Commons ChamberI am sure that the hon. Gentleman is fully aware that the mayor has repeatedly made it clear that he has no plans to act on road user charging.
We will all miss John Prescott. He was a titan of our politics, and a man not afraid to come out swinging for what he believed in.
The figures show that capital spending on transport is not rising under Labour; it will fall by 3.1% in real terms next year. We have huge tax rises and a more than £70 billion increase in tax. Labour’s black hole myth has been debunked by the Office for Budget Responsibility, the Financial Times and the Institute for Fiscal Studies—all real economists—so why the cut in capital spending? The Secretary of State was out of her depth when she negotiated a £9,000 pay rise for ASLEF train drivers with nothing in return. Was she out of her depth when she negotiated with her own Chancellor?
We are working with the mayors as we look to establish Great British Railways. I have asked the Office of Rail and Road to conduct an independent review of rail operators’ revenue protection practices. That launches today and will involve devolved operators, where appropriate. Addressing fare evasion is a priority, but we must always treat passengers fairly and appropriately.
Order. Questions should be a bit shorter. I do not know who is doing your briefings—well, I suspect I do—but shorter questions would be helpful.
Of course, a priority for this Government is to keep public transport affordable, but our absolute priority is to fix the mess in the railways that we inherited after 14 years of under-investment, decline and putting passengers last in a broken system.
John Prescott was a towering figure in the politics of the Humber region, and I associate myself with the words of sympathy to his family. Roads in my constituency are under greater pressure because traffic from the A180 is continually being transferred on to them while it is being patched up. Earlier this month, the hon. Member for Great Grimsby and Cleethorpes (Melanie Onn) and I met National Highways, and it is perfectly obvious that the A180 will be in its present state for many years to come. Will the Secretary of State meet me and the hon. Member for Great Grimsby and Cleethorpes to discuss this and other transport issues in the area?
I am sure that the Minister with responsibility for roads, my hon. Friend the Member for Nottingham South (Lilian Greenwood), would be very happy to meet the hon. Gentleman and my hon. Friend the Member for Great Grimsby and Cleethorpes (Melanie Onn).
The Budget committed significant funding both for mayoral areas and those not covered by mayoral combined authorities through the local transport fund. Crucially, new powers will be delivered to those areas to ensure they can take back control of their local public transport services. Of course I would be delighted to meet my hon. Friend to discuss this further.
Greater London is the most heavily populated and most economically active area in the whole country. It also has the highest level of bus use. In the last financial year, the level of bus subsidy in London amounted to £646 million. In the Secretary of State’s statement on Monday, of the £1 billion of funding that she indicated, £700 million will be spent on producing bus planning documents, and only £243 million is going to bus services. That will not touch the sides, will it? Is the truth not that, far from it being generational reform, it is publicly funded window dressing?
I absolutely agree with my hon. Friend. I have repeatedly made clear that it is not good enough. We inherited a railway where workforce terms and conditions were completely outdated and not fit for a modern railway. We are addressing that, and as a result Northern’s cancellations are starting to come down, but we appreciate that there is still a long way to go.

Order. I am sure that question must be related in some way to Old Oak Common. I think we need to be more descriptive when asking such questions. Secretary of State, answer as you wish.
I am happy to answer that question, Mr Speaker. The two-year industrial dispute cost the taxpayer £25 million a day every time the Tories oversaw a strike day. The reforms that they pursued cost taxpayers hundreds of millions of pounds. We have since settled the national pay dispute and localised disputes on London North Eastern Railway and CrossCountry, leading to improved passenger services across the country.
I am grateful to the hon. Lady for raising that point, and it sits at the heart of our ambition to develop the new road safety strategy. The previous Government pursued poisonous culture wars against road users of all descriptions. We are determined to take back streets for pedestrians, cyclists and drivers, and that will be at the heart of our new ambition for the road safety strategy.
Road safety is inextricably linked to the state of our roads. [Interruption.] Government Members might want to wait. New polling suggests that surface conditions on major roads are getting worse, risking more accidents. Will the Secretary of State confirm—a yes or no answer will suffice—whether her Government will maintain the previous Conservative Government’s commitment to £11 billion in road repair budgets?
I welcome the fact that the Secretary of State has met the chief executive of the DVSA to discuss urgent solutions to the sky-high driving test waiting times. According to the latest statistics, the waiting time in the Wood Green driving test centre in my constituency was 18.64 weeks. Will my right hon. Friend confirm that this issue is a top priority for the Government, so that my constituents can be reassured that driving test waiting times will be drastically reduced?
Order. Can I just say to Members who have been here a long time, please speak to the Chair? They should be speaking through a third party, not directly. I am trying to take some of the anger out of it. Please work with me on that.
I am very grateful to you, Mr Speaker, as I am to my hon. Friend for raising that important question. He is absolute right. Average waiting times at the Wood Green centre currently sit just above the national average. The measures that the DVSA is already taking to reduce waiting times include conducting tests outside regular hours, at weekends and on public holidays, and continuing to deploy examiners from areas with lower waiting times. That is in addition to producing additional examiners across the country in areas where waiting times are highest. We will soon set out to the House further steps by which we will bring down waiting times further.
The hon. Gentleman has made the case for franchising. It is totally unacceptable that entire villages are cut off, without the bus services that they absolutely need. That denies people the opportunity to move around their area and get to work or education opportunities. The Mayor of Cambridgeshire and Peterborough is pursuing franchising. We are supporting him in those efforts, and we will make sure that villages such as those in the hon. Gentleman’s constituency are properly included in the franchising process.
I wonder if the right hon. Lady can see the irony in the fact that the new bus system that she is so excited about introducing is broadly the same as the train system that she is busy dismantling. The simple truth is that without funding, the Government’s plan will not make struggling bus services viable or affordable for passengers. What has helped is our £2 fare cap, which has saved millions of people money and helped to keep local buses going, especially in rural areas. Does the Secretary of State agree that the £2 fare cap has been a good thing and, crucially, is she going to keep it?

Commons ChamberCar insurance costs have increased by 80% since the Secretary of State came into office. If he is intent on ending the war on motorists, what has he done about it?
Given that the Secretary of State had advance notice of my question, I am afraid that his answer shows how out of touch with reality he has become. Car insurance is not a luxury but a legal requirement, and it is completely unaffordable for millions of drivers. There has been a £219 increase in the average premium in two years. Instead of parroting conspiracy theories about 15-minute cities, why does he not do his job, take action, demand action from regulators, call in the Competition and Markets Authority, and act on soaring insurance premiums?

Commons ChamberLast Sunday marked the two-year anniversary of P&O Ferries illegally sacking 786 workers, but two years on nothing has changed. This week an investigation by ITV and The Guardian revealed that P&O Ferries is not only paying many of its workers less than half the minimum wage but forcing staff to work 12-hour shifts seven days a week for up to 17 weeks at a time. France’s maritime Minister has called that “dangerous” and “not moral”, and has changed the law to stop it happening. The Seafarers’ Wages Act will not curb that treatment, nor will the Government’s voluntary charter, so when will the Government act to prevent those exploitative practices from happening in our waters?
The Minister will have seen reports this week that 3,000 jobs are at risk at Alstom rail factory in Derby. The Government told us that they were doing everything in their power to prevent those job losses, but they appear to be failing. It gets worse: this morning, I received correspondence from Hitachi Rail, warning that despite years of representation to Ministers, no solution has been found that will keep its order books full and safeguard the future of 700 staff at its factory in Newton Aycliffe. The Secretary of State has it in his power to vary contracts and commission the necessary orders. When will he do that and protect those jobs?

Commons ChamberI associate myself with the Secretary of State’s best wishes to His Majesty the King.
During my time in this House, I have worked alongside victims and survivors of the Rotherham child sexual exploitation scandal. Following the scandal, Rotherham council set very high standards for its taxi drivers, including installing CCTV in cabs and requiring national vocational qualification level 3 on child safeguarding. Those standards are being undercut by the Government’s deregulation of taxi standards, and nothing the Minister has set out this morning will stop that. Does he not agree that the Government’s position is putting the safety of women and girls at risk? Is it not time for robust legislation and national minimum standards to protect them?
What does the Secretary of State think that it says about the performance standards in the contracts that he signed with failing operators that senior executives at Avanti, whose cancellations now run at 17%, could boast about the “free money” from the taxpayer that is
“too good to be true”?

Commons ChamberWhile Heathrow and Gatwick set out plans to expand, the Government’s regional airport strategy has been seriously undermined by the—hopefully—temporary closure of Doncaster Sheffield airport. The Secretary of State has the power to protect the air space around the airport while Doncaster council undertakes negotiations with Peel on the lease. Will the Secretary of State do that?
The Minister has managed to unite Labour MPs, his own Back Benchers, you Mr Speaker, disability groups, trade unions and consumer groups in their concern about these closures. Even former “Pointless” presenter Richard Osman has voiced his concerns. And it is little wonder, because this consultation is completely pointless. There are just 21 days for people to voice their concerns, no equality impact assessments, and no answers on job security, accessibility or digital ticketing. Will the Minister think again, acknowledge the consultation is a sham, pause it and go back to the drawing board?
Does the Secretary of State think it is acceptable that the villages of Little Ouseburn and Beal, in the Selby and Ainsty constituency, have no bus service either in the evenings or on Sundays? Who does he hold responsible for that? Is it the Tory Government, which completely snubbed Selby and Ainsty in their bus strategy, the Tory council, which cut 1 million km of subsidised bus routes, or the previous Tory MP, who mentioned buses just three times in over 13 years? Does he not agree that it is time for Selby and Ainsty to have a fresh start, with Keir Mather?

I associate the Opposition with the Secretary of State’s comments. We send our thoughts and prayers to the victims of the terrible tragedy in India.
Over the past year, passengers have faced total chaos on our railways. Cancellations rose to their highest ever levels. Strikes have disrupted countless journeys, while the Transport Secretary still refuses to sit down with the unions. The fourth franchise in five years has just been brought into public ownership. And now we hear that the lucky few who actually manage to get a train will not have the luxury of using wi-fi. The Prime Minister might not be aware of this, given his preference for private jets, but will the Secretary of State at least admit that our railways are fundamentally broken?

As Chancellor, the Prime Minister personally slashed the pothole budget by £400 million, which is enough to fill 8 million potholes. Lined up side by side, that giant Tory pothole would stretch from here to John O’Groats and back again. Will the Minister accept that after 13 years, the British public see that our roads, like the Tories’ excuses, are full of holes?
Last year, the Prime Minister said:
“Smart motorways are unpopular because they are unsafe.”
Yet last week he confirmed that he would leave 400 miles- worth in place. Will the Secretary of State tell the House how many breakdowns were missed by the stationary vehicle detection system on our smart motorway network last year?

Commons ChamberEighteen months ago, the Government slashed Northern Powerhouse Rail, binned HS2 to Leeds and sold out the north of England. Here we are again: huge changes affecting billions in investment and jobs announced at 5 pm on Thursday—minutes before the House rose.
We now know why the Secretary of State was desperate to dodge scrutiny: I have a leaked document written by his most senior officials that blows apart his claims and lays bare the consequences of the decisions he has hidden from. His chief justification for the delays to HS2 was to “balance the nation’s books”, but his Department admits what he will not—that the delays themselves will increase costs. It admits that they will cost jobs and that construction firms could go bust; it cannot rule out slashing high-speed trains that serve Stoke, Macclesfield and Stafford altogether; and it suggests that HS2 could terminate on the outskirts of London until 2041.
Is it not time that the Minister came clean that this absurd plan will hit jobs, hurt growth and cost taxpayers even more? As his own officials ask,
“you have already changed the design once, which wasted money. What will be different this time?”
Even the Government have lost faith in this Government, and little wonder. Is there anything more emblematic of this failed Government than their flagship levelling-up project that makes it neither to the north nor to central London? Last year they crashed the economy, and once again they are asking the country to pay the price. Does this announcement not prove once and for all that the Conservatives cannot fix the problem because the Conservatives are the problem.

Commons ChamberTransPennine Express has been providing unacceptable levels of service to the north and the midlands for years—well prior to covid—and now they are at truly dire levels. The operator of last resort has made it clear to the Transport Committee that it has capacity and can bring TransPennine Express under its remit. Is the Secretary of State confirming that for ideological reasons he will refuse to step in and provide a better service to the north and the midlands?
Last month I was delighted to visit the Hitachi Rail manufacturing facility in Newton Aycliffe, where 800 highly skilled employees are delivering world-class manufacturing excellence. They told me that they need certainty from the Government, but briefings, leaks and rumour about the future of HS2 are pouring out of this Department. Will the Minister categorically deny that his Department is working on any plans that would slash what is left of the eastern leg and leave Yorkshire and the north-east permanently entirely cut off by cutting high-speed platforms at Euston?

“not only stop the decline”—
in bus services, but—

Since then, have bus services increased or decreased?
The Minister must surely agree that this is simply not good enough. In November, he assured us that the new timetable would be deliverable. This week, the results are in and the service has never been worse. This morning alone, at least 123 services have been cancelled or disrupted on TransPennine Express. He cannot pretend that the management are blameless in this farce. The north cannot afford to continue like this any longer, so will he strip TransPennine Express of its contract and bring it under the operator of last resort?

Commons ChamberI warmly welcome the new Secretary of State and the entire ministerial team—and in particular the former Chair of the Transport Committee, the hon. Member for Bexhill and Battle (Huw Merriman), who I am sure will bring his expertise and experience to the team. Of course, the problem for him and the benefit for the Opposition is that we know what he really thinks. [Laughter.] Has he managed to persuade the Secretary of State that the integrated rail plan under-serves the needs of the north and lets down those who require change the most?
As we have heard in concerns raised by Members on both sides of the House, a crisis facing millions of people across the country right now is the total absence of reliable and affordable bus services. How much of the promised bus service improvement funding has actually been handed to local authorities? When will the Secretary of State reopen applications to cover the 60% of the country that did not get a single penny in the initial round?

Commons ChamberI welcome the new Secretary of State and the entire ministerial team to their place. We look forward to shadowing them. I am afraid that we are not off to a great start, though. The Prime Minister promised to protect Doncaster Sheffield Airport during her leadership campaign, and she gave a promise to the hon. Member for Don Valley (Nick Fletcher), who I do not see in his place this morning, at her first Prime Minister’s questions to do what she could to protect the airport. This is not just a commercial decision. The Mayor has written to the Peel Group this morning with names of potential bidders and a reiteration of financial support to keep the airport running. Will the Secretary of State agree to meet the Mayor and Members across this House, and consider using her powers under the Civil Contingencies Act 2004 to keep this strategic asset running?
Northern Powerhouse Rail, and the billions of pounds in growth and tens of thousands of jobs, depend on HS2 being delivered in full. So will the Minister guarantee that the HS2 leg beyond Birmingham to Manchester will not be the victim of his Chancellor’s kamikaze Budget?

Thank you for granting this important urgent question, Mr Speaker.
Avanti West Coast’s decision to slash services on the UK’s busiest rail route has left passengers facing chaos; it has lost more than 220,000 seats per week between our major towns and cities. The damage that this shambles is doing to the regional economy and the public purse is enormous, yet, incredibly, it was signed off by the Government. Ministers have let this failing operator get away with appalling performance for far too long: the fewest trains on time; more complaints than any other operator; and a wholesale failure to train new drivers. A serving Transport Minister in the Lords has admitted that its performance is “terrible”.
Despite that, this Department has handed tens of millions of pounds of taxpayers’ money in performance and management fees, which have then been pocketed by shareholders, including—you could not make this up—a £4 million bonus for “customer performance”. What passengers need to hear today is a plan to get this vital line back on track, because those who rely on this service are tired of excuses. It is not sustainable or reasonable to continue to rely on the good will of drivers to work on their rest days, so will the Minister demand an urgent plan from the operator to restore the timetable, as she is perfectly entitled to do under the contract? Will she commit to claw back taxpayers’ money for services that have not run? Will she tell the House why, despite a contractual obligation to train new drivers, Avanti has comprehensively failed to do so? Above all, will she ask the new Secretary of State to guarantee that there will be no more reward for failure and to strip Avanti of its contract when it comes up for renewal next month? This ongoing fiasco is causing real damage to the economy, passengers and the public. The Ministers must stop washing their hands of responsibility and, finally, intervene.

Last week, our part-time Transport Secretary claimed it was a stunt to suggest that he could do anything to resolve the rail disputes. At the weekend, that claim was blown apart, as it was revealed that a policy he issued means that he has direct powers over train operators to get them to follow his directions on disputes. Can he explain to the British public why on the eve of last week’s strikes he found time to wine and dine Tory donors, but still cannot find a single second to resolve these disputes?
I apologise to the Secretary of State, but what he has said raises even bigger questions about what he has been doing with his time.
From near-record delays on railways, mile-long tailbacks at Dover, disruption at airports and the first national strike in three decades, everything this Transport Secretary is responsible for is falling apart, and now so is his promise on buses. From October, when the covid funding runs out, there will be four buses across the whole of South Yorkshire after 10 pm. That is four buses for more than 1.3 million people. That is not levelling up, is it? It is managed decline.

Commons ChamberNo one in the country wants these strikes to go ahead, but as I have repeatedly said, even at this eleventh hour they can still be avoided. That requires Ministers to step up and show leadership. It requires them to get employers and unions round the table and address the very serious issues, involving pay and cuts in safety and maintenance staff, that are behind this dispute. The entire country is about to grind to a halt, but instead of intervening to try and stop it, the Secretary of State is washing his hands of any responsibility. On the eve of the biggest rail dispute in a generation taking place on his watch, he has still not lifted a finger to resolve it. Not one meeting. No talks, no discussions; only media interviews and a petition to the Labour party. This is a grave dereliction of duty. Should the strikes go ahead tomorrow, they will represent a catastrophic failure of leadership. Ministers owe it to all those impacted by this serious disruption to get around the table for last-ditch talks to sort it out and avert it. If the Secretary of State will not listen to me —[Interruption.]
Order. Can the hon. Member for St Austell and Newquay (Steve Double) and the right hon. Member for Leicester South (Jonathan Ashworth) either go outside or be quiet for a little while?
If the Secretary of State will not listen to me, he should at least listen to his own colleague and former parliamentary aide, the right hon. Member for Rossendale and Darwen (Jake Berry), who said yesterday:
“I can tell you the only way out of a dispute is via negotiation. I’d call on all parties including the Government to get around the table because this is going to have a huge negative impact on people’s lives.”
The Secretary of State’s own MPs and the public know that the only way to sort this out is for him to do his job.
But that is not all, because this week it was revealed that the Secretary of State had not only boycotted the talks but tied the hands of those at the table. He and his Department failed to give the train operating companies—a party to the talks—any mandate to negotiate whatsoever. One source close to the negotiations said:
“Without a mandate from Government we can’t even address the pay question.”
Today, the Rail Delivery Group confirmed that it had not even begun those discussions. That is the reality. These talks are a sham, because Ministers have set them up to fail. It is for the Government to settle this dispute. They are integral to these negotiations, which cannot be resolved unless the Secretary of State is at the table, but it is becoming clearer by the day that Ministers would rather provoke this dispute than lift a finger to resolve it.
This is the same Transport Secretary who just a few short weeks ago was feigning outrage over the disgraceful behaviour of P&O and who is now adopting its playbook. Replacing skilled, safety-critical staff with agency workers cannot and must not be an option. So what exactly has changed between the Secretary of State calling on the public to boycott P&O and now, when he is suggesting that that behaviour should be legalised?
Tomorrow we will see unprecedented disruption. We have been clear: we do not want the strikes to happen. Where we are in government, we are doing our job. In Labour-run Wales, a strike by train staff has been avoided. Employers, unions and the Government have come together to manage change. That is what any responsible Government would be doing right now, because whether it is today, tomorrow or next week, the only way this dispute will be resolved is with a resolution on pay and job security. The Secretary of State owes it to the hundreds of thousands of workers who depend on our railways and the tens of thousands of workers employed on them to find that deal.
Those rail workers are not the enemy. They are people who showed real bravery during the pandemic to keep our country going. They showed solidarity to make sure other workers kept going into work. Some lost colleagues and friends as a result. They are the very same people to whom the Prime Minister promised a high-wage economy a year ago before presiding over the biggest fall in living standards since records began. There is still time for the Secretary of State to do the right thing, the brave thing, and show responsibility. Patients, schoolchildren, low-paid workers—the entire country needs a resolution and they will not forgive this Government if they do not step in and resolve this. Even now, at this late hour, I urge the Secretary of State: get around the table and do your job.

Commons ChamberOn Monday, I was in Bradford meeting local schoolchildren left stranded by cuts in Northern rail services. In Wakefield, some passengers will face a four-hour gap in services between 6 am and 10 am. The Transport Secretary has not said a word about the cuts, but has spent his week boasting about new routes in Sevenoaks. Of course the south-east needs routes, as does the rest of the country, but what message does that send to our northern communities? If Ministers mean a single word of what they say about levelling up, will they commit themselves to restoring those northern services to pre-pandemic levels, as a matter of urgency?

Commons ChamberMy hon. Friend is absolutely right; that is exactly why the motion calls not only for the reinstatement of workers, but for Ministers to take action to outlaw this practice for good.
What is important is that we now know that the Government had the opportunity to stop this before it happened. They knew before the workers what P&O had planned. I can inform the House that I have come into possession of a memo that was circulated to the Transport Secretary, his private office and, we are told, 10 Downing Street. For the benefit of Members, I am happy to lodge it in the House of Commons Library.
This memo was no vague outline; it was the game plan of P&O. I can reveal to the House that it not only makes it clear that the Government were made aware that 800 seafarers were to be sacked, but explicitly endorses the thuggish fire and rehire tactics that P&O had clearly discussed with the Department ahead of Thursday. There is nothing in this memo at all that expresses any concern, any opposition or raises any alarm about the sacking of 800 loyal British workers. This is the clearest proof that the Government’s first instinct was to do absolutely nothing. There is no use Government Members wringing their hands now; it is here in black and white, and I will happily lodge it in the Library, Mr Speaker, for the benefit of Opposition Members when they are considering how to vote tonight.
Order. In fairness, that would benefit all Members—if documents are being referred to, all hon. Members need to be able to see them.
Order. Will the hon. Gentleman let the hon. Lady answer one point before she takes the next, please?
As I was saying, I completely agree that DP World needs to be fully responsible for the actions of P&O Ferries. The Government exercise considerable leverage over both companies.

Have you had any indication of the Government’s wish to make a statement on their woeful oversight of covid fraud, Lord Agnew’s resignation and the dying days of this Government, who are currently in the cones hotline phase of their demise?
The short answer is no, but in fairness, it is obviously not a point of order for me. I am sure that those on the Treasury Bench will have heard that and will want to clarify the position—it is rather unusual for people to resign at the Dispatch Box—so we will leave it at that for now.

Ahead of a tough Christmas, people across this country are paying the price of Tory inflation. In Dewsbury, for example, since the Conservative party came to power, the price of the commute into Leeds has risen more than three times faster than pay. Does the Secretary of State think that that is reasonable? If he does not—he failed to answer this point earlier—will he rule out the brutal 3.8% hike in rail fares rumoured for millions of passengers next year?
I am grateful to the hon. Member for giving me notice of the point of order. As I said in my statement, the regulations in question have been withdrawn. I understand that the Department intends to bring forward revised regulations, which will be considered by the House in the usual way. If she requires more procedural guidance, I recommend that she raises the matter with the Clerks and the Journal Office, who will advise her on the best way forward.
On a point of order, Mr Speaker. Last week Lord Frost made a statement in the other place regarding our relationship with the European Union, negotiations following Brexit and, in particular, the Northern Ireland protocol. He promised my noble Friend Baroness Chapman of Darlington that there would be a subsequent statement in the House of Commons. Today, a written ministerial statement has been placed before the House, which I am sure you agree is not acceptable or appropriate and follows a pattern of behaviour by the Government of excluding elected representatives—not least those from Northern Ireland—from negotiations and updates on the protocol. I would be grateful for your advice on how we can ensure that Ministers are brought to the House to update us on the protocol so that elected representatives can have their say.
First, I will certainly look into the matter. It is normally the case that major Government statements are made in both Houses. What I find appalling is that this is the elected House that represents constituents across the country, and yet somehow it seems fit for their lordships to hear a statement that has been denied to this House. My best suggestion would be to try an urgent question in the morning. I am not promising, but I would certainly look at it.

Thank you for granting this urgent question, Mr Speaker. There are 43 days until the end of the transition period, and it is hard to express the frustration, anxiety and fears that have been relayed to me and to the Minister by countless businesses and communities in Northern Ireland, as the clock has started to tick. Northern Ireland needed every second of this transition year to get ready for the biggest changes to its trading relationship that it has ever known, but vital time has been squandered, first with the denial that any checks would take place at all and then with the extraordinary spectacle of the Government threatening to tear up their own oven-ready deal and breach international treaties that they had signed into law—an approach that the Minister has just confirmed they are sticking to when the Bill returns to the House from the other place.
The result of that recklessness and incompetence is that thousands of businesses still do not know the bare basics of how they will trade with Great Britain in just six weeks’ time. As the president of the Ulster Farmers Union said this morning, we are in a transition, but we do not know what we are transitioning to. The whole purpose of the protocol was to protect the Good Friday agreement in all its dimensions, and the relationship east-west is as important as the relationship north-south. The Government’s reckless approach to negotiations and their incompetent failure to prepare risk significant disruption, a maximalist interpretation of the protocol and completely unnecessary checks. Ministers should take their heads out of the sand and give businesses the answers for which they have been begging throughout this transition year.
First, on the customs declaration service, which will handle over 1 million declarations in January alone, experts say that they need 18 months to get traders ready for the new system, so why has the industry not had the final version? Given that those experts now say that it is simply too late for the system to work, what are the contingency plans to avoid widespread disruption on 1 January? Will there be flexibility to allow businesses to adapt to new systems? What is plan B?
On the trader support service, which the Minister mentioned and which is supposed to guide businesses through the complex new customs arrangements, can he confirm that the Government are not seriously considering leaving it until 21 December for that system to go live? Why have businesses had no information whatsoever on the tariff rebate system, as confirmed by the chief executive of Manufacturing NI this morning? Where is the border operator model promised by the Chancellor of the Duchy of Lancaster over summer? Without it, traders are completely in the dark on what data they will need to provide in order to move goods.
Finally, on food imports, which the Minister referenced, a compromise is now desperately needed—and the EU has a huge responsibility of its own to deliver this—in order to reduce checks that some supermarkets and food producers say could lead them to pull out of Northern Ireland altogether. It is absurd that food destined for Northern Ireland supermarkets should be considered a risk to the EU single market, so is either a temporary waiver requirement or a permanent trusted trader scheme about to be confirmed? Again, why have the Government refused to engage directly with Northern Ireland retailers?

The Secretary of State will regret, as I do, the disrespectful way in which the devolved nations were cut out of the Prime Minister’s announcement on Sunday and the confusion that reigned across the UK as a result. Will he commit to ensuring that the Northern Ireland Executive are fully consulted and informed on the next phase of lockdown and future changes to messaging?
I would like to offer the hon. Lady a warm welcome to her new role. I look forward to working with her for the benefit of the people of Northern Ireland. If you will indulge me briefly, Mr Speaker, I want to pay tribute to the hon. Member for Rochdale (Tony Lloyd), who served in his post admirably for over two years and through three different Secretaries of State; I hope that the hon. Lady only deals with one Secretary of State in her time in office. I was hugely pleased to hear of his recovery, and I am glad that he has decided to continue to represent the people of Manchester as he recovers, as he has done over the last four decades.
We are working with the devolved authorities. They have Ministers sitting on all the committees that are discussing issues around how we deal with coronavirus, and all the devolved authorities were present and part of the decisions made at the Cobra meeting on Sunday, ahead of the Prime Minister’s announcement.

As the Secretary of State said, not only is co-ordination across the UK important, but the unique situation in Northern Ireland means that co-operation with the Republic of Ireland is equally important. Can he explain why those in Northern Ireland who hold an Irish passport, as is their right under the Good Friday agreement, are still unable to check their eligibility for the self-employed support scheme, and can he commit to urgently rectify that problem before the scheme starts to pay out?

Commons ChamberOn a point of order, Mr Deputy Speaker. As the lead signatory to the amendment that sought to remove these 0.50 calibre weapons from the Bill, the hon. Lady has implicitly accused me of endangering public safety. That is completely untruthful and unworthy, and she should withdraw her remarks.
I did not see that comment as a personal accusation. One thing is clear—the hon. Gentleman has certainly put his view on the record.
Later in my speech, I will come to exactly why we think the amendment that the Government have tabled will indeed risk public safety.
The Home Secretary said back in April that he wanted to bring forward an Offensive Weapons Bill within weeks and that if it achieved cross-party support, it would become law “very quickly”, making a “big difference”. Over the weekend in London and across the country, more lives have been taken in senseless violence. Thirty-seven children have been killed this year. How can it have been allowed that the already limited measures in the Bill have been held up three times now because of a fight over high-calibre rifles? It reflects very poorly on this Parliament.
I speak in support of new clauses 3 and 4 in my name, new clause 2 in the name of my hon. Friend the Member for Bristol South (Karin Smyth), and new clauses 18 and 19 in the name of my right hon. Friend the Member for Delyn (David Hanson). I will also refer to the amendments regarding .50 calibre rifles, with which the Labour party profoundly disagrees.
New clause 3 would bring miniature rifle ranges under the existing provisions of the Firearms Act 1968. It would remove a loophole in our decades-old firearms law that is providing easy access for non-firearms holders to get their hands on ammunition. Law enforcement officials have been clear on this. They have said in no uncertain terms that the exemption in section 11(4) of the Firearms Act is glaring and provides an easy route for terrorists and criminals to access firearms. This little-known exemption allows non-certificate holders to acquire and possess up to .23 calibre miniature rifles and ammo in connection with the running of a miniature rifle range.
Section 11(4) also allows a person claiming that they are running a miniature rifle range to acquire an unlimited number of .22 calibre rifles and ammunition without any background checks being completed or the police being made aware. In this context, the term “miniature rifle” is something of a misnomer. They are semi-automatic rifles and go far beyond that which is safe in the hands of a non-certificate holder. These are potentially lethal weapons, so this exemption is far too broad.
We are asking the Government to consider using this legislation to stop criminals having ready access to potentially lethal weapons. We were not at all convinced by the Minister’s justification in Committee and were staggered that she suggested that the Government had not been approached regarding this loophole, when they have been copied into the specific correspondence from counter-terrorism experts and the police. They simply cannot say they have not been warned. Will the Minister outline the Home Office’s thinking? Why does the Department believe, in the face of expert evidence, that this exemption does not pose a threat?
New clause 4, in my name and the name of the shadow Home Secretary, would make it an offence to possess component parts of ammunition with the intent to manufacture. Again, this has been explicitly recommended to us by the National Ballistics Intelligence Service, which said in Committee:
“There is a lack of control and legislation around purchasing and acquiring ammunition components. People can freely acquire all the equipment they need to make ammunition; the offence kicks in only once you have made a round.”––[Official Report, Offensive Weapons Public Bill Committee, 17 July 2018; c. 42, Q99.]
Senior law enforcement officials have said:
“the reality is that individuals are being found in possession of primers (for which there is no offence) cartridge cases (for which there is no offence), missiles i.e. bullets (for which there is no offence) and smokeless powder (which is technically a minor offence contrary to explosives regulations but rarely…prosecuted).”
The fact is that, unless complete ammunition is found, there is no prosecution despite very strong suspicion that someone is making ammunition to be used in criminality. This simply cannot be right. New clause 4 is an attempt, in the light of the growing threat picture from DIY ammunition making, to give law enforcement the tools needed to clamp down on this practice, which is undoubtedly raising the threat to the public from firearms.
