We are committed to implementing our 25-year strategy to eradicate bovine TB. The strategy has been the subject of extensive consultation. The issuing of a licence to Dorset is a measured approach to extending this policy, building on experience from previous years. There was a local consultation and an opportunity-to-comment procedure at the beginning of the licensing process.

This folly has now cost the taxpayer £17 million, and it is so far not proving as effective as the approach taken by the Assembly in Wales. Will the Minister give a commitment not to extend the cull beyond Dorset until there has been a proper evaluation of what is happening in Wales and of the folly of spending £17 million to date on something that is totally ineffective?

If we were to do nothing to tackle this disease, it would cost us about £1 billion over the next decade. The reality is that no country in the world has successfully eradicated TB without also dealing with the issue in the wildlife population. That is why a cull will continue to be part of our balanced strategy, alongside tighter cattle-movement controls and other measures, such as vaccination.

The hard-pressed dairy farmers of south Devon, which is a bovine TB hotspot, are keen for the cull to be extended into our part of the world. Can the Minister give any hope in respect of when such a cull might come our way?

We decided this year to have a cautious roll-out by adding one cull area in Dorset. In the light of that cull, we will review things again. There were applications and expressions of interest from north Devon and Herefordshire this year, and there are many other interested parties that I am sure will be considered in future years.

Has the Minister taken cognisance of the ongoing trials in a specific area of Northern Ireland? Has he had any discussions with the Minister for Agriculture and Rural Development in Northern Ireland about those trials?

I regularly discuss this issue with Northern Ireland. It is trialling an alternative approach called “test and vaccinate or remove”, whereby badgers that are not believed to have the disease are vaccinated and those that are believed to have it are culled. There are limitations on that because of the limitations of the diagnostic tests. However, we liaise closely with all the relevant devolved Administrations.

In a written parliamentary answer that was published on Monday, the Minister stated:

“Natural England has authorised badger culling in Dorset this year in addition to Somerset and Gloucestershire.”

Will he explain to the House whether the new Dorset culling area is part of a roll-out of culling or another pilot area? If Dorset constitutes the start of a national roll-out, how can that be justified on the performance of the pilot culls? If it is another pilot area, what monitoring and evaluation will be put in place by his Department?

The extension to Dorset, as I explained earlier, is part of a cautious roll-out of the policy. We piloted the culls in the first year in Somerset and Gloucestershire. Our experience last year demonstrated that a cull along the lines that we are pursuing could be successful. It was successful and that is why we are continuing.

The Government believe that our relationship with the European Union needs to change. That is why we will negotiate a new settlement with the EU and put it to the people in a referendum. In the meantime, DEFRA will continue to press for reform and simplification of the common agricultural policy to ease the burden of regulation on our farmers.

The question explicitly asked what assessment had been made of the potential impact of leaving the European Union. We can only assume from the Minister’s lack of answer that the answer to that question is: none whatever. The Minister will be aware that, thanks to our links with Europe, the world-class food and drink industry in Scotland—some of our products are almost as healthy as Walker’s Christmas puddings, I may add—is well on track to reach a seemingly impossible target, set by the Scottish Government, of a £1.65 billion contribution to our economy by 2017. Will the Minister give an assurance that he personally, and his ministerial colleagues, will campaign vigorously for Scotland and the UK to remain in the European Union?

The hon. Gentleman makes a very good point. We have some fantastically successful Scottish exports, not least Scotch whisky. Increasingly, Scottish salmon is doing well in international markets. We have a very informative debate to look forward to. There will be two sides of the debate once that negotiation is concluded. I am sure all Members will be rigorously involved in those debates.

We introduced the Groceries Code Adjudicator to ensure that there are fair contract arrangements between supermarkets and their suppliers. That will be reviewed next year and we continue to work with retailers and farmers to ensure we can help them through the current difficulties

I am sure the Minister will join me in welcoming new figures showing record turnover for sales of Scottish food and drink surpassing £14 billion for the first time in 2013. Will he work with the Scottish Government to make sure that producers feel the benefit of those sales and take up the call from the Cabinet Secretary for Rural Affairs, Food and the Environment to introduce a fairer framework for all those involved in the supply chain?

Yes, I can. I am a huge supporter of our Scottish exports. They do incredibly well. I discuss this regularly with Richard Lochhead, my opposite number in Scotland. We work with some of the lead Scottish agencies, such as Scottish Food and Drink and Quality Meat Scotland, to help to promote Scottish exports.

We do not accept that the allocation was done unfairly. Scotland gets slightly less per hectare, but because the average holding size is much larger, the average per farm is the highest in the UK. Nevertheless, we have committed to review the allocation in 2016-17 and have made it clear that part of that review will compare land types among the constituent parts of the UK.

T3. I welcome DEFRA’s focus on connectivity in the rural productivity plan. This week, Rural Action Yorkshire said it was nigh on impossible for a rural business to be in business without decent broadband and mobile phone coverage. The final 5% and the “not spots” will require innovation and investment. What comfort can the Secretary of State give to businesses trading in those areas?

The Minister will be well aware that the Labour Welsh Government have introduced regulation to improve conditions in dog breeding. Does he have any plans to introduce similar legislation in England to tackle some of the horrific conditions that back-street dog breeding gives rise to?

Yes, we have looked at this, because there was a misunderstanding on the part of some local authorities that a licence to breed dogs was not required provided that people were breeding fewer than five litters a year. We clarified that last year with local authorities because anyone in the business of breeding puppies requires a licence, but we continue to keep this under review.

T4. When on 9 August two cattle visited a supermarket in my constituency, they will have been disappointed to note that the only lactose-free milk was imported from Denmark. There is no such product made in the UK. Does the Secretary of State agree that this is an opportunity for import substitution, to use British milk, and an export opportunity?

T6. I met a delegation of local dairy farmers during the summer regarding the problems in their industry. One of their suggestions was that the Government do more to market dairy products as part of a healthy diet. Will my hon. Friend take that suggestion on board and perhaps resurrect some of the “Drink milk” television commercials that I fondly remember from my childhood?

My hon. Friend makes a good point. The dairy part of the Agriculture and Horticulture Development Board does some promotion of milk already and will continue to do so, and we should also note that the Department of Health spends around £63 million a year buying milk for infants.

T8. With the crisis in the price of liquid milk, one way to help our farmers increase their income is through products—dairy, cheese and additional products. I understand what my right hon. Friend the Secretary of State says about labelling, but what specific initiatives do the Government have for developing these products and developing new markets?

My hon. Friend makes a good point. In the long term, we want to develop processing capacity so that we can export some of our fantastic cheeses more widely around the world. That is why we are investigating the potential to use the European Investment Bank and rural development funds to support the development of that processing capacity.

I congratulate the right hon. Member for Orkney and Shetland (Mr Carmichael) on securing this debate. I know that the fishing industry is of huge importance in his constituency. I welcomed the opportunity that I had last year to make the long journey to visit his constituency and meet industry representatives.

I will try to cover as many of the points raised by hon. Members as I can. However, I will first give my reflections on my job from the two years that I have been Fisheries Minister. The marine environment is incredibly complex. No man-made policy designed to manage it and deliver sustainable fisheries will ever be perfect. The science will never be perfect, and we will never be able to pick up every interaction between different elements of the marine environment. If we want sustainable fisheries, there is no alternative but to have some kind of catch limit on vessels and some kind of quota system. Whether we were in or out of the common fisheries policy, we would have that quota system, just as Norway, the Faroe Islands and other states pursue catch limits, and we would still have arguments with other countries about allocation of fish stocks and seek reciprocal access arrangements.

The right hon. Member for Orkney and Shetland asked about forums for discussion with countries such as Norway and Iceland. Those forums exist. The coastal states meeting takes place each autumn, where we argue about, for example, the allocation of mackerel quotas in his part of the world. There is already an EU-Norway agreement that precedes the discussions at the December Council.

We should all pay tribute to the great work of my predecessor in this post, my hon. Friend the Member for Newbury (Richard Benyon), who I believe made some important breakthroughs on reform of the common fisheries policy. Unlike the negotiations on reform of the common agricultural policy, which were very difficult and where we made little progress, even I, a strong Eurosceptic, recognise that good progress was made on CFP reform.

Four key things were delivered. First, there was a legally binding commitment to fish sustainably—to fish at MSY by 2016 where possible, and everywhere by 2020. Secondly, there was the discipline of a discard ban to ban the shameful practice of discards. Thirdly, in order to help deliver the policy and make it a reality, there was the regionalisation of policy making, so that nation states multilaterally agreed between themselves how they should manage the waters in which they have a shared interest, with the role of the Commission reduced to simply rubber-stamping those agreements at the end. That is really important. Although it is sometimes difficult to get member states to reach those agreements, it forces them to work through their differences, and these are the countries that actually have an interest in an individual fishery.

The final important element in making the discard ban work, as a number of colleagues have alluded to, was the introduction of flexibilities in the quota system. Those flexibilities include the ability to bank and borrow quota from one year to the next, which has been extended, and an inter-species flexibility, so that if a fisherman runs out of quota for one species—say, haddock—he can count some of his cod quota against haddock within certain limits. There were exemptions involving survivability on certain flat fish, for instance, and a quota uplift to take account of the fact that fishermen are no longer discarding. The deal to the fishermen is, “Stop discarding the fish and we will increase your quota by the amount that we estimate has been discarded previously.”

We should also recognise that good progress has been made. Contrary to what the hon. Member for Brent North (Barry Gardiner) said, the most recent assessment shows that we now have 32 stocks being fished at MSY. That is up from 26 in 2014 and from only around 13, if we go back around a decade. That progress is starting to feed through into benefits for the fishing industry. In relation to the North sea, last year’s December Council was much easier, and there were recommendations for increases. In fact, in certain species, such as cod and haddock, there is a similar situation this year, so where we have shown restraint, we are starting to see benefits accruing to the fishing industry. I always try to get this point across to fishermen: “If you show restraint now and allow stocks to recover and achieve that maximum sustainable yield, you are safeguarding your own financial future, because you will have more fish tomorrow.”

We have made good progress with the regional groups. A number of people have mentioned the importance of getting the industry involved, and I confirm that there is an industry regional group. The regional groups have been successful in developing the discard plans, both for the pelagic species, which is now in place, and for the demersal landing obligation, which was submitted in May. Following on from that discard plan, we now have the multi-annual plan for management, for instance, of the Baltic area, and we will shortly be beginning work to take forward ideas for our own plan. Therefore, good progress has been made, and as we made clear in our manifesto, our primary objective during this Parliament is to ensure that we get the hard-won CFP reform properly implemented.

The right hon. Member for Orkney and Shetland commented that some of the science is out of date, and it will not surprise him to learn that I hear that all the time from fishermen. The reality is that we always try to make sure that we have the most up-to-date science. At last year’s December Council, we brought scientific results that were collected during the month of November/December straight to the Council. ICES always tries to project trends, so when it publishes its advice for a particular Council, it is not as dated as people suggest, because it factors into that the ongoing trends. I sometimes hear fishermen say that it goes where the fish are; that it goes to the same part of the ocean each year when it does its surveys. That is true, but some kind of basic yardstick is needed, which is consistent from one year to the next, so there is a control. In addition to that, we put scientists on actual fishing vessels, so that they can see fishing activity and the stocks that fishermen are landing.

The right hon. Gentleman and a number of colleagues asked about the renegotiation and the Prime Minister’s plans to renegotiate our relationship with the EU. The Prime Minister probably would not thank me if, here in a Westminster Hall debate, I were to add something to his renegotiation list, but I will say that, in common with the CAP, we have regular reforms of the common fisheries policy. They happen every 10 years. The next one is due to commence around 2019 and to be implemented from 2022, so there is a natural timetable for the next reform of the CFP.

Although our focus now is on making the existing reform work, I can say that the next reform might look at a couple of areas—it is too early to say whether it will. The first is to move from the rather arbitrary single-stock quota system to something a bit broader that recognises that biomass would be a natural step forward from MSY—but that is difficult to achieve. The second is, as my hon. Friend the Member for Waveney (Peter Aldous) and a number of colleagues mentioned, to look at the issue of relative stability. The reference period for the quota system that we have was set between 1973 and 1978. It is undoubtedly dated. However, we should not enter that venture lightly, because many other countries would believe that they have a claim for more fisheries, and we always have to be cautious that we are not unlocking something that would leave our industry at a disadvantage. They were set in that way at that time to end disputes about who should have access to what.

I will carry on, if I may. My hon. Friend the Member for South East Cornwall (Mrs Murray) gave us a very detailed history lesson, and I will not challenge her historical knowledge of these things. However, we should recognise, as the shadow Minister said, that fish stocks were in a really bad place in the 1930s. We had suffered overfishing. Although we hear now about the discard ban and how the common fisheries policy created that, the truth is that as long ago as 1942, George Orwell was complaining about the discarding of fish. The fish stocks were basically saved by the second world war. We then had a period of plenty for the fishing industry during the ’50s and ’60s, but we then needed to move on to a quota system.

Along with a number of other colleagues, my hon. Friend mentioned the issue of access. She is right that when we joined the EU there was equal access in the 12 to 200- mile, or median, line in our waters, but access to the six to 12-mile line was for countries that had access agreements prior to accession. It is also important to recognise that we have access to other European countries’ waters. If someone were to talk the French industry, they would find that it complains, usually to the fishing Minister, about British access to, for instance, the bay of Biscay and the baie de Seine, which is important to part of our fleet. We also have access to waters in Ireland, Germany and the Netherlands.

My hon. Friend the Member for Waveney made a very important point about the under-10s, which I recognise. We have consulted on top-slicing 25% of the quota uplift for stocks and allocating that to the under-10s, on the basis that at the moment, they have to discard quite a lot of the fish that they catch because they do not have enough quota. He is right that during the reference period in the late 1990s, there was patchy reporting, which means that the under-10s do not really have a fair deal at the moment. We have already taken on Mr Bumble, as he would have it, and we have had legal challenges with the producer organisations to realign some of the quota. We will be doing more on that as well.

The hon. Member for Great Grimsby (Melanie Onn) raised the issue of choke species, among other things. The flexibilities that we have in the common fisheries policy can, I believe—if deployed correctly—deal with those problems. We start by not having every species covered from year one with the discard ban, and with the key species that define the fishery. For instance, in Scotland, fishermen often cite hake. Hake does not define the fishery in the North sea, and it is a species that would be returned to later in that window, closer to 2020. However, I was pleased to meet her, along with my hon. Friend the Member for Cleethorpes (Martin Vickers) earlier, with representatives from fish processors in her constituency. I recognise its importance there.

The hon. Member for Berwickshire, Roxburgh and Selkirk (Calum Kerr) mentioned relations with the Scottish Government. We are fully engaged and work very closely with my opposite number, Richard Lochhead. He attends trilaterals with the Commission at December Council and we will be working closely together, leading up to that.

Finally, the shadow Minister asked lots of questions that I cannot answer in full now, but he also asked about the precautionary principle. Of all the countries in the European Union, the UK has the strongest history of relying on and arguing the science, so we do have a science-led approach to fisheries management.

I represented the UK at The Eu Agriculture And Fisheries Council on 16 June in Luxembourg. Aileen McLeod MSP was also present.

Organic production and labelling of organic products

The Council discussed the presidency’s latest compromise text on the organic proposal with some member states continuing to call for further changes. On the issue of the presence of non-authorised substances on organic produce, Belgium and a few other member states argued for the ability to apply a strict decertification threshold to all produce. However, I supported the presidency’s text, with some minor modifications proposed by Germany, so that those member states that already use thresholds could continue to do so but for a limited time period. This means that the UK will not be bound by the need to apply a specific decertification threshold and by the end of 2020 this will be the approach that applies across the whole of the EU. Belgium, Bulgaria, Slovakia and the Czech Republic, all of whom agreed with the threshold, voted against the proposal. Denmark also voted against it as it disagreed with the move away from mandatory annual inspections to a risk-based approach. I, along with the remaining member states, voted in favour of the proposal which secured a general approach. Trilogues will begin after the summer, once the European Parliament reaches its first reading position.

Fishing opportunities

The Commission introduced its policy statement on setting fishing opportunities in 2016, which was generally welcomed by all member states. Commissioner Vella emphasised the good progress made towards reaching the maximum sustainable yield (MSY) targets under the reformed common fisheries policy. I agreed that we should continue to build on this, aiming to reach MSY by 2016 wherever possible. However, exceptions may be necessary, including the need to minimise discards of by-catch. Some member states, particularly those fishing in the Mediterranean and Black sea, argued for a gradual transition to MSY, with a final deadline of 2020. I also stressed the importance of the demersal landing obligation, including the need to adjust catch limits for those species covered next year, and the need to progress multi-annual management plans for the North sea and western waters.

Any other business items

Country of Origin Labelling

The Commission presented its reports on possible mandatory country of origin labelling for a range of foods including dairy and certain meats. The Commission concluded that consumer interest was not strong enough to justify the likely extra costs. I, along with France, Italy and several other member states, stressed that the issue required further consideration, especially for milk and dairy products. Luxembourg, Poland and Ireland, however, stated that they were not in favour of further discussion as the Commission’s reports highlighted that the costs outweighed the benefits.

Animal Health

The presidency confirmed that a final position on the animal health regulation had been reached following trilogue discussions. I congratulated the presidency on reaching agreement on the proposal but explained that we had been unable to fully support it, specifically the areas where delegated acts will be used to define technical detail such as the list of diseases to which the regulation applies. This was an important point of principle because the list is a technical issue rather than a political one, which should be determined by member states experts.

Russian import restrictions on fishing sector

Estonia provided an update on the unjustified export ban on all fish products originating from Estonia and Latvia that was imposed by Russia on 4 June, following a recent Russian official audit on their control systems. It called on the Commission to raise the issue in meetings with Russia and also to change the rules to allow for increased carrying over of 2015 fisheries quotas into 2016 and urgent assistance under the European maritime and fisheries fund (EMFF). I, along with Finland, Poland, France and Lithuania, supported Estonia and Latvia, arguing that it was crucial to maintain unity in the face of unjustified trade restrictions from Russia, that current actions were clearly disproportionate and that we needed to stand up to such aggression. The Commission stated that it would endeavour to do all it could to ease the impacts of the ban, including supporting the sector from the EMFF and considering the option of carrying over 2015 fishing quotas into 2016 on the basis of scientific advice.

Outcome of the Visegrad meeting

Slovenia presented the outcome of a recent meeting of the Visegrad Agriculture Ministers and those Ministers from Bulgaria, Romania and Slovenia at which they discussed trading practices in the food supply chain, Forest Europe and CAP simplification. Several member states intervened to support the concerns about unfair trading practices in the food chain which the Commission stressed it was an issue it would look at further.

Extension of eligibility period of expenditure for 2007-13 Rural Development

The Commission confirmed that it would not be extending the eligibility for 2007-13 rural development expenditure for an additional six months, despite further calls from Romania and several other members states to do so. The Commission explained that it had not been possible due to a lack of legal provisions and limited financial and political flexibility.

Extension of eligibility period of expenditure under the European Fisheries Fund

Similarly to the item on rural development expenditure, the Commission also confirmed that it would not be extending the eligibility period for 2007-13 fisheries funding. Instead, it would look at existing flexibilities within the current legislation to assist member states.

International Year of Plant Health 2020

The presidency reported back from the food and agriculture organisation conference on 9 June, which had approved the initiative to declare 2020 the international year of plant health.

We have made it very clear that we do not support the routine preventive use of antibiotics or the use of antibiotics to compensate for poor animal husbandry. That is reflected in the revised guidelines on the responsible use of animal medicines on the farm, published by the Veterinary Medicines Directorate last December. We continue to work with a number of industry bodies to encourage the development of prescribing guidelines, to challenge and optimise prescribing practices and behaviour.

Today, we hear that MRSA of a livestock origin is not only likely to be well established within the UK pig herd but has for the first time been found in British retail pork, from which it could be passed on to humans. In the light of this new and extremely troubling evidence, will the Department now finally set clear targets for phasing out routine preventive use of antibiotics in farm animals where no disease has been diagnosed, or is the Minister happy to take the risk of a post-antibiotic future?

It is important to recognise that livestock-associated MRSA is a different strain from that which affects our hospitals and does not cross to the human population. This country has always had slightly lower levels of antibiotic usage than countries such as Denmark and the Netherlands, which have had more serious problems. They have to be prescribed and clinical decisions have to be made, but the guidelines we have issued mean we have managed to suppress the use of antibiotics and ensure they are used sparingly.

Does the Minister agree that microbial antibiotic resistance is by no means exclusively a concern for veterinary medicine, and will he join me in welcoming the publication back in 2013 of a Government strategy to deal with the issue across Departments?

My hon. Friend is absolutely right. This issue also affects the Department for Health, and the chief medical officer is leading our work in this area. As my hon. Friend says, we have published an antimicrobial strategy setting out our approach for the next five years. It is also true that, although the use of antibiotics in farming has been relatively static over the past decade or so, we have seen an increase in the use of antibiotics in medicine, which is of great concern.

McDonald’s is phasing out beef products that contain antibiotics, but it has indicated that beef products containing ionophore drugs will be acceptable, as they harm neither animals nor humans. What discussions has the Minister had with the catering industry about that?

I have not had any specific discussions on that point. As I have said, all antibiotics have to be prescribed. It is important to distinguish between routine use and preventive use. Sometimes it is right to use them preventively if there is a particular problem in a herd or a flock, but they have to be prescribed by vets—and only sparingly.

British food and farming is worth more than £100 billion a year to our economy and employs one in eight workers in Great Britain. That is why the Government are committed to working with industry to develop a long-term plan to buy more, sell more and grow more British food. The plan will set out how British food and farming can become a world leader that is innovative, competitive, profitable and resilient, and we will work on that in the months ahead.

I draw Members’ attention to my declaration of interest.

Population growth predictions estimate that we will need to produce 60% more food by 2050, but British crop yields have plateaued over recent years and the agrichemical toolbox available to farmers has been ever reducing. Will the Minister look seriously at offering more support for research and innovation that is focused on increasing yields and on the production challenges that farmers face today?

My hon. Friend makes an important point. Following large growth immediately after the war, yields have plateaued in recent decades. DEFRA is spending about £1.75 million a year on research into crops, and our research councils, through the Biotechnology and Biological Sciences Research Council, have a number of programmes in this area. In particular, Rothamsted has a major programme called “20:20 Wheat”, which aims to get yields of wheat to 20 tonnes per hectare in the next 20 years.

This week a dairy farm in my constituency closed its gates for the last time. That follows a 55% reduction in the number of dairy farms in the UK since 1998. What can the Minister say to support British dairy farming?

My hon. Friend highlights a real problem with dairy at the moment. We have had a very difficult year, following a very good year last year. The long-term prospects for the industry are good: demand is growing by about 2% a year, and the Government are making it easier for farmers to average their tax, working with the National Farmers Union to develop futures markets to help farmers manage volatility, and making available investment—through the rural development programme—to help farmers improve their competitiveness.

The number of young people entering the UK food and farming sector is encouraging. What assurances can the Minister give that young people can access the skills they need to ensure that the sector has a secure future in areas such as west Cornwall and my hon. Friend’s constituency?

As my hon. Friend knows, we have Duchy College in my constituency, and many of his constituents attend it. He makes an important point: we want to treble the number of apprenticeships in food and farming and to encourage more young people to choose farming as a career. We are working with organisations such as Bright Crop to get ambassadors to go into schools to help teenagers to choose the right subjects so that they can take up careers in farming. That area will be a major part of our food and farming strategy.

No, the right hon. Gentleman will know that the Government want to renegotiate our relationship with the European Union, and then we intend to campaign to stay in. The CAP is not perfect, and during the course of this Parliament we will push for a mid-term review. We will also argue for longer term reform so that the CAP serves farmers and consumers more effectively.

Farmers in my constituency, a mere 10 miles from Manchester city centre, are still seeing the productivity and competitiveness of their businesses inhibited by the lack of superfast broadband. What discussions is the Minister having with ministerial colleagues in the Department for Culture, Media and Sport to expedite the roll-out of superfast broadband in rural areas?

The Secretary of State had a meeting yesterday on that very issue. Broadband Delivery UK has made available some £750 million to roll out superfast broadband in our most rural areas, as well as funds to pilot new technologies in the hardest to reach areas. We recognise that this is an important issue, and the Government will focus much of their energies on it.

The Government have withheld from Scotland the vast majority of a €230 million pillar one allocation of EU uplift money. The UK qualified for that money only because of Scotland’s low payments. Can the Minister explain why, against the clearly expressed will of the Scottish Government and all political parties in the Scottish Parliament, the Government intend to deprive Scottish farming communities of most of that money?

The allocations that we have made are based on land types, and historically Scotland has tended to have less per hectare because its land was less intensively farmed, but it actually receives more per farm holding than any other part of the UK. We have made it clear that we will have a mid-term review of that issue, which will include comparisons of land types in every part of the UK.

Bees and other pollinators play an absolutely crucial role in our environment and are estimated to contribute around £400 million a year to our economy. Last year, DEFRA published the national pollinator strategy—a 10-year plan to bring about the best possible conditions for pollinators to flourish. The Government are committed to taking action to support pollinators across all types of land, enhancing the response to pest and disease risks and improving our evidence base.

I share the concerns of many constituents who have contacted me about the threat to the bee population from the proposed use of pesticides. We tamper with bees’ wellbeing at our peril; the evidence on this issue is incomplete. Will my hon. Friend give me an assurance that the restrictions on neonicotinoids will not be lifted until the evidence is complete?

I can tell my hon. Friend that the United Kingdom has implemented the restrictions in full, and that the European Food Safety Authority is about to conduct a review. It has made a call for evidence, to which the United Kingdom will contribute. We have commissioned work from the Centre for Ecology and Hydrology, and that will be taken into account when the authority has completed its review.

I recommend to the Minister Hoxton Manor honey, which is made by the many urban beekeepers who are now based in my constituency. Production there has mushroomed in the last decade; indeed, my first piece of casework involved a beekeeper. Does the Minister agree that we need to encourage more urban beekeeping to ensure that we have a good ecosystem in our inner cities as well as elsewhere?

I entirely agree, and the national pollinator strategy refers to the importance of providing better habitats for bees in urban areas. I can inform the House that there is even a beehive on the roof of the DEFRA building.

I welcome the pollinator strategy, but yesterday I was contacted by a large number of people who were effectively lobbying. Will the Minister assure us that he will look at all the evidence, in order to ensure not just that the wonderful bees are protected, but that our farmers can farm economically and produce healthy food?

Many of my hon. Friend’s constituents have contacted me as well, and I know that there is a great deal of concern about the issue. There is a gap here: we do need more field trials. The United Kingdom has commissioned some work of that kind, as have other European Union member states including Sweden.

I am going to lose all my honey now. [Hon. Members: “How much?”] I shall ignore the heckling from my own side. It usually comes from the other side.

I was very concerned to learn that farmers who use polytunnels are buying hives in order to pollinate them and, as a condition of their contracts, must then destroy the hives with the live bees inside. I should be grateful if the Minister could confirm or deny that, in the context of his review, or at least look into it if he is not sure of the answer.

I was not aware of that particular problem. We have tightened the regulations on imported bumblebees that are used in glasshouses in order to ensure that the native breed, audax, is the main one used, but if there is a specific issue involving honeybees, I shall be happy to engage in correspondence and then deal with it.

T2. Bovine TB is an incredibly serious disease, with over 26,000 cattle slaughtered last year alone. My constituency of Lewes falls in a high-risk area. What steps are being taken to roll out pilot vaccination programmes and other measures to help support farmers in the south-east?

It is part of our 25-year strategy to roll out additional cull areas in high-risk areas and to roll out vaccinations in edge areas. The hon. Lady’s constituency, in East Sussex, is part of a high-risk area and has an edge area, and we would be happy to consider any application that came forward.

T6. In the Minister’s written answer to me yesterday, he refused to publish the National Farmers Union application for an exemption on the ban on using neonicotinoid pesticides. Does he agree that on this vital subject and this major threat to bees and pollinators the public should know what is going on behind closed doors? If so, will he publish that information, even if he redacts the names of the farmers?

The hon. Lady knows that that information is commercially sensitive, but what I can say is that two applications are being considered by the Health and Safety Executive, and before any decision is taken we would take the advice of our expert committee on pesticides.

It is a pleasure to serve under your chairmanship, Mr Davies. I congratulate the hon. Member for Newport East (Jessica Morden) on securing the debate. She has championed this cause for some time and she made it clear towards the end of the last Parliament that she would seek an early opportunity for a debate. She has succeeded. Everyone here will have been touched by the story of her constituent and his ill health.

I am sympathetic to farmers suffering from ill health and I acknowledge that some of them associate their illness with the use of organophosphate sheep dips. There is a long history of research into the hypothesis that low-level and non-toxic exposure to organophosphates, sheep dips in particular, might have caused long-term neurological health conditions.

The independent Committee on Toxicity released a statement on organophosphates in March last year, following its earlier report in 1999. The COT reviewed the science published since the original 1999 report and in summary concluded that the reviewed evidence suggests that exposures to cholinesterase-inhibiting organo- phosphates that are insufficient to cause overt acute poisoning do not cause important long-term neurological toxicity in adults and that, if toxic effects on the nervous system do occur, they are minor and subtle.

I am sorry, but I really must take issue with that; that is not the case. My constituency covers Exmoor and one of my constituents, George Wescott, has suffered with this for more than 30 years. As the hon. Member for Newport East (Jessica Morden) and I have already said, the Minister should set up a commission so that we can get to the bottom of the issue rather than accepting what I suspect is slightly flawed science, although I hesitate to say that.

It is worth looking further at the science, because the committee’s statement was also endorsed by the medical and scientific panel, which is a sub-group of the independent Veterinary Products Committee. A cross-Government official group on organophosphates also endorsed it. It is worth highlighting some extracts from that detailed report. I have read the report, which is very scientific; I recommend it to anyone with an interest.

The report highlighted that, since 1999, 13 new papers have been published on the relation of low-level exposure to organophosphates and peripheral neuropathy, which added to the 13 studies already available at the time of the previous COT report. Having reviewed all 26 of those studies, the report concluded:

“The current balance of evidence suggests that there is no long-term risk of clearly demonstrable peripheral neuropathy from exposure to organophosphates”.

I know my constituent well and, having gone through his case in great detail, I am absolutely convinced that his health condition was caused by his exposure to sheep dip—the link is all too clear. Has the Minister also had a chance to review the independent academic research by Sarah Mackenzie Ross, an academic at University College London, who has reviewed all the existing studies and concluded that there is a considerable association between low-level exposure to organophosphates and impaired neurological function?

I am aware that that report was reviewed by the Committee on Toxicity and that, in fact, part of the COT’s report does concede that there may be some effects in some cases. I will return to that. However, just to stick to the COT report, it highlighted that 22 investigations published since 1999 had looked for neuropsychological consequences of low-level exposure. When the committee looked at those, in addition to the nine published previously, it concluded:

“Overall, there is no consistent evidence that low-level exposure to organophosphates has adverse effects on any specific aspect of cognitive function. If organophosphates do cause long-term neuropsychological impairment in the absence of overt poisoning, then the effects, at least in the large majority of cases, must be minor and subtle.”

In relation to Parkinson’s disease, the report concludes:

“The overall balance of evidence from 11 studies suggests no increased risk of Parkinson’s disease from exposure to organophosphates that is insufficient to cause overt acute poisoning”.

However, it did acknowledge that

“a small elevation of risk cannot be ruled out.”

The report does acknowledge—this links to the point that the hon. Lady was making—that

“Despite limitations of individual studies, current evidence suggests that there is an excess of multiple neuropsychiatric symptoms in people who have been exposed to organophosphates at levels insufficient to cause overt acute poisoning. However, it does not support the existence of a specific syndrome of ‘chronic organophosphate-induced neuropsychiatric disorder’, as has previously been hypothesised.”

In its conclusion, the report states:

“Collectively, the evidence reviewed is reassuring. It suggests that exposures to cholinesterase-inhibiting organophosphates that are insufficient to cause overt acute poisoning do not cause important long-term neurological toxicity in adults”.

The reason why I have outlined those points—with long medical words that I am not used to pronouncing—in some detail is that it is important to acknowledge that there have been dozens and dozens of studies about this issue for more than 20 years. After the first COT report in 1999, the Government commissioned additional research into the subject, which was considered along with all the other evidence gathered since 1999 as part of the COT report last March. The committee has reached its conclusion based on the science.

I will try to make some headway, and then perhaps give way later on.

The hon. Lady will be aware that in November 2001 a group of farmers took a case to the High Court seeking damages for OP poisoning. In the event, the case was struck out, because the claimants could not prove that their symptoms were caused directly by exposure to OP dips. The decision was upheld by the Court of Appeal in November 2002.

I turn now to the issue of the HSE report that the hon. Lady mentioned. The report was commissioned in 1990 and published in 1991; there has been some discussion of whether it has been covered up, so it is important to note that it was published at the time. Since December 2014 there has been increased media attention on possible health effects experienced by people who used sheep dips, focusing on what was known about the substances by Government at the time, as sheep dipping was compulsory until 1992.

An FOI request was received from Tom Rigby of the Sheep Dip Sufferers Support Group at the beginning of February this year, seeking a copy of the HSE report. The HSE was initially unable to locate one; it informed Mr Rigby, who then stated that he held a copy from another source and further requested sight of any correspondence between the HSE and the MAFF in relation to the contents of the report. As no such correspondence was found, the HSE sent a nil response. However, a misfiled copy of the 1990 survey report was subsequently located elsewhere and passed on to Mr Rigby.

I know Mr Rigby still has outstanding FOI requests relating to some documents. The documents in question are HSE-commissioned reports into cholinesterase and the chronic effects of dipping sheep in OP products dating from the mid-1990s. Some are publically available and Mr Rigby has been pointed towards those; the HSE is currently looking into the status of others. To clear up any concerns, I am happy to say that we will place a copy of the 1991 report in the Library for hon. Members to look at.

It is clear that there are significant documented records from around 1993 that indicate considerable cross-Government work taking place on the subject of OP dips at the start of the decade. The 1990 survey appears to have been prompted by reports from farmers that they believed dips were making them ill. The research was focused on the extent to which operatives were exposed to organophosphates, the efficacy of their personal protective equipment and the dipping systems used. Although the report refers to known toxic effects of organophosphates, it does not focus on whether dips were causing ill health, nor does it look at whether dips can cause the long-term ill health that is the focus of the existing sufferer groups.

The Government recognise that organophosphates are potentially dangerous substances whose use needs to be controlled to minimise the risks to humans. Government policy is, and always has been, based on the best scientific advice. Safety warnings on the products reflected the known risks at the time. It is Government practice regularly to review the controls in line with the latest scientific advice and to carry out research to provide more information where required.

Throughout the debate, Members have detailed the examples of their constituents. What consideration has the Minister given to the common denominator of those examples—namely, the organophosphates used by all those people, who are now suffering as a result? There has to be a common denominator and an investigation into that.

All I can say is that the Committee on Toxicity has looked at the matter exhaustively. It has produced a detailed report reviewing dozens of studies, and has been unable to establish a link. Its conclusions are very clear. Over the past decade, the Government have commissioned £4 million of research into the issue. Many, many people—experts in their field—have looked into the issue and reviewed all the available evidence to reach their conclusions.

The 1991 report—it is important to recognise that that report was published at the time—was a survey of farmers who self-reported symptoms. We should bear two things in mind. First, it was not a scientific report; all the reports that the Committee on Toxicity has looked at are scientifically robust research projects. The other thing to note is that the focus of the 1991 report was whether farmers had the correct protective equipment to prevent acute poisoning. We must make a distinction between actual poisoning—organophosphates are poisonous substances that cause tetanus-like symptoms if acute poisoning takes place—and the separate issue of whether exposure to low levels of organophosphates that does not cause overt poisoning nevertheless contributes to long-term conditions. The conclusion of the report is that it does not. We must make that distinction. The report of 1990-91, which as I say was published at the time, was about the concerns about overt poisoning, not possible long-term conditions.

The sale and supply of OP sheep dips have been restricted to appropriately trained and certified users since 1995, reflecting concerns at the time about their toxicity. In addition, the Veterinary Medicines Regulations 2006 introduced a requirement for dipping to be supervised by a holder of a certificate of competence; that requirement remains in force.

Sheep scab is a severe disease with profound and sometimes fatal welfare implications for affected animals. There are currently still two sheep dips containing organophosphates that are authorised for use in the UK. There are other authorised veterinary medicines available to protect sheep against scab, but dips remain the most clinically effective treatments for the mite that causes it.

Yes—I was going to conclude by saying just that. The hon. Lady put that challenge to me and I am more than happy to meet members of the group to discuss their concerns. I am also aware that she raised the specific issue of her constituent’s medical records, which she suggested were evidence that sheep dip might have contributed in his case. If her constituent agrees, I am happy to make that information available to the Veterinary Medicines Directorate, which regulates these products on our behalf, and the Health and Safety Executive, which has been the lead on the issue.

This has been a long-running saga. The interventions in the debate have shown that many hon. Members have constituents who associate their condition with OP sheep dips. I reassure Members that we are not hiding anything. The 1991 report was published at the time, but for the sake of completeness I am happy to ensure that we put a copy in the Library.

I represented the UK at the EU Agriculture and Fisheries Council on 16 March in Brussels. Rebecca Evans AM and Richard Lochhead MSP were also present.

There were only agriculture items on the agenda.

Organic production and labelling of organic products

The Council held an orientation debate on the proposal for a regulation on organic production and labelling of organic products. Most member states agreed that good progress had been made. Austria and the Netherlands, however, repeated their calls for the proposal to be withdrawn, arguing that it would hinder rather than support development of the organic sector. I, along with a number of other member states, argued for the removal of the requirement for annual physical inspections in favour of a risk-based approach. I also stressed that the Commission’s proposal to move to an import regime based on compliance with EU rules should not impact negatively on developing countries and that a significant transition period should be included. The presidency confirmed work on the proposal would continue with the aim of reaching a Council position in May.

Milk Sector: market situation, trends and EU measures

The Council discussed the milk sector focusing on the market situation, trends and EU measures. Poland stressed that its producers were finding the current market situation tough and France and Spain repeated their request for the Commission to consider stronger crisis management tools. I stressed that further work was needed to identify and develop new markets and urged the Commission to come forward with its feasibility study on dairy country of origin labelling as soon as possible. Commissioner Hogan acknowledged the difficulties in some parts of the sector but expressed optimism about global demand in the future. He also said he would consider suggestions for broadening the scope of the Milk Market Observatory.

CAP implementation and simplification

Commissioner Hogan opened the session on CAP by announcing that he would consider extending the 15 May deadline by when farmers had to submit their scheme applications given the administrative demands of the new regime. I supported Italy and other member states in calling for that extension and I stressed that it should be a minimum of a month. The Commissioner also confirmed that his services were examining all of the ideas submitted by member states in response to his simplification exercise. Ministers then proceeded to highlight a wide range of priorities for change, including the new greening requirements. I called for more realistic greening mapping and control regimes and argued that member states’ own interpretations and implementation should be respected. The presidency confirmed that they would seek to agree Council conclusions on CAP simplification at the May Council.

International agricultural trade issues

The Commission provided an update on EU agricultural imports and exports and the progress of a range of bilateral and multilateral trade negotiations during a Minister-only lunch session. I agreed with those member states who stressed that the EU’s high production standards and system of geographical indications should not be undermined. However, I underlined that global trade could boost economic growth across Europe and that significant opportunities were available to the EU, in particular in negotiations with the US and Japan.

AOB: Angora wool and fur from maltreated rabbits and furred animals

The Netherlands highlighted the issue, mainly in China, of plucking live angora rabbits for wool and furred animals being maltreated. I shared their concern and stated that UK officials would approach our textile and clothing industry to better understand their position. The Commission noted that the World Trade Organisation rules currently prevent the EU from imposing its animal welfare standards on third countries and agreed that a business to business approach would be best.

AOB: Xylella fastidiosa in southern Italy and risk of further spread in the EU

Commissioner Andriukaitis underlined the seriousness of the threat of the Xylella fastidiosa bacteria not only for olive trees but also potentially to the wider agriculture sector. Italy explained what measures had been taken and that the eradication of host plants was now under way. I supported the need for stronger EU emergency measures as well as updating the plant health directive, to provide better protection against all strains, from all countries and on all host plants.

As part of the Government’s red tape challenge initiative, DEFRA will complete this Parliament an ambitious programme of reform to improve and simplify its regulation. These reforms will reduce regulatory costs to business by around £300 million per year, thus helping to promote growth, while maintaining our high standards of environmental, animal and plant health protection.

In total, 650 legislative reforms will have been made which will reduce the number of regulations in force by more than 20% compared to May 2010. I am today placing a full list of these legislative reforms in the Libraries of both Houses.

Reforming the amount of guidance that accumulated over many years has also been an important priority. In May, DEFRA and its regulator network will have reduced their guidance by more than 70,000 pages, which is a reduction of over 80%. I am placing in the Libraries of both Houses the current impact assessment to support this reform.

All DEFRA’s legislation in force is now accessible to the public via DEFRALex, an online portal on legislation.gov.uk/defralex. This is designed to make legislation more accessible and easier to locate by businesses and the public.

(Urgent Question): To ask the Secretary of State for Environment, Food and Rural Affairs if she will make a statement on the Government’s failure to deliver a digital-only system for processing the basic payment scheme via the Rural Payments Agency, and what assurances she can give to UK farmers that the failure will not result in significant delays to the receipt of their basic payment?

I am grateful for this opportunity to update the House. This is the first year of the new basic payment scheme. As the new common agricultural policy is so complex, we needed to invest in a new computer system to administer claims; the existing single payment scheme computer system would not have been able to cope. The new system included a core, which was there to process data and which was based on an existing system used in other countries, and a portal that enabled farmers to register their details and to map land passes.

The core of the new rural payment system is working well. To date, more than 80% of farm businesses in England have registered successfully on it, so they can submit a BPS claim. We continue to engage and encourage farm businesses to register online as soon as possible. However, there have been performance issues with the online interface that enables farmers to input the data directly, especially when it comes to mapping land passes. We have been working to address those issues since February. Our priority has always been to ensure that farmers can submit their claims by the deadline. That is why we have made adjustments to our plans. The RPA is now offering farmers and their agents the option of using existing paper-based forms to finalise their claims. Information from those forms will then be input by the RPA on to the system.

There are two new ways in which farmers can complete their claims. Farm businesses with little change to their land will be fast-tracked by the RPA. In particular, those who predominantly have permanent pasture will not need to map those details. They will receive an e-mail in April that summarises the land and entitlement information already held on record, together with simple instructions on completing their claim by e-mail. The RPA has identified approximately 39,000 farmers who fall into that category.

Secondly, farm businesses that need to map new features can use blank existing forms to prepare their claims before they are sent a pre-populated form in early April. They can submit their claim by e-mail, by post, or through an RPA drop-in centre, and we have 50 of those now established. Separately, all agents will have received maps of their clients’ land from the RPA by the end of next week. Those dealing with the most complex cases will be offered additional support. The RPA is also exploring the option of giving some agents direct access to the system so that they can make applications quickly.

This is a pragmatic response that applies to the application process in 2015. It means that we will be able to make payments to farmers when the payment window opens in December 2015. All data entered so far on the rural payment scheme system have been saved and will be used by the RPA to complete farmers’ claims this year.

In addition, a number of other EU countries have had difficulties in getting their IT systems in place this year to process this first year of a new, more complicated CAP. In parallel, the Commission has offered an option to member states, allowing them to extend to 15 June the deadline for basic payment scheme applications. That was discussed on 16 March in a Council meeting, which I attended, and it was confirmed by the Commission on 19 March.

In conclusion, the core of the new system works and we are not abandoning anything. We will continue to use it and it will enable claims to be processed efficiently this year and will be the basis for service improvements in future years. However, the action that we announced last week will ensure that farmers can submit their applications successfully this year, and it has been welcomed by stakeholders and those in the industry.

Given the imminence of the general election, I am keen that we communicate with the Opposition on this issue and keep them in touch. I have written to the hon. Member for Garston and Halewood (Maria Eagle) explaining the current situation in detail, and, as she knows, I have offered to meet her, with Mark Grimshaw, to discuss the matter further. Our offices are in discussion about a date for that meeting, which I intend to happen this week. I am also more than happy to keep Opposition Front-Bench Members updated on the changes in the weeks ahead.

Many farmers will be depending on the basic payment scheme to keep their business afloat and on prompt payment to maintain vital cash flow. Given the seriousness of this matter, I am astounded that the Under-Secretary of State has been sent to this House to deal with it. Where is the Secretary of State? As well as refusing to answer questions on BBC’s “Farming Today”, she now appears to be running away from her duties to this House. Let us hope that the Select Committee has better luck getting her to appear tomorrow.

The disastrous late admission from Ministers that the mapping functionality of the Government’s digital by default system for making payments to farmers does not work is a serious blow to hard-working farmers, not least because the Secretary of State said on 11 March, in evidence to the Environment, Food and Rural Affairs Committee:

“The maps are up and running.”

We have all heard rumours for weeks, but the Government have blithely continued, heads in the sand, to insist that everything will work. As recently as 12 March, at the last DEFRA oral questions, the Under-Secretary of State was saying that his only plan was to make the system work; there was no contingency. As a consequence, many farmers who have endured incredible frustration trying to use the system to map the land, or have paid agents to do it for them, now face having to do it all again on paper, and at one of the busiest times of the farming year. How frustrating and wasteful of time and hard-earned money.

Will the Under-Secretary of State please tell the House why Ministers have repeatedly given assurances that the system works which have turned out not to be accurate? Will those farmers who have paid agents to make their claims online be compensated for now having to pay them again to submit the same information? It has previously been insisted that the scheme is too complex for paper. Now we have reverted to paper, so is there an increased risk of errors, which could result in penalties? Will the hon. Gentleman give an assurance that in future farmers will be able to access and use the information they have already submitted, or will they be forced to start again?

On Saturday, Mark Grimshaw, the chief executive of the Rural Payments Agency, referred to the fact that the EU payment window is open until the end of June. He said:

“I am absolutely confident that we will pay within the payment window.”

For farmers expecting their payments in December, that is far from reassuring. It is disastrous. Will the one-month delay in the deadline for applications cause a delay in payments? Mr Grimshaw has said:

“It will be foolhardy of me to commit to anything in December”.

What does the Minister expect farmers to do for cash flow while they wait for their cheques?

When did Ministers first hear that the digital by default system they chose to insist upon would not work? Why did they not implement contingency arrangements sooner, to save farmers the time and expense now wasted? How much money has been wasted? Finally, can the Under-Secretary of State assure the House that Ministers will now remove their heads from the sand, rise above the chaos and confusion their incompetence has caused, and come clean to the House: will the mapping functionality ever work, or will it need to be completely replaced?

I will begin by reminding the Opposition of their own record on the Rural Payments Agency. Let us not forget that in 2005, the system they introduced led to £600 million of disallowance for this country. Payments were regularly more than a year late—hardly any farmers ever received their payments on time. It took a Conservative-led Government coming to power in 2010 to sort it out.

The hon. Lady asks whether everything will have to be resubmitted on paper. As I made clear in my opening statement, for those farmers who have managed to enter their mapping details, the information has been recorded; they will not need to start again. She says that we have always maintained that the new CAP is too complex to be processed on paper alone and needs a computer. That remains the position. As I said in my opening statement, that is why we will still use the core of the system to process the data. We have, for example, coefficients on the areas farmers have of broad beans, leguminous vegetables, hedges and so on. It is complex, and that is why we are not removing a digital approach, but simply having RPA officers enter the information on behalf of the farmer. This is not a paper-only system; it is a paper-assisted system.

The hon. Lady said that Mr Grimshaw, the chief executive of the RPA, had said that he could not give guarantees about the payment window. Having worked with Mr Grimshaw for 18 months, I can say that he is cautious and he never gives guarantees. In all the time I have known him he has never said anything other than that we will make our payments within the payment window. In the past couple of years well over 95% of farmers have been paid on the first day of banking and paid early. I am confident, as I said, that once we have the information in and it has been processed, we will have a system in place that can deal with it.

The hon. Lady mentioned contingency plans. We have adapted our plans and acted to ensure that farmers can get their applications in time this year. That is the responsible thing to do. It would have been wrong to abandon the system and prematurely abandon attempts to sort out the portal, particularly the part that deals with land mapping. We have acted in time to ensure that farmers can get their applications in place, and the steps that we have taken have been welcomed by the farming industry.

I pay tribute to my right hon. Friend the Member for South East Cambridgeshire (Sir James Paice), who carried out fantastic work in turning around the mess that he inherited in the Department and sorting this out. Will my hon. Friend help me with one detail? The mapping that we are talking about is often very detailed—an electric fence here, a bit of undergrowth there. Would it be possible to pay farmers on account as partial payment this year, with the amounts being adjusted in subsequent years’ payments?

Provided an application is received by the deadline, there is provision in the EU regulations for it to be amended for a period of weeks after that. My hon. Friend’s suggestion of a payment on account while an application has not been received would not fit within the EU regulations, but we have made progress in getting that deadline extended to 15 June, and I have asked the RPA to take a sympathetic view towards farmers who are struggling to get their application in and who may want to amend those details after their form has been submitted.

When the Paymaster General boasted to the public services 2030 conference just 20 days ago that under this Administration the words “Government” and “IT” no longer induce visions of failed IT projects, is it safe to assume that he did not know about this situation?

As I pointed out, we have not abandoned anything. The core of the system is working and will still be used. Does my hon. Friend regret the Department saying that there was no need for a contingency plan? Will he reassure the House that there cannot be a digital-only system where farmers do not have access to broadband? What are the Government doing to speed up the situation for farmers living in areas with less than 20% and sometimes less than 40% coverage by broadband to ensure that the core system will work next year, as we were assured by the RPA in the Select Committee that the system had been tried and tested across the European Union? Will he confirm that the extension has been agreed for payments to be entered by 15 June?

I hope that my hon. Friend will understand that our plans have always been adaptable. We have always had the ability to change plans and our priority is to ensure that every farmer can get their application in by the deadline. That is why we announced what we did last week. It is not necessary to announce one’s contingency plans until one is ready to use them. That does not mean that we had not thought about this and that we did not have the ability to keep those plans adaptable.

On my hon. Friend’s wider point about an internet-only or digital-only application, we have 50 digital support centres that will help farmers to do this, and we are setting up help centres in farmers markets and everywhere we can to ensure that they are able to get their application in on time. We have ensured as well that the system can work at relatively low broadband speeds, so I believe we have addressed the issues that she raised, but in the short term farmers can submit their application this year in paper-based form.

Why is it that every time this Government mess things up they send a junior Minister to the Dispatch Box—the Secretary of State is nowhere to be seen—to blame someone else? I happen to be an avid fan of the BBC’s “Farming Today”—almost as avid a fan as I am of Clare Balding’s “Ramblings”, as those who follow me on Twitter will know—and the fact is that had “Farming Today” not exposed the deep concern in the farming community about this mess, we would not have had this urgent question today.

That is simply not true. We made our decision when we realised that a software update the weekend before last had not worked as we had hoped. It had nothing to do with any media coverage; the media have told us nothing that we were not already aware of. The Secretary of State and I work as a team, so I am here today and she will be appearing before the Environment, Food and Rural Affairs Committee tomorrow. We have been working closely together on this and both regularly meet the RPA to discuss these challenges.

I remind my hon. Friend that until the coalition Government sorted out earlier problems at the RPA, I was having to deal with hundreds of cases of farmers in my constituency who were affected and to make representations on their behalf. Has he noted the fact that we will soon be in a six-week election period during which none of us, whether or not we are standing for re-election, will have the status of a Member of Parliament, so he is likely to receive representations during that period from extremely worried farmers?

The right hon. Gentleman will be aware that although we will all cease to be Members of Parliament next Monday, I will remain the farming Minister and the Secretary of State will remain the Secretary of State until a new Government are formed, and I can reassure him that I will be having regular telephone conferences with the RPA and attending meetings to discuss and monitor the situation. We will keep a very close eye on this indeed.

I assume that departmental officials produced a risk assessment for Ministers when the move to this system was proposed, so can the Minister today advise the House on what he thinks are the projected costs to be incurred by DEFRA and the RPA, and indeed by farmers and landholders, as a result of this mess?

The important thing is that farmers can submit their claims on time and that the Government have rightly taken action to enable them to do so. In learning the lessons, will my hon. Friend recall that a decade ago only 15% of farmers were being paid on time by the Rural Payments Agency? Under this Government, that figure is now 98%, so he should take no lessons from the Labour party.

Obviously there are difficulties with payments across the whole United Kingdom of Great Britain and Northern Ireland. Has the Minister had an opportunity to discuss these matters with his counterpart in the Northern Ireland Assembly, for example, and what discussions has he had with the farming unions, which might be able to indicate the best way to ensure that payments are made on time?

On the latter point, all farming unions and representatives and agricultural consultants have welcomed the steps we have taken, because they want to ensure that they can get their applications in on time. I discussed the matter with some colleagues from the devolved Administrations at the European Council last week, and I can confirm that they are all relieved that the Commission has extended the deadline.

Can my hon. Friend reassure farmers in the remote parts of my constituency by confirming that they will get the support they need, whether on paper or through access to online services, to avoid the disaster they faced under the system introduced by the previous Government?

Amid all the arguments, is it not simply vital to recognise that the important thing is that farmers get the money that is due to them when they need it? Echoing the words of my hon. Friend the Member for Thirsk and Malton (Miss McIntosh), there is the consolatory thought that that will allow broadband roll-out to catch up.

As my right hon. Friend knows, this Government have spent over £700 million on rural broadband, and we are still looking at other options to reach the remaining 5% who still need it. He makes a good point. The focus for me this year is to ensure that farmers can get their applications in on time, which is why we have taken action. Unlike the Labour party, which let chaos continue for years, we acted swiftly to ensure that we could deal with the problem as soon as it was identified.

I welcome the extension of the deadline to 15 June. However, bearing in mind that too often deadlines are not met, can the Minister reassure me that our farmers will not be fined if they do not meet the deadline and that, whatever happens, the situation will be resolved before anyone talks about being fined, or of the country being fined, and will the European Union fine us if we do not meet certain deadlines?

As my hon. Friend might know, the deadline of 15 May is written in EU regulations and the Commission has agreed to extend it to 15 June. Under the regulations, farmers are given a period of 21 days during which a late application can be accepted. Until last week it was not clear whether the Commission would agree to an extension, although it had indicated that it might, so our plans were made on the basis that we would be aiming to meet the deadline of 15 May. Having that additional month gives us some more leeway, which is obviously welcome.

Does the Minister agree that the over-complicated CAP system demonstrates that this can affect all member states in a very detrimental way? Is that something that we should be renegotiating as part of our new deal with the European Union?

My hon. Friend makes a good point. We are already in discussions with Commissioner Hogan about the interpretation of existing regulations for next year to ensure that we can get some simplification. In the mid-term review we will be pressing for further simplification of the greening rules. For the new CAP, which will take effect post 2020, we are already looking at radical reform to make it simpler and make more common sense.

I draw the House’s attention to my entry in the Register of Members’ Financial Interests. Farmers understand better than anybody that things can go wrong, but what they cannot tolerate is damage to their business. Can the Minister give me a categorical assurance that if mistakes are made on these forms, the farmers will be corrected, not punished?

I have had that conversation with the RPA. One of my jobs as farming Minister is to sign off some of the appeals that reach the final process, and I can tell my hon. Friend that I am very challenging on those and have asked the RPA to adopt the most sympathetic approach possible. All information that farmers provide on paper will ultimately be entered by digitisers working for the RPA, and they will carry out checks to ensure that the forms they are entering reflect what farmers intended to put on them.

I draw the House’s attention to my entry in the Register of Members’ Financial Interests. I congratulate the Minister on taking decisive action and avoiding the disaster that the previous Government oversaw in 2006-07, when only 15% of farmers were paid on time. I congratulate him on listening to the National Farmers Union, the Country Land and Business Association and other groups that have made representations and on making sure that we find a system that operates and allows farmers to be paid.

I draw the House’s attention to my entry in the Register of Members’ Financial Interests. I, too, congratulate my hon. Friend the Minister. At least farmers now have certainty and know that they can apply and that they will receive their payments, but can he give an utmost assurance that he will do everything he can to ensure that this delay in applications will not result in any delay in payments?

As the Minister knows, all that farmers in my constituency want is to get their application in on time and to get paid on time so that they can get on with running their business. Is he concerned about errors made this year and the ensuing penalties that we have heard about from other Members? Will farmers still be able to use the online system, or just agents, given that not all farmers have the use of agents?

We are giving some of the larger agents, representing just short of 20,000 farmers, access to the online system. We will not be able to give that access to all agents because of the training required and the time scale needed to enable them to use it. All farmers must still register online, and they will be able to download maps. Those who have simple claims will be able to sign a declaration to say that their land use has not changed and is still simple, such as permanent pasture. I take on board my hon. Friend’s point about errors. As I said, I have been pressing the RPA to take the most generous possible interpretation of the EU regulations. The regulations are clear that where an error is not the farmer’s fault, no penalty can be levelled against them.

Before he steps down from the House very shortly, I join colleagues in paying tribute to the work of my neighbour, my right hon. Friend the Member for South East Cambridgeshire (Sir James Paice), not only for his work in clearing up the mess that we inherited with the RPA but his wider work on behalf of farmers.

My hon. Friend mentioned the 15 digital centres that are going to provide assistance. Will he update the House on what additional resource allocation will be put in place to help with the bureaucracy and the difficult conversations that farmers may have with helplines?

Yes. We have started to treat these digital centres as drop-in centres so that farmers can drop in on them without an appointment. During this crucial period, we are redeploying staff from DEFRA to the RPA to ensure that the helpline and the digital support centres are fully manned and have the capacity to cope with anything thrown at them.

I congratulate my hon. Friend the Member for Folkestone and Hythe (Damian Collins) on securing this timely debate. I am grateful for the opportunity to discuss some of these issues because DEFRA has a number of consultations out at the moment, looking at the discard ban and how we implement it for the demersal fleet, as well as at some of the issues that are of direct relevance to the under-10 metre fleet.

Let me begin by saying a little about the common fisheries reform that was agreed at the end of 2013. The UK worked hard to ensure that the reforms were a success. A great deal of credit is due to my predecessor, my hon. Friend the Member for Newbury (Richard Benyon), for doing so much to get what is quite a radical reform. It was said earlier that the European Union was a big problem in this regard. When it comes to the common fisheries policy, I think we have some potentially quite radical reforms, which I shall describe in a minute. I believe that those reforms can help to safeguard the marine environment while giving new flexibilities to our fishermen.

There are three key aspects to the reforms. First, there is a ban on the wasteful practice of discarding fish, or the so-called landing obligation. Secondly, there will be more regional fisheries management, with more power given back to the nation states that actually have an interest in those waters. In future, much more of the plans we have for individual waters will be agreed multilaterally by member states before being put to the European Union for final agreement. The third and final key component is a legally binding commitment to fish sustainably—that is, at maximum sustainable yield. Together, those three components make up a radical reform, but I am under no illusion that there will be challenges along the way. As always, the marine environment is very complex. It will not be easy to do some of those things, but by working together with industry, NGOs, scientists and other European member states, we can ensure that the reforms are a success.

Let me turn to the discard ban. It is important to note that we have been trialling an early forerunner of the discard ban for some time. I am proud to say that the UK has been leading the way in Europe in tackling the problem of discarding. For several years now we have trialled so-called catch quota schemes, which manage fisheries in line with what is caught rather than what is landed. Those schemes have shown that we can significantly reduce discards. In the North sea, vessels on our catch quota schemes reduced discards of cod, for instance, to just 0.1%, compared with 41% for vessels that were not part of the scheme. That shows just what we can do by working with industry.

The first stage of the discard ban, covering the pelagic fisheries—predominantly mackerel and herring—entered into force in January this year and has been working well. As with any radical change in policy, we have encountered some issues along the way, but I am pleased to say that we have successfully overcome each of these. The discard ban will progressively cover all remaining fisheries—the so-called demersal fleet—between 2016 and 2019. I am under no illusion that the next stage will be more complex, but that is a reason to get going and develop those plans now, and why on 23 January we launched a public consultation seeking views on various implementation issues. The consultation closes at the end of March.

My officials are currently travelling the length and breadth of the English coast from Newlyn to Whitehaven visiting fishing ports. They are answering any questions or concerns the industry has, but they are also tapping into the detailed local knowledge of our fishermen. It is essential that we do that. Fishermen often complain to me that they are not listened to. They sometimes feel that science is done to them rather than with them, but we know from experience that policy works well when scientists and fishermen work together to identify solutions.

My officials have not yet visited Folkestone and Hythe, but I have said to them that we should visit the area as part of the roadshow. If my hon. Friend thinks that will be useful for his fishermen, I am happy for my officials to go down there.

If I were to write to the Minister tomorrow, would he give a date before Parliament is dissolved on 30 March when his officials can come down that we can offer to the fishermen?

I am more than happy to do that. My officials are in the officials’ box listening. I can assure my hon. Friend of that offer. They wanted to hold one of those meetings in Kent; Folkestone and Hythe would be a perfect place for it.

Exemptions and flexibilities will help to make the discard ban work. To ensure that it works in practice as well as in theory, during the deal we negotiated increased flexibility in how we manage quota. Those problems were considered during the reform. There are a number of key flexibilities. First and perhaps most importantly, there is inter-species flexibility. If fishermen put their nets out in a mixed fishery and catch more haddock than they expected but do not have the quota for it, they might be able to count that haddock against whiting or cod. That inter-species flexibility is essential to making sense of a quota regime.

Secondly, fishermen will be able to bank or borrow up to 10% of their quota from one year to the next, which gives them more flexibility in matching catches to quota. Thirdly, to pick up on a point made by my hon. Friend, there is a survivability exemption. Fishermen will be able to return some catches to the sea if they have been scientifically proven to have a high rate of survival. Returning those fish to the sea allows them to grow and spawn, fortifying the stock for the future. As he pointed out, landing under-sized, juvenile plaice for which there is little market makes no sense if, by returning them and they survive, they can continue to grow.

Last year, we commissioned a large-scale research project to assess the survivability of plaice in different fisheries around the coast. The industry has identified plaice as a key species that has a high rate of survival. Once we have marshalled and considered that evidence, we will argue for exemptions on the basis of survivability for plaice and probably for a number of flat-fish species. It is important to recognise that we have access to other exemptions. That can include reasons such as disproportionate cost, or that it is not possible to further increase selectivity and reduce unwanted catches—that is the so-called de minimis exemption.

Finally, another point to bear in mind is that when implementing the discard ban, we will start with the species that define the fishery. It will not be a discard ban on every quota species from the beginning. We will start with those that define the fishery in 2016 and aim for it to cover all quota species by 2019. For instance, in the North sea, hake is sometimes referred to as a choke species. Fishermen find it difficult to avoid as a by-catch, but it would be possible to get to a discard ban on hake in later years, closer to 2019.

There are specific issues for the inshore fleet. I greatly value our inshore fishing communities and understand the specific problems they face. My hon. Friend used a figure that is often quoted to me—he said that they have access to only around 4% of quota. It is not quite as simple as that: the less mobile nature of the inshore fleet means that it is unable to access about 60% of the UK quota because it is in offshore waters—for instance, some of the mackerel fisheries well offshore are outside the range of the inshore under-10 metre fleet.

Within their inshore area of operation, however, by value the under-10 metre fleet land about a third of all quota stocks. At December Council I fought hard to secure roll-overs and quota increases for stocks around the UK, including some of those stocks that are important for the inshore fleet. Where there were cuts, which my hon. Friend has mentioned, we made an argument and brought fresh science to the table in order to reduce them. For instance, we managed to get a 10% increase in North sea skates and rays for Folkestone and Hythe and a roll-over for other areas in the UK, as opposed to a proposed 20% cut. I also agreed an extra 300 tonnes of whiting for the under-10 metre fleet in the north-east of England to allow it to land and sell its by-catch.

I recognise that many under-10 metre fleet fishermen will still feel that the current allocation means that they do not get a fair share, and they have a fair point. The reference period for when current allocations were decided was around the mid-’90s. By all accounts, some of the data for the under-10 metre fleet at that time were quite patchy and one result of that may be unfair allocation. That is why, since 2012, we have given the under-10 metre fleet access to additional quota to try to support it, and we continue to work with the industry on the quota realignment from unused quota on the larger vessels and producer organisations to the under-10 metre fleet. We are currently working to make that permanent and we are working through a number of appeals that some producer organisations have made to our approach. It is our intention to put that on a permanent footing.

The total increase in quota will vary from species to species, because it often depends on what is unutilised by the under 10-metre fleet. For instance, there could be significant increases in flatfish species that are particularly important to the under 10-metre fleet. Across the board, we estimate that the increase in quota could be about 12% for the under-10 metre fleet.

I also recognise that the under-10 metre fleet faces particular issues when implementing the discard ban, and we are looking at options to try to address them. As part of our consultation, we are seeking views on possible exemptions and changes to quota management for that part of the fleet, including options to make best use of any quota uplift. One option we have suggested in the consultation is to ring-fence 25% of the total national uplift in quota for the inshore fleet. That could give a significant increase in quota for the under-10 metre fleet.

I am also aware that the issue of latent capacity in the inshore fleet causes concern. We are currently consulting on options to make sure that inactive vessels are not able to re-enter the fisheries. That would provide certainty and security for those vessels operating in the under-10 meter pool. However, having discussed the issue at a number of fishing ports, I am aware that there are mixed feelings about that in the fishing industry. Obviously, I shall wait to see the full responses to the consultation.

I want to say a little about the new European maritime and fisheries fund, which will open shortly. The UK will receive some £200 million from the fund, which will help us to meet the challenges of implementing CFP reform. For instance, the lion’s share will go on selective net gear, helping fishermen to get the equipment they need to fish more selectively. It will also be used to help foster growth in the sector. Fishermen will be able to use the funding to help them adapt to the discard ban by purchasing more selective gear.

Across Europe, we have made real progress towards more sustainable fishing and stock recovery. In 2014, 27 stocks in the north-east Atlantic, North sea and Baltic were managed at maximum sustainable yield, up from just five species in 2009. At December Fisheries Council, I was pleased to secure a continued increase in the number of sustainable stocks this year and we expect to have 30 or more species that are fished sustainably. We are moving in the right direction with sustainable fisheries.

In my time as Fisheries Minister, I have visited many different ports across the UK and have always been impressed by the enthusiasm, determination and resourcefulness of the fishing industry. The marine environment, as I said at the beginning, is very complex.

As this is probably the last fishing debate we shall have in this Parliament, I thank the Minister for all the hard work he has done for all the fishing sectors across the whole of the UK, particularly in Northern Ireland. I know that he has a good relationship with the Minister for Agriculture and Rural Development, Michelle O’Neill. They have been an example of how to work together, in particular for the betterment of the fishing industry.
