The Prime Minister has been clear about the importance of family in ensuring children can thrive and this Government are determined to put families at the heart of society. I am therefore pleased to update the House on our progress to reform children’s social care to ensure that children and families get the support they need at the right time.

Earlier this year we set out bold and ambitious plans to reform children’s social care through “Stable Homes. Built on Love”. Our strategy, backed by £200 million investment, responded to reviews that provided a vision of how to do things differently—including the independent review of children’s social care and the national review into the murders of Arthur Labinjo-Hughes and Star Hobson. These reviews were clear that we must reform services to improve the outcomes of children and families. Our strategy set a vision for a transformed children’s social care system that makes sure families get the help they need, when they need it.

We have moved a step closer to realising this vision, and honour commitments to publish:

The first ever national kinship strategy, “Championing Kinship Care” which sets out support for family networks providing loving and stable homes to children.

A new children’s social care national framework which sets out the purpose, principles and outcomes that should be achieved in children’s social care.

Updated statutory guidance, “Working Together”, which sets out how to safeguard and promote the welfare of children.

•A data strategy which sets out the long-term plan for transforming data in children’s social care.

Through this statement I update the House on each publication, copies of which have been laid in the Libraries of both Houses. I am also informing Members that we will also increase our budget to deliver fostering reforms by up to £8.5 million, taking the total investment to £36 million. This is the largest ever investment in fostering in England and will support us to roll out recruitment and retention programmes to over 60% of all local authorities in England.

We want children who cannot live with their parents to be supported to live with people who are known to them and love them. Kinship carers need our support and backing to offer this care and love so that they can in turn help us achieve our aim of keeping more families together. Our kinship strategy, “Championing Kinship Care”, sets out the practical and financial support we will provide to kinship families, and is backed by £20 million investment. It details how we will provide further support for kinship carers, including launching a financial allowance pathfinder which will provide more financial stability for children growing up in kinship care and sets out our plans to champion the outcomes of children in kinship care in schools. Prioritising kinship care requires us all to champion, support and empower kinship families.

We must also deliver excellent standards of practice to improve outcomes for children, raise aspirations and ensure partnership working across all agencies, including police, health and education. We have published the children’s social care national framework as statutory guidance. It brings together the purpose, principles, enablers, and outcomes that children’s social care should achieve so children, young people and families can thrive. We want all local authorities to consider how their local offer of support makes a real difference to the lives of children, young people and their families.

Our plans for reform have always recognised the central importance of children’s welfare. Children must be kept safe, and this means we must take swift and decisive action to protect them when they are not. Our multi-agency statutory guidance, “Working Together to Safeguard Children”, has been updated and replaces a version from 2018. We want all parts of the system to embed new child protection standards for practitioners, and to use and deploy a multi-disciplinary workforce to provide co-ordinated help, support and protection.

Lastly, the data we collect about children and families and the information recorded about their lives and interactions with children’s social care is sensitive and personal. This data is held in many places, which makes bringing it together challenging. Our digital and data strategy sets out the foundations needed to embark on ambitious transformation, and the actions we will take between 2023-2025. We will also publish a children’s social care dashboard next year to understand progress towards the outcomes in the national framework.

The reviews from last year called for an urgent, fundamental and system-wide transformation of children’s social care. Today we reaffirm our commitment to reform. Transforming how we operate depends on the support and commitment of local Government leadership, leaders across children’s social care, safeguarding partners, relevant agencies and all practitioners. That is why we have also published a reform statement for local authorities and partners in the system.

Today is a time to reflect on the thousands of people who have shared their views since we embarked on reform, including children and families, kinship carers, social workers, dedicated professionals and practitioners and charities. I give my personal thanks to every individual in helping us reach this milestone in our reform journey.

The Government announced earlier this year transformative reforms to childcare to benefit children, parents and the economy. By 2027-28, we expect to spend in excess of £8 billion every year on free childcare hours and early education, representing the single largest investment in childcare in England ever.

Last week the Department for Business and Trade published its response to its consultation on flexible working, making clear that this Government are committed to changes to legislation that will enable more flexible working. Together with our expansion of childcare, that will ensure parents have more choice over how, when and where they work.

Welcome back, Mr Speaker.

The Early Education and Childcare Coalition has found that 57% of nursery staff and 38% of childminders are considering leaving the early years sector in the next 12 months, and Stroud businesses say the same thing. That absolutely cannot happen. They are a skilled and amazing workforce, whom parents trust with the most precious things, and the Government have backed the industry as integral to the growth strategy. What evidence does my hon. Friend have that the UK is retaining nursery staff and childminders, and what can we be doing to ensure the new system is successful?

I thank my hon. Friend for her work championing the early years workforce and join her in the tributes she pays to them. The total number of paid early years staff has remained stable in recent years, and between 2021 and 2022 the number of staff increased by 2%, or 5,900 people. We will publish updated statistics in the coming weeks.

Is it not a fact that after 13 years of the Conservatives in government, our country is in a situation where preschool and out-of-school care is the most expensive in Europe and beyond? We have so many talented people—especially women, but men as well—who are not coming back to use their high skills to recharge the economy, because they cannot afford childcare. What is the Minister going to do about it?

What we are doing is making the single largest investment ever made in childcare. That is going to save the average family up to £6,500 per year on the cost of childcare, in contrast to the hon. Gentleman’s party, which has no policy for this area whatsoever.

In October, the Government announced the allocation of £289 million of start-up funding to local authorities for wraparound care, which we know supports parents to work, as well as having the potential to improve attainment, engagement and attendance.

I recently visited Muschamp Primary School in Carshalton and Wallington, where I observed the Junior Adventures Group UK—a leading provider of school-age childcare in my constituency—in the crucial support that it gives children, particularly those with special educational needs, beyond school hours. However, it is evident that school-age childcare needs reform. I welcome that £289 million, but can my hon. Friend explain how the frameworks will ensure that that investment effectively supports families, specifically those with requirements for special educational needs and disabilities?

My hon. Friend makes an important point. We have set out clear expectations that all wraparound provision should be inclusive and accessible. We have given local authorities flexibility in how to spend their funding, but we expect them to distribute it in a way that ensures equal access to provision for parents of children with special educational needs.

In our improvement plan, we set out plans to deliver consistent early support through our new national standards, backed by a 60% increase in high-needs funding and in programmes such as our £13 million investment in the Partnerships for Inclusion of Neurodiversity in Schools programme, which supports the needs of neurodiverse children.

More than half of children with an education, health and care plan are now experiencing a delay, and even after receiving an EHCP, my constituent’s child was held back a year and had to wait another year before finding a space in a special school. Over 1.5 million children in the UK have special educational needs, so can the Minister tell me what he is doing to ensure that parents and children such as my constituents get the support they need quickly?

We are investing £2.6 billion to transform the special educational needs and alternative provision system. That has included a 36% increase in funding to Birmingham, where the timeliness of EHCPs has been getting better each year between 2020 and 2022.

Beyond the traditional methods of support for SEND, the Minister will know that councils give specialist provisions, and we have heard a lot today about some of those longer-term provisions, for children in particular, and the time involved. What assessment does the Department make when looking at the distance that some of these children need to travel to get this specialist support, particularly when it is out of county—for example, Shropshire into Staffordshire? It may not seem a long distance, but on some of those meandering, serpentine roads it can take a very long time to travel 20 miles.

My right hon. Friend makes an important point. Out of county placements are not ideal for the child and their family or for the cost to the local authority, which is why we have 78 new special schools in fruition. We are also committed to seeing the children whose needs can be met in a mainstream school being supported at an early enough stage with their special educational needs.

I wondered what was happening there, Mr Speaker.

As part of our £2.6 billion investment to reform the SEND and AP system, we have announced 41 new special free schools, with a further 37 in the pipeline. We have also set out plans for new national standards to make clear the support that should be available in mainstream settings for children with special educational needs.

Can I take this opportunity quickly to thank the Secretary of State, her junior Ministers and officials for all the help for the schools affected by RAAC—reinforced autoclaved aerated concrete—in my constituency?

Turning to SEN, demand in Essex far outstrips supply. The Secretary of State will know that just prior to the summer recess, I launched a campaign for a new SEN school in south Essex. I am delighted to tell her that we have a trust that is seriously interested, we may have a site and we may even have some money. On that basis, could I meet her or one of her junior Ministers—early in the new year, please—to update her on where we have got to and to ask for help to make this dream a reality?

I congratulate my right hon. Friend on his campaign, with which we are very familiar in the Department; we would be delighted to meet him. Where local authorities do feel there is a need, they can open a new special school through the free school presumption route, which I would be happy to discuss with him further.

The Minister mentioned the £2.6 billion that the Government have invested, but this is not filtering down. That is the key issue for parents accessing SEN provision, and so many parents are raising it at my surgery. One concerned mother told me:

“Parents and children are being put under intolerable stress and anxiety with a system which is inefficient and creating a significant mental health burden”.

The Minister mentioned the national standards. Will the standards include the fact that SEN children and children with autism are being arrested and their mental health is not being treated properly because schools simply do not have enough training and support? Will the Minister please address that?

I thank the hon. Lady. We are keen that schools are as inclusive as they say they will be when it comes to children with special educational needs. We have nine change programme partnerships to try to make sure that the system works a lot better. The money is given to local authorities, and we should already be seeing an improvement, but I would be happy to discuss it further with her.

T2. I heard from a school in my constituency last week that, even though it has six school counsellors, there is a long waiting list for children with mental health concerns to see a counsellor. What steps is my hon. Friend taking to ensure that schools are adequately resourced to best support pupils in that regard?

I thank my hon. Friend for raising this important issue. We know that school-based provision works best when all staff are clear about how to support mental health, which is why we are providing senior mental health lead training grants to all state schools, 14,400 of which have claimed a grant so far. We are also working with the Department of Health and Social Care to extend mental health support teams to cover at least 50% of pupils by spring 2025.

It is a pleasure to serve under your chairmanship, Mr Sharma. I congratulate the hon. Member for St Albans (Daisy Cooper) on securing a debate on such an important subject. Improving the special educational needs and disabilities system across the country is a priority for this Government, and that includes improving services for children and young people with SEND in Hertfordshire.

The Government’s ambition for children and young people with SEND is for them to thrive, fulfil their potential, and lead happy, healthy and productive adult lives. That means making sure that they have access to the right support in the right place at the right time, and intervening when a local authority is not providing that. I was therefore very disappointed to learn that Ofsted inspectors have significant concerns about the experiences and outcomes for children with SEND in Hertfordshire. The issues raised in the report are serious. I need to be confident that the local area partnership is taking the right actions to secure rapid and sustainable improvement.

DFE officials, along with NHS England advisers, are due to meet local leaders next week to scrutinise and challenge their improvement plan in response to the inspection. They will seek assurances about the actions that leaders are taking to improve SEND provision rapidly. The local authority has already appointed Dame Christine Lenehan, as the hon. Member noted. She was director at the Council for Disabled Children and will be the new independent chair of the partnership’s multi-agency improvement board. She is one of the country’s most highly respected and experienced SEND experts. I have every confidence that she will push the local authority to take the actions that it should take and move it in the right direction.

The Department for Education has also appointed a specialist professional SEND adviser to provide additional advice and support to the local SEND leaders and to the Department until such time as the Secretary of State is satisfied that that is no longer required. It is essential that rapid action is taken to improve SEND services in Hertfordshire and that the local area partnership accepts collective responsibility and accountability for delivering the agreed actions. That will require a relentless focus on improvement across all service providers so that children, young people and families can access the support that they need.

Let me turn to the hon. Lady’s questions about funding. Funding for mainstream schools and high needs funding for children and young people with complex needs will be more than £1.8 billion higher next year than this financial year. Total schools funding will be £59.6 billion—its highest ever level in real terms per pupil. Within that total, high needs funding will be over £10.5 billion in 2024-25—an increase of more than 60% on the 2019-20 allocations. That will help local authorities and schools with the increasing costs of supporting children and young people with SEND.

We recently announced provisional 2024-25 high needs allocations for local authorities, and Hertfordshire’s allocation is £187 million, which is £8.4 million more than the council will receive this year—a cumulative increase of 29% per head over the three years since 2021-22.

The Minister talks about the allocation that will be given to Hertfordshire County Council. Will he confirm that he will instruct his officials to speak directly to HCC about what should have been included in the 2017 baseline, so that we make sure that the money that we are going to receive is a fair reflection of what we should get?

If officials have not had that conversation already, I am happy for them to discuss that point with the council. This is the first time that I have heard that point from the hon. Lady today. I am well aware that she and other right hon. and hon. Members representing Hertfordshire have had discussions and correspondence with my predecessors at the Department about the way that the high needs funding formula works for Hertfordshire and other counties, and particularly the different levels of per-head funding that the council receives compared with neighbours. As she might know, officials from the Department met Hertfordshire County Council officers yesterday to discuss the local authority’s concerns, in addition to the meeting that she had with officials last week.

As the hon. Lady suggested, the situation is partly due to the historical spend factor in the formula that was in place when we came to power in 2010 and which used to be used as a proxy for supply and demand. We have been reducing the weight of that factor over time, but because of how much it made up the formula that we inherited, it is not something that can be changed immediately. That is why, as she suggested, the increases for Hertfordshire are higher than for others as we try to close the gap.

I accept that the increase cannot happen “immediately”, to use the Minister’s word, but does he agree that 15 years is too long? And if it is, and if immediately is not possible, is there a midway point? Might he look at how Hertfordshire can catch up with Buckinghamshire’s funding, for example, in a few years? Even knowing that that can happen over two or three years, or a maximum of four years, would bring huge relief to our services. Although I might accept him saying that it cannot happen immediately, I cannot accept him saying that it still has to happen over 15 years.

I can say to the hon. Lady only that we review the formula every single year. This is not the only factor that is within the formula. I believe that the gap is closing as a result of what we have been doing. As part of our annual process, we will look at every authority to see what is happening.

To turn to the hon. Lady’s questions about special school places, we know that demand for specialist provision in Hertfordshire currently exceeds the number of available places. We have published more than £1.5 billion of high needs provision capital allocations for the 2022-23 and 2023-24 financial years as part of our transformational £2.6 billion investment into high needs provision between 2022 and 2025. That includes almost £27 million for Hertfordshire. Local authorities can use the funding to deliver new places in mainstream and special schools, as well as other specialist settings, and to improve the suitability and accessibility of existing buildings.

Local authorities can also commission new schools through the free school presumption route. Hertfordshire held a successful free school presumption competition in autumn ’22 to identify an academy sponsor to open a 60-place primary school in Potters Bar. The new school is planned to open by September 2025. In addition, a 60-place secondary special free school, the James Marks Academy, was opened in September this year.

Hertfordshire has a county-wide capital programme to deliver the key priorities of the county’s SEND special school place planning strategy. I understand that the local authority intends to extend the current SEND sufficiency strategy by one year into 2025 to provide additional specialist provision places and resource provisions for children with communication needs in mainstream schools, ensuring that children can attend the provision stated on their EHCP and that their needs are met in the most appropriate local provision.

As well as expanding special resource provision in mainstream schools across the county, a priority from Hertfordshire County Council’s strategy is to open more permanent places for pupils with severe learning difficulties, physical and neurological impairment, and social, emotional and communication development need.

Positive actions have been taken. For example, the county is establishing a number of new specialist resource provisions in mainstream schools for children with communication needs. Four secondary provisions with 20 places each are being developed. One is already open and the other three will open in the next academic year. Those will be followed by nine primary provisions with 12 places each across the next two academic years.

I thank the hon. Lady again for bringing this matter forward and for raising the issues that she is seeing with Hertfordshire’s SEND provision. We all care passionately about the outcomes there, along with SEND outcomes across the country, and that is why this Government are determined to transform the system with our reform plan.

I thank the hon. Member for Strangford (Jim Shannon) for securing this debate. It is typical of him to bring to Parliament incredibly important issues that do not get the attention they should. He does so consistently in Westminster Hall and the main Chamber, and we all admire and appreciate that.

I start by offering my deepest condolences to the family of Benedict Blythe, who died two years ago tomorrow. No parent should experience what Helen has gone through. I was deeply saddened to learn of the story before I came here and to hear more detail today; the colourful picture that my hon. Friend the Member for Rutland and Melton (Alicia Kearns) painted of what Benedict was like moved us all. My heart goes out to any family experiencing that sort of loss. I just wanted to say that at the outset to Helen and her husband. As she knows, the coroner’s inquest into Benedict’s death is ongoing, so I am unable to comment on the details of his case, but officials from the Department met her in May to hear about the excellent work she has been doing through the Benedict Blythe Foundation to raise awareness of how best to protect children.

I can, of course, address the more general points that hon. Members made about allergies and our policies. I understand how worrying allergies can be for parents. As my hon. Friend the Member for Rutland and Melton said in her moving speech, when parents send their children to school, it is only right and natural that they expect them to be kept safe. If their child has an allergy, that adds a particular level of concern about what is happening in the school day.

Allergies are complex conditions that can range enormously in severity. Not all allergens are foods either, as hon. Members know, which makes it more complicated to manage them. I welcome the schools allergy code that the foundation launched this week, which will provide helpful guidance to schools on how to implement allergies policies; we would be keen to encourage schools to look at that code.

I know that the Minister cannot commit to anything at this moment, but I would very much appreciate it if I could pick up that point about the code with him, maybe in a few weeks’ time; we could see whether that resource could be put on the Department for Education’s website or look at the best way to ensure that all schools around the country are aware of it, not just through the foundation but through the Department. That would be a meaningful way to spread that code across the country. I know that he cannot commit to that now, but would he be happy to pick that up with me in a few weeks?

Turning to the statutory duties on schools, hon. Members have called for voluntary guidance to be replaced with a funded mandatory requirement. We have heard from each Member who has spoken in this debate about the four things that they would like to see: an allergy policy in place; the co-creation of an individual healthcare plan with all pupils with allergies and anaphylaxis; spare adrenaline auto-injector pens in schools; and the training of school staff and teachers in allergy awareness and allergy first aid.

Let me start with the first of those points. Section 100 of the Children and Families Act 2014 places a legal duty on schools to make arrangements to support pupils at their school with medical conditions. The accompanying statutory guidance from 2015—“Supporting pupils at school with medical conditions”—is not voluntary; governing bodies must have regard to that guidance when carrying out their section 100 duty. The guidance makes it clear that schools should ensure that they are aware of any pupils with medical conditions and have policies and processes in place to ensure that those conditions, including allergies, can be well managed. The guidance is clear that policy should also include how the processes will be implemented, what should happen in an emergency situation and the role of individual healthcare plans in supporting pupils. It says that

“The school, healthcare professional and parent should agree, based on evidence, when a healthcare plan would be inappropriate or disproportionate”

and that the policy should also set out

“how staff will be supported in carrying out their role to support pupils”

including

“how training needs are assessed, and how…training will be commissioned and provided.”

It states that

“any member of school staff providing support to a pupil with medical needs should have received suitable training.”

Members also raised the important issue of adrenaline auto-injectors. The regulations already allow schools to obtain and hold injectors and, in an emergency, they can be administered to pupils the school knows have a risk of anaphylaxis but whose own devices are not available or not working, perhaps because they are broken or out of date. To support schools to meet the needs of pupils with allergies, the Department of Health and Social Care has produced guidance on the use of adrenaline auto-injectors and emergency inhalers in schools, including the purchase of spare adrenaline auto-injectors.

We have a little more time. On that point, would the Minister accept that there is a real problem that, while the auto-injectors are stored in schools, not many staff go through any form of training on how to use them? We have to be honest, in this day and age when we see Americanism being imported to our country, teachers are scared that they will end up in law courts. The Department has a responsibility to support staff so that they are confident enough to provide that life-saving aid. Does the Minister agree, therefore, that there should be funding or a process in place? Does he agree that training should be provided in some way, even if it is just a YouTube video that every single teacher must watch, so that teachers have the confidence to administer auto-injectors? That is a concern that we hear repeatedly, and there is currently no provision.

Staff should have training in it—that is absolutely right. That is part of what we are requiring. We continually review the policies in this area, and if we feel that there are deficiencies, or indeed inconsistencies, which I suspect is the biggest problem, we will do whatever we can to ensure that they no longer occur.

I wonder if I am following you correctly—you will confirm whether that is true or not. We have asked for this provision to be not just voluntary, but mandatory. In other words, we are seeking for it to be put down in legislation—given the cost factor is so small—to make it happen and change lives. I suppose the core question that we are asking, Minister, with great respect, is whether you can confirm that that is something you are prepared to look at. It is really important.

We have a difference of opinion about the requirement on schools. The Department’s view is that what is set out in the statutory guidance should require schools to do most of what is being described, and the question then is whether that is happening in every place or not. If what we expect to be happening under the Children and Families Act and so on is not happening, then we definitely want to ensure that it does happen.

Yes. The question with these things is always whether the laws are already there. Do you need new laws, or are the laws already there but not being enforced? I have heard from Members today that we are clearly not seeing in every case the practice that we want to see. If the point is around the Department believing that this is being done rightly, does the Minister know whether Ofsted, when it reviews schools, takes into account whether or not the allergy guidance and section 100 is being upheld adequately? I am aware that this falls between two briefs; it is not just the Minister’s brief. If that is not the case, could he write to me? That may actually be the solution: we say that when Ofsted inspects schools, because the loss of life is so high—66 children—this should be part of its reviews. That way, it can say it is meeting its requirements and commitments to children—to keep them safe and ensure it is doing everything to look after them in every single way it can, as we would all wish it to be doing. That may be the solution that fixes this gap that, between us, we seem to be coming to.

I will write to my hon. Friend to clarify that particular point. Ofsted has a role in inspecting safeguarding, which incorporates a wide range of vulnerabilities that children may have. I do not know the answer to her specific question about section 100, so I will write to her on that afterwards.

I have no idea where I was in my speech at this point, so I will turn back to the code. On the points in the code on taking a whole-school approach and having clear governance and risk management, the statutory guidance makes it clear that all state-funded schools should have a policy for supporting children with medical conditions. This should be reviewed regularly and be accessible to parents and school staff.

The hon. Member for Washington and Sunderland West (Mrs Hodgson) talked about school catering policies. Schools are expected to make reasonable efforts to cater for pupils with particular requirements—for example, as she touched on, to reflect medical, dietary and cultural needs.

In deciding what is reasonable, schools and their caterers are expected to take into account factors such as the type of diet required by the child with allergies, the number of children in a similar position and the cost of making suitable food available. In exceptional circumstances it may be considered reasonable for the school not to make special provision for particular children—for example, where this would be very difficult and costly to achieve.

Turning specifically to younger children, the early years foundation stage framework sets the standards that all registered early years providers must meet for the learning, development and care of children from birth to age five. It states:

“Before a child is admitted to the setting the provider must also obtain information about any special dietary requirements, preferences and food allergies that the child has, and any special health requirements.”

Providers must have

“a policy, and procedures, for administering medicines”

and

“systems for obtaining information about a child’s needs for medicines, and for keeping this information up-to-date. Training must be provided for staff where the administration of medicine requires medical or technical knowledge.”

Within all early years settings there is a requirement for at least one person who has a current paediatric first aid certificate to be on the premises and available at all times when children are present, and who must accompany all children on outings. The PFA criteria is clear that the training should include being able to

“help a baby or child who is suffering from anaphylactic shock.”

In September, we changed the adequate supervision requirement within EYFS to be explicit that adequate supervision while children are eating means that children must always be within “sight and hearing” of an adult; not within sight or hearing, as was the case previously. This will help practitioners to be able to notice the signs of an allergic reaction as soon as they present themselves, and allow them to act quickly. The new early years educator level 3 qualification will come into force next September. That will ensure that early years practitioners have an understanding of allergies and anaphylaxis.

I will have to write to the shadow spokesperson, the hon. Member for Newcastle upon Tyne North (Catherine McKinnell), about the expert advisory group on allergy—this is the first time I have heard of that. Likewise, I will write to her about monitoring the effectiveness of the allergens policy. I think her question on research into life-saving treatments is probably better directed to the Department of Health and Social Care, but I will obtain for her the information about what that Department is doing in that regard.

Having outlined the various legislation and guidance that covers allergies in schools, the Government’s overall position, given the complexity and individual nature of allergies—which was set out very clearly by the hon. Member for Dagenham and Rainham (Jon Cruddas), who chairs the APPG—is that the legislation we have in place is proportionate, and allows schools to respond to individual circumstances and the specific needs of their pupils, but, as I said earlier, we keep these policies under review. We welcome feedback on how we can better support schools’ implementation and awareness of these polices, particularly to try to remedy any inconsistencies between what we require from them and what is happening.

The bold and transformative reforms to childcare that this Government announced at the spring Budget, including the single biggest investment in childcare in England ever made, will help to give children the best start in life and is a core element to our long-term strategy to grow the economy and get people back into work.

By 2027-28, we expect the amount of money we are investing in childcare to have doubled from £4 billion to £8 billion each year. It will give working parents 30 free hours of childcare per week from when their children are nine months old until they start school.

Today’s announcements are a vital next step to deliver our new entitlements for parents, providers, local authorities, and the early years sector in preparation for the first phase of delivery in April 2024.

They include details of when and how eligible working parents of two-year-olds can apply to receive the first 15 hours free childcare for two-year-olds and the significant increases to sector funding to support the successful delivery of the upcoming entitlements.

Early years funding

We have published the new local authority rates funding for 2024-25 alongside the Government’s response to the recent consultation on early years funding.

In 2024-25, we are providing over £400 million additional funding to deliver a significant uplift to the hourly rate paid to local authorities for the entitlements. This includes £67 million of new funding to reflect the 9.8% increase in the national living wage from April 2024, £57 million in recognition of teacher pay and pension costs in 2024, and the £288 million additional funding for 2024-25 announced at spring Budget in March 2023.

The final local hourly funding rates for 2024-25 include an average 4.7% increase for the current three and four-year-old entitlement, from £5.62 in 2023-24 to £5.88 in 2024-25. Average funding rates for two-year-olds will be £8.28 per hour, and rates for under-twos will be £11.22 per hour.

As set out in the Government response to our consultation, there was broad agreement with our proposals relating to funding the entitlements for two-year-olds and under-twos, and we will implement the majority of the proposals included in the consultation. This includes a new national funding formula to distribute entitlement funding for two-year-olds and under-twos, extending the majority of the existing local funding rules to the new entitlements, and extending eligibility for the disability access fund and the early years pupil premium to younger age groups. These proposals will ensure that funding for the early years entitlements are distributed fairly and efficiently, and support delivery of the entitlements across the country. Childcare entitlement codes

From 2 January, eligible working parents will be able to apply for their 15 hours childcare for their two-year-olds. Parents have until 31 March to apply for a code.

To apply for a childcare code, each parent needs to be working and earning the equivalent of 16 hours a week at national minimum/living wage. This means that each parent needs to earn from just over £9,500 per year to be eligible for 15 hours a week of childcare during term time. Parents must also each earn under £100,000 adjusted net income per year to remain eligible for the entitlement.

More information on the range of childcare support available to parents can be found on the Childcare Choices website, where parents can explore the early education entitlements and other Government help with childcare costs.

Capital funding allocations

We will publish this week the allocations of the £100 million of capital funding for the 2023-24 financial year to support local authorities in delivering the expansion of the 30 hours early years entitlements and our commitment that all parents will be able to access wraparound care from 8 am to 6 pm by 2026.

Local authorities are responsible for mapping supply and demand in their areas to ensure there are sufficient places available locally. They will be expected to work their local private, voluntary and independent providers and schools to introduce or expand childcare provision in their area where there are gaps in provision.

The funding is anticipated to help deliver thousands of new places across the country.

Full details of the allocations, including guidance for local authorities and childcare providers, will be published on gov.uk this week.

Childminder grants

The childminder start-up grant scheme is open for applications from Thursday 30 November. The scheme supports new childminders by providing them with grant funding, worth up to £7.2 million, helping childminders with the cost of setting up their own businesses.

As previously announced, we are offering £600 to new childminders registering with Ofsted, and £1,200 to new childminders registering with a childminder agency, or CMA. Grants to childminders registering with CMAs will be paid in two instalments, with a six-month limit on claiming the second instalment.

Childminders must apply for the grant within two months of registering as a childminder, or within two months of the scheme launching.

The scheme is available to all new childminders who have completed their registration on or after 15 March 2023. Individuals who have previously been registered as childminders and wish to re-register into the sector may also apply for the scheme, but there must be at least a 12-month gap between the date of their previous registration being cancelled and their new registration being finalised.

The scheme will be facilitated by Ecorys UK Ltd, and new childminders can apply on www.gov.uk.

It is a pleasure to serve under your chairmanship, Mr Vickers, and I am grateful to my hon. Friend the Member for Gosport (Dame Caroline Dinenage) for securing a debate on such an important subject. She has played an instrumental role in mandating learning disability and autism training across the health and care sector, and in rolling out the Oliver McGowan mandatory training. I know that my colleague the Secretary of State for Education, who championed that as a Minister in the Department of Health and Social Care, is an equally strong advocate for the training.

I thank Oliver’s family for their tireless dedication to this issue. They went through what no family should have to go through, and I share their passion for ensuring that dedicated and hardworking professionals have the knowledge, skills and expertise to provide the right support and try to ensure that no family experiences the same. I hope I might get the opportunity to meet Paula in a moment.

My hon. Friend the Member for Gosport predicted some—not all—of my answers to her questions on the picture of learning disability and autism training for education professionals. Teachers in schools focus on SEND at each stage of their training. To be recommended by an accredited provider for qualified teacher status, trainees must demonstrate that they meet the teacher standards at the appropriate level. Both the initial teacher training core content framework and the early career framework outline what trainee and new teachers should learn, including content on adaptive teaching for students with special educational needs.

The universal services programme, which my hon. Friend touched on, provides SEND-specific training for the school and college workforce. So far, 6,600 school and college staff have accessed free online training modules, and 81 schools and 135 colleges have identified and led their own SEND-focused school improvement projects. Since the programme was launched in 2022, over 100,000 education professionals have undertaken autism awareness training through the Autism Education Trust’s “train the trainer” model. My hon. Friend may not know this, but the largest take-up of the programme’s range of online units has been within her own local authority of Hampshire. I assume that is in part due to her advocacy on this issue.

Our SEND and alternative provision practitioner standards, which will focus on supporting frontline practitioners in mainstream settings, will include a practitioner standard on autism. We will publish the first three practitioner standards by the end of 2025. Regarding the Department’s understanding of not only the quantity of training, but the quality, in the summer Ofsted carried out full inspections on all six lead providers of the early career framework that I referred to. All got a positive Ofsted judgment, with four of the six being awarded an “outstanding” judgment. Surveys from the universal services programme have consistently highlighted the positive impact of it, with 2,300 participants surveyed three to six months later finding that 98% had an improved confidence in identifying and meeting needs. Perhaps even more importantly, 93% had reported making changes to their practice as a result of accessing the activities.

I was asked about conversations I have personally had with teachers, parents and some of the excellent charities in this area. I have had a wide range of conversations as a constituency MP, because I visit a school in my own area pretty much every week. The issue of parents in Oxfordshire not getting the support they should for their children with special educational needs has been one of the top two issues I have been written to about in the last 18 months, so I had lots of conversations with parents, teachers and charities before I got to this role. In this role, I have made a number of visits around the country and had lots of meetings with different charities on this issue. The voice of parents has been incredibly important in elevating the status of this issue, more so even than the voice of schools or Government or local authorities. It is parents who very articulately describe what feels like a war of attrition to try to get the support they need for their children. It is a war that any parent would wage but no parent should have to.

On the confidence of professionals to teach neurodivergent children and children with learning disabilities so that their needs are met, our school and college panel survey indicated that just over half of schools agreed that they were able to effectively support pupils with special educational needs. The February 2023 parent, pupil and learner survey found that about 60% of all parents were confident in the school being able to meet their child’s needs.

My hon. Friend touched on the fact that the National Autistic Society and Ambitious about Autism reported that 87% of teachers surveyed felt confident supporting autistic children in the classroom. That is a very high figure, but I accept that, as she said, teachers’ confidence may not always reflect the experiences of children and their families. We are exploring opportunities to build teacher expertise by reviewing the initial teacher training framework and the early career framework, which we will conclude by the end of this year. In early 2024, we intend to publish what more we will do to support trainees and early career teachers to be more confident and have the most up-to-date evidence that should inform their practice.

SENCOs play a vital role in setting the direction of their schools and co-ordinating the support required by children with special educational needs. We want to invest in their training. That is why we have developed the new national professional qualification for SENCOs, which will come into force in autumn next year. We hope that will play a key role in improving outcomes for children with special educational needs in schools. We have also committed to funding 7,000 early years staff to gain an accredited level 3 SENCO qualification because, as we all know, the earlier we can identify need the better. That programme for the early years workforce has been hugely popular with the sector.

Turning to the point made by the hon. Member for Worsley and Eccles South (Barbara Keeley), we are not targeting a 20% reduction in EHCPs or the growth of EHCPs. We have no target of that nature whatever. We want children to get the support they need at an early enough stage and without them needing an EHCP to get that support. I refer the hon. Lady to my letter to the Education Committee for further clarification.

I congratulate my hon. Friend the Member for Darlington (Peter Gibson) on all his work, which includes setting up a forum for the families of those with autism. That is typical of his work as a local champion. Like my right hon. Friend the Member for Skipton and Ripon (Julian Smith), he brought the voice of families to this debate, which is the most important voice when we are discussing these issues.

More broadly, the Department for Education has worked closely with the Department of Health and Social Care to develop a refreshed cross-Government autism strategy, which was published in 2021 and backed by more than £74 million. This year the Department of Health and Social Care has allocated £4.2 million to improve services for autistic children and young people, including assessment services through the autism in schools programme.

There is a lot happening as part of the £2.6 billion special educational needs and AP reform programme. Of course there is more to do. I thank my hon. Friend the Member for Gosport for bringing us this debate and all of those professionals and parents who are working so hard to support children with these conditions. I look forward to working with Members present on how we can ensure that these children get the support they need at an early enough stage.

What steps is the Department taking to help boost SEND services in rural areas such as mine?

By 2024-25, we will have increased high needs funding by 60% since 2019-20, and we have approved the opening of 78 special free schools.

My hon. Friend is right to say that tribunals are costly and stressful, but it is important to say that most education, health and care needs assessments and plans are concluded without a tribunal hearing. We will be introducing new national standards, strengthened mediation and greater system-wide accountability to give families the support they need earlier and reduce the number of tribunals.

I was one of 31 MPs from across the Chamber who signed the f40 letter to my right hon. Friend the Chancellor urging significant investment in SEN. Will my hon. Friend, behind the scenes at least, endorse that campaign and also look at how we can reduce the reliance on education, health and care plans, which are a barrier to so many young people getting the education they need?

It is probably worth saying that I am an f40 MP myself, and I met the group just last week to hear its concerns. On my hon. Friend’s point about EHCPs, through the reform plan we are working to get parents the support they need for their child at an earlier stage so that they do not always need an EHCP to get that support.

There is a crisis in funding for SEND in Walsall South. In Old Church Primary, 78 pupils have special needs, which is 19% of the school total. How can the Minister target the funding to the schools that really need it? Does he agree that when Ofsted inspects, it should take into account children with special needs in schools such as Old Church so that these are mitigating factors?

The right hon. Lady makes an important point about the role of Ofsted and ensuring that it assesses that provision. It is worth saying that there will have been a 36% per-head increase in Walsall between 2021-22 and 2024-25, but I would be happy to meet her to discuss the issue further.

Thanks to Government support, local Conservatives in the London Borough of Bexley have secured an incredible £39.5 million to expand and improve SEND provision in our borough. Does my hon. Friend agree that it is vital that local authorities, charities, schools and families work closely together to maximise the educational impact of this Government-backed funding?

The SEND crisis extends to Devon, and my postbag is full of correspondence from parents trying to get their children the educational provision they need. It has got so bad that in some cases children are being taught in school cupboards, and Devon has appointed a SEND champion to its cabinet. What steps is the Department taking to help boost SEND services in rural areas such as mine?

There has been a 30% increase in the per-head funding to schools in Devon for their special educational needs provision, and the whole thrust of our reform plan is to make the system work better for parents and families and get the support for their children at the stage when they need it.

Will the Minister tell the House when he expects the plans that the Government have announced for SEND to make a difference to the long waiting times and lack of support experienced by so many families across the country?

We are investing over £4.1 billion to expand the current free childcare entitlement offer to eligible working parents of children aged nine to 36 months. We are also increasing the hourly rates for childcare providers for the existing entitlements, and funding rates will be confirmed in the autumn.

The Government’s proposals will lead to thousands more families expecting to access childcare, so we might expect to see more childcare opening. However, in the past year some 600 nurseries have already closed, and in my constituency of Walthamstow there are now three children chasing every childcare place. Why does the Minister think that is the case, what will he do about it, and how will we ensure that in April parents who are not already accessing childcare can do so?

Part of the reason why we are staggering the entitlement is to ensure that we have the staff in place to deliver it. In the next few weeks we will announce changes to the processes for recruiting people. We will launch a big campaign of recruitment in the new year to increase the workforce, and I have every confidence that we will meet the commitment.

Higher needs funding for children and young people with complex needs is increasing by a further £440 million next year, bringing the total higher needs budget to £10.5 billion in 2024-25—60% higher than it was in 2019-20.

I am grateful to the Minister for that response, and I heard the earlier responses, but there is a shortage of places in special needs schools—special schools for children who need those places. Will he carry out a national assessment of the number of places that are available in special schools against the number of places that are needed, because it is resulting in some children having to attend mainstream schools when actually they should be in special schools?

My hon. Friend makes an important point. We have approved the opening of 78 special schools, and this year we collected new data from local authorities on their capacity and demand forecast for special schools. That will help us to support them more effectively to fulfil their duty to provide sufficient places.

T4.   Like all county councils, Staffordshire County Council is struggling with the rising demand for special educational needs and disabilities support in schools, and with lengthy delays in issuing education, health and care plans. That is leaving children and families with a lack of vital support and appropriate education for their needs. What steps are the Government taking to tackle the shortage of educational psychologists and to ensure that children receive the education that they need to achieve good outcomes?

My hon. Friend is absolutely right about the importance of educational psychologists. We are investing £21 million to train 400 more educational psychologists, building on the £10 million already announced to train more than 200 from this term.

The Metropolitan Borough of Bury is getting significant support. In addition to the funding increases, we have appointed a SEND adviser to work with the borough to improve services. The Council for Disabled Children is supporting it to strengthen EHCPs. Two special free schools have been approved, and Bury is also one of 34 areas in our safety valve programme.

In recent weeks, we have seen reported instances of antisemitism rise by 1,300% and Islamophobia by 150%, with Jewish kids afraid to go to school and Muslim kids asked, “Whose side are you on?” What are the Government doing to ensure that children are taught sensitively but robustly about the wrongs of such intolerance, and does Ofsted have a role in ensuring consistency of approach in all schools?

One day after Hamas’s brutal massacre in Israel, a student at the University of Manchester spoke of being full of “pride and joy” at a once-in-a-lifetime experience—not only a disgusting comment but one that points to possible extremism in our university campuses. Far too many think that there are no consequences for spreading such hate in our educational settings, so will my right hon. Friend set out what the real consequences are?

May I first congratulate my hon. Friend the Member for Worcester (Mr Walker), the Chair of the Education Committee? He has helped with the development of our policy in this area, and his Committee produced a good report that we have responded to. I am also grateful to him for relinquishing his time so that I have longer to respond to some of the points made in the debate.

I also congratulate the hon. Member for Selby and Ainsty (Keir Mather) on giving his maiden speech, which I thought he delivered with aplomb. He gave us a lovely portrait of his constituency, which I visited—on the losing side—a number of times earlier in the year. I have no doubt that he will be a strong advocate for his constituents.

May I also take the opportunity to pay tribute to the hard work and dedication of our early years and childcare workforce? Through challenges from the pandemic to the rising costs of living, they have worked tirelessly to provide care that allows children to flourish. Extensive evidence makes it clear—a number of hon. Members touched on this—that high quality early years education has a positive effect on the cognitive, behavioural and social development of children in both the short and long term. Building a strong foundation for every child is at the heart of the Government’s agenda, and it is critical to enabling children to succeed both at school and later in life. That is true for all children, but as hon. Members will know I have a particular interest in disadvantaged children, having run charities for them before I became an MP, and it is especially important to try to ensure that they get the right support in their earliest years, as my hon. Friend the Member for Stroud (Siobhan Baillie) touched on in her excellent speech.

High quality childcare is also fundamental to building a strong economy, allowing parents to enter employment, take on more hours or choose from a wider range of jobs. That is particularly important for mothers, whose employment rates and pay have been and continue to be disproportionately impacted by having children.

The Government have a strong track record of supporting parents with the cost of childcare, supporting disadvantaged children and ensuring that childcare is of high quality. In September 2010, we extended the three and four-year-old entitlement that parents typically take as 15 hours a week for 38 weeks of the year. In 2013, we introduced 15 free hours a week for disadvantaged two-year-olds. In 2017, the three and four-year-old entitlement was doubled to 30 hours a week. Now, recognising that childcare is one of the biggest costs facing working families today, the Government are making the largest single investment in childcare ever.

This investment—an additional £4.1 billion—will double the amount being spent by the Government on childcare so that by September 2025 all eligible working parents will be able to claim 30 hours of free childcare—I will come back to the word “free” in a minute—from when their child is nine months old until they start school. As hon. Members know, that will be rolled out in stages. From April, eligible parents of two-year-olds will be able to access 15 free hours. From September, eligible parents of children aged nine months and upwards will be able to do likewise. The full 30-hour entitlement will come in from September 2025.

We are all going to welcome additional funding within childcare and the expansion of services, but surely we need a very clear workforce plan if we are actually going to deliver all this.

I am grateful to the hon. Member, because I am about to come on to workforce. However, just before I do so, alongside this we want to increase the supply of wrap-around care to enable families to work more, or flexible, hours. We are investing £289 million in start-up funding to provide local authorities with funding to set up wrap-around provision from 8 am to 6 pm in their areas. More broadly, local authorities are critical to delivering this expansion of childcare, and we are working closely with them to understand the challenges they face and ensure they have sufficient places to meet parental demand. We will shortly be appointing a contractor to support them in that work.

There have been some key themes in this debate, beginning with funding rates. By 2027-28, we expect to be spending more than £8 billion every year on childcare. We have already increased the funding paid to nurseries for the existing entitlement by £204 million this year, rising to £288 million next year. That means that the national average rate for three and four-year-olds has gone up to £5.62 an hour, and for two-year-olds it has gone up to £7.95 an hour from £6—an increase of a third. Those rates are informed by a survey of more than 10,000 providers that we carry out in order to understand the funding pressures they face. That said, I am very happy to meet both my hon. Friend the Member for Buckingham (Greg Smith), who raised issues in his constituency—there has been a 10.1% increase for providers there—and my hon. Friend the Member for Devizes (Danny Kruger), where there has been a 6.8% increase. I am happy to continue that discussion.

On quality and flexibility questions, it is worth first noting that we have some of the highest-quality childcare in the world, with 96% of early years settings rated good or outstanding. However, we are working with the sector to increase flexibility and remove unnecessary burdens. In September, as my hon. Friend the Member for Truro and Falmouth (Cherilyn Mackrory) touched on, we changed the ratios for two-year-olds. We are pushing landlords to be more flexible and to allow childminders to operate on their premises, and we will shortly announce our response to the recent consultation with the sector about the early years foundation stage, where we are hoping to make a series of changes to help practitioners more easily do their jobs while maintaining higher standards.

Delivering expansion is going to require a significant boost to the workforce, so it is key that we are able to encourage more people into this sector—to raise its status, as my hon. Friend the Member for Truro and Falmouth touched on. In the new year, we will launch a big recruitment campaign to encourage people to consider working in a nursery school or as a childminder. We are expanding the early years professional development programme: nearly 25,000 people are already undertaking apprenticeships in this sector, but we are looking at accelerated apprenticeships and degree apprenticeships and will also be running early years skills bootcamps from next year to try to get more people into the sector. A start-up grant scheme for childminders, which will provide £600 for those registering with Ofsted and £1,200 for those registering with a childminder agency, will also be starting shortly.

Very briefly, I will touch on some other points made by the Chair of the Select Committee. Our funding rates do take business rate costs into account, and in the autumn statement the Government announced a freeze to the business rates multiplier, a tax cut worth £9.3 billion over five years. Small business rate relief exists, as does relief for charities, but I am happy to look at the extreme cases that my hon. Friend set out. He is right to flag the issue of tax-free childcare, which can save parents up to £2,000 per year on the cost of childcare, or up to £4,000 for children with disabilities. We are trying to drive up the take-up of that through our Childcare Choices website. As for people in education and training, a big part of this offer is to try to encourage people into work: students are eligible for the universal 15 hours for three and four-year-olds and for the 30 free hours if they meet the income criteria, and there is also the childcare grant and the parents’ learning allowance. However, I have heard the point that my hon. Friend has made.

I think I have covered most of the points that people have made. A number of Members from Northern Ireland have spoken: obviously, this issue is devolved in Northern Ireland, but I will just say that next week, I am chairing a meeting of the British-Irish Council on the topic of childcare. I am sure we are going to discuss childcare in both Northern Ireland and the Republic.



I think I have covered most of Labour’s commentary. I would be a lot more amenable to criticism from the Labour party if it had any policy whatsoever in this area. As it does not and all it has done is commission a taskforce to tell it what to think, I will close the debate there.
