My Lords, as set out in the Government’s Covid-19 recovery strategy, we have advised people who are clinically extremely vulnerable to follow shielding guidance by staying at home at all times and avoiding all non-essential face-to-face contact until the end of June. However, we will continue to review that and will issue further guidance about shielding and social distancing as new evidence emerges. I assure the noble Lord that the Government continue to seek advice from a wide range of policy experts on this matter.

My Lords, the number who are shielding and are therefore in rigid lockdown appears to have risen to 2.5 million, and many, by the end of June, will have been doing so for 14 weeks. Surely there will need to be urgent advice to them on mental and physical health and also on employment rights, as well as resourcing of local government and the voluntary sector, even though many of us feel that it is not sustainable to keep that number of people in rigid lockdown for very much longer.

My Lords, the noble Lord makes an important point about mental health. The Government have stressed at all times that there needs to be a balance in these matters. However, the scientific advice is clear that the groups concerned are at the greatest danger of suffering severely from this virus. That has been the reason for the advice, which, as I said, is under continual review.

My Lords, as we have just heard, 2.5 million people have been advised to stay at home, often on the basis of just a text message or a letter from the NHS. Perhaps I may press my noble friend a little further on the details of the review: how it will be conducted; whether there are any timelines; and when the up to 2.5 million people might be given further guidance about whether they really need to continue shielding in the way that they are.

My Lords, will the Government ensure that the steps to adjust restrictions for those isolating clearly allow for healthy individuals over 70 to be trusted to use their judgment regarding their personal safety and that of the wider community?

My Lords, the guidance that is in place is advisory. We have no plans to make it mandatory for people aged 70 and over to follow advice beyond what is mandatory for all of us. However, I repeat that the scientific and medical evidence is clear that those in older age groups are in graver danger from the serious consequences of this virus.

My Lords, does the Minister understand that the shielded group and their household members are facing an impossible choice between returning to work and breaching public health advice, and endangering their own health? Therefore, will the Government review the restrictions in place for those shielding from Covid-19, and will they consider establishing a right for this group to be furloughed in protecting themselves from the coronavirus, which requires them not to work?

My Lords, I do not accept the premise of the noble Lord’s question. The advice to the shielding group is clear and is based on scientific advice that it is wise for them to avoid face-to-face contact and follow the shielding guidance. That advice is still in place and will remain so until the guidance is revised. I have told the House that the guidance is under review and that we hope that we will be able to say more during June.

My Lords, a society is judged by how it treats its most vulnerable. The real policy and practice experts are the NGOs and major specialist charities. Will the Minister tell the House which of those organisations have been consulted on the impact of the restrictions on vulnerable adults and what guidance is in place to help them see family and loved ones?

My Lords, in order to promote more faith, not fear, what more will the Government do to show that the four nations of the United Kingdom can have a more co-ordinated approach to Covid-19?

My Lords, the Government work closely with the devolved Administrations and hope that the whole country will move forward together. That has been the advice, and the aspiration has been repeatedly expressed by the Government. Obviously, in moving forward, we have to review factors across the nation. But Covid does not discriminate by place of residence. The impact is on the factors that we have described so far in this conversation.

My Lords, many people in this country who have been sick over recent weeks believe that they have had Covid-19, even though they were not tested while they were ill. They now believe that they are immune and some are, therefore, not staying as alert as the Government would like. Given that the latest surveys suggest that only 5% to 10% of people have actually had the virus, most of these people will have had one of the other bugs circulating at the time. This is putting at risk the Government’s plans to bring R down. When will the reliable antibody test, announced last week, be widely available, to allow the public to know if they have had coronavirus or not, and therefore act responsibly as restrictions are lifted?

My Lords, again I agree with the sentiments expressed by my noble friend. The Government are proceeding as fast, and in the best way, as they can on every front, including this one. As is often said at Downing Street press conferences, the science around immunity is, as yet, unclear—and, by definition, it will remain so, as this is a new virus. As the noble Baroness said, people should follow the guidance that is in place.

My Lords, some disabled people seem to have received a second letter asking them to shield for another 12 weeks. It appears that the government website is not necessarily clear on the correct procedure for vulnerable and/or disabled people. Will Her Majesty’s Government provide greater clarity on shielding and, at the very least, ensure that the website is up to date for this group of people?

I will look into the matter raised by the noble Baroness. Whenever somebody receives a shielding letter, the advice will be to observe the guidance in it. However, I repeat that that advice is currently under review. That will be the case for all those who have received a letter. If necessary, it will be updated, or reaffirmed, by the end of June.

My Lords, the Conservatives seem a bit confused about older people. They raised the pension age to 67 and Iain Duncan Smith now wants it raised to 70. Meanwhile, Ministers tell those aged 70 plus not to go out, even those who are fit and healthy, who look after grandchildren, who work and have an active life. At the same time, they leave the generations that fought the war under- resourced and underprotected against Covid-19. Will the Minister please listen to relevant representatives—not just scientists—of older people, both those in need of care and those whose health and independence give them much to contribute? Will he undertake that those talks will take place?

My Lords, the Government are talking with people, scientists and organisations right along the front. The noble Baroness injected a political note into this question, which I thought unfortunate. All parties should share in the aspiration to protect those she rightly describes as the most precious in our community, who have served the country longest. That is why the advice is in place. As I have said, that advice will be reviewed and further announcements made before the end of June.

My Lords, the Government’s guidance on social distancing for vulnerable people—the tier below those who have to shield—was published on 16 March and withdrawn on 1 May. Pregnant women and those over 70 without underlying conditions now have no guidance at all. Which group should they regard themselves as part of?

My Lords, in moving this Motion, I declare an interest as a member of the Society of Genealogists. In fact, last night I looked at the 1891 census online, which illustrates that a population census has been taken across the UK every 10 years since 1801, with the sole exception of 1941.

Subject to the approval of the House, this draft Order in Council provides for the 22nd census of England and Wales to take place on Sunday 21 March 2021. The draft order was laid before both Houses on 2 March 2020, under the provisions of the Census Act 1920. It prescribes the date of the census, the people to be counted, the people responsible for making a census return, and the information to be given in those census returns.

Under the terms of the Census Act 1920, delivery of the census in England and Wales is the statutory responsibility of the UK Statistics Authority and its executive arm, the Office for National Statistics. The draft order gives effect to the independent recommendations of the Office for National Statistics set out in the December 2018 White Paper, Help Shape Our Future: The 2021 Census of Population and Housing in England and Wales.

The ONS’s recommendations for the 2021 census have been informed by an extensive programme of consultation, research and engagement. Comparability of data between censuses is important, so the majority of questions will remain the same as in 2011. New questions or response options are included only after research and consultation that provide compelling evidence for their inclusion. For 2021 there will be new questions on past service in the Armed Forces and new voluntary questions on sexual orientation and gender identity for those aged 16 and over.

The Census (Return Particulars and Removal of Penalties) Act 2019 enables two of the new questions, those on sexual orientation and gender identity, to be asked on a voluntary basis. As confirmed during the debates on that Act, the census questionnaires will clearly indicate which questions are voluntary, and the form of those questionnaires—both the online and paper versions—will be prescribed by law in the census regulations that will be made following this order. I express my thanks to noble Lords for their support for the Act during the debates in this House, and particularly to my noble friend Lord Young of Cookham for steering the legislation through the House.

This draft order is subject to a composite procedure. Under the terms of the Census Act 1920 the order is principally subject to the draft negative procedure, but some questions—those printed in italics in the draft order—may be included in the census only if they are approved by affirmative resolutions of both Houses. Unusually, questions subject to the affirmative procedure may also be amended by Parliament, if agreed to by both Houses. I express my thanks to the Secondary Legislation Scrutiny Committee, whose 9th Report of this Session set out clearly the special procedure for this statutory instrument.

Noble Lords will be aware that this draft order was debated last week in the House of Commons, and that the Motion was approved by that House without amendment. There was considerable focus in the Commons debate on tick-box response options that have not been recommended by the ONS; notably, Cornish national identity and Sikh ethnicity. As my honourable friend the Minister of State, Chloe Smith, was clear to emphasise, it is absolutely no reflection of the ONS’s or the Government’s recognition of or respect for any ethnicity, religion or national identity that it does not have a specific tick-box response option on the census. It is simply not possible to include a tick box on the census for every group that has asked for one: to do this would make the census forms, whether paper or online, long, cumbersome and confusing.

For the ethnicity question alone the ONS received 55 requests for new tick boxes and, as I am sure noble Lords will understand, it is necessary to prioritise what is included in the questionnaire. This the ONS has done through an extensive programme of consultation, research, engagement, testing and assessment. People will be able to record their ethnic group, religion and national identity however they wish in the 2021 census, including as Cornish, using the write-in boxes. An online search-as-you-type functionality will assist people in answering these and other census questions. There will continue to be a specific Sikh response option in the census question on religion. Despite being a voluntary question, the response rate on the religion question is very high—over 92%—and the ONS is confident that religion data from the census will provide high-quality data for public bodies to inform service provision and equalities monitoring.

The 2021 census aims to be the most inclusive ever. For the first time it will be predominantly online, making it easier for people to take part when and how they want. Paper questionnaires will, however, be available for those who need or prefer to complete the census this way. There will be a wide range of help, including a contact centre offering support through various channels and services to assist people with hearing or speaking impediments. There will also be a large-print version of the paper form, language support and translated materials, and information in Braille or British Sign Language for those who may not otherwise be able to complete the census. There will be national and local promotional campaigns to encourage and help people to complete the census. This will include work with community groups, by field staff on the doorstep, and through face-to-face assistance at completion events that will be arranged, where possible, in local settings such as libraries.

To be successful in its aims, the census relies on the willing support and participation of the public, on whose behalf the information is collected. Key to this is trust that people’s personal data will not be disclosed in ways they do not wish it to be, whether deliberately or accidentally. It is made clear to respondents that their data is protected in law, and leaflets to accompany the census form sets this out in more detail.

The ONS is working with the National Cyber Security Centre to ensure that processes and systems for collecting or handling census data are secure, and appropriate measures are in place to prevent unauthorised access. Census security will adhere to, and where possible exceed, the minimum set of cybersecurity standards. The information collected during the census is held by the ONS for 100 years, and by law data can be used only by the ONS for statistical and research purposes. Personal census data cannot be used to make decisions about individuals.

It is clear from useful and informed discussions with noble Lords ahead of today’s debate that there is a great deal of interest not just in the next census but in the future of the census, and in particular the question of whether this will be the last traditional census. The census is the most important source of statistics about the population available to us. It is currently the only data collection that provides accurate and reliable information about populations at a local area level. It provides the underlying information needed to inform a wide range of policy decisions, and it is used extensively to plan services and allocate funds to local areas, but it is only carried out every 10 years. Decision makers need information more frequently, to understand the changing nature of the population. The 2021 census is part of a £900 million programme of work by the ONS to transform the system of population and social statistics, making greater use of data already held by government for administrative purposes. This wider work programme will also inform whether, beyond 2021, the traditional census will remain the most appropriate way of collecting vital population data, or whether census statistics could be replicated in other, quicker ways using administrative data.

That is a debate for the future. In 2023, the National Statistician will make a recommendation on the future of the whole system of population and social statistics, including the census, based on the progress of this programme. I am sure that the House will take a great interest in that when the time comes.

The draft order before us today is concerned with the census in England and Wales. Noble Lords will be aware that the Scottish Parliament and Northern Ireland Assembly have approved census orders for Scotland and Northern Ireland respectively. Together, these three statutory instruments allow a census to take place across the UK at the same time next March. This draft order is the first of two statutory instruments needed for the census to take place. Subject to the approval of the Order in Council, the Government will bring forward census regulations for England. These will set out the final questions and govern much of the operation of the census. Separate regulations for the census in Wales will be laid before the Welsh Parliament by the Welsh Government. The regulations will describe the content and functionality of the online forms for this first predominantly online census and will also contain copies of the corresponding paper questionnaires.

The census is unique in the insights it provides into our nation and the data it provides to support policy-making. The proposals for the 2021 census set out in this draft order will provide the data needed to inform policy and planning decisions across our national and local public services and enable national and local government, community groups, charities and businesses to better serve communities and individuals across the country. My Lords, it is customary to say that we have had a wide-ranging and excellent debate, and of course that is true, particularly on this occasion. It has been a fascinating debate to me personally and I am grateful to many noble Lords, starting with the noble Lord, Lord Clark, and others, including my noble friend Lord Young of Cookham and the Baroness, Lady Hayter of Kentish Town, for saying how important the institution of the census is over the long term in enabling an understanding of the familial and social development of communities and of the whole country. Both in the past and now in the present, it is an enormously valuable historical resource. As an historian, I freely acknowledge that. Indeed, I am sure that when the 1921 census comes to be published, one of the interesting things to look at will be the impact on the nation of the Spanish flu epidemic as well as that of the Great War between 1911 and 1921.

I said that in 2023 the National Statistician will publish recommendations based on views about the future of the census in light of the experience of the census that we are about to conduct, and indeed past experience along with other data and relevant material. Your Lordships will have ample opportunity, as will the other place, to consider those recommendations. The Government of the day will give them careful consideration, and I am sure will reflect on the unique nature and value of the census over time. As I said in my opening remarks, that really is a debate for another day, although I believe that all those who read this debate will note the sentiments that have been expressed by many who have spoken.

Questions were asked by the noble Lord, Lord Mann, and others about whether any contingency consideration is being given to the current pandemic that we are dealing with. Census day—21 March 2021, obviously—is still nearly a year away, and currently the Office for National Statistics is working to deliver the census as planned. Like any other part of the Government, the ONS will be guided by the scientific evidence and the evolving advice from medical experts. At the same time, therefore, we are considering the contingencies that may be needed if measures to contain the spread of Covid-19 remain in place or indeed again become necessary in the run-up to census day itself. That is a matter of which those who are involved are aware. The situation, as noble Lords will know, is evolving and we will be guided by medical advice as it emerges.

The noble Lord, Lord Wallace, made important remarks about data more generally, many of which I agreed with. He asked specifically about the national data strategy, the potential involvement of Parliament and parliamentarians in the evolution of that strategy, and the debate generally about the use of data—something that is obviously extraordinarily important to being an effective modern economy and society in the future. The position, as the noble Lord recognised, is that because of the coronavirus pandemic progress has been delayed, but I assure him that it remains the Government’s intention to publish the national data strategy in 2020. I will endeavour to keep him and other noble Lords informed as to progress.

The question of identity has come up in this House and in the other place. I underline the abounding respect and admiration that this Government—and, indeed, I believe the whole nation—have for the Sikh people and the Sikh religion, faith and values. The Sikh community is an embedded and enormously valued part of the British nation. Even today, we have heard conflicting views on whether the ONS has made the right call in respect of the questions in the census. The noble Baroness, Lady Hayter, and others spoke strongly in one direction, while the noble Lord, Lord Singh of Wimbledon, and indeed the noble and right reverend Lord, Lord Harries of Pentregarth, spoke in the opposite direction.

The ONS has to reach a balance, and the tick-box options set out in the order have been informed by its very extensive programme of research, consultation and engagement, which has gone on for over three years. As I said in my opening statement, more than 55 requests were made for tick boxes under the ethnic group question alone. There is already a Sikh tick box for the religion question, and the ONS concluded that the needs for data on Sikh communities can be met without the addition of a Sikh ethnic tick box.

The 2011 census and subsequent research show that the religion and ethnic group questions capture similar Sikh populations. The number of people using the write-in option, which will exist in this census, to record Sikh as their ethnic group has been referred to. In 2011 the ONS promoted the ability to use that write-in option, and 83,000 people used it to write in their ethnicity as Sikh—but 92% of those also identified their religion as Sikh, and more than 423,000 people in England and Wales identified their religion as Sikh in 2011.

Qualitative research that the ONS commissioned on the acceptability, clarity and quality of the tick boxes showed that the inclusion of a Sikh ethnic tick box without other religions also having an ethnic tick box or tick boxes was viewed as unacceptable, particularly among younger, second-generation participants. The ONS has offered to work with members of the Sikh population to encourage wider participation in the census and to raise awareness of the option of writing in their identity in the ethnic group question. I hope Members of the House will help the ONS in this effort.

A question was asked about the Welsh language; the noble Lord, Lord Wigley, and others referred to this. I understand the point he made that it is important for the Welsh Government to understand the extent of the Welsh language, not only in Wales but outside Wales. Obviously, the draft census order provides for a question on the Welsh language to be asked in Wales, but anyone in England who wishes to record their main language as Welsh in the 2021 census will be able to do so using, again, the write-in options in the language question. Testing by the ONS convinced it that the inclusion of that question generally might lead to confusion among the larger number of respondents about why they were being asked it. When it comes to conducting the census, I am sure that those in the ONS and working on its behalf will pay heed to the points made by the noble Lord, Lord Wigley, and others.

My noble friend Lady Anelay of St Johns and others raised Cornish identity. Again, the Government recognise the distinct culture and heritage of Cornwall. We understand how important that is to the people of Cornwall, who are rightly proud of their Cornish history. The reality is that everyone who wants to identify as Cornish in the census will be able to do so using the new search-as-you-type facility online or the write-in option. In its consultations informing the contents of the 2021 census, the ONS found that the need for data on Cornish populations is localised and—in the context of the many requests to have questions included in the census—not strong enough to justify the inclusion of a Cornish national identity box nationwide.

I assure noble Lords who have spoken—I myself have had representations from elected representatives in Cornwall—that the ONS is committed to working with Cornish MPs, Cornwall Council and others to meet their data needs through data gathered via the write-in option. It will promote this option in both national and local census campaigns. After this census, the ONS will for the first time produce an analytical report on the population who identify as Cornish and how their health, housing, work and education differ from those of people who do not identify as Cornish. I hope noble Lords will welcome that assurance.

The social condition of various parts of the population is extremely important and relates and translates across to the question asked by many noble Lords about accessibility and support, including for those who are homeless. The ONS will offer a range of support to help people who complete the census, whether online or on paper. As I said at the outset, paper forms will be available in large print. Language support will be provided for those who need it. There will also be an option to complete the questionnaire by telephone. I referred to the fact that additional help to fill in the census online or on paper will be available at community events in community centres, libraries and places of worship. I was grateful for the remarks of the noble and right reverend Lord, Lord Harries, on that.

In addition, the assisted digital service will be provided by the Good Things Foundation to provide support for those who are offline or need additional digital help. We are well aware of the importance of reaching those who are not digitally enabled; they are in fact, paradoxically, among the most important parts of the population which the ONS needs to reach in the census. It is a great responsibility to do that. That is why the ONS aims to recruit up to 40,000 field staff to support this kind of engagement. They will have a particular focus of resources on the known hard-to-count groups and areas. I assure the noble Baroness, Lady Whitaker, that, given the inclusion of the Roma question, there will be a great effort to reach all Traveller people. I will provide her with a written answer on the other question that she asked.

To return to the homeless, those who are homeless are particularly vulnerable and hard to reach. That is obvious. We have seen in the Covid crisis the Government’s efforts to reach that important and much underprivileged part of the population. In preparing for the census, the ONS is working to ensure that all those who are homeless, particularly those who are sleeping rough, have every opportunity to take part. Census forms will be available at day centres and night shelters over a series of days. The ONS is working closely with homelessness charities to ensure that there is help and support for those who are homeless to participate in the census.

As in 2011, special arrangements are being made to make sure that all those living in communal establishments are recorded in the census. My noble friend Lord Balfe referred to some of these, including those living in hospitals, residential care homes, student halls, prison establishments and military camps. This is an important duty laid on the ONS, and I am sure that it will rise to it.

My noble and learned friend Lord Mackay of Clashfern, the noble and learned Lord, Lord Judge, and my noble friend Lord Young of Cookham referred to the voluntary nature of questions on the census. I am grateful for the welcome that has been given again by noble Lords, the noble Lord, Lord Rennard, among them, for the inclusion of questions on sexual orientation and gender identity. These will be voluntary. I am very grateful for the discussions the Government have had with the noble and learned Lord, Lord Judge, and my noble and learned friend Lord Mackay of Clashfern, and for their advice to enable us to better underline the fact that these questions are voluntary.

I note what the noble and learned Lord, Lord Judge, said about the 2031 census. I am sure that, in that time, something will be done to improve any deficiencies in the drafting, but I repeat what I said in my opening remarks: the regulations that will come before the House and provide opportunity for further debate will prescribe the census form. They will make it absolutely clear that these questions are voluntary. I am grateful to noble Lords for raising that important point.

The noble Lord, Lord Young of Cookham, asked a number of questions, some of which I can answer and some of which I will have to respond to in due course. He asked what efforts have been made to test some of the provisions for the census. There has been a census rehearsal. It was held last autumn in four local authority areas: Carlisle, Ceredigion, Hackney and Tower Hamlets. These areas were chosen to reflect urban, rural and mixed areas with their varying internet coverage and places where there are Welsh speakers, students and residents from a variety of backgrounds and ethnicities. Although participation was obviously voluntary, the rehearsal was a large-scale test of the census operational systems and processes. They included the online questionnaire, the field force function, digital assistance and public contact centre. The rehearsal has provided valuable insight into how the questions have been answered, and how the help and guidance is used. As I said, it covered most of the questions and areas raised in this debate.

The ONS is planning to publish a report on the rehearsal later this summer. It will incorporate the lessons from that and from the other work it has been taking on to test the census questions in its report this summer. The household response in the 2019 rehearsal was similar to that in the 2009 rehearsal, although direct comparisons are not possible because they were held in different areas. The 2011 census went on to reach 94% of the population, so this gives some confidence that the Government and the ONS will be able to reach large numbers of people in the census.

As many noble Lords stressed throughout the debate, starting with the noble Baroness, Lady Kennedy, it is vital, of course, that the information gathered in the census is confidential. I can assure noble Lords that the highest priority is given to that. It is fundamental to trust in the 2021 census. There are strict legal safeguards: unlawful disclosure of confidential census data by the statistics authority and its employees, including the ONS, is a criminal offence with a sanction of up to two years in prison. The same applies to the Registrar-General in Scotland. We are consulting on cybersecurity, and the National Cyber Security Centre is being carefully and continually engaged in the process.

I thank all those who have contributed to the debate. It is essential that everyone is counted in the 2021 census to provide service providers and policymakers with the information they need to help target support and resources where they are most needed, and as efficiently and effectively as possible. I am very grateful to noble Lords for their contributions and I thank everyone who has taken part in the debate.

My Lords, I express my gratitude and admiration to my noble friend Lord Boswell, not only for his report but for his long service to his country and his very distinguished chairmanship of the EU Committee. I look forward to working closely with his successor, the noble Earl, Lord Kinnoull, who is already proving to be a doughty and statesmanlike leader in that role.

The report is crucially important, as is its title, Beyond Brexit: how to win friends and influence people. The noble Duke, the Duke of Montrose, reminded us from a past perspective of the importance of international friendship and co-operation—friendships and co-operation which can lie across, within and outside all sorts of international institutions. I simply disagree with those who say that the Government are isolationist and dogmatic—I heard those terms used in this debate among others; I shall not list them, but it is simply not a fair representation of the attitude of this Government or of the British people, who, I must remind this House, voted for a new relationship between this country and the European Union and, ipso facto, a new relationship between this country and the wider world. There were times in the debate when I felt like whistling or humming

“Lead, kindly light amid th’ encircling gloom”

because many of the speeches shared a tone of impossibilism and doubt that this country could succeed in its common objectives, which are to reach a friendly future relationship with our friends in the European Union.

The view of the Government is that there is ample time to strike a deal based on fair trade and friendly co-operation. As your Lordships know, we are looking for an agreement largely like those that the EU has agreed with others. There are plenty of precedents and texts around. We are familiar with each other’s systems and, with sufficient energy, there is plenty of time. Moreover, the EU agreed to this timeline when it agreed the political declaration last autumn. I submit that no one should cast doubt on it; we should be getting on with it.

Of course Covid, as a number of noble Lords have referred to, exists; it is a great tragedy and a great crisis. However, the Government have the bandwidth and the capacity to conduct negotiations within Europe and to deal with the Covid crisis, as my right honourable friend Mr Gove assured the EU Committee last week. Notwithstanding the succession of noble Lords who asked for an extension in the transition, the Government’s view remains that that would simply prolong the negotiations and business uncertainty and delay the moment of control of our borders. As my noble friend Lord Cavendish of Furness said, extending the transition would mean that we would have to make further payments into the EU budget. It would also keep us bound by EU legislation at a point when we need legislative and economic flexibility to manage the UK response to the Covid pandemic. Some would characterise that as an ideological statement; I would characterise it as a statement from a Government intent on doing what they have been asked to do by the British people and to do so amicably to reach agreement with the people who will always remain our European friends.

Some have said that a long time has elapsed since this report was published. I was reminded when the noble Earl, Lord Clancarty, was speaking of the old saying that there are decades when nothing happens and there are many weeks when decades happen. Sometimes in this House last year, it seemed that there were hours when weeks happened. New circumstances have arisen and we are now finally beyond Brexit, having left the EU in January, with a third round of the negotiations on our future relationship having started yesterday and with, I repeat, the transition period ending at the end of the year.

While the passage of time has meant that many areas raised in this report have been superseded, I agree with many noble Lords that that does not make this debate any less important or our aspiration for good relations across Europe and beyond any less vital. I hope to respond a little later to some of the specific points on our representation. I also acknowledge the important remarks of my noble friend Lord Howell of Guildford.

While much of the work of this House and the other place has lately been focused on what we were looking to achieve, this report and debate are about not losing sight of how we should achieve our objectives. I will try to address most of that in the rest of my remarks.

I will answer one or two specific points raised in the debate. We still believe that it will be possible to reach an understanding on financial services equivalence by June. On the question of refugee children, raised by the right reverend Prelate the Bishop of Durham—technology has let me down; I hope to be able to reassure him on that later in my response.

Many noble Lords asked about the work of the Withdrawal Agreement Joint Committee and the specialised committees. The Joint Committee met for the first time on 30 March via remote means and was co-chaired, as noble Lords know, by my right honourable friend the Chancellor of the Duchy of Lancaster and the European Commission vice-president, ‎Maroš Šefčovič. The UK and the EU updated the Joint Committee on progress to implement the withdrawal agreement, with particular focus on citizens’ rights—I agree with the noble Baroness, Lady Ludford, that they are important and I endorse what my right honourable friend said on that matter—and on the Ireland/Northern Ireland protocol, which I will come to in a moment.

The UK and the EU also agreed to start the work of the six specialised committees on citizens’ rights, other separation provisions, the protocol on Ireland/ Northern Ireland, the protocol relating to the sovereign base areas on Cyprus, the protocol on Gibraltar and financial provisions. The UK and EU co-chairs of the specialised committees have each now spoken informally. They are making plans for their respective specialised committees to meet as appropriate. Indeed, the Ireland/Northern Ireland Specialised Committee met on 30 April. UK and EU officials co-chaired the first meeting via video and the UK and EU co-chairs both welcomed the collaborative and constructive conversation.

The Government are determined to give Parliament appropriate opportunity for scrutiny of the Withdrawal Agreement Joint Committee, and we have committed to issuing Written Ministerial Statements before and after each meeting. The Government have always been clear—the noble Lord, Lord Wood, and the noble Baroness, Lady Hayter, referred to this—that Gibraltar is covered by our negotiations with the EU and we have committed to involve it fully. Decisions on representation at specialised committee meetings will be taken in accordance with the withdrawal agreement.

A number of noble Lords asked about work on the Northern Ireland protocol—if I listed the names on each occasion it would take time from this debate. However, the noble Lord, Lord Caine, introduced a parallel point, reminding us that our top priority in implementing the protocol should be to protect the Good Friday agreement and gains from the peace process, and to preserve Northern Ireland’s place in the United Kingdom. That is the central purpose of this Government in agreeing ways to carry this forward. The protocol puts legal obligations on both sides. We are committed to complying with ours, just as we expect the EU to comply with its.

I apologise to the noble Baroness, Lady Ritchie, for not replying on this in a previous debate, but I was asked about the presence of an EU Commission office in Belfast. There is no reason why the Commission should require a permanent presence in Belfast to monitor the implementation of the protocol, nor, with respect to the noble Lord, Lord Kerr of Kinlochard, any reason why that should cause distrust. This is not a requirement that was included in the protocol; it is an additional EU ask. Article 12 of the Northern Ireland protocol does not necessitate, or place any requirement on the UK to facilitate, such a presence. Our position remains that EU officials can exercise their rights under Article 12 of the protocol, without necessarily a permanent presence in Northern Ireland.

The protocol is a practical solution to prevent a hard border on the island of Ireland and makes clear—this is important—that Northern Ireland is, and will remain, part of the customs territory of the United Kingdom. The arrangements that we introduce will reflect this. As set out in the New Decade, New Approach deal, the Government are committed to legislate to guarantee unfettered access for Northern Ireland’s businesses to the whole of the UK internal market, and to ensure that this legislation is in force for January 2021. We want to work with Northern Ireland businesses, as many noble Lords have asked us to, to ensure that new administration procedures are streamlined and do not affect the flow of trade.

The protocol also ensures that the future arrangements for Northern Ireland will depend on the consent of those affected by them through a vote that can take place every four years. We will continue to take forward discussions on the implementation of the protocol in the joint committee and specialised committee, and to do so in good faith.

A number of noble Lords remarked on how we are engaging with the EU during the transition period. Since the UK has left the European Union, we are seeking to engage and co-operate with the EU through normal diplomatic channels. That is why the UK will not attend EU meetings, other than in exceptional circumstances. Our relationship with the EU and its member states will be conducted on the basis of normal diplomatic and international practice, as part of our wider agenda.

However, as was recognised by, I think, the noble Baroness, Lady Bowles, it is the fact that the United Kingdom Government are increasing the number of members of the UK Mission to the European Union, or UKMis—formerly known as UKRep, for those not up to date with the changes. That will continue to be our principal interface with EU institutions. As part of the strengthening of our diplomatic effort across Europe—I agree with the noble Lord, Lord Empey, on the importance of this—UKMis Brussels has grown from over 120 staff in 2016 to over 180 staff at the time of the UK’s exit from the EU. It has established a dedicated public diplomacy function to support the new ways of working, and has enhanced its communications team, which will play an important role in shaping the narrative around the UK’s activities and priorities within Europe. We set great store in the importance of maintaining good relations with our partners across Europe.

The noble Lords, Lord Foulkes and Lord McConnell, were among many who raised the question of the devolved Administrations. Of course, the UK Government are engaged with the devolved Administrations during the development of the approach to negotiations, through regular official meetings and bilateral discussions between the Paymaster General and her ministerial counterparts in the DAs. That has ensured that the UK Government have taken on board the views of the DAs, and that has been reflected in the published approach to negotiations. I reaffirm our commitment to working with them to deliver a future relationship with the EU that works for the whole UK. The UK Government are committed to this, and last week, on 6 May, the Paymaster General spoke to Ministers from the DAs to update them on negotiations and exchange views.

I follow my right honourable friend Michael Gove in responding to the important question raised by the noble Earl, Lord Kinnoull, and a number of other Peers about parliamentary engagement with the EU institutions post Brexit. It is clear that, understandably, many Members of your Lordships’ House are keen to maintain those links—important links between the Parliaments of member states. But I repeat the position, expressed by my right honourable friend when he spoke to your Lordships at the EU Committee, that it is not for the Government to tell Parliament how to maintain and develop these arrangements. I can assure the noble Earl that the Government are keenly supportive of such proposals and developments.

The noble Lords, Lord Bruce and Lord Broers, and others asked about participation in EU agencies. We will, of course, discuss with the EU how best to manage our friendly relations but any solution has to respect our red line of no commitments to follow EU law and no acceptance of the CJEU. That is fundamental and was put to the British people at the last election.

Unfortunately, there are relatively limited options for third-country membership of the EU bodies, but we have been clear that we will operate on the basis of existing precedents where they represent a real benefit to British people and industry and provide convincing value for money. I confirm that we are considering participation in Horizon and in a number of other bodies referred to in the debate. We are also, obviously, considering participation in Erasmus+.

My noble friend Lord Duncan of Springbank asked about climate change. We are already working closely with the EU on climate change and I see no reason why that should not continue. I also want to confirm that the UK will continue its participation in the emissions trading scheme during the transition period.

The technology now having worked, I can reply to the right reverend Prelate on refugee children. The UK continues to be fully committed to meeting our obligations under the Dublin regulation. We remain in close contact with member states, to keep abreast of updates and establish where transfers can take place as quickly and safely as possible in accordance with existing Covid-19 restrictions. I hope that is a reasonable response.

The noble Lord, Lord Moynihan, referred to the importance of sport. This is, of course, important in Europe, both within and outside the EU; one recognises that.

Time is unfortunately constrained. I agree with the feelings of a number of noble Lords who have spoken: it will be a good day when we can get back to challenge and response. But, despite my feeling sometimes that it was a little pessimistic, the debate has been good and instructive. It has demonstrated again the capacity of this House and its committees to look at our exit from the EU in the round and look towards our long-term relationship. We do not believe that our vision for the future is incompatible with having a close relationship with the EU. We continue to see the EU, and the EU nations, as our neighbours and our friends. We will continue to aspire to, and have, a relationship inspired by our shared history and values and, I hope, always informed by your Lordships’ House.

With respect and admiration for my noble friend the Minister, I ask: as this Question is about the future of this House, why is the Leader of the House not answering it? What have the Government done to rebut the Sunday Times report that Ministers are examining whether they could retire every Member of this House who is over the age of 65 and that we are all so old that there is no prospect of us doing our job? Will the Government name the Whitehall source responsible for this false and malicious briefing? If this is not known, will they invite the Cabinet Secretary to investigate and, if the source is identified by him, ensure that they are summarily dismissed?

My Lords, there are a number of questions there which I am sure have been noted. I am sorry if my noble friend thinks it is only the second division that has come out to answer the Question, but I think the second division is adequate to put paid to a third-rate story. There is no substance in it. It is not the intention of the Government to introduce such a policy.

In the light of that answer, would the Minister ask the Leader of the House, who is meant to represent the whole of the House of Lords, to put in her own words in the public domain, either through a statement or press release, the answer that has just been given, which is that there are no plans of this nature? Could the Minister give us that undertaking and say why on earth anyone in Whitehall is thinking about reform of this House at the moment, rather than the national emergency facing us?

My Lords, I have stated on the record the position of the Government—I am sure that any number of Ministers could do the same—and I have no doubt that the Leader of the House will be following our proceedings. The current total priority and focus of this Government is to deal with the Covid-19 emergency. I assure the noble Baroness that, were such an idea ever to be suggested, it would be given the very lowest priority.

My Lords, is it not obvious that somebody in No. 10 is playing party games with the constitutional role and responsibility of Members of your Lordships’ House, as set out in our Writ of Summons from Her Majesty the Queen? Following the answer that was given just now, can we be assured that the Leader of the House will start leading for the House and will stand up to No. 10? Will the Minister confirm that any changes of this sort will follow the normal process of scrutiny, debate and votes in your Lordships’ House?

My Lords, I certainly agree with the point on scrutiny. The Government have made it very clear that they do not consider piecemeal reform of this House to be sensible. However, I repeat that there is no substance in this story. I am not sure whether it was a case of the ill informed meeting the inventive or perhaps one or the other, but I repeat that it is not government policy.

My Lords, reducing the size of the House is obviously not a priority for the moment but it is something that we need to do. Will the Minister confirm that the Government will consider putting a cap on the size of the House, allowing its numbers to be reduced along the lines of the Burns report? However, as other noble Lords have said, the priority now is surely to enhance and increase both the scale and the effectiveness of the scrutiny that we as a House can bring to the conduct of the Government during the current crisis. Are there plans to expand the role and function of the House from their limited forms at the moment?

My Lords, I welcome scrutiny and think that it is vital for a democracy. Obviously, the arrangements made by the authorities of the House are beyond my remit; I am here to answer for the Government. The Government do not currently intend to put a cap on the size of the House; indeed, their position is that from time to time the House will need refreshing. That has always been the position; it has never been a static House.

My Lords, I speak as a Member who is still just in his 50s. Our House does indeed need to be kept fresh and current, so reform is necessary. However, does my noble friend agree that the expertise and knowledge brought to this House by my noble and learned friend Lord Mackay, or the mastery and love of democracy and its institutions of my noble friend Lord Cormack, to name but two examples, rather proves the point that the implementation of arbitrary criteria would be not only wrong but seriously detrimental to our deliberations?

My Lords, I understand what my noble friend is saying. For example, my noble and learned friend Lord Mackay of Clashfern makes an immense contribution, even though I think he only gives a year in age to Her Majesty the Queen. Anybody who had half a tin ear to the work of your Lordships’ House would understand the immense contribution made by older people in it. I submit that if an appointed House is not in good part a House of expertise and experience, it is nothing, but I repeat that the House needs to be refreshed from time to time.

My Lords, the story has all the hallmarks of a No. 10 briefing intended to stifle scrutiny by your Lordships’ House. If that is not the case, will the Government agree to strengthen scrutiny by this House, perhaps by agreeing to a daily statement by the relevant Minister following the Downing Street press conference, and allowing more time for debate and routine questioning of the Government? Surely the Minister accepts that transparency will strengthen public confidence in the Government and their handling of the present crisis.

My Lords, I agree that transparency is vital in public affairs. I am not responsible for usual channels. I would be a wealthy man if I had a pound for every unattributable briefing that was knocked down under the last Labour Government. I have repudiated this story and the alleged proposals on behalf of the Government in Parliament, and there it should rest.

It cannot really rest, of course, because this is only one of a series of unattributed weekend briefings from No. 10. Although the finger cannot be pointed definitely at someone, most of us have a pretty good idea where the briefings are coming from. Frankly, it is not acceptable; it should be stopped, and the Prime Minister should stop it. On refreshing the House, what the Minister said is of course true, but it is generally accepted that some 40 names are already waiting to be introduced to the House. That goes far beyond “refreshing”, and drives a horse and cart through the Burns proposals, which the House unanimously accepted.

My Lords, while I completely support reform of the House of Lords—indeed, I was enthusiastic about the last reform—I hope that when Ministers get round to considering this matter they will look at the need for a more balanced Chamber representing not only the protected characteristics but expertise beyond the current framework. The House does need refreshing from time to time; I support the Minister in that view.

While I welcome the brief and robust way in which the Minister has answered this Question, will he take a moment to put to bed a couple of other stories circulating in the news at the moment which are alleged to be future government policy and are causing worry particularly to our older people: first, that the triple lock on pensions is to go and, secondly, that 9 million people over 70 are to remain incarcerated after lockdown is eased? Does he agree that these stories have caused increased anxiety and entirely justifiable anger and outrage? Will he assure us that both stories are also fake news and that there is no reality in them now or in the future?

My Lords, again, I understand where the noble Baroness is coming from, but her questions go slightly wider than the Question before the House. On future arrangements on lockdown, the Government have promised further advice shortly. As noble Lords will know, the position is that everyone is being asked to stay at home at the moment however old they are, but I will not speculate here on what may be considered appropriate in the next phase.

My Lords, many noble Lords will be familiar with the purpose and provenance of this annual Motion and debate. Since 1999, in the days when we were members of the European Union, the Government were required to send an annual assessment of our economic and budgetary position to the European Union, following its consideration by Parliament. Known as the UK convergence programme, this is part of the stability and growth pact based in the Treaty on the Functioning of the European Union. It is also now important to reflect on and embrace the fact that the UK will be sending this economic assessment having left the European Union. This Government have honoured the promise we made to the British people in the 2019 general election and, after years of regrettable delay, we have delivered on the instruction that was given in the 2016 referendum.

The UK having left the European Union, some noble Lords may find it somewhat perplexing that I am bringing forward this Motion at all. However, as we are in the transition period, there is still a legal obligation under the terms of the withdrawal agreement to provide the European Commission with an update of the UK’s economic and budgetary position. However, the UK cannot be subject to any action or sanctions as a result of our participation, which will end once the transition period comes to an end. This is just one example of the kind of reporting back and accounting to the European Union that will become a thing of the past at the end of this year, when we are a fully independent and sovereign country.

I present this year’s assessment to the House today at an unprecedented and challenging moment for our country and people, and at a unique time in our history. The coronavirus pandemic is the biggest challenge we have faced in decades. For many, life as normal, and business as usual, is on hold. The sacrifices that the British people are making in observing social distancing measures are helping to protect the NHS and save lives, and we thank them all. However, there is clearly a financial and economic cost to bear. Our huge and unprecedented programme of support is therefore helping people and businesses around the country.

Having set out that context, I will now give a brief overview of the information we will provide in the assessment that makes up the UK’s convergence programme. This information is based on the Spring Budget report and the Office for Budget Responsibility’s most recent economic and fiscal outlook. It is this content, not the convergence programme itself, that I ask the House to take note of. Noble Lords should also note that this does not represent new information; rather, it captures the Government’s assessment of the UK’s medium-term economic and budgetary position, as we set out in the 2020 Spring Budget that the Chancellor of the Exchequer delivered almost seven weeks ago.

The Office for Budget Responsibility’s forecast confirmed that the Government delivered the Spring Budget within our fiscal rules. Since 2010, significant progress has been made to restore the public finances. By 2018-19, the deficit had been reduced by four-fifths—from 10.2% of GDP to 1.8%—and debt brought back under control. This careful management of the economy and public finances meant that the fundamentals of the United Kingdom economy going into the coronavirus pandemic were strong. This helped the Government to act in an unprecedented way, with measures to protect people’s jobs and incomes, to help businesses and to support the economy through this difficult period.

It is clear, however, that the impact on the economy as a result of coronavirus, and the Government’s unprecedented response to it, will lead to a significant increase in borrowing this year compared to the OBR’s forecast. Indeed, under the OBR’s coronavirus reference scenario, borrowing is expected to rise sharply this year, but fall back quickly in 2021-22 as temporary policy costs end and the economy recovers. While growth remained solid in 2019, as noble Lords would expect, growth in 2020 will be significantly below that of last year—although estimates are highly uncertain at this point. The consensus, both in government and among external economists, is that not taking the steps we have taken would have risked the impact of coronavirus leaving more permanent scars on our economy. As the OBR has said,

“the costs of inaction would certainly have been higher.”

In the Spring Budget, the Chancellor initiated the start of that unprecedented and wide-ranging economic response to the impact of coronavirus. The Budget itself made available £12 billion for temporary, timely and targeted measures to provide security and stability for people and businesses, which by itself represented a significant state intervention. That included, for example, a commitment to refund small businesses for two weeks of statutory sick pay, and waiving business rates for properties used for retail, leisure, hospitality and nurseries during the next financial year.

Since the Spring Budget and the accompanying OBR forecast, the UK, like many countries around the world, continues to face significant economic disruption. Noble Lords will know that in response, the Government have continued to build on the initial financial support package set out in the Spring Budget, for example through the Coronavirus Job Retention Scheme, the Self-employment Income Support Scheme and the Coronavirus Business Interruption Loan Scheme.

We are making great progress in getting much-needed support out to businesses to help manage their cash flows during this difficult time, with millions of pounds of loans and finance provided to hundreds of firms across the country. The Government are also deferring VAT payments for the next quarter, and UK VAT-registered businesses will not need to pay VAT alongside their normal VAT returns—an intervention by itself worth over £30 billion.

While the Spring Budget rightly focused on our immediate measures to respond to the coronavirus outbreak and support people and businesses in the short term, it also set out our medium and longer-term plans, which I will also briefly highlight. The Budget confirmed a significant funding package to deliver 50,000 more nurses, 6,000 more doctors and 6,000 more primary care professionals, and a change to NHS pension rules which means that NHS staff, including senior doctors, can work additional hours for the NHS without their annual allowance being reduced.

The Budget also included ambitious measures aimed at levelling up all regions of our country. For example, the Government will invest £500 billion in roads, railways, broadband, housing and research to level up opportunity across the whole of the United Kingdom. It set out a consultation on our new £3 billion national skills fund and a £1 billion investment to upgrade the further education college estate—measures designed to help young people get the skills they need for the high-paid, high-skilled jobs of the future. These are vital investments in our public services and our future that display the ambition of this Government and for a country free to forge its own path and shape our own destiny having left the European Union.

Now, the Government have clearly committed considerable resources to respond to the unprecedented coronavirus crisis. However, we have also committed to continuing negotiations on the future relationship with the European Union, which are being undertaken virtually. We look forward to negotiating constructively in the next round, which will begin on 11 May. Whatever the outcome of those negotiations—and we remain committed to a deal with a free trade agreement at its core—our position on extending the transition period is clear and unchanged. The transition period ends on 31 December this year, something enshrined in United Kingdom law.

I know some noble Lords are concerned about the impact of not extending the transition period. The fact is, extending the transition period would simply prolong the negotiations, bringing further uncertainty for businesses at a time when they need clarity. As the First Secretary of State said last week in the other place:

“Given the uncertainty and the problems and challenges coronavirus has highlighted for us and for our European friends ... we should focus on removing any additional uncertainty, do a deal by the end of the year and allow the UK and the European Union and all its member states to bounce back as we come through coronavirus.”—[Official Report, Commons, 29/4/20; cols. 317-18.]


An extension would also entail further payments into the EU budget and keep us bound by EU legislation at a time when we need full legislative and economic flexibility to manage the UK’s medium and longer-term response to the pandemic. We need to be able to design our own rules, in our best interests, to manage our response to coronavirus, including working closely with our European friends, without the constraints of following EU rules.

In the Spring Budget, as well as responding to the challenges posed by the coronavirus outbreak, the Government prepared this country for our longer-term recovery and prosperity. Having continued to improve the state of our public finances, we are well prepared to step up and provide unprecedented short-term and temporary financial support for people and businesses at this time of national emergency. As the Budget showed, we are also investing in our public services and infrastructure for the longer term, levelling up all regions of the UK, with the Budget setting out meaningful investment in our future productivity and our current public services, something that will be needed more than ever as we emerge from the coronavirus crisis.

Following this debate on the economic and budgetary assessment that forms the basis of the convergence programme, the Government will, for the last time, submit it to the Council of the European Union and the European Commission. I beg to move.

My Lords, it is customary to say that a debate has been very wide-ranging; this certainly has been that. One thing that has come out of this outstanding debate—many who spoke put forward very fruitful and interesting ideas—is the question of accountability. It was first raised by my noble friend Lady Noakes, but the noble Baroness, Lady Bennett, and my noble friends Lady McIntosh and Lord Trenchard all referred to the difficulties in conducting parliamentary business and scrutiny in the present circumstances. As I said earlier in response to another Question, it is not for me to manage the detail of the arrangements that are put in place by the House authorities and which are agreed through the usual channels. There is certainly no lack of willingness on the part of the Government or Ministers to face Parliament and answer to Parliament on such questions. As has come out forcefully in the debate, these are unique and exceptional circumstances, in which we are forced to operate remotely in this way.

Of course, I share the hope of all those who spoke that, in time, it will be possible to relax the constraints on the management of our business so that accountability will not only continue but be strengthened. I note that it is certainly not easy to respond to a detailed and complex debate from one’s back room with no access to the Box or information. I assure all noble Lords who have spoken that where I am unable to answer detailed questions in detail, we will seek to ensure that such answers are given.

There was a dichotomy between noble Lords on both sides of the argument, if there are two sides to the argument. Some were impatient that we were still having this debate, and some felt that it was a signal that we needed to maintain and continue our institutional links to the European Union in some way. That divide in and difference of opinion ran through the debate. We are obliged to have this debate and provide this information to the Commission under our treaty obligations. It is certainly not the United Kingdom’s position not to carry out the obligations into which it has entered.

It is true that, by the end of the year, we will be a fully independent country; this will happen regardless of what occurs in the negotiations ahead. It is not true that this in any sense reflects, as the noble Lord, Lord Liddle, said, a hatred of what the Prime Minister always rightly calls our European friends. We are, and always will be, a European nation and those nations always will be our friends. I repudiate the view that there is hatred towards any other country or people in the European Union. We are looking for a relationship that is grounded in precedent and respects the autonomy of decision-making on both sides. We have not asked for a special or bespoke deal.

Indeed, our proposals build on the EU’s original offer of a Canada-style deal and reflect the type of free trade agreement that should be entirely achievable this year between sovereign states. The precedents are based on previous deals that the EU has done. In no way is that vision incompatible with having a close relationship with the EU. We will continue to co-operate with the nations of the European Union, as we are doing on coronavirus, and with a wider family and comity of nations. As was referred to in the debate, only this week my right honourable friend the Prime Minister initiated international action in the face of the virus.

The progress of the negotiations was referred to by a number of noble Lords. We have had two full and constructive negotiating rounds, with a full range of discussions covering all the issues. We have made it clear that we are determined to regain our independence but that does not in any way reduce our commitment to high standards in all areas. I assure those noble Lords who referred to wishing to see a better world after we come out of this crisis—I share that aspiration—that our commitment is to high standards. No matter what happens, the United Kingdom will continue to champion high standards for products and in human rights, as well as for many other important principles.

However, we will not accept a relationship that restricts domestic democratic debate or enforces the supremacy of EU law—here I agree with the noble Baroness, Lady Deech, and my noble friends Lord Howard of Rising and Lady Noakes, who were among those who spoke on this.

There is promising convergence, and there is no reason why progress should not continue in the core areas. There is progress on a free trade agreement, for example on goods, services and trade, and also on related issues such as energy, transport and civil nuclear co-operation. However, as some noble Lords acknowledged, there are differences of principle in other areas. For example, we will, frankly, not make progress on the so-called level playing field and the governance provisions until the EU drops its insistence on imposing conditions on the UK which are not found in other trade agreements and which do not take account of the fact that we are an independent coastal state. We now need to move forward in a constructive fashion, and we look forward to negotiating constructively in the next round, which begins on 11 May.

A number of speakers touched on the question of extending the transition period. As I said in my opening speech, the Government’s policy on this remains unchanged—as a number of noble Lords asked that it should. Others asked that it should not, but it does remain unchanged. Our view is that extending the transition period would simply delay the moment at which we achieve what the British people asked for, namely economic and political independence of decision-making. It would prolong the negotiations and thereby also prolong uncertainty for businesses and citizens alike. As was pointed out in the debate, it would also mean making further payments into the EU budget.

The coronavirus crisis has demonstrated that nation states will take and use the freedoms afforded to them to make the best response to the conditions that appertain in their own nations at the right time and in the right way. That does not mean that international co-operation and exchange of opinion does not remain important.

The underlying theme of this debate has been that the coronavirus pandemic is the greatest challenge that we have faced in decades. It is certainly true that the changes that have come upon the Government—specifically, on the economy and the country—since the emergence of coronavirus have obviously meant a dramatic reappraisal and response to the conditions that were in place at the time of the first Spring Budget. I welcome the general support that there has been for the action that my right honourable friend the Chancellor of the Exchequer took in the early stages of this crisis.

The noble Baroness, Lady Kramer, made some good and reasonable points on the need to encourage innovation and support, and the importance of self-employed people. She also referred to perceived difficulties with the Coronavirus Business Interruption Loan Scheme. The House will have seen that the Chancellor of the Exchequer responded to that by introducing it for the smallest businesses. I agree with the noble Baroness and the noble Lord, Lord Birt, that the unique range, variety and difference of small businesses is something which is sometimes hard for us all to grasp. They are absolutely fundamental. My right honourable friend has responded with the bounce-back loan scheme which is already proving to be swifter and is responding very well to the demands of many small businesses. It is no source of apology or shame that, once an unprecedented measure is introduced—with the best of good will and with the aspiration that we will do whatever it takes to bring British business and the British people through this crisis—it is found in the course of events that improvements and modifications can be made to the scheme. The introduction of the bounce-back scheme is such a thing, and I can assure the House that the Chancellor and the Government will keep all eventualities under review as the crisis unfolds.

Engagement with business was referred to by a number of those who spoke. Of course, the Government are involved in intense discussion with business and the trade unions about the ongoing response to the coronavirus crisis. That will also be true, of course, in relation to the ending of the transition period at the end of the year. We recognise the challenges that businesses are facing in light of the Covid-19 pandemic, and we remain determined to stand behind them at all times throughout this critical period. We know and recognise that responding to the pandemic is the principal focus for many businesses right now, as it is for the Government, but we stand ready to engage with and support businesses on the required changes for the end of the transition period in the coming weeks and months.

Noble Lords—including the noble Lords, Lord Livermore and Lord Hain, and the noble Baroness, Lady Quin—asked about economic analysis. They rightly referred to many challenges facing the economy, and the fact that new assessments will need to be made in the weeks and months ahead. Indeed, that is why, in relation to European developments, we will in time want to stimulate and capture the widest possible range of analysis from economists, academics, businesses and civil society. As has been announced, we will in time be throwing open the question to the wider analytical community to help inform the Government and the country with the widest possible range of models, data and perspectives.

The noble Lord, Lord Tunnicliffe, who was kind enough to speak to me earlier, asked some specific questions about infrastructure, as did the noble Baroness, Lady Quin, and the noble Lord, Lord Purvis of Tweed. Capital and infrastructure investment is and remains vital. I referred in my opening speech to some of programmes that the noble Lord, Lord Tunnicliffe, referred to in his speech. The Government intend to set out further detail of our plans, as well as our longer-term ambitions, in the national infrastructure strategy and in the comprehensive spending review in due course, taking our response to Covid-19 into account.

I do not know whether this is a Gilbert and Sullivan debate—I am not sure whether I am Gilbert or Sullivan in this matter—but it is certainly taking place in exceptional, unprecedented and fast-moving circumstances in which, as a number of those who have spoken pointed out, many of the forecasts made before Covid was heard of vitally need to be reassessed. That is why it is difficult to give precise answers to a number of the points that have been raised, but, clearly, the Chancellor of the Exchequer is watching the situation and will come forward with proposals.

There are some difficulties with this virtual system, but I will deal with one or two detailed questions that were raised. On the fiscal rules, referred to by the noble Baroness, Lady Falkner, the Chancellor of the Exchequer will address that point in due course in the manner that I have described.

The noble Lord, Lord Shipley, and the noble Baroness, Lady Quin, referred to the north-east. The Government’s levelling-up proposals remain a core objective of the Boris Johnson Government and they will continue to dictate and guide policy, whatever the circumstances in the future.

The noble Lord, Lord Shipley, raised a couple of detailed points—or at least he commended some tax ideas, as did the noble Viscount, Lord Chandos. I cannot make promises or commit the Government to follow any of the proposals, but they will lie on the record and no doubt can be considered by those who follow our affairs.

As one speaker said—I think it was the noble Baroness, Lady Deech—stuff happens, and this is peculiarly unpleasant stuff. It has made the timing of this debate doubly odd. I am sure that my Treasury colleagues will not thank me for saying this, but I had great sympathy with the aspiration expressed in the debate that this great House, while it has no power in the matter of finance, should have the opportunity to debate from time to time economic forecasts and the economic position of this country. If this particular prop is disappearing into history, I am sure that it is something that the usual channels will consider in the months and years to come.

In March, the Chancellor delivered what was recognised by many at the time as a historic Budget. It responded to the unprecedented health and financial emergency that we face, but it also set out to reduce our budget, preserve fiscal flexibility and invest in Britain’s future. As we emerge out of the coronavirus crisis and, as the Prime Minister has said, we start to fire up the engines of our economy once again, our view is that the economy will come back stronger than ever.

With the transition period coming to an end on 31 December this year—whether we have a Canada-type deal or an Australia-type deal—we will aim to write a new chapter for the United Kingdom and, echoing what was said in the debate, I hope that we will be a country that is not only stronger but fairer, and being independent and sovereign will not stand against either of those objectives. That is the basis of the convergence programme that we will present to the European Union.

I am very grateful to those who have spoken in the debate and for the spirit in which they have done so. On this basis, I am pleased to commend the Motion to the House.

My Lords, with the leave of the House, I will now repeat a Statement made yesterday in the other place by my right honourable friend the Chancellor of the Duchy of Lancaster:

“With your permission, Mr Speaker, I would like to make a Statement on the work this Government have undertaken over recent weeks to support and steer our critical public services through the coronavirus pandemic. I would like, first, to thank all those on the front line of our public services for the spirit of selflessness and commitment to others that they have demonstrated in dealing with this pandemic—nurses, doctors, porters, cleaners, paramedics, pharmacists, care home staff, prison and police officers, teachers, social workers, those preparing and delivering food, collecting our refuse and administering the welfare system. They deserve our gratitude, they need our support and they are in all our minds. They are the very best of us.

I am sure that everyone in this House observed that one-minute silence at 11 o’clock, as we reflected on sacrifices being made by so many on our behalf. This pandemic has claimed more than 20,000 lives and left every community across the country grieving. Our thoughts, and prayers, are with all those who have suffered loss in the humble knowledge that every life is precious.

As the Prime Minister said on his welcome return to work yesterday, we are dealing with

“the biggest single challenge this country has faced since the war”.

Like him, I want to thank the British people for their forbearance and solidarity as we have all had to abide by the guidance on social distancing, which restricts cherished liberties but protects precious lives.

The challenges that the pandemic is presenting us with require an unprecedented response from the Government. For this reason, as the House will know, on 17 March we established four ministerial implementation groups to lead the Government’s response to the pandemic. The Health Secretary chairs one group, co-ordinating work on the NHS and social care. The Chancellor chairs the group considering how to support business and the economy, and the Foreign Secretary chairs the group co-ordinating our international response. I chair the general public sector group which looks at how we support the delivery of public services beyond the NHS and social care, working with Ministers from across the UK Government and Ministers from the Scottish Executive, the Welsh Government and the Northern Ireland Executive. I am very grateful to colleagues from the devolved Administrations for their participation and their constructive contributions to all our discussions. These have helped us to understand how the virus has affected every part of our United Kingdom, enabling us to take action that meets the needs of people across all our nations.

The ministerial implementation group has now met 30 times, and we have considered the impact of the pandemic on schools and children’s services, the police and the Prison and Probation Service, the courts, the food supply chain, the welfare system, charities and support for the most vulnerable. With my colleague the Environment Secretary, we have been working to address the shortfall in the agricultural workforce to protect our domestic food supply, working closely with industry to launch the “Pick for Britain” campaign. Working with the Education Secretary, we have established the free school meal voucher scheme to make sure that children who need it can continue to access food despite school closures. The scheme has seen 15,500 schools place orders for those vouchers, of which £29 million have been redeemed. We were able to ensure that more than 60% of schools were open every day over the Easter holidays to provide places for the children of critical workers and vulnerable children. In addition, we have launched the Oak National Academy, providing 180 video lessons each week. We have committed £100 million to ensure that remote education is accessible for all, including by providing laptops, tablets and routers to disadvantaged children. Since the end of March, 90% of rough sleepers known to councils have been made an offer of accommodation, ensuring that some of the most vulnerable people in our society can stay safe during this pandemic.

Of course, we recognise that this is not just a national crisis; it is also a local one in communities across the country. We have deployed dedicated military planning support to every local resilience forum. Some 156 military planners are embedded across the country, helping the resilience fora to co-ordinate and protect local services and supplies, with additional support from senior Whitehall officials and named resilience advisers in regional knowledge hubs. Of course, this crisis has put our existing services under huge strain. To bolster this, we have worked with the MoD to mobilise a Covid support force of over 19,060 strong, of whom 2,948 personnel are now committed, supporting a total of 79 military assistances to civil authority tasks nationwide.

Our police have been working hard to keep people safe while enforcing the new measures the Prime Minister put in place just over a month ago. Between 27 March and 13 April, they issued 3,203 fines to those flouting the social distancing rules, and that number will have increased considerably since then—this is all dedicated to helping to save lives and to protect the NHS. We have tested over 150,000 key workers and their families for coronavirus, allowing those who do not have it to go back to work and protecting those who do. We have also made sure the Civil Service and wider public sector are resourced to operate under the considerable new pressures imposed by this virus. We have worked to fill around 1,300 Covid-19 roles through Civil Service redeployments, with over 400 civil servants now moving to the Department of Health and Social Care.

We also recognise that there are people who have developed new needs as a result of coronavirus, as well as individuals whose pre-existing needs are now more acute or more complex. The Government are undertaking a programme of work to support those who have not been identified as shielded but are still vulnerable. We know that many local community organisations have stepped forward to help their friends and neighbours at this time. The Government want to support this activity and we welcome the important role that volunteers, charities and local authorities are playing throughout this crisis. Over 750,000 people have signed up to the NHS volunteer responders programme, and over 600,000 have had their ID verified to start helping with tasks such as collecting shopping, providing telephone support, transporting patients and helping with supplies for the NHS.

To support this effort, and to make sure people know where to turn, we have been working to signpost people to existing and available support—whether local, national or voluntary—through the website address www.gov.uk/find-coronavirus-support. This service has supported over 35,000 people since its launch on 10 April. We are working with supermarkets as well to ensure that a greater number of online delivery slots are made available explicitly to those most in need. We have also been working to understand and identify where there are gaps in provision and what government, working with local and voluntary partners, can do to address this. A notable example of that is the Home Office’s announcement of an additional £2 million of funding to immediately bolster domestic abuse helplines and online support for those at risk.

There will, of course, be further challenges ahead. I do not shirk from acknowledging that, as a Government, we will not have got every judgment right. Indeed, I know that many people, including the honourable Member for Leeds West, have asked fair questions about the Government’s response in a constructive spirit. I and my colleagues will do our best at all times to respond to these questions and challenges, because we owe it to our public sector workers to work collaboratively and harness all available resources in the fight against this virus. And in this fight, it is important that all of us recognise just how much we owe to the stoicism and steadfastness, the hard work and heroism, the compassion and commitment of those working on the front line of public service. We owe them so much, and we in the Government will do everything we can to support them. It is in that spirit that I commend this Statement to the House.”

I, too, welcome this Statement and the remarkable change of tone it contains about public sector workers used by Conservative Ministers and advisers until a few weeks ago. Last December’s Conservative manifesto, and even more the writings of Conservative advisers such as Dominic Cummings and Rachel Wolf, condemned the Civil Service as “incompetent” and wasteful, as ignorant about science and looking after their own interests rather than the public as a whole.

Happily, Ministers have now realised that civil servants and others across the public sector believe in the concept of public service, which right-wing libertarians and public choice economists have rubbished for so long. Across our entire public service, from the NHS to the police and military to Whitehall and local authorities, we have seen people rising to the challenge, moving jobs to help others, and working all hours. Many of them, we should also recognise, are far more modestly paid than their equivalents in the private sector, but they have shown their commitment and their loyalty to the communities they serve.

I am glad to see the reference to local resilience forums, and the recognition that this is a series of local crises across the country as well as a national crisis. I hope that this will persuade the Government to reverse their marginalisation of local authorities and to recognise the vital contribution that effective local government makes to a thriving democracy. I was struck when I read the section on democracy and political reform in last December’s Conservative manifesto that it contained no reference at all to local democracy. I hope that the Minister will argue for its inclusion in the agenda for the constitution, democracy and human rights commission which the Government have promised to set up this year.

The Statement expresses gratitude to

“to colleagues from the devolved Administrations for their participation and their constructive contributions to all our discussions. Those discussions have helped us to understand how the virus has affected every part of our United Kingdom.”

Can the Minister tell the House how the Government have ensured that they have understood the impact on every part of the UK, given that the large majority of the UK’s population lives in England and that there appears to have been no visible mechanism for consultation with the English regions or even with the city mayors from outside London?

The Minister mentioned that the military has now been brought in to help out with logistics but also with expanding testing for the virus. The Statement does not explain why the initial programme of testing was contracted out to a large private consultancy firm: a contract which, the Daily Telegraph has reported, was awarded without the normal tendering process. Was that because of an instinctive Conservative assumption that the private sector is always better than the public sector? The underutilisation of the first testing centres, reported and repeated difficulties with the booking system, and the apparent assumption that all care and health workers had access to their own cars and had time to drive up to 50 miles to be tested all show this to have been one of the weakest aspects of the response to the epidemic. I am glad that the military have now been brought in to expand testing. Why were they not brought in at the outset? My own experience in government, dealing with the digitisation of Whitehall, suggested that outside consultancies often charge more and deliver less.

The Statement refers also to the redeployment of a large number of civil servants across Whitehall to cope with the crisis. What other tasks of government have had to be put on hold as a result? I understand, for example, that the Government’s promised White Paper on data strategy, for which the Minister is responsible to the Lords, is now several months behind schedule, since officials had been transferred; first, to help with preparation for Brexit and now to respond to the epidemic. I understand that officials working on the Brexit negotiations have also been redeployed in response to the epidemic. Will the Minister commit to informing the House in the near future whether the team negotiating Brexit is still sufficiently staffed to handle the complex negotiations that we are engaged in or whether the demands of this emergency will enforce a change of pace if we are to avoid confusion or failure?

Finally, I welcome very warmly the Government’s tribute to

“the stoicism and steadfastness, the hard work and heroism, the compassion and commitment of those working at the front line of public service.”

We all make that tribute, and long may the Government’s change of tone continue.

My Lords, perhaps I may begin by congratulating the Prime Minister and Carrie Symonds on the birth of their son. It is a story of movement from near death to new life in a few weeks. I am sure that that is what we all avidly pray for for this economy and this nation as we look ahead to a way out of this crisis and to new hope.

I thank the noble Lord and the noble Baroness for their responses to the Statement and the constructive way in which they put forward their points of view, many of which I share. I endorse their admiration for all that is being done in the NHS, social care, the public services and the private sector in the face of this crisis. Naturally, I add my own respect and prayers for those people and their families who have given, literally, all they had to give. None of us, as the nation showed at 11 o’clock yesterday, will forget them.

Everyone across the land, which includes central government and, yes, local government, is doing the best they can, as fast as they can, and the most they can in these difficult times. As the noble Baroness said, there has been an extraordinary response from the public in the coming-together across the land, and long may it last.

We must not forget that some remarkable things have been achieved. I acknowledge to both the noble Baroness and the noble Lord that there have also been things that have not gone as well in every detail as all would hope. I think that it was General Moltke who said that no plan extends with certainty beyond first contact with the main force of the enemy, and Covid is a new, hidden, mutable and invisible enemy with characteristics not met before. However, I assure the House that the Government and all their agencies are working night and day to ensure that our front-line health and social care staff have the equipment they need to tackle this virus, and we have delivered more than 1,000 million items of PPE since the outbreak began, including 36 million to care homes.

I agree with the noble Baroness that transparency is important. As she acknowledged, we are moving today to bring together the different strands of statistics in relation to care homes, which will give full and proper transparency on that. Her point on BAME is very important. Work on that is under way, as the scientists have said at the daily briefings. I cannot give her a date for an outcome to the work.

Care homes are obviously a sector of enormous importance, and they have been of concern to the Government all the way through. As I have said, 36 million items of PPE have already been delivered to care homes, but it is a vulnerable section of the community where I acknowledge the need always to strive to do better.

On communications, I will take up the noble Baroness’s point; I understand it very well. I acknowledge her point on the need for the broadest co-operation if and when we move into test and trace. On publishing frameworks, I think that the noble Baroness and the House know that the Government’s position is that we have first to keep on with the effort that that public are making to contain this virus and to meet the five tests before we move forward to any release from the current lockdown provisions. As the Prime Minister acknowledged when he came back to work, over the next few days, the Government will continue to examine carefully all these issues.

On the points made by the noble Lord, Lord Wallace of Saltaire, I do not need any reminder of the need to commend the Civil Service. I have always had the highest respect for it and have worked with it through my life. The ideal of public service is one that I personally consider to be of the highest importance, and it is something to which I have always aspired. I assure the noble Lord that that is shared widely, if not universally, across the Government. On the importance of local authorities, I referred to the local resilience fora. Local authorities are making a great contribution. We will continue to work to improve and maintain communications with them and with agencies right across England, as the noble Lord rightly said.

I welcome what the noble Lord said about the military. Its role has been extraordinary. The Armed Forces have made a great difference and perhaps have not had as much attention in the media as they might have done, but I was grateful for what he said on that score.

So far as the redeployment of civil servants and the delay of business is concerned, there has been an impact on some aspects of government business, of course. It is right that full priority should be given to confronting this crisis, but on the noble Lord’s concerns about the negotiations towards the transition on 31 December, I assure him that a very effective team with a large number of civil servants is at work there, as was said in the recent Statement. Indeed, if he read Monsieur Barnier’s statement, he will have seen how Monsieur Barnier himself commented on the professionalism of David Frost and his team in carrying forward those negotiations. I believe that we can have confidence in that.

My Lords, I welcome my noble friend’s Statement. I join in the expressions of deep gratitude to all those who have kept public services running. We owe them a huge debt.

Does my noble friend agree that, while we understand the entirely fair and legitimate questions and concerns about, for example, the delivery of some equipment to the front line—notwithstanding the burning desire of some in the media to produce a so-called gotcha moment—one of the most important features of this pandemic is that, unlike in some other countries, our National Health Service has not been overwhelmed and has coped brilliantly with the extra demands placed on it? For this, both our fantastic health service workers and those in government deserve credit.

My Lords, I thank my noble friend. Of course, I wholly endorse what he said about the great achievement of the National Health Service, with all the support that it has received from others, in providing its services and in maintaining a safe distance between being overwhelmed and offering the outstanding-quality service that it does. I agree that a little more attention might sometimes be given to some of the remarkable and unprecedented things that have been achieved over the past few weeks.

It is right that there should be scrutiny. It is right that questions should be asked, above all in Parliament but also by the media. The country has demonstrated that it has the will to go forward and triumph over this virus. To win, one has to travel with hope and encouragement, as well as with humility and honesty. It behoves us all, both those who report and those who perform, to keep that spirit of hope and encouragement alive.

My Lords, the Minister brings a vast range of experience to this subject, so he will recall that after the banking crisis of 2008 there followed 10 years of austerity and during those years, local authorities experienced an increase in demand for services and major cuts in their budgets. As a result, as we look back, in relative terms the most vulnerable sometimes paid the highest price because they had no margins and the services they needed were restricted or removed. We are now told that borrowing is at an unprecedented level, so I hope the Minister will agree that it would be timely, among all the other things that have to be done, for a robust plan of action to be put in place to ensure that as we go forward, the most vulnerable and the services they need are properly protected.

My Lords, I am not going to follow the noble Lord into considering history; otherwise, one could go back further and further into how we got into the 2008 crisis and so on. The thing we must do now is to go forward and look forward. I cannot at this virtual Dispatch Box anticipate what the Chancellor will do in managing the economy as and when we come out of this crisis, but it is this Government’s firm resolve to level up, as the Prime Minister has repeatedly stated. Indeed, in in this crisis, as we know, additional resources have been given to local authorities and the social care sector. Of course, I understand, accept and share the spirit of the noble Lord’s remarks, if not following him in every detail.

My Lords, I, too, welcome the Statement and join in the expression of appreciation of everyone who is working so hard during this unprecedented public health challenge. However, I want to raise a question about the future of the acquisition and delivery of PPE. We are very aware that in the past few weeks, this has not been conducted as efficiently and effectively as everybody would like, including Ministers. However, we know that with the Spanish flu there were two further peaks. Can the Government assure us that by this autumn, we will have sufficient and robust supplies of PPE that meet the right standards from the HSE’s perspective? Looking at the Statement and the four teams that are working together, many people, including me, do not quite understand where the noble Lord, Lord Deighton, who is co-ordinating the manufacture and distribution of PPE locally, will link in with those four teams. We could, of course, become completely self-reliant as a country on PPE, which may be something we want to think about in the longer term. I would be very happy to have a virtual meeting to discuss this further if it is appropriate.

PPE is of course of fundamental importance. If anybody in the country did not realise it at the start of this crisis, it is fully understood now. Ministers have always understood it. We had a large stockpile. Great efforts will continue to be made to ensure that our front line has sufficient equipment. I note the points that the noble Baroness made about the experience of Spanish flu, and I would certainly be interested in talking to her about it on another occasion, but I must reiterate that the Government are 100% committed to securing a stable and safe supply of PPE now and in the future.

Following on from the noble Lord, Lord Laming, I want to explore the needs of local authorities a bit further. Councils of all political persuasions are very concerned about the considerable shortfall in the funding they need—for example, to prevent the failure of private sector social care provision. Will the Minister join me in urging the Government to meet this large and urgent need for additional funding—over and above, I have to say, what has already been provided to local government during this crisis?

My Lords, I might be new in the game, but I am afraid that I cannot urge the Government because I am no longer on the Back Benches. I can say that the Government understand the critical importance of local authorities in confronting this problem. I will certainly make sure that the noble Baroness’s points are heard and understood by the Chancellor. As I said, I cannot anticipate what financial provision he will make for the future.

My Lords, given the latest Public Health England advice that quarantining of new and at-risk prisoners should be in place for the rest of this year, can my noble friend advise us of the Government’s planning for the resumption of prisoners’ family visits and the progress on making virtual visits widely available?

My Lords, my noble friend raises a very important point. Prisoners are a vulnerable part of the community and mental health is important for everyone, not least prisoners. I assure him that although this is at an initial stage, action has already been taken to ensure that locked mobile telephones can be given to prisoners in settings where there is no access to call boxes. Provision is being made to bring in the kinds of virtual conferences and meetings that he describes. I cannot give him an exact figure on the number of settings, or the timing, but I assure him that the Government are aware of the issue and addressing it.

My Lords, I thank the Government for agreeing the £60,000 award for health and social care workers who have died, but I ask them to extend this to other workers who have died on the coronavirus front line. Will the Government please ensure that bereaved families of those who have died on the front line but who are not in the NHS Pension Scheme get the same benefits, including a monthly allowance for dependants?

I would like to say first how impressed I am by the work of the Department for Work and Pensions, which has the responsibility for meeting the needs of the most needy people in our country. Also, can the Minister tell me the effects of the present restrictions on the criminal and civil courts in our country?

My Lords, I am grateful for what my noble and learned friend said about the Department for Work and Pensions. It is an important area when it comes to confronting this crisis. Helping the most vulnerable is absolutely key, as well as those whose jobs are suddenly insecure. On the courts, there has been an impact, particularly in the case of the county courts. Virtual proceedings are continuing where it is possible to do so. I believe that court proceedings are continuing in 159 settings—I cannot remember the exact figure off the top of my head but if it is wrong, I will write to my noble and learned friend. That has also obviously had an impact on magistrates’ courts, where the throughput of cases is considerably down from the normal level. This matter receives the constant attention of the Ministry of Justice, which is monitoring the situation closely.

As the Government have recognised clearly and appropriately in the Statement, front-line workers from overseas have been essential to managing the Covid-19 epidemic, and have done so at risk to themselves and their families. Will the Government give credit for this in applications for UK residency and citizenship and urgently revise the criteria, and in the process, are the costs of their visas being waived?

My Lords, I cannot answer the detail on the last point; I will advise the noble Baroness on that point. Obviously she will know that the NHS visa scheme will be ongoing as an important part of the Government’s plans. On the other aspects of her question, I agree that the significance and importance of workers in the NHS who come from overseas is hugely recognised and valued; that has been made publicly clear several times by my right honourable friend the Minister for Health, and I endorse that. I will pass on to him all the remarks the noble Baroness made, and I am grateful for what she said.

My Lords, I thank my noble friend for his comments, particularly on schools. Reopening schools as soon as possible must be a top priority. Since most pupils and teachers will have had a very long Easter break—unexpected and unwelcome—and since it will not be possible for anyone to go away on holiday this August, will the Government therefore consider and instruct all schools to stay open throughout the usual summer holiday period, apart from a couple of weeks’ break, in order for pupils to catch up?

My Lords, obviously, education is of critical importance. As my noble friend will know, some schools have stayed open to provide support for the children of key workers—I express our gratitude to them. It is right that we should congratulate and commend the professionals who have done that in the circumstances. I understand the aspiration to return to school, whether it comes from children or from parents and grandparents. I remind the House of the five tests —so far I have not—which are vital if we are to sustain the fight against Covid. Those have not all been met, but obviously, as the Prime Minister said when he came out of hospital, consideration is being given to the future. The key task currently is to protect the NHS, save lives and protect lives, and, as the Prime Minister put it, this is a moment of maximum risk, as well as of maximum opportunity. I understand what my noble friend said and I assure him that the Government are well aware of many people’s aspirations. However, for the moment we must keep on with social distancing.

I thank the noble Baroness. It is of course in the hands of the Chancellor. I am sure the noble Baroness would agree that his massive response to this crisis, helping businesses and families, and supporting those in need, has been unprecedented and striking. We are obviously still in the middle of these circumstances and do not know how long this is going to continue. The noble Baroness will understand if I cannot anticipate what will happen in the weeks and months ahead, but I assure her that the Chancellor is vividly aware of the impact of the present crisis on the economy, and what it means for real people whogo out to work to make the resources that the country needs.

Our National Health Service may be wonderful, but it has a very sclerotic decision-making process, rather like the former Soviet Union. I live in Cambridge, where our local hospital has almost 400 empty beds. Cancer radiotherapy and cancer operations have stopped. The cardiology department has almost stopped and there are no face-to-face appointments available. When the hospital is questioned, it says that it is waiting for guidance; when the Minister is questioned, we are told that it is up to the hospitals. Will someone try to shake this up, because although we have to combat Covid-19 we must also remember that many very ill people in the community are not being looked after?

My Lords, the fact that my noble friend points to—the indirect impact on people and their health in the Covid crisis—has been repeatedly stressed by the Chief Medical Officer in the press conferences over recent weeks. That is understood. I take the point that he makes about spare capacity, which is obviously a result of what was a necessary response to the crisis. Yesterday in the press conference, my right honourable friend the Minister for Health spoke—I cannot remember the exact phrase— about reopening the NHS to normal business. That is probably not the phrase but it was something of that sort. I assure my noble friend that consideration is being given to this.

My Lords, I listened in vain for reference in the Statement to public transport or to the freight transport industries. Our economy sits on the shoulders on those industries, so while the Government have announced assistance for transport in its various forms, does the Minister agree that we owe a debt of gratitude to all public transport workers during this crisis? Sadly, many of them have died, particularly bus drivers, because they come into close and regular contact with the public. What are the Government doing to ensure that those workers, and other rail and bus workers, are given much better protection from the virus?

My Lords, I totally agree with the noble Baroness about those who work in public transport. I am a public transport user myself; I do not drive a car in normal times. I know every day how important it is, as is the work which public service workers on transport have done. Albeit that it is less used, the Government recognise—as I think the whole nation recognises—the risk that they run. As the testing provision extends, more and more key workers will have access to this kind of provision. I fully take on board the points that she makes; these are vital and much valued members of the public services.

My Lords, I share that aspiration and I know that the Government do, but the need to protect the safety of the public and to save lives is still paramount; the five tests have not yet been met. But I repeat what I said in an earlier answer: that aspiration is clearly understood, and the Government have invested heavily in trying to support distance learning. That is a great thing, as I am sure a virtual Parliament is, but a virtual Parliament is no substitute for the real thing, and I hope that in due time virtual learning will be taken over by a return to a more normal life. But I am afraid that the time is not now.

My Lords, I am grateful for the Minister’s comments about the support from the voluntary sector—it is terribly important—but I do not know whether he is aware that the hospitality sector is failing quite dramatically. An awful lot of employees are on zero-hours contracts, and there are reports of them having to sleep rough in London and many other places because they cannot afford their rent. The problem is that there are no hotels, shops, restaurants or cafés open that might give them some food, there is nowhere for them to stay because they cannot afford the rent, and of course the public toilets are shut—so it is very different. Of course, these people do not always know the normal way in which local rough sleepers go about things. Could the Minister talk to local authorities and try to instruct them to open public toilets, encourage the voluntary sector and get the day centres open so that these people can at least survive until there is a better chance of getting a new job?

My Lords, I certainly take into consideration what the noble Lord says. As I said earlier, through the help of local authorities and the truly outstanding agencies that work in the area of assisting homeless people, the Government believe that we have reached some 90% of those we wish to. I congratulate my noble friend and his department on the work they are doing on domestic food supply. Now that we have left the European Union, can my noble friend the Minister explain what steps are being taken to encourage schools, hospitals, prisons and councils to source their meat from domestic production at this time? Will he be mindful of the overnight loss of a huge part of the dairy production market, leaving 2,000 farmers possibly destitute and potentially leading to a mass slaughter of their cows?

My Lords, last week, the United Kingdom and the EU had a full and constructive negotiating round. It was conducted remotely by video conference and there was a full range of discussions across all the issues on the basis of extensive legal texts provided by both sides. We now need to move further forward in a constructive fashion.

I thank the Minister for that. As he said, there were 40 sessions of negotiations last week , but I am afraid that we heard from both sides about the difficulties and the lack of progress. There was even a slight hint of bad faith—this at a time when there are dire consequences to our trade and finance because of Covid. Given that the Government’s chief negotiator is not a Minister and so is not answerable to Parliament, can this Minister, the noble Lord, Lord True, confirm that the Government are genuinely prioritising a deal, as envisaged in the political declaration? Will he give serious consideration to releasing the legal texts that he has mentioned to assist the House in its work? Can he also say whether the Prime Minister’s original Brexit blueprint has in any way changed in the light of the new economic circumstances?

My Lords, there were several questions there, but it is always welcome to hear from the noble Baroness. The Government are determined to reach a constructive and amicable relationship with the EU, to maintain that and to reach an amicable agreement. These negotiations have only just begun. There were good areas of convergence in the first discussions, as well as areas of disagreement; that is normal in a negotiation. On legal texts, we have always said that we would consider whether it is appropriate to publish certain documents during the course of negotiations and whether it is useful to make them available more widely. However, those decisions will be taken at the appropriate time.

Can my noble friend the Minister explain why, in the interests of flexibility, the Government are refusing even to consider an extension to the transition period given that we do not know what situation we will be in next week, never mind the situation we will be in by December this year? Secondly, can he say whether, in the interests of flexibility, the Government will seek to join European Union Ministers in discussions on co-ordinated steps to open up tourist traffic with the rest of the European Union, of which we are still part?

My Lords, as the Prime Minister said yesterday, various decisions on future arrangements under the Covid crisis will be considered in due course. On my noble friend’s main question, there is a clear mandate from the British people to leave the European Union. We have left the European Union and Parliament has enacted that the transition period will end on 31 December. The Government are conducting themselves in accordance with the direction of the British people and the direction of Parliament.

On what basis do the Government believe that they will have full access to EU security operations and databases such as Europol and the Schengen Information System, an ambition that has been labelled as “cherry picking on speed” by a spokesman for one of the parties in the coalition Government of Germany, which will have the EU presidency from July? Are the Government relying on a belief that the EU will compromise on its legal rules on data protection, human rights and the European Court of Human Rights or, in the words of Mr Gove yesterday, that they will set aside their principles?

My question concerns the border and customs controls that are due to be put into place on 1 January next year between Great Britain and the EU and Great Britain and Northern Ireland. Given the Government’s rejection of regulatory alignment in goods and their refusal to accept the principle of the level playing field on which Brussels insists, when these controls come in, they are likely to be onerous. What steps are the Government taking to prepare business for these extensive border and customs controls at the end of this year and how do they expect businesses to cope with these new requirements, given the devastating consequences of the Covid crisis? Is that not in itself an argument for seeking an extension?

My Lords, seven months ago the Government presented to Parliament the political declaration setting out the framework for the future relationship which did not talk about a free trade area, but rather about,

“an ambitious broad, deep and flexible partnership”

including

“foreign policy, security and defence and wider areas of co-operation.”

The paper presented to us by the Government in February set out a much narrower free trade agreement, as the Minister has just said. It says nothing about a wider partnership. Should we now accept that the declaration made last October is no longer a reference point for the Government’s negotiations?

My Lords, the Minister will accept that business has gone through a long period of pain and what it wants is certainty. Surely, giving us an almost unreachable deadline will only add to the uncertainty affecting business. We will not get out of the current pandemic unless we drop the idea of having this deadline now and concentrate on the real issues that matter to the country.

My view, and the Government’s view, is that business profits from certainty. My Lords, Mr Barnier said that the EU would not agree to an economic partnership without a long-term solution on fisheries—publicly grandstanding, not negotiating. A future fisheries agreement should not leave the UK at a disadvantage compared with the likes of Norway and Iceland. Does my noble friend agree that, with the right attitude on both sides, it is possible to deliver a trade deal before the end of the transition period, a deal formed on the back of the clear democratic vote just last December?

Yes, I certainly agree with my noble friend, and the Government believe that that will be possible. The Government are asking nothing of the European Union that it has not agreed in free trade agreements with other nations. On fisheries—I should declare an interest as a descendent of six generations of fishermen—the Government’s position is that Britain will be an independent coastal state; we will make our own arrangement but we will negotiate with all parties, as is done with Norway, on the future use of what will be our waters.

My Lords, I congratulate my noble friend Lord Balfe on being the first Peer in the history of the House of Lords to ask a virtual Question. Those who know me know that it will be the ultimate technological stress test for me to get through this. The Government are grateful for the work of the Burns Committee. I refer my noble friend to the response of the former Prime Minister in February 2018.

My Lords, I am sure the House will agree that, particularly at the moment, we need to look to our reputation. This is not helped by the mass creation of new Peers. However, no Peer can be introduced to sit in the House without following the Standing Orders, in particular Standing Order 1.12 of the 24th edition of the Companion, 2015. It would seem that alterations to the normal procedure are achieved with the agreement of the House. So, a resolution of the House to amend this resolution, to reduce introductions to the number in the Burns formula, would theoretically be the way to try to import the target set by the noble Lord, Lord Burns; new Peers could be created but would have to wait to be introduced. Does the Minister agree that this matter could usefully be referred to the noble Lord, Lord Burns, and his committee—to look at this suggestion as a way of bringing some discipline to the procedure?

My Lords, it is not for me to decide what should be referred to the committee. The size of the House is reducing, given retirements and departures; we have sadly heard some today. However, some new Members are essential to keep the expertise and outlook of the House of Lords fresh.

My Lords, I congratulate all those in IT, the usual channels and the Procedure Committee for their tremendous achievement in making this possible in just two weeks. It is extraordinary; I thank them all. While I entirely support the two-out, one-in plan, if it fails to deliver for whatever reason, will my noble friend the Minister not rule out other measures to reduce numbers? These could include creating non-legislative Peers who would not sit in this place, looking at an age retirement point, or simply ejecting those who failed to participate in our proceedings above a threshold of, say, 25% or 30% of sittings in any Parliament.

My Lords, my noble friend makes some concrete suggestions, some of which would require legislation. The Government’s view is that any reform of your Lordships’ House would need careful consideration and should not be brought forward in a piecemeal fashion. On a minimum participation threshold, I think many noble Lords feel that it is not the quantity of participation that matters in this House but its quality.

My Lords, I am of course strongly in favour of the proposal for two out, one in, as it is an important part of the transition to a smaller House. However, I would not like to lose sight of some of the other issues which the Lord Speaker’s Committee felt were important in the longer term. We concluded that the hard work of getting the numbers down would be in vain unless a cap on the size of the House is maintained and the allocation of new Members reflects each party’s electoral performance and progress in achieving departure. Does the Minister agree that without some combination of proposals such as these it is difficult to see how we will bring an end to the almost continual growth in numbers that we have seen since the 1999 Act?

My Lords, as a matter of fact, the recent history is not of numbers increasing. I pay tribute to the noble Lord, Lord Burns, and his committee for the inventive and constructive suggestions they have made and commend the spirit with which many in the House are following them. However, the longer-term proposals of the committee to maintain a steady-state size require further careful thought and wider engagement, particularly with the House of Commons. That was a point made by the previous Prime Minister.

My Lords, further to the point raised by the noble Lord, Lord Burns, he will know that a year after his original report, he produced a progress report, which set benchmarks or targets for each of the main groups, for the remaining years of the 2017 Parliament. Since then, we have had a general election. Would it not make sense for that committee to be reconvened and new benchmarks for the current Parliament to be set, so that we can see what progress is being made towards the target of 600? Do the Government accept that 600 is a realistic target to aim for?

My Lords, on the first point, it is a matter for your Lordships’ House. We have had two follow-up reports from the noble Lord, Lord Burns, and the Lord Speaker, which have been very informative and helpful. As far as a specific number is concerned, the previous Prime Minister did not commit to that; nor I think will this one.

My Lords, in addition to two out, one in, there is the issue of the hereditary Peers having a different policy: one out, one in. Given that the Leader of the House got agreement before our recent Recess to postpone hereditary by-elections until September, would it now be possible to suspend all such by-elections as they arise, so that we are at least working towards two out, one in, rather than the hereditary Peer system of one out, one in?

No, my Lords. This matter has been given extensive debate—I think “extensive” is a fair word in the context of the Bill of the noble Lord, Lord Grocott. The Government’s position remains that reform of the House of Lords should be considered at the due and appropriate time, and not conducted in a piecemeal fashion.

My Lords, this order has been laid before this House and the other place, which approved it on 18 March 2020. It will update the membership arrangements of the Conservation Board of the Chilterns Area of Outstanding Natural Beauty to take account of the restructuring of local government in Buckinghamshire. We expect that this will be the final statutory instrument connected to local government restructuring in Buckinghamshire.

The order bringing about local government reorganisation in Buckinghamshire came into force on 23 May 2019. It provided for a reorganisation date of 1 April 2020, when the new Buckinghamshire council will assume the full range of local authority responsibilities and the five existing councils—the county council and the four district councils—will be wound up and abolished. That order established a shadow authority and shadow executive, which has been managing the transition to the new council. I am very pleased that all the councils have been working closely together to deliver the new unitary council and I thank them for their hard work and dedication.

The Conservation Board of the Chilterns Area of Outstanding Natural Beauty, which is the subject of this order, is made up of members appointed by the relevant local councils, parish council representatives and members nominated by the Secretary of State for Environment, Food and Rural Affairs. The board’s composition is set out in the Chilterns Area of Outstanding Natural Beauty (Establishment of Conservation Board) Order 2004. The conservation board is responsible for conserving and enhancing the natural beauty of the Chilterns and increasing the understanding and enjoyment of its special qualities, which are so loved and well known by so many.

As I have said, local government restructuring in Buckinghamshire will abolish all five of the Buckinghamshire councils that currently nominate a member of the board. Some changes are needed to the board membership arrangements to take account of these changes. The Chilterns board currently has a total membership of 27: one representative for each of the 13 councils specified in the 2004 order, two parish council members for each of Buckinghamshire, Hertfordshire and Oxfordshire, and eight members nominated by the Secretary of State. Without this order, the new Buckinghamshire council will only be able to appoint one member, instead of five, to the conservation board. However, 50% of the Chilterns Area of Outstanding Natural Beauty falls within Buckinghamshire. The shadow executive of Buckinghamshire Council has, therefore, requested that the status quo be maintained so that the new council will nominate five members to the board to provide adequate representation for the area. It considers that the current membership arrangements, with five board members for Buckinghamshire as a whole, better reflect the extent of the Area of Outstanding Natural Beauty that falls within the new council area, and the Government agree. Furthermore, the Countryside and Rights of Way Act 2000 specifies that at least 40% of the AONB board membership must be from local authorities and at least 20% from parish councils. These changes ensure that that statutory requirement continues to be met. There are no other changes to the membership of the board.

In conclusion, this order will amend the membership arrangements of the board of the Chilterns AONB to retain a total of 13 members nominated by local councils, five of whom will continue to be nominated from the Buckinghamshire area, for the reasons explained. There are no changes to membership of the board otherwise. I commend the order to the House.

My Lords, it is a pleasure to speak in this debate on behalf of my noble friend Lord Kennedy. The issue of restructuring local government in Buckinghamshire has been discussed by this House previously and is settled, so I do not intend to dwell on it today. This minor order is, however, the final statutory change necessary for the restructuring process and the House will recall that the initial public consultation on the creation of a Buckinghamshire unitary authority found that a majority of respondents opposed the change. I would therefore be grateful if the Minister confirmed whether the Government believe that the people of Buckinghamshire are now fully behind the merger.

Moving on to the order before the House, there are two small issues on which I would appreciate clarification. First, as the House will be aware, a shadow authority for the new unitary council has been in place since mid-2019, as part of the effort to aid the transition. Can the Minister confirm whether, during this period, a representative of the shadow authority has been sitting on the board of the AONB? Secondly, as this change will result in the five representatives who are currently distributed equally between the five authorities being replaced with five representatives of the new Buckinghamshire council, can he confirm that the new council intends to appoint five individuals from across the county, rather than multiple representatives from any single area?

My Lords, I thank the noble Lord for his response and for speaking on behalf of the noble Lord, Lord Kennedy. On the question of transformation, which is slightly wider than this order, the process has obviously been the subject of repeated discussion. My understanding is that the shadow arrangements have been working well. I am sure that, over time, consent will continue to grow so far as the changes undertaken are concerned. The appointments will be a matter for the Buckinghamshire authority, but I am sure that it will take note of the noble Lord’s remarks. As a responsible local authority, it will obviously be able to decide that matter for itself.

I have a feeling that the noble Lord asked another question that I did not initially know the answer to, but I will look it up and respond to him; I am grateful for the response. This is a technical change but, as I explained, it is required for statutory reasons to keep the numbers up. The size of the area of outstanding natural beauty in Buckinghamshire also justifies that change.

I may be getting an answer to the noble Lord’s other question. The board membership will have been drawn from the membership of the shadow authority, as it comprises all elected members in Buckinghamshire. I ought to have been able to think of that answer myself, but I come late to the Buckinghamshire issue, given the coronavirus crisis, which I want to conclude on.

All of us are dealing with this matter. This is one of a number of small orders that are dwarfed by what is going on, but I am sure everybody in this House wishes that the day will come, after this period of enforced confinement, when the people of this country can go out and again enjoy the beautiful area of the Chilterns, for which the board is responsible. I commend the order to the House.

My Lords, the Government are giving the highest priority to the welfare of all citizens—and, indeed, those of friendly nations—in the coronavirus crisis. Given the latest developments, we are of course in regular contact with the European Commission to explore alternative ways to continue discussions and we will be guided by scientific advice.

I am pleased about that last comment, because we need not just Brexit but the right Brexit. This week’s talks have been cancelled because of Covid-19, and the attention of not only our Government but all the EU Governments is on that crisis. I ask the Government to take account of that, and of the fact that businesses are concentrating more on their survival than on preparations that they will have to make for the end of the transition. Should it become advisable not to walk out of the talks in June if we have not made enough progress, will the Government not be hidebound by their repeated holding on to a particular date and, if necessary, allow the talks to continue? With this global crisis, surely it is important to get the right Brexit, not just a rapid one.

My Lords, in his reply to the debate on the EU Committee’s report yesterday, the Minister made an absolutist statement that “under no circumstances” would the Government “accept an extension”. This contrasted interestingly with an earlier response to my noble friend Lord Oates by the Minister’s colleague the noble Lord, Lord Goldsmith of Richmond Park, at Question Time, who said:

“Were it the case that the … Government felt the need to do such a thing”—


amending the EU withdrawal Act—

“they would take the step that the noble Lord has outlined”,—[Official Report, 16/3/20; col. 1274.]

so that they have the power to extend. However, that is not the Government’s view today. The answer from the noble Lord, Lord Goldsmith, was much more flexible. Does the noble Lord, Lord True, accept that a flexible rather than absolutist, rejectionist policy towards extension would be regarded by the House and by the country as statesmanlike, rather than as some kind of cave-in?

My Lords, is more uncertainty not the last thing that business needs at the moment? For the Government to sound an uncertain note on our determination to leave the European Union, as has been agreed, would be a great mistake. When the noble Baroness, Lady Hayter, talks about the right Brexit, we all know that she thinks that the right Brexit is no Brexit at all.

My Lords, the Minister talked about the ongoing discussions and the coronavirus emergency in his Answer. Could he tell the House what discussions are going on about relationships with the European Medicines Agency? I hope that we will have new vaccines and new medicines, which need a speedy, combined and accepted recognition and licensing process. It would be a great shame, since we no longer have the European Medicines Agency here, if we were not in the closest co-operation with it over this very urgent matter.

My Lords, Parliament did indeed accept the ambitious timetable of the Government but, since then, an amendment has been moved—namely, the crisis of coronavirus. Surely the Government should be sufficiently flexible to see that things have changed and to realise that perhaps the conference calls and so on will not deal with a situation where many of the potential negotiators are unable to leave their own countries because of lockdown.

My Lords, I hear what the noble Lord says and understand where he is coming from, but I must repeat that both sides remain fully committed to these negotiations and to continuing them. Of course we are looking at the possibility of videoconferencing and conference calls as he suggests. That is the resolve of both parties in this negotiation.

My Lords, I doubt anyone would disagree that the absolute priority—a term we sometimes use loosely—of the Government at present must be to deal with the virus. However, in the way that different countries have reacted, is it not at least worthy of reflection—I put this in as neutral a way as I can—that when individual citizens of individual countries face a real crisis, they look not to supranational bodies to resolve it, although of course they want countries to co-operate with each other, but to their own Government? In many cases, that leads to them closing their own frontiers. Does that not give some pause for thought about the continuing expectation of the populations of individual nation states to look to their own Government in times of crisis?

The noble Lord makes a very interesting point. Of course, it does not in any way resile from the views of those countries about their membership of the European Union. It is not for us to comment on the policy of other countries, but he is certainly right that different approaches are being made by different countries. Each one will adopt policies, as we are, in the interests of securing the livelihoods and lives of its citizens.

My Lords, since I doubt that the Minister will agree with anything I say about the European Union, can I try to find some consensus with him? Will he agree with me that one of the very few positive things to come out of this awful coronavirus epidemic is the fact that a second Scottish independence referendum is off the agenda for the foreseeable future?
