I beg to move,

That the following provisions shall apply to the proceedings on the Northern Ireland (Welfare Reform) Bill:

Timetable

(1) (a) Proceedings on Second Reading and in Committee of the whole House, any proceedings on Consideration, and proceedings up to and including Third Reading shall be completed at today’s sitting.

(b) Proceedings on Second Reading shall be brought to a conclusion (so far as not previously concluded) four hours after the commencement of proceedings on this Motion.

(c) Proceedings in Committee of the whole House, any proceedings on Consideration and proceedings up to and including Third Reading shall be brought to a conclusion (so far as not previously concluded) six hours after the commencement of proceedings on this Motion.

Timing of proceedings and Questions to be put

(2) When the Bill has been read a second time:

(a) it shall, despite Standing Order No. 63 (Committal of bills not subject to a programme order), stand committed to a Committee of the whole House without any Question being put;

(b) the Speaker shall leave the Chair whether or not notice of an Instruction has been given.

(3) (a) On the conclusion of proceedings in Committee of the whole House, the Chairman shall report the Bill to the House without putting any Question.

(b) If the Bill is reported with amendments, the House shall proceed to consider the Bill as amended without any Question being put.

(4) Where paragraph (2) or (4) of Standing Order No. 83L (Reconsideration of certification before Third Reading) applies in relation to the Bill, the Speaker shall, where it is not possible to do so immediately in accordance with paragraph (7) of that Order, announce the Speaker’s decisions under paragraph (2) or (4) of that Order no later than 15 minutes after the conclusion of proceedings on the previous stage of the Bill.

(5) Where a legislative grand committee decides on a Consent Motion under Standing Order No. 83M to withhold consent to the Bill or any Clause of or Schedule to the Bill or any amendment made to the Bill since Second Reading, the House shall proceed to Reconsideration of the Bill and any proceedings on consequential consideration without any Question being put.

(6) For the purpose of bringing any proceedings to a conclusion in accordance with paragraph (1), the Chairman or Speaker shall forthwith put the following Questions (but no others) in the same order as they would fall to be put if this Order did not apply:

(a) any Question already proposed from the Chair;

(b) any Question necessary to bring to a decision a Question so proposed;

(c) the Question on any amendment moved or Motion made by a Minister of the Crown;

(d) any other Question necessary for the disposal of the business to be concluded.

(7) On a Motion so made for a new Clause or a new Schedule, the Chairman or Speaker shall put only the Question that the Clause or Schedule be added to the Bill.

(8) If two or more Questions would fall to be put under paragraph (6)(c) on successive amendments moved or Motions made by a Minister of the Crown, the Chairman or Speaker shall instead put a single Question in relation to those amendments or Motions.

(9) If two or more Questions would fall to be put under paragraph (6)(d) in relation to successive provisions of the Bill, the Chairman shall instead put a single Question in relation to those provisions, except that the Question shall be put separately on any Clause of or Schedule to the Bill which a Minister of the Crown has signified an intention to leave out.

Consideration of Lords Amendments

(10) (a) Any Lords Amendments to the Bill may be considered forthwith without any Question being put; and any proceedings interrupted for that purpose shall be suspended accordingly.

(b) Proceedings on consideration of Lords Amendments shall (so far as not previously concluded) be brought to a conclusion one hour after their commencement; and any proceedings suspended under sub-paragraph (a) shall thereupon be resumed.

(11) (a) This paragraph applies for the purpose of bringing any proceedings to a conclusion in accordance with paragraph (10).

(b) The Speaker shall first put forthwith any Question already proposed from the Chair.

(c) If that Question is for the amendment of a Lords Amendment the Speaker shall then put forthwith:

(i) a single Question on any further Amendments to the Lords Amendment moved by a Minister of the Crown, and

(ii) the Question on any Motion made by a Minister of the Crown that this House agrees or disagrees to the Lords Amendment or (as the case may be) to the Lords Amendment as amended.

(d) The Speaker shall then put forthwith:

(i) a single Question on any Amendments moved by a Minister of the Crown to a Lords Amendment, and

(ii) the Question on any Motion made by a Minister of the Crown that this House agrees or disagrees to the Lords Amendment or (as the case may be) to the Lords Amendment as amended.

(e) The Speaker shall then put forthwith the Question on any Motion made by a Minister of the Crown that this House disagrees to a Lords Amendment.

(f) The Speaker shall then put forthwith the Question that this House agrees to all the remaining Lords Amendments.

(g) As soon as the House has:

(i) agreed or disagreed to a Lords Amendment, or

(ii) disposed of an Amendment relevant to a Lords Amendment which has been disagreed to,

the Speaker shall put forthwith a single Question on any Amendments that are moved by a Minister of the Crown and are relevant to the Lords Amendment.

(h) Where a single Question would be put under sub-paragraph (c)(i), (d)(i) or (g) in circumstances where some or all of the Amendments concerned are certified under Standing Order No. 83O (Consideration of certified Motions or Amendments relating to Lords Amendments or other messages) in relation to a particular part or parts of the United Kingdom, the Speaker shall put forthwith—

(i) a single Question on any Amendments for which the certification is in relation to England,

(ii) a single Question on any Amendments for which the certification is in relation to England and Wales,

(iii) a single Question on any Amendments for which the certification is both in relation to England and in relation to England and Wales, and

(iv) a single Question on any Amendments for which there is no certification.

(i) Where a single Question would be put under sub-paragraph (f) in circumstances where, if there were (or are) separate Motions to agree in relation to each of the remaining Lords Amendments, some or all of the Motions would be (or are) certified under Standing Order No. 83O (Consideration of certified Motions or Amendments relating to Lords Amendments or other messages), the Speaker shall put forthwith—

(i) in the case of any remaining Lords Amendments for which there would be (or are) Motions certified in relation to England, the Question that this House agrees to those Lords Amendments,

(ii) in the case of any remaining Lords Amendments for which there would be (or are) Motions certified in relation to England and Wales, the Question that this House agrees to those Lords Amendments,

(iii) in the case of any remaining Lords Amendments for which there would be (or are) Motions certified both in relation to England and in relation to England and Wales, the Question that this House agrees to those Lords Amendments, and

(iv) in the case of any remaining Lords Amendments for which there would be (or are) Motions which would not be (or are not) certified, the Question that this House agrees to those Lords Amendments.

(j) If a division is held on a question put under sub-paragraph (h) or (i), the Amendments shall be agreed to only if, of those voting in the division—

(i) in a case falling within paragraph (i) of that sub-paragraph, a majority of Members and a majority of Members representing constituencies in England

(ii) in a case falling within paragraph (ii) of that sub-paragraph, a majority of Members and a majority of Members representing constituencies in England and Wales,

(iii) in a case falling within paragraph (iii) of that sub-paragraph, a majority of Members, a majority of Members representing constituencies in England and a majority of members representing constituencies in England and Wales, and

(iv) in a case falling within paragraph (iv) of that paragraph, a majority of Members,

vote in support of them.

(k) Paragraph (9) of Standing Order No. 83O shall apply to a decision made by virtue of sub-paragraph (j) above on a Question as it applies in relation to a decision made by virtue of paragraph (7) of that Order on a Motion.

Subsequent stages

(12) (a) Any further Message from the Lords on the Bill may be considered forthwith without any Question being put; and any proceedings interrupted for that purpose shall be suspended accordingly.

(b) Proceedings on any further Message from the Lords shall (so far as not previously concluded) be brought to a conclusion one hour after their commencement; and any proceedings suspended under sub-paragraph (a) shall thereupon be resumed.

(13) (a) This paragraph applies for the purpose of bringing any proceedings to a conclusion in accordance with paragraph (12).

(b) The Speaker shall first put forthwith any Question which has been proposed from the Chair.

(c) The Speaker shall then put forthwith the Question on any Motion made by a Minister of the Crown which is related to the Question already proposed from the Chair.

(d) The Speaker shall then put forthwith the Question on any Motion made by a Minister of the Crown on or relevant to any of the remaining items in the Lords Message.

(e) The Speaker shall, subject to sub-paragraphs (f) and (g), then put forthwith the Question that this House agrees with the Lords in all the remaining Lords Proposals.

(f) Sub-paragraph (g) applies where, if there were (or are) separate Motions to agree in relation to each of the remaining Lords Proposals, some or all of the Motions would be (or are) certified under Standing Order No. 83O (Consideration of certified Motions or Amendments relating to Lords Amendments or other messages).

(g) The Speaker shall put forthwith—

(i) in the case of any remaining Lords Proposals for which there would be (or are) Motions certified in relation to England, the Question that this House agrees with the Lords in those Proposals,

(ii) in the case of any remaining Lords Proposals for which there would be (or are) Motions certified in relation to England and Wales, the Question that this House agrees with the Lords in those Proposals,

(iii) in the case of any remaining Lords Proposals for which there would be (or are) Motions certified both in relation to England and in relation to England and Wales, the Question that this House agrees with the Lords in those Proposals, and

(iv) in the case of any remaining Lords Proposals for which there would be (or are) Motions which would not be (or are not) certified, the Question that this House agrees with the Lords in those Proposals.

(h) If a division is held on a Question put under sub-paragraph (g), the Proposals shall be agreed to only if, of those voting in the division—

(i) in a case falling within paragraph (i) of that sub-paragraph, a majority of Members and a majority of Members representing constituencies in England,

(ii) in a case falling within paragraph (ii) of that sub-paragraph, a majority of Members and a majority of Members representing constituencies in England and Wales,

(iii) in a case falling within paragraph (iii) of that sub-paragraph, a majority of Members, a majority of Members representing constituencies in England and a majority of Members representing constituencies in England and Wales, and

(iv) in a case falling within paragraph (iv) of that sub-paragraph, a majority of Members

vote in support of them.

(i) Paragraph (9) of Standing Order No. 83O shall apply to a decision made by virtue of sub-paragraph (h) above on a Question as it applies in relation to a decision made by virtue of paragraph (7) of that Order on a Motion.

Reasons Committee

(14) (a) The Speaker shall put forthwith the Question on any Motion made by a Minister of the Crown for the appointment, nomination and quorum of a Committee to draw up Reasons and the appointment of its Chair.

(b) A Committee appointed to draw up Reasons shall report before the conclusion of the sitting at which it is appointed.

(c) Proceedings in the Committee shall (so far as not previously concluded) be brought to a conclusion 30 minutes after their commencement.

(d) For the purpose of bringing any proceedings to a conclusion in accordance with sub-paragraph (c), the Chair shall:

(i) first put forthwith any Question which has been proposed from the Chair, and

(ii) then put forthwith successively Questions on Motions which may be made by a Minister of the Crown for assigning a Reason for disagreeing with the Lords in any of their Amendments.

(e) The proceedings of the Committee shall be reported without any further Question being put.

Miscellaneous

(15) Standing Order No. 15(1) (Exempted business) shall apply so far as necessary for the purposes of this Order.

(16) (a) The proceedings on any Motion made by a Minister of the Crown for varying or supplementing the provisions of this Order shall (so far as not previously concluded) be brought to a conclusion one hour after their commencement.

(b) Standing Order No. 15(1) (Exempted business) shall apply to those proceedings.

(17) Standing Order No. 82 (Business Committee) shall not apply in relation to any proceedings to which this Order applies.

(18) (a) No Motion shall be made, except by a Minister of the Crown, to alter the order in which any proceedings on the Bill are taken or to recommit the Bill.

(b) The Question on any such Motion shall be put forthwith.

(19) (a) No dilatory Motion shall be made in relation to proceedings to which this Order applies except by a Minister of the Crown.

(b) The Question on any such Motion shall be put forthwith.

(20) The Speaker may not arrange for a debate to be held in accordance with Standing Order No. 24 (Emergency debates) on a day on which the Bill has been set down to be taken as an Order of the Day before the conclusion of any proceedings to which this Order applies.

(21) (a) This paragraph applies if the House is adjourned, or the sitting is suspended, before the conclusion of any proceedings to which this Order applies.

(b) No notice shall be required of a Motion made at the next sitting by a Minister of the Crown for varying or supplementing the provisions of this Order.

(22) Proceedings to which this Order applies shall not be interrupted under any Standing Order relating to the sittings of the House.

(23) (a) Any private business which has been set down for consideration at 7.00pm, 4.00pm or 2.00pm (as the case may be) on a day on which the Bill has been set down to be taken as an Order of the Day shall, instead of being considered as provided by Standing Orders or by any Order of the House, be considered at the conclusion of the proceedings on the Bill on that day.

(b) Standing Order No. 15(1) (Exempted business) shall apply to the private business for a period of three hours from the conclusion of the proceedings on the Bill or, if those proceedings are concluded before the moment of interruption, for a period equal to the time elapsing between 7.00pm, 4.00pm or 2.00pm (as the case may be) and the conclusion of those proceedings.

In the course of my brief remarks, I also propose to address amendment (a).

From the outset, let me say that the Government fully accept that what we are asking the House to do today is exceptional. We agree that taking all stages of the Bill through the House in a single day is not ideal and I fully understand that a number of right hon. and hon. Members will have misgivings about it. I would very much prefer not to have had to take this approach. I note the amendment tabled by the Social Democratic and Labour party. However, I can assure the hon. Members who tabled the amendment and the whole House that the Government are embarking on this procedure only because we view it to be absolutely necessary in this specific case.

The Secretary of State may, like me, be a little reticent today, but will she reflect on the huge irony that on 5 September Martin McGuinness said it would be a huge mistake for the Secretary of State to be legislating on this matter, yet today he now welcomes it?

I very much welcome the fact that there is now a broadly based acknowledgement among the Northern Ireland parties that the financial sustainability of the Executive is crucial for the success of devolved power-sharing government, and that that requires the implementation of welfare reform. This has been a long and involved debate, but I am glad we have got to the right destination in the end.

I believe it is necessary to adopt this fast-track procedure to ensure that welfare reform is no longer an issue that is undermining the political process in Northern Ireland, as it has done over the past four years. I believe it is necessary to take this approach if we are to implement the agreement reached at Stormont last Tuesday, and I believe it is necessary that we take this approach to underpin the stability and survival of power-sharing devolved institutions at Stormont.

The proposed legislation is a fundamental part of the agreement reached last week. If we do not get it on to the statute book and continue with the implementation of last week’s agreement, there will be a very serious risk that devolution would collapse, leading to a return to direct rule. A resumption of direct rule would inevitably mean many items of long and complex primary legislation being taken through by Order in Council month after month, potentially year after year. Not only would that mean denying such legislation the scrutiny in the Assembly, but it would inevitably take up large amounts of parliamentary time.

I do not propose to detain the House for long on this procedural matter, but it is important to understand some of the background to the Bill in order to emphasise its crucial significance and the crucial importance of getting it on to the statute book as soon as possible.

The Secretary of State has chosen her words very carefully and very deliberately, describing rushing through all the stages of a welfare reform Bill in one day as “exceptional”, “not ideal” and “absolutely necessary”. Where does she think the emergency comes from? Who is going to renege on last week’s very welcome agreement? Which party is going to renege on it? Why should we have emergency procedure today and rush through all the stages?

As I will explain, the primary legislation enabled by the Bill has had extensive scrutiny over the last four years. The Order in Council published alongside the Bill reflects the proposed welfare legislation in the Northern Ireland Assembly that fell as a result of the tabling of a petition of concern. That proposed legislation had a First stage, a Second stage, a Committee stage, a Consideration stage, a Further Consideration stage and a Final stage, and there was an extensive debate on a legislative consent motion. It has, therefore, had extensive scrutiny, including 21 weeks of cross-party talks this year and last year. It is not an ideal way to legislate, but the proposed legislation, at its heart, has had extensive scrutiny.

The Secretary of State has outlined what debate there has already been on the terms of the Bill. Will she accept that one reason for urgency is that, until the Bill is passed, Northern Ireland will continue to lose money by the day to the Treasury by way of payments that have to be made back because of the differences in the welfare arrangements, and the Northern Ireland budget cannot sustain that?

The hon. Gentleman makes a valid point. The difference between the level of benefits in Great Britain and Northern Ireland is £2 million a week, which is a drain on the resources of the Executive that they can ill afford at this difficult time for the public finances. Successive attempts to resolve the welfare question over the last four years have foundered, which has contributed largely to a political crisis in Northern Ireland and the Executive’s finances. By early autumn, it looked increasingly likely that the issue would bring down the devolved institutions themselves. As he points out, this has been costing the Executive money—approximately £2 million a week. That is the difference between what the Treasury is prepared to pay—to fund up to parity with Great Britain—and the cost of continuing to run an old, unreformed welfare system in Northern Ireland. The Executive estimate that the cost to their budget will rise to more than £200 million next year and to more than £500 million a year by the end of this Parliament. That is simply unaffordable, and the figures do not even take into account the costs of IT.

Although welfare is technically a devolved matter in Northern Ireland, up to now it has always retained parity with the rest of the UK and been fully integrated into the UK system, through the Department for Work and Pensions. Once Great Britain moves entirely to the new system, based around universal credit, Northern Ireland will no longer have access to the DWP computer systems on which it currently relies to assess and deliver people’s benefits. It would be left with no option but to devise, implement and maintain an entirely separate and more expensive system and meet the massive costs of the IT needed to support it. For a small devolved Administration, that cost would be prohibitive.

The Secretary of State is explaining well the need for emergency legislation, and although it is not desirable to pass legislation in one day, it is far more desirable than the Assembly collapsing from not having a viable budget and all legislation having to come back here.

My hon. Friend makes a fair point. We have to get a move on with implementation. We do not want the “Fresh Start” agreement to suffer the same fate as the Stormont House agreement, implementation of which stalled relatively early on. It is important we do all we can to move ahead with implementation.

Is this not a massive climbdown by the Government? I say good luck and well done to the parties that stood out against the Government and their nasty welfare reforms. Should the Government not now fund a welfare system on the mainland in the same way as they are funding one in Northern Ireland with a £500 million bung to places such as Newry, Belfast and Omagh?

I would describe the outcome of the cross-party negotiations as a sensible compromise. The welfare reforms we have introduced in Great Britain, which we think are a better system, will be implemented in Northern Ireland, but from its own resources—from the block grant. The Northern Ireland Executive have made the reasonable and legitimate decision to top up some of those benefits.

I go back to my previous remarks. The cost of a computer system would be massive. Budgets for other Departments would have to be cut significantly to pay for a more expensive welfare system, with an inevitable impact on front-line services and capital spending available for crucial infrastructure such as road improvements, almost all of which would probably be swallowed up by the need to build a new computer system. That scenario would undermine the credibility of the devolved institutions but, even more importantly, do irreparable damage to the political relationships that are central to making power-sharing devolution work in practice.

Last December in the Stormont House agreement, the Northern Ireland parties agreed to take forward welfare reform as part of a wider package of measures. It is well known, however, that by March this year progress had begun to founder, when the two main nationalist parties withdrew their support for the Assembly legislation on welfare reform. On 26 May, that legislation passed its final stage, with the backing of three of the five main parties then in the Executive, but was blocked by the other two parties using the petition of concern, meaning that it did not have the necessary cross-community support, so by June we were once again faced with almost complete deadlock. The Executive then passed a budget that was based on an assumption that welfare reform would ultimately be adopted, but which would exceed the controlled totals available from the block grant if it was not.

The Secretary of State might add that Northern Ireland has achieved a better deal in terms of welfare payments, and it could have done so a year ago if parties had not tabled the petition of concern and instead supported the changes. Now we have people on the mainland complaining that we have a better deal, but that is because we negotiated it, and it could have been operational a year ago. It is Sinn Féin that has done the U-turn, no one else.

The hon. Gentleman is right to say that the arrangement could have been reached some time ago, but the important thing is that we have got to a sensible compromise. As for this being a good deal for Northern Ireland, I agree that the combined financial package—£2 billion under the Stormont House agreement and a further half a billion pounds or so under this agreement—will help Northern Ireland and will be a good deal, but it is aimed specifically at the challenges that are unique to Northern Ireland, such as dealing with peace walls, paramilitary-related crime and the terrorist threat.

I wonder whether she could enlighten the House as to what exactly persuaded Sinn Féin, after all these weeks of arguing, rowing and opposing the welfare reforms, to do the deal last week? What was the turning point?

I promise to speed through the remainder of my remarks. The hon. Lady may wish to direct that question to Sinn Féin, but at the heart of it I think Sinn Féin, like the other parties in the Executive, really wanted to make devolution work and realised that, without compromise on welfare questions, the Executive would not have a sustainable budget and that pretty soon that would mean no effective devolution at all.

Last year we made it clear that, if the welfare issue were not resolved, we would have to legislate here to deliver welfare reform in Northern Ireland, even without the consent of the Assembly, but we acknowledged that that was a last resort, and we made resolving the issue a key goal of the talks getting under way. As the House will be aware, they began on 8 September and successfully concluded 10 weeks later, last Tuesday, resulting in a new agreement, called “A Fresh Start: The Stormont Agreement and Implementation Plan”, which has been endorsed by the Northern Ireland Executive. In that agreement the Executive made a commitment to passing a legislative consent motion asking Westminster to legislate on its behalf for welfare reform. That motion was debated and passed by the Assembly last Wednesday with a majority of 70 to 22. It was supported by the First and Deputy First Ministers, and because it was backed by their respective parties—the DUP and Sinn Féin—it had the necessary cross-community support to succeed. The LCM therefore represents the clearly expressed will of the Northern Ireland Assembly that we in Westminster deliver this legislation.

The Assembly has moved quickly and decisively to deliver on its side of this crucial aspect of the “Fresh Start” agreement. It is now the responsibility of the Government to deliver on our side of that deal. We need to retain that momentum in the House; we cannot afford another stalled implementation process of the kind that occurred earlier this year. As both sides of the House acknowledged during my statement last week, if that were to happen, it is likely that early Assembly elections would result, followed by a real risk of suspension and direct rule. After all that has been achieved in Northern Ireland in recent years, that would be a very severe setback. It could take several years to re-establish devolution.

I urge the House to support the motion and the Bill that we shall debate shortly. In tabling this allocation of time motion, the Government have guaranteed six hours on the Floor of the House today for consideration of what is a very short Bill. I believe that will give us the opportunity to scrutinise all the tabled amendments and new clauses. With that in mind, I cannot support the SDLP amendment to the allocation of time motion, and if it is pressed to the vote, I must ask my colleagues to oppose it.

The motion as drafted reflects the long-standing practice of the House. Expedited legislation for Northern Ireland is by no means unusual. In fact, the last Northern Ireland Bill was very unusual and did not involve an expedited timetable. Withdrawing the amendment to the motion would allow us more time for debate on crucial amendments and new clauses as the debate continues this evening.

I also highlight the fact that the six hours of today’s debate is just one part of a much longer process. If the Bill passes, it will be followed by debates in both Houses to approve the Order in Council to be made under the powers contained in the Bill. It is also the case that the welfare legislation that it will enable us to introduce has been considered in depth in the context of its application in Great Britain and debated in this House on many occasions. The order, published alongside the Bill, reflects the draft legislation for Northern Ireland that was debated at very great length in the Assembly. As I said earlier, it went through no fewer than six stages of scrutiny stretching over three years, plus the recent debate on the LCM.

These measures have therefore been very extensively considered and scrutinised in the Assembly, as well as being the major focus of two sets of cross-party talks lasting for a total of 21 weeks this year and last. None of the contents of the measures will come as a surprise. They are a crucial part of an agreement that is vital to the stability and survival of devolved government in Northern Ireland—an agreement that genuinely offers a fresh start for Northern Ireland and its devolved institutions. It is vital that we implement it as a matter of urgency. That is why I am asking the House to adopt this emergency procedure today. I commend the motion to the House.

I thank all right hon. and hon. Members who have taken part in the debates this evening, and all the Members of the Legislative Assembly and others who have settled the question of welfare reform in Northern Ireland.

This Bill fulfils an important commitment made following the recent political talks, which culminated in the “Fresh Start” agreement. The enabling power contained in the Bill paves the way for the introduction of a modern, reformed welfare system for Northern Ireland. The Government’s welfare reforms have at their heart the principles that it should always pay to work and that the vulnerable will always be protected. The benefits cap will ensure that no one household can claim more in benefits than the average family can bring home by going out to work. This is welfare support when people need it, not welfare support as a way of life.

The legislation will help us deliver our long-term economic plan. It will replace a system that was not working, a system that was not fair to the people trapped in dependency and poverty, and not fair to the hard-working taxpayers who paid for it. An unreformed welfare system was not sustainable in Great Britain and it is not sustainable in Northern Ireland. I believe that the reforms that this Bill will allow us to implement will help more people in Northern Ireland to get on because it will enable them to get into work, with the dignity of a job, the pride of a pay packet and the peace of mind that comes from being able to support their family. As in Great Britain, the reformed system will help people to make the journey from dependence to independence, providing more opportunity and greater security.

Before I conclude, I want to be clear that this Bill and the Order in Council that is to follow do not represent the Government taking a decision to impose something on Northern Ireland, but rather what the Northern Ireland Executive have agreed and what the Northern Ireland Assembly supported in its recent LCM vote. Together with the top-ups that the Executive will implement and fund from the block grant, Northern Ireland will have the most generous welfare system in the United Kingdom and one of the most generous in the world.

We have been having the debate on welfare reform in Northern Ireland for nearly four years. The dispute over the budget has been a drag anchor on Northern Ireland politics for too long, and it is time to get this matter settled. I firmly believe that without these questions of financial sustainability being resolved once and for all, we would be on an inexorable path to direct rule, and that is an outcome that nobody in this House wants. The Stormont House agreement ran into trouble at the implementation stage. This is our chance to learn from experience in trying to ensure that the “Fresh Start” agreement stays on track and plays its part in delivering effective, confident and stable devolved government for Northern Ireland. I commend the Bill to the House.

With permission, Mr Speaker, I would like to make a statement on the agreement reached this week in the cross-party talks at Stormont, but first I would like to pay tribute to Peter Robinson, who announced this morning that he will soon be standing down as First Minister and leader of the Democratic Unionist party. Peter has been a central figure in Northern Ireland politics for over four decades. He has a long and distinguished record of public service in both this House and the Assembly, and he has championed the interests of Northern Ireland with unparalleled effectiveness, determination and dedication. He was key to the agreement reached this week and he can be rightly proud of his contribution. I am sure the whole House will join me in wishing him a long and happy retirement.

Last December, the Stormont House agreement was reached after 11 weeks of negotiations between the five largest Northern Ireland parties and the UK and Irish Governments. The agreement addressed some of the most difficult challenges facing Northern Ireland, including the finances of the devolved Executive, welfare, flags and parades, the legacy of the past, and reform of the Assembly to make devolution work better. All this was underpinned by a financial package from the UK Government that would give the Executive around £2 billion in extra spending power.

In the Government’s view, the Stormont House agreement was, and remains, a good deal for Northern Ireland. By the summer, however, it was clear that implementation had stalled. There were strong differences of opinion within the Executive over the budget and the implementation of the welfare aspects of the agreement, and these were preventing other elements of the agreement from going ahead. We were facing a deadlock, which, left unresolved, would have made early Assembly elections more and more likely, with an ever-increasing risk that collapse of devolution would follow. After all that has been achieved in Northern Ireland over recent years, a return to direct rule from Westminster would have been a severe setback, and it is an outcome that I have been striving to avoid.

In August, a second issue arose to threaten the stability and survival of devolution. The suspected involvement of members of the Provisional IRA in a murder in Belfast raised the spectre of paramilitary activity in Northern Ireland and its malign and totally unacceptable impact on society. Faced with those circumstances, we concluded that it was necessary to convene a fresh round of cross-party talks with the five main Northern Ireland parties and the Irish Government on matters for which they have responsibility, observing the well-established three-strand approach.

Those talks began on 8 September and have run for 10 weeks. The objectives we set were twofold: first, to secure the implementation of the Stormont House agreement and, secondly, to deal with continued paramilitary activity. I believe that the document published on Tuesday entitled “A Fresh Start: The Stormont Agreement and Implementation Plan”, makes real progress towards fulfilling both of those hugely important objectives. Crucially, it tackles the two issues that have posed the greatest threat to the stability and survival of devolution in Northern Ireland.

Let me turn first to the Stormont House agreement. The new agreement will help to give the Executive a stable and sustainable budget, assisted by further financial support of around £500 million from the UK Government. These funds are to help the Executive to tackle issues that are unique to Northern Ireland. They include support for the Executive’s programme of removing so-called peace walls and £160 million to assist the Police Service of Northern Ireland in its crucial work to combat the threat from dissident republican groupings. The package also paves the way for completion of the devolution of corporation tax powers to the Northern Ireland Executive— something that could have a genuinely transformative effect on the Northern Ireland economy and on jobs and prosperity. The measures in the Stormont House agreement designed to address issues around flags and parades will now go ahead, and there is agreement on reforms to the Executive and Assembly to make devolution work better, including on the size of the Assembly, the number of Government Departments, use of the petition of concern and provision for an official opposition.

Secondly, the agreement takes Northern Ireland’s leaders further than ever before on the issue of paramilitary activity. It strongly reaffirms the commitment to upholding the rule of law and makes it absolutely clear that in no circumstances will paramilitary activity ever be tolerated. The agreement places new shared obligations on Executive Ministers to work together towards ridding society of all paramilitary groups and activities, and challenging paramilitarism in all its forms. It commits all participants to a concerted and enhanced effort to combat organised and cross-border crime, which the UK Government will help to fund.

A key element of the Stormont House agreement on which we were unable to agree a way forward was the establishment of new bodies to deal with the legacy of the past. We did establish common ground between the parties on a range of significant questions about how to establish those important new structures, but sadly not enough to enable legislation to go forward as yet. The Government continue to support these provisions because of the pressing need to provide better outcomes for victims and survivors—the people who we must never forget have suffered more than anyone else as a result of the troubles. So it is crucial that we all now reflect on what needs to be done to achieve the wider consensus necessary to get the new legacy bodies set up.

I want to emphasise that, in very large part, the agreement published on Tuesday takes on board a wide range of points made by all five Northern Ireland parties during the 10 weeks of talks just concluded. As the overwhelming majority of issues were in the devolved areas, this agreement has rightly been driven by Northern Ireland’s elected leaders, in particular by the First and Deputy First Ministers. I would like to reiterate my sincere thanks to them and to all the five Northern Ireland parties who worked with determination and commitment in the talks. Thanks also go to the Under-Secretary of State for Northern Ireland, my hon. Friend the Member for Wyre and Preston North (Mr Wallace) and of course to Ministers Charlie Flanagan and Sean Sherlock from the Irish Government, who all devoted many long hours to this process and made an invaluable contribution to its successful outcome.

Implementation of this week’s agreement is already under way. On Tuesday, the Executive voted to support it; yesterday, the Assembly passed an legislative consent motion on welfare legislation at Westminster; and the Northern Ireland welfare reform Bill will be introduced to Parliament later today. I believe this package as a whole gives us the opportunity for a fresh start for devolution. It is a further stage in delivering the Government’s manifesto commitment to implement the Stormont House agreement, and it is another step towards a brighter, more secure future for everyone in Northern Ireland. I thank the Secretary of State for her statement and her usual courtesy in allowing me early sight of it. I join her in paying tribute to Peter Robinson, who has announced that he is to step down. His contribution to peace and progress in Northern Ireland has been immense. He has taken tough decisions and tried to reach out to all communities. Northern Ireland is a better place in no small part thanks to his immense work. I join the Secretary of State, as I know all Members would, in wishing him well for the future.

I begin by complimenting all those who have contributed to this document, including the UK and the Irish Governments. It is a document that, despite some obvious challenges and indeed omissions, once again offers Northern Ireland a way forward. It is one more stepping stone towards the brighter, better future that the people of Northern Ireland want and deserve.

Does the Secretary of State agree that it is the implementation of the agreement that is crucial and that the people of Northern Ireland do not want to be faced in a year or two with another crisis? This really has to be a fresh start. Is she, like me, confident that the measures contained in the agreement really offer a way forward in a number of areas? In particular, we welcome the commitment to bring an end to paramilitarism. Paramilitary activity has to end, and the proposal for a new strategy to bring this about, overseen by a panel, is critical. Is the Secretary of State, like me and many people I meet in Northern Ireland, worried about these groups and their particular attraction to some young people. Apparent easy money, lack of career opportunities, educational under-achievement and indeed a false belief that membership of such groups can provide status are all aspects that need to be tackled so that many of these young people can grow up in relative peace. Will the Secretary of State use her position to ensure that countering the attraction of these groups for young people is one of the strategic priorities, as I believe it should be?

In relation to the establishment of the joint agency task force, will the Secretary of State say more about how cross-border co-operation will work, what resources there will be for the PSNI, and, crucially, whether she expects the number of prosecutions to increase? I welcome her confirmation that work will be undertaken in respect of flags and parades. Does she agree that that work is both urgent and crucial?

Does the Secretary of State share my disappointment that it has not been possible to reach an agreement on legacy issues and the past? Will she say more about what the issues were, and how she believes they can be resolved? How, for example, will the clash between national security considerations and disclosure be resolved? Victims and survivors must clearly be a key part of any agreed process. I understand that dealing with the past is incredibly difficult, given the competing narratives and contested versions of events, but a comprehensive approach is critical to continuing progress in Northern Ireland.

The problem with the search for truth and justice is that they often seem to be unattainable possibilities, but is it not the case that the people of Northern Ireland and their politicians have arrived at compromises that were apparently impossible, and have built consensus where none seemed likely?

Will the Secretary of State ensure that further efforts are made to deal with the past? What plans has she to meet victims and victims’ groups, and discuss a way forward? Given that no agreement has been reached on the issue, will funds be provided for the PSNI so that it can continue its legacy work?

The House has been asked to legislate on welfare reform. We will not oppose those measures, but a programme for jobs and growth is also needed in Northern Ireland, as it is in the whole of the UK. What measures in the agreement, over and above the devolution of corporation tax, will provide such a programme, while also improving the infrastructure?

As I said at the beginning, I see this agreement as a stepping stone towards a shared future. Of course there are frustrations and disagreements—of course there is disappointment at the inability to reach agreement on legacy issues—but could not the alternative have been a situation in which the devolution settlement itself was at risk with a return to direct rule—both those outcomes are unthinkable?

Whatever people may consider to be the agreement’s imperfections or disappointments, there is another breathing space: there is another opportunity for Northern Ireland to move forward, combat criminality, banish paramilitarism, tackle sectarianism, and establish a Government that is stable financially and politically. That opportunity must be grasped, outstanding issues must be resolved, and a fresh crisis in a year or two must be avoided.

Experience leads me to agree with the hon. Gentleman that implementation is key, and that reaching an agreement is just the start of a broader process. However, I warmly thank him for his support for this agreement and the Stormont House agreement. I also agree with him that a strategy to end paramilitarism in Northern Ireland must include programmes for young people to ensure that they are not drawn into activity of this kind. We had some constructive discussions about that during the talks, and I am sure that it will form part of the strategy foreseen in the agreement.

The hon. Gentleman asked about the task force, the surge in criminal activity, and the cross-border work. That work will be based on structures that already exist, but it will involve renewed vigour and activity, and there will be £25 million of additional funding to support action against paramilitarism. The UK Government are determined to do all that we can to work with the devolved bodies, the Minister of Justice and, of course, the Irish Government and the relevant agencies there. The PSNI and the Garda are working together, which is crucial. They do tremendously effective work now, and I am sure that the existing levels of co-operation will rise still further in the future. I agree with the hon. Gentleman that progress on matters relating to flags and parades is urgently needed. One of the aspects of the agreement that I welcome most is the fact that it allows that progress to be made.

I share the hon. Gentleman’s disappointment that we were unable to reach a conclusion on the legacy issue. However, we did make progress on, for example, the role of the implementation and reconciliation group and its relationship with the other legacy bodies, and on a number of aspects relating to how the Historical Investigations Unit will work and the devolution of responsibility between the HIU and its director. I think that we made significant improvements to how proposed draft clauses might work by clarifying the role of the Department of Justice. We had many discussions on national security. We did not manage to find a solution to that to which everyone could sign up, but I am sure that the shadow Secretary of State will agree it is crucial that we ensure that we do nothing to jeopardise national security.

I agree that an important way forward from now on is to meet victims groups, and I will be doing that soon. I also hope that I will be able to meet the victims commissioner soon to discuss the best way forward because we need to find a way to get these bodies set up.

I welcome the shadow Secretary of State’s indication that he will not be opposing welfare reform. He is right to state that it is crucial that we do all we can to promote jobs and prosperity in Northern Ireland. A crucial way to do that is to ensure that the Executive have sound public finances. There have been many illustrations in recent years of the hugely negative effects Governments face if they cannot make their budgets add up, so getting the Executive’s budget on a sustainable basis and ensuring that it is delivering effective government for Northern Ireland is a crucial way to deliver the prosperity agenda, which is so important for Northern Ireland’s successful future.

I congratulate the Secretary of State on her achievement in bringing the parties to an agreement. I know that she has put an enormous amount of time, effort and indeed patience into the negotiations. In her statement, she referred to the importance of ensuring that young people do not get drawn into paramilitary activity. Does she agree that one way in which we can try to help with that is through improving and increasing integrated education? I understand that some funds were made available in the Stormont House agreement for those purposes and that there are projects waiting to start. Does she think that, with this agreement, that funding will now be available for those projects?

I thank my hon. Friend for his kind words. He is right that integrated education is a crucial means to address sectarian division in Northern Ireland, as is shared education. There are funds available in the £2 billion Stormont House agreement package, which will now be released. We are contributing to a £60 million programme to promote confidence-building measures to see the interface barriers, or so-called peace walls, taken down. That is another way to bring communities together, which is a key part of ensuring that paramilitary groups disband once and for all and are no longer part of Northern Ireland’s present day.

May I associate myself and my party with the Secretary of State’s remarks about Peter Robinson and his four decades of service?

I congratulate the Secretary of State, the Irish Government and the Northern Ireland parties on coming to this agreement. It should be hailed a success. It would have been easy for any politician to have stumbled during this.

The additional funding in recognition of the particular problems in Northern Ireland, a legacy of the troubles, is welcome and the welfare provisions equally so. The bedroom tax will not be applied, nor will some sanctions. I wonder whether after today’s proceedings the Secretary of State might set out the differences between the two welfare systems, in written form, to allow us a better understanding.

Part of the funding for the welfare package, if I have understood correctly, will come from savings made through tightening up on error and fraud. Given the role that welfare reforms played in creating the recent difficulties, is there an alternative plan if those savings are not realised? I say, in passing, that the inclusion of a sunset clause in the Bill is welcome as a sign that the UK Government do not intend to continue to exercise control over the welfare system.

I note the substantial commitments made by the Irish Government in this agreement and their desire to improve links to, and economic development in, the north. I welcome those commitments and their commitments to assisting in ending paramilitary activity. That commitment on all sides is particularly welcome and interesting. I wonder whether the Government are in a position to explain what they see as being the scale of paramilitary activity in Northern Ireland and whether it is mainly a criminal undertaking now? The signs, though, from this agreement are good and I offer the support of my party in helping to make it work.

I am very grateful to the hon. Lady for her support for the agreement. As the Leader of the House said, it is crucial that we see support in all parts of the House for this agreement, which will signal a way forward for the devolved institutions.

The hon. Lady kindly mentioned the Irish Government. I share her sentiment that Minister Flanagan and the Irish Government have played a very important role. Indeed the process was also strongly supported by the US Government, with Senator Gary Hart playing a constructive role throughout, which was much welcomed.

The hon. Lady asked about the differences in the welfare system. The proposal in this agreement, reflecting the Stormont castle agreement back in December, is that the system applicable in GB will apply, but benefits will be topped up by the Northern Ireland Executive drawing on funds from the block grant. Under this agreement, rather than write that all in advance, a fund has been agreed and a panel will be set up to decide how to allocate those funds, but one of the areas to which those funds will be devoted relates to the social sector size criteria.

The hon. Lady asked about the programme for making savings in error and fraud in welfare. I believe that that could save significant amounts of money and the Northern Ireland Executive believe that it will save very substantial amounts of money. The agreement makes it clear that half of any savings resulting from this can be shared by the Northern Ireland Executive and used for whatever purposes they deem appropriate.

The sunset clause is an important part of the legislation that we will consider next week. These are exceptional circumstances; we must urgently take action to enable the Northern Ireland Executive’s finances to be put on a sustainable basis, but there is no justification for the powers to be extended into the future. The key challenge comes in the next year or so, and that is why the sunset clause has been inserted.

In relation to the hon. Lady’s question on the scale of paramilitary activity in Northern Ireland, I direct her to the assessment we published a month or so ago making it clear that, very unfortunately, members of paramilitary organisations in Northern Ireland are extensively involved in a range of criminal activities, such as drug dealing, money laundering and in some cases murder as well.

May I add my thanks to Peter Robinson? I met him first in 1970, when he was an aspiring politician and I was aspiring to be a halfway decent infantry officer. I liked him then. He is honest, he is straight, he knows how to talk to soldiers, and he is in no small part responsible for the decent situation we now have in Northern Ireland. I thank him, with all my colleagues, for what he has done in his work.

I am delighted to associate myself with those comments. Peter has done a huge amount of work for the good of Northern Ireland. He has achieved many things in his long career in public life, and Northern Ireland is the better place for his input into public life and politics there over four decades.

May I, on behalf of my right hon. and hon. Friends, thank the Secretary of State, the shadow Secretary of State and those other Members who have paid tribute to Peter Robinson today? There is no doubt that, as far as we are concerned, words are not adequate to convey the thank you that we as a party—and everyone who values progress in Northern Ireland—owe to him for the work he has done not just recently, but over a lifetime of dedicated service to Northern Ireland. When one thinks back over the years to the dark days when politics was a dangerous occupation—it remains so for some—one realises that we owe an enormous debt of gratitude for the sacrifices he and his family have made to make progress in Northern Ireland. We thank him sincerely for all he has done.

Today’s agreement is, of course, another tribute to the work Peter and others have done to try to move Northern Ireland forward. There will, of course, be snipers—there will be those who will want to downgrade this agreement—but the reality is that without this agreement, devolution would fail. We would be back to direct rule, which is, effectively, as far as Unionists are concerned, joint rule with Dublin. That is a far less appealing vista. What we have instead is an agreement that will provide a fresh start, allow us to move forward and put the budget on a sustainable footing.

Does the Secretary of State agree that we will now have the best welfare system in the United Kingdom? Help will go to the people who will be affected by the working tax credit cuts. That is something that those who voted against or sniped at the welfare changes need to bear in mind.

On paramilitaries, we are determined that a blind eye will never be turned to violence or to the actions of the paramilitaries.

On the legacy of the past, I share the right hon. Lady’s disappointment that an agreement could not be reached, but it is right that we should never allow a hierarchy of victims to be created and that we should not allow those who were so-called victims of the state to be elevated above the victims of the paramilitaries. She is right to hold the line, along with us, in protecting national security. I want to thank everyone involved for the work that has been done to achieve this milestone agreement.

I should like once again to pay tribute to the work of the right hon. Gentleman and his party on achieving this agreement. He is absolutely right—as was the shadow Secretary of State—to say that if this process had failed, we would have been staring direct rule in the face, and I would have had to head off and write a programme for Government. We would have had to prepare for office. As the right hon. Gentleman said, there are always parts of these agreements in which one would have liked to go further and difficult compromises that have to be made, but the crucial point is that this agreement will secure the continued operation of devolution. Without it, there would have been a real danger of suspension, collapse and a return to direct rule. I believe that this can be a fresh start.

On the right hon. Gentleman’s question about welfare, he is right to suggest that at the end of this process, Northern Ireland will have the most generous welfare system in the United Kingdom. Indeed, it will be one of the most generous in the world because, for all the reforms that have taken place, this country retains a generous welfare system across the board, and rightly so. It is crucial that we get this agreement implemented and ensure that it sticks, and I will be working with the right hon. Gentleman and with all the five Northern Ireland parties to do my best to ensure that that happens.

Northern Ireland is a long way from Essex, but I am sure that everyone is very pleased that that important part of the UK can have the fresh start that it deserves. Does the Secretary of State agree that this agreement will provide Northern Ireland with a safer, more secure future and put an even greater distance between the past and the present, which will benefit the whole of the UK?

I believe that strongly. This agreement will pave the way for a safer, more secure future. Returning for a moment to the previous question, it is important that we strive to find a way to resolve our differences on the legacy bodies. We must ensure that when the bodies are set up, they are entirely fair, proportionate and balanced and that they do not focus disproportionately on just a handful of cases in which the state was involved. This Government will do all that we need to do to protect our national security; we will not compromise on that in any circumstances.

Will the Secretary of State accept that, while many of us have misgivings over parts of the agreement, including over what is not in it, that does not in any way detract from our support for its positive aspects, which we have long advocated, and which we advocated in the negotiations, including the whole-community approach to paramilitaries and the signing up by all parties to a uniform position on eradicating paramilitarism from our society? She said at the talks, as she has said publicly and consistently, that there would be no agreement on the past without an agreement on welfare reform—that that was the hard message for Sinn Féin and the Social Democratic and Labour party. However, we have now apparently ended up with an agreement on welfare reform but with no agreement on the past. People want to know how that came about. Would she consider publishing clauses on the past, on a without-prejudice basis, and committing them for pre-legislative scrutiny by a Joint Committee of both Houses, so that they could be the subject not of some sort of private abeyance to be sorted out between herself and Sinn Féin but of proper consideration by Members of both Houses here and by the public in Northern Ireland, particularly the victims?

On the way forward on the institutions dealing with the past, we will certainly give consideration to the proposals the hon. Gentleman puts forward. I think we all recognised that it was difficult to reach the conclusions we needed to get to within a structure containing just the parties. We need to reflect on whether we can have a wider, more inclusive process. Of course we will give consideration to whether we can publish a further draft of the Bill in the future, but we have not made a conclusive decision on this.

The hon. Gentleman talked about the linkages between the past and welfare reform. To the end, I was arguing to keep legacy in, and I wish we had been able to do so; even if we could not agree on all the issues relating to legacy, I had hoped that we would be able at least to agree on a fair selection of areas where consensus had been achieved. I could not get everyone to sign up to that, but I will continue to strive to find a way to get these legacy bodies set up, as that is crucial for victims and survivors.

Lastly, I pay tribute to the work that his party did in the talks process, particularly on the legacy matters, but also on paramilitaries. The Social Democratic and Labour party’s call for a whole-community approach to ending paramilitarism will resonate in this House and across Northern Ireland.

In welcoming this deal, may I ask the Secretary of State to say a little more about what sounds like £500 million of new funding for Northern Ireland outlined in her statement? Will she go a bit further by saying that if there are any further disputes between parties in Northern Ireland, they will not be fixed by more money from Westminster?

In these extremely difficult days for the public finances, we thought very carefully about what additional support we were able to provide on top of the Stormont House agreement package, but we did feel that a case had been made credibly and strongly to us that Northern Ireland does face unique challenges in the United Kingdom and that therefore there was a case for additional support, on top of the favourable conditions in relation to the block grant. That breaks down roughly as: £160 million of additional security funding for the PSNI to help it counter dissident republican terrorists and paramilitary groups; £25 million for tackling paramilitary activity and strategy; £3 million for a verification body in relation to paramilitary activity; £60 million for programmes to build confidence and see inter-faith barriers coming down; crucially, as a result of the legislative consent motion passed by the Assembly last night, the savings forgone payments—sometimes referred to as welfare penalties—will stop, and that means that a further £40 million will be added to the block grant for the next two years; and we also have £125 million to support a programme to eliminate fraud and error, which we have already discussed. The Executive believe that that will yield substantial savings, half of which they are allowed to retain, and that that is likely to take the total value of the package to well over half a billion pounds.

May I associate myself with what those who have spoken have said about the contribution made by Peter Robinson, who has announced his retirement from active politics? I have engaged in Northern Ireland affairs throughout my time in this House, but particularly between 2001 and 2010, when our service overlapped. We did not always agree when we had matters to deal with, but there was no doubting at any point that Peter Robinson was a man who was staunch in support of his community and his party. On behalf of my colleagues, I send him and Iris our very best wishes for a long retirement.

May I also add my congratulations to the Secretary of State on an agreement for which there must be a broad welcome, given the context of it? I should, however, say that it is regrettable that significant areas remain outstanding, and I agree with her in respect of the legacy issues she listed. Will she assure us that the budget for dealing with these legacy issues will not be taken from the current operational budget of the Department of Justice? What discussions has she had with the Minister of Justice on that so far?

I keep in regular touch with the Northern Ireland Minister of Justice on all these matters. Of course it is crucial that we all work together to try to ensure that the policing and criminal justice system is as properly resourced as possible. That is one reason why additional security funding was provided in the last spending review. We have now announced further additional security funding for this forthcoming spending review period.

I should also point out that the legacy funding provided in the £2 billion package of the Stormont House agreement amounts to £150 million. It was a priority to try to relieve the pressure on the PSNI so that it could devote its resources to policing the present rather than the past. Naturally, that £150 million package is delayed for the moment pending the establishment of those legacy bodies. The money is still there on the table, and it is another reason why we should get on and try to find an agreement to set up those bodies, so that that funding can be used. As the right hon. Gentleman said, it is a matter of regret that we have not yet been able to reach consensus on how we establish those bodies, but we will continue to work on that with his party and others to try to find a way forward.

I congratulate my right hon. Friend on her patience and diligence in delivering this much needed package. I also wish to pass on my appreciation to Peter Robinson as he takes a well-deserved retirement. I met him at university many years ago, and he has been in public life ever since. What a remarkable job he has done.

In her statement, my right hon. Friend referred to the devolution of corporation tax. Will she clarify when that will happen and whether it is contingent on any other measures that will need to be implemented?

The Government’s position is that we will give the final go ahead for the devolution of corporation tax once the conditions on financial sustainability in the Stormont House agreement are met. We have already passed the legislation to enable us to do that. We just need commencement of that legislation to enable the transfer of power to take place. The agreement published this week sets out the aim of the Northern Ireland Executive to deliver a reduced rate of corporation tax operating from April 2018. I know that we are all working on that and hoping that that target date will be met.

I thank the Secretary of State for bringing forward her statement today. May I, too, pass on some words to Peter Robinson to wish him well in his retirement and in future years?

In her statement, the Secretary of State suggested that the involvement of members of the Provisional IRA in a murder in Belfast led to the conclusion that it was necessary to convene a fresh round of cross-party talks. How concerned is she now that all those involved in the discussions, including Her Majesty’s Government, the Irish Government, the Democratic Unionist party, the Social Democratic and Labour party, the Ulster Unionist party, the Alliance party and others, all accept that the IRA is still in place, but Sinn Féin does not?

The crucial issue is that all participants in the talks process are absolutely clear that there is no justification whatever for paramilitary groups in Northern Ireland, that they must all disband, and that for that to happen we need not just a surge in criminal justice activity, but a broad approach that embraces the whole community in working for the day when those organisations are consigned to Northern Ireland’s past rather than its present.

Indeed. It is something for which the Conservatives have been campaigning for many years, particularly during the tenure of my predecessor as Secretary of State, my right hon. Friend the Member for North Shropshire (Mr Paterson). It is a big step forward that there will be more formal provision for an Opposition. I thank my hon. Friend for his kind comments about the officials of the Northern Ireland Office, all of whom have worked tremendously hard during this talks process and the previous one.

I echo the comments that have been made from all parts of the House in relation to the retirement of my party leader, Peter Robinson. I add my personal tribute to the contribution he has made over many years to the politics and the people of Northern Ireland. I thank the Secretary of State for the hard work that she and her team put in during these talks, and commend her for the progress that has been made. I welcome the constructive tone of the comments from the hon. Member for Foyle (Mark Durkan). We now need to build on the progress that has been made and work towards delivering for the innocent victims and those who have suffered so much. Let us look at ways in which we can find an agreement to implement the legacy elements. What we cannot do, especially at this time, with our national security threatened by terrorism, is compromise the work of the security services who are here to protect every single citizen of this country.

These national security questions are very difficult. We reflected hard on whether we could stretch ourselves to find a way through on this, but we have not been able to so far. The right hon. Gentleman is right: we cannot take risks with our national security. There is documentation that could be disclosed in Northern Ireland which would give support, knowledge and expertise to terrorists, not just in Northern Ireland but around the world, so I am always aware of that being a hugely important part of my role. The role of a Government—our first duty—is to safeguard the security of our citizens; sadly, events over the past fortnight or so have demonstrated how important that duty is.

I welcome the investment in policing, but can she say a little more about what steps the Executive will be taking to reform the public sector and ensure a more sustainable financial approach into the future?

The Executive have already embarked on a very significant reform, funded by a voluntary exit scheme, which will see the Northern Ireland civil service contract considerably. These are difficult decisions, but I believe that with reform in the coming months and years, the Executive will be able to release more funds for crucial front-line services, and I very much welcome the announcement of significant additional funding for healthcare that the Executive announced today.

I begin by congratulating Peter Robinson on his retirement and on the hard work that he has put in since the agreement. I congratulate the Secretary of State, too, on her hard work, and my hon. Friend the shadow Secretary of State on his sensible comments. All parties involved in the agreement have shown how important the Northern Ireland situation and this deal in particular are to the House and to the security of the wider UK. Does the Secretary of State agree that there is no alternative to the deal? In order to avoid direct rule, the deal was crucial for the peace process in Northern Ireland to continue. Does she agree that by avoiding direct rule, she has provided the largest and most significant step in controlling, monitoring and dealing with any potential future paramilitary activity in Northern Ireland?

I think I can agree with all that. Devolved power-sharing government requires two crucial things, the first of which is the ability of parties to work together. The paramilitary question was having a toxic impact on working relationships. Another crucial thing for any Government, devolved or not, is a workable budget. They must be able to live within their means. This agreement today sets a path to addressing both of those. As has been said, there are parts that we would all have liked to see added to the agreement and there are compromises in it. These stages in Northern Ireland’s process forward are never without their imperfections, but this is a good step forward for Northern Ireland. Without it, I am convinced that we would be headed steadily and surely towards suspension and direct rule, which would be bad for Northern Ireland. We have worked hard to try to avoid that and will continue to do so.

There is a timetable for the commission to report on flags. I believe the plan is for it to report within 18 months but, if my hon. Friend will forgive me, I cannot remember the exact date. It is another reminder that with the Stormont House agreement and the fresh start agreement in place, we need to get on with implementing them. That is why I welcome the fact that the legislative consent motion was passed yesterday and the Bill will be introduced to Parliament within minutes and debated. The debate on the welfare legislation will take place early next week.

I, too, thank the Secretary of State for her statement and for the very kind tribute that she paid to our party leader. I echo the thanks and gratitude to the Secretary of State and her team, for I know the very long hours that she personally has put into dealing with the situation in Northern Ireland. There will, of course, be some nay-sayers in Northern Ireland about this deal, but will the Secretary of State go as far as to say that this is by far the very best welfare deal that anyone in the United Kingdom could have? We know that there will be some people who hate the deal so much that they will be on their knees tonight in Northern Ireland praying that Scotland comes up with a slightly better deal so that they do not have to welcome it, but over 105,000 low-paid families in Northern Ireland will today be grateful that their tax credits will not be cut in the way that they would have been under another deal or under direct rule.

On national security, will the Secretary of State confirm that there is no change whatever to the national security portfolio and arrangements? Although there is £160 million available to assist the police in dealing with the dissident and Irish terror threat, if ISIS uses our border as a soft way into the United Kingdom, can the right hon. Lady confirm that additional resources will come from the national budget to assist with that?

I can confirm that if the welfare legislation goes ahead and the Executive proceed with the top-ups proposed under the agreement, Northern Ireland will have the most generous welfare system in the UK. I can also confirm that we are not proposing changes on national security. It continues to be a tier 1 priority for us. We recognise the lethal threat posed by dissident republican terrorists. Thankfully, they seldom succeed in their aims to harm, but there is no doubt that that activity is regular and that these groups have both lethal intent and lethal capacity, and it is only by the efforts of the police and their security partners that we do not see dissident republicans succeeding in more of their evil plans.

The hon. Gentleman is right to highlight the concerns about ISIL being a factor in Northern Ireland, just as it is everywhere else in this country and beyond. Of course, we as a Government are absolutely focused on our efforts to keep people safe both from the DR threat and from the ISIL threat, and that includes work on cross-border crime and doing all we can to ensure that neither ISIL nor anybody else is able to exploit our border with the Republic of Ireland for criminal or terrorist purposes.

I associate myself with the good wishes to Mr Peter Robinson on his retirement. I thank the Secretary of State for her statement today and for all her hard work that led up to it. I find that in general there is widespread support in my constituency for the welfare changes we have introduced since 2010, based on the principles of helping those who are trying to find work and making work pay, while still controlling the cost of welfare. Does my right hon. Friend agree that these welfare reforms will be just as welcome in Northern Ireland?

I warmly agree with my hon. Friend. The reforms we have introduced into the welfare system in Great Britain give us a better system that has the rewarding of work at its heart and becomes more affordable for the taxpayers who fund it. That is another reason why I welcome the fact that that system will, I hope, apply in Northern Ireland as it does elsewhere.

I would like to take this opportunity to thank all hon. Members who have kindly offered me their thanks and congratulations in relation to my role in the process that was recently completed.

I thank the Secretary of State for her statement and join others in wishing Peter Robinson well in his retirement. We have differed politically on many occasions, but notwithstanding that, wish him well.

Will the Secretary of State confirm that she has ensured that next week’s comprehensive spending review supports and sustains the financial provisions of the mark 2 Stormont House agreement? Does she acknowledge that any modest financial gains contained in that agreement could be wiped out next week with one stroke of the Chancellor’s pen? Will she confirm the nature of the sunset clause in relation to the decision-making power in the Bill?

The sunset clause brings to an end the decision-making power by the end of next year. I can confirm that the £500 million package on offer is confirmed; it will not be withdrawn by the spending review. As for the rest of the spending review, I am afraid that it would not be appropriate for me to comment on that at this time, and that the hon. Lady, like the rest of us, will need to wait for the Chancellor’s autumn statement.

We have already heard about the proposed cross-border taskforce. A key aspect is to build on the work of the organised crime taskforce in Northern Ireland and the cross-border work that is going on—for example, in relation to fuel smuggling—in order to bring fresh impetus and capacity to that in providing support for things such as forensic accounting to pursue the proceeds of crime. A crucial step forward is for the PSNI and the Garda Siochana to be able to share more equipment and facilities. That will enhance their effectiveness and their ability to co-operate, and policing resources can go further when they are shared, in part, between the two police services.

I, too, pay tribute to the Secretary of State for all her efforts in securing this agreement, and for keeping this House updated as matters have progressed. Cross-border policing is a challenge, and that has been alluded to. What more work can be done to make sure that forces across England, Wales and Scotland work with forces in Northern Ireland and southern Ireland to help solve this problem and to help feed intelligence up the chain to try to tackle these crimes where they happen?

There are extensive co-operation agreements that ensure that police services in Great Britain can share information with the PSNI, and I am sure there is always scope to build on those.

I thank my hon. Friend for his kind comments. It has certainly been a long 10 weeks with very many meetings—a pretty gruelling process—but I am very conscious that while I have been engaged in cross-party talks for only a couple of years, there are many fine men and women in Northern Ireland who have been engaged in this kind of process for about 25 years. We need to pay tribute to their determination and all that they have achieved in transforming life in Northern Ireland. They are rightly an example held up throughout the world of how bitter division can be overcome, and how people who were once bitter enemies can find a way to work together for the good of the whole community.

With permission, Mr Speaker, I would like to make a statement on the assessment of the structure, roles and purpose of paramilitary organisations in Northern Ireland, which I am publishing today and copies of which I am placing in the Library. Before I turn to the assessment, it is worth reminding the House of the phenomenal progress that has been made in Northern Ireland over the past 20 years. We have moved on from a time when terrorism was an almost daily fact of life to one where the overwhelming majority have completely rejected violence as a means of trying to secure political ends. The political settlement, which sees people who were once enemies working together for the good of the whole community, has transformed life for the better. However, as the murders of Gerard Davison and Kevin McGuigan have highlighted, there are still serious legacy issues that need to be addressed, and they include the structure, role and purpose of paramilitary groups.

I commissioned an assessment of those matters following the statement in August by the Police Service of Northern Ireland that a line of inquiry in relation to the murder of Kevin McGuigan was the involvement of members of the Provisional IRA. The assessment has been jointly drafted by the PSNI and MI5, drawing on current intelligence, and has been reviewed by three independent figures, Lord Carlile, QC, Rosalie Flanagan and Stephen Shaw, QC. The three reviewers have confirmed today that the PSNI and MI5 engaged fully with them, consistent with their duties and constraints, and that the assessments are, in their words, “fair and balanced”, “evidence based” and “credible”. They state that they are

“satisfied that the assessments meet all the requirements placed upon us”.

I wish to thank the PSNI, MI5, and the independent reviewers for carrying out this important work within the timeframe I gave them.

I would first like to set out the Government’s position on paramilitary organisations in Northern Ireland: paramilitary organisations have no place in a democratic society. They were never justified in the past, they are not justified today and they should disband. These organisations brought misery and suffering throughout the 30 years of the troubles. Together, they were responsible for more than 3,000 murders, and thousands more have been injured. Only last week a service was held to mark the 25th anniversary of the IRA murder of that great champion of freedom and democracy, Ian Gow. Today the thoughts of the House should be with all those who suffered directly at the hands of paramilitary organisations. We should also be mindful of the fact that, thanks in large part to the efforts of the police and our armed forces, along with the determination of the overwhelming majority of people across these islands, the future of Northern Ireland will only ever be determined by democracy and consent.

The assessment sets out the position in respect of those organisations that declared ceasefires in order to support and facilitate the political process. It does not cover in any detail the threat posed by dissident republican groupings, which is the subject of separate, regular reports that I make to this House. The assessment does, though, confirm that dissident republicans remain a severe threat and that, at any given time, a terrorist attack from them is highly likely. For our part, the Government will always give the police and security services the fullest possible backing in their efforts to keep the people in Northern Ireland safe and secure.

The assessment confirms that all the main paramilitary groups operating during the troubles are still in existence, including the Ulster Volunteer Force, the Red Hand Commando, the Ulster Defence Association, the Provisional IRA and the Irish National Liberation Army.

On structures, the assessment finds that

“the majority of paramilitary organisations in this report still have leadership structures”

and

“organise themselves along militaristic lines.”

It goes on to say:

“These labels make the groups look more prepared for a campaign of violence than they are”

and that

“in the highly unlikely event that the groups are minded to return to terrorism, we judge they would be unable to resurrect the capability demonstrated at their peak.”

On the role of these groups, the assessment concludes that

“none of these groups is planning or conducting terrorist attacks”,

although some INLA members have provided help to dissident republican terrorists.

The report also states that

“members of these paramilitary groups continue to engage in violent activity, both directed by local leadership and conducted without sanction.”

It says that

“members of all groups have carried out murders since the 1998 Belfast Agreement.”

In addition, the assessment makes it clear that

“members of these paramilitary groups, to different degrees, are also involved in other serious criminal activity.”

That includes:

“large scale smuggling operations, fuel laundering, drug dealing and extortion.”

On weapons, the report says that

“although the majority of paramilitary weapons were decommissioned, some were not.”

On the purpose of these groups, it concludes that

“it is our firm assessment that the leaderships of the main paramilitary groups are committed to peaceful means to achieve their political objectives”

but that

“we judge that individual members of paramilitary groups with a legacy of violent activity still represent a threat to national security.”

The report is in no doubt that these groups

“cause serious harm to the communities in which they are embedded and undermine support for policing.”

On the individual groups, the assessment confirms that the

“structures of the UVF remain in existence and that there are some indications of recruitment.”

It states that

“the UVF’s leadership has attempted to steer its membership towards peaceful initiatives and to carve out a new constructive role in representing the loyalist community.”

However, the assessment goes on to confirm that

“a larger number of members, including some senior figures, are extensively involved in organised crime.”

UVF members are also involved in paramilitary assaults.

In respect of the UDA, the assessment concludes that while its structures remain in existence they have “become increasingly fragmented” and are split into “discrete geographical areas” that “act almost completely autonomously.”

The assessment states that

“with the support of some leadership figures there are UDA members who have continued attempts to steer the group into positive community based activism.”

Others, however, remain engaged in criminality and violence with individual members and some senior figures involved in organised crime, including

“drug dealing, robbery, extortion, and the distribution of counterfeit and contraband goods.”

There is also involvement in paramilitary style assaults, street disorder and violent protest.

In respect of the Provisional IRA, the assessment says:

“The structures of PIRA remain in existence in a much reduced form”

including

“a senior leadership, the ‘Provisional Army Council’ and some ‘departments’.”

The authors of the report do not believe that the group is actively recruiting. They state that, although decommissioning took place between 2001 and 2005, PIRA continues to have access to some weapons. However, the assessment judges

“that PIRA has not conducted organised procurement of new weaponry in the period since the last IMC report of 2011.”

While the assessment states that

“PIRA members believe that the PAC oversees both PIRA and Sinn Fein with an overarching strategy”,

it judges that

“this has a wholly political focus.”

The report points out that

“individual PIRA members remain involved in criminal activity, such as large scale smuggling, and there have been isolated incidents of violence, including murders.”

In conclusion, the report says:

“The PIRA of the Troubles era is well beyond recall. It is our firm assessment that PIRA’s leadership remains committed to the peace process and its aim of achieving a united Ireland by political means. The group is not involved in targeting or conducting terrorist attacks against the state.”

That is a direct quote from the assessment.

I will not seek to hide from the House that much of the assessment makes uncomfortable reading. These organisations should never have existed in the first place and, 21 years after the first ceasefires, it is clearly unacceptable that they still exist today.

For all that the assessment judges the leaderships of the main paramilitary groups to be committed to peaceful means, such groupings have no place in a democratic society. Members of those groups continue to exert a malign influence, which, as the assessment puts it

“harms communities and damages the financial prosperity and reputation of Northern Ireland.”

Inevitably, a document of this kind does not provide all the answers, but I hope that it will assist in identifying the nature and scale of the problem and in framing the debate about the way forward. Working with the main political parties, and society more broadly, we need a strategy to lead us to the point where these organisations no longer exist and their influence is removed from Northern Ireland once and for all. That is one of the two main goals of the talks that I am chairing at Stormont and it is an outcome to which all parties say they are committed.

The other goal is to secure the implementation of the Stormont House agreement. I believe that those talks represent the best chance of making progress on both these vital issues and of finding a way forward that builds a brighter, more secure future for everyone in Northern Ireland. We all now need to engage intensively in the talks in the days ahead, and I commend this statement to the House.

I thank the Secretary of State for advance sight of her statement and for her usual courtesy. May I also join her in thanking the members of the independent panel for their serious report, which I know will be read by the families of the victims? Those families and those victims are very much in our thoughts today.

Does the Secretary of State agree that at the heart of the undeniable progress that has been made in Northern Ireland is trust? I am talking about trust in the institutions, trust in the democratic process and, crucially, trust between parties and politicians. Above all, there is a belief in the principle of the rule of law. It is that core principle that has to be paramount. It is a principle that has to be at the centre of the continuing progress in Northern Ireland, and we should not forget that the work of the Police Service of Northern Ireland remains crucial to that.

The current political crisis in Northern Ireland was sparked by allegations surrounding the murder of Kevin McGuigan, following the murder of Gerard Davison. Will the Secretary of State tell the House what the report says about those murders and the extent of any paramilitary activity? In order to reach its conclusion, the panel will have had access to sensitive intelligence. Will she confirm that the panel has obtained all the intelligence for which it has asked? Crucially, will the Secretary of State tell us whether she believes that the assessment of the independent panel and its report today provides a basis for an end to the political crisis in Northern Ireland? If she does, what happens now and how will progress be made? Will she be convening further talks? If not, what does she expect to happen and what will she do?

Will the Secretary of State also update the House on the current situation with respect to the Stormont House agreement and when she intends to publish the Bill?

The reaction of the Northern Ireland parties to the panel’s conclusions is obviously of huge importance. Has the Secretary of State had any preliminary discussion with the parties on this matter? It is also important to know the view of the Irish Government. Will she say what discussions she has had with them?

Paramilitary activity has no place in Northern Ireland. The vast majority of the people do not want it and neither do their politicians. Does she agree that it is for the police to enforce the law? They should, of course, be accountable, but their independence is crucial. No paramilitary activity is acceptable, whether it is carried out by remnants of the IRA or loyalist paramilitaries. Will the right hon. Lady tell us what measures, if any, she intends to take as a result of the report? Much of the media focus has been on the IRA, but what is her view of loyalist paramilitaries? Does she believe, for example, that the establishment of the Loyalist Community Council recently was a good thing?

Is not one of the crucial conclusions of the report that

“none of these groups is planning or conducting terrorist attacks”?

Does the Secretary of State agree that, as the report states,

“the existence and cohesion of these groups since their ceasefire has played an important role in enabling the transition from extreme violence to political progress”?

If so, what does that mean for the future? Can she confirm that, as the report says, it is individual members of paramilitary groups who pose the real threat? Although much of the focus is rightly on threats to national security, is it not disgraceful and unacceptable for any individuals or groups to be involved in what the report describes as

“large scale smuggling operations, fuel laundering, drug dealing and extortion of local business”?

It is surely right, therefore, that we in this House restate our support for the work of the PSNI in tackling these issues.

There can be no doubt that once again hugely difficult issues have arisen in Northern Ireland—issues that are an immense challenge to the politicians of Northern Ireland and to all of us who seek to support them as they emerge from the horror of the past. We know that time and again politicians in Northern Ireland have risen to that challenge. They have found a way forward. They have dealt with seemingly intractable problems. Is it not time again for all of us to restate the fundamentals of the agreements that have brought us to where we are, and to reassert the principles of trust, sensitivity and mutual respect on which so much progress has been made, and the primacy of the rule of law? So many people have said to me that they do not want their children or grandchildren to suffer as they have done. Let us all find a way once again to ensure that that aspiration remains a reality.

I agree with the shadow Secretary of State that trust between political parties is crucial in making progress in Northern Ireland and crucial to the effective functioning of devolved government. I wholeheartedly agree that belief in the rule of law and support for that concept is crucial in Northern Ireland, just as it is everywhere else in our country. Like the hon. Gentleman, I believe that the PSNI does a hugely important job in tackling not just the terrorism of the dissident republicans, but the criminality from the groupings about which I have been speaking today.

In relation to the case of Kevin McGuigan, the assessment confirms that the view of the two organisations, the PSNI and MI5, which compiled the report, is that the Chief Constable’s statement in August remains valid, so the situation in relation to the Kevin McGuigan case continues to be as set out by the PSNI in August.

On the question of access by the panel to classified and sensitive intelligence, yes, members of the panel were shown classified material and they had access to individuals from MI5 and the PSNI to challenge them on the process by which the assessment and the report had been compiled.

The shadow Secretary of State asked whether I believe the assessment can provide a basis to move forward. Yes, I do. As I said in my statement, I do not for a moment say that it answers all the questions in relation to paramilitary organisations. There is now a pressing need in the talks for the parties together to establish what is the best way to grapple with the continuing problems associated with the existence of paramilitary organisations, but I hope the publication of the assessment will inform the decisions that will need to be made in the coming days by the leaders of Northern Ireland.

In response to the question about my discussions on these matters, I have had extensive discussions with the five main parties in Northern Ireland and with the Irish Government as part of the talks process and beyond that. On the hon. Gentleman’s question about the establishment of the Loyalist Community Council, I welcome initiatives designed to move groups away from criminality, but this initiative must be judged on its results.

I echo the shadow Secretary of State. It is correct to highlight the conclusion in the assessment that none of the groups under consideration is planning terrorist attacks. He referred to the role these groups might have played in the transition of their members from a violent past to a peaceful future. I acknowledge that the picture is mixed, but there are some aspects of the assessment that are not completely negative.

That covers most of the hon. Gentleman’s questions. I close by saying that I agree with him that it is unacceptable for individuals, whether they are in paramilitary organisations or not, to be involved in disgraceful activity such as the fuel laundering and smuggling that I outlined today.

The report makes for depressing reading in some ways. Has the Secretary of State had the chance to assess whether any of the money from the fuel smuggling, extortion and so forth finds its way into the political process? Does she agree that the work of these criminals is no reason to bring the institutions down, provided that the police and the other agencies have sufficient resources to track these people down and stamp out their poisonous activities? Are sufficient resources going to these agencies so that they can do exactly that?

Yes, in some ways the assessment makes for depressing reading but, as I said to the hon. Member for Gedling (Vernon Coaker), the assessment is that the statement of the Chief Constable remains valid. He emphasised in that statement that the criminality appears to be by members for personal gain and to pursue personal agendas, so there is no evidence of funds being diverted for political purposes. On police resources, it is important that the police have the resources they need to tackle criminality and terrorism. That is one of the reasons why the UK Government have provided additional security funding, and it is why we need to resolve the budget questions around the Northern Ireland Executive and implement welfare reform so that it has resources for its priorities, such as policing.

I thank the Secretary of State for advance notice of her statement. That is much appreciated.

I and my party very much welcome the assessment of the review panel, showing that there is little likelihood of a return to the levels of violence that we saw during the troubles. So many people have worked on that over the years and the peace has been hard won. It is very satisfying to note that, in the main, the intent among the parties and organisations is to keep that peace.

There are, of course, the concerns already mentioned about the ongoing criminality and the damage that can be done to communities by that. The police and security services, as mentioned, will require ongoing support in addressing that. I note, though, that the report is clear that the concerns relate to both sides of the debate. We can perhaps now leave aside the idea that one side maintains readiness and the other does not. Both sides, it seems, continue to operate at a lower level than they did previously. I offer whatever help I and my party can provide in dealing with the issues outlined.

In the light of the report and the other developments, including the recent development in the investigation of the murder of Kevin McGuigan, is the Secretary of State confident that the talks to put the Stormont House agreement back on track can now succeed? Does she have any indication that all the governing parties are ready to return to their ministerial posts in Stormont? In relation to her analysis of what will be required to address the criminality mentioned in the report, does the Secretary of State believe—I realise that this question has already been raised—that sufficient resources are available to the police and the security services to tackle it?

I, too, welcome the assessment’s confirmation that the intelligence services do not believe that any of these paramilitary organisations are preparing for a return to terrorism. The hon. Lady is also right to highlight the fact that the problem of criminality is common across the different organisations. She asked whether I am confident that the talks will succeed. It is difficult to say, because there are still some significant gaps between the parties, and the debate over the financial sustainability measures, which are crucial if we are to return to successful devolved government, continues to be difficult to resolve. However, I believe that all five parties participating in the talks want to find a way through and to make devolution work, so I have some hope that we might have a successful outcome, although it is not guaranteed.

I thank the Secretary of State for her statement, particularly her tribute to our military and security forces, who defended the rule of law through some very difficult decades and created the conditions in which the talks could take place. Does she agree that we cannot have a normal political process in Northern Ireland while those engaged in political activity have links to shadowy organisations that might either go to the grotesque end of murdering Kevin McGuigan, or indulge in money-raising activity that is wholly illegal, such as racketeering, money laundering and fuel smuggling? The answer is absolutely to bear down on every one of those criminal activities, regardless of where that might lead and any potential political embarrassment.

I agree that it is vital that Northern Ireland moves to a situation in which paramilitary groups are part of its past, not its present or its future. It is entirely unacceptable for those organisations still to exist, and the involvement of their members in such serious criminal acts must be a matter of grave concern. It is vital that the police follow the evidence wherever it leads them. Bearing down on the criminal activities of those individuals is how we will help Northern Ireland to move forward.

Our party sought this assessment, and it comes as a result of the pressure that we were determined to exert, whatever the criticisms or brickbats that that brought us. We therefore welcome its publication today, setting out the clear, factual position regarding paramilitaries in Northern Ireland. However, the report demonstrates the scale of the work that lies ahead in the talks process. It states that the IRA is committed to the peace process, and it recognises the lack of recruitment, procurement of weapons and so on. Nevertheless, it clearly sets out the continuing existence of its paramilitary structures—that applies to all the organisations that were looked at—and illegal activity by its members. That is totally unacceptable, and it is beyond high time that it was ended in all its forms—terrorism and criminality.

With regard to the account of loyalist groups, although there are no direct implications for devolved government, it is essential that transformation takes place in that regard, too. In that context, will the Secretary of State welcome the willingness of the leadership of those groups to move forward, as publicised last week? Will she work with us, and all those committed to peaceful and democratic means, to end once and for all—this must be the outcome of the talks process—all forms of paramilitarism in Northern Ireland?

I can give the right hon. Gentleman that commitment. I think it is vital that we find a way to end all forms of paramilitarism in Northern Ireland. I also agree that it is crucial that the talks currently underway succeed. All the parties need to engage intensively on this matter and on the Stormont House agreement, because without resolution of those questions it is difficult to see how we can have an effective and functioning Executive delivering on their priorities. It was very important that the assessment was produced and that we have further facts in the public domain, but I acknowledge his point that the scale of the task is great. We must not underestimate that, which is another reason why all the parties need to engage in the talks with determination to find a way forward.

I congratulate my right hon. Friend on her statement and the panel on its assessment, which offers partial reassurance, but does she agree that that reassurance must be qualified by the fact that, unlike state actors, paramilitaries do not obligingly leave an audit trail that can easily be assessed by intelligence services, however excellent they are?

Naturally, with criminal and paramilitary activity it is not easy to get an entirely clear picture. Of course, a key element of the talks will be deciding what further process of verification is needed. There has been considerable discussion of reviving a body similar to the Independent Monitoring Commission. I think that is a useful point for discussion, and I am sure that the parties will be considering it in the coming days.

I thank the Secretary of State for her statement. I know that she has tried to put as positive a spin as possible on the report, but it confirms that the report by the Chief Constable of the PSNI two months ago was accurate, that the IRA is still in place, that IRA members murdered Kevin McGuigan and that they are still involved in paramilitary and criminal activity. It actually goes further and gives more information, indicating that the IRA army council is still in place and that it oversees the IRA and Sinn Féin’s overarching strategy. Will she now indicate whether Sinn Féin accepts that the IRA is still in place, and does she accept that the IRA and Sinn Féin continue to be inextricably linked?

It will not surprise the hon. Gentleman to hear that I am unable to speak for Sinn Féin—no doubt it will provide its own response to the report—but I also take issue with him, because I am not trying to put any spin on the assessment. Today of all days, we need people to read the report and consider it objectively. Yes, there is a great deal in it to be very concerned about, but we need to use it as an opportunity to reflect on how we deal with the problem and on what more needs to be done to ensure that Northern Ireland makes progress. I have acknowledged that the situation is serious and that the task will not be easy, but I think that it is a task that can be achieved. Northern Ireland’s leaders have shown in the past that they are capable of grappling with this very difficult kind of issue.

When I was the intelligence officer in Londonderry, the discipline among paramilitary groups such as the Ulster Defence Association, the Ulster Volunteer Force, the Irish National Liberation Army and the Provisional IRA was hugely effective. The independent reviewers have clearly suggested that the leadership of such organisations are not necessarily in control of what their members are doing. I suggest that our security services should be putting huge efforts into dislocating and separating these maverick members of paramilitary organisations from their leadership, who say that they have nothing to do with the upsurge in violence.

It is certainly clear from the assessment that in many cases the leadership of the various organisations do not control or sanction what their members get up to, but I can assure my hon. Friend that Northern Ireland has an outstanding police service, supported by the intelligence services, and they will pursue crime wherever they find it. They do a fantastic job. They will pursue the individuals responsible for the sorts of crimes outlined in the report with as much vigour and determination as they pursue anyone else involved in wrongdoing in Northern Ireland.

I am very grateful indeed to the Secretary of State for making her statement to the House. I am relieved that, with regard to the Provisional IRA:

“The PSNI and MI5 do not believe the group is actively recruiting.”

However, what I am worried about, and very curious about, is how much seepage there is from the Provisional IRA to dissident republicans. Is there a high or low level of seepage? What is her assessment?

I am sure that the hon. Lady will accept that these are very sensitive matters and that it is not appropriate for me to go beyond the assessment. Naturally, the risk of seepage between the Provisional IRA and dissident republican groups is always a risk about which our intelligence services and the PSNI are acutely aware. One of the reasons these groupings remain a threat to national security is the danger that their expertise might find its way into the hands of dissident republicans. That is a risk that we all need to be aware of.

Does the Secretary of State agree that the assessment proves that there is a need for a whole community approach to making sure that we eradicate all traces of malignant paramilitarism? Does she also agree that alongside that we need a whole enforcement approach by policing and revenue channels against any level of criminality? We have to be absolutely clear that no level of crime can be treated as par for the course in a peace process. We welcome the predisposition towards peace, but we cannot accept a predilection towards crime from the members of these groups.

I agree with all of that. We do need a whole community approach to resolving this problem, and we do need a whole enforcement approach. I pay tribute to the work of groups such as the Organised Crime Task Force, which co-ordinates all the organisations working on organised crime. I wholeheartedly agree with the hon. Gentleman that there is no tolerable level of criminality. Anyone responsible for criminal activity should be pursued by the police and brought to justice.

May I remind my right hon. Friend that this is not a Northern Ireland problem but a UK problem? The offence of paramilitary violence that has been the scourge of our lives for more than 50 years in these islands has affected some of our families directly, in all parts of the House. I urge her to maintain the pressure that she has so rightly placed on the criminal actions of a few, and to encourage the PSNI, which has been extremely courageous in its work these past years, to continue its work.

I agree with my hon. Friend that this is a UK-wide issue. He is right to remind us all that victims and survivors of the troubles are not confined to the population of Northern Ireland; many of them live in Great Britain. Indeed, there are also people elsewhere in the world who share the pain of those who suffered directly at the hands of these terrorist organisations in their violent past.

I thank the Secretary of State for her statement and commend my hon. Friend the Member for Gedling (Vernon Coaker) for his response. The Secretary of State said that she wants to see the full implementation of the Stormont House agreement, and I wholeheartedly share her sentiments and support her in that. Is it the Government’s position that they wish to see agreement between all the parties before legislating on the Stormont House agreement, and how long does she anticipate it will take to get that agreement?

We have had some good discussions in the talks on the technical aspects of the legislation needed to deliver the institutions on the past. We hope to introduce that legislation soon. It is important that the Stormont House agreement is implemented in full. For clarification, the assessment in relation to the paramilitary organisations does not indicate that those organisations are no longer on ceasefire. However, I think that my hon. Friend’s question was primarily about the Stormont House agreement. As the House will be aware, the major blockage on the Stormont House agreement is that the two nationalist parties, having signed up at Stormont castle to welfare reform with top-ups from the block grant, then withdrew their support. That is an instance where two of the parties signed up to something and are not currently supporting it, but I hope we can find a way to get their support back in the days to come.

As the Secretary of State has indicated, dissident republicans are very active and deadly. The PSNI is on a high alert. Army units have been sent to the Province to give assistance to the PSNI. The terrorist threat is at a severe level in Northern Ireland. The law-abiding overwhelming majority of Northern Ireland citizens are sick to the back teeth of this cancer in our society. Does she agree that only by taking a ruthless and uncompromising approach to paramilitary activity can we have a real chance to heal the scars on the face of Northern Ireland once and for all?

We certainly need an uncompromising approach to pursuing criminality wherever it is found. It is also important to harness the activities of wider society. One of the problems in getting convictions for things like paramilitary assaults is that people feel afraid to come forward and give evidence. We need to reflect on what more can be done to give them the confidence to confront these individuals in their communities and to come forward and give evidence in court when those individuals commit crimes.

The assessment makes it clear that the time of large-scale mass violence by paramilitaries is a thing of the past, but there is a danger, as the years from that period to now extend, that people will romanticise that period of violence and that people who formally or informally associate themselves with paramilitary groups will take independent violent action. What steps is my right hon. Friend’s Department taking to ensure that this romanticisation is nipped in the bud and that people who aspire to relive what they perhaps believe to be some glorious bygone era have their minds set straight and do not embark on individual acts of violence?

My hon. Friend makes an important point. There is a tendency among some to try to rewrite history. That is something that this Government will never support and will always firmly oppose. There is no possible means by which one could romanticise a campaign that saw thousands of people murdered. That is at the heart of our approach to the institutions on the past to be created under the Stormont House agreement. They must be balanced, objective, fair and impartial to make sure that we establish all the facts about the history of the troubles, and do not enable anyone to seek to rewrite the history of the troubles and to draw some wholly unacceptable form of equivalence between terrorism and police officers.

The report indicates that individual IRA members remain involved in criminal activity and describes a range of acts, from smuggling right up to murder. What it does not say is that those people are defended by Sinn Féin political representatives who eulogise them, discourage people from giving evidence against them, and make excuses for their activities. Does the Secretary of State agree that one of the biggest impediments to making devolution work in Northern Ireland is the ambivalence of Sinn Féin’s political representatives to the criminality of their associates?

Does she agree that the biggest issue is that while they might not be planning to launch terrorist attacks against the state, they are still encouraging a culture of criminality, including murder and extortion, that terrorises local communities, and that there is no way we can have a peaceful Northern Ireland for its people if these organisations remain?

My hon. Friend puts his points very well. It is worth recalling that some paramilitary assaults have involved teenagers—young people—and in some instances such assaults are child abuse. There is a real brutality to some of the cases we have seen in Northern Ireland in recent years. That is another reason why it is vital that we see an end to paramilitary activity in Northern Ireland.

I thank the Secretary of State for her statement. Paramilitary action was never justified at any stage, whether now or in the past. All those murders and all that violence and terrorism were totally unjustified and put people in a great state of peril.

Will the Secretary of State outline what the paramilitary organisations could do to assist in alleviating the problems and anguish experienced by victims, and those who have lost loved ones either through the bullet or the bomb, who are anxious that the Governments and the paramilitary organisations resolve those issues to provide full truth and accountability?

I wholeheartedly agree that the terrorist activities of those groups was never justified, and I pay tribute to the role played by the hon. Lady’s party and the other parties in Northern Ireland that stood out against terrorism throughout the 30 years of the troubles. The crucial way forward for those groupings is to cease involvement in criminality. Their members should stop their criminal activities, and it is vital that the police continue to do all they can to pursue anyone who continues to be involved in such activity.

May I thank the Secretary of State and others both for their work on the report and for all the work that goes into everything for us in Northern Ireland? On PIRA, page 11 mentions the continued existence of senior leadership, the provisional army council and some departments. I assume that similar departments—which suggest to me a department of knee-capping or of smuggling—exist in other paramilitary organisations. The Secretary of State has said that she will take an uncompromising approach in future, so will she make sure that all political parties employ no one who is linked to such organisations?

As I have said on a number of occasions, anyone involved in criminal activity should expect to face justice, and the police will pursue anyone involved in such activities. On the organisational structures, the assessment provides further information beyond what the Chief Constable was able to share in his statement. Parties and individuals, however, will continue to have questions about the organisations and how they are run and structured. That is another reason why a formal ongoing verification process to try to move us forward towards resolving the problems once and for all will be an important part of a successful outcome to the talks.

I do not think it comes as much of a surprise to any Member that structures are still in place. Security forces personnel to whom I have spoken are concerned that members of the Provisional IRA who have bomb-building experience have moved to dissident organisations and that that is why there have been a number of under-car booby trap bombs in the past few weeks and months. I am sure that the Secretary of State and the security forces are investigating that.

The security forces have placed a huge priority on seeking to prevent the dissident republican groupings from carrying out lethal attacks. In recent days there have been two examples of attacks on the state by those groupings. It is crucial that the PSNI and its security partners both north and south of the border continue to do all they can to keep people in Northern Ireland safe from the terrorist threat from dissident republicans, and I am confident that they will do that.

Last but not least, I was very pleased to hear the Secretary of State say that the Government will always give the police and the security services the fullest possible backing in their efforts to keep the people of Northern Ireland safe and secure. On Thursday we learned of a murder attempt on a member of the armed forces in the constituency of my right hon. Friend the Member for Belfast North (Mr Dodds), and on Friday there was an attempted murder of PSNI colleagues in my constituency of Belfast East.

The Secretary of State will know that, sadly, extremism still exists on the fringes of our society, yet we discovered yesterday that Northern Ireland is specifically excluded from the Government’s counter-extremism strategy. What discussions has the Secretary of State had with the Home Secretary on that, and what assistance does she believe the strategy could give to the righteous fight against extremism in Northern Ireland and across the UK?

I have discussed this important matter with the Home Secretary on a number of occasions. I draw the hon. Gentleman’s attention to the part of the report that makes it clear that the UK Government are open to extending the strategy to Northern Ireland in the future. Given the particular circumstances, we do not think that is appropriate just now, but we are happy to work with the devolved bodies to share best practice and do all we can to counter extremism in whatever form it comes.

I would first like to associate myself with the tributes paid to Garda Officer Golden. His death was a tragedy, and my condolences go to his family, friends and police colleagues.

It is essential that the cross-party talks deliver a way to implement the Stormont House agreement and also a means to address the continuing impact of paramilitary organisations. The Northern Ireland parties are engaging intensively, but time is short and a resolution is urgently needed.

We cannot yet say whether we will have a successful outcome, but my feeling is that all five parties participating in the talks want the institutions to work, so they recognise that they have to fix these problems. It is essential, however, that that includes implementing welfare reform. Without it, there will be no sustainable public finances in Northern Ireland—and without that, as the Chairman of the Northern Ireland Affairs Committee has said, we cannot really have a functioning and effective Government.

I can give my hon. Friend the assurance that the needs of victims and survivors of the troubles will always be at the forefront of this Government’s approach to the troubles and the Stormont House agreement Bill. That is why absolutely no provision is made in the Bill for an amnesty, which would be completely unacceptable to victims and survivors, just as it is unacceptable to this House. We will press ahead with measures to implement the bodies on the past in the Stormont House agreement.

That is important. For the most part, that view is shared across the House. It is obviously of grave concern that the leader of the Labour party, when asked as recently as this August to condemn IRA terrorism, said that he condemned the actions of the British Army in Northern Ireland.

The Secretary of State will be aware that a lot of Northern Ireland businesses are rapidly expanding. For example, Almac in Craigavon is taking on 300 new people, and Moy Valley is looking to take on another 600 employees across the Six Counties. Does my right hon. Friend agree that businesses expect the political process to be put on track to underpin this wealth creation?

I do agree. The Government’s long-term economic plan is working, and it is reflected in economic recovery in Northern Ireland. One of the reasons why we need a successful outcome of the cross-party talks and implementation of the Stormont House agreement is to open the way for devolution of corporation tax, which will mean even more jobs and prosperity in Northern Ireland.

I welcome what the Secretary of State has said about there being no amnesty in relation to past terrorist crimes. That is absolutely right, in the view of our party and the vast majority of the people of Northern Ireland. Will the Secretary of State assure us that there will be no question of the past being rewritten or revised, or of a different narrative emerging from the discussions of the past that are currently taking place as part of the political process?

I can give the right hon. Gentleman assurances on both those points. As he well knows, the Stormont House agreement makes it very clear that there is no amnesty, and that an amnesty would not be justified. I also believe that it would be completely unacceptable to set up any bodies that would seek to rewrite the history of the troubles. There can never be any equivalence between the police officers who defended the rule of law and the terrorists who sought to destroy it.

I warmly welcome what the Secretary of State is saying, and we will work with her to ensure that that objective is achieved in the current talks process. Does she agree that, just as there was never any justification for the terrorists in the past, there can be no justification for their continued existence in the future, and that all their criminality, racketeering, fuel laundering and the rest of it must be addressed by the establishment of a dedicated resource to rid the people of these terrorist godfathers and their criminality?

The British Government will continue to be unrelenting in their action to support those who are fighting terrorism in Northern Ireland, and, indeed, in the rest of the United Kingdom. Sadly, we have seen republican terrorism manifest itself on a number of occasions in recent months, with devices being left in public areas in Lurgan, Belfast, Strabane and Londonderry. The PSNI is doing an excellent job with its security partners in preventing such attacks from causing harm, but it is of course essential that we also do everything we can to crack down on criminality on the part of paramilitary groups.

I am concerned about that. It simply does not reflect the contents of that summary of the Bill, which is faithful to the Stormont House agreement.

Discussions continue on the technical details of the Bill. Naturally the agreement does not cover every detail that is needed to produce legislation, and the parties continue to engage intensively in preparation for the presentation of the Bill to Parliament.

The Secretary of State will agree that the aftermath of a deplorable murder is not just a test inviting the political parties to demonstrate their own resolve, but a collective challenge to us to prove the resilience of the democratic process. Does she also agree that we can do that best by adopting a whole community approach to eradicating paramilitarism, guaranteeing the stability of the political institutions and standing by the integrity of the new beginning to policing, especially in circumstances in which dissidents are yet again threatening the policing arrangements and those who may be recruited?

I agree that we need a whole community approach to tackling paramilitary organisations and moving to a time when they will disband. I also agree that we need a whole community approach to supporting the policing settlement. I do think, though, that supporting the devolved institutions involves another crucial factor, namely sustainable public finances. I therefore urge the hon. Gentleman and his party colleagues to find a way to ensure that the agreement is implemented, including the welfare provisions.

May I begin by associating myself and my party with the Secretary of State’s remarks about Garda Tony Golden, and sending our condolences to his widow and three children?

Let me say at the outset that there is and can be no place for paramilitary activity in Northern Ireland. The primacy of the rule of law is fundamental, and there can be no compromise on that principle. Does the Secretary of State agree that, at a time when this and other matters are being discussed in the current talks, it is vital for the House to say loudly and clearly that we have every confidence in the ability of the political leadership in Northern Ireland to secure a successful outcome to the current negotiations, and that we, along with the Irish Government, will play our part in supporting them?

I completely agree that it is not acceptable for paramilitary organisations to exist in a democratic society. They were never justified, they are not justified today, and they should disband. I also share the hon. Gentleman’s confidence in the leadership of Northern Ireland. They have demonstrated many times over the last 20 years that they can achieve phenomenal results and can solve seemingly intractable problems, and I urge them all to repeat that over the coming days. I do not think it would be wise for me to give a running commentary on every detail of the negotiations, but there is a considerable amount of consensus on the content of the Bill. There remain difficult issues to resolve and there is no doubt that the provisions relating to national security will always be sensitive, but this Government are determined that they will defend their national security interests, because if we were to neglect that duty, that could have a price in lives. We believe that it is very important to ensure that all disclosure provisions are consistent with our article 2 duties and our duty to protect national security.

Over the past two spending reviews we have provided an additional £231 million to support the PSNI in its efforts to tackle dissident republican-related terrorism. That has provided vital support in a campaign against those terrorists and it is one of the reasons why, thankfully, the vast majority of the attacks do not succeed. I know that the PSNI will work hard to find alternative venues so that its recruitment event can go ahead.

I agree that we need to do everything we can to try to avoid suspension and a return to direct rule. Devolved government has been approved in two referendums in Northern Ireland. That is why we are working to make the institutions work, but there is a real danger now that those who are taking a hard-line stance against welfare reform could end up collapsing the institutions as collateral damage. No institution can function effectively without a workable budget. That is why in these talks a solution to implementing the Stormont House agreement is vital.

I agree that it is vital that we do everything possible to deliver prosperity in Northern Ireland. Our long-term economic plan is helping to do that. The economic pact agreed with Northern Ireland is helping to do that, but we are always open to more ideas about how we work together to spread prosperity in Northern Ireland throughout the whole of Northern Ireland and all its areas.

With permission, I would like to make a statement about political developments in Northern Ireland. First, I welcome back the hon. Member for Gedling (Vernon Coaker) as shadow Secretary of State. I hope we can continue the constructive working relationship that we had when he last held the post. With that in mind, I would say that the new Labour leader and the shadow Chancellor are on record as having expressed their support many times for a united Ireland. That is an entirely legitimate view, as is the clearly held preference on the Conservative Benches that our country should stay together and that Northern Ireland should remain part of the United Kingdom. It would be helpful for the shadow Secretary of State to confirm when he responds to this statement that, under his party’s new leadership, the consent principle at the heart of the Belfast agreement will remain paramount.

Last week we started a new round of cross-party talks focused on two issues: the continued presence of paramilitary organisations in Northern Ireland and the pressing need to implement the Stormont House agreement. The talks began on Tuesday with a meeting of all the participants, at which everyone agreed that those two issues needed to be addressed as a matter of urgency, although views differed on the sequence in which they should be considered. On Wednesday morning, the Police Service of Northern Ireland arrested three well-known members of the republican movement, including the northern chairman of Sinn Féin, in connection with their ongoing investigation into the murder of Kevin McGuigan. It would not be appropriate for me to comment on a live police investigation, save to say that all three were subsequently released unconditionally. These developments had dramatic political consequences.

On Thursday evening, Peter Robinson announced that Democratic Unionist party Ministers, with the exception of Finance Minister Arlene Foster, were resigning from the Northern Ireland Executive. The First Minister himself has stepped aside, with Mrs Foster taking over the functions of that office for a period of six weeks. That does not trigger an early Assembly election—that would happen only if either the First Minister or Deputy First Minister were to resign. Nor does it mean suspension of the institutions or a return to direct rule—that would require primary legislation at Westminster, which is not something the Government believe would be justified in the current circumstances. It also does not mean that the Assembly or the Executive cease to function, but the situation is very grave.

A number of Departments are left without ministerial leadership, and relationships between the parties have almost completely broken down. That leaves the devolved institutions looking increasingly dysfunctional. Over recent days, I have been maintaining close contact with the five main Northern Ireland parties and with the Irish Government, and I have kept the Prime Minister constantly updated on the situation. Yesterday, I held a series of bilateral and trilateral meetings at Stormont, aimed at establishing a basis for further intensive talks. I plan to hold further such discussions at Stormont tomorrow and in the days ahead.

The events I have outlined do not alter the fundamental issues that need to be resolved. First, the brutal murders of Gerard Davison and Kevin McGuigan have brought into sharp focus the continuing problems around the existence of paramilitary organisations in Northern Ireland, and the involvement of some of their members in criminality and organised crime. The Government are clear that paramilitary organisations have no place in a democratic society. They were never justified in the past, they are not justified now and we all need to work together to find a way to bring to an end this continuing blight on Northern Ireland society. The Government are working with the parties in the Northern Ireland Executive on how to achieve that goal. For example, serious consideration needs to be given to whether the time is right to re-establish a body along the lines of the Independent Monitoring Commission. The remit the parties might wish to give to such a body is likely to be different from the matters addressed by the original IMC, reflecting changed circumstances. But there might well be scope for such a body to play a part in providing greater community confidence and repairing working relationships within the Executive. The Government will also actively consider whether there is more that we can do to support efforts to tackle organised crime and cross-border crime in Northern Ireland. In the days to come, we will continue to listen carefully to representations made to us on the best way to ensure that all parties can engage in this process.

The second issue on the agenda is just as important as the first. Resolving the differences that have been blocking the implementation of the Stormont House agreement is crucial if the finances of the Northern Ireland Executive are to be placed on a sustainable footing. Without welfare reform and steps to tackle in-year budget pressures, there is a real danger that Executive Departments could start running out of money, becoming steadily less able to pay their bills, with the serious negative impact that could have on front-line public services. As we have seen in those parts of Europe where Governments are unable to control their debts and live within their means, some of which are supported by the new leader of the Labour party, it is the vulnerable and most disadvantaged who suffer most in such situations. We have therefore made it clear that if these matters are not dealt with by the parties, as a last resort the Government would have to legislate here at Westminster, a position on which I hope we would have the support of the hon. Member for Gedling.

As things stand, every day that passes is likely to see the devolved institutions less and less able to function effectively. We have limited time, so once again I urge all parties to engage intensively and with focus, determination and goodwill in the talks under way. We on the Government Benches, and I hope those across the whole House, continue to give our full support to the Belfast agreement and the institutions it created. There can be no doubt that power-sharing, inclusive government comes with its frustrations and difficulties—indeed, I hear about them every day—but as my right hon. Friend the Prime Minister often reminds this House, the Northern Ireland political settlement was a huge achievement. It has transformed life in Northern Ireland for the better, and it is an awe-inspiring example of what can be achieved with political leadership and vision. On so many occasions in the past 20 years Northern Ireland’s politicians have come together to achieve the seemingly impossible. It is time to do so again, so that we can continue on the road to a brighter, more secure future for Northern Ireland. I commend this statement to the House.

I thank the Secretary of State for her good wishes and for advance sight of her statement. Let me take this opportunity to thank all the parties in Northern Ireland, as well as many others, for their good wishes.

Let me say straight away to the Secretary of State that it is the Opposition’s intention, as well as my own, to pursue a bipartisan approach based on the agreements reached, in particular the principle of consent. Our policy remains absolutely the same and I emphasise that to the Secretary of State and all those who are listening to or reading this debate.

I take up this post again at a time of real challenge in Northern Ireland. Will the Secretary of State reassure us all that the full authority of the British Government, working with the Irish Government and with Washington, will be used to help resolve these difficulties along with the parties of Northern Ireland? The current problems of political stability revolve around continuing paramilitary activity and the implementation of the Stormont House agreement.

Following the murders of Gerard Davison and then Kevin McGuigan, the Chief Constable of the Police Service of Northern Ireland said that some Provisional IRA organisational structures still exist, but for a radically different purpose than before, although some members still engage in criminal activity. Does the Secretary of State agree with this assessment? Can she explain what it means and give her assessment of what it means for communities? Will she update the House as far as she can on the investigation by the PSNI into the two murders I mentioned earlier? Does she agree that we need once and for all to end any ambiguity on the issue of paramilitary activity? As she said, paramilitaries have no place whatsoever in Northern Ireland, so will she update us on her assessment of the level of paramilitary activity in all communities, the threat it poses and what is being done to combat it? Does she agree that supporting a more comprehensive approach across all departments and agencies could be beneficial?

The rule of law must be paramount and there can be absolutely no compromise on that principle. The parties in the Northern Ireland Executive are all committed to that, but in the light of the Secretary of State’s statement to the House last week and today about the IMC, will she update us further on the current position, what she is considering and what any of the proposals she has outlined actually mean?

Let me turn to the implementation of the Stormont House agreement, which was a tremendous achievement by all involved. It has clear proposals on finance and welfare, on difficult issues such as flags, identity, culture and tradition, parades and dealing with the past, and on institutional reform—many, if not all, of the hugely challenging and difficult issues that arise in the context of Northern Ireland with its different traditions. However, it was a negotiated agreement to move forward on those matters, not to leave them as being too difficult to resolve, reflecting a desire to tackle them. It showed hugely courageous political leadership from all involved, including many in the Chamber today.

Does the Secretary of State agree that the price of negotiating a way of successfully implementing the agreement would be another historic milestone? Does she agree that it would take forward the peace process by saying that, although we have brought about a substantially better Northern Ireland now is the time to deal with many of the outstanding issues arising from the different traditions and competing narratives as well as legacy issues around victims, mental health, economic insecurity and poverty?

On that basis, how will the Secretary of State play her part in helping to break the impasse, particularly on welfare reform? Are there other ways of supporting vulnerable people with targeted Treasury money to help, for example, mental health or economic insecurity, both of which are significant legacy issues? Does she accept that to break the deadlock the same proposals cannot always be put forward time and time again? Although Northern Ireland should not be treated as a special case, there are in Northern Ireland special circumstances.

Can the Secretary of State also tell us what progress is being made on a Bill to implement the Stormont House agreement? Is there a timescale, and is a legislative slot available? She knows that many people would feel let down if bodies designed to deal with such issues cannot be set up.

These are immensely challenging issues, but let me once again reassure everyone in the House, and in Northern Ireland, that Her Majesty’s Opposition will work hard, in the spirit of bipartisanship, to play our part in helping to make the continuing progress that we all want to see. It is my strong belief that talks, discussion and negotiation, in the end, are the only way forward. Is the Secretary of State hopeful that roundtable talks will be possible in the near future? The prize of a more prosperous, stable and peaceful Northern Ireland is within reach. Let us all play our part in helping to seize it.

I thank the shadow Secretary of State for his clear commitment to a bipartisan approach and his reiteration of the consent principle at the heart of the Belfast agreement, which I am sure will be warmly welcomed across the House. In response to his first question, yes the full authority of the Government will be deployed in our efforts to try to resolve these two very serious issues facing Northern Ireland’s political leaders.

Do I agree with the Chief Constable’s assessment of the situation in relation to the Provisional IRA? Yes, I do. The shadow Secretary of State asked me to expand on that. I think that we need to be cautious about what information we put into the public domain, but we are giving serious consideration as to whether there is a fuller picture that we could share with the parties and the public.

The shadow Secretary of State asked for an update on the police investigation. I do not think that it would be appropriate, or that it would serve the interests of justice, to provide a running commentary, although I appreciate that interest in the case is high. I think that the important thing is for the police to be able to get on with their job and to follow the evidence wherever it leads them.

I agree that there must be no ambiguity about the fact that there is no role for paramilitaries in Northern Ireland. It is time that all these organisations disbanded. I also agree that we need to work across agencies and Government Departments, with the Government and the Executive working together, and indeed with groups in society, as we develop a broader strategy to deal with the scourge of paramilitarism. There is no easy political fix; we need a range of people making an effort to bring an end to the paramilitary presence in Northern Ireland.

With regard to the Independent Monitoring Commission, the important thing is not to prejudge what the parties will put forward during the talks. In my discussions with all the parties in recent days there has been some recognition that an independent body of that sort could play a role in resolving the questions around paramilitaries.

I agree with the shadow Secretary of State’s comments on the importance of implementing the Stormont House agreement. The Bill is being worked on as we speak, and we still hope to be able to present it to Parliament next month, as planned. I agree that it is important to press ahead with creating the institutions on the past that are contained in the Bill in order to give better outcomes and greater support to the victims of the troubles who have suffered most at the hands of terrorists.

Lastly, the shadow Secretary of State mentioned the implications of Northern Ireland’s special circumstances in relation to welfare. We have often said that we will not fund a more expensive welfare system in Northern Ireland than we do elsewhere in the UK, but our settlement with Northern Ireland does reflect the fact that it requires extra help, which is why public spending per head in Northern Ireland is considerably greater than it is anywhere else in the UK. Northern Ireland’s special circumstances are one of the reasons why the Stormont House agreement is accompanied by a package worth £2 billion in additional spending power for the Executive.

I thank the Secretary of State for her statement and for the steady manner in which she has reacted to recent events.

I congratulate the newly appointed shadow Secretary of State and thank him for the robust manner in which he stated that Her Majesty’s official Opposition will stand by the Belfast agreement and succeeding agreements that guarantee that Northern Ireland is a fully participating part of the United Kingdom so long as the majority deliver their consent. I am glad that that was delivered in the face of the new shadow Chancellor, the hon. Member for Hayes and Harlington (John McDonnell), who is no longer in his place.

In the talks, the Secretary of State has the full support of the people of Northern Ireland, who are exasperated and bewildered that the Stormont House agreement has not been delivered. Will she go forward by making it very clear that the current generation will be let down if the parties that are being difficult at the moment do not deliver on their responsibilities, and that future generations will be let down, because if powers were taken back to this Parliament, the local politicians could no longer implement corporation tax reduction, which is key to the long-term prosperity of every single citizen in Northern Ireland?

I, too, welcome the hon. Member for Gedling (Vernon Coaker) to his place as the new shadow Secretary of State for Northern Ireland. I welcome the robust way in which he set out the commitment to maintaining Labour’s approach on support for the principle of consent. I wish him well in holding the line in terms of the position of the Labour party.

Does the Secretary of State accept that we need to be reminded in this House of how we have got to this position: namely, Sinn Féin’s decision to renege on its commitments in the Stormont House agreement; and Sinn Féin’s links to an existing IRA, in the words of the Chief Constable, whose current members carried out a murder on the streets of Belfast? People need to remember how we got to this point today.

So far as the Secretary of State is aware of the First Minister’s discussions with the Government in relation to our concerns about the basis on which talks need to take place, will she commit to continuing to discuss with us in the next number of days how our concerns can be addressed to allow full participation in the talks by us and others? We will then be able to have a proper talks process that will resolve the outstanding issues and not cause any further fudge or putting off of the difficult decisions? We need to move forward, but it can only be on the basis of our concerns being addressed.

It is important for us to recognise the reasons why we have got to where we are on this. I do recognise that Sinn Féin’s change of mind on welfare reform has played an important part in destabilising relations between parties. One cannot have a coalition that works effectively if it is incapable of delivering a workable budget.

In answer to the right hon. Gentleman’s last questions, of course I will continue to engage with his party and others to discuss how we ensure that we have an effective talks process in which all parties can engage with enthusiasm and determination.

The Secretary of State said that she was very reluctant to reintroduce direct rule, and rightly so. I speak as somebody who led for the Conservative party for a number of years when major decisions on Northern Ireland were taken upstairs in a small room with very few Members of Parliament present, even fewer Members from Northern Ireland present, and nobody from the Assembly able to influence the affairs of Northern Ireland. Has she been able to put it to those taking part in the talks that the very stark choice is that either we make the institutions work or we go back to that very unsatisfactory way of governing Northern Ireland?

I firmly believe that no one wants to wind back the clock and go back to direct rule. As I have said, there are difficulties and frustrations with power-sharing and inclusive government, but it is hugely preferable to direct rule. That is one of the reasons why the Government are determined to work as hard as we possibly can with Northern Ireland’s leaders to find a way through to ensure that the Executive and the institutions can continue to work effectively to deliver on their priorities for the people of Northern Ireland.

I welcome the Secretary of State’s statement. I particularly welcome her view that this is not the time to re-impose direct rule. I must question, however, the need for the party politics in her statement. I hope that we can go forward in a more cohesive and co-operative manner.

The resignation of the First Minister and Ministers at Stormont was an unwelcome development. I understand the political frustration and I appreciate the stresses that politicians in Stormont are working under, but there needs to be leadership now, and the presence of all of them at the negotiating table is needed. A willingness to compromise by all parties to the negotiations is needed as well. No one should be going into these talks with anything but the best intentions and a determination to find a way forward that will allow the resumption of the Executive’s business at Stormont.

Alongside the full engagement of the UK Government, the involvement of the Irish Government would be advantageous. Ireland is not a disinterested party in this affair, and the good offices of her Government may provide an additional channel of opportunity. I understand that the Secretary of State has already been in touch with her Irish counterpart, and I hope that she will bring us up to speed on those discussions.

It is to be hoped that all the concerned parties will go into the negotiating rooms with a positive attitude and a determination to come away with a result that everyone can live with, even if it means that each has to give ground to get there. They have to enter into those negotiations without preconditions and without prejudging the outcome, and come to the table in a spirit of compromise and co-operation. The only real alternative is for them to lay out their case and allow the voters to judge them in an election, but that would leave Northern Ireland without the Assembly for even longer.

I wish the Secretary of State well in her endeavours over the next while, but may I ask her how far she considers us to be from getting all the parties around that table and whether she will update us on her discussions with the Irish Government?

In answer to the hon. Lady’s first point, I make no apologies for holding to account the official Opposition and their new leader. It is useful that they have confirmed today that the consent principle remains paramount for Northern Ireland.

I agree that we are in a serious situation. The hon. Lady talks of the need for Northern Ireland’s leaders to enter talks with a positive attitude and a willingness to compromise. I firmly believe that all the five largest parties in the Northern Ireland Assembly want this to work, are trying to find a way through, and want to resolve these two important questions. They are going to be extremely tricky to get right, but with determination I think it is going to be possible.

The Irish Government have been taking part alongside the UK Government in the round of cross-party talks that we have recently started, in accordance with the three-strand approach. I do recognise that their input can be very positive in trying to find a resolution on these matters.

I congratulate my right hon. Friend on her statement and welcome the reassurances of the hon. Member for Gedling (Vernon Coaker) in respect of the position of his party under its new leadership.

My right hon. Friend will remember from what happened at Christmas how important it was to engage those within civil society in the talks. I would be grateful to know what efforts have been made to re-engage with them in the light of recent events, and also what efforts have been made to contact the American authorities, who were extremely helpful at Christmas in brokering what we hoped was going to be an agreement.

I agree that it is helpful for civil society to be involved in trying to resolve these questions. As I said in response to the shadow Secretary of State, if we are going to deal with this paramilitary problem we need a response from across society, not solely from politicians. The business community can play a part, not least because they have campaigned long and hard for the devolution of corporation tax and can see it slipping through their fingers unless these matters are resolved.

I agree that the influence of the United States has often been hugely positive and helpful in Northern Ireland’s political history over the past 20 years. I keep in regular touch with the representative of Secretary of State Kerry, Gary Hart, who is following events closely.

The Secretary of State has mentioned dealing with the past. Has she had time to read the harrowing evidence given by the victims of Libyan-imported Semtex? There were strong views on how previous Governments and the current Government have dealt with the issue. The Government could help to sort this out—they really must do something. Will the Secretary of State please assure us that she will read the evidence and take action to make sure that the matter is settled once and for all?

Of course I will read the documents to which the hon. Lady refers. I fully recognise the scale of the suffering caused by the Libyan Semtex. The UK Government have always tried to provide support to the victims of those brutal incidents. It is our policy not to espouse individual claims, but we are doing our best to provide support for victims in their efforts to find a way forward. We will continue to do so, but the reality is that the situation in Libya continues to be very difficult. Of course, however, the interests and needs of the victims of Libyan Semtex are taken into account in our relationship with Libya.

Does my right hon. Friend agree that there will be no peace, security or long-term stability in Northern Ireland until we have dealt with the paramilitaries, and will she confirm that the police and security services are getting all the support and resources they need to do just that?

I believe that the police and security services have the resources they need to properly and appropriately combat the dissident republican threat. One of the reasons it is crucial that the Stormont House agreement is implemented is that, if the Executive do not have a workable budget and they continue to pay out on a more expensive and flawed welfare system, that will mean fewer resources for the police, which could have worrying consequences for front-line services.

The importance of implementing the Stormont House agreement should not lead to any indifference about its detail. Obviously, some of us have different views on welfare reform, but I will not dwell on that now. Questions about the past are particularly important. The Secretary of State should be aware that many victims and victims groups are expressing suspicion and concern about the burden of the proposals relating to the past and the fact that the Department of Justice in Northern Ireland is declining to have open consultation and hiding behind the fact that negotiations are taking place among party leaders.

Will the Secretary of State assure the House that, if she introduces the proposed legislation, she will not hide behind or rest on the fact that there was no proper consultation, she will meet the victim groups to hear their concerns and suspicions, and she will avoid the sort of misadventure a previous Government got into in 2005 with the Northern Ireland (Offences) Bill? Many of the victims groups view the schemes and language attached to the arrangements on the past as on a par with that misadventure.

The hon. Gentleman and his party do not share my view on welfare, but I emphasise that the agreement they helped to secure at Stormont castle was a good one for welfare in Northern Ireland. It provides a reformed system that is more effective in rewarding work, but it will also top it up from Northern Ireland’s own resources, giving Northern Ireland the most generous welfare system in the United Kingdom and one of the most generous in the world.

On the proposed legislation, there was a discussion about having a consultation in Northern Ireland, but there was not enough consensus to enable that to happen. We will do everything we can to engage with a range of groups and with the Northern Ireland Affairs Committee in advance of publishing our Bill, which we propose to do shortly.

The Secretary of State says that the Government will legislate on welfare reform as a last resort. Can she indicate how close we are to that last resort? Can she conceive of a situation where we could get to next year’s Assembly elections with no deal, without us having to take over that responsibility?

We have reflected on whether it would be appropriate to set deadlines at this point. I do not think we are at that stage yet, but I reiterate that we cannot let this situation drag out indefinitely. The public finances are at stake. We have a duty to safeguard the interests of the taxpayer and we believe that, if the Northern Ireland parties cannot resolve these questions, ultimately this House will have to do so.

Despite the present crisis, is it not a fact that the Belfast agreement has saved the lives of so many people, certainly compared with what happened previously? May I tell the Secretary of State, since she was not here at the time, that when atrocities and crimes were being committed by the IRA, the overwhelming majority of Labour Members of Parliament denounced such actions, as we did, of course, the murderous crimes of the loyalist gunmen? To describe the actions of the IRA in any way as an armed struggle is absolutely wrong and farcical.

I will reflect on whether we could talk about more specific conditions, but I am really not sure that trying to set them out at the Dispatch Box today would be helpful. All the parties know that we need to find a way through this. They have a deal—all five parties agreed it at Stormont castle. It is a good deal for Northern Ireland, giving it a better welfare system—one of the most generous welfare systems in the world. We need to find a way to get that back on track and get it implemented.

May I join others in welcoming the hon. Member for Gedling (Vernon Coaker) to his new position? The maintenance of a bipartisan approach in this House has been enormously useful and necessary at times to keep the peace process on track. I say to the Secretary of State, in the nicest way possible, that that may occasionally mean that she and her colleagues will have to resist the temptation to make the most obvious digs, however tempting that may be.

May I welcome, albeit with a heavy heart, the Secretary of State’s recognition of the possible need to create a future Independent Monitoring Commission-type body? May I encourage her to talk to the parties in Northern Ireland and, indeed, the Irish Government and other interested Governments about the remit and possible membership of that body so that, should its constitution ever be necessary, it can be done as effectively and as quickly as possible?

I am delighted to hear the right hon. Gentleman confirm that the Lib Dems will continue to take a bipartisan approach. He makes fair points about a potential new IMC. This is an urgent matter for Northern Ireland’s political parties to consider, but I agree that the input and thoughts of the Irish Government and contacts in Washington could also be helpful.

Will the Secretary of State join me in regarding with the utmost horror the now well-known comments made by the shadow Chancellor, which in particular endorsed armed struggle, bombs and bullets?

It is important for Her Majesty’s Opposition to express very clearly from their Front Bench that they will support the self-determination of the people of Northern Ireland. That is an important confidence-building issue and I welcome the statement made by the shadow Secretary of State and hope that others on Labour’s Front Bench were listening.

Does the Secretary of State agree that at some point the can kicking will have to stop and that the Government will have to start dealing effectively and determinedly with the issues of criminality that go right to the heart of the poison in Northern Ireland society? The sooner that is tackled, the better for everyone—both Catholic and Protestant—in getting these people off their backs.

Like the hon. Gentleman, I welcome Labour’s confirmation of its strong support for the consent principle. His point about criminality has been at the heart of many of my discussions with his party colleagues and others over recent days. I am convinced that the Police Service of Northern Ireland, the Garda and their security partners are doing a huge amount of good work in tackling such matters, but I am of course open to seeing whether we as a Government can, with others, do anything further or take any further action to provide confidence that no criminality will be tolerated and that we will do everything we can to combat it.

My right hon. Friend has raised the issue of perhaps creating an independent monitoring commission. What consideration has she given to the terms of reference, the membership and the timetable for the introduction of such a body, and whether any of the political parties in Northern Ireland could veto such an exercise?

We would aim to build consensus across the five main parties. I would hope that we can discuss the terms of reference and membership in due course. As always with such matters, there is a trade-off between time and the perfection of the organisation: some structures may be ideal, but would be problematic if they took a long time to get established. We need to look for a compromise or middle way that provides an effective independent institution in which people can have confidence, but does not take forever to set up and to report.

If I have learned anything from Northern Ireland in 30 years it is, first, do not leave a vacuum, and secondly, choose your words very carefully. The Secretary of State has come to the House today and has quite clearly not chosen her words very carefully in relation to tackling the history of some of my leaders. In the interests of moving things forward, what will her leader do now? I am not asking what my leaders did in the past, but what her leader will do now. Will he engage in a better way than he has during recent impasses in Northern Ireland, when his not being there has been very unhelpful?

I assure the hon. Gentleman that the Prime Minister remains constantly engaged in these matters. He is updated all the time, and he has played a hugely positive role in delivering many things in Northern Ireland recently, not least the legislation on devolving corporation tax, which he championed for many months. We should bear in mind that it is important to scrutinise the new leadership of the Opposition. The track record of the attitude of the right hon. Member for Islington North (Jeremy Corbyn) and the shadow Chancellor on IRA violence is very worrying, and I make no apologies for challenging them in the House on such matters.

I thank the Secretary of State for her statement. I, too, welcome back the hon. Member for Gedling (Vernon Coaker) as shadow Secretary of State for Northern Ireland. I also welcome his comments on the issue of consent in relation to the people of Northern Ireland, and I look forward to that being repeated by his party leader and the shadow Chancellor.

The Secretary of State will be aware that very few cases of criminality have been brought by Her Majesty’s Revenue and Customs for fuel laundering and tobacco and alcohol contraband products. Is the Secretary of State willing to engage the National Crime Agency in tackling the issue of criminal and organised paramilitary activity? It is an international issue, because some of those concerned come from the Republic of Ireland jurisdiction. I hope that the Secretary of State will ensure that they are not let off the hook by making sure that the Garda Síochana is also involved in tackling such criminality.

The hon. Gentleman is right to raise matters relating to HMRC and the National Crime Agency, as well as law enforcement bodies south of the border. They all have a hugely important part to play in tackling organised crime, criminality and cross-border crime, and I know that they are making every possible effort. I will engage with my colleagues across government who have responsibility for such bodies to see whether we can do more to ensure that we do everything we can to combat criminality and cross-border crime.

I thank the excellent Secretary of State for coming back to the Commons to update us. I am not sure about the timescale in relation to what is undoubtedly a crisis. Are we talking about having to resolve it within weeks or within months? If it has to be done within weeks, will she undertake to request a recall of Parliament during the conference recess, if necessary?

I do think we must press ahead as a matter of urgency. Last time I stood at the Dispatch Box, I said that we should aim for a period of four to five weeks. These matters are hugely difficult, but as every day passes, the credibility of the institutions is at stake. We do not want them to carry on in a dysfunctional way; we want to find a way to ensure that they are back up and running properly to enable them to deliver on their priorities in achieving a secure Northern Ireland for the future.

I welcome my hon. Friend the Member for Gedling (Vernon Coaker) to his position.

When I was Minister for Social Development back in 2007, I had to take action to ensure the protection of the then political institutions in Northern Ireland, because of paramilitarism. That position was supported and substantiated by the Police Service of Northern Ireland, but it was not supported by either Unionist parties or Sinn Féin. In that respect, does the Secretary of State agree that we need all parties in Northern Ireland to commit to round-table talks to discuss and resolve all the issues in order to underpin the political institutions and ensure that there is no further frustration among the wider public? Does she agree that there is a need, as the hon. Member for South West Wiltshire (Dr Murrison) emphasised, for the active involvement of a member of the American Administration, possibly as the independent chair of the round-table talks?

As I said in my statement, we will only find a way ahead if we can engage all of Northern Ireland’s five parties in the process. I think that the American influence is positive, which is why I am engaging regularly with Senator Hart and keeping him updated. He has provided very helpful influence in relation to previous discussions, and I will continue to work with him.

I thank my right hon. Friend for her statement. She will agree with me that with power comes responsibility. In Wales and Scotland, devolved Administrations agree balanced budgets. Does she agree that it is now important that all, not just some, parties in Northern Ireland are prepared to agree a deal to do the same and to implement and deliver it?

My hon. Friend is absolutely right. It is not possible to function as a Government unless that Government can live within their means. That is the key to everything else. If they do not have a workable budget, they will be plunged into the sort of chaos that we have seen in some parts of Europe. That is why it is imperative to implement the Stormont House agreement. It gives Northern Ireland a good deal, a workable budget and sustainable public finances.

In her statement to the House, the Secretary of State directly quoted the Prime Minister’s description of the political settlement in Northern Ireland as “a huge achievement”. It was, and it is. At what stage does the Secretary of State believe that it would be helpful for the Prime Minister to go to Northern Ireland and become directly involved in finding a resolution to the current difficulties?

I assure her that he is in day-to-day contact about events as they unfold. The situation is extremely worrying and getting more dangerous all the time. The ordinary people of Ireland, including families—like mine—who live close to the border, are frankly worried sick over this. Is it not time for the Prime Minister and No. 10 to bother to get themselves involved?

Secretary of State, last week when the Prime Minister spoke in this Chamber, Members listened to his impassioned plea for the institutions in Northern Ireland but felt that he missed the elephant in the room. Given the lack of any content in the statement referring to consequences, will the Secretary of State outline what concrete proposals she has for consequences for those who wish politically to disrupt or dismantle our institutions and our peace?

A number of parties have raised their concerns about the way the rules on exclusion from the Executive work. It is important for the political parties to give thought to that. A number of parties have indicated that they would like to look again at the ministerial code and how it is applied. It is important to look at that in the cross-party talks, in which I hope all parties will take part.

Has she asked the parties in Northern Ireland whether they would welcome the assistance of a Senator Mitchell figure to act as an honest broker, in an effort to save the peace and institutions at this worrying time?

It is obviously important that Washington and US figures continue to provide support. There is not a clear case for a Senator Mitchell-type role, but I am open to ideas and discussions on those matters.

I thank the Secretary of State for her statement. I am pleased to have secured a Back-Bench debate in this Chamber on 12 October to give everybody a chance to discuss this matter. We would like to get back to the Belfast agreement and the principles in it, which were voted on and agreed to in the referendums 17 years ago. On one key point from that agreement, we do not believe that the truth about the IRA can be negotiated as part of the talks, and neither can the issue of tackling paramilitary criminality. That should not be part of a process whereby nothing is agreed until everything is agreed. The truth cannot be a bargaining chip. Will she ensure that that point is fully recognised?

I do recognise that point. The hon. Gentleman’s party leader, Mike Nesbitt, has made it very clear. I reiterate that it is essential that both those questions are resolved. Both cause a huge threat to the sustainability and future success of the institutions. Therefore, both must be addressed.

I am sure that the Secretary of State will agree that with all the punishment beatings, the shootings, the murders, the 160 criminal gangs operating on both sides of the border, and a fuel-smuggling organisation run by republicans that is the second best to western Europe, this is an unacceptable society for the people of Northern Ireland. A group of people who have been forgotten about—the wounds are being opened again—is the victims. We saw some of that yesterday on TV. The wounds are being opened again and people are suffering again. That is an intolerable situation to be in.

It is always important to have a reminder of the interests of those who have suffered most as a result of the troubles and the terrorism that took place. The hon. Gentleman is right to highlight the problem in Northern Ireland of so-called paramilitary assaults. These things are utterly unacceptable. For people to seek to take the law into their own hands is just an excuse for violent thuggery. Many people have lost their lives or suffered permanent disability as a result of those assaults. That is one reason why we need to address urgently the role of the continuing paramilitary organisations, so that we can finally see an end to what really is a scourge on Northern Ireland’s society.

I thank the Secretary of State for her statement. I am especially pleased to see the shadow Secretary of State back in his position. I look forward to welcoming him down to Strangford. He said that it was the best constituency in Northern Ireland and I know he will say it again the next time he is there.

Political developments in Northern Ireland are obstructed and held back by criminality. Dissident republicans—who have been involved in maiming and killing—are involved in my constituency of Strangford in illegal fuel smuggling and the disposal of that fuel. The rise in the number of people being intimidated out of their homes by thugs is at an unprecedented level in my constituency and it continues to cause great concern. What discussions has the Secretary of State had with the Chief Constable in relation to those matters, and what steps will be taken to ensure that such criminality right across the Province and in my constituency comes to an end?

I am regularly briefed on the actions that are taken to combat the dissident republican threat. That extends not only to their terrorist activities but to the criminal activities that they engage in to fund those terrorist activities. I am working closely with the PSNI and its security partners to ensure that the UK Government do all they can to combat this menace, whether on the criminal side, the terrorist side or both.

With permission, Mr Speaker, I would like to make a statement on the political situation in Northern Ireland. Over recent days, I have been involved in a series of discussions with the Prime Minister, the five largest parties in Northern Ireland and the Irish Government. On Thursday, we announced a fresh round of intensive cross-party talks. Those talks will begin in Stormont this evening and they will be conducted in accordance with the established three-stranded approach.

The Government’s objectives are clear. We are committed to working with Northern Ireland’s political leaders to ensure that we have a fully functioning Assembly, able to deliver for the whole community; a Northern Ireland where a stronger economy brings greater prosperity for all; and a Northern Ireland that is no longer defined by its divided past, but by its shared future. But to achieve this we need urgently to tackle the two main sources of current political instability. These are, first, the issues arising from continued paramilitary activity and, secondly, the implementation of the Stormont House agreement.

Turning to the first of these, on 12 August a prominent republican, Kevin McGuigan, was brutally murdered in the Short Strand area of east Belfast. This followed the gunning down of another senior republican, Gerard Davison, in the Markets area of Belfast in May. While it is not yet possible to know with certainty who was responsible for these murders, on 22 August the Chief Constable set out the Police Service of Northern Ireland’s assessment of the McGuigan case. This was the Chief Constable’s estimate at that date, but we should recognise that we do not yet know where the investigation will ultimately lead.

The Chief Constable confirmed that the police were following a line of inquiry that indicated that members of the Provisional IRA were involved in the crime. He said that the PSNI did not at that stage have information to indicate that this involvement was sanctioned or directed at a senior or organisational level in the Provisional IRA. On the status of the Provisional IRA, the Chief Constable’s assessment was that some PIRA organisational structures still exist, but for a radically different purpose from before. His view was that the organisation was committed to a political path and was no longer engaged in terrorism, although some current and former PIRA members continued to engage in criminal activities for personal gain and for personal agendas.

I do not intend to comment further on what is a live police investigation. The PSNI must be allowed to pursue its lines of inquiry wherever the evidence leads. The police assessment I have outlined may change over time, but I want to make this clear: there was never a justification for politically motivated violence in Northern Ireland, from whichever side of the community it came. During the troubles, paramilitary organisations inflicted huge suffering on thousands of ordinary people. These organisations should never have existed in the first place; they should not exist today, and they should disband.

For our part, the Government believe fundamentally in the rule of law. We will not compromise it. We stand fully behind the Mitchell principles of democracy and non-violence. Only parties committed to exclusively democratic and peaceful means can or should be eligible to participate in Northern Ireland’s political institutions.

I believe that all the parties in the Northern Ireland Executive are committed to those principles, but I am fully aware that the fallout from the murder of Kevin McGuigan and continued existence of PIRA structures is a cause of grave concern, as is the continued existence of other paramilitary groups. So we have moved swiftly to convene talks to address these matters and to consider how best we can make progress towards the day when paramilitary groupings are consigned once and for all to Northern Ireland’s history.

The second matter for consideration in the talks is the implementation of the Stormont House agreement. The Government believe that the agreement is the best hope of building a brighter, more secure future for Northern Ireland, but for that to happen, it is essential that the agreement is implemented in full by all those who participated in the negotiations last autumn. We are delivering on our side of the deal.

In March, we passed legislation to open the way for the devolution of corporation tax powers. In line with the Queen’s Speech, we are on course to introduce a Bill in October to set up important new institutions to help deal with the painful legacy of the past, and we are now releasing funding to enable the planned voluntary exit scheme to proceed in order to take forward much-needed public sector reform.

The manifesto on which we were elected commits us to working with each of the other participants to ensure that all aspects of the agreement are implemented. That has to include the financial provisions of the agreement—including welfare reform. Without welfare reform and measures to deal with in-year pressures, the budget passed by the Executive in June simply does not add up. This raises the real prospect that the Executive will start running out of money, with resulting damage to front-line public services such as hospitals, schools and policing.

In those circumstances, the Government cannot stand by and let this situation drag on indefinitely, with Stormont less and less able to deliver key public services. As a last resort, we would be prepared to legislate here at Westminster for welfare reform in Northern Ireland, but I must emphasise that we would do so reluctantly and only after we had exhausted all the realistic alternatives. By far the better outcome would be for the Northern Ireland parties to reach agreement to resolve this blockage themselves without the need for Westminster intervention. I still believe that is possible, and that is why we will press ahead with talks this evening, determined to see the implementation of all aspects of the agreement.

We are a one nation Government and we want to build a Northern Ireland where politics works, the economy grows, and society is stronger and more united. We strongly support the power-sharing devolved institutions established under the Belfast agreement. The future of these institutions is in jeopardy if the two very serious matters I have outlined here today are not resolved.

I do not underestimate the challenges we face, but I believe that a way through can be found. That is what we will be striving to achieve as we embark on this new talks process with urgency, focus and determination. Northern Ireland political leaders have shown remarkable courage over the last 20 years and have achieved truly great things by working together. We need to show that same spirit over the next few short weeks. I commend this statement to the House.

I sincerely thank the Secretary of State for advance sight of her statement, and I would like to apologise to the Secretary of State and the House for the absence of my hon. Friend the Member for Bury South (Mr Lewis),the shadow Secretary of State, who has asked me to relay his apologies for not being in attendance today. He has to be in Belfast for the launch of the Heenan-Anderson commission report.

The official Opposition strongly support the UK and Irish Governments’ decision to convene all-party talks this week in an attempt to secure a positive way forward on the challenging issues raised by the murder of Kevin McGuigan Sr and its aftermath, together with implementation of the Stormont House agreement. There is no doubt that a combination of real concerns following the Chief Constable’s assessment in relation to the status of the Provisional IRA and the failure to agree a sustainable budget pose the biggest threat to political stability in Northern Ireland for many years.

We urge all parties to seek the necessary compromises and confidence-building measures that can avert the collapse of the institutions. The people of Northern Ireland have had their faith in politicians and political institutions badly damaged by the perpetual crises of the past few years. There should be no doubt that the vast majority want to see progress, and a return to a focus on issues such as jobs, education, health and opportunities for young people. It is also the case that business confidence, and therefore investment, are now being put at risk by political uncertainty. All parties in Northern Ireland must take responsibility for stepping back from the brink, and for finding a way forward.

I have some questions for the Secretary of State. In the aftermath of Kevin McGuigan’s murder, she said that the Government had always been aware of the continued existence of the Provisional IRA. Will she make clear exactly what she meant by that statement? Some have proposed the reintroduction of the Independent Monitoring Commission. What is the Secretary of State’s assessment of the feasibility, or the desirability, of such a measure? At what precise stage of the current financial year will the Northern Ireland budget cease to be sustainable? Are the Government now actively considering introducing emergency legislation to suspend the political institutions and return to direct rule if the current round of talks should fail? Finally, what further detail can the Secretary of State provide following her statement yesterday that the Government would now consider legislating for welfare reform and releasing funds for the civil service voluntary redundancy scheme, and what will the timeline be?

Having asked those questions, I want to place on the record the support of Opposition Members for the talks that will take place this evening, and stress our continuing and undiluted endorsement of the bipartisan approach in which we both believe.

The Secretary of State has rightly listed the challenges that face the people and the politicians of Northern Ireland, but we must never ignore the progress that has been made. These may be dark and dangerous times, but I profoundly hope, and I believe, that the good sense of all in Northern Ireland will prevail. It may be too late to hope that Kyle Lafferty’s last-minute goal in the match against Hungary last night has imbued Northern Ireland with a feelgood factor that will permeate every aspect, but surely this must be the time to reroute the march to the cliff edge and head back to sanity—and forward to the peaceful and prosperous future that we all know Northern Ireland deserves.

I thank the shadow Minister for his support. Let me deal with his questions.

In relation to the existence of the provisional IRA, my assessment is the same as that of the Chief Constable, and the assessment that I have been given by security advisers during my time as Secretary of State is broadly in line with the summary given by the Chief Constable that I outlined earlier: the continued existence of some organisational structures, with no involvement in paramilitarism or terrorism, but with individual members pursuing criminality for personal gain to pursue personal agendas.

As for the IMC, it is an important issue to consider, and I think that we would want to consider it as part of the talks. It may well be the case that if an IMC-type body were set up, we would want to ask it different questions from those that were asked by the IMC; but it is, of course, a model that we should consider when proceeding with the important process of dealing with the issues related to continuing and wholly unacceptable paramilitary activities.

The hon. Gentleman asked at what point the Northern Ireland Executive would become unsustainable. I am afraid that it is already unsustainable. There are already Ministers who feel that they cannot sign off projects because of the uncertainty surrounding the future availability of funds. I think that those matters are very urgent.

I am conscious that the issue of suspension is very sensitive. I have received representations on it from the Democratic Unionist party. I understand the DUP’s concerns, but the Government do not feel that it would be right to suspend the institutions at this stage and in these circumstances. If the circumstances were to change in the future, we would of course need to look at all our options.

As for the welfare reform matters, I said that we would be prepared to legislate as a last resort, but we are not at that stage yet. My priority will be working with the parties to find a way to ensure that the welfare package in the Stormont House resolution is implemented, because it is a good deal for Northern Ireland. The voluntary redundancy scheme is expected to start its operation with the first participants leaving their roles at the end of this month.

One of the worrying aspects of this whole situation is the lack of respect and lack of confidence that people in Northern Ireland now have for the institutions, and that makes it very important that we move those institutions towards becoming efficient decision-making bodies so they can enjoy some successes. Does the Secretary of State agree that that evolution is best carried out with the institutions up and running, rather than attempting to do it from a standing start?

I agree that it is hugely important that we keep the devolved institutions up and running. I know the situation is difficult and that there are tensions between the participants in the institutions. There is no doubt that sharing power comes with real tensions and real challenges, but it would be a huge setback if the institutions were to collapse. There can be no guarantees about when it would be possible to set them up again, so it remains the Government’s top priority to ensure we do all we can to support these institutions and the parties in finding a way through these current very serious difficulties.

I thank the Secretary of State for her statement.

No one in this Chamber will wish to see the end of the progress made in Northern Ireland and no one will wish to see the Stormont House agreement fall. SNP Members stand ready to offer whatever assistance we can to all sides in finding a way forward. We believe that power should be exercised as close to the people affected as possible, and Stormont’s continued success will enhance that.

The withdrawal of parties from the Executive was a worrying development, and their re-engagement would be welcome. It would be a great blunder if the austerity cuts Northern Ireland is facing became the catalyst for the breakdown of the democratic institutions that have helped to hold the peace, notwithstanding the recent violence, and I urge the UK Government to redouble their efforts to find a resolution to this problem.

The parties in Northern Ireland have faced down greater problems than this and found ways forward. I think their perseverance and desire to serve their constituents well can be relied upon to provide a basis for a resolution, provided they have adequate support from Whitehall and this place.

The Government will want to see progress made, and I can assure them they will have the support of the SNP at all levels in helping Stormont build for the future. A fully functioning cross-party institution there seems, at the moment, to be the best option for all of us in these islands. I reiterate that if there is anything the Secretary of State feels we can assist with, we stand ready and willing to help in any way we can.

I am grateful for the hon. Lady’s support. It is of course a worrying development that the UUP felt the need to withdraw from the Executive, but the priority now is for all parties to work together to try to find a way through this impasse.

The hon. Lady refers to austerity. We feel it is very important for the Northern Ireland Executive to have sustainable public finances. To do that, they need to deal with in-year pressures in their budget and to implement the Stormont House agreement provisions on welfare reform. These would give Northern Ireland the most generous welfare system in the United Kingdom, and overall public spending per head in Northern Ireland remains well ahead of the rest of the UK, rightly reflecting the particular circumstances of Northern Ireland, but I am afraid that none of us in the developed world is immune to the difficult decisions that have had to be taken to deal with the deficit we inherited.

I thank the Secretary of State for her statement and the measured manner in which she has conducted herself in recent weeks. I was in Northern Ireland recently, and there is complete exasperation that local politicians, having come to an agreement with the Stormont agreement, have not delivered it. Every day that passes we see the ability to reduce corporation tax in Northern Ireland missed. We see projects missed and going instead to the Republic of Ireland, bringing jobs and investment there. There is real exasperation on the ground. What the Secretary of State has said has huge local support, and I encourage her to take an extremely robust line in talks. She will have the support of the people of Northern Ireland. Will she confirm that to impose welfare reform from here would be a cop-out, and now is the time for local politicians to deliver on their responsibilities to the local people who voted for them?

I thank my right hon. Friend for his question. I agree that the devolution of corporation tax could have a transformational effect in Northern Ireland. It is understandable that it has been the key ask of Northern Ireland’s leaders over many years. I pay tribute to my right hon. Friend for his role in taking forward the campaign for corporation tax devolution. The opportunities provided by that are one more reason why it is so essential to find a way through here, because it is frustrating to see this great change—this potential economic game-changer—receding into the distance. It will never be possible to implement corporation tax devolution without a resolution on sustainable public finances, and that is one of the reasons why I will be working hard in the talks to resolve those questions.

As a result of the Chief Constable’s assessment arising out of the recent events in Northern Ireland, does the Secretary of State agree that it cannot be business as usual as far as the Northern Ireland political institutions are concerned? The Democratic Unionist party, speaking on behalf of many thousands of people who actually elect us in Northern Ireland, is very clear that this matter cannot be swept under the carpet, fudged or ignored. We are not prepared to continue as though nothing has happened. Murder has happened, carried out by those who are linked to a party of Government. Just imagine if that were to happen here—that a party in Government was linked to a paramilitary organisation still in existence whose members carried out murder on the streets of the United Kingdom. It is an intolerable situation and it must be sorted out at the talks. Serious consequences will flow from failure, striking at the very existence of devolution.

Does the Secretary of State accept the need to deal also with the criminality of the provisional republican movement and the paramilitaries? Does she also accept that one of the options—she has hinted at this already—that she may be forced to consider is to suspend the Assembly and the political institutions in order in the long run to restore and maintain any hope of the long-term viability of devolution and the Assembly?

The talks must also be about the implementation of the Stormont House agreement, not a renegotiation. I am referring to the remarks of the former Secretary of State, the right hon. Member for North Shropshire (Mr Paterson). Instead of issuing a blanket condemnation of all Northern Ireland politicians, he and other Members of this House should realise there are parties in Northern Ireland who are prepared to move forward, make the difficult decisions and implement welfare reform, and that it is Sinn Féin and, sad to say, the SDLP that have blocked those decisions.

Let us be very clear about where the blame lies. It does not lie with all the politicians and political parties of Northern Ireland. This is now about getting on with implementing the Stormont House agreement, which all the parties, including Sinn Féin, signed up to. That is what must happen in these talks, or else we are going to have a very serious situation indeed.

I do recognise that it cannot be business as usual. That is why the Prime Minister has moved swiftly to establish this fresh talks process, to address with urgency precisely the questions the right hon. Gentleman has outlined. Of course, overshadowing all this is the fact that two individuals have been brutally gunned down on the streets of Belfast.

The right hon. Gentleman raises the matter of criminality among members of the Provisional IRA. Any criminality is to be condemned, whether or not it is committed by a member of a paramilitary organisation. Whatever label these people choose to give themselves they are criminals, and the PSNI has the Government’s full support in pursuing them and bringing them to justice and putting them in prison where they deserve to be.

The right hon. Gentleman mentioned suspension. As I said in response to the shadow Minister, we do not feel it would be right to do that in the current circumstances. If those circumstances change dramatically in the future, we will of course keep all options open and consider them all.

I fully agree with the right hon. Gentleman’s statement about the subject matter of the talks and the Stormont House agreement. We are not renegotiating; we are simply finding a way to relieve the blockage of implementation and make sure that the agreement is implemented in full.

I, too, congratulate my right hon. Friend on the calm and measured way in which she has dealt with this difficult situation. Having served in Northern Ireland three times, I am fully aware of the difficulties that she and many others face. I should also like to congratulate the police on the good work that they do. We all know that the Provisional IRA exists and that it is involved in criminal activities. Can my right hon. Friend assure the House that the fear of reigniting a conflict will not in any way prevent the police from chasing thugs on both sides of the political divide?

Yes, I can give my hon. Friend that assurance. The PSNI will pursue criminality and criminal offences wherever they find them, and it is right that they should do so without fear or favour, uninfluenced by the political climate.

On behalf of the Liberal Democrats, I wish the Secretary of State well in her endeavours in convening the talks. We very much share her aspiration to see a fully functioning Assembly in Northern Ireland, although I have to say to her in all candour that I think the answer lies not in her hands but in those of the Northern Ireland parties themselves. She speaks of the possibility of suspension, but my understanding is that that would be next to impossible politically and that there would be significant legal impediments to its happening as well. What assessment has been made of those legal impediments?

I thank the right hon. Gentleman for his support. I agree that resolving these questions lies primarily in the hands of the Northern Ireland parties and their elected leaders. There is no power on the statute book relating to suspension. If any future Government were to consider suspension, it would require primary legislation. That is not part of our current plans.

I congratulate my right hon. Friend on the work that she is doing, but may I press her further on the timetable? The Executive appear to be suspended in regard to meetings, but the budget and the Stormont House agreement need to be implemented. If the talks are unsuccessful, at what stage would my right hon. Friend come back with further legislation in this place to implement that budget and the legislation that is required?

The next four to five weeks are going to be absolutely crucial. These matters are very urgent, as we have heard from a number of hon. Members around the House. The Stormont House talks took 150 hours over 11 weeks, and it was Christmas eve before we nailed down that deal, but we do not have the luxury of that timetable this time round. We need a much shorter, sharper, more focused and more intensive process, and that is what I shall be seeking.

Will the Secretary of State tell us how this new round of intensive cross-party talks will be different from previous rounds of intensive cross-party talks, the last of which led to the Stormont House agreement? What has changed that makes her feel that these talks will be successful? Does she not feel that it is time to be planning for a properly working Assembly with an Opposition and a Government?

On that last question, the Conservatives have a commitment to supporting an official Opposition, and moves were made in that direction in the Stormont House agreement, which is one of the reasons that we want to see it go ahead. The hon. Lady asks whether these talks will be different from previous talks. In many ways, they will be very similar to previous ones, some of which succeeded while others did not. Another thing that they will have in common with previous cross-party talks is that even if we have a successful outcome culminating in an agreement, that will be just one step along the much longer road of getting implementation properly effected.

I welcome the Secretary of State’s statement and the Government’s continuing commitment to the peace process. Does she agree that peace will be dependent on having a stable devolved Government with a stable Executive and based on stable finances? Does she also agree that all the parties involved should be prepared to take the decisions necessary to deliver this, and not just some of them?

My hon. Friend is right to suggest that success in Northern Ireland is inextricably linked to a stable, devolved, power-sharing Government. It is also hugely important for those who are part of that Government to take responsible decisions on the public finances. As we all know, they are often painful decisions, but the alternatives are far worse, as we have seen from the melancholy experiences of Governments around Europe who have lost control of their spending.

May I reassure the Secretary of State that the Social Democratic and Labour party has always taken responsibility, unlike others who have upset themselves and boycotted—[Interruption.] In spite of the hecklers behind me here, who have little constructive to offer, I should like to say that the SDLP still supports the Stormont House agreement, but that we reserve the right to amend the gaps and repair the flaws in it. The difficulty was that when my heckling friends produced a Bill, it was a flawed Bill. We tried to help them repair those flaws, but they would not tolerate those repairs. They refused even to consider constructive amendments to their flawed and inadequate Bill.

It is important to set the record straight. The SDLP will always uphold its responsibilities on every occasion, not just on the few occasions that suit party political purpose. Does the Secretary of State accept that it is not the existence of the Provisional IRA—God knows, we in the SDLP have reminded her and her predecessor time and again that it continues to exist—but the activities and functions of that organisation that cause the problems? One person’s radically different purpose is another person’s mafia programme extending to a financial empire that undermines attempts to rebuild our economy. Does she also accept that withdrawal, abstentionism, suspension, adjournment and all these other gimmicks that are used, with threats and preconditions, make it difficult to arrive at a constructive and honest solution? We all want positivity, but we must all put our shoulder to the wheel and be positive all the time.

I must emphasise that these talks are not about a renegotiation of the agreement. We need to get the agreement implemented, and that is the priority. The hon. Gentleman mentions the forthcoming Bill, which will be on its way in October. We have been working hard on that and we have had helpful input from the Northern Ireland Executive. He is right to raise concern about the activities of members of the Provisional IRA. His party, along with others, has been forthright in criticising members of all paramilitary organisations. Recent events have brought into sharp focus the pressing need to see all paramilitary organisations disbanded. There is no place for them in Northern Ireland, and that subject will be an important part of the talks. On the question of funding for the Executive, I urge him and his party to be flexible and pragmatic. The deal in the Stormont House agreement was a generous one, and the welfare package would give Northern Ireland the most generous welfare system in the country and put the finances of the Executive on a sustainable basis. I hope that hon. Members will bear that in mind.

The allocation of resources between different operations will be a matter for the PSNI; it is not a matter for me to interfere with. I emphasise, however, that the Government provide additional resources to the PSNI to counter the terrorist threat, and the fact of those resources’ presence means that the PSNI can release resources to pursue other activities, including this case.

Will the Secretary of State address the issue of criminality? Murder is wrong, and we abhor it. The reality is that the Chief Constable has clearly indicated that the Provisional IRA and other paramilitary groups are now effectively organised criminal gangs. This is not just a question of resourcing the PSNI. There have been no arrests in south Armagh in the past few years, despite the fact that a multimillion-pound criminal empire is being operated there by the Provisional IRA. Is it not time for HMRC to be given not only the necessary resources but the power to start arresting people?

On criminality, I have set out the Chief Constable’s position, which I share: individual members of the Provisional IRA are involved in criminality for personal gain and to pursue personal agendas. I have discussed this matter with the Chief Constable on a number of occasions, and his view is not that there is organisational involvement in criminality, save of course for the fact that existence involves criminal conduct, because it is a proscribed organisation.

On arrests, the Chief Constable has indicated that he wants a better clear-up rate on paramilitary beatings. They cause huge concern and often have fatal consequences, and it is utterly unacceptable for organisations to seek to take the law into their own hands. On arrests in South Armagh, I can assure the right hon. Gentleman that the PSNI, HMRC and their various security partners are working very hard to bring to justice anyone responsible for criminality, be it in South Armagh or in the rest of Northern Ireland. Indeed they are working with their partners to tackle those who seek to exploit the border and engage in criminal conduct south of the border, too.

The politicians from Northern Ireland are some of the most courageous politicians we have, and they have worked hard for years. It is good to see the Secretary of State at the Dispatch Box, but it is even better when she is not at the Dispatch Box, because that means things are going well. Having a boring Secretary of State is rather useful, so it is sad that she has had to come to make this statement today. I wish to ask about the specific issue of welfare reform. Judging by the timetable she mentioned earlier, we could expect, if it is necessary, that this legislation will come back almost in the first week after the next recess. May I ask that we have enough time to scrutinise it, if it does come back, because there has been a tendency in the past to rush Northern Ireland legislation through quickly?

I agree that Northern Ireland’s elected leaders have achieved great things over the past 20 years and that in many ways it is better for Secretaries of State for Northern Ireland not to be at the Dispatch Box, because sometimes their being here means bad news, but there is much to celebrate in Northern Ireland. I have been at this Dispatch Box talking about economic prosperity in Northern Ireland, the great events that have been run there in recent years and the high quality of its education. We should not forget, even at this difficult time, that Northern Ireland is a great place to live—it has so much going for it. We just need to sort out these political impasses in order to let the place flourish as it should. On welfare reform, I assure my hon. Friend that this legislation will not be coming to the House in October. It is a last resort and we will be working with the parties to try to find a way through before we consider whether, in the end, we have no choice but to legislate at Westminster.

The Secretary of State has taken a two-strand approach. She clearly has a view on the welfare reform: if all else fails, she will have the nuclear option of legislating in this House. Has she a similar view on the issue of paramilitaries? How exactly does she see things moving forward in dealing with that? Does she have the resources in the Northern Ireland Office to help her to do the job that we all want her to do? By that I mean not just numbers, but the people with the capability, capacity and understanding to make it work.

I thank the hon. Gentleman for his questions, which raise what will be one of the most urgent issues to address when the talks are held over the coming days: how we deal with this situation in relation to paramilitaries. We have heard one suggestion about whether we need a revival of the Independent Monitoring Commission—some form of re-verification and assessment so that people can have a clearer understanding of the facts around the continued existence and activities of the paramilitary organisations which persist in Northern Ireland. We also need to consider how we can work together as a society to do more to reach a place where these organisations disband once and for all.

I have the NIO resources I need. I have good people working with me in the NIO, but of course of crucial importance will be the determination, the resources put in and the efforts made by Northern Ireland’s political leaders. On matters where they are responsible, we will be working with the Irish Government, too.

The Secretary of State will have heard the comments from Members from all parts of the House about the frustration, the lack of confidence and so on. She has said that whatever resources are required to resolve a number of the issues to do with the murders or the criminality will be given, but the general public’s attitude is that these are words and we are not getting results. The criminality is costing the economy of Northern Ireland and the British Exchequer hundreds of millions of pounds a year—the price of a new hospital. The frustration is there, so what more can she do to help the PSNI to resolve cases of fuel smuggling in South Armagh?

Various organised crime taskforces operate in the Northern Ireland context, and in a UK-Ireland context too, and they are determined to tackle those who seek to exploit the border for criminal gain in places such as South Armagh. We will continue to support those organisations. Obviously, much of that responsibility is devolved. I am afraid that is another reason why we need to settle the welfare reform question, because the longer it goes on, the greater the payments the Northern Ireland Executive are paying out in running the old system which is more expensive. That means less and less money is available for policing, hospitals and schools. That makes it very urgent that we get these questions resolved, because without a sustainable budget, no Government are able to deliver on their priorities, and those of course include law enforcement.

Did she and the Prime Minister agree to the DUP’s plan for there to be no meetings of the Northern Ireland Executive over the next number of weeks as part of that “no business as usual”? Does she recognise that that could be perceived as, or could be a breach of, the ministerial code for Ministers in the Northern Ireland Executive?

Rather than share the shadow Secretary of State’s belief that some political Kyle Lafferty will pull a match-saver out of the bag, I believe it is more likely, given the attitude of some of the parties in Northern Ireland, that more own goals will be scored during the talks. Will the Secretary of State give us an assurance today that if the rumours circulating at the moment in Belfast are true—that senior people associated with Sinn Féin are likely to be arrested for serious crimes—she will not hesitate to show the red card to those Sinn Féin associates and put them back behind bars, where they should be and from where they have been released under licence?

I thank the hon. Gentleman for his question. I do not think it would be appropriate for me to comment on specific matters relating to what future arrests might take place, but I reiterate that this Government believe firmly in the rule of law. Therefore, if the police have reason to believe that criminal offences have been committed by individuals, they must be allowed to pursue those individuals and bring them to justice, regardless of their political background or political status.

I believe the PSNI is still appropriately resourced to deal with the dissident republican threat. Like all other aspects of the public sector, the PSNI is needing to undertake a process of reform to ensure that it can continue to deliver its functions within reduced resources. As I said, one reason we need this question resolved is that the Northern Ireland Executive have a choice: do they spend ever more money on a more expensive and discredited welfare system, or can they release some of that money to support policing and justice? I believe that diverting that money to front-line public services is by far the better outcome, and that the welfare reforms we have introduced in Great Britain improve the system and reward work. As I have said, with the top-ups agreed at Stormont Castle, Northern Ireland would have the most generous welfare system in the country and would have resources to spare for the important priorities such as policing, which the hon. Lady is right to raise.

As I have emphasised, we do not yet know with any certainty who was responsible for the two recent murders. What we do know is that the continued existence of paramilitary organisations is a concern. I say “organisations” because there are still a number in operation. Their existence was never justified. They did huge damage, and took the lives of thousands of people, including Members of this House and many brave members of the armed services and the police. Their time is up and they should all disband. It is an appropriate time for Northern Ireland’s leaders to work together to bring about a complete end to paramilitary activity in Northern Ireland.

When my constituent Kevin McGuigan was murdered over the summer, it not only precipitated the political posturing and cynical positioning of one party, the abject denial of responsibilities by another and the downright delusion of a third, but raised the spectre of paramilitaries on our streets once again. Last Thursday at the Northern Ireland Policing Board, the Chief Constable said that it was not his job to provide an assessment of the paramilitaries or their criminal activity, yet when asked in a written question last year by our colleague, the Reverend William McCrea, the Secretary of State indicated that it was a matter for the Police Service of Northern Ireland. Will the Secretary of State tell us who is right?

The Chief Constable has been clear that he does not propose to give a running commentary on the criminal investigation of his officers. That is not generally helpful to a successful criminal justice outcome. Whatever the political background, we should be understanding of the police for not wanting to share day-to-day details of their investigation. As for looking at the continuing status of paramilitary organisations, there is of course a split in the responsibilities. It is vital that the police pursue anyone who is responsible for criminal acts. Now is an important time to consider whether we need some form of separate process to look again at the question of what these organisations are up to, their status, what they are engaged in and what we can do to see them disband and stop altogether. That is an important part of what we will be addressing over the coming weeks.

I must say that I am very pleased indeed that the Secretary of State has taken this opportunity to confirm that her Government are committed to a fully functioning Assembly. For all its shortcomings, and the Assembly has many, it is infinitely better than direct rule. This House will be well aware that, over the worst of times, our Church leaders in Northern Ireland have provided a very valuable contribution to moving discussions along, and to chivvying people who might not otherwise have been open or easy to chivvy. In light of that, I wonder whether the Secretary of State has made any approaches to our Church leaders. If not, may I encourage her to do so? I should say that I have not forewarned them about volunteering them for this role.

The hon. Lady makes the most important point of the statement. It is hugely important that we support the devolved institutions. Yes, they are difficult. Yes, like any other Government, they have their bad days and their good days. It would be such a big setback to return to direct rule. It is vital that we do all we can to sustain that huge success that is the establishment of the political settlement and the institutions of Northern Ireland. That is why these talks will be so important. I have regular contacts with the Church leaders, but I am happy to get in touch with them now and take their views on these important matters.

The cornerstone of the political settlement reached in Northern Ireland was the three-stranded nature of the Good Friday agreement—relations within Northern Ireland, relations between the north and the south, and indeed east-west relations. Will the Secretary of State confirm that the Government are still committed to that approach and rule out taking any action to suspend the Assembly without the agreement and support of her partners in the Irish Government?

The Irish Government are very enthusiastic about trying to move things forward, not least because they are a party to the Stormont House agreement. Paramilitary involvement has been the source of important discussions in an east-west context over many years, and successive Irish Governments have played a part in trying to find the right solutions in relation to paramilitary activity. I will be working with them and the Northern Ireland parties over the next few days to work out a way forward.

I thank the Secretary of State for her statement. The IRA army council continues to exist; the murder of Kevin McGuigan confirms that. Today, it has been confirmed that Kevin McKee and Seamus Wright, two of the disappeared, have been found in the Republic of Ireland, murdered by the IRA. The past and the present have caught up with the IRA, and therefore Sinn Féin. Confidence has been undermined to the greatest extent for many years and it needs to be restored. What assurance can the Secretary of State give to the people of Northern Ireland—those who are involved in the democratic political process—that the IRA army council will be brought to account for its control of republican terrorism?

As I have said, it is very important that the police are allowed to get on with their investigation and to pursue whoever they find evidence against regardless of their background or status. The hon. Gentleman is right to mention the finding of two of the disappeared, which has been confirmed today. It will be a difficult day for those families. I hope that they will derive a degree of comfort in knowing that at last the remains of their loved ones have been found. As for confidence in the institutions, there is no doubt that that has been shaken. Both of the issues in the talks have contributed to that. The concerns felt over the events of recent days and the fall-out from the Kevin McGuigan murder have been intensified by the fact that relations within the Executive were so very severely strained anyway because of the decision to block the welfare reform within the Executive and the inability to deliver financial sustainability. These are difficult times, and it is important that we work together to find a way forward.

I thank the Secretary of State for her statement. I had the pleasure recently of visiting and speaking with members of the International Fund for Ireland, which is an independent organisation that was established with the British and Irish Governments back in 1986. The fund promotes economic and social advance and encourages contact, dialogue and reconciliation between north and south. Reconciliation is the key word for all parties in moving forward. Perhaps it is time to bring organisations such as that around the table. To suspend the Assembly and impose direct rule is not the answer and should be used only as a last resort. I urge all parties to set aside their differences and to get around the table tonight and over the next few weeks to sort this out and move forward for the benefit of all the citizens of that island.

The International Fund for Ireland that the hon. Lady mentions and other such organisations engaged in community-based work in Northern Ireland already play a significant role in trying to bring different parts of the community together to build a shared society. That is part of the challenge of tackling paramilitarism; one of the ways that we tackle it is to persuade people that it is a hugely damaging choice to get involved with the paramilitary organisations. Organisations such as Co-Operation Ireland that are engaged in improving community relations can play a real part in showing people a different path and demonstrating the real risks and damage they can do to their prospects if they find themselves involved in paramilitary organisations.

I thank the Secretary of State for her statement today and assure her that the Ulster Unionist party wants a proper working Government in Northern Ireland, not the dysfunctional Government we have at the moment. The public are fed up with that and with the lack of action on crime. They want to see things happen and happen quickly. As most of my question has been asked by others, I want to focus on this point. Can we please ensure, if we ever have to suspend the institutions—I hope we do not—that there is a plan to get them back in place so that we are not left without them for long?

One reason we do not think that it would be right to move to suspend is the difficulty in getting things up and running at the end of a period of direct rule. As I have said, it is not part of our plan and we hope to see a successful outcome to the talks so that that question goes away.

I welcome the Secretary of State’s statement today. Obviously, there is a lot of bad faith and bad trust in the entire process in Northern Ireland. Whether through Sinn Féin supporting the Stormont House proposals on welfare reform and then reneging on that agreement some three months later, or as a result of members of the IRA who have murdered people on our streets in Northern Ireland, there is a lot of bad faith. I note that the Secretary of State said that she will initiate the voluntary exit scheme for the Northern Ireland civil service. Is that the start of the Secretary of State’s process of returning powers to Her Majesty’s Government in Westminster, or is that something separate?

That is a separate issue. We have always said that the Stormont House agreement is a package and that if one part of it falls, the rest of it falls. Most of the financial package has not been delivered yet and we would look carefully at the implementation of the rest of the agreement before we could deliver it. For the VES to happen we needed a decision, as people were going through the scheme and expecting to leave their roles from the end of the month. That is why we pressed ahead and will release the funding to enable that to go ahead. Let me make one last point on welfare reform. I want to thank the UUP, the DUP and the Alliance for voting for financial sustainability in the Assembly. I know that it was not an easy choice and I thank them for their responsibility.

I point out to the Secretary of State that some of us find it difficult to conscript our colleagues to vote for something in Stormont having argued and voted against the same measures here. Will she acknowledge that the SDLP has been consistently forthright in our assessment that an ulterior nexus has continued to exist offstage, even when the IRA had purportedly left the stage politically? Those vestigial networks have manifested themselves not just through apparently privatised criminal enterprise but in other ways. Those are among the issues that need to continue to be addressed, but not just by the parties. Will the Secretary of State acknowledge that the British Government do not come to the welfare reform issue with clean hands? The Government adopted a tactic of inducing budget stress, which in turn created a budget crisis and has now contributed to a political crisis. Will the Government rethink their tactics of budget bullying in relation to welfare reform, which has created some of the difficulties we now have?

I reject the allegation that we are bullying over the budget. The Northern Ireland block grant has actually gone up in cash terms over the course of the last spending review and has come down by only about 1% in real terms. The savings asked of the Northern Ireland Executive are considerably less than for many other aspects of the public sector in Great Britain. As for welfare, we inherited a situation in which with 1% of the world’s population and 4% of the world’s GDP we are paying out 7% of the world’s spending on benefits. That is not sustainable in the long term and it had to be dealt with. We have to put welfare on a more sustainable basis and we have sought to do that with a core principle of ensuring that work always pays and that a single household cannot take more in benefits than the average family gets by going out to work. Those are both reasonable approaches to take.

With permission, Mr Speaker, I will first offer my condolences, and those of my colleagues in the Government, in relation to the tragedy that occurred in Berkeley which took the lives of five Irish students. The pain of that loss is felt across the UK and Ireland.

The Government are making progress on their obligations under the Stormont House agreement. We have legislated for corporation tax devolution and we expect to introduce a Bill soon on new structures on the past. I urge the Northern Ireland political parties to deliver on their side of the agreement, including welfare reform and passing a sustainable budget.

Many young people in Northern Ireland have been given the opportunity to build a shared and integrated future through educational programmes for which there are substantial resources under the Stormont House agreement. Now that a waiting game is being played as the parties in Stormont must agree on other matters, will the Secretary of State update the House on the status of those initiatives?

An important part of the financial package offered by the UK Government under the Stormont House agreement includes £500 million to support shared and integrated education as a crucial means of building reconciliation in Northern Ireland. The financial package is of course contingent on the Stormont House agreement being implemented. The UK Government think this is one of the main reasons why we need to press ahead with the welfare provisions and the sustainable budget. It would be a huge setback for Northern Ireland to lose the rest of the Stormont House agreement, including the valuable funding for shared and integrated education.

I do agree. We are working hard and the Executive are making a degree of progress with a number of their obligations under the agreement, but it is vital that welfare reform, which was agreed in Stormont Castle and Stormont House, is implemented. It is a good deal for Northern Ireland. The reformed system provides real help for vulnerable people and rewards work. It is a better system than the one it replaces. Under Stormont Castle, the five political parties agreed top-ups from the block grant that would give Northern Ireland the most generous welfare system in the United Kingdom.

It would indeed be in jeopardy, which is one of the main reasons why it is very important for the Northern Ireland Executive to pass a budget that works. That will be impossible without the implementation of the welfare provisions. It is incumbent on every Administration worldwide to live within their means. The consequences of denying the deficit and spending money without regard to the consequences are extremely negative for front-line public services, which is why getting the Stormont House agreement back on track is essential if we are to continue to ensure public service provision is of high quality in Northern Ireland and vulnerable groups are protected.

Everyone in Northern Ireland and further afield agrees that the reason the Stormont House agreement is not being implemented is the failure of Sinn Féin and the Social Democratic and Labour party to live up to what they agreed back in December, and to implement what they agreed and signed up to. Will the Secretary of State accept that this is now costing Northern Ireland £2 million a week in terms of loss to the block grant? That is hitting vulnerable people, and imposing austerity and greater cuts, which those parties claim to be against. Does she accept that she must live up to her responsibilities and take action to ensure the agreement is implemented?

I agree that every day welfare reform is delayed and every day Sinn Féin and SDLP refuse to live up to their obligations under the Stormont House agreement costs the Northern Ireland Executive money. If the situation is not resolved soon, we will start to see a significant negative impact on Northern Ireland’s front-line services, because it will not have a sustainable or workable budget without Sinn Féin and SDLP living up to the commitments they undertook as part of the Stormont House agreement. I will continue to work to see that welfare reform is agreed and implemented, and the Government will consider all the options.

Given that we are now into the period running up to 12 July and beyond, does the Secretary of State accept that enormous efforts were made last year by community leaders and political parties to ensure peace and calm on the streets of Belfast and elsewhere? Since then, she has abandoned the only initiative that was in the offing to move things forward, and has not come up with an alternative. Will she undertake to look at the parades legislation? She has the responsibility for parading issues—it is not devolved—so will she come forward with proposals to move the situation forward and find a replacement for the current failed regime?

The best way to take forward reform of parades adjudication is, of course, through the Stormont House agreement. I understand that the Office of the Legislative Counsel has been preparing the options for which it was tasked, under the agreement, for reform of parades legislation. I hope that they will be published soon. Alongside others, I will take part in the debate about what a reformed system of parading would look like and how it would work. In the meantime, it is crucial for us all to work together to encourage a peaceful parading season, where determinations are obeyed and any protests and parades are both peaceful and lawful.

With regard to setting the budget and many other decisions that need to be taken, is not the fundamental problem that the Assembly and the Executive were designed for the very good reason of bringing people together, but that that does not make for an efficient decision-making body? What thought has the Secretary of State given to how we might move forward to a position in which the Assembly and the Executive can take decisions on a day-to-day basis?

These difficult decisions on living within one’s means are more challenging in a situation in which there is a broad coalition and multiple vetoes. Where there is the political will, however, it is perfectly possible for the Northern Ireland Executive to pass a sustainable budget and implement the Stormont House agreement. That is why it is very important for the two nationalist parties, Sinn Féin and the SDLP to live up to the undertakings they made. The Stormont House agreement was a good deal for Northern Ireland. It was rightly praised by Sinn Fein when it was agreed, and now it needs to get on and implement it.

Let me reassure the Secretary of State that the SDLP has lived up to, and will continue to live up to, every detail of its obligations. I would be very glad to discuss with her any of the details that she has not understood. Although the Stormont House agreement achieved much, it did not fully complete the circle of the many issues involved. Will she define the Government’s position with regard to the Stormont House agreement? Are they active participants for peace and progress, or are they neutral observers?

We are active participants for peace and progress. That is why we are fully engaged on our side of the Stormont House agreement and in encouraging the parties to live up to theirs. Obviously, a crucial part of the agreement is progress on dealing with the legacy of the past. That is another reason why I appeal to the hon. Gentleman and his party colleagues to unblock the questions about welfare so that we can press ahead with those institutions that his party championed during the Stormont House talks.

Although we disagree with the Government on the bedroom tax and on their refusal to come clean on future benefit cuts, the Secretary of State is right to insist that these agreements are honoured without extra money from the Treasury. In the past, Northern Ireland’s leaders have earned great respect for making tough choices for peace. Does she agree that all parties must now accept that an affordable and sustainable welfare system is vital to securing financial and political stability in Northern Ireland?

I thank the hon. Gentleman for those comments. It is crucial for the Northern Ireland Executive to find a way to live within their means. They are not being asked to do anything that Governments across the developed world have not had to grapple with over the last five years. Their block grant has gone up a little in cash terms and come down only by about 1% per year in real terms. It is deliverable; it is possible to do this. The Stormont House agreement delivers a good deal for Northern Ireland, including on welfare.

I am sure the Secretary of State will agree that the last party that should be seeking additional fiscal flexibility for Northern Ireland is the SDLP, given the way in which it and Sinn Féin have put the budget in Northern Ireland in jeopardy. But will she spell out for us the implications for the budget of the financial mess that the refusal to implement the Stormont House agreement has made? What are the implications for the devolution of corporation tax, which has already been agreed?

The implications are very serious: if the welfare question is not resolved, it means that the pressure on the Northern Ireland Executive budget grows considerably and, ultimately, that the Executive will get to a point where they cannot pay their staff and bills, and front-line services will suffer as a result. Without resolving the welfare question, the prospects of corporation tax being devolved and reduced are remote.

I have just heard the Minister passing the buck on the cuts to the PSNI, but the situation in Northern Ireland goes on, with 171 bombings, shootings and paramilitary actions in the past year. What is the Minister doing to ensure that the PSNI has the resources it needs to meet this ongoing security situation?

The Government have provided £230 million in extra security funding for the PSNI. The primary responsibility for funding the PSNI rests with the Executive, but the Stormont House agreement contains a provision to seek to protect its budget. That is yet another reason why this welfare question must be settled; the PSNI is among other front-line services that will suffer directly if it is not and if the Executive start to run out of money because their budget is unworkable.

The security situation is one that we monitor at all times, and of course the security implications of the current political impasse will be an important part of our thinking in how we approach it. It is vital that this question is resolved. Does the Secretary of State agree that there is a worrying trend that legacy cases in Northern Ireland involving senior republicans are not resulting in convictions?

It is obviously not appropriate for me to comment on the outcome of a particular court case, but these events were very shocking. This is another reason why it is important to press ahead with the new structures on the past, including the Historical Investigations Unit and the Independent Commission on Information Retrieval, which were agreed as part of the Stormont House agreement, because the current systems are not providing good enough outcomes for victims and survivors. Their interests should be at the heart of the actions of all of us in this House and in the Northern Ireland Assembly.

The devolved institutions are responsible for setting a viable budget for Northern Ireland. I have an almost continuous round of meetings with the Northern Ireland political parties. I have a review meeting on the Stormont House agreement on Thursday, alongside Minister Flanagan from the Irish Republic. I will be doing everything I can to get the process back on the road, but, fundamentally, it is down to Sinn Féin and the SDLP to live up to the commitments they made under the Stormont House agreement.

This is a summary of the main findings from the report by Lord Carlile, the independent reviewer of national security arrangements in Northern Ireland, covering the period from 1 December 2013 to 31 December 2014:

“Throughout the year I have been briefed extensively on the state of threat in Northern Ireland. The context in which national security activities are performed in Northern Ireland remains challenging. There have been successes in 2014 and a number of trials of significant alleged terrorists are pending. This is a very dangerous, unpredictable terrorist threat, though one which is much smaller than in the days of PIRA terrorist activity. The authorities are achieving a good level of attrition. Most of the public lead lives unaffected by terrorism.

I regard 2014 as a year of continuing success in thwarting and detecting terrorism. Pending trials are likely to demonstrate this, as have trials during the year. However, there is no sign of reduced ambition in the minds of terrorists, and limited evidence of a lack of capacity on their part. Attrition and continued effort against the dissident republican groups remain a paramount requirement. The number of ongoing investigations remains high. The work is painstaking and, for some involved, potentially dangerous. Peace is in no small way the result of these efforts by PSNI and MI5 personnel.

In preparing this report I have considered the current threat level, and what I have learned of events of a terrorist nature during the year. There have been several serious incidents during 2014, as well as a spate of crude letter bombs. Once again the parading season proved a challenge. Although there were some injuries as a result of sectarian clashes, it was more peaceful than in 2013, with fewer injuries to police and public.

During 2014,1 have met a range of stakeholders. I have engaged with PSNI and MI5 and examined the relationship between them and others. I have held meetings with HM Inspectorate of Constabulary concerning activities relevant to this Report, and with the Police Ombudsman for Northern Ireland and the Northern Ireland Executive's Minister of Justice, David Ford MLA. The liaison between Mr Ford and those responsible for national security issues is satisfactory. I have also engaged with the Independent Human Rights Adviser to the Northern Ireland Policing Board (NIPB) and the Board itself. The Policing Board can feel reassured that the Human Rights Adviser is well able to discharge her duties in respect of national security. The Board has been shown the material reports in relation to Northern Ireland of the Office of the Surveillance Commissioners, subject to minor redactions. Compliance is at 'best in class' level. I am grateful to NIO Ministers for their close interest in national security matters discussed; meetings with Ministers have occurred. Ministers are always very well informed on all material security issues.

I am satisfied that the periodic briefings provided to me have been full and not selective, and that I have a good understanding of relevant matters. I note that when matters of moment occur, active steps are taken to ensure that I am briefed. When I request access, it is given.

I have asked questions again this year about the relationship between MI5 and PSNI staff working alongside each other in security operations in Northern Ireland. Comments made to me in 2014 about the relationship between the two services were strongly mutually supportive. That they work together well and in the national interest is beyond question. The effectiveness of what they do is demonstrated by the successful disruptions that have taken place over the year.

This year once again I have reviewed in some detail the arrangements for Covert Human Intelligence Sources (CHIS). Overall, the use of CHIS has been effective. All activity and decision making concerning CHIS are documented carefully and European Convention on Human Rights issues are fully considered. There is a rigorous legal and policy framework for dealing with CHIS. The Regulation of Investigatory Powers Act (RIPA) 2000, and associated orders and codes, provide the legal framework for authorising and managing CHIS within the UK in a way that is compatible with the European Convention on Human Rights, and particularly the right to privacy. It requires that use of a CHIS is subject to prior senior officer authorisation, limits the purposes for which the CHIS may be used, ensures detailed records are maintained, establishes independent oversight and inspection, and provides an independent appeals mechanism to investigate complaints.

I have also considered a number of issues relating to terrorism prosecutions including arrangements for the continuation of the temporary and renewable non-jury trial arrangements provided under the Justice and Security (Northern Ireland) Act 2007. The situation continues to improve. The number of cases requiring non-jury trial diminishes. The Director of Public Prosecutions for Northern Ireland uses considerable and proper care in the identification and selection of such cases. It is fully recognised that the norm is jury trial but the residual serious and lethal threat of terrorism justifies the continuation of the non-jury system.

There is no evidence of any disadvantage in terms of outcome to defendants in the current system of non-jury trials. They are as likely to be acquitted as in jury trials, and have the advantage of reasoned judgments, and less inhibited access to appeals. Part of the criminal justice setting in need of appraisal is sentencing in terrorism related cases. Generally such sentences are considerably shorter than comparable sentences in England and Wales, with notably different tariffs in murder cases.

I remain as concerned as before about the disclosure regime operated in scheduled cases in Northern Ireland. In England and Wales issues of Public Interest Immunity and other disclosure issues are dealt with by the trial judge, who of course is not the tribunal of fact save in the rarest of trial exceptions, or in 'Newton' hearings where there has been a plea of guilty on a disputed factual basis. In Northern Ireland in non-jury trials there is a separate disclosure judge. This still leads not only to delays in trials, but to a disconnect between the day by day reality of the trial and the insulated disclosure process.

I remain concerned that the disclosure issue outlined above is a real difficulty in dealing with non-jury cases. Given the high regard held generally for the quality of the reasoned judgments given in such cases, and also for the fairness of the trials, I find it difficult to accept that there would be any diminution in actual fairness if the trial judge dealt with disclosure too.

I have inquired about the use of intercept evidence. I remain satisfied that there is solid scrutiny and review of interception, in an environment in which communications technology is developing quickly.

As before, I have asked about loyalist paramilitaries. These are people and groups whose real interest is in making money from crime. The authorities are well sighted against these organisations. I have enquired about violent Islamism in Northern Ireland. For the present this is not a significant threat.

Continued vigilance and the maintenance of counter-terrorism resourcing are essential. However, once again I have drawn comfort from the successful joint operations between MI5 and the PSNI.Normality is a genuine and mostly realisable ambition, rather than merely an aspiration.

I have measured performance in 2014 against the five key principles identified in relation to national security in Annex E to the St Andrews Agreement of October 2006. My conclusions in relation to Annex E are set out in the attached Table.”

Further to reinforce this comprehensive set of safeguards, the Government confirmed that they accept and will ensure that effect is given to the five key principles which the Chief Constable has identified as crucial to the effective operation of the new arrangements, viz:

Conclusions

All security service intelligence relating to terrorism in Northern Ireland will be visible to the PSNI.

There is compliance. Arrangements are in place to deal with any suspected malfeasance by a PSNI or MI5 officer.

PSNI will be informed of all security service counter-terrorism investigations and operations relating to Northern Ireland.

There is compliance.

Security service intelligence will be disseminated within PSNI according to the current PSNI dissemination policy and policy and using police procedures.

There is compliance. Dissemination policy has developed since the new arrangements came into force.

The great majority of national security CHIS in Northern Ireland will continue to be run by PSIN officers under existing police handling protocols.

The majority of CHIS are run by the PSNI. Protocols have not stood still. A review of existing protocols and the development of up to date replacements should always be work in progress and clearly accountable.

There will be no diminution of the PSNI’s responsibility to comply with the Human Rights Act or the Policing Board’s ability to monitor said compliance.

The PSNI must continue to comply. The Policing Board, with the advice of their Human Rights Advisor as a key component, will continue the role of monitoring compliance.
