I am incredibly grateful to my hon. Friend the Member for Wealden (Ms Ghani) for securing this debate, and I pay tribute to her, and to all hon. and right hon. colleagues who were the recipients of those ill thought-out and ludicrous sanctions announced by China recently, for their continued work on this important issue.

I of course acknowledge the strength of feeling across the House on this critically important issue. We have heard some powerful speeches from all parts of the House today. Parliaments and individual parliamentarians rightly play a pivotal role in drawing global attention to human rights violations, wherever they occur. I am very grateful for all the contributions and I will try to answer the points raised within the context of my speech. I am conscious that I need to leave my hon. Friend some time to wind up the debate.

As we have heard from across the Floor, the situation faced by Uyghurs and other minorities in Xinjiang is truly harrowing. We have repeatedly emphasised our grave concern at the serious and widespread human rights violations occurring in the region. There are credible reports of the extrajudicial detention of over 1 million Uyghur people and other minorities in political re-education camps since 2017, extensive and invasive surveillance targeting minorities, forced separation of children from their parents, forced sterilisation of women, systematic restriction on Uyghur culture, education and the practice of Islam, and the widespread use of forced labour.

The evidence of the scale and severity of the violations in Xinjiang is extensive. That includes, as the whole House knows, satellite imagery, the testimony of survivors, credible open-source reporting by journalists and academic researchers, and visits by British diplomats to the region that have corroborated reports about the targeting of specific ethnic groups. United Nations special rapporteurs and other international experts have also expressed their very serious concerns.

Meanwhile, leaked and publicly available documents from the Chinese Government themselves verify many of the reports that we have seen. Those documents show guidance on how to run internment camps, and lists showing how and why people have been detained. They contain extensive references to coercive social measures and show statistical data on birth control and on security spending and recruitment in Xinjiang.

In the face of that evidence, the United Kingdom has acted decisively. In March, the Government took the significant step of sanctioning four senior individuals responsible for the violations that have taken place, and which persist, against the Uyghur Muslims in Xinjiang. We also designated the organisation responsible for enforcing the repressive security policies across many areas of Xinjiang.

The sanctions involve travel bans and asset freezes against the individuals and an asset freeze against the entity that we are designating. These individuals are barred from entering the UK and any assets that they hold in the UK are frozen. By acting alongside our partners, the United States, Canada and the European Union, on an agreed set of designations, we have sent a clear and powerful message to the Chinese Government that the international community will not turn a blind eye to serious and systematic violations of basic human rights. These countries amount to a third of global GDP.

On 12 January, we announced robust domestic measures to help to ensure that UK businesses and the public sector avoid complicity in human rights violations in Xinjiang through their supply chains, including a review of export controls as they apply to Xinjiang, the introduction of financial penalties for organisations that fail to comply with their transparency obligations under the Modern Slavery Act 2015, and robust and detailed guidance for UK businesses to target those who profit from forced labour and those who would support it financially, whether deliberately or otherwise.

We have also acted internationally to hold China to account for its policies in Xinjiang. In February, in the first personal address to the UN Human Rights Council by a UK Foreign Secretary in more than a decade, my right hon. Friend underlined his call for China to allow the UN High Commissioner for Human Rights, or another independent expert,

“urgent and unfettered access to Xinjiang.”

That point was made powerfully by the hon. Member for Oxford West and Abingdon (Layla Moran) and was reinforced by the hon. Member for Dundee West (Chris Law) and the Opposition spokesman, the hon. Member for Aberavon (Stephen Kinnock).

Working with our partners, we have built an international caucus of countries calling China out for its gross human rights violations and increased the diplomatic pressure for Beijing to change course. On 6 October 2020, alongside Germany, we brought together 39 countries to express grave concern at the situation in Xinjiang in a joint statement at the UN General Assembly Third Committee. That was an increase on the 23 countries that supported the UK-led joint statement a year earlier.

We continue to raise the human rights violations in Xinjiang directly with the Chinese authorities. I had direct conversations recently when I summoned the chargé to the Foreign, Commonwealth and Development Office, and my right hon. Friend the Foreign Secretary has raised his serious concerns on a number of occasions with his counterpart, Foreign Minister and State Councillor Wang Yi.

The motion before the House is that the situation in Xinjiang amounts to genocide and crimes against humanity. The UK of course treats all allegations of genocide and crimes against humanity with the gravity they demand. As a nation, we have a strong history of protecting global human rights, but as the House is no doubt aware, the UK’s long-standing position, like many countries around the world, is that determining whether a situation amounts to genocide or crimes against humanity is a matter for competent national and international courts, after consideration of all the available evidence.

I will be very brief. Will my hon. Friend now commit the Foreign Office and the Government, given that they do not want to say genocide, to co-operating with and giving full evidence to the Uyghur tribunal led by Sir Geoffrey Nice? Can he now give that commitment that they will co-operate and give evidence? It will define genocide, and then the Government could sign up to it.

I have made our position clear. Incidentally, I have met Sir Geoffrey Nice. I met him yesterday, along with Lord Anderson of Ipswich. We had a very constructive dialogue, and we will continue to have dialogue with Sir Geoffrey. Our policy is that a competent court should determine genocide. Sir Geoffrey is an eminent lawyer and he has done fantastic work in this area, but his tribunal is of course not a criminal court. That is our policy.

What I will say to my right hon. Friend is that competent courts include international courts such as the ICC and the International Court of Justice, and national criminal courts that meet international standards of due process.

Genocide and crimes against humanity are among the most egregious of all international crimes. We believe —my hon. Friend the Member for Gedling (Tom Randall) concurred with this in his powerful speech—that the question of whether they have been committed is for a competent court of law to decide. Genocide and crimes against humanity are subject to a restrictive legal framework under international law. In particular, a finding of genocide requires proof that relevant acts were carried out with the intent to destroy, in whole or in part, a national, ethnic, racial or religious group. Proving such intent to the required legal standard can be incredibly difficult to achieve in practice.

For these reasons, we do not believe it is right for the Government to make a determination in this, or in any other case where genocide or crimes against humanity are alleged. Parliaments in Canada and the Netherlands have passed motions saying it is a genocide, but the Dutch Prime Minister’s party voted against the motions and Prime Minister Trudeau’s Government abstained.

The United Kingdom is committed to seeking an end to serious violations of international human rights law wherever they occur, preventing the escalation of any such violations and alleviating the suffering of those who are affected. Our approach has not prevented us from taking robust action to address serious human rights violations, as we have done and will continue to do in the case of Xinjiang. We are also committed to ensuring that, where allegations are made, they are investigated thoroughly, including, where appropriate, independent international investigation by relevant bodies and experts. The Foreign Secretary has been clear that we wish to see the UN commissioner for human rights or another independent observer have full and unrestricted access to Xinjiang to investigate the situation on the ground. Today, I again call on China to grant that without further delay.

A number of colleagues mentioned the issue of the winter Olympics. The Prime Minister has made it clear that we are not normally in favour of sporting boycotts, and of course the participation of the national team at the Olympics is a matter for the British Olympic Association, which is required to operate independently of the Government under International Olympic Committee regulations. The hon. Member for Lewisham East (Janet Daby) mentioned the recent announcement of the official development assistance cuts in China. We have cut the budget to China by 95%, but every single penny of the remaining budget for China will be spent solely on open societies work and human rights work.

The Government understand the strength of feeling on this issue and share the grave concerns expressed by Members. I commend the efforts of hon. and right hon. Members to draw attention to the deeply troubling situation in Xinjiang. We have taken robust action. We have introduced sanctions, we are tackling Uyghur forced labour in UK supply chains, and we are ramping up pressure on Beijing through UN human rights bodies. We will continue to work with international partners to hold China to account for its gross violations of human rights against Uyghurs and other minorities in the region.

We are at the heart of discussions about global challenges and mega-trends, including through the UK’s G7 and COP26 presidencies. On clean growth, we will harness those presidencies to advance our climate agenda in the run-up to COP26. On artificial intelligence, in September, the UK signed a declaration with the US to drive technological breakthroughs in AI. This puts the UK at the forefront of the AI and data revolution. On science, the UK has strong science collaboration arrangements with more than 50 countries, from the research powerhouses of the US and Europe to emerging economies.

Through my work with the Prime Minister’s taskforce on innovation, growth and regulatory reform, we are looking at how we can make Brexit a real opportunity for the UK as a global science and innovation superpower to better integrate our aid and trade and to boost R&D investment, inward investment, exports and sustainable global development. Does the Minister agree that, to help developing nations to confront the biggest global grand challenges of sustainable agriculture and development, as set out in the Foresight report, including the challenge of nearly doubling world food production on the same land area with half as much water and energy, we could use variable tariffs to incentivise high-quality production, and UK aid to support tech transfer of UK agritech and clean tech for sustainable growth?

I thank my hon. Friend for all the work he does in this area. Nowadays—and when he was an excellent Minister—we provide preferential tariffs for 70 developing countries through the generalised scheme of preferences. This includes a framework covering implementation and international environment conventions. We are supporting international research partnerships and the roll-out of agritech across the poorest and most climate-vulnerable countries. This is delivering crop varieties that are more productive, nutritious and resistant to drought and pests. Our clean tech investments are enabling UK battery pioneers to develop new technologies and business models to deliver clean energy in Africa.

The violent crackdown and killing of peaceful protesters in Myanmar are completely unacceptable and require a strong message from the international community. The UK secured G7 statements on 3 February and 23 February, as well as a United Nations Security Council presidential statement on 10 March. In response to the military’s appalling human rights violations, the UK has imposed sanctions on two key military-linked entities that fund the military’s actions and on nine senior military figures, including the commander-in-chief.

I thank the Minister for his answer. Can I impress upon him the plight of the people in Myanmar and the need to do all in the power of the Government to assist them? Do the Government intend to review the process of administering sanctions, which is often slow and difficult? Will he inform the House as to what talks are being held with other Governments, particularly those in Asia, to ensure a united approach is being taken to sanctions on the Myanmar regime?

I thank the hon. Member for her question. When we impose sanctions, we have to make sure that they are done on a properly solid legal basis. The Foreign Secretary recently travelled to Brunei and Indonesia and attended the second United Kingdom-Association of Southeast Asian Nations meeting of Foreign Ministers. We made clear our views on the coup in Myanmar and the senseless violence against civilians. We welcome ASEAN’s unique role in addressing the crisis and support its call for an end to the violence and for restraint and a peaceful resolution.

The people of Myanmar desperately need help. Medical staff such as my constituent Dr Thomas Lamb have been actively persecuted—including through arbitrary detention, torture and death—simply for attempting to treat peaceful protesters. Following the coup d’état in February, my constituent saw at first hand the atrocities committed by the junta, such as the use of gunfire and the forcible removal of innocent civilians from their homes. During his meetings with the military junta’s Foreign Minister, has the Minister raised the killings of more than 700 innocent Burmese civilians? Will he now follow the lead of Canada and the Netherlands and formally join the Gambia’s genocide case against Myanmar at the International Court of Justice?

We have been clear that we are completely steadfast in our opposition to the coup. What is happening to innocent civilians in Myanmar is obscene. We have demonstrated our strong international leadership, including at the UN Security Council and the G7. We are clear that there should be accountability for the military’s acts, both historic and recent, and that all options, including referral to the International Criminal Court, should be on the table.

The Labour party stands with the pro-democracy protesters in Myanmar, who have shown extraordinary courage in resisting the barbaric brutality of the military junta. The UK Government’s response has lacked both strength and urgency. The Minister mentioned the ASEAN conference, but the tweet put out by the Foreign Secretary shortly after that conference made no mention whatsoever of what has been happening in Myanmar; will the Minister say a little more about why? Also, 42 nations have an arms embargo against Myanmar; will the Government commit today to writing to every other UN nation asking them to join that arms embargo? Will the Foreign Secretary publicly call for the orchestrators of the atrocities that we are witnessing in Myanmar—

We are clear that countries should not sell arms to the Myanmar military. We played a key role in securing and strengthening an EU arms embargo following the 2017 Rohingya crisis. The Foreign Secretary welcomed ASEAN’s unique role in addressing the crisis, in line with the purpose and principles enshrined in the ASEAN charter.

(Urgent Question): To ask the Secretary of State for Foreign, Commonwealth and Development Affairs if he will make a statement on recent sanctions imposed by the Chinese Government on UK citizens.

The Government stand in complete solidarity with those sanctioned by China. As the Prime Minister and Foreign Secretary have made clear, this action by Beijing is utterly unacceptable and unwarranted.

The House will recall that on 22 March, the UK, alongside the EU, Canada and the United States, imposed asset freezes and travel bans against four senior Chinese Government officials and one entity responsible for the violations that have taken place and persist against the Uyghur Muslims in Xinjiang. In response, China sanctioned nine individuals and four organisations, including Members of this House and the other place, who have criticised its record on human rights. It speaks volumes that while 30 countries are united in sanctioning those responsible for serious and systematic violations of human rights in Xinjiang, China’s response is to retaliate against those who seek to shine a light on those violations. It is fundamental to our parliamentary democracy that Members of both Houses can speak without fear or favour on matters of concern to the British people.

The Prime Minister and the Foreign Secretary have made absolutely clear the Government’s position through their public statements and on 22 March. I also summoned China’s representative in the UK to the Foreign, Commonwealth and Development Office to lodge a strong, formal protest at China’s actions. This Government have been quick to offer support to those who have been sanctioned. The Prime Minister and the Foreign Secretary held private meetings with the parliamentarians named in China’s announcement. My noble Friend, the Minister for human rights, Lord Ahmad, met other individuals and the entities that have been targeted. Through this engagement, we have provided guidance and an offer of ongoing support, including a designated FCDO point of contact and specialist briefing from relevant Departments.

Just as this Government will be unbowed by China’s action, I have no doubt that Members across this House will be undeterred in raising their fully justified concerns about the situation in Xinjiang and the human rights situation in China more broadly. I applaud the parliamentarians named by China: my hon. Friends the Members for East Worthing and Shoreham (Tim Loughton), for Tonbridge and Malling (Tom Tugendhat), for Harborough (Neil O’Brien) and for Wealden (Ms Ghani), my right hon. Friend the Member for Chingford and Woodford Green (Sir Iain Duncan Smith), the noble Lord Alton and the noble Baroness Kennedy for the vital role they have played in drawing attention to the plight of the Uyghurs and other minorities in Xinjiang.

This Government have worked with partners to build the international caucus of those willing to speak out against China’s human rights violations and increase the pressure on China to change its behaviour. We have led joint statements at the UN’s human rights bodies, most recently joined by 38 countries at the UN General Assembly Third Committee in October, and we have backed up our international action with robust domestic measures. In addition to the global human rights sanctions announced on 22 March, the Foreign Secretary announced a series of targeted measures in January to help ensure that British businesses are not complicit in human rights violations in Xinjiang. The United Kingdom will continue to work alongside its partners to send the clearest possible signal of the international community’s serious concern and our collective willingness to act to hold China to account for its gross human rights violations in the region.

Mr Deputy Speaker, I thank the Speaker for granting this urgent question and for his robust support, together with that of the Lord Speaker, the Prime Minister, the Foreign Secretary and the Minister today. I suppose I need to declare an interest as one of the five right hon. and hon. Members of this House who have been placed on the Chinese Government’s sanctions list, apparently for “maliciously” spreading “lies and disinformation”; in the language of the Chinese Communist party, of course, that is a euphemism for speaking the truth. As parliamentarians we have been singled out, together with Lord Alton and Baroness Kennedy of The Shaws, presumably for our vociferous calling out of the genocide against the Uyghur people by the Chinese Government, the industrial-scale human rights abuses in Tibet and the suppression of free speech and liberty in Hong Kong. That is what parliamentarians do, without fear or favour, in a democracy. To be sanctioned by a totalitarian regime is, therefore, not only deeply ironic and laughable, but an abuse of parliamentary privilege of this House, by a foreign regime.

What further action are the Government considering against the Chinese Government to emphasise how unacceptable and unfounded their action is? Will the Minister assure the House that the Government will not be proceeding with any new agreements with the Chinese Government while these sanctions remain in place?

The other individuals named were Newcastle University academic Dr Jo Smith Finley and Uyghur expert lawyer, Sir Geoffrey Nice QC. Does the Minister agree that this also represents an attack on academic freedom and the independence of the legal profession in the United Kingdom? What support are the Government offering to those two individuals?

Given growing concerns about the malign influence of the Chinese Government in sensitive research projects in our universities, the sinister tentacles of the Confucius institutes on campuses and increasingly in our schools, not to mention the wide-scale buying of influence in UK boardrooms, will the Government commit to a detailed and transparent audit of Chinese influence in our education system, our military capability, our business and our infrastructure projects, and, if found to be acting against British interests, send them packing?

Given the disgraceful recent dressing-down of our ambassador in Beijing for supporting on social media the role of a free press, will the Minister confirm that British diplomats will not be bowed and will be fortified in calling out abuses by the Chinese Government wherever they happen, as we sanctioned parliamentarians have been fortified to call out the abuses of the totalitarian Government in China by their badly-thought-out and counterproductive use of sanctions, which we will wear as a badge of honour? Will the Minister signal, clearly and firmly, that project kowtow is over and that Britain will not flinch from standing up and calling out Chinese Government abuses, which they have got away with for far too long?

I thank my hon. Friend for his questions and for his bravery in the work that he and other right hon. and hon. Members have done, which led to these extraordinary measures by China.

We have been absolutely clear with China that its sanctioning of UK individuals and entities is unwarranted and unacceptable. My hon. Friend is right to shine a light on these measures. We will not allow this action by China—neither will our diplomats—to distract attention from the gross human rights violations in Xinjiang. We will continue to work alongside our partners to send the clearest possible signal of the international community’s serious concerns and our collective willingness to act.

My hon. Friend mentioned Jo Smith Finley, who is another of the individuals named. Academic freedom and freedom of speech are fundamental UK values and a cornerstone of the world-class UK higher education system. The attempt to silence those highlighting human rights violations in Xinjiang in academia is absolutely unwarranted and unacceptable. We are offering support to Jo Smith Finley, as we will and have for all those impacted by these sanctions.

The Labour party stands in solidarity with the nine British citizens, including Members of both Houses, who have been sanctioned by the Chinese Government solely for calling out Beijing’s appalling human rights abuses against the Uyghur people in Xinjiang. We welcome the Prime Minister’s invitation to those who were sanctioned to meet him, and we hope that the Government are providing those individuals with adequate advice and support. However, we are deeply concerned about the rank hypocrisy and inconsistency in the Government’s actions regarding China.

When Beijing introduced the Hong Kong national security law last summer, the UK withdrew from two UK-China Government investment forums: the joint trade and economic commission and the economic and financial dialogue. However, it is reported that those forums are now reopening. Will the Minister confirm that?

On Hong Kong, does the Minister now agree with the Opposition that British judges who serve in Hong Kong are only lending a veneer of credibility to a broken system and that they should therefore withdraw? Lord Reed’s review was announced in November. When will its conclusions be published? Where are the Magnitsky sanctions against Carrie Lam and the human rights violators in Hong Kong?

In January, the Foreign Secretary said that “we shouldn’t be” doing trade deals with countries committing human rights abuses

“well below the level of genocide”,

yet the Government whipped their MPs against the genocide amendment to the Trade Bill. Will the Minister explain that rank hypocrisy and why the Foreign Secretary says one thing in public and something else altogether in private? The Government claim to be alive to the threat that Chinese state-backed investment poses to Britain’s economic security and prosperity, so why on earth is the Business Secretary weakening our defences by watering down the National Security and Investment Bill? Today, Taiwan suffered the biggest Chinese military incursion into its airspace to date of 25 planes. What conversations is the Minister having with his counterparts about that worrying development?

It is clear that the Government have no strategy on China at home and no strategy on China abroad. Will they now commit to an audit of every aspect of the UK-China relationship so that we can finally call time on the Conservatives’ failed golden era strategy and replace weakness, division and inconsistency with an approach that is instead based on strength, unity and consistency?

I thank the hon. Gentleman for his questions. The reality is that the UK has always wanted a mature, positive relationship with China. That has to be based on mutual respect and trust. There is still considerable scope for constructive engagement and co-operation, but we will not sacrifice our values or our security. It is worth getting it on the record that China is an authoritarian state with different values from the UK. We continually act on matters on which we do not agree, including human rights and Hong Kong.

The hon. Gentleman mentioned Hong Kong. The prosperity and way of life for Hongkongers relies on respect for fundamental freedoms, which includes an independent judiciary and the rule of law. We are fully committed to upholding Hong Kong’s high degree of autonomy and rights and freedoms under the joint declaration. On the national security law, the imposition of the new rules including disqualifying elected legislators and changes to election processes, clearly constitutes a serious breach of the joint declaration. We consider Beijing to be in a state of ongoing non-compliance with the Sino-British joint declaration.

On Taiwan, yes, we are clearly concerned by any action that raises tensions in the Taiwan strait and risks destabilising the status quo. We have a long-standing policy that the Taiwan issue needs to be settled peacefully by the people on both sides of the Taiwan strait through constructive dialogue. We continue to work with Taiwan constructively on economic trade, education and cultural ties, and I think our relationship brings huge benefits to both the United Kingdom and Taiwan.

I thank Mr Speaker for his opening statement of support, which is absolutely right, and the Minister for his response. Surely the key question is: where do we go with our relationship with China? China has sanctioned, without reason, British politicians, people beyond the political sphere and organisations. It has also sanctioned people in Europe and in America. Surely it is now time for the Government to lead our allies in Europe and the United States in saying to China that there can be no preferential trade, economic or commercial deals done while our citizens are sanctioned. Will the Minister resist any moves by any other part of Government to water down any of the measures in the new National Security and Investment Bill, which is going through Parliament?

I commend my right hon. Friend for his continued work on this subject. The Government see China’s increasing international assertiveness at scale as potentially the most significant geopolitical shift in the 2020s, but it is vital that we co-operate with China to tackle the most important challenges facing this generation, not the least of which is climate change. We will do more to adapt to that growing impact and to manage our disagreements. We need to defend our values but co-operate where our interests align. We must pursue a positive economic relationship as well as tackle global challenges. I said in response to a previous question that the House should be in no doubt that China is an authoritarian state, with different values from those of the United Kingdom. We will continue to act on matters on which we do not agree, including human rights and Hong Kong.

As Members have said, the sanctions fit into a wider pattern of action that Beijing has been taking forward across the European continent and the US, reaching beyond politics and into academia and elsewhere. From the perspective of the Scottish National party, the whole point of democracy is that we can disagree, if not as friends then certainly as colleagues, and I have no hesitation in expressing our total support and total solidarity with the right hon. and hon. Members across the House and those elsewhere who have been sanctioned in this way. I am quite sure it will not silence them; it certainly will not silence SNP politicians in the Scottish Parliament or in this place.

Beijing has taken advantage of mixed signals from the UK Government. Although the Government have not done nothing, they could be tougher. It was a Conservative Government who whipped their own Members against a genocide amendment to the Trade Bill—a matter of great regret—and the UK still does not define the situation in Xinjiang as genocide. Does the Minister not agree that we need to be tougher on this? It is high time that the UK Government follow the lead of others, define what is happening in Xinjiang as genocide and make it clear that the UK will not do business with genocidal regimes anywhere?

The amendment to the Trade Bill that was passed is consistent with our long-standing policy that any judgment on whether genocide has occurred is a matter for a competent court, rather than for Governments or non-judicial bodies, and should be decided after consideration of all the evidence available in the context of a credible judicial process.

I want to put on the record my thanks to Mr Speaker for his robust support. He fully understands that sanctioning MPs was not only about intimidating us, but about threatening the integrity of this House.

It is absurd for MPs to be sanctioned for producing a Select Committee report that talks about slave labour in Xinjiang. My question to the Minister is this: if we know that the United Nations is broken when it comes to determining genocide, what are we to do now that the Chinese communist party has decided to sanction those Members who dared to speak about it? The Minister spoke about the work the Government are doing with businesses to make sure that modern slavery is not in supply chains, but that is now worthless, because every business doing the right thing that was identified in our report is now being threatened by the Chinese communist party.

Finally, alongside many colleagues, I led on the genocide amendment to the Trade Bill. Although it is good that the Government’s compromise tackled genocide, it is shameful that it excluded the Uyghur. I do not expect a change in the law, but I do expect the Minister to say that the Uyghur people can now come forward in any process in this place that is established to see whether genocide is taking place.

I thank my hon. Friend for her persistent work in this area. She—and other colleagues and entities that have been sanctioned—obviously have the full support of the Foreign Office. I know that her work on the issue of genocide has been long standing, but I do think the Government’s amendment to the Trade Bill is consistent with our policy. Select Committees will be able to come up with a report that the Government have to consider. Depending on the response of the Select Committees, that could very well lead to a meaningful debate on the Floor of the House.

The Liberal Democrats offer full solidarity with colleagues and organisations who have been sanctioned for daring to speak out against atrocities committed by China. If the purpose of those sanctions was to try to muzzle them, I am sorry to say that all it has done is made all of us even more determined to speak truth to power in this place.

On 8 April, US Senate Foreign Relations Committee chairman Bob Menendez announced a bipartisan agreement on new comprehensive China legislation. What consideration has the Minister given to seeking cross-party support for a comprehensive and nuanced new foreign policy settlement towards China that protects democracy and human rights? As he will have seen from the strong support for the genocide amendment to the Trade Bill, such a settlement would be welcomed across the House.

Four months ago, the Foreign Secretary initiated a small, interdepartmental, Minister-led group on China, working on the exact point raised by the hon. Lady. It is absolutely right that we react after seeing China’s increasing international assertiveness in recent years. As I said previously, these are some of the most significant geopolitical shifts that we have seen in the 2020s. We will continue to hold China to account by bringing together the coalition through statements at the UN, and by working with and having alongside us 30 countries regarding the measures that we recently announced that have led to these sanctions. That should give the hon. Lady some comfort that the UK Government are working together with our international partners to shine a light on these gross violations.

My hon. Friend is spot on. That would help to clear up a lot of these issues. The Foreign Secretary has made it clear that the UN High Commissioner for Human Rights or another independent fact-finding body must be given unfettered access to Xinjiang to check the facts. We have called for this repeatedly in joint statements and national statements at the UN. It is vital that China allows such access without delay. If, as China claims, these allegations are fabrications and falsehoods, how can it object to granting access?

China sees the UK Government refusal to allow our courts and Parliaments to make judgments about genocide in relation to trade agreements as a sign of weakness, and its sanctions against UK citizens is the latest move to show that it will suppress democracy, abuse human rights and flout the rule of law. Since bullies only respond to strength, will the Government now use their chairing of COP26 and the G7 to bring unity in our trade and financial agreements to strongly support our shared values and our shared environment?

The hon. Gentleman raises a point about genocide that I have answered on previous questions. We are absolutely committed to ensuring that our trade policy is consistent with our international obligations, and it is absolutely clear that more trade does not have to come at the expense of human rights. We have a high level of ambition for our trade and investment partnership with China, but it should not come at the expense of human rights.

Many in Newport West were delighted by the election of Joe Biden and Kamala Harris, and I for one was among them. The Minister will know that the American Government have taken action where we have not, so can the Minister be clear? He has already been asked the question, but I was not clear on his answer. Does he intend to bring forward further sanctions on other entities and more senior individuals in relation to the appalling situation in Xinjiang? A simple yes or no will do.

We have acted to hold to account senior officials and a senior organisation responsible for the human rights violations taking place in Xinjiang. We have also acted with 30 other countries on an agreed set of designations. We have increased the reach and impact of these measures, and we have sent the clearest possible signal of the international community’s serious concern and collective willingness to act. As I have said many times at this Dispatch Box, it is not particularly wise to speculate on further such designations.

My hon. Friend is spot-on, and I agree with her. That is why on 12 January we announced a series of measures to help ensure UK businesses and the public sector are not complicit in human rights violations in Xinjiang. These measures target in a forensic way those profiting from forced labour or those that would financially support it, whether deliberately or otherwise.

I thank the Minister for his response. I spoke to the Minister beforehand, so he knows my question in advance. Will he further outline what support has been offered to those who have left China and Hong Kong and taken up UK citizenship? They are being called by the Chinese embassy to pick up letters—as my constituents have been over the last few weeks—with no further information about what is in the letters or even the need for them to attend in person to pick up the letters. They have been shaken by this secrecy and what some of them term as the “threat” of these letters. This is happening right here in the United Kingdom of Great Britain and Northern Ireland.

I thank the hon. Member for his point, and up until a few minutes ago I was not aware of the reports to which he refers. He will know the level of support we are offering to those coming from Hong Kong, not least the £30-some million announced by the Ministry of Housing, Communities and Local Government last week, to help people assimilate within communities. If he were to write to me formally with more detail, I would be more than happy to provide a full response or indeed to meet the hon. Member.

When it comes to the call to accuse China of genocide in Xinjiang, I am reminded of the work of Evelyn Beatrice Hall, who wrote in “The Friends of Voltaire”, as an illustration of Voltaire’s beliefs:

“I disapprove of what you say, but I will defend to the death your right to say it”.

Therefore all of us, perhaps especially those of us who have had China visas denied in the past for alleged misdemeanours, should show our solidarity with colleagues so sanctioned.

Does the Minister agree with the statement made the other day by the former Foreign Secretary William Hague? He said that

“it’s very important to find a framework of co-operation even with a rival power when there’s so much at stake in the world on climate change, arms control and on the future stability of the financial system.”

Does my hon. Friend agree that this has to be the way forward?

My hon. Friend speaks with a great deal of experience on China. It is the case that China has different values from the United Kingdom, and as I have said, its increased international assertiveness is the most significant geo-political shift in recent years. A recent publication on international relations highlights that we will do more to adapt to China’s growing impact. We need to manage those disagreements, defend our values, but co-operate where those interests align. That includes pursuing the positives. As the former Foreign Secretary William Hague pointed out, this is a difficult balancing act, but we must pursue a positive economic relationship. That includes tackling all sorts of other challenges, but we have to call out China when it commits human rights violations. In great contrast to the sanctions that China has placed on right hon. and hon. Members, the sanctions that we issued, alongside our international partners, were thought out. They took some time to deliver, but they had a legal basis to them, contrary to the recent sanctions on our colleagues that we have seen from China.

I, too, put on record my thanks to Mr Speaker for granting this Urgent Question. The Foreign Secretary described what is happening in Xinjiang as

“barbarism we had hoped was lost to another era”—[Official Report, 12 January 2021; Vol. 687, c. 160.]

The growing evidence of Uyghur Muslims being repeatedly violated and used as slaves to farm cotton is indeed barbaric. When will the House be presented with Government legislation to firm up section 54 of the Modern Slavery Act 2015, so that all companies have a responsibility to prove that their supply chains are free from forced labour, and to reinforce sanctions for non-compliance?

I thank the hon. Lady for her question and for her support of the Government policy that will come forward to the House. Evidence of the scale and severity of the human rights violations being perpetrated in Xinjiang against the Uyghur people is far reaching and, as I am sure she will agree, paints a truly harrowing picture. We are looking forward to hearing about further measures, but hon. Members should be in no doubt that the Government will take action to ensure that slave labour is not used in any United Kingdom supply chains.

We have made it clear that we regard China’s attempts to silence those who highlight and shine a light on human rights violations in Xinjiang as unwarranted and unacceptable, and we stand in solidarity with all those sanctioned by China. Freedom of speech is a fundamental part of our British democracy. Can my hon. Friend confirm that he unequivocally supports the right of Members of this House to criticise China over human rights abuses? My hon. Friend is absolutely right. The fundamental difference between our two countries is that parliamentarians in the United Kingdom have freedom of speech and are allowed to raise issues in this place and outside it without fear or favour—that is the fundamental difference that China does not quite seem to understand. Its attempt to silence those highlighting violations in Xinjiang is not only, frankly, ridiculous; it is unacceptable and unwarranted. The Prime Minister has made it clear that the freedom of parliamentarians to speak out in opposition to human rights violations is fundamental, and that is why this Government stand firmly with all those who have been sanctioned.

The Chinese approach to geopolitics is grim to behold. At the United Nations, scores of countries have signed up to China’s distorted view of human rights. What is the UK doing at the United Nations to build an alliance that will take on China when it needs to be taken on?

The hon. Member raises a good point. As we have heard, this is a big year for the United Kingdom on the multilateral stage. We have built alliances. To be able to get 38 countries supporting our statement last October in the UN and to pull together an international caucus, with a number of countries that has risen from the early 20s to the late 30s, is by no means a small achievement. The ability also to work with international partners—every country in the European Union, the United States and Canada—to deliver the announcement the other week on our global human rights sanctions is a significant achievement.

May I associate myself with the tributes paid to Cheryl Gillan, the late Member for Chesham and Amersham? She was a dear friend, and we will miss her.

Does my hon. Friend agree that the Members who have been sanctioned by the Chinese, be they hon. or right hon. Members, are heroes of this Parliament for speaking up for free speech? Is this not just a thinly veiled attempt to distract the public from the horrific crimes that the Chinese Government are committing against not only the Uyghurs but other minority communities in China?

I agree wholeheartedly with my hon. Friend’s remarks about our former colleague Cheryl Gillan. I was her Whip for a time when I first became a Whip. I had not realised that Cheryl had also been a Whip and knew how the game worked, and she very politely reminded me of that. I remember her telling me, “If you need to be bothering me as a former Whip over this particular vote, Nigel, then you really are in trouble as a Government.” She will be sorely missed.

I also wholeheartedly agree with my hon. Friend’s comments about whether this is a thinly veiled attempt to distract attention from the horrific crimes. Well, of course it is. I agree 100% that we must not let this action by China distract from the horrific violations taking place in Xinjiang. We will continue to work with our international partners to send the clearest possible signal that the international community has a collective willingness to act.

I shared a room with Dame Cheryl for a period of time, and it just shows the strength of Dame Cheryl that she was able to put up with me for so long. We sat on the Council of Europe together and, Dame Cheryl, we are going to miss you greatly.

I thank the Minister for responding to the urgent question, which, as the Speaker intimated, hits at the very heart of the democracy in this country. We are now going to suspend for three minutes.

It is a pleasure to serve under your chairmanship here this afternoon, Mr Efford. The Minister for Civil Society would love to have replied to this debate, but she is travelling on FCDO business, so I am afraid hon. Members will have to put up with me in her place. I will do my best to fill her considerable boots.

I am incredibly grateful to the hon. Member for Strangford (Jim Shannon) for securing this debate. It is always a pleasure to listen to him speak and to hear his wisdom on these matters. He speaks with great authority. May I also add my birthday congratulations? It is a real shame that he is not here today, because I brought a card for him. I will pop it in the internal post for my hon. Friend—indeed, my friend.

I commend his ongoing work as chair of the all-party parliamentary group on freedom of religion or belief. It continues to raise the profile of this human right to parliamentarians and, importantly, to the public. I thank all hon. Members for their contributions. The hon. Member for Cardiff South and Penarth (Stephen Doughty), the Opposition spokesman, brings with him a depth of knowledge, having worked in the sector. We are incredibly grateful for the commitment to the causes and the ongoing work that he does.

The integrated review, which was published last week, sets out our renewed commitment to the UK as a force for good in the world. It is our goal to defend open societies, democracy and human rights. For open societies to develop and thrive, they need an inclusive civic space and a vibrant civil society, and for that reason, NGOs and faith-based groups are essential partners. These partnerships can open a dialogue with and provide support for the world’s most marginalised people. This is particularly true, as we have heard this afternoon from hon. Members, during the pandemic. As covid-19 continues to affect communities around the world, we continue to take a leading role in this response.

We have committed up to £1.3 billion of ODA to counter the seismic impact of the pandemic. Nearly £70 million is going directly to international and UK-based charities to support vulnerable communities to recover and to rebuild. There is a great deal of work going on, but, as we have heard in the informed speeches this afternoon, the challenges of the pandemic run deep.

As hon. Members have said, we have had to take an incredibly tough but temporary decision to reduce our spending on overseas development. In real terms, as hon. Members will know, we will still be spending more than £10 billion to fight poverty and climate change. That money is to help improve global health and achieve the UN sustainable development goals. I appreciate that the hon. Member for Cardiff South and Penarth wants more detail about potential reductions in funding in this regard. At this time, I cannot confirm such details, but hopefully clarity will be given in the coming weeks. So we understand the challenges for the sector and the need for clarity—that is absolutely clear—and although this is a complex process, the Government commit to sharing details, as I have said, as soon as is practically possible.

Together with NGOs, faith-based groups and religious leaders, we are continuing to deliver for those most in need, in order to keep essential services going at this time. Through our partnership with Unilever—the Hygiene & Behaviour Change Coalition—the UK Government are providing up to £50 million to mount a rapid response to covid-19 in 37 low and middle-income countries. Through this programme, charities including World Vision, which the hon. Member for Cardiff South and Penarth once worked for, WaterAid and ActionAid are delivering evidence-based hygiene messages to vulnerable communities. This type of support plays a vital role in stopping the spread of the disease in the developing world and will also potentially limit its further spread in the UK.

My hon. Friend the Member for Strangford asked about the humanitarian response to covid-19. Through our rapid response facility, we have allocated £80 million to support UK and international humanitarian charities, including Christian Aid, to meet the basic needs of some of the world’s most vulnerable people. That includes those suffering from multiple crises in Yemen, Afghanistan and Somalia.

Last summer, the British public generously donated more than £10 million to the Disasters Emergency Committee appeal for covid-19, and the UK Government have provided match funding to double that amount. The appeal is funding the work of the British Red Cross and CARE International UK, among others. These charities are tackling the impacts of the pandemic on displaced people, including those in the Rohingya refugee camps in Bangladesh. They are providing frontline doctors with equipment and supplies to care for the sick, and giving families clean water and soap to stay healthy.

We are committed to delivering our aid according to internationally recognised humanitarian principles. Those principles ensure that aid gets to those who are most vulnerable and most urgently in need of help, irrespective of race, religion or ethnicity. This issue was raised by the hon. Member for Strangford, and this group includes minority religious communities, who are assessed by our partners when they are determining those most in need of protection and assistance. And as the hon. Member also mentioned in his excellent speech, churches and other faith groups are providing essential services around the world during the pandemic.

We know that faith-based networks can reach the most remote communities and involve the world’s poorest people in their social, economic and political life. They can reach people who are largely untouched by secular institutions, such as persecuted religious minorities, which is vital, because these groups may experience crises such as covid-19 outbreaks differently from others. Such crises may reinforce their marginalisation, multiply their experience of discrimination, violence and stigma, and further limit their access to essential support and services. We are currently funding more than 200 projects that are managed by 126 different faith-based groups, organisations and churches. Our support totals £130 million annually and spans 39 countries.

The hon. Member for Cardiff South and Penarth rightly mentioned many of the great projects around the globe, many of them in conflict areas. The majority of our partners are small in-country groups deeply rooted in local communities, such as the Christian Association of Nigeria and the Jamaica Baptist Union. In many countries, the indirect health, humanitarian and economic impacts of the pandemic are being felt very keenly, as they exacerbate pre-existing problems. They are reversing years of development gains in areas such as poverty reduction, gender equality, girls’ education and sexual and reproductive health and rights. With our support, faith-based groups are working to counter that trend.

The hon. Member for Strangford asked that funding be prioritised to reach the most marginalised, and he is correct. The UK is committed to delivering aid according to its internationally-recognised humanitarian principles. Those principles ensure that aid gets to those who are the most vulnerable and most urgently in need, irrespective of race, religion or ethnicity. They provide health and education, empower people to hold their Governments to account and strengthen resilience to disaster and conflict. Through our support to Christian Aid, we are enhancing nutrition for women of childbearing age and under-fives in South Sudan, our funding to CAFOD is building community resilience to climate shocks in Eritrea, Zambia and Zimbabwe and we have supported Tearfund to provide secure livelihoods for women in the Central African Republic.

The hon. Member for Cardiff South and Penarth referred to transparency. We have a world-renowned reputation on transparency. We are committed to aid transparency both legally and publicly, and we are committed to the publication of quality, accessible information on our aid programmes, which is available on the Development Tracker, along with the continued independent scrutiny of the Independent Commission for Aid Impact.

The pandemic has undoubtedly brought out the best in many communities around the world. Nevertheless, there has also been a concerning increase in hate speech and a rise in conspiracy theories, which the hon. Member for Strangford referred to, such as that certain faiths are to blame. I take this opportunity to reaffirm the Government’s steadfast commitment to championing freedom of religion or belief for all, and to promoting respect between different religious and non-religious communities. The UK’s recently appointed special envoy for freedom of religion or belief, my hon. Friend the Member for Congleton (Fiona Bruce), will continue to advance that important agenda.

My ministerial colleague, Lord Ahmad, also regularly meets civil society and faith-based development organisations to hear about the challenges minority faith communities face, particularly during the pandemic. The UK Government are deeply concerned by the severity and scale of violations and abuses of freedom of religion or belief in many parts of the world, and we will continue to refute those divisive and harmful claims.

We will also continue to put our money where our mouth is on hate speech. The FCDO is funding an Institute of Development Studies project that works with minority religious groups in Africa and Asia, doing vital work in challenging narratives and countering hate speech relating to minorities and the spread of covid-19. We are also working with the University of Oxford and parliamentarians in nine countries to reduce the use of language during elections that intimidates minority religious groups.

I think I heard the hon. Member for Argyll and Bute (Brendan O’Hara) extending an invitation to me to visit Togo to see the great work that is being done there. I would love to take that up but, unfortunately, I am the Minister for Asia, not the Minister responsible for this particular brief. I will ensure that my colleague hears about it, and I am sure she will be very keen to see the great work that is going on in that regard.

The effects of the pandemic have been far-reaching and will continue to have an impact on our lives for some time. The UK will remain at the forefront of the international response as we recover and rebuild in the wake of covid-19. We will be a force for good in those places most in need and for the most vulnerable communities. Our effectiveness will rely on the expertise of our partners, the NGOs whose brilliant work has been described so well this afternoon and the faith-based organisations. Only with trusted people embedded in those communities most in need can we provide relief, promote recovery and build back the open societies that shape security and prosperity for us all.

I am particularly grateful to the hon. Member for Mitcham and Morden (Siobhain McDonagh) for securing this debate. I pay tribute to her for her work with the APPG. I also pay tribute to the many other Members across the House for their work on this important issue and for the many informed and passionate contributions that we have heard this afternoon. I will try to respond to as many of them as possible in the time I have, but I am conscious that I have to give the hon. Lady a couple of minutes at the end of the debate. The Minister for South Asia—the Minister that the hon. Member for Aberavon (Stephen Kinnock) wrote to—would have been delighted to take part in this debate, but obviously he sits in the other place so it is my pleasure to respond on his behalf and on behalf of the Government.

Human rights in Sri Lanka are an important issue and a long-standing priority both for the UK Government and for many fellow Members. This debate is timely, coming during the 46th session of the UN Human Rights Council, which began on 22 February. The human rights situation in Sri Lanka and the limited progress on reconciliation and accountability raised by many right hon. and hon. Members are deeply concerning. As the Opposition spokesman, the hon. Member for Aberavon, pointed out, in February last year the Government of Sri Lanka withdrew their support for the UK-led UN Human Rights Council resolution 30/1 and its successor resolutions 34/1 and 40/1. Those resolutions concerned reconciliation, transitional justice and accountability.

The Sri Lankan Government then announced a domestic mechanism on accountability. As with previous domestic initiatives, however, meaningful progress has yet to be delivered. There have also been a number of setbacks on accountability, including the appointment into Government positions of military figures accused of war crimes, as referenced by hon. Members this afternoon. As the right hon. Member for East Ham (Stephen Timms) pointed out, they also include the presidential pardon of former army sergeant, Sunil Ratnayake, one of the few perpetrators of war crime atrocities to have been convicted in Sri Lanka.

Other worrying human rights developments include the continued harassment and surveillance of minorities and civil society groups, as was pointed out by the hon. Member for Strangford (Jim Shannon), the increasing role of the military in civilian governance, and a constitutional amendment that has extended Executive control over the judiciary and the independent institutions. As the hon. Member for Slough (Mr Dhesi) pointed out, the Government’s policy of forcibly cremating those deceased due to covid, which has only recently been reversed, has particularly affected the Muslim and Christian communities. Even now, our understanding is that families face significant restrictions on where and how burials can take place.

The UK Government are deeply concerned by these developments. We have long stood by all the victims of the conflict in Sri Lanka. I was particularly taken by the comments made by the hon. Member for Glasgow North East (Anne McLaughlin), who had very personal recollections of that time. We have condemned LTTE terrorism and worked over many years to achieve post-conflict truth, accountability and transitional justice. Together with our international partners in the Core Group on Sri Lanka, the UK has led successive UN Human Rights Council resolutions on Sri Lanka in 2014, 2015, 2017 and 2019. In February, June and September of last year, we set out our continued support for the UN Human Rights Council framework and our growing concerns about the human rights situation in Core Group statements to the HRC.

Sri Lanka is a human rights priority country for the Foreign, Commonwealth and Development Office. In our annual reports, and in Lord Ahmad’s autumn ministerial statement, the Government have highlighted a number of important concerns, which have been highlighted here this afternoon. Accountability and human rights have also been integral to any bilateral discussions we have had with the Government of Sri Lanka. The Foreign Secretary underlined the importance of accountability when he spoke to the Sri Lankan Foreign Minister in May. Lord Ahmad, the Minister for South Asia and the Commonwealth, has also had numerous discussions with the Foreign Minister, most recently in January, and with the Sri Lankan high commissioner here in London.

We welcome the recent reports on Sri Lanka by the UN’s Office of the High Commissioner for Human Rights. We agree with the high commissioner that the Human Rights Council must continue to monitor the situation in Sri Lanka very closely and we must continue to press for accountability and reconciliation. Along with our Core Group partners, the UK, as penholder, has presented a new draft resolution on Sri Lanka at the UN Human Rights Council. The resolution aims to provide a continued framework for international engagement on human rights in Sri Lanka. The draft calls on the Government of Sri Lanka to make progress on accountability and human rights, and stresses the importance of a comprehensive accountability process for all violations and abuses committed in Sri Lanka. It aims to keep Sri Lanka firmly on the HRC agenda and requests OHCHR reporting on the human rights situation and, importantly, on accountability.

A number of right hon. and hon. Members, including the hon. Member for Mitcham and Morden and the right hon. Member for Kingston and Surbiton (Ed Davey), have called for an international accountability mechanism —a mechanism to collect and preserve evidence of human rights violations—as part of the resolution. I can confirm that our resolution strengthens the capacity of the OHCHR to collect, consolidate, preserve and analyse evidence. The resolution supports future accountability processes and builds on the investigations conducted under previous HRC resolutions. We are now working hard to build support for our draft, which we hope will be adopted next week.

Regrettably, the Sri Lankan Government have made clear their opposition to further substantive action by the HRC. None the less, we will continue to seek to work constructively with them on these issues. We will underline the importance of accountability and human rights in our dialogue with the Government of Sri Lanka. My right hon. Friend the Member for Epsom and Ewell (Chris Grayling), my hon. Friend the Member for Harrow East (Bob Blackman) and the hon. Members for Brent Central (Dawn Butler) and for Coventry North West (Taiwo Owatemi) raised the issue of the hunger strike carried out by Ambihai Selvakumar. We understand that, as has been pointed out, she was able to conclude her hunger strike two days ago. We absolutely recognise the concerns she has raised about the issues faced by the Tamil community in Sri Lanka. We have highlighted these concerns about the lack of progress towards post-conflict accountability and the wider human rights situation.

A number of hon. and right hon. Members raised the question of sanctions. We established the global human rights sanctions regime in July 2020, and in a statement to Parliament, the Foreign Secretary set out the full scope of the new regime without speculating, importantly, on future designations. We continue to consider further designations under this global human rights sanctions regime, and we keep all evidence and potential listings under close review.

I acknowledge and welcome the strength of feeling in the House. We are right to be concerned. We will continue to prioritise international efforts to support accountability and reconsideration at this current session of the Human Rights Council, and we are pushing very hard for our resolution to be adopted next week. I must reiterate that we cannot speculate on future designations under the global human rights sanctions regime.

Finally, I make it clear that we want a positive relationship with Sri Lanka. We share deep historical ties. We work well together on a number of common interests, such as climate change and covid recovery, and we value that partnership, but accountability and human rights must remain high on the agenda—accountability and human rights to provide justice for all the victims of the conflict and the lasting reconciliation and stability that will allow the people of Sri Lanka to prosper.

The United Kingdom is deeply concerned about the situation in Hong Kong and the erosion of rights enshrined under the Sino-British joint declaration. In response to these worrying developments, the United Kingdom has already taken decisive action. This includes offering a bespoke immigration path for British nationals overseas, suspending our extradition treaty with Hong Kong indefinitely and extending our arms embargo on mainland China to Hong Kong. The United Kingdom has led international action to hold China to account. As recently as 22 February, the Foreign Secretary addressed the UN Human Rights Council to call out the systematic violation of the rights of the people of Hong Kong, making it clear that free and fair legislative elections must take place with a range of opposition voices allowed to take part.

On the question raised by the hon. Member for Oxford West and Abingdon (Layla Moran), this week meetings of China’s National People’s Congress are taking place behind closed doors. We understand that the agenda includes proposals for changes to Hong Kong’s election processes. Although the detail is yet to be revealed, these measures might include changes to the election of the Chief Executive, the removal of district councillors from the Chief Executive election committee and the possible introduction of vetting for those standing for public office to ensure that they are described as patriots who govern Hong Kong. Such measures, if introduced, would be a further attack on Hong Kong’s rights and freedoms.

Ahead of possible developments this week, the United Kingdom has raised our concerns, including with the Chinese Ministry of Foreign Affairs, the Hong Kong Government and the Chinese embassy in London, as have many of our international partners. The Chinese and Hong Kong authorities can be in no doubt about the seriousness of our concerns. Given recent developments, including the imposition of the national security law last year, the imposition of new rules to disqualify elected legislators in November and the mass arrests of activists in January, we are right to be deeply concerned. We are seeing concerted action to stifle democracy and the voices of those who are fighting for it.

There is still time for the Chinese and Hong Kong authorities to step back from further action to restrict the rights and freedoms of Hongkongers, and to respect Hong Kong’s high degree of autonomy. We will continue working with our partners to stand up for the people of Hong Kong and hold China to its international obligations, freely assumed under international law, including through the legally binding Sino-British joint declaration.

Thank you, Madam Deputy Speaker, for granting this urgent question, and I would like to thank the Minister for his reply.

This Government have a duty to the people of Hong Kong to guarantee their rights and the integrity of their democratic institutions. The proposals made at the National People’s Congress spell the end of democracy and of one country, two systems in Hong Kong, and are another blatant breach of the Sino-British joint declaration. In response to my last urgent question on this, the Minister told the House that the UK

“will stand up for the people of Hong Kong”,

and

“hold China to its international obligations.”—[Official Report, 12 November 2020; Vol. 683, c. 1051.]

Well, here we are again. Almost every prominent member of the democratic movement is in jail. The BBC has been banned in China. Our ambassador has been rebuked just yesterday, and now free and fair elections are being erased. Surely by now, any red line that might have existed has been well and truly crossed.

On Hong Kong, China behaves like a bully, and bullies only understand words when they are followed by concerted action. Does the Minister really believe that it is going to step back? Will the Government now impose Magnitsky sanctions and other measures on the officials responsible, such as Carrie Lam and Xia Baolong? Sanctions were applied in the cases of Belarus and Alexei Navalny. Why there and not here, when we have a direct duty of care? Will the Government take this case to the International Court of Justice? It is up to us to lead that international co-ordinated effort to hold China to account. What conversations has the Minister had with our allies to join us in any actions we take?

I hope that Members across the House will join me in putting on record how welcome all Hongkongers using the British national overseas scheme are to this country. I am distressed to hear that some are now being targeted by China for doing so. Enough is enough. I urge this Government to take immediate action to protect Hong Kong, its democracy and human rights, as they are obliged to do under international law. No more excuses—it is time for real action.

I thank the hon. Lady for bringing this urgent question to the House. As she rightly says, we will continue to bring together international partners to stand up for the people of Hong Kong, to call out the violation of their freedoms and to hold China to its international obligations. It is worth reminding her that the National People’s Congress is currently debating electoral reform behind closed doors. We have made clear our concerns and urge the authorities to uphold their commitments to the people of Hong Kong. She mentioned this being a clear breach of the joint declaration. We declared two breaches of the joint declaration in 2020 in response to the national security law, and when the details of these proposals are published by the NPC, we will closely examine them.

The hon. Lady also referenced our new ambassador to Beijing, who was summoned by the Chinese MFA in response to an article that was posted to the embassy’s WeChat account in her name. I strongly support the work of our ambassador in Beijing and the rest of the Foreign, Commonwealth and Development Office on this important issue. The United Kingdom is committed to media freedom and to championing democracy and human rights around the world.

I start by saying that Caroline Wilson enjoys the support of the Foreign Affairs Committee and, I am sure, everyone in this House in championing media freedom and the right of a free press to criticise a Government—even, perhaps, this one.

The actions that Her Majesty’s Government have taken in recent months are very welcome. Despite the list that the hon. Member for Oxford West and Abingdon (Layla Moran) set out, the welcoming of British nationals overseas—the correcting of a wrong that we all made in 1984—and of Hong Kong people to the UK is important in standing up for the values that we signed into international law when we signed the Sino-British joint declaration.

I must welcome one or two things that the hon. Lady said, one of which was about Magnitsky sanctions. We really do need to see greater action. I welcome what my right hon. Friend the Foreign Secretary has said in the past in championing Magnitsky sanctions and ensuring that they come into law. We now need to see names put to those charges, because this has gone on long enough. We know that the abuses of human rights in Hong Kong have continued, and we need to stand up for those who have been targeted.

I thank the Chairman of the Foreign Affairs Committee, in particular for his work on this issue and his support for our excellent ambassador, Caroline Wilson. He mentions sanctions. As he will know, we do not speculate on who may be designated. They are just one tool in our arsenal. The UK has already offered a new immigration path for BNOs, which my hon. Friend raised. We have suspended our extradition treaty with Hong Kong and extended our arms embargo on mainland China to Hong Kong, and that is all in response to Beijing’s behaviour.

Beijing’s assault on Hong Kong’s electoral system is the latest breach of the Sino-British declaration and is viewed by experts as the final nail in the coffin of Hong Kong’s democracy. It follows the arrest and charging of 47 opposition politicians, 32 of whom were refused bail. As a signatory to the Sino-British declaration, the UK has not only a legal duty but a moral responsibility to stand up for the democratic rights and freedoms of the people of Hong Kong. As parliamentarians, we will feel a sense of profound sadness as we witness this steady suffocation of democracy. For the past few months, the UK Government have just been going through the motions, so may I ask the Minister these questions?

Labour welcomes the BNO offer, but there appears to have been very little planning, and a family of four need £16,000 up front. What steps is the Minister taking to ensure that the scheme is accessible to all BNOs, and what steps are the Government taking to support their integration into British society?

Hong Kong Watch’s latest report describes Hong Kong as being a “canary in the coalmine” of China’s expansionism, so what assessment have the UK Government made of the threats facing Taiwan, given that Chinese fighter jets and bombers buzzed Taiwanese airspace more than 300 times last year?

China’s growing presence in the UK’s critical national infrastructure clearly has implications for our own national security. What assessment has the Minister made of the role of the China General Nuclear Power group, which owns one third of Hinkley Point, but has been blacklisted in the US for stealing nuclear secrets?

The Conservative party is deeply divided over China, but we cannot afford any more dither and delay. Will the Minister work across Government to undertake an audit of the UK’s relationship with China and come back with a clear strategy to replace their failed golden era policy? What steps has the Minister taken to deliver a co-ordinated international response to China’s assaults on democracy and human rights and, finally, where on earth are those Magnitsky sanctions?

I thank the hon. Gentleman for his questions. He will have heard the response that I gave to the Chair of the Select Committee, my hon. Friend the Member for Tonbridge and Malling (Tom Tugendhat), on Magnitsky sanctions. With regard to CGN’s involvement in our nuclear sector, obviously, investment involving critical infrastructure is subject to thorough scrutiny and needs to satisfy our robust legal, regulatory and national security requirements, and all projects of this nature are conducted under that regulation to ensure that our interests are protected.

As with all foreign policy priorities, the FCDO recognises the importance of cross-Whitehall collaboration, particularly on Hong Kong. The Foreign Secretary regularly chairs a ministerial group meeting attended by Ministers from across Whitehall and a number of Departments. We obviously take any threat to the joint declaration very seriously, but we need to wait and see what comes out of the National People’s Congress before making an assessment. We have already called a breach twice last year, but the hon. Gentleman will need to wait until we have seen what comes out of the NPC.

On BNOs and the integration of BNO passport holders, that is a really important question. We are working across Government and alongside civil society groups and others to support the integration of those thousands of people who will be taking up that route and arriving here. We encourage and look forward to welcoming applications from those who wish to make the United Kingdom their home. The Foreign Secretary has met the Secretary of State for Housing, Communities and Local Government to discuss exactly this issue. I know that the hon. Gentleman has been in contact with one of the Ministers at the Ministry of Housing, Communities and Local Government, and we look forward to seeing the outcome of those discussions, because it is absolutely crucial that we support those individuals who are coming here from Hong Kong.

I congratulate the hon. Member for Oxford West and Abingdon (Layla Moran) on securing his timely urgent question. I say to my hon. Friend the Minister that we have heard a lot of this already before. The problem that we have in waiting for the National People’s Congress to come to a decision is that we know what will happen. The Chinese Government have already dismissed the Foreign Secretary’s comments about their failures and essentially told him to mind his own business, despite the fact that we are co-signatories to that agreement. Furthermore, we have evidence from Xinjiang, Tibet, the Christians, the Falun Gong, the entries into the South China sea, and the abuse on the border with India.

The real problem is that we sit and wait for something really substantial to happen. Other countries have moved, but we have still not come forward with Magnitsky sanctions, which were promised again and again. When will this happen? That is the only real action we can take that tells the Chinese that we have had enough of their behaviour and that they now have to step back into line with the international order or they will be sanctioned.

My right hon. Friend asks about action. Well, the action that we have taken on Hong Kong is substantial. He knows the answer on Magnitsky sanctions—we do not speculate on whom, and this is a policy area that is under constant review. Let me give him an example of our action. In response to the arrests in January, the Foreign Secretary issued a joint statement alongside his Australian, Canadian and US counterparts underscoring our concern. He also released a further statement following the charges of conspiracy to commit subversion brought against 47 of those arrested. We have made the very generous BNO offer. We have made it clear that in our view the national security law violates the joint declaration, and its use in this way to stifle political dissent contradicts the promises made by the Chinese Government as a co-signatory.

I do feel for the Minister in this discussion, and in the further ones we will have about Hong Kong. I will do my best to be constructive. We are agreed across the House that Hong Kong matters are not a domestic affair specifically and only for Beijing. They are subject to an international agreement and subject to international law. If these measures to curtail democracy come forward—let us be realistic, we are talking about how and when, not if—it will be increasingly clear that the UK Government and global Britain look increasingly toothless, powerless and, most worryingly, friendless in this discussion. I do not say that the UK has done nothing within the UN, but where is the global coalition to move beyond warm words, inaction and concern to action against the economic interests of China. There are measures that can be taken and I would be grateful if the Minister updated us on what assessment has been made of the impact of the sanctions on Chinese economic interests domestically here, however we define domestically, and in the academic community as well. There are things that can be done while we push towards the international coalition.

No, we can’t. That would be rather foolish.

As I have said, sanctions are just one tool in our arsenal. We have already offered the immigration path for BNOs, as I said, and cancelled the extradition treaty. I have an awful lot of time for the hon. Member for Stirling (Alyn Smith), who is very constructive on these issues. We are working closely with our international partners, and the work we have done with the US, with Canada and with Australia, and the statements made by the Foreign Secretary have managed to bring together the international community. As a co-signatory to this joint declaration, we have a responsibility to uphold the content and a duty to speak out when we have concerns. When we do so, it is a matter of trust, and leaders of the international community, including China, also need to live up to their responsibilities.

There seems to be no purpose in having the Magnitsky sanctions as a tool but popping them on a shelf. If the Minister or the Department feel vulnerable in applying them in a solo fashion, what work is being done with the Five Eyes countries to introduce co-ordinated Magnitsky sanctions against the Hong Kong and Chinese officials responsible for the national security laws? My hon. Friend the Minister mentioned our allies the Americans. Just this morning, the Biden Administration reconfirmed their belief that genocide is taking place against the Uyghur at the hands of the Chinese state. What work is being done with the Minister’s counterparts in America to prevent this genocide from carrying on?

I thank my hon. Friend for the assiduous way in which she pursues this matter. She knows exactly what the longstanding policy of the British Government is: any judgment on whether genocide has occurred is a matter for a competent court, rather than for Governments or non-judicial bodies. She mentioned the United States. It has a different process for determining genocide that is not linked to a court decision. Of course, given our longstanding policy over many decades that this is a matter for a competent court, she will understand the reason behind the responses that she may have heard once or twice before. I make no apologies for having to repeat myself to her.

I find this so frustrating. We come back time and again, and we hear exactly the same old words: “We’re not allowed to speculate about using the Magnitsky sanctions.” We do not want anybody to speculate; we want them to use them. It is like they are z, the unnecessary letter. It is like they are an appendix that we are never prepared to use for any bodily function. We should be using them. To be honest, it feels as if the Government are completely two-faced on this—not individual Ministers, but the Government—because one day the Government say, “Yes, it’s terrible what’s happening in Hong Kong. Yes, it’s terrible what’s happening in Xinjiang province,” and the next day the Prime Minister says that he is “fervently Sinophile”. Frankly, we should be calling this out with a great deal of urgency, and we should be using every single tool in the box, so please Minister do not give us all the old stuff all over again. The hon. Gentleman needs to be congratulated for the work that he has done in the first place, working cross party, to allow and help the Foreign Secretary to deliver our own sanctions regime. Again, we continue to hold China to account. We lead international efforts in that regard. We work very closely with not just the US Administration. We have a huge opportunity this year through our presidency of the G7. What I will say to him—I will try to use slightly different language from that in the answer I provided to my hon. Friend the Member for Wealden (Ms Ghani)—is that we are carefully and closely considering further designations under our global human rights regime. They were introduced, as he knows, in July, and we will keep all evidence and potential listings under very close review.

What assessment has the Foreign Secretary made of the impact of the national security law and the further dismantling of human rights in Hong Kong on freedom of religion or belief, particularly in the light of the raid on Good Neighbour North District Church, the freezing of its bank account, and the Catholic diocese of Hong Kong’s instructions to clergy to be careful in their sermons? What implications does the proposed national security education curriculum have for FORB in faith schools there?

I pay tribute to my hon. Friend for her work as the Prime Minister’s envoy for freedom of religion or belief. We are deeply concerned about the issues that she has raised, and about the severity and scale of violations and the abuses of freedom of religion or belief in many parts of the world, including China. Religious intolerance and persecution are often at the heart of foreign and development policy challenges. Where freedom of religion or belief is under attack, other human rights are often threatened too, as she knows full well. The prosperity of Hong Kong and the way of life relies on respect for those fundamental freedoms. We are committed to defending freedom of religion or belief for everyone.

As the hon. Member for Congleton (Fiona Bruce) said, freedom of expression is under attack in Hong Kong like never before. With the introduction of national security education, new censorship guidelines encouraging students and teachers to monitor each other for thought crime, and the removal of pro-democracy academics, the chilling effect on the education sector in Hong Kong is profound. Unfortunately, the UK Government’s visa programme favours the richest in Hong Kong society because of the high costs of the BNO visa route. What steps will the UK Government take to make it easier for students, academics and intellectuals to seek refuge in our democracy?

We are actively encouraging people and their immediate family members to apply through our new bespoke immigration route. They will be able to come here to live, study and work. They will be able to choose whether to apply for 30 months’ leave in the first instance, followed by a further 30 months, or to apply straight away for five years. Of course, there is an application fee, as well as the associated immigration health surcharge. Since 23 February, applicants have been able to apply via a fully digitally accessed process. We did an impact assessment in October, and we now estimate that between 123,000 and 153,000 BNOs and their dependants could take up the route in its first year. That is a forecast as exact uptake is likely to vary, but, especially looking over five years, potentially between a quarter of a million and 300,000 people will be using this route—something the whole House will welcome.

The reported proposals in China’s National People’s Congress to change Hong Kong’s electoral system will break the promises that she has made and end democracy in Hong Kong. With almost every prominent leader in Hong Kong’s democracy movement now on trial, in exile or in jail, what steps are the Government taking in multilateral institutions to hold China to account for her actions?

One example of that was on 22 February, when the Foreign Secretary addressed the United Nations Human Rights Council calling out the systematic violation of the rights of the people of Hong Kong. We have made it clear that free and fair legislative elections must take place. The impact of our diplomacy is reflected in the growing number of countries supporting the statements that we have led or co-ordinated at the UN: we have gone from 23 countries to 39 within a year. This sends a powerful message to China about the breadth of international concern.

Will the Minister raise with the Chinese authorities the cases of Lee Cheuk-yan, the general secretary of the Hong Kong Confederation of Trade Unions, and Carol Ng, its former chair, who have been arrested and charged with organising an illegal assembly and with subversion of the national security law for participating in the democratic primaries? What action do the Government intend to take against those UK-based companies that have expressed support for the national security law, like HSBC and Jardine Matheson, and Swire, which has victimised its workers who have expressed opposition to this law?

It is clear that Conservative MPs are deeply divided over how to respond to the Chinese Government’s increasingly belligerent policies and actions, from its assault on democracy in Hong Kong, to the genocide of the Uyghurs, to its mistreatment of minorities and its aggression on the Indian border and in the South China sea. This Government are increasingly out of step with opinion in all parts of the House, so does the Minister agree that there is an urgent need for a cross-departmental strategy—it is long overdue—for our engagement with China? If so, what specifically is he doing to take that forward?

As I said in response to the hon. Member for Aberavon (Stephen Kinnock) earlier, the Foreign Secretary chairs a cross-Government ministerial group. We meet regularly cross-departmentally on all issues to do with our engagement with China, including Hong Kong. The hon. Member for Slough (Mr Dhesi) refers to the South China sea. We have made it very clear that we encourage all parties to settle their disputes peacefully through existing legal mechanisms, particularly the UN convention on the law of the sea.

Does my hon. Friend agree that it is only through working with like-minded allies that we will be able to convey to China the international community’s concerns about the erosion of democracy in Hong Kong? Will the Minister ensure that those concerns, along with those of the Uyghur in Xinjiang, are raised when we host the G7 later this year?

My hon. Friend raises a very good point. This is a real opportunity for the United Kingdom to raise important matters, as we have the presidency of the G7. It is absolutely crucial that China understands the breadth of international concern regarding its actions not just in Xinjiang but in Hong Kong, and we are taking a leading role in that regard. I referred to the number of countries that have supported our statements at the UN General Assembly Third Committee rising from 23 to 39, and that does send a very powerful message to China.

Does the Minister share my assessment that it is inappropriate for UK-based financial institutions, such as HSBC, to have corporate sponsorship in the UK, given their public support for the national security law and the freezing of Ted Hui’s and his family’s bank accounts? Does he agree that this support undermines the UK Government’s attempts to hold the Chinese Government to account?

The hon. Lady raises two important point. I met Ted Hui recently, in February, and we are in close contact with a wide range of businesses in Hong Kong, but it is important that businesses themselves make their own judgment calls. Businesses, including HSBC in Hong Kong, have to do that. They need to be able to stand by each decision they make publicly. We have made a historic commitment to the people of Hong Kong to protect their autonomy and their freedom and, importantly, so did China when it signed the Sino-British joint declaration.

After these latest and most troubling examples of Beijing tightening its grip on Hong Kong, how can the UK Government justify not suspending any further trade talks with China in response to its inability to live up to its international treaty obligations? With this Government’s shameful watering-down of the genocide amendment to the Trade Bill, and now this current situation, how can the Minister reassure the general public that the UK Government are not putting profit above human rights?

Of course, the situation is not as the hon. Lady describes. I understand why she has put it in such terms, but we must remember what the Trade Bill is intended to do. Its key measures will deliver for UK businesses and for consumers across the UK, and it provides continuity and certainty as we take action to build a country that is more outward-looking than before. The UK has long supported the promotion of our values globally, and we are clear that more trade does not have to come at the expense of human rights.

Under the Sino-British joint declaration, obligations exist that clearly state the UK will ensure a “high degree of autonomy” and way of life in Hong Kong. While I applaud Her Majesty’s Government for introducing the BNO scheme to defend the rules-based international system, we must ensure that China is held accountable, and that there are consequences for breaching a binding treaty. Will my hon. Friend outline how his Department intends to properly hold China to account for breaching the Sino-British joint declaration?

My hon. Friend raises a good point. We are a co-signatory to the joint declaration. We have a responsibility to uphold the content, and a duty to speak out when we have concerns, which is what we have done. We did so last year: the Foreign Secretary has declared two breaches of the joint declaration in response to the national security law, and, of course, when the details that come out of the National People’s Congress are published, we will examine them and respond accordingly.

May I first reinforce the words of my hon. Friend the Member for Oxford West and Abingdon (Layla Moran) in extending the warmest possible welcome to Hongkongers coming to the United Kingdom under the BNO passport scheme? As part of that, we should all be calling out any increase in racially motivated abuse or violence against our own Chinese community.

The Minister is quite right when he says that we should not speculate about the list of who might be subject to Magnitsky sanctions, but can I say to him in the nicest possible way that that speculation will continue for as long as he and his colleagues in Government refuse to act? If he wants to end the speculation, the tools for that are in his own hands. Why will he not use them?

I thank the right hon. Gentleman for the work he does with the all-party parliamentary group on Hong Kong. He knows what I have to say about sanctions, and that to speculate would be unhelpful, but I will just say to him—as I have said to other hon. and right hon. Members this afternoon—that we are closely and constantly reviewing our sanctions regime. I know it is not the answer that he wants immediately, but that is the situation. We will keep any designation under extremely close review.

Does my hon. Friend agree that China’s behaviour towards Hong Kong will have a huge effect on China’s standing in the world, and particularly in Africa, where I have seen for myself the extent to which China is involved in the economies of a whole range of countries? Does this not show that China cannot be trusted as a member of the international community?

My hon. Friend makes a very good point. No doubt he refers to the belt and road initiative that China has under way on that continent and elsewhere. He is right to say that it is vital that China understands the breadth of international concern about the situation not just in Hong Kong but elsewhere, and we have made clear the extent of our concern directly to the Foreign Secretary’s counterpart, Foreign Minister Wang Yi. It is precisely because we recognise China’s role in the world, as a fellow member of the G20 and a fellow permanent member of the UN Security Council, that we expect it to live up to its international obligations and the responsibilities that come with that stature.

Despite a degree of paranoia on the part of some in mainland China, they should understand that nobody here disputes its sovereignty over Hong Kong. We are, however, joint guarantors of the common law system, democratic rights and freedoms continuing for 50 years after handover. We care about these provisions because our word is our bond. How do we move beyond statements and actually deliver a co-ordinated international response with the US, the EU and democracies in the Indo-Pacific region to this assault on democracy on Hong Kong?

I agree totally with the hon. Gentleman’s assessment. This is an assault on democracy in Hong Kong. It looks like what it says on the tin: it is an attempt to stifle that democracy. As I outlined in previous responses, we are working with international partners in this regard and we will continue to do so. We will continue to communicate directly with the Hong Kong authorities and the authorities in China. We have taken robust measures, and our presidency of the G7 this year gives us a great opportunity to step up that work.

Will my right hon. Friend tell the House what further discussions he is having with Five Eyes allies and other allies so that BNO status holders, who are most welcome in the United Kingdom, have similar rights of abode in those countries? More importantly, if we all act in lockstep, we are much more likely to influence China’s policy towards acting in accordance with international norms of behaviour.

My hon. Friend makes a very good point. We are of course liaising with our international partners, including our Five Eyes colleagues. The United Kingdom is not the only country that is offering access for Hongkongers, certainly since the national security law was introduced. He will know that this is a generous offer for BNO status holders and their dependants. As I said, we are working with international partners, across Government and alongside civil society groups and others to make sure there is effective integration of BNO status holders when they arrive in the United Kingdom.

Several international media outlets have reported gross human rights abuses in Hong Kong, Xinjiang and Tibet. Today, 10 March, marks the anniversary of the 1959 Tibetan uprising against the presence of the People’s Republic of China and the subsequent crackdown on Tibetan independence groups. Does the Minister agree that senior Chinese Government officials who are responsible for these abuses should be sanctioned through the global human rights Magnitsky sanctions legislation?

The hon. Member is right to mention Tibet. He knows the answer in terms of Magnitsky sanctions. We are very concerned about the human rights situation in Tibet, where there are restrictions on freedom of religion or belief, assembly and association, as well as reports of forced labour. We are urging China to respect all fundamental rights across the People’s Republic of China, including in Tibet, in line both with China’s own constitution and with the international framework to which it is a party.

China is in clear breach of the 1984 Sino-British joint declaration, and we must stand with Hongkongers in their fight for freedom. The Minister says that China understands the breadth of international concern about these issues. If China does understand, it does not seem to respect international opinion and is not respecting human rights within China and Hong Kong. May I join the calls for Magnitsky sanctions sooner rather than later?

My hon. Friend is right to push this point and, of course, we are constantly reviewing our regime, as he knows. The Chinese Government insist that they are within their rights to unilaterally propose these undemocratic changes to Hong Kong’s constitutional framework, as Hong Kong’s Basic Law was enacted by the Chinese National People’s Congress. What assessment has the Minister made of the validity of this claim and whether it contradicts the Sino-British joint declaration?

We will have to wait and see what comes out of the National People’s Congress, possibly this week, but who knows when we are likely to get an accurate read out? My hon. Friend is absolutely right, of course. This is something that we have under review, and we have a responsibility to do so. I think I mentioned early in my remarks, for example, the work we do with China General Nuclear Power Group in the nuclear sector. He is right to raise it, and it is important that we continue to assess those arrangements regularly.

Can the Minister tell the House which Government Department has overall responsibility for supporting the successful integration of BNO passport holders coming from Hong Kong to the UK? What support is available to Hongkongers who are travelling to the UK under the BNO visa extension? And how can he make the scheme equitable to all those who wish to come?

The hon. Lady makes a fair point about the offer to BNOs. Work is happening across Government, and the scheme is devised principally by the Home Office, but in close collaboration with the Foreign, Commonwealth and Development Office. We are working very closely with the Ministry of Housing, Communities and Local Government, which has the work of ensuring there is proper support not just by Government but across civil society and other groups to ensure that those who take up this route arrive here with the correct support.

The not-yet-confirmed accounts of proposals being considered by the National People’s Congress would, if true, contradict the commitment of the UK and China that the rights and freedoms of Hong Kong, including those of speech and assembly, will remain unchanged. Does the Minister agree that they might also run against China’s own Basic Law for Hong Kong, article 45 of which states that the ultimate aim of elections in Hong Kong is the selection of a Chief Executive by universal suffrage, in accordance with democratic principles?

As chairman of the all-party China group, I will be writing to the NPC on this issue. Will my hon. Friend confirm whether he has raised this with the acting Chinese ambassador, and whether Dame Caroline Wilson has raised it with the Chinese MFA in Beijing?

I thank my hon. Friend for his question and for all the work he does and has done in this area over many years. We have spoken directly to the chargé at the Chinese embassy, and our ambassador in Beijing, who has been there only a small number of months, is in regular contact there as well. My hon. Friend raises the issue of universal suffrage, and we certainly will not be taking any lessons on that from Beijing. We have made clear our concerns and urged the Chinese authorities to uphold their commitments to the people of Hong Kong. That includes respecting their fundamental rights and freedoms, and also Hong Kong’s high degree of autonomy.

I thank the Secretary of State and every Member who has requested action, as I do. Will the Secretary of State outline what steps have been taken to co-ordinate with businesses in the financial sector so that they play their part in letting the Chinese Government understand that their continued acts of aggression, which make a mockery of any agreement at all, will have financial consequences?

The hon. Gentleman speaks regularly in this place on these issues and he has elevated me to Secretary of State. I thank him for that, but there has not been a reshuffle just yet. [Interruption.] That is kind of the Opposition spokesman, but that has certainly not occurred. I am, however, happy to be here responding to this urgent question. We are regularly in touch with businesses in the region to make sure that they are living up to their responsibilities. Whatever decisions they take they have to be responsible for publicly. That is probably the best way of putting the response to the hon. Member for Strangford (Jim Shannon).

Does the Minister accept that an estimated 250 to 300 former naval and military personnel are at particular risk as Hongkongers who served the British Crown? Will he discuss with the Home Office the fact that it has said in answer to questions, both in June last year and January this year, that their situation is under review and that it is time for that review to be brought to a close and for those Hongkongers who served this country but were not awarded citizenship to have their right to come here now granted?

It is a pleasure to serve under your chairmanship, Mr Stringer, under these new arrangements. So far, so good—the technology appears to have worked very well. I am grateful to the hon. Member for Linlithgow and East Falkirk (Martyn Day) for introducing this debate in an excellent way. I pay tribute to the hon. Gentleman for his work on the Petitions Committee. I am also grateful for the contributions from all right hon. and hon. Members, many of whom have given passionate speeches this afternoon—under-standably so, given the interest in their constituencies and their own personal connections with India.

I also want to thank Councillor Gurcharn Singh, whom the hon. Member for Oxford West and Abingdon (Layla Moran) rightly commended for initiating the petition and ultimately this debate. There are clearly very strong feelings, both inside and outside the House, about the farmers’ protest and about press freedoms in India, as indicated by the fact that more than 100,000 people have signed the petition. May I thank every single one of them for taking such a keen interest and for bringing the subject to the House? I will try to respond to many of the points raised by right hon. and hon. Members, but I am conscious that I need to give the hon. Member for Linlithgow and East Falkirk a few minutes at the end of the debate—he says hurriedly, looking at the clock to see how long we have. Perhaps you might give me a pointer, Mr Stringer.

I will begin by saying that the officials in our network of high commissions in India have monitored and reported back on the protests in response to the agricultural reform laws ever since they first flared up in September. In January, the Indian Supreme Court suspended the reforms and established an expert committee to scrutinise the laws. We understand that the committee has completed its consultations with concerned parties and will give a final report to the Supreme Court at the end of the month. We are also aware that the Indian Government have met farmers’ unions on several occasions and that those talks remain inconclusive, but are ongoing.

Understandably, those events have caused alarm and uncertainty for many British people who have family ties to farming communities in India. The Government’s written response to the petition aimed to address those concerns while making clear that agricultural policy is a domestic matter for the Indian Government, as the Opposition spokesman, the hon. Member for Aberavon (Stephen Kinnock), confirmed. The UK Government firmly believe, however, that freedom of speech, internet freedom, which was mentioned by the right hon. Member for Wolverhampton South East (Mr McFadden) and many others, and the right to peaceful protest, are vital to any democracy.

We also accept that if a protest crosses the line into illegality, security forces in a democracy have the right to enforce law and order in a proportionate way. We encourage all states to ensure that domestic laws and the way in which they are enforced comply with international human rights standards. In that spirit, we look to the Indian Government to uphold the freedoms and rights guaranteed to the Indian people by the constitution and by the international instruments to which India is party.

Concerns about press freedom in India were raised by right hon. and hon. Members, including the right hon. Member for Islington North (Jeremy Corbyn), my hon. Friend the Member for Peterborough (Paul Bristow), the hon. Member for Ealing, Southall (Mr Sharma), and the SNP spokesman, the hon. Member for Argyll and Bute (Brendan O'Hara). Again, let me be clear that this Government believe that an independent media is essential to any robust democracy. That is why we are committed to championing media freedom around the world, as is evident from our ambitious media freedom campaign that we launched in November 2018.

India has a vibrant media scene that promotes lively debate across the political spectrum, and the UK Government have worked to support that democratic tradition. In 2019, for example, we awarded scholarships on our flagship Chevening programme to seven talented and aspiring young Indian journalists. Last year, we supported the Thomson Reuters Foundation to run workshops for Indian journalists to help them report on human rights issues.

My colleague Lord Ahmad of Wimbledon is the Minister responsible for both human rights and our relations with India. He regularly discusses media freedom, including the Media Freedom Coalition, of which the UK is a founding member, with India’s Minister of State for External Affairs. Right hon. and hon. Members will recognise that this is a time of great ambition for the UK’s relationship with India. Both Governments are working to advance shared priorities across trade and investment, health, sustainability, climate change, and defence and security. We are also working with India as a force for good on the UN Security Council, and it is one of the Prime Minister’s guest countries at the G7 summit later this year in June. This co-operation will help us to fix global problems and it will strengthen prosperity and wellbeing in India and the UK.

While this is an exciting time for the UK-India partnership, it does not hinder our raising difficult issues. A number of right hon. and hon. Members, including the right hon. Member for Hayes and Harlington (John McDonnell) and the hon. Members for Ilford South (Sam Tarry) and for Birmingham, Perry Barr (Mr Mahmood) spoke about the Prime Minister’s upcoming visit to India. This will be an opportunity to discuss a range of bilateral issues with India. Where we have serious and specific concerns, we will raise them directly with the Indian Government, as would be expected of a friend and neighbour. Candid discussions are an important part of our mature and wide-ranging relationship with the Indian Government.

The hon. Members for Oxford West and Abingdon and for Aberavon wanted to know what further discussions the United Kingdom has had since the Foreign Secretary discussed the farmers’ protest with his counterpart during his visit to India in December. This month alone, senior Foreign, Commonwealth and Development Office officials have met with the Indian high commissioner and discussed this very thing—the UK parliamentary interest in the freedom of civil society groups, for example, to operate in India—and Lord Ahmad of Wimbledon speaks regularly to his counterparts in the Indian Ministry of External Affairs, as well as to the high commissioner here in the UK. Human rights issues are an essential part of these conversations.

The hon. Member for Oxford West and Abingdon raised the issue of article 9. We have not made an assessment of India’s agricultural bills in relation to article 9 I will certainly consult officials on this, but I would stress again that these reforms are a domestic matter for India. The hon. Member for Birmingham, Hall Green (Tahir Ali) raised the issue of sanctions. This sanctions regime, which we launched in July, enables the UK to impose sanctions on those who commit serious human rights violations or abuses. It is not appropriate to speculate on who may be designated under the regime in future, as to do so could very well reduce their impact.

The Opposition spokesman also raised the issue of Amnesty International in India. We raised this case with the high commissioner on 1 December and with officials via Lord Ahmad, and our officials have raised our concerns most recently in November, as well as in December. We have requested that Amnesty’s accounts be unfrozen while the investigation is ongoing, and in our contacts with the Government of India we have noted the important role in a democracy of organisations such as Amnesty.

I am incredibly grateful to my hon. Friend the Member for Basildon and Billericay (Mr Baron) for securing this debate on the British Council and the integrated review. May I use this opportunity to pay tribute to him for his work as chairman of the British Council all-party group, particularly as he referenced the recent report on influence and the integrated review?

For more than 85 years, the British Council has been the UK’s international organisation for education and cultural relations. It is a crucial part of the UK’s presence overseas and it is a key soft power asset. It has work in more than 100 countries, reaches 790 million people annually, promoting UK education, arts and culture and, as my hon. Friend referenced, the English language. He also referenced in his excellent speech that the United Kingdom is a soft power superpower. We have huge strengths from sport, culture and creative industries to our world-class higher education system, and the important role that we play internationally in addressing whatever the major issues of the day are. We rank consistently in the top three in leading soft power indices, and we ranked as the most attractive country for young people in the G20 in the British Council’s recent soft-power perception study.

The British Council promotes UK influence and attraction overseas by building long-lasting connections between people. It acts as a force for good—for example, through its work to empower young women in south Asia through English language teaching. It encourages cultural understanding through programmes such as its fantastic seasons of culture and through educational exchanges.

The British Council also fosters connections between higher education institutions and students in the UK and in other countries. I am pleased to note that the council will use the expertise it derived from delivering Erasmus+ to administer the new Turing scheme from September. This will enable a new generation of international students to benefit from the UK’s world-class education system.

I thank the hon. Member for Basildon and Billericay (Mr Baron) for his presentation. It is always a real nice pleasure to see him again; we look forward to renewing friendships shortly.

It has been said that a state’s credibility and capacity to effect change depends as much on diplomacy and the social and human capital of international networks as it does on gross domestic product or military might. Does the Minister agree that it is essential that our diplomacy should be used to make a difference—as I often ask for—to the lives of those who are oppressed throughout the world?

The hon. Gentleman is absolutely right: it is important that, through our network and posts and through what we do in our embassies and high commissions around the world, as well as through our British Council offices, there is a huge diplomatic effort going on. I appreciate that that is not the principal object of the British Council, but it does add to the UK’s strength of diplomacy. If there are emergencies or crises around the world—sadly we have seen a number of them—the United Kingdom has a strong part to play, and he is absolutely right to raise that.

To continue the theme of that intervention, the council also contributes to our global prosperity and helps to develop favourable conditions for new trade and investment links. My hon. Friend the Member for Basildon and Billericay rightly raised the integrated review. The Government want our foreign policy to deliver for the British people and to be rooted firmly in our national interests, which is why the commitment to deliver a review of foreign, defence, security and development policy was announced in the Queen’s Speech in December 2019.

The integrated review will define the Government’s ambition for the UK’s role in the world and the long-term strategic aims for our national security, foreign and development policy. It will outline the way in which the United Kingdom will be a problem-solving and burden-sharing country, and it will set a strong direction for recovery from covid-19, both here and overseas, so that together we can build back better.

The full conclusions of the integrated review will be published later this month. My hon. Friend the Member for Basildon and Billericay will understand that I do not want to pre-empt the findings, nor how the British Council will feature in the final report, but I would be surprised if soft power does not play a part in it. It is absolutely certain that the FCDO will continue to value the British Council’s role as a contributor to our long-term foreign policy and our development ambitions.

As I set out, the integrated review will map out the UK’s direction for recovery from covid-19. It is important to acknowledge that the British Council has been acutely affected by the pandemic, as my hon. Friend said. At the pandemic’s peak—at its worst—more than 90% of the British Council’s teaching and exam centres were forced to shut, with a huge impact on the organisation.

We have worked hard to provide the British Council with additional support at a time of strain on public finances. Last March, the Department provided £26 million of emergency funding, as well as providing half of the council’s grant-in-aid funding up front. We will also provide up to £145 million in loans to ensure that the British Council is able to continue to operate through this exceptionally difficult time. We will provide further financial support for future restructuring plans to enable the British Council to rebuild its commercial surpluses.

I am extremely grateful to the Minister and am very encouraged by everything he has said so far. Does he agree that, despite the covid-19 pandemic forcing us all to move into the virtual world, the physical footprint of organisations such as the British Council must be maintained and restored, because in international competitive environments, where we leave a vacuum, other countries with less benign intentions will be all too ready to fill it?

My right hon. Friend is right to raise that issue. The footprint of the British Council is huge globally. If he is referring to potential office closures, no decisions have been taken. Clearly, the British Council is operationally independent in that regard. We will work and are working extremely closely with the council to ensure that any negative impact on its work is minimised as much as possible.

Despite the hardship endured throughout the pandemic, the British Council has continued to innovate and it has adapted to digital delivery. I understand the point of my right hon. Friend’s intervention. Previously, the digital footprint was nowhere near what it is now in terms of delivering the English language. Currently, more than 80,000 students are learning English online.

The British Council has also been able to deliver events online. An example of that is the UK-Italy season of culture, which was the first of its kind. Fifty virtual events have been held for hundreds of cultural professionals. I was delighted to take part in the UK in Japan season earlier this year, although very sadly I was unable to get to Japan for obvious reasons. I was able to visit digitally, and I had the pleasure of taking part in an online discussion with leading figures from the UK and Japanese cultural sectors. It is a credit to the British Council that it has been able to continue its vital work throughout this period. It demonstrates the resilience of our soft power institutions.

We have ensured that the British Council will be on a steady footing for the future, so that it can continue delivering core work across arts and culture, the English language and, importantly, education. As part of the spending review settlement for 2021-22, the Foreign, Commonwealth and Development Office will provide £189 million of grant-in- aid funding, of which £150 million is official development assistance.

The British Council delivers key soft power benefits for the UK, as I have said, through its networks and expertise. It ensures UK influence through its programming. It attracts students and visitors to the UK and, through its work on the ground with communities and young people, it helps to secure global co-operation, as referenced in the intervention by the hon. Member for Strangford (Jim Shannon).

The full conclusions of the integrated review will set out the UK’s vision for the next decade. It will be based on our values and grounded in the UK national interest. I have no doubt that the British Council will continue to play a vital role, and the FCDO will continue to support it as one of our most valuable soft power institutions.

Copies of the British Council’s annual report and accounts for the 2019-20 financial year have been placed in the Libraries of both Houses.



The British Council builds connections, understanding and trust between people in the UK and other countries through arts and culture, education and the English language. As the UK’s international organisation for cultural relations and educational opportunities, it makes a significant contribution to projecting British values overseas and generating soft power for the UK in return. In doing so it makes a lasting difference to the UK’s security, prosperity and influence.



The British Council is the world’s leading cultural relations organisation, with a reach in 2019-20 of 983 million people. This included 76 million direct interactions, through a presence in over 100 countries.



The Council received £187 million grant-in-aid, including £161 million ODA, from the FCO in 2019-20.

The Minister for South Asia, Lord Ahmad, set out our serious concerns about human rights in Sri Lanka in a statement at the UN Human Rights Council on 25 February. On 22 February, the Foreign Secretary confirmed that the UK would lead a new resolution on post-conflict reconciliation, accountability and human rights. We continue to engage with Sri Lanka on these issues and on climate change, trade and the covid-19 response. UK-funded programmes in Sri Lanka support peacebuilding, resettlement, police reform and demining.

For decades, the UK has provided extensive military and police support to the Sri Lankan police and military, and this support has continued despite deeply troubling reports of the widespread use of torture by the Sri Lankan police, including the use of the death penalty for drugs charges. Will the Minister please explain why the UK has spent more than £7 million through its conflict, stability and security fund to assist the Sri Lankan police and military? More importantly, will he commit to publishing the full overseas security and justice assistance assessments for activities under this programme to reassure the House that the UK is not contributing to serious human rights violations?

I know the hon. Member takes a very keen interest in Sri Lanka. Our engagement with the military in Sri Lanka is designed to support the development of a modern, effective and human rights-compliant military. Engagement with the police is focused on community policing, increasing women’s representation, and improving responses to sexual and gender-based violence. Our engagement is subject to ongoing overseas security and justice assessments, as he says, to ensure that it supports UK values and is consistent with human rights obligations.

Many of my Slough constituents, especially those worshipping at Masjid Al-Jannah, were extremely distressed by the alarming reports of forced cremations of Sri Lankan coronavirus victims, including Muslims and Christians, for whom burial rights and traditions are sacred. As the country hopefully progresses with truth, justice and reconciliation after its devastating civil war, what representations has the Minister made to his Sri Lankan counterpart on respect for and the protection of everyone’s religious beliefs and freedoms?

The hon. Gentleman is absolutely right to raise this matter, which I know is of great concern to his constituents and to many other hon. Members’ constituents. My colleague, Lord Ahmad, who is the Minister responsible for Sri Lanka, has raised the important issue of human rights, accountability and reconciliation with his counterpart, the Sri Lankan Foreign Minister, and the UN high commissioner, but he also has deep concerns about the decision to mandate cremations for those deceased due to covid. The United Kingdom has shared guidance on how burials can happen within World Health Organisation guidelines to the Sri Lankan authorities.

With reference to the expiry of UN Human Rights Council resolution 40/1 this month, what success have the Government had in their role as leader of the core group on Sri Lanka at the UNHCR in drafting a new UN Human Rights Council resolution that secures international support and reflects the eight areas of focus set out by the UNHCR’s recent report?

We are very concerned by the recent UN report on human rights and accountability in Sri Lanka. As I have said previously, we have made our concerns about the human rights situation clear. The Foreign Secretary has confirmed that the United Kingdom would lead a new resolution on post-conflict reconciliation, accountability and human rights.

The Foreign Secretary announced targeted measures on 12 January to help ensure that no British organisations are complicit in the gross human rights violations occurring in Xinjiang. The United Kingdom continues to lead international action, including at the UN, to hold China to account. The Foreign Secretary made a robust intervention at the Human Rights Council on 22 February, calling out the systematic violation of the rights of people in Hong Kong and pressing China for unfettered access to Xinjiang for the UN High Commissioner for Human Rights.

Ahead of International Women’s Day, I would like to take this opportunity to highlight the recent report by the BBC, which highlighted the extensive use of sexual violence in Xinjiang. I am sure the Minister will agree that the report was incredibly troubling and details what can only be described as torture and abuse of human rights and dignity. Can he explain why it is taking the Government so long to sanction Chinese officials? In the light of recent Magnitsky sanctions in the case of Myanmar, can he explain why they have yet to be used in the case of Xinjiang?

The hon. Gentleman takes a keen interest in this subject, and I appreciate all the work he does on it. We are carefully considering further designations under our human rights sanctions regime, but he will appreciate that it is not appropriate to speculate on who may be designated in the future, as to do so could reduce the impact of such sanctions.

The hon. Member will no doubt have heard the Prime Minister highlight that we are not normally in favour of sporting boycotts. Along with that, participation of the national team at the winter Olympics is a matter for the British Olympic Association, which is required to operate independently of the Government under International Olympic Committee regulations.

I am indeed aware of what the Prime Minister has said. Nevertheless, allies such as the United States and Canada have referred to what is going on in Xinjiang province as genocide. First, does the Minister agree that we should get international condemnation of these ghastly goings on in China? Secondly, in view of what the Prime Minister said, does the Minister agree that we should support those athletes who choose individually to boycott the winter Olympic and Paralympic games, as a demonstration of their opposition to this genocide?

We are leading international action, including at the UN, to hold China to account. We have led from the front. We have an increasing cohort of countries supporting our statements on the happenings in Xinjiang. This is a matter for the British Olympic Association and the individual sportsmen. The British Olympic Association is required to operate independently of Government, and rightly so, under the regulations set down by the International Olympic Committee. This is a matter for the Olympic organisations and individual sportsmen.

The malfeasance of the Chinese Government in Xinjiang, Tibet and Hong Kong is well documented, and my party supports the offer that has been made to the 5 million Hong Kong citizens of a route to citizenship. However, I would be grateful for an assurance from the Minister that proper preparations and proper funding for the integration of Hongkongers coming to the UK are actually in place, because I am not convinced they are. We cannot let this scheme just be a first-class lifeboat for the rich of Hong Kong; it does need to be properly run through for everybody. Can he commit to a statement to the House in due course explaining how the scheme is being worked through with the Home Office and the proper funding being allocated to make sure this is open to all Hongkongers?

That is a very sensible question from the hon. Gentleman. It is absolutely the case that we need to ensure that those British national overseas passport holders who arrive in the UK are treated and greeted well. We welcome the many applications that we have had thus far. My right hon. Friend the Foreign Secretary has met the Secretary of State for Housing, Communities and Local Government to discuss exactly the issue the hon. Gentleman raises. It is important that people are given the right support when they arrive in the United Kingdom, and I am sure that further information on such schemes and what has been organised for these people coming from Hong Kong will be announced very shortly.

Given that covid-19 is reported to have killed more than 120,000 of our fellow citizens it is reasonable, in time, to understand where lessons can be learned domestically, but surely it is our moral duty to establish the origins of the virus and how it spread as an international community. So may I ask the Minister: what is the British Government’s view on where this came from and on the efficacy of the World Health Organisation’s current fact-finding mission to China?

My hon. Friend asks a very sensible question. The UK co-sponsored the World Health Assembly resolution in May 2020 that agreed an investigation into the origins of covid. It is important that that investigation is given the time it needs. The field mission to Wuhan was a key early step in the investigation. Of course we cannot pre-empt findings, but we will look closely at the field mission’s report when it is published. We have been clear that the investigation must be robust, open and scientifically rigorous.

Thank you, Mr Speaker, for granting the right hon. Member for Sutton Coldfield (Mr Mitchell) the urgent question that is to follow on Yemen, which is a human rights catastrophe. Similarly, every Member of this House must acknowledge the humanitarian hellhole that Syria has become over the past decade. Given that the existing programme has now run out, will the Secretary of State update the House on our country’s intentions on welcoming refugees to our shores from Syria and the region, and the good quality of life that we will guarantee them once they are here?

    The Government have made it clear that we must protect the reputation of organisations such as the UN Human Rights Council. Given our work on gender-based violence and the fact that next Monday is International Women’s Day, I would be grateful for an update on what work is being undertaken on the preventing sexual violence in conflict initiative and what steps we might take to implement an international body that can support survivors, document crimes and lead prosecutions.

The PSVI remains a top priority for the UK Government. Since its launch in 2012 we have committed £48 million and funded 85 projects across 29 countries to prevent and respond to conflict-related sexual violence. Of course, the UK’s G7 presidency is an excellent opportunity for us to galvanise support for the PSVI.

The UK Government have repeatedly asserted our long-held position that we respect the territorial integrity of Indonesia, including the provinces of Papua and West Papua. The UK Government categorically do not support the activities or views of Papuan separatist activists. The presence of some individuals in the UK, including Benny Wenda, in no way means that we support their position. We engage with a diverse range of cultural and political figures in the Papua region, and our ambassador made a visit to Papua in November, when he met environment, education and human rights experts, as well as the Governor of West Papua.

Iranian officials have made it clear that the imprisonment of British dual nationals is directly linked to the £400 million IMS debt. The longer the Government deny that link, the longer Anousheh, Nazanin and Aras will be kept away from their families. Will the Foreign Secretary tell me what consideration has been given to an urgent repayment of the debt through alternative means, such as covid-19 supplies or other medical aid?
