I represented the United Kingdom at the Agriculture and Fisheries Council on 6 November in Brussels.

The Council opened with member states responding to the presidency’s questions on the sustainable use of pesticides. There was widespread agreement that national action plans are a good way for member states to tailor their approach to meeting the objectives of the sustainable use of pesticides directive, and widespread support for the principles of integrated pest management. The UK welcomed the European Commission’s report on the sustainable use of pesticides, highlighting that integrated pest management is the key to future crop protection.

The presidency outlined the conclusions of the sustainable soil management conference held on 4-6 October in Tallinn, which highlighted the importance of managing soils and designing policies based on a strong evidence base. Responding to questions posed by the presidency, the UK informed Council that soil health goes hand in hand with farming productivity.

Commissioner Hogan then updated the Council on EU agricultural trade.

On 23 June 2016, the EU referendum took place and the people of the United Kingdom voted to leave the European Union. Until exit negotiations are concluded, the UK remains a full member of the European Union and all the rights and obligations of EU membership remain in force. During this period the Government will continue to negotiate, implement and apply EU legislation. The outcome of these negotiations will determine what arrangements apply in relation to EU legislation in future once the UK has left the EU.

I congratulate my hon. Friend the Member for Wellingborough (Mr Bone) on securing the debate on an application that has been made for a new poultry development in his constituency. I am aware that it is contentious in his constituency, and indeed that a petition signed by many people is already doing the rounds. I join him in offering my sympathy and condolences to Jenny Harwood, the wife of Councillor Glenn Harwood, whom he mentioned. He gave a fitting, moving tribute to the councillor, who sadly passed away this week and who, like so many of our councillors, did much work and campaigning that does not always get recognised. It was right for him to note that today.

The proposal is currently the subject of a planning application, and it will not be considered by East Northamptonshire Council’s planning committee until December 2017—next month—at the earliest. My hon. Friend is familiar with processes and aware that this is a planning application and not an issue that either DEFRA or Ministers would lead on in the first instance. Local authorities act independently of central Government when it comes to planning applications. However, the Government have a role when it comes to developing national planning policy. We are clear in national planning policy that local councils should prevent existing developments from being put at unacceptable risk from, or adversely affected by, unacceptable levels of air or noise pollution. That can include emissions such as smoke, fumes, gases, dust, odour and noise.

Obviously, the weight to be given to representations on a particular matter is ultimately for the decision maker, whether that is in the first instance the planning authority, or indeed, if it goes to appeal, the planning inspector. I know my hon. Friend is familiar with all that; indeed, he did not ask me to intervene in a planning decision. Many of his points related to animal welfare, to which I will return.

My hon. Friend also mentioned the area where DEFRA has a role: environmental permits, for which the Environment Agency is responsible. Under the Environmental Permitting (England and Wales) Regulations 2016, there is provision for large poultry units—as he identified, that is those with more than 40,000 places—to be permitted by the Environment Agency. The permit covers all aspects of farm management from feed delivery to manure management in order to ensure that farms take the responsibility to address risks of pollution to air, land and water.

Permits regulate the general management of the site, the operations that take place on the site, and emissions from the site while also ensuring that sites keep good records and are accountable. Permit holders must take appropriate measures to reduce their environmental impact. Those include, but are not limited to: the prevention of odour by restricting odorous raw materials, minimising quantities of odorous materials, and effectively containing any odorous materials; restriction, recovery where possible, and disposal of waste in a manner that minimises the impact on the environment; and the adoption of best-practice techniques to reduce ammonia emissions from the site.

In the case in question, Bedfordia Farms, I understand that the operator originally applied for a permit covering a poultry unit of 360,000 birds in 2016. That permit was granted in June last year. In January 2017, the operator applied to increase the number of birds to 540,000, to increase the site boundary, to increase the number of sheds and to install biomass boilers. Due to the scale of the increase, the permit was publicly advertised for consultation. I am told that no objections were received in response to that particular consultation, and the permit was subsequently issued by the Environment Agency in March 2017. At that point, however, the site expansion had yet to obtain planning consent or, indeed, be constructed, as is still the case.

I have looked at the environmental permit issued and the consideration given. A comprehensive range of issues were taken into account, including the change to the site boundary, the increased number of bird places and whether the additional biomass boilers were sufficient, with an assessment of those impacts. It gave consideration to groundwater and soil monitoring, it considered the impact on special protected areas—a Ramsar assessment—and also potential impact on a site of special scientific interest, and it looked at ammonia emissions. It was a fairly comprehensive review, as is normally the case with such applications.

Environmental permits are designed to regulate the day-to-day operation of the site to minimise pollution. That the site has been granted a permit by the Environment Agency means that the agency is satisfied that the operations at the site will not negatively affect the environment. It also means that the site has been deemed to have no likely significant effect on local sites of scientific interest, or on the local area through ammonia emissions. I will point out that, in general, intensive poultry sites are classed as a high-performing sector, and very few sites cause local amenity issues.

I make those points because there is an important issue here. My hon. Friend’s speech was predominantly dedicated to animal welfare considerations, which I will return to at the end. I point out to him that environmental permitting takes account of environmental considerations, as it says on the tin. It is not the role of the Environment Agency to consider animal welfare; that is an issue of national policy, set either through domestic national or EU legislation. There are rules in place on maximum stocking densities and so on, which I will touch on later.

I will say a little bit about the poultry sector. While I acknowledge and appreciate the concerns surrounding the proposal, we should not forget the importance of the British poultry industry. It employs around 45,000 people in the UK, is largely unsupported by subsidies and does not have a levy body. It is one of our more innovative sectors. The output of the poultry sector was worth more than £2 billion in 2016, and the sector has achieved quite impressive reductions, for instance in the use of antibiotics, through voluntary industry actions. It has reduced its use of antibiotics by—the last time I looked—over 40%. The UK chicken industry maintains an excellent level of salmonella control; it has one of the lowest salmonella prevalence levels in the EU and is well below the EU target.

We should also acknowledge that poultry meat consumption is increasing. Per capita consumption increased from 31.8 kg in 2010 to 37.3 kg in 2016 and the long-term projections are that consumption is likely to increase, as many people find themselves switching more to white meat and eating less red meat. Over the past 50 years, the poultry sector has developed and honed quite a progressive industry, committed to improving and expanding skills in the industry and looking for new markets. Of course, there is always more that can be done, and the public are definitely growing more conscious of the impact of agriculture on both the environment and animal welfare. The UK poultry industry, through the British Poultry Council, operates a climate change agreement that includes targets for the reduction of energy use. BPC member companies are also required to be part of the agreement for both their farms and processing plants.

I am most grateful to the Minister for much of what he says, but the Secretary of State has said that we will not have American-style factory farming. This is American-style factory farming, so why has it got its licences?

As I said, there are two types of permits being sought here. The first is the environmental permits. As I explained earlier, under the environmental permitting regulations, the Environment Agency looks at the environmental issues. It does not look at animal welfare issues, which was the point my right hon. Friend the Secretary of State was making. The second issue is planning, and that is something for the local planning authority to look at.

Returning to animal welfare, it is something we are considering in the context of future agricultural policy. The Secretary of State and I have been consistent on that: we want the highest standards on animal welfare in the world. As we design a new agricultural policy, we are considering whether we can support and incentivise different approaches to farm husbandry that would be better for animal welfare. It is worth noting that we already have individual farm animal welfare codes on a statutory footing, and there is one for broiler chicken production. We already have regulations to ensure that our stocking density—as my hon. Friend the Member for Wellingborough pointed out, they do not have a lot of room—in the UK is far lower than it is in the United States. Our standards of animal welfare here in the UK are infinitely better than those we would see in the United States. The reason we have debates around chlorinated chicken from the United States, which is always a contentious issue when potential trade deals are discussed, is that the chlorination of chicken in the US masks wider animal welfare problems.

While acknowledging my hon. Friend’s points, we should recognise that standards of welfare in Europe and the UK are already far better than would be the case in the US. I recently visited one of the FAI farms in Oxfordshire, which is dedicated to researching how we can promote and improve animal welfare. For instance, they have done some interesting work on using mottled shade, trees and bushes for laying hens, so that free-range chickens are more likely to venture outdoors. Sometimes, simple interventions like that can go a long way towards improving animal welfare.

I agree with my hon. Friend: we support the view that animals are sentient beings, and how we treat sentient beings is a hallmark of a civilised society. That is why I have always championed high animal welfare in agricultural policy. In conclusion, the animal welfare issues that my hon. Friend raised are issues that we are considering in the context of future policy.

It was in the Queen’s Speech that there will be an agriculture Bill later in this Session—possibly by next summer or autumn. We will publish further thoughts on future agriculture policy at some point in the new year. I assure my hon. Friend that a great deal of thinking on all these issues is going on. We are working with organisations such as Compassion in World Farming and with Peter Stevenson, its head of policy and a key advocate, and looking at ways to improve animal welfare. That includes looking at incentives to support different approaches to farm husbandry.

We are considering whether to divert more research to promoting high animal welfare. One of the issues my hon. Friend raised was that genetic research is currently targeted only at yield, which is also a common problem in the laying poultry sector. I want more genetic work to go into addressing other concerns such as prevalence of disease and animal welfare issues. For instance, we know that, using the right approach to genetics with laying hens, it is possible to reduce feather pecking, so that there is no issue of beak trimming for laying hens. That is just one example. I am sure there will be similar examples for broiler chickens, and I look forward to debating animal welfare with my hon. Friend when the agriculture Bill comes forward.

I am pleased that there has been such a surge of interest in our debate on poultry welfare and that so many people have come to hear about that important issue.

I congratulate my hon. Friend the Member for Cheltenham (Alex Chalk) on securing this debate on such an important issue. I also commend the work that he does in the APPG on bees. He gave a very uplifting speech. As he said, we Conservatives believe in conservation; we want to leave an environmental legacy, and our pollinators are incredibly important to our environment.

Often in debates on this issue there is a focus on pesticides, but as a number of hon. Members—in particular, my hon. Friend the Member for Bexhill and Battle (Huw Merriman)—have pointed out, a big role is played by loss of habitat. In fact, a lot of analysis suggests that loss of habitat has been the key driver of the decline in our pollinators. As my hon. Friend rightly pointed out, declines have taken place since the 1950s—long before neonicotinoids were invented.

There is no doubt that our bees face many pressures. However, the population data are complex. Many species of wild bee and other insect pollinators have declined over the last 30 to 50 years. A few have increased, but the net effect has clearly been negative. Three of our native bumblebees have been lost from the UK—the apple bumblebee in the 1800s, Cullum’s bumblebee in the 1940s and the short-haired bumblebee in the 1980s. On a positive note, that last species is currently being reintroduced to Kent and has become a real focus for conservation and land management action.

Similarly, there has been a decline in the number of honey bees kept since the 1950s. Again, however, there has been better news more recently. I am referring to the renewed interest in beekeeping over the last decade, with membership of beekeeping associations and the number of registered colonies on the rise. The number of colonies registered with the National Bee Unit increased from just over 100,000 in 2009 to 195,000 this year. Often, those are amateur keepers with a couple of hives in their garden. My hon. Friend the Member for Bexhill and Battle called for Parliament to have some beehives. DEFRA is already doing its bit: we have two beehives on the roof of our building—Nobel House in Smith Square.

Nevertheless, we should not be complacent. Wild and honey bees continue to face many challenges and we must maintain our efforts to help all our pollinators. The area of wild flower habitat on farmland, as well as the presence of clover leys in our rotations, declined substantially after the second world war, as farmers responded to our need for food. Many of the insect pollinators that have seen the greatest declines are those that are strongly associated with these habitats. On our protected sites and through countryside stewardship, we are putting these habitats back into the countryside and I am keen that we continue to do this as we develop our new environmental land management measures outside the European Union.

I turn now to the action the Government have taken in relation to this matter, first, our national pollinator strategy, which my hon. Friend the Member for Hornchurch and Upminster (Julia Lopez) highlighted. This strategy sets out how the Government are taking a leading role in improving the status of the 1,500 pollinating insects in England. It sets out how Government, beekeepers, conservation groups, farmers, researchers and individuals can work together to achieve common goals. It builds on current policies across DEFRA, which support pollinators, including habitat creation and public engagement.

On 9 November we published a progress report detailing the positive progress we have made. I am pleased to report that this included the valuable creation of new habitats for pollinators and improvements in our understanding of the status of pollinating insects. We have supported the reintroduction of species such as the short-haired bumblebee, whose conservation we know to have additional benefits for other species. Over 95% of our sites of special scientific interest and almost two thirds of the total area of our resource of wildlife-rich habitats are now in good condition or have management plans in place to restore them to it.

Secondly, I want to consider farm measures. We have introduced a pollinator and wildlife package to our countryside stewardship scheme, to help landowners provide year-round habitat such as flower-rich field margins. Since 2011, we have established more than 100,000 hectares of land that we are restoring to flower-rich habitat, principally through those agri-environment schemes. Forty per cent. of all 2016 countryside stewardship mid-tier agreements are delivering the pollinator and farm wildlife package. Last year, countryside stewardship applications increased by almost 45% and requests for mid-tier application packs are up this year. We have worked with farmers to make it easier and simpler to apply for the scheme and will continue working to improve it and make it simpler as we go forward.

Thirdly, on the Government estates, the Ministry of Justice planted over two miles of native hedgerows and created over 20 hectares of wild flower meadows in 2016. The Ministry of Defence has collaborated with organisations such as Plantlife, National Parks, the Wildlife Trusts and its own tenant farmers to set up suitable areas for pollinators to thrive, including through the creation of wild flower meadows.

Fourthly, in addition to supporting our pollinators with habitat creation, we have put in place measures to improve our understanding of the status of pollinators in our environment. We have established a monitoring and research partnership with research institutions and volunteer organisations. This partnership will allow us to gather further data on the status of our pollinators and the challenges they face.

I do not want to introduce a disagreeable note, but if the Minister compares, for example, the amount of money we have spent, under all Governments, as a nation, on issues such as bovine spongiform encephalopathy or bovine TB, with the amount of money we spend, or do not spend, on research into protecting our pollinators, what can we look forward to from this Government to significantly increase those research efforts?

First, I mentioned the countryside stewardship schemes. That is a £3 billion programme going to those environmental stewardship schemes during the course of the financial perspective that the EU looks at. That is a large amount of money, and, as I said, a lot of that is focused on those pollinator packages. Specifically on research, we have supported the Insect Pollinators Initiative, a £10 million research programme, which still produces high quality science papers that help us to understand the importance of pollinator populations to UK agriculture.

Awareness raising is also important, as several hon. Members pointed out. It is a key feature of our national pollinator strategy. We have established a “Bees’ Needs” campaign, including public events, talks, best practice advice and award ceremonies to demonstrate and acknowledge people’s work to provide suitable habitat for bees and other insects. This year, my noble Friend Lord Gardiner presented 17 awards to individuals and groups who have shown best practice in all areas of pollinator work. Winners included honey-bee keepers, community groups, farmers and schools.

As a number of hon. Members pointed out, including my hon. Friend the Member for Hornchurch and Upminster, we also have to address the effect of pests and disease on our pollinators. As part of our support for pollinators, we continue to protect our honey bees through the healthy bees plan and the work of the National Bee Unit. Our team of bee inspectors visited over 6,000 beehives last year, looking for harmful pests and diseases. It is through the hard work of our inspectors that endemic diseases such as the foulbroods remain at low levels. They provide advice on good husbandry practices to thousands of beekeepers to help them manage other important pests like varroa. It is pleasing to observe the collaboration between beekeepers and the National Bee Unit. Registration of beekeepers on the National Bee Unit’s voluntary database is on the rise. It has gone up from 20,000 in 2009 to over 40,000 today. To support these beekeepers, we continue to aspire to educate and improve husbandry standards right across the country. This year, the National Bee Unit provided talks at 190 beekeeping events reaching some 9,000 beekeepers.

I want to mention the Asian hornet. My right hon. Friend the Member for East Devon (Sir Hugo Swire) highlighted this in an intervention. The training we have done has been of great value in detecting the Asian hornet. In 2016, we witnessed their arrival in the UK in an outbreak in Gloucestershire and Somerset. We also, as he pointed out, saw a separate outbreak in Devon earlier this year. Both incidents were reported by beekeepers and, through the sterling efforts of the Animal and Plant Health Agency, both nests were destroyed and no further hornets have been seen.

I want to turn finally to the issue of pesticides. As several hon. Members acknowledged, last week we announced our support in principle for further restrictions on neonicotinoid pesticides. There has been additional evidence in the last two years that they are harmful to bees and other pollinators. We have always been clear that we will follow the science on these matters. The advice from the UK Government’s advisory body, the UK Expert Committee on Pesticides, is that the evidence now suggests that the environmental risks posed by neonicotinoids—particularly to our bees and pollinators—are probably greater than previously understood.

My hon. Friend the Member for Cheltenham said that we were initially sceptical in 2013, as a Government, about the initial restrictions that were brought in. That is correct. Our chief scientific adviser’s advice at that point was that he did not believe the doses bees were likely to get would be a problem, but he was always clear that there should be further field trials. The first of those field trials was carried out in Sweden by Rundlof and others, and that concluded that there could be some impacts, particularly on bumblebees, and on that basis we moved to supporting the existing restrictions. However, in the light of subsequent, more recent proposals from the Commission, we asked the UK Expert Committee on Pesticides for its view. In particular, it looked at some evidence from Woodcock and others that concluded that there may be a persistence of neonicotinoids in soils, and that that may therefore have wider effects beyond the immediate impact on pollinators. As a precaution, we have decided to act on that. The committee was clear in its recent advice, which we have published, that the evidence is not that clear at the moment, but it is, it believes, reason to extend the restrictions further and that is why we have taken our current position.

Many hon. Members have talked about some of the unintended consequences and we must be mindful of those. There will more use of pyrethroids—greater use of those applications—which can also have environmental impacts and lead to growing resistance to the dwindling number of synthetic pesticides that we have left. It is also the case that we have seen an increase in the use of neonicotinoids in winter cereals, partly because other products, such as pirimicarb, were withdrawn from the market. This is a complex area. In the long term, we need to look at integrated pest management, with a wider range of approaches to tackle crop protection.

I represented the United Kingdom at the Agriculture and Fisheries Council on 9 October in Luxembourg.

The Council opened with an exchange of views on Baltic Sea fishing opportunities. Council agreed to consider EU-wide issues surrounding fishing for eels at the December Agriculture and Fisheries Council, and catch quotas in the Baltic Sea were agreed.

The Council discussed EU-Norway annual fishing consultations for 2018, and there was widespread support for the Commission’s aim to seek a balanced deal with Norway. The UK raised the issue of overreliance on EU stocks, such as blue whiting, in previous agreements on the exchange of fishing opportunities with Norway.

An exchange of views was held ahead of the International Commission for the Conservation of Atlantic Tunas (ICCAT) meeting on 14 November in Marrakech.

The Council discussed the implementation of the 2030 agenda for sustainable development. Member states supported the sustainable development goals and the role of agriculture in achieving them, but agreed on the importance of exploring vehicles other than the Common Agricultural Policy to achieve the goals.

The Commission gave a presentation updating Council on the market situation in EU agricultural sectors. The Council then discussed the ongoing trade negotiations with Mercosur countries. The UK, alongside several other member states, struck a supportive tone, welcoming progress on the trade agenda while recognising the need to be cautious on certain sectors.

A number of other items were discussed under “any other business”:

The Commission updated Council on the implementation of the European Maritime and Fisheries Fund.

Commissioner Andriukaitus gave a read out of the recent Fipronil conference in Brussels.

The German delegation drew the Council’s attention to the importance of the financing of the EU minor use co-ordination facility (EUMUCF).

The Hungarian and Lithuanian delegations presented the joint declaration of Visegrad group, and the Latvia and Lithuania from the Baltic states on the prospects of the post-2020 Common Agricultural Policy.

The Austrian delegation informed Council on farming in the Alps.

The Spanish delegation updated Council on the proceedings opened by the US authorities against the import of black table olives from Spain.

The Maltese delegation presented the conclusions of the 41st conference of directors of EU paying agencies.

The Maltese delegation presented the conclusions of the informal meeting of directors for rural development.

The German delegation presented to Council on sustainable and deforestation free supply chains.

I congratulate my hon. Friend the Member for Mid Worcestershire (Nigel Huddleston) on securing the debate. I know, based on the number of hon. Members present, that people care deeply about this issue. Hon. Members who have attended similar debates in recent years will know that, both as a Back Bencher and as the Minister responsible for companion animals, I have championed this cause and tried to make improvements, particularly to the legislation on the breeding of puppies —an issue to which I shall return.

As my hon. Friend the Member for Mid Worcestershire pointed out, puppy smuggling is an abhorrent practice and is partly driven by demand for certain breeds in this country. We need to ensure greater public awareness of these things. If a person is told that someone wants to meet them at a motorway service station to sell them a puppy, that should set alarm bells ringing that something is not right. Everyone has a role to play in solving this problem, but in the time I have, I shall restrict my comments to what the Government are trying to do to improve things.

First, I shall explain a bit about what is required now. Under our current regulations, predominantly shaped by EU law, any dogs imported for commercial reasons—

First, I congratulate my hon. Friend the Minister on the Government’s brave and right decision to increase sentences for animal cruelty, which will certainly help to deal with the scourge of puppy smuggling. Secondly, may I encourage him to use the opportunities of Brexit to bring about reform of the 2012 legislation, to which he has just referred, so that we can clamp down more firmly on puppy smuggling? Thirdly, may I echo the comments of the hon. Member for Ceredigion (Ben Lake) and encourage the Minister to encourage other people to take on rescue dogs? I have seen in my own family how even very difficult dogs can become wonderful pets with the right family.

My hon. Friend and I have worked together on European issues in the past, so we come from a similar position on that. A number of hon. Members have mentioned their dogs. I had a pet dog called Mono, a particularly erratic border collie, which came from the RSPCA, and I would always recommend that as the first choice for people.

As I was saying, under the existing regulations, we have something called the Balai directive, under which all commercial dogs are supposed to come in. There has been growth in the number of dogs coming in under those commercial provisions, but also, following changes to PETS—commonly called the pet passport scheme—in 2012, we have seen significant growth in the number of dogs and puppies coming in under that pet travel scheme.

There are really three potential problems of which we need to be aware. First, are there people who are flouting the system altogether, not having any kind of passport or documentation and simply smuggling puppies in in the most literal sense? I have asked that question many times and I can give hon. Members some reassurance. Border Force obviously carries out lots of checks at the border for people who are people trafficking, for drugs, and for customs issues. Whenever they come across dogs that are hidden and do not have the documentation, they alert the local trading standards officers so that they can take action, but we do not get many of those cases. In the last 10 months, there has been one case of people coming in with no documentation at all.

The second issue is whether there are people bringing puppies into the UK on the PETS travel scheme, which is supposed to be for people’s pets, with the intention of selling them commercially. That is where there is greater concern and where our efforts have been focused.

The final issue is whether the existing commercial arrangements go far enough, because the truth is that checks under the Balai directive are more thorough than under the PETS travel scheme, but the difference is not that great, and applying that may not achieve very much.

I want to let hon. Members know that we have been working with Dogs Trust and the Animal and Plant Health Agency in the Department for Environment, Food and Rural Affairs. Two years ago, following a similar debate to this, I asked them to get involved to toughen our approach at the border, and I can say that where we have come across examples of fraudulent vets, predominantly in east European countries, issuing fake documentation, we have taken action. For instance, the chief veterinary officer has written to authorities in Hungary, Latvia, Poland and Slovakia to highlight in particular the problem of under-age puppies. In January 2017, the Hungarian authorities wrote to advise us that they had responded to our letter and taken action, including police investigations of the veterinary practices and transporters involved. In July 2015, the Lithuanian authorities introduced legislation meaning that passports can now be issued only by a vet from their state veterinary service. Where we have seen problems, we have acted, which has led to change in some of these countries.

As I said, we are working with Dogs Trust to carry out more physical checks at our borders and particularly at the port of Dover. I thank Dogs Trust for the work that it has done in helping us to put the puppies that are seized into quarantine and, hopefully, find homes for them. Following that work, which started in December 2015—two years ago—in response to a similar debate to this, we have seized 649 non-compliant animals. The Animal and Plant Health Agency has played a leading role in that by helping to age the puppies involved. In most cases, the people are single, one-time offenders. I have asked whether we have a small number of repeat offenders. That appears not to be the case, but we are taking action on that front.

A number of hon. Members mentioned third-party sales. When I was the Minister responsible for companion animals, we took action on that. We have completed a consultation. We are bringing forward regulations that will ensure that anyone selling pets, whether online or in a pet shop, will need a licence, and they will have to abide by a statutory animal welfare code for dogs. We have introduced in that some provision to have “earned recognition” for groups such as the Kennel Club that run their own schemes.

The changes that we have made, both to the threshold before which people need a licence to breed puppies in the first place and to put it beyond doubt that anyone selling a puppy needs a licence and must comply with the dog welfare code, will deal with this problem. We should also recognise the work done by groups such as the Pet Advertising Advisory Group, to prevent people from going on and selling if they have high-velocity sales. A lot of progress has been made there.

I want to touch on the options that we will have when we leave the European Union. There is obviously a chance to look at these things afresh. We could, for instance, review the approach that we take on commercial animals so that we tighten the restrictions for those coming in—tighten the requirements. We could introduce more checks and restrict the ability of pets to travel from other European countries. If we think that a European country has weak authorities, we could address that by putting a particular restriction on it. It will be open to us to start to consider these things once we leave the European Union, but while we are in the EU, we must focus on doing the work we are doing to tackle this problem at the border and seize these under-age puppies.

Beer is the UK’s third largest food and drink export with a value of nearly £600 million last year. Last week, I visited the Griffin Brewery in Chiswick, run by Fuller Smith & Turner, to launch a new British beer export strategy with the British Beer and Pub Association. Fuller’s now exports to more than 80 countries and is one example of our successes with exports. We have regular discussions with the Treasury on the beer industry’s contribution to our local economies and communities.

The Minister will be pleased to know that we have had some initial success in promoting and exporting Shropshire beer to Poland, but more needs to be done over the small breweries relief scheme to help breweries such as Battlefield Brewery in my constituency to unlock the potential for additional exports. Will he continue to press the Chancellor on this important project?

There are some great success stories in my hon. Friend’s constituency and in Shropshire. I did in fact discuss the small breweries relief scheme with the British Beer and Pub Association last week. I am aware that many microbreweries feel constrained by the current regime and have argued for changes to it. While this is obviously a matter on which the Treasury is the policy lead, I can say that we have ensured that those representations have been highlighted with the Chancellor.

I am grateful to my hon. Friend the Member for Shrewsbury and Atcham (Daniel Kawczynski) for raising this issue. St Peter’s Brewery in my constituency has built up a very good export business over many years. Does my hon. Friend agree that it is vital post Brexit, if we are to open up new markets and create new jobs, that such obstacles are removed?

I very much agree with my hon. Friend. Indeed, I attended an event that we hosted in our embassy in Japan just last year to promote a range of British drinks, including British beers. They are one of our great success stories. The industry aims to increase its exports by around £100 million a year over the next few years, and there are some great success stories that we should champion.

5. How many culled badgers have been found to be infected with tuberculosis since new cull licences were issued in September 2017.

We do not carry out post-mortem examinations on every badger removed in cull operations. However, we know from previous research that the prevalence rate of the disease in badgers in the high-risk area is typically around 30%. However, we do want to monitor trends as the cull is implemented, so a small sample of badgers is being collected and tested this year to explore different testing protocols that could be deployed to track the prevalence of TB in badgers culled in future years.

The basis for the roll-out of the cull was the randomised badger culling trials carried out under the previous Labour Government. Those trials showed that there would be a reduction in the disease through a badger cull. Indeed, research carried out earlier this summer by Christl Donnelly has confirmed that there is a 58% reduction in the disease in cattle in Gloucester and a 21% reduction in Somerset. That is within the range we would expect, based on the RBCTs.

I hear what the Minister says, but now that the culls are coming to an end, it is estimated that between 20,000 and 33,000 badgers were caught and dispatched in the roll-out. Is he seriously telling me that we will not test a significant proportion of those badgers so that we can at least have some scientific efficacy and know that there is some sense in what the Government are trying to do, even though Labour Members totally oppose it?

If the hon. Gentleman had listened to my earlier answer, he would know that I said precisely that we want to monitor trends in this disease, which is why we are starting to collect and test a sample of badgers to develop these protocols. A lot of post-mortem analysis was done during the RBCTs, and we know from that—it was not conclusive—that the typical prevalence rate of the disease in the badger population in the high-risk area is 30%.

We are working with the farming and agriculture sector to assess the impact on this industry of leaving the EU. Following the decision to close the seasonal agricultural workers scheme in 2013, DEFRA set up the SAWS transition working group, which brings industry and the Government together to monitor seasonal labour. I met this group on 7 September. DEFRA is working with the Home Office to ensure that workforce requirements are considered in any future immigration system.

We regularly meet the SAWS transition group, as I said, and we work closely with Home Office officials on this. The Home Office has established a review by the Migration Advisory Committee. Indeed, its call for evidence closes this week—on 27 October. Over the past month, we have been encouraging all interested parties to contribute to that review.

There is a lot of discussion about the farming and agricultural sector but, as the Minister will know, the Department is also responsible for food and drink manufacturing, which is the largest manufacturing sector and also a very large employer. Will he assure me that that sector will not be overlooked?

I assure my hon. Friend that I regularly meet food processing companies and food manufacturers. He is right that some sectors, notably fish processing and meat processing, have become very reliant on east European labour, particularly over the past 10 years. We are ensuring that all the information provided by those sectors is fed back into the review that is being undertaken by the Home Office.

14. The Minister will no doubt be aware that farming contributes £1.5 billion a year to the Welsh economy. If the Government decided on a no-deal Brexit, it would have a significant impact on Welsh farming, including in relation to workforce shortages. Will he make a statement on what he plans to do in a no-deal scenario to support the Welsh agricultural economy?

I assure the hon. Gentleman that the Government are planning for all scenarios. We have been very clear that we want a comprehensive free trade agreement with our European partners, and we want a close partnership to be put in place. However, if we want to be serious around a negotiating table, we obviously have to prepare for everything, and that is why we are also preparing for a no-deal scenario.

New Zealand has had an effective seasonal migrant workers scheme for farms for many years. Will the Government, at the very least, look at that? Will they also note that New Zealand has expanded its scheme to include the tourism sector, and especially the fishing sector? Such a scheme would prevent boats on the west coast of Scotland from being tied up due to lack of crews, especially at a time when we often see fine crews prevented from coming from the Philippines or Ghana. Due to barmy Home Office rules, the boats are tied up, at a cost to the economy.

We are indeed looking at the system in New Zealand, which is similar in many ways to the seasonal agricultural workers scheme that operated from 1945 to 2013 in this country. The Home Office had some other sector-based schemes, but the MAC concluded in 2013 that they were not being utilised and were therefore unnecessary, but as I said, there is a review led by the Home Office with the MAC looking at this question now. That is the right place to put that information.

Leaving the EU is a great opportunity to design a new agriculture policy that is fit for purpose in the 21st century. As we develop plans for a new agriculture Bill, we are considering how best to deploy the financial support committed to agriculture and the farmed environment. At the heart of that policy will be a focus on delivering environmental outcomes and improving soil health. Other measures under consideration will address issues such as productivity, animal welfare and risk management.

As part of our work on innovation, we are considering grants to support investment in farms. Tax policy is obviously a matter for Treasury Ministers, but there are already annual investment allowances to support investment in farm machinery, and many farmers make use of them.

We are doing quite a lot of analysis of sectors of the industry that could be affected by any future reform in agriculture policy. The hon. Lady is right to say that some farmers in the uplands are more financially vulnerable, and we are taking that into account. We have also been very clear that any change we implement would have a transition period to ensure that people can adjust.

As the Prime Minister made clear to the House on 11 October, when we leave the European Union we will leave the common fisheries policy, and we leave the EU in March 2019. However, the European Union (Withdrawal) Bill will bring across current EU legislation to provide continuity on the day we leave. In the context of fisheries, that will include the body of technical conservation regulations currently set by the EU.

That is very interesting: we will not have a voice at the table but we will have to abide by all the CFP rules. Can the Minister give an assurance to our industry, which exports more than 80% of what it catches straight to the rest of Europe, that it will not face any tariffs or other barriers during or after that transition period?

We are seeking a comprehensive free trade agreement and trade would continue as usual during the transition period. The right hon. Gentleman is wrong to say that we would not have a seat at the table. He is familiar with fisheries negotiations and knows that they are annual events, whether we are negotiating with EU member states at December Council, with EU-Norway or at coastal states meetings. We will become an independent coastal state on the day we leave the European Union in March 2019.

I welcome the Government’s commitment to listen to the views of the food sector and to ensure that it has a strong voice in the EU exit negotiations. Does the Minister share my view that the interests both of Scottish fishermen and of those in the other devolved nations must not be sacrificed during the negotiations?

I very much agree with my hon. Friend and I know that many Scottish Conservative MPs have worked closely with Scottish industry on the issue. The fishing industry is very important in Scotland. Roughly half of the industry is located there, and sectors such as the pelagic sector, which targets mackerel, the largest fish species that we target in this country, are of incredible economic importance. I reassure my hon. Friend that I regularly meet fishing industry leaders in Scotland to discuss their concerns.

May I take this opportunity to send our sincere condolences to the family of the crew member of the fishing vessel Solstice who sadly died at sea since the last DEFRA questions?

While the Brexit negotiations on the common fisheries policy continue, the fishing Minister will appreciate that the safety of our fishermen and women must be paramount. The Solstice is the third fishing vessel to sink involving the loss of life in the last two years where there has been a delay in launching lifeboats. With that in mind, will the Minister reassure the fishing industry that he is working with his colleagues in the Department for Transport to secure a full investigation into the Solstice, in order to rebuild confidence in the fishing community that the coastguard is able to respond quickly and effectively to incidents at sea?

I join the hon. Lady in offering sincere condolences to the family of the crew member who sadly lost his life with the loss of the Solstice in the west country. She will be aware that this issue is covered by the Department for Transport and the Maritime and Coastguard Agency, but I have had the opportunity to discuss the matter with my colleague the shipping Minister, and I know that the marine accident investigation unit will carry out an investigation in the normal way. In addition, and to respond to the points the hon. Lady has raised, he has asked the marine accident investigation unit to consider whether we have adequately learned the lessons from previous accidents—which, as she said, have some similarities—and whether there are wider trends on which we ought to reflect and change policy.

How many slaughterhouses do not currently have CCTV installed?

From memory, about 90% or 95% of all animals slaughtered are slaughtered in the larger slaughterhouses which have CCTV. However, about half of all slaughterhouses do not, particularly some of the smaller ones. That is why we are bringing forward legislation to make CCTV compulsory in all slaughterhouses.

Eighty per cent. of Welsh farm income is rooted in the common agricultural policy. The Welsh Government are currently responsible for the distribution of that funding. Will the Minister confirm whether they will retain that responsibility post-Brexit, and whether funding received will be based on the needs of Welsh farms, not a simple headcount?

Last Friday I visited Askham Bryan agricultural college in York. It says that the new exam framework does not work because assessment of, for instance, the felling of trees cannot be done in the tight window of the spring, and the harvest cannot be brought in during the spring either. Will the Secretary of State make representations to the Education Secretary about broadening the scope within which assessments can take place?

I congratulate the hon. Member for Islwyn (Chris Evans) on securing this debate on a subject that is dear to many hon. Members’ hearts, including mine. He gave an account of his first family pet when he was young, and I never give up the opportunity in such debates to talk about Mono, a rather erratic border collie that I adopted from the RSPCA. He lived to a good age and, certainly in the last seven years of his life, had a good life on our farm.

As a Back Bencher and a member of the Environment, Food and Rural Affairs Committee, I campaigned to change the rules around the licensing of puppy breeding. I was therefore pleased to have the opportunity to become a DEFRA Minister, and then to become responsible for companion animals. For once, I was in a position to see through something that I had sought for some time. As the hon. Gentleman pointed out, many people and organisations have been calling for more restrictions on the breeding and selling of dogs. I initiated a consultation, which Lord Gardiner has continued, and I now have the opportunity to update the House on some of our plans.

The hon. Gentleman will be pleased to hear that many of the ideas that he outlined are exactly what we are planning to do and exactly what we have already consulted on. The Government will be replacing existing laws on the breeding and selling of dogs with a stricter licensing regime. The regime will, for the first time, be linked directly to the Animal Welfare Act 2006 and will introduce several important changes. First, we will lower the threshold under which a dog breeder needs a licence, moving it from five litters or more to three litters or more, thus ensuring that more commercial dog breeders will be required to have a licence.

Secondly, we will require all dog breeders and the sellers of all pet animals, including dogs, to adhere to statutory minimum welfare standards that will be linked to the welfare needs set out in the 2006 Act. That is important for raising standards and improving consistency in the licensing regimes that local authorities put in place. Thirdly, we will remove the exemption through which some people who breed from their own pet dog claim that they do not need a licence to sell puppies. Fourthly—the hon. Gentleman made this point—we intend to reward licensees who are considered to be at low risk of breaching the new regulations with longer licences and fewer inspections. We could, for instance, recognise those who sign up to United Kingdom Accreditation Service-accredited schemes run by groups such as the Kennel Club, and the new regulations will provide for that.

Finally—this goes to the heart of the issues that the hon. Gentleman raised—we intend to make it clear that anyone in the business of selling dogs online will need a licence from their local authority. As he says, our legal view has always been clear that the 1951 Act, which regulates the licensing of pet shops, already provides that anyone in the business of selling dogs, whether they have a shop on the high street or are selling online, requires a licence, but we have accepted in the consultation that there may be a sense of ambiguity. We therefore want to place the requirement beyond any doubt, so I reassure him that we will be doing precisely what he asks for.

There have also been calls for more robust inspections. The statutory minimum welfare standards will have to be applied by local authorities, and the regulations will be accompanied by guidance to which local authorities must have regard. The regulations will require all inspectors to be suitably qualified, and the guidance will set out what “suitably qualified” means.

As the hon. Lady knows, local authorities already have budgets for such things and departments that deal with animal welfare. We will be addressing exactly what is required by “suitably qualified”. The Minister was doing well up to that point. We all know that our local authorities are under particular pressure. If this is to mean anything, the Government will have to put some money into it.

Local authorities are already required to carry out such activity. They already have animal welfare departments and dog wardens, and they already issue licensing conditions for a range of things. I thank my hon. Friend for all his welcome proposals. One thing that we have not tackled so far is illegal imports. Supply does not equal demand in this country, because people want more puppies and dogs than the breeders in this country can supply. How do the Government plan to address that real problem? As we have heard, puppies often travel in difficult conditions and die within a few weeks of being in this country.

I conclude on the licensing point by thanking the many stakeholder organisations and animal welfare groups that have already contributed to our contribution and the formulation of these draft regulations. The hon. Member for Islwyn raised a point about the sale of puppies under eight weeks old, and he said that the first dog he had was sold at two and a half weeks. A couple of things are being done. First, the microchipping regulations that were introduced two years ago already require that no dog can be sold until it has been microchipped, and it is unlawful to microchip a dog until it is eight weeks old. In the normal course of events, it is already the case that no dog under the age of eight weeks can be sold.

Again, there is some ambiguity under the 1951 Act, and some people have identified the fact that a small number of pet shops might have been able to sell dogs under eight weeks old. We will put the situation beyond doubt in the regulations by making it clear that no puppy below that age can be sold.

I want to move on to maximum sentences for animal cruelty as that is another important area in which we have recently made some announcements. The issue has been raised a number of times, including in private Members’ Bills promoted by several hon. Members, notably my hon. Friend the Member for Torbay (Kevin Foster). The Government have made it clear that we will increase the maximum penalty for animal cruelty from six months’ imprisonment to five years’ imprisonment. The maximum sentence needs to be increased for the most horrific acts, such as deliberate, calculating and sadistic behaviour. The offences for which that would apply could include causing unnecessary suffering to an animal and holding organised animal fights. The existing six-month limit does not allow judges to pass the most appropriate sentence in such circumstances. We want to send a clear message that animal cruelty is not acceptable in our society, and a Bill to effect the necessary changes to the Animal Welfare Act will be introduced as soon as parliamentary time allows.

I turn now to the question of a ban on the third-party sale of puppies. This issue is often raised and the hon. Member for Islwyn, to be fair, rightly pointed out the difficulty that enforcing such a ban might involve. We do not believe that a ban on third-party sellers is necessary, and that view is shared by many stakeholders. We believe that a better approach is to aim for more robust licensing of pet sellers, as well as continued encouragement that people source dogs from reputable breeders and see any puppy interact with its mother, and consider a rescue or re-homed dog first, alongside consumer pressure to drive down the sales of dogs from third parties such as pet shops. The evidence shows that that is already happening, with as few as 4% of pet shops now licensed to sell dogs. That figure is always declining, and the reality is that even fewer shops actually do so.

We want to drive up animal welfare standards rather than introduce bans that are difficult to enforce. That is why the new regulations will set statutory minimum welfare standards for all commercial pet sellers that the local authority must apply when considering whether to issue a licence. There will also be an opportunity to apply higher standards, with pet sellers and dog breeders able to earn recognition so that the better performers have a longer licence, with fewer inspections and a lower fee. We are developing a star system similar to that which applies to food hygiene, and that will be backed up by statutory guidance. The use of a risk-based assessment of operators and an emphasis on cost recovery will enable local authorities to fulfil their responsibilities and target enforcement on the poorer performers. It will also assist the public to make an informed choice when choosing a pet provider.

I turn now to the issue of online sales. I particularly wish to point out to hon. Members that the Department established the Pet Advertising Advisory Group some years ago. DEFRA has already published guidance on buying a pet and has worked closely with PAAG to drive up standards for online advertisements. It is important that we give credit where it is due, so I should like to take this opportunity to praise PAAG’s work, which has resulted in six of the largest online sites signing up to agreed minimum standards for sites that advertise pet animals for sale. The types of measures that have been introduced include: a requirement that all adverts display the age of the animal advertised, with no pet advertised for transfer to a new owner before it is weaned and no longer dependent on its parents; a permanent ban on vendors on a “three strikes and you’re out” basis, so that those who attempt to post illegal adverts can be blocked indefinitely from advertising on any of these sites; and steps to ensure that every “view item” page includes prominent links to PAAG’s advice on buying and selling a pet, which can ensure that someone who is searching for a dog or any other pet is targeted with informative emails to tell them what they need to know so that they will be able to care for that pet. The standards are being applied by half a dozen or so sites, including the main ones. People who are looking online should be advised to keep to those sites that have signed up to PAAG’s minimum standards.

The Minister is being generous in giving way. I, too, applaud PAAG for its work—it has been very successful—but some advertisements are disappearing only to be found on sites other than the big six. Surely the Minister agrees that the Government have done part but not all of the job of dealing with problems relating to online sales.

As I pointed out earlier, with the new regulations we are putting it beyond doubt that anyone selling online requires a pet licence. That is how the UK Government can address the issue. The hon. Lady will understand that we do not have jurisdiction over a classified ads operation based in Australia, for instance. What we can do, however, is to ensure that anyone who attempts to sell via the internet, wherever the classified ad website might be registered, will nevertheless require a licence. We continue to apply many of the other standards of the code, including the requirement that licensed breeders or sellers must display a licence number, and the need for an advert to include a photo of the pet and to set out its age. We have made good progress on online sales.

My hon. Friend the Member for Witney (Robert Courts) asked about the responsibility of buyers. It is a sad fact that unsuspecting buyers sometimes unwittingly provide a lucrative market for rogue dog breeders and dealers. Potential buyers need to take great care when they are considering taking on a puppy. They should always insist on seeing the mother when they purchase a puppy. My hon. Friend asked whether there are warning signs. If someone arranges to meet at a motorway service station to sell a puppy, that should be a warning sign. Before people buy a puppy, they should consider whether they have the right lifestyle to look after a dog for the next 10 to 15 years and, if so, what type or breed of dog is right for them. They should also consider whether they are prepared to spend the sort of money and commit the sort of time needed to look after a dog for the duration of its lifetime.

There is plenty of advice out there to help people to make the right choice when they buy a puppy. Such advice includes making sure that the breeder is a member of the Kennel Club’s assured breeder scheme or signed up to the puppy contract, which is of course supported by many animal welfare organisations, including the RSPCA, the Dogs Trust, Blue Cross and Battersea Dogs & Cats Home. Such advice can help to inform buyers before they make purchases. In addition, the new regulations I have outlined will help to ensure that puppies born in a licensed dog breeding establishment have a better chance than those born in backstreet breeding establishments.

Finally, I wish to address the point made by my hon. Friend the Member for Brecon and Radnorshire (Chris Davies) about illegal puppy imports and to talk about some of the work we are doing on that. We are aware that some puppies may be smuggled into this country from abroad to be sold as pets. DEFRA takes the illegal puppy trade seriously. Responsibility for deterring the illegal movement of puppies starts with their country of origin. Dogs, including puppies, and cats, including kittens, that move to the UK from EU member states, or from other low-rabies-risk third countries, must have received a rabies vaccination at not earlier than 12 weeks of age, after which there must be a wait of 21 days to allow immunity to develop. In practice, that means that puppies or kittens that enter the UK legally will always be a minimum of 15 weeks old.

The UK carries out more pet checks at the border than most member states. All pet animals that travel on approved routes are checked for their compliance to travel. Enforcement at the border also has an important part to play in combating the illegal trade. We are grateful for the Dog Trust’s continued support of the Dover puppy pilot. This partnership between the Dogs Trust, transport companies, Kent County Council and the Animal and Plant Health Agency has so far resulted in 649 non-compliant animals being seized and placed into quarantine since December 2015. DEFRA’s Animal and Plant Health Agency has also played a leading role. Crucially, it has helped to age puppies and identify those that have been illegally smuggled into the country when they are too young.

If a transport company suspects that undeclared pets are present in a vehicle, it can alert the appropriate authorities so that they can take the necessary action. Border Force and local authorities share intelligence and monitor movements, and Border Force officials are constantly searching vehicles for a range of things, and when they detect animals being smuggled in illegally, they alert APHA.

The Government are responding to concerns about the welfare of puppies. This issue has been dear to my heart both as a Back Bencher and as a Minister. I am sure that the hon. Member for Islwyn will be reassured to hear that the Government are already implementing many of the measures that he seeks. Indeed, perhaps reading our consultation gave him some thoughts about this area. I am clear that the measures that we are implementing will improve the welfare of our dogs and give them the respect that they deserve.

Leaving the EU presents a major opportunity for UK agriculture. We will be able to design new domestic policies that benefit British agriculture, the countryside and the environment. We have announced our intention to introduce an agriculture Bill in this parliamentary Session in order to provide stability to farmers as we leave the EU. We have pledged to work with industry to devise a new agri-environment system, to be introduced in the following Parliament.

One of the most promising opportunities after we leave the EU will be to expand the range of markets available to our farmers, but that will come with corresponding challenges. Will the Minister please explain what the Government propose to do to open the new markets that will be available to the farmers of west Oxfordshire while maintaining our high standards, which are not always observed in other parts of the world?

My hon. Friend makes an important point. Since 2015, DEFRA has opened around 160 new markets to quality British foods. In the future there could be opportunities to export more British produce, particularly meat and dairy. However, as the Secretary of State has made clear, we value our high standards in food production and animal welfare, and they will not be compromised as we develop future trade agreements.

The hon. Gentleman makes an incredibly important point. Agriculture is very important to the Northern Ireland economy—its dairy and poultry sectors are particularly strong. I have previously meet the Ulster Farmers’ Union leaders. Indeed, I met one of the dairy companies from his constituency only yesterday. This Saturday the Secretary of State is planning to meet the president of the Ulster Farmers’ Union.

Tapadh leibh, Mr Speaker. Farming and crofting leaders in Scotland hope that agriculture will be fully controlled in Scotland post Brexit, and according to fishing leaders the Secretary of State has intimated that the Scottish Government will control fishing to 200 miles—incidentally, Na h-Eileanan an Iar is probably the only constituency to reach 200 miles of the exclusive economic zone. Therefore, can I have it on the record that the Government will indeed be back in this position and that farming and fishing for Scotland will be controlled in Scotland post Brexit?

Some of these matters are obviously already devolved. I think that everybody recognises that there also needs to be some kind of UK framework to protect the integrity of the UK single market. On leaving the EU, we will take control of our agriculture policy, and there is an opportunity to give all the devolved Administrations more control than they currently enjoy to be able to do that while protecting the integrity of the single market.

Yes; my hon. Friend is absolutely right. We believe that there should be careful risk-based assessment when it comes to regulation. We also have a great opportunity to change the culture of regulation. The reality of the common agricultural policy, as it exists now, is that there are far too many complex rules against which farmers are judged. We have an opportunity to simplify that and have a much more effective system going forward.

The National Farmers Union says that the number of seasonal farm workers coming to the UK has dropped by 17%, and a report published this week states that

“the silence from Government on the labour question is astonishing.”

Food production, processing and packaging rely heavily on migrant labour—the Office for National Statistics states that they make up 41% of the workforce. Why are the Government ignoring the industry’s warnings? Will they compensate for the loss of produce as a direct result of this complacency, and will they ensure that the food manufacturing industry continues to have access to the workforce it needs?

There is no silence from the Government on this issue—indeed, there was a debate in Westminster Hall just last week where we discussed this issue in detail. We have the seasonal agricultural workers scheme transition group, which monitors seasonal labour requirements. It met in March, it had informal discussions last week, and it will meet again later this week. In addition, the Home Office intends to commission the Migration Advisory Committee to do a piece of work on the labour needs of this country after we leave the EU.

Well, that all sounds marvellous, doesn’t it? So why does the report say we have a looming food crisis if everything is under control? It says we could actually run out of some foods after Brexit. One of the authors, Professor Tim Lang, accuses the Government of a

“serious policy failing on an unprecedented scale”

for their handling of the food security situation. The Secretary of State is notoriously dismissive of expert advice, but does he accept the findings of this report, and will he meet me and industry representatives to urgently discuss the food crisis before us?

The issue with that report is that it has not looked at the issues as closely as we have in DEFRA. We have been studying all these issues at tremendous length. The truth about food security is that it depends on increasing food production globally at a sustainable level and on open markets around the world, and those are challenges whether we are in or out of the EU. There is nothing about leaving the EU that will affect our food security.

Does the Minister accept the definition of “food security” provided by the former Government chief scientific adviser, Sir John Beddington—notably, that food security is characterised as requiring a food system that is sufficient, sustainable, safe and equitable? The Foresight report to which the right hon. Gentleman refers set out that this country has a high level of food security. We have open markets, and a relatively high level of self-sufficiency as well, although that is not the key factor in food security. The report actually highlighted that there were no issues on food security. As I said earlier, we do not believe that leaving the EU has any impact on food security at all.

Food security can be enhanced by supporting the export of great British foods throughout the world. It is no surprise that I love British food and drink—particularly Lancashire cheese and British beer, both produced in my constituency. Will the Minister ensure that as we approach Brexit and these trade deals, we do a lot more to ensure that many more markets around the world can enjoy the food that I enjoy here in this country?

The Secretary of State said earlier that he was not in favour of mega-farms, yet there has been a 26% increase in the history of this Government. This has an effect not only on food security, animal welfare and food standards, but on the structure of our British farms, including the future of tenant farms. What will the Minister say to tenant farmers about their security after Brexit?

I had a meeting with the Tenancy Reform Industry Group just a couple of weeks ago, where we discussed in detail the issue of tenancy law, including whether we could review the workings of existing farm business tenancies and whether we could do more to encourage models such as contract farming, share farming and franchise farming to create new opportunities for new entrants.

As the right hon. Gentleman knows, I have a number of leading west country food manufacturers in my constituency, including Falfish and Rodda’s cream, both of which are successful exporters. In addition, we are working closely with trade organisations, such as the Food and Drink Federation, to understand the needs of the industry. We have been clear that we intend to put in place a new partnership with the EU, which will include a comprehensive free trade agreement.

The Minister will know that 80% of west country fish and 30% of our lamb is exported straight to EU markets, free—currently—of tariffs and other barriers. Those food producers will be extremely concerned by the comments today of the International Trade Secretary, who appears completely relaxed about the prospect of leaving the EU with no deal. Does the Minister agree with him, or with the Chancellor, who said that this would be a very, very bad thing?

As the right hon. Gentleman will know, the UK has a significant trade deficit in food and drink products with the EU, so the EU needs access to our market as well. We have a significant deficit of around £18 billion a year, and I believe it is in the EU’s interests, therefore, to secure a free trade agreement too.

Farmers in Somerset expect their Government to negotiate continued tariff-free cross-channel trade, and hundreds of thousands of farmers across the EU expect the same of theirs. What are Ministers doing to secure engagement now between Her Majesty’s Revenue and Customs and Europe’s national customs agencies to ensure that timely and appropriate data exchange keeps agricultural trade smooth after we leave the EU?

The Secretary of State talks a great deal about gaining control of our waters after Brexit, but, as usual with this Government, so much of the detail is sadly lacking. Since 2013, three British-based vessels of the Royal Navy fishery protection squadron have not been exclusively used for fisheries enforcement. The Government’s own figures show that the number of boats boarded by the fishery protection vessels has plummeted from 1,400 to just 278 over the past six years. Will the Minister explain what, “Take back control of our waters,” actually means and why fishing enforcement has dwindled so dramatically under this Government? Will he agree to conduct an urgent review to assist the level of fisheries enforcement required now and after Brexit?

I can tell the hon. Lady exactly what taking back control means. When we leave the EU we automatically, under international law, become an independent coastal state. That means that we will have responsibility for managing our exclusive economic zone, which is 200 nautical miles or the median line. We already enforce those waters. The hon. Lady raises concerns about the number of vessels, but most of the work these days is digital. We have a control room in Newcastle that monitors the movement of every single fishing vessel in the country.

My right hon. Friend is right. There is a particular problem in Cheshire, which is why two years ago we introduced six-monthly surveillance testing. We held a consultation in December on changing the way in which we calculate compensation rates on other species, including sheep and goats. The pig industry has some concerns and we are reviewing and addressing them. It is important to recognise that we already pay compensation to people with sheep and goat farms affected by TB.

T7. My hon. Friend the Member for Brecon and Radnorshire (Chris Davies) has drawn the House’s attention to the fantastic show in his constituency. I wish to draw hon. Members’ attention to the most spectacular summer’s day out in Worcestershire, the Hanbury show, which is held in my constituency. However, the farming communities in Inkberrow, Hanbury and the Lenches, who take part in the show with their fantastic produce, are concerned that, post-Brexit, there will be standards that affect the import and export of their products and have a negative impact on their trade. Will the Minister give us specific reassurances on that?

In Blaenau Gwent, we are proud of our Tudor Brewery. However, although beers can trade on their Britishness, there is no guarantee that they are produced on these shores. With calls to buy British ever louder, what are the Government doing to ensure that customers know that British brands are made in Britain?

May I return to the issue of animal welfare? The Secretary of State will recognise that the use of antibiotics in farming is part of an animal welfare regime. However, there is massive concern that overuse of antibiotics is destroying their effectiveness, both for animals and humans. What can be done to reverse this trend?

The Veterinary Medicines Directorate and our chief vet have been working very closely with the Department of Health on plans to reduce the use of antibiotics. Great success has been achieved in sectors such as poultry, where there has been a substantial reduction of some 40% to 50% in antibiotics use. Often it is about adopting different approaches to husbandry to reduce reliance on antibiotics, but although a lot of progress has been made, there is more to do.

Today I am updating the House on the implementation of the Government’s 25-year strategy to eradicate bovine TB (bTB) in England.

The Government’s comprehensive bTB strategy includes one of the most rigorous cattle surveillance programmes in the world, strong movement controls, a focus on good biosecurity, and badger control where TB is rife.

We are making good progress. The Government have this week applied for official TB-free status for the low risk area of the England—more than half the country—two years ahead of schedule, which will bring trade benefits for farmers in these areas.

Further measures I am outlining today will help us eradicate the disease from the rest of England more quickly and more effectively.

A consultation begins today on proposals to catch disease in herds as early as possible, by introducing a simpler, more risk-based TB testing regime in the high risk area with six-monthly routine surveillance tests. Lower risk herds where owners can demonstrate good biosecurity will be subject to less frequent testing. We are proposing some adjustments to the compensation system to improve incentives for farmers to reduce disease risks on their farms. Also included is a proposal to allow farmers to retain in-calf TB test positive cattle for up to 60 days, subject to biosecurity controls.

I can also confirm that we are now confident that supplies of BCG vaccine are sufficient to allow us to resume the badger edge vaccination scheme. This will help protect healthy badgers and stop disease spreading to new parts of the country. Private groups intending to run vaccination schemes will be able to apply for grants later this year for projects to run next summer.

We are also publishing responses to a consultation on supplementary badger control, and its licensing guidance, outlining plans to make sure disease control benefits in areas that have completed intensive culling are maintained while the disease is still present in England.

We are determined to implement all available measures necessary to eradicate this devastating disease as quickly as possible to create resilient and successful dairy and beef industries.

Copies of the cattle controls consultation and the badger control summary of consultation responses have been placed in the Libraries of both Houses.

I congratulate my hon. Friend the Member for Broxbourne (Mr Walker) on securing the debate. I note your comments too, Madam Deputy Speaker. In your neighbouring seat, you clearly share many of his concerns and his passion for the very important Lea valley glasshouse industry.

I recognise the importance of the sector and some of the challenges it faces. For several years, I ran a glasshouse enterprise in Cornwall. I had two acres of heated glasshouses, a former tomato nursery and I grew strawberries for the best part of five years. I am therefore familiar with some of the issues and, having studied horticulture, I am familiar with the role that Lea valley enterprises play. As my hon. Friend pointed out, the Lea valley is the UK’s largest cucumber and sweet pepper producer, accounting for more than 200 million pieces per annum—including 60 million cucumbers—and representing up to 75% of the UK’s total cucumber production and over 60% of the UK’s sweet pepper production.

Lea valley horticultural enterprises contribute some £500 million a year to the British economy and sustain 2,500 jobs annually. Today members cultivate around 120 hectares of glasshouses, extending beyond the Lea valley and across a dispersed area including London, Essex, Hertfordshire, Middlesex, Cambridgeshire and Yorkshire.

I want to pick up a different issue, although it is directly relevant to the Lea valley greenhouses, to my hon. Friend the Member for Broxbourne (Mr Walker) and to you, my wonderful constituency neighbour, Madam Deputy Speaker. We have a woodpile in Nazeing—which is part of both the Harlow and the Epping Forest constituencies—which has burned down four times in the past four years, causing massive damage to one greenhouse glass enterprise as well as local residents. Many residents feel that not enough has been done, and we cannot understand why new licences are given to new companies to “run” the woodpile site. It causes enormous damage and expense—it burned down again only recently. I urge my hon. Friend the Minister to look into the matter because it has a significant effect on the Lea valley glasshouse industry.

I am not familiar with the issue that my hon. Friend raises, but if there are concerns about the licensing of the woodpile operation he mentions I will ask officials to look at them.

I want to point out the history of the Lea valley. The success of the Lea valley over the years has been its fantastic contribution to feeding London throughout its history. From the middle ages onwards, it served the fledgling London with wheat, hay and barley, which came through to east London. The Lea valley has fertile alluvial soil, so by the mid-18th century it had become the leading market garden for Britain, growing a wide range of field vegetables and fruits. By the mid-19th century, the advent of the railways resulted in greater supply to London. As the population grew and the glass tax was removed in 1845, Lea valley became home to the very first greenhouses and subsequently developed its industry in everything from grapes to cucumbers.

My hon. Friend the Member for Broxbourne raised the issue of labour, and I can reassure him that I am in regular contact with representatives from the farming industry, including the National Farmers Union and others, and I am picking up that concern. Indeed, it was recently the subject of a report produced by the Environment, Food and Rural Affairs Committee, and only last week we had a Westminster Hall debate on that very issue.

In the last 12 months the number of EU migrants to the UK has increased by about 171,000, bringing the total to more than 2.3 million. However, horticulture faces a particular challenge relating to seasonal workers, who come here for a few months and then return home. Between 1945 and 2013, a seasonal agricultural workers scheme enabled people from countries outside the European Union to work here on a temporary basis. The scheme was closed in 2013 on the advice of the Migration Advisory Committee, but we have always made it clear that we will keep the issue under review. We established a SAWS transition group, which has met regularly, and met as recently as 6 March to discuss some of the challenges that businesses are facing this year. For instance, changes in the benefits system in Poland mean that fewer Polish citizens come here, and the work being done in Bulgaria to encourage people to stay and take employment there has also had an impact.

We estimate that there are between 67,000 and 80,000 seasonal workers in the UK, and that is very important to the industry. The Home Office, which leads on the issue, has said that it intends to commission the Migration Advisory Committee to examine the issue of immigration in the context of the decision to leave the European Union, including the issue of so-called tier 3 low-skilled labour. We had some discussions with members of the SAWS transition group to establish when they will be able to give us accurate data for the third and fourth quarters of this year, with a view to meeting again before the end of the year to review the position. I am therefore well aware of the issue of labour, and I can reassure my hon. Friend that we will be looking closely at the issue.

One of the great things about leaving the European Union is that we will regain control, and it will be in the gift of the British Government to do whatever they choose to do. If we deem that we need additional labour in a particular area, it will be within our power to secure that labour, and to set up whatever work permit arrangements are required to satisfy our needs.

My hon. Friend dedicated most of his comments to the issue of the Hoddesdon incinerator proposal in his constituency. Applications of that kind are always incredibly contentious. I remember that, a few years ago, there were proposals for an incinerator in Cornwall, a few miles down the road from my constituency, and I am well aware of the deep-seated concern that people may feel in such circumstances. My hon. Friend made a number of flattering remarks about my knowledge of the issue. As he knows, the Secretary of State for Communities and Local Government would have to lead in this regard, and planning issues are obviously a matter for the local authority in the first instance, but there is a role for the Environment Agency in a couple of areas.

As my hon. Friend also knows, Hertfordshire County Council is currently dealing with the planning application. One of the roles of the Environment Agency is to act as a statutory consultee in the planning process, and I am told that it is engaged in a dialogue with the council in that role. The agency also has a role in the environmental permitting regulations, dealing with any concerns that would arise as a result of an environment permit. I understand that it has received an application for an environmental permit, and that the application has been duly made, which means that the information has been received, but it has not yet been processed or assessed. I am told that the Environment Agency is due to start consulting on the permit application imminently and that it intends to hold a public drop-in session in due course. I understand that that consultation will take place in earnest in the weeks ahead.

I have asked the Environment Agency whether in principle there are certain issues here. It will not surprise my hon. Friend to know that it very much depends on the individual application and that it would not be appropriate for me to make any judgments on the case he described in his constituency. However, as a general point on some of the concerns about smoke, I am told that a properly constructed incinerator with the right kind of filtration would not necessarily have a problem such as he describes and residues would not necessarily be expected. I am also told that the environmental permit will assess and control emissions to air, land and water. That said, he is right that each case has to be considered on its merits. This case will be considered thoroughly on its merits. The consultation is under way. I would encourage any—

My hon. Friend makes a very important point. He said that the application will be considered on its merits. As it currently stands, it will be considered by Hertfordshire County Council, which is both the owner of the contract and the determiner of the contract. It is impossible for anyone in my constituency, and I believe in the constituencies of Epping Forest and Harlow, to imagine that the application will be considered on its merits, given that Hertfordshire County Council, if it does not grant it, will have to pay a £1.2 million failure fee to Veolia. That is the real concern, which is why I am hoping that the Minister will help the Lea valley growers and the NFU to make representations to the Secretary of State for Communities and Local Government for a proper independent inquiry by a planning inspector.

I understand the point that my hon. Friend makes, but he will be aware that I am not an expert on planning law and planning policy and that any such decision would be a matter for the Secretary of State for Communities and Local Government.

Yes, the consultation that the Environment Agency will conduct on the environmental permitting regulations will be an open process. As I said, it intends to open the drop-in session to members of the public. I encourage anyone with concerns about this application, of which, according to my hon. Friends and the representations they have made, there are many in their constituencies, to contribute to the consultation that the Environment Agency is putting together. I understand that the consultation is open and that that drop-in session will take place shortly.

I recognise the points that my hon. Friends have made on this contentious issue and I will ensure that the Secretary of State for Communities and Local Government sees a transcript of the debate. I am sure that Members will continue to make representations to him. It is ultimately for the Secretary of State for Communities and Local Government to make any decisions along the lines that my hon. Friend the Member for Broxbourne seeks.
