This school produces, for kids from all sorts of backgrounds, some of the best results in the east midlands, but its buildings are in a shocking state. He has been refused a condition improvement grant, despite the fact that he has temporary and mobile classrooms that are classed by the Secretary of State’s Department as grade A. Will the Secretary of State assure me that, in his national funding formula negotiations, there is no discrimination against grammar schools? I often find that, while the education is wonderful, the buildings are peeling.

The Minister will know of my enthusiasm for campaigning for another outstanding secondary school in Wolverhampton. Will she work with me to see that that comes to fruition and that we get another outstanding secondary school in Wolverhampton?
My hon. Friend shares our passion for making sure that we improve education in Wolverhampton and all across the country. He has been championing that non-stop, lobbying my right hon. Friend the Secretary of State. The free schools programme has created thousands of high-quality school places. Three secondary applications have been received from my hon. Friend’s constituency, and we hope to make a decision later this year.
Rolling out the excellent holiday activity and food programme for children across the country will mean that even more children will benefit from free healthy meals and enriching holiday activities. We have already written to all the local authorities with guidance. We will work closely with them, including sharing best practice from our pilot programmes, and we are appointing a national organisation from spring next year to support the local delivery.
Ipswich was lucky enough to be one of those pilots and, this summer, it actually had the holiday activity and food programme in operation. It was great to go there to meet not only the children who benefited from it, but the different organisations and the young adults from Ipswich who were able to play a part in delivering that service. Can the Minister outline what plans are in place, looking ahead to the Easter and summer holidays, to make sure that this continues to happen and that the community is completely aware of how it can get involved in this fantastic project?
It was a huge pleasure to visit the Government’s holiday activity and food programme with my hon. Friend in Ipswich this summer. We saw at first hand how local partnerships helped to deliver these excellent schemes, so we want to encourage schools, childcare providers, food suppliers, voluntary organisations, sports experts, and arts experts all to come together in partnership. Interested parties should contact their local authorities and together we will all make sure that next year’s holidays are full of food and fun.
This Government are completely committed to free school meals, and no Government have ever been more generous with entitlements, extending eligibility to all infants and disadvantaged children in further education. But throughout the pandemic we also extended eligibility to groups with no recourse to public funds, and we continue to work across Government on longer-term eligibility for these families. Meanwhile, the extension of eligibility for free school meals remains.
It is Government policy that has forced overstretched schools, charities and councils like Southwark to pick up the pieces and pay the price of the hostile environment that has left over 100,000 with no recourse to support, according to the Children’s Society. The Minister says that there are cross-Government talks. What representations has she made to the Home Office to end this scandal and save schools from this huge, inappropriate burden when they are already struggling with covid?
I remind the hon. Member that our new £170 million covid winter grant scheme will directly target the hardest-to-help families and individuals, and also provide food for children in need of it over the holidays. Some families with no recourse to public funds do receive support from the Home Office as is provided for under the Immigration and Asylum Act 1999, and section 17 of the Children Act 1989 requires local authorities to safeguard and promote the welfare of children within their area if they are in need, regardless of their immigration status.

Thank you for your excellent chairing of this debate, Sir Christopher. I start by congratulating my hon. Friend the Member for Devizes (Danny Kruger) on securing this important debate. It is good to have so many different hon. Members present.
I will use this opportunity to update the House on what the Department for Education has been doing to support children, young people and their families during this time. The Government are dedicated to supporting children and families, and the Secretary of State for Education has been entrusted with the family policy brief by the Prime Minister, to ensure that there is a Cabinet-level Minister with oversight of the issue. The Secretary of State is very clear that the two core aims are the protection of vulnerable children and ensuring that every child has the best start in life. He recently made a speech outlining the improvements needed to the adoption system in this country, aiming to close the gap between the number of adopter families and the number of children looking for those loving-forever homes.
We are soon to announce the independent review on children’s social care with the aim to reform and improve an incredible service that plays a vital role in the lives of our most vulnerable children. We continue to work on the SEN review for children with special educational needs and disabilities. We work with Departments across Government on a range of policies to support all children to grow up in happy and loving environments.
No, because there is a lot that I want to update hon. Members on. As the hon. Member for Walthamstow (Stella Creasy) said, supporting a family starts even before a child is born. My hon. Friend the Member for East Worthing and Shoreham (Tim Loughton) pointed out how important health visitors are, so I was really pleased this month when the chief nursing officer made it absolutely clear that health visitors must not be redeployed from their frontline support for families, even as cases of covid rise further.
Early education and experience set up a child for life and support parents with childcare. Since 2013, the proportion of children who are at a good level of development by the time they end their reception year has gone up from one in two to three out of four. This is why the Government continue to invest and support early years education. We introduced the 15 hours free childcare for disadvantaged two-year-olds and then 30 hours for three and four-year-olds. We prioritised the early years sector for reopening from 1 June and out-of-school clubs and provision for reopening on 4 July. We have continued to support the sector by paying for those Government hours of entitlement at pre-covid levels of attendance, even if the providers had to close. Attendance is now around 85% of the usual pre-covid levels.
We also know that grandparents and other family members often provide crucial informal childcare. The good news is that those childcare bubbles can still be formed even in higher lockdown areas.
The hon. Member for Strangford (Jim Shannon), who was born in a wonderful part of the world, spoke about mental health. On World Mental Health Day, we published a state of the nation report which looks at research into children’s and young people’s mental health at this time. Levels of happiness among all children have remained stable, compared to previous years, but children have been anxious about missing education and social contact, which is why it has been so important to get them back to schools.
Levels of anxiety have increased for certain cohorts of children and young people, especially disabled children, BAME children, disadvantaged groups and those with previous mental health conditions. This is why we introduced the Wellbeing for Education Return project, which gives support for schools and colleges, delivered in their local area by local mental health experts. Over 97% of local authorities have signed up to that. We must continue our Green Paper commitment to introduce new mental health support teams in all schools and colleges and training for senior mental health leads and faster access to specialist support.
My hon. Friend the Member for Penistone and Stocksbridge (Miriam Cates) spoke of a heart-breaking story about families of children with special educational needs. They have faced enormous challenges. The Government have provided over £37 million to the Family Fund to help over 75,000 of those families, including an extra £10 million specifically for the pandemic. As she knows, we are also increasing the high-needs budget by nearly a quarter over a two-year period. In our £1 billion catch-up premium for schools we have ensured that specialist settings and alternative provision will get three times more per pupil than those in mainstream schools.
Fundamentally, it has been so important to make sure that all children can get back to school and get back their support, especially those with special educational needs and disabilities. Over 80% of those children and young people are back in their educational settings now.
The shadow Minister, the hon. Member for Hampstead and Kilburn (Tulip Siddiq), mentioned that children in care and those children who have a social worker are especially vulnerable, which is why we kept schools open for them at the height of the pandemic. I am enormously proud that we were one of the few countries in the world that did that. Yes, attendance was low, because parents were rightly concerned at the beginning of the pandemic, but it grew over the summer and now 85% of children with a social worker are now back at- school.
We also invested another £360 million in frontline charities supporting vulnerable people during the crisis and worked hand in hand with the NSPCC to make sure that people could report—and knew where to report—a child at risk of harm.
We have provided another £4.7 billion to local authorities to help them respond to the pandemic. We know that some local authority children’s services are stronger than others, so we have supported those who need extra help by deploying our new react teams across the regions and Ofsted inspectors have come back to the frontline.
Family hubs were mentioned with great passion by my hon. Friends the Members for Congleton (Fiona Bruce) and for Don Valley (Nick Fletcher) and I share their passion. I have an excellent family hub in my constituency that offers early support to families who need advice or help. Co-locating such services supports families and providers.
To inform Members, what is happening to the £2.5 million which the Chancellor allocated in the Budget several months ago and which I understand was passed to the Minister’s Department to champion family hubs?
I will make announcements on that very shortly. I want it to be spent on research and development.
Regarding adoption, data was published last week showing a gap of about 600 children between those waiting for adoption and those waiting for a child. The gap has narrowed, but we must narrow it further. We need to encourage more families to come forward to provide those loving forever homes.
We are investing £1 million in a national adoption recruitment scheme and another £2.8 million supporting the voluntary adoption agencies. Courts have prioritised adoption. Flexibility to the adoption support fund during covid has helped another 60,000 families. The changes we made to social care regulations—incidentally, the Opposition tried to throw them out—were specifically to make sure that adoption could continue while not being delayed for medical reports. However, I take the important point made by the hon. Member for York Central (Rachael Maskell).
We have put in more support to those who are leaving care to make sure that they do not need to leave care at this time. On the very important point on child poverty and food, we have injected more than £9 million into the welfare system over this period and given support to income protection schemes, mortgage holidays, additional support for rent, and we have done other things to support family income.
When schools were closed to the majority of pupils, we launched the national voucher scheme. It was challenging, but it meant that 1.4 million children who normally received free school meals could still be supported. We also extended free school meals to the children of those families who have no recourse to public funds. Some £380 million was spent on supermarket vouchers, but now that schools have reopened, kitchens have reopened and children are being provided with food, which is so much more important than a paper voucher.
Schools up and down the country are also providing food parcels to those who are self-isolating. In the summer, children from more than 1,800 schools received healthy breakfasts through the breakfast club programme. Our holiday activities and food programme was absolutely remarkable in the 17 local authorities where it was run. We have also announced £63 million for local authorities to provide discretionary financial help to those in need in schools.
My right hon. Friend the Member for Chingford and Woodford Green (Sir Iain Duncan Smith), who has now left, mentioned that schools sometimes sent home whole bubbles. We have set up a new Department for Education helpline to help schools with bespoke advice when they have cases.
Finally, the hon. Member for Loughborough (Jane Hunt) spoke about the outstanding work that schools and school staff have done to bring children back to school. She is absolutely right, and I agree with every word she said about how fabulous school staff up and down the country have been. We will continue to work with other Departments to put in place significant amounts of wider support. As we know, providing a child with the best start in life means that they can grow up in a loving, happy, stable home environment. That is what we are committed to do.

I congratulate my hon. Friend the Member for Mansfield (Ben Bradley) on securing this really important debate. As he knows, ensuring equality of opportunity is a topic that is close to my heart. I feel privileged to be part of a Government that holds this important issue as a real priority.
The Equality Act provides protection to all children, as well as to adults. We must get away from the perception that protected characteristics in the Act are there only to protect certain groups and exclude others. For example, a white boy at school is covered by the Act in the same way, and to the same extent, as his BAME classmates or schoolgirls of any race. If a white boy from a disadvantaged background feels he has been treated less fairly in educational work compared with his female or BAME peers, he has a means of redress available to him, initially through informal routes, but ultimately at a tribunal if it is felt to be necessary.
My hon. Friend the Member for Mansfield asked about the elements of the Act that relate to positive action. The Act enables positive action to help to ensure that all groups of society are fairly represented, but that is not the same as positive discrimination, where one group might be unfairly favoured over another. Positive action is designed to enable the promotion of a level playing field. An example of positive action is when an employer wants to address the fact that it does not have any disabled apprentices; the employer can favour the recruitment of a disabled applicant over a non-disabled one, provided that their applications are broadly of equal merit. That is positive action.
Positive discrimination is unlawful under the Equality Act, however. If people have evidence of positive discrimination, they should take such cases to the courts or tribunals and call out breaches, to help to ensure that the positive action provisions are used only as intended. The provisions were supported across Parliament when the legislation was brought in in 2010. We support them as a means of levelling up the playing field for disadvantaged groups, but it is really important that the public and private sectors understand the lawful use of positive action. The code of practice and guidance exist for that purpose.
My hon. Friend the Member for Mansfield also asked, most perceptively, about the socioeconomic provisions in the Act. Social status is not one of the characteristics protected by the Act, and we need to be careful not to use it as a vehicle for social engineering rather than as a shield against discrimination. A duty of that kind would more likely result in public bodies trying to retrofit a levelling-down agenda, rather than offering better opportunities for all disadvantaged groups and levelling up.
I do not mean to try to catch the Minister out here, but can she explain to me the difference between social engineering and positive action?
Positive action is designed to enable opportunities to be given, as opposed to positive discrimination, which is unlawful. That is why it is so important that the guidance is clear on the subject. We need to promote the level playing field and enable levelling up, and not encourage behaviour that could constitute levelling down.
We need to avoid taking a tick-box approach. Amending part 1 of the Equality Act would not necessarily lead to what my hon. Friend seeks, because there is a real danger that it could create a tick-box mentality, which might be seen as an acceptable substitute for meaningful action. We want to avoid such distractions and concentrate on real help. I assure him that the action he has taken today has ensured that the Government will keep both the legislation and the guidance under review.
We are also improving our approach to equalities. We are reshaping the Government Equalities Office, bringing it closer together with the race disparity unit and the disability unit to create an equality hub. We need to move away from the idea that we are simply dealing with groups that already enjoy Equality Act protection, and instead ensure that we are looking at individuals across the country and identifying those who are most in need, what their biggest barriers to success are and where there is unequal delivery of public services. We want to examine issues such as geography, as my hon. Friend the Member for St Austell and Newquay (Steve Double) mentioned, where communities in certain areas risk being held back. We also should be focusing on analysing the data, looking closely at individual dignity and opportunity and also at areas such as income and background, so that we have a more holistic view.
We understand, however, that pupils from disadvantaged backgrounds, including boys, may face greater challenges at every stage of education. We are committed to addressing those challenges, levelling up education standards and improving outcomes.
Will the Minister tell us a little bit about how the Government are particularly addressing the issue of boys from disadvantaged backgrounds, to get that levelling-up agenda delivered?
Absolutely. One of my passions is the early years of development, and too many children, especially those from disadvantaged backgrounds, are falling behind in those early years. It is then so hard to close the gaps once they have emerged, and evidence shows us that what happens in a child’s pre-school years—those very early years—are the most important and have a huge influence on later outcomes. That is why the Government have been making record investments in early education, including 15 hours of free education for all disadvantaged two-year-olds as well as three and four-year-olds. It is also why we have doubled the amount of free childcare available to three and four-year-olds for working parents.
These investments have led to a real improvement. The latest early years foundation profile shows that the proportion of all children reaching a good stage of development by the time they start school—year 1—has gone up from 51%, or one in two children, in 2013 to nearly 72%, or two in three children, in 2019. Furthermore, over the same period, the gap between the children who are eligible for free school meals and their peers at age five has narrowed from 19 percentage points to just under 18 percentage points. Indeed, the same is true in school: because of the education reforms that were mentioned by my hon. Friend the Member for Warrington South (Andy Carter), 86% of schools are now judged to be good or outstanding, compared with only 68% of schools in 2010. As a result, the disadvantage attainment gap has narrowed by 13% at age 11 and by 9% at age 16, and it has narrowed at every stage from early years to age 16 since 2011. However, we know there are still issues in other areas, so we have committed an extra £18 million to the £72 million opportunity areas programme to transform the life chances of young people in 12 of the most disadvantaged areas of the country—those with particularly low social mobility.
My hon. Friend the Member for Warrington South also mentioned the very important issue of exclusions. It used to be the case that looked-after children—children in care—had the very highest rates of permanent exclusion, and we are making sure that those children in care, who often have the worst life outcomes, are supported to succeed in education. For example, we have put in place virtual school heads, designated teachers for looked-after children, and extra funding through the pupil premium plus for this group. The virtual school heads, in particular, have made a significant impact since they were introduced in 2014. Data shows progress across maths, reading and writing for looked-after children, and today, looked-after children are less likely to be permanently excluded from school than all other children. Interventions of this nature are making a real impact on some really disadvantaged groups.
However, we know that the disadvantage gap is at risk of widening because of the pandemic. Lack of digital access is of particular concern, and that is why we have committed over £160 million to support remote education access and provided nearly half a million laptops and tablets to those most in need. We have also announced the £1 billion covid catch-up fund, of which £350 million is going into the national tutoring programme. That will particularly focus support from high-quality tutors on disadvantaged and vulnerable children who are most at risk of falling further behind. The first group of tutors starts on 1 November, and I strongly urge all my hon. Friends to ensure that schools in their constituencies are aware of that element of the catch-up programme and ensure that the vulnerable students in their area receive support.
I do not expect an answer to this, but I want to highlight a challenge. The poorest school in my constituency in the poorest catchment is very keen to access support for IT, tutoring and everything else, but 25% of parents within the school are illiterate and they do not want to take laptops home because they fear that the laptops will be stolen, or that they will targeted by gangs involved in drugs on the estate where they live. There are children on free school meals, and then there is another group of children who have this huge disadvantage. Will the Government consider that group, who will not be able to engage with laptops and tutors? Is there something else we can do to help them?
My hon. Friend raises an excellent point. This is why the national tutoring programme will bring extra resources into schools to help young people. That will be on top of the £650 million catch-up fund that has gone to all schools. It will provide extra tutoring and support—one on one, or in small groups—for those individuals, for whom it is so important. This is a deeply challenging time, and we absolutely understand that we need to make sure that the attainment gap does not unnecessarily widen any more. We have spent a decade trying to close it, and we need to make sure that it does not spring apart again, particularly for the cohorts of children that my hon. Friend mentions.
I am enormously grateful for my hon. Friend’s support for this agenda. He has raised important concerns. I particularly note his questions, which we will take up with the Equalities Office. I hope I have helped to explain the difference between positive action, which is allowed, and positive discrimination, which is not. I point him again to the need for continual work on the guidance on this subject, and I will make sure that I continue to raise these points with the Minister for Equalities, my hon. Friend the Member for Saffron Walden (Kemi Badenoch). I hope my hon. Friend the Member for Mansfield is happy that the Government’s response today echoes his concerns. We have taken steps to underline the importance of supporting the most disadvantaged and vulnerable, and to make sure that all children from all backgrounds, including the most disadvantaged, have the best opportunities in life.

Commons ChamberHigh-quality childcare supports children’s development and helps parents to work, and we are therefore continuing to bulk-buy childcare hours from the sector at pre-covid levels, even if providers had closed due to the pandemic. Some 708,000 children attended an early years setting on 1 October, which is an increase of about 300,000 compared with the end of the summer term. We have also encouraged schools to ensure that after-school and breakfast clubs are reopening.
Many residents in Hyndburn and Haslingden have contacted me regarding our manifesto commitment to delivering a £1 billion flexible childcare fund to support parents and children with holiday and wraparound care. What progress is being made on delivering on that promise?
I thank my hon. Friend for raising such an important question. We know that families want to be able to access affordable out-of-school childcare, and that is particularly important during the school summer holidays, so our manifesto commitment is to establish a new £1 billion fund from next year to help to create more accessible childcare, including before school, after school and in the summer school holidays. As with all future commitments, this is dependent on the outcome of the spending review, and I hope to be able to update the House with further details following the spending review.
Nurseries in west Berkshire suffered a loss of fee income during the lockdown, and they are now anxious about a reduction in parental demand. They are grateful for the guaranteed funding until the end of this year, but what assessment has my hon. Friend made of the recovery of parental demand, and what assurances can she give the sector for the rest of the academic year?
May I start by thanking childcare providers in west Berkshire and across the country for providing such essential support for our very youngest children? This term, we have committed to block buying those hours from providers, provided that they are open, regardless of how many children are attending, and local authorities should pass that funding on. We are obviously looking closely at the situation from next term, and the future funding will be dependent on the funding review, but the really good news is that attendance is increasing and, on 1 October, the numbers showed that it was about 80% of the pre-covid usual daily level of attendance.
Data from Ofsted shows that the number of nurseries and other childcare providers with coronavirus cases has, on average, been doubling every week since the start of September, yet many early years workers cannot access covid tests or get quick results, which is forcing them to stay at home. I have heard from a nursery in Surrey that has been forced to close as a result, affecting 40 children and depriving their parents of childcare. Will the Minister confirm whether childcare workers still qualify for priority testing? If so, why are they not getting it?
Yes, I can absolutely confirm that education and childcare workers, including those in the early years, are essential workers and have priority access, via the online booking portal. That has been the case since April.
Children with special educational needs and disabilities have faced many challenges during the pandemic, and some of them will find returning to school difficult, but the good news is that more than 80% of those with education, health and care plans are now attending. We have published guidance and resources to support schools to re-engage pupils with learning. We are increasing high-needs funding by a nearly quarter—a record amount—over a two-year period and we are also providing an additional £1 billion in catch-up support for schools.
I asked the Education Secretary on 2 July and again on 7 September about support for children with SEND during the covid-19 catch-up. He said that he would write to me, but that letter has not been forthcoming. I ask again: what assisted technology is being offered as part of the distribution of laptops and tablets to enable pupils to work from home if needed? Will the Minister provide an answer this time or will I have to do this again next month?
I am enormously proud of the fact that we are one of the few countries in the world that have asked schools to remain open for vulnerable children, including those with the most severe disabilities. Although we know that they could not all attend due to their own circumstances, it is incredibly important that they all get back to schools. On remote learning, to support schools in delivering remote education, we have delivered a range of resources and guidance, including specific support for children and young people with SEND. Obviously, those who were eligible for laptops, receive laptops and devices as part of that programme.
We are putting an extra £730 million into funding those with complex special educational needs and disabilities next year, which represents a 10% increase year-on-year in the high needs block, and that comes on top of the £780 million increase for this year, which means that the block will have grown by £1.5 billion, which is an increase of nearly a quarter. In Hertfordshire, funding for the high needs block will grow by 24% over that two-year period.
I welcome the increased Government funding in Hertfordshire, but the county council does not pass it through to families on the frontline. It is cutting funding to our Delivering Special Provision Locally groups. Our child and mental health services are overwhelmed. It is focusing on process, instead of our children with SEND. Will the Minister undertake a review of the real accessibility of SEND services in Hertfordshire and help me hold the council to account, so that we can fix SEND in Hertfordshire?
I thank my hon. Friend for his concern for the young people of Hertfordshire and their families. The Government are undertaking a major review of the special educational needs and disabilities system. It is a major priority for the Government and we are considering improvements to make sure that the SEND system is consistent, high quality and integrated across education, health and care and, importantly, that it works with parents, carers and families to make sure that they and their children are at the heart of the system.

It is a delight to serve under your chairmanship, Mr Betts. I wish to congratulate my hon. Friend the Member for Bury South (Christian Wakeford) on securing this important debate, as well as my hon. Friends the Members for Meriden (Saqib Bhatti) and for West Bromwich East (Nicola Richards) for their contributions. I also acknowledge the very personal contribution from my hon. Friend the Member for High Peak (Robert Largan), who recalled his own experiences of religious hatred during his student days.
It is very good to be back in Westminster Hall, where views can be aired openly. I am grateful for the opportunity to discuss this topic as I stand in for my hon. Friend the Minister for Universities, who has been self-isolating today awaiting a covid-19 test, which I am glad to report has come back negative.
The Government are clear that there is no place for religious hatred in our society. Racism of any kind should not be tolerated anywhere, including in our higher education institutions. Higher education providers should be at the forefront of tackling the challenge of antisemitism and, indeed, all racism and religious hatred, making sure that the higher education experience is a genuinely fulfilling one and a welcoming experience for everyone. Higher education providers have obligations, in particular under the Equality Act 2010, and their policies and procedures must be appropriate to ensure that they are complying with the law.
In 2016, the Government adopted the IHRA definition of antisemitism. We were the first country to adopt that definition and it is an important tool in tackling antisemitism. Universities have a big role to play. We expect them to be welcoming and inclusive to students of all backgrounds, and the Government continue strongly to encourage all higher education providers to adopt the IHRA definition, which would send a strong signal that higher education providers take those issues seriously. However, they are autonomous institutions and that is also set out in law. As such, the decision on whether to adopt the definition rests with individual providers.
The Government have taken action, however. In 2019, the then Universities Minister and the Secretary of State for Housing, Communities and Local Government wrote to 130 institution heads to outline the importance of the definition and to strongly encourage the providers to consider adopting it. On Holocaust Memorial Day this year, the Secretary of State for Housing, Communities and Local Government announced new funding of £500,000 over three years for a programme supporting universities in tackling antisemitism on campus. The Government will continue to call on providers to adopt that important definition. It is a decision for vice-chancellors, but I urge them all to listen to their staff and students, as well as to the wider community and, indeed, our proceedings.
Without doubt, the university experience of many Jewish students is overwhelmingly positive. However, the number of antisemitic incidents in the UK remains a cause for concern, including in our universities. The Community Security Trust statistics for 2019 show record numbers of antisemitic incidents. Furthermore, in the first six months of this year, the number of incidents of antisemitism involving universities rose by an alarming 34%, compared with the same period in 2019. That is absolutely unacceptable and shows how much further the sector has to go to tackle the issue. Recent statistics also show that the way in which antisemitism is manifesting itself is changing—for example, there are increased reports of online incidents. I am concerned at the way in which religious harassment has evolved at this time of global crisis.
Throughout the pandemic, the Government have made it clear that higher education providers have a responsibility to their students to ensure that they continue to be able to access support and the complaints procedures. As universities begin to teach the autumn term, it is more important than ever that students feel able to report incidents of antisemitism and other hatred. We expect higher education providers to have a zero-tolerance approach to all racial harassment and religious hatred and to act to stamp it out, whether it is on campus or online.
I call on all leaders to step up their efforts to address this issue within their institutions. Adopting the IHRA definition is one way of showing that antisemitism is not welcome, although adoption alone does not mean that our work is done. Hon. Members are no doubt aware of activity to tackle antisemitism that has already happened across the higher education sector. For example, in 2015, the Government asked Universities UK to set up a taskforce to address harassment and hate crime. That taskforce resulted in the “Changing the culture” framework, which was published in 2016. Much of that has shaped work across the sector.
In 2019, Universities UK published a report on the impact of “Changing the culture”, and it showed that progress had been made, especially in certain areas of focus, particularly student-to-student sexual harassment, but work remained underdeveloped in other areas, including hate crime. In particular, the report emphasised the requirement for further senior leadership buy-in and investment to enable culture change. UUK then committed to convening an advisory group on racial harassment in higher education, which would include vice-chancellors. That group is soon to publish guidance for the sector.
The Government have worked with partners, including UUK and the Office for Students. Through ministerial guidance, the Government have tasked the Office for Students with supporting efforts to tackle harassment and hate crime in higher education. As a result, the OFS has provided £4.7 million for a range of projects over four years.
In conclusion, we will continue to work across Government to ensure that racism and religious hatred of any kind are not tolerated anywhere, particularly our world-leading universities. We call on leaders across the sector to do more to ensure that a zero-tolerance approach is taken. As a Government, we have adopted the IHRA definition of antisemitism and have encouraged universities to do so. We will ask them to do this again and we will be clear that there is much more progress to be made. Our universities should be inclusive and tolerant environments. They have such potential to change lives and society for the better. I am sure that our universities are serious in their commitment to tackle racism and hatred, but much more work remains to be done.

The pandemic has been challenging for all families, but it has been particularly challenging for children with special educational needs and disabilities and their families. We have published a range of guidance to support children, families, carers and educational settings, and I wrote an open letter to all children and those who support them last week. We are increasing high-needs funding by £730 million next year on top of this year’s £780 million, which is an increase of nearly a quarter over the two years, and providing additional catch-up support on top of that.
Special schools for physically disabled children, such as the superb Pace centre in my constituency, have faced especial challenges over the past few months. How will my hon. Friend ensure that, as term gets under way, they receive advice and support that is tailored to the specific physical needs and circumstances of their pupils and the wider circumstances of their families, so that all children, whether they are disabled or non-disabled, can benefit from a full and varied education?
I thank all the staff at Pace and special schools across the country for all that they do. We have worked with the sector to provide detailed guidance, which we continually update as needed, and we will continue to do so going forward. Those who need tailored support will be glad to hear that specialist therapists, clinicians and other support staff can attend school sites and provide those interventions as usual. In terms of our £1 billion of catch-up funding, there will be three times more going into special schools than into mainstream schools.
Many children with special educational needs and disabilities will find their return to school after a prolonged period of absence extremely challenging. The Children’s Commissioner for England has warned that Government guidance on school exclusion could encourage a zero-tolerance approach to challenging behaviour that may result in children with SEND who are struggling to readjust being excluded in large numbers. Can the Minister reassure me that she will not allow this to happen, and will she commit to reporting to the House the number of children with SEND being excluded from school as the term progresses?
Permanent exclusion should only ever be used as a last resort and must be lawful, reasonable and fair, and that is why we have already asked all schools to be understanding of the needs of all children and young people, including those with SEND, especially as they return. That is exactly the point I covered in my open letter last week to all children with SEND and their families. Off-rolling is never acceptable and will be monitored by Ofsted.

Written StatementsOn 24 April 2020 regulations were introduced to provide local authorities and children’s social care providers with temporary flexibilities to support them to focus on core safeguarding duties during the coronavirus pandemic. We made no amendments to primary legislation, and the vast majority of statutory duties in secondary legislation remained unchanged. The regulations—the Adoption and Children (Coronavirus) (Amendment) Regulations 2020—are due to lapse on 25 September 2020.
When the regulations were introduced, we faced exceptional circumstances, with social workers and others facing decisions that they had never faced before. There was an urgent need to take action to ensure that local authorities and others supporting children and young people could focus on core safeguarding responsibilities should the worst-case scenario come to pass. We needed to prepare for very significant rates of staff sickness coupled with family illness potentially leading to many more children needing to be found emergency care. We were aware that the coronavirus pandemic would have a real impact on the lives of children and families, and that this would be a difficult time for them.
Protecting vulnerable children has been at the heart of the Government’s response to the virus. These regulations formed part of that response, alongside keeping schools and other settings open for vulnerable children, substantial additional investment, and additional support direct to children, young people, and their families.
The Government have always been clear that these temporary amendments should be used only when absolutely necessary and only if consistent with the overarching safeguarding and welfare duties that have remained in place. Our guidance sets out clear safeguards about how and when they should be used:
where staff shortages, due to sickness or other reasons, make it difficult or impossible to meet the original requirements.

where there is a consequential reason to make use of flexibilities, for example, due to limited capacity in other providers or partners making it difficult or impossible to comply with the original requirements.
Our monitoring has shown that the majority of the regulatory flexibilities have been rarely used and only when needed in response to coronavirus.
Our approach to monitoring is based on a triangulation of information we are gathering from a range of delivery partners to understand which of the regulations are being used and why. We are actively seeking regular feedback from a variety of sources including local authorities, social workers, charities, Ofsted, and other key partners. We will continue to engage on this scale while the regulations remain in place.
Our monitoring data shows that the regulations are being used infrequently. Out of 128 local authorities we have spoken with in June and July, 87 have used at least one regulation, although many have only used them on a limited number of occasions and in a limited number of areas.
The most used related to the fostering and adoption regulations, notably allowing medical reports to be considered at a later stage in the adoption and fostering process though still prior to approval. This has minimised delays in approving adopters for children needing a new, forever, family. Similarly, relaxations around panels have allowed for the continued recruitment of foster carers and a continued functionality of processes.
Virtual engagement with children and families has often been used alongside face-to-face visits and, in some cases, this has resulted in greater levels of contact between children, young people, parents, and carers—and improved engagement from some young people.
Senior leaders in children’s social care have set out to the Government and Ofsted how they have approached the use of the temporary regulations and explained that they have robust sign-off processes in place for when a regulation has been used. Ofsted reports that local authorities have said decisions on the use of the regulations are being made with the child at the heart of the case, in line with the principles in the guidance, including assessing risks and working on a collaborative basis.
We have always been clear that these temporary amendments will remain in place only for so long as they are needed.
The extraordinary measures the Government have taken over the last few months means that we are now in a much better position to ease the restrictions that everyone has faced. Given the lower level of coronavirus now present, there is a significantly reduced need for local authorities and providers to use these flexibilities. I therefore intend to update guidance immediately to make it clear that there should no longer be a need to use most of these flexibilities and will be writing to local authorities and providers accordingly. Where they do use flexibilities, local authorities and providers should ensure that they have strong justification.
I would also like to provide further clarity about the future of these flexibilities and am today announcing that, subject to a short period of consultation, the overwhelming majority of these regulations will expire as planned on 25 September.
The Government believe that there may be circumstances in which some services continue to face specific and exceptional challenges into the autumn. As more children are seen by schools, and social distancing eases further and hitherto hidden harms come to light, we must be prepared for the potential additional demands that may still be placed on services.
I am therefore minded, subject to consultation, to extend a very small number of temporary changes for a further period. These regulations specifically address the following points.
Medical reports
In order to become a foster carer or adoptive parent, one needs to provide a medical report from a general practitioner. As restrictions are eased and schools return, we expect that there may be more children needing care than is usual, and therefore there will be a higher need for potential adopters and foster carers. Our national health service still faces significant challenges as we enter a period of recovery. Therefore, I am minded to extend the amendments that allow more time for general practitioners and other health professionals to provide information to support the process of approving much needed potential adopters and foster carers. This does not remove the requirement for medical reports to be provided but moves the time during the process that the report must be provided before the child is placed with the foster parent or adoptive parent.
Virtual visits
We must be able to keep essential services, such as social worker visits, operating during any local lockdowns, and in cases where households are being required to self-isolate due to a case, or suspected case, of coronavirus, or contact with someone who has tested positive for coronavirus, in line with medical advice from the NHS test and trace service. Therefore, I am suggesting that it may be appropriate to continue to enable visits in these situations to happen virtually. However, in all other situations I would expect face-to-face visits to take place. Moreover, in my view the flexibilities regarding timing of these visits should lapse, as the provision for virtual visits should now provide sufficient flexibility on the basis that workforce capacity, the original reason for these flexibilities being introduced, is now no longer the concern that it was.
Ofsted inspections
Ofsted inspections have not taken place since March so Ofsted will need a period of catch-up before it can resume normal service. As announced last week, Ofsted is planning to carry out a phased return to routine inspections. This will include risk-based assurance visits to children’s social care settings, based on the previous inspection judgement, the amount of time since a setting was last inspected and other information Ofsted holds about the setting. These assurance visits will occur between September 2020 and March 2021. At this point full graded inspections will recommence. I am therefore recommending that the suspension of the existing frequency regulation for Ofsted inspections be extended until 31 March 2021, to allow Ofsted to provide the most assurance, to the sector and the wider public, about the safety and care of children.
A short consultation will launch later this week to inform final decisions and I would encourage all interested parties to respond. Should a new statutory instrument be proposed to extend any flexibility beyond 25 September 2020, Parliament will be provided with the customary 21 days opportunity to scrutinise the regulations before they come into force.
Our guidance has been clear that the regulatory flexibilities should only ever have been used with senior management oversight and that all decisions should be recorded. I am, however, considering how additional safeguards on the use of the flexibilities could be employed. Our consultation will therefore seek views on this question.
As inspections resume, Ofsted will want to be assured that any flexibilities have been used in the best interests of children, following careful risk assessment and with clear records of decisions made by local authorities and providers. As such, local authorities and providers must maintain a focus on child-centred practice and continue to record their decisions and ensure that these records are available for Ofsted. Inspectors will want to see the best possible practice for children. While routine inspections have been suspended, Ofsted has continued to inspect where it has been made aware of safeguarding concerns. It has acted swiftly and taken action to restrict children going into a home or stop a home operating in 23 cases. It has continued to start proceedings to cancel the registration of homes or managers where this is the right thing to do. And while it has prioritised registration of new children’s homes, it has still refused to register people it did not think were suitable.
Throughout this pandemic, social workers, charities, and others working to support our most vulnerable children and families have worked tirelessly to ensure that they continue to receive the support they need. I would like to place on record my personal gratitude, and that of the whole Government, for everything they have done and continue to do. I would also like to acknowledge the extremely difficult circumstances many children and families have faced during this pandemic.
Protecting vulnerable children remains our top priority, as it does for local authorities and children’s social care providers across the country. As the country begins to return to a more normal way of life, it is absolutely right that this also applies to children’s social care.

Commons ChamberAt this deeply challenging time, it has been so important that people, especially children, have been able to stay in touch online, but, of course, they should be able to do so safely. We have worked with the National Crime Agency, the UK Safer Internet, Internet Matters, the National Society for the Prevention of Cruelty to Children and many other experts to provide detailed guidance and support to schools and colleges on keeping children safe online, as well as advice and high-quality resources for parents and carers.
Does my hon. Friend agree that, although we must be cognisant of the risks on the internet to children and young people, it is very important for their mental health and social wellbeing that they are encouraged to connect via various internet channels with family, friends and others who are part of their support network?
My hon. Friend is absolutely right. Being online has had great benefits for children, giving them access to educational resources and entertainment but also enabling them to stay in touch with family and friends, which is vital to their wellbeing. Social media companies have a role in keeping children safe. This Government are committed to creating a statutory duty of care on companies to protect their users, especially children. But they should not wait for us to legislate—they should act.
Charities such as the NSPCC and Barnardo’s have highlighted how children are at increased risk of online harm during this pandemic. It has been over a year since the Government’s White Paper on online harms, which set out the need for a duty of care regulator. Every day that this is delayed, more and more children are put at risk. So I ask the Government now: at what point will they stand up to the tech companies, put vulnerable children first, and bring forward a Bill on this?
I thank the NSPCC and Barnardo’s for the work that they are doing with the Government to help to keep children safe online, but also in the home and outside the home. We are committed to introducing a duty of care on social media companies. We published the initial response to the consultation in February and a full response will be published later this year. We are working with the sector on a detailed code of conduct. But the first thing we must do to keep children safe is to get them back in school, and I would like the hon. Lady to support us in doing that.
Social distancing is challenging with young children, so we have worked with stakeholders on a detailed planning guide to keep early years settings safe. This includes advice on keeping people, including children, in small, consistent groups and implementing hygiene measures. Thanks to the sector’s work in reassuring families, 234,000 children were in childcare on 11 June.
Nursery providers in my constituency are worried that social distancing will result in a reduction in capacity, which for them means a reduction in income. The sector is already at crisis point, so I would like my hon. Friend to reassure me that she is working closely with the sector to ensure that places will be available so that parents—particularly mothers—will be able to go back to work?
We all recognise how important early years settings are, both for children and for their parents and carers. Early years settings have been able to open their doors to all children from 1 June. I spoke to sector representative organisations and childcare providers in the first week of wider opening to understand the detailed challenges they face. We know that it is a difficult time for many businesses, and we will continue to ensure that early years providers get the best possible help from all the Government’s support schemes.
About 18% of children with an education, health and care plan or a social worker attended an education setting on 11 June. The Department does not collect separate attendance data for those eligible for free school meals.
Is the Minister not ashamed that after 10 years of a Tory Government, in West Yorkshire alone there are almost exactly 100,000 children at risk living in families of multiple vulnerabilities? Many of them are still not at school and therefore at risk. What will she do about it?
I am enormously proud that after 10 years of a Conservative-led Government the attainment gap between those from disadvantaged backgrounds and those from more advantaged backgrounds has narrowed at every stage of children’s education. We have kept schools open for vulnerable children, and those children most at risk have been seen or contacted by their social workers. I thank social workers and schools across the country for doing that. We need to get children back to school, and the Opposition should support us.
Due to covid-19, we have made some temporary flexibilities for local authorities. They are temporary, not permanent, and they are to be used only where normal procedures cannot be followed. I am told that the number of missing children at this time has decreased.
