Commons ChamberWhat we have done as a Government is act decisively to deal with the very severe energy crisis we are facing. [Interruption.] We are facing a severe energy crisis. We are also facing a slowdown in economic growth globally due to Putin’s war in Ukraine, and not acting is not an option.
The energy price guarantee is a key part of the growth plan, but too few businesses and households know about it, even if the Labour Party does not support it. Can I urge the Prime Minister to have a nationwide mail-out campaign to communicate what the Government are doing to assess people on reduction of energy and, more particularly, to have a reduction-of-energy campaign for public buildings, so that we do not go down the route of spending too much on consumption?
My hon. Friend is absolutely right, and I know that the Energy Secretary is working on a plan to help companies and individuals use energy more efficiently. We are also working on this across Government. I was delighted to speak to my hon. Friend the Member for Hexham (Guy Opperman) yesterday, and I hope we will be able to start this going in No. 10 straightaway.

Commons ChamberOver recent months, we have been forced to gather here far too often to remember colleagues who, very sadly and often suddenly, have been lost to this Parliament.
Jack Dromey is another Member of this House who has gone well before his time. On behalf of myself and my colleagues in the Scottish National party, I want to extend our deepest sympathies to all who knew and loved Jack. My thoughts, of course, are most especially with the Mother of the House; she has lost a constant companion at her side. She and the family bear the biggest burden of the loss of someone who was at the very centre of all their lives.
I would also like to extend sympathy to Jack’s beloved party, because we all know he was a Labour man through and through. I will also remember Jack as one of the feistiest campaigners in this place—a man rooted in trade union politics, rooted in the rights of workers, and a man who never lost an ounce of that spirit when he entered this Parliament. That fighting spirit extended to causes and campaigns far and wide, and I know that it extended to strikes and protests in Scotland, too. He was a true friend of Scottish workers and a champion of workers everywhere.
Jack was true to the cause and that is probably why he was so good at working cross-party and winning support and friendship across this place. My friend, the former Member of this place, Neil Gray, worked very closely with him on the Pension Schemes Act 2021 and he still speaks so fondly about Jack’s determination and his passion to make sure that that Bill was amended. He would often bound up the stairs to my office to seek my and my party’s support for various campaigns not just for him, but more often, for Harriet.
I will finish by sharing one story that I read about Jack, which I thought was both very telling and very touching. Apparently, a few years ago, a great admirer of the Mother of the House from the feminist movement approached Jack and said, “I always feel a bit nervous around Harriet—I am so in awe of her,” only for Jack to reply, “Me too. Even after all these years.” Today, we can assure Jack and his family that many of us were in awe of him, too. We deeply admired the way he conducted himself and the way he carried himself every day of his life. He left his gentle mark on so many and he will be greatly missed. May he now rest in peace. God bless you, Jack.
Thank you for allowing me, exceptionally, to speak from the Front Bench on a very difficult occasion. What an honour, my dear Jack, and what a sadness it is to speak of the friend I got to know from the other side of the Aisle.
For three years, Jack was the shadow Pensions Minister and we became close. We would meet, talk and plan, and sometimes agree to disagree, but always with equanimity. Politics is adversarial and heated. The media encourage us—in fact, demand of us—to be aggressive and mean-spirited. Jack did not play that game. Others have spoken of his decades of work for the union movement, of his being a loving father and a devoted husband, and even of his management of truculent children on a deserted Greek road. I want to talk about two things. First, he is the best example I know in 11 years in the House of Commons of cross-party working. Many used to joke about how often I would exchange texts with Jack. We worked together and we got results. I would give him briefings on all future legislation, ongoing inquiries and difficult issues. That requires a lot of trust, and such trust can go wrong, as we all know. But he never used confidences unfairly or for quick political gain. I believe that we and this House work better for such a thing. During the process of the Pension Schemes Bill, we spoke or sent texts to each other more than 110 times—I counted them up. Without his help, the Bill, in particular, the measures on collective defined contributions, and the work with the Transport and General Workers Union, would not have happened as they did.
Secondly, I want to talk about Jack’s kindness and generosity of spirit. My children died in childbirth in June 2020 and I want to share with the House what he said when I tried to return to work, as we had two Bills to do that autumn. He saw that I was struggling at this Dispatch Box on 29 June. He sent a text to me afterwards and I wanted to share it with the House:
“Guy, I know we both have a job to do, but I was not comfortable today. I feel for you, and your wife, my friend. We will build work around you. My thoughts are with you. Please take your time. Best wishes, Jack”.
Jack Dromey was, in my opinion, a man made in the Teddy Roosevelt spirit: kind but combative; passionate but polite; and always in the arena, always striving for the benefit of others. There can be no finer compliment than saying that “The Man in the Arena” quote, which is my favourite, applies utterly and totally to Jack. Farewell my friend, it was an honour to know you.
My husband Henry introduced me to Jack and Harriet when we got together in the ‘70s. We were, as ever, at some conference, Jack was, as ever, preoccupied with fixing some vote, and I was in total awe of Harriet and Jack. Fortunately, I got the seal of approval and we have been friends now for nearly 50 years. Those who knew him well know what a generous, kind, funny, enthusiastic, interested and interesting, loyal, unselfish and consistent friend Jack was.
Jack’s life was filled by his total passion for social justice, his tribal loyalty to the Labour party, his consummate determination to be at the heart of any and every campaign that might help to make the world a better place, and his relentless optimism that he would always win. Jack’s life achievements were so many, his campaigns so eclectic, that it is impossible to capture everything in a short tribute. I want to focus on his work before he became an MP. From the Grunwick strike to fighting to maintain the Rosyth and Plymouth dockyards, from corralling the first ever equal pay strike at Trico to observing the Luanda mercenary trials in Angola, seeking to stop the execution of three British mercenaries, wherever there was injustice, Jack was there. I remember Jack in the ‘70s leading the occupation of Centre Point in London, when London was littered with empty new office buildings while the homeless slept on the streets; in the '80s, when he bravely led the trade unions to oppose Militant in Liverpool; in the ‘90s, when he served on Labour’s national executive committee and worked to modernise the Labour party and make us fit to govern; and in the noughties, when he organised the cleaners’ strike here in Parliament when they were earning as little as £5 an hour.
Finally, two personal memories. In all our fantastic adventurous holidays together, whenever we arrived at a new destination, Jack’s first question was always, “What’s the wi-fi code?” He was not looking for a local restaurant. He was not finding a place for us to have a drink. His first priority was always, “Is everything okay in Erdington?” On new year’s eve, we would always have a sing-song, me playing the piano and everybody else singing. Each year, Jack, with his great singing voice, would give us a solo performance, that harked back to his Irish roots, of “Danny Boy”, with the women joining in to help him with the high note at the end. We always brought in the new year with a bang.
Our grief at his loss is an expression of our love for the man. Jack will continue to live on in all our todays and tomorrows as we take forward the campaigns he worked on and enjoy the successes he achieved. Thank you, Jack, for everything, and for just being you.

Commons ChamberUnder the 2021 spending review there will be delivery of targeted support for disabled people, including £1.1 billion of investment in helping them to get into work, £2.6 billion of funding for new school places for children with special educational needs and disabilities, and much more on health and other matters.
In the autumn statement the Government snuck out a £70 million stealth cut to benefits. I was grateful for the opportunity to speak to the Minister before questions, and I know he is not the Minister responsible, but can he confirm that disabled people will be involved in the process and say how it will affect them? If he cannot, will the Minister responsible write to me?
Yes, the Minister for Disabled People will write to the hon. Gentleman, but I can confirm that we will spend the record sum of £58 billion this year on benefits to support disabled people and people with health conditions. The hon. Gentleman will be aware of the health and disability Green Paper and the strategy published in the summer of last year, which will be responded to in this House in the summer of this year.
The Conservatives are simply unable to get a grip on the cost of living crisis, and disabled people are paying the price. After failing to act in the Budget, yesterday the Conservatives voted against measures to slash the cost of fuel, which would have disproportionately benefited disabled people, who are more likely to be in fuel poverty. Indeed, the Conservatives seem to have little understanding of the reality of disabled people’s lives. Can anyone on the much enlarged Treasury Bench inform the House what percentage of disabled people currently live in relative poverty?
I will get the Minister for Disabled People to provide the precise stats for the hon. Lady, but I repeat the point that funding for disabled people and people with health conditions is at the record level of £58 billion.
I find it astonishing that no one on the Government Front Bench appears to be aware that 27% of disabled people in our country live in relative poverty—that is up by 1 million more disabled people since 2010. The situation looks set to be exacerbated by the Chancellor’s £70 million stealth cut to disability benefits in the Budget, of which the Minister seemed to be unaware when it was raised a moment ago. Were the rest of the Women and Equalities team consulted about that stealth cut?
The hon. Lady will understand that only the Minister who is asked the particular question can answer. The practical reality is that the spending review has shown that £58 billion is a record sum. It is an increase of nearly £5 billion in real terms since 2010.
Yesterday, the Secretary of State for Business, Energy and Industrial Strategy assured me that he has had extensive conversations with the Chancellor about the cost of living crisis that we have just heard about, but what we need is action. Not only have disabled people on benefits lost the £20 a week universal credit uplift, but their benefits are lower in real terms than they were before the pandemic and many face the future with real dread. Disabled people should not bear the brunt of the cost of living crisis, so what discussions has the Minister had with his Treasury colleagues about tackling the toxic blend of Tory cuts, tax hikes, soaring inflation and surging energy bills that is affecting disabled people across the UK?
The hon. Lady will know that there is the household support fund, the winter fuel payments, the cold weather payments and the increase in the state pension by 2.5% for this year and by 3.1% next year, and that there is everything from the energy price cap to the freeze in fuel duty, which all go to assist anybody affected.
The DWP has launched 50Plus Choices, which specifically addresses the issues the right hon. Gentleman raises. I will get the Minister responsible for that matter to write to him.
Outcomes for people in Blackpool in education, health and employment are among the worst in the whole country. I welcome the equality data programme, which is examining how factors such as social background and geography contribute to inequality. How does the Minister expect the programme to reduce the inherent inequalities that have disadvantaged people in Blackpool for decades?

Commons ChamberIn July this year we published the health and disability Green Paper and the national disability strategy, which takes into account the impacts of covid-19 and the impact on disabled people in particular. It also focuses on the issues that affect disabled people in general, which we want to address on an ongoing basis.
A disabled constituent from Bosworth wrote to me about difficulties in travelling within the UK. I wrote to the Department for Culture, Media and Sport, which wrote back referring to the national strategy for disabled people and a vision of making the UK the most accessible country in Europe by 2025. What work is being done in respect of enabling the Department for Transport, the Department for Business, Energy and Industrial Strategy and the DCMS jointly to make the UK a place where disabled people can work, travel and play?
I want to reassure my hon. Friend’s constituent and indeed my hon. Friend, who has done so much already for his constituency and the many tourist destinations on his patch, that we are on a mission to make the UK the most accessible tourist destination in the world.
Disabled people, on average, face increased costs of £583 a month. Worryingly, the High Court case against the Government on the lack of a £20 uplift in legacy benefits has been delayed owing to a lack of available judges. The Government’s strategy for disabled people promised better cross-departmental working. What pressure is the Minister putting on the Department for Work and Pensions to publish its commissioned research on the uses of health and disability benefits to ensure that we assess the adequacy of the various benefit rates that apply to disabled people?
The hon. Lady will be aware that we have published the health and disability Green Paper. We have also published a strategy, and we are working across Government to ensure that all these matters are being addressed.
Understanding why labour market disparities exist between ethnic groups is complex, and work is ongoing across Government to understand better why these disparities exist. In particular, we have a national programme of mentoring circles involving employers who are offering specialised support to unemployed young ethnic minority jobseekers.
I am sure the Minister was as shocked as the rest of us to discover that the increase in young black unemployment was exponentially higher than the increase in young white unemployment at the end of the last quarter of last year, and it has not got better. What specific programmes will he undertake to make sure that we do not see the additional scarring of a generation of young black people aged 16 to 24?
The Government are already acting on this precise point, and in the hon. Lady’s Hackney constituency the jobcentre is working with the council and with local charities as part of the improving outcomes for young black men programme. The focus of that programme is on harnessing successful young black men’s potential and tackling specific inequalities where they exist.
I am the Government’s new trade envoy to Pakistan, so does my hon. Friend agree that greater trade links and investment between our two great countries can only improve jobs and prosperity for all our communities?
As the hon. Lady will understand, the vaccine roll-out is key. I was delighted to have my third jab this morning, and I would urge all colleagues to make the case for the vaccine roll-out, which is important for everyone but particularly for those with protected characteristics and those of us who are in the 1% who were shielded throughout the pandemic.
The outbreak of covid-19 posed a risk to all workers, but especially to those with particular disabilities and those who are immunocompromised. The UK Government’s national disability strategy could have made progress in supporting those workers by introducing statutory timescales on reasonable adjustments for employers, but it did not. What priority on the strategy is the Minister communicating to his colleagues in the Department for Work and Pensions and the Department for Business, Energy and Industrial Strategy? Will representations be made to add timescales for statutory reasonable adjustments?
The Government are working on a number of issues, but the hon. Lady will be aware of the Access to Work programme, which has introduced a more flexible working offer to support disabled people to move into and retain employment, including with homeworking support and mental health support. Of course, the kickstart scheme also has more than £2 billion of funding.
Baroness Lawrence’s report, “An Avoidable Crisis”, found that the Government’s failure to ensure workplaces are covid secure had a disproportionate impact on black, Asian and ethnic minority workers. They are more likely to be trapped in low-paid, precarious work, more likely to be overlooked in decisions on workplace protections and more likely to be struggling to self-isolate due to the risk of financial loss. Why are the Government still refusing to require employers to report occupational covid infections and to publish their risk assessments to keep these workers safe?
I am sure the hon. Lady will meet the relevant Ministers, but she will be aware of the disability strategy and the Access to Work programme that we have introduced, which has a more flexible working offer for disabled people with the chance for homeworking support and mental health and wellbeing support. There are also 20 black, Asian and minority ethnic mentors working across the country, from Birmingham to Brent and from Glasgow to Manchester, to ensure there is true access.
I thank the Minister, and I hope he will at least attempt to answer my second question. People with protected characteristics have taken a disproportionate hit to their workplace income during the pandemic. Ethnicity pay reporting is a vital tool to address that. Three years have passed since the McGregor-Smith report recommended it, yet two days ago a Minister said that the Government still need to work out even what it makes sense to report on. Why are the incomes of black, Asian and ethnic minority people of apparently so little interest to this Government?
I would make two points. First, the Minister for Equalities, my hon. Friend the Member for Saffron Walden (Kemi Badenoch), has reminded me that the Government will be responding to the matter this autumn. Secondly, I was shielded myself. I had my third vaccine this morning. We need to make the case that everybody needs to go out and get their third vaccine or their booster straightaway.
Being online is a critical part of a politician’s work, yet in the past two weeks we have seen such an appalling level of abuse targeted at women and people of race that a Conservative Member has come off social media and an Opposition Member has been unable to go to their own party conference. Will the Minister please set out what we can do to get online companies to take more care on the level of abuse and harassment they tackle online?
I can, Mr Speaker. This is a very serious matter and it does touch upon the point raised. The hon. Member for Canterbury (Rosie Duffield) and many others deserve the full protection of the police and so many others, in our workplace, out of our workplace, on an ongoing basis. We stand with all of them, regardless of party.
Following the 2008 crash, pregnant women and new mothers were made redundant in their thousands, unfairly selected because they were mothers, in what has been described as “straight up discrimination on an industrial scale”. The Taylor review and the UK Government research both confirmed that such discrimination still exists. So as the furlough scheme ends, pregnant women and new mothers need immediate action on this. Will the Minister press his colleagues to bring forward the much-delayed employment Bill and take immediate action to tackle pregnancy and maternity discrimination?
I refer the hon. Lady to the answer given by the Minister for Care, who represents the Department of Health and Social Care. I also respectfully invite the hon. Lady to meet Ministers from the Department for Business, Energy and Industrial Strategy specifically to raise the employment status of the women she identifies.
I was very sorry to learn of the injuries sustained by Thomas, and it is right that this matter is raised by my hon. Friend. I can assure him and the House that equality applies to all aspects of justice—it always has and it always will.
The Government are doing huge amounts to tackle the gender pensions gap. Automatic enrolment is transforming the situation. Women used to be at 38%; they are now at more than 80% of savings on an ongoing basis.

Commons ChamberThe Government are committed to supporting disabled people affected by the covid-19 outbreak, including those who claim legacy benefits. We have delivered an unprecedented package of support, injecting billions into the welfare system, and we continue to monitor the impact on disabled people while ensuring that they are able to access the support that they need.
The Minister claims that legacy payments were not increased because disabled people have not faced additional costs during the pandemic, but the Disability Benefits Consortium found that 82% of disabled people have had to spend more money than they normally would during the pandemic. So will he set out for the House what evidence he is basing his assumptions on, because disabled people really do deserve better from this Government?
I will get the Minister for Disabled People, Health and Work to write to the hon. Gentleman, but he will be aware that we spend £57 billion on benefits to support disabled people and people with health conditions. At the same time, we have reformed employment and support allowance in the light of covid and brought in supportive changes to statutory sick pay, local housing allowance and the Access to Work programme. We continue to support the disabled into work.
The Government are committed to supporting people from all backgrounds to move into work. Clearly, £2 billion has been spent on kickstart. There are 13,000 extra job coaches, and the job entry targeted support scheme is also being rolled out. For black, Asian and minority ethnic claimants specifically, we are taking action in 20 local authority areas with high populations of ethnic minority people.
With the Office for National Statistics finding that in coronavirus, black and minority ethnic people are less likely to be in management positions, more likely to be unemployed and more likely to earn less, confirming the Government’s own McGregor [Inaudible.] report, when will the Government implement its 26 recommendations?
I am happy to write to the hon. Lady through the Department when she gives me a more detailed version. I can just answer that we have 500 kickstart jobs per day, and from 20 locations—from Bradford to Barnet, Glasgow to Leicester, and Manchester to her own Ealing community—jobcentres are specifically helping BAME people.
Disabled people account for two thirds of deaths from covid, and recent research by the BBC showed that 78% of disabled people said that their mental health had got worse during the pandemic and 72% said that their disability had deteriorated. This Government’s failure to comply with their public sector equality duty and undertake equality impact assessments has cost disabled lives. Does the Minister acknowledge the extent of those failures? When will her Government finally bring forward the delayed national strategy for disabled people, and will they finally treat disabled people with dignity and respect and tackle those fatal inequalities?
I will get the Disability Minister, my hon. Friend the Member for North Swindon (Justin Tomlinson), to write to the hon. Lady with a specific answer to her specific questions, but I can assure her that yes, when the consultation is responded to, it will be in full detail and will address the points that she raised.
A third of people who use social care are working-aged disabled adults, and the Equalities and Human Rights Commission recently recommended that the Government enshrine in law article 19 of the UN convention on the rights of people with disabilities, to support them to live independently. It has now been over 700 days since the Prime Minister stood on the steps of Downing Street and promised that he would fix social care, yet there are still no plans, so what steps is the Minister taking with her colleagues to guarantee that the long-overdue plans for social care will adequately support disabled people to live independently, as recommended by the EHRC?
As I believe the hon. Lady is aware, that is a work in progress.
I wholeheartedly reject the comment by the hon. Gentleman. The state pension has gone up dramatically under the triple lock—by £2,000 since 2010 —by the coalition and Conservative Governments. We have a system that is taking forward real change and making a real difference to state pensioners.

Commons ChamberOver the past year, there have been 2,500 more Disability Confident employers, a much more flexible system and greater extended support through Access to Work going forward.
According to the Business Disability Forum, 11% of employers furloughed a disabled employee at the beginning of the pandemic after failing to provide reasonable adjustments. Disabled people have already been disproportionately impacted by the pandemic, but it is clear that disabled workers are continuing to be forced out of employment through a lack of access to reasonable adjustments. Will the Government introduce mandatory timescales for employer-implementation of reasonable adjustments and end the Access to Work payment cap to prevent the disability employment gap from widening further?
As I outlined earlier, there are greater numbers of Disability Confident employers and Access to Work has been adapted during covid to help the disabled, with greater online assistance, extended timeframes, flexibility, mental health support and much, much more, about which I will get the Minister for Disabled People, Health and Work, my hon. Friend the Member for North Swindon (Justin Tomlinson), to write in specific detail to the hon. Lady.
There has been an 800% increase in Disability Confident employers in the Durham-Tees Valley area. The newly re-elected Conservative Tees Valley Mayor, Ben Houchen, and our new Hartlepool MP are utterly committed to ensuring that more disabled people get access to work and into work.

My hon. Friend anticipates things that I was going to say, but yes, absolutely. The Atlantic gateway is one of those vital, iconic and important infrastructure schemes in the north-west that we want to support. I know all too well the hard work that he is putting into Daresbury and into life sciences. A clear strategy is emerging and we need to make sure that we fulfil its potential.
The Prime Minister also highlighted the cultural and sporting strengths in the region.
I should like to spend a little bit of time on how we transfer power to our great cities and how to ensure we link that with the counties around them. Of course, the north of England led from the front during the industrial revolution. The ambition of the northern powerhouse is to ensure that the north leads the post-industrial—what we might even call the re-industrial—21st century, too. We have the support in the north. People from different political parties and others such as the chief executive of Manchester city council, Sir Howard Bernstein, talk about how the north should become the
“destination of choice for investors”.
There is no question about that, but I believe it should be a destination of choice for career seekers, hard-working families, tourists, for audiences, students, and many more. In this region we need to get support behind what I call the four e’s of economic success—entrepreneurs, employers, exporters and, of course, employees—and help more people trying to take that first step in any of those areas.
My hon. Friend will know, of course, that the north-east is leading the way, with the fastest rate of growth of private sector business in the autumn quarter. On supporting the four e’s, does he agree that it is key that the Government, local authorities and the local enterprise partnerships ensure that broadband access, which we all need so much for our businesses, is made available to all parts of the country as quickly as possible?
Absolutely. Superfast broadband is vital, particularly in places such as Hexham, with its rural communities, but it is just as vital in some more remote communities in Macclesfield and the Peak district. I am thinking of Rainow, Wincle and Wildboarclough; if they are going to survive and thrive, they need to have access to superfast broadband.
The other thing that we need to do to support businesses is ensure that they have information about the support that is available. Too often, speaking to the Federation of Small Businesses and small businesses in Macclesfield and in the north-west, I hear that they find it difficult to work out how to get access, whether to employment allowance or export finance or training and apprenticeships. We have to do everything we can to ensure that we communicate well and get the word out: that is partly our job as Members of Parliament, too. Having served on the FSB’s recent productivity inquiry, it is clear to me that it wants better communication.
On strategic priorities, I believe, like many of my colleagues here, that life sciences and transport infrastructure are vital and that the transfer of power away from Whitehall is critical. A growing consensus is emerging on that. Whether I speak to the North West Business Leadership Team or the local enterprise partnerships—the Cheshire and Warrington enterprise partnership is doing a good job—there is support for that approach on strategic priorities.
On life sciences, in early 2013, the prospects for Cheshire East’s Alderley Park site were not good. AstraZeneca had made a decision to relocate—some colleagues will remember this only too well—its research and development staff to Cambridge. Those were concerning times, but now, a year and a half later, we have seen more than 300 jobs brought to the site. There is a new business owner, Manchester Science Partnerships, and a healthy pipeline of businesses wanting to locate there. That success could not have been achieved without close collaboration between Cheshire East council, Manchester city council—they are councils not of similar political views, but of common economic interests, coming together for the local good—and the university of Manchester. It is a powerful case study of how collaborative partnerships can work for the economic interests of local citizens, about which the Minister is absolutely passionate.
On the back of that partnership, we secured a £20 million investment from the growth deal to help further strengthen life sciences in the area, which is a real boost. Success breeds success. We are seeing that sense of partnership and wider collaboration growing. There are imaginative and innovative plans.

At the outset of this process, Lord Smith set out a number of guiding principles underpinning cross-party talks. They included the principle that the proposals should strengthen Scottish devolution and the Scottish Parliament within the United Kingdom, and that they should not cause detriment to the UK as a whole or to any of its constituent parts.
My constituents campaigned very strongly so that we remained “better together”, and whether that related to farmers, business, trade or joint air passenger duty, it continues. Does the Minister welcome the borderlands initiative between local authorities on either side of the border?
I very much welcome the borderlands initiative, which is an excellent example of cross-border working. Councils are working together across the Scottish and English borders to maximise economic and cultural opportunities.

Commons ChamberI prosecuted nine murder trials and all manner of other things in my previous career, so I can endorse the fact that there will be a huge time gap in these matters. If we adopted the proposal made by my hon. Friend the Member for Richmond Park (Zac Goldsmith), the Member involved would simply be hounded out.
I am grateful to my hon. Friend, who has such expertise, for endorsing that point.
It goes even further. Often we are talking about offences that are not indictable. They are what are regarded as offences in the mind of the electorate. They may be genuine or they may not be genuine, but if they are genuine and bear upon conduct in this House and are, on the face of it, a breach of our code of conduct, they should be considered by due process. We are trying to make the process in this House as fair as possible.
I have heard Members, including my right hon. Friend the Member for Haltemprice and Howden, be very critical of the processes relating to past decisions of the Standards and Privileges Committee. Let us be clear: we have made changes in this Parliament to standards and privileges. We now have a Standards Committee that examines matters not solely at the behest of MPs who are members of the Committee but has three lay members. We should consider this Bill alongside, and I hope with the benefit of, the review that will be conducted by the Standards Committee and its lay members. I am sure that in Committee the Chair of the Standards Committee will be able to add further to that.
When I was Leader of the House I made it clear to the Standards Committee that I saw these two things happening to some extent side by side, because the second trigger in this Bill depends upon the credibility and authority of the Standards Committee and the recommendations it makes. We can improve that. I think it will require more lay members and I think it will require a veto whereby a recommendation from the Standards Committee may not be made without the support of its lay members.
For reasons not least of parliamentary privilege we cannot give lay members a vote. However, as Leader of the House I said—I would be grateful if my right hon. Friend the Deputy Leader of the House confirmed this—that if there was a recommendation arising from a vote in the Committee on Standards relating to the conduct of a Member that did not have the support of the lay members, when the House came to consider that recommendation, I would see it as my responsibility, as I hope that my successors would, to put alongside any motion that was presented by the Chair of the Committee an amendment that would reflect the view of the majority of the lay members of the Committee. Therefore, while it would remain true that the membership of the House as a whole was responsible constitutionally for the regulation of the conduct of Members of this House and for a decision to suspend or expel a Member, it would be transparent whether the House was acting directly in accordance with the majority view of lay members. It would of course be acting with the benefit of the advice of the Parliamentary Commissioner for Standards.
