My Lords, the Government will publish a new international development strategy this spring that will guide our work for the coming decade and beyond. It will align our development work with the aims and objectives of the integrated review and will continue to prioritise women and girls through support to educate girls, empower women and end violence, including by strengthening sexual and reproductive health and rights and working to end female genital mutilation.

My Lords, UK investment in sexual and reproductive health not only promotes health and well-being across the whole of life but also leads to improvements in education, gender equality, political stability, economic development and, indeed, environmental sustainability, so it is a very worthwhile investment. Sadly, SRHR and family planning programmes are extremely disproportionately impacted by the cuts to UK aid. Can my noble friend the Minister reassure me that we will retake our place as a global leader on this issue, that SRHR will be an explicit priority in the upcoming strategy and that funding will be returned to previous levels of around 4% to 5% of ODA as part of the Foreign Secretary’s commitment to restore funding to women and girls?

I thank the noble Baroness for her campaigning on this issue. Sexual and reproductive health and rights are central to achieving the UK Government’s manifesto commitment to end the preventable deaths of mothers, babies and children by 2030 and our ambitious commitments on girls’ education and Covid recovery. The Foreign Secretary has been clear that we will restore funding to women and girls. The UK plays a vital role in global partnerships and funds to support and strengthen the ability of countries to deliver life-saving maternal reproductive and child health services. We certainly regard ourselves as a world leader in this area and we will continue to be.

My Lords, global donor support for reproductive health fell in 2020 by $100 million to the 59 low and middle-income countries. That cut was driven by the UK cuts. The place on earth that is the most unsafe for mothers and babies is South Sudan, which I have asked the Minister about before, where one in 10 babies dies before the age of five, but the Government are discussing a new round of cuts for health support for women and babies in South Sudan. If the Government are proposing to restore funding, why are they proposing to cut further in South Sudan? Will the Minister please intervene to make sure that this does not happen?

My Lords, as I said, the Foreign Secretary has been clear that we are restoring funding to women and girls. I am not able to answer region-specific questions at the moment because that work is being done and until it has been completed and our spending review settlement translates into programmes on the ground, I am afraid I cannot go into the specifics.

My Lords, we know that the cuts this year have resulted in 9.5 million fewer women and couples receiving services. The noble Lord keeps repeating the assurances of the Foreign Secretary in terms of devoting resources to women and girls, but how much of that will be devoted to sexual and reproductive health? We want to know the answer.

My Lords, we will know the answer, but we will not know it until the IDS is published and the allocations are made and the programmes are chosen. As a principle, the Foreign Secretary has made clear that we are restoring funding and this House and the other House will be able to hold the Government to account against that promise.

My noble friend has said that this is important in order to carry through the Conservative Party manifesto. In that manifesto we committed ourselves to 0.7% for overseas aid. We have cut that, contrary to both morality and our manifesto. When can we expect that to return and us to have the shame removed?

My Lords, I start by saying something I have said many times: no one welcomes the cut from 0.7% to 0.5%. Notwithstanding that cut, we will have spent more than £10 billion on ODA in 2021. We will return to 0.7% as soon as the fiscal situation allows. Based on 2020 OECD data, the UK will be the third largest ODA donor in the G7 as a percentage of GNI. We will spend a greater percentage of our GNI on ODA than the US, Japan, Canada or Italy, and forecasts fortunately suggest that government will be able to return to 0.7% on aid in the final year of this spending review.

My Lords, I wonder whether the Minister fully understands the impact of sexual and reproductive health in many parts of the world. There are large areas of the world where, if a woman is infertile, she does not have a roof over her head or a meal to eat; she has to abandon the family and is left completely without support. That is common and it is not just a matter of children and girls, but the education of a whole population and better infrastructure.

My Lords, we fully understand the importance of this area. That is why the Foreign Secretary has made the commitment that she has, and why it appeared in the manifesto. SRHR means that women and girls can have control over their bodies and if, whether and when to have children, giving them the choice to complete their education and take up better economic opportunities. In turn, the children will likely be healthier and better educated. It is central to the effective delivery of a country’s universal health coverage. Good quality maternal and newborn health services and survival outcomes are often used as a proxy for the strength of an entire health system, so we fully understand the importance of this area.

My Lords, is the Minister aware that many countries have very inadequately staffed maternity services and pregnant women who have HIV can get stigmatised? Can the global fund help and make the situation better? Can the Minister ask it to do this?

The noble Baroness makes an important point. Every year nearly 300,000 women die from pregnancy-related causes, 2.5 million newborns die in their first month and 2 million babies are stillborn. Most of these deaths are avoidable with access to better health services to help mothers and newborns through pregnancy and delivery. The UK supports maternal and newborn health through global and country programmes, often integrated with wider work to strengthen health systems.

My Lords, last week I met young people who had been working on programmes on reproductive and sexual health with the International Citizen Service and VSO. That programme was pulled by the Government, meaning that hundreds of young people, here and in the developing country working with them, have now lost that opportunity to work on those issues and make a real difference in local communities. Will the Government commit to refunding that programme and making sure that VSO is able to continue the very valuable work it has been doing in this area?

My Lords, funding levels for individual programmes across the FCDO will be confirmed after the departmental planning process taking place over the coming months has concluded. I am afraid that is the only answer I can give, but I will take the noble Baroness’s comments back to the FCDO, where I am absolutely certain they will be met with a nod of agreement.

My Lords, when I joined the Foreign Office in 1982, I learned that there were only two seasons in government: spring and autumn. The curious thing is that each can last for longer than six months. Once again, the Minister has said that the international development strategy will appear in the spring. Can he at least give us a month?

My Lords, improving sexual and reproductive health and rights is among the most cost effective of all development investments and would give personal, social and economic benefits, as well as helping to stabilise population growth and reduce poverty. I ask the Minister the same question as the previous noble Lord: when will the international development strategy be published and the Minister’s promises fulfilled?

Most of our programmes across the FCDO are delivered through trusted partners on the ground. Where we do not have the expertise, we look for it. Health is one of the most obvious areas where that is important.

My Lords, in response to the rising threat of massive Russian military intervention in Ukraine, we reluctantly took the decision to withdraw our UK secondees to the OSCE special monitoring mission, in line with our duty of care responsibilities. We are aware that this will have an impact on mission operations. However, the UK remains a strong supporter of the special monitoring mission and will continue to work with the mission to support it in delivering its mandate.

My Lords, I thank the Minister for his reply, which amounts to, “Other countries will do this for us”. On 20 January, answering a Question, the noble Lord, Lord Sharpe of Epsom, said:

“The OSCE special monitoring missions are essential and the UK is one of the leading contributors to those.”—[Official Report, 20/1/21; col. 1753.]


I appreciate that the incursion of Russian troops into the supposedly independent breakaway regions of Donetsk and Luhansk threatens the continued presence of the SMM in these areas, but that was not the case when we withdrew our monitors. Does the Minister accept that this OSCE operation is one of the few tools, if not the only tool, that the international community has agreed and that is readily available in theatre? Does he agree that any limitations to the ability of the mission to provide verified facts are nothing less than an invitation to construct unverified pretexts for more violence? Even under the current dire circumstances, more monitoring and verification, not less, would give the right signal, including one to demonstrate solidarity with Ukraine.

I did not hear the first part of the question, which I think related to other countries and their reactions to the threat. If I am wrong, I apologise. A number of participating states are taking a similar decision to us, including the US, Canada, Ireland, Denmark and Albania. On the noble Lord’s broader point, we fully recognise the critically important role of the mission in reducing tensions and helping to foster peace, stability and security, and that our withdrawal will have an impact. There is no argument there. We continue strongly to support the SMM and its mandate. We will continue to work with the mission to support its ongoing delivery of that mandate, including calling for the SMM to have free, safe, unconditional access throughout Ukraine, including in non-government-controlled Donetsk and Luhansk. The mission continues to face unprecedented restrictions on its freedom overwhelmingly in those non-government-controlled areas, as well as targeting of its technological capabilities.

My Lords, does the Minister agree that the OSCE monitors provide the best and possibly the only totally objective means of telling the rest of the world if the Russians add to what is already an incursion into Ukraine by crossing the ceasefire line? Is it not therefore extraordinarily unhelpful that we have withdrawn our observers from that? Are there not still some NATO allies who have observers with the mission? Surely it is necessary, if we are to muster a worldwide condemnation and reaction to any further Russian incursion, for that mission to be effective?

My Lords, the UK had the third largest number of monitors and is the leading financial contributor to the mission. Because of the rising threat from Russia and our duty of care responsibilities to those taking part, the UK made a difficult decision to withdraw. However, our secondees remain on contract and we are ready to deploy them as soon as the situation allows. That is of course what we want to do.

My Lords, when the UK ambassador to the OSCE talked about withdrawal, he noted that, even in the four months to 12 January, the number of weapons in the area doubled against what was in the Minsk agreement. That was when our monitors were there. What sort of evidence does Her Majesty’s Government imagine there can be when no monitors are present? As the noble Lords, Lord Hannay and Lord Browne, said, that evidence is vital, otherwise we will have fake news from the Kremlin.

My Lords, as I said, we continue strongly to support the SMM. We are calling for it to have free, safe and unconditional access throughout the country, including those areas described by Russia as independent republics. The situation on the ground required the Government to make a decision. I will not second-guess that decision.

My Lords, yesterday, the Minister for Europe told an OSCE meeting that Russia had rejected the diplomatic efforts of the OSCE’s chair in office, refused to engage in the proposed renewed European security dialogue and boycotted every meeting called by Ukraine under chapter 3 of the Vienna document. Can the noble Lord tell us what, if any, opportunities remain for Russia to engage properly with the OSCE to find a diplomatic resolution?

My Lords, all options are open to the Russians to engage in the kind of dialogue that might help prevent an escalation in the current situation. It is worth remembering that there are few—if any—countries in the world more highly skilled in the distribution of misinformation. In this Question, we are discussing Russian claims about the withdrawal. Their pitch is that withdrawal indicates knowledge of an alleged imminent Ukrainian offensive. This is clearly and self-evidently false. Our decision to withdraw was based on a threat posed by Russia—nothing else.

Yes, I am saying that the Government took their decision to safeguard the lives of the people in question. The noble Lord can draw his own conclusion. It is easy to make such statements from the comfort of these red Benches. Nevertheless, it is the Government’s job to ensure, as much as they can, the safety of those people on the front line doing extremely difficult work.

My Lords, is this decision not helping the Russians? They have a strategy and a plan for their misinformation. By withdrawing our people, we have allowed Russia to continue its misinformation and make more efforts with it during the next few weeks.

My Lords, there is no question but that the behaviour of Russia in Ukraine crosses numerous red lines. There is no question either about the seriousness with which we and our allies take that, as is reflected in the package of measures announced earlier by the Prime Minister. We are committed to extend this package as far as is necessary to hit Russia where it hurts.

My Lords, in the light of the Question and given these uncertain times, should not sanctions—or something similar—be seen as a deterrent, rather than as a punishment after the event? What is the Government’s plan if the Russians attack Kyiv?

The noble Viscount makes a good point. As he knows, in the run-up to recent events, the UK, the US and their allies were very clear about threatening sanctions. We had hoped that this threat would deter Russia. Russia has taken the action that it has, and we have responded with sanctions, as we said we would. We have also been clear that the package of measures which we are willing to take and for which we are making preparations will go much further than that announced earlier by the Prime Minister. I am sure that all noble Lords hope, as I do, that the threat of a greatly extended package of measures will act as a deterrent to Russia.

My Lords, evidence that the OSCE has seen shows that some 14,000 people have already died in eastern Ukraine, underlining the nature of the threat that Russia poses. Is not now important for NATO allies to stand together? When the House considers that 75% of NATO’s costs are met by the United States of America and that Europe has a $21 trillion economy, is it not time that everybody else stepped up to the plate and followed the example of this country in meeting their 2% share of NATO’s costs?

I strongly agree with the noble Lord’s comments. In addition to the role we play within NATO and the investment we make in our own capabilities, the Prime Minister has announced a whole package of support, which I will not be able to go into now, to support Ukraine in its current endeavour. The noble Lord is absolutely right that we should encourage other members of NATO to step up.

My Lords, on 24 January, the Irish Minister for Foreign Affairs, Simon Coveney, briefed EU Foreign Ministers about the planned exercises and publicly stated that Ireland did not welcome them, but that Russia was within its legal rights to conduct them. He reiterated this position in a call with the Foreign Secretary on 28 January. The next day, 29 January, Minister Coveney confirmed that the exercises would in fact take place outside of Ireland’s exclusive economic zone.

I thank my noble friend for that Answer. Of course, the exercises did not take place, partly thanks to the representations of the Irish South and West Fish Producer’s Organisation, which deserves great credit for this. In the intervening period, the Irish state commission on defence has reported, flagging certain concerns it has about the level of Irish state capability in defence. What further can the Minister say about further interactions and connections between the British and Irish Governments through mechanisms such as the British-Irish Intergovernmental Conference? Looking forward, might the Secretary of State for Defence’s Office of Net Assessment be able to take a view and produce an assessment on what is going on in what used to be called the Western Approaches, in terms of threats there to the totality of interests of all states in these islands?

I assure my noble friend that I will pass on his specific request to my counterparts in the Ministry of Defence. On the issue he raises, the Secretary of State’s Office of Net Assessment and Challenge, or SONAC, which my noble friend has long championed, is a useful mechanism for Her Majesty’s Government to look across all areas of defence. SONAC is closely involved in supporting cross-government efforts on the current crisis in Ukraine, providing rigorous red teaming, a challenge scrutiny and expertise, and it will continue to do so. I note and agree with his comments about Ireland’s fishing community.

My Lords, will the Minister use his good offices with his colleagues in the Cabinet Office and the Northern Ireland Office to ensure that there is an early meeting of the British-Irish Inter-Governmental Conference? The last meeting was held in early December 2021, and promises were made that a further meeting would take place in early 2022. There is a large agenda, including the item referred to by the noble Lord, Lord Godson, and other issues that involve the co-guarantors of the Good Friday agreement, such as legacy and the protocol, and the restoration of political institutions in Northern Ireland.

Ireland is a hugely important ally, and we continue to work closely across a number of security and defence interests, and there have been many exchanges in recent days, weeks and months. On 6 January, the Minister for Foreign Affairs, Minister Coveney, spoke about sanctions, the risk of escalation and the need for a united Europe. Concerning Russia, Minister Coveney assured the Foreign Secretary that the EU would support a very robust response. The UK’s integrated review sets out our foreign and security priorities with Ireland, including the common travel area, upholding the Good Friday agreement and protecting the prosperity and stability of Northern Ireland, and the peace process. This is obviously a sensitive time in UK-Ireland relations, but we deeply value that relationship, and we are working closely with Irish counterparts in a range of areas of common interest.

My Lords, acting in lockstep with our allies is not just about punishing Russian aggression. It is also about protecting our interests, so could the Minister tell us when we will see stronger targeting of systems, rather than people? When will we see the reform of Companies House to make it fit for purpose? When will we see a register of overseas owners of UK properties? And when will we see a strong economic crime Bill?

I do not think there can be any doubt about the extent of the package set out yesterday. We are out in front by sanctioning 275 individuals, placing restrictions on banks worth around £37 billion, and under the measures that Parliament has already approved, we can target any Russian entity or individual. It is the most far-reaching piece of legislation of its kind. The key is for us to proceed in lockstep with our allies to simultaneously pressure Russia from all angles. Our unity is critical. As the Prime Minister said earlier, we have prepared, ready to go in the event of further aggression, an unprecedented package of further sanctions, including wide-ranging measures targeting the Russian financial sector and trade.

My Lords, the Chancellor of Germany made a major statement yesterday about Nord Stream 2. If Her Majesty’s Government are trying to act in lockstep, should not the sanctions against Russians in London, and other sanctions be of a similar magnitude to those introduced by Germany?

My Lords, we greatly welcome the announcement from Germany—indeed, the Government have long argued against the project proceeding for precisely the reasons that have now become clear. We are clear that yesterday’s announcement in the UK represents the first wave of sanctions, which target some of the individuals and entities closest to the Kremlin. We are co-ordinating with our allies around the next steps, and we will continue to work with our partners to build the most powerful set of financial sanctions ever imposed on any major economy.

My Lords, the Minister said in reply to a previous question that these sanctions had already been approved by Parliament. But that is not true—they are on the Order Paper for tomorrow, so they have not yet been approved by this House. They are totally inadequate, and I hope that when we consider them tomorrow, this House will say that they are totally inadequate.

My Lords, I was talking about the changes that were introduced on 10 February, which will mean that we are able to more readily designate a far greater range of individuals and businesses associated with the Kremlin. It is clear from what the Prime Minister said today and what the Foreign Secretary said yesterday that that is our intention.

My Lords, much has happened since the noble Lord’s original Question appeared on the Order Paper, and the situation in Ukraine continues to be grave. Russia’s announcement that it was to hold live artillery and missile-firing exercises in part of the exclusive economic zone of Ireland was an early indication of the path that Vladimir Putin has foolishly chosen to tread. Although it is not a member of NATO, the Republic of Ireland currently serves alongside the United Kingdom as a non-permanent member of the UN Security Council. What precise role does the Minister feel that the Irish Government can play with the rest of the free world in standing up to Russian aggression?

My Lords, the UK will always stand up for the interests of Ireland, which is not just our closest geographic neighbour but one of our closest friends. On the subject of this Question, Minister Coveney raised his concerns with the Russian ambassador to Ireland at the EU foreign affairs meeting on 24 January. Five days later, on 29 January, the Russian ambassador to Ireland announced in a statement that the exercises would be moved outside of the Irish EEZ. Therefore, from the point of view of Ireland and Minister Coveney, the issue has been resolved.

My Lords, does the Minister consider that there is any significance to the fact that where the Russian exercise was planned for is the point where the two most important transatlantic fibre-optic cables come within a matter of two miles of each other, or is that just happenstance?

The noble Lord raises an important point. Obviously, I can only speculate, but irrespective of whether what the Russians were planning to engage in was legal—I think it is generally accepted that what they were intending to do was legal—it was undoubtedly provocative and overly assertive.

My Lords, is it the case that both Russia and China have a strategy and a plan to promote their interests, while the West, including the Government, has no strategy or plan for dealing with China or Russia?

I do not agree. It is essential that we work with and align as closely as possible with our allies. However, the single most effective thing we can do in relation to the current threat, which has become more than a threat in recent days, is to hit Russia where it hurts, which means imposing as tight a series and set of sanctions as possible to punish those who are closest to, and in many cases propping up, the Kremlin.

My Lords, in response to questions from my honourable friend Caroline Lucas in the other place, the Prime Minister said yesterday that he was not aware of any Russian interference in UK elections. Today he said that he was not aware of any successful Russian interference in UK elections. I am sure that the Minister is aware of the Intelligence and Security Committee’s report on Russia, which said simply that there has been no investigation, so we have no idea whether this has happened. Is it not time, in the current geopolitical climate, to launch that investigation, particularly given the fact that we have elections coming up in the UK in a few months’ time?

My Lords, I start by referring the noble Baroness to the answer given by the Prime Minister today. However, I would just caution her: it seems that this question and indeed this issue became a bit of a bogeyman during the Brexit debate, when all kinds of allegations were made around Russian money, none of which, as far as I am aware, has been substantiated. Our Prime Minister and this Government have done most of the running in terms of corralling our allies to take the position that we have now taken in response to the threat posed by Russia. I do not think that there is any doubt internationally that the Prime Minister has led this international coalition-building exercise.

My Lords, European allies are vital in building a network of liberty and in tackling shared challenges. The Foreign Secretary has spoken with many of her European colleagues in recent weeks, as has the Prime Minister, including on the situation in Ukraine. France and Germany are two of our closest partners, and we work with both countries at the highest levels. Our forces regularly operate alongside one another around the world, including defending NATO’s eastern flank.

My Lords, I thank the Minister for his reply. I tabled this Question before the Ukraine crisis reached fever pitch. I was pleased a couple of weeks ago that the Prime Minister said that he would bring together Europe in a united stance against President Putin, but now all I read is government briefing that Britain stands four-square with the United States, in contrast to the alleged weakness of France and Germany. Despite the Government’s temptation to scratch away at the Brexit issues that remain unresolved, will they now restate clearly and firmly the supreme and overriding importance they attach to a common European and NATO position with our European allies and friends, which in this moment of great crisis should come above all other considerations?

My Lords, European security is clearly directly linked to UK security, and I do not think anyone questions this. We share many security and defence interests with our European allies, from addressing climate change to tackling malign actors. As one of only two European nations with truly global military reach and the largest European spend in NATO, we remain an essential ally on foreign policy, security and defence for the wider European Union.

My Lords, does the Minister recognise—I pay tribute to what the Government are doing on this—that the key aspect of this crisis, in our hands and those of our European and NATO allies, is a tough sanctions response, if there is any invasion of Ukraine? Therefore, would it not have been rather more useful in the last few weeks if we had been part of the dialogue within the European Union—which we could have been if we had put that into the TCA—instead of having to operate purely from the outside on sanctions, which is an EU matter, not a NATO matter?

The UK will continue to work with the EU and other international partners to tackle this shared global challenge. For example, on 2 December, alongside the US, Canada and the EU, the UK imposed fresh sanctions on eight Belarussian individuals responsible for repression and human rights violations. Our departure from the EU has meant that we are able to move more quickly than we could through multilateral channels, where it is in our interests to do so. Only a week ago, the UK Government laid legislation in Parliament to toughen and expand the UK sanctions regime, specifically in response to Russia’s aggression against Ukraine. These powers will go further than ever before.

My Lords, we are already extremely closely aligned to both Germany and France on most overseas issues. Our defence relationship with France is closer than with any other country in the world, except the United States. We are working together to protect our people from shared threats. Germany is an essential ally and one of our most important international partners. We welcome the new German coalition’s description of the UK as one of Germany’s closest partners. The relationship is good and we have a shared interest in resolving this issue.

My Lords, while maintaining my deep concern for the sovereignty of Ukraine, I ask the Minister to confirm that no country has a right to join NATO and that allowing new members to join is a decision for all existing NATO members. By its nature, this imposes an obligation on any member to come to the aid of another, an obligation not to be undertaken lightly by any country.

My Lords, as the noble and learned Lord knows, Ukraine is a sovereign nation with a long and rich history of cultural and political independence. Ukraine has the absolute right to determine its own future. The sovereignty and integrity of Ukraine, and other partners, are not remotely up for discussion.

My Lords, could the Minister take back to the Foreign Office the strong message that it does not help the cause of close co-operation with France and Germany if Cabinet Ministers make comments which suggest that they are weak and we are strong? For example, the suggestion that there was a whiff of Munich in President Macron going to Moscow was not helpful for Franco-British co-operation. I am well aware that the Blair Government did much the same in criticising the French in the run-up to the Iraq war. That damaged our co-operation with our major European partners, too.

My Lords, given that the official position, now established, is that NATO will not fight even if Ukraine is invaded, does it not effectively mean that Ukraine is not likely to become a member of NATO—and has not the President of the United States said that Ukraine is a long way from membership of NATO? Given that, why is it so difficult to come up with a formula that could assure Russia that the possibility of Ukraine joining NATO is very remote?

I thank the noble and gallant Lord for his comment, but we have shown that we do not need a separate institutional treaty to work effectively with the EU on foreign policy, whether co-ordinating on sanctions, responding jointly to Russian aggression or on wider issues involving Iran. Although we have left the EU defence structures, we will continue to work closely with the EU across the common challenges that we face. We do so on a very wide range of issues, including Libya, climate change, Russia and so on, and the trade and co-operation agreement provides for future co-operation on emerging security challenges, where it is in the interests of both sides to continue to work together.

My Lords, what is the Minister doing to improve co-ordination with our EU partners on sanctions against Russia? Can he also tell us what the Government are doing now, independent of the EU, to implement long-overdue measures to prevent money laundering, including reform of Companies House, regardless of any further Russian attacks on Ukraine?

My Lords, we have cracked down on illicit finance through ground-breaking legislation in the Criminal Finances Act, and we have already published our ambitious economic crime plan. The National Crime Agency has increased investigations into corrupt elites, and the Government are reviewing all tier 1 investor visas granted before 5 April.

On the broader point that the noble Baroness raises, the UK will continue to work with the EU and other international partners to tackle shared global challenges. My Lords, the instrument before us was laid before the House on 13 January. It makes small but crucial changes to repatriate powers to the UK and correct an error in a previous agriculture SI by restoring an accidentally omitted definition of an appropriate authority. This instrument covers two subject areas: waste management and agriculture. I shall take them in turn.

First, for waste management, this instrument transfers powers relating to several directives concerning waste from the European Commission to the Secretary of State. Where appropriate, these powers are also transferred to the devolved Administrations. The powers will largely give the Secretary of State and, where appropriate, the DAs, the ability to make regulations to set various technical standards, criteria, thresholds, and conditions. All these standards are currently operational, and we do not anticipate the need to alter them soon. However, there may be a need to amend them in future. For instance, should a superior waste treatment method be developed, without the amendments made by this SI we would not be able to make regulations to take account of the new method, which may weaken our high environmental standards.

I shall briefly outline the power, or powers, being transferred from each EU directive. Regulation 5 transfers the power to set standards for the sampling of waste going to landfill from the landfill directive. Regulations 6 to 9 transfer powers from the end-of-life vehicles directive to update and modify exemptions covering the use of certain heavy metals in vehicles based on scientific or technical progress; to specify minimum requirements for the certificate of destruction for waste motor vehicles; to modify conditions for storage and treatment for waste motor vehicles in line with scientific or technical progress; and to specify material and component coding standards for vehicles.

Regulations 10 to 11 transfer powers from the mining waste directive to modify non-essential elements such as guidelines for inspecting waste facilities and sampling methods, and to update regulations in line with scientific and technical progress. Regulations 12 to 13 transfer powers from the batteries directive to specify export criteria and to grant exemptions from labelling requirements for batteries and accumulators.

Regulations 14 to 17 transfer powers from the waste framework directive: first, powers to prescribe detailed criteria for what substances may be considered a by-product of a manufacturing process rather than a waste product, whereupon it can be sold or treated differently; secondly, powers to prescribe detailed criteria for when waste may no longer be considered waste, such as if the substance can be put to a more useful purpose elsewhere; and, finally, powers to specify the application of the formula for incineration facilities.

Regulations 18 to 20 transfer powers from the waste electricals and electronic equipment directive to update selective minimum treatment technologies for waste electrical and electronic equipment, or WEEE; to update the technical requirements for WEEE treatment and storage operations and the non-exhaustive list of products listed as falling into each of the categories specified in the WEEE directive; and to update the crossed-out wheeled bin symbol. These powers could, for example, be used to tighten treatment requirements of substances in WEEE found to be hazardous to health and the environment. The powers, apart from those relating to the batteries directive and the mining waste directive, will apply in England, Wales, Scotland, and Northern Ireland. I shall now cover this instrument’s effect on agriculture- related legislation. This instrument amends Regulation (EU) No 1306/2013 of the European Parliament and of the Council as it relates to the organisation of common markets and rural development measures. Regulation-making powers from that regulation were previously transferred to the Secretary of State and their counterparts in the devolved Administrations by three EU exit SIs. However, the effect of the interactions between these three SIs has resulted in Regulation (EU) No 1306/2013 no longer containing a definition of “appropriate authority” in relation to the financing, management and monitoring of the organisation of common markets and rural development measures. Therefore, this instrument reinserts the definition of appropriate authority into Article 2 of Regulation (EU) No 1306/2013 and revokes the ineffective definition in a previous EU exit SI, the Agriculture (Payments) (Amendment, etc.) (EU Exit) Regulations 2020, to correct this deficiency.

No impact assessment has been prepared for this instrument, because this instrument only repatriates powers to the UK and corrects an accidental omission in a previous EU exit SI. The impacts will be considered if regulations are made using the repatriated powers.

Safeguards are provided through a requirement, in relation to the waste-related powers, to consult appropriate authorities and such other persons as the Secretary of State or the devolved Administrations consider appropriate, before making regulations under these powers. Any regulations made under these powers would receive Parliamentary scrutiny through the negative procedure, except one agriculture-related power to make regulations in the event of an emergency to make payments to beneficiaries. This allows use of the urgent affirmative procedure where it is both necessary and justifiable to ensure that beneficiaries can be paid.

My Lords, I am most grateful to my noble friend for such a full explanation of the impact of this measure. Did I hear him say that this will allow the Government and the devolved Administrations powers to amend the waste regulations, presumably in their area? Does he expect the powers to vary between the different areas? On the disposal of cars, one can see that a devolved Administration could perhaps make the regulations less onerous and thereby attract cars for disposal to set up a bit of industry or activity in their area. Have the Government considered that? Is it likely to be beneficial in these areas?

Finally, is this a one-off set of measures or is Defra carrying out a wider review of the European Union (Withdrawal) Act 2018, as set out in paragraph 7.6 of the Explanatory Memorandum? Are these new freedoms and flexibility for the Secretary of State now part of a process to review all the withdrawal legislation? I should like an answer to that point, particularly, but also to my other questions. Perhaps if the Minister does not feel able to reply today, he could write to me on those matters. I look forward to his reply.

I thank noble Lords who have contributed to this debate today. Now that we have left the EU, it is essential that our legislation reflects this new reality, and I shall try to address the questions that were put to me. On the first, put to me by the noble Duke, the Duke of Montrose, I simply emphasise that there is and has been very close co-operation between the Government and the devolved Administrations, and between the devolved Administrations themselves. Waste policy is devolved, but the current UK approach on, for example, ELVs, gives no indication so far that the DAs have any intention of diverging. If there are exceptions to that, I shall come back to the noble Lord, but I am unaware of them. It is also the case that some elements are regulated at the UK level—for example, end-of-life vehicles, which therefore applies across the board.

The noble Baroness, Lady Bakewell, asked some quite detailed questions about the percentage of batteries disposed of, where they are exported to, and so on. I shall not be able to answer all her questions, but I shall do my best to answer some of them. As she knows, there are certain labelling requirements for batteries. The powers here would enable exemptions from labelling to be put in place if necessary, but currently there are no exemptions in place. There are numerous portables exported to major EU destinations, including Belgium. However, to provide the noble Baroness with a comprehensive list we need to get data from the Environment Agency, and we will do so on the back of this debate.

The noble Baroness also asked about agricultural waste. The amendments in this SI effectively reinstate the definition of an appropriate authority; that is what it is about. It amends EU 2013/1306, the horizontal or cross-cutting regulations underpinning the CAP schemes, in so far as they relate to the organisation of common markets and rural development measures. Defra previously transferred secondary legislation-making powers in this regulation to the appropriate authority—that is, the Secretary of State and the devolved Administrations. The noble Baroness, Lady Jones, asked the same question. Through the unintended effect of three interacting statutory instruments, the definition of the appropriate authority was deleted, so the amendment will allow the Secretary of State and the devolved Administrations to use these already transferred secondary legislation powers to develop and refine the technical details required to operate rural development schemes and marketing measures. The Scottish Government have told us that they wish to use these powers to make a Covid-related derogation in inspection rates for new Scottish domestic agricultural support schemes early this year.

The noble Baroness, Lady Jones, pressed me in this area and asked whether it was a one-off. I think it is; I would like to say so. I cannot absolutely guarantee that I will not come back with more, but my understanding is that we are done now—this is the end. The error was identified in summer last year, and we have taken steps to make the correction that we are dealing with now at the earliest opportunity. I am reassured that there were no adverse steps that we are aware of. Neither Defra nor the devolved Administrations have sought to use the particular powers that we are legislating for today since we left the European Union, so this has not cost us in any way. It was an error, but the error is being corrected. The human explanation is simply that there has been a flurry of activity since we left the European Union, as the noble Baroness knows as she and I have dealt with much of it. I think it is inevitable that some errors were going to be made.

I know that the noble Baronesses, Lady Jones and Lady Bakewell, asked other questions, but I will have to go through Hansard and find them and give the specific answers they are looking for, rather than waste time now, because I did not catch all the questions while I was going through my papers. In any case, I will need to consult the experts. I hope I have covered at least the most serious questions that have been put to me by Members.

To conclude, I am grateful to noble Lords for both understanding and accepting the need for this instrument. It is small but crucial. The changes it makes to repatriate powers to the UK correct an accidental omission in a previous SI, and it is clearly something that has to be done. This instrument makes it possible to swiftly update many technical standards, criteria, thresholds and conditions in the field of waste management to reflect the latest developments and to ensure that our high environmental standards are maintained. It will also enable our agricultural legislation regarding the organisation of common markets and rural development measures to function as intended. Once again, I thank noble Lords for their contribution and support today.

My Lords, I appreciate that the Minister said he will go through Hansard and perhaps give us a more detailed reply, but I suspect he already knows the answer to the last question I asked him. Partly on the back of the Brexit freedoms Bill, is there a wider review of the powers of the Secretary of State arising from the withdrawal Act, as set out in paragraph 7.6 of the Explanatory Memorandum? Is this a one-off, devolved to the Secretary of State, or are the Government going back and looking at all the provisions in the withdrawal Act? Is that a bigger process that Defra is involved in?

No, it is not. Defra is one of the busiest departments of government at the moment, not least because we have an enormous amount of follow-up to do following the passing of the Environment Act. An enormous amount of secondary legislation and work will follow. One area of the work we are looking at is how we can refine, and potentially improve, the habitats directive. That is also taking up a lot of bandwidth. What we are talking about here today is not the thin end of any kind of wedge. There is no overall Defra review that is happening. In the context of what we are talking about today, I can say that this is a one-off, as opposed to part of an overall review.

My Lords, in our increasingly interdependent world, successive Secretaries of State for International Development and Prime Ministers have recognised the crucial importance of conflict prevention and peacebuilding in our international development strategy. That is precisely because those who are affected by violent conflict are those who suffer from the least development and the fewest opportunities; of course, those conflicts spill over and affect us in our country too. Will the Government give a cast-iron guarantee that, in the priorities outlined in the new international development strategy, this cross-party approach will be continued and that support for conflict prevention and peacebuilding will continue to be a priority for the United Kingdom?

The UK is committed to working to prevent and reduce the frequency and intensity of conflict and instability, and to minimise opportunities for state and non-state actors to undermine international security. As the noble Lord said, it is absolutely in our national interest to mitigate the global impact from terrorism, serious and organised crime, and health threats, as well as regional impacts of conflict.

My Lords, when DfID existed, the department regularly published detailed country profiles setting out the purpose for delivering aid, what UK aid had achieved, what it aimed to achieve, how the UK was supporting countries to transition from aid, what the UK was getting from that aid and future spending plans. I do not believe that this information has been updated since the merger, so can my noble friend the Minister tell me whether the international development strategy will include this detailed information? If not, is he able to commit that the department will publish it in the near future?

My Lords, the most vulnerable women and children on earth live in South Sudan, where one in 10 babies die before the age of five. As the UNICEF website highlights horrifically:

“Giving birth on the floor, cutting the umbilical cord with a stick. That is the reality for some women in South Sudan.”


Any development strategy should look to increase support for those women and children, but the Government have cut support by 10% and, quite unbelievably, I understand that there are now discussions in the department to cut even further the combined health pool, which supports 80% of health provision in South Sudan. Will the Minister please intervene and make sure that these cuts do not happen, and then write to me and other noble Lords assuring us that they will not take place?

My Lords, on the issue of the geography and the example given by the noble Lord—whom I commend for being a champion for that continent—the UK remains a leader in international development in Africa. We are committed to supporting the poorest people on that continent. That will be reflected in the strategy when it is published in spring. As well as providing humanitarian support, our UK aid is helping to protect rainforests, deliver vaccines, educate girls, reduce crime and improve economic growth and development.

My Lords, between now and 2050, the population of Africa will double. One billion more people will need to be fed, to be housed and to be employed. What effect will this have on the new strategy? Will it be a priority—for example, by encouraging family spacing and discouraging adolescent childbearing?

My Lords, the Foreign Secretary has been clear—and it will be equally clear in the strategy when it is published—that we intend to restore funding for women and girls. We will continue to prioritise women and girls by supporting education systems, to empower women by strengthening sexual health and rights, and to work to end violence against women, including practices such as FGM. Within that focus on women and girls, we have already seen that one of the best ways to encourage stable populations is by investing in women and girls in the way that I have just described.

My Lords, at the end of 2021, the UK had delivered only 11% of the vaccines that it had earlier promised to the developing world. As a result, coronavirus has continued to spread and mutate throughout many of the poorest nations on the planet. How will the Government use their new strategy for international development to support and promote vaccinations in the poorest parts of the world? Do they support the World Health Organization’s target of vaccinating 40% of the population of every country by the end of this year and 70% by the middle of next year?

Protecting global health and meeting the Prime Minister’s commitment to deliver 100 million Covid-19 vaccine doses to the world’s poorest countries remains a top priority. My Lords, parishes across England have links through the Anglican Communion with international communities where the issues of poverty, conflict and disease are most clearly felt. Those are shared by the people in our congregations in this land. As the bishops from the Anglican Communion gather for the Lambeth Conference this summer, I hope the Minister will enable us to present something about our nation’s international strategy for international development that will address some of the most crucial issues. First, there are the ways in which human rights are trampled on, particularly in the context of persecution of people for their faith—both Christian and other faiths. Secondly, there is the use of opportunities for partnership with the Anglian Communion in that strategy. Thirdly—

My Lords, the volcano in Tonga demonstrated the vulnerabilities of island nations in the Pacific—as indeed, in a different way, has the Chinese Government’s intervention in the Solomon Islands. Will my noble friend the Minister say that the international development strategy will give an enhanced priority to island nations in the Pacific, when it is published?

My noble friend makes an important point. Covid exposed the vulnerabilities of those small island developing states, in much the way that climate change, in the longer term, is exposing the vulnerabilities of small island states and small island developing states. So, yes, the answer is that we are increasing our emphasis on, and will boost our support for, small island developing states. Part of this is the Indo-Pacific tilt, which noble Lords have heard a great deal about. Equally, we will be raising our aspirations towards and support for the Caribbean, through overseas territories and beyond, for precisely the reasons my noble friend addresses.

The Minister reminded us of the Foreign Secretary’s commitment to ensure that the strategy focuses on women and girls and, in her words, their “freedom to succeed”. Malnutrition is the single largest cause of death in women worldwide and I was extremely disappointed that the Government were not able to make a commitment at the Nutrition for Growth Summit in December. However, I was heartened to see that our global leadership position is returning, in part with the announcement of £1.5 billion in funding for nutrition. None the less, this will not meet the WHO global nutrition targets by 2025. Will the Government review that pledge in time for the next Nutrition for Growth Summit in 2024?

The noble Lord is certainly right. Malnutrition contributes to nearly half of all child deaths globally. It is a key priority for the FCDO. Improving nutrition will play a key role in achieving all our objectives on ending preventable deaths of mothers, babies, children, women and girls through humanitarian aid and global health. The strategy, when it is published in the spring, will lay out what that means in terms of the financial priorities and allocations.

The reduction from 0.7% to 0.5% was always going to result in difficult decisions. It is not a decision the Government took lightly or that anyone in government welcomes. We will return to 0.7% as soon as the tests laid out by the Chancellor are met. As I have said, our focus on and recognition of the importance of the continent of Africa will be reflected in the changes going forward.

My Lords, we continue to work closely with our international partners, including through the UN and in the region, to tackle the environmental threat posed by the FSO “Safer” to the Red Sea region. We have provided technical support and expertise to the UN, and we play a facilitating role between the UN, the private sector and regional actors to drive progress on mitigating the threat. We are also working with partners on contingency planning in the event of a spill.

I thank the Minister for that Answer. We have been talking about the principle that the polluter must pay. Does he agree with the assessment from environmentalists that, should this ship degrade further, we could be looking at a disaster greater even than “Exxon Valdez”? Will the Government put pressure on the backers of the Islamist Houthi regime, who are pulling the strings and preventing this ship being given the treatment it so urgently needs?

The noble Lord is absolutely right. This would be a really colossal disaster—probably four times worse than the “Exxon Valdez” spill. It would cause irreparable damage and require clean-up costing many billions. He is also right that we urgently need the Houthis to allow the UN to make a technical inspection of the vessel. Unless and until they agree to that, the international community cannot make any meaningful progress. Houthi co-operation is therefore absolutely critical if we want to make that progress.

My Lords, the UN humanitarian co-ordinator in the region warns that the risk of imminent catastrophe is very real. As the Minister will know, clearly such a spill would disrupt trade through the Red Sea and the Suez Canal, with global effects. Above all, as he has noted, it would be disastrous in the region, closing Yemeni ports, disrupting the food aid on which half the population of Yemen depends, and affecting all sides, including the Houthis. What strategies are being taken forward to try to deliver a safe resolution to this problem?

My Lords, in addition to the answer I gave to the previous question, that really is absolutely central. Our hands are tied until there is proper, meaningful co-operation. The UK has put this on the international agenda. UK-funded research identified the threat posed by the tanker and has been used by international partners, including the UN, to underpin their assessments. We have provided £2.5 million towards UN efforts. We are supporting the UN “Safer” working groups by providing a technical adviser to help them develop their mitigation and contingency plans, and much more besides. Fundamentally, we need to stop this happening, because the effects will take many years and costs vast sums of money to recover.

My Lords, I return to the fundamental question. The United Kingdom is a penholder on the UN Security Council. This ship has been there for five years and is being used as a weapon in itself. We have a responsibility at the Security Council to support the peace process, so can the Minister tell us exactly where we are now? What is the United Kingdom doing to ensure that we end this terrible humanitarian crisis in Yemen and move towards a peace process that works?

My Lords, there are numerous moving parts. It is worth pointing out that we remain one of the biggest donors to Yemen, contributing more than £1 billion since the conflict began. We remain very concerned by the situation there and continue to support the UN-led efforts to end the conflict. We believe that a negotiated political settlement is the only way to bring long-term stability to Yemen. To deal with this particular part of the conflict—this potential crisis—the UK is working closely with the UN donor group consisting of the Netherlands, Sweden, Norway, France and Germany to support UN efforts to resolve the risk posed by the “Safer”.

My Lords, to follow on from the noble Lord, Lord Walney, the answer to this possibly lies through those who control the Houthis. We all know that they are dependent to a large degree on Iran. We have diplomatic relations with Tehran; we sometimes forget that. Can the Minister say what representations our ambassador in Tehran has made to the Government there to solve this crisis?

My Lords, the UK is using every avenue we can. The noble Lord mentions one; there are others. The UK is now playing an important role in supporting a commercial initiative to resolve the issue. We supported local Yemeni partners to develop a feasible initiative, which they have been negotiating directly with the Houthis in a way that others would struggle to do. Along with the Dutch Government, the UK has been foremost in rallying the international community behind that commercial initiative, including securing support from Saudi Arabia and the Government of Yemen.

My Lords, the noble Baroness referred to many of the disastrous impacts that will happen if this oil leaks, spills or causes an explosion. I am sure the Minister is aware that the Red Sea is a crucial coral reef area. Indeed, with the warming climate and seas, it is a real area of refuge where, it is hoped, coral reefs could survive even if they die out in other areas. Is the Minister confident that enough is being done to contain the damage? It does not necessarily require Houthi agreement for containment mechanisms to be put in place in the region. More than that, we have heard lots of discussion about “polluter pays”. What contribution are oil companies making to the mitigation effort?

I will give the noble Baroness an example. There was a false alarm, if she remembers, a little over month ago, on 27 December, of a spill from the pipeline connected to “Safer”. The reaction to that—thankfully, false—alarm demonstrated how quickly the international regional community could respond if that were to occur. Due to our close co-ordination with, and support for, our allies, we were quickly able to confirm that there was no leak. I stress that, no matter how good the contingency plan, the disaster would be very real irrespective. Therefore, the priority has to be to try to stop it from happening.

My Lords, people, not animals, were the priority during the Kabul evacuation. As a British national, Mr Pen Farthing was offered evacuation as part of the organised airlift, which he declined. The decision to call forward the Nowzad staff was communicated by the Defence Secretary publicly, in tweets, on the morning of 25 August, and reiterated to the FCDO via the Cabinet Office later that day. The UK military, with the Defence Secretary’s authorisation, provided practical support for a private chartered plane organised by Nowzad. This flight occurred after the civilian evacuation had come to an end during Operation Pitting. It is worth just saying that 15,000 vulnerable people were evacuated from Kabul.

My Lords, that was all very interesting, but it did not answer my Question at all. Did the Minister not hear Dominic Dyer, who was the principal lobbyist for Operation Ark, on LBC last Wednesday—and indeed repeated elsewhere—saying that the Minister, who is answering this Question, and the Prime Minister were involved from the very start? Indeed, he was not at all surprised therefore that the leaked emails confirmed that the Prime Minister had authorised the evacuation of animals from Kabul. He went on to say that he was sad that the Prime Minister was not proud of his part in it. So why are the Minister and Prime Minister so reluctant to accept credit for what they did?

My Lords, the email that the noble Lord mentioned says nothing of the sort and confirms nothing of the sort. A decision to call forward the Nowzad team was communicated by the Defence Secretary on the morning of the 25th. The Prime Minister had zero role in authorising individual evacuations from Afghanistan during Operation Pitting. The PM has made this clear, the Defence Secretary has made it repeatedly clear, other Ministers have made it clear and so have I in this House and outside of this Chamber. We got more than 15,000 people out during that process; it was the biggest and fastest evacuation in our history. Animals were never prioritised over people.

My Lords, I am slightly troubled by the Question, because we run the risk of overshadowing what was an incredibly successful operation in Operation Pitting. I hope that your Lordships’ House will join me in paying tribute to those members of 16 Air Assault Brigade who risked their lives in this operation doing a tremendous job in evacuating some 15,000 people. I simply seek reassurance from my noble friend that there are no circumstances under which animals would take priority over people.

My Lords, I can absolutely provide that reassurance. I add that Pen Farthing was on one of the very last flights to leave Afghanistan; he left on his own charter plane rather than on an RAF flight. It was not part of the evacuation effort, and the flight took place after the evacuation effort had ceased. That private plane landed in Kabul on 28 August. Animals were never prioritised over people at any point during the process.

As a result of the emails that we have seen from the brave Foreign Office whistleblower, either Parliament has been misled by the Prime Minister and the Minister or life and death decisions have been made in the name of the Prime Minister or the Minister but without the authority of the Prime Minister or the Minister. Which would the Minister consider to be most serious?

I do not accept the premise of the question on any level at all. This was an extraordinarily difficult time, particularly for officials in FCDO. There were people who were working two jobs all day and almost all night, dealing with thousands upon thousands of emails with evacuation requests every single day. Their work was heroic. It has been made clear that the PM did not weigh in on the Nowzad case. I do not deny that there is some confusion. It is not uncommon in Whitehall—as anyone who has been a Minister knows—for decisions to be interpreted or portrayed as coming directly from one department or another or even the Prime Minister, even when that is not the case. In this instance, that is not relevant because the decision was made publicly and directly by the Secretary of State, as he has made clear.

My Lords, I think that the families and children who were left behind would be shocked by the Minister. If there was a plane flying out of Kabul, I know who should have been on it. The simple question is—the noble Lord has to answer it, because I asked a Question last week about the Companion to the Standing Orders—why is it that someone in his private office believed that the decision to facilitate this evacuation of animals was approved by the Prime Minister? It is his private office. Can he tell us why the official believed that? It is a simple, straightforward question that deserves an answer.

I can answer half the question. I cannot tell the noble Lord why the confusion arose, other than that it was a particularly complicated time, but I can say that at the time the email was sent, the staff member who the noble Lord mentions was seconded to that emergency evacuations unit at the FCDO and was emailing in that capacity. The email was not sent under my instruction or with my knowledge; it was part of a wider process.

My Lords, as I said, it was an exceptional emergency situation. In normal circumstances, we do not recommend the movement of consignments of animals, particularly large consignments. We take biosecurity very seriously. On landing in this country, the cats and dogs were transferred to prearranged quarantine facilities where they will have to remain for four months or until they have completed the rabies risk management process fully. The process ensures that animals meet the highest standards and protects our rabies-free status, which of course we value greatly.

My Lords, the noble Lord has not actually answered the Question that was put, which was not about authorisation. It quite clearly asked “what representations” the Government received “concerning the evacuation of Pen Farthing and his animals from Kabul.” Will he address that issue? I suspect that, like every MP, and probably every person in this House, I experienced an extraordinarily effective campaign mobilising people to write emails to their representatives. So, like everyone, I received hundreds, maybe thousands of emails from people on this issue, but my position—in writing, on the record—has always been that animals should never have been, and were not, prioritised over people. The noble Baroness asked about specific representation. I could spend hours, probably, relaying the torrent of emails that was received, but I will add one further thing: at no point did the Government as a whole receive any kind of authorisation on this issue, one way or the other, from the Prime Minister, who had no involvement at all. I think that was the point of the Question that was put to me and I emphasise that again.

My Lords, it is coming to something when the Prime Minister has a habit of not knowing what was going on in his department, and it sounds as though the Minister does not know what is going on in his. Can he explain why this individual was allowed to get a private jet in when there were still people we wanted to get out of there? How could he do it when the Government could not for a lot of brave people who will potentially give their lives because Ministers failed?

I think that is a completely nonsense question. The idea that the Prime Minister should be engaged in issues around the welfare of a handful of animals when we were engaging, as a Government, in one of the biggest—indeed, the biggest—evacuations this country has ever been involved in is just absurd. I would be appalled if the Prime Minister had been involved in such minutiae, frankly. As I said, we got 17,000 people out in a very short period of time. That is a record—it has never happened before. I think we can salute our Armed Forces and those officials who worked incredibly hard to pull off an extraordinary feat.

My Lords, does the Minister agree that the Navy evacuated one-third of a million people from Dunkirk and that that was actually the largest evacuation in our history? I do not know how many animals came, but certainly it was one-third of a million people.

I do not know what emails were sent. Millions of emails would have been sent. I can say that there was no email from the Prime Minister’s department, as the noble Lord called it, that authorised in any way this evacuation. That authorisation never came from the Prime Minister. I never said that he did not know about it; I am sure that, like everyone, he would have seen it on the news, but he was not involved in the decision and did not weigh in in any way at all.

My Lords, on 20 December, the Foreign Secretary hosted her Gulf Cooperation Council counterparts. The meeting was primarily focused on foreign policy and trade and investment, and the full communiqué detailing the main discussion points has been published on GOV.UK. I can reassure all in this House that we regularly engage with our partners from the GCC and consistently underline the importance of respect for human rights. We continue to work closely with our allies to tackle any human rights concerns.

My Lords, a month before that meeting, the Foreign, Commonwealth and Development Office published its update on the human rights abuses about which it was concerned in Saudi Arabia. They include enforced disappearances, arbitrary detention and torture. Did the Foreign Secretary raise these issues with the Saudi Foreign Minister when she met him and with what results? If not, why not?

My Lords, no aspect of our relationship with Saudi Arabia prevents us speaking frankly about human rights. Saudi Arabia remains an FCDO human rights priority country, particularly because of its use of the death penalty and restrictions on women’s rights, freedom of expression and religious freedom. We regularly raise concerns with the Saudi authorities through diplomatic channels, including through Ministers, our ambassador and the British embassy in Riyadh.

My Lords, I want to underline the important question that the noble Baroness, Lady Anelay, has just asked the noble Lord. Will he return to the issue of capital punishment that he has just referred to and confirm that, since 2015, there have been over 600 executions? Although there has been a welcome reduction in recent years, did we raise that directly with the Saudi authorities and did we raise with them their obligations under Article 18 of the 1948 convention on human rights, the issue of freedom of religion or belief—comparing them perhaps with the much more favourable disposition of countries such as the UAE in implementing Article 18?

My Lords, the full communiqué has been published on the government website but, in relation to the death penalty, in October last year my noble friend Lord Ahmad—in whose portfolio this sits—raised his concern regarding the use of the death penalty in the kingdom with Dr Awwad al-Awwad, president of the Saudi Human Rights Commission, inquiring specifically into the case of Abdullah al-Howaiti and Mohammed al-Faraj, both believed to be minors at the time of their crimes. He raised a range of other concerns as well.

My Lords, at the time of the meeting, a number of human rights organisations wrote to the Foreign Secretary regarding Dr al-Singace, a human rights defender who is in prison in Bahrain. He has been there for over a decade and has been on hunger strike for over 190 days. Can the Minister tell us whether this case was raised and whether we are seeking his release after this horrendous period?

My Lords, the International Relations Committee found that the Government were on the wrong side of international human rights law in not pausing arms sales to Saudi Arabia while the attacks in Yemen are carrying on. The Minister will know that the UN Secretary-General has condemned the Saudi-led coalition for the recent attack on 21 January that led to 91 civilians dying. This, together with the Houthi rebels who are recruiting child soldiers—primarily from Sudan—shows an escalation of the conflict in Yemen. This is the very wrong time to be cutting our support for women and children in Yemen. Will the Government now reverse this and ensure that those most at risk in Yemen are supported by the Government, rather than the floor being taken away from under them?

As I said, we have a good, full and frank relationship with our Saudi Arabian allies. There are no issues that are off the table in our discussions with them. Saudi Arabia remains a human rights priority country within the FCDO, particularly because of the use of the death penalty. We will always raise concerns with the Saudi authorities when it is felt that we should do so.

My Lords, my noble friend Lady Anelay is entirely right to raise the question of promoting human rights. It is a great cause, but does the Minister agree that along with rights go responsibilities? Will he accept that if these countries are to join properly in the comity of nations and gain our respect, they not only have to improve their own human rights record but have to stand up internationally and vocally for the rule of law and speak out in flagrant breaches of the rule of law—particularly as we now see being proposed by President Putin around the borders of Ukraine?

My Lords, the UK has always believed that reform will be the guarantor of longer-term stability in the region—that we are more likely to bring about change through engagement, dialogue and co-operation. However, of course my noble friend is absolutely right to say that with the rights enjoyed by these countries come enormous responsibilities.

My Lords, some of these states, in contrast with the UAE, have a very patchy record on human rights, particularly in respect of freedom of Christians. Does the Minister believe that gross human rights violations should render a state ineligible for membership of the UN Human Rights Council?

My Lords, some 20 years ago we signed a big contract with Qatar to get liquid natural gas from the North Dome oilfield and take it round to Milford Haven, and that contract was running well. Bearing in mind the current energy crisis and the need for gas, were there any discussions about that? It seems to have tailed away slightly. Where do we stand now on ensuring that provision of LNG?

My Lords, I may not have heard the beginning of the question correctly; I think it was about whether the countries visited permit the kind of religious freedom that the noble Lord rightly says should exist in all countries. If that was the question, the answer is no. There are any number of restrictions in place in countries across the region, including Saudi Arabia. In this country, we have always strongly supported the right to freedom of religion or belief across the region and indeed across the world.

My Lords, my noble friend Lord Purvis asked specifically about Yemen and Saudi involvement, but I did not hear a clear response on that. Could the Minister comment on the escalation of the war and the humanitarian disaster in Yemen? Also, could he comment specifically on whether, in the discussions, Saudi Arabia is being asked why it is not allowing international organisations to deliver basic food and medicine to people who are starving and suffering in this terrible conflict?

My Lords, there is barely a country in the world with which we will not have some differences on domestic policy, but with Saudi Arabia this has spilled over into international affairs—in Yemen, with the kidnap of the former Lebanese leader and in the Khashoggi murder. Will my noble friend the Minister confirm that, in our relations with all GCC countries, we will stress the vital importance of the principles of national sovereignty, territorial jurisdiction and order among nations?

My noble friend is exactly right, and that is very much the view of the British Government. There is no single formula for success or single model of government, particularly in a region with such distinct cultures and differing political systems. It is not for the UK or indeed other Governments outside the region to dictate how each country meets the aspirations of its people, but there are certain principles that we must—and do—continue to stand up for.

My Lords, we are currently consulting on measures to end the use of peat in horticulture in England and Wales. This includes a call for evidence on the impacts of ending the use of peat and peat-containing products in the professional horticulture sector. The consultation closes on 18 March this year. Our assessment of the responses and the evidence that we receive will inform our next steps, which will include targeted engagement with specialised areas within the sector.

I was frightened that that would be the Answer. Environmentalists are sick of all these consultations. The Government promised to ban peat in 2020, and there were years to achieve that then. In the interests of moving on, I suggest two things: first, that imports of professional peat be stopped, because when we stop selling it here it will just get imported. Therefore, this is a primary thing to do. Secondly, we must replace peat with something, and we could use green waste from councils, for example. Can the Minister take that back to his department and make them think about it?

My Lords, I will certainly take both those suggestions back to the department. The point the noble Baroness makes about imports is a good one; I will have that discussion with the Secretary of State. She is not the only person who is sick of endless consultations but unfortunately, they are unavoidable when the impact of a policy affects the value of a business or of assets. We have no choice but to consult, but we are doing so as quickly as we can.

My Lords, with apologies for jumping in too soon, the main concern of those who use peat professionally is finding alternatives of sufficient quality and quantity. This is not easily solved, even by just using green waste. Can my noble friend ensure that very real research is done by his department into a cure for this problem?

My noble friend raises an important point, and she is right that there are insufficient amounts of suitable replacement materials. However, there is clearly scope for making better use of what is otherwise garden and vegetable waste. There are high-quality peat-free alternatives that are effective and price-competitive, including a growing material formulated with wood fibre, bark or coir, all currently available in garden centres.

My Lords, as the Minister knows, 3% of the earth is covered with peatlands, but they account for a third of the store of carbon. It is imperative that this carbon is not disturbed. We have a huge amount here in the United Kingdom. Can the Government commit to reducing to a minimum the amount of carbon from peat bogs?

My Lords, I absolutely make that commitment, and that is one reason why we are moving with renewed vigour on banning the use of peat in horticulture. Additionally, our England peat strategy lays out ambitious plans to restore degraded peatlands on a scale we have not done before in this country, with plans leading up to 2050 involving hundreds of thousands of hectares being repaired, for all the reasons that the noble Lord has identified.

My Lords, the Minister may be aware that DAERA has undertaken a consultation on the peatland strategy for Northern Ireland. While peatlands cover 11% of England’s land area, 24.6% of Northern Ireland is covered by peat. Is there scope for Defra to play an active part in the formulation of this strategy to ensure that it delivers the very best results for Northern Ireland and its ecosystem?

The peat strategy we have produced is an England peat strategy, so clearly, there are geographical limits. However, the issue goes far beyond England: it is a UK issue, for the reasons the noble Lord has provided. Peatlands are iconic features of our landscape. They are the UK’s largest stores of carbon by far, and they provide hugely important ecosystem services, supply over a quarter of the UK’s drinking water, decrease flood risk and provide food and shelter for rare and, in some cases, endangered wildlife. That is why peat recovery and peat protection is a priority.

My Lords, an enormous amount of progress was made at COP 26. The story that made the headlines related to forests but the principles that were agreed around the protection of forests apply also to peatlands. Between us, we secured unprecedented sums—billions of dollars of finance—specifically to protect fragile, carbon-rich, biodiverse-rich ecosystems such as peatlands. Part of the agreement we reached involved commitments by countries with those precious habitats to end their destruction and to engage in restoration with renewed vigour.

My Lords, the Minister has already referred to the need to protect peatlands as an example of our iconic landscapes; they are a feature of these islands. Considering that the devolved Administrations are involved in this work as well, as a follow-on to COP 26 and as a means of protecting our landscapes, can he give due consideration to leading a summit with his ministerial colleagues and those involved in environmental organisations on how to protect our precious peatlands the length and breadth of the United Kingdom?

I am very happy to make that commitment on behalf of my colleagues in whose portfolio and remit this issue sits. From an international perspective, the noble Baroness makes a very important point. We are designing programmes on the back of the new commitments we have made using our ODA; £3 billion of our international climate finance commitment will be invested in nature-based solutions, a very big part of which will be peatlands. I hope that we can describe in more detail soon what those projects will involve.

My Lords, in a Written Answer to me, the Minister stated that all government departments and their arms-length organisations should meet the mandatory government buying standards, which include not purchasing peat. Can he confirm that all government departments are indeed abiding by that ruling, and explain why organisations such as the Forestry Commission are still purchasing and using peat when, as we have heard, other alternatives are available?

The noble Baroness is right: Forestry England continues to use peat in the manner she has described. However, it has committed to eliminating completely the use of peat in the growing media by 2028 at the very latest. All government departments and their related organisations must ensure that they meet the minimum mandatory government buying standards when buying goods and services. We also encourage the wider public sector to do likewise, but it is certainly our intention to accelerate the progress that is and being and needs to be made.

I am not convinced that peat as a fuel does fit into this picture. Our priority is to restore peatlands as closely as possible to their natural conditions, so they can fulfil the ecological functions we need them to fulfil.

My Lords, I am interested to understand how the Government reconcile allowing commercial peat exploitation while at the same time the Exchequer, and thus taxpayers, are paying millions of pounds for peatland restoration.

I am afraid I cannot provide that justification because there is a clear contradiction, but that is why we are pushing ahead with our proposals and measures to eliminate the use of peat in horticulture. The noble Lord makes a very good point.

My Lords, does my noble friend share my concern that, since we have left the European Union, we will now have different environmental standards in England, Wales, Northern Ireland and Scotland? Will he use his good offices to ensure that the devolved nations all impose a ban on the use of peat for horticultural purposes, bearing in mind that it takes 200 years to create a peat bog?

My Lords, it is not a source of concern that we are able to legislate or regulate differently; the UK has demonstrated a commitment to raising the bar in terms of environmental protections. It is generally recognised—if not in this country then certainly elsewhere—that the UK is a world leader in conservation and nature restoration, but it is for the devolved Administrations to make their own policies and, of course, we will continue our discussions in the hope that we are as closely aligned as possible.
