This issue has yet to be discussed in detail within the framework of the Transatlantic Trade and Investment Partnership (TTIP) negotiations. The Government will consider its negotiation position based on a range of factors including the environmental impact and public health benefit of such anti-microbial treatments that can reduce potential for foodborne illness.

We believe that, in the first instance, it is for food retailers and food outlets to provide their customers with reliable information. I know that my hon. Friend is a long-standing campaigner on this issue, but, as I have explained to him before, the introduction of a compulsory labelling scheme for halal and kosher meat would present challenges, because there is no single unified definition. Nevertheless, the European Commission is currently conducting a review, and we will consider its report when it is published later in the year. [Interruption.]

As I have said, the European Commission is considering the issue. It is most likely to consider whether the animal was stunned or unstunned, because there is a clear definition in EU law. I am aware that groups in both halal and shechita say that they are open to exploring that further, and I look forward to having a dialogue with them and considering the European Commission report when it appears in December.

I am very pleased to see that the Minister survived the Prime Minister’s cull. The point that he has made is absolutely correct: it is a question of whether the animal has been stunned or not stunned. It is an animal welfare issue. Is it not the case that the majority of halal meat is from animals that were stunned? Surely that is the line that the Government should be pursuing in Brussels: “stunned” and “not stunned” labelling.

I entirely agree. There is a clear legal definition of “stunned” in EU law, namely that stunning renders the animal insensible to pain immediately. In the case of halal, some 90% of poultry and lambs have been stunned, and we should recognise that fact.

Consumers are entitled to know exactly what is going on. Does the Minister agree that what we need in all our slaughterhouses is CCTV to give them that further assurance?

We considered the issue of CCTV in slaughterhouses during our consultation on slaughterhouse regulations last year, and concluded that it would not improve the situation much. Indeed, CCTV had already been installed in some of the slaughterhouses in which problems had been exposed by, for instance, Animal Aid, and it had not prevented abuses. However, we keep an open mind.

My constituents believe that halal and kosher food should be labelled as such, but if there are already clear EU legal definitions of “stunned” and “not stunned”, what is there to prevent the UK Government from pressing ahead with labelling food in that way?

Having looked into the matter exhaustively, we concluded that if we introduced “method of slaughter” labelling, it would be best to introduce it at European level, because that would be safer and clearer legally. Spain considered introducing a national labelling scheme in 2012, but the Commission ruled against it.

The Government recognise the important contribution that shooting sports make to rural life, the economy and the environment. Although there are no Government assessments or official statistics, I am aware of a recent industry-funded study, which estimated that shooting is worth £2 billion to the UK economy and supports around 74,000 full-time jobs. It also assessed that the industry spends nearly £250 million a year on conservation.

I congratulate the Secretary of State on her new appointment. I appreciate that she and the Minister are busy at the moment, but may I draw their attention to the report by the Sport and Recreation Alliance, which outlines the enormous economic benefits to rural areas that shooting brings? Will the Government continue to support this excellent form of recreation?

As I said, we recognise the value of shooting sports. Indeed, I referred precisely to the report that the hon. Gentleman mentioned. Shooting sports have an important role to play in rural communities and contribute to our economy.

I thank the Minister for that response. Almost 1 million people participate in shooting sports in the United Kingdom of Great Britain and Northern Ireland. The recreation is worth £2.5 billion through spending on goods and services. What discussions has the Minister had with the British Association for Shooting and Conservation and the Countryside Alliance about how to complement the good work that they do in the countryside?

The Government are aware of the success in countries such as Australia, New Zealand, the United States and the Republic of Ireland in tackling the scourge of TB. For instance, in New Zealand the number of infected herds has reduced from 1,700 20 years ago to just 66 in 2011-12, whereas in the Republic of Ireland the number of BTB reactors fell by 65% between 1999 and 2013. All those countries have pursued a strategy of tackling the reservoir of the disease in the wildlife population as well as other measures.

As we seek to tackle this dreadful disease, is not one of the main lessons from the countries the Minister listed that while we must be prepared to use every tool available to us, we must also continue to develop new tools that might as yet seem out of reach?

I completely agree with my hon. Friend. The 25-year strategy to eradicate TB, which was published earlier this year, emphasised the fact that no one measure will tackle the problem. We need to pursue a range of measures, and that is why we are constantly improving our cattle movement controls and why we are spending £4 million a year investing in research into vaccines. It is also why we are continuing to develop effective cull methods.

17. The new Secretary of State is not answering this question personally, but perhaps she might do so later. The science clearly criticises the Government’s culling policy and this House has voted twice to end it. When will the Government change their mind? Do we not now have an opportunity, with the new broom, to do so?

I disagree with the hon. Lady. The evidence is very clear that no country has ever eradicated TB without also tackling the reservoir of the disease in the wildlife population. The randomised badger culling trial showed very clearly that in the four years after it concluded there was a significant reduction in the incidence of TB. I meet farmers, some of whom have closed herds but have repeated breakdowns and some of whom have been under restriction for 12 years, and although they are not bringing cattle on or off their farm, they have a reservoir of the disease in the wildlife population.

The Minister will be aware of the disappointment and anger among the farming community in Dorset that the badger cull was not extended to Dorset this year despite the support of both the former Secretary of State and the Prime Minister. Will the Minister reassure the farming community in Dorset that DEFRA is on-stream to roll out effective control of bovine TB in Dorset next year?

As the former Secretary of State made clear in his statement, we listened to the recommendations of the independent expert panel. It made recommendations to improve the methodology of the cull and we are going to implement them this year. Our view is that we should improve and get the methodology of the cull right in the two existing pilots before we roll out new ones. Clearly, we will reassess the situation once this year’s culls have concluded.

Small-boat fishermen in South East Cornwall and throughout Cornwall are concerned that a discard ban, along with their tiny share of the UK quota from the EU total allowable catch, will affect their economic viability. Does the Minister agree that repatriation of UK waters should have preceded a discard ban? Will he take forward a request to include repatriation of UK waters in future negotiations?

On the small fleets, I point out to my hon. Friend that we have reallocated some of the unused quota from producer organisations to the under-10 metre fleet. My predecessor, my hon. Friend the Member for Newbury (Richard Benyon), made considerable progress in reforming the common fisheries policy. We now have far greater regional control, with member states multilaterally deciding the management plans, and flexibility on quotas and a legally binding commitment to sustainability.

It is a pleasure to be in the Chamber with so many fellow farmers. I have heard many of them declare their interests this evening. I congratulate the hon. Member for Thirsk and Malton (Miss McIntosh) on securing the debate, and thank members of the Select Committee for their report.

Let me begin by saying a little about the approach that the Government took during the negotiations. My right hon. Friend the Member for South East Cambridgeshire (Sir James Paice) explained very clearly the difficulty that we experienced. We set out to secure a common agricultural policy that was simpler and greener, but despite the best endeavours of my predecessors and a very talented negotiating team, we have ended up with a CAP that is more complex because it was not possible to move the European Commission, or indeed sufficient numbers of other member states, to our position. Our view all along had been that we should keep pillar one—the single farm payments—as simple as possible, and that pillar two was the right option to deliver for the agri-environment.

There are two key issues about which farmers are expressing concern. One is the issue of the three-crop rule, which will affect at least 7% of farmers; the other is the issue of the environmental focus areas and some of the administrative burdens connected with them.

It is important to note the successes that my predecessors achieved in the negotiations. My hon. Friend the Member for Sherwood (Mr Spencer) asked what had been my achievements. I have to say that I was not involved in the negotiations, so the credit for what we achieved should go to my predecessors. However, when it came to the three-crop rule, we did manage to increase the threshold to holdings with 30 hectares or more. We did manage to get the Commission to accept that there should be a distinction between spring barley and winter barley, or spring wheat and winter wheat. And we did manage to move the Commission away from its initial proposal for action that would have been very intrusive—looking at farmers’ incomes to see exactly how much they were earning from agriculture—and, instead. to establish a negative list to remove, for instance, airports, railways and golf courses. So there were successes in the negotiations.

On implementing the CAP, however, we have tried to stay true to that basic stance that we adopted during the negotiations: first, we should keep the implementation of pillar one as simple as possible so farmers can implement this in the most flexible way that works for their own individual holding; and, secondly, we should take the environment very seriously, and we want to deliver for the environment through pillar two—through the agri-environment schemes for which this country has built up an admirable track record.

Does my hon. Friend share my surprise that the shadow Minister should be so strong in his condemnation of the position the Government have ended up with through these negotiations, without in any way spelling out what the Labour party would do on any of the issues?

Well, I think there was quite a degree of consensus. I suppose we have to recognise that the last Government gave up a chunk of our rebate supposedly in order to get CAP reform, but that did not work either. I want to stay on the substance of the issue before us this evening, however.

In terms of applying this basic approach of keeping the pillar one payments as simple as possible, when it came to greening we were clear we wanted to have the flexibility to allow farmers, for instance, to use hedges to count towards their environmental focus areas.

The inclusion of hedgerows as being eligible for pillar two payments is one of the Government’s successes. On that point, while many areas of the country have hedgerows as field boundaries, there are other areas, such as the Cotswolds, that have stone walls as field boundaries. May I ask him to press the Commission hard that those sorts of landscape features should also be included for payment?

There were serious administrative difficulties in terms of allowing hedgerows and all landscape features to count towards the environmental focus area, because each one has to be mapped, and we took the decision in the end that hedgerows were so important to many parts of the country that in the first year we should include those hedgerows and endeavour to get the mapping done, and where it could not be done in year one—we have three years to complete the mapping— farmers would self-declare the hedgerows. We do not rule out adding things like stone walls in years two or three, once we have got hedgerows in place. The task of mapping every single individual feature on every farm is an enormous one, however, and we therefore wanted to start first with hedges, before moving on to things such as dry stone walls.

I am going to try to make progress, I am afraid, and I will address many of the points my hon. Friend made if I have time to get to them.

On the agri-environment schemes, we have been clear that 87% of the pillar two budget will go on the new environmental land management scheme. At the higher end, the scheme will be broadly similar to the existing higher level stewardship scheme, but we will also have an additional rate that has more requirements and obligations than the existing entry level stewardship scheme, and which is more proactive and is almost a middle rate. These will be more targeted, and my right hon. Friend the Member for South East Cambridgeshire raised concerns that this would effectively lead to white areas or deserts where there would be no such support. Alongside this scheme we intend to deal with the problem of so-called white areas by ensuring that there will be directed options right around the country so that whole areas of the country will not be excluded, and grants to support the planting of woodland, for instance, will be universally available.

Many Members touched on matters relating to the three-crop rule, which will cause difficulty for some farmers—up to around 7%, possibly more. We gave serious consideration to advancing what is called a national certification scheme—a nationally designed scheme that would achieve the same thing—because, as my right hon. Friend the Member for South East Cambridgeshire said, the three-crop rule does not in itself guarantee crop rotation. Indeed, there are all sorts of anomalies, not least that a cabbage and a cauliflower are regarded as the same crop botanically as far as the EU is concerned, and there will be lots of similar complications to work through. When we looked at the alternatives, however, we found that they were all more complicated and even more difficult to administer than what was already on the table.

A number of hon. Members have mentioned the uplift to the single farm payment, which is important. It recognises the value we place on upland and moorland farmers, not just as custodians of the countryside, as my hon. Friend the Member for York Outer (Julian Sturdy) mentioned, but as food producers. We are, therefore, equalising the basic payment for upland farmers and lowland farmers, and we will almost double the rate for moorland farmers to about €70 per hectare.

My hon. Friend the Member for Thirsk and Malton raised a number of issues, the first of which related to commons. We understand the concerns about the commons register, which has always been the starting point for the mapping of commons. There are disallowance risks in departing too far from the system we have had in place to date, but I can confirm that in addition to starting with that existing commons register, the RPA will utilise other information available to it, such as aerial photography, to help ensure that those who are entitled to claim on common land can.

My hon. Friend also mentioned the issue of disallowance, and I can confirm that we have set aside a figure of 2% to plan for that. It is our aspiration to get to zero disallowance, but the way in which the disallowance scheme works is incredibly complicated and convoluted. Frequently, the disallowance we get is through no fault of our own; it is often because the European Commission does not understand its own rules, and we can get into very protracted arguments. For instance, the fruit and veg scheme has been notorious as a cause of disallowance. The system is very complicated and I do not think we will ever be able to eliminate disallowance altogether.

A number of hon. Members, including my hon. Friend the Member for Thirsk and Malton, have highlighted the issue of the modulation rate—the inter-pillar transfer. We have made it clear that we will modulate at 12% initially and have a review in 2016. She asked what the criteria for that will be. There are two basic criteria, the first of which is whether there is sufficient demand for those agri-environment schemes to warrant an increase in that budget. That links to a question raised by my hon. Friend the Member for Hereford and South Herefordshire (Jesse Norman). The second is an assessment of the impact on the competitiveness of British agriculture.

Many hon. Members, including the hon. Member for Bishop Auckland (Helen Goodman), have raised concerns about the new IT system. The existing RPA computer system is simply not fit for purpose and we need a new system. The new common agricultural policy is far more complicated, and there are coefficients attached to some environmental focus areas. Somebody growing peas or beans will find that that counts for only 0.7% towards their EFA—0.7% of the area declared—whereas for hedges there is a coefficient of up to 10 times the area of the hedge. The idea that we could do this by drawing things on maps with pencil, as we do under the existing system, and sending that in to the RPA is simply not credible. We therefore believe that to cope with the new system we have to have a digital by default approach and to have everyone adding their data by computer, because that will be simpler.

I completely understand the point that many hon. Members have made about broadband access. We are investing £500 million through BDUK—Broadband Delivery UK—and a further £250 million in phase 2. We have a third fund of £10 million to pilot creative ideas for those really hard-to-reach areas. In addition, we will have an assisted digital package. We will send paper guidance to every farmer in year 1, so although they will not have a paper application form, they will have paper guidance. That guidance will include detailed information on our digital offer. The crucial thing for those lacking the computer literacy to complete their form online or those who have no broadband access is that we will be setting up a number of digital service centres right around the country, particularly targeted at those areas where there is a problem. Farmers will, thus, be able physically to take their information into an office, which will have privacy and be discreet, and work with an RPA agent to enter that information on the system. That is the right thing for everyone. It is right for those farmers, because it removes the risk of them getting penalties and disallowance.

I will finish now, because we are nearly out of time. My right hon. Friend the Member for South East Cambridgeshire highlighted the issues of appeals and a proportionate system. I can tell him that I am now the one who looks at those appeals, this issue is close to my heart, and we are examining it and reviewing it as I speak. The hon. Member for Brecon and Radnorshire (Roger Williams) talked about pillar two, and said that we still needed those single farm payments of pillar one. Part of the 2016 review will examine the competitiveness of agriculture.

In conclusion, we have introduced a CAP that is more complicated than we would have liked, but in the way that we are implementing it, we are staying true to the approach that we took in negotiations to make it as simple as possible

Monday 16 June

Dairy sector

The Commission presented its report on the development of the market for dairy. This was followed by an exchange of views on the draft Council conclusions on the future of the dairy sector. The main point for discussion was the proposal, led by Austria, Germany, the Netherlands, Ireland and Denmark, to relax quotas for 2014-15. After a lengthy debate and failing to achieve a qualified majority in favour of changing the current quotas, the presidency concluded that the Council conclusions could not be adopted at this Council.

School Schemes

The Council noted the presidency’s progress report on the Commission’s legislative proposals for reform of the school milk and fruit schemes without discussion.

The implementation of the provisions concerning producer organisations, operational funds and operational programmes in the fruit and vegetables sector since the 2007 reform

The Council adopted conclusions on the Commission’s report on the operation of the fruit and vegetable producer organisation scheme, including a clear message on the need to cut red tape, simplify the rules and provide much needed legal certainty. The Commission made an accompanying statement committing to review the legislative framework for the fruit and vegetable sector by 31 December 2018.

CAP reform implementation

Ministers highlighted the common agriculture policy (CAP) implementation decisions they had taken and some of the accompanying challenges faced by national administrations and farmers. The UK paper requesting a pragmatic and sensible interpretation of the new CAP regulations, particularly with regard to the greening requirements, was referred to and supported by a range of other member states.

Informal Lunch—US Secretary of Agriculture

EU Ministers attended an informal lunch with US Secretary of Agriculture, Tom Vilsack, to discuss progress on the transatlantic trade and investment partnership (TTIP).

Country of origin labelling for meat

The Commission updated member states on its exchanges with the European Parliament (EP) following the latter’s request for more detailed labelling of the country of birth on fresh meat. All those who spoke stressed that the current rules had been carefully negotiated and could not now be changed.

Severe weather in Slovakia

Slovakia raised the impact of recent storms on its forests and suggested they would call on the EU solidarity fund.

Athens conference on scientific support to agriculture

The presidency reported on a recent conference in Athens on scientific support to agriculture.

National Emissions Ceiling Directive

Twelve member states supported Hungary’s request that Agriculture Ministers be involved in negotiations on the national emissions ceiling directive given the potential impact on agriculture of restrictions on ammonia and methane emissions.

Omnibus Regulation on the Implementation of the Landing Obligation

The Council discussed the latest position on the “Omnibus” regulation, which amends existing technical rules with a view to facilitating the introduction of the landing obligation from 1 January 2015. This will now go forward for discussion with the European Parliament, to reach an agreement by the end of the year, ahead of the first year of the landing obligation.

Implementation of the Common Fisheries Policy: Discard Plans

The Commission welcomed the progress made on the development of discard plans under the new regionalisation process, a new way of working that decentralises decision making and brings it closer to the fisheries affected. I intervened to reaffirm support for the introduction of the landing obligation and the regionalisation process, highlighting the work being done to tailor the first discard plans to the specific needs of the pelagic fisheries in each region.

Management of CapelinTAC for 2014

The Commission reported they had now received an offer of capelin from Greenland and will bring forward an amendment to the total allowable catch (TAC) and quota regulation as soon as possible to provide a TAC for this stock.

Anti-microbial resistance in animal husbandry

Sweden, supported by Denmark, called on the Commission to provide an update to the 2011 action plan on the responsible use of anti-microbials in animal husbandry, claiming that antibiotic resistance contributes to approximately 25,000 deaths per year and €1.2 billion costs to health care services. Commissioner Borg stated that this is a high priority for the Commission. A five-year road map has been published and a full progress report will be published this year.

Animal, plant and control package: smarter rules for safer food

The presidency described progress made on the package of measures. The discussion focused in particular on import controls with divergent views among Ministers on the need for a risk-based “open” system or precautionary “closed” system. I was robust in calling for the outcome to be a genuine simplification with fewer powers delegated to the Commission and respect for subsidiarity in relation to fees and charging of businesses.

Plant Reproductive Material

I specifically supported the presidency paper and its pragmatic approach. Some Ministers took the opportunity to highlight particular changes they wanted to the Commission’s proposal.

In the first instance, the Government believe that it is for retailers and food outlets to provide their customers with such information. However, the European Commission is currently producing a study on options for compulsory method of slaughter labelling, and we will review the options when the report is published later this year.

The Minister is a good man, and I am sure he must understand the strength of feeling among the public about this issue. Surely it is in the best interests of everyone that halal and kosher meat be properly labelled, for the benefit of those who particularly want to buy it and those who particularly do not. Which consumers do the Government think will be disadvantaged by having meat fully and properly labelled at the point of sale?

I am aware of the strength of feeling on the issue, and my hon. Friend has been a long-standing campaigner on it, ever since his ten-minute rule Bill two years ago. There are two difficulties with the approach he suggests. In the case of halal meat, we must remember that about 80% is stunned anyway, so “halal” does not distinguish between stunned and unstunned meat. When it comes to kosher meat, we should recall that the hind quarters of the carcase are not deemed kosher anyway, so an approach along the lines he suggests would not help consumers who want to avoid unstunned meat. However, we will examine method of slaughter labelling when the European Commission produces its report, which is expected in the autumn.

Farmers and food producers raise the issue of labelling often with me and other Members. Can the Minister assure the House that his Department is doing everything it can to have clear labelling on all packaging, particularly after the horsemeat crisis and various other issues, so that we can have country of origin and even region of origin labelling on our packaging?

Some new labelling requirements from the European Union have just been put in place, to distinguish between animals that are born, reared and slaughtered in a particular country, reared and slaughtered there or simply slaughtered there. That is a major improvement. We have stopped short of having compulsory country of origin labelling on processed foods, because the European Commission report suggested that it would be incredibly expensive to implement. However, we do encourage voluntary labelling on such products, and there has been widespread uptake of that.

I am sure my constituents in Kettering would want to see halal and kosher meat labelled as such. Although the Minister is a good man, the response drafted for him by his Department was weak and pathetic. If we wait for the European Commission to rule, we will have to wait for ever. If his objection is that there is no distinction between stunned and non-stunned meat, why not label meat as such? Why cannot the UK do that ahead of the European Commission?

The advice we have received is that it would be better to introduce such regulation at European level. A number of other countries have considered it, including Spain and France, and have run into difficulties. However, my hon. Friend makes a good point—if one were to introduce compulsory method of slaughter labelling, I think one would go not for labelling as halal or kosher, for the reasons I gave earlier, but for labelling as stunned or unstunned.

On 13 May, new amendments to the Dangerous Dogs Act 1991 came into force, including higher sentences for dog attacks, an extension of the offence of a dog being dangerously out of control to all places, including private places, and a specific offence for a dog attack on an assistance dog.

In my constituency there has been a spate of vicious dangerous dog attacks, the latest on an eight-year-old girl named Grace Lucas, who suffered horrible injuries to her face. The real problems are a lack of education and, of course, irresponsible dog ownership. What are the Government doing to tackle those important issues?

The hon. Gentleman makes a good point. Before I became a Minister, I followed the issue closely from the Back Benches. We are doing two things. Later this year we will introduce community protection notices, which will introduce new powers, for instance to issue orders to require an owner to keep their dog on a lead, muzzle their dog or put postbox guards on their door. In extreme cases, there will be powers to insist on a dog being neutered. I also agree with the hon. Gentleman about responsible dog ownership. That is why we are clear that anybody who is breeding dogs for sale should have a licence.

I recently attended a free Dogs Trust chipping event in Blacon in my constituency, and I noticed that a lot of people were unaware that it will be compulsory to have dogs chipped in England from 2016, and Wales from 2015. What is the Minister doing to ensure that dog owners are aware that that will be compulsory from 2016?

That is an important point and we must ensure that dog owners are aware of those proposals. We are working with veterinary practices across the country to ensure that they know about them and are passing the information on to dog owners. We will also run a communications exercise in the press to raise the issue.

In 2013 we opened 112 markets for animals and animal products, helping increase exports to non-EU markets by £179 million, to £1.35 billion. We continue to negotiate with third countries, and so far in 2014 have opened 54 new markets.

My hon. Friend has been an enthusiast for this event coming through his constituency. He raises an important point. We will be looking to use all opportunities we can to promote British foods. Major sporting events are an excellent way for companies to showcase their products. UK Trade & Investment Yorkshire and the Humber is bringing in a series of buyers from around the world to meet local companies at a “meet the buyer” event at the Carriageworks in Leeds on Wednesday 2 July. Many of those buyers will then travel on to the International Festival for Business in Liverpool.

Our egg producers have been outraged to learn that Italy will face no financial penalties for its failure to implement the EU directive that outlaws battery cages. Our poultry farmers have invested millions of pounds to comply with the law, and, as a result, have put themselves at a competitive disadvantage in a very tough international market. Why does the UK implement EU directives that other countries see fit to ignore, and what will the Government do to support our poultry sector?

The Government have consistently raised concerns about other member states not complying with the rules on battery cages that were introduced two years ago. It is fair to say that the Commission has taken this matter seriously and has brought some cases against some member states in the European Court of Justice. We continue to maintain pressure on the Commission, but I believe it takes the matter seriously and is taking the appropriate action.

I draw the attention of the House to my entry in the Register of Members’ Financial Interests.

The Minister will be aware of the drastic reduction in farm-gate beef prices and the effect that has had on confidence in the sector. Will the Minister tell us why he thinks that reduction has taken place? What is he doing to find other markets that will encourage an increase?

The hon. Gentleman makes an important point. This is one of the key issues being raised with Ministers as we go around agricultural shows. We will have a summit on the matter before the summer recess. A number of factors are driving this: it is partly due to changes in global commodity prices, but it is also clear that in some cases supermarkets are taking a larger margin than before. Regarding solutions, we are keen to open new export markets for British beef so that farmers can get a better price. We are also keen to ensure that there is fair contracting between farmers and processors, and between processors and retailers.

The Minister will be aware of my correspondence on the export of pork to China. From his correspondence to me on 8 May, I know that inspections are to take place with the authorities in Northern Ireland, as DEFRA regulates the negotiations on behalf of the whole of the UK. Will the Minister advise the House on when those inspections will take place? What is the possibility of approval following on from that?

The hon. Lady has raised this issue with me a number of times and we have had meetings on it. It was also raised with me at a meeting in Northern Ireland at the beginning of this year, and we continue to raise it with the Chinese authorities. When Mr Zhi, the Chinese farming Minister, was in the UK in April we took the opportunity to raise it again. We want more meat processors to be able to export pork to China and we need clearance for their plants. We will continue to keep up the pressure.

Exporting beef would improve the market here, and I know the Secretary of State has done an excellent job in China. Japan still bans our beef, right back from the days of BSE. We now have BSE completely under control, so it is time those markets were opened up again. Will the Secretary of State and the Minister do their very best to make sure that happens?

All I can say to my hon. Friend, who has been a champion of this industry for many years, is that we are working on many different fronts to create new markets. In the past year, we have opened markets for breeding cattle to countries such as China, for pig meat to Chile and for dairy to Cuba. In the year ahead, we will continue to look at exporting beef to Singapore and poultry meat to Papua New Guinea. The country is working incredibly hard to open as many new export markets as possible.

The International Council for the Exploration of the Sea assesses the state of EU fish stocks annually. The next round of advice for the majority of European fish stocks, including those in UK waters, will be released on 30 June, and will inform decisions on 2015 fishing quotas that will be made at the 2014 December EU Fisheries Council.

Given that fishing is such an important part of Southend’s economy, it is very disappointing that stocks of sole, plaice, cod and herring have been depleted as a result of channel deepening via suction dredging. Will my hon. Friend please look into that, and ensure that the Thames estuary is pollution-free and full of fish again?

This issue was raised with me during a recent conference of the National Federation of Fishermen’s Organisations, and my hon. Friend has written to me about it as well. The chief fisheries science adviser at the Centre for Environment, Fisheries and Aquaculture Science has subsequently overseen an initial investigation of the issue, and has prepared a detailed report that acknowledges that there has been a decline in stocks recently. The cause of the decline is not clear, but some have pointed the finger at the London Gateway development. Other possible causes include the discharge of surface water that may contain contaminants. Another meeting is planned for July, when next steps will be decided on.

Given that it is clearly in everyone’s interests for the UK fishing industry to modernise and, in so doing, to use good data to protect and grow fish stocks, why has the Minister allowed the Marine Management Organisation to relax its commitment to use a European Union grant that was specifically designed to support the sector for that purpose?

Responsible drift netting plays an important role in the management of UK fish stocks, and has been a traditional part of fishing off the East Anglian coast for centuries. Can the Minister confirm that the Government will ensure that the European Commissioner’s proposed blanket ban on drift netting, which will destroy what is left of the Lowestoft fleet, is not introduced?

We are aware of the issue, and we think that the targeting of species such as herring, bass and salmon by UK drift net fisheries is a far cry from the type of drift netting with which the previous ban sought to deal in the Mediterranean. We will be negotiating for the application of a risk-based regional approach to ensure that the right fisheries are monitored and required to take the appropriate litigation action when that is necessary, without the imposition of a blanket ban on drift netting.

First, I would like to declare an interest: my brother is the chairman of the British Lop Pig Society, and he has made representations to me about the time it takes some abattoirs to carry out the trichinella test, which we are investigating.

The Food Standards Agency, which has responsibility for this policy area, formally consulted on the changes to trichinella testing in March 2014. Responses indicated broad support, but also that awareness of the changes is low.

I thank my hon. Friend for that answer. Outdoor or free-range pigs are very prominent in Suffolk, where the industry is important, and it feels there has been a stitch-up by the FSA with the pig marketing association. I recognise the FSA is not my hon. Friend’s ministerial responsibility, but it is very important that free-range and organic pigs should not be literally the sacrificial pig to satisfy the European conditions that are being imposed.

I understand the point my hon. Friend is making. There had been some indication at some point that all pigs should be tested for trichinella. We have tended previously to test only boars and sows that are cull sows. However, the argument for testing only outdoor pigs as a compromise is that outdoor pigs are more susceptible to picking up this type of tapeworm.

T3. I never thought it would be possible that in this day and age, in one of the richest countries in the world, I would see my local churches and charities going out collecting money for food banks. Will the Minister pay tribute to those kind and caring people? Is this not in stark contrast to this rotten Government, who shower gifts on the wealthy while they watch the poor go hungry?

I am happy to join the hon. Gentleman in welcoming the great work that is done by the food banks. I regularly visit one in my own constituency that does very good work, and we should celebrate that. On the wider point about food prices, which the Department is responsible for looking at, it is important to note that in the year to the end of April, food price inflation was down to 0.5% and food prices have actually fallen in the past couple of months, so this is now significantly below average inflation in the economy.

The removal of notifiable disease status for contagious equine metritis and equine viral arteritis is causing much concern in the world-class blood stock industry in this country. Is the Minister aware that the export of horses from the UK to Hong Kong, India, Qatar, New Zealand, Saudi Arabia, UAE and other countries is likely to be hit because notifiable status is a prerequisite for horses in those countries?

I had the opportunity to meet my hon. Friend and my hon. Friend the Member for West Suffolk (Matthew Hancock), the Minister for Skills and Enterprise, with a delegation from the Thoroughbred Breeders’ Association. I understand the points they are making. Although those two diseases have a low impact and can be prevented through the application of the industry’s codes of practice, there could be some concerns about the impact on trade. That is why I have asked officials to look at the matter closely, to reassess the impacts on the trade, and to investigate alternative ways forward, such as burden sharing with the industry. I can assure my hon. Friend that we are looking at this closely and will take his views into account.

The collapse in beef prices is having a very damaging effect on the market. What steps can the Government take to ensure that where cheap imports from eastern Europe are for sale on supermarket shelves, shoppers know that they are cheap imports?

I am grateful to the Liaison Committee and to the hon. Member for Stoke-on-Trent North (Joan Walley) for securing the debate. I should also say that I am disappointed that, in a way, our debate has been undermined by the previous one. Let me reassure the shadow Minister, the hon. Member for Bristol East (Kerry McCarthy), that although I am giving the Government response to the debate, we take this issue seriously across Government. The Under-Secretary of State for Foreign and Commonwealth Affairs, my hon. Friend the Member for Boston and Skegness (Mark Simmonds), gave evidence when the Environmental Audit Committee was considering the issue, and we work closely on it.

It is clear from today’s debate that people are very passionate about our overseas territories and the rich natural flora and fauna that they support. The UK has 14 very diverse overseas territories, 11 of which are inhabited, and between them they contain, as the hon. Member for Stoke-on-Trent North said, about 90% of the biodiversity found in the UK and its overseas territories combined.

I shall start by talking about some of the constitutional issues, to which my hon. Friend the Member for Hendon (Dr Offord) dedicated most of his contribution. Many of the recommendations made by the Committee and raised again today pertain to that aspect. The constitutional position was set out very clearly in the 2012 White Paper, “The Overseas Territories: Security, Success and Sustainability”, published by the Foreign Office. It made it clear that although the Government have a fundamental objective and responsibility for the security and good governance of the territories, each has its own constitution and local laws, and powers are therefore devolved to the maximum extent possible.

The inhabited territories are constitutionally responsible for the protection and conservation of their natural environments and for developing appropriate environmental policies and legislation. There is no appetite in the territories for the UK Government to take a greater role in managing environmental issues on their behalf, but that is not to say that we cannot provide considerable support. I want to come on to that issue later.

There is, and I will come back to that point, because I want to talk about some of the international aspects.

The second issue that I want to touch on is that of staff, because several hon. Members have suggested that DEFRA has no one dedicated to this subject. In fact, there are four DEFRA staff working on overseas territories issues, and they include the head of our international biodiversity policy unit. The report suggested that there should be more visits by DEFRA staff to the overseas territories. I am sure that there would be no shortage of volunteers to undertake those visits to see the wonderful specimens of wildlife that we have there, but I question the value of spending money on air fares when we could be spending money on projects that will deliver and will enhance the biodiversity of these areas. Also, not carrying out physical visits to these areas does not mean that they are not in regular contact with their counterparts in the territories. They certainly are. For instance, earlier this week we were speaking to officials from Tristan da Cunha about the islands’ biosecurity needs and the exciting news that a new bird species may have been identified on one of the islands. I am told that it is a prion and similar to a kiwi. We await peer review of that new discovery.

We also organise workshops and training for the territories. For example, in March, officials organised a practical workshop on how to implement the convention on international trade in endangered species. It brought territory officials together with representatives from DEFRA, the Animal Health and Veterinary Laboratories Agency, the JNCC, Kew gardens, Border Force and the Government Legal Service. We also offer access to expertise and a range of services, including a plant pest identification service provided through the Food and Environment Research Agency which helps to protect both biodiversity and agriculture in the territories. That service has helped the territories to put in place measures to combat invasive invertebrate pests, and has to date identified 16 species new to science.

There is also, of course, regular discussion at ministerial level. We have the Joint Ministerial Council, which brings together UK Ministers and territory leaders and representatives and is organised collaboratively. The Environmental Audit Committee recommended that we should prioritise greater involvement of the territories in setting the agenda for those meetings, but I assure hon. Members that we already do that. We already have regular meetings with the UK-based representatives of the territory Governments in the run-up to Joint Ministerial Council meetings and, following discussions with them, we held Minister-led plenary sessions on the environment in 2012 and on renewable energy in 2013. Responding to specific territory requests, we also held in 2013 a technical discussion in which territory representatives were able to speak to UK experts on a range of environmental issues.

International agreements were mentioned by a number of speakers. As the Select Committee rightly pointed out, protection of the environments of the territories is relevant to the goals and targets set out in the convention on biological diversity’s strategic plan, which 193 countries around the world, including the UK, have already committed to implementing. As the Committee also pointed out, the convention has so far been extended only to four of the UK’s 14 overseas territories.

The Government recognise that most of the territories are small islands or island groups that face capacity constraints, which may affect their ability to consider or implement treaties. In such circumstances, we do not believe that it would be in the best interests of the territories, the UK or the wider environment to impose on the territories obligations that they are ill equipped to fulfil. We do, however, encourage territory Governments to join in the UK’s instrument of ratification of core multilateral environmental agreements. That includes working with them to ensure that they have the necessary measures in place to fulfil their obligations, providing technical advice and building capacity before extension of ratification takes place. As the hon. Member for Stoke-on-Trent North made clear, the Select Committee recommended that the CBD be extended to other overseas territories. Although we believe that that is a matter for the territories themselves, I am pleased to be able to inform hon. Members today that my officials are currently working with a further three territories on just such an extension of the CBD.

Funding is important. The Committee’s own report acknowledged that DEFRA spending on the UK overseas territories has increased since 2007-08, and increased sixfold between 2010-11 and 2012-13. We do that mainly through mechanisms such as Darwin Plus. That cross-Government grant scheme, co-funded by DEFRA, the FCO and the Department for International Development, funds environmental projects in many of the territories. In the past two years, Darwin Plus has committed nearly £3.7 million to 29 projects in the territories. Returning to the issue of international agreements, it is important to note that in many cases the grants that are offered help to deliver and advance the objectives that were set out by the territories in the environmental charters, when those were put together and agreed on in 2001.

I am grateful to the Minister for giving way at such short notice. In the Cayman Islands, there is a conservation fund, which comes from a tax levied on people when they leave the islands. That has allowed a pot of money—£40 million—to accumulate, but the authorities are not able to spend it, because there are not governance arrangements in effect. Does the Minister think it wise to be spending UK taxpayers’ money overseas when they already have their own resources but they do not have the governance measures to allow them to spend it?

I was going to come on to the issue of the Cayman Islands. I am not familiar with the particular point that my hon. Friend has raised, but, consistent with the charters, I am able to say that, with UK Government support, the Cayman Islands’ long-awaited National Conservation Bill was passed on 13 December 2013. The law will, for the first time, give legal protection to Cayman’s unique and diverse land and marine-based natural resources. Although this is a delegated area of responsibility, the UK Government provided political support for the passing of the law, including through visits by the Under-Secretary of State for Foreign and Commonwealth Affairs, my hon. Friend the Member for Boston and Skegness.

My hon. Friend the Member for Richmond Park (Zac Goldsmith) spoke about marine protected areas. The Government have been enthusiastic supporters of MPAs, having established the largest no-take MPA in the world in the British Indian Ocean Territory in 2010. We have also established a 1 million sq km sustainable use MPA around South Georgia and the South Sandwich Islands, 20,000 sq km of which is a no-take zone. I am sure that the House will be pleased to hear that in 2009 the UK provided the science that underpinned the declaration of the first Antarctic marine protected area.

I want to mention a couple of other points that were raised. One was about EU funding and LIFE+. I can confirm that the Government worked with NGOs to allow that European fund to be used on these projects, and we continue to work with them on that. An issue relating to the Department for Culture, Media and Sport was raised. On that, one of the obstacles is that, in some of these countries, gambling is illegal. Nevertheless, certain organisations can already claim money.

We are running out of time, but let me say in conclusion that I think we have had a very good debate. I hope that I have managed to persuade hon. Members about our commitment to these issues, and we will be publishing on Monday—

I congratulate my right hon. Friend the Member for Uxbridge and South Ruislip (Sir John Randall) on securing the debate and on bringing the subject to the attention of the House. He has a lifelong passion for such issues, being a member of the RSPB for some 50 years, as he said. Last time I debated with him in Westminster Hall, the subject was farmland birds, so I know that he is a long-standing campaigner. He is also in tune with the mood of many in the country.

Britain has always been a pioneer of conservation, and birds have always been at the forefront of this country’s passion for wildlife. Groups such as the RSPB are among those with the largest membership in the UK. As a result, wild birds have been afforded strong levels of protection in the UK since the introduction of the Protection of Birds Act 1954—a full 25 years before the EU birds directive made the protection of wild birds, in much the same manner, an obligation on all member states. It therefore comes as no surprise to me that my right hon. Friend, along with many others, was disturbed to see recent media coverage of the annual spring hunting season in Malta.

In reacting to such reports, it is important to bear in mind the distinctions between lawful hunting activity that the EU birds directive specifically permits member states to undertake, and the illegal hunting carried out by those acting outside the law. The directive provides a strong framework for the protection of all naturally occurring wild birds throughout the EU and requires each member state to take measures to ensure the protection, management and control of birds, their eggs, nests and habitats, and to maintain populations occurring within their range at levels that correspond to their particular ecological, scientific and cultural requirements. The directive, however, also lays down rules for the exploitation of such birds through hunting activity and permits the “judicious use” of wild birds for economic and recreational purposes.

Some species may be hunted for sport or food throughout the European Union, while certain others may be hunted only within specified territories. The birds directive is clear that any hunting activity must remain compatible with maintaining the populations of the species, and it contains safeguards to ensure that. The responsibility of individual member states and of the European Commission is to ensure the correct transposition of, and compliance with, EU directives. It is, however, a well known fact that the Commission has previously expressed concerns about the hunting of migratory birds in Malta. Permitting the spring hunting of turtle doves and quail has been the subject of particular Commission scrutiny to ensure that it is compliant with the directive.

Together with other islands in the Mediterranean, such as Crete and Cyprus, the islands of Malta play a vital role for many migratory species of bird during their long flight between Africa and Europe. The EU directive recognised that it is important for the birds to receive particular protection in spring, so that they may breed and build up their populations from the low point in their natural annual cycles. Some evidence suggests, in particular for turtle doves, that the impact on populations of spring hunting can be up to eight times higher than the impact of autumn hunting.

In 2009, as a result of such concerns, the European Commission referred Malta to the European Court of Justice for permitting the hunting of turtle doves and quail during their spring migration. The Court ruled that, by permitting that activity between 2004 and 2007, the Maltese Government had failed to comply with the derogation conditions associated with hunting and, as such, had failed to fulfil their obligations under the directive. The Court, however, also recognised that Malta’s unique bio-geographical circumstances restricted hunting opportunities in autumn, and it therefore reaffirmed Malta’s right to permit limited hunting in spring through a derogation from the birds directive, subject to meeting the stringent parameters of article 9(1)(c) of that directive.

I am told that the doves migrate through Malta, rather than being resident there. That was a conclusion of the Court—that the situation could not be dealt with in other ways, which was why it upheld the right. That was its judgment.

In response to the 2010 judgment, the Maltese Government developed a new legal framework and introduced a number of changes to how they control the spring hunting of turtle doves and quail to ensure compliance with the directive. Measures include annual estimations of the populations of species; limits on the number of birds that may be shot during the hunt under the derogation; and an assessment of whether the populations are likely to suffer any detrimental effect.

Despite the changes, a number of organisations and individuals have continued to campaign against the spring hunting permitted by the Maltese Government. I understand the concerns expressed, but it is for the Maltese Government to investigate any alleged illegal hunting activity that might be taking place alongside their permitted hunting regime. We should also bear in mind, as a number of Members have pointed out, that the issue is an incredibly contentious one in Malta itself. It has been said that more than 10% of the population have signed a petition calling for a referendum—as my right hon. Friend pointed out, it already has up to 45,000 signatures and it is being considered.

Fortuitously, I was in Athens over the past few days, at an informal meeting of the European Council. Knowing that the debate was coming up, I had the opportunity to discuss the subject briefly with my opposite number, Roderick Galdes, on the margins of one of the meetings. In fairness, the Maltese Government believe that they have done a lot to tackle the illegal killing of doves, and they feel frustrated that that has not been recognised. He highlighted some of the steps that Malta has taken to strengthen enforcement. It now has the highest ratio of enforcement deployment possible per square kilometre of countryside anywhere in Europe. He also pointed out that Malta’s penalties and legal deterrents against bird-related crime are among the most severe in Europe. He stressed that there had been some 4,000 physical inspections. I am simply pointing out the argument made by the Maltese Government.

Yes. I am simply reporting the argument of the Maltese Government. As I said, I took the opportunity to discuss the matter briefly with my opposite number. They feel that they are not given credit for the steps they have taken, which they argue have resulted in a very tight regime, with tough reporting requirements.

Where there is evidence to suggest that illegal hunting activity is occurring, the UK Government encourage all relevant authorities to ensure that sufficiently robust action is taken. As I have stated, compliance with the European Union directives, including any alleged failings, is a matter for the individual member states and for the European Commission. Representations have been made, for example by a number of MEPs in the European Parliament, and many organisations and members of the public may also express their concerns through their MEPs.

Finally, turning to the situation here, sadly a number of the UK’s migratory bird species have experienced population declines over recent decades. A range of factors are thought to have contributed to that trend, many of which we discussed in the previous debate on this issue, including habitat loss from historical farming intensification, poor food availability and disease.

The impact that overseas hunting may have on British populations of migratory birds is unclear at the moment. Malta’s geographic position means it is unlikely that a significant proportion of our migratory bird populations pass over it; most are thought to come through places such as Gibraltar. We therefore think that spring hunting in Malta is unlikely to be having a direct impact on populations here. However, my right hon. Friend has made the valid point that he is not taking a British but a European perspective on the issue, and it may be having an impact on populations elsewhere.

Domestically, we have implemented a range of initiatives to help improve bird populations. When I last discussed the issue with my right hon. Friend, we talked at great length about the environmental stewardship schemes and the new environmental land management schemes. Turtle doves are one of six targeted species for funding in the current regime, and we expect that the new environmental land management schemes will see further benefits for farmland birds. We have made it clear that we want to prioritise biodiversity.

We are aware that illegal hunting and killing activity is a problem for many countries that are important in the life cycle of migratory birds—that is the case with Malta. This issue therefore needs strong co-operation and enforcement activity at every level. In the UK, the joint nature conservation committee has always played a leading role in the international action plan for African and Eurasian migratory land birds. We are playing our part and continue to make the case on these issues.

I congratulate my right hon. Friend once more on securing the debate. As I said, he has long championed these issues. This is a contentious issue in Malta as well. I am not sure that a British intervention will necessarily help Malta to make up its mind, given that the issue is so contentious and so many people there have expressed clear views on it. The debate has been an interesting one that has highlighted an issue that is important to many people.

I represented the UK at the EU Agriculture and Fisheries Council on 24 March. Richard Lochhead MSP was also present.

Promotion of agricultural produce

The Council agreed its political approach to national co-financing and selection of programme proposals for promotion of agricultural produce. It set the ceiling for EU funding at 75%—85% in times of crisis—with producers making up the difference and national co-financing removed, in line with UK lobbying.

Management of sand eel—establishment of a total allowable catch (TAC) for 2014

The Council adopted by qualified majority a Council regulation setting up TACs in 2014 for sand eels and blue whiting. The UK abstained as the Council regulation had not cleared parliamentary scrutiny.

Coastal states consultations on mackerel and EU/Norway bilateral consultations

The Council discussed the outcome of the negotiations. The deal on mackerel reached between the EU, Norway and the Faroe islands 12 March was a major achievement, bringing to an end the long-running international dispute over the management of what is the UK’s most valuable stock. The Commission confirmed that discussions with Iceland would continue in the hope that it would also join the agreement.

The conclusion of a deal on mackerel also enabled bilateral fisheries agreements to be reached between the EU and Norway and the Faroe islands. These allow the joint management of shared stocks and give access to each other’s waters for 2014.

Overall the three agreements were supported by member states, though some expressed their concerns about the extension of the fully documented fisheries (FDF) scheme for North sea plaice in the EU-Norway agreement. The UK welcomed the agreements given the benefits they will provide for UK fishermen and responded to the concerns on extension of the FDF scheme by highlighting the importance of pilot projects to prepare for the discard ban. The Commission supported the UK position on FDF.

Processed meat labelling

The Council was divided on indications of the country of origin or place of provenance for meat used as an ingredient. During discussions three broad camps emerged: the UK and others favoured the current voluntary approach; a second group favoured mandatory labelling and a third group said that further discussion was necessary. The presidency decided to convene a working party to examine the report and member state positions further.

Organic production

The Commission reported on its organic production proposal which aims to support the increased demand, while taking account of consumer standards, the risk of fraud and the need for transparency. It also encourages spending of both pillar 1 and pillar 2 funds on research and innovation in this area. There was no discussion, and the presidency confirmed that the proposal would now go to working group.

Fruit and vegetables

The Commission presented its report on the ED fruit and vegetable production sector following the reform of the sector in 2007. ED Fruit and vegetable consumption had reduced since the reform. However the percentage of the EU’s fruit and vegetables grown by producers that are members of producer organisations had increased during the same period. The Commission stated that it would bring forward specific proposals, with a focus on improving the long-term competitiveness of the sector. Again, there was no discussion but the presidency confirmed that this topic would be on a future Council agenda.

Any other business

Honey breakfast initiative

Slovenia explained its “honey breakfast” initiative which aimed to educate children on the importance of bees.

International year of family farming

Hungary reported on the convention it had hosted to celebrate the international year of family farming. The Commission noted that it would run a conference on the same topic in Bucharest next month.

Rice

Italy and other member states said that their rice sector was under pressure from imports from Cambodia. The Commission noted that the import tariffs imposed on developing countries had been zero rated to encourage development and that it would keep the situation under review.

Dairy sector

Member states maintained the same positions outlined in last month’s discussion on the situation in the dairy sector. The Commission and presidency again noted the lack of a qualified majority in favour of the “soft-landing” on quotas and that the Commission would report in June.

Illegal, unreported and unregulated (IUU) fishing

Spain, supported by other member states, said it was firmly committed to combating IUU fishing, but was disappointed with the implementation of the regulation. They also had concerns about the transparency of the process for listing non-co-operating countries. The Commission disagreed that the process for listing non-co-operating countries was opaque or that they were not committed to the regulation. The Commission confirmed that the regulation would be reviewed next year but for now it was focused on its implementation.

As always in these debates, I have many questions to answer and not a great deal of time, but I will do my best. I begin by congratulating my hon. Friend the Member for South Thanet (Laura Sandys) on securing the debate, which has provided us with an excellent opportunity to explore the interim report on the integrity and assurance of food supply networks and for me to update colleagues on activities since the discovery of horsemeat fraud in 2013.

As my hon. Friend pointed out, the horsemeat fraud incident last year inflicted considerable damage on our food industry and undermined confidence in our food. It was damaging to the retailers and processors involved, and that should drive home to all of them the reality that they have more to lose than anyone by cutting corners or allowing the integrity of our food supply chain to be compromised.

Food fraud is completely unacceptable. It is a crime. The competitive pressures of the marketplace, to which my hon. Friend referred, are no excuse for misleading consumers and committing fraud, so lessons must be learned by all involved. The Government take the threat of food fraud very seriously and want to ensure that lessons are learned. That is why we asked Professor Elliott to look into what could be done to protect the food chain and to restore consumer confidence following the horsemeat fraud scandal.

As all hon. Members here know, Professor Elliott published his interim report in December 2013. We should note that, in it, he makes it clear that UK consumers have access to some of the safest food in the world, so it is not all bad. However, there is no room for complacency. Professor Elliott sets out what he has identified as the key features of a national food crime prevention strategy. The interim report includes no fewer than 48 recommendations, which Professor Elliott has been discussing with the industry and the Government as part of the consultation process for the preparation of his final report. The Government have also been discussing the interim report with interested parties. My hon. Friend specifically asked whether we were discussing the issue with retailers and with industry, and I can confirm that we are. Whenever I have meetings with retailers, it is one of the issues on our agenda.

There are 48 recommendations, but we can break down Professor Elliott’s report into three key themes. First, he identifies a package of measures in relation to testing and enforcement. Secondly, a big part of his report is dedicated to responsibilities in the supply chain, both on retailers and on processors. Finally, there are issues relating to the co-ordination of Government efforts, the links between Government agencies and co-ordination between Government agencies and local authorities. Professor Elliott raises important issues relating to all three areas, and we will consider carefully the supporting analysis in his final report before making a formal response.

However, there is much that we are already implementing, and I want to spend a little time highlighting what has already been done. First, the Government have increased their funding to support local authorities’ co-ordinated programme of food sampling from £1.6 million to £2.2 million in 2013-14. The Food Standards Agency and DEFRA are helping to target local authority resources through greater central co-ordination of intelligence, by providing additional support for complex investigations, by making available some of the funding for additional training and through prioritised sampling to target delivery at areas of agreed national importance.

Secondly, an intelligence hub has been established in the FSA to improve its capability to identify and prevent threats to food safety and integrity, based on the approach to intelligence used by the police. City of London police is heavily involved in that. That intelligence hub approach, which brings together local authorities, the police, the FSA and other interested parties, is a key step towards improving co-ordination, the need for which was highlighted in Professor Elliott’s interim report and which many hon. Members have referred to today. My hon. Friend the Member for South Thanet also talked about the importance of information sharing, particularly with industry. We are working with industry to tackle some of the commercial sensitivities that can act as a barrier to information sharing. The FSA is doing some work to improve its access to industry information.

Thirdly, as my hon. Friend the Member for Thirsk and Malton (Miss McIntosh) pointed out, the food fraud experienced last year was a problem at a European level, so we need action at a European level to tackle it. Despite famously being quite Eurosceptic, I am happy to tell the hon. Member for Ogmore (Huw Irranca-Davies) that we recognise the problem to be a European one, and that we need action at a European level. The new European food crime unit, which is being developed by the European Commission, will be an important part of that intelligence network. The FSA is working with the European Commission and with other member states to get the unit up and running as soon as possible.

Several hon. Members have talked about the importance of enforcement, and particularly pursuing convictions for the offences committed last year. My hon. Friend the Member for Thirsk and Malton asked why more had not been done. Action has been taken to try to secure convictions for the offences committed last year. Those investigations are taking a little longer than many people would hope, because they are quite complex and cross many national boundaries. A number of police authorities across Europe are involved: Dutch, Polish, Danish, Italian, French and our own. Because the crimes were committed on a pan-European level across borders, it is taking time to deliver those convictions.

I do not accept that. Investigations are continuing at a number of sites across the UK. City of London police is co-ordinating the police forces for all the investigations. Five arrests have been made, and the announcement a couple of weeks ago by the Crown Prosecution Service of two cases being taken to court demonstrates that action is being taken to protect consumers from mislabelling and to tackle food businesses’ failure to ensure the traceability of the products that they supply.

The hon. Member for Ogmore talked about the penalties for committing food fraud crimes. The penalty for food offences can range from giving advice or a formal notice for very trivial breaches, such as if a mistake has been made on labelling, to criminal prosecutions for the most serious offences such as fraud. We should bear in mind that when it comes to fraud, it is possible to implement a prison sentence of 10 years. I think that there are sufficient penalties in our criminal law to tackle the most serious cases.

Several hon. Members have talked about the role of the industry, which is one of the key themes picked up by Professor Elliott. As I said at the outset, the food industry has the most to lose from a decline in confidence in the supply chain, and it has a responsibility to take a leading role. As of today, the industry has submitted more than 45,000 tests of beef products for horsemeat since the horsemeat scandal broke, and no new positives have been reported since the height of the incident. Retailers and processors have taken a thorough approach to testing. The tests are being carried out through the supply chain, not only by retailers but by processors, looking at the ingredients going into products in local convenience stores as well as large national retailers.

Food businesses and trade associations representing the whole food chain are also working with the FSA and Professor Elliott to consider how to make better use of audit and controls. Professor Elliott is keen to develop ways of achieving a more streamlined and effective auditing process.

I welcome the Minister’s full response. Is the Department for Environment, Food and Rural Affairs working, in its strategy section, on early warning systems when commodity prices are going up but food prices are going up only a little bit, totally disproportionately? That must be an important signal that gives Government the sense that something is not quite right.

I was going to come on to that point, but I will deal with it now because my hon. Friend has raised it. She highlighted passionately in her speech the fact that there has not been as much of an increase in retail food prices as there has been in commodity prices. That can be normal, because commodity prices tend to cover a small number of products, whereas there is a broader range of products in food stores. There has been a 12% rise in food prices in real terms between 2007 and 2012, with the biggest spike in 2008.

In many debates on food banks and the like—I notice that the right hon. Member for Birkenhead (Mr Field) is not here—I am told repeatedly that the price of food in the shops is going up. My hon. Friend the Member for South Thanet highlighted the frozen cottage pie that cost £1 and did not go up in price again, but food prices at the retail end have gone up by 12%, and the fact that certain individual products have stayed the same price may come down to pricing strategies and promotion, so we cannot read too much into such examples. I recognise her point, however. The FSA has reviewed its emerging risks programme, and it is working with DEFRA to identify and assess the economic drivers of food fraud so that those influencing factors are better understood and acted on.

Again, that is something that I was going to come on to. Food enforcement is a devolved responsibility. The Elliott review was commissioned by the UK Government, but it is being followed with close interest by the devolved Administrations and we are discussing it with them.

Some hon. Members have suggested that the supply chain is too long and too complex. I should perhaps declare an interest, in that my family run a farm shop and butchery, the slogan of which is “Food yards, not food miles.” I have a clear interest in such issues. It is a valid point that small businesses and small retailers may often have far less complex supply chains, and we can learn from that. The horsemeat fraud incident demonstrated the higher vulnerability of some of the more complex supply chains, and many retailers are learning the lessons from that. One could argue that there has been an over-reliance on the paperwork involved in all the systems for traceability and following products from processor to retailer. The onus is on larger retailers to take much greater interest in where their food comes from.

I want to pick up on a few of the other points that were made. I completely agree with my hon. Friend the Member for South Thanet that we should not be seen as a soft touch. It is worth remembering that the EU-wide testing programme discovered less than 1% of products in the UK that were affected by the horsemeat scandal, compared with an average of 4% to 5% in other European countries. Although we are not complacent, we had a more robust system than did many other countries. She also highlighted the fact that there are 111 inspectors in Holland, but I point out that Holland has a slightly different approach. In our local authorities in this country, we have more than 2,700 inspectors; it is simply that they are not in a dedicated unit but sit within trading standards.

The hon. Member for Bristol East (Kerry McCarthy) mentioned adverse reports from local authorities that have done their own inspections. It is encouraging that local authorities are stepping up to the mark and carrying out such inspections. As I pointed out, there are two reasons why the figures can look misleadingly high. First, local authorities tended to investigate where there had been complaints, so we would expect them to have found more problems. Secondly, many of the problems that they found were mislabelling, foreign-language labelling or things not being in the right place. Only a small number were food adulteration.

I am afraid that I have run out of time. We welcome this debate, which has been a great opportunity to explore the issues highlighted by Professor Elliott, and we look forward to his final report.
