A combination of plans within the strategy will support that. We have seen an increase in need and better awareness of different conditions, so the national standards will bring together the best evidence so that people’s needs are met consistently and at a high quality across the country. On accountability, we have improved the area inspection framework by recognising that we need to bring in not just education and councils but health partners.

My hon. Friend the Minister will recognise that one of the greatest causes of strain and stress in the system is the assessment process. I welcome much that is in this plan, including funding for additional educational psychologists, but they will not be present in the system for some time. More urgently, what can we do to accelerate the assessment process so that children in need can take advantage of all the good things that she has described?

There are two things: increasing the number of educational psychologists, which will improve the ability to get a diagnosis quickly; and ensuring that identification happens in schools or early years. If we can catch things early, we can treat them and make sure that people get the right support so that they do not escalate. Too often, people do not have their needs met and they escalate into a crisis. That will help children and young people to get the exact support that they need earlier on.

We continue to work closely with the vital sector as we look towards the economic recovery that we are going to be building towards as we come out of the pandemic. We will work closely with it in terms of the actions and support it needs to help youngsters who need to catch up, but equally, to ensure that every further education college is fully open for September.

My right hon. Friend has already made the point that our schools make a significant contribution to the general wellbeing of our children, as well as to their academic education. I ask him to recognise the sad likelihood, however, that as children return to school in September, more of them than usual will report to teachers and others in school the disturbing or abusive experiences, physical or virtual, that they have had during the lockdown period. Can he confirm that our schools will have the support they need to deal effectively with those reports?

My right hon. and learned Friend touches on an incredibly sensitive and important issue. We have been working closely with not just schools but local authorities and the police to establish local partnerships to support schools as they deal with some of the consequences of children not having the protection that schools have often wrapped around them. We recognise the sensitivity of the issue. I pay tribute to the Home Office and the work that the police have done in terms of forging new partnerships with schools and local authorities, so that action can be taken much swifter where there are fears and concerns about the wellbeing of children.

This is a 4.7% increase. I know that the hon. Gentleman is a distinguished lecturer, and that he inspired many pupils in the course of his career before entering the House. I look forward to discussing with him how we make the best possible investment to deliver the best possible outcomes for all those children in further education.

The Secretary of State’s announcement of additional funds is very welcome, but as governors and head teachers need to plan in advance does he agree that what he said about the predictability and understandability of the funding system is almost as significant? Will he ensure that as the system is designed in detail he keeps an eye on ensuring that it stays so?

My right hon. and learned Friend makes an important point. I know that he represents a county that has historically faced funding challenges and that he has always campaigned for them to be addressed, and I am pleased to be able to do that. I will take his words very much to heart and ensure that we retain clarity and simplicity, as well as always ensuring that schools have a view as long-term as the funds that they will be receiving.

4. What steps the Crown Prosecution Service is taking to support victims and witnesses giving evidence in court.

Prosecutors can apply for special measures to allow victims and witnesses to give evidence in court unseen by the defendant. The Government are making available the opportunity for vulnerable witnesses to give pre-recorded evidence without going into a courtroom at all. In addition, recent CPS guidance, now implemented nationwide, makes it clear what prosecutors can do to explain what is likely to happen at court, so that victims and witnesses can better understand the trial process and give the best evidence they can.

I am encouraged by the Attorney General’s words, but half of all cases going through the courts at the moment are connected with sexual abuse, and with police investigating no fewer than 70,000 claims of historic child sex abuse this year alone, that figure is likely to remain high. Given the traumatising impact on historic survivors and children especially of reliving their experiences in the witness box, what additional measures are being taken to make the process less intimidating and ensure that appropriate counselling services are readily available?

I agree with my hon. Friend. It is important that the system does all it can to reduce the effect, particularly on vulnerable witnesses, of giving evidence in these difficult cases. That is why I am delighted that my right hon. Friend the Lord Chancellor has decided to extend what I believe was a successful pilot of pre-recorded cross-examination. It means that vulnerable witnesses, particularly children, can give their evidence outside a courtroom environment and have it all done and dusted before the trial begins, which also means that they are not affected by any delays that the trial may then be subject to. That is hugely important, as is the opportunity for prosecutors to speak to witnesses and explain what is going on, and I am pleased to say that that has resulted in much improved satisfaction rates among witnesses for the support they get from the CPS.

Will the Attorney General join me in thanking the NSPCC and Esther Rantzen for their campaigning work to reduce the intimidating environment in courts for children, and will he confirm how many children give evidence in court?

I will have to write to my hon. Friend with the figure he asks for, but I entirely agree with his comments about the NSPCC. It is worth noting that a variety of organisations assist tremendously in the work of the criminal justice system in making sure that all witnesses can give their best evidence. That is in the interests of the whole system, and it is particularly important when we are dealing with children.

I have only attended one trial—a murder trial—where, in the summing up, the family of the young lady who had been brutally murdered had to listen to an absolutely appalling character assassination. It was totally fraudulent, but they had to sit there and listen to that. Has anything been done to stop that horrible practice?

I understand entirely the point that the hon. Gentleman makes. He will recognise that in a criminal trial it is necessary that the defence case is put. That is what we need to see to make sure that the process is fair, but we are doing what we can to ensure that the experience of those who are in court not of their own volition—because they are the victim of an offence or a witness to it—is as easy as it can be, although we accept that it will never be wholly easy.

Will the Minister outline what steps have been taken to address the 2015 report by Her Majesty’s inspectorate of constabulary and Her Majesty’s Crown Prosecution Service inspectorate, which revealed that some vulnerable people are being let down by the inconsistency of approach to criminal case file management, and will he say how successful those steps have been?

I recognise the point that the hon. Gentleman makes. This was a troubling report in some ways. One of the most troubling aspects is the way in which victims of crime in particular are communicated with by the CPS—the language used and the sensitivity shown. My hon. and learned Friend the Solicitor General and I have been particularly keen to ensure that the CPS takes those lessons on board and acts on them, and I am confident that it is doing so.

My hon. Friend makes a good point. There are many people within the system, both defendants and witnesses, who have mental health difficulties and it is important that the system is sensitive to that. What we need to do is understand better what the particular needs of each witness may be and then respond to them as best we can. The way to do that is to have the maximum number of tools available and ways in which evidence can be given, whether that is pre-recorded cross-examination, as I have mentioned, or the assistance of others in court who can help those who give evidence.

Will the Attorney General ensure that no witness or defendant can give evidence to a court while wearing a full-face balaclava or the burqa?

What is important is that the court and in particular the jury can assess the evidence that a witness gives, so it is important that that witness is able to give evidence in a clear way, so that a jury can assess whether they think that witness is telling the truth or not. Anything that gets in the way of that, I am sure the court will wish to consider very carefully.

The case that concluded in the Supreme Court last week dealt with an important constitutional issue. It was absolutely right that the Government both defended their position and appealed against the first-instance judgment in England and Wales to the Supreme Court, where the case was heard alongside connected litigation from the Northern Ireland courts. The figures for the total costs of those cases will be published in due course, but I can confirm that the Advocate General for Scotland and I, who appeared on behalf of the Government, received no additional fee for our work on the case.

I thank the Attorney General for his response, although I am not sure that we have got any closer to learning the figure. Given that every serious legal commentator in the land said that the Government’s appeal was doomed to fail, will he please explain to the House why it was so necessary to waste taxpayers’ money on funding the appeal?

I am afraid that I do not agree with the hon. Gentleman’s premise. Let me point out a number of things to him. First, I think that the Supreme Court of the United Kingdom is the right place in which to decide a case of such significance. Secondly, if the Government’s arguments had been as hopeless as the hon. Gentleman suggests, three Supreme Court justices would not have agreed with them. Thirdly, as I have already pointed out, the case was in the Supreme Court partly because judgments in Northern Ireland cases were appealed against to the Supreme Court, not by the Government but by the other parties. The Government responded to those cases, and, incidentally, were successful. Fourthly, the Supreme Court was dealing with arguments presented by the devolved Governments, which had to be dealt with by the Supreme Court. In that instance, the Government were again entirely successful.

Lastly, let me say this to the hon. Gentleman. I think it is a good thing that, in a system governed by the rule of law, a Government are prepared to go to court to argue their case, to make use of appeal mechanisms like any other litigant, and then to abide by the final outcome. That is what has happened, and I think it is a good example of the way in which a rule-of-law system should work.

Does my right hon. and learned Friend agree that when members of the public bring cases on a matter of this importance against the Government in Northern Ireland and in England and Wales and there are conflicting decisions, our Government have no alternative whatsoever but to pursue this matter to the Supreme Court?

I do agree. It is important that the Supreme Court resolved this matter and gave us clarity on what should now happen, and it is now for Parliament to decide what to do next—and I am pleased to see that last night Parliament began to answer the question it had been posed.

When the costs are eventually published, will the Minister ensure that the price that was exacted was for liberty and freedom from the bureaucrats in Brussels, against which it is very difficult to attach any cost?

I take the hon. Gentleman’s point. This will be an expensive case, but the answer the British people gave should be respected and acted upon, and that, as I say, is now a matter for Parliament—it is no longer a legal matter—and I hope very much that Parliament will answer it clearly.

The Attorney General maybe needs to think again about some of the dubious shorthand that he uses in respect of the devolved cases. The Supreme Court really only made clear judgments in relation to two of the five matters that were referred in relation to Northern Ireland, and on one of them some of its observations are politically telling in ways that the Government are yet to respect.

The other three issues were not determined because they did not need to be, as other aspects of the case were decided as they were. But I am afraid the position is very clear: in relation to the arguments being made, particularly by the devolved Administrations, that there should be the capacity for those Administrations to veto the process of leaving the European Union, the court simply did not agree and rejected those arguments unanimously.

I think the whole House would like to know that we got value for money in that judgment, and of course there are lots of rights and obligations in many Acts of Parliament and it is the courts’ job to interpret them. Can the Attorney General explain why the Supreme Court held that the Sewel provisions in an Act of Parliament were not a matter for the courts?

I am sure that the hon. Gentleman will read the judgment carefully: it says that whereas the Sewel convention might be important politically, it is not a matter for the courts to enforce. That was perfectly properly for the Supreme Court to say. What respect the Sewel convention is given in political terms is of course not a matter for the court. The judgment made that clear.

If the Government were genuinely motivated to spend this money by wanting a definitive answer from the courts on a constitutional question, why did they not thank the judges in the divisional court in November for such a clear answer, instead of being in a position where the Justice Secretary had to be pressured into giving a lukewarm defence of them?

No, the Government have always been clear that, at every level, the courts are entitled to consider the cases brought to them and to reach whatever judgment they think appropriate in the light of the arguments they have heard. That was true in relation to the High Court and it is true in relation to the Supreme Court, too. But the hon. Gentleman knows, as an eminent lawyer himself, that the appropriate thing to do if we disagree with the court of first instance is to appeal the judgment. That is exactly what the Government did, doing exactly what any other litigator would do—and, incidentally, exactly what some litigators in this case did in Northern Ireland.

Is it not absolutely remarkable that we have significant numbers of litigants in person in our courts because of the Government’s legal aid cuts, yet when the Government wanted a lawyer, the money was found? Is it not the case in terms of access to justice that there is one rule for the Government and another rule for everybody else?

I am tempted to point out that, as I said earlier, when the Government wanted a lawyer, two out of the three they used in the Supreme Court did not cost the taxpayer anything. I also point out to the hon. Gentleman that when cases like this one are brought—and I make no criticism of those who brought these cases so that these issues could be resolved—it is important that they are resolved through proper and full legal argument. That was done through the High Court and then the Supreme Court. That is the right way to get to the answer the Supreme Court has now given, and, as the hon. Gentleman knows, I have made clear very many times that the Government will honour and respect the judgment of the Supreme Court.

UK nationals can be prosecuted in our domestic courts for genocide, crimes against humanity and war crimes that have taken place abroad. My hon. Friend will know that the UK Government are also working with other Governments to explore international legal mechanisms whereby Daesh can be held to account for its crimes.

It appears that no steps are currently being taken by the International Criminal Court to pursue prosecutions for crimes against humanity or genocide in Syria and Iraq, despite a substantial vote in this House advocating such action. Is the UK taking any steps to use its own legal competences to prosecute UK nationals who might be committing such crimes in those countries?

My hon. Friend will know that the UK Government sought to pursue a route whereby the International Criminal Court would consider offences of this type committed in Iraq and Syria, but that our approach was vetoed by the Russians and the Chinese, so there has been no lack of effort on the part of the United Kingdom. In relation to domestic law, we will certainly pursue those offences as and where we can. She will also recognise that the primary practical difficulty is that of obtaining the necessary evidence, and we are working at international level to determine how evidence can be properly collected and retained in theatre so that it can be used for prosecutions when the time comes.

The offence of failing to prevent bribery under the Bribery Act 2010 is holding corporate offenders to account for criminal activity and has incentivised good governance within companies. A new offence of failing to prevent tax evasion is included in the Criminal Finances Bill, which is going through Parliament at the moment, and a call for evidence will be published shortly to explore the options for further reform.

I am grateful for my right hon. and learned Friend’s answer; I know he has had a busy week. I am sure he is aware that there is real concern that our regime has made it much harder to prosecute senior directors of companies that have been involved in very serious wrongdoing. When he gets on to this consultation—perhaps he could say when that will be—will he look at other regimes such as that in the US, to see how they have performed better than we have?

I hope it is no disrespect to my hon. Friend to confirm that he is not the most intimidating tribunal I have addressed this week. He is entirely right that we should look at examples abroad, as well as at domestic practice, to make sure that we are doing all we can to deal with corporate criminal offending. He is right, too, that we must address the issue of whether it is easier to prosecute those in charge of small companies than those in charge of large companies because of the complexity of the latter’s management structures, because that cannot be right.

During the passage of the Criminal Finances Bill, the Government have so far refused to extend corporate economic crime beyond tax evasion. Does the Attorney General agree that companies should only be criminally liable for failure to prevent tax evasion?

The hon. Lady’s question reflects precisely why we are asking for evidence on this subject. We will then conduct a consultation to see whether there is a case to extend the type of “failure to prevent” offences that she describes beyond bribery, where it currently exists, and tax evasion, where it will shortly exist, assuming that Parliament passes the Criminal Finances Bill. There is an argument to say that we should look at this, because, as I say, there are other types of offending where it would be sensible to consider whether a “failure to prevent” offence would be appropriate.

The late Professor Gary Slapper, the well-known commentator and columnist who sadly died at the weekend, was a considerable crusader for informing the law on corporate responsibility. It would be a tribute to his memory if we were to work on that.

Does my right hon. and learned Friend agree that we should also look at two other matters? The first is the so-called Magnitsky arrangements for freezing the assets of those involved in corruption. Secondly, in order to enforce that, we must maintain the operational independence of the Serious Fraud Office.

I will attempt to remember them all, Mr Speaker. I agree with my hon. Friend that it is worth looking at his first point. There are many people who believe that there are gaps in the law, but it is also important to make sure that we take full account of concerns that will be expressed about the burdens placed on businesses of all kinds if we get that balance wrong.

On asset freezing and asset seizure, my hon. Friend is right to say that if we are going to successfully prosecute and convict those who are engaged in criminal activity, we must also make sure that we can recover assets where appropriate, so we will look at that in the course of the process in which we are engaged.

As I hope I made clear in my first answer, I do not believe that human rights protections in this country are dependent on EU law. We will certainly look, in the course of the great repeal Bill and other measures that this House will have to consider, at how we transfer those obligations currently under EU law into domestic law where the House believes that it is appropriate to do so. I maintain the view that we will continue to protect human rights in this country. Moreover, we will continue to be leading advocates for human rights around the world.

We remain of the view that human rights law requires reform. I think that my hon. Friend and I are in full agreement that, although we have no quarrel with the content of the European convention on human rights, it is the way in which that document is applied that gives us difficulty. The Government are certainly committed to seeking to do something about that. He will have noticed that we have a few other things on our plate at the moment; I think we will have to resolve those before we can resolve the matter to which he refers.

What assurance can the Attorney General give that, once we exit the EU and become once again an emancipated, independent and liberated nation state on the stage of the world, we will maintain the proud heritage and tradition of defending individual rights in this United Kingdom?

Does my right hon. and learned Friend agree that, when referring to our exit from the European Union, it is important to distinguish between that and the convention, and that the Government’s policy continues to be that we should remain in the European convention and observe human rights as before?

My hon. Friend is entirely right: those two things are distinct. It is our exit from the European Union that the public have confirmed in the referendum outcome and that we will now follow through. Of course, as I said earlier, our commitment to human rights will be maintained not just domestically but abroad.

Vulnerable victims and witnesses can already give evidence from behind a screen or via a video link. In addition, having piloted pre-trial cross examination, which allows vulnerable witnesses to pre-record all their evidence ahead of the trial, we will be rolling it out nationally.

I thank the Minister for that reply. What special arrangements are there to support vulnerable children and under-age witnesses, in particular in cases of abuse or of a sexual nature?

My hon. Friend is right that those witnesses are of particular concern. I am sure she will be pleased to learn that those kind of witnesses will particularly benefit from pre-recorded cross examination; where it has been trialled—we have trialled it in three court centres so far—about three quarters of the cases have been cases of a sexual nature, and most of the witnesses have been children.

Does the Attorney General agree that we have to address the issue of having to go to court for initial proceedings, where victims may come face to face with the accused at a very early stage? Victims feel fear when facing the accused. Will he outline what will be in place to help them?

The hon. Gentleman is right that that is a serious concern for many of those involved in these kinds of cases. That is precisely why the measures I have described are of benefit. If all of a witness’s evidence is pre-recorded, they will not come face to face with the defendant at all. That is a huge benefit.

With the rise of social media, victims and, in particular, witnesses fear intimidation from the online community. Will my right hon. and learned Friend take into consideration protections in the digital space as well as the physical courtroom?

Yes, indeed—my hon. Friend makes an important point. We have to deal with a context that is very different from anything we have experienced before. It is important for people to understand that social media is not ungoverned space. The law applies there as it does elsewhere. If those using social media engage in behaviour that would otherwise be criminal, they will find it is criminal there, too.

I thank the Attorney General for outlining protection for vulnerable victims in the criminal courts. What progress has been made in providing special protection measures for vulnerable victims within family courts?

We need to look carefully at how we might read across some of the things that are clearly working well in the criminal courts to other types of court. The hon. Lady is right to highlight that. There is huge scope for us to understand more about how people can give their best evidence. That, after all, is what court systems of all kinds should be looking for.

The Crown Prosecution Service and the Serious Fraud Office regularly engage with Scotland’s prosecution service and the Public Prosecution Service for Northern Ireland. The Government recognise the importance of retaining good co-operation with European countries on prosecutions, and will continue to engage with the devolved Administrations to seek the best arrangements possible on leaving the EU.

Post Brexit, will the Government seek to continue to use the European arrest warrant? If not, what will they put in its place?

As the hon. Gentleman will anticipate, I am not going to prejudge the outcome of the negotiations and discussions we will have. It is of course right that the European arrest warrant and other measures like it are of huge benefit not just to this country but to our European partners as well. For that reason I am optimistic that we will be able to put in place measures that benefit both sides.

Once we are freed from the freedom of movement rules, will the Crown Prosecution Service seek to prosecute EU nationals who commit crimes in this country and to ban them from returning to this country, which we are not able to do at the moment?

My hon. Friend will know that at the moment the CPS does indeed prosecute European nationals who commit crimes in this country. Some of the measures I have just described are of assistance not just in returning those individuals to be tried in this country but in gaining the evidence necessary to secure their conviction. As for the measures taken thereafter, sentencing decisions are of course for the courts. We will look carefully at what other measures might become available to the courts once we have left the European Union.

4. What assessment he has made of the effectiveness of the unduly lenient sentence scheme.

The number of sentences considered by my office under the unduly lenient sentence scheme has increased by over 108% since 2010, from 342 to 713 requests in 2015. Of those, 136 were referred to the Court of Appeal as potentially unduly lenient, with the court agreeing to increase the original sentence for 102 offenders.

Stalking causes enormous harm and distress to victims, and the Government have rightly strengthened the law in this area. Will my right hon. and learned Friend consider extending the unduly lenient sentence scheme to cover these crimes?

My hon. Friend will know that as a party we have a manifesto commitment to extend the unduly lenient sentence scheme. A number of offences are surprisingly not included in the scheme at the moment. We need to look carefully at the whole range of criminal offences to decide what should be inside and what should be outside the scheme, but he certainly makes a good case for the types of offences we might consider including in the future.

Given that the need for an unduly lenient sentence scheme has been conceded, the public are very confused as to why some offences are covered and some are not. Would it not be simpler to have a scheme that covered all offences?

My hon. Friend makes a tempting proposition to give my office a good deal more work. There is no doubt that one of the advantages of the unduly lenient sentence scheme is that it is available to the public. It does not require the intervention of lawyers and it is, I hope, easy for the public to access. It should also be easy for the public to understand, and I am therefore in favour of drawing the line between cases within the scheme and those outside in a logical and easily understandable place. I would also say that it is important to bear it in mind that, even with an extended version of the scheme, we are talking about a very small minority of cases where judges err in this way. As I said, last year 102 cases were considered under the scheme to be unduly lenient. That is out of about 80,000 sentences passed in the Crown courts that year.

I thank the Attorney General for that answer, but is not the stark reality that Europol’s director stated that the UK will be demoted to second-tier membership? Will that not undermine the UK Government’s plans to tackle and prosecute money laundering crimes?

Again, I do not think we should pre-empt the outcome of any discussions that will follow, but, as I said earlier, I think there is an understanding, not just in the United Kingdom but in the rest of the European Union, that the sort of co-operation on crime and security that we have now benefits both sides and will need to continue in order to make sure that we are all safer and more secure, and that we can successfully capture and prosecute the sorts of offenders he describes.

Is it not fallacious for the remoaners to always say that once we have left the European Union, we will not have access to European institutions? Is it not the case that Europol, the Erasmus programme and the Eurovision song contest all have members who are not members of the European Union?

I do not think that by grouping them together my hon. Friend is describing Eurovision as a criminal enterprise—although there are those who may say so. It is important, as he says, to recognise that leaving the European Union is not the same as leaving Europe, and it is certainly not the same as being unprepared to co-operate. We will be co-operating with a whole range of partners, because, as I have said, it will be in our mutual interest.

Given the warnings from Rob Wainwright and given the Attorney General’s duty to the legal profession, will the Attorney General confirm that he will be making the case on Europol, the European arrest warrant—and, indeed, the Eurovision song contest—in the Brexit Tory Cabinet?

I am unwilling to commit to making the case for the Eurovision song contest, but it is very important that all in this House understand that the Government are committed to continuing our internationalist perspective and to keeping this nation and its citizens safe. I do not think the hon. Gentleman will hear, from any member of the Government, the view that we can do so without co-operating internationally. We will seek to do that just as successfully and just as fully as we have done in the past, inside or outside the European Union.

How is my right hon. and learned Friend interacting with the Government of Romania? He will know that the Heritage Foundation has recently issued a report saying that the courts in Romania are subject to chronic corruption and political influence.

I am not going to comment on the status of other court systems. What I will say is that part of the engagement that this country has abroad on the rule of law, in a variety of different countries, is designed to ensure that the long experience that this country has in running effective, efficient and fair court systems is transmitted to others where they ask for our help, and I am sure we will continue in that enterprise.

I regularly meet the Director of Public Prosecutions to discuss this and other topics. The Crown Prosecution Service continues to prioritise rape and serious sexual offending and has taken steps to ensure that prosecutors are able to prosecute these cases effectively. Those steps include increasing the number of specialist staff in its rape and serious sexual offences units, providing specialist training for prosecutors and developing closer working arrangements with the police.

A constituent of mine is a victim of rape. A complete lack of communication and action from the police has left her unable to move on and recover from the horrific ordeal. After a year and a half, the case—which the superintendent deemed “a professional embarrassment”—has finally been brought to the CPS. However, this might not be the end of my constituent’s torment. Does the Attorney General agree that communication with victims is vital in effectively prosecuting offenders and that the Director of Public Prosecutions should ensure that every victim is kept updated, that their views are taken into account on key decisions and that a high level of communication is upheld?

Yes I do agree, and what the hon. Lady describes clearly does not sound acceptable or in line with the standards we would all expect. There are two things that I think are important. The first is that the prosecutors should be involved as early as possible, so that advice can be given to the police about the development of an investigation with a view to prosecution. The second is to ensure that when a case comes to court, we continue the communication that we should have had up to that point with victims and witnesses and that people are given to understand what is going on around them. Courts can be very confusing places, and we only add to the distress if we do not take the trouble to explain the process to those who are, through no fault of their own, suddenly involved in it. That is one of the things we will look to do better.

I welcome the increased number of prosecutions for rape, but will the Attorney General outline what more can be done to improve the consistency across different areas and also the prosecution rate?

My hon. Friend is right that although we should welcome the increased volume of prosecutions that are taking place, there is still a divergence in the way in which this is done across the country. For that reason, the CPS has set up a national delivery board and is looking at ways in which we can understand why those differences exist and is attempting to resolve them. As my hon. Friend says, this is also a matter of making sure that prosecutors are properly trained, as they are, and have the resources they need to do the job well.

As this is my first question in this role, I refer to my entry in the Register of Members’ Financial Interests and the fact that I am a non-practising door tenant at Civitas Law in Cardiff.

The Attorney General will be aware of the grave recent concern about the admissibility of a complainant’s previous sexual history in rape trials. Does he agree that single, high-profile cases can give rise to wider perceptions about the law, partly because of the level of coverage they receive, and will he undertake to tackle those wider perceptions?

I welcome the hon. Gentleman to his new responsibilities. It is good to see him across the Dispatch Box. He will be pleased to learn that this is probably the only part of Parliament where he does not have to apologise for being a lawyer.

There is concern about the subject that the hon. Gentleman has raised, and we need to accept that that concern is sensible and deal with it. We need to look at a number of things. We need to understand more about the decision in this particular case. We need to understand whether a change in the law is appropriate and, if not, whether it is sensible to look at the guidance that is given to judges about when such evidence is admissible and at the guidance that judges give to juries about how that evidence should be used. We need to do all those things before we are in a position to understand what, if any, changes are needed.

I am grateful to the Attorney General for his welcome and I look forward to debating with him and, indeed, my fellow Welsh lawyer, the Solicitor General, across the Dispatch Box.

Prosecution lawyers will, of course, deal with these applications for the admissibility of a complainant’s sexual history before the courts. I am glad to hear that the Attorney General has committed to looking at the guidance given to judges and at what judges say to juries. In addition, will he look at the guidance given by the Crown Prosecution Service to the lawyers who appear before the courts and regularly deal with these applications?

Yes, I will. He will know that in the case he raises the Crown Prosecution did indeed oppose the admission of this evidence at the Court of Appeal stage. It is certainly worth looking at all the guidance and indeed at the whole picture. This provision is, as far as I am aware, not routinely used, but we must be confident that the message sent to those who are willing but currently worried about reporting these sorts of offences is not that they are not encouraged to do so—quite the reverse; they are. We need to ensure that those messages are clear.
