I just want to respond to this issue that has come up many times. I will not have enough time to respond to everything, but on this particular point on Yemen, President Hadi has invited support because of what is happening with the Houthis. Other countries have been invited to assist a country in need in the same way that President Abadi in Iraq has invited us to assist his country in dealing with a threat. That is why Saudi Arabia and the United Arab Emirates are involved in south Yemen.

They may have been invited in, but if countries such as Saudi, which are supplied with UK weapons, are acting indiscriminately in that country, we need to be concerned.

Clearly, there is a role for a strong UK arms industry. It creates jobs and helps technological development, but there is certainly no role for a UK arms industry that exports weapons made here to repress people in other countries.

Thank you, Sir David. It is a pleasure to be able to call you that, and I am delighted to work under your chairmanship today. I begin by joining others in paying tribute to the right hon. Member for Cynon Valley (Ann Clwyd). She has a formidable reputation in this House going back many years. She has been consistent not only on this issue, but on wider humanitarian concerns. It is no surprise that she is at the forefront of this debate today. I echo the tributes paid to Robin Cook and the work that he did on this area and to Sir John Stanley, who continues to be active in these areas. I met him only a few days ago to discuss these matters.

To make it clear, I will not have the opportunity to answer all the questions, but as I have done in the past, I will write to Members personally and individually—I am looking at my officers behind me—to ensure that each question is answered in detail. I have done that before and I will honour that today. Ten minutes does not do these debates justice.

I will touch on some of the important contributions, and I echo the comments on the standard and importance of this debate. It is a healthy debate for the House to have. My hon. Friend the Member for Twickenham (Dr Mathias) mentioned cluster munitions, as did the shadow Minister, the right hon. Member for Leeds Central (Hilary Benn)—I have got to know him so well that I wanted to say my right hon. Friend; I am pleased to see him in his place and welcome him. I can confirm that cluster munitions are not on sale in any form at the DSEI exhibition. The exhibition is patrolled to ensure that every bit of kit meets the required standard and that such equipment is not on sale.

My hon. Friend the Member for Twickenham also mentioned Bahrain, an example of a country that is on the list of concern, but also a country with which we have a strong military relationship. We do sell it military equipment—air force, navy and army components—but, as in all the cases of countries that are on the Foreign and Commonwealth Office list and with which we have a defence relationship, we make sure that our robust controls are honoured. That allows us to have a strong and robust relationship with countries. Bahrain is a great example of where that allows us to be frank and up front about human rights concerns. I will write to my hon. Friend with the detail on how our experts are working with the Bahraini Government to improve human rights. That is welcome, and we can do it and be frank with them because we have built up that relationship.

The hon. Member for York Central (Rachael Maskell) talked about Daesh and the potential for UK weapons to fall into their hands. I would be grateful to know of any examples. There have been many suggestions that UK equipment might have fallen into the wrong hands, but we need to make a distinction between press reports and evidence. If the hon. Lady has any actual evidence, she should please provide that to us and we will certainly look into it. I am not aware of any evidence on that front.

The same goes for Yemen. I touched on this in an intervention on the right hon. Member for Carshalton and Wallington (Tom Brake). The coalition was put together at the request of the Yemeni President. UN Security Council resolution 2216 states that all means and measures should be taken to support the country. The Houthis were asked to return and back away from the areas that their military had taken over. They refused to do so, which is why military action was confirmed. There is the potential that the military equipment that has been sold could be used, but that would be deemed a legitimate use of those weapons systems. It comes down to the fundamental right, guaranteed in article 51 of the UN charter and mentioned by the shadow Minister, for any country to have the means and the right to defend itself, or to provide support to other countries for the same reason.

If the right hon. Gentleman does not mind, I will not because I have so much to get through. If there is time at the end, I will certainly come back to him.

The hon. Member for Newport West (Paul Flynn) is no longer present, but his views on this matter have been consistent. He spoke about the humanitarian crisis in Yemen, which certainly worries me. All the humanitarian aid is currently coming through the port of Aden. Until the port of Hodeidah is liberated, the humanitarian crisis will not be avoided. In fact, we are one step away from famine breaking out in Yemen, affecting some 20 million people. The international community should certainly be concerned about that, but we can all be proud of the British humanitarian contribution in providing aid and support to that country.

The hon. Member for East Kilbride, Strathaven and Lesmahagow (Dr Cameron) spoke about the connection between conflict and poverty, on which I agree with her. She also made it clear that, as a clinical psychologist, she has experience and brings expertise to the House, which is very much to be welcomed. I absolutely agree with her ambition to remove those children who are in uniform and put them into school uniforms. If I may, I will write to her with more detail on the programmes we are involved in to make that happen. That is exactly what we should be doing.

The hon. Member for Ashton-under-Lyne (Angela Rayner) began by quoting Matthew 5:9—“Blessed are the peacemakers”. I wrote that down and underlined “makers”. How do we make peace? That is a big debate in its own right. She also discussed the causes of the crisis and looking at ways to deal with the source of the problem, not just those who are running away from it. The House will soon have to look in detail at what more we might want to do in relation to Iraq and Syria.

The hon. Member for Cardiff Central (Jo Stevens) spoke about another very important area: what has happened in Israel. There was huge scrutiny of the most recent events that unfortunately unfolded in front of the world’s eyes. We have to recognise that Israel lives in a very difficult neighbourhood, confronting Hamas on one side and Hezbollah on the other. Arms exports came under huge scrutiny during those events, but Israel does have the right to defend itself, and we conducted the necessary reviews to ensure that our robust rules, which have been mentioned a number of times, actually fell into place. The hon. Lady spoke with particular passion and, may I say, expertise, and if she would like to meet to discuss the issue in more detail, I would be delighted to do so.

The right hon. Member for Carshalton and Wallington, on whom I intervened, also spoke about UK weapons being used for oppression. I return to the fundamental question about our ability to have influence in a country by having not only a defence relationship with it, but a relationship right across the spectrum, in order to have influence on the improvement of human rights. Again, if he is aware that any UK weapons systems are used for oppression, it is important that he makes me aware of that.

There have been many reports that in Yemen the Saudis are using weapons that we are supplying to them indiscriminately. Is the Minister willing to investigate that?

I visited the United Arab Emirates only last week, and what is happening in Yemen, from the military campaign to the humanitarian issues, came up in our discussions. I am interested in any and every aspect of what we are doing in Yemen. If any reports with bona fide evidence suggest that that is happening, we would be the first to ask how our arms exports are being used. That applies not only there but in every situation, which absolutely must be the case.

The hon. Member for Rutherglen and Hamilton West (Margaret Ferrier) discussed a specific case. She said she would write with more detail; I do not know whether I am the Minister to whom she was going to write, but I would be more than delighted not only for her to write to me but to meet her to discuss that case.

The hon. Member for Edmonton (Kate Osamor) spoke about Saudi Arabia. I do not have enough time to go into everything now, but I have a whole list of areas—such as human rights, labour reform, migrant worker reform, political reform, and the elections taking place in which women are participating for the first time—in which things are moving forward. They are not moving forward as much as everyone would like; sometimes progress is slow, particularly in countries with a more conservative approach where reform can be difficult, but we are making inroads and progress. I will write to the hon. Lady with specific details about what is happening in Saudi Arabia.

The Scottish National party spokesman, the hon. Member for Glasgow North (Patrick Grady), spoke in detail about the arms trade treaty. I think I can answer his outstanding questions in the affirmative, but, again, I will write in more detail to clarify the Government’s position in relation to all his questions.

The shadow Minister gave a very measured response, which I was pleased to hear. He underlined the importance of article 51 on the right of individual countries to defend themselves.

I am left with exactly one minute for my speech, but I will try to articulate the main messages by reiterating that, as Members would anticipate me saying, we take arms export responsibilities very seriously. We aim to operate one of the most robust, vigorous and transparent systems in the world. Our core objective in export licensing is to promote global security and prevent controlled goods from falling into the wrong hands, while at the same time facilitating responsible exports and supporting British businesses. I make it clear that as we develop relationships with various countries, we very much scrutinise what is actually happening, and if we think there is something untoward, we try to correct it.

It is a pleasure to work under your experienced chairmanship, Mr Chope. I begin, as others have done, by congratulating the hon. Member for Glasgow South (Stewart McDonald) on securing the debate. I will not try to say which names are which, but I was grateful for the clarification at the beginning.

I will say as a general remark that this debate has been informative and constructive. From a personal perspective, it is good to see new Members of Parliament from the Scottish National party come here with such a depth of knowledge and interest, and such a commitment to these issues. It is healthy and important to have them at such debates, along with those of the older generation who are regulars at them; I am only sorry that there are not more Members from my party to match them. However, I am pleased that we are here to place on record our relationship with Saudi Arabia and the important human rights aspect of that relationship.

It is worth placing in context where we stand. The UK and Saudi Arabia have a long history of friendship, understanding and co-operation. That relationship is rooted in defence, security, trade and investment, as hon. Members have mentioned. There are many bilateral challenges and opportunities, as has also been said, including Iraq and Syria, ISIL and Daesh and the changes taking place with the new Iranian nuclear deal. As the Opposition spokesperson, the hon. Member for Bristol East (Kerry McCarthy) also mentioned, Yemen is also an issue.

It is important to remind ourselves that the people of Britain have strong bilateral links with Saudi Arabia. Millions of Muslims travel to Saudi Arabia every year to perform the Hajj and Umrah pilgrimages and to visit the holy sites of Mecca and Medina. I understand that 18,000 Britons completed the Hajj in 2014. The bilateral relationship is strong, which allows us to have frank conversations, often behind the scenes.

My speech has now been ruined by my scribbles in trying to answer all the questions that have been asked in this interesting debate. As I have done in the past, I will do my best to respond now, but if I do not, I will ensure that we scroll through Hansard and write to hon. Members individually to give them more details about the important questions that they have asked.

Saudi Arabia and Britain are essential partners and good friends. As a long-time friend of Saudi Arabia, we are able to have honest and meaningful conversations with the Saudi Arabian Government about all issues, including human rights. To be frank, sometimes those conversations are difficult. We remain deeply concerned about Saudi Arabia’s use of the death penalty, restricted access to justice, the women’s rights situation and continued restrictions on freedom of expression, freedom of assembly and religious freedom.

One issue that has not been mentioned is human trafficking, rates of which are extremely high in Saudi Arabia. The kingdom is currently designated by the USA as a country of particular concern. The Saudi Arabian Government do not comply with the minimum standards for eliminating trafficking and are not making significant efforts to do so; they have moved from tier 2 to tier 3 due to their lack of progress on anti-trafficking efforts, particularly their failure to protect victims and prosecute those guilty of involuntary servitude. Will the Minister look at that as well?

The Government’s view is a matter of public record, and we continue to make our views known in public and in private through multilateral and bilateral channels. We use the UN universal periodic review process and the FCO’s annual human rights and democracy report, which has been mentioned several times, including by the hon. Member for Islington North (Jeremy Corbyn), as well as our own diplomatic engagement with the Saudi Arabian authorities, to raise such concerns at all levels.

We can and do give tough messages, but we must recognise the crucial point that Saudi culture is deeply rooted in widely held conservative social values. We usually judge that our human rights concerns are best raised in private, and we will continue to work with the Saudi Arabian authorities and those in Saudi society advocating human rights reform, but we will continue to stand up for the full range of human rights. That is at the core of the strategy that we are discussing. Many—including, I think, the hon. Member for Glasgow South; I apologise if I misunderstood his tone—have advocated that we should somehow back away and not trade with that country because we should stand up for certain human rights issues. Forgive me if that is incorrect; if so, I will allow him to correct it. If we were to do so, would we give up an opportunity to have influence at the front line in favour of shouting from afar?

The Minister mentioned the UN Human Rights Council’s universal periodic review, which was very strict and raised many complaints about Saudi Arabia. What are the Government doing to monitor progress on that? Is the UN going to send any special rapporteurs to Saudi Arabia, and have the Saudi Arabian Government agreed to that process?

On a more general point, the Minister says that representations are being made behind the scenes and that that is the best way to influence the Saudi regime. Can he point to instances in which he feels that British influence has actually made a difference to the Saudis’ record on human rights? What changes has he seen as a result of our representations?

Again, I need to make some progress, and then I will answer those questions. It is important, if we have these debates, that we can see progress being made. We must be able to see movement forward. I will give some illustrations of that and of instances in which Britain is trying to assist in that progress.

Turning to some of the specific questions that have been asked, the hon. Member for Glasgow South asked about the lowering of the flag on the death of King Abdullah. I should make it clear that it is a long-standing convention to half-mast the Union flag on Government buildings following the death of any foreign monarch. That is the convention; it was not specifically to do with that particular case.

Many hon. Members, including the hon. Member for Glasgow South, spoke at length about the Raif Badawi case. I give the hon. Gentleman the same answer I gave in the main Chamber: the case is in the supreme court and is under review. We therefore cannot interfere with that process, in the same way that the Saudi authorities would not interfere with our process.

The hon. Gentleman raised two specific issues, so I shall just make a couple of points, which might answer the questions that he might be about to ask me yet again.

Raif Badawi has been found guilty of various charges. We strongly condemn the sentence passed, but we must honour the judicial process. Once that process has been completed, we can then take stock and comment on the process itself, but we must be careful not to interfere with it.

I am grateful to the Minister. May I press upon him again, as I tried to do earlier, that it is not a normal justice system? He is asking me, and people across the world, to have confidence in the system that put Mr Badawi where he is now. Is the Minister seriously going to stand up with a straight face and ask us to do that? It is nothing short of a joke. It is the same justice system that bestowed upon Mr Badawi a prison sentence, a fine and 1,000 lashes. Minister, we can do better than this.

The case has returned to the supreme court, which reflects the fact that the leadership has taken stock of international opinion and what people have said. The punishment has stopped and is under review. Until that process moves forward, it would be incorrect to comment on another country’s judicial process. That would be interfering, in the same way that the Saudi authorities would be interfering in our processes if they commented on them.

The hon. Gentleman asked whether the ambassador should request to visit Raif Badawi. We will not advocate that; again, it would inappropriate. Raif Badawi is not a British citizen as such. Once the sentence is upheld, we can obviously look at making contact, but it is not appropriate for our ambassador. That would, again, be seen as interfering with the process. A non-governmental organisation would be in a better position to make that judgment, rather than another country’s ambassador going in to see a citizen to whom the ambassador has no direct connection.

Given what the Minister has said, will he ask the Saudi Government if it would be possible for Amnesty International to visit Mr Badawi in prison?

Absolutely; we can certainly put that forward. I would be delighted to make that request.

Religious tolerance and the situation of Christian and other minority religions have been raised in the debate. The British Government strongly support the right to freedom of religion or belief, which is restricted in Saudi Arabia. As the hon. Member for Strangford (Jim Shannon) is aware, our views on the subject are well known. We must recognise that the restrictions on freedom of religion or belief in Saudi Arabia reflect widely held conservative social values in Saudi society. The key to increasing freedom is to focus on tolerance. We must work with Saudi Arabia to identify areas in which different faiths can work together, foster trust and build slowly in more challenging areas.

I referred in my speech to the 28 Christians who were arrested. Men, women and children have disappeared into the ether of Saudi Arabian society and into the prison system. I know that the Minister is unable to respond today, and I respect that, but could he respond directly to me, and perhaps to other hon. Members present in the Chamber?

I pay tribute to the hon. Gentleman for the work that he has done in this area. He has raised such issues with regard to a number of arenas, not only Saudi Arabia. I do not have the information he seeks at hand, but I will certainly write to him with more details, if I may.

The hon. Member for Islington North raised the important issue of migrant rights. He also touched on Qatar, which I visited recently. I will not digress now, but I will write to him on that point; we have seen progress, in which Britain has been very much involved.

As the hon. Gentleman will be aware, the amnesty for foreign workers to regularise their status in Saudi Arabia came into affect in 2013. It led to many people—1.5 million, I think—leaving the country. The Saudi Government have now agreed updated bilateral arrangements with a number of labour-supplying countries for legalised workers to remain in Saudi Arabia. We also expect to see more accurate labour records, and recent legal reforms will improve the basic rights of migrant employees. Legislation requires workers to be paid at least monthly and have access to their own identity documents, and domestic workers to have at least nine hours’ rest per day and one day off per week. We welcome any improvement in the legal position of migrant workers. Those are steps in the right direction, but clearly there is more work to be done.

The hon. Member for Bristol East raised the question of the imprisoned princesses. I will write to her with more details, but we have received no further reports since King Salman’s accession to the throne in January.

Export licences are another an important subject, given the closeness we have to Saudi Arabia. I make it absolutely clear that we have a robust mechanism in the UK. All exports of arms and controlled military goods are assessed on a case by case basis against the consolidated EU exporting licensing criteria. Concerns about excessive use of force and arbitrary arrest by police and security forces are considered extremely carefully.

In answer to the question about what progress has actually been made, I put my hand up and say that of course serious barriers remain and we want to see a huge amount of progress. The Saudi Arabian Government have confirmed that women will now be able to stand and vote for the first time in municipal elections, which will take place in December 2015. There are already women on the Shura Council, and we understand that 80 women will be standing, across 285 municipalities. There is obviously a long way to go, and we continue to engage with the Saudi authorities, but that is an example of real progress.

Saudi Arabia has also ratified the convention against torture, but, as has been articulated today, allegations of torture continue to be heard, particularly from political activists. We are pressing to work together to implement the requirements of international obligations, particularly human rights conventions. The Saudi Government have recently allowed the quasi-independent body the National Society for Human Rights free access to all prisons and prisoners to assess claims of torture and abuse. That needs to be placed in its context, which includes Raif Badawi.

The Saudi Ministry of Justice continues to implement an ambitious $1.6 billion reform programme. More than $1.2 billion has been spent on new courthouses, technology and judicial training. Special courts in family, commercial and labour law are planned. The appeal court and new supreme court have increased access to justice, and a new arbitration department has been formed to reduce the number of trial cases. Nevertheless, the legal system continues to suffer long delays in bringing defendants to court, and delays due to the lack of codification of case law. We have raised our concerns about that, and there are signs that trials are becoming more transparent, with the media and diplomatic community being given access to some trials. We also expect people to be brought to trial more quickly as the number of judges increases.

We have a strong and important relationship with a key ally in the region. I thank right hon. and hon. Members for this thought-provoking debate. I apologise for the fact that I have not been able to go into all the details in the answers that I have given today, but I will certainly write to colleagues with a more informative response.

I wish to make it clear that human rights are at the heart of UK foreign policy. Asthe Secretary of State for Foreign and Commonwealth Affairs has stated:

“It is in the UK’s national interest to help our international partners promote, protect and enjoy human rights; and to find effective ways to tackle violations wherever they occur.”

We have concerns about the human rights situation in Saudi Arabia, which we will continue to raise, but we also recognise that progress has been made. Clearly, more needs to be done. Our friendship with Saudi Arabia affords frank and open dialogue, and we continue to use our close relationship to ensure that the incremental process we are seeing is only the beginning.

I have today placed a copy of the annual statement on the Government wine cellar for the financial Year 2014-15 in the Libraries of both Houses.

Following the outcome of the review of the Government Hospitality wine cellar in 2011, this fourth annual statement continues our commitment to annual statements to Parliament on the use of the wine cellar, covering consumption, stock purchases, costs, and value for money. The wine cellar has been self-funding since 2011-12, through the sale of some high-value stock and payments made by other Government Departments for events organised by Government Hospitality.

The report notes that:

Sales of stock amounted to £71,050 (cf. £56,000 in FY 2013-14);

Further funds from other Government Departments added £21,514 to the overall receipts (cf. £16,762 in 13/14);

Purchases amounted to £70,432 (cf. £50,054 in 2013-14);

The highest consumption level by volume was of English and Welsh wine, at 44% of the total (cf. 48% in 2013-14);

Consumption rose in 2014-15 by around 15% due to the significant number of major international conferences and meetings (eg NATO summit, Ending Sexual Violence in Conflict summit).

As the House is aware, Raif Badawi is a Saudi human rights activist and blogger who, in May 2014, was sentenced to 10 years in prison and 1,000 lashes. The British Government have raised the case a number of times at senior levels. I now understand that the case is under consideration in the Saudi supreme court.

We often hear that answer from the Government. One of two things is happening. Either the Government are trying and failing, or they are not really bothering at all. May I ask the Minister two questions? First, will he instruct the United Kingdom ambassador in Saudi Arabia to request a prison visit to check on Raif Badawi’s health? Secondly, will he say without equivocation that Mr Badawi should be set free?

I am not sure that the hon. Gentleman heard my first response, so let me repeat it. I understand that the case is under consideration in the Saudi supreme court. This country, along with many others across the world, made representations at senior levels to ensure that it was understood where we stand as a supporter of freedom of expression around the world. It is now for the supreme court of make a judgment, and we should not pre-empt what the court will say.

I am grateful to my hon. Friend for his comments. It is very important that Britain stands by other countries in pushing for not only the right of freedom of expression, but the right of justice for those in prison, and we will continue to do so. The lashings have now stopped and this case is currently being reviewed by the Supreme Court—[Interruption.]—something I think the hon. Member for Glasgow South (Stewart McDonald) still does not understand.

The House will be aware that all the victims of the terrible tragedy in Tunisia have now been repatriated. Every family of a victim has a dedicated UK police family liaison officer—[Interruption.] I am sorry if the hon. Member for Bolsover (Mr Skinner) does not feel these issues are important, but I would be grateful if he did the House the courtesy of listening to this important message. Every British national injured in the attack is back in the United Kingdom. Our embassy team arrived in Sousse within hours of the attack and further teams were deployed in the following days. The London crisis operation centre moved into operation mode and worked on a 24/7 basis from 26 June until 1 July and the FCO remained in crisis mode to assist with the departure of tourists.

I commend the Prime Minister’s response to my hon. Friend the Member for Walsall South (Valerie Vaz), saying that a committee would be set up to look after the interests of the survivors and the bereaved families for the long term. That is sensible and it is the right approach. In the light of BBC reports of chaos in the security infrastructure in Tunis and the region, what support are we able to give them to augment their security infrastructure?

I am grateful to the hon. Gentleman for his initial comments, and I will be participating in that committee to make sure we do all we can to support all those caught up in that terrible tragedy—not just the families of the victims, but the injured and those who witnessed what happened. We have been working with the Tunisian authorities to investigate the attack and the wider threat from terrorist groups. The threat intelligence picture has led us to believe that a further terrorist attack is highly likely, and I stress to the House that the Sousse attacker was not working alone, but was part of an organised group, most likely trained in Libya. I am glad we are standing by Tunisia as best we can. We must look after the security of our citizens, and may I thank you, Mr Speaker, for receiving the Speaker of the Tunisian Parliament, who I know will wish to come to this country to express his condolences for what happened to the Britons in Tunisia?

I am sure the whole House will join me in thanking the Minister for his inspirational service to the Government in working with the families of those affected by last month’s tragedy. It is brilliant to hear that each family will have a dedicated liaison officer to see them through the coming years. Can he confirm that that will be along the lines of the groups set up to support the victims of 7 July 2005?

It is important that the support that this country and the Government provide is not confined to the time of the event itself but continues well into the future. I pay tribute to the Home Office and the work the police do—the important work of the family liaison officers. This work will not be needed simply over these few weeks; it will be needed for months and years, as the families come to terms with this terrible tragedy.

The funeral of my constituent Claire Windass, who was killed on holiday in Tunisia, will take place tomorrow, and I am sure the whole House will want to send our thoughts and prayers to Claire’s family at this very difficult time. Can the Minister say a little more about the practical assistance that the UK Government are offering the Tunisian authorities in investigating this horrific terrorist attack?

All in the House pay a huge tribute to the families of the fallen victims. This was a terrible disaster for both Tunisia and Britain. The numbers climbed in the first hours from five to six, then eight, then 12, then 30. Then it was not just 30 in number; they became names, individuals, parts of families, as the hon. Lady has outlined. We must stand by these people in their years of need. She rightly points out that Tunisia needs support. It is the country where the Arab spring began; it is where Bouazizi set himself alight and ignited the Arab spring. We must not allow that country to slide back into extremism, so we have teams working in a variety of areas, from airport security to the police to collecting intelligence, which is the crucial ingredient in understanding what is happening behind the scenes in the mosques, as well as next door in Libya.

With respect to the appalling tragedy in Tunisia, will the Minister give the House an assurance that our response will be part of a wider package across the region from Egypt to Libya, where there is a great lack of stability? Are the Government working across the piece to ensure that terrorist outrages such as these are minimised?

My hon. Friend makes a pertinent point, which the House needs to consider. The person and the group that were involved in that terrible killing were trained by an ISIS operation, Ansar al-Sharia, which has now chosen to fly the black flag in Libya. We are seeing the same thing happening in Algeria with Boko Haram, and in northern Sinai with Ansar Beit al-Maqdis. Terrorist groups all across the northern Maghreb are joining forces with ISIS, and this country and the international community need to do more to tackle this extremism.

More than 100 Syrian civilians have been killed since May as a result of the use of indiscriminate weapons such as barrel bombs. In the light of the recent meetings in New York, what role are the Government playing in the United Nations Security Council to ensure that the UK’s strong statement of support for the implementation of UN Security Council resolution 2139, in response to the increasing use of barrel bombs in Syria, is followed through?

The hon. Lady is absolutely right, and there are a number of quarters in which we can provide assistance. We are the second largest donor to the refugee programmes providing support to the neighbouring countries in the region that have taken in the 4 million refugees who have now fled the conflict. The UN has been crucial in coming up with that Security Council resolution, but we have run into the buffers because some of the usual characters do not want to support it. I hope that we will advance the programme and that we will see some movement in the UN General Assembly in September.

The Minister will recall that, back in April, the acting head of the United Nations High Commissioner for Refugees said that Europe was simply not doing enough in this regard. This is a humanitarian disaster, with 4 million refugees living in neighbouring countries. What urgent representations is the Minister making to his European counterparts about making the funds available to deal with this humanitarian crisis?

The Kuwait III talks are taking place, and a number of countries in the region are being asked to donate more funds in order to provide that assistance. There is a philosophical argument, which we have discussed in the House, as to whether this country should take in more refugees or provide more support in the region. I have visited the Zaatari refugee camp, and it is clear that the majority of Syrians want to remain in that location, which is why we are donating so much money—£800 million—to support people in the region.

As the Minister has just suggested, details are still emerging of the agreement reached in Vienna on Iran’s nuclear programme. Those talks have seen many missed deadlines over the past 12 years, but all sides have been consistent in saying that no deal was better than a bad deal. At this early stage, what confidence does the Minister have that this is a good deal and that it will be implemented?

I am grateful for the question. There is little more we can add at this stage, because the deal is just being concluded in Vienna, as my right hon. Friend the Minister for Europe said. We have made it very clear that we need a long-term and comprehensive solution on the Iranian nuclear issue and that we want a durable, verifiable and comprehensive nuclear deal that addresses the proliferation concerns. We will have to wait, but I hope that there will be a statement very shortly.

I thank the Minister for that reply and we look forward to hearing from the Foreign Secretary on his return. Let me turn to the struggle against ISIL. The recent attacks in Tunisia, Cairo and elsewhere have highlighted that we will defeat this threat only by working together as an international community. Will the Minister update the House on what specific actions are now being taken alongside other countries to cut off the finances that fund ISIL’s hateful crimes?

As I said in a previous reply, this is the largest threat that we face in the 21st century. The hon. Gentleman is absolutely right to point out that there are many strands to our programme to try to tackle that. The strategy involves not just the military but countering foreign fighter recruitment and dealing with stabilisation and support for those caught up in that, as well as denying funds. That means working with individuals in regional countries that continue to support this activity, and we need to work with the banking community to ensure that we cut off the supplies of funding that are generating and paying for fighters who are recruited from across the globe.

Friend knows, I take a great interest in the Balkans and last year I travelled to Bosnia with colleagues to visit Srebrenica and worked with a charity, Medica Zenica, which helps families affected by the conflict. Does he agree that as well as remembering the anniversary of Srebrenica last week we must refocus on rebuilding Bosnia-Herzegovina and help the people of that country to secure a better future?

What is the Government’s assessment of the situation on the ground in Lebanon, where about 500,000 Syrian school-aged children are believed to be living?

I am grateful for the opportunity to update the House on the situation in Lebanon, which I visited recently. We have advanced our Department for International Development programme to assist. Lebanon has taken on almost a quarter of its population in refugees and I commend the work being done to take those people into its society. Unfortunately, ISIL has already set up camp east of the Bekaa valley and is already in Lebanon. We are also providing military support to train the Lebanese forces so that they can have a buffer between the west of the country, towards the Mediterranean, and the east, looking out towards Syria.

I pay tribute to the work that my hon. Friend did as a pilot in the no-fly zone in the 1990s. He comes with a wealth of experience of the area and is right to point out that there must be greater co-operation between Kurdistan and Baghdad. We very much encourage that; that is what I did in my last visit to Baghdad a week and a half ago and what I will do when I visit Kurdistan in the near future.

The UK voted for a UN resolution calling for Palestinian co-operation with the International Criminal Court’s preliminary investigation into the Gaza conflict. Can the Minister therefore confirm the Government’s support for Palestinian membership of the ICC?

Given the growing importance of our conversation with Iran and in particular the part it is playing in fighting ISIL, can the Minister give us a firm date for the re-opening of our embassy in Tehran?

It is our intention to reopen the embassy in Iran. That is one of the first things I would have done over a year ago, had the deal moved forward in the manner in which we expected. Well, there’s a task! Thank you very much indeed, Mr Hollobone, and it is a pleasure to respond even in brief to the debate. May I express my frustration that this debate has not taken place in the main Chamber and that we do not have three hours for it? I am looking at the hon. Member for Easington (Grahame M. Morris), who I think is a member of the Backbench Business Committee. I feel frustrated that I have little time to reply and simply cannot do so properly.

As hon. Members might be aware, I try to do my best on such occasions, and I will certainly write to them with the details, but even to list all the questions would take all my time before I gave any reply. Such debates are important and should not be conducted in Westminster Hall for 90 minutes. We do not do the subject matter any justice, and if I feel frustrated, hon. Members who have been given only two to three minutes to speak must also feel frustrated. I hope that the usual channels—if they are listening, read Hansard or hear the debate—ensure that next time we have such a debate, we do it properly, because the world, the nation and our constituents are watching, and we need to do the subject justice.

I welcome, I think for the first time, the hon. Member for Halifax (Holly Lynch) and I congratulate her on securing the debate. She shows a grasp and understanding of and a genuine interest in the subject. I also welcome other hon. Members to Parliament—it is my first opportunity to do so for some—and their contributions to such debates as this. Britain thrives on international affairs, which is something we do well, and it is good to see that this Parliament is taking the issues very earnestly.

I, too, congratulate the Scottish National party spokesperson, the hon. Member for Central Ayrshire (Dr Whitford), on a formidable speech—I echo the comments of the Labour spokesperson, the hon. Member for Bristol East (Kerry McCarthy)—and she is another person to come to the Chamber with real knowledge of the subject matter. She is most welcome here today.

I will outline the Government’s position on the vote and the report, on what Britain is doing in Gaza unilaterally and multilaterally on the humanitarian front and so forth, and on the longer-term aspects—although I will have probably run out of time by then. I will do my best.

We deeply regret the loss of civilian life during the Gaza conflict last summer and the terrible toll of the ongoing Israeli-Palestinian conflict on citizens of both sides. The UN commission of inquiry report brings the scale of human suffering into sharp relief. It notes the victims’ continued hope that leaders will

“act more resolutely to address the root causes of the conflict so as to restore human rights, dignity, justice, and security to all residents of the Occupied Palestinian Territory and Israel”.

As many hon. Members have said, this is not the first time that we have been around this buoy—Operation Cast Lead, Operation Pillar of Defence—and it seems to be something that we do every two years, with Gaza getting destroyed and rebuilt. We must break that cycle if we are to hope to move forward. We continue to believe in the critical importance of a negotiated two-state solution to end the conflict once and for all. We strongly condemn the indiscriminate firing of rockets into Israel by Hamas and militant groups in the Gaza strip, as detailed in the report. On the seeming imbalance of munitions going from one side to the other, hon. Members will be aware of the Iron Dome project in Israel, which has stopped many of the munitions fired by Hamas. That is why there is the disproportionate number of fatalities or injuries on one side. I simply state that as a comment, not to justify anything.

As we have made clear, we recognise Israel’s right to defend itself. Every country, including ours, has a right to defend itself from terrorist groups and organisations, such as Hamas, and attacks. But it is a principle of international humanitarian law that the use of force in self-defence must be proportionate. The commission of inquiry report calls on all parties to fully respect the main principles of international humanitarian law and international human rights law that the hon. Member for Bristol East articulated—distinction, proportionality and precaution—and to establish credible, effective, transparent and independent accountability mechanisms promptly. We echo those calls.

I am afraid I simply cannot—it would be unfair to anyone else—but I will certainly speak to the hon. Gentleman afterwards.

We note that the report highlights

“substantial information pointing to serious violations of international humanitarian law and international human rights law by Israel and by Palestinian armed groups. In some cases, these violations may amount to war crimes”.

Those allegations must be fully investigated by Israel, the Palestinian Authority and the authorities in Gaza. We welcome the fact that Israel is already conducting its own internal investigations into specific incidents. Where there is evidence of wrongdoing by either party, those responsible must be held accountable.

The UK, along with our EU partners, voted in favour of the resolution on the report at the Human Rights Council last week. We would have preferred to see a text that gave more weight to Israel’s legitimate right to self-defence, and to the threat Israel faces from militant groups operating from inside Gaza, including Hamas. However, despite those concerns, we supported the resolution. I make it clear to hon. Members, who will be familiar with this from texts agreed behind the scenes in this place, that we need to find a balanced text to support; we found that resolution to be a balanced and appropriate text.

A number of hon. Members have raised concerns about the political and humanitarian situation in Gaza. We must do everything we can to avoid another conflict. The ceasefire agreement reached in 2014 holds, by and large, but there has not been the necessary progress toward a durable solution that addresses the underlying causes of the conflict. Indeed, worse than that, we are aware that the tunnels are being rebuilt and that Hamas is re-engaging and purchasing new weapons systems. We are also aware that other extremist groups such as ISIS are taking an interest. Where would it take this conflict if we were to see that extremist operation move into the area?

The current situation in Gaza is unacceptable. As has been articulated by others, the humanitarian situation remains bleak. More than 100,000 people remain displaced, there are power outages for up to 12 hours a day and 120,000 people across Gaza remain without a water supply. I am afraid, however, that the Palestinians have not taken the steps needed for progress on reconciliation and for the Palestinian Authority to resume control of Gaza. That is one of the main causes of frustration here: the Palestinian Authority are denied access because of Hamas. Israel has eased some of its restrictions, but far more needs to be done to ease the suffering of ordinary Palestinians, and there is more that Israel can do. Egypt, too, is wary of extremists in Sinai—the Ansar Beit Al-Maqdis—and is reluctant to reopen the Rafah crossing in the south. It opens it sporadically, but is further restricting the movement and access of both people and goods.

Hon. Members have asked what can be done. It is clear that there is an urgent need to do more to address the terrible situation now. We need bold political steps: without addressing the underlying causes of the conflict, we will never break the cycle of violence I alluded to earlier—there is no alternative that can deliver peace and security for Israelis and Palestinians alike.

We welcome the recent positive steps that Israel has taken in easing some restrictions, including doubling the water supply and permitting an increase in exports from Gaza. However, we want to see Israel go much further, as I have articulated on every visit I have made to Gaza, Israel and the west bank, and to visitors from there to the UK. We call on Israel to ease restrictions much further, on President Abbas to take concrete steps to return the Palestinian Authority to Gaza and on Egypt to show maximum flexibility in opening the Rafah crossing once and for all.

I will conclude, as I want to leave the hon. Member for Halifax time to respond to the debate. I reiterate my promise to write to hon. Members in more detail and apologise for not being able to answer them more fully in this debate.

Thank you, Mr Hollobone, for the opportunity to reply to this interesting, informative and important debate, which is taking place before the negotiations.

Let me begin by responding to the kind words from the right hon. Member for Warley (Mr Spellar). I am sorry that we have heard his valedictory foreign affairs speech. We will certainly miss him. I have worked with him for more than a year, and it has been a real pleasure. There has been huge cross-party support on this and other issues, and that is very welcome. I am sorry that the energy and enthusiasm he has shown in the debate has not been reflected by Labour Back Benchers, who have not taken part in the debate. It was perhaps also too early for Scottish National party Members to make the debate. I would have thought that they would want to engage in a debate on nuclear issues. None the less, I am grateful for the debate.

Like others, I congratulate my hon. Friend the Member for Aberconwy (Guto Bebb) on securing the debate and on his continued interest in this matter. We had a good debate last November, and I hope there will be further opportunities to discuss the issue. Through you, Mr Hollobone, I would certainly ask the Backbench Business Committee to make time for it to be debated on the Floor of the House as well as in Westminster Hall.

For more than a decade, the Iranian nuclear issue has posed one of the most intractable and persistent threats to international security and stability. The prospect of a nuclear weapons-capable Iran carries severe consequences for the security of the UK, the region and, indeed, the world. The Government have always been clear that the best solution lies in finding a peaceful, diplomatic and negotiated settlement. The process has been long and challenging, and we are grateful to both sides of the House for their support.

Our discussion today comes at a crucial moment. The joint plan of action agreed by the E3 plus 3 and Iran in November 2013, and extended in July and November 2014, froze the most concerning elements of Iran’s nuclear programme in return for limited sanctions relief. When the interim deal was extended in November, we, our E3 plus 3 partners—China, France, Germany, Russia and the United States—and Iran set ourselves a deadline of 30 June to reach a final comprehensive deal.

The UK played a leading role in diplomatic efforts that secured agreement on the key parameters of a deal in Lausanne on 2 April. That marked an important milestone in the ongoing negotiations, but as has been made clear today, those negotiations are not complete. Since April, UK diplomats and experts, and E3 plus 3 colleagues, have been working intensely to secure a comprehensive agreement by the 30 June deadline. That agreement, which has been questioned in the debate, must satisfy the Government’s objectives, which have remained consistent throughout this process: preventing Iran from developing a nuclear weapons capability, while recognising its right to access nuclear energy for peaceful purposes. We have always been clear that we will not agree to a deal that fails to address our proliferation concerns.

My right hon. Friend the Foreign Secretary will be present for the talks in Vienna in the coming weeks, where he will maintain a laser-sharp focus on our key UK objectives. As the deadline draws ever nearer, it is crucial that Iran should appreciate what is at stake. Significant economic advantages and political benefits await if Iran agrees to a robust nuclear deal. Right hon. and hon. Members must forgive me for not going into the detail of the deal, but I will try to outline answers to some of the questions.

My hon. Friend is right to raise that question: what assurances do we have that Iran would maintain the deal? I shall certainly try to answer the questions that have been asked. I am, to the horror of my team, going to abandon the speech that they have carefully prepared for me, and do my best to answer the questions from the debate. I offer my apologies if I do not manage to answer all the detailed questions. I shall read Hansard—not because I like reading what I have said, but because it is important that I read what Members have said and reply in writing, if I may, to keep dialogue going.

My hon. Friend the Member for Aberconwy asked whether the agreement was intended to be a non-proliferation or arms control treaty. It is a mixture, as I have made clear. It important for us to be able to maintain that, because there are breakout weapons systems that we are concerned about in addition to what Iran is doing on the nuclear side. He mentioned Iran’s foreign policy objectives, for itself and the wider region, which I want to touch on in relation to other concerns. Iran’s role, and where it sees itself in the region, is a major issue. It has a responsibility not just to itself but in the wider region and we look to it to act responsibly.

My hon. Friend mentioned the United States foreign policy aspects of the matter, and my hon. Friend the Member for Tiverton and Honiton (Neil Parish) raised the question whether there was a legacy issue. I have never heard the line before that a President is most dangerous in his second term. It could be argued both ways; a President in that case is not tied by anything and therefore can be more robust in some of the measures that he or she is willing to pursue.

I want to go through the eight major headings of the deal, which may help the House to understand where the conversation and agreement are going, leading up to 30 June. First there is the question of a durable and verifiable deal. The first heading is enrichment, which covers Iran’s capacity and its enriched stockpile. The number of centrifuges is obviously part of that. Many figures have been given in the debate, but the number is less significant than the breakout time—how quickly a weapon could be procured if it was decided to close the doors and prevent IAEA from carrying out inspections. We have set that as a year. Whatever the experts are saying, that leads to the number of centrifuges that we would consider acceptable. We are less focused on the actual numbers at the moment, and more on the breakout time.

The second area heading is research and development, covering types of centrifuges, and leading to a mutually agreed scope and schedule. Thirdly, the Arak plutonium reactor has been mentioned. There will be a redesign to cut off the plutonium route to a nuclear device. Fourthly, Fordow, which has also been mentioned, will no longer be a site for the enrichment of uranium. The fifth area is duration. There are programme restrictions in a number of areas. A period of 10 years for the agreement has been mentioned. It could well be that parts of it will last longer, and parts might even be shorter. That is some of the detail being worked out.

The sixth heading is the possible military dimensions, which I have touched on. That covers the measures that Iran must address: the IAEA’s concerns about the possible military dimensions of its nuclear programme. If there is one area that is of concern in the discussions at the moment, that is probably the most difficult. The seventh area is sanctions: relief from the comprehensive EU and US economic and financial sanctions in return for IAEA-verified actions on Iran’s programme; an agreement on the termination of UN sanctions, with limiting transfers of sensitive technologies and activities; and other issues relating to conventional arms and ballistic missiles. The eighth and final area is transparency and verification, which many hon. Members have mentioned. That covers the ability to make sure that nothing is being done behind our backs, and a robust and credible monitoring programme including the implementation of various protocols to give the IAEA greater oversight of Iran’s activities.

My right hon. Friend is right; we must have such access. I am pleased that the IAEA has confirmed that it currently has the access it needs. Were that to be closed down, those would be the consequences—it would be about whether sanctions would be brought back. I acknowledge my right hon. Friend’s understanding of and interest in the matter. He spoke about the Iranians as a proxy power elsewhere in the area. If Iran is looking for a more responsible role, as he mentioned and encouraged, it must be seen to take greater responsibility in events in places such as Syria. It is propping up Assad, so no space is being given to moderate Sunnis. They are then pushed, or encouraged, to join ISIS. Iran could easily assist the international community in progressing with a political solution for Syria, and could help immensely with what is happening in Anbar and Nineveh province in Iraq. General Soleimani is pushing across with the Hashed militias and causing sectarian friction in Iraq; that is unhelpful in the long term. Likewise in Yemen, weapons systems coming by boat and the provision of weapons for the Houthis, further complicate an already difficult and complex issue.

There are ways for Iran to show its initiative and greater responsibility in the region, and I think that many hon. Members would like to see that. It is not happening now and we are concerned about that. I am conscious of the time; I will write to hon. Members with more details. The debate has been extremely good. I simply want to make it clear that we are working hard for the deal, but, as has been explained, we need to make sure we reach the correct one. Without the correct deal, we have no deal.

The reason we needed this debate in Westminster Hall was timing. The issue is live and is reaching a conclusion. I am grateful for the Minister’s comments and for his generous offer to write to right hon. and hon. Members on points raised in the debate. I fully understand that the complexity and extent of questions made it a challenge for him to respond in full in the 12 minutes allocated. I pay tribute to the shadow Minister, the right hon. Member for Warley (Mr Spellar), for his final Front-Bench speech. He said he disagreed with my viewpoint, but few disagreements came to light from his comments. I wish him well on the Back Benches.

The debate has made it clear that there is interest, certainly on the Conservative side, in this important issue. The Backbench Business Committee has not yet been convened, so Westminster Hall was our only option for getting this debated in the House. Given that the Foreign Secretary will go to Vienna, and in view of the interest shown in the Chamber, a statement should perhaps be made after the visit—and there should certainly be one if an agreement is reached.

We remain firm in our belief that a comprehensive plan is needed to tackle the problem of irregular migration. The most useful development towards stopping the flow of illegal migrants would be the formation of a unity government in Libya, and we are working with European Union partners to achieve that. We are also working with colleagues in the Department for International Development and the EU to support countries of origin; reinforce security in countries of transit; and, with the Ministry of Defence, save lives in the Mediterranean.

Does my hon. Friend agree that the current instability in Libya means that its borders are not being properly policed and that, as he says, if the warring parties could get a ceasefire and form a unity government, that would help tighten up the borders and stop the tide of economic migration to southern Europe?

My right hon. Friend makes an important point. Although the maritime component has much the highest profile, it is the transit and trafficking operations that need to be stopped. Parties and stakeholders in Libya are coming together in Morocco—in fact, the conversation started yesterday under United Nations envoy Bernardino León—and we hope they will finally be successful.

The problem in Libya obviously stems from much further away than Libya itself, so the stabilisation of Libya is not the solution. What will the Government do to make sure that people do not need to flee to southern Europe, because that is the root of the problem?

The hon. Gentleman is right in part, but as I have just pointed out, it is not simply the transit issues that are important. There is a maritime component, on which we are working with Operation Triton, and there is also the source countries, so there are three parts to the solution. However, if Libya is able to provide the stability that is needed and to provide its own security, the trafficking operations can be curtailed.

Has the Department been able to assess from intelligence exactly who is behind the trafficking? If we can only prevent the trafficking and prevent individuals from making a lot of money, that will dry up the problem.

My right hon. Friend makes an important point. As I say, there are complex aspects to tackling this problem. It is important to understand what is happening in the source countries, notably Nigeria and Somalia. We are working with our DFID colleagues to make sure that happens. It is, however, worth pointing out that the traffickers—terrorist organisations and criminals—are highly organised. They charge about $1,000 a seat to make the journey from Africa to Europe. We must make sure that this stops.

The processes we are following are well established in international law. I commend the work of Federica Mogherini, the EU lead on this. In April, she brought together EU member states on the common security and defence policy operation that will ensure we are able to prevent the boats from leaving Libya in the first place.

The Minister for Africa, the Under-Secretary of State for Foreign and Commonwealth Affairs, my hon. Friend the Member for Rochford and Southend East (James Duddridge), has called on all parties to end the violence and respect the principles of the Arusha agreement. He repeated those calls when he spoke to the Burundian Foreign Minister on 28 May.

I thank the Minister for that answer. He and the Minister for Africa will be aware that just this week civil society representatives have called for the replacement of the UN special envoy who is meant to be mediating the dialogue. The Burundi electoral commission’s legitimacy is also being questioned, and it has now scrambled together a date for an election in circumstances that are particularly adverse, with repression still at play, refugees unable to return and armed youth groups not disarming. What will be the Africa Minister’s message to international partners and the Burundi Government at the African Union meeting?

We need to focus on the Arusha agreement. The UK Government are extremely concerned about the instability in Burundi that the hon. Gentleman articulates and are working actively within the region, with the African Union and the international community, to resolve the crisis.

23. The instability is principally being caused, of course, by President Nkurunziza’s desire to avoid the constitutional term limits, which threatens not only Burundi but the region as a whole. What discussions has my hon. Friend had with Ministers in Burundi’s neighbouring countries about their attitudes to that extension to the constitutional term limits?

The situation in Burundi reminds us of the risk of mass atrocities and the need for the international system to be more effective in preventing them and responding to them. What is the Foreign Office’s attitude to the French initiative, which proposes veto restraint by the permanent five members of the United Nations Security Council in cases in which mass atrocities might have occurred?

Given the volatile situation in Syria, it is difficult to ascertain exactly the number of British nationals who are fighting in militia groups against or for ISIL without the risk of being inaccurate. We advise against all travel to Syria and parts of Iraq and do not want British nationals taking part in the conflict on either side. There are ways to support the Syrian people more effectively and get aid to where it is most needed.

A young and quite vulnerable Newark man with autism has recently been recruited to fight with the Kurdish peshmerga through their foreign legion, the Lions of Rojava, who recruit—somewhat indiscriminately —through Facebook and websites. While we all stand shoulder to shoulder with the brave peshmerga, will the Minister urge the Kurdish Government to exercise greater caution and, in particular, to review those websites?

The Minister will be aware that Cardiff, like many parts of the UK, has been afflicted by young people being attracted to fight for ISIL. What steps is the Foreign Office taking with the Turkish authorities to help to close that route into that part of the world?

Demolitions are an impediment to the two-state solution and, in all but the most limited circumstances, contrary to international humanitarian law. We have made our concerns clear to the Israeli Government, and I raised our objections with the Israeli national security adviser last week and during my visit to the occupied territories in October.

I welcome those steps, but that is broadly the same answer Ministers have been giving for a number of years. The demolitions are breaches of the fourth Geneva convention on war crimes. Given that the demolitions are continuing in spite of these steps, is it not time to consider stronger action, such as the suspension of the arms trade with Israel?

The hon. Lady is right to say that these complex issues have perplexed the House—and, indeed, the international community and the region—for a long time, but as my right hon. I thank the Foreign Secretary for his response. The illegal sale of antiquities is not only a crime; it provides significant funding for organisations such as ISIL. Will the Foreign Secretary confirm that Britain supports the International Council of Museums updated red list, which classifies endangered archaeological objects and works of art to help to prevent their illegal sale and export?

I am grateful for my right hon. Friend’s interest in this area. In an effort to remove connections to past civilisations, ISIL is indeed tearing down ancient monuments and selling them on the black market. The International Council of Museums, to which she refers, and its red list will help tackle illegal sales, and the Government very much support it.

As more and more people try to make the perilous boat journey across the Mediterranean, the dedicated men and women of HMS Bulwark are having to rescue an ever-increasing number of desperate people in very difficult circumstances. My hon. Friend is absolutely right. It is not too dissimilar a situation to the one we find in Burundi, where there is a constitution which should be recognised and should be honoured—and we expect President Kabila to do the same. Until that happens, unfortunately we will have further instability.

My right hon. Friend is absolutely right: following the Arab spring, we have seen huge advances in that area of Africa—in governance, prosperity and, indeed, stability. I was able to visit the region two weeks ago, and I hope to return in November with trade missions, taking British companies to that part of Africa in order to promote the prosperity agenda.

The House may welcome a report on the 2015 nuclear non-proliferation treaty (NPT) review conference, held at the United Nations in New York between 27 April and 22 May to review progress and agree future actions against the NPT’s three pillars: disarmament, non-proliferation and peaceful uses of nuclear energy. The review conference was a substantive event, which advanced discussion on each of the treaty’s three pillars but concluded without reaching a consensus outcome.

The UK played an active role both in the preparation for the review conference and at the conference itself. As part of its preparations for the review conference, the UK invited certain non-nuclear weapons states and civil society representatives, for the first time, to the UK-hosted P5 conference of nuclear weapon states in February this year. The UK also submitted a revised national report setting out the action the UK is taking to support the NPT. We encouraged and participated in five rounds of informal consultations between Israel and Arab states on a conference on a middle east zone free from nuclear weapons and other weapons of mass destruction.

The Minister of State at the Foreign and Commonwealth Office, the right hon. Baroness Anelay of St Johns DBE, set out the UK’s approach and progress against NPT objectives on the opening day of the conference. The UK delegation participated actively, both in the main conference and at side events, including on our pioneering verification work and nuclear energy. We engaged constructively in the negotiations throughout, seeking to reach agreement and to make progress on all three pillars of the treaty.

We were disappointed that, despite the progress made in many areas, the conference was not able to find common ground on how to make further progress on the proposed middle east zone free from nuclear weapons and other weapons of mass destruction. This issue was the reason that consensus was not reached on the draft outcome document. The UK sought a process which was meaningful and based on arrangements freely arrived at by all states of the region. The proposed text would not have enabled tangible progress to be made and so we were unable to support the draft conclusions. We remain committed to the 1995 resolution on the middle east, the creation of a middle east zone free from nuclear weapons and all other weapons of mass destruction, and the steps agreed in 2010 towards that end.

The UK’s commitment to the treaty and to fulfilling our NPT obligations, including under article VI on disarmament, remains undiminished. As a responsible nuclear weapon state and an original party to the NPT, the UK remains committed to creating the conditions for a world without nuclear weapons. We have reduced our nuclear forces by well over half since the cold war peak and dismantled all of our air delivered nuclear weapons. In 2010 the UK committed to reducing the number of operationally available warheads to no more than 120; we have now achieved this which means that our Vanguard submarines now carry 40 warheads. We also remain on course to reduce our total stockpile of nuclear weapons to no more than 180 warheads by the mid 2020s.

The lack of a consensus outcome neither undermines the treaty nor changes states’ obligations. Of the eight previous review conferences, three have ended without consensus. Throughout, the treaty has remained vitally important for the UK and for the international community as a whole, playing an unparalleled role in curtailing the nuclear arms race and keeping the world safe. The action plan agreed at the 2010 review conference remains valid as a comprehensive roadmap for all NPT states to follow to take forward action on disarmament, non-proliferation and peaceful use of nuclear technology, as do the agreements from 2000 and 1995. The UK will continue to pursue this roadmap, working closely with our partners in the NPT.

This has been a helpful and constructive debate, and I join others in congratulating the hon. Member for Hayes and Harlington (John McDonnell) on securing it through the Backbench Business Committee. I thank all right hon. and hon. Members for their contributions and the many right hon. and hon. Members who have campaigned in this House and outside. I am pleased that hon. Members have highlighted the work of my hon. Friend the Member for Battersea (Jane Ellison) in supporting Shaker Aamer’s family, who live in her constituency.

I will do my best to answer as many points as I can. I spoke to the US embassy today at length on this matter, and the Minister of State, Foreign and Commonwealth Office, my right hon. Friend the Member for East Devon (Mr Swire), who deals with the United States, had a meeting with US Ambassador Barzun yesterday at which he discussed these issues. I might be the only Member to have visited Guantanamo Bay, albeit from the Cuban side—that was as close as I could get—back in 2005. When I looked over at the camp area, I wondered how long it would be before it was closed.

My right hon. Friend the Member for Haltemprice and Howden (Mr Davis) spoke about the reliability of the confessional evidence and how standards dropped after 9/11. The right hon. Member for Manchester, Gorton (Sir Gerald Kaufman) talked about the double standards created by the creation of Guantanamo Bay. My right hon. Friend the Member for Sutton Coldfield (Mr Mitchell) paid tribute, as do I, to the difficult and often unrecognised work of the intelligence services and the importance that justice prevails. The hon. Member for Hammersmith (Mr Slaughter) talked about the size of the campaign, which has lasted a number of years, in support of Shaker Aamer. My hon. Friend the Member for Westmorland and Lonsdale (Tim Farron) talked about the west’s moral authority being eroded and undermined because of Guantanamo Bay.

The hon. Member for Islington North (Jeremy Corbyn) and others talked about the number of people who had taken up this cause and referred to the Senate intelligence committee report—anyone who has read the accounts of that report will, like me, have found it deeply troubling. The hon. Member for Brighton, Pavilion (Caroline Lucas) talked about the concerns about Mr Aamer’s release or transfer to Saudi Arabia. It is clear that Shaker Aamer wants to return to the UK, and that is what we support. The hon. Member for Harrow West (Mr Thomas), the shadow spokesman, raised several important questions that I shall try to answer.

One aspect that I will cover now relates to the powers given to the US Defence Secretary under the National Defence Authorisation Act 2012. We have been in discussions with the US President, as I say, so we look to any measure required to ensure that justice prevails and Shaker Aamer is returned to the UK—whichever system, whichever protocol or whichever mechanism is used, including the one to which the hon. Gentleman referred.

On the point about the NDAA, as I understand it, any waivers that can be secured for the release of Mr Aamer under this legislation are controlled by the US Defence Secretary. Will the Minister tell us whether any representations have been made directly to the US Defence Secretary, perhaps by the Secretary of State for Defence or the Foreign Secretary?

The Foreign Secretary has raised this matter, but as I say, we have called on the President to use all available powers, and this is simply one mechanism that could be used.

I certainly welcome this opportunity to highlight the Government’s commitment on this issue. The UK has long held that indefinite detention without fair trial is unacceptable. Mr Aamer has been detained in Guantanamo Bay for 13 years, yet has not been charged with any crime. As a result of the UK’s long-standing opposition to the operation of the US detention facility at Guantanamo Bay, the UK Government exceptionally requested Mr Aamer’s release in 2007, and that request also included four other former UK residents who have since returned to the UK. The UK Government are committed to bringing Mr Aamer back to the UK, and we have made our position very clear to the US Government. We want to see him released as a matter of urgency, and we know that they fully understand this request.

As hon. Members will have noted, the Prime Minister personally raised Mr Aamer’s case at his meeting with the US President on 16 January this year. We welcome President Obama’s commitment at that meeting to prioritise the review of Mr Aamer’s release to the UK.

Supporters of Mr Aamer often cite the fact that he was cleared for release, and this has been repeated here today. He was cleared for release some years ago, and given the President’s commitment, people cannot understand why he is still in detention. I need to clarify, however, that Mr Aamer has been cleared only for transfer to Saudi Arabia, not cleared for release either in Saudi Arabia or indeed the UK. This is an important distinction under the applicable US legislation.

President Obama’s statement means that Mr Aamer’s case has been prioritised for review through an inter-agency process. This comprehensive process undertaken by six US Government Departments involves a complex case-by-case review. We do not have a timetable for a decision, but we are confident that this review is under way. We hope, of course, that Mr Aamer will soon be released.

However, it is important to understand that President Obama’s decision to close the detention facility and release its inmates remains a contentious political issue in Washington, as hon. Members have outlined in today’s debate. Stark differences of opinion exist in Congress across the political spectrum about the wisdom of doing this at a time of heightened terrorist threats. Within that, there remain real concerns about recidivism and the actions that detainees may take after they leave Guantanamo. Let us be clear, however, that Mr Aamer has not been charged with or convicted of any crime.

I have listened carefully to the debate and to the Minister’s contribution so far, so I hope I am not pre-empting what he is about to say. He has not yet told us, however—perhaps I have missed the clarity on the matter—what reasons the US has given to the Foreign Office for not releasing Shaker Aamer. What are the reasons behind not processing his release?

I do not know whether the hon. Gentleman was present at the beginning of the debate. I should like to make some progress, but I shall come to the point that he has raised.

As I have said, Mr Aamer has not been charged with or convicted of any crime, but the United States Government have made it clear that any action taken to release him would have to remain consistent with United States national security.

The Minister is making much of concerns about what will happen to Shaker or anyone else after their release. The United Kingdom is one of the safest places for such people to return to. We have one of the safest structures to deal with any risk that might exist. This simply does not add up: I do not see what the obstacles are.

Let us take a step back from this particular case. Security questions must be asked, in the case of any inmate, about what will happen once the process has taken place. As I have said, the judicial process that is being conducted is very complex, and involves a number of Departments.

The point has been made time and again about the manner in which many of the detainees ended up in Guantanamo Bay, and about the creation of Camp Delta in the first place. I make no comment on this particular case because it would be wrong for me to do so, but we need to ensure that every person who is processed will not be a danger to the United States or to any other country. It is a complex process, and I must make it very clear that I make no judgment on this particular case. I am about to give some numbers and a timetable, and details of the frequency with which detainees are being processed.

The Minister is setting out his case, and he says that he does not need to make a judgment, but the United States has made it clear that there is no evidence against Shaker Aamer. Is that not the critical factor? I want to make some progress. As I shall make clear shortly, I am not privy to the very complicated process, involving six United States Government Departments, that every single detainee will have to undergo before being cleared for release. That is the process that Shaker Aamer must undergo, like everyone else who has been released so far or will be released in the future.

In supporting Mr Aamer’s release, we have emphasised to the United States Government that any individual who engages in terrorist-related activity in the United Kingdom can expect to be dealt with through use of the full range of powers that are available to us. I shall not list them here, but they are extensive, and we remain confident in the ability of our police and security services to deal with any such threats. I think that that partly answers the question asked by the hon. Member for Brighton, Pavilion.

It would be inappropriate to comment on why Mr Aamer is in the Guantanamo Bay facility, especially as we continue to discuss the details of his case with the United States in order to secure his release. This is a sensitive issue and, as the House will understand, it has been the policy of successive Governments not to discuss intelligence matters. However, as Members well know, the United Kingdom does not participate in, solicit, encourage or condone the use of torture or cruel, inhuman or degrading treatment or punishment for any purpose. We remain absolutely committed to ensuring that serious allegations of UK complicity in alleged rendition and mistreatment overseas are examined carefully. If any evidence of that were to come to light, we would take appropriate action. The investigation of, or prosecution of individuals involved in, any alleged torture carried out by the United States is a matter for the United States authorities.

I thank the Minister for giving way; he is being very generous. In these investigations into torture and extraordinary rendition, is he getting all the co-operation he has asked for from the US authorities?

I can only repeat what I have just said: I cannot comment on intelligence matters relating to this particular case.

Consular access is afforded to states only as regards their own nationals and, as has been repeated in this Chamber, Mr Aamer is a Saudi national. Our consular policy for non-British nationals is clear: we cannot help non-nationals no matter how long they have lived in the UK and regardless of their connections to the UK.

Although the timeline for the closure of the facility remains a matter for the US Government, President Obama was elected in November 2008 having vowed to close Guantanamo Bay. In the early days of his presidency, he said:

“There is…no question that Guantanamo set back the moral authority that is America’s strongest currency in the world.”

He recognised that, faced with uncertain threats, hasty decisions were made

“based on fear rather than foresight”.

President Obama remains determined to see the Guantanamo Bay facilities closed by the end of his Administration, and we remain committed to assisting him in this aim.

Of the original 779 detainees held in Guantanamo Bay, 122 remain, including Mr Aamer. Five detainees have been released so far this year, but in 2014 the US released 28, 19 of whom were released in November and December. That is a considerable increase in releases compared with previous years. From 2011 to 2013, a total of just 19 detainees were released.

We have already made a significant contribution to reducing the number of detainees in Guantanamo Bay by taking back nine UK nationals and, exceptionally, five former legal residents. Aside from Mr Aamer, the UK is not considering accepting any further detainees from the Guantanamo Bay facility. More widely, we have facilitated engagement with countries that have agreed to accept former detainees, and shared experience and advice on managing the return process.

In conclusion, as hon. Members have highlighted, 14 February was the 13th anniversary of Mr Aamer’s arrival at the Guantanamo Bay facility. Along with his family and his many supporters, the UK Government would like this to be the last anniversary that Mr Aamer passes in detention. Since the Prime Minister’s meeting with President Obama on 16 January, my officials and Government colleagues have continued to work to make that a reality, and we will carry on raising his case at the highest levels and at every reasonable opportunity to impress further on our US counterparts that we are looking for an urgent resolution.

I am sorry to press the Minister, but he has still to answer the question from my hon. Friend the Member for Edinburgh South (Ian Murray). In the Minister’s long conversations with the American embassy and others in the US Government, what is the precise and exact reason he has been given as to why the release of Shaker Aamer is not possible at the moment?

I understand the difficulty the Minister is in, but, as he announced, we all know that others have been released, although he cannot give any reasons. It appears that there is to be an investigation, but it seems there is a clear difference between those who have been released and Shaker Aamer. Is that the picture that emerged from the Minister’s conversations?

Everybody has been waiting for the Minister to reply. I was saying that it is a total anticlimax. The Minister has said that, far from being released, Mr Aamer is only under review. Almost all of what he has had to say is a sop to Congress, to the Americans generally and to the President, rather than an explanation to the House that he and his superiors will try their level best to get Mr Aamer out. He is like an apologist for the American regime.

If I may continue, we have made it very clear that we have listened to this debate and we stand with this Parliament in calling for Shaker Aamer to be released. If the hon. Gentleman would care to have the courtesy to listen to what I am saying, he would understand that he has not heard this Government’s passion and commitment to speak at the highest levels to ensure that we can leverage and use our relationship.

I stress that we have a strong, close and frank relationship that brings concrete benefits to both sides and that advances joint objectives. In the January meeting with President Obama, we were able to secure for the first time a guarantee that this will now become a priority. That is the first time that has been said. We will continue to press the issue, and this debate will have its place and be useful in that regard.

I hope I have made it clear that the UK Government are absolutely committed to securing the release of Mr Aamer. Today I would like to underline that commitment and join the House in calling for the US Government to approve the release of Shaker Aamer to the UK.
