Commons ChamberI was delighted to attend the Council of Nations and Regions, held in a Labour constituency in Edinburgh. I can assure my hon. Friend that our manifesto said “no return to austerity”, and that is what we are determined to deliver.
The trade union Unite has issued a joint letter from political leaders across the United Kingdom’s nations and regions opposing Labour’s cut to the winter fuel payment. That letter has been signed by every party at Stormont and by parties in Wales, and the Scottish Conservative leader Russell Findlay also signed it. Was the winter fuel payment even discussed at the Council of Nations and Regions?
I thought that, with a full House, the shadow Secretary of State would have taken the opportunity to apologise for his Government not only crashing the economy, but leaving a £22 billion black hole. That is something this Government are determined to clean up. [Interruption.]
Order. We have not even got to the Budget yet, Mr Bowie, and you are already excited. Come on, Secretary of State.
I hope that, in a later question, the shadow Secretary of State will apologise at the Dispatch Box to the country for crashing the economy, and to pensioners for what has happened to them as a result.
Elgin is certainly not the final frontier, so I would be very happy to visit. The Minister for Science recently visited the UK Space Agency’s new office in Edinburgh, and during that visit, he echoed my sentiments about the importance of Scotland’s space sector. The Minister for Data Protection and Telecoms has recently met Orbex as well, and I will remain in close contact with my ministerial colleagues to ensure that we back the sector. I am very happy to visit when ministerial time allows.
As the Secretary of State knows, I recently had the opportunity to visit California with the Scottish Affairs Committee to look at how that state has created an environment that encourages new space projects. In Scotland, we have a unique opportunity, not least because of developments in Glasgow, but also because the University of Edinburgh is already well respected and part of the programmes at Stanford, New York University, Columbia and NASA. What will the Government do to encourage the creation of that sort of environment in Scotland, and will the University of Edinburgh, given its reputation, be central to that?
I am surprised that the hon. Gentleman was keen to ask a question, given that he did not apply for one in the shuffle—nor did any other SNP Member. It is also surprising that he, with all his experience in the House, wants to spend his time in this new Parliament defending the previous Tory Government’s reckless gambles with the economy.
Order. I do not know whether the Chair of the Select Committee is standing or not. Do you want to come in on this question?
Yes, thank you, Mr Speaker. Does my right hon. Friend the Secretary of State agree that the Drumchapel levelling-up fund bid and the project that would follow from that would be a good way to promote the economic and social growth of the area?
The best way to keep the United Kingdom together is to make sure that this is a successful UK Labour Government, and that is what we are determined to do. May I point the hon. Gentleman to the row in front of him? There are nine SNP MPs left, and we have 37 Scottish Labour MPs. That is how we protect the Union.
The Secretary of State said at the weekend that the Labour Budget
“will herald an era of growth for Scotland”,
but what is going to grow? Is it the tax burden on hard-working Scots, the number of pensioners choosing between heating and eating because they have not got their winter fuel payments, or the number of Labour broken promises? Or will we get all three this afternoon?
Scotland is rightly proud of its six world heritage sites. As the hon. Gentleman will appreciate, responsibility for planning decisions for large-scale energy projects in Scotland rests with Scottish Government Ministers. The UK Government work closely with the Scottish Government to deliver for Scotland, while respecting devolution. I meet regularly with my Scottish Government counterparts on these issues.
I thank—[Interruption.] I thank the Secretary of State for his reply. In any discussions he has, will he take account of the fact that I have written to UNESCO about the potential for a huge offshore wind farm very close to the Giant’s Causeway and the UNESCO world heritage site there? The Communities Minister in Northern Ireland has also met UNESCO. Will the Secretary of State make representations to ensure that all considerations are taken account of, so that people know the problems that may compromise that world heritage site?

I am really sorry to hear of the difficulties facing Mitsubishi Electric’s workforce, and of the uncertainty those workers face during this difficult time. I pay tribute to my hon. Friend for his efforts to support the workers in his constituency, and we have talked about this issue already. I will commit as a matter of priority to a meeting with the company and its workforce in the coming weeks.
I agree with the right hon. Gentleman and congratulate him on his role when he was in the Scotland Office. We hope to emulate much of the work that he did. I have met the European Marine Energy Centre and those involved with tidal resources in his constituency. This is critically important to our net zero ambitions and in getting to clean power by 2030. I am due to meet them when I visit his constituency in the coming weeks, and I will make sure that this is top of the agenda.
I congratulate the Secretary of State and welcome him to his place. I associate myself with his earlier remarks, particularly about Scotland’s Olympians and Paralympians. I was delighted to hear the recognition in his first answer of the role that our universities will play in a new industrial strategy, which is going to be vital in Scotland, particularly in the light of the recent admissions about the mess that the Scottish National party has made of our economy in Scotland. That is why I was baffled to see the UK Government cutting £800 million from a supercomputer project at the University of Edinburgh that has the potential to support research on drug discovery, climate change and advanced engineering. What discussions did the Secretary of State have with the Chancellor of the Exchequer about the impact of that?
My hon. Friend is right; the Scottish Fiscal Commission did say that. While this new Government are cleaning up the mess of the previous Conservative Government, the SNP seems to be cleaning up its own mess. In 2023, Audit Scotland said:
“The Scottish Government’s projections suggest that it cannot afford to pay for public services in their current form.”
As we have heard, the IFS said this morning that SNP decisions have reduced the tax take rather than increase it. This is about treating taxpayers’ money with respect and being honest about the tough choices we face. An honest assessment of the SNP Government’s Budget is that these problems have been stored up for years. Tough decisions have been kicked into the long grass, and money has been spent recklessly. It is a problem of the SNP’s own making, and the Scottish people will suffer as the SNP tries to clear it up.
I, too, start by congratulating both Ministers on their appointment to the Scotland Office. I loved my time at the Scotland Office, and I know they will be very well supported by the Department’s excellent team of officials, some of whom are in the Box today.
Labour plans to end the winter fuel payment, taking money away from elderly people who have worked all their days. Age Scotland has said:
“At minimum, a quarter of a million pensioners in Scotland on the lowest incomes or living in fuel poverty will no longer receive this vital financial support over the winter months, while hundreds of thousands more on modest incomes are going to struggle”.
Labour has cut the winter fuel payment across the UK, and the SNP is doing Labour’s dirty work in Scotland. What does the Minister have to say to the 250,000 elderly Scots who are in poverty and struggling with the decisions of Labour and the SNP?
May I welcome the hon. Gentleman to his place and congratulate him on winning his seat? The Foreign Secretary is sitting two seats along from me, and I am sure that he will have heard what the hon. Gentleman said. I am sure that the issue is a concern to everyone in the House, and we will make sure that a written response is given to the hon. Gentleman as soon as possible.
The Rosebank oilfield will provide more than £6 billion of investment in UK-based businesses. The Jackdaw oilfield will cater for the energy needs of 1.4 million UK households. This Labour Government are jeopardising all that investment, energy and jobs by dropping the UK Government’s opposition to the judicial review, which aims to block these vital energy projects. Can the Secretary of State seriously tell the 90,000 people whose jobs rely on oil and gas in Scotland that the future of this crucial industry is secure under Labour, when it is his Government’s policy to oppose all new developments?

Commons ChamberRegardless of what the Chancellor announces today, we are in the highest tax-raising Parliament in history, which is a consequence of the Minister’s Government’s failure over 14 years. Ordinary hard-working Scots did not cause this economic crisis—the Government did—but they are being made to pay for it. There have been 25 Tory tax rises since the last election, and the average family is much worse off as a result. Does the Minister agree with the Institute for Fiscal Studies that even after today’s Budget the overall tax burden on working people will still reach record levels?

Since the Government have been in power, working people have paid on average 10p on the pound more in tax. The supposed party of low tax has created the highest tax burden on working people in 70 years, making this the biggest tax-raising Parliament since records began. In Scotland, the SNP has looked at that tax burden and said, “Hold my beer,” as everyone earning more than £28,000 pays even more tax than they would in England. What impact does the Minister think that historically high tax burden has on the Scottish economy?

Commons ChamberLet me take this opportunity to congratulate my hon. Friend the Member for Rutherglen and Hamilton West (Michael Shanks) not only on his vast—and fast—promotion to the shadow Front Bench but on the 20.4% swing from the SNP that brought him the by-election victory.
The announcement of the closure of the refinery at Grangemouth is a hammer blow. Too many communities are still living with the devastation of being left behind after coalmine closures in the 1980s. That must not be allowed to happen again. Grangemouth’s owner is buying football clubs and investing in plants elsewhere, while the workers lose out. The Prime Minister has decided that a culture war on the environment trumps getting the UK into the global green energy race by backing Labour’s green energy superpower plans. The devolution settlement demands that both Governments work together, but they certainly do not. What discussions is the Secretary of State having with the Scottish Government to protect jobs at Grangemouth? What impact will the closure have on the Acorn carbon capture and storage project?

I take this opportunity to thank my hon. Friend the Member for Blaydon (Liz Twist), who was in the shadow Scotland team but has moved on to do new things after the reshuffle, and to welcome to the Scotland team my hon. Friend the Member for Keir Hardie’s old seat, Merthyr Tydfil and Rhymney (Gerald Jones). He is very welcome.
Last week, it was revealed that the former Prime Minister, the right hon. Member for South West Norfolk (Elizabeth Truss), had secured a book deal. Her book is titled “Ten Years to Save the West”, but it might have been better focusing on the 44 days it took her and her Government, with the support of the Scottish Secretary, to crush the economy. Does the Minister accept that Scots will be paying the price for years to come for the Tories’ kamikaze handling of the economy?

Nearly five months ago, the Secretary of State promised to arrange a meeting for David Williamson, a Scottish terminal cancer patient, but neither his Department nor the Secretary of State for Health and Social Care has been able to do so. I wonder whether that could be sorted out as soon as possible.
Millions of people across the country are facing spiralling mortgage rates and rents. Statistics released by Citizens Advice Scotland this week show that the number of Scottish mortgage holders searching for advice on repossession is up by 341%. Does the Minister agree with the insightful advice from the Prime Minister that worried mortgage payers hit by a Tory mortgage premium should just “hold their nerve”?

Commons ChamberWith the energy crisis, the importance of developing Scotland’s renewable energy sector has never been higher. The UK Government have no energy strategy—indeed, it is a sticking-plaster approach to the energy crisis, all paid for by the taxpayer, of course. In the 16 years of the Scottish Government, they have regularly launched glossy policy documents on renewables but have never delivered, especially on jobs. A scathing report from the Scottish Trades Union Congress said of the Scottish Government that “with energy bills soaring, climate targets missed and job promises broken, more targets without the detail of how they will be realised is unacceptable.” Does the Minister agree that only Labour has the solution to this crisis, creating high-quality, well-paid renewable jobs so that bills can be lowered, energy can be secured, and Britain can be an energy superpower?

May I seek your guidance on whether the Standing Order No. 24 debate should be postponed until the statement has been published and we have had time to digest the reasons?

Commons ChamberLast week, analysis of average wages in Scotland showed that they are almost £800 lower in real terms than when this Government came to power 13 years ago. In my constituency, they are £6,000 lower. That is the result of 13 years of Tory and SNP incompetence and not growing the economy. Does the Minister agree that after 13 miserable years of Tory wage stagnation, and with inflation now soaring into double digits, the cost of living crisis for families in Scotland is made in Downing Street?

They crashed the British economy on the back of handing out tax cuts to the richest. The economic crisis was created around the Cabinet table in Downing Street by the people the Secretary of State sits beside, and it will be paid for by working Scots. What price does the Secretary of State think Scottish public services and Scottish working people should pay for his Government crashing the economy?

In the latest poll in Scotland, the Prime Minister has a net approval rating of minus 71. Included in that negative figure of course are the Scottish Conservative leader and every Conservative MSP and Scottish MP —except for the Secretary of State. So does the Minister think that the threat to the Union posed by the Prime Minister clinging to his job is a price worth paying?

Commons ChamberLet me first join the Secretary of State in wishing Rangers football club all the very best in Seville tonight—although I wish them no luck whatsoever for the Scottish cup final on Saturday, when they will play the famous Heart of Midlothian FC.
The Cabinet was asked for ideas on how to deal with the cost of living crisis. So far, we have had “Take on more hours”, “Get a better job”, “MOT your car every two years”, “Buy supermarket branded food”, and even “Learn to cook”, but all that the Chancellor has delivered is “Give taxpayers a loan of their own money to pay their bills.” Although oil and gas company profits are more than the combined increase in everyone’s energy bills, the Government are rejecting Labour’s plan to give all households up to £600 off their energy bills with a one-off windfall tax on those profits. Can the Minister tell us what the Scotland Office team’s contribution has been to these ideas, and which of those ludicrous ideas he favours the most?

Holyrood unanimously approved a legislative consent motion for the Economic Crime (Transparency and Enforcement) Bill, which included an amendment from my Labour colleague Michael Marra urging the UK Government to remove a provision that would require ownership of land only from 2014 to be registered in Scotland registered, when the requirement is from 2004 in England. So if someone has laundered Putin’s dirty money in Scotland before 2014, they are in the clear. For example, Perthshire’s Aberuchill castle was bought by the Russian steel magnate Vladimir Lisin for over £5 million in 2005. He has been on the Treasury’s watchlist since 2008, but he is not covered. Vladimir Romanov, who bought Heart of Midlothian football club along with swathes of central Edinburgh, is allegedly hiding in Moscow under the protection of Putin. He would not be covered either, but both of them would be covered in England. Does the Secretary of State think that is right? What is he doing to implement the LCM amendment to sort this smugglers’ cove in Scotland?

Commons ChamberA proper plan for jobs would have Scottish renewables at its heart. There are four simple steps that the Minister could take today to unleash that proper plan’s potential: first, persuade the Treasury to create a pot dedicated to tidal energy in the fourth contracts for difference auction; secondly, instruct Ofgem to reform transmission charges to stop disadvantaging Scotland; thirdly, fund energy interconnectors from the island generators to the mainland; and fourthly, back the Acorn carbon capture and storage project. Those Government decisions would not only transform the UK energy sector, but create a Scottish jobs legacy from COP26. Will the Minister demand that his Cabinet colleagues act now to create a proper jobs plan for Scotland?

Let me go back to what we could be debating today. We could have debated the dreadful picture that everyone will have seen on social media from George Square in Glasgow last month, where 220 people were queuing up in sub-zero temperatures in the snow to get food from the soup kitchen. A photo says a thousand words, and those words were that both the UK and Scottish Governments are failing the people of Scotland who need their Governments the most. But, no, we are not debating that.
We could have debated universal credit and the £20 uplift becoming permanent, extending it to legacy benefits, removing the rape clause and helping those most in need.

I am sure that the Secretary of State would like to join me—I am sure he accidentally omitted it—in congratulating Anas Sarwar on becoming leader of the Scottish Labour party, the very first ethnic minority leader of any UK political party. I am sure that his positivity and optimism will transform Scotland when compared with what we have at the moment.
Business covid support in Scotland has been sporadic at best, and I hope that the Government will tell us how we will get a full transparent audit from the Scottish Government, following the Audit Scotland report last week that estimated that £2.7 billion was unspent, not including the £1.2 billion from last week’s Budget. Every penny needs to be spent now.
This Government talk a lot, as we have heard already, about a post-covid levelling-up green agenda, yet they are pursuing a policy in offshore renewables that benefits its business solely in the south-east of England. The Government’s fourth contracts for difference auction at the end of this year actively disadvantages viable Scottish offshore renewable projects, as the Department for Business, Energy and Industrial Strategy includes out-of-date and expensive transmission charges in auction bids. What is the Secretary of State doing to ensure that the Government ditch this unfair renewables policy that advantages south-east England at the expense and detriment of perfectly viable offshore renewables projects off our Scottish coasts?

I join the Secretary of State in recognising that it is the 11th day of the 11th month, lest we forget those who gave their lives so that we could live freely today. We will always remember them.
I am disappointed that the Secretary of State did not congratulate President-elect Joe Biden on his wonderful election in America. Given that in a recent poll 75% of Scots said that they would vote for Joe Biden, they have eventually got the Government they would have voted for.
The announcement this week of a potential covid vaccine is incredibly positive. While it certainly does not mean, of course, that we have reached the end of this crisis, it does perhaps signal some hope for the public. If the vaccine is approved, the country will face an unprecedented logistical challenge. If mass vaccination is to be done successfully, we will need all levels of government working together. However, a poll just yesterday found that two thirds of Scots were dissatisfied that the Scottish and UK Governments do not work together and a majority wanted closer co-operation. So can the Minister inform the House: what work are the UK and Scottish Governments undertaking together to build an infrastructure that will be able to distribute and administer any future vaccines to everyone?

Commons ChamberFirst, I congratulate the hon. Gentleman and his partner on the birth of their baby daughter, Zola, which is why he is currently on paternity leave.
I hope that I face even questions such as that from the hon. Gentleman for some time to come, because he is honourable, which is a lot more than can be said for many in his party—the hard left of his party—who have sought to smear and undermine him in recent days. In answer to his question, we absolutely do want a deal. We are in serious negotiations again this week because we want to get a deal, and that is our intention, but the withdrawal agreement was written on the basis that subsequent agreements could be reached through the Joint Committee, and that Joint Committee process is ongoing and we are committed to it. None the less, in the event that it cannot deal with any adverse implications for the Good Friday agreement, it is important that we have a position that creates a safety net to uphold our commitments to the members of Northern Ireland.
I am very grateful to the Secretary of State for his kind words about Zola, and if his Government could legislate for a minimum of six hours’ sleep for new parents, I certainly would be the first person in the Aye Lobby to support them.
The Secretary of State’s Conservative colleague and prominent constitutional expert, Adam Tomkins MSP, his own—now resigned—most senior Government lawyer and many on his own Back Benches disagree with him. He must surely realise that the UK Government’s recklessness only benefits those who want to break up the UK and the consequences of breaking up the UK would be dire for all of our constituents. As has already been mentioned, the Scottish Government’s own figures last week showed that the UK dividend to Scotland is an extra £15 billion a year—the entire budget of the Scottish NHS. Does the Secretary of State agree with me that the focus of both the Scottish and UK Governments must be to protect public health, invest in our economy, and secure jobs and not to continue with this endless paralysing constitutional division?

The Secretary of State will be aware of the February outbreak of covid-19 at an international Nike conference in central Edinburgh. In a catastrophic error of judgment, the Scottish Government decided that the Scottish public would not be informed, despite that being contrary to Scottish public health legislation. The public could have helped with the tracing and used their own common sense, as the Prime Minister has said, to make choices about attending large events and gatherings. A BBC documentary reported that a lockdown then could have saved 2,000 Scottish lives. Will the Secretary of State tell the House whether the UK Government were informed; why the public were not told, given the subsequent disinfecting and closure of Nike outlets all over the UK; and how many UK lives could have been saved as a result?

A constitutional convention would deal with all these issues, alongside devolving £30 billion to the English regions, reforming the House of Lords and turning it into a regional senate, and further devolution for Wales.
These are important debates. We should have more Government time in which to explore these issues properly, but it is clear that the devolution vow and promise made to Scotland will be carried through—separately from all these other issues about English votes and devolution elsewhere in the United Kingdom. This is a view for the whole of the UK and we should do it on that—

It is worth pondering the question of the compatibility of these provisions with the European convention on human rights. A vast number of organisations, including the well-respected organisation Liberty, have raised that issue. Liberty believes that part 3 should be removed in its entirety, and I could not agree more. It believes the proposals breach article 11 on freedom of assembly and association, which takes us back to the intervention of my hon. Friend the Member for Denton and Reddish (Andrew Gwynne) who was worried about the impact of this part of the Bill on trade union members, and article 8. For many individuals, membership of a trade union is a deeply private choice.

We know the origins of the code came from the Competition Commission report in 2008; we have already discussed the excessive risks to suppliers, particularly overseas ones. The practices behind that would have had the potential to harm those producers overseas who are the most vulnerable and to be an obstacle to progress on the pay and conditions of, and innovation by, farmers and farm workers in developing countries. UK shoppers rightly enjoy the widest range of choice, via large retailers. The outstanding quality of produce cannot be in doubt, but the Bill has the opportunity to ensure that there is protection for all territories and to make a large contribution to the development of other countries. Amendment 30 asks for the code to be extended to other territories and asks the adjudicator to look at this matter when making recommendations to the OFT.
The subsidiaries issue is also worth exploring, as it shows clearly that the large retailers have different arrangements in place. That has to be taken into account, which is what the amendment seeks to achieve. It would be good to get clarity from the Minister on what the process would be if difficulties were identified with regard to the code in these subsidiaries or other territories. The relationship of the code in the complex matrix of buying and production is from the large retailer to the immediate supplier. As the Bill stands, that means that the large retailer is able to set up subsidiaries to buy apples from X Ltd rather than directly from the supplier.
Amendment 34 stands in my name and that of my hon. Friend the Member for Ogmore (Huw Irranca-Davies), and it goes to the heart of some of the main issues that have been discussed in the House over the past few months. Our amendment calls on the Government to ensure that the GSCOP, which the adjudicator referees, covers the issue of commercial pressures that can be put on suppliers and that drive down quality and safety, creating possible food scandals, such as the recent revelations around horsemeat in beef products.
The amendment would explicitly enable the adjudicator to include in its annual report details of any incidents where it had become aware that commercial pressure had been applied to suppliers to drive down costs, standards and health and safety, resulting in a drop in food standards or authenticity. To answer some of the criticisms that will probably come from the hon. Member for Shipley and his like, I should say that the amendment is directly related to clause 14 and the annual report to the OFT, not necessarily in the sense of the issues arising where someone takes a case to the adjudicator to deal with in terms of the code.
Amendment 35 would require the adjudicator to send its annual report to the Food Standards Agency. That would create an important link between the adjudicator and the FSA in terms of some of the issues related to the horsemeat scandal that we have seen in recent weeks. As has been reported, the UK’s National Beef Association has blamed what it called the “bullying culture” that retail buyers have used for decades for the presence of horsemeat in beef products. Its national director, Chris Mallon, has said the public and retailers were paying the price for
“short-sighted, price-led purchasing tactics”.
He said that buyers had
“adopted a bullying culture aimed exclusively at securing as much farm food as possible, for as little cost as possible, and the result is tortured supply chains that add so much unnecessary cost that short cuts on quality and traceability, and even cheating by some suppliers, was inevitable.”
That quote shows how important it might be to include the amendment in the Bill.
Consumers must have confidence that the food they buy is correctly labelled, legal and safe, but over recent weeks that confidence has been hit hard. Many of the problems in this particular scandal have been outright criminal, and, of course, the criminal courts will deal with those, but Ministers have been slow to act, as has been shown in our debates in this House. The Food Safety Authority of Ireland has been ahead of the UK every step of the way. By having an annual reporting requirement on food safety and hygiene through the adjudicator, some of the issues that have been raised eloquently by the national director of the UK NBA could be dealt with.
The amendment has another link with the Food Standards Agency, as its budget has been cut from £143 million to £132 million. Although we should not get into a debate today about budgets of particular Government agencies or Departments, it would be an important step to say that the adjudicator, in its report to the OFT, could refer some of these cases. That might help to soften the blow caused by the reduction in resources.

Commons ChamberDoes my hon. Friend share my concerns about the head of the Scottish civil service? It has been accused in the past by many people of being native and refusing to speak truth to power. Is it not a concern that, when it comes to the referendum, it will not have the courage to speak up against the First Minister who controls all?
Order. We are in danger. We are debating the section 30 order, rather than the referendum. A lot of Members want to speak, so I do not want to tempt Members on to another subject.
I will take your guidance, Mr Deputy Speaker. My hon. Friend has his remarks on the record. That issue will be a concern to many Members of this House and to the people of Scotland.
I was going through issues on which I have concerns about the section 30 order, and what the SNP Government might do with it. I was talking about the First Minister taking credit for falling unemployment, but blaming everyone else when it goes up. We have had the arc of prosperity with Ireland and Iceland, until they went bust; then it was Norway, and now it is back to Iceland again. We have been told that Scots should not have taken part in Team GB, but the First Minister has taken credit for the gold medals—indeed, some SNP Members in this House play in the UK parliamentary football team. The issues are there for people to see.
We have seen the SNP Government espouse a nuclear-free Clyde, while changing their 60-year opposition to NATO. They want a nuclear-free Scotland, but it is okay for a US submarine to sail into Faslane and launch a nuclear weapon from Scottish shores. That is a ludicrous position which is yet another fudge on the Scottish people. They are changing their own rules to suit themselves, and that is why they might change the rules of the section 30 order to suit the referendum. Mr Deputy Speaker, I sense that I may be ruled out of order shortly, so I will say merely that the list is endless, and move on.
To emphasise what the Scottish Affairs Committee has said, the Scottish Government cannot be both player and referee with regard to section 30. The Electoral Commission has a vital role as an independent overseer of the process that includes critical aspects of funding and, most importantly, the wording of the question. The commission sent an updated briefing to hon. Members, and the first thing it says about the section 30 order is that the commission will have responsibility at the referendum for assessing the intelligibility of the proposed question. That is a critical part of its involvement, and this is where my discomfort lies.
The Minister deserves credit, along with the Secretary of State, but he was questioned in the House more than a dozen times during the debate on the Edinburgh agreement about what mechanics would be used if the Scottish Government ignored the commission’s recommendations, and all he could say was that he was confident that the Scottish Government would do the right thing and that the Scottish people would judge their actions. The SNP’s track record on straight answers about Scotland’s future shows that it has form in this area, and it would be wrong not to put on record that that is a real concern. The commission has been involved in every election in recent history. Its involvement in the AV referendum resulted in the question being changed on several occasions until it and the Government were satisfied that it was fair. No Government have ever overruled the commission, and the First Minister should not be the first to do so. This decision is the most important that Scotland has faced for 300 years, and that makes the role of the commission integral to the entire referendum process.
The commission’s role is also integral to campaign funding. The order does not give any details about funding, so it will be dictated by the memorandum of agreement between both Governments signed as part of the Edinburgh agreement. The commission will make recommendations after a consultation, but the SNP has already indicated that it would overrule the commission on several points, including in respect of much lower limits for businesses and unions to campaign, as my hon. Friend the Member for Glasgow Central (Anas Sarwar), the deputy leader of the Scottish Labour party, indicated. Those limits are much lower than those recommended for the AV and Welsh referendums in respect of the umbrella campaigning groups and, as he also said—this point stuck in my head—even lower than for local government elections. Those of us who have helped run those elections know how low those limits are for getting information out to electors and voters, who deserve to have the information in front of them so that they can make an informed decision. The people of Scotland deserve as much information as possible in order for them to decide whether Scotland is better together or separate from the rest of the UK.
Then, there is the question itself. The SNP has been challenged time and time again to say whether it would abide by the commission’s recommendations on the question, but it has refused to commit to answering. The hon. Member for Moray (Angus Robertson), the leader of the SNP in the House, was questioned four times during his contribution, and all he could say was that the Scottish Parliament would have regard to the recommendations. Any SNP Member could intervene now and say, “Yes, it’s a matter for the Scottish Parliament, but the SNP and the Yes Scotland campaign will abide by the recommendations, whatever they are, of the commission.” The fact that they have not done that sends out a very strong message that our concerns about the question, with regards to the section 30 order, are not just valid but very real.
It is critical that the commission’s recommendations be respected, otherwise the Scottish people will not get the fair and transparent referendum that they ought to have. The section 30 order passes the power to the Scottish Parliament, and I am proud that the party with a track record of devolution will be wholeheartedly supporting it. We will continue to scrutinise the process both in this place and in Holyrood to ensure that the decision is decisive, legal and fair.

Does she agree that that probably explains how the Scottish National party ended up voting on the Health and Social Care Bill—because of the interlinked nature of the NHS between Scotland and the rest of the UK?

I have allowed some latitude, but I have to watch that we do not stray too far away from the amendment. I understand that the provisions affect Scotland and that hon. Members want to open up the debate, but we must try to stick to the amendments.

A former Chancellor of the Exchequer, Mr Hugh Dalton, resigned in 1947 for leaking part of his Budget to a journalist when on the way into the Chamber to deliver it. Given that we have heard nothing in the Chancellor’s statement today that had not already been trailed in the media on Monday, Tuesday and this morning, please will you, Mr Deputy Speaker, use the good offices of the Speaker to make sure that senior members of this Government make important statements to the House before going to the media?
The principle is clear, and it will have been heard by those on the Treasury Bench. We must now move on.

Commons ChamberHad the Government allocated enough time for us to debate this topic this evening, the hon. Gentleman would have heard a cross-section of views not only from Wales, Devon, Cornwall and colleagues from Northern Ireland and Scotland, but from the whole country, expressing concern about communities being split up and boundaries being drawn on the basis of strange anomalies or purely in accordance with mathematics. In fact, the Government are in danger of ensuring that people such as those mentioned by colleagues are under-represented in the House, not over-represented.
