My Lords, this is the most positive Statement the Prime Minister has been able to give since March, as we now have the real prospect of effective mass vaccination against coronavirus, which offers a route—of whatever length—back to normality. Huge congratulations are due to the team in Oxford and the other groups which produced the vaccine in record times. Reading accounts of how this has been achieved, I see that the key improvement on normal practice has been a willingness to work outside the normal silos in which scientists and others usually work. I hope this lesson will be learned for future vaccines, other areas of scientific research and public policy more generally.

There will no doubt be valid discussions about which groups other than those in care homes and the elderly should have priority on vaccine programmes, but the experience of the flu vaccination programme earlier this autumn should give us all some confidence that the programme can be undertaken speedily and effectively. I have one question about the vaccination programme. Do the Government intend that all those who receive the vaccine will get a vaccination certificate? One can certainly see many attractions of this, not least in that, if it were part of an international agreement to recognise such certificates, it could facilitate the return to greater normality in international travel, with the attendant benefits for the airline and tourism sectors.

The Statement sets out four criteria against which decisions on the placing of regions into tiers will be based and says that the tiering will be reviewed on a fortnightly basis. Can the noble Baroness clarify how that will work? The Prime Minister said yesterday that there will be a uniform approach, but the Health Secretary said it would depend on local circumstances. Which is it to be?

It is clear that, in tier 3 areas, the hospitality sector will continue to be very badly hit. Obviously, I understand the need for that, but will the Government look at additional, narrowly targeted support for this sector so that, when the toughest restrictions are lifted, there is still a hospitality sector able to reopen?

The Statement says that another £7 billion will be allocated to the test and trace system, bringing the total spend on this to some £22 billion—a huge sum which is, for example, greater than the total cost of Crossrail. I do not think that a single person believes that this has been money well spent so far. I hope that the new rapid tests will prove effective, but unless people who should get tested actually do so and then self-isolate if necessary, they will be ineffective. Equally, unless the tracking system also works, the money will be wasted. On all those grounds, the system to date has underperformed, to put it kindly.

In Liverpool, although the headline number of people tested is high, in the most deprived areas the take-up has been only 4% of residents. How do the Government aim to tackle this particular take-up problem? The proportion of people who self-isolate when asked to do so is still abysmally low. This is in no small measure due to the financial costs of doing so. There is of course the grant of £500 per week theoretically available so that those on low pay can be compensated for isolating. However, this is subject to so many conditions that, at the moment, apparently some 80% of all applications are rejected—this from a Government who have shown no such rigour when doling out PPE contracts worth millions of pounds. Will the Government now urgently recast the £500 scheme so that it can be accessed by those who need it?

Finally, I have a very specific question, of which I have given the noble Baroness prior notice. Page 24 of the winter plan document states that places of worship will be allowed to reopen but that there will be limits, depending on the tier, on the number of people with whom congregants can “interact”. Can the noble Baroness explain what “interact” means in this context, given that before the lockdown people were required to socially distance, wear masks and certainly not touch each other? Does it mean that there will be more or less “interaction” in churches now than there was a month ago?

I thank the noble Lord and the noble Baroness for their questions. We have published our winter plan, the aim of which is to take us through to spring. I will first answer a few questions on the tier system, which both the noble Baroness and the noble Lord touched on.

We have adapted our tiers in this plan on evidence that gives us the best chance to control the virus, developing community testing with scientific advice from national advisers and local directors of public health. The noble Baroness is right: these tiers are designed to reduce and keep the R below 1 and to support areas moving down tiers. That is the aim of where we are going. I will move on to vaccines, mass testing and other elements that we think will play an important part as we move towards the spring and, I hope, some kind of normality.

The noble Lord and the noble Baroness are absolutely right. To provide clarity and consistency, all tier restrictions have been standardised and will not be negotiated locally—so that is tiers 1, 2 and 3. Both asked about decisions on moving out of tiers. Decisions on the areas that go in and out of tiers will be based on a range of indicators, including: case detection rates in all age groups; case detection rates in the over-60s; the rate at which cases are rising or falling; the positivity rate—so the number of positive cases detected as a percentage of tests taken; and pressure on the NHS, including current and projected occupancy. Tiering allocations will be reviewed every 14 days, so there is a process and range of measures that will be published around which decisions will be made. While we appreciate that people would like to see firm thresholds, because areas and localities are different we will need to take into account local factors as well, but the indicators that I mentioned are key ones.

The noble Baroness rightly asked about local engagement on the basis that there is now some consistency among tiers. Absolutely, there will be local engagement. In particular, we will offer local authorities in tier 3 areas the opportunity to participate in a new community asymptomatic testing programme to help to find people who have the virus but do not show symptoms. Local authority directors of public health will be able to select their own approaches for delivering tests and priority testing targets and, as the noble Lord said, we hope that will mean that there is proper targeting of local areas, and some of the issues around take-up that he mentioned can be addressed through this local programme.

The programme will involve a six-week surge of testing capability to enable regular testing to be rolled out to the community in a way that works for the local authority with support from national government, including sufficient test supply, funding to cover support set-up costs and staffing test sites and support for extra contact tracing to break up clusters before they become outbreaks. That is where the additional funding that the noble Lord mentioned for test and trace will be focused.

The noble Baroness asked about contracts, and I can only reassure her that we will, of course, follow all the proper processes, procedures and oversights in awarding any future contracts.

In relation to Christmas, just as we came in discussions finished with the devolved Administrations, and they have reached some conclusions. Between 23 and 27 December, up to three households will be able to join together to form an exclusive Christmas bubble. The noble Baroness rightly asked about the clinically extremely vulnerable. Everyone must continue to take personal responsibility for spreading the virus and protecting their loved ones. For someone who is clinically extremely vulnerable, forming a Christmas bubble carries additional risk, but it will be a personal choice. People should take all precautions, including maintaining social distance from those they do not live with at all times, and they should consider seeing their bubble outside, where the risks are lower—but that will be a personal choice for people.

From 23 to 27 December, travel will be permitted between tiers and nations for the purposes of joining a Christmas bubble. People coming to or from Northern Ireland—and I see the noble Lord sitting there—will be permitted to travel a day either side of 23 and 27 December. I am sure there will be further information coming out, but that has come hot off the press.

In relation to care homes, we have launched testing pilots across 20 care homes, using PCR and the new rapid turnaround tests to allow up to two specific visitors to take two tests a week so they can do indoor visits to residents, including some physical contact. We intend to roll out this approach in a phased way across December, because we have made a commitment to provide tests to enable care home residents to have two visitors tested twice a week.

The noble Baroness and the noble Lord asked about vaccines, which is a key part of our route out by spring, we hope. It is about a combination of the mass testing that I have talked about and, obviously, the improved therapeutics that we have, which are having an impact when people are in hospital, but also vaccines. We anticipate that a number of safe and effective vaccines will be available in 2021, and we have taken steps to ensure that the UK has access to them. As everyone will know, we have agreements with seven separate vaccine developers, but we accept that the shift will not happen overnight, which is why spring is the timescale that we are looking towards.

The noble Lord, Lord Newby, asked about a vaccination certificate. I am not aware of that, but I will take that issue back and raise it. I reassure him that an enormous amount of preparation is taking place to make sure that we have adequate provision, transport, PPE and logistical experts to ensure that the rollout is successful. As he rightly says, the NHS is working from a great base—every year for the flu vaccine we have to roll out a vaccination programme, so we are starting from a good base.

I will attempt to answer the question from the noble Lord, Lord Newby, on interaction in places of worship. Social distancing rules should continue to be followed within places of worship, including during communal worship, which can of course now take place in all three tiers. That means that in areas under tier 1 restrictions, people should attend only in groups of up to six—the rule of six—and in tiers 2 and 3, people must not mix outside their household or household bubble. People should stay socially distanced. There should be closer distance only when absolutely essential to enable a faith practice to be carried out—for example, contact with a faith leader—and time spent in such contact should be kept to an absolute minimum.

My Lords, I draw attention to my declared interests. In his Statement in the other place, the Prime Minister made reference to the imminent initiation of a mass vaccination programme for the UK population. Have Her Majesty’s Government considered creating a prospective research cohort from among the millions of citizens who will be vaccinated in the early months of this programme? This would facilitate individual follow-up and invaluable data collection, better inform our understanding of pandemic epidemiology and provide invaluable insights into the future development of novel vaccine platforms.

I thank the noble Lord for his question, and I also pay tribute to all the fantastic work that has been done in relation to the vaccinations. Indeed, obviously a lot of research and testing has been done to develop the vaccines. We will certainly learn from that as we roll out the vaccination programme, and from his very useful comments and observations about things we may consider. I am very happy to take that back to the department of health, which I am sure will be considering these things and talking to experts, such as himself, throughout the industry to make sure that we roll out this programme as effectively as possible.

Mindful that we live in one of the richest nations on earth, that we have one of the best healthcare systems, some of the most brilliant scientists and pharmaceutical companies, and that they have developed the best Covid vaccine to date, will my noble friend reaffirm the commitment made at the G20 summit last weekend to ensure fair and affordable access to the vaccine for the vast majority of the world, who are not nearly as fortunate as we are yet whose need is just as great?

I am very happy to provide that reassurance to my noble friend. We are absolutely committed to ensuring rapid and equitable access to safe and effective vaccines, therapeutics and diagnostics, and we have committed up to £829 million of ODA to this. We have announced up to £500 million to the COVAX advanced market commitment, supporting 92 low and lower-middle income countries to gain access to a vaccine.

My Lords, with regard to the Minister’s news regarding us being able to have up to three households together at Christmas, does the rule of six still apply and, if not, what will be the limit on people celebrating together? I spoke in the debate on the regulations to put us into lockdown, and asked the noble Lord, Lord Bethell, about the nonsense of children being able to play with their friends bubbling with them in school but not play with the same children out of school. He said he would definitely look into it, but since then I have heard nothing. Can I ask the Minister to please urgently pursue this? Whatever tier we are to move into next week, please can the Government ensure that children have this right to play with their school bubble-mates after school and at weekends?

As I said, the decisions on Christmas have just been made, so I probably do not have full information. As I said, between 23 and 27 December, up to three households will be able to join together to form an exclusive Christmas bubble. Everyone can be in one bubble only and cannot change that bubble during this time period. The bubble will be able to spend time together in private homes, attend places of worship or meet in a public outdoor place. Beyond this, people should follow the local restrictions in the area in which they are staying. I will speak to my noble friend Lord Bethell about the noble Lord’s other question.

My Lords, I echo the plaudits of my noble friend Lord Newby for the team in Oxford that developed a viable, stable, successful and inexpensive vaccine. Does the noble Baroness have any clear idea when the vaccination programme will start? Will it start all across England at the same time? Who will be responsible for carrying out the vaccinations? How many will be trained to do this? They do not need to be clinicians.

On behaviour in churches, can congregations now sing?

Moving to testing, last month, in round figures, of the 315,000 people who were identified as having come into close contact with someone who tested positive, only 60% were reached and asked to self-isolate, and that figure was little changed from the record low of the previous month. It means that 126,000 people with coronavirus were not contacted and, therefore, were not isolating and so were infecting others. Are the Government are satisfied with this? We have had months to make this more effective. Why can we not do better?

Well, there will be further guidance on carol singing, I am assured, so the noble Baroness can keep an eye out for that.

On vaccines, obviously the safety of the public comes first. A Covid vaccine will be approved for use only once it has met robust standards. In relation to the Pfizer/BioNTech vaccine, the Health Secretary has asked the MHRA to begin its assessment of this vaccine, and Pfizer/BioNTech has begun supplying data to the MHRA. But it is an entirely independent process, so that will be done in time. As I have said, we anticipate a number of safe and effective vaccines available in 2021.

My Lords, I welcome this approach, particularly to care home testing, but have concerns in relation to SI 1292, which came into force on 17 November to provide an exemption from travel restrictions to allow poultry workers into the UK to assist with turkey slaughter. Many are coming from eastern European countries experiencing high levels of Covid-19 infection. I understand that testing and other requirements are based on individual workers showing coronavirus symptoms. Could the noble Baroness the Leader of the House explain why there are no plans for routine testing of these workers to protect public health, as there is the potential for asymptomatic transmission from these workers? Has the Department for Transport undertaken a thorough review of this situation, together with the Department of Health? Could the noble Baroness inform us on this issue and investigate it if she is unable to answer at this time?

What I can say is that this is one of the areas in which the mass testing programme rollout can be used. For instance, local authority directors of public health may wish to roll out one of their programmes to higher-risk industries, for instance. Those are exactly the kinds of situations where local authorities may wish to use this programme to deal with the very issues that the noble Baroness set out.

My Lords, at great personal cost, as well as social and financial cost to the country, millions have now had Covid and therefore have antibodies. I am indeed one of them. Significant savings can be made by excluding anyone who has contracted the disease in, say, the last six months, from needlessly being traced, tested or required to isolate, including after returning from abroad. So what has been decided about such people and where they should come in the pecking order for vaccination?

In relation to the pecking order, as my noble friend said, for the vaccination, it will be for the independent Joint Committee on Vaccination and Immunisation to advise the Government on which vaccine should be used and what the priority groups are—and the committee has indeed issued some interim advice on this already.

Another initiative that we are launching which will, to a degree, help to address my noble friend’s points going forward, is the plan to introduce frequent testing as an alternative to the need to self-isolate for people who have had close contact with someone who has had Covid. The contacts would have regular tests during an isolation period and would have to self-isolate only if they tested positive.

My Lords, 18% of those for whom self-employment makes up at least half their income are ineligible for the Self-employment Income Support Scheme, while 38% of those with any self-employment income are still ineligible. When will the Government address this wrong? Secondly, can the Government publish a list of businesses that have received subsidies through the Coronavirus Job Retention Scheme?

We have put in place one of the world’s most comprehensive economic responses, backed by over £200 billion, to protect jobs, incomes and businesses throughout this period and beyond the pandemic. Our support for the self-employed has been more comprehensive and generous than almost any other country’s, with around £13.5 billion for over 2.5 million people.

First, as the father of three young boys, I associate myself with the comments of the noble Lord, Lord Knight, about children being able to meet with other children from their school bubble, who they work with every day, outside the school. It is critical to their socialisation and enjoyment of the coming weeks.

More specifically, it only takes walking down the high street to see how many businesses have shut over the last months—permanently, not just for lockdown. Hospitality businesses are at enormous risk of long-term closure now if they are not able to operate during the critical weeks up to Christmas. Will the Government extend specific support beyond that already being given to them, as they will be required to miss their most important trading time?

I completely accept and acknowledge the difficulty for hospitality businesses in particular over the past few months. As the noble Lord is aware, we have provided a comprehensive array of economic support packages, through the furlough scheme, grants to businesses forced to close as a result of the restrictions, business rate relief and the extension of various schemes. We are cognisant of this and will continue to support the hospitality sector. To get all businesses back on their feet, we want to find the pathway out of this pandemic. With vaccines, mass testing and improved therapeutics, I hope we are getting towards that, so that businesses can start to open and return to some sense of normality, which we and they all want.

The agreement of a UK-wide approach to Christmas rules is welcome. Will a UK-wide approach also be sought for the distribution and allocation of vaccines? Do the Government agree that, after prioritising key NHS and care workers, it is preferable that those who contribute to economic recovery and growth, and education, are prioritised over the more elderly, who have successfully kept free from the virus by isolation?

I reassure the noble and gallant Lord that a vaccine will be deployed across the whole UK. We are working closely with the devolved Administrations to ensure that it is deployed fairly. As I mentioned, the independent Joint Committee on Vaccination and Immunisation will advise on which vaccines should be used and what the priority groups are. The initial advice is that the vaccine should first be given to care home residents and staff, followed by people over 80 and health and social care workers, and then the rest of the population in order of age and risk.

I thank the noble Baroness for the Statement. The Prime Minister said that the scientific cavalry is now in sight. Can I be assured that the squadrons of cavalry will all arrive on the battlefields of the United Kingdom together, so that care home workers, clinical staff and all the rest will be vaccinated and have access to rapid testing at roughly the same time?

I hope that I have made it clear that we are working very closely with the devolved Administrations to make sure that these programmes and vaccines are rolled out. Obviously, the mass testing programme in England is the only testing programme, but we will be working with all the devolved Administrations to make sure that they have access to the tests and vaccines they need in order that we can all move forward together and, I hope, see some light at the end of the tunnel come the spring.

My Lords, this is a moment of hope. One hopeful thing that caught my eye in the Government’s White Paper was paragraph 79, which sets out a plan to legislate by the end of this year, requiring care home providers to restrict all but essential movement of staff between settings. This is very desirable, but does the noble Baroness accept that these movements are in part because of the scandalous pay and conditions of people working in the care sector, their need to combine several part-time jobs and their poverty, which makes them reluctant to isolate? Will the legislation proposed by the end of the year include a statutory framework to improve pay and conditions in the care sector, and will the Government consult the trade unions on it?

The noble Lord is right in the sense that one issue that care homes have faced is the movement of staff who work in a number of them. We have extended the infection control fund and ring-fenced over £1 billion to support social care providers, exactly to help ensure that workers do not have to go between care homes. We have also made over £4.6 billion available to help local authorities respond to the pressures caused by the pandemic in key services such as adult social care. So we are very cognisant of the issues that he has raised.

The Prime Minister likened the work of Oxford and other universities to the cavalry riding to the rescue over the hill. Two years ago, Oxford attracted more European funding than any other academic institution in the Union, much of which we will lose as we move into the EEC. Will the Government make good these losses? Our universities defend us from disease, feed us, and find ways of tackling climate change and cybercrime, but they are run by much-derided public servants, many from overseas. They are motivated by finding answers to problems. University research must be financed, staff must receive reasonable salaries or they will go elsewhere, and in many cases they will need visas. Will the Leader of the House speak up for these university staff, who are not well paid, so that they are supported in their work and are available to deal with more challenging problems ahead?

I am very happy to again pay tribute, as the noble Baroness, the noble Lord and others have done, to the fantastic scientists who have worked on these vaccines and indeed who work across universities. I very much hope that the exciting developments we have seen at Oxford and other universities will encourage young people to think about this work as a career. It is incredibly impressive and challenging work, and I hope that some of the coverage and interest in it will encourage more people to think about it as a career, ensuring that we continue to have fantastic scientists working in this country.

My Lords, we rejoice at the wonderful news of the Oxford-AstraZeneca vaccine. However, in the meantime, does the noble Baroness agree that a six-week mass, rapid and affordable lateral flow antigen testing surge could be a game-changer? Now that these tests will be manufactured in the UK at very low cost—perhaps even as low as £3—do the Government agree that they should be freely distributed to enable as much of the population as possible to self-test regularly? This would reduce the R rate rapidly, within weeks, and, in the words of the Prime Minister, would be the boxing glove that truly pummels the virus.

I agree with the noble Lord, and that is exactly why we are offering all local authorities in tier 3 areas the opportunity to participate in the sort of programme that he has suggested. It will be called the kick out Covid testing challenge and will build on the positive results from the Liverpool pilot.

My Lords, my noble friend will be aware of the risks associated with large numbers of students returning home in the run-up to Christmas, and of course in some cases travelling between higher tier areas to lower tier homes. Will she ensure that the Government will work with universities so that all of them provide two tests for each student to ensure that they return home only when they have a negative test result that is immediately available?

I can certainly reassure my noble friend that we are working closely with universities. As he will know, between 3 and 9 December, students will be allowed to travel home on staggered departure dates set by universities. Tests will be offered to as many students as possible before they travel home for Christmas, targeted using a range of factors, including local prevalence rates, whether a testing history is already available, and the percentage of high-risk students in each institution.

I thank the Leader of the House for repeating the Statement. I assume that an estimate has been made of the extra people who will be killed in January as a result of this crazy five-day three-family rule. What is it? I have just watched Professor Sridhar at Edinburgh University advise on the Channel 4 news programme: “Don’t travel. Don’t put your family at risk. Why throw away the gains of the past few weeks?” Does the Leader agree?

Regardless of faith, Christmas is a time when family and friends come together. It has been an incredibly difficult year for everyone, and time with loved ones is very important. We have been very clear about the rules and we have also been clear that it is for people and families to make judgments about how comfortable they feel in terms of the importance of seeing loved ones with regard to their vulnerability. However, I personally would say no to stopping people seeing family for Christmas. I would prefer to see my family, but obviously I will have to make judgments with them about how comfortable we feel, and I think that that is quite important.

My Lords, I am reminded of the line from the poem,

“If winter comes, can Spring be far behind?”

It seems that this is the Government’s last chance to get things right on a lot more testing and distribution of the vaccines. The Royal Blackburn Hospital reports that despite the fact that the number of infections in east Lancashire has started to go down at last, it has twice as many Covid cases in hospital as it had in the spring. That is putting huge pressure on all its services.

I asked about the Nightingale hospitals in a recent Question and was told that each Nightingale team has been developing a clinical model that can be scaled up as and when additional capacity is required. Why are we not using the Nightingale facilities in places like Manchester and Harrogate to relieve the pressure on hospitals like Blackburn?

The NHS Medical Director has made it clear that the NHS has carefully planned to make sure that we can deal with additional demand using, as the noble Lord has rightly said, the mobilisation of the Nightingale hospitals and through partnerships with the independent sector. They will ensure that this is rolled out as and when it is needed. I am sure that they will be cognisant of the situation in Blackburn and will be monitoring it very carefully.

My Lords, will the noble Baroness kindly clarify further her response to the noble Lord, Lord Newby? Do the Government plan to relax international travel restrictions to allow for air travel over the Christmas and new year period on the proviso that compliance is upheld in the country of destination? More generally, do the Government anticipate accepting negative test results within any 72-hour criteria being allowed towards the proposed five-day criteria when that test has been taken at an overseas clinic?

On travel over Christmas under the new tier system, people will be permitted to travel abroad, but those in tier 3 areas are being advised to avoid leaving the area for any reason other than work, education or caring responsibilities. The noble Lord may be aware that from 15 December, passengers arriving in England from countries not featured on the travel corridor list will have the option to take a private test after five days of self-isolation with a negative result, releasing them from the need for self-isolation.

I thank my noble friend for her response on Christmas—that it is a matter for all families to make educated judgments on their own risk. This is a much better way of leading the British people through a crisis. Given that there is strong evidence that infections peaked in the UK in the weeks before the lockdown in March due to voluntary action, in the weeks before the current lockdown nationally, and in most regions across all tiers—1, 2 and 3—due to the changing community perceptions of the virus, what intention do Her Majesty’s Government have to pivot to a strategy of public health messaging to improve adherence and enable voluntary, as opposed to mandatory, measures that empower citizens to take responsibility for their own health and the health of their families and communities?

Well, I assure my noble friend that the legal consistency of the new tiers—as I said, they are now standardised—will be complemented by targeted communications and public health campaigns to inform and influence behaviours to strengthen the sense of personal responsibility in behaviours that will be important to combat the spread of the virus over the winter, together with using local mass testing programmes, with local knowledge about how to encourage people to use them. All that will lead to the kinds of conversations and messaging that my noble friend talks about.

My Lords, does the noble Baroness agree that the public health campaigns she just referred to need also to be targeted at people over uptake of vaccines? Is she concerned about the rise in anti-vaccine sentiment? A UCL survey recently showed that, while 78% of people were willing to get the vaccine, only half considered themselves “very likely to”, with 10% saying that they were “very unlikely to”. There is pernicious anti-vaccine sentiment around. What action will the Government take to deal with it?

We have a central government unit that will be working on this, but also DCMS is working very closely with social media platforms to help identify false claims, exactly as the noble Lord said, about both the virus and the vaccine and, where necessary, promoting authoritative sources of information in their place. I assure the noble Lord that we are very cognisant of these issues and are working hard to make sure that the rollout of the national vaccination plan is accompanied by a public health strategy and message to make sure that people understand that we will always put the safety of the public first, and that any vaccine that is approved will have gone through an incredibly rigorous process to pass that hurdle, as the noble Lord will well know.

My Lords, it is very encouraging news that vaccines will be available in 2021—a remarkable feat. We should all congratulate Oxford, which is not only supplying 100 million vaccines to our Government but is doing so on a not-for-profit basis. Is Pfizer, the supplier of the first vaccine to be announced, which is supplying us with 40 million doses, doing so on the same basis? More importantly, deal or no deal, as the Pfizer vaccine is, I believe, coming from Belgium, will there be import duties or tariffs?

Well, we have secured more than 40 million doses of the Pfizer vaccine, as my noble friend rightly said, which is enough for about a third of our population, and in total we have secured early access to more than 355 million doses through a portfolio of promising new vaccines—so we are very well placed to take advantage of both the Pfizer and Oxford vaccines, which have now reached the stages they have, and other vaccines that will hopefully follow through on the back of their success.

As it is very usual for couples, whether or not they have children, but particularly when they do, to split their time at Christmas by visiting in turn the homes of their respective parents, is there any possibility that the grand easing of restrictions will stretch enough to include such behaviour, which is so highly valued by the elderly and the very young alike?

As I have said, there was a COBRA meeting this afternoon with the devolved Administrations, and details of the decisions made were released just before we came into the Chamber, so I am afraid the only information I have is the information I provided earlier, which is that between 23 and 27 December up to three households will be able to join together to form an exclusive Christmas bubble.

Does my noble friend agree that all three vaccines are fine examples of the benefits of genetic modification? If she is happy to have them injected into her body, as I am, why do we still not allow the planting of genetically modified potatoes in our fields?

My Lords, I thank the noble Baroness the Leader of the House for answering questions on the Prime Minister’s Statement. The Prime Minister begins by saying that he

“will update the House on the Government’s integrated review of foreign, defence, security and development policy”

but the Statement does nothing of the sort. It is simply a statement of increased military expenditure, particularly on the Navy. The Prime Minister has successfully wrenched the nation’s credit card from the Chancellor’s possession long enough to provide for significant additional expenditure on defence kit. In themselves many, if not all, of the items on the shopping list are clearly desirable. Who could possibly object to having more frigates or drones, better AI or the National Cyber Force? But it seems more than somewhat bizarre to be announcing this additional spending in advance of the completion of the integrated review. Could the noble Baroness explain to the House exactly when that review will be published?

It is particularly worrying when we hear repeated rumours of a cut from 0.7% to 0.5% of GDP spent on overseas development. Can the noble Baroness the Leader confirm that these rumours are simply untrue? If she cannot, what is the rationale to spend more on military kit and to cut the aid budget? How could robbing Peter to pay Paul in this way possibly lead to a net gain in our credibility and reputation, taking account of the soft, as well as hard, power we wield as a nation?

The Statement waxes lyrical on the need to fight terrorism, and no one can disagree, but the best way to fight terrorism and protect our security as a nation is in the closest possible co-ordination with our nearest allies. Is it therefore not reckless of the Government to have completely failed to address security co-operation with our EU partners, as part of the Brexit negotiations? Does leaving the EU systems for sharing information on criminals and terrorists, and the European arrest warrant, not present a body blow to our ability to identify, track and trace individuals who pose a direct threat to our security?

There is no update or set of principles on foreign policy, just a general statement that the world is an increasingly dangerous place. This a pretty thin basis for detailed defence procurement priorities. In the Statement, the Prime Minister says that new technological advances will

“surmount the old limits of logistics”,

but there are no advances that mean that fighting ships do not require refuelling or that sailors do not require feeding. When one of our carriers is deployed to the Far East, for example, how is it to be provisioned and, given that the new frigates will not be built for a number of years, how will it be protected?

While there is quite a lot about the Navy in the Statement, there is nothing at all about the Army. What does this mean for Army expenditure? For example, are the Government committed to keeping troop levels at their current levels and are rumours about reducing the number of tanks correct? How does this increased expenditure fit into the Government’s overall public expenditure plans? We will be hearing more from the Chancellor later this week but, given the weakness of public finances, the expenditure being discussed today simply cannot be funded by increased borrowing. To echo the noble Baroness, Lady Smith, which other areas of public expenditure will fall or which taxes will rise to pay for this?

The noble Baroness will no doubt say that she cannot give an answer to these questions because that would pre-empt Wednesday’s Statement—but today’s Statement pre-empts Wednesday’s Statement. The truth is that the Prime Minister has done what he does best: making exaggerated claims for future policy developments, while leaving the Chancellor of the Exchequer to pick up the bill. That is the fundamental problem with this Statement. It is isolated from the integrated foreign, defence, security and development review and from the overall tax-and-spend strategy of the Government. With its soaring rhetoric, Boys Own breathlessness and glowing references to past glories, it runs the risk of being isolated from any realistic assessment of Britain’s place in the modern world.

I thank the noble Baroness and the noble Lord for their comments. I will start by talking briefly about the integrated review, as they both asked some questions about it. We will conclude and publish the full integrated review early next year. Both noble Lords asked about the delay and, as they rightly said, the review was announced in February; it was then paused in April, due to Covid, and restarted in June. So we did have a delay in the review and it will now conclude early next year. However, we are in the final phases of it, aligning our ambition with our resources. The defence settlement outlines the first conclusions of the review, which will put us on the front foot as we equip our Armed Forces for the threats of today and tomorrow, while ensuring that long-term defence projects have certainty and are not put on hold.

When the full integrated review concludes early next year, it will set out our overarching strategy for national security and foreign policy, including defence, diplomacy, development and national resilience. It will set the direction for more detailed strategies and departmental activity in the coming years. It will also set out the way in which the UK will be a problem-solving and burden-sharing nation, and a strong direction for recovery from Covid at home and overseas. That issue was touched on at the G20 virtual summit held over the weekend, when all the leaders discussed it.

The noble Baroness, Lady Smith, rightly talked about making sure that all parties were engaged. I can certainly reassure her that this is a cross-Whitehall process, allowing all to contribute expertise and analysis—not only within Whitehall but with partners, including NATO. Our closest allies have been involved during the process and will continue to be so. She also asked about the defence review, which is ongoing. Further details will be updated in due course.

Both noble Lords asked about spending. This is the only multiyear settlement for any government department that will be announced this year. I can reassure them that it has been fully costed, building on extensive work by the Treasury and MoD to understand what future capabilities will cost and how much can be delivered through efficiencies.

The noble Baroness talked about jobs, quite rightly. We expect this settlement to create up to 10,000 jobs each year across the UK, and as many as two-thirds more in the supply chain. Both noble Lords will be aware that in 2018-19, the MoD supported over 400,000 jobs, while defence spent £19.2 billion with UK industry last year. This new settlement will support further jobs in a whole array of areas: in shipbuilding, for instance, and obviously in emerging technologies—in space and in the building of the Tempest. We hope that this spending will create jobs in a range of ways. Part of the investment will also be looking to upskill and make sure that we can provide jobs for people around the whole of the United Kingdom—Scotland obviously being key to some of the developments that we are talking about. Hopefully this will be a UK-wide investment in jobs.

Both noble Lords rightly asked about international development. We are of course extremely proud of our work there. We remain committed to supporting international development and helping the world’s poorest people. Of course, our Armed Forces are also a humanitarian force for good, coming to the aid of the most vulnerable following natural disasters, bringing stability to countries marred by conflict with peacekeeping missions and bolstering efforts to tackle Covid in the developing world. Both noble Lords will both know that the spending review will be announced on Wednesday; funding will be announced then.

The noble Lord, Lord Newby, asked about the Army. I can assure him that the UK will continue to have full-spectrum Armed Forces, including an armoured capability. But we also need to ensure that we focus on how the Army is equipped and what we want it to do. This settlement will ensure that our soldiers have some of the best equipment in the world, so that they can continue to do their fantastic job.

Both noble Lords talked about global leadership. They are absolutely right, which is why this settlement raises our defence spending to 2.2% of GDP. That is more in cash terms than any other European ally or NATO member, other than the United States. We will continue to lead internationally. Next year is a critical year for our international leadership, as we have the G7 presidency, COP 26 and the 75th anniversary of the first UNGA meeting in London. We will continue to play our part on the global stage, and this settlement will help us to do that.

My Lords, does my noble friend agree that the battlefields of future warfare will lie increasingly right inside our societies and inside people’s minds? So, while these measures are obviously extremely welcome for our Armed Forces, in the Prime Minister’s own words, we must

“upgrade our capabilities across the board”.—[Official Report, Commons, 19/11/20; col. 488.]

Will she also assure us that when the integrated review eventually appears, having looked further at our defence needs, it will fully reflect what the Trade Secretary calls the “Pacific mindset”—along with the “Commonwealth mindset”—since these are the areas where our key future alliances increasingly lie for security and defence, as well as for trade and investment?

I thank my noble friend. He is absolutely right that we must look across all our capabilities to ensure an integrated response across the board to the threats and opportunities of the modern world. He is also right to emphasise the importance of the Commonwealth and the Indo-Pacific region. One of our greatest strengths is our alliances, along with our deep ties with the nations of the Commonwealth. We will continue to work closely with them, and of course the Indo-Pacific is the fastest-growing economic region in the world, so it is a crucial transit point for global trade, and a home to UK allies and trading partners. They will be at the forefront of our thoughts.

My Lords, the Statement last week is to be welcomed, albeit I think that it brought relief rather than jubilation to most defence and security experts. However, I too thought that the style and content of the Statement were somewhat disappointing. It is potentially a missed opportunity—little more than a hubristic announcement of a list of new defence capabilities. Will the integrated review itself give more evidence that the capability choices that have been made are matched to reconsidered strategy, particularly in the areas of modernised deterrence, national resilience, an integrated approach and—dare I say it—a more effective use of strategic information?

I thank the noble and gallant Lord and, yes, I can say that as we are now in the final stages of the integrated review, we are aligning our ambition with our resources. As I said in response to the noble Baroness, Lady Smith, this defence review outlines the first conclusions of that and gives certainty to our defence projects. But the noble and gallant Lord is absolutely right: when we publish the fully integrated review, it will set out our ambition for the UK’s role in the world and our long-term strategic aims for our national security and foreign policy.

My Lords, I welcome this announcement, with its impact on jobs and industry, including in the diocese I serve. I note the welcome emphasis that the Government appear to give to defence and security. Will the Minister therefore recognise that previous defence reviews set out grand, strategic ambitions but were not backed by the necessary resources? Will she specifically confirm the Government’s commitment to providing those resources to match the ambitions of the review, and will she further recognise that as we wait for spending commitments on development aid and public sector pay, how much the Government propose in additional investment is an accurate barometer of what they consider to be most important?

I reassure the right reverend Prelate that this settlement puts the defence programme on a sustainable footing and will make sure that our Armed Forces can meet today’s threats at the same time as delivering on a once-in-a-generation modernisation. This £16.5 billion increase over four years is the biggest uplift in 30 years, and, as I mentioned, it cements the UK’s position as the largest defence spender in Europe and the second largest in NATO.

My Lords, I am sure that I do not need to remind the noble Baroness the Leader of the House that the Conservative Party manifesto contained a commitment to spend 0.75% of GNI on development aid. She failed to answer the direct question put by my noble friend Lady Smith and the noble Lord, Lord Newby, about whether this would be maintained. How, in the circumstances, can abandoning an election manifesto commitment of this kind even be considered—it is enshrined in law? Can she tell the House what the effect of doing so will have on the lives of millions of poor people living in dire poverty around the world, quite apart from the damage it will do to our international reputation?

As I have already said, we are, and should be, proud of our international development work. I have also already said that the spending review will be on Wednesday and announcements will be made there. I will not say anything further on that today, but I can certainly say that we are absolutely committed to supporting international development and helping the world’s poorest people. We will remain a world leader in this area through, as I have said, hosting COP 26, our G7 presidency and hosting a major girls’ education summit next year.

My Lords, I suspect that the Prime Minister’s Statement divides Peers, MPs and everybody else, to an extent, into those of us who speak on defence issues and those concerned about wider issues. Therefore, while I obviously welcome what the Statement said on defence expenditure, like other Peers, I ask the Minister what has happened to the 0.7% legal commitment to development aid. In the defence sphere, the Prime Minister talked about a

“once-in-a-generation modernisation”

programme and how we are going to get away from the “vicious circle” of

“squandering billions along the way.”—[Official Report, Commons, 19/11/20; col. 488.]

Given that the cart has come before the horse—the expenditure has been flagged up before the integrated review is complete—could the Minister explain to us how the Government intend to avoid “squandering billions” and how they will improve defence procurement?

As the noble Baroness says, we believe that this settlement gives a chance to break free from the vicious circle whereby we ordered ever decreasing numbers of ever more expensive items of military hardware. We have set out a number of projects that we will move forward across the Navy in particular but also with the RAF and others. We have also set out a very ambitious plan focused on using new technologies, AI, our new National Cyber Force and space. This is a broad package that we believe will truly help our Armed Forces modernise and be able to tackle the emerging and very different global threats that they are currently facing.

My Lords, I certainly welcome this pledge to increase defence spending: the world is a very much more dangerous place, and I will take the noble Lord, Lord Newby, through a few more of the threats outside later, if he likes. Can my noble friend say whether I can be confident that this announcement marks a reverse in the defence cuts that have taken place over the last 30 years since the end of the Cold War? Before I sit down, I will also say that I was on the International Development Committee for six years in the other place and saw some quite excellent work done with British taxpayers’ money. I also saw some shocking waste: an example that particularly springs to mind was an African country buying a fleet of Mercedes cars for its Cabinet Ministers with British taxpayers’ money. I have to say, if I might, that not all money spent on international development, or indeed on defence, is well spent.

I can certainly say to my noble friend that this is a significant investment in defence, and, as I have said, it is the biggest uplift in 30 years. The MoD is committed to making a step-change in defence transformation so that it delivers the digitised, efficient, productive and modernised defence that we require. We will also accelerate the adoption of new technologies, ensuring, all in all, that our military has the best capacity and capability that it needs, as he rightly says, to address the ever-growing challenges that we face.

My Lords, the Prime Minister’s defence announcement is to be greatly welcomed, especially the multi-year settlement. Also welcome is the firm recognition of the strategic priority to keep the sea lanes open. The key to this is destroyer frigate forces, which are of barely sufficient size for this task. Their numbers are imperilled by the decay, through old age, of the Type 23 frigate. The intent to build more ships for the Royal Navy is good news, but this ageing out of the Type 23 means that this intent must be expedited. Would the Minister agree that an in-service date of 2027 for the Type 31 is an unacceptably long time to have to wait for this much-needed asset to join the fleet and that the shipbuilding industry, which is much favoured in this announcement, should be made to do better?

I thank the noble and gallant Lord. Certainly, this settlement will significantly expand the Royal Navy: as well as confirming the current frigate orders, as he rightly says, we have also committed to the next-generation warship, the Type 32, and to research and support vessels. We are sticking to the timescale of 2027 for both the Type 31 and the Type 26. The Type 32 will represent an investment in UK shipbuilding of over £1.5 billion over the next decade and will, of course, create and sustain more jobs. We plan for this to be a UK-led programme that will revitalise the shipbuilding sector and create thousands of jobs. We believe that this is a strong settlement for the Navy, which will enable us to invest in new technology and ships and provide our Royal Navy with the capability that it needs.

My Lords, I am delighted that the Government are investing an extra £24.1 billion over the next four years. It is desperately needed after the reductions since 2010. The decision to base our defence and security on a maritime strategy is also correct and welcomed. As you can imagine, it is music to my ears to have the Prime Minister say

“If there is one policy that strengthens the UK in every possible sense, it is building more ships for the Royal Navy”,—[Official Report, Commons, 19/11/20; col. 488.]


and that we should become the “foremost naval power” in Europe. It would be very easy to express concerns about the many unknowns and possible pitfalls in this announcement: the timing of the frigate build, for example, is one of them, as the noble and gallant Lord, Lord Boyce, mentioned. However, today, I believe we should celebrate the extra money for defence in this increasingly dangerous and unstable world. Many of the details will have to await the review’s outcome in January next year, but I ask the Leader of the House to confirm that, as the Prime Minister is so positive about running two operational carriers by 2023, we will still be ordering a minimum of 90—if not more—F-35Bs to ensure that we have two air groups and an operational conversion unit.

I welcome the noble Lord’s welcoming of this announcement. He has been a vocal and consistent strong voice for the Navy within this House, and I am glad that he is pleased. He is right that the carrier strike group 21 is an ambitious global deployment. From 2023, it will be permanently available to be routinely deployed globally, and, in fact, HMS “Queen Elizabeth” will lead a British and allied task group on our most ambitious deployment for two decades, encompassing the Mediterranean, the Indian Ocean and east Asia. We are currently finalising our plans for the deployment with regional partners.

My Lords, pandemic was on the 2015 review risk register. Does the noble Baroness recognise that failing to address that has resulted in costs to the economy which are multiples of this defence uplift? What is the point of an integrated review, dismantling DfID even before the review began and this announcement before it concludes if we do not know what challenges the Government think we face and how we might tackle them with our allies? Does she think that global Britain is enhanced or undermined by cutting the development budget?

As I said, we have already worked through the main findings within government to inform this announcement and they are the first conclusions of the integrated review. The Government are working to ensure that we have an integrated strategy. As I have said to a number of noble Lords, that will be published in its entirety in the new year.

My Lords, the investment in space and cyber is most welcome. Many of the skills required are already held in the private sector, so will this review provide the catalyst to implement the whole-force approach? Is this not a golden opportunity to reset the relationship between defence and industry into one of genuine partnership?

My noble friend is absolutely right. That is certainly what we intend to do. On AI, for instance, the MoD is working with partners across government, UK industry and academia, and will invest in AI hubs to test and develop new models of collaboration and co-creation. On space, Space Command will be staffed jointly from the three services, the Civil Service and key members of the commercial sector, and will bring together three functions: space operations, space workforce generation and space capability. Such working together, as my noble friend set out, is at the centre of our approach, particularly in these new and emerging technologies.

Although the UK will still be spending a smaller percentage of its GDP on its defence than at the end of the previous decade, I welcome the financial settlement and the commitment to new and emerging technologies. However, conflict tends to bring with it rather unpleasant surprises. Will the noble Baroness the Leader therefore confirm that the four structures and processes that will be set out in the integrated review will retain the necessary agility and adaptability to enable us to respond effectively to those things that we did not or could not foresee?

The noble and gallant Lord is absolutely right. Flexibility and being able to adapt to emerging threats are certainly at the heart of what this review will look to do. A lot of our investment in new technologies is based on the very issues that he raises: that we need to be able to adapt, because what we face now may not be what we face in years to come. We are all cognisant of that.

My Lords, it is 53 years since the British Government announced our withdrawal of forces from east of Suez, and we well know that our current Prime Minister wants nothing better than to move an increasing proportion of our forces back east of Suez. All the report says about that is that we will be extending our influence, but it does not tell us what influence over whom. Do we intend, as we build up our Gulf base, to defend Saudi Arabia against Iran? If we are to send a carrier task force next year into the South China Sea, is it our intention to challenge China and would that be good for our trade relations with it?

I join noble Lords in welcoming this significant and long-overdue spending commitment. What impact will it have on job creation in all four nations of the United Kingdom?

As I said in a previous answer, we believe that this settlement will create jobs across the United Kingdom. For instance, in Scotland, we already spend £1.7 billion a year supporting 10,000 jobs, and we are taking forward our plans for the eight Type 26 and five Type 31 frigates currently being constructed on the Clyde. There will be further growth of jobs in Northern Ireland and, we hope, in Wales. This is indeed a good settlement for job creation in the United Kingdom. We want construction on those projects to be UK-led. As I said, we hope that 10,000 jobs a year will be created, with many more within the supply chains, across the UK.

My Lords, I am rather disappointed that one “shoddy practice” can be cited to discredit a whole generation of excellent international development work. What assessment have the Government made of the defence and security implications of the proposed US withdrawal from Iraq and Afghanistan? What consideration has been given to ensure the empowerment and education of women and girls in conflict regions where our past military interventions continue to cause death and destruction in the present day?

The noble Baroness will know our absolute commitment to supporting women and girls in areas of conflict. It is one of the personal priorities of the Prime Minister, and we will continue to work on it. Indeed, it was one of the issues discussed by the Prime Minister with other world leaders at the G20 over the weekend. We remain committed to supporting security and stability in both Afghanistan and Iraq and will continue to work closely with our allies and partners on a collective approach to ensure that.

My Lords, I welcome the commitment to our Armed Forces and the Prime Minister defending our people and keeping the world safe, but it would be a moral, strategic and social mistake if we did not continue our foreign aid at the present 0.7% target. Since we have had such a target, Britain has achieved soft power and saved millions of lives in Africa by reducing the number of deaths from malaria and HIV. I hope that the Government will continue with these projects.

My Lords, on behalf of my noble friend the Lord Privy Seal, I beg to move the Motion standing in her name on the Order Paper. This Motion will allow the House to debate the statutory instrument containing the new national health protection measures tomorrow. The regulations will be published and laid before the House today; they are due to come into force on Thursday. The debate will be extended from the usual maximum of one and a half hours to four hours. These are significant national measures that warrant debate at the earliest opportunity and I am grateful to the usual channels for their support in making the necessary arrangements to debate them tomorrow.

Because of this decision, the consideration of the Medicines and Medical Devices Bill in Grand Committee tomorrow will need to conclude at around 4.30 pm, which is earlier than originally planned. Further dates for this important Bill will be advertised later in the week. The debate on the regulations will take place before both the Joint Committee on Statutory Instruments and the Secondary Legislation Scrutiny Committee have had the opportunity to consider them. I thank both committees for the important scrutiny work that they have been doing in respect of the various health protection regulations and, in particular, for the pace at which they have been doing it. The Government will, of course, take note of anything that either committee has to say when it reports.

I thank the noble Baroness, Lady Smith, and the noble Lord, Lord Newby, for their comments and will attempt to answer their questions. They asked what had changed to mean that we are now looking to introduce these new restrictions. As SAGE said in September in relation to a circuit break, we had to balance the epidemiology against the real damage that lockdowns cause for the economy and people’s mental health, which is something we all acknowledge. We had hoped that the strong local action we were looking to take would get the rates of infection down. It is important to say that the measures have made sure that the R rate is lower than it would have been but, unfortunately, we have seen the rates going up and have exhausted every other tool at our disposal in trying to suppress local outbreaks with local action.

We were presented with national data that we could not ignore. It suggested, for instance, that if we did not take further measures, we could exceed the first wave peak around 20 November, exceed currently available hospital beds around 23 November and exceed surge capacity—capacity freed up from postponing some local hospital services—around 4 December. Data like that meant that the Prime Minister felt that we needed to take further action.

The noble Lord, Lord Newby, mentioned scientific evidence and the data. I should stress that the case for the latest measures was not built around the analysis to which he referred about possible deaths. As I have said to noble Lords on many occasions—I know that everyone is aware of this—a whole series of metrics is involved in these decisions, including the medium-term projections on hospital admissions and daily deaths, as well as the evidence on the ground, which in too many areas, unfortunately, were going in the wrong direction.

The noble Baroness, Lady Smith, and the noble Lord, Lord Newby, talked about the economic support. I am grateful to the noble Baroness for acknowledging the extension of the furlough scheme and some of the other measures we have taken in relation to the self-employed. We have had one of the most comprehensive economic responses of any country, with more than £200 billion of support. She and the noble Lord mentioned sectors that are struggling and need support. I hope that noble Lords will accept that we have moved to try to address the circumstances and support our businesses. We will continue to do that. The noble Lord mentioned the charter and looking at the carers’ allowance. We will of course keep all this under review as we start to see the impact of the latest lockdown as we move towards 2 December.

The new restrictions are being accompanied by additional support through the extension of the furlough scheme, whereby employees receive 80% of their current salary for hours not worked. There is an additional £1.1billion for local authorities to enable them to support businesses in their areas more broadly. We will continue to look at the economic package and there is strategic long-term planning to make sure that we can provide the support needed.

The noble Baroness asked about evictions. From the start of the pandemic, we have provided nearly £1 billion of support by raising the local housing allowance to cover at least 30% of market rents. As she will know, we changed the law to double eviction notice periods from three to six months, allowing someone who is served notice today to stay in their home until May, save for the most serious cases. We will continue to protect renters facing hardship from eviction and set out further details of measures soon.

The noble Lord talked about our relationships with the devolved authorities. I think that there are more similarities than differences in our approaches. For instance, we have all brought in measures at a local and national level to control the virus, mandated closing times for hospitality and brought in social distancing restrictions. We work closely with the devolved Administrations; obviously, the CMOs of the devolved nations talk regularly. However, it is right that they make their own public health assessments and decide what measures they should put in place and are most appropriate.

I assure the noble Lord that we have had hundreds of committee meetings, calls and meetings at official and ministerial levels, and that will continue. We have provided Wales with £4.4 billion of extra funding this year, Scotland with an extra £7.2 billion and Northern Ireland with an extra £2.4 billion through the Barnett guarantee. We are working as a United Kingdom as we tackle this terrible pandemic.

Both the noble Lord and the noble Baroness rightly asked about the end of the current restrictions. As the Prime Minister has said, these measures will be time limited, ending on 2 December, which is when the SIs that we will debate tomorrow will expire. At that point, we will review the restrictions, which will be eased on a regional basis, according to the latest data. Of course, the aim of this action is to get the R number down now, beat this surge and use this opportunity to exploit the medical and technological advances we have made. For instance, I am sure noble Lords have seen the pilot in Liverpool of the mass city testing as well as the better drug treatments that we have and tackling some of the issues we have seen with test and trace.

The R rate is lower as we move into this new phase than it was in March, so we are confident, knowing that the great British public will stick to these rules, that we will have a good reduction in the R rate and that we will be able to come out of these restrictions. I cannot predict what will happen after 2 December, but I assure noble Lords that we will work to make sure that everyone has as much clarity and confidence as they can.

My Lords, the Government have a very difficult task indeed, and I ask my question simply in a spirit of inquiry. I am puzzled by the latest graphs, to which the noble Lord, Lord Newby, referred: the four winter scenarios shown to the country by Patrick Vallance on Saturday, showing deaths totalling 4,000 a day. Is this really a realistic possible figure, considering that the previous realistic worst possible case forecast was 800 a day? The daily death rate was 1,000 in the first wave, and this figure is well above the daily death rate of a country like Brazil. Why is the second wave forecast to be so much worse than the first? Was lockdown ineffective and just temporary or is it, as the Deputy Chief Medical Officer suggested yesterday, just in the nature of the virus that the second wave would be worse? If so, why was this not predicted in previous forecasts and why did anyone ever talk about defeating the virus?

I thank my noble friend. I hope that I mentioned, in my response to the noble Lord, Lord Newby—and I should stress this—that I believe the Chief Medical Officer and Chief Scientific Adviser are giving evidence to the Commons Select Committee at the moment to say that the case for the latest measures was not built on the analysis of deaths that the noble Lord mentions. This was not a prediction but just one of the possible worst-case scenarios. My Lords, the situation facing the country is gravely concerning and we all have a collective responsibility to avoid over- whelming the NHS with the spread of the virus. Churches and faith communities continue to play a crucial role in supporting their local communities. The social and economic support of churches has been estimated at more than £12 billion a year. In my diocese, many churches have offered emergency food and essential supplies to those in desperate need as part of the love your neighbour initiative. It is pleasing, therefore, that the Government have recognised the significance of this contribution by permitting places of worship to continue to offer such essential services during lockdown. I also welcome the provision for private prayer, broadcast and the continuation of funerals.

However the most reverend Primates the Archbishops and the right reverend Prelate the Bishop of London said in their letter to clergy this weekend:

“The sacramental life of the church cannot be seen as an optional extra.”


Access to the sacraments and communal worship are essential to sustain us with much needed hope at this time and to strengthen our commitment to social action. Yet more is needed: people need to be married and not just buried. I am glad to say that we are not exactly in the place where we were in March. Many clergy have worked hard to ensure that places of worship are safe places to be. Today our Archbishops, the Cardinal, the Chief Rabbi and other faith leaders have written to the Prime Minister to say that the continuation of public worship is essential. Will the Minister commit to review the blanket ban? If not, will she publish the evidence used to justify this decision?

Lastly, given the lack of consultation with faith communities before this announcement, can the Minister provide assurances that the Government will consult the churches and other faiths in advance of future decisions such as these?

Of course we recognise that religious practice is of fundamental importance to millions of people across the country. That is why we are enabling individual prayer in places of worship for those who practise that way. We absolutely understand that, for people of faith who take part in communal worship, it will be extremely disappointing news that it cannot continue for the next month, and, of course, it will be difficult for those whose festivals fall during this time. We entirely understand the issue, but we are committed to ensuring that we work collectively to bring the R rate down so that in December we can, we hope, start to get back to normality once we have suppressed the virus, which is what we are all intending to do.

My Lords, I draw attention to my registered interests. The lockdown for the coming month in England must achieve a substantial reduction in coronavirus circulation in the community so that hospitals are not overwhelmed by Covid-19 admissions and are able to continue to admit Covid-19 and non-Covid patients requiring urgent and elective care in future. How will Her Majesty’s Government use this one-month period better to prepare our National Health Service and our public health systems to secure these objectives so that further lockdowns will not be necessary?

The noble Lord is absolutely right. Concerns about pressure on the NHS were one of the key drivers behind the decision made as well as the fact that, unfortunately, we are seeing in some areas of the country a small number of non-elective procedures having to be cancelled, and we absolutely do not want that to happen. That is why during this time opticians, pharmacies and GPs will stay open, and we will continue to urge people who need any type of medical opinion, attention or treatment to continue to attend appointments and see professionals. We are ramping up testing capacity. We are providing millions of items of PPE, £3 billion of funding to make sure the Nightingales can provide surge capacity and £300 million to make sure that departments have the funding they need to upgrade ahead of the winter and ensure that the NHS is not overwhelmed.

My Lords, as part of Saturday night’s slide presentation, the Chief Medical Officer and Chief Scientific Adviser made it clear that the Covid-19 hospital admissions rate is the key factor in deciding on a new national lockdown now. Has the bed and ventilator capacity offered by the Nightingale hospitals been taken into account when calculating admission rates compared to the last peak and surge capacity in our NHS?

My Lords, financial support is essential to compliance with lockdown. At the start of the Welsh lockdown, the Government declined the Welsh Government’s request for early access to the job support scheme, despite Wales offering £11 million towards it, and declined a request to widen eligibility for the job retention scheme. Now that the job retention scheme has been extended and includes workers recently made redundant, will support be backdated to 23 October for Wales and be guaranteed for future lockdowns, if needed, in the devolved nations?

My Lords, can the Minister confirm that local authorities now get sufficient information and data to know where their centres of infection are? Will the Government commit today to working with them to ensure that they have the resources to bear down on those places, whatever they may be, so that they can confidently be prepared to come out of lockdown and to keep on top of that? That means that they will need to be on top of test, track and trace in that more dangerous time after lockdown in particular. Local authorities have shown that they can do track and trace effectively. Why do the Government not work with them in a more trustworthy way and give us all hope that we can get out of lock- down and begin to deal with this virus more effectively?

I entirely agree with the noble Baroness. We are working very closely with local authorities, and they do indeed have significant resources and powers to do local contact tracing. In fact, there are more than 128 local authority contact tracing teams in place around the country, with more to come. I am sure she will be aware of the Liverpool pilot scheme, which we are hoping will be successful and roll out. Everyone living and working in Liverpool will now be offered a Covid test, whether they have symptoms or not. Whole-city testing aims to protect those at highest risk and find asymptomatic cases in order to prevent and reduce transmission in the community, exactly as the noble Baroness said. If this approach works—and we are looking to roll it out—we are hopeful that it will play a significant role in doing exactly what the noble Baroness says in helping to make sure that local authorities and local areas can bear down quickly and effectively on outbreaks within their area.

My Lords, yesterday the Prime Minister, in his characteristic style, said that the same terms would be available to Scotland if it went into lockdown later than England, yet this seems to be have been qualified by Robert Jenrick today, who said that it was a matter for the Chancellor. Scotland is watching to see whether the current restriction levels will bring about a sustained fall in the infection rate or whether more stringent measures will be needed. I am happy to acknowledge the £7.2 billion of additional support provided by the Treasury to Scotland, but we do not want a lockdown just to qualify for furlough, so clarity is needed. Will the same support now being given to England be available to Scotland if it has to follow the same route on a later timescale beyond 2 December?

I am grateful to the noble Lord for acknowledging the £7.2 billion of funding for Scotland. This intervention has saved nearly 1 million jobs in Scotland, which I am sure is very welcome. As we have said, the furlough scheme is a UK-wide scheme, and it will always be there for all parts of the UK.

My Lords, I would like to make a small plea about the NHS. There was a very good statement today from Professor Stephen Powis on the actual position facing the NHS. Accurate information is essential to keeping the confidence of the public, as has been said already today. Sometimes it seems that what is happening in the NHS is slightly cloudy behind a lot of other information—scientific information in particular. Will my noble friend encourage the NHS to go on telling us exactly what is happening within its own front line and make sure that, when it does, it gets properly publicised?

Across the House, we pay tribute to all staff in the health service, from doctors and nurses to cleaners and security, who have done so much over the last few months. I cannot imagine the strain they must be feeling at the moment. Data from the NHS is critical. One of the key things we are trying to do in taking these measures is to ensure that the NHS is not overwhelmed and continues to provide fantastic service, support and care for all members of our society.

My Lords, like other noble Lords, I welcome the reintroduction of schemes put in place during the first lockdown to protect livelihoods. However, thrown into sharp relief is the absence of a shielding programme this time. This puts people with disabilities and others vulnerable to Covid in a difficult position. It makes going to work a choice for them or their employer, with all the risks that entails. It increases financial peril and makes access to appropriate care a greater challenge. Can the noble Baroness explain why, when support programmes to protect livelihoods have been reintroduced, a formal shielding programme to protect lives has not?

We learned from the first lockdown that shielding, as I am sure the noble Baroness is aware, can have a considerable impact on mental health and well-being. That is why we decided, at this stage, not to ask people to shield in the same way again. However, we accept that the clinically extremely vulnerable, in particular, will need to minimise their contact with others and not go to work. We are providing over £32 million of extra funding to enable local authorities to provide support to that group, which needs it, including by helping people to access food and meeting other support needs to enable them to stay at home. We have balanced the experience from the first lockdown and its impacts on mental health and well-being with the decision not to suggest shielding, at this point.

My Lords, I share the view in the Statement that it was right to try every possible option to get the virus under control at the local level. As the Minister reported, there have been some successes there, but we did not make the progress we should have, overall. Unfortunately, political wrangling has not gone down well with the public, who are getting tired of seeing it. If the Government intend, as they state, to adopt a pragmatic and local approach again in the months ahead, is one of the lessons learned that this might be more successful if the Government seek to bring all the political parties, at all levels, into the process? Would the noble Baroness consider a joint plan of action along the lines suggested by her colleague and former Minister, the noble Lord, Lord Bridges of Headley?

The noble Lord is right that we need co-operation locally and nationally. The Liverpool pilot that I mentioned is starting specifically as a local partnership, with central government support. That was requested by the leaders of Liverpool. We hope that we can roll out this model across the country, with the effects that it will have from its ability to find and bear down on the virus locally. It is absolutely about local and national partnership.

My Lords, the tourism and hospitality industries have been thrown into confusion by the latest announcements. Tour operators, conference and events organisers, coach operators and language schools are important components of the travel industry. Will these firms be eligible to claim either the local restrictions support grants or any of the £1.1 billion given to local authorities to support businesses?

Both the pots of money the noble Baroness mentions are under the control of local authorities, and it is entirely up to them to decide which sectors or types of business to support in their area. It is within their gift to provide support, if they have businesses in those sectors, as the money is for them to provide to local businesses, which they know best.

Such a plan must mean very limited social contact if we are to keep schools and businesses open and the economy moving, so does she also agree that it will not help to talk of a return to normal any time soon?

I think we are all aware that, as I said, we will review the restrictions on 2 December and look to ease them on a regional basis, according to the latest data. The Chief Scientific Officer has been clear that we will not be going back to normal in four weeks’ time—if we can remember what normal is now. My noble friend is absolutely right: we want to use this time to make sure that we provide the drugs that have proved to be quite effective and, as I said, start new pilots such as the one in Liverpool, so that we are able to bear down in a more effective way. We must use this time to bring the R rate down and make sure that we have the tools available to keep it down, so that we do not have to go back to further national measures such as these if we can avoid them.

My Lords, I have a quick thought, having listened to the Mayor of Liverpool this morning, about not counting into the statistics those who have multiple tests and were shown to be Covid-free first time around. Thinking of the future with hope, will the Government press for an expansion of the no-tariffs WTO pharmaceutical agreement and an acceleration of the implementation of the WTO trade facilitation agreement? What are the Government planning in preparation for a fair and equitable distribution of any Covid vaccine worldwide that leaves a positive legacy on the global trading system, particularly in relation to no tariffs on medical supplies and to efficient, digitised customs and borders?

I am not sure I heard everything the noble Lord said, so I will go back and check. I think he was talking about the economy, but if I have got that wrong, I apologise. We have put in place one of the most comprehensive economic responses of any country, with more than £200 billion of support. We have protected 12 million jobs through the furlough and self-employed schemes, and we will continue to provide all the support we can to businesses that are struggling at this time.

Yes. Part of the reason behind that is that the number of younger people testing positive is falling, particularly among the university student population. Universities should certainly be congratulated on the work they have been doing, but I point out to my noble friend that the over- 60s rate, which then correlates with future hospitalisations, is still rising.

I welcome the more generous level of support to self-employed people announced by the Chancellor, but the 3 million self-employed people who were disqualified from receiving support earlier this year remain so. Given that many of these people are now hungry, as we have seen in Feeding Britain, which I chair, and are having to use food banks for the first time in their lives, will the Minister urgently review the eligibility criteria?

As I have said, we have put in place a comprehensive economic package but the noble Baroness is right that some people have not benefited from certain schemes. My Lords, do the Government recognise that it is crucial what they do with the breathing space that this lockdown is providing? In that context, did they listen—as I hope they did—to what our former Prime Minister suggested on the “Today” programme yesterday? He said that we should roll out vaccines as soon as we know they are safe, before we know how effective they are; push out experimental therapeutics as long as they are safe; get a grip on the data confusion that exists; and appoint a Secretary of State for Testing to sort out track and trace, just as Churchill appointed Max Beaverbrook in the Second World War to handle aircraft production.

We have secured early access to 350 million vaccine doses through agreements with six separate vaccine developers, and are investing more than £140 million to make sure that we are ready to manufacture a successful vaccine. We are planning for rollout, making sure that we have adequate transport, PPE and logistical expertise. I assure the noble Lord that, at the forefront of what we are doing, we are working towards making sure that we can take advantage of vaccines when they reach the stage when they can be used.

As we have said, we want track and trace to improve and need faster testing turnaround times. They are improving but I accept that we need to do more. As I have said, the testing pilot in Liverpool is another way in which we hope we will be able to use the time over the next month. By testing a large proportion of a single town or city, more positive cases can be identified and people can be told to self-isolate immediately. The residents and workers of Liverpool will be tested using a combination of existing swab tests and the new lateral flow tests that can turn around results rapidly, within an hour, without needing to be processed in a lab. With all these things together, we will make use of this time to see how much we can roll out so we can really bear down on this in December.

My Lords, I think the Cabinet may come to conclude that national lockdown is not the answer. However, let us look forward. When adopting Covid measures in future, can the Government please set out, in a straightforward way, the expected cost-benefit analysis in numerical terms, including not only the number of delayed Covid deaths and hospital admissions but estimates of the economic costs and the cost in other lives lost, as NHS treatment for other diseases is necessarily limited as a result?

My Lords, I welcome the Government’s stated intention to mass test. What percentage of the population tested in Liverpool would be considered a success, and are the Government looking at the Slovakian example, where being tested is mandatory for all?

Everyone living and working in Liverpool will now be offered a Covid test, whether they have symptoms or not. Testing will begin this week and, as I mentioned in a previous answer, the pilot is being undertaken at the request of and in close collaboration with local leaders. The aim is to better control the spread of the virus and, as the noble Earl rightly says, gain more data about the number of cases across the city, so that even more targeted action can be taken and people find out the results of their test very quickly. Then they will know to self-isolate and will not perhaps unwittingly spread the virus.

My Lords, the Minister will be aware that many people have relatives, often aged parents, in care homes, and are unable to visit them because of the restrictions imposed. This is causing a great deal of pain. If we can test all the people of Liverpool, as I welcome, could we not have a rigorous testing programme where all people who have relatives in care homes can be tested so that they can visit their relatives, who often have dementia and are very lonely and isolated?

The noble Lord is absolutely right, and this is perhaps one of the most—of so many—heartbreaking situations within this pandemic. He will know that regular testing is now available for all care homes, which includes weekly testing of staff and monthly testing of residents. He is absolutely right—in this pilot in Liverpool the aim is to do this, but then to look at being able to roll out this sort of testing within the NHS and care homes so we can do exactly as he suggests.

My Lords, I thank the noble Baroness the Leader of the House for responding to questions on the Prime Minister’s Statement. Although we are discussing a Statement barely 48 hours after it was made, things on the ground, as the noble Baroness, Lady Smith, has said, have moved on apace since Monday. Infections have risen, deaths have risen rapidly, and people have become more confused and more worried.

In the Statement, the Prime Minister said the Government are seeking to balance the

“objectives of saving lives and protecting the NHS while keeping our children in school and … protecting jobs and livelihoods.”—[Official Report, Commons, 12/10/20; col. 23.]

What he did not do was level with the British people about what his scientific advisers have been proposing. We now know that last month, SAGE urged an immediate circuit breaker of more restrictive measures, because, as the noble Baroness said, and in its words,

“not acting now … will result in a very large epidemic with catastrophic consequences.”

That was several weeks ago. No action was taken, and we do now have a “very large epidemic” on our hands. That is why my colleagues in the other place and those on these Benches support the leader of the Opposition’s proposal for a short circuit breaker, to give time to get firmly in place some measures to get the virus under control, in the hope that we might have some relaxation—albeit possibly temporarily—at Christmas. I have never seen the Prime Minister as one of nature’s Roundheads but as things stand, he looks set to succeed and follow Oliver Cromwell by cancelling Christmas as we know it.

The one welcome change in the Government’s position over recent days is that they have been willing, for the first time since March, to have a serious dialogue with civic leaders in those areas most heavily affected by the virus. This is extremely welcome but long overdue. However, it needs to go much further. The national test, track and trace system is failing, and failing badly. A large proportion of people who have been in contact with someone who has tested positive are still not being contacted. Some 27% of those asked to isolate do not do so. Will the Government now effect a step change in the role they give to all local directors of public health to implement the track, trace and isolate system in their areas? Will they do so across the country and not only, as currently envisaged, in very high-alert areas; and will they give them the resources they need to do the job properly? If they do not, I fear we are simply going to see a large increase in the number of areas requiring the highest level of restrictions.

The Prime Minister’s Statement seems to bring clarity to an extremely confused picture, but it simply does not. It is completely unclear, for example, on the criteria the Government will use to decide which areas fall into the “very high”, “high” and “medium” categories. Can the noble Baroness tell the House what those criteria are?

The Prime Minister said the measures announced on Monday could lead to additional measures if local government leaders agreed. What measures do the Government have in mind? What happens if the Government think additional measures are needed and local leaders do not? Equally, if local authority leaders think that more restrictive measures should be imposed in advance of any government initiative—as is now the case with Essex County Council, and which is, I believe, the policy of the Mayor London—what will the Government’s response be?

The Government have briefed that they are preparing to open some of the Nightingale hospitals. It is widely believed in Yorkshire that, as far as the Nightingale hospital in Harrogate is concerned, this will not happen, because the hospital simply does not have the staff available to allow it to operate safely. Can the noble Baroness assure the House that this is not the case?

The country is now at a very dangerous point. The Government are at odds with their own scientific advisers, many council leaders and many of their own Back-Benchers. Their rules are complex and, in some cases, perverse. Track and trace is a shambles: it has lost the confidence of the majority of the population. It is time for a reset.

I thank the noble Baroness and the noble Lord for their comments and questions. First, they are right to point out some of the statistics to highlight the situation we are in. As the noble Baroness rightly said, there are now more people in hospital with Covid than when we went into lockdown on 23 March, and the number of people testing positive for Covid has quadrupled in the last three weeks, so we are very cognisant, as I know we all are in this House, of the issues that face us.

The noble Lord and the noble Baroness referenced the need for action in September. We did take robust and proportionate action when introducing measures in England, including the rule of six and the 10 pm curfew, which we discussed in this House, as well as advising people to work from home when they can. Each of those was carefully judged to protect lives and reduce transmission, while minimising the impact on people’s livelihoods.

So, we did take robust action, but with the step change in cases, more action is needed, which is why we made the decision to move to the tiered approach. The reason we have gone for the tiered approach rather than the circuit breaker is that, as the Prime Minister said to the leader of the Opposition at Prime Minister’s Question Time today, the disease is appearing more strongly in some areas and regions than others, which is a different situation from March. That is why we are introducing this approach, which can be tailored more effectively to local situations. However, having said that, we regularly, and will regularly, keep measures under review to ensure that we are always taking the best action we can.

The noble Lord and the noble Baroness mentioned evidence. Evidence is considered by SAGE and its advice is published regularly online when it is no longer under live consideration for policy decisions. That is exactly what happened in this case. I hope I can reassure noble Lords that we will continue to take advice from a wide range of scientific and medical experts, as we have done throughout the pandemic, to inform our decisions. We are, as the noble Baroness rightly said, constantly having to evaluate the balance between protecting the NHS, saving lives, keeping our economy moving and keeping our children in school. These are very difficult issues to balance and I think the tone of the noble Lord’s and the noble Baroness’s questions, which I very much welcome, expresses the gravity of the situation and the difficult decisions that are being made.

I can assure the noble Baroness that as a member of Cabinet I have regular briefings, along with my Cabinet colleagues, from the Chief Medical Officer and the Chief Scientific Adviser about the latest data. As I have said, the Prime Minister and the Cabinet have to take decisions based on the best available science, along with considerations of the economic, operational, social and policy implications that follow, and that is what we do.

The noble Lord and the noble Baroness both reiterated criticisms of the test and trace system. I remind noble Lords that our daily capacity for testing is now around 340,000, with the aim of reaching more than 500,000 by the end of October. We increased capacity by around 30% in September alone. We are testing at a higher rate than other European countries and we have assembled the largest testing network in our history, including 96 NHS labs, 151 walk-in sites, 258 mobile testing sites and 77 regional sites. We are also looking to combine, as effectively as possible, the national framework and local expertise, which is why, since August, NHS test and trace has provided local authorities with dedicated teams of contact tracers to work alongside local public health officials to provide a more specialist service. We have provided more than £300 million to local authorities to help with this and, across the country now, we have 95 local authority contact tracing teams that are live, and more are coming online in the coming weeks. We have been very cognisant of some of the criticisms and are improving the situation on the ground. More than 700,000 people have been contacted and advised to isolate through the system and the latest figures show that more than 82% of contacts were reached and asked to self-isolate where contact details were provided.

The noble Lord, Lord Newby, asked about moving between tiers. Decisions on which areas are in which tier are made on a number of factors, including the rate of transmission, how quickly it is increasing and the effectiveness of current interventions, as well as hospitalisations and hospital capacity. Of course, all is also done in line with work and conversations with local leaders to discuss all their evidence and what they are seeing on the ground. It is a collaborative effort, but a range of factors is taken into account.

The noble Lord also asked about the Harrogate Nightingale Hospital. I am not sure whether he is aware, but it is currently being used. CT scanners have been made available to provide people with safer and faster access for a range of conditions, including cancer. As he will be aware, there are two hospitals providing that kind of support, Harrogate and Exeter, and another three Nightingale hospitals in some of the areas with the highest rates have been put on standby in order that they can play their part, along with the rest of our fantastic NHS, as we deal with this crisis.

My Lords, I welcome the Statement made on Monday in the other place by the Prime Minister. However, I have received lots of correspondence from people who are confused, very angry and very concerned. This means that their mental health is actually off the scale. My concern, therefore, is that the area that I live in, in Liverpool, is in a high tier and everything has been shut down. One place that a lot of people like to go to is gyms, and while they appreciate that there has been recent overcrowding, these businesses have invested a lot of money to be Covid-friendly. This morning, the Northern Ireland Assembly has said that from Friday they will be in a four-week lockdown, but gyms are allowed to be open on a one-to-one basis. What conversations has the Prime Minister had with the mayors of Liverpool to discuss how we can keep certain businesses open, so that people have safe spaces for their anxiety and their mental health?

I thank my noble friend. Certainly, the Prime Minister, the Secretary of State for Health and Social Care and the Communities Minister have all had regular dialogues with the leaders of the Liverpool City Region over the last few days. She is absolutely right that within the very high tier there are certain baseline restrictions and then others that can be decided at a local level. She is right that in Liverpool, decisions have been made to close casinos, betting shops, indoor gyms, fitness and dance studios and sports facilities, although there are going to be exemptions for organised indoor team sports for disabled people and activities for under-18s, understanding some of the issues she raised. Obviously, she is absolutely right about mental health, which is why we have provided £9.2 million of additional funding for mental health charities.

My Lords, it is generally accepted that the test, track and isolation policy is important for suppression of the virus. Despite the large volume of tests that we carry out, as the noble Baroness stated, plus the increase in capacity, we have not seen any significant effect in suppression of the virus through this policy, so what more needs to be done to make our test, track and isolation policy more effective? Furthermore, does the Minister agree that any policy, suggested by some, of abandoning suppression of the virus and adopting a policy of herd immunity is morally, ethically and scientifically flawed?

On test and trace, I hope I outlined in my earlier answers the work that is going on to further improve national and local link-up. As I said, across the country there are now 95 local authority contact tracing teams—21 local teams in the east of England, for instance, 23 in the east Midlands and 21 in the north-west. Combined with the national system, they are helping to ensure that we have good data on the ground so that we are able more effectively to track what is happening and then, with the tiered approach, make sure that the interventions work on a regional or even more local level.

In welcoming the fact that places of worship have been allowed to continue to open—that is partly a recognition of their important place in the life of the nation—I note that the Prime Minister spoke still in the binaries of economic health and medical health that we have heard throughout the course of the pandemic. However, the nation’s health is more than this binary. The Government must surely no longer overlook the need to protect the nation’s social and spiritual health too. The Christian faith is clear that well-being is far more than being medically healthy or simply alive; rather, it involves social engagement, emotional nourishment, spiritual rest and love from good community. Will the Government acknowledge the nation’s need for social and spiritual health by including experts on social well-being in all future conversations around lockdown measures?

I agree with the right reverend Prelate that that is the dilemma being faced. As he rightly says, harm to health is harm to the economy and harm to the economy is harm to health: these things are all interlinked, which is why this is a very difficult situation and why difficult decisions are having to be made about how to balance them. I can assure him that that is at the forefront of our thoughts. As part of the ongoing discussions around decisions being made about national and local levels, I know that Cabinet colleagues and the Prime Minister are talking to a huge range of people with different backgrounds to make sure that we get that right and get the country moving in the right direction.

I can certainly assure the noble Baroness that discussions are ongoing across government, including through the Treasury and the Business Secretary, with local leaders, local business leaders, unions and workers’ representatives. Of course, she will be aware that, as part of the announcements we have made, we have extended the job support scheme. She will also be aware that, since the beginning of the crisis, we have provided more than £200 billion of support to business. We completely understand, and by using these figures I am not trying to diminish the issues that people are facing in their daily lives, but I can reassure her that this is top of our agenda. I hope she will recognise that the Chancellor has been working fleet of foot so that he is able to bring forward support packages to help individuals and businesses through this difficult time.

My Lords, I spent quite a lot of time yesterday afternoon looking at the detailed infection figures for Covid for each Lancashire district on a daily basis over the last 10 weeks. It is absolutely clear that the first main surge of infections occurred during September, particularly around the middle of September. On 1 September the schools went back, and this seems to be the topic that we are not allowed to talk about. The Government have said they are not going to close schools under any circumstances. I am not saying that the statistical correlation—which is clearly there—is a causal one; I am saying it needs to be looked at hard and investigated. I notice that Northern Ireland is closing its schools for a fortnight. Will the Minister forecast how long it will be before schools in the most affected areas in England are closed?

Within the very high tier—the top level of the new interventions—non-essential retail, schools and universities will remain open. They remain open at all levels. As the noble Lord rightly said, we have prioritised keeping schools open as one of the key things we wish to do because, as we have heard in previous debates in your Lordships’ House, the disadvantage to young people when schools close is something that we really do not want to repeat, having seen what happened earlier in the year. I am afraid I will not make any apology for the fact that we have put that at the top of our priority list.

If saving lives is a key criteria, will my noble friend commit Her Majesty’s Government to ensuring that no hospital patients will be discharged to care and nursing homes unless they have had a negative Covid test? Furthermore, will she commit that no persons may enter those homes, including inspectors, unless they have had a recent Covid test? Finally, if any of these homes should be in considerable financial difficulty, will she commit that Her Majesty’s Treasury will support them until the pandemic is over?

My noble friend is absolutely right to talk about care homes, and I can certainly reassure him that no care homes should be forced to admit residents they do not feel they can provide appropriate care for. Also, all individuals must be tested before discharge from hospital into a care home. I hope I can reassure him by letting him know that we have provided over 208 million items of PPE and are giving every care home free PPE until at least the end of March. We are also piloting weekly testing for professionals who visit care homes regularly and come within one metre of residents when carrying out their roles, so that we can do everything we can to ensure that infection rates do not rise exponentially within that sector.

My Lords, I draw attention to my registered interests. The noble Baroness the Leader of the House made reference to Nightingale hospitals. Is she in a position to advise your Lordships on what measures were taken and how the Nightingale hospitals have been prepared during the summer months, with specific reference to the provision of protective equipment, clinical equipment, advanced therapeutics and, most importantly, human resource staff, so that they are now immediately able to make a contribution to the management of this second wave of Covid-19? In particular, I ask if, and how, a clinical protocol has been established to ensure that the Nightingale hospitals can be deployed for the management of not only Covid-19 but other diseases, in such a way that the NHS can continue to deliver?

As I mentioned in reference to a comment by the noble Lord, Lord Newby, CT scanners have been made available—for instance, in Harrogate and Exeter—to provide safer, faster access for people with a range of conditions, including cancer, so that we can continue to try to ensure that routine appointments and operations can still take place. As I also mentioned, three other hospitals are now on alert in areas of high prevalence in order that they can come on stream. Obviously work is going on between the Department of Health and NHS England, but they will be staffed from the local area. We will of course keep all of this under review because we know that capacity is important, and the Nightingale hospitals will, I am sure, once again play an important part in our response as we go forward.

My Lords, given the threat to jobs from measures set out in the Statement, can the Leader of the House say what the Government intend to do to prevent higher levels of unemployment? In replying, can she tell the House what proportion of jobs will be supported by the Job Support Scheme, and who will still miss out in the extension of the Self-employment Income Support Scheme?

First of all, our Job Support Scheme is in line with those of other major European countries, including France, Germany, Ireland and Italy, in its proportion of wage support. We very much believe that this scheme can help the lowest paid in particular, who can benefit from the responsiveness of our welfare system. The dovetailing of those two things should actually mean that some of the poorest workers—or those on the lowest pay, I should say—could end up on around 88% of their original income, and so more than the two-thirds on which the scheme itself is based. Obviously, businesses are able to top up the two-thirds as they wish, as they did for the furlough scheme.

However, I think the Chancellor has been quite clear: unfortunately, we are not going to be able to save every job. We will do all we can to support businesses and individuals. That is why we are trying to look to the future with, for instance, the £2 billion Kickstart scheme, which will create thousands of subsidised jobs for young people; paying employers to hire apprentices; and doubling the number of work coaches. We are very cognisant of the issues in this area, and have a range of things—both trying to protect jobs at the moment and looking to the future—to make sure that everyone has an opportunity for employment going forward.

My Lords, it is now clear that lockdowns do not solve the problems posed by the virus. They merely delay them, at enormous cost in money, running into tens of billions; unhappiness, brought on by loneliness; and, indeed, lives lost, due to the consequent neglect of other medical conditions. We need to avoid another national lockdown at all costs. Instead, we need to deal with the virus regionally, as the Government are now doing. Will the Government ensure that any local controls are adapted very quickly to take account of developments? Speed is of the essence—I think everyone agrees about that—and we are not yet as quick as we need to be.

I entirely agree with my noble friend. That is the basis of the thinking behind the very high tier in particular, where restrictions can be dovetailed to the specific circumstances of the individual region. I can assure her that PHE, the Joint Biosecurity Centre and NHS Test and Trace are constantly monitoring levels of infection and data across different areas of the country, so we can do exactly as she suggests.

My Lords, a second national lockdown would be devastating for our economy, so it is right to prioritise bringing infections under control. As president of the CBI, I know that business supports the simplification of the Covid rules with three tiers of restrictions. But does the noble Baroness the Leader of the House agree that the Government must show more of their evidence base for the new restrictions? This includes the 10 pm closing for restaurants, bars and pubs, where, I am led to believe, less than 5% of new infections come from. Why do we still need the 10 pm rule? Will they also keep financial support under review, in lock-step with the severity of the restrictions? The noble Baroness the Leader of the House mentioned testing. It is admirable that the testing has gone up from 2,000 to 350,000, and soon to 500,000, but she has not mentioned mass testing. Could she talk about mass testing—

Very quickly, analysis from PHE and NHS Test and Trace suggests that pubs, bars, restaurants and cafes account for the highest rates of common exposure for Covid, especially in those under-30. We will of course continue to keep an eye on financial support, which we have continued to do. I am afraid I did not hear the third part of the question.

My Lords, the House will have noted that the Leader of the House, in answering the questions put by my noble friend Lady Smith, did not answer the specific question of whether or not the Cabinet was aware of, or saw, the SAGE advice for 21 September before the decision was taken to have a lockdown. Perhaps the noble Baroness could answer that now. Perhaps she could also say why the Prime Minister, having relied so heavily on scientific advice, chose on this occasion to ignore it and to ignore the warnings about the catastrophic position if it were ignored.

I have never and will never comment on Cabinet meetings, so I have said as much as I can in answer to the noble Baroness. I also said, with regard to the decisions being made, that we will continue to take advice from a wide range of scientific and medical experts, but we will also have to look at the wide economic policy implications of decisions. That is why we believe that the tiered approach, which comes into effect only today, is correct at this time.

My Lords, the Prime Minister is right to have resisted the call by some for a return to a full lockdown, and I congratulate him on insisting on retaining a balanced approach. However, it is important to note that the death toll, while rising, is nowhere near the same percentage of known infections that it was in late March. That suggests that the mortality rate attributable to Covid alone is lower than we thought at that time. If the mortality rate remains at a relatively low level compared to infections, can my noble friend confirm that the Government will take early steps to lift restrictions on the hospitality and other affected sectors, providing a platform for economic recovery?

I can certainly assure my noble friend that our priority is to ensure that we bear down on this. As I said, the number of people testing positive for Covid has quadrupled in the last three weeks, there are more people in hospital with Covid now than there were when we went into lockdown and, worryingly, infections among older people are rising. However, of course, part of this tiered approach is very much also to ensure that businesses such as hospitality can function in areas where the disease is perhaps not as prevalent in the community.

My Lords, the Government’s overriding objective must be to reduce both the direct threat to life from Covid-19 and the indirect threat of an overwhelmed health service being unable to help those with other serious conditions. It is an affront to many that the risk to life and the hardship caused by pubs closing at 10 pm is talked about in the same breath. A short, sharp shock approach is clearly needed to reduce a rapidly rising reinfection rate to less than R1. Will the Government now urgently consider something like a two-week national lockdown to coincide with the half-term break?

The noble Lord will be aware that these new measures came into effect only today, and we believe that they will have an impact. As I said in my initial answer to the noble Baroness, Lady Smith, we have taken this approach because the disease is appearing at the moment more strongly in some areas and regions than others, which is a different situation from that we were in in March. That is why we have introduced this regional, tiered approach.

My Lords, the noble Baroness in her responses has not addressed the fact that, as SAGE put it so starkly, the centralised track and trace system is bringing only marginal benefit in stemming the pandemic in the regions. Despite all the statistics she has offered, is it not absolutely clear that local leaders are still therefore not getting what they have been asking for for months: full access, full support and all the resources they need to put them in the driving seat? When will that happen?

I am afraid that I do not agree with that assessment from the noble Baroness. As I said, local and national government are working together with resources and expertise, and 95 local authority contact tracing teams are now live, with more to come, and we will continue to increase that capacity. However, we are working together, because the only way we can combat this is by national and local government and local leaders working together.

Does my noble friend accept that conceding that a vaccine is a long way off changes the calculation? Mathematically, treating old and young by the same rules ensures that they have an equal probability of catching the disease, other things being equal, whereas a policy of voluntary focused protection would ensure that the elderly and vulnerable are less likely to catch it. Given that young people are very unlikely to die from this virus, does she agree that focused protection may now be the safest route to slowing the spread the virus through community immunity while not destroying young people’s livelihoods and mental health?

Unfortunately, as we have seen in the UK and other populations, a high infection rate among the young population is almost always followed by delayed infection rates in the older and vulnerable population, leading to more deaths. That is why we are not pursuing that approach.

My Lords, is the noble Baroness aware that in Wales large areas are closed down for all but essential travel, so that, for example, people along the north Wales coast between Wrexham, Rhyl and Bangor are banned from travelling to Anglesey for recreational purposes? Yet people from the areas of highest Covid incidence in England, such as Liverpool and Manchester, can travel with impunity to Anglesey as tourists. When will the UK Government start working in co-operation with the Welsh Government in this regard, instead of systematically undermining them?

Obviously, it is for each devolved Administration to make its decisions, although I know there has been a lot of discussion in this area. However, I reassure the noble Lord that, among the restrictions in areas of high incidence, it is very clear that people should avoid travelling in and out of such areas apart from for work, education, youth services and caring responsibilities, and that overnight stays in other areas of the UK as a whole should be avoided. That is quite clear guidance.

My Lords, I have lost count of the number of taxi drivers who have told me that the 10 pm curfew produces too many people on the streets at the same time. Could that be looked at? Will my noble friend also bear in mind that political acrimony does not help to create national unity? Would it not be a good idea if Sir Keir Starmer were invited to No. 10 to sit down with the Prime Minister and discuss all these complex matters?

I agree that we all want to work together to fight this terrible disease. Your Lordships’ House provides a very good model for how constructive discussions can happen. On my noble friend’s point about the 10 pm curfew, public health directors have reported that compliance with social distancing and enforcement of regulations becomes more challenging later in the evening, after people have been drinking. That is part of the reasoning behind the 10 pm curfew, so that drinking does not continue through the evening.

My Lords, the complexities of getting the balance right are immense. While I sympathise with a circuit-breaker strategy that pulls the nation together in regional endeavour and would resolve confusion, why not thereafter reduce risk by restricting or shutting down hospitality but funding it, keeping manufacturing and construction running as normal, and encouraging or even insisting on working from home?

My Lords, we have the highest rate of deaths in Europe and the third-highest in the world. The Government did not take the risks to people in care homes seriously until it was almost too late; they dithered for a couple of months about wearing masks. My question is on test and trace. There are too many examples of delays in getting test results and failure to collect samples from care homes until those samples have to be destroyed. The noble Baroness said that the largest number of people are now being tested. Can she say something about the poor quality control?

I can say to the noble Baroness that, in total, one in eight people in England have now been tested at least once. The average distance travelled for in-person tests is now 3.7 miles, and we continue to return the majority of in-person tests the following day.

My Lords, government Ministers, including the Prime Minister, like to characterise alternatives to their liberty and economy-destroying actions as “letting the virus rip”. Will my noble friend the Leader accept that that is a mischaracterisation of a sincerely held belief that there is a different way to arrive at a difficult balance between dealing with the virus while minimising the wider health, societal and economic impacts? That way has worked in Sweden without any letting rip. Why do the Government refuse to contemplate changing course?

I am happy to acknowledge that there are differing views on how to approach this issue. In fact, today’s discussion has shown that. I believe that everyone is taking their position for the right reasons and because they truly think that that is the best way. As I have said to all noble Lords, we are looking at the advice and are having to make very difficult judgments. The Prime Minister has that weight on his shoulders and it is a very difficult situation to have to manage.

My Lords, the Government have, quite rightly, encouraged the uptake of the flu jab to help to minimise the severity of Covid, but in this area—and in many others—it is impossible to get a flu jab. I realise that she may need to write to me but can the Leader tell me how the sourcing of flu jabs is going, because it is almost impossible to get one in many areas?

The issue is that the flu jab is released in batches so certain amounts are available per month. It is more about flow-through than the availability of the flu jab; that is because it is delivered in batches up to and past December.

My Lords, does the Leader agree that it is important to keep public opinion onside and that, if the public have lost faith in the Government’s policies, they will not respond in the way we want them to? Specifically, why has local government been virtually ignored over the whole period of the pandemic, as have the Governments of Northern Ireland, Scotland and Wales? Surely we must ensure that all local bodies, Governments and Administrations pull together so that the people of this country can have confidence that the Government are doing the right thing.

I assure the noble Lord that dialogue with local leaders at the local government level and between the devolved Administrations is ongoing. There is a lot of working together. Obviously, it is for the devolved Administrations to make judgments on their areas. The Chief Medical Officers also talk regularly, so we are working together closely.

I can also assure the noble Lord that there will be a significant communications campaign about the new tiers. Actually, if noble Lords go on to GOV.UK, there is a postcode checker and some very good, accessible information; we need to make sure that that is getting out to everyone because we need people to follow the rules so that we can hope to turn the tide on the virus.

My Lords, this was the most telling comment from the SAGE meeting on 21 September:

“The more rapidly interventions are put in place, and the more stringent they are, the faster the reduction in incidence and prevalence, and the greater the reduction in COVID-related deaths”.


Do the Government not owe it to the public to spell out for them the consequences for health and deaths of the decision to reject the advice from SAGE?

As I have already said, we took a robust and proportionate approach in September, introducing the rule of six and the curfew. We have done the same again. As I said, our new tiered approach came into effect only today. We believe that it will be effective and we look forward to working with leaders across local government and the devolved Administrations to make sure that we get a grip on the virus and bring it down and ensure that we all follow the rules so that we go into winter in the best possible situation.

My Lords, I wish to notify the House that I have received the following letter from the Clerk of the Parliaments:

“I write to inform you of my intention to retire from the office of Clerk of the Parliaments at Easter next year.


At that point I will have served as Clerk for four years and I think it will be a suitable point to hand over and to ensure an orderly transition to new leadership of the Administration.


It has been an immense privilege to work here in a fascinating variety of roles, since I joined in 1983. I have seen the House evolve and change massively during that time—but perhaps no more spectacularly than now, where the way in which we are currently working is not something most of us could previously have imagined. These last four years as a whole have contained more than their fair share of challenges for the House and the Administration, and I hope that we can continue to build on the positive changes we have collectively made to meet them.


I would be grateful if you could convey my deep appreciation to members in all parts of the House for their generous help and advice to me during my time here. Most of all, I would like to place on record my thanks to my colleagues, the staff of the House. I am indebted to them for their unstinting professionalism and dedication to the House, as well as their support and guidance to me personally.”


In light of the ongoing external management review, I will consult the leaders of the other parties, the Convenor of the Cross Benches and the Lord Speaker, and ensure that a recommendation for Ed’s successor as Clerk of the Parliaments is made to Her Majesty in good time, and of course, as is customary, I will put a Motion before the House nearer the time of his retirement to enable Members to pay a proper tribute to Ed’s distinguished service.

My Lords, I thank the noble Baroness for reading out the letter and for saying that there will be time later in our calendar to thank the Clerk of the Parliaments for his service; there will be an opportunity for further comments then. I am grateful to the Clerk of the Parliaments—to Ed—for the timing of his announcement. That is clearly for the benefit of the House and not for his own benefit, because he will be working throughout the football season and will miss the opportunity to see quite as much of his beloved Charlton as he would like; and because he will be cycling to the House throughout the cold, wet winter, as I know having regularly seen him clad in Lycra. It is helpful that he has set out a timetable and we are grateful for that. We look forward to working with the noble Baroness to choose his successor and to pay appropriate tributes in due course.

My Lords, I thank the Leader of the House for agreeing to answer questions on the Prime Minister’s Statement yesterday.

The Government now face four tough challenges in combating coronavirus. The first is how to act proportionately to drive down infections and deaths while at the same time allowing as much economic and social activity as possible to continue. This is an extraordinarily difficult balancing act but, if the threat is as severe as the scientists believe, I find it surprising that the rule of six remains intact and allows, for example, individuals from six different households to meet in a restaurant, possibly for several hours, with zero social distancing. If I were a generous-hearted soul, I could invite five noble Lords for breakfast, five different ones for lunch and five different ones for supper. That sounds a lot to me. Can the noble Baroness confirm that Professor Whitty argued for stronger measures than those now being proposed? The rules also appear inconsistent. Why can 30 people attend a funeral but only 15 a wedding? That seems bizarre. Can the noble Baroness explain the science behind that decision?

The second challenge is how to identify those with the virus quickly and then isolate them from the rest of the population. Sadly, the Government’s track record on test, track and trace is hopelessly inadequate. It is miles behind the system devised in Germany, where, for example, anyone entering the country by car can have a prompt test at the side of the motorway, the results of which are quickly relayed to a working app, and where localised delays in getting tests done are so rare that they become major news stories. To argue that the German success and our failures have anything to do with our attitudes towards freedom is both risible and insulting. The Government are at least trying to be clearer on those who have priority in getting a test in future. But does the noble Baroness accept that it seems illogical to exclude from the priority list ancillary staff who work in hospitals, care homes and schools? Surely a caretaker, cleaner or member of the catering staff is just as capable of spreading the virus as a doctor, care worker or teacher.

The third challenge relates to persuading the public to adhere to the rules, and the Government have this week strengthened the stick and the carrot. On the stick, the Government have proposed increased penalties, but they are no good without more effective enforcement. The Prime Minister said yesterday that the Government will provide the police and local authorities with the extra funding they need to do this. But will he really live up to his promise? Up to now, the Government have provided extra resources to local government at levels well below what they believe they need to do their Covid work effectively. Will the noble Baroness confirm that the Government will now make funds available to police forces and local authorities at a level that they, not the Government, judge to be required to do their job properly? On carrots, the Government have announced a new £500 isolation support payment for people on low incomes who have tested positive or been told to self-isolate. What is the definition of “low income”, and how quickly and by what means do they intend to get this extremely sensible initiative up and running?

The fourth challenge relates to the additional economic damage that the new restrictions will bring. The hospitality, arts and sport sectors will be particularly badly hit. We are told that the Chancellor and Business Secretary will bring forward further plans to help support those most affected. But the new restrictions bite from tomorrow. So when will the promised new business support measures be announced and take effect? Businesses have a very small cash cushion to keep them going while the Government decide what they are going to do to support them.

Finally, the Prime Minster expressed the Government’s willingness to give the Commons every opportunity to scrutinise government decisions. This is a sound principle but, as the noble and learned Baroness, Lady Hale, forcefully pointed out, Parliament has effectively surrendered its scrutiny role over Covid legislation. The principal Covid Act was passed with barely any debate, and the delay in debating statutory instruments means that by the time we do discuss them they have been in operation for many weeks in most cases. So the scrutiny is, in effect, meaningless.

This deficiency, however, could easily be rectified by the Government. Will the noble Baroness assure the House that future statutory instruments such as the one coming into force tomorrow will be debated at the earliest opportunity? In the specific case of those new rules, and in light of the completion of the debate on the Agriculture Bill yesterday, can she give any reason why the House should not discuss the new statutory instrument tomorrow, in advance of it coming into effect, rather than at a later date when it will already have done so?

For the Government’s measures to work, individuals across the country have got to believe that they are necessary and proportionate. The scientists can set out the objective evidence, but only the Government can decide on the response. Bringing Parliament and the nation with them will be vital in the months ahead. To achieve that, they will need less bombast and more openness. I hope that we might now get it.

I thank the noble Lord and the noble Baroness for their comments and questions. I assure the noble Baroness that the Government remain committed to the test and trace system, and it will clearly play an important part in our efforts to continue to tackle the virus. I am sure she will be pleased to know that the test and trace app will be rolled out nationally tomorrow, further enhancing that programme. It is designed to work alongside the traditional contact tracing services and testing to help people understand if they are at risk. On her questions about the rules, my personal interpretation is that she could indeed invite two noble Lords to join her for curry if two had left, as the rule is about six people. Children are counted as individuals, so they are counted as one of the six.

Both the noble Lord and the noble Baroness talked about evidence. Certainly both the Government and the scientific advisers looked at a range of evidence in order to come up with the package that we have.

The noble Lord and the noble Baroness quite rightly talked about the economic impacts, which we are all extremely aware of. They will know that through the measures we have taken so far we have protected 12 million people and jobs through the furlough and self-employed schemes, at a cost of £40 billion. However, I entirely accept their points about the impact that this virus is still having, and the impact it is still having on our economy. I can certainly assure the noble Baroness that my right honourable friend the Chancellor, and those across government, are working with employers, representatives, unions and businesses to continue to work out exactly what the best form of support for businesses in all sectors is. We keep that package under constant review.

The noble Lord, Lord Newby, asked about the prioritisation of testing. He is absolutely right: at the moment prioritisation is for those who work in acute clinical care, broader NHS staff and people in care homes, and targeted testing for teaching staff. He is obviously quite right to mention other individuals who work within these settings, and we will keep the prioritisation under review. As we increase our testing and look towards the 500,000 tests that we hope to get to by the end of October, we hope to be able to offer tests much more widely and include more people within that prioritisation.

On face coverings, the noble Lord, Lord Newby, talked about indoor settings with lots of people. That is why we are now mandating face coverings in indoor settings and enclosed places which are freely accessed by the public, where it may not be possible to maintain social distancing. He will be aware that we already had those measures in place for shops and supermarkets and on public transport. It is for that very reason that we are now extending the mandatory wearing of face coverings to hospitality settings, taxis and private hire vehicles—again, in enclosed settings where it is particularly difficult for people to maintain social distancing.

The noble Lord also asked about extra funding for the police and local authorities. We have already announced an initial £50 million to support the range of enforcement activity we would expect to see in relation to the new rules that we have just announced. It will be up to the police to decide how they wish to deploy that—for instance, it could be used for increasing patrols to enforce social contact rules, deploying police to high-risk areas where there is rising concern, and providing more support to local authorities and NHS Test and Trace where quarantine and self-isolation breaches are being escalated. Of course, those are just some of the ways in which this funding could be used at a local level.

In relation to the new payment that was announced, the £500 is targeted at those on low incomes and who cannot work from home. It is an additional payment, on top of statutory sick pay and existing benefits or support, such as universal credit, employment support allowance, local housing allowance or hardship fund payments. It will become available for those who are required to self-isolate from 28 September. Local authorities are working quickly to set up these support schemes, and we expect them to be in place by 12 October. Anyone who has had to self-isolate from 28 September will receive backdated payments. That is, I hope, the detail of the new scheme.

The noble Lord talked about parliamentary scrutiny, which is of course extremely important. Each SI has undergone full scrutiny, in line with the requirements of its parent Act. We have been using the appropriate parliamentary procedures for considering regulations, including waiting for the JCSI and the SLSC to report on them before they are debated. On Monday, we will have a more general debate, in line with the commitment we made, on the Coronavirus Act itself.

The noble Lord asked about tomorrow. As the noble Baroness, Lady Thornton—who is sitting there—will be well aware, we have two days of full discussions on coronavirus SIs, so I do not think we can criticise the House or anyone within it for the work they are doing on this. We will be discussing the SIs that were to be in the Grand Committee in the Chamber. We are dealing with them in order: there are deadlines within which we have to discuss these SIs, and that is the order in which we are taking them. I hope the noble Lord will accept that, as well as the fact that we have two coronavirus Statements today, we are taking this very seriously and ensuring parliamentary scrutiny.

Sorry, I did have an answer on schools. Our advice for children is very clear: they should have a test only if they have symptoms. Obviously, we are well aware that there is a capacity issue in the system at the moment, which we are trying to address, so there are perhaps longer waits than we would like for tests. However, 64.7% of people who have a test get the results back within 24 hours.

My Lords, I join others in thanking the noble Baroness for taking questions on the Prime Minister’s Statement, and in so doing draw your Lordships’ attention to my declared interests.

The first wave of Covid-19 earlier this year saw major challenges for the NHS, in being able to treat patients with non-Covid conditions, such as cancer and cardiovascular disease, while dealing with the large numbers of patients needing admission for acute Covid conditions. How will Her Majesty’s Government determine whether the measures now in place are having sufficient impact to be confident that the NHS will be able to manage not only patients requiring Covid-19 admissions but those with non-Covid conditions requiring urgent treatment during the winter? This is a critically important issue. Do they have modelling available? How will they determine if these measures are going to have the desired impact and, if not, how will they act to ensure that the NHS will be able to look after all patients, both Covid and non-Covid?

I assure the noble Lord that the department is working extremely hard with the NHS to ensure an absolute minimum of disruption to other treatments. It was thanks only to the incredible work of staff that, even at the peak of demand earlier this year, hospitals were still able to look after two non-Covid patients for every Covid patient. A similar picture was seen in primary, community and mental health services. The most effective way to ensure that other treatments are not disrupted is to make sure we tackle this disease and try to make sure we do not have huge numbers of hospitalisations of patients with Covid. We are working towards that. We are also working on the principle that the most urgent treatments, including mental health support, should be brought back first. I assure the noble Lord that is a priority for the department.

My Lords, what matters most in this crisis is not the number of coronavirus infections but the deaths that occur. All deaths are tragic, but I regret to say that they are mostly among the elderly, the frail and those with comorbidities. Two weeks ago, the number of deaths was approximately 11 or 12 a day. In the last seven days it has just about doubled. The number fluctuates, but it appears to be going up. Still, it is only between 1% and 2% of the average daily death rate in this country. That is after three months of greater social mingling.

I regret to say that this policy is incoherent, illogical and, without a vaccine, unending. It is doing incalculable harm to livelihoods, lives, the economy, our country’s future and, worst of all, our children’s future. Will my noble friend the Lord Privy Seal take this message back to the Prime Minister at the next Cabinet? Whatever focus groups may say, the British public are fed up and will not support the restrictions announced in this Statement any more than I do.

My noble friend has been very clear in his views on the actions being taken and I respect them. He speaks for people who feel that way but, I am afraid, as the CMO and Chief Scientific Adviser set out earlier this week, we know that death rates are a lagging indicator. We have raised the alert level because we have seen that the doubling rate of cases could be between seven and 20 days, and that in the last fortnight daily hospital admissions have doubled. There is enough concern that we have felt it absolutely necessary to take this action early so that we can try to stop a devastating second spike. I completely accept and understand the points he makes about the economy—I touched on that in my answers earlier—but we strongly feel we need to take this action. I am very sorry—I think we all are—for the inconvenience it causes, but it is worth it to save lives.

My Lords, I am looking forward to my invitation to curry supper. More seriously, I think I speak on behalf of all the faith communities in welcoming the Prime Minister’s continued affirmation of the importance of places of worship being open, albeit with restrictions, not just for the private benefit of the adherents of a particular faith but for wider community cohesion and well-being, bearing in mind not least that many of these places host food banks and other community care initiatives. I hope that, if any further measures are needed, that community well-being dimension will be kept in mind alongside others.

I return to the question asked by the noble Lord, Lord Newby, about the 30 and the 15 attendance at particular kinds of events and add to that the announcement made, I believe, this afternoon that as of Monday attendance at life events will be restricted to six. There is some confusion about definitions here. As a narrower question, can the noble Baroness confirm that an ordination service, of which there will be dozens all over the country in the next few weeks, is not a life event for this purpose but rather a regular part of church and community life? Restricting attendance to six in a space such as Canterbury Cathedral would seem a bit odd when tourists can visit every day.

My Lords, is the noble Baroness aware that there has been a considerable rise in mental and emotional ill health since the pandemic began? Many people are fearful, anxious and depressed. In the Government’s messaging on the virus, does she agree that there needs to be a balance between frightening people about the seriousness of the disease so that they will obey the rules and reassuring people that, if they do obey the rules, they will probably be okay? Does she think the Prime Minister got that balance right yesterday? I am afraid I do not.

The noble Baroness is right about how incredibly important it is that we get messaging right. We are in a very complicated situation and everyone is doing their best. She is also right about concerns over mental health; for those with severe needs or in crisis, all NHS mental health providers have established 24/7 mental health crisis lines, and PHE has published its surveillance tracker to monitor the impacts of Covid-19 on the population’s mental health. These are proactive steps to help ensure that our response to the effects of the pandemic is shaped by emerging data. I am sure work such as that will help feed in as we think about messaging now and going forward.

My Lords, during the Statement yesterday the Prime Minister spoke of Parliament’s ability to

“take forward its business in a covid-secure way”.—[Official Report, Commons, 22/9/20; col. 798.]

Does the noble Baroness the Leader of the House recognise that there are grave concerns about how we are taking that business forward and the quality and effectiveness of current debate and scrutiny? As the noble Lord, Lord Newby, said, particularly concerning is the retrospective and often totally irrelevant nature of our scrutiny of statutory instruments which have been in force for weeks or months before they are ever considered in the House. In her response to the noble Lord, the noble Baroness did not seem to recognise that there was a problem. I urge her to read the words of the noble and learned Baroness, Lady Hale, and of her noble friend Lord Forsyth in the debate last Friday, and reconsider.

I am sorry if the noble Baroness did not think I gave due weight to that response. As I have said, we are very concerned to ensure we have scrutiny. We have ensured that each SI has undergone full scrutiny, in line with the parent Act, and worked around the appropriate parliamentary procedures. At this point I also thank the House authorities for all the work they have done to help us ensure we are a Covid-secure workplace. I hope noble Lords, while finding it frustrating, will continue to appreciate that we are working in a hybrid way and doing remote voting in an attempt to make sure that as many noble Lords as possible can continue the important work we do in this House in scrutinising legislation.

Following the lead of the right reverend Prelate the Bishop of Rochester, I thank the Government for the clear, helpful and sensitive guidelines given to the Jewish community for celebrating Rosh Hashanah, the Jewish new year, last weekend. It was Rosh Hashanah, but not entirely as we have always known it.

As more local lockdowns will inevitably follow, bringing difficulties for people and businesses—perhaps even a good crisis to exploit, were I the shadow Education Secretary—can my noble friend the Leader of the House explain what extra help will be given to businesses which find themselves in local lockdown areas?

Businesses in England required to close due to local lockdowns or targeted restrictions can now receive grants worth £1,500 every three weeks. To be eligible for the grant, a business must have been required to close due to local Covid-19 restrictions. The largest businesses will receive £1,500; smaller businesses will receive £1,000. Payments are triggered by a national decision to close businesses in a high-incidence area. That is specific help for businesses within local lockdowns but, as I alluded to in answer to the noble Baroness, Lady Smith, we are keeping the broader package of national support under review. That is why we have introduced things such as the £2 billion Kickstart Scheme, paying employers £2,000 for every apprentice they hire. There will be national measures and those specific measures I mentioned for local lockdown areas.

If that is the case, what exactly is the role of the military to free up the police, given that promise of adequate funding for the police?

The police will have the option to draw on military support if they require it. This would follow tried and tested mechanisms and so, for instance, could involve the military back-filling certain duties, such as office roles or guarding protected sites. What this is absolutely not about is giving additional powers to the military or having them replace the police in enforcement roles. They would not be handing out fines.

My Lords, I was pleased to hear the Leader of the House mention an increase in testing to 500,000; I hope that that includes a rapid turnaround time. My question is about the ambition, mentioned by the Secretary of State and the Prime Minister, to use testing as a mass screening tool. The current test and track system has lots of problems but mass screening has even bigger problems, so I hope that before it is introduced, the Government will publish the plans and consult beforehand.

I am sure that the department will take soundings and work with as many experts as possible as we look to develop this. It is a future aim to start testing people to identify those who do not have coronavirus and are not infectious with a quick, simple, scalable test but we are not near that yet, so we will certainly work with experts and companies to develop it. We will draw as much expertise as we can because, along with the development of vaccines, this will be critical hopefully to moving back to some kind of normal life.

My Lords, the announcement yesterday hit sport very hard at all levels—not just those levels that are seen on television but community sport in whatever form. I believe that Ian Botham is to be introduced into this House on 6 October. Will my noble friend guarantee that sports will receive the same proportion of grants as have been given to the arts by the time that he arrives in this Chamber?

I thank my noble friend. Like him and many others, I am extremely disappointed that we have had to pause these events. I was able to get one of 1,000 tickets to see Norwich play football on Saturday as one of the pilot events and, in terms of the way that was held, I thought that it worked very well.

We absolutely understand the economic consequences, as he rightly says, particularly for community and grass-roots sports, which so depend on spectators. I know that my right honourable friend the Secretary of State is working at pace with representatives from a variety of sports to ensure that we can come up with some kind of package to help them.

My Lords, there is a well-supported view that, in or close to lockdown, the most elderly should be allowed to meet close family and friends, or to self-isolate if they prefer, because of the human importance of such contacts. They should not be legally imprisoned for the rest of their natural lives in lockdown. Will the Government give this view serious consideration?

I can certainly assure the noble and gallant Lord that such considerations are at the forefront of everyone’s mind. The noble Baroness, Lady Walmsley, talked about the impact on mental health generally; of course, many of us have not seen some of our relatives for a long time, which is very painful for them and for those of us who cannot see them. I assure him that we are considering that very carefully. It is why we are trying to take packages of measures that continue, at this point, to allow social contact, because we know how important it is. However, we will obviously have to take action if we cannot stop the virus continuing to increase, because it is critical that we save as many lives as we can.

The Statement drew attention to the fears of those who were on the shielding list and those who are shielding others. What additional practical support is being reactivated to ensure that those people can remain Covid safe? In relation to businesses and private rentals in the commercial sector, what are the Government doing about the exorbitantly high commercial rentals that are destroying local businesses, whose profits have fallen at the moment?

The noble Baroness will be aware that, in the announcement yesterday, the advice remains that the clinically extremely vulnerable do not need to shield at the moment, although this will be kept under review. Obviously, if things change, packages of support will be looked at. Local directors of public health are also able to offer specific advice for clinically vulnerable residents. Of course, in local lockdown areas there will be different packages of support, so that is absolutely something we will consider as and when the guidance changes. In relation to rents, I am afraid that I will have to write to the noble Baroness as I do not have information on that particular issue.

Following on from the comments of my noble friend Lord Hayward, my noble friend the Lord Privy Seal will be aware that, in May, the whole rugby league family applauded the Government for the £16 million lifeline that they made available to the sport. That money was, however, predicated on a 12-week lockdown, and yesterday’s announcement on pausing the return of spectators could have a devastating impact on the viability of professional rugby league clubs both large and small. Can my noble friend therefore assure the House that the Government will engage urgently with the Rugby Football League to seek a quick solution to this issue and examine what more can be done to ensure a future for a sport that is so deeply embedded in communities such as mine in Leeds?

I thank my noble friend. As I said to my noble friend Lord Hayward, the Secretary of State is working on this as we speak. He is well aware of the issues faced. As my noble friend said, we have already worked with the rugby league to help but, as he said, with the new situation unfortunately facing sport, we will certainly work to see what we can do because so many clubs in a range of different sports are absolutely central to their local communities and we want to make sure that they continue to thrive once this crisis is over.

My Lords, I thank the Leader of the House for being here to speak to this Statement today. I want to talk about people who need to remain at work, of which nothing was said in the Statement yesterday. What are the Government doing about PPE stocks, based on the highest prediction of need? Does the UK hold sufficient stock for the NHS, voluntary and independent providers of health and social care, and domiciliary care services? If so, for how many days? How rapidly can the stock be replenished and what proportions are now manufactured in the UK? Are the Government’s distribution plans for PPE satisfactory, and have they adequately tested a system for distribution over the summer?

Obviously, PPE was a significant issue earlier this year. Lots of lessons have been learned. The department continues to work to make sure that we have plans in place. The noble Baroness will be aware that, for instance, we provided more than 250 million items of PPE. We are working with both the public and the private sector to ensure that we have robust plans in place so that we can make PPE available as and when it is needed. Obviously, one of the priorities, as I have just identified, is care homes.

My noble friend is absolutely right: ensuring that we protect jobs and support those in work has been central to our work so far. As I mentioned in a previous answer, we have put in place an unprecedented package of support for businesses, including grants, loans and the furlough scheme. We will continue to support business to make sure that we have a thriving economy once we come out of this crisis.

My Lords, the noble Baroness, Lady Smith, the noble Lord, Lord Newby, and the right reverent Prelate the Bishop of Rochester have all effectively set out the scientific and medical problems with the rule of six and the lack of clarity or logic in the rules announced. Will the Government consider, instead, having rules that will be enforced and guidance for the public, with a clear division between the two? Confusion between the two has been a significant source of problems. Rather than, for example, threatening to roll out the Army for two groups of neighbours numbering seven who are standing at a distance and briefly exchanging greetings in the park, will they acknowledge that it is the vulnerable and communities already suffering discrimination who are most likely to be affected by such enforcement action?

I have made it clear that the military will not be rolling out but may be called upon to help with certain back-office duties, so I do not accept that characterisation by the noble Baroness. My Lords, I thank the Minister for the Statement and for responding this afternoon. She will be aware of the massive investment that restaurants, pubs, clubs, bars and casinos have made to be Covid secure, so the devastation to the night-time economy following the announcement of the 10 pm closure will be considerable. The Prime Minister said that it is true that the number of new cases is growing fastest among those aged between 20 and 29. How are the Government specifically targeting that group to ensure that they stay safe, maintain a safe distance and are not super-spreaders?

Obviously, we continue to put out as much public messaging as possible, and we are looking at social media and other ways of getting the attention of that group of people. The other issue we need to recognise is that unfortunately, cases are now rising throughout all age groups, which is a concern. The package of measures we have put together is an attempt to stop the rise in cases while ensuring that the economy continues, albeit in a somewhat restricted fashion. We do not want another full national lockdown. We hope that, added together, this package of measures, as well as everyone sticking to the basics of social distancing, good handwashing and wearing face coverings, will help to stop the rise that we are seeing at the moment, before we have to take further and more unpalatable measures.

My Lords, I declare my interests as set out in the register and apologise to the House for omitting to do so in the debates today on the two rental Motions.

What assessments have the Government and their advisers made of the evidence from Sweden, which has managed so much better by not accepting the modelling assumptions predicting significant deaths? What estimates have government advisers and the CMO made of the number of deaths from undetected or untreated other illnesses such as cancer, stroke, heart failure and suicide, which have resulted from the NHS’s seemingly singular focus on one serious illness? We may not be choosing between deaths from Covid and the economy; maybe the choice has been between deaths from Covid and deaths from other causes.

Certainly, the Prime Minister, the CMO and other advisers have been talking to their Swedish counterparts regularly in order to learn lessons from there. Indeed, they have also been talking to other European countries such as Belgium, which have taken measures, in order to learn internationally. We are all learning the best way to deal with this virus, so I can certainly reassure my noble friend of that. As I said, we are trying to restore the NHS services that were suspended while we dealt with the initial impact of Covid. NHS England has issued guidance for the return of non-Covid health services to near normal levels, making use of the available capacity while protecting the most vulnerable from Covid. As I said, this is something that the department is very much focused on. The way to minimise disruption to other treatments is to deal with this virus as effectively as we can, so that we do not have a huge spike of people with Covid being admitted to hospital.

My Lords, I do not want to detain the House for more than a few seconds, really. While I am grateful that there is to be a debate on the negotiations with our European friends and former partners, I regret the fact that it is not on the Floor of the House. There is a strong tradition in your Lordships’ House that important constitutional issues are debated on the Floor of the House. I cannot think of any more important issue, particularly in the light of very recent announcements. The debate will take place in Grand Committee because we need to debate SIs on the Floor of the House that day. Obviously, all noble Lords will be aware—because many are participating—that we have an extremely heavy legislative agenda, which we are working through together. However, we recognise that many noble Lords have requested a debate on this topic so we have come to this arrangement in order to facilitate it.

That, if the bill’s Committee stage is not concluded by the rise of the House on Wednesday 16 September, the bill be reported from the Committee of the Whole House in respect of proceedings up to that date; and that, for the remainder of the bill, the order of commitment of 22 July 2020 be discharged and the bill be committed to a Grand Committee.
