I congratulate the hon. Member for East Kilbride, Strathaven and Lesmahagow (Dr Cameron) on securing this important debate, because representation matters. It strengthens the media for it to be more representative of the people that it serves. As a white man who used to be a journalist, I am acutely conscious of the diversity, or lack of it, in some newsrooms. Diversity in the media influences society as well. One of the crucial points that the hon. Lady made is that the incidental presence of people with disabilities not talking solely about their disability on screen normalises something that should be completely normal. There has been progress on that issue, among many others, but it is important that the Government are realistic and say that there is more to do in this area. A huge amount of progress has been made, but there is no room for complacency.

Ofcom’s 2021 report on news consumption showed that TV was the most used platform for news consumption. Nearly 80% of over-16s get their news from TV, which is ahead of the internet, and yet TV has many of the problems that she describes. TV needs to be representative of the country in which we live, and to offer opportunities for people from all backgrounds to contribute and achieve—so too, of course, does the rest of the media. Evidence indicates that there remains a huge number of barriers preventing access to the media sector for under-represented groups. Those from working-class backgrounds, women and disabled people are among the most greatly impacted. Initiatives such as “Time’s Up” are hugely welcome, and it was welcomed by the Secretary of State at the time, but she also said at the time that there remained more for the industry to do to get to those shared goals.

To look first at gender representation and inclusion in the sector, it is a welcome development, of course, that three of our four main public service broadcasters are led by female executives: ITV, Channel 4 and Channel 5. However, to look at that one metric would lay us open to reasonable charges of tokenism, and that is not enough. There is increased visibility of women on screen in sports media roles—sports commentary and punditry roles—that have traditionally been dominated by men. That is hugely welcome, and I am sure that the hon. Lady also welcomes the increased coverage of women’s sports, which has seen the women’s Euro tournament hosted in England and getting publicity that it would never have received a few years ago. Although that increased visibility is welcome, it does not add up to equality, and it remains the case that women are less well paid and less likely to advance to influential senior positions than their male counterparts. The Government are keen to work with the industry to change that rapidly.

According to Ofcom’s five-year review of diversity in broadcasting, which was published last year, the representation of women in TV and radio workforces was close to or above 47% of the UK labour market, but the representation of women at senior levels falls to 42% for television and 43% for radio, which is close but not sufficient. Data covering the same period also shows that, for TV and radio, the proportion of women leaving the workforce was greater than those joining. Ofcom found that broadcasters were focusing on entry level recruitment at the expense of retaining diverse staff and enabling them to progress.

Whether it is women leaving the workforce or the lack of older people in general on screen or behind the camera, there remains much to do. Those imbalanced pictures perpetuate harmful stereotypes, which is also seen in the online abuse of high-profile female figures, which further exacerbates the problem of retaining talent. I know that the hon. Lady has experienced that and has spoken powerfully about it. We witness it far too often in public life, in the media and elsewhere. The Online Safety Bill seeks to tackle some of that, but nobody in Government is naive enough to pretend that it will be a panacea.

On the representation and inclusion of disability in the media, the evidence presents a more concerning picture. Disabled people are the most under-represented group in television; the industry is significantly failing to meet the targets that it has set itself for representation in the workplace on and off screen. Of course, the setting of those targets is hugely welcome, but meeting them is what matters.

Ofcom’s diversity report shows that the representation of disabled people in the TV and radio workforce in 2020-21 was less than half the UK benchmark of 19%, as the hon. Lady highlighted, and that even the highest-performing employers have a long way to go. At senior levels, disability representation failed to show any progress since Ofcom’s first diversity in broadcasting report was published in 2017; in the case of radio, the situation had actually got worse. Ofcom again found that in television, more disabled people were leaving the industry than joining. Although we should welcome all those initiatives, they are still not sufficient.

As the hon. Lady said, the highlight has to be Channel 4’s incredible coverage of the Paralympic games, and the broadcaster’s brave decision to have the team that it put in place. It was a resounding success and, in many ways, made more progress than anyone predicted in advance.

The Creative Diversity Network, whose members include public service broadcasters and Sky, collects on and off screen diversity data through its project Diamond, which found that only 8.3% of onscreen contributions in general were made by disabled people compared with, as the hon. Lady said, nearly 20% of the population. That lack of representation results in limited visibility and inaccurate and sometimes damaging portrayals of disabilities. In the excellent report from Underlying Health Conditions and Jack Thorne, “Everyone Forgot About the Toilets”, we see a lack of provision for disabled people at almost every level. It is the same in many walks of society, but the media have an ambition to go further and lead the way. As I say, that ambition is welcome but meeting it is what matters.

There are a huge number of challenges to be met if there are to be real improvements in disability representation, whether that be attitude, awareness, knowledge or inclusive and accessible work environments. They all need to be addressed and the Government are keen to work with the industry to do that. The work of the APPG is also an important step that I am sure will make a real contribution.

Barriers to careers in the media and creative industries start early. The Secretary of State has spoken of her desire to see improved access across the sector, recognising that this is a systemic issue that requires sustained collaboration from everybody. We welcome the work being done by the industry: a number of organisations have launched their own individual strategies, some of which have been highlighted today.

Ofcom has an important part to play in holding broadcasters to account through its statutory duty to promote equality of opportunity in relation to employment in the broadcasting sector in particular. It has the power to ask broadcasters to provide information about their equal opportunities policies and the make-up of their workforce. Its work in this area is important for increasing transparency and accountability and ensuring that the industry has the available data to support the case for change and measure progress.

The Government are committed to supporting the sector to achieve those improvements. The national disability strategy sets out our ambition to improve the lives of millions of disabled people, and DCMS is working closely with its seven disability and access ambassadors, including Allan MacKillop—I think he is well known to the hon. Lady—whose work includes introducing confidential access and inclusion passports to support better inclusion of disabled people across all major broadcasters, and delivering the Elevate and Extend programmes, which provide entry and mid-level placements for deaf, disabled and neurodivergent people on BBC shows. The forthcoming creative industries sector vision will set out the Government’s vision for addressing those barriers and making careers in the media and creative industries accessible to all.

Once again, I thank the hon. Lady for securing the debate. I genuinely commend her for her work on representing and championing those under-represented groups, particularly in the APPG. A huge amount more can be done, and the Government look forward to working with her and many others to pursue those important efforts.

Today, the Government are introducing the Data Protection and Digital Information Bill in the House of Commons. The Bill is being introduced after the Government published their response to the “Data: A New Direction” consultation on 17 June 2022.

We now have the opportunity to seize the benefits of Brexit and transform the UK’s independent data laws. We have designed these new updates to our data protection framework so it works in our interests, protects our citizens, and unburdens our businesses.

Through this Bill we will realise the opportunities of responsible data use while maintaining the UK’s high data protection standards. The EU does not require countries to have the same rules to grant adequacy, so it is our belief that these reforms are compatible with maintaining a free flow of personal data from the European economic area.

Our Bill will improve people’s lives in many different ways. Firstly, we are increasing fines for nuisance calls and texts that break the rules. Telecoms network providers will also be required to notify the ICO when they have reasonable grounds for believing that unsolicited direct marketing is occurring on their networks.

Reforms to the Privacy and Electronic Communications Regulations will also remove the need for cookie banner pop ups for low risk activities, such as audience measurement, so it’s easier for businesses to use information to improve their services. The Bill will also pave the way for the removal of irritating banners for other types of cookies when browser-based or similar solutions are sufficiently developed.

The Bill will bring some everyday physical processes into the 21st century. It will be easier and more secure to use digital identities, which give people more choice and greater security when they want to prove things about themselves online or via apps instead of with physical documents. We will improve Government data sharing to improve public services for businesses, and the Bill will also update the way births and deaths are registered by clerks, moving from a paper-based system to an electronic register used by officials.

Our reforms to data protection laws will mean that UK scientists are no longer needlessly impeded by overcautious, unclear rules on how they can use people’s personal data. We will simplify the legal requirements around research, which will provide scientists the clarity and confidence they need to get on with life enhancing and life-saving research.

We are reducing the burdens on businesses that have held the UK back from the benefits of greater personal data use before now. By focusing on outcomes not box-ticking, we will unburden businesses from prescriptive requirements and empower them to protect personal data in the most proportionate and appropriate way. Our changes could create around £1 billion in business savings over 10 years.

The Bill will sustain and scale the UK’s approach to supporting international data flows by capitalising on its independent status to strike partnerships with some of the world’s fastest growing economies. Reforms will ensure that the mechanisms to transfer personal data internationally are secure and flexible to help British businesses grow.

The structure and objectives of the Information Commissioner’s Office (ICO) will be modernised so that it remains an internationally renowned regulator, including increased investigatory powers to help it keep pace with changing practices. New strategic objectives will have an emphasis on economic growth and innovation, while ensuring the ICO continues to produce high-quality codes of practice, and has the flexibility to allocate its resources appropriately. The ICO will remain operationally independent while enabling the public and parliament to more effectively hold it to account through key performance indicators.

Reforms will also confirm that elected representatives may process general personal data where necessary for the purposes of democratic engagement activities. The intent is to allow MPs, councillors and political parties to undertake the democratic engagement activities they have done for decades—such as opinion surveys of local residents, and targeted letters to constituents—without the unnecessary complexity and confusion of the EU’s general data protection regulation. This builds on measures in the Data Protection Act 2018 which received broad cross-party support at the time.

The Bill will improve the efficiency of data protection for law enforcement and national security partners—encouraging better use of personal data where appropriate to help protect the public. Our proposed reforms create greater consistency between general, law enforcement and national security data processing. They will provide agencies with clarity on their obligations, boosting the confidence of the public on how their data is being used. These changes are vitally important for the work of our law enforcement and national security agencies who process personal data in the public interest, to prevent crime and safeguard national security.

New information standards for IT products and services supplied to the health and adult social care sector will ensure these are interoperable to make it easier for staff to access the information they need to help their patients.

The powers included in the Bill allow Government Departments to establish sector-based smart data schemes with supporting regulation, to ensure consumer and business protection. This is the secure and consented sharing of customer data with authorised third-party providers. These approved providers then use this data to deliver innovative services for the consumer or business, such as automatic bank account switching. This saves time, money and effort for customers who can more easily find and choose better-suited deals.

It is a pleasure to serve under your chairmanship, Mr Robertson, and it is a pleasure to be back, however briefly. I thank hon. Members for their kind words.

I feel that I should join the ex-journalist fest. As a former journalist, I never had the pleasure of working for the BBC, but my first job was to be paid to watch its output. I promise that, as a first job out of university, being paid to watch television is less fun than it sounds, but it is pretty unusual. Among a whole host of other things, I covered the launch of BBC iPlayer in 2007 as a journalist, and in some ways I think that tells us how far the BBC has come and how much it has changed since then. It is as much a technology company as a broadcaster.

The thread that runs through all of that period, and which predates it by some way, is the value of regional news output. I think that the continued preservation of that output is something we would all like to see the BBC look to. The Government would, of course, like to see it preserve and enhance its regional output as much as possible, but that is a matter for the BBC. We have all paid tribute to our local news organisations, but I could not stand here without mentioning the giant that is Peter Levy on “Look North”.

Turning to the substance of the debate, as the Secretary of State and many others have said, the BBC is a global British brand. The Government want the BBC to continue to thrive in the decades to come and be a beacon for news and the arts around the world. The royal charter, underpinned by a more detailed framework agreement, guarantees the BBC’s current model as an independent, publicly owned, public service broadcaster.

Has the Minister been struck, as I have, by the similarity between what we are asking for for local investigative journalism and how the brand operates at a global level? It seems that at the global level the BBC has appreciated that it can only achieve its aim by investigative journalism and working in small groups, which is to its credit. We see that every day on the television.

I wonder whether my hon. Friend has read my next paragraph. The value that we have seen recently from the BBC in the reporting on the crisis in Ukraine is not the whole story. We have to look at the huge value it adds in its heroic reporting and investigating of local issues just as much as its value on the world stage.

The charter and framework agreement set the BBC’s mission and public purposes, which establish the BBC’s responsibilities and what it must do. Those responsibilities include the provision of impartial news and information to help people understand and engage with the world around them—of course, that is a world that is experienced locally, nationally and internationally.

On 17 January, the Secretary of State announced in Parliament that the licence fee would be frozen for the next two years. The BBC will continue to receive around £3.7 billion in annual public funding, allowing it to deliver its mission and public purposes and continue doing what it does best. Under the terms of the charter, the BBC is operationally and editorially independent from Government—quite right, too. As Members have acknowledged today, there is no provision for the Government to intervene on the BBC’s day-to-day operations. That means that it is for the BBC, subject to Ofcom’s regulation, to decide how best to use its funding as it delivers its remit and meets its mission and public purposes. Of course, as my hon. Friend the Member for Aylesbury (Rob Butler) implied, as Ofcom is set up by the Government, there is a role for the Government within this. However, I have to stress that Ofcom regulates that aspect of the BBC, rather than the Government.

On 26 May 2022, Tim Davie set out his vision for keeping the BBC relevant and offering value to all audiences in the on-demand age, with a particular focus, as has been referred to, on a digital-first BBC. This included an announcement that while the BBC will maintain its overall investment in local and regional content, some services and bulletins will be merged or ended, as we have discussed today. In the BBC’s explanation for this change, it set out that a small number of changes to its regional TV output will help strike a better balance between broadcast and freeing up money to invest online.

The announcement also confirmed that the BBC will continue to support the local news sector through the £8 million it spends each year on the local news partnerships and the Local Democracy Reporting Service, and that it will increase investment in local current affairs by creating a new network of journalists to focus on investigative journalism in communities across England. Of course, the Government welcome the maintenance of support for the LDRS during this charter period. It is an effective model for collaborative working between the BBC and local commercial news outlets.

As the BBC’s independent regulator, Ofcom is responsible for setting out the regulatory conditions that it considers appropriate for requiring the BBC to fulfil the mission and public purposes that my hon. Friend the Member for Aylesbury referred to. Those conditions are set out in the operating licence, and Ofcom is conducting a public consultation on proposed changes to the current licence.

The Government firmly believe that public service broadcasting plays an important role in reflecting and representing people and communities from all over the UK. The BBC has a particular role to play and must ensure that it meets the responsibilities set out in its charter. That will be regulated by Ofcom, including through an annual assessment of the BBC’s performance.

Regional news and local current affairs play a vital role in bringing communities together—as the hon. Member for Cambridge (Daniel Zeichner) said—and providing shared experiences across the UK. In that context, we recognise the continued requirement for the BBC to produce and schedule regional news programmes on traditional platforms. The value of television remains immense; whatever the changing figures of its reach, for a large number of people, it is obviously hugely and uniquely valuable.

We also recognise that the remits of all PSBs, including the BBC, must be updated to reflect the rapidly changing sector, where that mixture of online and digital distribution is of increasing importance. We therefore welcome Ofcom’s consultation on the BBC’s operating licence to ensure that the BBC continues to be allowed to innovate and respond to changing audience needs through greater recognition of those online services. We look forward to seeing the consultation’s results in due course.

It goes without saying that the BBC needs to consider whether local news meets the needs of local communities. That is, of course, its ambition and what Ofcom looks to ensure that it achieves. However, in my own community for instance, people in Boston will think that Hull is a very long way away, just as people in Oxford and Cambridge may think they do not have much in common with the Isle of Wight, as the hon. Member for Cambridge pointed out.

Among the actions we are taking to support the sector, we have committed to a series of measures that we intend to deliver through a media Bill. It will support PSBs by updating decades-old rules to give them more flexibility in how they deliver on their remits across their services. They will also have their online prominence guaranteed.

While there are some excellent examples of effective news services provided by local TV, the picture is more mixed for local TV as a whole. A number of local stations have been granted permission by Ofcom over the past few years to reduce local news and local content production to sustain services. By the end of the year, we will consult on the process for licensing local TV after 2025, and will gather views on whether to offer renewals, and the terms under which they should be offered. We will consider whether to set minimum local news requirements as a condition of renewal.

The Government also fund the community radio fund, which gives grants to help fund the core costs of running Ofcom-licensed community radio stations, such as management and administration. As my hon. Friend the Member for Aylesbury mentioned, those radio stations reflect a diverse mix of cultures and interests and provide a rich mix of mostly locally produced content, typically covering a small geographical area. Their value in the mix cannot be overstated. However, specifically on the BBC, we are evaluating how the BBC and Ofcom assess the market impact and public value of the BBC in the local news market through the mid-term review.

To conclude, noting our manifesto commitment to support local newspapers as vital pillars of our communities, it is important, in a debate about regional TV programming, to consider the sustainability challenges faced across the broader local news market, and the extent to which the BBC can help. My hon. Friend will be aware that the Digital, Culture, Media and Sport Committee is conducting an inquiry into the sustainability of local journalism, and I look forward to seeing its report in due course.

We all know that the BBC is a great national institution; we all want to see it thrive. Over the past 100 years, as has been said already, it has touched the lives of almost everyone in the UK and made a unique contribution to our cultural heritage. The Government are clear that the BBC must continue to adapt if it is to thrive in the decades to come, but, of course, we all want to see it serve local, regional and international audiences to the best of its ability. I think we would all like to see it define that in ways that are understood by the general public.

The BBC needs to represent, reflect and serve audiences, taking into account the needs of diverse communities of all the UK nations and regions. It is vital that the BBC continues to meet that requirement, and it is vital that it is held to the highest standards in doing so. On that note, I congratulate my hon. Friend the Member for Aylesbury on securing the debate, which has been an important part of holding the BBC to those standards, alongside the work of Ofcom and others.

As the shadow spokesperson, the hon. Member for Manchester Central (Lucy Powell), said, this is a technical Bill, but it is hugely important and will make a real difference. It will build on the incredible speed of the gigabit roll-out programme—up to 65% from just 11% two years ago. That is, whether she likes it or not, the fastest roll-out in the world, delivered under the Minister, and indeed under her predecessor—but I will leave that to the rest of the House to judge. She is right, however, to say that we should be doing everything we can to go as fast as we possibly can. I humbly submit that setting the large number of broadband providers that operate in this country in competition against each other to get as much of the country connected as possible, is one of the ways that is delivering that incredible roll-out speed and I think she should welcome that.

None the less, it is important to make sure that the operators that seek to deliver the roll-out are able to access the land they need. My right hon. Friend the Member for New Forest West (Sir Desmond Swayne) made a passionate speech, possibly one that none of us was expecting in this kind of debate, in defence of landowners. Landowners are a crucial part of getting the roll-out right, but I say gently to him that there has been an incredibly successful lobbying campaign on behalf of those landowners, who, for a very long time, have had a very good deal. The 2017 proposals to cut the amount of money they receive, bringing it in line with other utilities—we could argue about whether broadband is technically a utility—was absolutely the right thing to do. It is what will speed up the roll-out programme.

I will let my right hon. Friend intervene in a minute. He talked about the benefit to landowners. When we get the roll-out right and get masts at as many locations as possible, the benefit accrues not to landowners primarily but to all the communities that live around them. That is where we should be focusing, not primarily on the small number of landowners who are concerned.

I am only interested in the lobbying of my constituents who have been so harshly affected. We have heard the stories of the 90% and 95% reductions in income. This has made things very much less expensive for the companies concerned. Where has that money gone? It has certainly not been invested in the programme.

My right hon. Friend does not make a wholly unreasonable point, but ultimately that money is going into an incredibly rapid roll-out of 5G. In rural areas in particular, we are seeing the industry putting in half a billion pounds of its own money alongside half a billion pounds of Government money to get to some of those hardest to reach places, so I fundamentally do not accept his premise, which is that the industry is not investing as it should. I would like the Government to go even further to see even more investment. He is right to focus on some of the small areas that rely on this income. However, that cannot be the main economic driver for the roll-out of 5G.

Does my hon. Friend accept that the reverse seems to be happening and that the roll-out seems to be slowing down? Does he also accept that this is a rather mature market of providers in an increasingly profitable arena, with ever-greater demand for their services from a growing population? Therefore, it may be worthwhile revisiting this de-incentivisation—obviously that was not the intention but it seems to be the result—to see whether restoring the proper remuneration that people had expected may speed up this much-needed roll-out.

Ultimately, I think reducing it in the predictable and long-announced way is what will speed up the roll-out. However, to give my hon. Friend and my right hon. Friend the Member for New Forest West, who is no longer in his place, a little succour, the industry should be on notice that if the currently voluntary dispute resolution system does not work and does not deliver fair settlements, perhaps the Government will think about giving the system some more teeth. There is a balance to be struck, and this Bill strikes it in the right way. However, there is another step that one could take.

My hon. Friend is being characteristically generous with his time. We had this sort of debate about the water companies and sewage. Unless their toes are held to the fire, they will exploit a system—I do not criticise them for so doing—for as long as they can. If the Government were more robust in bringing this forward as a clear commitment and making it binding and obligatory, that might help unblock the logjam.

Ultimately, I simply say, from a Conservative standpoint, that I would like regulation to be as light touch as possible. This is the right step down that road. It may be necessary to be more robust, but we are not there yet.

Moving on to “secure by design”, my hon. Friend the Member for Rushcliffe (Ruth Edwards) asked the Opposition which of the other 13 points they would bring in. This Bill introduces three of them, and they are immensely welcome, but they are the lowest hanging fruit when it comes to cyber-security. I would not jump immediately to all 13, and the world has somewhat moved on since the 2017 report to which she referred, but there is a clear direction of travel. I welcome how the Government are introducing the proposal, but the industry should be looking at what more there might be to do.

Finally, my hon. Friend also talked about cyber-security in a much broader sense than this Bill. A huge number of businesses will rely on cyber-security professionals in future to ensure that they are provided with the kind of security that they need and that which their insurance companies’ policies might require to guard them against the potential costs of hacking. In due course, some of the people operating in that profession will require greater regulation. The UK Cyber Security Council, which the Minister oversees, is welcome, but further regulation, perhaps in the manner of the Bar Council, is what will allow the cyber-security profession to grow, flourish and continue to preserve Britain’s place as a world-leading cyber-power, which we all want. This Bill helps us to get ever closer to that goal, and I commend it to the House.

I think that on Instagram I added that it is likely to be the last, because I cannot see a world—and I do not think many people can—in 2028 where individual households are paying an outdated fee which was established in 1922 to fund such an organisation; I do not think anyone could ever have seen what a digital landscape would be like today, what the viewing habits of young people would be like today or what the opportunities will be in 2028.

In some ways, the BBC is the best of global Britain, but in a globalised media landscape we know that there are people prepared to pay for Netflix, for all those subscription services, and for web services and for all the multitude of things that the BBC offers. Is it not daft that someone would suggest that the Secretary of State should stand up today and say that even from 2028 to 2038 people will have to pay for the whole lot, whatever they want?

I thank my hon. Friend for that contribution and for his contribution to the Department when he was there. He is absolutely right: it is not about whether we have our great British institution of the BBC, which is globally recognised—that is not the question. The question is that we live in a different world, people have different and changing viewing habits, and by the time we reach 2027—[Interruption.] When I started some of the negotiations—when my predecessor started some of the negotiations—TikTok did not even exist. We are moving rapidly to a different place, which is why we have to have the debate.

Let me start by commending the work of the Joint Committee. I do so in large part because it reflects the fact that, thankfully, there is precious little partisan politics in this area. There is huge agreement across the House.

I congratulate my hon. Friend the Minister. He is the latest custodian of what I fear will become the largest Christmas tree Bill in Parliament. We run the risk of presenting this piece of legislation as something that will fix the entire internet. When I was the Minister with responsibility for this matter, I felt two possibly conflicting things. The first is that our guiding and most important principle is that what is illegal offline should be illegal online. There are huge parts of this Bill where that need not even be a conversation. The cyber-flashing example is an interesting one, because flashing is illegal in the real world. The idea that it might not be illegal online is absurd. We should not even be having that conversation. There are many pieces of this Bill where, in fact, what is required is simply a tidying up exercise, reflecting the fact that our legislation has not kept pace with the changing nature of the digital world.

The second feeling that I had was that, in many cases, we had existing laws that did not even need as much modification as perhaps we might think. There is an important issue of the existing resources that the police allocate to online criminality. That is not to denigrate the fantastic work that the police do—of course it is not—but, too often, we will have had constituents who have gone to their local police forces and found that online crime is treated fundamentally differently. The Home Office is on board with addressing that, but it does need to change.

I am, however, fundamentally optimistic about what this Bill can achieve. We are now all agreed that it is only right that elected people regulate the public square, and the public square now firmly includes Facebook and Twitter, so it cannot be right that Mark Zuckerberg has more power than my hon. Friend the Minister, or, indeed, the Prime Minister of many countries. That cannot be right, and this Bill goes a long way to fixing that.

I want to touch on a couple of specific points. The first is that it is plainly also right that we should be regulating advertising at the same time as we are regulating other content. There has never been a doubt in the Government’s mind that that should happen, but, importantly, I know that there is some ambition to align the timetables of both of those pieces of work.

Likewise, the place of journalism online is incredibly important. We can overthink who is a journalist in the modern world, but we should be able to make some sensible progress on whether the self-regulated journalism that we have in this country adopts a different status online, and Ofcom, in its work in this Bill, should reflect that.

My final point on those specific issues is that I know that my hon. Friend the Member for Gosport (Dame Caroline Dinenage) and former Secretaries of State who spoke in the debate wanted the primacy of free speech of the individual to be protected in all the work that we have done in this Parliament. I know it is difficult to embed that in a Bill, but we must address the fact that, just as large numbers of people are—rightly or wrongly—genuinely hesitant about taking the vaccine, large numbers of people genuinely worry that the Bill will allow serious constriction of free speech online. For me, that potentially has a chilling effect, which we should all be concerned about.

I commend the Minister for how he has engaged with colleagues across the House. We need to communicate better about how the Bill will tidy up some aspects of the imperfections that I have mentioned and make a real change and difference to how people experience social media. Fundamentally, we need to be clear that the Government’s commitment to protecting free speech runs like a golden thread through the Bill and that the measure will not potentially undermine that. None the less, I think we all agree that the Bill will perform an essential function in an area that is essential to all aspects of modern life.

I will be brief, as much has been said already. However, I want to say a bit to my hon. Friend the Minister about Lords amendment 4. I also, by the way, want to recognise my hon. Friend the Member for Boston and Skegness (Matt Warman), who is no longer a Minister but who was in charge of much of the Bill’s passage. I thought that he did an excellent job. It is a very good Bill which is long overdue, and there is much to praise in it.

I think that Lords amendments 4 and 5 are worthy of a little more assessment. Lords amendment 4 does have merits, because it recognises that there is a real problem about diversification. The point that I was trying to make to the hon. Member for Newcastle upon Tyne Central (Chi Onwurah) earlier was not an argument against any kind of strategic review or industrial policies; it was the argument that if a nation is in a sense rogue, in terms of its ability to stay within the market, and subsidises companies deliberately for strategic effect, that is why the number of companies will fall from 15 to three in the free world, which is what happened in this case. I think the amendment is about the need to recognise the fact that diversification, if not pursued deliberately, will lead us into the hands of a country like China, which then forces us eventually to have only one vendor on price, because that country has subsidised it.

As for Lords amendment 5, I heard the argument of my right hon. Friend the Member for New Forest East (Dr Lewis), the Chairman of the Intelligence and Security Committee, but I would not regard this as “gilding the lily”. I do not much like lilies and I think they could do with a bit of gilding, but I think that this is more a case of locked doors, and if the amendment is about putting an extra door into the security panoply, I think it is important. I will be brief, but last year, along with many others, I had very strong arguments with the Government about Huawei, and we were disregarded, disregarded, disregarded. The Government even led out all the great security experts who told them that they could control everything, saying, “Don’t worry, we can manage the risk”—until it finally became apparent to them that they could not. We faced that at the time. Other Five Eyes members had already said that this was not on, but we seemed to disregard their views. So I simply say that this is not about gilding the lily; it is about reminding the Government that they must abide by these provisions.

I should also make the point that there are many other companies to which we should be giving real consideration right now, and which are being looked at and banned by the Five Eyes—such as Hikvision and ByteDance—and I urge the Government to think again about those as well.

I want to thank the various Members who have paid tribute to my small role in this Bill. I say simply to the right hon. Member for North Durham (Mr Jones) that I regard all reshuffles as an upgrade, so I welcome the Minister to her place. I mean that sincerely. I would also like to pay tribute to the officials—some of whom are in the Box today—who do not get enough credit for getting the Bill to the place that it is in. Ultimately, this is the Bill that will remove Huawei from our 5G network, and that is something that we should all welcome. It addresses a number of the issues that I raised and discussed robustly, as my right hon. Friend the Member for Chingford and Woodford Green (Sir Iain Duncan Smith) said, during the process of getting the Bill to this point.

As the current broadband Minister I can say that, as Members will have seen, across the country gigabit broadband is now at 47%, up from just 10% in November 2019. This Government will leave no stone unturned to get that number as high as possible as quickly as possible.

May I, too, offer my congratulations to my hon. Friend the Secretary of State on her very recent promotion?

I thank the Minister for his response. Residents of the newly built Parc Derwen estate in my Bridgend constituency, and others across the UK, have found themselves tied to disagreeable fibre providers and unable to seek competitive quotes due to restrictions placed on them by developers as they are laying infrastructure. What will my hon. Friend do to ensure a competitive market as we roll out gigabit broadband?

My hon. Friend is right that competition is a crucial part of a functioning broadband market. FibreNest, the company that he refers to, says that it is willing to let other providers use its networks, and it is a commercial decision for the company. It is important that all the right steps are taken to ensure that that promise becomes a reality, and the Government will work with him and the company to ensure that it does so.

It is very good to see my hon. Friend in his place at the Dispatch Box. As a rural constituency, Montgomeryshire is very reliant on the roll-out of Project Gigabit, which I welcome very much. Not only is that integral to increased speeds, but the backbone of that fibre network is key to our levelling-up ambitions. Does my hon. Friend agree that we need to deliver it at pace?

My hon. Friend is very kind; I hope that is not the kiss of death. He is right that, in areas such as Wales in particular, the power of levelling up through digital infrastructure is key. We have recently made positive announcements with the Welsh Government. We look forward to making more, and I know that Montgomeryshire will be a key part of delivering that mission.

I congratulate the Minister on retaining his position and welcome the new Secretary of State to hers. The Minister’s is a wide-ranging and critical role, not least because we need our broadband. Parliament, our businesses, our students, our economy and our social lives depend on it—but it is another broken promise. Full fibre by 2025 was the Prime Minister’s pledge, and the 2020 Budget set aside £5 billion to deliver it. Will the Minister confirm that only £1.2 billion of that £5 billion is planned to be spent by 2025 and that, far from full fibre, we will not even get affordable broadband? According to Ofcom, more than 2 million households find it hard to afford broadband, yet the Government are slashing broadband price controls, slashing the broadband budget, slashing universal credit support, and slashing gigabit targets. When will we get the broadband we need?

Absolutely, Mr Speaker.

The fact remains that this is a £5 billion commitment to getting as close to 100% broadband across this country as fast as we possibly can. The only barrier to doing that is the speed with which we can dig up the roads and lay the cables. This Government will do every single thing we can to make sure that every single barrier is removed in order to spend every penny of that £5 billion as quickly as we possibly can.

The Government are committed to tackling online fraud. That is why, later this year, we will be consulting on the online advertising programme, which is considering all options, including legislation, to tackle paid-for advertising online. Meanwhile, the draft online safety Bill, which is currently in prelegislative scrutiny, will address fraudulent user-generated content.

Paid-for scam adverts are rife online, and it is not unusual for people to lose their entire life savings to them. The Prime Minister told the Liaison Committee in July that

“one of the key objectives of the Online Safety Bill is to tackle online fraud,”

but the Bill as drafted does not cover paid-for scam adverts at all. I am pleased that the prelegislative scrutiny Committee is going to take a look at this, but will the Minister review the Department’s currently indefensible position? We cannot wait years for the other process that he referred to to work its way through the system.

The right hon. Gentleman is right to raise a hugely important issue. I and this Government share his impatience to tackle it, but that is why we are talking, through the online advertising programme, about looking at every single option, whether it is to tackle user-generated content through one mechanism or, potentially, advertising through another. It is about getting that combination of measures right so that we can achieve the maximum possible effect.

In line with the whole issue of fraudulent adverts, there is also the big issue of the appalling behaviour of gambling companies and their advertising, which causes huge problems and addiction for many young people. May I, through the Minister, ask the new Secretary of State whether she would take a meeting with families bereaved as a result of gambling addiction?

May I, too, extend a warm welcome to the new Secretary of State and the new Minister? I hope that, as Digital Secretary, she has changed her parliamentary password.

Online fraud is a growing goldmine for fraudsters and online child abuse is a growing goldmine for paedophiles. Latest figures from the National Society for the Prevention of Cruelty to Children and the Internet Watch Foundation show a 70% increase in sexual communication offences with children, and a 77% increase in self-generated child sexual abuse material. Why are the Government still stubbornly and inexplicably refusing Labour’s call and the NSPCC’s call for the immediate implementation in the online safety Bill of personal criminal liability for senior tech executives whose actions consistently and significantly put children at risk? We already have such a legal regime that works in financial services and in health and safety. There must be a compelling reason why the Government refuse to do the same to protect our children online. Can the Minister tell us what it is?

As the hon. Lady knows, the Bill is going through the pre-legislative scrutiny process. We are entirely aware of the issues she raises. The aim of the Bill and the aim of the Government’s approach will always be to take the most effective attitude to tackling them. As the Bill goes through that process, we will of course continue to look at all the options, but our priority will be the effectiveness of the legislation. A mechanism may well work well in other industries, but that does not necessarily mean we should copy and paste it into another.

As I am sure the hon. Member would agree, youth services play a vital role in supporting young people, and the £500 million youth investment fund remains a manifesto commitment. It builds on more than £12 billion given this year to local authorities, who have the statutory duty to allocate funding to youth services in line with their local needs. Detailed plans for the fund are subject to the 2021 spending review, which, as she knows, will be coming later in October.

Will the Minister join me in welcoming the innovation and expansion we have seen in the Scouts this week with the launch of the Squirrels, which will open up Scouting opportunities for four and five-year-olds? The sector is hugely innovative, but it is also really struggling financially. It has been two years since the £500 million youth investment fund was announced, but not a penny has been spent. Can the Minister tell the sector when it can expect that money to come forward, or whether the Government have raided our children’s piggy banks?

We all, I am sure, have Scout troops in our constituencies to which we would pay tribute, and the expansion is hugely welcome. I admit I was hoping that the Secretary of State would answer this question so that I could say “from one red to another”, although maybe not in the full range of meaning of that term. I am the secretary of the National Union of Journalists parliamentary group. NUJ members are concerned about the future of public broadcasting, because of the sale of Channel 4, because of the 25% cut that has already been incurred at the BBC and because of reports that the Government are considering refusing even an inflation-rate increase in the BBC licence fee. Will the Minister meet a delegation from the NUJ parliamentary group to discuss these concerns?

What assessment has she made of delegating the decision on what is harmful and what is not harmful to the online platform providers?

The fact is that the Online Safety Bill does not delegate that decision to online platforms. What it does is define the harmful content that companies must address. The Government will set out the categories for those harmful contents later. Companies will need to ensure that children are protected from any content that meets this definition, and that will clearly be directed by Government; it will not be delegated to them.

We know that the new Secretary of State has set out her own views and interpretation of racism online, because she has written about it, so I am sure she will remember what the Prime Minister said about the torrent of online racist abuse against England footballers on 14 July. This is what he said:

“Today we are taking practical steps to ensure that the football banning order regime is changed, so that if a person is guilty of racist online abuse of footballers, they will not be going to the match—no ifs, no buts, no exemptions and no excuses.”—[Official Report, 14 July 2021; Vol. 699, c. 362.]

I am really pleased that the Prime Minister heeded my call to extend banning orders to online racism. Can the Secretary of State tell us exactly what practical steps have been taken to change the football banning order regime since 14 July?

T3. May I also offer my congratulations to the new Secretary of State? In Eastbourne, the ambition for a mixed augmented reality studio is beginning to take shape. What would this mean? Skilled jobs, an injection into the hospitality sector and keeping us at the forefront of film-making. What support can the sector and MediaBite, the project lead, anticipate from the Government, and will the Minister join me in wishing them well in their endeavour and in their bid to Innovate UK?

I absolutely join my hon. Friend in endorsing that bid. It is a key ambition of this Government to ensure that augmented reality and all those future technologies are made a reality not just in London and the big cities but across the whole country, so Eastbourne is a real opportunity. I would be happy, for instance, to facilitate a meeting with the BFI or something of that nature in order for her to help to pursue this endeavour.

I would also like to welcome the Secretary of State to her place. I have been glancing at her oeuvre, and now is perhaps not the time to discuss the alarming dumbing down she once identified in the once highbrow artform of panto or, indeed, to ponder her long anti-gay rights voting record. Just as well there are no homosexuals in the arts sector.

Instead, let us continue to focus on Afghanistan. We know the Taliban respect only violent power. They care nothing for culture or heritage. UNESCO is monitoring the evolving situation, focusing on the universal rights to education, freedom of expression and heritage. Does the Secretary of State agree that the women standing up for their rights and national culture in street protests are extraordinarily brave? Will she outline what the UK Government will be doing to protect all those who feel abandoned in Afghanistan, whether they are women, LGBT people or minorities who fear for their lives and futures?

T5. Last year there was full gigabit-capable broadband in just 13% of households in my Eddisbury constituency. Thanks to UK Government initiatives such as the rural voucher scheme, the figure now stands at 47%, but we still have a long way to go, which is why I am launching a survey of the broadband and mobile coverage of my local residents to find out where the notspots are. Will the Minister agree to meet me to assess that survey and to discuss what more can be done to ensure that we get full coverage right across the constituency?

T2. The lockdowns during the pandemic have brought into sharp focus the stark digital divide in our country. Despite Government promises, 1.9 million households still do not have internet access, and many more, including in my Slough constituency, rely on expensive pay-as-you-go services. Is it not about time that the Government finally bridged this divide?

The hon. Gentleman is right to highlight the need for affordable broadband and mobile access, which is why this Government have worked with the companies during the pandemic and since to make sure there are social tariffs so that cheaper products are available. Such tariffs are a crucial part of making sure everyone has the access we all need in the 21st century.

It is an honour to respond for the Government in this important debate and I congratulate the hon. Member for Bermondsey and Old Southwark (Neil Coyle) on securing it, but I hope the whole House will agree that it is right to turn first to the extraordinary speech from the new Member, the hon. and brave Member for Batley and Spen (Kim Leadbeater). She spoke movingly about her journey to this place, what it means to be here and her passion to diligently represent the area that she loves and that Jo Cox loved too. If I may, I will pick out two areas of her speech specifically. The first is what she said about public service.

Every day in this Chamber we see that, for doing this job, some Members of Parliament have made the ultimate sacrifice. We all, in one way or another, make sacrifices doing it, but there are too many shields on these walls. We all know, though, that Parliament, this place, is where we can make the lives of our constituents and this whole country greater still. As the hon. Lady said, both she and her sister sought to reach across party lines to do that. We are strongest when we can make that work and when we can “crack on and get stuff done”, as she said. In so doing, perhaps we will make the divisive, damaging, fractured politics that we have seen in recent years a little bit less painful. Over the last few years, we have lived through some of the most polarised times in British politics. From the tone of today’s debate, we all think that we should do better. I know from speaking to Members across this House that Jo Cox worked across party from the moment she was elected, and I know from speaking to the hon. Member for Batley and Spen herself before this debate that she will continue that legacy. We have, as so many have said, more in common than that which divides us, wherever we sit in this House. We forget it too often.

The second thing to say is that while this debate is not focused solely on the Jo Cox Foundation but on her legacy as a whole, it is the foundation that will ensure that so much of that work lives on. Legacies are always about the future, not the past. Those values of stronger communities, a better public life and a fairer world are all things that the past 18 months have shown to be more vital than ever. Whether that is, as Jo put it herself, to

“turbo-charge the public’s awareness of loneliness”

or to tackle the scandal of online hate, this Government are committed to tackling the issues that the foundation is involved in. That is because those issues mattered profoundly when she identified them and they still matter profoundly today. I could talk at great length about how the Government are supporting the superb initiatives that have been mentioned a lot today, including the Jo Cox memorial grants and the Jo Cox Foundation’s Great Get Together campaign. Collectively, Jo’s legacy is already benefiting tens of thousands of people across the world, but I will highlight three areas.

The first is intimidation in public life and the behaviour that can stop talented people, particularly women and those from minority backgrounds, standing for public office. We recognise that in the past several MPs have referenced abuse as a reason for standing down. To humanise that, it means there is hardly a woman in Parliament who has not received a death threat, even though many men have not. It means the police judge that we need security in our homes, and it means an emotional toll on our families who worry that this job poses far more risk than it is worth, as the hon. Member for Washington and Sunderland West (Mrs Hodgson) said.

For all those reasons, and more, the Government are taking action to tackle this culture. I do not think that today is a day to introduce partisan politics, but let me say simply that the need to tackle intimidation of every sort drives the Government’s agenda, from online safety to defending democracy.

Secondly, as Jo said:

“Young or old, loneliness doesn’t discriminate.”

The covid-19 pandemic has, as so many Members have today, highlighted the importance of social connection to everyone across society. I pay tribute to my hon. Friends the Members for Chatham and Aylesford (Tracey Crouch) and for Mid Sussex (Mims Davies), and our former colleague Seema Kennedy, for all the work they have done on loneliness.

The Government are proud to have continued to play our part in building on the pioneering work that Jo Cox started. The Jo Cox Commission on Loneliness carried out invaluable work that informed the Government’s 2018 tackling loneliness strategy—the world’s first Government strategy of its kind. It evolved into nearly £50 million of investment, the world’s first loneliness Minister and huge progress in destigmatising an issue on which there remains so much to do.

Thirdly, Jo Cox’s work had strong roots in her local area. Like Jo, we believe that local people understand what is needed in their community, be it local and grassroots action on tackling loneliness or on a host of other issues. We can all take action, no matter how small, to reach out with kindness to those around us, and we should never underestimate the huge impact that can have in our communities.

The hon. Member for Bermondsey and Old Southwark was the first, but by no means the only, Member to mention the importance of family to Jo and the hon. Member for Batley and Spen. It is great that the family join us today in the Gallery. There are clearly some formidable genetics up in the Gallery, and I worry that there are now some formidable genetics on the Opposition Benches. It was kind of the hon. Member for Bermondsey and Old Southwark to invite us all to Bermondsey for another Great Get Together.

My hon. Friend the Member for Chatham and Aylesford and the hon. Members for Coventry North West (Taiwo Owatemi) and for Enfield, Southgate (Bambos Charalambous) mentioned loneliness. One of the things I suspect the hon. Member for Batley and Spen will learn is that Thursday afternoons are a particularly great opportunity for Back Benchers to press the Government to take action on a host of issues, and she saw an adept way of doing that from my hon. Friend the Member for Chatham and Aylesford.

The hon. Member for Batley and Spen may also learn that she will not always get the straightest and most immediate answer from the Dispatch Box, but my hon. Friend the Member for Chatham and Aylesford knows that both the issues she raised are under serious consideration by the Government and that her views are shared elsewhere. Those two issues, particularly social prescribing, are hugely valuable.

Among other things, the hon. Member for Batley and Spen might learn from my right hon. Friend the Member for Sutton Coldfield (Mr Mitchell) that it is genuinely true that friendships go across parties, and I hope we can continue that. She may also learn that there is no place in which she cannot promote a book, but that is a separate issue.

My hon. Friend the Member for Tonbridge and Malling (Tom Tugendhat), who is no longer in his place because he is carrying out his duties as Chair of the Foreign Affairs Committee, made a genuinely important speech about why we are all here. I think we all value his contribution. We can all learn how to turn being late into a politically useful point, too.

The hon. Members for Aberavon (Stephen Kinnock) and for Wirral South (Alison McGovern) talked powerfully about the persistent emotional impact of Jo’s presence and about her internationalism. We all learned even more than we had from previous tributers about the ongoing impact Jo has had on so many people.

My hon. Friend the Member for Devizes (Danny Kruger) spoke about the value of debate, which is why we are all here. The hon. Members for Erith and Thamesmead (Abena Oppong-Asare) and for Canterbury (Rosie Duffield) talked about the value of the Labour women’s network, highlighting the progress that has been made in this House and, indeed, in the Labour party on improving diversity. We all share those ambitions, and I can think of a couple of Tory Prime Ministers who would definitely agree.

My hon. Friend the Member for Wealden (Ms Ghani) talked about the value of leadership, which she has shown on a number of issues, and I know she will continue to do so.

Turning finally to the contributions of the hon. Members for Glasgow North East (Anne McLaughlin) and for Glasgow Central (Alison Thewliss), both talked about cheering the result in Batley and Spen. I must confess that it is easier for a member of the SNP to cheer that result than it is for a member of the Conservative party, but that does not mean that we cannot celebrate the arrival of the hon. Lady and all her qualities.

The Government are proud to continue the legacy that we have discussed today. Whether it is through supporting women and girls internationally through the Jo Cox memorial grants, working at a national level to address intimidation in public life and tackle loneliness or supporting people to connect in their local communities, we continue to be inspired by the life and the work of Jo Cox and her belief in a kinder and fairer world for everyone.

I want to end by saying simply one thing: we have heard powerful speeches today watched by honoured guests in the Gallery, and I know that there are others, including the former Prime Minister, my right hon. Friend the Member for Maidenhead (Mrs May), who had hoped to be here, too. Today has been an exceptional parliamentary moment and that is because we have been here to commemorate an exceptional life. We see that shield in this Chamber every day, a pointed reminder that Jo Cox’s legacy is permanent in our minds and in this place. I know that the hon. Member for Batley and Spen will do justice to it and we should all work to honour it as well.

I am pleased to inform the House that the Government are today publishing a public consultation on enabling legislation to strengthen digital identity use for the whole economy.

More and more people, in all walks of life, are using products and services online. People expect these transactions to be simple, quick, safe and personalised. However, people in the UK often still have to use a combination of paper documents issued by Government, local authorities and the private sector—and a mixture of offline and online routes—when opening a bank account, claiming benefits, starting a new job or applying for a school place. And these steps often need repeating for each new transaction.

Voluntary online authentication, identity and eligibility solutions can increase security, ease of use and accessibility. They are central to transforming the delivery and efficiency of public services and people’s ability to operate confidently in an increasingly digital economy.

The Government are committed to realising the benefits of digital identity technologies without creating ID cards. We have committed to put in place the necessary framework and tools so that digital identity solutions enhance privacy, transparency, confidence and inclusion, and that users are able to control their data, in line with the principles published in the 2019 call for evidence response.

In our response to the call for evidence, we committed to enabling businesses and individuals across the economy to use digital identities securely and with more confidence. This is only achievable by putting in place a legal framework and regulatory infrastructure.

The consultation DCMS is publishing today follows up on that commitment. It sits alongside the UK digital identity and attributes trust framework, which was published as a first draft in February 2021, opening the way for legislation. Digital identity legislation is needed to underpin a governance framework in law, to enable Government to allow checks by industry against data it holds, and to create confidence in the validity of digital identities. We have worked extensively with industry, civil society, and academia to get to this point.

The consultation sets out our plans to create a digital identity governance framework. Creating a governance system which can build trust in digital identities is vital. This trust will drive innovation and growth in the UK economy and good governance will ensure that the digital identity and attribute principles are upheld.

We are also consulting on our intention to create a permissive legal power for Government-held attributes to be checked safely and securely by non-public sector organisations for eligibility, identity, and validation purposes. This will allow digital identities in the UK to be built on a greater range of trusted datasets and ultimately provide people with a choice of how they use this data to prove their identity.

Finally, we are proposing to establish in law that digital identities and digital attributes can be as valid as physical forms of identification or traditional identity documents. This builds on our commitment to enable the use of digital identities in as many areas as possible and to build confidence in their validity.
