Commons ChamberI understand that some colleagues are worried, as I have just said, that we could end up stuck in the backstop indefinitely. In the negotiations, we secured seven separate commitments in the withdrawal agreement and political declaration to ensure that that is not the case. First, there is an explicit legal duty to use best endeavours to reach an agreement by the end of December 2020 that avoids the backstop coming into force in the first place.
That is not just a political commitment. As the Attorney General has set out, this is a recognised approach in international law, and we have the right to seek independent arbitration if this duty is not upheld. Secondly, if despite this, the future relationship is not ready in time, the backstop can be replaced by alternative arrangements. The political declaration makes it clear that we will seek to draw upon all available facilitations and technologies that could be used to avoid a hard border, and preparatory work will be done before we leave so that we can make rapid progress after our withdrawal. Thirdly, if neither the future relationship nor the alternative arrangements were ready by the end of 2020, we would not have to go into the backstop at this point. Instead, we have negotiated that there would be a clear choice between the backstop or a short extension to the implementation period.
Fourthly, if we do go into the backstop, the legal text is explicit that it should be temporary and that the article 50 legal base cannot provide for a permanent relationship. Fifthly, if the backstop is no longer necessary to avoid a hard border, we have the right to trigger a review through the Joint Committee. Sixthly, as a result of the changes that we have negotiated, there is an explicit termination clause that allows the backstop to be turned off. Finally, the legal text is now clear that once the backstop has been superseded, it will cease to apply, so if a future Parliament decided to move from an initially deep trade relationship to a looser one, the backstop could not return.
I am grateful to the Prime Minister for giving way—indeed, she is being very generous in giving way to a lot of people. We are told that the EU does not wish to exercise the backstop, Ireland does not wish to exercise it and certainly, the UK does not wish to exercise it. Is it not the case, therefore, that this is a matter not of renegotiating the withdrawal agreement, but of the European Union showing good will and good faith towards the United Kingdom by allowing us one additional line in the withdrawal agreement? This could be words to the effect that in the event of the backstop being triggered, the United Kingdom can, say, at three months’ notice, leave the customs union. To allow that one line would show enormous good faith and good will on the part of the EU, and nothing else.
I recognise the degree of concern that there is about this issue, and I will go on to speak about it further in my speech. The withdrawal agreement has been negotiated. It is clear from the European Union that this is the deal, and I just ask those colleagues who wish to reopen the withdrawal agreement to recognise that were it to be reopened, it would not simply be a question of what the United Kingdom then wanted to change; it would also be a question of enabling others to change elements of that withdrawal agreement. Given the rigorous fight that we had in the negotiations to ensure that there were certain elements that were in the interests of the United Kingdom, notably around fisheries and other issues, I caution hon. Members that not only has the EU made it clear that the withdrawal agreement cannot be reopened—we have agreed the deal and the deal is there—but it is not the one-way street that hon. Members would perhaps wish it to be.

Commons ChamberNo, it represents a good deal for the people of this country. Focusing on a future relationship that delivers a good, comprehensive trade agreement with the European Union together with a security partnership, both of which are unprecedented in their breadth and depth, I believe is good for the people of the UK.
In my right hon. Friend’s response to my right hon. Friend the Member for Chingford and Woodford Green (Mr Duncan Smith), and indeed to other Members, she said that there are alternatives to the backstop. For the sake of clarity, if there were to be an extension to the implementation period and we had not yet reached an agreement with the EU when the extended period expired, would the backstop then kick in, or would it have fallen away?
I referenced the situation in which the backstop would cease to apply in my statement, and it was further referenced by the right hon. Member for Belfast North (Nigel Dodds), the leader of the Democratic Unionist party. The alternative arrangements being considered could be in place to provide for the border in Northern Ireland instead of using the backstop or the extension of the implementation period, and crucially to provide for an alternative for coming out of the backstop were the future relationship not in place.

Commons ChamberMy Department has no role in the allocation of any savings resulting from the reduction in MLA pay. The budget for the payment of salaries to MLAs is held by the Assembly Commission. Any savings would be returned to the central Consolidated Fund for redistribution within the Northern Ireland civil service, and their reallocation would be for that civil service to determine. I can also advise that the Secretary of State has today written to the Assembly Commission to bring the pay reduction into effect.
In their LGBT action plan, the Government allocated £4.5 million for an implementation fund that will be available to voluntary sector groups in England, but when I was in Northern Ireland recently, I met people in similar groups facing even greater challenges who have never received Government support from Stormont or Westminster. I have already asked the Secretary of State about that and I wrote to her on 7 September, and I have not had a reply. Will the Secretary of State consider supporting funding for these groups—if not from MLA pay, from another source?
Thank you for clarifying that, Mr Speaker; it is much appreciated. I am sure that the hon. Gentleman will receive a response from the Secretary of State very soon.
Any unspent money or savings would be returned to the central Consolidated Fund, for redistribution within the Northern Ireland civil service, and it is for civil servants to allocate as they feel appropriate.
Does the Minister agree that the pay reduction seems a bit unfair, because the vast majority of MLAs actually want to do their job, and it is only a small percentage that are stopping the Assembly being reassembled?
My hon. Friend is absolutely right that the vast majority want to get on with doing their job; but we have to recognise that some of their duties have lessened, so we are making a reduction but recognising that they still have constituents to look after and are still voices within their communities.
I would be fascinated to know how much it has cost to pay the MLAs their full salary since the collapse of the Assembly and the Executive in January 2017. Is it £12 million, £13 million, £14 million? Does the Minister honestly believe that was money well spent, when our education budgets and our health budget in Northern Ireland are so overstretched?
I do not know what the precise sum is, but I fully appreciate and am happy to put on record the hon. Lady’s commitment to this issue, on which she has spoken regularly. When the talks collapsed, there was an element of good will and we hoped that the parties would return and form the Executive again. There has to be an element of good will, rather than instantly saying, “Right: we are making reductions.” We had that element of good will; we had to introduce legislation for the cuts, and we also had to have the review conducted by Trevor Reaney.
Last week, the Secretary of State said she wanted to see action on victims’ and survivors’ pensions. May I press the Minister, because legacy is a Northern Ireland Office responsibility? Will the Government pledge the considerable savings from MLA pay to those pensions and make good on the UK Government’s promise to the victims and survivors of the troubles?
As I said earlier, as far as any savings are concerned, the unspent money will be redistributed to the central Consolidated Fund for redistribution to the civil service, who can then reallocate. As far as legacy issues are concerned, the pension issue is actually a devolved matter.
The publication by the Electoral Commission of donations and loans data for the Northern Ireland parties from 1 July 2017 is a positive step that should be welcomed by the whole House. The decision to publish data from July 2017 was taken on the basis of consultation and broad support from the majority of political parties in Northern Ireland.
How can it be right that the very party that would come under investigation if donations dating back to 2014 were published essentially gets a veto? We know that the leave campaign is now under investigation for donations during the referendum. Surely Northern Ireland deserves that kind of transparency, too. Why are this Government ignoring the recommendations of the Electoral Commission?
I am sorry that the hon. Lady seeks to make political capital out of this. The then Secretary of State for Northern Ireland, my right hon. Friend the Member for Old Bexley and Sidcup (James Brokenshire), wrote to all the political parties in January 2017 regarding transparency and a date. With the exception of one party, they all agreed on the way forward. As for any other issues, I am sorry that the hon. Member for Oxford West and Abingdon (Layla Moran) cannot accept the broad view of the majority of parties in Northern Ireland.
Does the Minister agree that the loophole that allows millions of pounds of donations, including money from America, to be channelled to Sinn Féin through the Irish Republic drives a coach and horses through the UK’s financing rules that seek to prevent foreign influence on elections in the UK? This loophole needs to be closed for Northern Ireland to be brought in line with the rest of the UK.
I appreciate that this is a long-standing issue and a matter of concern. What I will say is that we have just introduced measures for transparency. It is important that we have some data as we move forward. Then, as with many other things, there is no reason why there cannot be a review. When that review takes place, there will be consultation with the Northern Ireland parties and the Electoral Commission.

Commons ChamberMay I start by paying tribute to Lord Melchett who, when he was in the House of Commons, was Peter Melchett? He did outstanding service to the nation when he was here. Indeed, he was a Minister of State in the Northern Ireland Office in 1976.
May I also say, Mr Speaker, that in the past 36 hours or so in Northern Ireland there have been three car crashes, which have taken the lives of four people? I am sure the whole House sends our sympathies and condolences to the loved ones of all those who have died.
The UK Government are determined to deliver the best deal for the whole of our United Kingdom, including Northern Ireland. We are committed to avoiding a hard border, including any physical infrastructure or related checks and controls, while maintaining the constitutional and economic integrity of the United Kingdom. We have proposed a comprehensive future partnership between the UK and the EU that would meet these commitments.
I thank the Minister for that response and for his tribute to Peter Melchett who, as well as serving in the Northern Ireland Office, was a good friend of mine, a lovely man and a passionate environmentalist.
Is it not the case that the backstop proposal is now just dead in the water? The Government are not going to get anywhere with it. A poll this week said that people in Northern Ireland would vote for a united Ireland if a hard border was put in place. Are not the Government sacrificing the Union on this altar? Would not the best solution be to move forward with plans to stay in the single market, stay in the customs union, avoid a hard border, and protect the people of Northern Ireland from Brexit?
I make it absolutely clear to the hon. Lady that it is our intention that there will be no hard border and no physical infrastructure. The people of this country voted in the referendum, and this Government’s intention is to make sure that we are not part of the single market or the customs union. The whole United Kingdom, including Northern Ireland, will be leaving those two institutions.
One of the reasons why a majority of people in Northern Ireland voted to remain was because they understood the consequences of leaving the European Union on jobs, livelihoods, communities and cross-border relationships—not simply economic relationships, but personal ones. Given the absence of a functioning Executive and Assembly in Northern Ireland, and given that the concerns of the people of Northern Ireland are evidently not understood by leading figures in the governing party in Westminster, what are the Government doing to ensure that the concerns and interests of the majority of the people in Northern Ireland are properly heard and represented at the negotiating table?
As far as the referendum is concerned, it was not a regional referendum but a national referendum, and the people of the United Kingdom took a decision to leave. On the hon. Gentleman’s second point, let me make it absolutely clear that we are committed to ensuring that the devolved Administration is up and running again. We are working very hard to ensure that that happens. He should remember that the last time Northern Ireland went into direct rule, that lasted for five years, and the period before that lasted for 25 years. It is very easy to slip down the road to direct rule, but we want to avoid that because it is important that local people have local representation that can be accountable locally.
On 27 June, Mr George Hamilton, the Chief Constable of the Police Service of Northern Ireland, told the Northern Ireland Affairs Committee:
“We do not know who is leading the multiagency response to the land border”.
What has been done to give clarity in the weeks since he made that statement? In particular, what proportion of the uplift to Her Majesty’s Revenue and Customs and the UK Border Force, as announced by the Government, will be assigned to Northern Ireland?
May I remind the Minister that in the December joint report on article 50, the EU agreed that the United Kingdom would make sure there was unfettered access for Northern Ireland’s businesses to the rest of the United Kingdom in all circumstances? Reports over the summer suggest that Mr Barnier appears to be devising creative solutions to try to get around the commitment that he made. May I ask the Minister and the Secretary of State to remind him that he signed up to those words and that we expect him to deliver on the commitments that he has made?
I am grateful to my right hon. Friend for putting that point at the forefront of our proceedings following the recess. He is absolutely right: Michel Barnier made the commitment; and the European Union and Britain signed up to the joint report in December. We intend to hold him to it.
May I bring the Minister back to the question asked by the Chairman of the Northern Ireland Affairs Committee, which he did not answer? The issue highlighted by the Chief Constable of the PSNI, which we have raised directly with the Prime Minister, is what extra resources are being given to prepare for Brexit. Those resources have been requested by the Chief Constable, since he has made it very, very clear that he has not had a fair allocation.
With the greatest respect, we are not asking about issuing guidance; we are asking about the allocation of resources. I really want to press the Minister on this issue, since it will have a very big impact on the resourcing of policing in Northern Ireland more widely. What are he and the Government going to do—this has been on their table for many months now—to allocate to the Chief Constable the resources that he needs and that he fairly has asked for?
I assure the right hon. Gentleman that my right hon. Friend the Secretary of State spoke to the Chief Constable this morning. We are in regular dialogue and we are considering the proposals that he has put forward. That is what I can say. We hope to come up with a solution in due course.
The Government are right to reject the EU’s proposals for a customs border in the Irish sea. Will the Minister remind the House of the balance of trade between Northern Ireland and the Republic of Ireland, and the Republic and Great Britain?
Two weeks ago, the Government published advice for UK businesses on the potential impact of a Brexit no deal. Unbelievably, businesses in Northern Ireland were asked to
“consider whether you need advice from the Irish Government about preparations you need to make.”
That is a quite extraordinary abdication of responsibility. Will the Minister confirm what involvement his Department had in the preparation of the advice, and will he commit to giving further assistance to businesses in Northern Ireland?
Clearly we have a responsibility as a Government to business people in respect of what we will do or what we intend to do, but we cannot speak for other countries. It therefore of course makes eminent sense for businesses in Northern Ireland that do deals across the border to consult so that they find out what is happening with other EU countries. The UK Government cannot speak for the Irish Government, so that dialogue is important.
How do the Government plan to ensure that our departure from the European Union is used as an opportunity to strengthen the Union?
My hon. Friend makes a very good point. We are leaving the European Union as four nations. It is absolutely clear that the economic and constitutional integrity of the United Kingdom will not in any way be compromised. In our negotiations with the European Union, we speak as the United Kingdom, not as any specific one of the four nations.
May I share the Minister’s sentiments about Peter Melchett and the recent loss of life due to the car crashes?
Tourism has been a success story in the years since the Belfast/Good Friday agreement, helping to transform the image of Northern Ireland throughout the world. It is therefore worrying that figures released in August show a 6% drop in visitors between January and March. The Prime Minister and most of her current and past Cabinets have barely set foot in Northern Ireland over the past two years, so may I suggest a group booking? Such a visit would help to end the drip of uninformed, unhelpful comments about Northern Ireland from the Government Benches that has become dispiritingly regular.
First, I congratulate the hon. Lady on her appointment to the shadow Northern Ireland Office team. We look forward to working with her in a constructive way.
It is important that we speak up for Northern Ireland and the rest of the United Kingdom as we leave the European Union. The hon. Lady talks about tourism. More people visit Northern Ireland now than before. They are spending more money and staying longer. The “Lonely Planet” guide has recommended Belfast and the Causeway coast as the No. 1 region in the world to visit. It is important to recognise the strengths of Northern Ireland and to build on them.
Northern Ireland has proved itself to be a top destination for inward investment from companies from the rest of the UK and also from overseas. Over 900 companies worldwide have invested in Northern Ireland, and I welcome this week’s announcement that PA Consulting will be creating 400 new jobs in Belfast. I firmly believe, however, that Northern Ireland can do even better, and we continue to work to restore stable, devolved government so that Northern Ireland can maximise its potential as a place to invest and do business.
I share the Minister’s enthusiasm. Northern Ireland is clearly a key driver of United Kingdom exports and will be even more important as we leave the European Union, so what steps is the Department taking to foster further investment and also to sell the opportunity of Northern Ireland as a top exporter around the world?
One of the fastest routes to a strong economy is through a healthy, growing export economy. The Northern Ireland Office is working with Departments across Whitehall, including the Department for International Trade, to maximise UK Government initiatives such as the GREAT campaign and the recently launched export strategy to promote exporters and help them to realise their potential. My right hon. Friend the Secretary of State and I regularly champion new investment announcements in Northern Ireland and promote Northern Ireland as a great place in which to invest and do business. That is something that was referred to in the Budget as well.
How on earth does the Minister expect to attract inward investment into Northern Ireland when we have not had a functioning Assembly for 18 months? We have a Secretary of State who said some months ago that she was “minded” to cut the salaries of the MLAs, but she has done absolutely nothing about doing so, so can the Minister give us some very good news today and announce a cut in MLAs’ salaries?
I am delighted to be able to give some very good news to the hon. Lady: in July US company Allstate, which is one of the many companies that are investing in Northern Ireland, opened Northern Ireland’s largest single office development for 15 years, investing £30 million. Allstate employs around 2,200 people in sites in Belfast, Derry and Strabane so, notwithstanding the present circumstances of not having a devolved Administration, the economy is looking up, business is coming in and we continue to try to get that devolved Administration up and running.
The people of Northern Ireland have a proud history of sporting achievements gained while representing both the United Kingdom and Ireland. It is for individual athletes, subject to the rules of their respective sport’s governing body, to decide which country they wish to represent. This Government are wholly supportive of this choice being maintained.
The Minister is, as he knows, quite wrong. A young Northern Ireland sportsperson who wishes to, for example, box for the United Kingdom has to move to Great Britain; otherwise, they have to box for Ireland. That is the case in other sports, too. The Belfast agreement said that everyone had the right to choose to be British or Irish. Surely this must apply to sport, and the Minister must do more about this because it is just not fair.
First, I pay tribute to the hon. Lady, who I know has taken a passionate interest in this subject; we have talked about it before. She will of course be aware that Northern Ireland has won serious medals at the Commonwealth games for boxing. The issue itself is a devolved matter, and is also an issue for individual athletes and their governing sporting bodies to take up. As far as the boxing association of Northern Ireland is concerned, I suggest that it continues its dialogue with the Ministry of Housing, Communities and Local Government.
Does the Minister agree that all sportsmen and women should have the right to represent the country they choose to, as long as they meet the eligibility criteria for that country?

Commons ChamberMay I start by paying tribute to Stephen Neil Heaney, who tragically died while taking part in the Belfast city marathon a few days ago? I think that the whole House will join me in conveying our deepest sympathies and condolences to his family and friends.
The implementation process for child tax credit is a devolved matter in Northern Ireland. To protect claimant confidentiality, the Department for Communities in Northern Ireland has established an exceptions team to handle any applications for benefit payments for a third child under an exemption to the two-child tax credit cap on the ground of non-consensual conception. The Department has advised that, to date, the team has received no applications for an exemption on the ground of non-consensual conception.
Many women say that they are put off applying for this abhorrent exception under the rape clause due to shame, trauma or perhaps fear. In Northern Ireland, women and those who assist with and endorse their applications, such as GPs, social workers and midwives, face an extra hurdle, as they risk prosecution under section 5 of the Criminal Law Act (Northern Ireland) 1967 for failing to report details of a crime. What is the Secretary of State doing to support women in Northern Ireland and protect them from that risk?
The hon. Lady raises a sensitive issue, which is being treated sensitively by all concerned. She will appreciate that criminal law is a devolved matter, but I can assure her that in the 50 years since 1967, when section 5 was introduced, no prosecutions for failing to report a rape case took place. The outgoing Director of Public Prosecutions has said that it would be highly unlikely that one would happen in the future.
I associate myself with the Minister’s remarks about the tragic death at the Belfast marathon in my constituency on Monday.
The Minister is right to indicate that this is a devolved matter, but we are implementing national policy in Northern Ireland. May I invite him to ensure that we operate this policy in the most compassionate and caring way possible? Will he meet a range of stakeholders including me, Women’s Aid, the Royal College of Midwives and others?
The benefits charity helpline Turn2us has evidence that women are choosing to abort and terminate their pregnancies as a result of this Government’s despicable two-child cap. The Northern Ireland Association of Social Workers says, despite the Minister’s assurances, that the law is the law and that women and those who support them in their applications could find themselves prosecuted under section 5 of the Criminal Law (Northern Ireland) Act 1967. Will he accept that the two-child policy, and the rape clause of which it stands part, is abhorrent and unacceptable, and will he support its abolition?
I repeat what I said earlier: this is a devolved matter. We have to respect—[Interruption.] The hon. Lady in particular, given that she is a Scottish National party Member, will want to respect the rights of the devolved Assemblies. Criminal law is a devolved issue in Northern Ireland. I say again that there have been no prosecutions at all as regards the rape issue in the 50 years since 1967 when section 5 was introduced, and that the outgoing Director of Public Prosecutions has said that it is highly unlikely that there will be any.
With support from this Government, Northern Ireland stands among the UK’s most popular inward investment destinations. We have increased the block grant in real terms, proposed a city deal for Belfast, with more to follow, and created business opportunities through our industrial strategy. Ultimately, however, political stability is key to economic growth, and that means a restored Executive delivering for the Northern Ireland economy. That remains my overriding priority.
I am sure that my hon. Friend and the rest of the House welcome the news of Bombardier’s investment in Northern Ireland. My constituency is dominated by small and medium-sized enterprises, and I am sure that the economy of Northern Ireland reflects that. What is his Department doing to ensure that SMEs also benefit from inward investment in Northern Ireland?
My hon. Friend makes an excellent point. He is right to point out the importance of small and medium-sized businesses, which do a fantastic job in Northern Ireland and contribute a huge amount to the local economy. I have met many of those small businesses, and I have nothing but praise for them. They have contributed to the 52,000 more jobs and 12,300 more businesses since 2010. The Government will continue to engage with organisations such as the Federation of Small Businesses and Invest Northern Ireland so that those small businesses can fulfil their maximum potential.
There is no progress on the border’s status after Brexit, which will crunch inward investment badly unless Northern Ireland remains part of the customs union. The alternative is a border in the Irish sea. Which is more likely: customs union or sea border?
I am afraid that the hon. Lady should deal with facts rather than what analyses say. If she took an interest in what the Belfast Telegraph has to say, she would have read on Wednesday 2 May the inside-page headline, “Top US software firm to create 50 new jobs in Belfast investment”. My hon. Friend the Member for Braintree (James Cleverly) has welcomed the new Bombardier contract, which is worth more than £500 million. I am afraid the facts are that business is continuing, and continuing to prosper.
One of the reasons why there is so much inward investment in Northern Ireland is the peace created by our soldiers, policemen and special forces, with whom I had the honour of serving in the 1970s. If we are to honour the bravery of people such as Robert Nairac and my other colleagues who lost their lives in the Province, the consultation should flatly say, “We are not having a conversation. We will protect our soldiers, putting them first and the terrorists second.”
If we are to maintain a stable economic environment for inward investment, if we are to have democratic oversight of decisions such as that of the Belfast Health and Social Care Trust to recall neurology patients and, indeed, if we are to have a legislature in Northern Ireland that is capable of changing the law for victims of rape who may fall foul of the UK Government’s foolish two-child policy, we need the Stormont Assembly back in action. Can we have a very clear road map from the Minister today setting out how the Government intend to get that Assembly back in operation?
I welcome the hon. Gentleman to his new position. Both the Secretary of State and I very much look forward to working with him constructively. He raises a good point about the need to have the devolved Assembly up and running again, and I assure him that the Secretary of State, the Prime Minister and I, and all those concerned, are very keen to do so.
We are doing an enormous amount. The hon. Gentleman will be aware there were intensive talks in February, when the two main parties in Northern Ireland got close but not close enough. We are not giving up. Indeed, my right hon. Friend the Secretary of State is having regular conversations with the parties. Only a couple of weeks ago she met the five main parties with a view to seeing how we can make progress and get the Assembly up and running.
The Government are committed to delivering a Brexit that upholds the commitments we have made to the people of Northern Ireland to uphold the Belfast agreement, and to avoid a hard border and any border down the Irish sea.
The Department for Exiting the European Union’s own impact report predicts an 8% hit to economic growth in Northern Ireland—a part of the UK that has long been less economically developed than others—after we leave the EU. Why are the Secretary of State and the Minister prepared to let Northern Ireland suffer, when they could avoid that by following the Labour party’s lead and committing to a new customs union?
The hon. Gentleman will be aware that the economic analyses of the past have not always been exactly accurate. As far as Northern Ireland is concerned, he might wish to reflect on the fact that as well as the huge economic benefits that I outlined in answer to earlier questions, over the past year exports are up by 9%.
Paragraphs 47 and 48 of the joint report identified the commitment to north-south and east-west co-operation. The Government have still not published the results of the mapping exercise on the 140 areas of cross-border co-operation. Will the Minister tell us when we can have the list demonstrating those 140 areas of co-operation?
Is the truth not that we have seen record foreign direct investment in the United Kingdom as a whole despite Brexit, and that when we leave, Northern Ireland will continue to be a top destination of choice for investment? After all, we do have the fifth largest economy in the world.
My hon. Friend is absolutely right to make the good point that we have one of the leading economies in the world. Leaving the European Union will be an opportunity for the United Kingdom to pursue a new path and trade policies that benefit us, and us exclusively. I agree entirely that we have a positive future outside the European Union. [Interruption.]
Can we have a little quiet so that I can hear the questions and the answers?
I am glad to hear what the Minister and the Secretary of State have said about the integrity of the United Kingdom. Will the Minister take this opportunity to reaffirm that whatever happens and whatever the effect of Brexit on Northern Ireland, the United Kingdom will remain together economically, politically and constitutionally?
Every right-thinking person should welcome that commitment, not only on the political front but economically, given that the vast bulk of sales from Northern Ireland go to the Great Britain market. Those who advocate separating out Northern Ireland into the customs union while the rest of the United Kingdom leaves it would inflict economic misery on all our constituents. Will the Minister take the opportunity to remind Leo Varadkar that when he talks about not leaving Northern Ireland behind, what he means is sucking Northern Ireland into the institutions of the EU, which would be economically disastrous for all our citizens?
Let me assure the right hon. Gentleman that the Prime Minister has made it absolutely clear that neither she nor any other Prime Minister would ever compromise the economic and constitutional integrity of the United Kingdom. That means that Northern Ireland is very much a full part of the rest of the country, along with Scotland, Wales and England. There is no question whatsoever of having a border at the Irish sea—none whatsoever.
I think the House recognises that I am a beacon of stability in an ever-changing Opposition Northern Ireland team. Sadly, I am always the bridesmaid.
The European arrest warrant is vital to policing in Northern Ireland—we all accept that—and enables the Police Service of Northern Ireland to co-operate with colleagues in the south. Many have commented that no visible progress has been made on the replacement of the critical EU policing frameworks that enable vital cross-border co-operation. Will the Minister outline what discussions his Department has had with Home Office colleagues about this vital issue, and reassure not just the House but the people of Northern Ireland?
It is good to see that the hon. Gentleman is still in his place and that there is some continuity in the shadow Northern Ireland team.
As far as the withdrawal agreement is concerned, a huge amount of progress has been made. The hon. Gentleman raises the very important issue of the European arrest warrant. The various Departments are all working together to ensure that we achieve the very best deal possible. Yes, the Northern Ireland Office is speaking with the Home Office to make sure that we get the very best deal in terms of protection and of the replacement framework that we will have when we leave the EU.
Order. Mr Speaker is attending the funeral of the late Michael Martin, who was Speaker of this House and a true family man who was committed to his community in Glasgow. I know that the House wants to pass on its prayers and condolences to his wife, Mary, and family.

Commons ChamberI too thank the hon. Member for Ealing North (Stephen Pound) for his kind words of welcome. He and I have worked together on a number of issues, but this is the first time we have met across the Dispatch Boxes, and I look forward to constructive engagement with him and his team.
On my hon. Friend’s question, this Government are committed to reaching our pledge of 3 million apprenticeships by 2020. Through our industrial strategy, we are committed to helping young people across the country to develop the skills they need for the future. My hon. Friend will appreciate, however, that delivering apprenticeships in Northern Ireland is a devolved matter. As such, that is another reason why we need to see a restored Executive up and running.
Employers in Northern Ireland recently told members of the Northern Ireland Affairs Committee that while there is no Northern Ireland Executive in place they are having to pay the apprenticeship levy but have no access to the funds to take on apprentices, because without an Executive the block grant is not being distributed. The apprenticeship levy in Northern Ireland is turning into a stealth tax for businesses. Does the Minister agree that this is another reason why we urgently need a Northern Ireland Executive in place?
My hon. Friend makes a very good point, and gives an excellent example of why it is so important that we have a devolved Assembly up and running again. Important decisions, such as the one she mentioned, need to be taken, and that is why we need the Assembly up and running as soon as possible.
It is worrying that we hear of the loss of apprenticeships, and yesterday we had an announcement that Williams Industrial Services in my constituency has actually gone into administration. What help will the Minister give us to ensure that we retain manufacturing and the apprenticeships there?
May I say at the outset that I am very sorry to hear about the position of the company in the hon. Gentleman’s constituency? I very much hope that the employers will follow all the legal processes by way of consultation and everything else that needs doing as far as the employees are concerned.
On the promotion of more jobs, it is clearly important that the devolved Assembly is up and running because it has a critical role to play. In the absence of such a devolved Assembly, however, I assure him that my right hon. Friend the Secretary of State and I are doing all we can. Indeed, only recently we met Invest NI with a view to seeing what is happening in Northern Ireland and what we can do to help.
One of the best apprenticeships programmes is run by Bombardier. Does the Minister agree it is fantastic news for those apprentices that the complaint against Bombardier has been soundly rejected?
I thank my right hon. Friend for her comments. It is very welcome news that the United States International Trade Commission unanimously agreed with Bombardier, and we very much look forward to working with Bombardier, which plays such a critical role in the UK economy, particularly in Northern Ireland.
We speak regularly with our counterparts in the Irish Government on a range of issues. In the joint report agreed with the EU at the December European Council, we reached an agreement that will maintain the common travel area. We also agreed that any future arrangements agreed between the UK and the EU must be compatible with the UK Government’s commitment to avoiding any physical infrastructure on the border between Northern Ireland and Ireland. We will continue working closely with the Commission to agree a legally binding text for the commitments made in December.
If the Government are committed to regulatory alignment on both sides of the Irish border, has it made it easier that the Prime Minister has declared that there will be no membership of the customs union or single market?
Does the Minister agree that once the UK leaves the EU we will have a duty to protect the rights of Irish citizens under UK law, through the common travel area, which predates Britain’s membership of the EU?
My hon. Friend makes an excellent point and is right that the reciprocal rights under the common travel area between the UK and Ireland predate either country’s membership of the EU. I can assure him that the joint report from last December contains a commitment to maintaining the common travel area arrangement.
A recently published European Parliament report has indicated that it will be possible to have a frictionless border after we leave the EU, but is the Minister not concerned about the friction in relations between the UK Government and the Irish Republic? Will he comment on the threat issued by the Irish Foreign Minister yesterday that he will block negotiations unless legislation is introduced to force the Northern Ireland Assembly to introduce EU regulations?
All the parties involved recognise that this is a difficult negotiation, but we are all committed to being flexible and coming up with innovative solutions. Our relationship with Ireland goes back centuries: trade, geography, history and so on. We have an excellent working relationship with Ireland. We hope to continue that relationship to secure the best solution possible to the issue of the border between Ireland and Northern Ireland.
Will the Minister confirm that whatever arrangements are needed to achieve a frictionless border between north and southern Ireland will apply to the whole UK?
My right hon. Friend the Secretary of State for Northern Ireland has regular conversations with Cabinet colleagues on a range of EU exit issues, including on an implementation period. We recognise the importance of negotiating an implementation period that benefits the whole UK, including Northern Ireland. [Interruption.] We welcome the EU’s agreement to negotiate an implementation period. The precise terms should be agreed as quickly as possible to provide vital certainty to businesses and citizens. [Interruption.]
Order. It is most unfortunate that neither the Minister’s mellifluous tones nor the content of his answer could properly be heard because of the number of private conversations. I think he deserves a more attentive audience.
Thank you, Mr Speaker. I grasped the word “negotiation” in there. Has the Secretary of State agreed a concession in those negotiations with the Brexit Secretary that will allow Northern Ireland to remain part of the single market and customs union, while the UK leaves, to avoid a hard border—yes or no?
I think that we are all a little confused about how the Government intend to avoid a hard border on the island of Ireland. The Minister’s Cabinet colleagues are falling over themselves to secure the maximum possible separation from the EU and the least possible realignment. Has he ruled out the idea of separate arrangements for Northern Ireland governing trade and commerce, or not?
Let me say again that the constitutional and economic integrity of the United Kingdom remains. We are in phase 2 of the negotiations, and these matters are currently being discussed. I am sure that all the parties—Ireland, the United Kingdom and the European Union—recognise the difficulty of the issue and will be as flexible and innovative as possible.
Does the Minister agree that it is about time the Government demonstrated a “no surrender” attitude to the EU bureaucrats who try to blackmail us and bully us over flights, passenger duty and everything else? Stand up to them, man! Stand up to the EU, and let us get on with leaving it. [Interruption.]

The Good Friday agreement was one of the greatest legacies of the last Labour Government. Is the Minister content that messing up the border issue could make destroying the Good Friday agreement one of this Government’s legacies?

Commons ChamberMay I congratulate the Prime Minister on her sheer determination and stamina in reaching the stage of having this joint report? To the extent that we do have an agreement in March 2019, and that thereafter, for many years to come, we do make payments to the EU as agreed, will she consider publishing the amount of money that we are not paying to the EU so that the British people can see the benefit that they are deriving in the years to come?
I thank my hon. Friend for his suggestion. I think that in due course we will be able to show not only the amount of money that we will not be spending through the European Union, but the positive ways in which we can spend that money here in the UK.

Commons ChamberObviously I am aware that that will be causing distress to Hayley while she is waiting for the appeal decision, and I am sure that the Secretary of State for Health will look closely at the case that the hon. Lady has raised. We were of course able to introduce the Cancer Drugs Fund, which has allowed some patients to have access to drugs that would otherwise not be available, but I recognise the concern and distress from which the hon. Lady’s constituent will be suffering while she waits for the decision.
The Prime Minister will be aware that under President Mugabe, British citizens living in Zimbabwe, especially landowners, suffered considerably. Can she assure the House that as we see a new regime coming to Zimbabwe, the British Government will do all they can to persuade that new regime to treat British citizens living lawfully in that country with respect, and to give them the safety and security that they should have, along with all other Zimbabwean citizens?
My hon. Friend has raised an important point as we see that change taking place in Zimbabwe. I think that the resignation of Robert Mugabe gives Zimbabwe an opportunity to forge a new path, free from the oppression that has characterised the past. We want to see a democratic, free, secure Zimbabwe, where people across communities throughout Zimbabwe are able to lead their lives without fear and oppression, and we want to see the country rejoin the international community. We have obviously given Zimbabwe some support in the form of UK aid, and, as the country’s oldest friend, we will do everything we can to support its change into a country that is free and democratic, and free of all oppression for all communities.

Commons ChamberMy party has a track record of ensuring that we do not have to contribute to propping up the euro. That is exactly what my right hon. Friend the previous Prime Minister negotiated with the European Union.
I welcome the Prime Minister’s statement and the progress she has reported to the House. I do not believe that EU citizens living in the UK should have the European Court of Justice as the final arbiter of any disputes when we leave the EU. However, to the extent that this matter remains on the agenda for Brussels, will she give an assurance to the House that Britain is demanding that British citizens living in EU countries have recourse to our Supreme Court and not the ECJ?
The point that my hon. Friend makes shows up the issue of which court should have supremacy over such issues. What I have said in relation to citizens’ rights, which is one of the issues that remain on the table, is that we will give certainty to EU citizens in the United Kingdom by ensuring that what is agreed as part of the withdrawal agreement is put into UK law. They will then be able to take cases to the courts here in the United Kingdom. Of course, it is the case that courts here in the UK look at judgments that have been made by other courts, not just the ECJ, in matters where they are relevant. The important thing is that it is through our courts that EU citizens will be able to take their cases.

Commons ChamberMay I congratulate the Prime Minister and the Government on undertaking this broad-ranging audit, which is long overdue. We know what the problem is, and we know what needs to be done to address it. However, given the huge scope of the audit, will the First Secretary of State inform the House what is proposed to ensure that there is consistency and a high level of monitoring across the huge breadth of areas covered?
That is a very good point. There are clearly different problems in different areas, which is precisely why, in addition to individual actions by Departments, there is an inter-ministerial group, which will allow every Department to find out what the others are doing and ensure that it is responding as it should to the individual problems assessed in their area. Of course, the audit is not a one-off event, because the figures will be added to continually so that new policy responses can be made to new problems as they emerge. It will be a living document.
