After months of hard work, not least by my predecessor, the right hon. Member for South East Cambridgeshire (Sir James Paice), the industry code of practice is now being translated into contracts. I am encouraged to hear of new contracts and pricing mechanisms that improve the transparency and fairness of milk prices for farmers. The Government will soon be consulting on our domestic implementation of the EU dairy package, enabling dairy farmers to form recognised producer organisations to further improve their bargaining power.

There has been a dairy herd of Holstein Friesians in Eggington, outside Leighton Buzzard, since 1933, but I was concerned to learn from the farmer in July that he is not confident that milk production can continue there, which would be an absolute tragedy. The farmer told me last night that he receives 30.5p per litre, but when I checked this morning, Tesco was selling milk for 86.3p per litre, which is 49p a pint. Is the Minister sure that farmers are getting a fair share, and what can we do to ensure they have a sustainable future?

We need to do a lot of things to support the dairy industry, but I am optimistic. If we can make the voluntary code stick—I have no reason to suppose we cannot—it will go a very long way to improving the transparency of contracts, and, as the hon. Gentleman knows, the Groceries Code Adjudicator Bill is going through the House. The Department will do everything it can to maintain the profitability of producers and ensure that every part of the supply chain is fairly treated, including the retailer and the consumer.

Following our meeting of some weeks ago, will the Minister outline what discussions he has had with the devolved Minister in Northern Ireland on an evaluation of the operation of the voluntary code for the dairy industry? Is he satisfied that the dairy industry is being sufficiently protected?

As I have indicated to the hon. Lady, I would be very happy to talk to the Minister in the Northern Ireland Government, whom I met at the Agriculture Council. That matter did not crop up in our conversation, but the door is open to discuss how we might move forwards together on this important issue for farmers in the hon. Lady’s constituency.

My hon. Friend the Member for South West Bedfordshire (Andrew Selous) mentioned Bedfordshire and Tesco, but will the Minister praise the work of supermarkets such as Waitrose, which not only pays a fairer price, but pays promptly?

Both those elements are essential, but I do not want to name and shame specific supermarkets, however tempting that might be. I want all major supermarket chains to behave in a fair and transparent way as far as their suppliers are concerned. There are signs that that is happening not only in the dairy sector, but in other produce sectors.

The supply chain practices affecting our dairy industry affect other livestock producers, perhaps none more so than our pig producers, which are close to the Minister’s heart. Pigs are being sold well below the cost of production. Given VION’s announcements last week, what will the Minister do to ensure a future for the pig industry?

The hon. Lady is absolutely right to say that I am interested in the pig sector, having bred pigs myself. She will know that we cannot disguise the cyclical nature of the pig industry. Having said that, I am concerned about the current position, but there are signs of progress. Some supermarkets are now prepared to share risk in the pigmeat sector, which I want to encourage.

The milking of pigs is a novelty, and although I am not an expert on these matters, I hazard the guess that it would prove to be an unprofitable activity.

There is a place in UK agriculture for all sustainable production systems that meet our welfare and environmental standards. That is necessary to enable the industry to be competitive in UK, EU and global markets. Increasing the size of herds does not necessarily mean reducing welfare. More important factors are the design and construction of the units and the level of management and skill of the stockmen.

I am delighted that we have some of the most stringent regulations in the world to protect cattle, but can my hon. Friend confirm that the Animal Welfare Act 2006 and the Welfare of Farmed Animals (England) Regulations will be rigorously enforced to protect cattle from those who would exploit them?

I can certainly confirm that. The 2006 Act provides a duty of care to animals, which includes welfare provisions. We will rigorously enforce those measures to ensure that the welfare of farmed animals is maintained.

One of the greatest problems for dairy farmers is the retention and disposal of slurry, especially in poor weather conditions. What steps is the Minister taking to help to ensure that farmers can dispose of slurry in the poor conditions we face.

Members are being very inventive in their use of questions today. This is a real issue: many of us find it frustrating that slurry disposal is dictated by date rather than good husbandry practice. As the hon. Gentleman may know, I have extended the period for spreading slurry in England to the greatest extent I can within the regulations. I cannot do more than that, but we are working with the industry to find the best possible ways of helping farmers to dispose of slurry, which they cannot currently spread on wet fields.

Long-term successful farmers always make animal welfare and nutrition top priorities. Does the Minister agree that at the heart of all successful and profitable farming lies a commitment to animal welfare and that any system should be judged against that principle?

My hon. Friend is absolutely right. A good stockman recognises that the welfare of the animals under his or her control is of paramount importance. No one can farm well if they ignore the welfare of animals. As far as we are concerned, maintaining the highest possible welfare standards—as well as maintaining the pressure on the European Union more widely to adopt them—is a top priority.

7. What assessment he has made of steps taken by his Department to reduce the burden of regulation on farmers.

Good progress is being made to reduce regulatory burdens on farmers through our response to the farming regulation task force, through which, among other initiatives, we are working to reduce the burden of on-farm inspections and paperwork. Costs to farmers of complying with regulations are falling. Since 2011, for every £1 of new compliance costs, we are removing over £13 of inefficient compliance costs.

Farmers in Fylde are constantly raising with me the amount of paperwork they face and the regulatory burdens that causes. Will the Minister update the House on the recommendations he is making that will allow farmers to get on with farming and ease the burden?

I am grateful to the hon. Gentleman. It would detain the House for quite a long time if I went through all 137 commitments we have made on introducing deregulatory measures, but let me give one recent example of how we are working to reduce the burden of paperwork on farmers. We now provide for some record-keeping exemptions for low-intensity farms, as a result of the Government’s recent nitrates consultation. I hope that indicates the tenor of what we are trying to achieve in the Department.

I beg your pardon, Mr Speaker. I blame the shadow Minister, the hon. Member for Ogmore (Huw Irranca-Davies) for distracting me. Why not?

There are no provisions allowing the European Commission or individual member states to create exemptions from regulation 244/2009, which phases out incandescent bulbs. However, we are pressing to ensure that EU policy and legislation take full account of the potential health implications of artificial lighting. We have successfully ensured that provisions for people with light-sensitive health conditions were included in a new eco-design regulation that sets minimum standards for directional lighting and light-emitting diodes.

My constituents are pleased that the draft regulations for directional lighting acknowledge that there is a problem with health. The other regulations are due for review in 2014. Will the Minister confirm that he, along with other parts of the EU, will seek to achieve a change in 2014, so that the problem can be resolved?

My Department and the Department of Health are working closely with the lighting industry, the Health Protection Agency, charities and patient groups such as the Spectrum Alliance—I understand that the hon. Lady has a connection with the Spectrum Alliance—on how to make information on appropriate lighting solutions available. We have had productive discussions with the Department of Health and the lighting industry to identify health care professionals who can assist us. We will ensure that we have a plan of action by early next year, ready for next September when the new eco-design regulations come into force.

The European Commission has pledged further to investigate the link between artificial lighting and various health conditions. Will the Minister update the House on when that research will come forward?

On 30 October, my right hon. Friend the Secretary of State asked DEFRA’s chief scientific adviser to convene an independent expert taskforce on tree health and plant biosecurity to review the current arrangements and make recommendations to address long-term tree and plant disease risk. Today, the taskforce published its interim report and made a number of recommendations on measures to address the increasing threat to the health of our plants and trees. They included strengthening our approach to risk assessment, improving biosecurity and clarifying governance.

The Forestry Commission website indicates that there is an ash dieback infection in a tree in the north of my constituency, yet the Forestry Commission refuses to identify the location of the tree. Given that the Forestry Commission manages only a certain proportion of our trees, what about the danger to the other remaining trees? Why is there such secrecy in the Forestry Commission about revealing the identity of this infected tree?

Let us just be clear for the benefit of the hon. Gentleman: if the infected tree is mature, as we are not in the period of sporulation there is no danger to surrounding trees, certainly not at the moment. The advice from the scientific advisers is that it is better to leave mature trees in situ than to fell them. The contrary advice applies to new planting saplings.

T7. The people of Halberton and the Environment Agency worked very well when the damage to the canal happened, preventing flooding from occurring throughout the village. However, I want to see better management of our waterways, through farmers and local communities managing water and helping to dredge the rivers, because we are not doing enough to stop the flooding.

T9. Given lurid reports on the treatment of racing greyhounds, such as that they are being administered class A drugs, what assessment has the Minister made of the industry’s self-regulation regime, and will he make a statement?

Apart from that self-regulation, greyhounds are protected under the Animal Welfare Act 2006 and racing greyhounds are also protected through the Welfare of Racing Greyhounds Regulations 2010, which provide local authorities with powers to inspect independent greyhound tracks and to issue licences, as appropriate. If my hon. Friend has particular concerns that he would like to share with me, I would be very happy to meet him to see whether there is more we can do.

Absolutely. The hon. Gentleman makes a critical point, but the point is the full plethora of sanctions in the Bill. All we are talking about is what is in the Bill; we are not saying that fines could not exist in the short to medium term at the behest of the Secretary of State, but if he thinks that fines might be required in the future, why not just put them in the Bill?

Just so we know the terms of debate, will the hon. Gentleman outline how big a fine he thinks would be appropriate to deter inappropriate behaviour on the part of, say, Mr Tesco?

That should be in the hands of the adjudicator. We are asking the adjudicator to do a job to assess whether someone has breached the code. The adjudicator should therefore be given the power to determine the sanction. If the sanction is to seek recommendations, then that is the sanction. If the sanction is to name and shame, then that is the sanction. If the sanction is a fine, we should leave that in the hands of the adjudicator to determine. That could be a debating point in Committee. The Minister is chuntering from a sedentary position, but the argument is whether financial penalties should be in the Bill. If they are, the Secretary of State could then propose that fines be within certain parameters, or up to the adjudicator, or a proportion or a multiple of the loss achieved by a particular supplier. There are a plethora of ways for an adjudicator to determine a financial penalty. [Interruption.] The Minister says, “I don’t know,” but the Government have not told us what they would propose. Yes, we do not know how much the fine should be. That would be up to the adjudicator, within parameters applied in respect of the Secretary of State, to determine how much a fine should be, and that should be in the Bill.

It is a pleasant and, for me, unprecedented experience to speak at the Dispatch Box on a Bill that has received a welcome from Members from all parts of the House without exception, and I am very pleased that that is the case. I think it is because they share, to paraphrase the hon. Member for Tiverton and Honiton (Neil Parish), a desire to see a system in the supply chain that is fair to the producer, fair to the processor, fair to the retailer, and fair to the consumer. That is what we are trying to achieve in the legislation.

There is ample evidence, not least in the Competition Commission report that, in some ways, provides the origins of the legislation, of an imperfect market in the grocery trade. The hon. Member for Edinburgh South (Ian Murray) said that that there was a monopoly position for the big supermarkets. Strictly speaking, it is not a monopoly. Classical economics requires us to call it an oligopsony, but that term is not used very often. There are powerful players in the retail sector: there are a few buyers and many sellers, which produces an imbalance in the terms of trade. That is why I am pleased to introduce the Bill with the Under-Secretary of State for Business, Innovation and Skills, my hon. Friend the Member for East Dunbartonshire (Jo Swinson), from our sister Department. It is wonderful to have two Departments thinking and acting as one in government in introducing legislation of this kind, not least, as the hon. Members for Ogmore (Huw Irranca-Davies) and for Bristol East (Kerry McCarthy), and many others said, because I campaigned personally for the provision for a long time. Other Members who have spoken have been equally assiduous, or more so, in arguing that case, particularly my hon. Friend the Member for St Ives (Andrew George), who has worked very hard on the issue, and the hon. Member for Ynys Môn (Albert Owen). I loved his contribution: it was amusing, and most of what he said was well founded.

The measure has united—this, too, is unprecedented—the Chairs of the Select Committees on Business, Innovation and Skills and on Environment, Food and Rural Affairs. Select Committees do not always agree on absolutely everything, but both those Committees have had an opportunity to look at the measure in pre-legislative scrutiny. The hon. Member for West Bromwich West (Mr Bailey) kindly said that the Government listened to what his Committee said, and that they accepted 80% of its suggestions to improve the measure. That is how it should be; that is the whole point of pre-legislative scrutiny.

Let me make one point to those who have criticised the timing of the Bill. As far as this Administration are concerned, I reject that accusation. The Bill was introduced as a draft Bill in the first Session of this Parliament, as we promised, and it was introduced as a substantive Bill as the very first Bill after the Queen’s Speech in this second Session of Parliament. I find it difficult to understand how we could have been more urgent in our approach. There was fair criticism of the time it took for nothing to appear under the previous Government, but I do not want to be partisan in my approach. It is important to maintain the coalition of interests on both sides of the House in support of the Bill.

The Chair of the Environment, Food and Rural Affairs Committee, the hon. Member for Thirsk and Malton (Miss McIntosh), mentioned a few significant points, some of which were picked up by others. The most important initially was the business of indirect complaints and the capacity for anyone to bring forward a complaint. Let me make it absolutely clear that the Bill provides for any party to complain. It does not have to be the producer who is involved; it could be trade organisations or non-governmental organisations. Anybody who has information to put before the adjudicator should do so. Those complaints will be treated with anonymity, because it is part of the job of the adjudicator to ensure that that is the case. Yes, the adjudicator can take forward proactive investigations. If there is good reason to believe that an abuse of the code is going on, the adjudicator can take forward a proactive investigation.

The hon. Lady also asked about the recovery of costs and clause 10 makes that clear. She asked a perfectly proper question about the provisions for the transfer of functions or abolition, which she thought were slightly peculiar, but they are part of the Government’s normal process of inserting sunset clauses so that bodies do not persist simply because they were set up in primary legislation with no opportunity to repeal it at some stage in the future. There might need to be a significant change, a renaming, a merging of functions or any of the many other things considered as part of the Public Bodies Act 2011, so that is a perfectly proper provision.

The hon. Lady asked what the list of designated retailers was and it might be helpful to the House if I simply say who the 10 are. They are Asda Stores Ltd, the Co-operative Group Ltd, Marks and Spencer plc, Wm Morrison Supermarkets plc, J Sainsbury plc, Tesco plc, Waitrose Ltd, Aldi Stores Ltd, Iceland Foods Ltd and Lidl UK—[Interruption.] I cannot quite catch what the hon. Member for Ogmore is saying from a sedentary position, but I thought it was helpful to give the list of retailers included in the proposals.

I thought that the hon. Member for North Antrim (Ian Paisley) made a very thoughtful speech.

Now that peace and unanimity is breaking out, will my hon. Friend return to the vexed issue of fines being imposed? We are a little envious that the Business, Innovation and Skills Committee has had its amendments incorporated and we would like 80% of our amendments to be incorporated at the same time.

I will inevitably return to that point a little later, as it was raised by so many Members. Let me first, however, cover the other specific points mentioned in the debate.

The hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) asked about companies outside the big 10. He is absolutely right that they are not specifically included in the Bill as levy payers, but let us recognise that the big 10 represents 95% of the grocery trade. If we are successful in the application of the adjudicator in improving standards of contract compliance, that will feed through to the rest of the sector by competition alone, if nothing else. The hon. Gentleman also mentioned length of contracts. That is not specific to the code of conduct, but the matter can be properly investigated in the context of an abusive relationship. Where such a relationship exists, that will be laid bare by the process.

The hon. Member for Bristol East made some good points about food waste. She knows that we have engaged with her on that issue and will continue to do so. I think I have a meeting with her in the near future to talk about that.

A number of Members spoke with a great deal of experience of the sector from having worked on the producer side. The hon. Members for Camborne and Redruth (George Eustice), for York Outer (Julian Sturdy) and for Sherwood (Mr Spencer), my hon. Friend the Member for Brecon and Radnorshire (Roger Williams), and the hon. Member for Tiverton and Honiton all have direct experience of working in agriculture and could tell us about the sort of downward pressures that they know suppliers regularly experience. The hon. Member for South Down (Ms Ritchie) spoke about trade associations. I hope I have been able to put her mind at rest about that.

My hon. Friend the Member for Ceredigion (Mr Williams) raised a number of important points. He spoke about access to the code and, as I said, I hope I have given him some reassurance on that. He talked about changes to the code. That is an important point. According to the process set out in the Bill, the adjudicator can put forward for consideration changes to the code, but that proposal goes back to the Competition Commission for consideration before being put before the House. It is important that we maintain that linkage because fundamental to the Bill is the abuse that the Competition Commission identified between major retailers and their suppliers. It would be a great mistake for the House to substitute our opinion for the evidence adduced by the Competition Commission.

My hon. Friend also mentioned retrospectivity. Let me underline the point again. If an abuse is continuing at the time that the adjudicator is appointed, it is proper that he or she should investigate that abuse, but we have a strong principle in British legislation that we do not apply retrospectivity to something that occurred before the date that a particular statute comes into effect. Therefore it would not be entirely proper for the adjudicator to look at complaints within the terms of the code that pre-dated that appointment if they no longer continue.

My hon. Friend says that the code would not apply retrospectively, relative to the date of the statute. Of course, the statute came in on 4 February 2010. The Bill merely provides for the referee to enforce the code. Retrospectivity in respect of the statute therefore does not apply.

I understand the point that my hon. Friend makes. If he would care to engage with Government lawyers on that point of law, I am sure we would be happy to engage with him. We can return to the subject in Committee or on Report.

The hon. Member for Llanelli (Nia Griffith) queried clause 15(10), and the hon. Member for Hayes and Harlington (John McDonnell) also thought it was a bit odd. Let us debate that in Committee. What is proposed there is a safeguard which we hope will not be used. It is designed to deal with the circumstances in which the adjudicator was swamped with spurious complaints which hindered him or her from doing their work. The adjudicator would be required to pare those complaints down to the categories set out there. It would not stop them taking information from any source, but it would stop them taking complaints from any source. As I have said, I do not envisage that that will be necessary and hope that it will not be, so it is a reserve power, but I completely understand the point made by the hon. Member for Hayes and Harlington that it is in some ways an unusual provision. It is certainly something we can discuss properly in Committee.

The point I was trying to make is that if we have to amend the legislation in due course by statutory instrument, it would be better to design the new clause on the basis of the experience and recommendations of the review, rather than just reverting to type.

Member for Banff and Buchan (Dr Whiteford) mentioned the very bad news about Vion UK, which I understand will affect not only her constituents in Strath of Brydock, but many others in Livingston, Portlethen and Broxburn, and my hon. Friend the Member for Brecon and Radnorshire mentioned the situation in St Merryn in Merthyr Tydfil. I can certainly give an assurance today that we will happily engage with colleagues in the devolved Administrations—most of those jobs are situated in Scotland or Wales—to see whether there is anything we can do to assist them in dealing with what will be a very significant event in the local economy. If there is anything we can do, I can give an assurance that we will do our best.

I want to talk very briefly about the voluntary code in the milk supply chain, which I think is an important development. It would not be policed directly by the adjudicator, and I do not want to give the impression that it would.

Let us talk about sanctions. This is clearly a serious conversation we need to have in Committee and on Report. My hon. Friend the Under-Secretary set out the Government’s position on naming and shaming. I do not entirely agree with the hon. Member for Ogmore, because I think that naming and shaming played a significant part in events over the summer relating to the dairy industry. I think that several of the large retailers were directly shamed by consumers into changing their tune about their intended reductions in the price of milk.

However, I accept that many Members have indicated that they would prefer to see fines from the start. There are arguments about why that should not be the case, including the fact that it would introduce a new legal process of appeal that would not be there if it was not introduced ab initio. I want to make it absolutely plain that only one thing has to be done by order, which is for the Secretary of State to bring in a tariff system on the advice of the adjudicator, so it is not a separate process for each infringement.

Let us discuss what the effective sanctions are and make sure that we have got them right. The Government believe that we have got it right at the moment, but of course we will listen to what every Member has to say on the issue and ensure that we have legislation that is fit for purpose.

In closing, I think that we have had a very important debate. It means that we can go forward, perhaps not as heroes, as the hon. Member for Ogmore suggested, or as characters from grocery folklore, as the hon. Member for Ynys Môn said, but with something that will contribute to the well-being of our farming and retail industries. I believe that is right and commend the Bill to the House.

I beg to move,

That this House notes that ash dieback, which could affect 80 million native ash trees, has been identified in 115 sites; further notes that Government ministers were informed of the disease on 3 April 2012; regrets that the public were not informed about the disease this spring and that a thorough survey of woodland was not carried out this summer; further regrets that the Secretary of State for Environment, Food and Rural Affairs has circulated a briefing to hon. Members from the Conservative and Liberal Democrat parties, but not the Opposition; recognises that 530 staff posts have already been cut from the Forestry Commission, including 38 posts in Forest Research which investigates tree diseases, and that the Forestry Commission budget will be cut from £47.5 million in 2010-11 to £36.2 million in 2014-15; calls on the Government to issue clear advice to tree growers and the public as to the best way to prevent disease spread and to work with all hon. Members, including the Environment, Food and Rural Affairs Select Committee, as well as councils and other affected stakeholders to fight this disease and ensure that lessons are learned; and further calls on the Government urgently to assess whether the Forestry Commission has adequate resources to guarantee that there are enough Forestry Commission staff and scientists to carry out further tree health surveys and to commit to work with all stakeholders to overcome the environmental, economic and ecological impact of this terrible disease.

May I begin by saying what a disappointment it is to see that, once again, the Secretary of State for Environment, Food and Rural Affairs has delegated the challenge of explaining ministerial inaction on this disease to his colleague the Minister of State? I heard on this morning’s “Farming Today” that the Secretary of State was on a plane to China, yet Ministers were aware last Thursday that this debate was taking place. I believe it is a matter of courtesy to the House that Government business of this nature comes first. We wish him well on his trip to China, but we hope that he will, eventually, turn up in the House to tell us what he is doing.

I honestly think that if the hon. Lady believes that the Secretary of State should have cancelled a mission to the largest market in the world, where he is trying to promote British produce, in order to come to argue with her on her rather ridiculous motion today, her sense of priorities is very distorted indeed.

I will leave the public to decide whether flogging fromage to the Chinese is more important than explaining to the British people what action the Secretary of State is taking on a major environmental and ecological disaster that is unfolding on his watch. [Interruption.] I believe that “flogging fromage and fizz” are the words he used the last time he went off to France, so I am using his own words back at him. Clearly, it would be much more comfortable to be going off to China than to be in the hot seat, where the Minister of State finds himself.

The scale of the ash dieback emergency is now clear. It has been found in 129 sites in England and Scotland, including 15 nurseries and 50 recently planted sites. The most worrying discovery is that the disease is present in 64 woodland sites. That number will rise sharply as more trees are surveyed. Professor Michael Shaw from Reading university has described it as “catastrophic”.

Scientists believe that most of our 80 million ash trees will face a long, slow decline over the next 10 years. The tree that accounts for one third of our native broad-leaved woodland will all but disappear. A few resistant trees will survive and their seeds will be carefully stored to restock the forests when our children are already grown. Lichens, moths, beetles and bugs that rely on the ash’s alkaline bark will suffer. The 27 species of insects that depend on the ash as their sole food plant might become extinct. Plant nurseries and woodland owners will lose thousands of pounds as they destroy ash saplings, and the wood industry will suffer as wood prices rise. Timber that was planned for will not reach maturity. Chalara fraxinea, or ash dieback, will change our landscape for ever. It is an environmental, ecological and economic disaster.

Earlier today I had an opportunity to see for myself the effects of Chalara fraxinea in woodland near Canterbury and to meet some of the 500-plus people who have worked around the clock to complete a survey on an unprecedented scale aiming to identify signs of the disease. I want to offer my sincere thanks to them all. They are not all Forestry Commission staff or employees of the Food and Environment Research Agency; a great many others have joined in and worked so hard to complete what has been a massive undertaking, including volunteers who have given up their time to help. As of today, the results of the survey show 155 cases of ash dieback caused by Chalara across Great Britain: 15 in nursery stock, 55 in recently planted sites and 85 in the wider environment. Further suspect cases are currently under investigation and we will continue to provide updates on confirmed cases on the Forestry Commission website.

I am grateful to the hon. Member for Wakefield (Mary Creagh) for giving me the opportunity to set out for the House the decisive action the Government have taken to tackle the threat from Chalara fraxinea and to lay to rest some of the myths she has perpetuated in recent weeks.

The Minister said that he has received an assessment of the number of trees infected. Perhaps he could enlighten me on the answer I have received from Rossendale borough council. It states:

“Currently we are not aware of any infected trees in Rossendale. However, the announcement regarding the disease came when our ash trees had already dropped their leaves for winter and, therefore, it is not possible to identify symptoms positively until next spring at the earliest.”

Clearly we need to educate the hon. Gentleman’s borough council a little more on the signs and symptoms to look for with regard to Chalara fraxinea. It is possible to see retained leaves that are diseased and lesions on the bark, as I saw this morning. Summer is not the only time of year when it is possible to see dieback. I understand that the borough council officials have been unable to see signs of Chalara in his area, but that is because we have found no signs of Chalara in the area either. It is a long way from the English channel.

Ash dieback is caused by a fungal pathogen that has been present in Europe since 1992, when the disease was first discovered in Poland. Since then, it has spread to much of central and northern Europe. However, before 2010 the European scientific evidence indicated that the organism responsible for ash dieback was native in Great Britain. It was Hymenoscyphus albidus, which was drawn to the attention of the right hon. Member for Leeds Central (Hilary Benn) at the time. I understand perfectly his position at the time, because the advice was that it was unlikely to cause significant harm. That belief meant that it would not have been appropriate to use import restrictions to control the disease.

In 2010, new scientific evidence identified the pathogen that caused the disease, which was not known to be present in the UK. That meant that it was identified as a potential threat alongside many other potentially harmful organisms. In the light of that evidence, between 2010 and 2012 the Forestry Commission inspected ash trees across Great Britain—15,000 individual trees located in 8,310 groups. Only 103 trees were found to be suffering from disease, and in none of these was the cause identified as Chalara.

That position changed in February this year, when a routine check by Government plant health inspectors discovered Chalara in a nursery in Buckinghamshire. This finding was confirmed on 7 March, and the UK plant health authorities acted immediately.

With the potential loss of a third of Plymouth’s ash trees, there is real worry about this. Given that the disease was beginning to be understood some time ago, what work was started on disease-resistant seeds and young saplings, and is that work ongoing, so that when, we hope, this moves on, we can start to replant?

It is certainly ongoing; I will return to that shortly. What the hon. Lady must realise is that we did not believe that we had Chalara in this country. Indeed, there was some suggestion that our native ash was, in part, resistant to the disease. That might be one of the reasons the spread had not been observed until that point.

The honest answer to the hon. Lady is that, surprisingly, very little work has been done on this. As she may imagine, we have reviewed all the scientific work that has been done across Europe, not only on pathogen identification but on silviculture, to see how to mitigate the effects of the disease. We have all been struck by how little work has been done and the great need for us better to understand the disease, how it develops, and how to develop proper resistance to it. She raises a perfectly proper point to which the answer, our scientists having reviewed all the literature and talked to their European counterparts, is that we are not as far advanced in our understanding as we perhaps ought to be given how long the disease has been endemic across the continent.

The Minister is being extremely generous and courteous in giving way so often; I am grateful. He said that the first time the disease was positively identified was in April this year in stocks in a nursery. Can he therefore explain to the House, because this question is being widely asked, why it was not considered appropriate at that point to introduce a ban on imported ash seedlings? Many people look at this and say, “It was found in a nursery and we knew that these were imported seedlings, so why was the ban not put in place at that point?”

The answer is that we do not import at that time of year and therefore no imports were coming in. The most important thing to do was to carry out a very detailed search as to where imports had taken place, going on from there to identify where sales and possible plantings had taken place so that we could identify any infected seedlings and have them destroyed. That was the thrust of what we were doing. As the hon. Gentleman is aware, we also then went to consultation on the import ban, but we needed to know exactly the extent of what was happening, and the time scale meant that there were no plantings going on at that time of year.

This calendar is very important to hon. Members’ understanding of exactly what has happened. For instance, a lot of people have the mistaken impression that we are now finding that the disease is suddenly spreading. It is not; it does not spread at this time of year because we are out of the sporulation season. We are identifying possible symptoms of disease, most of which have been there for a very long time—two years, three years, or perhaps more—in the trees in the wider environment that we had discovered to be infected. It is very important that people understand what is happening now.

Let me return to my point. When Chalara was discovered, additional resources were deployed to trace ash trees known to have been supplied from infected nurseries, and over the summer 100,000 young ash trees were traced and destroyed. In parallel, the authorities developed the pest risk analysis that was required to support the precautionary action taken and to justify continued intervention—that is part of my answer to the hon. Member for Brent North (Barry Gardiner). Such analysis was the basis for a fast-track consultation to strengthen evidence and seek views on an import and movement ban on ash trees. As I said, that took place outside the main planting season, but the industry took the sensible precaution of instituting a voluntary moratorium on imports of ash-planting material.

We can be reasonably sure—not absolutely sure—that no ash seedlings were imported during the summer, other than through very casual means such as if someone brought one back in their car boot. The hon. Member for Wakefield (Mary Creagh) asked me in an urgent question whether I could guarantee that no one had brought back an ash seedling in their car, but I am afraid I have not looked in every boot of every car, so I cannot give that guarantee. I can, however, give a reasonable assurance that commercial imports of ash seedlings did not take place during the summer.

The Minister says that a ban on imports was not considered necessary because it was not believed that there would be imports at that time of year. Does he therefore accept that the horticultural trade and industry would have suffered no commercial detriment by the imposition of such a ban, and that prudence and risk analysis might have led him to do so?

Again, I return to the fact that to impose a statutory ban, we must have evidence to suggest it is necessary. That is why we developed such evidence, which was put out in the consultation. The most important point is that plant importers recognised the potential damage the disease could do, and imposed a moratorium that stopped trees coming into this country over the summer. A statutory ban was not needed for that, but we ensured nevertheless that it was introduced at the earliest possible opportunity.

None of that activity was compromised by cuts to the Forestry Commission budgets, as the hon. Member for Wakefield suggested. Although its overall budget has taken cuts since 2010, funding for plant health has not been reduced. Indeed, a bigger share of the Forestry Commission’s budget is now dedicated to plant health than previously, and spending by the Department for Environment, Food and Rural Affairs in that important area has increased. The hon. Lady knows that to be the case because she asked questions and got answers, even if she is not prepared to accept them.

Extra costs will clearly be required to monitor and tackle this disease. Will the Minister confirm whether he is prepared to go to the Treasury for those extra resources, and that they will not be taken from elsewhere in DEFRA’s budget?

May I ask the Minister to correct the record? Although it is true that the Forestry Commission programme shows an increased spend under the heading “tree health and biosecurity”, figures under the heading “tree breeding for increased resilience and improved markets” show a 52% cut over the lifetime of the review.

The hon. Gentleman chairs the Science and Technology Committee, which I know will want to look at this issue in more detail. I invite it, however, to look at the totality of spend in this area, not all of which goes through the Forestry Commission—there are other heads. I hope that the hon. Gentleman will look at that spend, as I am sure he will, and come to an objective view about how much is being spent on this important matter.

On Friday 26 October, the consultation, which I mentioned, closed. It demonstrated overwhelming support for import and movement restrictions, and on Monday 29 October, my right hon. Friend the Secretary of State announced a ban on the movement of ash from anywhere that is not a designated pest-free area—I should point out that nowhere is labelled a designated pest-free area. There is now a criminal offence, carrying a maximum fine of £5,000.

On 24 October—during the consultation period—Chalara was confirmed in the wider environment in East Anglia. The trees had no apparent connections to nurseries. Since that finding, the Government have taken action on an unprecedented scale to tackle the problem. At the beginning of November, we initiated a rapid survey of the whole of Great Britain. More than 500 people worked around the clock to survey 2,500 10 km squares for signs of disease. That massive undertaking was completed by 7 November, and gave us an initial picture of the distribution of ash dieback caused by Chalara. We have also received valuable intelligence from organisations including the Country Land and Business Association and the Woodland Trust, which has mobilised its members to look for signs of the disease.

The Northern Ireland Assembly has adopted additional safeguards to ensure that there is no infiltration of ash plants. It has adopted a “Fortress Northern Ireland” approach—in other words, nothing gets in and nothing gets out. Perhaps that has happened in the past, but even with those strict rules and legislation, there is an outbreak in Leitrim in the Republic of Ireland. Will the Minister confirm and assure the House that every step is being taken to stop ash dieback in the whole of the United Kingdom of Great Britain and Northern Ireland, and that there is direct consultation with the Northern Ireland Assembly, the Scottish Parliament and the Welsh Assembly?

I can indeed confirm that. Ministers or officials from all three Administrations have been involved in every one of our consultation meetings on the subject. We want to ensure that they have access to all the information we have, and that we have all the information they have. I ought to mention that we have been working closely with the Government of the Republic of Ireland, because we obviously need to co-ordinate our efforts to ensure that we understand how to treat cases, and particularly those in the wider environment, and how to preserve as far as possible the whole of the British Isles as a disease-resistant or disease-free area.

One infected area is just a few miles north of my constituency. What work has been done to get an idea of the possible spread of the disease within urban areas, as well as in more rural and forested areas?

We divided the country, including urban and rural areas, into 10 km grid squares. Every square where there is known to be ash trees has been examined, although there are only very few in some urban areas. Nevertheless, we have examined ash trees in all those areas, so the results of the findings cover the whole country, including urban areas. I am most grateful for the active interest of Scottish Government Ministers, who have been involved in our discussions from an early stage.

He has spoken to the devolved Administrations, but has he consulted his counterparts in the Department for Communities and Local Government and spoken to the Local Government Association about the role of local authorities in tackling the disease?

I can confirm what the hon. Lady asks—the DCLG and the LGA specifically attended Cobra meetings, so they are fully in the loop. We have given advice to the LGA for dissemination to local authorities, which understand their responsibilities. The Highways Agency is also involved—a point about transport links was made earlier. We are conscious of the fact that some new plantings are inevitably associated with major road systems—and, indeed, the railways—and we are taking great care to ensure that those trees are inspected and appropriate action taken.

Most of the cases confirmed in the wider environment are clustered in the east and south-east of England—in Norfolk, Suffolk and Kent. A few cases have been found further west or extending north up the east coast. The disease is present in mature trees in those areas. That pattern suggests two things. Chalara fraxinea first came to Britain through spores blown on the wind from continental Europe, and the advice from the specialists who know about these things is that it has been here for some time—at least two years, and possibly more.

I am grateful to the Minister for giving way again so generously. The scientific advice that we have received says:

“Local spread may be via wind, rain splash or even transmission by insects. Over longer distances the risk of disease spread is most likely to be through the movement of diseased ash plants.”

That does not accord with the idea that the disease first had its impact on these shores after being blown across the North sea or the channel by wind; it suggests that it would have come here in saplings with the contagion then spread on the wind locally.

The hon. Gentleman’s theory—it is also the theory of the hon. Member for Wakefield—does not accord with the advice of the leading experts—[Interruption.] The hon. Lady talks about “scientific facts”. I think that displays her underlying problem with understanding how science is developed. We can deal only with the most probable reason for the evidence that is put before us. The leading experts from the United Kingdom and Europe—whom we brought together over the last two weeks under the leadership of DEFRA’s chief scientific adviser, Professor Ian Boyd—have reviewed the evidence and said that what they see is consistent with a view that the disease is brought in by wind-blown spores.

In a moment, because I want to correct the nonsense that the hon. Member for Wakefield is promoting.

When the hon. Lady talks about the disease’s speed of progress being 20 to 30 km, we are talking about the front of an epidemic; therefore, it is the speed at which a front in a forest develops over mainland Europe. That does not mean that a spore cannot be carried on the wind for further than 20 or 30 km—that it somehow drops out of the sky when it reaches the 30 km mark and feels it cannot go any further. That is not what the science is saying; what the science is saying is that this is the most likely outcome. Anyone who looks at the distribution will see that it is entirely consistent with wind-blown spread. In fact, many people have said to me that it looks very similar indeed to the distribution of blood tongue, when that hit these shores. [Interruption.] I see the right hon. Member for Leeds Central is nodding, because he knows that that is the case, and that—[Interruption.] Yes, the hon. Member for Glasgow South (Mr Harris) knows better than the scientific experts and a former Secretary of State; he knows that none of this can happen.

I find it extraordinary that the original version of the “Key scientific facts” document from Wednesday said:

“Longer-distance spread occurs via infected plants,”

whereas version 2—or version B, or whatever it is—from over the weekend contains this miraculous new scientific fact:

“On occasions, spores may disperse much further on the wind,”

albeit without any scientific reference at all. It seems as though the scientists are desperately trying to cover Ministers’ backs.

Clearly wind has a role to play locally. No one is denying that. The issue is whether the wind is one of the primary vectors. Let us consider tree diseases more broadly. Does the Minister accept that since 2000, more than twice as many tree diseases have entered the UK as entered it in the whole of the last century? Does he want us to believe that it has been incredibly windy since 2000, or is it the case that the number of imports has increased vastly in that time?

No, I do not want the hon. Lady to believe that. Actually, I believe that there has been hugely greater mobility of goods and people in recent years, which has spread disease. That is of real concern to all of us, and we need to deal with it. All I am saying is that, according to a detailed analysis, the incidence of ash dieback disease in this country is consistent with its having been brought in by wind-blown spores. That is what all the leading scientists are telling us, and I see no reason to disbelieve them or to involve some conspiracy theory.

I am very grateful to the Minister. He has said that, according to the scientists, the incidence of the disease is consistent with its having been carried in by the wind. Of course I take his word for that, but he has used the same phrase repeatedly, which has led me to worry. Are the scientists saying that the incidence of the disease is consistent with its having been carried in by the wind, or are they saying that the wind is the most likely vector for its transmission? What do they believe is the most likely vector?

The hon. Gentleman, who purports to know about science, really ought to understand scientific method. I think that a theory from our chief scientific adviser, supported by all the experts in Britain and Europe, is rather better than one propagated by the hon. As I have said, these conclusions have been endorsed by the leading experts, who have reviewed the evidence about Chalara to help us to understand how it is spread, its impact on our ash trees, and how we might tackle it. A summary of their conclusions was sent to all Members on 7 November and published on 9 November. As my right hon. Friend the Secretary of State said in a written ministerial statement last Friday, the advice from the scientists

“is that it will not be possible to eradicate Chalara.”—[Official Report, 9 November 2012; Vol. 552, c. 49WS.]

The experience in the rest of Europe is that there is no effective treatment. However, that does not mean the end of the British ash. While young trees succumb to the disease fairly quickly, mature trees with the infection can live for many years. We know that the Danes have identified a small number of trees that seem to be resistant to Chalara. That knowledge buys us some time, so what can we do?

It is clear that the Government alone cannot tackle this threat. On 7 November, we convened a summit that brought together more than 100 representatives of the forestry and horticulture industries and environmental groups to advise us. There was a broad consensus on the evidence and on the action that we should take. The strong message is that we should not be panicked into taking draconian action that could be futile or counter-productive. The lesson of the Dutch elm disease of the 1970s is that much of the costly action taken then simply did not work. We have a window over the next few months while the disease is not spreading, and that will enable us to develop the right approach. The disease is not spreading, incidentally, because this is not the sporulating season for it. There are no fruiting bodies, and there are therefore no spores—unless the hon. Member for Wakefield has a theory that there is winter sporulation as well.

I am grateful to the Minister for giving way—he is being very generous with his time—but why has he not written to local authorities about this? He has written to neither Hyndburn borough council nor Rossendale borough council. Will he tell us, and the local authorities, when he intends to write to them explaining how he will intervene to tackle the issue?

I expect local authorities to show a little common sense. The whole country is benefiting from the very good Forestry Commission website, which is providing all the information that they need in order to identify the disease. We bring the Local Government Association into the inner workings of government at the Cobra committee, so it can provide information to local authorities. I do not think there needs to be a letter from me just to add to the pile of correspondence—and reduce the number of trees in this country in the process—rather than authorities taking sensible advice.

Building on the advice of the summit, on Friday the Secretary of State announced the immediate action we would be taking. Newly planted diseased trees and diseased trees in nurseries will be traced and destroyed, as young trees that are infected succumb quickly. Mature trees will not be removed, however, as they are valuable to wildlife and take longer to die. They can help us learn more about the genetic strains that might be resistant to the disease. Infection does not occur directly from tree to tree—a point which, again, is lost on some.

Better understanding of the disease will be built through research and surveys, looking not only for diseased trees, but for those that show signs of resistance to Chalara. The search for the disease will include trees in towns and cities—a point made by the hon. Member for Edinburgh North and Leith (Mark Lazarowicz)—as well as in the countryside. It will also include building partnerships with a range of organisations beyond government and providing advice to foresters, land managers, environmental groups and the public about how to identify diseased trees and those likely to be resistant to the disease, and what to do with that information.

Organisations such as the Woodland Trust and the National Trust have endorsed this approach. None of the action we have taken to date or that is planned involves restricting access to the countryside. The scientists are clear that there is no need for that. We want to ensure rural businesses continue to operate and that people who want to enjoy the countryside can do so.

These are just the first steps, and by the end of November we will have developed a comprehensive control plan that will set up longer-term action to tackle Chalara. It will consider measures such as designating protected zones and improving diagnostics and biosecurity. Our approach will, for the first time, look at how we can mobilise the many people who love our countryside and value the trees in our towns and cities, in order to help us tackle this disease. For the longer term, we will learn the lessons from the response to Chalara and use them to consider our strategic approach to plant health. The Secretary of State has already told the House that he is prepared to look at radical options. He will come back to the House in a few weeks to report on progress.

I believe we have taken all appropriate actions to deal with what is a very serious situation.

As I was saying, this is a very difficult situation, and I believe we have taken all appropriate steps. To repeat something I said in response to the previous urgent question, we are not going to engage in the blame game. This is not a question of attributing blame to anyone; it is a question of getting things right, by working with everybody who has a genuine interest in the future of our forests and woodlands and making sure they are mobilised in the most effective way to deal with Chalara. Those who want to peddle conspiracy theories can do so if they wish; we will get on with dealing with the disease.

That is precisely why I began by referring to the definition on DEFRA’s website, which encompasses the broader conservation issues. The National Trust, of which I am proud to be a member, welcomes the Government’s commitment to further research and calls for money to be committed to plant health, which is hugely important.

In my capacity as Chair of the Select Committee I wrote to the Minister on Friday—it is perfectly reasonable that he has not replied yet; I do not criticise him for that—asking what scientific evidence there is to support the theory that cases of Chalara fraxinea in East Anglia were caused by airborne spores from Europe. Will he put on the record the scientific citations that support that? He cannot do so because there are not any. An eminent group of people for whom I have the greatest respect has come up with possible explanations, but the Minister did not say that, given the way fungal infections spread, it is equally possible that these cases started some time ago and came from imported seedlings. He does not know the answer and perhaps he will confirm that.

The hon. Gentleman is being fair. With epidemiology there are never definite answers, but I hope he will agree that the distribution is not entirely consistent with the view that this came from imported seedlings—one would expect a much more rational distribution across the country than the eccentric distribution shown in the tests.

I referred to the SAGE precisely because the Select Committee’s report on scientific advice in emergencies called for an opening up of the process. I believe that one alternative explanation has not been rigorously tested, although it could be by an open call for evidence from the Minister. Nurseries in places such as Lancashire, from where the trees I planted 10 years ago were sourced, source their trees from locally grown seedlings, whereas closer to the European mainland the probability is greater that seedlings were sourced from within Europe. That possibility needs to be tested, and by opening up the SAGE process I invite the Minister to do just that and close the missing link.

There are issues on the DEFRA website that concern me. My hon. Friend the Member for Wakefield (Mary Creagh) spoke of how the website had changed miraculously, but I remind the Minister that the changes were made without any reference to scientific citation whatsoever, and that must be examined.

Chief scientific advisers ought to be able to give scientific advice, based on the science, freely and openly to the Government, and it is not for Ministers to reinterpret that on their Department’s website. That is an improper use of the scientific advice, which should be available to the whole House and indeed the whole country. There is no reason that the process cannot be conducted most transparently, and if it is we will suck in all the information necessary to solve the problem once and for all. It is a challenging issue, but I hope the Minister takes my advice.

I thought for a moment that my hon. Friend was congratulating you, Mr Chope, on introducing that concept, and I wondered whether I had missed something. Yes—a one-nation CAP reform. That is our slogan for today.

If the concerns raised by environmental organisations are not addressed, there is a danger that the CAP, which has demonstrably made some progress over the past 20 years—albeit painfully and slowly at times—could, as part of a process intended to improve its environmental performance, perversely be taken backwards. I am glad to say that there is general agreement on the need to green the CAP, which I regard as absolutely necessary if we are to achieve three objectives: first, to support more long-term sustainable food production; secondly, to address the ever-increasing challenge of global food security; and, thirdly, to meet our environmental goals, which range from halting and reversing biodiversity declines by 2020, to meeting our climate change targets.

Greening of pillar one payments must happen and, at the same time, pillar two must be fully protected or ideally, increased. The added justification for those changes is, in the words of the RSPB’s evidence to the Committee’s inquiry, to

“legitimise expenditure of €300 billion over the next seven years.”

That is a huge sum of money. We know from yesterday’s debate on the EU budget just how much concern there is in this place, and among the wider public, about EU spending, of which the CAP is the largest single component. I agree with the Committee’s conclusion that it is a concern that greening may be seen by the Commission as a way of justifying the significant public expense of its policy on direct payments, rather than a way of delivering environmental improvements across the EU. I hope that the Minister will devote some time to that concern in his response.

There is also concern, as there is in relation to other areas of Government policy, that this could become an exercise in so-called greenwashing—greening in name, but not in outcome. Greening must be designed and implemented in a way that secures genuine environmental improvements at farm level and across all member states. There are worrying signals that the member states want to maintain the status quo but to repackage the status quo as green when it is clearly not. The Luxembourg paper contains some strong examples of that. The measures suggested by 16 member states in that working paper, published in April, are even worse in delivering environmental outcomes. In particular, the section on farmers who are “green by definition” has raised concerns. Arguing that a farm is automatically green just because a certain proportion of it is grass is nonsensical, as there is huge variation.

I am glad that the Minister is nodding. I hope that he repeats that when he comes to make his speech at the end of the debate. Grassland can be managed in a way that is good for the environment, but can also include reseeded and extensively managed grassland, which does not deliver comparable environmental benefits. The UK was one of the member states involved in that document. I am pleased that the Government have since distanced themselves from it, saying that the UK was not a co-signatory, but just wanted to move the Commission’s thinking forward. I hope that the Minister will use this opportunity to clarify that again.

One argument that we are hearing a lot, including from the Country Land and Business Association and the NFU in the UK, is that farmers in agri-environment schemes should be counted as “green by definition”. It is true that there are many good examples of what those schemes are achieving in the UK, but there are two problems. First, there would be no environmental additionality from such an approach, and that is badly needed. Secondly, it would in effect involve double funding. Farmers would be paid once via their agri-environment scheme payment—paid for under pillar two—and paid again from their new greening payment, when the new CAP comes into force, under pillar one. Therefore, although it is important that greening and agri-environment schemes work coherently together, I do not think that “green by definition” is the answer.

Let me move on to talk about flexibility. The Select Committee and the Government agree that a one-size-fits-all approach is not appropriate. The Select Committee Chair, the hon. Member for Thirsk and Malton (Miss McIntosh), talked about that in some detail today, as did the hon. Member for Banff and Buchan (Dr Whiteford). It is only practical for there to be flexibility so that environmental measures can be tailored to local environmental and agricultural conditions. I would very much support that approach. However, there are some dangers with too much flexibility.

I can see that, for the UK, a flexible approach makes most sense, as we are leading the field with our higher-level stewardship schemes and would most likely use that flexibility to deliver positive environmental outcomes. However, if member states are allowed the full flexibility that they are calling for to implement greening in their own way, that flexibility could extend even to determining what counted as green. That could allow member states to kick out the Commission’s greening proposals and do what they liked, and sadly in many EU countries that could amount to next to nothing. The NFU has also raised concerns about that, but from a different perspective. As the report outlines, the NFU is concerned that DEFRA may impose more stringent greening measures on UK farmers that would not apply in other EU countries.

As I think the hon. Member for Tiverton and Honiton (Neil Parish) said, it is very important that we achieve the level playing field that is talked about so often when it comes to EU matters. I therefore support the calls from a number of environmental bodies that there should be a common framework that every member state must deliver, with flexibility to tailor implementation to local circumstances. A free-for-all on greening is not the best outcome for the environment in the EU.

Let me deal briefly with ecological focus areas. It is perhaps in the Commission’s proposals for EFAs that a common approach has best been mapped out and could make the best contribution to realising the ambition of greening the CAP. There is criticism outlined in the report about the proposed percentage of a holding that would be included in EFAs, with concern that that would mark a return to set-aside and severely limit increases in food production and competitiveness. However, as many environmental organisations have pointed out, because it could include a wide range of landscape features and low-grade agricultural land, which may already be under some form of environmental management, it would not necessarily mean taking significant areas of high-quality arable land out of production.

EFAs could have significant potential to make the direct payments that farmers receive from pillar one of the CAP deliver more for the environment. By including in EFAs important landscape features of the countryside, such as hedgerows, and ensuring that EFAs help to protect and maintain them, the character of our farmed landscapes and their wildlife could be greatly enhanced. However, the proposals would not achieve that aim and would need to be carefully designed and implemented to deliver real environmental benefits.

Lastly, I would like to raise an issue outlined by the CPRE. It stresses the need to ensure that the environment does not lose out when it comes to allocating funding to rural development measures under pillar two. Ensuring that pillar two is adequately funded is essential not only for green farming schemes, such as environmental stewardship, but to ensure that enough rural development funding is available for measures that support local food producers to boost economic sustainability in rural areas. The CPRE recently mapped the links between those who produce, process, buy and sell food sourced locally. It found that local food networks could be contributing £6.75 billion of value to local economies.

That is particularly important in Bristol, one of whose seats I represent. We recently held a mini food summit, bringing together organisations such as the CPRE and the people running Bristol’s green capital bid, which I very much hope we succeed with next year—it may be third time lucky. We were talking about how we could bring together people working in the food sector across Bristol as a hub for the south-west. The shadow Farming Minister, my hon. Friend the Member for Ogmore (Huw Irranca-Davies), was there, and I think that he would agree that it was a productive discussion in terms of how we can look at sustainability issues, encourage people to grow food locally and tackle food waste, which I have not mentioned today, but have spoken about on many other occasions. Obviously, that is also an issue in the EU. It is important to us locally that we look at how we can support local food networks.

The Select Committee says that DEFRA must redouble its efforts

“to find, engage and secure reliable allies across the European Union”

and have the resources in place

“effectively and persuasively to put the UK’s case that the CAP should support…the agricultural sector and provide environmental protection.”

I totally support that conclusion. I am somewhat pessimistic about what can be achieved, but I urge the Minister to throw his weight—his much-diminished weight, it must be said—behind our efforts to ensure that real progress on environmental issues can be made as part of this process.

Thank you for calling me to speak, Mr Havard. I do not deal in soundbites; I deal in solid policy and solid negotiation. We will leave soundbites to the hon. Member for Ogmore (Huw Irranca-Davies).

It is a delight to serve under your chairmanship today, Mr Havard. I also want to say a big “thank you” to my hon. Friend the Member for Thirsk and Malton (Miss McIntosh), the Chair of the Environment, Food and Rural Affairs Committee, first for committing her Committee to the report—the very compendious report—that it has produced, and secondly, for having the good sense to apply for the opportunity to debate it here in Westminster Hall today. It has been extremely useful for us to debate the report, not least because my official title is the Minister of State, Department for Environment, Food and Rural Affairs, so I am responsible for both agriculture and the environment, and it is nice to have a topic that clearly places both parts of my job description in the frame.

I am grateful to my hon. Friend for making it clear in her early remarks that we have these priorities of food security and climate change, and they are part of our background thinking in this sector. I am also grateful to her for drawing attention to the difficult weather conditions in the past few months, which unfortunately may continue, and to the need for certainty. Nothing would please me more than to say—through her to the farming communities, the people who are looking at this debate in terms of social policy and the people who are desperate to have answers to the environmental questions—that we have a degree of certainty, but the reality is that we do not. The negotiations that we are involved in are still very much in play and I will try to give the House the benefit of our experience, to say where we are and what our objectives are. However, I am afraid that what I will not be able to do, with any degree of certainty, is to say where we shall end up, because there is still an awful lot to play for.

I start by making it clear that the Government are very much in agreement with the majority of the EFRA Committee’s findings and with the conclusions in its report; that was also very clear in the formal Government response to the Committee’s report. If I may paraphrase, the Committee’s two key conclusions are that the UK’s existing agri-environmental schemes should not be undermined by greening, and that greening should be applied in a simple, flexible way that recognises local circumstances. As I say, we could not agree more with the Committee on either of those aspects. May I say how much I value the agri-environmental schemes that we have in this country? It is not being complacent to say that they are of a very high standard and that in many ways we achieve a higher level of outcome than many other EU member states.

Of course, I would always like us to do better and there are ways in which we can continually improve, not least by recruiting more people to higher-level stewardship schemes, but I will not say anything other than that we do a pretty good job at designing those schemes and we have done so for some time. The hon. Member for Ogmore said “Happy 50th birthday” to the common agricultural policy. I am not sure that that many people will be lighting candles in support of that contention, but I hope that more people might like to have a small celebration at the 25th anniversary of the groundbreaking agri-environmental schemes in England. I want to make it plain that we want to preserve and extend that legacy for future generations.

In light of the earlier comments by various hon. Members today, does the Minister agree that the success of the HLS schemes—albeit they might need to be tweaked again as time goes by—and the welcoming of that success is a result of DEFRA officials being out there on the farms, in the fields, with people, fine-tuning the schemes until the eleventh hour to get them right? Actually, the success of those schemes gives us a lesson about the need for there to be as much subsidiarity as possible within the CAP reform greening proposals. They need to be worked in the UK, for the benefit of UK farmers and the UK public.

The hon. Gentleman is absolutely right. Mr Havard, we are going to have an embarrassing degree of consensus in Westminster Hall today on an awful lot of this material, because we have very strong common ground across the political parties and across the nations and regions.

I must say that it was not always so. When agri-environmental schemes were introduced, I remember that in my part of the world in particular there was a huge outcry about the “imposition”, as it was described, of agri-environmental schemes on the Somerset levels. People were very upset about what was happening, and then effigies of Ministry of Agriculture, Fisheries and Food officials were burned on the levels. We get very excited about these things in my part of the world—we are all revolting peasants at heart.

My hon. Friend will agree with that contention, as I know where he comes from.

The confidence in agri-environmental schemes is, as the hon. Member for Ogmore says, the result of careful preparation and consideration, as well as ensuring that everybody understood not only what they were to do, but the reasons why they were to do it and why the schemes would have an effect.

That is partly the answer to the point made by my hon. Friend the Member for Thirsk and Malton about modulation. From our point of view, it is essential that we are able to ensure the continuation of these schemes, and the way that we can do that is to make sure that there are the funds within pillar two that enable us to maintain them. It is not just the agri-environmental stewardship schemes that matter, although they are important. It is also through one of the other things that she mentioned—the rural development programme for England—that we can deliver the other added benefits and the public good, by the use of modulated payments. We must be very conscious of that.

My hon. Friend also made a specific point about the exit from the schemes. I hope that the Government response to the Committee’s report set out the position of someone who has signed up to a 10-year involvement, which is clearly the legal position. However, if difficulties arise after we have concluded the negotiations and if the new schemes clearly require us to look again at transition, I will be happy to talk to her, the rest of the Select Committee and indeed other interested parties about that, to ensure that people are not penalised for something that is outwith anything that they might reasonably have expected. That is because my determination is that farmers who enter into agri-environmental stewardship schemes have the confidence that, in doing so, they are not shackling their businesses to something that they do not want to do and are not making a rod for their own back. Instead, they should have the confidence that the scheme will continue and will provide the support they need for them to do the things that they want to do, both in running their businesses on that land and in achieving the environmental benefits for the wider good. I happily give my hon. Friend that assurance.

What would be helpful is a letter of clarification. Perhaps I am misinterpreting the Government response, but when it so clearly states that

“there is no legal basis for allowing farmers wishing to withdraw”,

does that refer to an existing scheme or a new scheme that they are about to sign up to, which will then be an existing scheme from which they may wish to withdraw if the greener proposals are more advantageous to them? As I say, a letter clarifying that issue, which we could place in the Library, would be most helpful.

I am happy to give my hon. Friend a letter. Again—I am not trying to avoid the question—there may be some uncertainties at the moment, as we are discussing transition, a key issue, with the Commission. It is giving us all sorts of potential headaches in the administration of schemes. We have a limited time horizon, and we simply do not know at what point new arrangements will kick in and what those new arrangements will be. Until we know that, it is difficult to make longer-term plans. However, I will happily write to her and set that out if it is helpful.

I get the hon. Lady’s point. What we need clarity on—I understand if the Minister cannot give it today—is where the cut-off point is and at what point in the process it occurs. We need that clarity so that we and he can encourage farmers to keep signing up for existing schemes without fear that they will lose out.

There is no change in position. I am simply saying that we certainly want to ensure that people are not penalised. However, we will not be happy if people enter stewardship schemes and then try to exit for no good reason when there is no substantive change from the new arrangements—if they simply say, “We signed up for 10 years, but we now think that it is in our interests to bail out after two,” for unconnected reasons. I will write to my hon. Friend and copy in the hon. Member for Ogmore to ensure that there are no difficulties in understanding. Perhaps I am not expressing myself well.

I am grateful to you for setting that out, Mr Havard, but I have to say that anyone who hopes to follow all the ramifications and tergiversations of the common agricultural policy negotiations will need those pieces of paper in front of them to have any chance of understanding much of what we are talking about. Having said that, let us try to express ourselves.

I will now be even more runic, because the hon. Member for Banff and Buchan (Dr Whiteford) asked me about the effect of the rebate. Anyone who tries to explain how the rebate works inevitably ends up confusing everybody. I will simply say something about it, I hope without entering into a longer discussion, because we will all get confused.

If part of pillar one is greened, that will not affect the rebate. Even if we manage to secure a transfer of the greened component from pillar one to pillar two, it still would not have any impact, because all pillar one expenditure and all pillar two expenditure originating in pillar one counts toward the rebate calculation. I hope that the hon. Lady finds that helpful. Looking at her, I am not sure whether she does. Again, I can provide further information later if she likes.

I move to one of the key underlying issues of this debate: the Committee’s ambitions for simplicity and flexibility. Those are fundamental to the Government’s position on greening. We seek to ensure that the administrative burden is low for farmers and administrators. For farmers’ sake, we do not want to gold-plate—as my hon. Friend the Member for Thirsk and Malton called it—any proposals introduced, but the thrust of Government policy has been exactly in the opposite direction.

My hon. Friend mentioned the Macdonald review, but I think that it delivered some sound suggestions about how we could reduce the impact of red tape on the farming community. We are making good progress on implementing them. I am afraid that farmers do not always recognise when that has been done, because when they no longer have to fill in a form that they used to have to fill in, they do not notice. We may need to make people better aware of the fact that we are proceeding with that as fast as we can. Sometimes it will need changes in legislation, which will take a little longer, but wherever we can, we are trying to implement the Macdonald review. I have regular meetings with Richard Macdonald to ensure that we keep up with his timetable.

It is certainly an awful lot better than the pronunciation of the hon. Lady’s constituency from the hon. Member for Ogmore, so I would not worry too much, Mr Havard.

The hon. Lady is right. To be absolutely clear, one of the big bones of contention in the negotiations is that we think the Commission’s direction of travel on the issue is precisely wrong, and we have to push very hard back the other way. One of my drivers for that—I am sure my counterpart in Scotland feels the same way—is that I simply want to ensure that we can implement the CAP effectively and efficiently when it is introduced. I do not want the Rural Payments Agency in England to go back to the dark days of a few years ago, when it was incapable of doing the job set for it because it was insufficiently well equipped to meet the complexities. I want to ensure that on the day when the arrangements are implemented, whatever they may be, we can deal with them. That means a long implementation time and simplicity in the construction and design of what is proposed.

Will the Minister return to the point that I raised about the Commission’s impact assessment suggesting that the proposals would add about 50% to the costs? He can extrapolate from that to complexity and bureaucracy as well. Is it his intention that the final outcome of the negotiations will entail no increase in complexity or costs to farmers, or will he accept some complexity if that is the only way to finalise negotiations?

There are all sorts of competing interests. The hon. Member for Bristol East (Kerry McCarthy) is keen to ensure that member states cannot simply slide away from the commitments that they make. It is difficult to answer on what the final outcome will be. We are clear about our objectives, which are to simplify the proposals dramatically to achieve the environmental objectives, but with enough flexibility to ensure that we do not engage in complications that would jeopardise some of the things that we have in this country. We certainly do not want to increase costs. At the moment, I can give no assurance to the hon. Gentleman about the result of the negotiations. All I can give him an assurance of is our best endeavours toward that end.

I seek the Minister’s graciousness in giving way again only to highlight the fact that his answer sounds remarkably like the answer that the Opposition gave when we were in government, which was, “We would love to have no increase in regulation, but there just might be some, because that might be where we end up.” We took a lot of flak when we were in government over regulation and gold-plating. Sometimes there is good regulation as well.

There is, but it must achieve the right objectives, and our concern about some of the proposals is that they increase the complexity and the regulation and do not achieve the beneficial effects. That seems axiomatically wrong, and I think the hon. Gentleman is agreeing with me.

I note what the hon. Gentleman says about flexibility. That is certainly what we are trying to achieve. We want the flexibility to apply practical, effective and simple measures for our farmers. I thought that he ended a sentence in his speech with, “We want flexibility in the United Kingdom but not in other nations”. I thought, “Right. Yes, just stop there,” but I do not think that that is an achievable negotiating position. To be fair, he did carry on with his sentence.

Let us be absolutely clear: we want to achieve an environmental benefit across Europe, but we do not want to lose our high standards. We are engaging, therefore, with the European Commission, the European Parliament and other member states to ensure that there is flexibility in the EU’s approach to greening.

My hon. Friend the Member for Thirsk and Malton requested an update on the process. It will be extremely difficult to offer the precision that she requires. Many different views are being expressed within the Agriculture Council and the European Parliament, and much will depend on the outcome of the overall budget negotiations. As Members have already said, until that budget is completed we will not know what the quantum is, and it would be difficult to resolve many of the CAP issues without knowing the size of that envelope.

There is a move by the Cypriot presidency to achieve a partial general agreement, before the end of the year and the end of its EU presidency. Such an agreement will come about only if we are satisfied that we have something that is sustainable in all its senses, and as far as the UK is concerned I think that we are some distance from that. I expect—this is no more than an expectation—that it is more likely that we shall come to a conclusion during the Irish presidency, following the conclusion of the budget round.

My hon. Friend the Member for Thirsk and Malton asked whether we have allies. Yes, we do. As always with European negotiations, there is a constantly changing kaleidoscope on different issues, but there are member states that clearly understand our points about flexibility and complexity and about how we can achieve the results, rather than focusing on an incomplete understanding of how we can best achieve better environmental benefits across Europe. It would probably be unhelpful at this stage in the negotiations to be numbering our friends and our enemies, because someone’s friend on one issue will often be their opponent on another.

Let me make it plain that we are not opposed to the concept of greening if it delivers greater public benefits from taxpayer expenditure. That is our clear position—the hon. Member for Bristol East made that point—and we want it to be achieved in a way that recognises the wide diversity of agriculture around the European Union. I just do not believe in the one-size-fits-all approach. It is hard to find such an approach even within the United Kingdom, as the hon. Member for Banff and Buchan said. Circumstances are different within England itself, with a hill farm in the Pennines being different from a cereal farm in East Anglia, and different parameters apply. I entirely agree with the EFRA Committee’s view that a one-size-fits-all approach might lose its relevance when applied to particular circumstances, and certainly when applied to our own.

Each of the areas proposed by the Commission initially, which were crop diversification, the retention of permanent pasture and the need for a proportion of land to be designated as ecological focus areas, has the capacity to divide opinion—informed opinion, because of exactly the points that Members have made today. Each measure contains the essence of a good idea—there is something there in the initial thinking—but the environmental benefits are not clear when the proposals are considered in the light of our own circumstances. I know that many other European Union member states are forming the same view, particularly when the supposed benefits are considered in the light of the costs and complexities of implementation. It is not obvious that the money should be spent in a way that more demonstrably delivers complexity rather than environmental benefit, which is crucial.

It is fair, and not unkind to Commissioner Ciolos, to say that a particularly remarkable aspect of the greening debate in Brussels is the fact that the Commission seems to have few, if any, supporters for the precise way forward that it has proposed. I would take some comfort from that if I saw a majority in favour of an alternative, but at the moment there are only many minorities.

Some countries have yet to be convinced about the basics, about the further shift towards paying farmers for delivering environmental public goods. They see ideals that we have long shared in this country as an expensive luxury at a time of economic difficulty, and we have to be alive to that view. There are attempts by some to water the proposals down and exempt the majority of their farmers. It is funny how definitions always exempt a member state’s own farmers from their effects—that is known as greenwashing. There are issues about greening by definition, and we do not want this to be a badge of convenience, with people carrying on exactly as before but with the application of greater funding, as that cannot be in anyone’s interest.

The Minister makes an interesting point. There are cases in Europe of people wanting to exempt small farmers from a lot of the conditions. In countries where the majority of the land is made up of very small farms, all the greening aspects get taken out because the farmers are ruled out of them.

Precisely so. Time and again people pay lip service to a “very good idea” but somehow it then does not apply to their own circumstances. We have to be wary of that and not fall into the same trap.

If we are to go down a route of some form of greening by definition—to which there is some advantage, in reducing complexity and allowing for easier systems—it has to be on the basis of something that shows the environmental benefit. I would argue, for instance, that our stewardship schemes do that. We could demonstrate beyond anyone’s reasonable doubt that our environmental schemes show a clear commitment to environmental benefits on the land within their compass. If we extend the self-definition too far, however, we get to the point at which simply having a hedge is sufficient qualification to be a greened farm. That is not an adequate definition.

Other member states share our view that this is basically the right direction for the CAP to be moving in, but that the Commission’s proposals are too blunt, too inflexible and too complex in their implementation. We have heard a few examples of that. The hon. Member for Banff and Buchan talked about the definition of “active farmer,” and my hon. Friend the Member for Tiverton and Honiton (Neil Parish) pointed out that quite a lot of Scotland is not farmed as intensively as most parts of England because of the nature of the ground. Yes, that is true, but the Scots have a case with, for instance, grazed heather, and we are helping to press that case strongly in the negotiations on behalf of the Scottish Government, with whom we have very close contacts, as we do with the other devolved Administrations.

With tenants, there is a question of who is the active farmer. It is far more important to identify the activity, rather than the status, of the person doing the farming. I hope we can move in that direction. I have already mentioned hill farming, and in the negotiations we have to be alive to the interests of less favoured areas. I said as much when I was in Cumbria recently and, not surprisingly, I received a measure of support, but we have to be conscious of the fact that there are many different types of farming, and we need to have something that, as far as possible, can accommodate those differences.

The hon. Member for Ogmore and others mentioned capping—I am sorry, but I cannot remember who provided the response. With the proposals on capping and young farmers, for instance, it is all too easy for lawyers simply to adjust the holding to fit the policy, rather than change what is happening. I am wary of that. I want to maintain the incentives, the competitiveness and all the rest. Although I can sometimes see the advantages of such proposals, I do not want the nominal ownership of an enterprise to be changed simply to create a money stream that would not otherwise be there, because that is not in the interests of efficient farming or the objectives that we have set.

I urge the Minister to keep his mind open, because the larger arable farmers would argue that they are already the most productive, that they invest the most in innovation and that they collaborate the most extensively. On that basis, they should be the most susceptible to an argument that, for the largest payments in the country, they should easily be able to prove that they are adding value, not purely on acreage or hectarage, but in the productivity and innovation of their farms. I urge him not to close his mind, because that is a sharp and intelligent argument for the good use of CAP payments.

I never close my mind to anything. I am always open to a discussion, but the hon. Gentleman’s proposal is not that different—if, indeed, it is different at all—from something that the Commission proposed right at the start of the negotiations.

There are difficulties, but I am happy to have further discussions with the hon. Gentleman, because I never rule out proposals until I can see clearly that they are not in the wider interest. In return, I ask him to consider the potentially significant problems with artificially fragmenting landholdings or artificially transferring titles, which are not helpful things to encourage.

If there is a consensus among member states, it is that greening is too complex an issue on which to rush to agreement. I have already indicated that, in setting out the timetable, there are still wide differences in approach, and few support the proposals as they stand. It seems to me that there is still a lot of work to be done, and the negotiations need to continue. The one thing in the Select Committee’s report that I would take slight issue with is the implied criticism that Ministers and DEFRA have not been as active as we might be in Brussels on greening. I simply do not recognise that in the case of my right hon. Friends the Members for Meriden (Mrs Spelman) and for South East Cambridgeshire (Sir James Paice), who are the predecessors of the Secretary of State and me. They were very active in Brussels on CAP reform in general and on greening in particular. The Secretary of State and I are taking that forward and engaging at all levels. We are working with the Commission, the European Parliament and other member states.

My hon. Friend the Member for Thirsk and Malton enjoined me to cuddle up to MEPs. I do not know about cuddling up, but I do have conversations.

An eminent member of the European Parliament’s agriculture and rural development committee, whom I hope can advance our cause. It is important that we keep in contact because of the co-decision process that has changed the way such things move forward. It is important that we understand what is being talked about in the European Parliament, what the positions that are being adopted look like and whether we can, at the earliest stage, influence the way that those positions develop and where coalitions form to ensure that, as far as possible, our interests are served not only in the Council but in the Parliament, because ultimately we need to persuade both of what we want. Greening is on the agenda for pretty much everything that we do in Brussels on CAP reform at both ministerial and official level.

We are also working with stakeholder organisations on greening, because it is important to hear what they have to say. My message today is that achieving the right outcome will not be easy, and I am not going to pretend that it is. There are so many viewpoints to accommodate across the EU, and there is always a risk that we may not fully agree with every element of a wide-ranging package of measures. I find it reassuring that there is no discernible fundamental difference between the Select Committee and the Government on greening, but in some ways it is even more reassuring that there is no discernible difference in attitude between all the Members who have spoken in this debate and the Government or between the parties. We are clear on what the British position needs to be; the question is whether we can persuade others to adopt a similar position.

I am coming to the end of my contribution, but I want to mention agri-science, which was raised by my hon. Friend the Member for Tiverton and Honiton. In a way, agri-science is only tangentially relevant, but in another way it is fundamental. If we are talking about food security and measures that could benefit the environment within a context of higher food production, we have to embrace the best technologies to make that happen. I do not say that lightly—sometimes we have to adopt clear precautionary principles when we embrace new technologies—but the agri-science consultation launched by my Department and the Department for Business, Innovation and Skills, which has responsibility for science and technology, is important. Finding ways to get the research community and higher education properly engaged in those areas will be crucial to finding solutions in the long run.

My hon. Friend mentioned blight-resistant potatoes. I went to a research laboratory a few weeks ago and spoke to the only man in Britain who was really pleased about potato blight. That is perhaps being unkind to him, but he was researching blight-resistant potatoes and told me, “Look, everyone’s got potato blight this year—and we haven’t! I have a crop that has been shown to be resistant to potato blight.” There are things that can be done. It is not just about genetic modification or novel foods; we need to be engaged with, and make progress on, a range of areas.

Not only do we owe it to people in this country to make sure that we persist with the sustainability of our agriculture, but we owe it to people in other countries who will be facing much bigger difficulties—something mentioned by the hon. Member for Glasgow North East (Mr Bain). There are people across the world who need to be fed, and they will find it more and more difficult as the effects of climate change are realised. We are in a unique position because of what we can achieve with the quality of our research and technology. Our skills will provide some of the solutions to the questions that will increasingly be asked. I want this country to be in that position, I want the European Union to be in that position, and I hope that it is axiomatic to what we are discussing.

This has been a fascinating and positive debate. I hope I have been able to cover most of the issues raised and to indicate where we stand. At the moment, this is an incomplete and difficult negotiation. I will not be able to be certain about the outcome until the point at which we have an agreement, first on the budget and then on the CAP. However, I assure hon. Members, and the Committee in particular, that the concerns they have expressed are very much at the heart of our negotiating position. Dealing with those concerns is precisely what we are attempting to do as Ministers engaged in those discussions.

My right hon. Friend the Secretary of State is today in Cannock Chase visiting woodland, so I will reply in his stead. We are taking the threat posed by Chalara fraxinea—ash dieback disease—extremely seriously. We have today imposed a temporary ban on imports of ash and restrictions on its movement, supported by the results of a shortened consultation with industry on our pests risk assessment. The ban will therefore be effective well before the start of the main UK planting season. Before the ban, the Horticultural Trades Association urged its members to follow a voluntary moratorium on imports throughout the period, which is being well observed.

On discovering Chalara in the UK, plant health authorities took immediate action rapidly to assess ash trees for signs of infection at more than 1,000 sites where ash plants from Europe had been grown or planted in the past five years, and this has resulted in the destruction of 100,000 trees.

I thank the Minister for his reply.

Over the weekend, the risk facing the UK from ash dieback disease has become apparent. Experts fear that it is the biggest threat to British trees since 25 million trees were killed by Dutch elm disease 30 years ago. It is disappointing that the Secretary of State chose to announce the ban in Staffordshire instead of in person to this House.

We welcome the ban, but the question on everyone’s lips is, “Why did it take so long?” Ash dieback was found last February in a Buckinghamshire nursery. Why did Ministers sit back, cross their fingers and wait until the disease was found in the wild in June? Why did the Horticultural Trades Association act before the Government? Why did the Government’s consultation on an import ban on ash start only on 31 August? Can the Minister give a cast-iron guarantee that no infected trees were planted in the spring, especially after the severe winter? Can he guarantee that no infected trees were imported into the UK over the summer while Ministers dithered? How does he know that people did not import saplings into the country in the boot of their car? Why were landowners and local authorities told of the disease just three weeks ago?

How will the ban be implemented and policed, and how much will it cost? On Saturday, the Secretary of State told the “Today” programme that 58,000 trees had been burned since the disease was identified. The Minister said that within that short 48-hour period the number had been revised up to 100,000. Can he tell us what the number will be by the end of the week? Is it possible to treat and store felled wood so that it can be used productively in future? What assessment has he received of the impact of the disease on jobs in the wood services industry?

In autumn 2011, the Forestry Commission’s pathology bulletin carried the headline “One to watch for—Chalara fraxinea”, and stated that it was

“not yet present in Britain”.

On what date was Chalara fraxinea identified as the pathogen that causes ash dieback and when were Ministers informed? They cannot say that they were not warned as an internal Forestry Commission document warned that cuts meant that there would be

“no capacity to deal with the costs of disease or other calamity.”

The Forestry Commission trade unions’ evidence to the Science and Technology Committee stated:

“Forest research in Great Britain is already funded at a minimal level, and will be drastically under-funded as the cuts proceed.”

This Government cut the Forestry Commission’s cash by 25%, closed seven regional offices, and cut 250 staff. They have cut funding for forest research from £12 million a year to £7 million a year. The Forestry Commission’s website details the difficulty that scientists had in identifying the deadly form of the fungal infection, and those cuts reduced the commission’s ability to identify and tackle tree disease.

We welcome the creation of a tree disease taskforce under Professor Ian Boyd to deal with this crisis. We also welcome the app that is being launched to crowd-source the disease—I am surprised that the Minister did not mention it—although with leaf fall already under way this is, again, too little too late. After the forest sell-off fiasco, this incompetent Government have been asleep on the job with ash dieback. Like Nero, Ministers fiddled, and now it is our forests that will burn.

It is sadly predictable that when we have a serious condition that could have enormous consequences with which we are trying to deal as a country, the first thing the hon. Lady thinks is, “How can we blame the Government rather than deal with the disease?” She asked why the Secretary of State was not here today. It is because he is talking to people who are dealing with the disease; he is talking to foresters and making sure that we are taking all necessary precautions.

The hon. Lady asked why nothing was done in February. Of course something was done in February—we acted straight away under the previous Secretary of State. Once the first United Kingdom finding of Chalara was confirmed in March, plant health authorities prepared a pest risk analysis. No previous national or international pest risk analysis existed, partly because until 2010—[Interruption.] The hon. Lady would do well to listen to the background to this. Until 2010, there was widespread scientific uncertainty over the identity of the causal organism. That is actually an international issue, rather than an issue in this country.

Since the disease was intercepted, plant health authorities have been carrying out intensive surveillance and monitoring, chasing forward movements of ash plants from infected nurseries and inspecting trees in the vicinities of infected sites to ascertain where the disease may be present in the wider environment. That enormous ongoing task involves well over 1,000 sites, and it is as a consequence of that that the 100,000 trees have been destroyed.

The hon. Lady asked for a guarantee that no infected material came in during the voluntary moratorium, but of course I cannot guarantee that. I can say that no commercial imports took place, because of the action that we took, but I cannot guarantee that no one brought back a little ash sapling in the boot of their car. I hope that they did not, but I cannot guarantee it.

The hon. Lady may not understand that this is an airborne disease and that the incidence of the disease in mature trees in East Anglia had not previously been suspected—it is likely to have been carried on the wind over the channel. Now that we have discovered it, we have immediately taken the action required.

Finally, the hon. Lady was quite wrong about resources, because there has been no reduction in those for plant health and tree health in this country, as she would ascertain were she to speak to the Forestry Commission.

I welcome these proceedings and congratulate my hon. Friend the Minister. Will he pass on our thanks to the Food and Environment Research Agency in my constituency for its work and to the Forestry Commission? Will he explain to the House that this disease was already treated as a quarantine pest under national emergency measures? That would help to show that it was already high on the political agenda. Will he ensure that resources are put into urgently investigating the age profile of the disease? Saplings are deemed more likely to die from the disease, but are mature trees equally at risk? Will he also assure the House that none of the other plants that are being inspected by FERA and the Forestry Commission are causing the same concern?

I can certainly confirm that we are taking all measures possible to deploy colleagues in the Forestry Commission, those working in forest services and people from FERA to identify the incidence of disease wherever it can be found. We will look closely at a suspected further case in a mature tree. It is important to realise that there is a national forest inventory through which symptoms of disease are looked at across the board all the time. There were 8,000 inspections of ash trees under the inventory last year and it was found that the trees were, in fact, in very good health. Only 61 cases of any signs of ill health in ash trees were discovered, and none of them was due to Chalara.

There is concern because while it is now late autumn, this was discovered much earlier in the year. Leaving aside that delay, will the Minister give the House an assurance that he will work with the Woodland Trust, which has great expertise in this issue and has a series of asks for the Government?

It is important that we work with everybody; this is not something that we can leave entirely to the scientists and the experts. Anyone who spots an incidence of disease in trees would do well to advise the authorities. We can then use the great body of voluntary organisations that are interested in the health of our forests to do all we can to deal with the disease as quickly as possible. I repeat that there was not a delay over the summer. Planting does not take place during the summer period and, as far as we are aware, the voluntary moratorium has worked very well.

We are keen to bring together experts in plant disease, industry experts and wider forest interests so that we can see what more, if anything, can be done to deal with what could be a disastrous outbreak of the disease. We also need to look at how we will deal most effectively with plant and tree health in future. The Secretary of State and I have discussed that, because we feel that for many years this country has not been as well equipped to deal with plant health as it has with animal health. I would like us to be prepared for all eventualities at all times.

This episode is a terrible indictment of the Government, and also the Opposition, because the Horticultural Trades Association first warned about the disease back in 2009—[Interruption.] Neither of your houses has worked hard or fast enough on this. Will the Minister reverse the 25% cuts that he is making to the Forestry Commission so that it has the resources to tackle this episode urgently and properly?

I am afraid that the hon. Lady simply is not correct. I have explained the sequence of events and the fact that we have in no way reduced the resources available for plant and tree health.

Pound farm in Suffolk is a mile from my constituency boundary, in the constituency of my hon. Friend the Member for Central Suffolk and North Ipswich (Dr Poulter). Will the Minister update the House on what proactive policies are being put in place for local home owners and residents? Will there be a proactive felling and burning policy, and how will it be communicated?

We certainly need to communicate with local people who have forestry interests and trees on their property about what they should be looking for. I will not pre-empt the discussions with the experts on the ground about precisely what is the right action to take, but I assure my hon. Friend that we will apply all available resources to the problem, because we do not want it to spread further if we can possibly avoid it.

The Minister said that he had difficulty identifying the pathogen, but did he or his officials contact Danish scientists who have a decade of experience in the field? Will he publish the scientific research indicating that airborne spores could reach this country from continental Europe?

It was not I who had a problem identifying the pathogen; it was the international authorities, including the Danish authorities that the right hon. Lady mentions, who had reason to suspect that the pathogen was not the one that was initially identified, and that it was less virulent. That was why Europe and the world, frankly, took their eye off the ball to a certain extent and did not recognise the threat that Chalara represented to the Danish forests, for instance. Of course we work closely with our colleagues in other European countries and learn from their information, but I am afraid we cannot second-guess the international consensus.

The ash tree is known as the Lincolnshire tree. Indeed, my home in Lincolnshire is surrounded by them, and if only a couple fell over, my home would be completely demolished. We therefore take the problem very seriously in Lincolnshire. Will the Minister accept that there have been reports of nursery imports carrying the disease coming into Lincolnshire, and that the reason why such diseases have taken off in the past is that Governments have not had sufficient grip and have not been severe—ruthless even—by stopping them at their inception?

As I have indicated, we need to take tree and plant diseases very seriously. There is of course evidence that saplings have brought the disease into the country, which was precisely why we applied the voluntary moratorium and have now moved to a ban, which comes into effect today. That means that no trees have been imported on a commercial basis since early spring.

What advice would the Minister give to people who might have trees with the disease in their garden? How will he encourage them to come forward if they are concerned that they might be blamed for bringing the disease into the country?

Let me be clear: we are not going to blame anyone for bringing in a tree. The only person engaged in a blame game is sitting on the Opposition Front Bench; the rest of us are trying to find practical solutions. I have no intention of scapegoating somebody who has innocently brought a diseased tree into the country. We will ensure that advice is available through the Forestry Commission, and use every resource, including the press, so that people know the signs they should be looking for in mature ash trees. Meanwhile, it will be for experts to identify the existence of the pathogen in ash trees and to take appropriate steps. Nobody should feel worried that because they have planted an ash sapling, they will be held personally responsible for the outbreak of Chalara.

While the Labour party has been making cheap political points, a consultation has been in progress. What can the Minister tell the House about how effectively that consultation supported a prohibition?

The consultation was about a statutory ban and the responses we received were overwhelmingly supportive of that. In fact, they also provided some further helpful advice about the implementation of the ban, which enabled us to achieve that at the very first opportunity.

I do not doubt the Minister’s commitment to tackling this issue, but when the Public and Commercial Services union made representations to the Government, it stated that cuts in the Forestry Commission would have such consequences. Even if the Minister does not accept that point, we will need additional resources. Will he undertake a swift, independent review of the need for those resources? I assure him that if he requires support in getting those additional resources and lobbying the Treasury, the Labour party will assist him.

Has my hon. Friend experienced any resistance from the European Commission or the European Union regarding the import ban, as was suggested on the “Today” programme a couple of days ago? If so, will he make certain that under no circumstances we will allow the EU to stand in the way of the plans that he has announced?

In this instance I can put my hon. Friend’s fears to rest because the EU has not impeded what we have sought to do in any way. Indeed, we have been working extremely closely with colleagues in other countries who, to date, have faced a much larger incidence of this disease than we have. We have been able to learn from their experiences and put those lessons into action in this country.

The Minister will understand that the felling of a large amount of timber may have an effect on the wood services industry and the price of timber. Will he issue advice—perhaps he has advice now—on the safe storage, curing and drying out of wood that has been felled, to ensure that the pathogen does not persist?

We will certainly issue such guidance. The ban also deals with the movement of timber and timber waste products in this country. There is no evidence that the pathogen persists in felled trees and wood products but, nevertheless, we believe that an appropriately precautionary response would be to restrict movements in this country, and that is what we have done.

Ash is not the only tree in this country that is under assault from invasive species. In parts of Richmond park, up to 50% of our great oaks show signs of acute oak decline, and about 70% of horse chestnuts in the country show signs of bleeding canker. Surely we can make better use of our island status and apply stronger and better controls at points of entry.

We can do a number of things. Obviously, we cannot prevent the spread of wind-borne disease, but we can look carefully at where import controls are required. We have instructed the agricultural attachés network in our embassies to monitor local intelligence, so that when there are outbreaks of tree disease, we can deal with them in a timely and effective way. The hon. Gentleman is absolutely right that ash dieback is not the only disease to consider, because we also have phytophthora, Asian longhorn beetle and sweet chestnut blight. We are having to cope with a number of serious tree diseases, and we are applying the necessary resources to do so.

I understand that an incidence of the disease has already been identified in Scotland. Will the Minister therefore tell the House the date on which the devolved Administrations were first notified?

We have worked very closely with colleagues in the devolved Administrations to ensure that they are aware of what we are doing and that they can take appropriate decisions on what ought to be done. The Forestry Commission works across the border with its counterparts in Scotland to ensure that all scientific information is shared. I am absolutely clear that they will have all the knowledge we have in dealing with this case. I do not think there is any shortage of information.

The House has heard what the Minister said about his Government not second-guessing the international consensus and not being impeded by the EU, but does he not understand the annoyance of my constituents, who care about our precious, ancient Epping forest, at the EU’s lack of action on biocontrol? While EU officials are wasting their time and our money trying to interfere with the work of UK hairdressers, who do not need protection, they are doing nothing for our ancient forests, which need protection from airborne diseases and diseases imported from Europe. Why has the EU not taken action, and will he do all he can to ensure that it does so?

We have brought together scientific experts from all over Europe to deal with this problem. I am not sure that the people dealing with hairdresser regulation are best deployed dealing with tree health. We need to use all available methods to restrict the spread of tree diseases, because there is a very high incidence of several of them, particularly in northern Europe. We should do everything we can do to avoid their coming into this country.

In evidence to the independent panel on forestry, the Friends of Chopwell Wood, which is based in my constituency, said:

“There is a concern that having ‘saved’ our wood from sell-off we may lose it by neglect and disease”

and that that would be caused by “insufficient staff and funding”. Will the Minister give an assurance that that will not happen?

As the hon. Gentleman knows, the Government have not yet formally responded to the independent panel on forestry, but we have indicated that we accept the thrust of its recommendations. I look forward to giving a full response early in the new year on that subject. The future for forestry is very bright, despite setbacks of the sort that I have described today. I repeat that we have not cut back on the allocation of resources. I hope we will be able to mobilise not just scientists, foresters and the voluntary groups for which he has spoken up, but everybody who has an interest in trees in this country, to ensure we have a thriving forest—not only today, but in future.

Given that there will be a desire for public vigilance, what will the Government do to ensure that public concern and support for taking action on this issue are properly and effectively harnessed?

I am keen that all of us with an interest in tree health take responsibility for this. We cannot all be experts on fungal diseases of the ash—I do not expect that—but people should report clear symptoms of ill health in trees to the authorities. The Government play their part by ensuring that research programmes into aspects of tree health are augmented, and we will thus ensure that we have healthy forests in the future.

As a representative of one of the areas affected by the disease, may I—in contrast to the hon. Member for Wakefield (Mary Creagh), whose principal preoccupation seemed to be to play the blame game—thank the Department and its officials for their rapid action to get on top of this potentially devastating disease, particularly by inspecting more than 1,000 sites over the summer, destroying more than 100,000 trees and introducing an immediate ban? Given that the science of the disease is little understood, will he reassure the House by updating us on what steps are being taken to work with the forestry industry and researchers to understand its epidemiology?

That is absolutely right. We have actually allocated £8 million from existing resources for new research into tree health over the next four years, which I hope will go some way to supplementing what is already in place. There are question marks in the international scientific community over such things as the pathology of the organism and its means of transmission, which we need to explore more fully. The fact that those countries with a high level of infestation—Denmark, Germany, Poland and others in northern Europe—still do not have the answers to some of those questions indicates the complexity of the issue. It is not the case that Britain has not been playing its part; scientific research sometimes takes time.

Will the Minister assure the House that his officials are working with importers and nurseries to ensure that no affected stock remains that may be planted in the future, so that forests such as Sherwood stay not only clean and green, but great places to visit?

We will continue the programme of inspection that has identified those saplings that may be a risk and destroyed them. The ban has been in place on a voluntary basis—it is now on a statutory basis—to ensure that nothing came into the country over this summer and therefore was not available for the next planting season. We can be reasonably assured that infected trees will not be planted this winter—at least those from commercial sources—but we need to maintain vigilance, which we certainly will do. We will also work closely with the industry, which understands how dangerous the disease is and wants to co-operate. I am grateful for the help it has given to the Department in identifying and dealing with the threat at an early stage.

We have already seen one dangerous tree disease spreading into other species—phytophthora. Is there any evidence of Chalara spreading into other species, either on the continent or here?

I do not believe that there is evidence of Chalara crossing species at the moment, but I will check that and give the hon. Lady an accurate response. She is right about phytophthora, which is well evidenced. In the case of Chalara fraxinea, we are dealing with a specific issue for the ash tree but, as she will be aware, fungal diseases are sometimes more easily spread between species than some other pathogens. I will examine all the evidence and write to her if there is any suggestion of cross-species spread.

We have heard a range of passionate and fairly well-informed contributions to this debate on a very difficult subject. I was pleased to hear from the Chair of the Select Committee, the hon. Member for Thirsk and Malton (Miss McIntosh), and I look forward to the Committee’s report.

Today’s debate certainly forced all of us to view the issue at a much deeper level. My hon. Friends the Members for Bristol East (Kerry McCarthy) and for Penistone and Stocksbridge (Angela Smith) spoke of the weaknesses in on-farm biosecurity. We heard passionate speeches from the hon. Members for Shrewsbury and Atcham (Daniel Kawczynski), for Tiverton and Honiton (Neil Parish) and for Central Devon (Mel Stride), the hon. and learned Member for Torridge and West Devon (Mr Cox) and the hon. Members for North Cornwall (Dan Rogerson), for North Herefordshire (Bill Wiggin), for Totnes (Dr Wollaston), for Montgomeryshire (Glyn Davies), for Sherwood (Mr Spencer), for Brecon and Radnorshire (Roger Williams), for Stroud (Neil Carmichael), for North East Somerset (Jacob Rees-Mogg) and for Congleton (Fiona Bruce). They all spoke about the devastating impact of the disease on farmers.

We heard alternative views from my hon. Friends the Members for Inverclyde (Mr McKenzie) and for Scunthorpe (Nic Dakin), who spoke of the risk that bovine TB would spread in the short term as a result of a badger cull. The hon. Member for Torbay (Mr Sanders) criticised the design of the Government’s cull. The hon. Member for Chatham and Aylesford (Tracey Crouch) made a thoughtful speech from an international perspective, drawing attention to the costs of the cull. The hon. Members for Crawley (Henry Smith) and for Southend West (Mr Amess) suggested other options, as did the hon. Member for St Ives (Andrew George) and my hon. Friend the Member for Ellesmere Port and Neston (Andrew Miller), who gently punctured some of the Secretary of State’s claims to expertise in this matter.

We were privileged to hear from former Agriculture Ministers, including the right hon. Member for South East Cambridgeshire (Sir James Paice). My right hon. Friend the Member for Leeds Central (Hilary Benn), who is in his place, also struggled with these issues when he was in government, and my hon. Friends the Members for Poplar and Limehouse (Jim Fitzpatrick) and for Brent North (Barry Gardiner) described what happened under the Labour Government. It is important to put on the record that so far only a Labour Government have actually carried out a badger cull and tested the science in the field. I strongly predict that we will remain the only Government to carry out a badger cull in the field. I will explain why I make that prediction shortly.

My hon. Friend the Member for Newport West (Paul Flynn) coined a new word: the ineptocracy, which will be on the record in Hansard. The hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) described the heartache of farmers, and the hon. Member for Hove (Mike Weatherley) and my hon. Friend the Member for Copeland (Mr Reed) talked about the effect of perturbation.

I congratulate the hon. Member for Brighton, Pavilion (Caroline Lucas) and the Backbench Business Committee on securing the debate and on making sure such a wide range of perspectives was expressed. The existence of this motion and debate—and vote—have certainly contributed to the Government’s decision to drop the badger cull. The Opposition have warned the Government for two years that the cull would be bad for farmers, taxpayers and wildlife. It would be bad for farmers who have to deal with this terrible disease. I also know the toll the disease takes on farmers and their families, both personally and financially, but the Government’s own cost-benefit assessment said the cull would cost farmers more than it would save them.

We saw in the last six weeks that farmers were moving away from the free shooting of badgers and moving towards the cage trapping of badgers, yet the Government’s statistics show free shooting is 10 times cheaper than cage trapping. Will the Minister tell us the true costs of this to the farmers? I would also like to hear from the Minister about the size of bond that the two farm companies had lodged with Natural England. So far we have heard no mention from Ministers about how much farmers are required to pay up front to cover the full four-year costs of this cull. If there is a move to cage trapping and shooting, what training has been given to those responsible for carrying that out, because that is a different skill from free shooting? We know that the people involved in free shooting had to go on a badger anatomy course so as to get a clean kill when shooting badgers. Pistols are used for cage trapping and shooting, so that is a totally different technique. Will the Minister tell us whether that training has been given, because it certainly seems from the evidence on the ground that that was what was planned?

There has been a lot of talk in this debate about the science, and we heard a good exposition from the hon. Member for St Ives. It is important that we go back to John Krebs. I do not advocate that we go back to 1997 as the Secretary of State does. I am disappointed that he is not in his place, and I am disappointed about his earlier remark in the House that he “couldn’t take any more.” He has only been in the job six weeks. I have been studying the issue of the badger cull for 18 months—as have other hon. Members, along with farmers out there in the community who are living with this problem—and I think the Secretary of State will have to show a little more backbone.

Professor Lord John Krebs instigated the randomised badger culling trial, and took part in the review of the evidence with Sir Bob Watson last year. Lord Krebs stressed the fact that culling badgers makes TB worse at the beginning by spreading the disease. He stated clearly in the Lords on Tuesday that the badger cull would reduce the incidence of TB in cattle by 16% after nine years, leaving 84% of the problem still there. He said that

“this is not a reduction in absolute terms but actually a 16% reduction from the trend increase.”

In other words, as the background trend is going up, BTB still increases but not by as much as it would have done had the cull not been conducted. This cull is not the silver bullet the Secretary of State makes it out to be. The eminent zoologist Lord John Krebs continues:

“The number is not the 30% that the NFU quoted; that is misleading—a dishonest filleting of the data.”—[Official Report, House of Lords, 23 October 2012; Vol. 740, c. 148.]

Disappointingly, it appears, judging by his response to the debate in this morning’s DEFRA questions, that the Secretary of State has not read the Hansard record of that Lords debate, where the scientists were sitting there. He persisted in misusing a snapshot figure—the 28%—instead of using the one figure that the scientists are agreed on, which is the 16% figure. The Minister is looking puzzled. I hope that he is still not confused, because he is going to get a lambasting from the scientists. The Government are cherry-picking the data. Perturbation increases bovine TB, in the perimeter areas, by 29%, but I have chosen not to use that figure in any of the rhetoric or debate on this matter because it represents a snapshot; those perturbation increases happen in the early stages and are not borne out by the reduction that occurs afterwards.

The Secretary of State is not in his place, but he referred to Christl Donnelly as a “he” during his statement on Tuesday—Christl is a she.

Well, that is a relief. I do not know why the Minister has not told the Secretary of State that, because he is reported in Hansard as saying that she is a he. [Interruption.] He appears not to have read his own Hansard record or corrected it. He obviously has not spoken to the scientists, who faced down the animal rights activists during Labour’s badger cull in order to carry out the Labour Government’s research into culling badgers. We are not talking about some animal rights activists; these are scientists in the field wanting to get the right outcome for farmers and for the nation.

In my previous ministerial role, I instituted the e-petition concept and also introduced the Backbench Business Committee. This is a perfect example of why that was a very good idea, because Back Benchers were given the opportunity to debate matters of real importance that ought to be discussed. I was the first person to say that this matter should be debated in the House. Of course, the Government have only legislative time, so this is the right mechanism to use.

There are some issues on which most of the House will agree. Bovine TB is the most pressing animal health problem in the UK and the importance of the epidemic for our cattle farmers and their families and communities cannot be overemphasised. I hope that we can also agree about the geographical spread, although I was slightly worried by what the hon. Member for Brighton, Pavilion (Caroline Lucas) said at one point. This was once a disease isolated to small pockets of the country, but it has now spread extensively through the west of England and Wales, and the number of new cases is doubling every nine years. So I do think that it is spreading like wildfire, and one has only to look at the map to see that that is the case. Someone mentioned rather hyperbolically the prospect of a massacre. Well, there is a massacre going on: it is the slaughter of 26,000 cattle last year at the cost of nearly £100 million, and we cannot afford to shy away from tackling the rampant spread of bovine TB throughout our cattle herds. If we do not take the action needed now, this disease could cost us £1 billion over the next 10 years. That is the answer to the hon. Member for Poplar and Limehouse (Jim Fitzpatrick). I will accept that he, within the parameters that his Government set, took action to try to deal with it, but the fact is that it has not worked. The problem has carried on getting worse and worse, and that is why we are determined to do better.

I hope that we will also agree that bovine TB is transmitted from cattle to cattle, badger to badger, badger to cattle and cattle to badger. The task of managing bovine TB and bringing it under control is difficult and complex. I resent a little bit the caricature that we are blundering into an approach not based on evidence; that we are blind to obvious alternatives and guaranteed to make things worse; and that we have failed to understand the science. Ministers do not make decisions in this way, certainly this Minister and the previous Minister did not.

Plenty of people have told us that the cull will not work and what we should not be doing, but none of them—not the critics, the scientists or the politicians—has come up with a single workable alternative to the cull that would give us the positive impact that we need right now. Nobody wants to kill badgers, but no one can deny that they are a significant reservoir of the disease, which is contributing to the spread of TB. All the experts agree that we cannot hope to tackle the disease without addressing the problem in wildlife. That is why we are determined to use all the tools at our disposal, and continue to develop new ones, as a package of measures to tackle the disease. Some people say that the cull not the silver bullet. No, it is not the silver bullet, but it is not the only thing that we will do. This will not cure the problem, but it will contribute to curing the problem. People say that it will only be a 16% net reduction. Well, if I were to say that we were reducing cancer incidence in this country by 16%, people would say that it was a very good policy indeed. Let us be clear about that.

Cattle controls have been in place for many years and are vital. In high-risk areas, herds are tested annually, any cattle that test positive are slaughtered and infected herds are placed under movement restrictions. Restrictions on cattle movements have been further strengthened to reduce the chance of disease spreading from cattle to cattle. Only last week, we announced plans for a new surveillance testing machine and stricter cattle movement controls. We also continue to look at ways of improving the testing of cattle for TB, and—a point raised by my hon. Friend the Member for Totnes (Dr Wollaston)—PCR testing to identify infection in wildlife is also important. However, despite the robust use of cattle measures over many years, TB has continued to spread. We need to accept that we are at the point where cattle measures alone are not enough to prevent the spread of disease in the worst affected areas. That is why the Government support a policy of badger control as part—I stress, as part—of a package of measures to tackle bovine TB.

We will of course listen to what Back Benchers have to say. As a member of the Government, I will not have a vote today because we do not believe that the Government should be taking over the views of Back-Bench Members. We will listen to Members of the House; that is the purpose of this debate.

The eradication of the badger was mentioned. That is utterly ridiculous. No one is talking about that. I think the hon. Member for Sheffield, Heeley (Meg Munn) referred to the Bern convention. We have now had a categorical response that we are not in breach of the convention. Just like every other legal challenge, we have won categorically.

Let us go back to the science and consider what we can do. There has been much discussion about how evidence underpins the policy. Research in this country over the past 15 years has demonstrated conclusively that cattle and badgers transmit the disease to one another. That is what Professor Krebs found in the randomised badger control trials. It has also been demonstrated—there is no getting away from this—that culling badgers can lead to a reduction of the disease in cattle if it is carried out over a large enough area and for a sufficient length of time. That is why we designed the pilots in the way we did, with hard boundaries. The hon. Member for Brighton, Pavilion said that the hard boundaries are not rigorous enough. I do not know what she thinks would be more rigorous than the Bristol channel.

The Minister referred to Professor Krebs. What does he have to say about the fact that Professor Krebs described the work the Government are doing as a crazy scheme? Surely he also ought to listen to him on that and stop this crazy scheme.

I listen to a range of scientific opinion and take the evidence that was revealed by Krebs and Bourne in their trials. It shows that a cull would reduce the incidence of the disease by 16%, which the Government believe is a worthwhile objective. Through a range of measures that we can take, we can finally start to bear down on the disease, and not a single country has ever successfully borne down on the disease without dealing with the reservoir in wildlife. The decision to cull badgers has certainly not been easy and has not been made lightly, but we have to take action and get on top of this devastating disease.

The vaccines that we all hope will be part of the solution are still years away, despite what some people would have us believe. It is not as simple as jumping on a plane, going to talk to an official in the European Union and getting the vaccines ready for use. More research is needed. We are demonstrating our commitment to vaccines by investing a further £15.5 million in vaccine development over the next four years. Let us remember that £43.7 million has been spent since 1994.

So that Members understand the process, I will explain what is needed to get a vaccine into use. Six tests have to be passed before we have a usable cattle vaccine. We first need in-principle agreement from the Veterinary Medicines Directorate to a market authorisation for the vaccine. That is what the hon. Member for Brighton, Pavilion said had appeared on the DEFRA website: the use of the BCG—hardly a new development—which has been partially successful in dealing with cattle, with a 60% to 70% success rate. That is the stage we have reached.

We have to get international validation of the test to differentiate infected from vaccinated animals—the so-called DIVA test. That is quite difficult to substantiate because we must demonstrate that the vaccine is efficacious, which we cannot do in this country because vaccinating cattle here is illegal. Only after that is done can we discuss with the European Commission a joint application to the European Food Safety Authority for an opinion on cattle vaccination. We then need to secure the agreement of member states to remove the vaccination ban. Only then can the Commission remove the ban and will the Veterinary Medicines Directorate be able to grant marketing authorisation, which enables the vaccine to be manufactured and deployed.

If anyone thinks that will be done in a week or so, they are sadly deluded. I would like to have a vaccine that had been shown to be efficacious and that we could use legally in this country, but we do not have such a vaccine—[Interruption.] The hon. Member for Glasgow South (Mr Harris) says that the cull will not start until June. The vaccine will take years, not months.

A reduction of between 60% and 70% sounds pretty good when compared with the 12% to 16% reduction that a cull would yield. The problems the Minister identifies are largely bureaucratic. Surely the Government could take a more robust approach with the European Union and just get on with it.

I wish it were that easy. I wish we could ignore all the regulations and precautionary measures that are taken for the licensing of vaccines and just go to the EU and say, “Sort this out. Do it tomorrow,” and then come back and start using the vaccine. However, it is not that easy. We cannot put at risk several billion pounds-worth of produce from this country by implementing something that is illegal. Last week we saw a lot of nonsense in the newspapers about people going over to the European Commission to sort it all out because we stupid Ministers could not quite bring ourselves to do it. We have had an announcement from the Commission; it was mentioned earlier. It said that the Commission was disappointed to see an article by Brian May in The Mail on Sunday on 21 October, that some of the quotes were out of context or inaccurate and therefore misleading, and that vaccination of cattle against TB is forbidden under current EU rules agreed by all member states. That is very clear.

I will happily arrange for those who are genuinely interested in this issue and who want us to develop a vaccine, as we do, to speak to Glyn Hewinson at the Animal Health and Veterinary Laboratories Agency—our chief scientist who is working on this—and he will tell them directly, as he told me only two weeks ago, the exact state of play with vaccines. I want a vaccine to be in position at the earliest opportunity, but I have to face facts, and wishful thinking is not going to get rid of bovine tuberculosis in this country. We must have programmes and measures that work, and we must use all the tools in the box.

I am glad that my hon. Friend has set out the Government’s intention to persist, with determination, with vaccines but also to look at the testing regime, which is crucial in allowing the whole process to work in future. In the meantime, I am pleased that he is also continuing to pursue pilots to ensure that the science is further improved so that we are completely ready and have all the arguments at our fingertips.

Let me be absolutely clear: we will use every tool in the box to bear down on bovine TB. That is why we are not going to reject something that has been shown by experimental evidence to be efficacious as part of the answer, as some would have us do. That is why we will continue to put a lot more money into research and push ever further on the research into vaccines. That is why we will continue to do everything we can on controls for the movement of cattle and on biosecurity. If the question is, “Will you not do the cull and will you lock up every cow in the country in a shed to prevent them from having contact with badgers?”, the answer is no.

The Government are determined to tackle bovine tuberculosis by all the means available to us. Having looked at all the evidence over many years, I am utterly convinced that badger control is the right thing to do. Indeed, the higher than expected badger numbers only serve to underline the need for urgent action. I remain fully committed to working with the farming industry to ensure that the pilot culls can be delivered effectively, safely and humanely next summer.

My Department actively monitors retail food prices and their impacts on household expenditure. We know that some households are seeing the amount that they spend on food increase. The Government provide safety nets through welfare to support those on low incomes and out of work. We also provide a number of schemes, such as Healthy Start, to help the most vulnerable in our society afford and have access to nutritious food.

The Minister will be aware that the Department’s own book of statistics states that there has been a 12% increase in food prices, and that people are going without fruit and vegetables. The Netmums website states that one in five women are going without food to feed their children. What discussions has he had with his colleagues in the Treasury and the Department for Work and Pensions to ensure that families can feed themselves?

I do not in any way minimise the hon. Lady’s point, but I talk not about food poverty but about poverty. The fact that food prices have gone up means that people are finding it more difficult to make ends meet. We need to continue to talk to colleagues in the DWP and others to ensure that we provide as much support as possible. We also need to do what we can with manufacturers, processors and retailers to ensure, for instance, that vegetables that are perhaps not the best quality are available at a lower price that people can afford. If we do all those things, we can help people through what is undoubtedly a difficult period.

I am pleased to hear the Minister talk about waste within the supply chain. I was much involved in a project called Ugly Food. Can we ensure that we do not just target retailers, who say that they have no waste within their system, but increase waste in the supply chain at the producer and consumer end?

The hon. Lady touches on an important point. Ugly veg is still tasty veg, and there is absolutely no reason it should not be sold. We need to bear down on waste at all points in the food chain. The Love Food Hate Waste campaign is dealing with exactly that and looking at whether we can improve products and practices right the way through the system, to ensure that we minimise waste and get the best possible value for the consumer.

Ebbw Vale food bank fed more than 1,000 Blaenau Gwent families last year, and each month my office issues more and more food vouchers. I am alarmed that low-income families are struggling to put food on the table. What representations has the Minister made to the Chancellor and the Work and Pensions Secretary about growing food poverty and the impact of universal credit?

The hon. Gentleman should recognise that, as I said earlier, what we are talking about is poverty. One thing that I have always stressed is that poverty exists right across the country, in rural areas as well as urban ones, and we need to deal with it. Does the Minister accept that the Government’s plans for minimum alcohol pricing will make alcohol more expensive for hard-working, moderate, responsible drinkers while doing nothing to tackle problem drinking and the problems associated with it? It will also be devastating for the west country cider industry. Will he make representations to his ministerial colleagues to scrap that ill thought out scheme, which is not based on any evidence whatever?

We know that the spending power of hard-working families is being hit by the Government’s flatlining economy and wage stagnation. Shoppers are using self-imposed rationing, putting products back at the checkout and skipping meals to feed their children, yet the Secretary of State has urged shoppers to tackle his so-called “dessert deficit” by eating more UK-produced ice cream. Does he ever feel that he is living in a parallel universe?

Last week, the Secretary of State announced the abolition of the Agricultural Wages Board, and the Minister has spoken about the existence of poverty, in particular rural poverty. More than 1,000 workers in the Secretary of State’s constituency will be worse off as a result of his decision, and his own impact assessment states that abolishing the board will take £238 million of pay over 10 years from rural workers and the rural economy—

The Dairy Supply Chain Forum and the Dairy 2020 initiative are focused on the future of the industry and opportunities to boost growth and exports. After months of hard work, not least by my predecessor, my right hon. Friend the Member for South East Cambridgeshire (Sir James Paice), the many beneficial terms of the industry code of practice can be translated into contracts. Implementing the EU dairy package will provide new opportunities for innovation and collaboration, and £5 million of additional funds from the rural development programme for England are available for high-quality projects from the dairy industry.

I am optimistic that with the voluntary code we have for the first time the basis to be fair to producers, processors, retailers and consumers. I want to make that stick, and I believe that it can make a real difference. As I have said all along, if the voluntary code is not successful, we have the opportunity to bring forward a statutory code, and I will consult on that later this year if necessary.

That is a matter for the devolved Administrations who have responsibility for agriculture and for what they feel is appropriate for their own jurisdictions. The Government will offer any support and help they can, and provide advice to further the objective of a voluntary code, is that is what is wanted. The Department maintains contact and has conversations with counterparts in the devolved Administrations, and will continue to do so.

I welcome and support farmers markets. I and other DEFRA Ministers have been visiting local communities across the country and encouraging people to eat and drink local produce. I have recently visited a farm near my hon. Friend’s constituency, where I saw farmers produce wonderful food. In buying and eating local food, consumers will support rural jobs and help rural economies to grow. Farmers markets are an excellent way of bringing local producers and consumers together.

Farmers markets are very important to both rural and urban communities, and provide an opportunity for local people to purchase excellent local produce directly from source. The markets also provide a valuable opportunity for independent retailers to access new customers and help them to compete with their larger rivals. Will the Minister consider working with local authorities to champion the importance of farmers markets and promote awareness to people throughout the country of markets in their area?

I welcome what my hon. Friend says. The first successful farmers market was established in Bath in 1997, not a million miles from my constituency. There are some 750 regularly occurring farmers markets in the UK. The National Farmers Retail and Markets Association—FARMA—brings them under a membership organisation. I encourage local authorities to establish farmers markets wherever there is local demand. They make a valuable contribution to local choice, and to the vitality of our town centres.

In a recent written answer, the Minister estimated that the benefits of mandatory carbon reporting stood at £741 million over 10 years compared with just £28 million in compliance costs. My Department does not have responsibility for the Financial Reporting Council—the hon. Lady will understand that—but it has proved very effective at ensuring that legislation that applies to carbon reporting is upheld. We recently held a consultation on the draft regulation, which closed on 17 October, and we received about 100 responses. We will look very carefully at them.

I think I know rather more about workers in my constituency than the hon. Gentleman. I am aware of the circumstances in the agricultural industry, and I am also aware that there are now many protections for low-paid workers. I would not be proceeding with the consultation unless I was convinced that this was in the interests of those who work in my constituency and throughout the country.

As my hon. Friend knows, the circumstances in Ramsgate—about which we have spoken—were entirely unacceptable. I want to make that absolutely clear. I immediately asked for a report to be drawn up by officials who were working on animal health regulation, which they will submit to me shortly. I shall be happy to share their findings with my hon. Friend.

We have no power to ban live exports, but I do have powers to ensure that the regulations that are in place are enforced strictly and rigorously, and I shall do so.

When I introduced my Food Waste Bill earlier this year, I thought that I was making good progress in convincing the then Minister in the House of Lords of the need for legislation to protect good-faith donors of food to charities from criminal and civil liability, but I now have the impression that DEFRA is trying to hide behind EU food safety standards. What are Ministers doing to move things forward?

I congratulate the hon. Member for Strangford (Jim Shannon) not only on securing this debate on an important subject but on the admirably balanced way in which he presented information to the House. I am glad that he finished by stressing the importance of country sports, particularly shooting, to the economy and the conservation of our landscape. He said that he was a regular shooter, and he is not alone. He is one of 480,000 people who regularly shoot live quarry. I am just glad that I do not appear to be his quarry today: I think his targets are elsewhere.

The hon. Gentleman is absolutely right to stress that this is a complex issue—it is not a question of black and white. He is concerned to make sure that health and safety and wildlife issues are paramount, just as he is keen to make sure that the opportunities for sport and relaxation persist both in his part of the country and across the country. There are lots of interrelated interests that we have to balance.

I shall try to deal with some of the points made by the hon. Gentleman. He mentioned in particular the recent report by the Food Standards Agency. I am grateful to the hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) for his intervention, which highlighted the point that the hon. Gentleman was making. Let us be clear: lead is not a terribly good food additive. It is a dangerous substance; it is toxic. We do not want people to eat it. I remember something from my own history. As you will know, Mr Deputy Speaker, Somerset is known for drinking cider, and a study undertaken many decades ago discovered that the practice of making cider, which is acidic, in vats lined with lead, was probably not the best way to secure the public health of the county of Somerset. Eventually, we stopped using lead lining for the vats—historically, lead had been used for that purpose—and our public health improved as a consequence.

It is important that the Food Standards Agency does its work and highlights any concerns that it may have. People who are very high consumers of game birds, if such people exist, should be aware that they may be exposed to a risk. However, we should stress that people would have to eat an awful lot of pheasant or duck on a daily basis to get near the dangerous level. It is important that we stress that it is not dangerous to consume lead shot game occasionally, which is what most people would do, despite the hon. Gentleman’s exhortations to eat wildfowl more frequently, especially wildfowl that he personally has shot. For most of us, wildfowl is a limited part of our diet.

Reducing lead exposure remains a high priority for the Government. We, like successive Governments, want to reduce exposure to lead wherever possible, for both humans and wildlife. That is why I am keen, as is the hon. Gentleman, to wait for John Swift and his team in the Lead Ammunition Group to report in spring 2013. They have been looking at the key risks to wildlife from lead ammunition and the levels of those risks, and they intend to explore possible solutions if those risks prove to be significant. They will also report on the options for managing the risk to human health from the increased exposure to lead as a result of using lead ammunition, if measures need to be taken. I am confident that the group will take a balanced and measured view on the basis of evidence. That is why I am looking forward to that report. I think the hon. Gentleman shares that view and is concerned that there may have been early misrepresentations of what is likely to emerge.

The hon. Gentleman titled his debate “The EU directive on lead shot”. May I reassure him that the Government are not aware of any proposals for an EU directive on lead shot? Should one be forthcoming, of course we will look carefully at any proposal to ban lead shot. We will carefully assess whether there is clear evidence of a genuine risk and, if there is, whether any proposal to control the risk is appropriate and proportionate. Again, I will look to the Lead Ammunition Group’s report to inform our position. I repeat that there is no immediate prospect of an EU directive on lead shot. There are various activities within the European Union that are relevant to lead, but not in the form that the hon. Gentleman is concerned about. There may be some misunderstanding about that.

The concerns that we have are about the EU’s attitude to lead in general. As parliamentarians concerned about the impact of Europe, we are worried that the EU may try to introduce regulations on that. We are greatly encouraged to hear the Minister say that that will not happen.

I believe that to be the case. There is a European regulation for the registration, evaluation, authorisation and restriction of chemicals. We know that Sweden has indicated its intention to bring forward by April next year a proposal to restrict the use of lead and lead compounds in consumer products, but that does not include lead shot within its scope. There may be an informal view that Sweden would wish to extend that, but that is not on the table at present. I hope I can reassure the hon. Gentleman, but obviously we will watch carefully and if proposals come forward, we will look at them on their merits in due course.

Let us deal with the real concerns that lead shot may harm our wildlife. We are clear that ingesting lead is probably not good for birds, animals or humans. It is important that we ensure that the right steps are taken to conserve our wild birds, particularly our water bird species. It is not yet entirely clear what risks the use of lead shot might pose for the conservation of our wild birds, but the existing restrictions on its use need to be respected, as the hon. Gentleman pointed out.

The research that the Department for Environment, Food and Rural Affairs commissioned from the Wildfowl and Wetlands Trust in 2010, to which the hon. Gentleman drew attention, highlighted some concerns about compliance with the Environmental Protection (Restriction on Use of Lead Shot) (England) Regulations 1999. I entirely accept his point about the provenance of any lead appearing in the ducks, but the fact is that 70% of the ducks examined were found to have been shot with lead, which is a cause for concern. Even advocates of hunting game recognise that any clear evidence of non-compliance is a matter for concern. We will be looking at that carefully, but we will also take into account the points he has make, because it seems to me that some of them are balanced and valid.

I stress again what I think the hon. Gentleman was at pains to say throughout his contribution: what we need is balance. We must weigh up the arguments and the evidence, and not in isolation. We must look at matters in the round. I think that at the heart of the debate there is more that unites the various interests than divides them. We all want to see healthy wildlife, a well-managed countryside, thriving communities and a sustainable rural economy. Therefore, we need to ensure that the evidence is looked at carefully by the experts in the lead ammunition group and that we understand the risks so that we can respond in a measured and sensible way. That is why the Government will not rush to any premature conclusions. We will look at the evidence and will not move to any snap judgements. We will evaluate the results of John Swift’s report and consider the evidence it adduces and its recommendations in due course.

I can give an absolute assurance that we understand the importance of shooting, both in the rural economy and as a form of relaxation that the hon. Gentleman and many other people in the country enjoy—it is not simply an economic matter—so we will balance that with the need to protect our wildlife and ensure that its health is preserved, as is the health of the wider population. We will consider the evidence and base our judgments on what strikes us as the best balance between wildlife conservation, supporting traditional jobs and industries, enhancing sustainable economic group and, of course, doing what is best for our health.

I am grateful to the hon. Gentleman for securing the debate and for the points he raised. We will certainly take careful note of the points he raised on behalf of his constituents and of a much wider constituency across the country. This has been a most valuable debate and I am grateful to have had the opportunity to set out the Government’s case.

It is a pleasure to serve under your chairmanship, Mr Streeter.

I congratulate my hon. Friend the Member for Richmond Park (Zac Goldsmith) on securing this important debate and on how he introduced it. I found it useful that other hon. Members who wished to take part were able to intervene on him, so that there was a genuine debate rather than simply a dialogue between the two of us.

I have had form on this issue going back a long time—to before I was a Minister, when I worked for environmental non-governmental organisations. I hope that my hon. Friend will appreciate that I am aware of the problem and eager to do something about it—and that goes for the Government, too.

The Government are committed to promoting a strong and growing economy in which all resources are fully valued and waste is minimised. That is good for business and good for the environment. To achieve it, everyone has a role to play. That is true across the whole waste agenda, but nowhere more so, I suspect, than in relation to single-use carrier bags. We all have the opportunity to change our behaviour to ensure that fewer bags end up in landfill or as litter.

Does the Minister acknowledge that plastic carrier bags are part of an important industry? The packaging industry employs 85,000 people in the UK, is responsible for a turnover of £11 billion and represents 3% of the manufacturing industry.

I want to add to the point made by my hon. Friend the Member for Rugby (Mark Pawsey). Of the bags used in this country, 90% are manufactured in Asia, not the UK.

This is a very instructive debate. Members have come armed with a huge number of statistics that they are happy to trade across the Floor, which is all to the benefit of the debate.

We all have the opportunity to change our behaviour to ensure that fewer bags end up in landfill or as litter. Notwithstanding the point made by my hon. Friend the Member for Rugby (Mark Pawsey), reducing the number of bags that we use would be a step towards more responsible living that also encourages people to think about the resources that we use. Aside from the potential ecological problems such bags cause when disposed of irresponsibly, it is incredibly wasteful to produce billions of them each year to be discarded after a single use. We continue to encourage the reuse of bags wherever possible.

All bags have an environmental impact, irrespective of their composition. Reusing them as many times as possible and disposing of them appropriately when they cannot be used any more minimises that impact.

I thank the Minister for allowing me to intervene. I was being a little impatient, because he said that he encourages people to reduce waste and not use plastic bags. Could he concretely say how that encouragement finds its way down to ordinary people? It is true that they have the opportunity to reduce waste, but they are not doing it enough.

They are not, and I will return to that in a moment.

There are those who are clear about their obligations and will use reusable bags whenever they have the opportunity. There are some who it will always be difficult to reach, because they simply do not want to hear the message. Then there are what I call the “guilty middle”; they will use reusable bags, and want to do so, whenever they can, but they sometimes turn up—as, I confess, I occasionally do—at a supermarket and find that they have forgotten the bag that they intended to take and have to take a plastic bag. The sort of measure that my hon. Friend the Member for Richmond Park proposes might affect that large, guilty group in the middle, who want to do the right thing and feel guilty when they do not.

We have had lots of figures already, so I will add a few more. In 2011, around 8 billion thin-gauge plastic carrier bags—single-use carrier bags—were issued in the UK. If you include reusable bags, such as bags-for-life, the total figure is about 8.4 billion bags issued in the UK. Obviously, that is a very large number.

We have made some progress in recent years. The first voluntary agreement with retailers between 2006 and 2008, which has been mentioned, reduced the overall environmental impact of carrier bags by about 40%. Signatories to the agreement encouraged the reuse of carrier bags, increased their recycled content and reduced their weight, among other measures. A second agreement with supermarkets between 2006 and 2009 focused on reducing the number of bags distributed, and achieved a total reduction of 48% against the 2006 baseline. That is progress. We should not forget that.

Supermarkets and shoppers pulled together to reduce the number of carrier bags they were using. Despite some evidence of a reversal in the trend, the latest figures, for 2011, show an overall decline in bag usage of 32% compared with 2006. I hear what my hon. Friend the Member for Rugby said about the contribution that carrier bags make to landfill. He is right that they are not a large part of the total waste stream, but it is not possible to argue that plastic bags, particularly when they litter our towns and countryside, are not an unwanted eyesore. They represent 72,000 tonnes of waste entering the waste stream.

Aside from the impact that carrier bags have on wildlife, marine environments and our countryside and coast, no one travelling around our countryside wishes to see carrier bags in the trees or floating down the lanes. It is all avoidable if we, the public and retailers do the right thing by reducing the use of single-use bags. We all have a part to play.

Some retailers are taking positive action, with initiatives such as voluntary charging, rewarding shoppers for reusing bags by awarding loyalty points, offering front-of-store recycling and increasing the amount of recycled content in the bags. Although recycling is further down the waste hierarchy, after prevention and reuse, it is still important to improve recycling rates for carrier bags, because it also helps to reduce the overall environmental impact and makes use of a valuable resource. I am pleased to see that the number of shops offering front-of-store recycling facilities for bags has increased, but I would like more to do so. I hope that more retailers, particularly the big ones, will be prepared to take up that challenge.

A number of stores, including WH Smith, Marks and Spencer, Ikea and Lidl, have already introduced charges for carrier bags. Is there evidence from their initiatives to suggest that there are any perverse or unwanted outcomes from such a charge?

I am not aware of any, but a lot of work is being done to look at all the evidence because we want to get the policy right and to make a really effective contribution. I will come back to the Government’s position in a moment, but may I just say that that is part of the evidence-gathering process in which we are engaged?

Let me go back to the point about how we behave. On average, shoppers take three to four new bags every time they go out shopping, and most of them have a large store of bags at home, often under the kitchen sink, which they could take with them and reuse. We need not only to reuse bags, but to reduce the number of new bags that we take and to use bags that have a longer life. All those things put together are the actions of a responsible citizen. None the less, I recognise that we are all fallible. I would hate to be accused of being a hypocrite on these matters, because I know that someone will spot me taking a bag in Sainsbury’s in Frome next week and say, “You said that we shouldn’t be doing that.” I will have to say, “Yes, and you are right; I shouldn’t be doing this and I wish that I had remembered to bring a bag from home.”

Let me address the specific points that have been raised. A question that was asked by my hon. Friend and echoed by the hon. Member for Brighton, Pavilion (Caroline Lucas) was about the Government’s reaction to the first year of bag charges in Wales. The results so far look positive. I hope that when we have looked at the full year’s results we will see that they are very positive indeed. We are certainly monitoring the results. When we are clear that we have robust data, we can then base any decisions on them.

Will the Minister in his evaluation take account of the additional bag purchases that will take place in Wales as a consequence of people not having that stock of unused carrier bags under the sink? In resource terms, the fact that people will be buying other products should be taken into account.

It should be. My hon. Friend is giving an example of exactly why we need to look at the results in the round rather than at a simple indicator. Let us do that and let us be convinced, if convinced we are, that what has happened in Wales is the right way to approach the issue. We will also consider the Scottish consultation on change, which closed on 28 September, and discuss the matter with our colleagues in Scotland. We will balance the benefits of any change with the real, but avoidable, effect on household budgets to ensure that we get the right option.

My hon. Friend the Member for Richmond Park asked me whether I had met the Welsh Environment Minister, and the answer is that I have not, but my hon. Friend will accept, I think, that I would not be expected to have such a meeting because that would be the job of my noble Friend, Lord de Mauley. In fact, it was Lord de Mauley’s predecessor in the Department, Lord Taylor, who met John Griffiths in July 2012 to discuss the matter.

My hon. Friend asked me whether I could confirm that the introduction of a charge would only require secondary legislation. If we did take such action, it would be from powers that stem from section 77 of the Climate Change Act 2008, which makes provision for charges for single-use carrier bags. Therefore, in England, we could introduce such a charge through secondary legislation, but it would be subject to a consultation process because that is the mechanism of government.

Will the Minister say when we can look forward to a decision coming from Government? He has explained that it is right to evaluate the experience in Wales. Could we therefore expect some kind of Government decision early next year?

I will not give a firm answer to that, because we want to look at the data, but I hope that we will be able to make an early evaluation of the data. Once we are clear that we have a full-year set of data and we are convinced that the effect is beneficial, we can make a firm decision, and I do expect that to be sooner rather than later. Obviously, that falls short of the sort of commitment on timing that the hon. Lady wants.

My hon. Friend the Member for Richmond Park asked about the small levers that can be used. He is right. This provision is one lever among many that we can take. If we find that it is efficacious to go forward on the basis of a proposal—it will be based on the evidence that the hon. Lady has asked for and that we are committed to securing—similar to what exists in Wales, we will use it as a lever to long-term change. There are other things that can be done as well. We would never want to rely on one mechanism and eliminate all others.

If, after studying the Welsh experiment, the effect is deemed to have produced a net good, both in terms of a reduction and the other considerations that have been mentioned today, is that the bar that we need to cross for our Government to pursue the same course of action? In other words, how much does this Government’s decision depend on the results in Wales?

It is one area of data on which we can base intelligent decisions. We do not only want to see whether there is a direct correlation between the activity there and the number of single-use bags that have been used. For example, has the initiative simply prevented people from using single-use bags and led them to buy a bag for life every time they go to a supermarket? If that was the consequence, that would be a worse outcome, despite the fact that the statistics on single-use bags would be beneficial. I am suggesting not that that will be the outcome, but that it is a slightly more complex picture, and we are genuine in wanting to examine the outcomes before we come to a policy decision. Such a decision will have an impact on the consumer, on retailers and, as my hon. Friend the Member for Rugby has said, on manufacturers, so we must get it right. We want to achieve a beneficial outcome for the use of scarce resources and for the environment. That is our intention as a Department and that is the basis on which we will finally reach a conclusion.

I thank my hon. Friend the Member for Richmond Park for securing this debate and every Member for their contributions. I hope that I have responded to the points that have been made in a reasonable way. I will pass on my hon. Friend’s comments to my colleague, Lord de Mauley, for his consideration. I am sure that my hon. Friend’s early-day motion will continue to attract signatures. We will take into account all the factors involved before reaching a final decision, which I hope we will be in a position to make once we have all the information at our disposal.

It is a pleasure to serve under your chairmanship, Mr Caton. I express my genuine gratitude to the hon. Member for Copeland (Mr Reed); as it turns out, it is useful and timely to be having this debate today.

From the start, I should say that I entirely understand hon. Members’ concerns. It would be odd if I did not, and that is not just because of what the hon. Member for Ogmore (Huw Irranca-Davies) described as my general loveliness. I have represented, grown up and lived in one of the most rural parts of the country for a long time. I know that this issue is not only totemic for a lot of people but important to get right for a lot of people who work in agriculture.

Before coming to the more detailed points of my speech, I want to say first that I have introduced the consultation today because I am convinced that the proposals are in the interests of people who work in the agricultural industry. We simply cannot look at agriculture today through the eyes of somebody in 1948, or indeed, of someone 20 years ago. Agriculture has changed massively, and for the better, in many respects. It is a highly skilled industry in which people have to adapt to new ways of working all the time. I genuinely believe that the present set-up, which is unique in this particular area of employment, is grounded in times when agriculture and social conditions were very different. Most important, employment law was very different too, which we have to keep reminding ourselves. As a House, we have made huge changes to employment law over recent years, which has transformed the landscape in which we approach such discussions.

I acknowledge the Minister’s good intentions in speaking for his constituents and the farming community, and I accept that employment law has changed. However, we are currently faced with new proposals for changing employment law, including watered-down versions of the Beecroft proposals on hiring and firing, under which people can buy shares in companies in exchange for giving away their employment rights. Does it not worry the Minister, as a Liberal Democrat, that the employment rights that have been put in place over the last 20 years are now being denuded at the same time that we look to abolish the Agricultural Wages Board?

The hon. Gentleman will not tempt me into commenting on other Departments’ areas of responsibility. I am dealing with what falls within my ministerial responsibilities, and as I have indicated to hon. Members, we gave a commitment to consult on the board’s future. The written ministerial statement that I have issued today, and made sure that Members had before them, informs the House of the launch of the public consultation on the abolition of the Agricultural Wages Board for England and Wales, as well as the related 15 regional agricultural wages committees and 16 regional agricultural dwelling house advisory committees in England. The hon. Member for Ogmore picked up on the fact that my written ministerial statement describes the agricultural wages committees as “now largely redundant”. It does so because they are now largely redundant. I hope that he will look carefully at exactly what they do.

The point that underlies all this is that, in the absence of the Agricultural Wages Board, agricultural workers will be protected by the national minimum wage and working time regulations. I accept entirely what hon. Members have said—that that is not the sum total of the Agricultural Wages Board regime. It is not simply a safety net underneath the least well-paid workers. I shall come on to the other aspects, but that is certainly an important part of why it was set up in the first place. It was set up at a time when people working in rural areas were the least well-paid of the least well-paid and had very few protections. It was right, at the time, to give that protection. The question is whether it is still right to have that arrangement in this unique sector of employment when in other areas it has been abolished.

The hon. Member for Copeland talked about Baroness Thatcher’s Government removing a raft of wages boards, and that is correct—they did remove them—but surely he is not suggesting that that was necessarily a bad thing. I am not trying to reduce this debate to the absurd, because I know that there are genuine and important issues, but did he think that the Aerated Waters Wages Council, the Coffin Furniture and Cerement-making Wages Council, the Flax and Hemp Wages Council or the Ostrich and Fancy Feather and the Artificial Flower Wages Council really had a place in the 1990s?

In that case, I shall not tempt the hon. Gentleman further down that road, but the reason why I raised those other, perhaps flippant cases—I do not think that anyone would seriously suggest that those councils were relevant now—is that other wages councils that were abolished at the time had an effect on industries that would certainly be described as current industries and that are not entirely dissimilar to agriculture. I am thinking of the Licensed Non-residential Establishment Wages Council, the Licensed Residential Establishment and Licensed Restaurant Wages Council and the Hairdressing Undertakings Wages Council. Those were dealing with business that was often carried out by small enterprises, where many of the arguments that the hon. Gentleman and his hon. Friends have advanced today would have applied and where I do not think that a disbenefit from the abolition has been apparent in terms of comparative performance with other areas of industry. It is important that we recognise that.

We are now engaging in a consultation that will allow stakeholders and interested parties the opportunity to make their views known on the future of the Agricultural Wages Board before we make a final decision. I want to make it clear—because I genuinely think that this is the case—that the aim of the proposal to abolish the Agricultural Wages Board is to secure the prosperity of the agricultural industry for the future by encouraging growth and employment. I think that it will do that. I think that it will benefit all those who work in the industry, both employers and workers, as well as the wider rural economy.

Will the Minister give a guarantee that this is not a fait accompli and that if the consultation comes back with the view that the Agricultural Wages Board should be saved, the Government will follow that, rather than just proceeding with the plans for abolition anyway?

The job of Ministers when responding to a consultation is to listen to all the voices that are raised, to try to understand the points that are put forward and then to make a decision on whether to introduce appropriate legislation. It is then for the House to decide whether it supports that legislation, so let us be clear about the process. It cannot have come as any great surprise that we were going to go ahead with the consultation. Indeed, the hon. Member for Ogmore chided me gently for not having brought it forward earlier. I say to him that I would have brought it forward slightly earlier if there had not been a recess, but we are now ready to consult and ready to listen.

An impact assessment of the abolition of the Agricultural Wages Board has been published as part of the consultation package. I hope that hon. Members will take the opportunity to consider it carefully and to comment on the document and provide their own evidence on the likely impact for both individuals and the industry as a whole. The impact assessment suggests that abolition of the Agricultural Wages Board could lead to increased employment, which would have potential ripple-effect benefits for the wider rural economy.

Let me deal with some of the specific issues that were raised. A lot of hon. Members were understandably concerned that the proposal might mean workers losing their existing rights. Of course, that is not the case. Anyone in permanent employment will be protected by their contract. They will have exactly the same rights after the day on which the legislation is passed as they had before. They do not lose any of their contractual rights and the employer loses none of their contractual obligations simply by the passage of the measure. Of course, it would apply to new entrants and new contracts being negotiated, but it would not apply to anyone who was already in employment. It is very important that people understand that. Let us also recognise that permanent workers constitute about two thirds of agricultural workers, so for the vast majority of workers, there will be no change in terms and conditions as a result of the board’s abolition.

For new contracts, yes, I accept that there may be an impact. That is reflected in the estimates in the impact assessment. However, it is difficult to assess what that impact will be until we see it in action. My feeling is that there is a high level of competition for skilled workers in some sectors of the agricultural industry, and it is important that people attract workers who have both the necessary certification and the necessary skills, given that they are operating, as one hon. Member said, incredibly expensive bits of machinery, let alone dealing with livestock, which requires husbandry skills. It is important that people attract and retain the best workers. Therefore, I am clear that we shall not see a drift towards the national minimum wage in contracts in the agricultural industry. In addition, new entrants to the industry will have exactly the same levels of employment protection as workers in all other sectors of the economy.

In fact, there are potentially some direct benefits from abolition of the rigid structures of the Agricultural Wages Board, let alone the bureaucracy, in terms of what is permitted under contract. One example involves annual salaries. It is extraordinary that at the moment it is difficult to provide an annual salary basis for a contract under the rather rigid systems in place. In today’s employment market and particularly because I am optimistic about agriculture—we have a growing sector and there is huge potential in agriculture—farmers need to offer attractive remuneration packages that are competitive with those in other rural sectors if they want to retain skilled and well-qualified staff. I would be very surprised if employers did not recognise that they had to pay appropriately for skills and experience. That is already reflected, of course, in the banding in the Agricultural Wages Board system. The majority are paid above agricultural minimum wage rates. In 2010, about half of workers were paid more than 10p above the agricultural minimum wage. I do not see any reason why that should change in the absence of the board.

Of course, there are other protections as well. The gangmasters licensing legislation is both relevant and important in this debate. The hon. Member for Copeland talked about the Agricultural Wages Board specifically providing protection for migrant and seasonal workers, but he will find that it is the Fixed-term Employees (Prevention of Less Favourable Treatment) Regulations 2002 that provide such protection—passed by a Government that he, of course, supported. I recall supporting those regulations too. They will continue to provide protection, and it is important to know that that is the case.

I am not sure I recognise that abolition of the Agricultural Wages Board will necessarily affect those workers. The hon. Gentleman is right to raise the issue and we will look at it closely in the consultation. Let us look at it in more depth and when we come forward with legislation, we will consider whether we need to look at it further.

We know that the agricultural work force are an ageing population, and that is not sustainable in the long run. I want to attract young people into farming, agriculture and horticulture. There are signs that more people are taking up courses at agricultural colleges, which is a good thing. We want to attract and retain new entrants—young workers—and to do that, farms must offer wages and conditions competitive with other sectors.

The hon. Member for Ogmore made an important point: most farmers and farming employers are good employers and want to do the best for their workers. Let us get away from the slightly Dickensian view that the only purpose of an employer is to grind down the workers. That is not the case and not the relationship that he and I see every day when we talk to people in farm businesses and those engaged in the sector.

What will happen to advice for farmers if the Agricultural Wages Board is abolished? The NFU has already indicated that it intends to provide economic indicators, which I hope will help.

I am not sure that I entirely accept the point about contractors, which I think was made by the hon. Member for Rutherglen and Hamilton West (Tom Greatrex). People subcontract their work in lots of other businesses and industries without experiencing the difficulties that the hon. Gentleman anticipates. It has been said that such arrangements will simply stop. I do not believe that is the case, because I do not believe that agriculture works that way. People will find an appropriate level for such employment, as they do in the building industry and other industries where plant and specialist skills are often needed by contractors on a wider front. We will find ways of accomplishing the same objective without the bureaucracy involved.

I stress that we will specifically instruct the Low Pay Commission to include the agricultural sector in its range of indicators. If we go ahead with abolition, it will watch closely to ensure that we do not see a detriment at the lowest end of workers’ pay and conditions.

The board is the last remaining wages council. Does it serve a useful purpose? The hon. Member for Strangford (Jim Shannon) says, with his knowledge of what happens in Northern Ireland, that it does not. I have looked carefully at the issue, and provided that we have other protections, which we do, across all sectors, it is difficult to argue that there should be a lone system for the agricultural sector providing separate minimum employment terms and conditions.

The regime is overly complicated at the moment. Its provisions are wide-ranging and restrictive, hampering the ability of the industry to offer modem, flexible employment packages. It effectively dissuades employers from offering annual salaries, which is disadvantageous for workers as it hinders long-term financial planning. It is a one-size-fits-all approach that imposes a rigid structure on a diverse and diverging industry.

If we lose the Agricultural Wages Board and the agricultural minimum wage regime, farmers will be able to agree terms and conditions with workers that fit particular circumstances and take account of the specific requirements of the farming sector. It would make it easier for farm businesses to employ workers, encourage longer-term employment, boost growth and create job opportunities. It would also simplify employment law.

An issue that has not been raised in the debate is the confusion for farm businesses around whether activities fall within the national minimum wage regime or the agricultural minimum wage regime. For example, livestock and poultry rearing would normally be considered agricultural activities and covered by the agricultural wages order, but that is not necessarily the case for slaughtering operations. In farm packing businesses, the agricultural wages order covers the packing of produce grown on the farm, but not the packing of bought-in produce. There are strange anomalies at the boundaries of what is and is not covered.

Before time runs out, I should like to say that I have not met a small farmer—certainly not in Wales—who has been confused by the current functioning of the AWB.

Will the Minister address a point of real significance? Under Section (9)(7) of the Public Bodies Act 2011 consent is required from the Welsh Assembly Government. Alun Davies, the Agricultural Minister, made a brief statement on social media this morning:

“Welsh Govt are determined to maintain the AWB structures in Wales. We have not consented to any abolition in Wales”.

I ask the Minister directly: will he commit now not to abolish the AWB and the functions of the AWB in Wales without the consent of Welsh Ministers?

I work closely with Welsh Ministers and I am always happy to do so. I share information with them; for instance, before the event, I shared the fact that we were bringing forward the written ministerial statement and the consultation process. I had the advantage of meeting Alun Davies only yesterday to discuss the matter, and I will continue to discuss with him and the Welsh Assembly Government what they have in mind. I will not go into the constitutional issues, because they are outside the scope of today’s debate.

It is clear that the matter is not a devolved one at the moment. The hon. Member for Ogmore looks askance—agriculture is devolved, but wage control is not. However, that does not stop us having a perfectly sensible dialogue with Welsh colleagues on the subject or stop them having a dialogue with the Wales Office on the constitutional issues. He says that we are obliged to use the 2011 Act, but we are not. There is a range of different legislative processes that we could use. He was firmly against the Act, so it would be strange if he now insisted that it is the only way that we can reform public bodies.

We are running out of time. I will continue dialogue with the Welsh Government to find a way forward. I am clear that it is perfectly proper for us to consult as we are doing on the abolition of the Agricultural Wages Board for England and Wales. We shall listen to the responses, including those from the Welsh, and will take appropriate action when it comes to legislation.

I again thank the hon. Member for Copeland for initiating the debate. We will return to the subject. I hope that hon. Members will take advantage of the opportunity to express their views in the consultation, as many outside the House will. It is a serious issue and I want to get it right for the prosperity of all who work in the agricultural industry, with a view to reducing unnecessary regulation, without reducing necessary protections.
