kingdom, as long as we remain in the European Union?

The fact that we are outside Schengen means that we impose border checks on everybody, including EU citizens. We stop and turn back EU citizens when we have good reason for thinking that their presence in the United Kingdom would be a threat to public safety.

On my right hon. Friend’s specific point, the overwhelming majority of those who have been granted refugee status in Europe have been granted that in Germany, which is where people are trying to get to. The proportion of all refugees in Germany who get German citizenship is roughly 2.2%, and the numbers are small because the German citizenship procedure is so rigorous. It takes eight to 10 years before somebody can get German citizenship. To achieve that, they need to have a completely clean criminal record, to show that they have an independent source of income and to pass an integration test, including by demonstrating a knowledge of German. Some of the fears that have been expressed are rather exaggerated, given the reality of the German situation.

SNP Members share the deep concerns expressed by the United Nations that the proposals would contravene refugees’ right to protection under European and international law. Vincent Cochetel, the United Nations High Commissioner for Refugees Europe regional director, said yesterday that an agreement on this basis would not be consistent with either European or international law. With that in mind, what legal advice has the Minister received on the proposals from his officials? Will he set out how the Government will promote accountability and transparency around the €3 billion that is due to be given to Turkey by the end of March? Finally, what action have the Government taken within the process to promote human rights in Turkey and to hold Erdogan to account for his recent actions against his own citizens?

On the hon. Lady’s final point, we speak all the time to Turkish colleagues about human rights and rule of law matters. As I have said, we believe that the EU accession process—particularly chapters 23 and 24, if they can be opened—provides the best means for seeking those reforms in Turkey, which I think would command support on both sides of the House.

The statement of the Heads of State or Government says in terms that all those arrangements must comply with international law, so every Government have taken that on board. We should not forget that Turkey has provided refuge to about 2.6 million people who have fled from Syria. A large number of those people have been living in safety in UN-administered camps inside Turkey for many months, and sometimes for years. Please let us not forget to acknowledge the hospitality that not just the Turkish Government, but the ordinary people of Turkey, have shown.

The opening of chapter 23 negotiations simply serves to confirm that the EU has indeed agreed to accelerate the process of considering Turkey’s application for accession to the EU. Does my right hon. Friend consider it right even to enter such negotiations when Turkey’s human rights record is extremely worrying, not least in respect of its Kurdish population?

We certainly hope that the Turkish Government will resume as soon as possible the peace process with the Turkish Kurds, which appeared to be making quite some progress up to perhaps six months ago. On my right hon. Friend’s other point, as I have said, there has been no agreement yet as to whether any particular chapter or any number of chapters of the accession negotiations should be opened. The Heads of Government will return to that next week at the European Council. There would have to be unanimous agreement by every EU member state to each and every decision to open a new chapter, or to agree that progress had been made on any element of a new stage in Turkish accession negotiations. This is not a swift process.

Under the deal, Turkey has received €3 billion, and it has asked for a further €3 billion by the end of 2018. When will those negotiations start? Given that 90% of those entering the EU illegally do so with the assistance of criminal gangs, why have the Minister and the EU not ensured that Turkey will be paid on a performance-related basis for the number of people traffickers it brings to justice?

People traffickers need to be brought to justice in whichever jurisdiction they operate, but it is sometimes the case that the people committing the crimes involved in trafficking at the sharp end and organising the boats are not the people at the top of those organisations. As the right hon. Gentleman knows, we are talking about very professional, well-organised and well-funded international criminal networks that often indulge in drug smuggling as well as in people smuggling. They are transnational companies that are engaged in criminal enterprise.

There has been no agreement yet on anything beyond the €3 billion refugee facility that was agreed in November last year. Since that agreement, Turkey has taken a number of steps to help Syrian refugees, such as by making it possible for them to get legitimate work within Turkey and opening up work permit arrangements for them.

All hon. Members will have heard very disturbing reports recently of a newspaper office in Turkey being closed down for doing nothing more than publishing critical commentary about the Turkish Government. Will the Minister please inform the House whether the member states of the European Union value ever closer union and freedom of movement over and above the rights to freedom of speech of the individual?

The EU and the United Kingdom Government made it very clear last week that we continue to see freedom of the press and freedom of expression in the media as a cornerstone of the values that we champion at an international level. Adherence to those principles is written into the European treaties, and no country that fails to subscribe to them can expect to receive EU membership.

The principle of closing off the dangerous smuggler routes and instead providing safe legal routes to sanctuary is clearly sensible, but the Minister will know of the legal, practical and political problems with the plans put forward. He rightly makes it clear that there will be no changes to Turkish visa arrangements for Britain, but I suspect that in many others areas of the proposals there will be significant changes in the week ahead. In particular, have the British Government raised the plight of Afghan and Iraqi refugees? We know that about half the lone children who claimed asylum in Europe in January were from Afghanistan. What provision will be made for them?

The right hon. Lady makes a reasonable point, and the position of people who have come from other war-torn countries needs to be seriously considered, but we need always to bear in mind the basic principles of the 1951 UN convention on refugees: first, that to get refugee status one must demonstrate a well-founded fear of persecution; and secondly, that when somebody flees they are expected to apply for refugee status in the first safe country they reach, and not try to pick and choose, perhaps at the behest of people traffickers, between various safe countries.

May I press my right hon. Friend further on the human rights and rule of law abuses in Turkey? Last year Lord Woolf, the former Lord Chief Justice; Sir Jeffrey Jowell, the international jurist; Sarah Palin, the human rights barrister, and I wrote a report—I provided a copy to him, the Foreign Secretary, the Prime Minister and the shadow Foreign Secretary—outlining the serial and appalling human rights and rule of law abuses by the current Turkish Government. Will the Minister alter or firm up the Government’s attitude towards Turkish accession to the EU? While these abuses continue, there should be no question of opening any chapters at all, even though we need Turkey as a member of NATO and its agreement to help with the migration problem.

We certainly continue to regard adherence to the principles of human rights, freedom of expression and belief and so on as things that should be at the heart of the reform work of any country seeking to join the EU. I put it to my right hon. and learned Friend, however, that the evidence from other accession negotiations is that we can secure much swifter and more significant progress towards the reforms we all want to see when we sit down and start working on the detailed benchmarks and progress measurements in those chapters of an EU accession that deal specifically with rule of law matters.

The amount of money the EU gives to Turkey is fully justified—I hope that more will come—for the reasons the Minister has explained, but will he accept, following on from previous questions, that the President of Turkey has done his best to undermine democratic rights in that country? We have seen the outright intimidation of critics; last week, a newspaper was taken over by his henchmen and turned into a mouthpiece for the regime; and more recently, the same thing happened to a news agency. Does he realise that there can be no question of Turkey becoming in any way associated with the EU while this intimidation of critics continues and so long as the President does a good impression of trying to follow Putin?

As I have said before, we continue to talk frequently to Turkish officials and Ministers at all levels about the importance we ascribe to human rights, the rule of law and freedom of expression, and that will remain a core element of our dialogue with Turkey.

Further to the question from the hon. Member for Ochil and South Perthshire (Ms Ahmed-Sheikh), I am not clear on the Government’s position on the legality of the mass transfer of intercepted migrants back to Turkey. What instructions are being given to the captain of Royal Fleet Auxiliary Mounts Bay for when it intercepts a boatload of migrants? Has the captain been authorised to take those people back to Turkey? Will they be accepted back into Turkey? How does that fit with the comments from the UNHCR last night?

I am not sure whether my hon. Friend was in the House for the statement that my right hon. Friend the Secretary of State for Defence made on Monday about the naval operation. The NATO operation is engaged in initial reconnaissance and surveillance of illegal crossings. It then passes that information on to the Turkish authorities so that the Turkish coastguard can respond and carry out interceptions. At the moment, that work is not being done by NATO vessels.

Anyone watching the refugee scenes across Europe over the past year knew that we could not carry on as we were and that we needed to act in concert with others, in terms of both the consequences and the causes, which are rooted in war and conflict. I agree with the Minister, therefore, that no individual country can deal with the consequences alone. May I urge him to reject any approach that says Britain’s answer should be to pay nothing, do nothing and pull up the drawbridge?

This country has a long and proud tradition of seeking to help people in dire need, wherever they are in the world, and build political stability in areas within what I might describe as our own neighbourhood. There have been plenty of examples in our history and European history where the failure to grip problems decisively led to worse conflict, human suffering and political problems for European Government than would have been the case had action been taken earlier.

May I press my right hon. Friend further on the legality of the deal? As I understand it, the UN’s top official on refugees, Filippo Grandi, has expressed real concern about an arrangement that involves a blanket return of anyone from one country to another. I am particularly concerned because it looks as if the EU is trading one set of refugees in Greece for another in Turkey. I cannot see any guarantee in the arrangement that there will be any drop-off in numbers. In fact, I am beginning to find the arrangement very worrying.

As I said earlier, under this agreement, if it can be finalised next week, we will for the first time break the link between people getting into a boat or being rescued from a boat in the Aegean and their gaining the right to enter a resettlement or relocation process inside the EU. Instead, there will be an agreed legal route for people to go from the camps to European countries. That will provide a serious disincentive for people to place themselves in the ruthless and exploitative hands of the people traffickers.

On the matter of legality, the statement of the Heads of State or Government says in terms that whatever arrangement they might reach next week should be in accordance with both European and international law.

I wish to associate the Liberal Democrats with the comments on free speech and also with those we have just heard about the very troubling one-for-one refugee agreement, which raises both practical and moral concerns. The Minister is a very honourable man; surely he cannot be comfortable with an agreement that requires refugees to risk their lives travelling to the EU in return for another refugee, but only one from Syria, to get safe passage. That is entirely unacceptable.

The purpose is to put in place a set of arrangements that remove the incentives for people to entrust their safety to the people traffickers. Unless we are able to do that, the risk is exactly that the flow of people and the appalling casualties that result from that flow of people across the Aegean will continue.

As always, the Minister is putting in a very skilful performance, but the issue of whether Turkey should join the EU is terribly important. I am disappointed that once again the Foreign Secretary is not replying from the Dispatch Box. I do not think he has answered one urgent question of the last five. We like the Foreign Secretary so much that we would like to see more of him at the Dispatch Box.

On the question of Turkey joining the EU, the Minister has been absolutely clear today that it is Her Majesty’s Government’s considered opinion that Turkey should be a member of the EU. Apparently, we have allowed ourselves to be blackmailed into progressing this matter. Given the closure of the main opposition paper, Zaman, this week, will the Minister confirm as a matter of fact that because the EU believes so passionately in the free movement of people, once Turkey joins the EU, all 77 million Turks will be allowed to come to work and live here without any check or any opposition at all and there is nothing we can do about it?

As I said earlier, we are not yet at the point where anything has been finally agreed. My right hon. Friend the Prime Minister will make a statement after next week’s European Council. Support for Turkey eventually to join the European Union is an objective that has been shared by Conservative and Labour Governments alike since before I entered the House of Commons. My hon. Friend is not correct to say that this is going to be rushed. That is certainly not the history of previous accession negotiations: they take many years, and there is a right of veto for every member state over every single decision associated with an accession process.

One issue that has to be sorted out during an accession negotiation is precisely what the arrangements for movement of people are going to be. As the Prime Minister has said on many occasions, the United Kingdom is not going to agree to any further new members of the European Union until we have new and different arrangements in place to ensure that a new member joining the EU cannot again lead to the very large migratory flows that we saw after 2004.

Turkey has indicated that it needs £6 billion to help address the problem of refugees, but it is much better to address the refugee crisis where it begins—and one of those places is Turkey. Will the Minister tell us what discussions he has had with the Turkish Government to ensure that the moneys allocated are sent to the places that need it most and to ensure that those of ethnic or Christian beliefs are able to receive them as well?

The money assigned in our bilateral spending and at EU level is going to people in need in Turkey and the surrounding states. There is a separate facility to give humanitarian support to refugees and asylum seekers in Greece, but the large sums of money I have talked about so far are being spent in Turkey. The answer to the hon. Gentleman’s question is that both the United Kingdom and the European Union disburse that money largely through the United Nations relief agencies such as UNICEF and through the major reputable non-governmental humanitarian relief organisations, precisely so it can go to help those in need and that we can know exactly where it is going.

Those of us who are in favour of leaving the European Union are being pressed regularly on the need to provide certainty about what the world will look like outside, yet today the Minister’s speech has been full of caveats, maybes and what may or may not happen. Does he now accept that this is what “in” looks like for those of us who are concerned about human rights issues, freedom of speech issues and other things that would come with Turkish accession, that there can be no certainty about the fear factor of staying in, and that it certainly is not safer to stay in rather than to leave?

The reason why, as my hon. Friend put it, I am “caveating” some of what I am saying is that although there was a negotiation at the summit on Monday, there has not yet been a final agreement. An effort is going to be made to reach a final agreement next week, and then my hon. Friend will be able to question the Prime Minister about the detail. I simply say to my hon. Friend—she and I differ on the question of EU membership—that the habit of working together within Europe to solve foreign policy challenges that cannot be met by any one European country on its own, not even the biggest and most influential, is a sign of health and a good reason for us to remain members of that organisation.

Turkey, of course, has a pivotal position in all this. If it wanted to, it could make the moves to ensure that we have safe havens in Syria and stop a lot of people entering Europe that way. Equally, it has a very important role in stopping people traffickers. Have the British Government seen actual plans by the Turkish Government on how they intend to stop the people traffickers and stop people travelling across to Greece?

Talks are going on between our enforcement agencies, Frontex and Europol at European level and their Turkish counterparts. The hon. Gentleman will, I know, understand why I would not want to go into detail about those talks. The possibility of safe havens was discussed at the EU-Turkish summit, but there are many political, legal and military complications to taking that particular step. We have not ruled it out, but there is no agreement on it as yet.

Surely the most important thing in all this is to deal with the problem at source—namely, Syria. What discussions were had at this summit with the Turks and the EU about how to put more pressure on all the parties at the Geneva process to make sure that we have a lasting peace agreement in Syria?

Those discussions did take place in the margins of the summit, although its purpose was to try to hammer out a way forward in dealing with the refugee crisis that is causing such difficulties both to Turkey and the European Union. I can assure my hon. Friend that the British Government and other European Governments are in constant contact with our Turkish counterparts about how best to bring an end to the appalling conflict inside Syria.

The Minister must recognise that an adequate humanitarian response must involve more than simply asking Turkey to facilitate mass expulsion under almost a barter scheme between different classes of refugees. Will next week’s European Council meeting properly address the concerns about whether this scheme violates international law and human rights?

This agreement relates to a wider issue of underfunding of refugee camps across the middle east by the international community. What are the Government going to do to reinforce the message from the United Nations that many of our international partners—not the UK; we have done our fair share—are not stepping up to the plate when it comes to the funding of these refugee camps, and that includes many countries within the EU?

My hon. Friend makes a very fair point. I think we can trace the surge from Turkey into Europe last summer in large part to the decision that the United Nations had to make to cut food rations and restrict educational opportunities inside the camps, which led more people to feel that they had no option but to place themselves in hands of people traffickers. As I think my hon. Friend will know, the United Kingdom co-hosted a Syria donors conference in London a few weeks ago, which produced pledges from the international community of more than $10 billion. That is a welcome step forward, but I would be the first to say that we must now ensure that those pledges are turned into real money to help the people who are in desperate need.

I absolutely agree that Turkey is a crucial partner in the efforts to resolve the situation in Syria, and that we should be doing more to support what it is doing to deal with the migrant crisis. I must tell the Minister, however, that the largest number of UK citizens of Turkish origin live in north London and in Enfield in particular, the vast majority being Kurdish and/or Alevi, and that they are very concerned about President Erdogan’s refusal to acknowledge the decisions of the constitutional court, about the closing of newspapers, about the imprisonment of more than 30 journalists, about the curfews, about the restrictions on freedom of speech, and about the deaths of many innocent people who are their friends and relatives.

The EU and the accession process may well be the context in which those issues can be resolved—and I support the accession process in relation to Turkey—but can the Minister assure me that they will be raised with President Erdogan, and will not be brushed aside?

The UK raises concerns such as those in its dialogue with the Turkish Government at every level. We recognise that Turkey is in a better place today than it was under military rule, but we want to see our Turkish ally move with greater energy towards the full recognition of the rule of law and human rights to which its Government say they remain committed.

First, let me reiterate again that, as yet, there has been no deal. That is a matter for the discussions between now and next week’s European Council meeting.

I am sure that my hon. Friend has studied the European Union treaties intensely, in which case he will know that a measure affecting visas or migration must be introduced on a treaty base on which the United Kingdom is not bound, but can choose whether or not to opt in. As the Prime Minister has made very clear, we are not going to participate in visa liberalisation with Turkey. That is a sovereign decision for us to make, and one that is recognised in the European treaties.

I think most reasonable people would support a mechanism that cuts off the people-trafficking routes and the dangerous routes across the Mediterranean, but what assessment will the Government make when this mechanism is in place to ensure that it is operating as the Minister envisages and that the money reaches the people whom we want it to reach—the refugees?

I share the concern expressed by the right hon. Member for Enfield North (Joan Ryan) about the increasingly illiberal and authoritarian approach of Erdogan to, in particular, minorities such as Alevi Kurds, but we must also pay credit where it is due. The refugees are imposing a great burden on Turkey, and its camps are of a much better standard than those in any part of Europe, not least France.

May I ask the Minister a question about the European Union’s move on the liberalisation of visas and the opening of chapters? Will he confirm that, in the negotiations, the European Union will not renege on its commitment to ensure that no progress is made on those two matters before the republic of Cyprus has been recognised, and progress has been made towards a solution to the Cyprus problem?

My hon. Friend hints at one of the issues that have caused a stalling of the accession negotiations in recent years. Is not the logic of the proposals that if Turkey succeeds in stopping sea crossings, no refugees will be resettled from Turkey? Is that not a greater incentive than ever for Turkey to wave people on to the boats, and is it not clearer than ever that a better solution is to provide more safe, legal routes?

That is not the nature of the discussion that we are having with Turkey. I do not want to be unkind to the hon. Gentleman, but I think it is slightly simplistic to imagine that Turkey can just switch the taps on or off when it comes to flows of people and the activities of people traffickers. That applies particularly to the sea crossing to the island of Samos. Only 1,600 metres separate the Turkish and Greek coasts at that point, so once a dinghy has travelled 800 metres it is in Greek territorial waters. However, I think on Monday there was a clear commitment by both the Prime Minister of Turkey and EU leaders to finding a way forward, and a recognition that it was in the interests of both EU countries and Turkey for the issue to be settled through a coherent, well-planned strategy such as the one that is outlined in the statement issued by the Heads of Government.

Is not the Syrian issue one of the biggest problems that we face today? Has not the Russian action in Syria produced a large new wave of refugees who are leaving that war zone and being pushed into Turkey, and does that not mean that we must do all that we can to work with Turkey?

On 7 March, my right hon. Friend sent a letter to the European Scrutiny Committee, of which I am a member, emphasising that a great deal of the money that we are putting in is counting towards our international aid target of 0.7% of GDP. Everything that has been said today about Turkey’s human rights record and about the question of its entering the EU is absolutely right, but does my right hon. Friend not agree that, in the context of both those issues, we have more power and more influence in the EU than we would have if we were outside the EU and carping about it?

We really do have an excellent Minister for Europe. He has been in post for a record number of years and he has always implemented Government policy on Europe, however much it has changed. I hope that he will be there after 23 June when we negotiate our exit from the EU. I want to ask him a question about certainty. Does he agree that the only way in which the British people can be certain that 77 million Turkish citizens will not have the right to come to this country is if we vote to come out of the European Union?

No, no. I am afraid I must urge my hon. Friend to intensify his study of the European treaties and, particularly, the European directives. The treaties make it quite clear that each and every aspect of an accession negotiation, including arrangements for controls on migration, must be agreed unanimously. Every member state, including the United Kingdom, has a veto on every aspect of an accession negotiation. He is making a mistake in imagining that things will happen in the way he describes.

Will the Minister confirm that the majority of those coming into Europe from Turkey are men, and that the majority of them are coming from countries other than Syria that have a very poor human rights record in regard to women? How can we be certain that the mass migration into Europe will not have an impact on women’s rights, which have been hard fought for on this continent?

We have a genuine humanitarian crisis in Syria that has displaced about 11 million people, either within Syria or to neighbouring countries. That is now being exploited by people traffickers—on that point, my hon. Friend is correct. They are trying to encourage people of other nationalities to come in and claim refugee status on the back of genuine refugee claims and genuine refugee need. That reinforces the importance of having a robust system of processing individual claims, so that we can distinguish between people who have a well-founded fear of persecution and those who are trying to move for economic reasons. The reason that the United Kingdom is giving help to Frontex and the European Asylum Support Office is precisely to strengthen the capacity of the Greek system in particular to carry out those processes and to distinguish between genuine refugees and those who are trying to move for other reasons.

It is on everyone’s mind that the bombing of civilians by the Assad regime with Russian support in areas such as Aleppo is leading to the movement of even greater numbers of people, initially into Turkey and Lebanon and then across the Aegean towards Europe. That reinforces the need for us to turn this fragile cessation of violence into a genuine peace process inside Syria and a political transition that might offer the hope of rebuilding the country.

I have been reading the statement, and the Turks clearly have some good negotiators. The Minister has already stated that our financial contribution to the first €3 billion will be €250 million. The statement says that there will be a further decision on additional funding. Will he confirm that, whatever that additional funding might be, we will still be making a further contribution to it?

No formal proposal has been tabled as yet. The United Kingdom contributes to EU measures agreed collectively by the EU, but we have also paid out significantly more through our bilateral contributions to meet the needs of refugees in Syria and other countries in the neighbourhood. I do not think we should be in the least ashamed of this country’s role in helping those people in desperate need. One of the reasons I have been so proud to support this Government’s commitment to the 0.7% UN target is that it gives us the resources and the flexibility to respond to humanitarian crises speedily, wherever in the world they happen to be.

Am I right in assuming that the captain of Royal Fleet Auxiliary Mounts Bay has rules of interdiction that allow him to report people-smugglers’ vessels going across the straits between Turkey and Greece and to pick up people in distress, but not to stop any such vessels that do not wish to be picked up? If so, will the Minister tell us why that is the case? More to the point, if those rules pertain, what action are the Turkish security forces taking on the eastern seaboard of Turkey, which we are subsidising, to stop people-smugglers’ vessels setting out towards Greece?

Turkey already assigns a large proportion of its coastguard resource to the Aegean. For the reasons that I gave in answer to an earlier question, intercepting every small boat making the relatively short crossing to one of the Greek islands is not as straightforward as is sometimes suggested. For greater detail, I refer my hon. Friend to the statement that the Secretary of State for Defence made in the House on Monday, in which he said:

“The primary purpose of the mission is to provide monitoring, surveillance and reconnaissance of the migration route across the Aegean, which will better enable the Turkish and Greek coastguards”—

and the EU Frontex mission—

“to intercept the boats and disrupt the business model of the criminal traffickers.”—[Official Report, 7 March 2016; Vol. 607, c. 27.]

I was interested to hear the Minister confirm that Britain would not be required to be part of the visa waiver arrangements, given that we are not part of Schengen. However, we are part of another common travel area, with the Republic of Ireland. What discussions will the Government be having with the Republic of Ireland’s Government about their approach to these issues?

My hon. Friend makes a reasonable and important point. Like the United Kingdom, Ireland is not in Schengen and therefore not obliged to participate in any visa liberalisation. We keep in close contact with the authorities in Dublin, because the existence of the common travel area means that we need to ensure that we take account of each other’s decisions on this matter. I do not anticipate any difficulties in this regard—we normally think pretty much alike—but my hon. Friend is right to register that this is an issue that we need to keep in mind.

Thank you, Madam Deputy Speaker. Does my right hon. Friend appreciate that access to visa-free travel across Schengen for Turkish citizens might well lead to a large new influx of illegal immigration into Europe that could cause misery across the continent?

No, I do not think that there is necessarily a connection between illegal migration and the movement of people legally under some kind of visa waiver system. The reassurance that I can give my hon. Friend is that, because the United Kingdom is outside Schengen, we can, do, and will continue to impose whatever visa requirements and whatever checks on migration at our ports we consider to be right for the safety, security and wellbeing of the people of the United Kingdom.

In November 2015, the EU committed to provide €3 billion of resources over 2016 and 2017 for Turkey under the EU-Turkey Action Plan. In return Turkey committed to enhance its support for Syrians under temporary protection in Turkey and to strengthen co-operation with the EU on preventing irregular migration flows to Europe.

Final arrangements for the €3 billion Turkey refugee facility have been agreed by all EU member states. The €3 billion Turkey refugee facility will be funded by €1 billion from the EU budget and €2 billion bilateral contributions from member states. Member states’ bilateral contributions are calculated according to their Gross National Income (GNI) share. The UK’s bilateral contribution will be €327 million (around £250 million). It will be official development assistance (ODA) expenditure and count towards the UK’s ODA target of 0.7% of GNI.

Member states have secured a strong role in the governance of the facility and disbursals will be tied to Turkish efforts to implement the EU-Turkey Action Plan. The €3 billion Turkey refugee facility will provide immediate humanitarian support and is expected also to fund the schools, hospitals and housing required over the longer term to support refugees and the communities in Turkey which host them.

I thank my hon. Friend the Member for Reigate (Crispin Blunt) and the members of the Foreign Affairs Committee for bringing their report to the debate this afternoon.

From both sides of the House, there was a common theme: the importance of an effective diplomatic service and Foreign Office in advancing and defending the interests of the United Kingdom in the face of multiple challenges in different parts of the world. I thank in particular those hon. Members who paid tribute to the work of individual members of Her Majesty’s diplomatic service. That gives me the opportunity not only to thank those individuals myself, but to put on the record my own thanks and those of the ministerial team for the professionalism and commitment that members of the diplomatic service have shown to us, as they have to previous Governments. They continue to work day in, day out on behalf of the people of this country.

I want to move on to the spending review and the settlement for the FCO, but I cannot quite let the remarks of the hon. Member for Hornsey and Wood Green (Catherine West) go without comment. I completely understand that it is the job of an Opposition spokesman to try to find criticisms to make of the Government—I remember doing that myself some years back—but the degree of amnesia that infected her judgment on this occasion was astounding. It was as if the years from 1997 to 2010 had been airbrushed out of the historical record.

It is worth reminding the House that under the Governments of Tony Blair and Gordon Brown, the Foreign Office’s budget was cut, posts were closed, the language school was axed altogether, the library was scrapped, and we got to the craziest situation of all. After the Treasury had removed the traditional protection arrangement that it had offered against the Foreign Office’s exposure to foreign exchange movements, as a result of the payment of salaries and bills by overseas posts, the hon. Lady’s former colleague, Mr David Miliband, was reduced to having to draft in members of the diplomatic service to establish a hedge fund unit inside the Foreign Office so that the Foreign Office could try and run a hedging operation of its own. I do not want to hear too many lectures from the Labour party about Foreign Office expenditure and sensible budgeting.

The Foreign Affairs Committee and the House as a whole are entitled to ensure that the Government are held properly to account for delivery of their responsibilities in the field of foreign and security affairs. My hon. Friend the Member for Reigate and, I think, the hon. Member for Glasgow North (Patrick Grady) asked about two or three specific items in the estimates. I am going to have to write to them about two of those, but I can give them some satisfaction on the question of the battle of New Orleans, because I have been passed some additional advice. The purpose of the occasion was to commemorate the British dead in that battle and celebrate the 200 years of peace that have followed between the United Kingdom and the United States. The Foreign Office has contributed $215,000; other contributors have included the state of Louisiana and Boeing, and there has also been a significant personal contribution from our honorary consul in New Orleans.

While my right hon. Friend is on that issue, can we see how adroit he and his team are? Will he explain what the Foxhound Project is? Is this a welcome addition to the leisure activities of Her Majesty’s Government, or is it expenditure in respect of something else?

If my hon. Friend is expecting to reopen the debate on field sports, I will definitely disappoint him. That is one of the subjects on which I will write to him and the hon. Member for Glasgow North.

The Foreign Affairs Committee report, published on 20 October last year, came before the publication of the spending review, the national security strategy and the new development strategy in November last year. The report was important, because it contributed to an extremely vigorous public debate about the importance of continuing to invest in our diplomatic resources.

As a number of hon. Members noted, the Chancellor responded in his spending review. He noted in his statement in this place the crucial role of what he described as “our outstanding diplomatic service”, and he announced that the Government would protect the budget of the Foreign and Commonwealth Office in real terms. That is important because, as right hon. and hon. Members across the House have said, an effective and expert diplomatic service is an important element in allowing this country to respond to the international challenges that we face to our interests.

Now, there is no avoiding the fact that, despite that commitment to protect the FCO’s budget in real terms, my right hon. Friend the Foreign Secretary will still have difficult decisions to take about relative priorities in the Department, but that is no more than the challenge that would confront any Secretary of State. We would all like to feel that the budgets available to us were unlimited; in the real world, however, those budgets are finite, and they are constrained by the Government’s overall need to bring down the deficit and address this country’s long history of living beyond its means in terms of the public finances.

The Future FCO review, about which my hon. Friend the Member for Reigate asked me, is designed in part to find ways in which we can secure our objectives as a Department by doing things differently. I have talked briefly to the reviewer, who is also speaking to other Ministers and senior officials, and the purpose of the review is to advise Ministers and senior officials on how the FCO can be more expert, more agile and more focused on its key priorities than it is at the moment.

I expect the review to be in a position to set out its conclusions later this year—by the end of the spring, I hope. We intend there to be a clear vision of how the FCO should look by 2020, so that we can implement changes in the Department to enable us, within the priorities and resources we have, to secure our objectives more effectively and more efficiently than in the past. We also hope that the review will ensure that, where efficiencies can be made, the savings can be channelled straight back into serving the core objectives that the Foreign Secretary has set.

My hon. Friend asked about the spending review letter. The Government’s policy in respect of all Departments is not to publish settlement letters. There is plenty of public information in the spending review documentation and the Chancellor’s speech and answers. The letters are part of ongoing policy discussions, so it is not appropriate that they should be in the public domain at this time.

The overall resource departmental expenditure limit for the FCO will rise in line with inflation in each of the four years covered by the spending review, increasing our funding from £1.1 billion in 2015-16 to £1.24 billion by 2019-20. We believe that this settlement will enable the Department to maintain our world-class diplomatic service, including our network of posts around the world, which host not only the FCO but 32 other Government Departments and agencies. That global presence and continued foreign policy leadership in Whitehall by the FCO will serve to protect our national security, promote our prosperity and project the UK’s values overseas.

In line with the Government’s commitment to spend 0.7% of gross national income on development assistance, the FCO will be allocated additional ODA-eligible resources, more than doubling our spending from £273 million to £560 million in 2019-20. That will enable us to pursue our key foreign policies and to deliver the ambitions set out in the national security strategy and the development strategy.

The hon. Member for Ochil and South Perthshire (Ms Ahmed-Sheikh) asked, very reasonably, how we reconciled the priorities of different Departments and ensured that, as far as possible, they incorporated within an overall agreed Government approach. The answer, in part, is that there are frequent conversations between Ministers in the different Departments dealing with external affairs and between their officials. However, in the broadest sense, the strategic direction on the key elements of the United Kingdom’s external policy is set after discussion by the National Security Council, chaired by the Prime Minister. The NSC brings together the Prime Minister, the Foreign Secretary, the Chancellor, the International Development Secretary, the Defence Secretary and other interested Ministers precisely so that we can agree on an approach that harnesses the different skills of all Government Departments and, at the same time, establishes which Departments are to contribute which resources to that common objective.

The settlement includes increased spending to support the UK’s overseas territories. In order to meet our long-standing commitment to address their reasonable needs, the FCO will co-ordinate a new strategy for the overseas territories and chair a new director-level board to co-ordinate cross-Government activity. Furthermore, as announced by the Prime Minister during the Commonwealth Heads of Government meeting in Malta in November last year, the United Kingdom will host the next such Heads of Government gathering in 2018, and the FCO will co-ordinate that event.

The spending review settlement provides the same budget for Chevening scholarships as in 2015-16 of £46 million per year. Over its 32-year history, that scholarship scheme has built up a large and influential alumni network aligned with the interests of the United Kingdom, and this funding will ensure that that continues.

A number of hon. Members asked about language training and language skills. The FCO language centre was reopened in September 2013 to renew the focus on and investment in languages as a core diplomatic skill, and ensure that we get the right people with the right skills in the right jobs to deliver our objectives. As a priority, we will allocate new funds to improve Mandarin, Russian and Arabic language skills. In 2015, we trained 34 staff in Arabic, 14 in Mandarin and 24 in Russian, as well as 35 in French and 28 in Spanish. I completely accept that more needs to be done, but we are making progress, and there is a very clear commitment to continuing to develop language skills.

In addition, the Foreign and Commonwealth Office will spend up to £24 million over the next four years to increase the presence of its counter-terrorism and extremism experts overseas. In sum, our budget will allow us to focus on our key foreign policy objectives, including tackling Daesh and ensuring security in Europe. It will also allow us to do even more to prevent conflict and encourage stability in fragile states. My right hon. Friend the Foreign Secretary has made it clear that the Department will need to become leaner and build on its core strengths, and reinvest and refocus resources on new priorities. That is the reason for the review, about which I have already spoken, and it is also what lies behind the creation of a new digital transformation unit, the purpose of which is to ensure that FCO officials have access to the latest techniques for using modern technology in their work. After a year in operation, the diplomatic academy is already boosting both broader policy capability and specialist skills.

My hon. Friend the Member for Reigate (Crispin Blunt) asked about the tech overhaul programme. We are planning for its global deployment from 2016 to 2018, and a headline figure of £105 million has been agreed by the FCO board. We believe that the overhaul will provide greater speed, stability and reliability, and, partly by reducing the time currently lost because of inadequate IT systems, increase the productivity of staff members. We are using our IT partner, BAE Systems, to help deliver the tech overhaul to industry best practice standards.

A number of hon. Members asked about human rights. We have taken action to mainstream human rights across the FCO network. The issue remains a priority, but we believe that, rather than it being ring-fenced for a few specialist staff, it should be the responsibility of all British diplomats. More detail of our approach has been provided in our written evidence to the Foreign Affairs Committee’s human rights inquiry, to which my right hon. and noble Friend Baroness Anelay gave evidence on 24 February.

The Minister has mentioned mainstreaming the issue in the FCO, but, as I said earlier, there are 240 people working on human rights, versus 2,900 people working on prosperity. Does he expect that ratio to change significantly?

The difficulty with providing numbers is that we are talking about not only people who will be in post, but people in desk offices in London who will spend part of their time on human rights and other parts of it on prosperity and advancing British economic interest. I do not think there is a contradiction between the two. When I talk to British businesses about possible investment markets, they frequently tell me that when they assess investment opportunities in a particular country, one of the criteria they use is how good the rule of law is in that country. From a business point of view, they do not want to take the risk of putting money into a place and then finding that, because of corruption, their money, licence or permit is revoked at the behest of some political leader. This is not guaranteed, but a country with an effective rule of law of the kind that will attract inward investment is more likely to have genuinely independent courts and to respect the rights of individuals, so I think that the two go together.

In addition to its resource allocation, the FCO will be provided with a flat cash settlement of £98 million of capital funding per year, to invest in our estate. That will provide further investment across the estate, to maintain our global network and to keep diplomats and other Government staff safe while they work for the UK abroad. Additional capital requirements will be funded from asset sales and the recycling of receipts and, where necessary, through recourse to the reserve.

I have been asked about cross-Whitehall funds. I can confirm that the Government’s spending on international priorities will increase further, with a larger conflict, stability and security fund, a new prosperity fund and more funding for both the British Council and the BBC World Service. The CSSF, through which the FCO funds much of its conflict prevention work, will grow by 19% in real terms by 2019-20 to a total of £1.5 billion a year. That will strengthen our ability to support stabilisation in countries such as Syria, Ukraine, Somalia and Afghanistan, and it will strengthen our response to serious transnational threats, including extremism, serious and organised crime, and illegal migration.

In the conflict, security and stabilisation fund allocations for 2015-16, £400 million were allocated to countries eligible for official development assistance and £633 million to non-ODA countries. The new prosperity fund will be worth £1.3 billion over the next five years, and it will be used to support global growth, trade and stability. That will help us to reduce poverty in emerging and developing countries, and it will open up new markets and opportunities to the United Kingdom. Our diplomatic network helps to facilitate deals for trade and inward investment, to tackle barriers to our own businesses, and to promote open economies and a rules-based international system, which will benefit British business now and in the future.

Funding for the British Council will be protected in real terms, but there will need to be a shift in the balance between ODA and non-ODA funding to support an expansion of the council’s work in developing countries. In addition, the British Council will be able to bid for up to £700 million in additional funding to improve links with emerging economies, help to tackle extremism globally and support good governance.

I was asked about the Department’s human rights work through the Magna Carta fund, and about the balance between ODA and non-ODA countries. The Magna Carta fund has 47 priority countries, the overwhelming majority of which are ODA countries—developing countries. There are four non-ODA countries: Saudi Arabia, Bahrain, Russia and Israel. Those four, as well as being eligible for support from the Magna Carta fund, are eligible for funding streams such as the Arab partnership fund and the CSSF.

I think there has been agreement across the House that a strong diplomatic service and worldwide network are essential for this country to maintain its position in the world. I believe that the Government’s commitment to protect the Foreign and Commonwealth Office budget and provide additional funds for cross-government international activity will ensure that we are able to play a pivotal role, both bilaterally and through the membership of the many international and multilateral organisations of which we are part, in tackling the most important global challenges.

Without wanting to stray too far from the subject matter, I will simply say that I agreed completely with the point made by my hon. Friend the Member for Newbury (Richard Benyon) about how we can amplify the United Kingdom’s diplomatic reach through our active membership of the European Union. I am therefore confident that the outcome of the spending review is good not only for the Foreign and Commonwealth Office and British diplomacy, but, most importantly of all, for the interests of the people of the United Kingdom.

I beg to move,

That the draft European Union Referendum (Date of Referendum etc.) Regulations 2016, which were laid before this House on 22 February, be approved.

The statutory instrument before us does a simple, but critical job: it puts in place the necessary legislation to enable a referendum to be held on 23 June this year. It is the last piece of legislation that will be debated in this Chamber to make that vote possible. As such, it represents Parliament taking the final steps towards an historic moment when, for the first time in over 40 years, the British people will be given their say on the United Kingdom’s membership of the European Union.

My right hon. Friend the Prime Minister announced a few days ago his intention to hold the referendum on 23 June, and the Government believe that that strikes an appropriate balance, giving plenty of time for a vigorous and comprehensive debate. Ultimately, however, the date is a matter for Parliament to decide, and as set out in the European Union Referendum Act 2015, it is a decision that must be approved both here and in the House of Lords.

I am fascinated by my right hon. Friend’s reference to vigorous and open debate, because it is quite clear from the preceding urgent question and from many other matters that have come to light recently that the one thing that everybody needs—information—is the one thing that people are going to find themselves deprived of. If the voters do not have balanced, impartial and accurate information, what are they supposed to do?

My advice to any elector would be to look at what the Government are saying and advising, but also at what the various campaign groups and other organisations in this country are saying. I will come later to the designation of campaign organisations. We need this statutory instrument to be approved, among other things, to make it possible for the Electoral Commission to go ahead and designate the campaign groups on each side of the argument, and give them access to the privileges that come with that status, precisely so that they can go out and present their case and make information and argument available to the people to whom my hon. Friend refers.

On the contrary, my right hon. Friend the Prime Minister secured a deal that has brought some significant reforms to the European Union. I would advise my right hon. Friend to look at the reaction in many European capitals, in the media across Europe, and in the European Parliament, which has very largely been one of considerable surprise at the degree to which the Prime Minister of the United Kingdom was able to secure reforms. In some cases, that commentary involved a fair measure of criticism of other Government leaders for conceding what was believed to be too much.

I would be very happy to have a referendum as I have wanted one for years, but why did the Prime Minister ignore the views expressed in the letter from the leaders of the three Assemblies and Parliaments in the United Kingdom? Did that not show huge disrespect?

First, the letter was not ignored, and we certainly took account of the views of the devolved Administrations even though we decided in the end to disagree with their recommendation. I want to come to that point at a later stage in my remarks.

The date is just one element of the order, but clearly the most important, because the remaining elements largely flow from it. I will therefore explain the Government’s thinking on the date and then turn to the rest of the order. There must be enough time for a full, serious and considered debate that allows all the issues to have a full airing, and the campaigners must have enough time to put their case to the British people. On the other hand, although this may grieve some hon. Members, the campaign cannot continue indefinitely. The vote should be timely, while the issues are live and the details fresh—and we should also be wary of testing the public’s patience. Several prominent campaign groups are already active on both sides. Following the Prime Minister’s announcement on the outcome of the renegotiation, the debate on the referendum question will now begin in earnest and is already starting to gather real momentum.

The Government selected 23 June because we needed enough time for a proper airing of the issues, and we thought that any sooner would risk curtailing that debate, but to go any later would test the patience of the British people. School holidays in Scotland begin on 24 June, and from then people will be travelling and enjoying their summer. Later than 23 June would mean, in essence, waiting until after the summer holiday period had concluded in all parts of the United Kingdom and in Gibraltar. Frankly, I think that the British people would have found it very difficult to understand if we had asked them to wait seven or eight months after the conclusion of the renegotiation before they could have their say.

I have previously raised with my right hon. Friend the fact that a European Council meeting is also scheduled to take place on 23 June. What can we do to ensure that, if the leave campaign looks to be gaining momentum at a late stage, that will not be used to pretend that there are things on the meeting’s agenda to try to change people’s opinions, or that things will not be leaked in advance of that meeting to try to give people the impression that the Government have agreed a better deal than is actually the case?

I think my hon. Friend needs to study more carefully the words both of the document published at the end of the renegotiation and of a number of other European leaders. They could not have made it clearer, first, that they were not interested in a hypothetical further renegotiation in the event of a vote to leave, and secondly, that the very important safeguards that my right hon. Friend the Prime Minister secured during the renegotiation would lapse automatically in the event of such a vote. That is written into the document itself.

In practical terms, holding the vote on 23 June means 18 weeks between announcing the deal and the vote, and a full 10 weeks’ regulated referendum campaign period, with six weeks for the designation of lead campaigners, thus meeting the Electoral Commission recommendations. We envisage that the designation process will be commenced on 4 March and that the Electoral Commission will have to designate the two umbrella campaign groups by 14 April at the latest. The Electoral Commission supports the Government’s approach to the timing of the referendum. Last week it published its assessment of readiness and said that it was content that the date

“does not pose a significant risk to a well-run referendum”.

It is true, as the hon. Member for Vauxhall (Kate Hoey) has said, that there are still some concerns about the date, particularly among Members of the three devolved Administrations and right hon. and hon. Members in this place who represent those three parts of the United Kingdom. In particular, the right hon. Member for Gordon (Alex Salmond) expressed concern during Foreign Office questions about the possible interaction with the elections in Scotland, Wales and Northern Ireland on 5 May, which is also the date for various local and mayoral elections in different parts of the United Kingdom.

I think that those fears are misplaced, not least because multiple elections are already being held on 5 May. I really do not understand why a referendum that will take place a full seven weeks after the date of the devolved parliamentary and Assembly elections should be regarded as disrespectful. By contrast, I would argue that we are treating voters with respect when we assume that they should be perfectly capable of distinguishing between two different campaigns that will be nearly two months apart.

The Minister has just confirmed that the official campaign will launch bang in the middle of the devolved Administrations’ campaigns. It is quite an achievement to get Sinn Féin, the Ulster Unionists, the Scottish National party, Plaid Cymru and the Labour party in Wales to agree on anything. Why is he not taking seriously the concerns expressed by all those parties?

For the reasons I have given, I think that to have left the referendum until autumn, which was the next window available had we ruled out 23 June, would have tested the patience of the British people for the duration of the campaign. The campaign has already got under way. What will start in the period described by the hon. Gentleman is the regulated campaign period, during which special rules on campaign expenditure apply.

Will the Minister take some reassurance from the fact that in the canvassing that I have been doing for Caroline Pidgeon, the Liberal Democrat London mayoral candidate, I have found that voters have no difficulty whatsoever in understanding that there will be elections for the London Mayor and the London Assembly, and that the European referendum will take place a few weeks later?

The right hon. Gentleman puts the case very well. Others have said that June is simply too soon, and I do not agree. Traditionally, in our history, a general election has been held with only six weeks’ notice. Only since the implementation of the Fixed Term Parliaments Act 2011 under the coalition Government have we moved away from that practice. The referendum has had a much longer gestation period. The intention to hold a referendum before the end of 2017 was announced in the Prime Minister’s Bloomberg speech in January 2013, and it was reaffirmed at the general election last May, and again when the European Union Referendum Act received Royal Assent in December 2015. The intended date was announced four months in advance. The referendum has been a long time coming.

The Scottish independence referendum was held in September, and, if anything, the campaign benefited from the fact that people could campaign during the warm summer months with extended daylight hours. What advice does the Minister give to the devolved Administrations, who will no sooner have come out of a pre-election purdah period than they will have to go into a pre-referendum purdah period, just as they start implementing the manifestos they were elected on?

Of course, the purdah rules vary depending on the nature of the election concerned. The purdah rules for devolved elections limit what Government agencies can say and do in respect of devolved matters. We are talking about the question whether the United Kingdom should be in or out of the European Union, and that is, without any doubt whatsoever, a reserved competence in respect of all three devolution settlements.

The Minister is trying manfully but, dare I say it, completely unsuccessfully to explain what consideration the Government have given to the strong representations they have had from the elected Governments of 75% of the equal partners in this Union. I appreciate that he does not have time to do so now, but will he undertake to make sure that full details of the Government’s consideration of that letter are placed in the Library of the House as soon as possible after the debate?

We took account of that letter. We also took careful account of the specific request from the official foreign affairs spokesman of the Scottish National party, the right hon. Member for Gordon, during Foreign Office questions on 12 January for an assurance that the date of the referendum would be

“at least six weeks after the date of the Scottish, Welsh and Northern Irish elections”.—[Official Report, 12 January 2016; Vol. 604, c. 683.]

That request made by the right hon. Gentleman—I presume on behalf of his party, for which he was speaking at Foreign Office questions—has been met, and has been met in full.

The Electoral Commission has confirmed that it is content with the Government’s proposals and has said that, in its view, arrangements for a well-run referendum are now well advanced. The statutory instrument has been considered by both the Joint Committee on Statutory Instruments and the Secondary Legislation Scrutiny Committee. Both have considered the statutory instrument, and neither found any cause for concern.

I turn now to the other aspects of the regulations. They are very much in line with the framework set up by the European Union Referendum Act 2015, so I shall be brief. As well as setting the date, the regulations do three things. First, they set the start date for the designation process. That is the process by which the Electoral Commission appoints lead campaigners on one or both sides. We have followed the Political Parties, Elections and Referendums Act 2000 and allowed a full six weeks. That will give campaigners a four-week window to finalise and submit their applications, after which the Electoral Commission will have up to two weeks to decide which, if any, applicants to designate as the lead for each side. Let me be absolutely clear, to avoid misunderstanding. The regulations do not tell the Electoral Commission how to make its decision. That decision is entirely impartial, and the test the Electoral Commission must apply when making its decision is set out in the Political Parties, Elections and Referendums Act, as modified by the European Union Referendum Act. All the regulations do is set the start of the process as 4 March, while the rest of the timetable, finishing on 14 April at the latest, was set by the 2000 Act.

Will the Minister give us some indication of whether the Electoral Commission’s designation process is open to challenge, and if so, of how that challenge would operate?

Any executive decision by any public authority might be at risk of judicial review, but criteria for the Electoral Commission are set out in PPERA and they will guide the commission in making its assessment. I am sure that the commission will want to explain its verdict when it is published. There would have to be a pretty overwhelming case for a judicial review application for it to succeed, but such an option is available.

The Electoral Commission’s initial guidance for campaigners on this issue was updated on 5 February, so potential applicants have had plenty of notice. The commission has also now published the application form online. I remind the House that the lead campaigners, once designated, will receive a number of benefits, including a higher spending limit of up to £7 million, a free delivery of mailings to every household or every elector and, assuming that campaigners are designated on both sides, access to a grant of up to £600,000 and access to a broadcast.

The second additional element in the regulations is the referendum period—namely, when full financial and campaigning controls apply and, in particular, when spending limits are imposed on campaigners. The referendum period, as set out in the regulations, is a full 10 weeks and will not overlap with the designation process. That was the approach recommended by the Electoral Commission. The referendum period will, under the regulations, start on 15 April.

The Minister may be coming on to this, but will he clarify very clearly and succinctly how this will affect Government spending? I do not mean the Government, but the Cabinet members who support staying in as opposed to those who do not. How will that work for them?

The limits on what the Government can do are set out in section 125 of the Political Parties, Elections and Referendums Act 2000. The hon. Lady will recall that that provision was the subject of significant debate when the European Union Referendum Bill was going through its stages in the House. The so-called purdah restrictions remain those set out in the 2000 Act. In addition, in requiring the Government to publish particular items of information, the European Union Referendum Act states that the Government must do so at least 10 weeks before the date of the referendum. Those are the restrictions that she asked me about.

Finally, the regulations set out the periods for reporting donations and loans received by registered campaigners, and set the deadline by which the reports must be submitted to the Electoral Commission. The purpose of those arrangements is to ensure that sources of campaign finance are visible and public before the poll, so ensuring that the campaign is transparent.

The decision before us is a simple one: when should the British people have their say? We believe that 23 June strikes the right balance: it gives time for a substantial campaign, without testing public patience. There is time for campaigners and political parties to make their cases, and for the British people to decide. I commend the regulations to the House.

We seem to have focused on process for so much of today that I hope this will be the last time we do so.

I want to check some of the details of the statutory instrument with the Minister. It sets the date of the referendum on whether the United Kingdom should remain a member of the European Union. It also prescribes the length of the referendum period, the start of the period for applications to become a designated organisation, and the periods for the reporting of donations or regulated transactions. If would be good if the Minister nodded.

The main purpose of the statutory instrument is to set 23 June 2016 as the date of the referendum, which will take place over the whole of the UK and in Gibraltar. It prescribes the referendum period, which will begin on 15 April 2016, and it prescribes 4 March 2016 as the start of the period in which applications can be made to become designated organisations in the referendum. I understand that that poses no problem for the organisations in the remain campaign, but those in the hopelessly splintered out campaign seem to be having a much greater problem. Now is the time for them to get their act together if they are to hit the deadline.

The statutory instrument also sets out periods for the reporting of donations or regulated transactions—for example, loans—by permitted participants who are not registered parties or are minor parties. It sets out the dates on or before which reports must be delivered to the Electoral Commission. Okay so far?

My right hon. Friend the Secretary of State for Foreign and Commonwealth Affairs attended the Foreign Affairs Council on 15 February and I attended the General Affairs Council on 16 February. The Foreign Affairs Council was chaired by the High Representative of the European Union for Foreign Affairs and Security Policy, Federica Mogherini, and the General Affairs Council was chaired by the Dutch presidency. The meetings were held in Brussels.

In her introductory remarks Ms Mogherini welcomed the application from Bosnia for its application for EU membership and urged Bosnia to maintain the pace of reforms. On Libya, Ms Mogherini welcomed as a positive development the presidency Council’s revised list of Cabinet Ministers. Ms Mogherini also updated the Council on the recent meeting in Munich of the middle east peace process quartet. She also welcomed the launch of NATO’s maritime operation in the Aegean.

Climate Diplomacy

The Council underlined the importance of European climate diplomacy in encouraging implementation of the global agreement on climate change reached in Paris in December 2015. It set out the parameters for a 2016 climate diplomacy action plan, prioritising implementation of the Paris agreement and addressing the causes of climate change.

Moldova

The Council discussed the situation in Moldova and adopted Council conclusions on the reforms Moldova needed to carry out in line with its association agreement. In discussion Ms Mogherini emphasised the need for the EU to refrain from taking sides or intervening directly in Moldova’s internal affairs.

Syria

The Council discussed the political, security and humanitarian situation in Syria. Ministers were briefed on the outcome of the Syria donors conference held in London on 4 February, and the international Syria support group (ISSG) meeting in Munich on 11 February. The Foreign Secretary made clear in an early intervention that Russia had the power to end the violence and bring the Syrian regime to the negotiating table. He warned that the situation in Aleppo risked creating a massive humanitarian crisis and a new wave of migration. He highlighted the importance of implementing the outcomes of the London conference, and praised the commission and member states for their generosity. The financial pledges and commitments to provide education and jobs to Syrian refugees was vital.

Lunch with the Lebanese Foreign Minister

Over lunch, Ministers exchanged views with the Lebanese Foreign Minister, Gebran Bassil, on the situation in Lebanon and the region, including the refugee and migration situation. The Foreign Secretary emphasised the need to focus both on humanitarian and development support. Member states expressed support to Lebanon, in particular for hosting over 1.1 million refugees, and to the Lebanese armed forces for maintaining stability. Member states also urged Lebanon to break the political deadlock in regard to the presidential vacuum.

Belarus

Council conclusions were adopted on Belarus. In conclusion Ms Mogherini said EU-Belarus relations had for many years been trapped in a cycle of hope, disappointment, sanctions and difficult engagement. However, trends had been more positive over the last few years, including on Ukraine and important, albeit limited, steps on human rights and democracy. The Council reached a political decision not to extend restrictive measures for 170 individuals and three companies whose listings are currently suspended. However, it left in place the arms embargo and restrictive measures for four individuals involved in unresolved disappearances.

Ministers agreed without discussion a number of measures:

The Council adopted conclusions on climate diplomacy.

The Council adopted conclusions on EU priorities at UN Human Rights Fora in 2016.

The Council adopted conclusions on Burundi.

The Council adopted conclusions on Somalia.

The Council approved the EU’s position regarding the agenda set for the 14th meeting of the EU-Kyrgyz Republic Co-operation Council.

The Council prolonged EU restrictive measures against two persons and one entity in Zimbabwe until 20 February 2017, while removing the names of 78 persons and eight entities from the list of those targeted by the measures.

The Council set a financial reference amount of €825,000 to cover the expenditure related to the mandate of the EU Special Representative for Human Rights from 1 March to 28 February 2017.

The Council extended the mandate of the civilian EU integrated border management assistance mission in Libya by six months, until 21 August 2016.

The Council adopted the draft European Union programme of exercises and exercise-related. activities under the CFSP 2016-20.

The General Affairs Council (GAC) on 16 February 2016 focused on follow up to European Council conclusions, preparation of the February and March European Councils and the inter-institutional agreement on better regulation.

European Council Follow up and Preparation of the February European Council

The GAC prepared the agenda for the European Council on 18-19 February, which the Prime Minister attended. The agenda included the UK’s EU renegotiation, migration and eurozone recommendations as part of the European semester process. I emphasised that more work needed to be done before the February European Council on both renegotiation and migration. On migration, I called for a more strategic approach and a focus on full implementation. I also highlighted the contribution made by the London conference on Syria and called for pledges made at the conference to be honoured.

Preparation of the March European Council

The GAC also briefly prepared the agenda for the European Council on 17-18 March, which the Prime Minister will attend. The agenda will again cover migration and the European semester. The Council noted that discussion would also flow from outcomes of the February Council.

Inter-Institutional Agreement on Better Regulation (IIA)

The presidency updated the GAC on the ongoing IIA negotiations, with a view to a more detailed discussion at the March GAC.

Under any other business, Bulgaria updated the GAC on the recent blockades by Greek farmers at border checkpoints on its border with Greece.

My right hon. Friend the Foreign Secretary is meticulous in his courtesies to this House, but sometimes Secretaries of State for Foreign and Commonwealth Affairs have to deal with extremely urgent matters to do with this country’s national security.

I want to single out the speech made by my right hon. Friend the Member for Mid Sussex (Sir Nicholas Soames), as anybody who heard it, whichever side of this argument they stand on, will remember it as one of the great parliamentary set pieces of their years in this place.

I do not want to dwell at length on the arguments about renegotiation, because my right hon. Friend the Prime Minister went into them in great detail and answered questions about the subject for three hours on Monday. I simply say that I have sat through a fair number of these debates in the last six years, and I will be the first to say to my hon. Friends the Members for Wycombe (Mr Baker) and for North East Somerset (Mr Rees-Mogg) that they are models of consistency in their opposition to British membership of the European Union. If the Prime Minister had come back from Brussels brandishing the severed heads of the members of the European Commission and proceeded to conduct an auto-da-fé in Downing Street of copies of the Lisbon treaty, they would still be saying, “This is feeble, insufficient, not enough.”

No, I want to deal with what the right hon. Member for Gordon (Alex Salmond) said, as he raised some serious issues about the impact of a British withdrawal upon the devolved Administrations, particularly, but not exclusively, Scotland’s. It is for the Government of the United Kingdom, the United Kingdom being the member state party to the treaties, to decide whether to trigger an article 50 process after such a referendum result. But he is right to say that there would be some pretty complicated outworkings of British departure from the EU for all three devolved Administrations and for the United Kingdom and English statute book, because a fair number of Acts of Parliament reflect European law as it has developed over the past 40 years. Those things would have to be gone through, both in the two years’ negotiations following the triggering of article 50 and, I suspect, in the years subsequent.

Does the Minister understand the point here? If there is not to be a vote in this place because it is superseded by a popular sovereignty vote for out, what would be the circumstances, under the Sewel convention, of a vote in the Scottish Parliament if the popular vote in Scotland had been for in?

The United Kingdom is the signatory to the European treaties, and therefore it is the UK Government who take the decision on whether to invoke article 50.

My hon. Friend the Member for Ribble Valley (Mr Evans) raised important points about what he saw as security risks from people who had migrated to Germany crossing to the United Kingdom. My hon. Friend the Member for The Wrekin (Mark Pritchard) said, accurately, that we have some pretty effective security arrangements at our borders and that the record shows not only that the chief terrorist threat to the United Kingdom too often comes from British citizens, but that there have been terrorist incidents abroad that have been brought about by people who were British born and bred. In Germany, it takes eight to 10 years for someone to get citizenship, and they have to have a clean criminal record, pass an integration test and show that they have an independent source of income. It is probably because those tests are so rigorous that only 2.2% of refugees in Germany take German citizenship and get German passports. What we can and do do here is stop people, including EU citizens, at our borders and refuse entry to anyone about whom there is information of terrorist links. Some of my hon. Friends overlook the fact that our safeguards against terrorism are stronger precisely because we are party to the various European agreements on data sharing and information sharing, such as on passenger name records, which we would be outwith if we were to leave the European Union and were unable to negotiate some alternative arrangement.

The key question in deciding our position on membership is one my hon. Friend the Member for South Dorset (Richard Drax) touched on: how will we be better able to control our destiny and influence for good the lives of the people whom we represent? The point that the leave campaigners must face is that the alternatives that we see—most notably Norway and Switzerland—are countries that, in order to get free trade and the single market, have had to accept not only all the EU regulations that govern those matters without any say or vote in determining them, but the free movement of people and a duty to contribute to the EU budget. That is not sovereignty, but kingship with a paper crown. It would not bring the power to shape European policy and co-operation for the benefit of the people whom we are sent here to represent from all parts of the United Kingdom.

What has dismayed me during this debate is that, apart from my hon. Friend the Member for Gainsborough (Sir Edward Leigh), there has been little attempt to describe what the alternative is that will somehow enable us to have all the things that we value about European Union membership with none of the things that may matter to other Governments around Europe and which we perhaps find irksome or troubling.

No, I will not give way.

I am bemused that some of my hon. Friends have managed to convince themselves of two propositions: that other European countries are at present engaged in what has been termed a “vindictive and spiteful” attempt to harm our interests or a conspiracy to do us down; and that those same Governments will rush to give us everything that we want with none of the downsides if only we vote to leave. That is a fanciful analysis of European politics today. If we accept that we want a single market, we must have the EU rules that go with it and the other costs, such as those that Norway and Switzerland have to pay today.

We are putting so much at risk at a time of real peril not just for this country but for the whole of the west. We face a massive economic challenge from global competition and digital technology; a challenge from transnational crime and global terrorism; the collapse of states in parts of Africa and the middle east, which has allowed terrorism, people trafficking and drug trafficking to flourish; and the challenge from a newly aggressive Russia in both eastern Europe and the middle east. No one country in Europe, not even the biggest, will be able to tackle those challenges on its own. That is why our key allies—not just those in Europe, but the United States, Canada, Australia and New Zealand—see the United Kingdom as stronger and more influential in the world as a leader in our own continent. I am dismayed by the insouciant attitude of those who want to leave to the risk that their campaign poses of the possible fragmentation of the west. It is truly shocking.

We need to have confidence in this country’s ability to lead and shape events in Europe, as we have done in creating the single market, in pioneering free trade deals, in organising a firm response through sanctions to Russian aggression in Ukraine and to Iran’s nuclear programme, and in defeating piracy in the Indian ocean.

The United Kingdom should be confident in our ability to work with allies in Europe and around the world. We should not see the two things as in any way contradictory. As we look to the future and face again the challenges of large-scale migration driven by terrorism, failed states, climate change and economic problems in much of the developing world, we need to work together with our partners and our allies, because none of us can tackle that on our own. We see the United Kingdom today as a European power with global interests and global influence. Those two aspects of this country are not contradictory; they complement one another. We need to go forward with the confidence and optimism that the United Kingdom can help make a better future not just for every family in this country but for all the nations of the wider European family. That is the case that I and my right hon. and hon. Friends will be putting to the country in the months to come.

I am happy to respond. The Prime Minister responded to this point in answer to questions on Monday. The Government have a very clear position, which is to recommend to the country that people vote to remain members of a reformed European Union. Quite exceptionally, Ministers are being allowed to depart from the normal rules on collective responsibility in order to dissent from the official Government position on that referendum question, but the civil service exists to serve and support the policy agreed by the Government of the day. The letter published by my right hon. Friend the Prime Minister, subsequently extended by formal guidance from the Cabinet secretary to civil servants, does no more than give effect to that policy.

We oppose the use of the death penalty in all circumstances and advocate global abolition. The Government support a number of programmes around the world to promote both abolition and a moratorium on executions in those countries where the death penalty is still on the statute book.

I welcome the fact that the long-term trend is for reducing the number of executions and also the number of states carrying out executions. Will the Minister join me in expressing concern about areas of the world where that is not the case? Does he agree that if it is wrong to take a life, it is wrong for the state to take a life in revenge?

That is certainly my view, and the Government’s position is to oppose capital punishment. We need also to bear in mind the fact that while capital punishment exists, it is potentially a risk for a British citizen, anywhere in the world, who might be found guilty of a criminal offence.

Does the Minister share my horror that the United States remains in the top five countries for executing people, despite a reduction in the number of executions last year? When did he last speak to his American counterpart about the US record on executing people?

As I am sure the right hon. Lady knows, in the United States this is largely a matter for a state legislatures and state governments, rather than for the federal Government. We do take up cases with the relevant authorities, as appropriate, and when the lawyers and British citizens ask us to do so.

Belarus is the only country in Europe that still executes its citizens. Does my right hon. Friend share my concern that in the past three months two of its citizens have been sentenced to death? If Belarus wants to become a full member of the Council of Europe, should it not abide by international norms and the European regulations?

I very much agree with what my hon. Friend says. In all our dealings with the Belarusian Government, we do make clear the need for them not only to move to international and European standards on capital punishment, but to take action to improve what remains a dismal human rights record in that country.

Further to the Minister’s answer to the question from the right hon. Member for Slough (Fiona Mactaggart), is he aware of the concerns of Reprieve that drugs manufactured by UK company Hikma Pharmaceuticals were exported last year to the state of Arkansas for use in lethal injections? Hikma has told me in correspondence that it does not export for this purpose but that

“any sales to these entities usually occur through the use of distributors”.

This seems such an obvious loophole, so why is nobody closing it?

The conduct regulations that set out the detailed framework of how the referendum poll will be administered have now been agreed by both Houses of Parliament. Will the Minister give comfort to the Scottish students who are studying through Erasmus across Europe by providing details of what contingency plans are in place should there be a no vote in the EU referendum?

My advice to Scottish students studying in universities elsewhere in the EU would be to ensure that they are registered to vote so that their votes in the referendum count along with everybody else’s. The hon. Lady puts her finger on one of the uncertainties about a potential British exit from the European Union, because, after all, it is European law and the treaties that give British citizens the right to live, study and work in other EU countries.

The Minister may recall that in response to my amendment to the Finance Bill last year, the Government promised to negotiate with the European Commission for a zero rate of VAT on women’s sanitary products, and the Chancellor repeated that pledge in his autumn statement. It is time the tampon tax was ended, so did the Prime Minister use his recent negotiations to raise this issue and, if so, what progress has been made?

As I think the hon. Lady knows, value added tax was already part of the EU system before the United Kingdom joined the European Community in the 1970s. A review of the current EU directives on value added tax is due to take place this year, and that is the appropriate forum in which to raise this issue, where the Government very much hope to secure the reforms about which she speaks.

Successive UK Governments have signed up to a range of EU agreements vital in protecting our environment, upholding workers’ rights, and ensuring an EU-wide energy market. The removal of such environmental controls and statutory maternity pay, for example, would be a backward step. I am sure, therefore, that the Minister will agree that our membership of the EU is vital in promoting the interests of the people of Scotland and across the UK. However, he will be aware that the Justice Secretary said last week that

“our membership of the European Union prevents us being able to change huge swathes of law and stops us being able to choose who makes critical decisions which affect all our lives.”

Can the Minister therefore confirm specifically—[Interruption.]

As with every member state of the EU, particular issues will come up—particular legislative measures—where we find some of the rulings irksome. On balance, however, as my right hon. Friend the Prime Minister set out very clearly yesterday, the Government are convinced that membership of a reformed European Union will make the British people more prosperous, more secure, and more influential in the world than any of the alternatives so far proposed.

Some of this will be a matter for the implementing regulations that will now follow, both at European level and at national level. The answer to the hon. Lady’s question will depend in large part on the level of benefits and tax credits in the United Kingdom at the appropriate time. These matters will therefore become clear as time goes on.

I wish the Minister great success in trying to alter the level of VAT on sanitary towels. If the British people decide in the referendum to leave the European Union, would it then be up to the British Government to decide the level of VAT on sanitary towels and other products?

That would depend on the nature of the subsequent relationship. The reason that value added tax has, since before our membership of the EU, been dealt with, to an extent, at EU level is that the price at which goods are sold has a direct impact on the notion of a single market and free trade within Europe. The issues that my hon. Friend raises would have to be tackled in the course of negotiations about such a future relationship.

Our immigration controls in Calais are governed by the treaty of Le Touquet, as my right hon. Friend the Member for Europe well knows. He will also know, and the House of Commons Library has said, that the treaty can be broken only if the British or the French choose to do so, and it has absolutely nothing to do with whether we are members of the European Union. Will he ask whichever person who said it to stop talking this nonsense that if we leave the EU we are suddenly going to find a massive great refugee camp in the heart of Kent?

The Le Touquet treaty is certainly vital to this country’s border security. Of the 100,000 people who have been prevented from entering the UK in the past five years, roughly a quarter were stopped at Calais at the juxtaposed controls. We co-operate very closely with the French Government, but I fear my hon. Friend underestimates the extent of domestic French opposition to and protest against the juxtaposed controls. If we left the EU, the stock of good will towards Le Touquet and this country would be severely depleted.

T10. On the Foreign Office website, there is very clear advice to private companies thinking of doing business with illegal Israeli settlements. It states:“Financial transactions, investments, purchases, procurements as well as other economic activities…in Israeli settlements or benefiting Israeli settlements, entail legal and economic risks”and “we do not encourage or offer support to such activity.”Do the Government give exactly the same advice to public bodies, including local councils, with regard to their procurement decisions?

My right hon. Friend the Secretary of State for Foreign and Commonwealth Affairs will attend the Foreign Affairs Council on 15 February and I will attend the General Affairs Council on 16 February. The Foreign Affairs Council will be chaired by the High Representative of the European Union for Foreign Affairs and Security Policy, Federica Mogherini, and the General Affairs Council will be chaired by the Dutch presidency. The meetings will be held in Brussels.

Foreign Affairs Council

The expected agenda for the Foreign Affairs Council (FAC) will include Bosnia, South Africa, Moldova, Belarus, Libya and climate diplomacy. The Lebanon Foreign Minister will attend lunch where there will be an opportunity to follow up on commitments made at the London Conference on Supporting Syria and the Region 2016 and look at wider regional issues.

Bosnia

HRVP Mogherini will include Bosnia and Herzegovina (BiH) in her introductory remarks, signalling BiH’s intention to submit its EU membership application in the margins of the meeting. While the UK Government will wish to welcome BiH’s progress on its EU path, we will want to make clear what more needs to be done for the application to proceed—namely more meaningful implementation of the reform agenda, stabilisation and association agreement (SAA) adaptation to take into account Croatia’s accession to the EU; and agreement on a co-ordination mechanism to allow BiH to speak with one voice to the EU.

South Africa

Ministers are expected to exchange views on HRVP Mogherini’s forthcoming visit to South Africa and the future direction of the EU’s strategic partnership with the country. The UK will seek to encourage increased engagement and note the importance of the EU’s broad and significant partnership with South Africa.

Moldova

Ministers are expected to exchange views on recent developments in the Republic of Moldova.

Belarus

The FAC will have a discussion on relations between the EU and Belarus. Improving the human rights situation in the country remains a key priority for the EU.

Lebanon

Ministers will be joined for lunch by Lebanese Foreign Minister Gebran Bassil. As host to over 1.1 million refugees from Syria, Lebanon is on the front line of the humanitarian response to the crisis. At the Supporting Syria and the Region 2016 Conference held in London on 4 February the UK and co-hosts signed an agreement with Lebanon that will see the international community providing long-term support to strengthen the Lebanese economy and create job opportunities for host communities and refugees. Ministers will discuss the implementation of this agreement, the urgent need for Lebanon to elect a President, and security in the region.

Libya

The FAC will focus on the latest developments in the UN-led political process. The UK, along with the UN and international partners continues to urge all parties to resolve the remaining issues quickly. The EU will play an important role in providing immediate support to a Government of National Accord, and we will encourage the EU to develop its options for support in co-ordination with the UN.

Climate diplomacy

Ministers are expected to discuss the outcomes of the Paris climate change agreement and how best to support its implementation. They will exchange views on how the EU and member states should co-ordinate their efforts, including a draft climate diplomacy plan drawn up by the European External Action Service. As my right hon. Friend the Secretary of State for Energy and Climate Change said in her statement to the House on 14 December, this historic new global climate change agreement takes a significant step towards reducing, on a global scale, the emissions that cause climate change. The UK Government welcome the way the EU institutions and member states worked together to deliver the Paris agreement. The Government will continue to engage actively with EU partners and the institutions to support implementation of the agreement.

General Affairs Council

The General Affairs Council (GAC) on 16 February is expected to focus on European Council follow up, preparation of the February and March European Councils and the inter-institutional agreement on better regulation.

European Council follow up

The GAC will discuss the implementation of conclusions adopted at the December European Council, with a particular focus on the migration issue.

Preparation of the February European Council

The GAC will prepare the draft conclusions for the 18-19 February European Council, which the Prime Minister will attend. The February European Council agenda covers the UK’s EU renegotiation migration and economic issues.

Preparation of the March European Council

The GAC will prepare the agenda for the 17-18 March European Council, which the Prime Minister will attend. The March European Council agenda has not yet been released but we expect it to include migration.

Inter-institutional agreement on better regulation (IIA)

The GAC will receive a further update on the IIA negotiations from the presidency. The Council may also discuss implementation, depending on the progress made ahead of the Council.

My right hon. Friend the Secretary of State for Foreign and Commonwealth Affairs attended the informal Foreign Ministers meeting on 5 and 6 February in Amsterdam, the Netherlands.

The informal format of the Gymnich allows EU Foreign Ministers to engage in a free-ranging discussion on a number of issues. In contrast to the formal Foreign Affairs Council (FAC), Ministers do not agree written conclusions. The next FAC will be held on 15 February. The Gymnich was chaired by the High Representative of the European Union for Foreign Affairs and Security Policy, Federica Mogherini. Discussion centred on the European global strategy, Iran, and migration. The Gymnich also featured a scenario-based exercise.

Elmar Brok MEP, Chairman of the European Parliament’s Committee on Foreign Affairs and Foreign Ministers from EU candidate countries joined EU Ministers for the session on migration. The Parliamentary Under-Secretary of State for Defence and Minister for Reserves (Julian Brazier) represented the UK in the session on the European global strategy.

Gymnich discussion

European global strategy

EU Defence and Foreign Ministers met at a joint working lunch to discuss progress in the drafting of the strategy. Ms Mogherini stated her intention to produce a strategy that was broader than just security issues and covered the range of priorities for the EU. The Parliamentary Under-Secretary of State and Minister for Reserves highlighted the UK’s strategic defence and security review (SDSR) and commitment to spend 2% on defence and 0.7% on development. He said it was important that Europe should look first to NATO for its defence.

Iran

The next issue on the agenda was the EU’s relationship with Iran. Ms Mogherini said the joint comprehensive plan of action (JCPoA) should be implemented and respected. The Secretary of State for Foreign and Commonwealth Affairs added that the EU needed to take a cautious approach due to Iran’s ballistic missile programme and poor human rights.

Scenario-based exercise

At the joint initiative of Ms Mogherini and the Dutch Foreign Minister, Mr Bert Koenders, Ministers took part in a crisis simulation exercise, which involved a fictitious scenario followed by discussion of possible responses to an external threat.

Migration issues

The second day of the informal Gymnich meeting addressed migration with an extended session. EU Foreign Ministers were joined by Ministers from candidate countries and discussed the routes taken by migrants through the western Balkans and Turkey, the challenges ahead and possible solutions. Ms Mogherini intended to focus on implementing measures already in place, such as the Turkey action plan (AP) and work on contingency planning for the western Balkans routes.

The Foreign Secretary highlighted how the stream of legitimate refugees from Syria could worsen and stressed the need for a long-term strategy beyond the current crisis. This included addressing upstream push factors and supporting UN efforts and Syria’s neighbours.
