To ask His Majesty’s Government what steps they have taken to aid and support the women of Afghanistan since the departure of United Kingdom armed forces.

My Lords, we prioritise support for women and girls in response to the Taliban’s repression. We have repeatedly urged the Taliban to reverse harmful policies. I assure the noble Lord that we raise these issues internationally. I regularly meet Afghan women and leaders to hear their concerns directly. Since April 2021, the Government have disbursed more than £532 million to Afghanistan, giving 2.3 million women access to food, healthcare and other essential assistance. At least 50% of beneficiaries of UK aid are women and girls.

I thank the Minister for that Answer. However, the Taliban have targeted women and girls by using decrees which place severe restrictions on freedom of movement, expression and association, prohibitions on virtually all forms of employment and bans on secondary and higher education, as well as permitting arbitrary arrests and violations of the rights of liberty. Taken together, that is arguably a crime against humanity based on gender, so what further actions can the Government take to support women human rights defenders who seek safe passage to the UK because their lives are under grave threat?

My Lords, I believe that I speak for most noble Lords but I believe on a point of principle that the humanitarian support that we have given to the people of Afghanistan, supported by Pakistan, Uzbekistan and other near neighbours, has been the right approach. We cannot discard over 36 million people. We have also sought to provide support for those who are most vulnerable, those who work directly with the United Kingdom, through the various schemes that we have run—the ACRS pathway 3 and the ARAP. Those schemes support their access to the United Kingdom, particularly Chevening scholars working within the security firm GardaWorld but also those who worked within the British Council. That still is work in progress on year 1.

There is a lot more that we can do but we directly address the Taliban and say that what they are doing is not just against our assessment of human rights but against the assessment of the very faith that they claim to follow. Rights of women are human rights and the Taliban need to uphold them.

My Lords, I thank the Government for the moral support that they have offered to the Afghan women so far, particularly my noble friend the Minister, who has consistently met them. However, can he please tell me how the UK Government will help those Afghan women to be part of any international talks and able to play a part in the future of their country?

My Lords, I thank my noble friend for her kind remarks. As I say, it is about doing your job, but I pay tribute to her and to all other noble Lords who have worked collectively on this important agenda. There is no easy solution, but I assure my noble friend that we are working directly with leaders from various representative groups of women in Afghanistan and more broadly too. We continue to engage with key personnel on the ground in Afghanistan who were previously involved within administration while it was still functioning, but equally we are working with key international partners, notably Indonesia and Qatar among others, to ensure that the issue of Afghanistan is kept on the front burner and that inclusivity—the restoration of women’s rights and all rights, including minority rights—is not forgotten.

My Lords, the Minister will be aware of the growth of cluster education, or cluster classes, whereby groups of secondary school girls gather in neighbourhood houses and qualified teachers visit them. The scheme with which I am involved is now educating upwards of 1,000 girls in three provinces in Afghanistan. In a very few cases, local Taliban commanders have asked whether their daughters can join those classes. Is this something that the UK Government would support, since it is often difficult for those international aid agencies operating in Afghanistan to do it as it runs right across the policy of the Taliban? Maybe the UK has got a channel for funding this kind of education.

My Lords, recognising the important work that the noble Baroness has done, of course we fully support such initiatives. As she will know all too well, we protect the agencies that we work with on the ground to allow them to continue their important work, particularly when it comes to girls’ education. In our general assessment, there are now six to eight regions within Afghanistan where, because of the fragmented structure of the Taliban, there are initiatives which allow health access but also allow women in certain respects to go to work and allow girls to be educated.

My Lords, I also pay tribute to the Minister, who has personally worked tirelessly to help Afghan refugees fleeing the brutality of the Taliban. His commitment is well documented.

Do the Government accept that the deteriorating situation for Afghan women, as we have heard, amounts to gender persecution, which is a crime against humanity? This has happened in plain sight of the world over the last two years. What global support is taking place, such as we had in 2001 when the world rallied behind the cause of Afghan women? If Afghan women’s rights were important in 2001, surely they are just as important in 2023? What support is taking place globally to bring this gender apartheid, or gender persecution, to an end?

My Lords, recognising the important work the noble Baroness has done in this respect, I think I speak for everyone in saying that what is happening in respect of the rights of women and girls in Afghanistan is abhorrent. It is against the very traditions of the faith that the Taliban claim to follow; it is not right, it is simply wrong. That is why we are working with key partners within the Islamic world—for them to seize back the narrative on empowerment of women and girls’ rights and education. On our specific support, we are working with key agencies. I have already alluded to the figures but—just to share with the noble Baroness—we are supporting 4.2 million people with food assistance, of whom 2 million are women and girls. The issue of nutrition is high on our agenda, as well as empowering them through education.

My Lords, can the Minister tell the House how many Afghan interpreters who have been relocated to the UK have wives still awaiting security clearance in Afghanistan so that they can join their husbands here, as they are entitled to do? They are very likely to be living in vulnerable situations while they wait; even living in hiding. Perhaps the Minister could write to me if he does not have this figure to hand today.

My Lords, I assure the noble Baroness that I keep abreast of figures on a weekly basis, but I do not go into specific details at the Dispatch Box for the sole reason of protecting those vulnerable individuals. We have seen a large number of interpreters arrive in the UK and there is an issue about supporting family members. Where I can, I will share the specifics with the noble Baroness.

My Lords, perhaps by a slip of the tongue the expression “gender apartheid” was just used by a previous speaker. Increasingly, that terminology is used by Afghans who are here in exile, by the international community and by lawyers. A great deal of research has been done in support of it by South African lawyers, because apartheid means denial of participation in society—keeping apart. I wonder whether that is language that is accepted, and might be used by, the Foreign Office and whether the full force of the Foreign Office could be put behind amending the Rome statute so that it included gender apartheid as a crime against humanity.

My Lords, the noble Baroness with her legal background has far more insights into the technicalities and changes that she is proposing, but I can say to her that what is happening to women and girls in Afghanistan is nothing short of abhorrent and we need to do our utmost to ensure that we stand up for their rights and afford them the protections that we can. I assure the noble Baroness that we are working in a very focused manner on that objective.

My Lords, regrettably but perhaps understandably, there are still a large number of women in neighbouring countries, not least Pakistan, waiting to find somewhere to start their lives again. Many are former high-ranking officials, human rights defenders, policewomen or women connected to the police and politicians. Can my noble friend the Minister, who I know takes an enormous interest in these matters and I congratulate him on so doing, reassure this House that none of those women will be forcibly repatriated to Afghanistan against their will? If they are, many of them will meet a bleak future.

My Lords, I thank my noble friend for his remarks and I assure him that we are working very closely with the neighbouring Governments to Afghanistan, particularly Pakistan. Notwithstanding the change of Administration in Pakistan, they have been very supportive of our efforts to sustain and retain the people who have sought refuge there while their immigration status is finalised. Vulnerable women and girls are at the forefront our work in that respect.

My Lords, sanctions by the United Kingdom and its international partners have starved Russia of key western goods and technology, degrading Russia’s military and restricting its capacity to fight a 21st-century war. UK exports of machinery and transport equipment have decreased by 98%. Sanctions also limit Russia’s financial resources. The UK has sanctioned 29 Russian banks, accounting for over 90% of the Russian banking sector. We have also frozen over £18 billion-worth of Russian assets in the UK. Without sanctions, we estimate that Russia would have over $400 billion more to fund its war machine.

My Lords, I thank the Minister for his answer. The stated aim of sanctions is to

“encourage Russia to cease its destabilising actions in Ukraine”.

It seems to me that there is no evidence that sanctions have had any such impact. Russian GDP has dropped by a mere 2% and the country is skilled in circumventing sanctioned goods through third countries. Despite being subject to 13,000 different sanctions, which I think is more than any other country before, they have made no appreciable difference to Russia’s behaviour—we think of its links with North Korea, China, Iran and so on. Are the Government therefore prepared to move to more precisely targeted smart sanctions, the aims of which are clearly defined and the impact of which more measurable?

My Lords, the right reverend Prelate talked about the impact of sanctions. I can share with him that sanctions are having a direct impact. On revenues alone, they have left Russia’s budget in deficit, rather than the surplus that the Russian Government themselves predicted for 2022. Russia has suffered an annual deficit of £47 billion, the second highest of the post-Soviet era. Russia’s energy revenues fell 47% in the first half of this year. At the same time, global oil prices are lower. Less immediately visible, but more importantly in the long-term, more than 1,000 foreign businesses have left Russia, along with thousands of high-skilled workers. More continues to be done, as we co-ordinate and work with other countries. Particularly notable recently is that Armenia, Turkey and Kazakhstan have taken action on the issue of supply chains, which the right reverend Prelate raised. That kind of co-ordination is important if we are going to make these sanctions work across the piece.

My Lords, on targeted sanctions, the oligarchs who make up the inner circle around Putin, and the huge number of people who have property here, have almost invariably made their money by nefarious means—they must have done, because 30 years ago there was no private capital in Russia. Could my noble friend the Minister give us an update on how many oligarchs are having their property—and whatever else—put into suspension so that we can confiscate and use it to rebuild Ukraine?

I agree with my noble friend that we all want—I think I speak for the whole House—to get Russia to pay for its war on Ukraine. At the time of the invasion, the UK sanctioned 129 oligarchs who have a combined net worth of around £145 billion. As I said earlier, we have frozen £18 billion-worth of Russian assets under the regime. The UK has also set up specialist agencies in the NCA and, as I said earlier, we are working with key partners. Legal hurdles need to be addressed, but we are not doing that alone—other partner countries are also looking to allow those assets, now that they are frozen, to be moved across. Ultimately, when the war ends, we can use the money from those assets in the reconstruction of Ukraine.

I am sorry to say that I cannot disagree more with the noble Lord. We have not gone soft on Russia; this House has not gone soft on Russia; this country not gone soft on Russia. At meetings such as the G7 and the G20, there are a broad number of countries and alliances. I assure the noble Lord that I have sat in many meetings where we have had to agree a statement; the fact that Ukraine was mentioned in that statement, with Russia present in the room, indicates a way forward. We also have to address these issues with partners who still do not have the same view as us, and we do that through effective diplomacy and specific action, as we are taking with our key partners.

My Lords, the Minister knows that Russia’s export in goods is now at pre-war levels, and the very friends the Minister referred to—in India and the Gulf—are offering financial services directly to Moscow. We are currently negotiating trade agreements with those areas, offering them preferential UK market access. Does the Minister share my concern that we are actively encouraging financial instruments who are supporting the Russian war machine to have preferential UK market access? Surely that cannot be right.

My Lords, many of those countries, including India specifically, have had historic and legacy relationships with Russia. As the noble Lord is aware, India has relied on Russian defence support for a long time over history. It is right that we talk directly, and raise those concerns, with key partners such as the UAE and India, while, at the same time, working constructively to ensure that there are alternatives. I assure the noble Lord that we are seized of that; it is why we are making progress in our discussions on the issue of circumvention with key countries such as the UAE. Turkey recently initiated certain procedures domestically to assist in this respect. Let us be very clear that, while Kazakhstan has a strong reliance on Russia, it is looking at its domestic legislation to see how it can curb the issue of circumvention.

My Lords, could the Minister explain to the House why we have a memorandum of understanding with the United States on co-operation over sanctions against Russia but we do not have one with the European Union? Could he also explain why the Foreign Secretary fended off the recommendation by the European Affairs Committee of this House that we need a properly structured framework for co-operation with the EU on sanctions so that, together, we could make them more effective?

My right honourable friend the Foreign Secretary has been very much leading on direct engagement with our partners in the European Union, not just on the issue of sanctions specific to this Question but on a broad range of issues. I know that we will shortly be looking in the Moses Room at various committee reports. I assure the noble Lord that we are working very much hand in glove with our key partners—that is, Canada, the United States, the European Union and others—to ensure that sanctions are co-ordinated. I look to the noble Lord, Lord Collins, specifically—this may have been his question—and say that we are working hand in glove with those partners, and the impact on Russia is beginning to tell.

Let me ask that question, as the Minister provokes me into it. Last week, I asked him specifically about Ursula von der Leyen’s statement about freezing €200 billion-worth of assets. The EU has announced that publicly. He said last Thursday that we support this initiative. Let us have a clear statement from the Government today that we will act in concert with the EU and announce our intention to freeze assets so that they can be repurposed for rebuilding Ukraine.

I assure the noble Lord that, in many years across the Dispatch Box with him I have sought not to provoke him, and if I have done so, I have failed miserably on this occasion. However, I can give him that assurance. I totally agree with President von der Leyen’s statement, and we are working with our key partners on ensuring that the assets that have been frozen stay there. The important thing is the legal impact, and no country, including the various jurisdictions of the EU, has yet designed the system and structure to allow for those assets to be deployed for the reconstruction of Ukraine. We are working with the key countries, and, as the noble Lord knows from the Ukrainian Recovery Conference, with the private sector, on reconstruction.

Given the assertion in the Washington Post last month that 6,000 drones have been supplied by Iran to Russia, will the Foreign Office reconsider its position on Iran, and in particular the IRGC?

My Lords, as my noble friend knows, we have taken a very firm line on Iran and sanctions. As the Minister responsible for Iran within the FCDO, I can say that we have taken a forward-leaning position on ensuring that Iran is held accountable for its actions. I agree with my noble friend that it is appalling that drones have been supplied directly by Iran. It is also interesting to note that Russia is now looking to the likes of Iran and the DPRK, both countries themselves subject to sanctions. I hear what the noble Lord, Lord Coaker, is saying from the Front Bench about the IRGC—that is why God has given us two ears: one for the questioner and one for the Labour Front Bench. Of course, I cannot speculate on future proscription, but I assure noble Lords that we keep all tools under review.

Did our Prime Minister raise with Mr Modi the fact that India is still importing a large amount of Russian oil that is then being mixed with other oils, and so it is difficult to identify, and resold on the international markets? This is dangerous in a number of ways. First, it supports Russia, but, secondly, we are getting a plethora of very dangerous tankers—I got ships in—around the oceans of the world, which is a real problem.

Tankers—as I know from the definition at school—count as ships, so, again, awards must go to the noble Lord. The Prime Minister had wide-ranging discussions with all G20 partners and during his bilateral with Prime Minister Modi. As the noble Lord will be aware, Russia and its illegal war on Ukraine were among a number of points that the Prime Minister raised directly with Prime Minister Modi.

My Lords, the United Kingdom and international partners are resolute and united in supporting Ukraine to rebuild and emerge from the war with a modernised economy resilient to Russian threats. The Ukraine Recovery Conference in London raised over $60 billion in international support, including multi-year commitments by the UK and others. We have allocated £395 million in bilateral assistance between 2023 and 2025, alongside up to $5 billion in fiscal support. Support for the year 2025-26 onwards will, of course, be confirmed after the spending review.

I hope that the Minister can confirm that the Treasury and the Foreign Office are very clear about the size and long-term nature of the commitment to rebuilding Ukraine. The Republicans in the US Congress, with whom many Conservatives are now very close, are saying that the United States does not really need to commit to supporting Ukraine. Many Conservatives who supported the leave campaign thought that we should not be paying into the European Union budget, much of which was going to the reconstruction and development of east European, formerly Soviet countries, which contributed to British security. To ensure that Conservatives in opposition do not attack whichever Government it is for raising public spending to support Ukraine long-term, can he reassure us that the Treasury has this publicly in the forward figures?

My Lords, the noble Lord knows that I respect him greatly, but I am surprised by both the tone and the substance of his question. This Government, together with the full support of His Majesty’s Opposition, have been resolute—and, indeed, there has been support from the Liberal Democrats and universal support for the action that we have taken, for the support that we have given and, of course, for the financial commitments that we have made on humanitarian assistance, economic support, financial support and defence spending.

I have just had a meeting with our outgoing ambassador, Melinda Simmons, and I pay tribute, and I am sure that all noble Lords join me in paying tribute, to her resilience. As a sign of affection and support between us and the Ukrainian people—it is perhaps a poignant and reflective moment, but an interesting one, which I think that we should recognise—on her departure, a beautiful gesture on their part was to name a specific pastry after Melinda and call it the Melinda pastry. That shows the strength of relationships that we have built.

I am proud and resolute in that support. The noble Lord talked about the US. There are many Republicans—and I am not there to comment on the Republicans and Democrats. One thing is clear, irrespective: we have seen strong support from across the United States. As the noble Lord knows, Secretary Blinken is currently in Ukraine. Our support is resolute, and this is across the piece, irrespective of change. From this country, from this House and from the other place, there is unity of purpose and unity of action—we stand with Ukraine.

I take this opportunity to reiterate the Opposition’s support for the Government and absolute commitment to that—and certainly a future Labour Government will continue that support for Ukraine. The noble Lord mentioned the conference; at that conference, Ursula von der Leyen said that €200 billion of frozen assets belonging to the central bank of Russia will be repurposed to fund Ukraine’s reconstruction. Can the Minister update the House on what we are doing about those repurposed sanctioned and frozen assets? That is the key—making sure that Russia pays with its own money.

First of all, I thank the noble Lord again for underlining the strong support of His Majesty’s Opposition. I have been very clear on the international stage that we speak as one—and I pay tribute to the noble Lord, Lord Coaker, in that respect as well as to my noble friend Lady Goldie, who will respond to a debate on this issue shortly. On the issue of sanctions, I agree with the noble Lord, and we are supportive of those actions. More than 60% of Mr Putin’s war chest has been immobilised—that is £275 billion-worth. The end intent, with all legal considerations taken account of, is that it should be repurposed and service in rebuilding the infrastructure that Russia has destroyed in Ukraine.

My Lords, is it not important to recognise that among the destruction have been many historic buildings? It is very important that the Ukrainians are able to do what the Poles did in Warsaw—although under a very unhappy Administration. Is it not crucial that we give as much technical advice as we can, through bodies such as English Heritage, so that they can rebuild their patrimony?

My Lords, I take on board what my noble friend has said. I assure him that we are working to ensure that the infrastructure within Ukraine is developed in a more resilient fashion. We are providing technical support. We are working on energy infrastructure. My noble friend makes an important point about cultural heritage. We are working with bodies such as UNESCO to ensure that, first and foremost, we protect those heritage sites and that, where they have been destroyed, they are rebuilt.

My Lords, the Prime Minister confirmed in February that more than £2 billion of assets that previously belonged to Roman Abramovich of Chelsea Football Club were ready to be transferred to a humanitarian foundation to be spent on those impacted by the war in Ukraine. That money has not yet been transferred; the foundation has not yet been established; the humanitarian work has not yet begun. Will the Government move a bit more quickly to ensure that this happens as soon as possible?

I can confirm that that was the point my right honourable friend made. The current situation remains that those assets are frozen and cannot be moved unless a licence is issued by the OFSI department within the Treasury. I can assure the noble Lord that we are working in an expedited way with our colleagues in the Treasury to ensure that those funds can be utilised appropriately.

My Lords, the Minister will be aware of yesterday’s tragic news of the air raid on the Ukrainian city of Kostiantynivka, where 17 people were killed. Millions of pounds-worth of further damage was added to the literally hundreds of billions-worth of damage that has already been done. Surely we should be looking at a co-ordinated, Marshall-style plan for the rebuilding of Ukraine.

My noble friend raises another tragic event. I am sure that I speak for the whole House in saying that we stand once again in unity with the people of Ukraine. It was a blatant attack on a market in the middle of the day. We have heard about the 17 fatalities, and those are added to the many fatalities that have happened already and, tragically, I am sure that there will be others. I agree with my noble friend and I assure him that we are working exactly in that way, with cities being allocated to key countries—for example, there are elements within the city of Kyiv that are specific to UK infrastructure development. Of course, the real challenge is that, every time something is rebuilt, the Russians do not desist from destroying it again, so there has to be a plan. I assure my noble friend that we are working with international partners in that respect.

My Lords, can I ask the Minister to give some consideration to the scale of the problem? Does he recall that Europe got $13 billion after President Truman signed the Economic Recovery Act in 1948? Who is going to be as generous as that when it comes to Ukraine?

We are already seeing the support and generosity, not just of the United Kingdom and our partners in Europe and in the United States. We have been heartened in the advocacy that we have been doing, for example, across the Gulf states. We have seen the Kingdom of Saudi Arabia provide £100 million in humanitarian support. This trajectory will continue, and we are working towards the G20, which is the next important milestone. The UN General Assembly high-level week in New York will provide other opportunities to focus on a structured approach. But from what we have seen—and we should look at that as a precedent—everyone has come forward to provide the kind of technical and financial support that Ukraine needs.

My Lords, the Minister knows that I support the valuable assistance that has been provided to Ukraine. Can he give the House the assurance that, for any funds going forward, there will not, as happened with the previous funds, be a like-for-like matched cut in the official development assistance budget? We may win in Ukraine, but we will lose in the global South if the support we provide for Ukraine is cut from the emergency relief given to those countries most affected by this in Africa.

The noble Lord will be aware that we are producing a White Paper on the whole issue of international development to ensure that we can align our priorities and provide the support that is needed by countries around the world. I am proud of the United Kingdom’s historical record in supporting the most vulnerable communities; that will remain a priority. Equally, this is a very different situation that we face: this is a war in Europe, the like of which we have not seen since 1945. I believe, and I am sure the noble Lord agrees, that it is right that we support Ukraine at this important juncture.

My Lords, looking further ahead, the restoration and growth of trade will be an important part of Ukraine’s recovery. Have we looked to see whether we could build our trade in the longer term with Ukraine, and in which areas would we explore?

I can assure the noble Lord that we are doing exactly that. We are already looking at supporting Ukraine with generators through the Energy Community support fund. We are also providing a financial guarantee for a £47.5 million loan from the EBRD, we are looking at £35 million of innovation investment in energy recovery, and we are providing loan guarantees to Ukraine in the medium to long term.

My Lords, the United Kingdom is stepping up action to improve global food security and nutrition. We will spend at least £1.5 billion on improving nutrition from 2022 to 2030. Our Permanent Representative to the UN, Dame Barbara Woodward, briefed the US-led open debate at the UN Security Council to strengthen global food systems, prevent future famines and reduce conflict. At the debate the International Rescue Committee suggested five helpful, practical solutions to insecurity and famine. The UK is taking concerted action to tackle hunger, including by protecting global food systems.

My Lords, the shocking statistic that David Miliband highlighted at that conference is that 80% of the world’s acutely malnourished children are not getting any treatment at all. The lifelong consequences are horrendous. Solutions I have witnessed in Africa are the simple test of a band around the arm by parents and community health workers to judge whether a child is malnourished, and the supply of very cheap and cost-effective ready-to-use therapeutic food. In Mali this approach resulted in a 92% success rate and a 30% cost saving on other methods. Will this action be prioritised as part of the Minister’s pledge of £1.5 billion? When will we know how this money will be spent between nutrition-specific and nutrition-sensitive programmes?

My Lords, I pay tribute to the noble Lord. I know he has been seized of this issue, including in his work with the all-party parliamentary group. I can give him an assurance about the practical nature of what he suggests. In his report, David Miliband talked about these actions being taken in Kenya and Malawi. They are sensible, low cost and efficient. As the noble Lord said, they identify malnutrition at an early stage. That early intervention is crucial, particularly in helping impoverished children. We are committed to it. Our funding underlines our strong support in this area. As I said in answer to the previous Question, we do a lot on the world stage, where we are very much aligned in helping the most vulnerable. Among those are malnourished children. We need to be focused on those children to ensure that this remains a legacy of which we can be proud in the years to come.

My Lords, this is my first opportunity to welcome the proscription of the Wagner Group. The president of the IRC specifically singled out the Sahel and Sudan as part of this crisis of famine, so I welcome the Government’s moves this week, since I was the first person in Parliament to call for its proscription last spring.

I hope the Minister will reflect on the fact that the UK Government have cut support for famine relief in the Horn of Africa in particular—this conflict-afflicted region. This led the Catholic humanitarian charity CAFOD to say in a statement on 31 May this year:

“This is a shameful betrayal of the people suffering and, despite their claims, shows the government is not taking this crisis seriously”.


Now that both Labour and the Conservatives are not going to immediately restore the 0.7% lawful target after the next general election, when does the Minister forecast that the UK will return to the level of support for famine relief that we had before the cuts?

My Lords, as I look around this Chamber, I am sure we are all very much at one on the noble Lord’s earlier point about the Wagner Group. Proscribing a group, as I have always said from this Dispatch Box, is a sensitive issue that needs to be measured. I pay tribute to our colleagues in the Home Office who took that considered approach to ensure that all legal avenues were covered. I am pleased that has now taken place. The group caused instability in the very regions the noble Lord mentioned. We are making assessments to see whether that makes a difference. Personally, I do not think it will make that much difference in terms of its structures: I am sure it will have some kind of contingency in place.

On the wider point, of course there has been a limit to what we have been able to spend with the reduction from 0.7% to 0.5%. We are committed to restoring that at the earliest opportunity when the fiscal situation allows, but at the same time we recognise that the United Kingdom has continued to support many communities across the Sahel, further afield in Africa and indeed in Asia, on some of the key priorities that we remain very much aligned with.

This is when you look upwards for divine inspiration, notwithstanding being a person of faith. In all seriousness, it is important that a decision was taken that was not an easy one but a challenging one. The fact is that, even with our 0.5%, we have continued to support many communities around the world. As I said, the Prime Minister has made it very clear that we will look to return to 0.7% at the earliest opportunity. We are going through very challenging times, both domestically and internationally, and I am proud of the fact that we have continued to stand by many of our international obligations, especially when it comes to helping the most vulnerable around the world.

My Lords, as the president of the International Rescue Committee rightly noted, conflict is one of the primary drivers of food insecurity around the globe, so what steps are His Majesty’s Government taking, in co-operation with our partners, to convene dialogue and work with local peacebuilders and faith leaders to help in areas of conflict?

We are working in many areas, including an area in which I lead on the initiative of preventing sexual violence in conflict. Famine is a key driver of conflict; we all recognise that. That is why I said in my original Answer that our Permanent Representative in New York briefed the Security Council, which is purposed to look at conflict alleviation and to prevent conflict in the first place. We are working with faith leaders and civil society organisations in key areas and key countries on the ground. In Yemen, for example, near neighbours include the Kingdom of Saudi Arabia. We are engaging in places such as Afghanistan, where faith leaders have an important role. Some of this is discreet and we cannot go into the detail, to protect and support those who are working on the ground, but I assure the right reverend Prelate that we are doing exactly that.

My Lords, one of the things David Miliband also mentioned, on conflict being the driver, is that there is so much impunity and that the world needs to act when people commit horrendous crimes against humanity. We should stop just using words and take action. Does he agree with David Miliband’s statement in that regard?

My Lords, it is not just David Miliband who says that; we all agree that there must be accountability and justice for those who suffer and for survivors of whatever violence takes place. That is why I am proud, as I said on the earlier Question about Ukraine, that among the many areas that the United Kingdom is now supporting, we are supporting Ukraine on exactly that—during the conflict, on justice and accountability. As the noble Lord knows, we are working with key organisations, including the International Criminal Court, to ensure that those who commit these terrible, abhorrent crimes are brought to justice at the earliest point possible.

My Lords, the Russians having broken the agreement about grain shipments, which will obviously have a major impact, has the international community given any consideration to measures that can be taken to help resolve the problem caused by that lack of grain now shipping out of Ukraine?

My Lords, I have two points to make. First, on the broader point on issues of food insecurity, we in your Lordships’ House and in the other place all need to ensure that that narrative is established. Russia says erroneously that it is sanctions that are causing the humanitarian crisis. As all noble Lords know, every sanction that has been applied has a humanitarian carve-out. The grain initiative was an innovative initiative sponsored by the UN, where Turkey played an important role, and with the likes of Turkey we are ensuring that we can restore this initiative because it provides support to many. Let us put this into a context that needs to be understood: 400 million people across the world used to get their grain from Ukraine, which is why this initiative is so important.

My Lords, as ever my noble friend is absolutely right, and I agree with him. I assure him that we are doing exactly that with key partners. The challenge has also been, when we look at the Danube, that some attacks are on territory currently controlled by Russia. A full assessment is being made on certain parts of the infrastructure, not just the grain. As he knows, various elements have caused environmental pollution; pollutants have gone into the Danube and are feeding into the Black Sea as well. There will be a real environmental challenge to face, post the war, but I assure him that we are working with key partners to ensure that this can be addressed. Importantly, those who have influence over Russia should provide access so that assessments can be made.

My Lords, the United Kingdom commends the Zimbabwean voters for their peaceful participation in Zimbabwe’s recent elections. However, the UK shares the view expressed in international election observation mission preliminary statements that the pre-election period and election day fell short of regional and international standards. The UK is also concerned about the lack of transparency surrounding the compiling of results by the Zimbabwe Electoral Commission and the severe disruption of domestic observation.

My Lords, it was obvious to every independent observer that those elections were not free and fair. In the words of Nelson Chamisa himself, they were a “blatant and gigantic fraud”, but the hard-hitting SADC report questioned the credibility of the elections and the breaches of its own standards. The saddest thing is that, as the election observers left, the familiar pattern of widespread arrests, abductions and torture of grass-roots supporters of the opposition is taking place as we speak all over the country. There were even lawyers arrested last night in a hospital where they were representing tortured victims—the same kind of retribution that Mugabe did after 2008. Does the noble Lord agree that now is the time for full support by His Majesty’s Government for SADC’s efforts to resolve the crisis, and in particular for our newly arrived ambassador to re-evaluate all facets of our relationship with a Zimbabwean Government who flout their own laws through acts of violence and torture, and to give some hope even in the darkest days to the perseverance and courage of the Zimbabwean people?

My Lords, the noble Baroness refers to the arrival of our new ambassador. He arrived today and brings both diplomatic and development experience. I am sure he will play an exemplary role in our relations with Zimbabwe, its communities and all parties in Zimbabwe as well. The noble Baroness mentioned the abduction and torture of opposition CCC members, which we have raised directly. I can report that we are relieved that they have been found and are receiving treatment for their injuries. We also note the arrest and subsequent bail of two lawyers acting on behalf of the alleged victims on 4 September.

My Lords, I am sure that the Government’s present concerns and those of the noble Baroness, Lady Hoey, are quite correct, but will the Minister accept that Zimbabwe is a vast country of potentially great wealth? Will he accept that, in the longer term, we will need its markets, its raw materials and its support in keeping the Russians and Chinese from dominating the whole of Africa? Despite the present difficulties—and remembering that Zimbabwe was once a member of the Commonwealth and could be again, although clearly not now—will the Minister accept that these things should be kept in the back of our minds?

My Lords, I agree with my noble friend, who speaks on these matters with great insight and experience. Membership of the Commonwealth and its unique nature as an institution provide a real alternative to countries around the world. However, any country seeking to join must abide by standards, and, of course, that decision is ultimately for all members of the Commonwealth.

My Lords, I have just returned from Zimbabwe. I was a member of the Commonwealth observer group, and we did an extensive report, the interim statement of which Members can find in the Library. A lot of factors, many of which were also raised in 2018, led us to doubt the credibility of this election. Will the Minister agree that the ideal would be for Zimbabwe to re-enter the Commonwealth, but it can do so only when it meets the standards of proper democracy, the rule of law and free elections?

I answered the noble Baroness’s question in part in response to my noble friend, but I agree with her. I commend her efforts, and those of all the observer missions, in observing the election. We hope that, ultimately, inclusive and pluralist democracies emerge, and that Zimbabwe can find its way back into the Commonwealth.

My Lords, in light of the developments in Zimbabwe—the widespread violence and intimidation of voters in the rural areas, the abduction and torture of many opposition activists and the continued detention of opposition Members of Parliament—will the UK Government be rather less equivocal and make absolutely clear that they do not regard these elections as free and fair and that the Government of Zimbabwe have no legitimacy? Will they make clear that, as long as this is the case, it will not be readmitted to the Commonwealth, as far as Britain is concerned, and that we will work with SADC colleagues to try to find resolutions to the problem?

My Lords, I commend the noble Lord’s work as an observer of Zimbabwe, and I am sure that he has seen the two statements that we have issued since the elections. I agree with him about the importance of working with key regional partners, including SADC, which is very much deployed and making the same representations that we are, along with other key interested parties, to ensure that there is a pluralist approach when it comes to democracy. Democracy needs stability, security and inclusivity to be sustainable—that point has been made consistently to the Zimbabwean authorities.

My Lords, I will reiterate a point I have made before: the ingredients of a thriving democracy are not limited to elections; civil society’s role is vital. I welcomed the noble Lord’s statement before the Summer Recess about the Government’s response to the legislation that is being introduced, but has his department acknowledged, or made representations about, the new labour Act that they are pushing through in Zimbabwe? The Zimbabwe Congress of Trade Unions has warned that this will allow the Government to interfere in trade union administration. Will the noble Lord work with global unions to ensure that the voice of workers is heard, not just politicians?

My Lords, the noble Lord and I have often had exchanges on the importance of all aspects of society being represented, and of civil society organisations and groups having their voices heard—that is clear. The noble Lord points to legislation. We have been extremely concerned and raised directly the implications of when, in June 2023, the Parliament approved the criminal law code amendment Act—the famous “patriot Act”, as they call it—which limits civil society. We are also concerned about the PVO Bill currently in front of the President. We are making representations and will continue to do so.

My Lords, it is patently clear from all the international reports that these elections were not free and fair, but CCC still managed to secure at least one-third of the parliamentary seats. What measures can His Majesty’s Government take, as well as our international partners, to call for an all-party conference in Zimbabwe to try to reach an inclusive compromise road map for the economic and political sustainability of the country?

My Lords, the noble Lord speaks from great insight about Zimbabwe. First and foremost, he will be aware of the work that Zimbabwe must do with the African Development Bank on the repayment of its arrears. The economic focus that is needed is something that must be prioritised by the new Administration. I also very much agree on the need for inclusivity when it comes to Zimbabwe and its future. Of course, the CCC and indeed all other parties must be part of that. One does hope that these points prevail and, as I said earlier in response to a couple of questions, these then add to the basis and foundation for eventual membership, we hope, of the Commonwealth as well.

My Lords, is it not the case that, although we send observer teams to oversee the actual election, much of the stealing of elections takes place before any observer team actually arrives there? Was it not significant that the violence that I witnessed after the 2018 election took place after the observer teams left? We are seeing the parallel experience this time: it is before and after the observer teams are there that is the real problem in relation to elections in Zimbabwe.

My Lords, I understand the point my noble friend is making, and that is why it is extremely important that we continue to engage both pre-election but also importantly now post-election, through our ambassador and of course, as I said earlier, with key partners including most notably SADC and the African Union, to ensure that the very point my noble friend raises is addressed quite directly. I do feel we have traction: through representations, along with others, we see the release of those who are arrested. While it may be a glimmer, it is a positive glimmer in these situations.

My Lords, in February, at the UN General Assembly, 141 countries called on President Putin to withdraw Russian troops from Ukraine. This is the quickest way to end the war and deliver a just and lasting peace. The United Kingdom welcomes President Zelensky’s peace formula, which reflects principles of the UN charter. On Monday, my right honourable friend the Foreign Secretary chaired a UN Security Council briefing on Ukraine, and we will work with the Ukrainian Government to follow up on June’s discussions in Copenhagen between the G7 and several G20 countries on the principles for sustainable peace in Ukraine.

My Lords, notwithstanding any difficulties we have with China, but recognising that China, like us, needs a peace process that stabilises its world markets while safeguarding as much as possible the sovereignty of Ukraine, could we not initiate a dialogue with China, drawing on its special relationship with Russia, that seeks an end to the conflict—a dialogue that promotes international protectorate status for Donetsk and Luhansk, and limited restoration of Russian oil supplies, substantially top-sliced to fund the cost of Ukraine’s reconstruction? Someone, somewhere, from a position of strength, must make the first move, as a policy of “last man standing” suits nobody. Can China open that door?

My Lords, the first thing I would say is that there is someone who can stop this war. That is Mr Putin, and he can stop it right now. We welcome the role China has played in engagement with President Zelensky, but these discussions about Ukraine must be led by Ukraine. As I said in my original Answer, we are working with key partners, including an extended engagement with the G20, including the likes of Turkey, Saudi Arabia and India. This war can stop today: if President Putin withdraws from the occupied territories then peace can prevail. Let us not forget what he did yesterday: he bombed the very grain depots where he stopped that grain from leaving Ukraine. This is not a sign of peace; it is a sign of furthering war.

My Lords, I agree with the Minister 100%, but there is no case for the West telling Ukraine what to do in a settlement. It must be up to Ukraine’s elected Government, because after all it is their country that has been desecrated by this evil force that has invaded and committed war crimes. Surely we should reject the suggestions of the noble Lord, Lord Campbell-Savours.

My Lords, I agree with my noble friend. That is why my right honourable friend convened a meeting of the UN Security Council. The UN, as an organisation, is set up for exactly these purposes. It negotiated the Black Sea grain initiative. It is Russia that stopped the Black Sea grain initiative. It is Russia that not only stopped it but then went and bombed the very same grain supplies. When we talk about food insecurity in the world, it is not Ukraine’s fault—it is Russia’s.

My Lords, I intervene early to completely associate the Opposition with the words of the Minister. We are at one with the Government on this: any peace process must be initiated and led by the Ukrainians. We fully support that. I also associate myself with the Minister’s comments on the outrageous bombing of the grain stores. I hope the noble Lord will convey to the African Union just what impact that will have on African nations and food security. On the International Fund for Ukraine, is the Minister satisfied that the £770 million is delivering what it set out to do? Ukraine needs arms and it needs them now.

My Lords, I thank the noble Lord and reiterate what I said in the Moses Room yesterday in thanking the lead shadow spokesmen on foreign affairs for both the Labour Party and the Liberal Democrats. We are very much at one on this. The noble Lord will know that the United Kingdom has stood firm in its humanitarian, military and economic support. That is why we convened the Ukraine Recovery Conference. On the wider point that the noble Lord raised about peace, we are again very much on the same page. We are working very closely with Ukraine to ensure that all avenues can be explored, but any decision on the peace process must be led by Ukraine.

My Lords, these Benches also agree with the Minister in that regard. He referred to the egregious war crime of attacking the grain supplies; the hungriest and the poorest people on earth will be the victims of Putin’s aggression on this. Does the Minister agree that this provides an opportunity to say to those countries in Africa that are currently neutral that we can do two things with them? First, we can proscribe the Wagner Group, active in Africa, as I have called for since February last year; and, secondly, we can immediately restore humanitarian assistance for those suffering from acute hunger and malnutrition in the Horn of Africa. Restoring that, plus an active view on Wagner, will send very strong signals to the Horn of Africa and the African continent.

My Lords, both the noble Lords, Lord Purvis and Lord Collins, referred to the important role of Africa. I will be travelling to Kenya at the start of next week, and that will be an opportunity once again to emphasise the importance of the Black Sea grain initiative—unfortunately and tragically these humanitarian supply lines have been brought to an end. Tragically, this is not the only action Russia has taken. We have also seen it reject humanitarian corridors to Syria; we sought to restore the current pathways, as well as those at al-Rai and Bab al-Salam. Russia rejected these. It is very clear that it is not Ukraine, western support for Ukraine or the 141 countries that have backed Ukraine that have blocked this and caused food insecurity; it is Russia, supported by a small number of countries. Of course I will take that back. On the issue of the Wagner Group, the noble Lord knows that I cannot go further. We have proscribed a number of key individuals, through sanctions, but on proscription overall I cannot comment any further.

My Lords, Mr Putin likes to depict himself as a strongman defending Mother Russia against perceived threats from the NATO alliance. Does the Minister agree that it would totally destroy Putin’s credibility, help end the suffering of the Ukrainian people and further the cause of world peace if the West were to openly offer Russia the bait of membership of NATO in return for its total withdrawal from Ukraine?

My Lords, I refer to Indian supply and the breaking of sanctions. There is no doubt that a large amount of oil is going to India, and is then being mixed up and sold on the open market as oil not from Russia. Are we doing anything to focus on this, not least because there is something like 40 or 50 tankers, which are actually very dangerous—they are not well fanned—being used to supply this oil around the world?

My Lords, I assure the noble Lord that we are working bilaterally with other partners and directly with India in raising the bar on the importance of sanctions to be sustained. Of course, the deals that have been done—what has been referred to as the “rouble-rupee” deal—have not actually leveraged anything beyond one particular deal that was done in December last year. I take on board what the noble Lord has said, but that is why we are engaging through the Copenhagen process, where we opened up to other G20 countries.

My Lords, can my noble friend bring the House up to date on the latest figures on the number of Ukrainian children kidnapped by the Russian authorities and resettled in Russia? Is he in touch with our allies, Saudi Arabia and Turkey, which are reported to be trying to broker a deal to return these children to their parents? Regardless of the success that our allies may have, does he agree that President Putin, and his many crimes against humanity, must be brought to justice for the dreadful business of tearing children away from their parents?

My Lords, has the noble Lord seen reports this week that children are also being sent to Belarus? Will he ensure that the International Criminal Court investigates that, along with the previous reports of abductions to Russia? In answering the substantive Question that was asked this afternoon, will he also refer to those countries that have aided and abetted Putin, including China and including Iran, which has provided weapons to the Russians?

My Lords, I assure the noble Lord that we are working with the International Criminal Court on all elements. The taking of children from Ukraine, be it to Russian territory or Belarus, is abhorrent, and we are very focused on and seized of this. This is part of the conversations we are having with the chief prosecutor at the ICC. On the wider question of the malign influence of Iran, we are well-versed in that. It supplies drones. The issue of China I have covered. We have seen China at least not block action at the UN Security Council, and that action is welcome.

My Lords, these regulations amend the Russia (Sanctions) (EU Exit) Regulations 2019. This instrument was laid on 29 June 2023, under powers in the Sanctions and Anti-Money Laundering Act 2018. The measures in this instrument entered into force on 30 June 2023.

If I may digress from my script, once again we are debating Russia and its actions. As I came into the Room, I was catching up on some of the news on the Black Sea grain initiative. Yet again, we have seen tragedy; to say it is shocking is perhaps an understatement. According to media reports, Russia has not only scuppered the Black Sea grain initiative but attacked some of the grain ports, destroying much of the grain held in those warehouses. Again, it shows the tragic nature of this illegal war and the importance of our sanctions. I say at the outset that I appreciate the work of both Front Benches opposite and the co-ordination and unity that we have displayed in moving through sanctions at such a pace.

I turn to the SI in front of us. These measures have been co-ordinated with our international partners, while refining the approach to accommodate the particular circumstances of the UK legal sector. By restricting access to additional services from the United Kingdom, they will contribute to increasing pressure on Mr Putin for waging this illegal and brutal war against Ukraine. I know that noble Lords have been focused on this issue in previous debates too. These measures place further constraints on the Russian economy, and therefore Mr Putin’s war machine. They add force to the largest, most substantial package of economic sanctions that Russia has ever faced.

The instrument delivers on the commitment made by the UK Government to ban legal advisory services on specified commercial activities. This will further hamper the ability of Russian businesses to operate internationally. This legislation will make it illegal for any person working in the UK, as well as British nationals working abroad, to advise on or facilitate certain commercial activities that would be sanctioned by the United Kingdom Government if they involved a British national or entity or were taking place in the UK. In practice, this will make it harder for Russia to benefit from the United Kingdom’s world-class legal expertise. This goes beyond prohibitions already in place that cover a range of professional services, including accountancy, architecture and management consultancy. This latest measure demonstrates our continued determination to ratchet up the pressure on Mr Putin for continuing his illegal war.

Although this legislation will close down opportunities for Mr Putin’s associates and supporters to benefit commercially from the UK’s legal expertise, it is important that we ensure that legal services can continue to be provided where they contribute to upholding the rule of law and compliance with our sanctions framework. By protecting the fundamental right to legal representation, we, frankly and directly, distinguish ourselves from Mr Putin’s oppressive regime. By ensuring that legal advice can continue to be provided for the purposes of compliance with our sanctions framework, we enhance the effectiveness of our regulations and intensify the pressure on Mr Putin.

Legal professionals are under a strict obligation to ensure that their services support their clients to be sanctions-compliant and do not stray into enabling them to circumvent restrictions. However, it has become apparent that this legislation can be interpreted as having the unintended consequence of prohibiting persons in the UK and British nationals abroad from providing legal advice to clients seeking to comply with the sanctions regimes of our international partners. Let me assure noble Lords that it is not the intent of these regulations to prohibit this type of legal service. UK lawyers should be able to support their clients to be sanctions-compliant beyond UK law as we work closely with our allies to tighten the net on Russia’s economy.

We have looked at this issue thoroughly. As an immediate response, we are working, first, across government and, importantly, across the legal profession. We have met representatives of the legal sector. My colleagues, the Lord Chancellor and the Justice Secretary, have met members directly; indeed, the Lord Chancellor met the president of the Law Society this morning. I know that this is a concern that anyone would have but I assure noble Lords that we are working closely with the legal sector in this respect to ensure that we implement a general licence that will make it clear that this type of activity can continue. We aim to have this in place in the coming days. I put on record our thanks to the legal sector for its constructive engagement on this important issue.

We have sought here to provide a direct remedy to that possible unintended consequence; the valuable support and input that we have had from the professional legal sector is very much appreciated. Once we have issued the licence, we will consider whether further amendments to the SI to address the issue are appropriate and necessary. Of course, I will update noble Lords, particularly those representing the Front Benches, on this. We will do this in conjunction with the legal sector and, if amendments are deemed necessary, we will bring them forward at the earliest opportunity.

As with our sanctions, this latest package has been developed in co-ordination with our international partners, as I said. In doing this, we will continue to work with the legal community to monitor the effects of this legislation and ensure that it achieves the desired objectives. We will also continue to co-ordinate with our international allies to identify and address any gaps or loopholes that emerge in our respective sanctions regimes.

This latest measure demonstrates our determination to target those who participate in or facilitate Mr Putin’s illegal war of choice. Through our sanctions regime, and those of our allies, Russia is being increasingly isolated, cut off from western markets, services and supply chains. Key sectors of the Russian economy have taken a significant hit and its economic outlook is bleak. The UK Government will use sanctions to intensify the military and economic pressure on Russia until Mr Putin does the right thing and ends his brutal invasion of Ukraine. We welcome the clear and continued cross-party support for this course of action. I beg to move.

My Lords, I am grateful to the Minister for introducing these regulations in such a clear and comprehensive way. I will refer briefly to the concerns about unintended consequences in a moment but I will start by strongly agreeing with the Minister about what are likely to be the consequences of the decision on grain in the Black Sea.

Putin will again threaten the expansion to new victims of his aggression to Ukraine across those who are least able to feed and fend for themselves, especially as malnutrition and hunger ravage the Horn of Africa. Those countries that are dependent on the grain will be looking at this with doom. In a way, it is a horrific response to the leaders of countries, when they consider that they can effectively maintain the status quo ante relations with the Putin regime, to know how little he holds in his standing their people, who need this food.

My Lords, one of the issues we need to address is that Russia is highly dependent on western countries for legal expertise. As a country, we previously exported £56 million in legal services to Russian businesses every year, so it is important that we address this issue.

I also welcome the fact that we can use this debate to reiterate our cross-party support for these measures to show our unwavering commitment to and solidarity with Ukraine, its people and its sovereignty. Following last night’s Statement repeat on NATO’s Vilnius summit, I underscored the strength of feeling across our diplomatic and military alliance that we must stand with Ukraine until the war is won. It is vital that Parliament speaks with one voice.

The Opposition fully support the steps that the Government are taking to further strengthen our sanctions regime, prevent evasion and ensure that the Kremlin’s capacity to conduct this war is undermined. I stress that we recognise that this statutory instrument is common sense and prudent. It clearly should not be permissible that, more than 500 days into this conflict, it would be potentially lawful for a UK legal services provider to support commercial activities that advanced Russian interests because said activity did not have a sufficiently tangible connection to the UK, due to the territorial application of the 2019 regulations.

I hope the Minister can tell us what assessment the Government have made of how effective the 2019 regulations were and how we discovered any potential loopholes that people could get through. This leads on to my major point about this: can the Minister account for the delay in addressing these issues from the application of the regulations in 2019? If this loophole has been exploited, why has it taken us so long to address it?

I have read the Law Society’s letter and I appreciate the Minister’s response. I welcome the fact that the law officers and other departments are meeting with the Law Society but, to echo the point from the noble Lord, Lord Purvis, I am keen to support the Government in strengthening these sanctions. I do not want to see any further escape routes for people. It is important that we hear the Minister’s view on how effective these new regulations will be at imposing the sort of sanctions that we believe are necessary to limit Russia’s ability to wage war.

I know that the Minister has heard me say before that it is one thing to adopt particular regulations on sanctions, but how we resource them and how we are satisfied that they can be implemented and monitored is another. Can he tell us how the Office of Financial Sanctions Implementation is resourced? Will it be able to police these regulations? If our sanctions regime truly is a work in progress, we must be capable of reflection and improvement. If exemptions are causing more issues, we need to know about them; the assessment must be based on that.

There is one other question I will briefly raise, which is that the regulations provide exceptions when the Act relates to diplomatic missions or consular posts. Can the Minister give me a practical example of that? I am not sure I understand the purpose of it.

I have addressed the point about the Law Society. Of course, this was also raised with the Secondary Legislation Scrutiny Committee, which expressed the view that this issue needs to be addressed. The committee was approached by an international law firm.

I conclude by saying that we once again fully support the Government’s actions. We want to see the Russian regime sanctioned. The news I have just seen on the BBC website about not only breaking the agreement but bombing the very facilities that could feed Africa is absolutely atrocious. The sooner we bring this regime to account, the better. We fully support the Government in their actions.

My Lords, I put on record my thanks to the noble Lords, Lord Purvis and Lord Collins. I am sure I speak for all three of us in saying that, when we embarked on this journey of sanctions, we hoped that our debates and discussions would be limited. However, it is a real tragedy of the consequences of the war on Ukraine that we are continuing to have these debates. As I said in my opening remarks, and as was acknowledged by the noble Lords, Lord Purvis and Lord Collins, the fact that, even as we speak, there continue to be not just acts of aggression but pure violations of international law shows the nature of this war.

One point I would raise is how we amplify these points to the sorts of countries that still sometimes challenge us directly. I was delighted to see the noble Lord, Lord Wallace—I am not tempting him into the debate, but I am sure he will have a view on how we address the issue of influence directly. Quite often on the world stage and as I have travelled, it has been said to us that our sanctions are causing problems of food insecurity. Russia’s actions today demonstrate what is causing the challenges to food security. We have always worked with the UN and other key countries to ensure that the Black Sea grain initiative is kept on the front burner. It is regrettable and tragic that it was not. Further, it is tragic that we have seen the consequences culminating in this Russian aggression on the very areas that store the grain.

That said, I thank noble Lords for their specific contributions. To clarify the point made by my noble friend Lady Lawlor, whose intervention I welcome, what we are seeking to introduce—we have identified this issue—is a general licence as an immediate first step. We are working directly with the legal profession, including the Law Society, to ensure that any other unintended consequences and any other loopholes that we can address directly can also be met first hand. As I said in my opening remarks, we will seek to bring legislation forward at the earliest opportunity. It is important that we continue to do so.

The noble Lord, Lord Collins, raised the issue of identifying, as things are, how we have been working to address particular issues and the delay. As I am sure he would acknowledge, legal services are distinct from other professional services in the constitutional role they play within our country in supporting and upholding the rule of law. Therefore, we carefully consider the implications of different policy options. This is ever evolving. In collecting an evidence base, we also work with legal services to ensure that, as far as possible, the measures we lay have the desired effect.

I am not saying that this is the last time we will have this conversation. As we are imposing these sanctions and taking further steps to restrict Russian activities, I am sure that we will identify areas, as we have on this occasion, that will further address those very issues. As a former person of the City myself, I fully understand the comprehensive scope of not just the banking services but the services industry around them. We have previously addressed consultancy and accountancy firms and today, in conjunction with legal representatives, we have worked through the implications for the legal industry.

I am sorry to interrupt but regarding the exemptions, I was going to ask about the provision of professional business services, specifically related to auditing services. I cannot understand why there is an exemption for that.

As I understand it, the auditing element of it is a professional and legal requirement, but if I can amplify that further I will of course write to the noble Lord.

The noble Lord, Lord Purvis, and my noble friend Lady Lawlor raised the issue of the general licence and its application. Under the general licence, UK persons will be able to advise on global sanctions regimes, including but not limited to the United Kingdom, USA and EU. In response to my noble friend, the same applies to the scenario she illustrated of a UK person working in the USA. However, I will take all these elements and ensure that there is a specific response because these are understandably issues of concern.

At this juncture, I also say that our rule of law and justice system allow for the provision of representation services. I am sure that the fact that I did not get a question on that means that noble Lords have acknowledged and noted that it is right that a country such as the United Kingdom continues to protect that right of legal representation. We may have our personal views on particular people who seek to take advantage of our professional services but, at the same time, every professional, including legal professionals, will now be bound by the new regulations that we are putting forward.

On the issue raised by the noble Lord, Lord Collins, specific to the Diplomatic Service, I am sure that some areas of privileges and immunities are covered in that. Again, in the interest of completeness, I will cover that in the appropriate letter.

On auditing, as I said, audits apply to the shareholders rather than the companies, in order to ensure that audits can take place where they are a statutory requirement. I have just had that confirmation from the Box—I remember some of my private sector experience quite well. It shows that when you do things off the cuff, you remember things from years past.

In all seriousness, we have sought to address some of the key areas identified as these new regulations and sanctions regimes are applied. While we have worked to ensure that Russia cannot access our legal expertise in relation to certain commercial activities, we have not hindered work that helps to provide judicial rights and access to justice.

These measures are the latest addition to our package of sanctions, which is having a damaging effect on Mr Putin’s war machine and his regime. I know that the UK Government and all Members of your Lordships’ House are united in keeping the pressure on Mr Putin until he ends this horrific and senseless war.

Finally, if, before the House rises, there are further details I can share with noble Lords on the issuance and the date of issuance of the general licences, I will do so. I will write to noble Lords on the areas that I have said I will address, particularly on diplomats. That said, I put on record my sincere thanks to all noble Lords, including my noble friend, who participated in this brief debate. Sadly, and tragically, I am sure that we will have further debates on this.

My Lords, the UK strongly condemns the abhorrent attacks on civilians across Sudan. Reports of atrocities, including the UN report of a mass grave in Darfur, are, of course, deeply disturbing. These atrocities need full and thorough investigation. Those responsible must be held accountable. The evidence suggests another crime against the people of Sudan. Our immediate priority is to stop the violence in Sudan, to ensure that civilians are protected, and to secure immediate safe and unfettered humanitarian access. We remain seized of the importance of investigating these attacks.

My Lords, I am grateful to the Minister for that reply. Reports of mass graves come from Geneina, a place I visited during the genocide in Darfur, when hundreds of thousands died and 2 million people were displaced, many of them fleeing to Chad. The Minister will recall the recommendations in the All-Party Group on Sudan and South Sudan’s report, which was published in April following the inquiry that I chaired, warning of the risk of a new genocide in Darfur.

How are we fulfilling our duties, in this 75th anniversary year, under the convention on the crime of genocide, which places on us and on the international community the duty to predict, prevent and punish those responsible for atrocities, targeted in this case at non-Arab ethnic groups in Darfur? How are we assisting the prosecutor of the International Criminal Court, Karim Khan KC, who told the United Nations Security Council last week that we are

“in peril of allowing history to repeat itself”?

He said that Darfur is

“not on the precipice of a human catastrophe but in the very midst of one. It is occurring”.

Are we collecting the evidence? Are we protecting those at risk? Are we stopping that catastrophe unfolding?

My Lords, I agree with Karim Khan, the ICC prosecutor. That is why we are working very closely with him. He gave that evidence last Thursday, during the UK presidency. It is also important that he recognised that the ICC has a continuing mandate during this conflict and in Darfur. As the noble Lord will know, it is directly investigating whether genocide, crimes against humanity and war crimes generally have occurred. We are very much focused on that.

On evidence collection, we have a central unit within the FCDO that allows us to collect some of the evidence remotely. There are issues of access in Darfur. I remember visiting Darfur myself, and the challenges were still immense when there was access. However, as I said, the first step must be a resolution on a cease- fire between the two warring sides to allow for a full assessment to be made.

My Lords, what Karim Khan said at the Security Council was about impunity. He gave the historical cases; court cases are still continuing. One plea he made to members of the Security Council was: what pressure would be put on the Government of Sudan to co-operate fully with the ICC? Can the Minister tell us what we are doing to put pressure on Sudan so that people cannot act with impunity in the future?

My Lords, as I have already said, we are working very closely with the prosecutor. As the noble Lord will be aware, various avenues are being pursued in Sudan to resolve this conflict. The first thing is having a ceasefire. We are working with regional counterparts in IGAD and the African Union. We are also working as part of the quad, including with the Kingdom of Saudi Arabia, the UAE and the US, and of course we have troika responsibilities historically to Sudan. All of these avenues are focused first and foremost on stopping this conflict and, secondly, as the noble Lord articulated, ensuring that these crimes are fully investigated and that there shall be no impunity for those who have committed them.

My Lords, we are all in the debt of the noble Lord, Lord Alton, for raising this matter. Is it not deeply disturbing that the Security Council, mentioned by the noble Lords, Lord Alton and Lord Collins, has two permanent members which are themselves implicated in crimes against humanity, and that it is very possible that those could be defined as genocide as well.

My Lords, importantly, since the establishment of the United Nations the UN Security Council has sought to provide a forum. It continues, notwithstanding the challenges we face from certain members, to play an important role and to provide a way to address the issues of conflicts present and to avert future conflicts. I hear what noble Lords say, and of course we pursue all issues and concerns raised by any member of the international community and any member state in a forceful manner through bilateral representations, and we address them through multilateral fora.

My Lords, I declare an interest; I am actively involved in supporting dialogue with Sudanese civilians, including last week in Addis Ababa. Will the Minister agree that there is now a very real risk of ethnic and tribal conflict across the whole of Darfur? But there is a chink of light, as the civilians resisted calls by Minni Minnawi and other leaders to arm themselves. All efforts should be focused on supporting the current talks in Chad, which are multi-ethnic and could offer an opportunity for wider talks in Sudan. Some 200,000 Sudanese have fled into Chad. This is a crisis that, as the noble Lord, Lord Alton, said, we can see ahead of us, but it is one that can be prevented.

My Lords, I recognise the important work that the noble Lord is doing and I very much appreciate the strong engagement we continue to have outside the Chamber. I also recognise the importance of civilian engagement at this crucial time. The noble Lord and I have discussed this matter, and we will be pursuing it to see what role the UK can play in strengthening that voice. As I said, we are engaged at all levels with all key negotiations. Ultimately, what is required is that both sides cease their current crimes. Both generals believe that their reason for being is to beat the other into non-existence, which, ultimately, means that civilians suffer. On the humanitarian crisis, it was eye-watering to see the displacement both internally and externally prior to the conflict. Tragically, this continues, running not into the hundreds or thousands but into the millions.

My Lords, as the Minister is aware, the impact Darfur has on neighbouring countries is very serious. Many people are fleeing to neighbouring countries, particularly South Sudan, where the humanitarian crisis is already a major concern. Given that many are already in famine circumstances and the UN aid programme is stretched to the limit, can the Minister explain what we are doing to assist those who fled Darfur?

First, as the noble Lords, Lord Alton and Lord Purvis, said, those who are fleeing are often targeted, including many minorities. Early evidence from the mass grave shows that it contains 87 ethnic Masalit people. On the noble Lord’s specific question, we recognise the importance of South Sudan but the supply chain to it is through Sudan, and there have been reports of supplies being held up or seized by the warring factions. That is why we need to ensure that all the different diplomatic channels are fully explored. A key message needs to be given to both sides that they need to cease warfare now, so that humanitarian aid can reach the people of Sudan and, as the noble Lord said, the people of South Sudan as well.

My Lords, my noble friend mentioned the African Union and of course we are going to need the support of the African Union consistently in addressing this horror and, indeed, similar horrors that are likely to occur in future. Is he aware that the African Union as a whole has recently applied to join the G20, arguing that Africa has no adequate voice in geopolitical affairs or in gaining the support of the wider world with the problems we are discussing now? Is that something that he and the Government would look on favourably? Is there a way forward in which we can work more closely with the African Union anyway, 21 members of which happen to be members of the Commonwealth?

My Lords, I have noted this very carefully. During the Indian G20 presidency, this was pursued by India in both the invitations extended and the role of the African Union. I think there is a case to be made, as we see the different movements of power and power centres, that it is not just the European Union or western blocs: the African Union is equally important in what it presents, in terms of both conflict resolution and the empowerment of communities across the continent.

My Lords, what is happening in Sudan saddens me greatly, like other noble Lords in the House. I have had the privilege of working with women parliamentarians and civil society in Sudan: it is a country of great potential. Can the Minister assure us that he is also taking on board what is happening to the women of Sudan? In particular, how are we making sure that in this conflict, the rape and pillage of women and families is not being used as a weapon of war, given the worsening situation?

My Lords, I assure the noble Baroness that we continue to focus on the terrible tragedy that is unfolding in Sudan, with a particular focus on the plight of women and girls, as she points out. It is not just in Sudan; it is a tragic fact that wherever conflicts occur, the most vulnerable are attacked, and that includes women and girls. That is why only on Friday I chaired a session of the UN Security Council focused on preventing sexual violence in conflict, where we introduced a new guidebook, working with the Dr Denis Mukwege Foundation, on what action states can take in terms of prevention, not just in addressing live conflict. I agree with the noble Baroness and I assure her that my right honourable friend the Foreign Secretary, the Development Minister and I, as the multilateral Minister, are focused on delivering those exact messages.

This is a simple case of human values. The kinds of abhorrent crimes we see against women and young girls are shocking, to say the least. When we see victims as young as four, five or six, if not younger, being attacked, raped and pillaged in conflict, including in the conflict in Sudan and elsewhere in Africa—for example, in the DRC—we must act. We will continue to work collectively to ensure that we can put these abhorrent practices into the history books.

My Lords, as we have already heard from the noble Lord, Lord Alton, the situation in Darfur is dire, and I am grateful for this opportunity to be reminded of that. At least six towns and villages have been burned to the ground, alongside numerous cultural sites. We have heard a little about the effect on girls and women, and boys over fighting age are being shot. Understandably, many of the targeted Masalit ethnic group are fleeing to surrounding countries. We have heard about those going to South Sudan, but the vast majority are going to Chad. What steps will the Government take to provide Chad with support for the refugee crisis as a result?

My Lords, the right reverend Prelate raises the important issue of the displacement of refugees. We have already made a series of announcements of support for the stability of Sudan and its near neighbours. At the moment, alongside our £5 million commitment to help the urgent needs of refugees and returnees in South Sudan and Chad, we have, through the Development Minister, made a further commitment of £21.7 million, which we announced specifically for humanitarian aid for Sudan as part of our contribution at the UN Horn of Africa conference. We will continue to assess the key issue but, going back to other questions, the challenge is not just about providing money and support, it is about ensuring that humanitarian aid reaches those most in need.

My Lords, two decades ago in Darfur, systematic rape was used as a weapon of war as part of ethnic cleansing and genocide. No one has been held accountable and those same crimes are being repeated today. Can my noble friend tell the House what concrete steps we are taking so that this time around documentation is sufficient so that we reach accountability, not as an aspiration but as a reality?

My Lords, I agree with my noble friend. I am sure she will acknowledge the steps that we have taken to ensure that the testimonies of those who have survived sexual violence in particular, but other crimes too, are fully documented. Often there are representatives of well-intentioned INGOs in the field, but their collection of evidence can sometimes negate the impact of allowing a successful prosecution.

The concrete steps that we have taken include, as my noble friend knows, the Murad code, which allows not for a time-limited period but ensures that evidence can be collected and sustained, to allow for successful prosecutions. Indeed, that is why we are working closely with international courts such as the ICC, and the prosecutors specifically, to ensure that the connection between testimony collection and prosecution is very live.

My Lords, we are aware of the extensive involvement of the Wagner Group in this conflict and its associated criminal activities but, if one is to believe the messages coming from Moscow— I admit that is a bit of a stretch—the Russian Government are taking direct control of the Wagner Group and its activities. What assessment have His Majesty’s Government made of the direct involvement of the Russian Government in the conflict in Sudan, which of course is hardly likely to simplify the challenge of achieving a lasting peace?

The noble and gallant Lord raises a key point. Of course, we are fully aware of the growing influence of the Wagner Group in many conflicts across Africa. On the question of Russian state and non-state activities in Sudan, we are making repeated representations to and raising our concerns with others, both near neighbours and other countries that have influence. We are particularly focused on Russian activities in Africa, which include reports of Wagner Group involvement in gold mining specifically and in disinformation campaigns in Sudan. The noble and gallant Lord is right: it is a key concern at the moment, with the growing influence of, and instability caused by, the Wagner Group. As we have seen, it is not a reliable partner, and even the Russians are learning that lesson.

My Lords, with the leave of the House, I shall now repeat a Statement made by my right honourable friend the Minister for Indo-Pacific in the other place on the situation on Hong Kong. The Statement is as follows:

“Last week, I came to this House to speak on the egregious arrest warrants and bounties issued by the Hong Kong police against eight individuals for exercising their right to freedom of expression. Some of these individuals reside in the UK. As I said at the time, this is completely unacceptable.

Since then, the authorities in Hong Kong have taken further steps to silence and intimidate these individuals by targeting their families and alleged associates who remain in Hong Kong. Last week, we saw five individuals arrested by the Hong Kong police. On Monday, family members of one of the named individuals, Nathan Law, were detained for questioning by Hong Kong police and have since been released. This is a worrying development. This is a campaign of fear intended to intimidate and silence those who seek to speak out peacefully against oppression and the erosion of rights and freedoms.

This is a choice the Hong Kong authorities have taken, no doubt emboldened by the Chinese Government’s imposition of the national security law. It will only further damage Hong Kong’s international reputation and standing. The United Kingdom declared the national security law a breach of the Sino-British joint declaration and brought together the international community to condemn the imposition.

In response, we introduced the bespoke visa route for British overseas nationals. Hong Kongers have since made the United Kingdom their home and are making a valuable contribution to our communities. We suspended the UK-Hong Kong extradition treaty immediately and indefinitely. We also announced the extension to Hong Kong of the arms embargo applied to mainland China since 1989, as updated in 1998.

I would like to make it exceptionally clear that we will not tolerate attempts by either the Chinese or the Hong Kong authorities to intimidate and silence any individuals in the United Kingdom. Any attempt by any foreign power to intimidate, harass or harm individuals or communities in the United Kingdom will not be tolerated. This is an insidious threat to our democracy and fundamental human rights.

On 3 July, the Foreign Secretary called on the Hong Kong authorities to end their targeting of those who stand up for freedom and democracy. They have not heeded this call. At the instruction of the Foreign Secretary, a senior official will be formally protesting recent actions by the Hong Kong authorities with the Chinese ambassador.

We will make and have consistently made clear our objections to the Beijing-imposed national security law to Chinese Government and will continue to do so. It has stifled opposition and criminalised dissent. The authorities claim that this has brought stability to Hong Kong, but what it has really done is stifle the unique character of the city and diminish its pluralism and vibrancy. If this course of action continues, it will alienate business and the city’s international financial status will be at risk.

The Hong Kong and Chinese authorities repeatedly condemn comments in this House and by the Government as interfering in their internal affairs. As a co-signatory to the joint declaration, we have the right to make clear our position, and we will not be deterred from doing so.

The national security law should never have been imposed in 2020 and should be removed. The independent UN Human Rights Council concurred with this in its report on Hong Kong last year, as have many of our partners in the international community. No one living in the United Kingdom should feel inhibited by that law in any way. We will always stand up for the right of freedom of expression.

This is not what the United Kingdom wants for Hong Kong’s future. Hong Kong’s way of life, prosperity and stability rely on respect for fundamental freedoms, an independent judiciary and the rule of law. We will continue to stand up for the people of Hong Kong, to call out violations of their rights and freedoms, and to hold China to its international obligations. I commend this Statement to the House.”

My Lords, the Government will find no disagreement at all with the Statement from these Benches. We also support the remarks of the noble Lord, Lord Collins.

It is clearly unacceptable that the United Kingdom and its politicians should, in effect, be threatened by another country’s embassy over hosting individuals who will now, as John Lee indicated, be fearful for the remainder of their lives unless they return to Hong Kong. There is reportedly a £101,000 bounty on them. This is clearly unacceptable behaviour. What advice are the Government providing to individuals being threatened in such a way on accessing information and support from British police? We must be prepared for Chinese authorities to go beyond pure threats as, regrettably, we have seen physical action in this country, which is equally unacceptable.

I have three questions for the Minister. The first relates to our economic relationship with China. Clearly, our diplomatic relations are in a complex and sensitive state, but there seems to be very little action from the Government to see those concerns reflected in our trading and investment relationship via Hong Kong. Eight years ago, Prime Minister David Cameron indicated that he wanted Britain to be the preferred partner of China in the West and signed a number of preferential market access agreements with China. I have asked repeatedly which of those agreements we have alerted the Chinese authorities that we will pause on the basis of human rights concerns. The Government have indicated that none will be.

This is compounded by the Trade Minister from this House, the noble Lord, Lord Johnson, actively engaging with the Hong Kong authorities at the same time as they are announcing bounties on people in this country. My second question to the Minister is this: which Minister authorises Trade Ministers to visit Hong Kong? Is it the Prime Minister personally or the Secretary of State for the Department for Business and Trade? I do not know whether that department or the FCDO is in charge of our relations with China.

Thirdly, the Independent Commission for Aid Impact recently updated its review on UK aid to China. Many people will be alarmed to hear that, under the latest set of figures, it found that the United Kingdom has given £48 million in overseas development assistance to China—a country on whose goods we are dependent by a trade deficit of more than £40 billion. The commission found a concerning lack of transparency on a government strategy to reduce development assistance to China. I hope that the Minister can respond positively to the ICAI report and indicate when that figure will reduce to zero. I think that British taxpayers will be concerned when aid is being cut to those starving in the Horn of Africa but we are providing nearly £50 million to China.

My final point relates to the point made by the noble Lord, Lord Collins, with which I agree, on the need for a longer-term strategy. The Minister is well aware that a report of the International Relations and Defence Select Committee of this House found a “strategic void” from this Government on our relations with China. It said:

“There is no clear sense of what the current Government’s strategy towards China is, or what values and interests it is trying to uphold in the UK-China relationship”.


It is now absolutely necessary for us to have a clear long-term strategy on our relations with China—diplomatic, economic and cultural. I hope that the Minister will respond positively and say that this will now be the Government’s approach.

I thank both noble Lords for their support for the Statement. I accept that there are questions about our future relationship with China that we will continue to ask but, equally, I thank noble Lords and their respective parties for their support for the actions we are taking. It is right not just that we are concerned for the BNOs who have arrived to make their homes here in the United Kingdom and who are contributing so much but that we recognise that there remains a responsibility to every Hong Konger under an agreement signed by both China and the United Kingdom. In that respect, we remain focused and vigilant to ensure that those issues continue to be raised directly with China.

I will go through some of the specific questions, first on strategy and the way forward. The noble Lords, Lord Collins and Lord Purvis, both raised this in their own ways; the noble Lord, Lord Collins, repeated something that he asked me last week and the noble Lord, Lord Purvis, asked specifically about our future role.

First, I saw a summary of the Intelligence and Security Committee report on China earlier today. As noble Lords are aware, my right honourable friend the Prime Minister issued a Written Statement on this report, which I quote:

“The Integrated Review 2021 articulated the United Kingdom’s robust stance towards China. It highlighted China’s increasing international assertiveness and identified it as the biggest state-based comprehensive threat to the United Kingdom’s economic security. It placed greater emphasis on defending our interests and values while preserving the potential for cooperation on shared interests. The Integrated Review Refresh 2023 went further still, responding to subsequent changes in the strategic environment. In the IRR, the government recognised China as a systemic challenge with implications for almost every area of government policy”.


In the interests of time, I refer noble Lords to the Written Statement from my right honourable friend the Prime Minister, which clearly highlights the challenges posed and, importantly, the steps that we have taken in response to those challenges.

Noble Lords will recognise that much of the information for that report was received before 2021. A number of the issues and recommendations that it raises are addressed by some of the actions that we have taken, for example passing the National Security Act in 2023 and the foreign interference offence created by that Act. Through the Home Office, we have also set up the Defending Democracy Taskforce, overseen by the Security Minister. I refer noble Lords to that Statement; I am sure that further questions will arise on that issue.

The noble Lord, Lord Purvis, asked about visits and trade. I am sure all noble Lords recognise that China is a country that has a role to play on the world stage. I will shortly be going to the UN Security Council, and we have worked with China on a number of key priorities, including the issues and challenges of climate change, the security situation on various conflicts and, importantly, the issues of resolutions around the world. We recognise the role of China as a P5 UN Security Council member. We saw also that, on various health challenges that have been faced over time, China has played a role in assisting the global community.

However, that should not allow us to—and we do not—shy away from calling out China for its egregious abuse of human rights. I am sure noble Lords recognise the work of this Government on this important issue, and the leadership we have shown on the Human Rights Council, particularly on the issue of Uighur Muslims in Xinjiang.

The noble Lord, Lord Purvis, referred to my noble friend Lord Johnson’s visit to Hong Kong to discuss business ties that link the UK and Hong Kong. It is right that we continue to strengthen Hong Kong, not just because of our historic ties but because the whole basis of the agreement we signed was to ensure the continuing prosperity of Hong Kongers. I fully accept that it must be tied to ensuring that the rights of Hong Kongers are also protected. He spoke up quite directly against the erosion of rights and freedoms in Hong Kong and, I assure noble Lords, also raised key concerns that are affecting communities, such as pension access, in meetings with government officials.

The noble Lord, Lord Collins, asked about a UN debate specifically. I am sure that this will be something which I will reflect on, but I can certainly say at this time that there are no current plans to raise a particular UN Security Council debate. As the noble Lord, Lord Collins, may know, my right honourable friend the Foreign Secretary has made a statement on human rights in Hong Kong at the UN Human Rights Council. I will keep the noble Lord updated.

The noble Lord also asked about UK judges. The Government supported the decision of sitting UK judges to resign in March 2022. I am sure that both noble Lords recognise the independence of the judiciary as a key component of any democracy. The UK judges who remain as non-permanent members of the Court of Final Appeal are retired from judicial service in the UK. Lawyers who are practising in Hong Kong do so as private citizens. I am sure they are watching the situation very carefully but, from our perspective, ultimately it is for them to make their own personal decisions. It is important to respect that decision and I am sure they are reflecting on the latest pronouncements and announcements we have seen out of Hong Kong.

The noble Lord also raised issues of security measures in place for individuals in the UK. I am sure that both noble Lords will respect the fact that I will not go into specific details on individuals; as a matter of long-standing policy, we do not comment specifically on operational matters. However, I assure noble Lords that, where we do identify individuals at heightened risk, we are front-footed in providing them with protective security guidance, and indeed any other measures they may require in this respect.

The noble Lord, Lord Purvis, also raised the issue of overseas development assistance and China. We stopped direct Government-to-Government aid to China in 2011. Total ODA to China in 2021 included spend as outlined by the noble Lord. In a Written Ministerial Statement in April 2021, the FCDO committed to cut ODA-funded programmes in China by 95%. In addition, a lot of these programmes cover some of the educational elements. Chevening scholarships, ODA-eligible operational costs for UK diplomatic missions in China and ODA-eligible British Council activities are contained within this. I assure the noble Lord that no funding goes to Chinese authorities in this respect.

On the progress of this, BEIS, for example, announced in a WMS in May 2022 that its ODA-funded activity with China would also finish by the end of the financial year 2022-23. The FCDO is fully aware that China will eventually reach an income threshold to graduate, because of its sheer population size. But I hope I have reassured the noble Lord that, where those programmes are run, they are run within an educational sphere and support the vital work of organisations such as the British Council.

Both noble Lords raised concerns, which I share, that no citizen in the United Kingdom should be subject to any threat; we take this very seriously. The noble Lord, Lord Collins, raised the issue of transnational threats and our agreements and arrangements with other countries. I assure noble Lords that we work directly with all our key partners, including the United States and the European Union. Although the UK has indefinitely suspended its extradition treaty with Hong Kong, we recognise that there should be no place where others may seek to leverage transnational partnerships and abuse the use of Interpol. We are vigilant on such threats. Of course, if there are further updates to provide to noble Lords, I will do so.

I reassure noble Lords that we work in a transnational way to show that people from Hong Kong, or British nationals overseas who now reside in the United Kingdom, are protected and secure not just in the UK but wherever they may be in the world.

My Lords, I am sure that we are all grateful to my noble friend for bringing his customary thoroughness to the answers he has just given. I declare an interest in that I led the last CPA delegation to Hong Kong before the handover, and two of my grandchildren were born in Hong Kong—my son was serving there.

I am deeply troubled by one thing in particular: the position of the judges. I completely accept what my noble friend said about the independence of the judiciary, and I make no criticism whatever of those eminent judges who still function, to a degree, in Hong Kong. But will my noble friend perhaps think of convening a meeting with them? The fact is that they are lending a veneer of respectability to a dire situation. All our hopes were high at the handover in 1997, and they remained so for many years after. But there is now a sinister repression in Hong Kong that completely abrogates the treaty that China and we agreed to. The time has now come when either China has to accept that treaty again or those who are inadvertently giving a veneer of respectability to it cease to do so.

I make one final point. My noble friend said that there were no plans to raise this issue at the Security Council during our chairmanship. I would ask that he talks to the Foreign Secretary and rethinks that. This is of enormous importance; we are dealing with the second most important power in the world, after the United States, and we must do everything we can to see that the international rule of law is observed by China, not flagrantly abused, as it is currently.

My Lords, I will start with the final point that my noble friend raised, about the UN Security Council. As my noble friend knows, there are various institutions of the United Nations, and I have become reasonably familiar with them over the last six years as the United Nations Minister, among other things, at the Foreign, Commonwealth and Development Office. That is why we chose the vehicle of the Human Rights Council, which was set up specifically for this matter. It was right that the issue and the statement were raised directly by my right honourable friend the Foreign Secretary. The mandate of the UN Security Council is important, covering security and conflict issues across the piece. Of course, any agenda item on China’s role on the UN Security Council will also be determined, in part, by its effectiveness within that particular structure. However, we are raising these issues quite directly with China on a bilateral basis, with the Hong Kong authorities directly and, as I illustrated, at the United Nations.

On the issue of judges, there is nothing further I can really add. Like anyone, I am sure that the judges who continue to serve—and I add again that they are retired judges—will rightly make decisions that are reflective of their own key principles. I am sure that they are looking at these things very carefully. It is essential that the Hong Kong judiciary and Hong Kong’s legal institutions can operate independently and free from political interference.

My Lords, I thank the Minister for the Statement. He will recall from a debate last week the serious concerns around the alarming authoritarian actions that the CCP is taking against those who speak out so bravely against the regime. I have three questions for the Minister. First, can he assure us that our security forces are ensuring the freedoms and safety of the three individuals currently in the United Kingdom who have enormous bounties placed on their heads? Are they safe from any clandestine activities, whether by criminal or foreign government actors?

Secondly, can the Minister clarify whether any of these eight individuals will now be flagged by Interpol if they travel through international passport controls? Finally, can he give us any further information about attempts by an alleged Chinese spy to infiltrate a meeting in this very building in which two of the three targeted individuals were speaking? That the Chinese security forces are attempting to operate at the heart of our democracy is shocking. It cannot and must not be tolerated.

All parliamentarians must continue to speak up, unintimidated, for those who fight for freedoms in Hong Kong, most especially on our Parliamentary Estate. The Intelligence and Security Committee report released today, as my noble friend Lord Collins mentioned earlier, is critical of the Government with regard to China, especially in their apparent willingness to trade off economic interests and security concerns. These concerns now have a very human face.

My Lords, there is little that I can disagree with in what the noble Lord has said. I put on record again that I think he adds a real insight and value to our discussions and debates, as he has illustrated in his observations and the questions that he has raised today, and I look forward to working with him on this important agenda. I assure him, as I have already said, that with regard to those nationals who are present in the United Kingdom—and this applies to every British citizen—it is the first duty of any responsible Government to look after the security of their citizens. We do not take that responsibility lightly in any shape or form. Previous Governments have also made this a priority, and I know that future Governments will as well. We will not tolerate any attempts to intimidate people simply for speaking out. We will always defend the universal right of freedom of expression and stand up for those who are targeted.

I recognise the challenge and the important issues that the noble Lord has posed on issues of security. He raised issues and concerns about the Parliamentary Estate. I praise the parliamentary authorities, which remain very vigilant and on the front foot—I have personal experience of such things. Indeed, if any threat is perceived to the estate or to a given individual, particularly a parliamentarian, they are very much on the front foot when it comes to ensuring the safety and security of the estate and the individual parliamentarians. I have no doubt that it is very much at the forefront of their minds.

On the issue of any heightened risk, we of course keep every assessment and monitor this closely. We are very much aware of the challenges posed by the Chinese Government and state, and indeed other actors—and also of the way in which the threat may emanate. We live in a very different world of the digital age, and we are very much seized of the challenges that we confront there. I assure the noble Lord that, in all these respects but particularly with regard to security—he mentioned the use of Interpol, which I have already talked to—these institutions are set up to protect, not to intimidate.
