During my oral statement on 20 July 2015 (Official Report, column 1233), I committed to continuing to be transparent about UK service personnel embedded in other nations’ armed forces on operations.

Today I am publishing details of UK Service personnel embedded in other nations’ armed forces who are deployed on operations together with those who work on operations in deployed coalition or single nation headquarters roles. Embeds play an important role in enhancing our national security interests around the world, strengthening our relationships with key allies and developing our own capabilities. These personnel perform a wide range of roles for their host nation including staff in headquarters planning for operations and training missions, members of a ship’s company, helicopter pilots, transport pilots, fast-jet pilots and aircrew and air traffic control.

Following this first report to the House, future updates will be published annually through my Department’s annual report and accounts. For operational and personal security reasons the information that can be routinely released is limited.

All of our armed forces, including embeds, are bound by and operate in accordance with the law of England and Wales and international law, in particular, the law of armed conflict.

I am today laying before both Houses the 2015 Armed Forces Covenant annual report. The covenant is a promise by the nation to ensure that those who serve, or have served, and their families are treated fairly. They protect the nation with honour, courage and commitment, and deserve to be treated with fairness and respect.

The report sets out what the Government have done to uphold the principles of the covenant. The Armed Forces Act 2011 enshrined the covenant into law, setting out the requirement for the Defence Secretary to report progress annually to Parliament.

Last year we reported that every local authority in mainland Great Britain had signed the covenant, and I can confirm that over 750 employers have also now signed up.

This year particular emphasis has been given to supporting armed forces families. The Department of Health has embedded the principles of the covenant into the NHS constitution to ensure service families access healthcare where and when they need it. The schools admissions code has been amended to prioritise service children, and service families can now apply for, and be allocated a school place before they move to the area. Over 5,000 personnel have also been helped into homeownership through the forces help to buy scheme. We will aim to double this number to 10,000 by next year.

A further significant change is the inclusion of veterans from the merchant navy and Royal Fleet Auxiliary as core members of the armed forces community.

The report has been compiled in consultation with other Government Departments, representatives from the devolved Governments in Wales, Scotland and Northern Ireland, and the external members of the Covenant Reference Group, which includes the three Service Families Federations, the Confederation of Service Charities, the Royal British Legion, the Soldiers Sailors Airman’s and Families Association, the War Widows Association and Professor Hugh Strachan.

The Government welcome the opportunity to discuss our nuclear deterrent, so I thank the hon. Member for Argyll and Bute (Brendan O'Hara) for tabling the motion.

In his statement yesterday, the Prime Minister set out the growing scale, diversity and complexity of the threats we face, and to tackle them we must have an array of weapons, up to and including the nuclear deterrent. It is worrying that, in a more dangerous world, the cross-party consensus we used to enjoy on our deterrent appears to be weakening. I remind Opposition Members that it was Labour Ministers—Attlee and Bevin—who in the 1940s argued for a nuclear deterrent with “a Union Jack” on the top of it, yet today the leader of the Labour party opposes his party’s official policy. He wants to scrap Trident and has said he is not prepared to use it.

Equally worrying is the non-attendance of the shadow Secretary of State, who has been admirably clear in opposing her leader while agreeing to lead a review of the policy. I can well understand her anger at the decision to appoint as co-chair of that review Mr Ken Livingstone, who wants not to review Trident but to abolish it. Indeed, he declared London to be a nuclear-free zone. This is like appointing an arsonist as the co-chief fire officer.

Our international allies look on with dismay at this shambles opposite, which can only be of comfort to adversaries. I appeal again to the tradition in the Labour party that proudly supports our independent nuclear deterrent to renew the consensus, to put aside party politics in the national interest, as the shadow Chancellor said on television on Sunday, and to join us in remaking the case for the deterrent.

The decision had to await the publication of the SDSR yesterday, but I hope we can now take it in 2016. We will then have to get on and start building the Successor submarines, as I shall explain.

Successive Labour and Conservative Governments have judged that a minimum credible nuclear deterrent is critical to our national security—that a nuclear deterrent is the only assured way of deterring nuclear threats and blackmail by nuclear states. For more than 60 years, it has done that job. Whatever side of the argument we are on, let us pay tribute to the crews of HMS Vanguard, Vengeance, Victorious and Vigilant, their families and all those who ensure, and have ensured, that one of those boats is on patrol 24 hours a day, 365 days a year.

As the wife of a submariner serving on HMS Victorious, I thank the Secretary of State for his tribute. The crews are doing their job and serving in the way they have been sent to do, defending our democracy, but he has to realise that none the less they do not all agree with his views on Trident.

I accept what the hon. Lady says, and of course if she is married to one of them, she will know better than anybody in the House, but I have met some of the crews and I have yet to meet a submariner who does not have faith in the job he is doing—but there we are.

The decision that Parliament has to take next year, which hon. Members just asked about, is not whether to replace the Trident missile or renew the warheads, but whether to replace the Vanguard submarines that need to be replaced by the early 2030s.

What might the future of Faslane be without nuclear submarines and how many jobs, at the largest industrial employment site in Scotland, would be lost if nuclear submarines were banned?

There would obviously be significant implications for Faslane if the nuclear deterrent was no longer there, as was pointed out yesterday by GMB Scotland, which said:

“The commitment in the SDSR to multilateralism and to the successor programme going ahead is welcome as it is crucial to jobs”

in Scotland.

The Government were elected on a manifesto commitment to replace the Vanguard submarines, and it takes over a decade to build and trial a nuclear submarine, so we have to take that decision in 2016. Design work is already far advanced, and in yesterday’s review we announced further investment of £600 million, which takes the assessment phase cost from £3.3 billion to £3.9 billion.

I want to make three basic points about why renewal is vital. First, this is about realism. We are of course committed to creating the conditions where nuclear weapons will no longer be necessary. We have reduced our nuclear forces by well over half since the height of the cold war; this very year, I cut the number of deployed warheads on each submarine from 48 to 40, and by the mid-2020s, we will have reduced our overall stockpile of nuclear weapons to no more than 180 warheads. Unfortunately, those actions have not been matched by any other nuclear nation or stopped unstable nations seeking to acquire or develop nuclear weapons.

My right hon. Friend mentioned costs. If we had had an effective Opposition yesterday, and even today, there might have been a greater focus on the cost overruns, which are what worry me. He is making sterling efforts to deal with the problem in the MOD, for which I salute him, but will he commit to holding the feet of the private sector to the fire and making sure there are no more cost overruns? This is too big a project to take money from the conventional forces.

I can certainly give my hon. Friend that assurance. I will come later to how we will deliver the Successor programme and maintain that downward pressure on costs that he wishes to see.

I said that other nations have not matched our own disarmament. Russia is commissioning a new Dolgoruky class of eight nuclear submarines, is developing and preparing to deploy a variety of land-based ICBM classes, and is planning to reintroduce rail-based ICBMs. Last month, North Korea showed off a long-range ballistic missile carrying miniaturised nuclear warheads. It has carried out three nuclear tests and, in defiance of the international community, conducted ballistic missile tests. In an unpredictable nuclear age, we cannot simply wish away threats that exist now or that may emerge in the 2030s, 2040s and right through to the 2050s.

On 14 July this year, China, France, Germany, the Russian Federation, the UK and the USA, supported by the EU High Representative for foreign affairs, reached an agreement with Iran. The agreement included these words:

“under no circumstances will Iran ever seek, develop or acquire any nuclear weapons.”

Progress is being made by negotiation.

Indeed, and Members on both sides of the House should absolutely welcome that agreement with Iran, but we have not had similar progress from any of the other states that use nuclear weapons—and there are still a large number of states that are trying to get their hands on nuclear weapons.

I will give way again later, but I must make some progress.

My second point is about the practical effect of the deterrent. Our nuclear deterrent works. It deters aggression every single day. There have been many conflicts in the last six decades, and not one of them has involved a direct conflict between nuclear states. Not one country under the protection of an extended nuclear umbrella has been invaded. Our nuclear deterrent is operationally independent—the hon. Member for Argyll and Bute (Brendan O’Hara) is quite wrong about that—and its command and control system as well as its decision-making apparatus are ours, and ours alone. It offers, of course, a second centre of decision making within NATO that will complicate an adversary’s plans. It is worth reminding ourselves that NATO is a nuclear alliance. One of the absurdities, if I may say so, of the Scottish National party’s position is that while opposing Trident it would—if voters had not rejected its separatism last year—have sought NATO membership and would then have benefited from its nuclear umbrella.

The third reason we must renew our nuclear submarines is that there is no alternative at the moment. How do we know that? We commissioned the Trident alternatives review in 2013. Having looked at all the alternatives—non-submarine alternatives, other submarine alternatives, non-continuous deterrent—it demonstrated that no alternative system is as capable or cost-effective as the Trident-based deterrent. If we accept that there is a threat—perhaps the SNP does not—that needs to be deterred, and if we accept that our enemies work nights and weekends, we must also accept that there can be no half-measures. A four-boat continuous at-sea posture is the minimum way to offer the security we need.

Will the Secretary of State therefore explain to me and my colleagues how Trident addresses the real current threat that we are experiencing—the threat from radical jihadism? Would those enemies not be jumping for joy if the UK ever even thought about threatening IS with nuclear weapons?

As the SDSR document pointed out yesterday, there are a series of threats to our country at the moment, and we have to deal with all of them. One of them has been the proliferation of nuclear weapons and the commitment of countries such as Russia to continue to spend more on developing their nuclear weapons, as I have pointed out.

I must make a little more progress.

We have to address the consequences of passing this motion tonight. It is scarcely believable that other nations, hearing the news from 4 o’clock today in the House of Commons, will suddenly decide to disarm or stop seeking nuclear weapons. There are 17,000 nuclear weapons in the world today. We wish there were not, but there are. Anybody voting in the Division tonight has to answer who, after we had got rid of our nuclear weapons, would continue to provide the deterrent.

I wonder what message it would send to rogue and unstable nations if Britain were to scrap its nuclear deterrent.

It would send a terrible message—that we are not serious about deterring other countries, particularly those rogue countries that seek every day to develop exactly the kind of nuclear weapons that we already have.

We have touched in the debate on the future of HM Naval Base Clyde, which is one of the largest employment sites in Scotland. It is set to increase to 8,200 jobs by 2020 when all the Royal Navy’s submarines will be based at Faslane. That is a reminder that the Successor programme is a national endeavour, involving thousands of people and hundreds of firms right across our country, including in Scotland. Our state-of-the art submarines require skills that keep our Royal Navy and our country at the cutting edge, and they will inspire the next generation of engineers, software developers and designers. If the hon. Member for Argyll and Bute had his way, thousands of jobs would disappear and those manufacturing skills would be lost.

It has not been made clear to us how the SNP plans to deal with the industrial damage that will result from its decision. In the Scottish Parliament, it hid behind a vague motion that

“firm commitments must be made to the trade unions on the retention of defence workers’ jobs”.

Workers on the Clyde do not want parliamentary motions; they want to be sure of a pay cheque every month. They want to know that they have got a job. Indeed, the acting Scottish secretary of the GMB, Gary Smith, said that diversification

“is based on Alice-in-Wonderland politics promising pie-in-the-sky alternative jobs for workers who are vital to our national security”.

That is the authentic voice of a Scottish trade union.

The MOD permanent secretary Jon Thompson told the Public Accounts Committee in October that the Trident project is one that keeps him awake at night. Given the excessive escalation in Trident costs announced yesterday, can the Secretary of State not see how Trident undermines conventional forces? He may not lose sleep over this, but is not the UK sleepwalking into a reduction in conventional forces because of his decisions?

The document we published yesterday, the strategic defence and security review, really gives the lie to the hon. Gentleman’s proposition, because we are spending more on conventional defence, as well as renewing our Successor programme. The hon. Gentleman is right that the management of that programme has to be done properly and cost-effectively, so let me turn to the whole issue of cost.

I will make a little progress, and then give way again, as I know a number of hon. Members want to get into the debate.

There have been some wild reports, accentuated today, suggesting that the Trident replacement will cost £167 billion. That assumes a year-on-year growth in GDP of 2.5%.

That same logic would see us spending around £800 billion on overseas aid over the same period, with a Defence budget of about £100 billion in 2060. Let us look at the facts. We estimate that four new submarines would cost £31 billion—a cost spread over 35 years, which amounts to an insurance policy of less than 0.2% per year of total Government spending for a capability that will remain in service until 2060.

Let me put that £31 billion in context for the House and for those among my hon. Friends who are so keen on advanced high-speed railway lines. The Successor programme will cost £31 billion, with a contingency fund above that taking the total budget to some £40 billion. High Speed Two will cost £50 billion.

The Secretary of State said that he would put the £31 billion in context. Does it not constitute a £6 billion increase in the last year? We should add to that the £10 billion contingency fund, and also take into account the promise in the review to spend £178 billion on equipment, which we are told is an extra £12 billion. It is clear that that extra money will actually be spent on Trident, and that the Secretary of State is cutting provision for tier 1 threats to pay for a nuclear deterrent to deal with what is classed as a tier 2 threat. There is no doubt that nuclear weapons are being paid for at the expense of conventional protection.

No cuts in weapons are included in the document that we published yesterday. On the contrary, there are more ships, more planes, more equipment for the special forces—more frigates being built on the Clyde. Let me very clear. The figure has increased—and we gave the House the correct update yesterday—since it was specified in a 2006 White Paper and adjusted again in 2011. The figure that we gave yesterday has been updated from the original estimate four years ago. The cost is £31 billion for the four submarines, with a contingency fund of £10 billion on top of that.

Let me now respond to the question that was asked by my hon. Friend the Member for Gainsborough (Sir Edward Leigh), from the depth of his experience as Chairman of the Public Accounts Committee. Yes, we must be eagle-eyed where costs are concerned. The new conventional submarines that are being built at Barrow, the Astute class submarines, are late, but the new Successor submarines cannot be late. We therefore believe, the Chancellor and I, that it is essential to reform the way in which the submarines are delivered, to ensure that continuous at-sea deterrence can be maintained, and to ensure that the taxpayer is given proper value for money. We are establishing a new delivery body for the Successor programme, and a new team at the Ministry of Defence, headed by an experienced commercial specialist, to act as the single sponsor for all aspects of the defence nuclear enterprise, from procurement to disposal.

Does the Secretary of State agree that, if we want to keep Britain safe, it is not a question of choosing between renewing our nuclear deterrent and taking the necessary action against ISIL—given that both are vital—and that it would be foolhardy, not to say arrogant, to believe that anyone in the House can predict the risks and threats that Britain will face in the next 30 or 40 years?

I could not have put it better. In our latest assessment, which is contained in the document that was published yesterday, we tried to estimate the threats to our country. We should be honest and humble about the fact that the 2010 review did not predict the resurgence of Russia and the action that it took in Crimea and Ukraine; nor did it predict the rise of ISIL. We try to predict, but we cannot be sure further ahead.

Last year, the people of Scotland voted to remain part of the United Kingdom.

I have already been generous in giving way.

Let me remind the House that the deterrent is for the whole of the United Kingdom, and that the people of Scotland will benefit from the security it provides.

Earlier this year, in the last vote on Trident, Parliament voted to support it by a majority of 327. Yesterday the Prime Minister confirmed our intention to hold a debate and vote on the principle of continuous at-sea deterrence and our plans for Successor. This afternoon we face the SNP motion, and our allies and our adversaries will be paying attention.

This is not a time to gamble with our security; on the contrary, it is a time to safeguard this generation and generations to come. Let me put it as simply as the hon. Member for Leicester West (Liz Kendall) just put it to me. If Members on either side of the House can be absolutely sure that no nuclear threat to this country will emerge throughout the 2030s, the 2040s and the 2050s, they should vote for the motion. I cannot be sure of that, and Conservative Members are not prepared to gamble with our nation’s security.

I can absolutely give the hon. Gentleman that assurance. This is very much a question about our military capability, but we can never ignore the fact that it is a very important economic regeneration question, too.

As my right hon. Friend the Member for Islington North announced at conference, the shadow Secretary of State for Defence will lead a review on all aspects of our defence policy including our nuclear deterrent. She has been clear that she is going to lead an evidence-based review in an open-minded, inclusive and transparent way that investigates the issues that have been reviewed on many occasions and also searches for any new relevant evidence.

If the right hon. Gentleman had been slightly more patient, I would have got to precisely that point. If he bears with me, I will be able to enlighten him.

As I made clear, my hon. Friend the Member for Garston and Halewood will be leading that review, and my very next sentence is that, as is standard for policy commissions that will feed into the national policy forum, a member of the national executive committee, Ken Livingstone, will co-convene that review on behalf of the NEC. But, as the leader of our party said at conference and reiterated yesterday, it will be led by my hon. Friend the Member for Garston and Halewood.

The United Kingdom is already making a significant contribution to the international counter-ISIL coalition, with strike aircraft, intelligence, surveillance and reconnaissance, and in helping to train Iraqi forces. In addition to the intelligence co-operation and border security support we have offered to France, the House will wish to know that yesterday I authorised the use of RAF Akrotiri as a diversion airfield for French aircraft striking in Syria.

Many of us, on all sides of the House, will support the Government as they make the intelligent case for extending the air campaign into Syria, and we reject totally the accusation that such a move would be a gesture. Does my right hon. Friend agree that our allies—not us, our allies—have been diminishing ISIL’s command and control, restricting its ability to move en masse, and restricting its ability to take control of more ground? Is it not time to stop subcontracting our security to our friends?

I agree with my hon. Friend. We should not leave the fight against ISIL to French, American or Australian aircraft. While we are working through the Vienna talks, which aim to help to establish an inclusive transitional government to end the civil war and build more security for the Sunni areas of Syria, that should not either delay or deter us from degrading ISIL in eastern Syria, from where ISIL is directing the war in its region and directly threatening us.

The Chief of the Defence Staff has said that not striking ISIL in its heartland in Syria is like a football team trying to win a match without entering the opposition’s half. Is it not long overdue that we pushed up the pitch and stopped defending our goal line?

Yes. ISIL does not recognise the border between Iraq and Syria, and moves between both while the RAF can currently strike only in Iraq. It is illogical for us to be hitting ISIL targets in Iraq, while not targeting ISIL’s core leadership, its lines of communication and its oil revenue base, which are all to be found in Syria.

20 . What steps is the Secretary of State taking to squeeze ISIL’s supply chain, particularly with regard to munitions and ammunition? ISIL is not just supplied by organisations in the region; countries and establishments outside the region must be supplying ISIL with arms.

Yes, we are intensifying our effort to cut off ISIL’s sources of finance, in particular its ability to sell oil on the international market. We are also directly targeting its supply routes between Syria and Iraq, particularly in the region around Sinjar.

Yes. I discussed this matter in Ankara recently with the Prime Minister, Foreign Minister and Defence Minister of Turkey, who obviously want ISIL/Daesh pushed back from their own border in the remaining Manbij pocket between the two Kurdish areas. I emphasise, however, that all parties in Syria—Kurds, Shi’a, Sunni, Alawite, Christian and Druze—have to be brought into the process to deliver in Syria a more inclusive Government that can end this civil war.

History gives us practically no examples of a determined enemy surrendering in response to conventional air bombardment, so what ground forces are credibly and seriously fighting ISIL/Daesh in Syria, other than some unpleasant Islamist groups, the Kurds—in a limited area—and the Syrian Government army?

There are moderate forces fighting Daesh in Syria that have also been engaged in the civil war. The key is to bring the civil war to an end as quickly as possible so that we can focus on dealing with Daesh. Troops are already involved in the conflict. We have been helping to train them and supplying non-lethal equipment to them, and we will continue to work with them to ensure that Syria is rid of both Assad and Daesh.

The Secretary of State will be aware of a report published today in The Independent stating that in the aftermath of the terrorist attacks in Paris, Islamophobic hate crime in the UK increased by 300%, the vast and overwhelming majority of victims being young Muslim women. When will the Secretary of State join the cross-party consensus in the Chamber and follow the example of President Hollande, who refused last week to give the terrorists the legitimacy they craved and instead rightly described them as “Daesh”? Does he not accept that the language we use is important and that language connecting Muslims and terrorism is dangerous and misleading?

I agree with almost all of that, although I am afraid I have not had time to read the report in The Independent. I myself prefer the term “Daesh” because it is more accurate and does not embrace the word “Islam”, but “ISIL” and “ISIS” have become accepted terms in the British media, and it might be too late to make that change.

I agree, and I know my hon. Friend will have noted the UN resolution passed to that effect. We have to confront this terror organisation with all means at our disposal, not simply by defending our territory here but by striking at its roots and dealing with it politically, culturally, financially and ideologically.

People on both sides of the House will welcome the UN Security Council resolution passed on Friday night calling on member states to take all necessary measures against ISIL/Daesh, but will the Defence Secretary reassure Members on both sides of the House that, along with any proposed military action in Syria, there is also a parallel plan to secure peace, end Assad’s reign of terror over his own people, put in place a timetable for a transitional Government in Syria and for the protection of religious and ethnic minorities?

Yes, I fully accept we have to persuade those with doubts about military action that there is a political track as well. Towards the end of the week, the Prime Minister will be replying to the questions posed—quite legitimately—by the Foreign Affairs Committee that deal with exactly that point: how a transitional Government can be put in place that has the support of all sections of the different communities in Syria and how that can lead to the provision of security, particularly in the Sunni areas, in northern Syria. However, that should not delay our dealing with a terrorist menace that has already brought slaughter to the streets of Paris and resulted in the deaths of our own citizens on a beach in Tunisia and one in Paris itself.

24. Further to the answer given to my right hon. Friend the Member for New Forest East (Dr Lewis), it is dangerous to wound an enemy and not kill him, especially if fighting a wild beast. Given that no air campaign alone has ever dislodged a determined enemy, what is the plan after we have bombed Syria? Where is the strategy? What ground troops are we going to put in?

In Iraq, we are assisting the legitimate Government of Iraq, the Iraqi forces and the Kurdish forces to push ISIL out of Iraq, and we are having some success in that. Of course in Syria we will in the end need ground forces that are local and locally supported. Prime Minister Abadi in Baghdad does not want British troops or American troops on the ground; that would further radicalise opinion, particularly in the Sunni areas. On the ground, the battle has to be won by local forces that have the support of the local population, but that should not deter us from making a start in dealing with ISIL’s headquarters, from where this terrorism and slaughter is being directed.

Supporting moderates is a key part of our work to resolve the Syrian conflict, so that they can take their place in the inclusive transitional Government needed to defeat ISIL and provide security throughout Syria. Do the Government not recognise that as part of the solution to the ISIS issue we need peace in Syria? Do they not recognise that what they are proposing is a failed policy, and that by investing in a client as a proxy in a civil war, all we are doing is simply escalating the war and perpetuating a greater number of deaths?

I do not wholly agree with that. The work we are doing in Iraq to support the democratic Government of Iraq at their request has stemmed the onrush of ISIL and has started to push ISIL back, north up the Tigris and west of the Euphrates. We need to do the same in Syria, coming to the aid of moderate forces there who want to be free both of Assad, who is bombing his own civilians, and of ISIL, which represents a threat to us all.

The picture in northern Syria in particular is confused; it is not a simple conflict with front lines as we would normally understand them. It is our long-term objective for Syria to be free of both Assad and ISIL, and we continue to work with moderate elements in Syria to provide them with the equipment they need and, where we can, with training outside Syria.

We have seen ISIL attacks in Tunisia, Ankara, Sinai and elsewhere around the world, including on British citizens, most recently in Paris, as well as plots to commit murder on our own streets. ISIL poses a very direct threat to the United Kingdom, which is why we need to work with the international coalition to degrade and destroy ISIL in Iraq and why we need to consider what more we can do to deal with its headquarters and heartland in Syria, from where this threat comes.

Given that ISIL is using its base in Syria to plan attacks on the UK, does the Secretary of State agree that it is absolutely absurd to restrict the British armed forces to acting only in Iraq, and not to empower them to act against those who threaten Britain and who are based in Syria?

I agree that there is a compelling case for us to do more in Syria, not least because it is illogical to tackle ISIL only in Iraq. Those borders are meaningless to that organisation. As the Prime Minister has said, we must tackle the head of the snake in Raqqa, and we will be making our case to the House and to the country, starting with his response to the Foreign Affairs Committee report later this week.

When major cities such as London are targets of terrorism, how is the Secretary of State collaborating with the Home Office to deal with out-of-London areas, including the shopping areas in constituencies such as mine, which could easily be under just as much threat as central London?

We work closely with the Home Office, particularly on counter-terrorism and on providing assistance to back up civil capacity. We have 5,000 troops trained and ready to support armed police officers at 24 hours’ notice, and we will be increasing that number shortly. In the end, we can guarantee the safety of the United Kingdom only by defeating ISIL in Iraq and Syria, and I hope that my hon. Friend shares the new confidence of the Chairman of his Committee that the Committee’s conditions can be met following the murders on the streets of Paris.

The Secretary of State will be aware of the concept in international law that when a sovereign state is unable or unwilling to take action against a non-state actor carrying out acts of aggression from its territory, there may be a justification for action. To what extent does he think that that applies to Daesh, and what comparisons would he draw between this situation and the operation of the Taliban in Afghanistan when it was supporting al-Qaeda?

The hon. Gentleman is absolutely correct to say that there is already a clear legal basis for military action against ISIL in Syria which does not require a United Nations resolution. None the less, I hope he will welcome UN Security Council resolution 2249, which provides clear and unanimous political endorsement by the entire international community for the military action already being taken by the counter-ISIL coalition.

Why are the Government turning a blind eye to ISIL selling off its oil to our NATO pals?

The Government are not turning a blind eye. On the contrary, we are doing our best to interdict those supplies of oil and to stop ISIL selling its oil on the international market. I have discussed this with Syria’s neighbours. We also need to stop ISIL selling its oil to the Syrian regime itself.

My immediate priorities are our operations against ISIL and the strategic defence and security review. July’s announcement that the defence budget would increase in every year of this Parliament and that we would continue to meet the NATO 2% target means that we will be able to decide very shortly on what further capabilities and equipment we need to keep this country safe.

In March, I was delighted to host the Secretary of State on a visit to MBDA in my constituency. Is it not a sign of the Government’s commitment to national security and economic security that they have signed a £300 million contract to equip our Typhoons with the latest missiles and that these will be manufactured at a new MBDA site in Bolton, thus safeguarding 400 high-tech jobs?

Yes. I do recall my visit and this is part of our now £178 billion equipment plan to provide the very best capabilities for our armed forces. These advanced, short-range, air-to-air missiles will equip our Typhoon jets with battle-winning technologies, helping to protect British airspace, to defend our NATO allies and to sustain hundreds of highly skilled jobs in MBDA’s new £30 million plant in Bolton.

One of the many things briefed officially to The Times and The Daily Telegraph this morning was that the MOD will only purchase five fewer frigates than planned. Does the Minister share my concern about needing enough frigates to protect our carriers on operations, with any reduction to this fleet meaning that the capability to operate the carriers will be impaired?

We make sure that our own aircraft are equipped with the defensive aids that are necessary in each particular theatre. What we need to do is bring the civil war in Syria to an end and then focus on the task in hand, which is degrading and destroying ISIL in its heartlands. Syria needs to be free of both Assad and ISIL.

No, I do not accept that. Of course the membership of the European Union has enabled us to be as one in Europe in imposing sanctions on Russia for the action it took in Crimea and in the insurgency it stirred up in Ukraine, but the bulk of our defence rests on our membership of the NATO alliance.

I agree with the Defence Secretary that ISIL poses a very direct threat to the UK, but does he agree that, if the Government are to take military action against Syria, that action should be framed within a wider strategy? Military action can serve as only one strand of that wider campaign. The Government will also need to leverage the political, diplomatic, economic and cultural tools that they have at their disposal.

I completely agree. Any military strategy to deal with ISIL in Syria as well as in Iraq has to be embedded in a wider campaign to win the struggle against ISIL, politically and diplomatically, to construct a moderate Government in Syria who have the support of all sections of Syrian society and to show how that will lead to greater security in the Sunni areas in particular in northern Syria once ISIL is defeated in its heartland.

Non-action—the decision to do nothing —has consequences, and, as my hon. Friend implies, has had severe consequences not simply for the reputation of this country among its allies but in Syria itself, where we have seen a vicious civil war with hundreds of thousands killed and millions displaced as a result of a decision by the west not to get involved and begin to put a stop to it two years ago.

It seems strange that we give high-level British forces training to those fighting ISIL but we do not give them any of our equipment, so they end up fighting with Russian or other weapons. Will we look at changing that, so that they get body armour, medical supplies and, perhaps, more hardware?

I agree, and that is reflected in the United Nations resolution. ISIL made no demands of those whom it went to slaughter in Paris the week before last. This is not an organisation with which we can possibly negotiate or employ diplomacy; it has to be defeated using all means at our disposal, including military means.

I have today laid before Parliament a Ministry of Defence Departmental Minute describing the contingent liability for the installation of British Telecom (BT) Solent cables in support of Queen Elizabeth Class (QEC) base-porting.

It is necessary to conduct dredging works in the Solent and approaches to Portsmouth Harbour ahead of the arrival of the QEC aircraft carriers to ensure their safe transit to and from their home-port.

Two BT fibre-optic cables currently lie between the mainland and the Isle of Wight and must be removed prior to commencement of dredging works. BT have proposed that rather than burying the replacement cables they ’surface lay’ the cables to ensure they are relocated as soon as possible, minimising the impact to the capital dredging works which are scheduled to commence on 17 December.

Surface laying the new cable is not BT’s preferred solution as they consider the new cables will be more vulnerable to damage from fishing activity. BT requires the MOD to carry the liability for any repairs to the cables until they have naturally ‘self-buried’ into the seabed and forecast that the cables could be at risk to damage twice within the first five years and once in the following five.

If cable repairs are necessary, each one is estimated to cost £360,000. The maximum contingent liability against the MOD is therefore £1,080,000. The duration of the liability will be 10 years from the date the new BT cables are installed, with this activity scheduled to complete in early December. If the liability is called, provision for any payment will be managed through normal supply procedure. The Department will be noting this contingent liability in its accounts.

I have today laid before Parliament a Ministry of Defence departmental minute concerning a further gifting package which the UK intends to make to the Government of Ukraine.

Russia’s illegal annexation of Crimea and its destabilising activities in eastern Ukraine, including direct military support to the separatists, has demonstrated its disregard for international law. Since fighting began, nearly 8,000 people have been killed and approximately 18,000 injured. Around 1.4 million people have been displaced in Ukraine.

The latest ceasefire agreement, reached on 29 August, has seen a reduction in violence in the conflict zone. However, until there is a political settlement to the conflict the Ukrainian armed forces (UAF) have to remain deployed forward and continue to suffer fatalities and casualties. As a result of the prolonged engagement in this conflict, the UAF face a chronic shortage of basic equipment, and have requested help.

This Government are committed to supporting Ukraine’s sovereignty, independence and territorial integrity. Our proposed gift of non-lethal equipment is designed to prevent further Ukrainian fatalities and casualties and to help improve resilience on the ground.

The gifting package consists of 170 large tents with ancillary equipment to mitigate winter conditions and 600 sets of cold weather clothing. Subject to completion of the departmental minute process, delivery is expected to be undertaken over the coming weeks. The total cost of this proposed package of equipment is approximately £971,000, including transportation costs and contingency.

In January 2015 following 13 years of combat operations, NATO started its new non-combat train, advise and assist mission in Afghanistan. At the same time, the Afghan National Defence and Security Forces (ANDSF), which the UK and our NATO partners have played a key role in developing, assumed the lead for security in their country.

In their first fighting season since the drawdown of international combat troops, the ANDSF have been tested in parts of the country, but they have also shown themselves to be an increasingly professional, competent and dedicated fighting force.

The UK Government recognised it would take time for the ANDSF to develop into a fully fledged fighting force capable of providing complete security for the people of Afghanistan. We therefore made plans to review our commitment in light of its performance over the year and the overall security situation.

I would like to inform the House that we have now concluded that we should maintain the scale of the UK’s current military mission in the country in 2016, to help build a secure and stable Afghanistan.

The scope and role of the UK mission are unchanged. We will continue to help develop Afghanistan’s future military leaders through our work at the Afghan National Army Officer Academy, to build capacity within the Afghan security ministries, and to provide vital support to NATO operations in Kabul. Around 450 UK personnel will work in close co-ordination with our NATO allies and partners in the delivery of these important tasks.

This decision follows President Obama’s announcement on 15 October that the United States is delaying the drawdown of US troops and will maintain its current force level in Afghanistan through most of next year. Both the US and our own decisions underline NATO’s continued commitment to training and assisting Afghan forces as they grow stronger.

Finally, I wish to record my immense gratitude and admiration for all of our brave men and women who have served, or are currently serving, in Afghanistan. We will never forget the ultimate sacrifice made by each and every one of the 456 members of the armed forces who have died during operations in Afghanistan. Their sacrifice has helped to protect our country and our citizens from the threat of terrorism, as well as giving the people of Afghanistan the chance of a better future.

The UK is making a significant contribution to the coalition of more than 60 countries, supporting the Iraqi security forces to deny ISIL the freedom to operate in 30% of the Iraqi territory it once held, helping Syrian Kurds take 17,000 sq km from ISIL in Syria, and degrading ISIL’s ability to refine oil or to access the international financial system.

The UK military is focusing its efforts on areas where we can bring particular expertise and I am pleased to announce today that the new courses of counter-IED training for Iraqi ground forces are starting this week following the Prime Minister’s pledge in the summer that we would increase the number of personnel assisting the Iraqi Government’s counter-ISIL efforts. These 54 personnel, drawn mainly from 33 Engineer Regiment (Explosive Ordnance Disposal) from Saffron Walden, are delivering life-saving counter-IED instruction to members of the Iraqi security forces at training centres in Bismayah and Taji.

Some of the military operations—the strikes—have changed the pattern of refining. ISIL appears now to be getting some of its oil from small-scale wells rather than the larger refineries, some of which have been put out of commission, but we are intensifying our efforts internationally to make sure that where ISIL is attempting to sell oil, it is not able to gain the proceeds from it.

ISIL poses a direct threat to our national interest as well as threatening the stability of the middle east, and Britain should not be a bit-part player in combating ISIL on the ground. Does the Secretary of State agree that the time has come for Britain to extend its military operations beyond Iraq to take on ISIL in Syria?

I agree with my hon. Friend that ISIL has to be defeated in both Iraq and Syria, and we support the air strikes being conducted by the coalition against ISIL in Syria—air strikes which are now being carried out by Australian and French as well as American aircraft. As my right hon. Friend the Prime Minister has said, there is a very strong case for us to be doing more in Syria to deal with the heartland of ISIL—its command and control—but we will only return to Parliament for authority to do so when we have established a sufficient consensus here in this Parliament.

I entirely agree with my hon. and learned Friend. Our remotely piloted aircraft play a key role in current operations in the middle east and the 2% commitment enables us to obtain more of them. We have a moral duty to protect the lives of our servicemen and women to the best of our ability, and the use of remotely piloted aircraft avoids placing our aircrews in jeopardy.

ISIL is being directed from an area of north-east Syria where Assad has no control at the moment. That is where it has its command and control, its logistics, its personnel and the command of its supply routes from Syria into Iraq. It is well away from most of the civil war that is raging further west in Syria.

This is not just about Iraq and Syria. On 24 September, affiliates of Daesh claimed responsibility for the explosion in the central mosque in Sana’a in Yemen. ISIL is taking advantage of the civil war to extend its operations in that country. What is being done to stop it?

We agree that the legitimate Government of Yemen is that led by President Hadi, and to that extent we support the efforts of Saudi Arabia and its partners to ensure that President Hadi can again be recognised as president of the country. We also want the fighting there to stop so that we can get much-needed food aid and fuel into Yemen, where millions of people are now at risk of starvation. In the end, however, this is a war that must be brought to a conclusion through some kind of political settlement.

As I said in my original answer, it has reduced the ability of ISIL to operate, particularly in Iraq. To that extent, the coalition strikes in Syria are useful to that campaign. Given that ISIL is a danger to the people of this country as well as to the security of that region, and bearing in mind that 30 of our holidaymakers, including four Scots, were slaughtered on a beach in an ISIL attack in Tunisia, it would not be right for the task of defeating ISIL in Syria in order to keep our streets safe to be left to French, Australian and American aircraft.

The Secretary of State says that military personnel from America, Australia, Russia, Qatar, Saudi Arabia, Turkey, Libya, Egypt, France, Jordan, Iran, Belarus and North Korea are already in Syria, along with the peshmerga, the Free Syrian Army and Daesh. What does he think the UK dropping even more bombs is likely to achieve? Should not the United Kingdom be using its influence in the United Nations to pursue peace through diplomacy rather than gearing up for airstrikes?

ISIL has been butchering our own civilians, killing people of other faiths and throwing gay people off buildings. With respect, I have to say to the hon. Gentleman that I find the idea that it would suddenly cave in to diplomacy in the form of a United Nations resolution a little naive. ISIL has to be defeated in Iraq and in Syria, and the coalition would welcome the precision capability that our Tornado aircraft could bring in Syria, as they have done in Iraq.

When the Secretary of State was asked on “The Andrew Marr Show” at the weekend whether it was still his intention or his hope that RAF jets would be flying over Syrian airspace to tackle the threat of ISIL/Daesh before too long, he said that “the logic is inescapable”. Opposition Members will consider any Government proposal on this with the utmost seriousness, but in view of that reply, will he tell the House whether it is still his intention to ask for parliamentary approval ahead of any such intervention and, if so, when he expects any such vote to take place?

I should like to begin by welcoming the shadow Secretary of State to her first Defence questions and by welcoming the team that she has assembled alongside her. I made it clear yesterday, as I have done today, that ISIL has to be defeated in both countries, not least if we are to support the democratic Government of Iraq and help to keep our own country safe. This is a new Parliament and we will continue to work with colleagues across the House to build a consensus that will allow the RAF to operate in north-east Syria and not have to turn back at the border. When we have established that consensus, we will come to the House for the authority to act.

Countless past campaigns show that air strikes are seldom, if ever, decisive unless they are in support of credible ground forces. What credible ground forces are fighting Daesh in Syria, other than the Kurds, in limited areas, and Assad’s, which are not also Islamist?

There are moderate opposition forces contesting against Assad, trying to protect their towns and cities from the brutality of Assad, who is of course dropping barrel bombs on them—on his own people. The coalition is helping these moderate opposition groups where it can, with training and with equipment. Our troops have been helping to train some of those forces, outside Syria.

If this Parliament were to approve an extension of UK engagement in the conflict in Syria and Iraq, that would be predicated on an understanding that we will be relying on reservists as never before, because of the changing shape of our UK defence capability. The Ministry of Defence directly funds overseas development assistance eligible activity up to £5 million a year, including disaster relief training and international capacity building. This counts towards the NATO 2% guideline. The costs of conflict, stability and security fund programme activities led by the Ministry of Defence, and security and humanitarian operations, which are partly refunded from the Department for International Development budget, will also contribute to the ODA target.

The ministerial team will notice that that is not a question about defence of the north coast. When Back Benchers cheered the two commitments on aid and military spending, I wonder if they were fully aware that that is, in effect, double counting of expenditure. Does the Minister accept that although this may be technically permitted, morally it is a contradiction in terms? Will he do all he can to minimise such double counting in the future?

Rules for what is counted and what is not counted are set for NATO expenditure by NATO and for overseas development expenditure by the OECD, so these are international rules. However, I do not agree with the hon. Gentleman. There is expenditure—defence and overseas aid—that counts towards security. Stabilising countries, preventing conflicts, peacekeeping—all that contributes to the security of our country, as well as that of some of the more fragile regions of the world.

My right hon. Friend knows that I am so enthusiastic about the Government’s commitment to spending 2% of GDP on defence that I have my private Member’s Bill to enable the Government to join me in enshrining support for that commitment in law. In advance of that, can my right hon. Friend confirm the figures given to me by the Library that in reporting to NATO to meet our 2% commitment in 2015-16, we have added items of expenditure not previously included under defence? They were provision for war pensions, £820 million; assessed contributions to UN peacekeeping missions, £400 million; pensions for retired civilian MOD personnel, around £200 million; and much of MOD’s £1.4 billion of income, which makes more than £2.5 billion.

The Department has conducted a number of lessons-learned exercises during and after military operations in Libya, Afghanistan and Iraq, in particular that military action needs to be set in the wider political context. In Syria, for example, the long-term solution to the current conflict, and to the presence of ISIL, has to be an acceptable political transition, and we continue to work to support this.

Yes. My right hon. Friend the Prime Minister and other leaders were recently in New York at the United Nations General Assembly pressing all their colleagues to search for a political solution that would enable the formation of a more comprehensive Government who would appeal to and attract from all parts of Syrian society, whether Kurdish, Shi’a, Sunni, Christian, Druze, or whatever. We have such a comprehensive Government in Iraq; it is time now to find one for Syria too.

There is certainly a cost to military operations, but there is a greater cost in our not dealing with the growth and spread of ISIL across the middle east. We are doing this in response to a request from the democratic, legitimate Government of Iraq to come to their aid. We are also doing it for the greater stability of the region and, ultimately, to keep our own streets safe.

It is not a view I hold, but it is at least an entirely rational view, to say that Britain should never get involved in any military operations in the middle east. It is also rational to say that Britain should get involved in military operations across the whole area that our enemy occupies. Surely what is irrational is to do that just for part of it, and to recognise a border that ISIL, in this case, simply does not recognise.

I agree with my hon. Friend. Not taking action when one has the ability to do so also has consequences. I respect the position of various Members of this House in the previous vote two years ago, but a large number of people have died in Syria at the hands of Assad since this House was asked before to take action to stop him slaughtering his own citizens.

My immediate priorities are our operations against ISIL and the strategic defence and security review. Does the Secretary of State understand that any intervention in Syria has to be part of a wider series of actions, including creating safe areas for the civilian population to try to stem the refugee crisis, increasing humanitarian aid, bringing those responsible for war crimes to account, and trying to build a plan for peace in the region?

I agree with that. We have to look at this across the board, and not simply focus on military action. That is why we are also pursuing the political track of looking for a wider political settlement in Syria. The hon. Gentleman is right about encouraging other countries to match the commitment we have made financially to helping refugees, on behalf of this country, in Syria. Safe havens would of course require quite significant military force to police.

The national security strategy of 2010 identified cyber-attack, including by other states, as one of the four highest priority national security risks facing the UK. Does the Secretary of State agree that that is still the case?

Yes, I certainly do. The cyber threat—not simply from other states, but from non-state actors—remains very real. We are investing heavily in this area and the responsibility for the cyber programme is being transferred from the Cabinet Office to my Ministry, to make sure it is properly co-ordinated.

That is an interesting answer. The Times has reported:

“A well-placed defence source said that senior military officers were very concerned by the prospect of China building a nuclear power station in Britain.”

The Financial Times reports that our closest allies in other western capitals regard the policy as

“bizarre at best and craven and dangerous at worst”,

and says that China specialists at the Foreign Office are “in despair.” The Ministry of Defence’s own policy adviser, Paul Dorfman, asserts:

“America wouldn’t dream of letting China have such a part in its critical national infrastructure. The idea the UK is prepared to do so is, frankly, astounding.”

Will the Secretary of State therefore explain to the Chancellor and the Prime Minister, while there is still time, that they are putting our national security at risk in doing this deal?

I hope the hon. Lady will join me in welcoming the President of China on his visit to this country this week. On Chinese participation in the Hinkley Point power station, let me be very clear that it is a financial investment. It is a French-designed reactor and a French-built power station, and it will be supported by Chinese finance. In any case, we have independent regulation of our nuclear sites, and that regulation includes all aspects of security as well as of safety.

Absolutely. Although my Department’s budget is rising again, there will be no let-up in getting more value for money. We have a strong record of delivering efficiency savings, including some £5 billion in the last Parliament. For the first time, as a result of the July Budget, every pound we save can now be reinvested in the frontline rather than handed back to the Treasury, so we can spend more not simply on ships and planes, but on cyber, as we have discussed, and on unmanned aircraft and the latest technologies.

The United Kingdom was instrumental in securing the recent Security Council resolution 2240, which authorises all navies to take action against smugglers and human traffickers on the high seas in the Mediterranean. This will support the efforts of HMS Enterprise and HMS Richmond, which is taking up its station off the Libyan coast this week, in contributing to the naval operations in the Mediterranean and tackling this evil trade as it occurs.

Sensible people out there will think the world has gone mad if the Government allow companies controlled by the Chinese Government, and which helped to develop their nuclear weapons, to take a large stake in Britain’s nuclear power industry. The shadow Secretary of State was completely right to raise this matter. Will the Secretary of State tell us what assessment his Department has made of the risks and national security considerations of giving a communist dictatorship such a huge role in such a critical part of Britain’s national infrastructure?

Unlike the hon. Gentleman, we welcome the fact that there is Chinese investment in this country, just as there is British investment in China. As I have already made clear to the House, this is financial investment in a French-led project to build a new power station at Hinkley Point. Our independent nuclear regulator is well able to ensure that all security and safety aspects are considered.

My right hon. Friends know that I have repeatedly raised on the Floor of the House my concerns about the way in which the Chinese Government are building runways and port facilities on uninhabited and disputed atolls in the South China sea. Although my right hon. Friend the Secretary of State—and, no doubt, the Prime Minister, who I am pleased to see in his place—will welcome the Chinese President, do the Government have plans to raise with China the way in which they are seriously escalating tension in the South China sea to the detriment of many of our allies in the region, to which we have a responsibility under the five power defence arrangements?

I hope that my hon. Friend, too, will welcome the President of China on his state visit to our country this week, just as we welcomed ships of the Chinese navy on their visit to Portsmouth earlier this year. We welcome the growing military relationship between the armed forces of our two countries. All countries that trade internationally have an interest, as he said, in the peaceful navigation of the South China sea.

Syria is not Iraq or Afghanistan, but this country made some poor decisions in those countries, particularly in Afghanistan, in operational and intelligence matters that we must learn from. Most of all, surely we need to learn from the lack of clarity in our strategic objectives that so badly affected the war in Afghanistan. Listening to the Secretary of State today, I think that such a lack of clarity is still evident when he talks about Syria.

As far as Afghanistan is concerned, we are of course learning the necessary tactical lessons from that campaign, as we do with any campaign. I made the point much earlier that ISIL has to be defeated in both Iraq and Syria. It is somewhat illogical, when ISIL presents such a grave threat to the Government of Iraq, the stability of the region and our own streets, that our aircraft have to turn back at the Iraqi border.

Does the Secretary of State agree that some of the concerns about Chinese investment in critical infrastructure in this country, which have understandably been raised, can be placated by reference to the work that has been done between our security services and Huawei in relation to investment in telecommunications? Will he look on that as a useful template that can be utilised as and when there is investment in the nuclear industry by Chinese investors?

I will certainly look at that example. However, as I said earlier, when there are security concerns about any of our power stations or other parts of the nuclear grid, it is up to the office of the independent regulator to ensure that they are fully protected.

I beg to move, That the Bill be now read a Second time.

The introduction of an Armed Forces Bill is always a significant occasion for defence. It matters in particular for three reasons. The first reason is its constitutional significance. We are renewing the legislation necessary for the armed forces to exist as disciplined forces. That legislation is currently the Armed Forces Act 2006, which provides the system of command, discipline and justice for the armed forces. It covers matters such as the powers of commanding officers to punish disciplinary or criminal misconduct, the powers of courts martial and the powers of the service police. The 2006 Act confers powers and sets out procedures to enforce the duty of members of the armed forces to obey lawful commands.

Since the Bill of Rights in 1688, the legislation making the provision necessary for the Army to exist as a disciplined force—and, more recently, the legislation for the Royal Navy and the Royal Air Force—has required regular renewal by Act of Parliament. Without this Bill, the Armed Forces Act 2006 could not continue in force beyond the end of 2016. That reminds us that ultimate control over the system under which the armed forces are maintained resides not with the Executive, but with Parliament.

Secondly, this occasion is sufficiently rare in the lifetime of a Parliament to prompt us to reflect on the progress made since the last such Act, the Armed Forces Act 2011. The centrepiece of the last Act, the requirement to report on the armed forces covenant, remains more relevant than ever. The covenant has already made a huge difference to the lives of serving and ex-service personnel. In the past few years, we have seen not only the Government, but all 407 local authorities and more than 700 businesses, large and small, come together to make sure that our personnel get a fairer deal as a result of their service to our country.

We have perhaps been somewhat neglectful of armed forces personnel when they cease to be serving and become veterans. Does the Secretary of State agree that we must place a greater priority on ensuring that veterans have ongoing help and support because of the difficulties that many of them may still face as a result of their service in Iraq and Afghanistan?

I certainly do agree with that. This work is ongoing and is not yet done. We will continue to try to make progress. As the hon. Lady knows, we have implemented a number of reviews, not least Lord Ashcroft’s review of the mental health services that are available to veterans.

I assure the House that our commitment to the covenant remains unshakeable. Today, we are launching a credit union for armed forces personnel. By paying a regular amount of their salary directly into the credit union, they will be able to avoid the struggle for credit approval and the siren call of the payday lenders.

Thirdly and finally, the Bill gives us the opportunity to ensure that the 2006 Act remains fit for purpose for the next five years. The first clause keeps the 2006 Act in force beyond the end of 2016; provides for the continuation of the 2006 Act for a year from the date on which this Bill receives Royal Assent; and provides for renewal thereafter by Order in Council, for up to a year at a time, until the end of 2021. That will give Parliament a regular opportunity to debate the systems of the armed forces for command, discipline and justice.

Clauses 2 to 6 modernise and strengthen the service justice system by making sensible and proportionate changes to the existing provisions. I will take each of those clauses, very briefly, in turn.

Clause 2, on post-accident testing for alcohol and drugs, deals with the situation whereby a commanding officer may require a member of the armed forces or a civilian who is subject to service discipline to co-operate in a preliminary test for alcohol or drugs only when he or she suspects that an offence has been committed. The clause extends those circumstances by providing for post-accident preliminary testing without the need for suspicion that the person being tested has committed an offence. The new powers to require co-operation with tests will apply only after accidents involving aircraft or ships or other serious accidents. They are derived from, although not identical to, those in the railway and transport safety legislation under which civilians are required to co-operate with tests for alcohol and drugs.

Clauses 3 to 5 simplify the process of investigation and charging of criminal and disciplinary offences under the 2006 Act. The commanding officer rightly deals with 90% of cases in the service justice system, and that will not change. The remaining 10% of cases are those that the commanding officer does not have the power to hear, which involve offences such as perverting the course of justice and sexual assault. Some cases that cannot be dealt with by the commanding officer have to be referred by the investigating service police to the commanding officer and then by the commanding officer to the director of service prosecutions for a decision. That is an unnecessarily complex process.

Clause 3 provides for the service police to refer straight to the director of service prosecutions in any case where there is sufficient evidence to charge for an offence that the commanding officer cannot deal with on his own. That brings the service justice system into line with the civilian system.

Does that mean that the commanding officer is taken out of the loop entirely in cases concerning soldiers, sailors or airmen who are his or her responsibility?

No, because the commanding officer will be kept informed about the investigation and the stage it has got to. They are not being removed from the process; we are merely simplifying the procedure and shortening it so that the matter does not have to be referred automatically to the commanding officer and then back to the director of service prosecutions.

Clause 3 also deals with linked cases such as separate offences that occur during the same incident. Some cases may need to be sent to a commanding officer, even though they are connected to a case that has been sent to the director of service prosecutions, and that can result in separate decisions on whether to prosecute, and separate trials. Clause 3 allows the service police to refer a case to the director of service prosecutions if, after consultation, they consider it appropriate to do so because of a connection with another case that has also been referred to that director.

Clause 4 clarifies the procedure for the referral of those linked cases from the commanding officer to the director of service prosecutions, and clause 5 allows the director to bring charges. Currently, when the director of service prosecutions decides that a charge must be brought, they must direct the suspect’s commanding officer to bring that charge. Clause 5 allows the director to bring that charge, just as the Crown Prosecution Service brings charges in the civilian criminal justice system.

Clause 6 increases the range of sentencing options available to the court martial. Civilian courts are currently able to suspend sentences of imprisonment for up to 24 months, but service courts can suspend them for only 12 months. We would like courts martial to be given greater flexibility to vary the deterrent effect of service detention. In some cases it is right for suspended sentences to allow continued service alongside rehabilitation activities. The clause simply corrects the anomaly by giving courts martial the ability to suspend sentences of service detention for up to 24 months.

Clauses 7 and 8 give the director of service prosecutions power to give offenders immunity from prosecution, or an undertaking that the information they provide will not be used against them, in return for assistance that the offender may give to an investigator or prosecutor.

Will my right hon. Friend say what service offences he has in mind for immunity from prosecution? Will he reassure the House that that does not involve any form of plea bargaining, and say whether there are civilian equivalents of the kind of offences that he has in mind?

Only the most serious cases would involve that kind of immunity—perhaps the Minister will provide my hon. Friend with more examples of what such cases might be when he winds up the debate. These are cases where the evidence from a witness or defendant could be crucial, but where fears about self-incrimination stop someone coming forward and providing essential information.

In the civilian criminal justice system prosecutors such as the Director of Public Prosecutions have statutory powers to offer immunity and restrictions on the use of evidence, but the director of service prosecutions in the service justice system does not. That damages their ability to prosecute the most serious cases, because it may be necessary to rely on evidence from individuals who may not be willing to come forward and give evidence without conditional immunity, or an undertaking that that information will not be used against them. These clauses closely follow those in the Serious Organised Crime and Police Act 2005 that apply to the civilian criminal justice system.

I assure my hon. Friend that as in the civilian criminal justice system, the intention is for immunity and undertakings not to use information to be offered only in the most serious circumstances for those who are found, after proper investigation, to have fallen short of the high standards that we set.

Clause 13 brings the Armed Forces Act 2006 back into force in the Isle of Man and British overseas territories except for Gibraltar. Under United Kingdom law, the 2006 Act has always applied to members of the armed forces, wherever in the world they are operating, and that will remain the case. That means that a member of the armed forces commits an offence under UK law if they do something in another jurisdiction which, had they done it in England or Wales, would have been a criminal offence.

In addition, the 2006 Act originally formed part of the law of the Isle of Man and the British overseas territories. However, the Act expired in those jurisdictions in 2011. Clause 13 and the schedule to the Bill revive the Act in those jurisdictions so that, as it currently has effect in the UK, it will also be in force there. That ensures that things that members of the armed forces might do under the 2006 Act in those jurisdictions, such as the exercise of service police powers of arrest or search, would be lawful there not only as a matter of UK law but as a matter of the local law. It also ensures that the civilian authorities within those jurisdictions can do things under the 2006 Act which they might not otherwise have powers to do under the local law, such as the arrest of a person suspected of a service offence under a warrant issued by a judge advocate.

An exception is being made for Gibraltar. This is because we are currently consulting the Government of Gibraltar on how best to extend the provisions of the 2006 Act—and, therefore, of the Bill—to that territory.

Clauses 14 and 15 relate to Ministry of Defence firefighters. The Defence Fire Risk Management Organisation has more than 2,000 personnel operating over 70 fire stations. Yet those firefighters currently have no specific emergency powers to act to prevent or deal with fires to protect life or preserve property. That could lead to a situation where firefighters entering a property to put out the flames might have to defend themselves against charges of breaking and entering, or where restraining family members from returning to a burning building might leave them open to a charge of assault.

Fire and rescue services at some MOD sites are currently provided by a contractor. They, too, should be able to deal with an emergency in the same way as MOD firefighters. Clauses 14 and 15 address this issue by giving defence firefighters the same powers to act in emergencies as employees of a civilian fire and rescue authority.

In conclusion, the Bill is an important act in continuing the authority of the armed forces. It makes modest but relevant upgrades to the existing system for the armed forces of command, discipline and justice. The world-class reputation that our armed forces enjoy is underpinned by many factors, one of which is that system of command, discipline and justice. We need to make sure that that system continues to be fit for the modern age. I commend the Bill to the House.

I thank my hon. Friend, who is a member of the Defence Select Committee, for her welcome for my appointment, and I hear what she has to say about these matters. The reason Liberty is campaigning on some of these issues is that, if things go wrong, it can destroy people’s lives and cause many difficulties, not only for the individuals affected but for the services. In Committee, I want us to debate the matter further with Ministers, who I know have met and considered these matters with campaigners, and to hear a bit more detail about policy development and where they are in respect of some of these things.

We have already heard from the Secretary of State the rationale for extending the provisions in the Armed Forces Act 2006 to the Isle of Man and British overseas territories, except Gibraltar, but we will want to make sure, by way of the normal scrutiny one would expect of a Bill, that the provisions are correctly drafted, fit for purpose and will do what he said he wants them to do.

We are concerned about the rationale for the provisions in clauses 14 and 15 relating to the powers of Ministry of Defence firefighters in an emergency. There is no discernible problem, or any reason why those provisions need to be in the Bill. The explanatory notes suggest, as the Secretary of State did, that MOD firefighters currently have no power in an emergency to act to protect life and property, but I wonder whether there have been instances of the kind of difficulty to which he referred. Have there been instances of such firefighters being prosecuted, or being sued for assault or for breaking and entering? If there have been any such instances, I can see why he might want to introduce these provisions. If there have been no such instances and this is simply a tidying-up exercise, how come he perceives a problem now?

Let me try to answer that, but first may I welcome the hon. Lady and her team to the Dispatch Box for the first time? This measure is, of course, a precautionary one to reinforce the powers of those firefighters. There may well be instances where they might have to enter service accommodation or a civilian house on or near an MOD airfield. In other circumstances, perhaps in a remote area, MOD firefighters may be the first to reach a civilian fire in a civilian area, having got there in advance of the local authority fire service, but they do not have exactly the same powers. The purpose of these clauses is to deal with these things.

I am grateful to the Secretary of State for that further explanation. In preparing for my remarks, I gave the chief fire officer of Merseyside’s fire and rescue authority a ring to ask whether the Chief Fire Officers Association, of which he is a member, has been consulted about these provisions. I thought it might have asked for this kind of measure. My contact with him was the first he had heard of these provisions, although he was of the opinion that he would have expected the CFOA or the local authority fire and rescue authorities to have been consulted ahead of their introduction. They are category 1 responders and would have expected to have been consulted on these provisions. There are well-known, regular opportunities for the MOD to consult and liaise with the civilian fire authorities and chief officers, but that has not been done in this instance, which made me wonder precisely what was going on. The provisions seem to imply the deployment of MOD firefighters beyond the confines of their current role on MOD property. The definition of “firefighter” includes, as I believe the Secretary of State said, contractors and subcontractors employed by private companies, and we are at a time when the work the Defence Fire Risk Management Organisation does is being outsourced or tendered. We will want to probe this matter further in Committee.

The Secretary of State has sought to reassure me, and I am open to being reassured. I am pleased to confirm that, with those few remarks and slight concerns notwithstanding, we will be supporting the Bill and seeking in Committee to probe its provisions, improving them where we can. Of course, if they cannot be improved, we will support them. [Interruption.]

The UK’s intelligence surveillance and reconnaissance capabilities and equipping our special forces are two high priority issues for the strategic defence and security review.

We have reached some early decisions in these two key areas. We will more than double the number of remotely piloted air systems in the RAF’s fleet, as we start to replace the 10 current Reapers with over 20 of the very latest air vehicles. We will also provide our special forces with new specialist weapons and clothing, as part of a programme to ensure that they remain at the cutting edge of technology.

The first RAF Reapers were deployed to Afghanistan in 2007, and are now flying vital missions over Iraq and Syria. We want to expand our capability as this area of technology rapidly develops, so we will start to introduce the new Protector aircraft. With its greater range and endurance, it will significantly increase our ability to identify, track, deter, and ultimately counter potential threats. Previously known as the Scavenger programme, Protector will substantially enhance the UK’s global intelligence surveillance and reconnaissance capability.

The new special forces equipment package will ensure we maintain clear operational advantage over adversaries, and enhance their ability to work with our key allies.

This investment will enable us to address sophisticated dangers both at home and abroad, and is only possible because this Government have committed to increase defence spending, meeting the NATO investment pledge and spending 2% of GDP on defence for the rest of this decade.
