It is a pleasure to follow the hon. Member for Norwich South (Clive Lewis), who addressed the topic of today’s debate, “Achieving economic growth”, by seeming to argue that economic growth is not only not important, but not desirable. I wonder therefore whether he will be having a word with his Front-Bench team, who seem to have spent most of the afternoon criticising the Government for not delivering sufficient economic growth, but that is a matter for him.

It is a pleasure to take part in today’s debate, to address the issue in question and to raise one or two points about the Queen’s Speech. Successful growth will be delivered through the effective role of the private sector. It is the private sector that is the wealth generator. I was delighted that the Chief Secretary accepted that reality in his opening remarks.

Both the economy generally and individual businesses face exceptional challenges, ones that have not been encountered for generations. Those challenges revolve around the recovery from the covid pandemic and, now, the need to address the issues arising from the conflict in Ukraine and its impact on energy prices.

I recently spent a really interesting lunch time with the Coventry and Warwickshire chamber of commerce. I expected those who attended to talk to me about supply chain problems and the challenges presented by inflation, but the biggest single issue they wanted to talk about was ensuring that they had a workforce with the right skills and the recruitment and retention of their staff. We have heard about jobs from many Members, not least my hon. Friend the Member for South West Bedfordshire (Andrew Selous), who spoke about the “jobs miracle”. The ONS tells us that unemployment is at its lowest since 1974 and job vacancies are at a record high of 1.295 million. In fact, we have more vacancies than people looking for work. The unemployment rate is now just 3.7%, which is the lowest rate for 50 years. The figures for my constituency tell exactly the same story, with unemployment falling and vacancies rising.

However, the current situation creates real challenges for businesses. As consumers, we recognise the effect of staff shortages: short-staffed businesses do not have the time to answer the phone or respond to inquiries, and there is a decline in service levels. Significantly for both businesses and the broader economy, opportunities are missed. In previous years, UK companies were able to look to eastern Europe to fill vacancies when they had staff and skills shortages, but that has become less of an option following our departure from the European Union. Businesses have raised with me the loss from the workforce of people in the 50 to 70 age demographic who either lost or left their jobs during the pandemic. The Government should focus on how we might get such experienced people back into the workforce.

There have been a lot of references in the debate to the ONS and its reports. Just a few months ago, in March 2022, the ONS published a report on its over-50s lifestyle study, which looked at the motivation of 50 to 70-year-olds who left employment during the pandemic. The ONS found that 77% of those aged 50 to 59 had left sooner than they had expected or intended to. It found that 19% had left because of stress or mental health, but that 58% would consider returning the workforce and 15% actively wanted to return. Were those people to return to the workforce, 36% of them would consider a flexible attitude to working to be most important, and 69% would want to work part time. It is important for the Government to consider ways to get such people back into the workforce, because they have valuable experience and can make a contribution. I saw an example of the people I am talking about in the volunteers I worked with on the delivery of the vaccine programme. Demand exists in the economy but it is not being fulfilled. We need to put the two things together.

In achieving economic growth, it is important for investors, customers, suppliers and the workforce to be able to understand the true state of a company. I note the Government’s interest in restoring trust in our audit and reporting systems through our corporate governance system. I am a member of the Business, Energy and Industrial Strategy Committee and we have looked at auditing, so I was disappointed to see that the audit reform Bill in the Queen’s Speech remains only in draft form. I want to see swift action to ensure that the full Bill comes to the House as promptly as possible. We know about the dominance of the big four, and we have had many reports and three independent reviews, as well as the work done by the Select Committee. I want the Government to make sure that a transparent and effective audit system is introduced. There are plenty of reports calling for change, and we have seen the events at Carillion, Patisserie Valerie, Thomas Cook, P&O Ferries and BHS. We need to rectify the situation, and I hope that the audit reform Bill is brought forward.

It is important to equalise growth across the country, and the levelling-up provisions are incredibly important in that regard. On the planning system, I want to ensure that an adequate supply of land is made available for businesses. That is an issue in my constituency. We are at the centre of England, making ours an ideal location for the logistics businesses that want to serve the country, but land is rapidly being taken up. I am concerned that, even now, many local councils have no up-to-date local plan, and instead rely on applications coming in and development control.

I note some of the provisions on local involvement, but the current neighbourhood plans are too bureaucratic and long-winded and take too long to implement. I note, too, the attempt to give people more involvement in planning issues and the principle of street referendums, but I am uneasy about those proposals as they may become a vehicle for disputes between neighbours. The Government may also have a real challenge in defining what constitutes a street.

Housing supply is a vital part of economic growth. Building homes is an economic activity, and of course new housing provides homes for workers, as my right hon. Friend the Member for Gainsborough (Sir Edward Leigh) reminded us a few moments ago. In my constituency, we have probably one of the best examples in the country of delivering new housing at volume through the development of Houlton, the sustainable urban extension to Rugby, which is being developed by Urban&Civic. That massive developer has great control over the activities of the house builders, and I believe that it is creating communities as well as building homes. It is vital that we provide the infrastructure first. In Rugby, we now have a link road to the main urban community, and both primary and secondary schools, but the challenge is to get the healthcare provision in place. There is a great deal of development in Rugby, and I am proud of what we have achieved.

I conclude by noting that there are many provisions in the Queen’s Speech that will support our businesses and enable growth and development to take place.

I simply want to say that I concur entirely with what the Secretary of State has said, and to refer very briefly to Lords amendments 2, 3 and 5.

Let me say first that the Government’s arguments about the question of the lower courts in relation to the Supreme Court are completely valid. I think that an enormous number of complicated problems will emerge from Lord Mackay’s amendment. The use of expressions such as “is of the opinion” and

“set out the reasons for that opinion”

will create a quagmire of interpretation.

As for Lords amendment 5, when I had the pleasure of advising on the Canadian constitution back in about 1982, I engaged in extensive discussions with Mr Geoffrey Marshall of The Queen’s College, Oxford, who is the greatest authority on the question of conventions. I entirely agree with the Government’s position on that, in the light of my own experience of what conventions actually mean, and I have to say that I have heard a lot of hogwash this afternoon in support of the alternative view.

My apologies. Let me just say that I fully support the statement by the hon. Member for Bristol West (Thangam Debbonaire) that this is not about trying to refight the argument over Brexit; it is about what is best for the future of the country. In their manifesto just last month, the Government promised voters that the rights of European citizens would be protected. I appeal to Conservative Members to stand by that, particularly when it comes to the vulnerable children whom we have already discussed, who are separated from their families, who are refugees, and whom we can reunite legally with their families in this country. Why are the Government so reluctant to put that back in the Bill and protect it by law?

May I end by saying one tiny thing about the Sewel convention? The Government say much about protecting the United Kingdom, but I would ask them to consider how often they undermine their own argument and tie the hands of those of us on the Opposition Benches who want to protect and work for the United Kingdom. I learned a long time ago that impact is intention, and regardless of the intention in respect of the Sewel convention, the impact of it is to damage our own argument. The Liberal Democrats will therefore oppose the Government, and will support all five amendments.

I am unsure whether the hon. Gentleman is listening. I am saying that the SNP put a proposition before the people in a democratic election and they voted for it. Just to be sure, when I talk about this mandate, it was not only the SNP that talked about this matter. The central proposition of the Conservative party in Scotland was, “Say no to indyref 2.” The Conservative party in Scotland asked the people of Scotland to reject a referendum on independence, but the people of Scotland instead rejected the Conservative party. That is the truth of the matter, and that is why that party now has less than half the Members it had four weeks ago.

We have a new situation in these islands. For the first time in history, in this Chamber, which is charged with representing the whole United Kingdom, are Members elected from the two principal countries within the United Kingdom who have different mandates for the constitution of the country. I invite the Government to say—this will not go away—how they will respond, how they will acknowledge Scottish public opinion and how they will come to an accommodation with the political representatives of Scotland. The start of that process will be to understand what their response will be to the approach from the First Minister of Scotland, who has asked for negotiations with a view to transferring powers to the Scottish Government so that they may consult the people on how they are governed.

To be crystal clear, we are not asking the Conservative party or this Parliament to agree with the notion of Scottish independence. We are not even asking them to agree that there should be another referendum. We are simply saying they should agree that when and whether that happens should be a matter for the people who live in Scotland, and no one else. The decisions on these matters should be made by the people via their elected representatives in the national Parliament of Scotland in Edinburgh and not here in the Union Parliament in London.

That is the central proposition and, in making it, we are consistent with the claim of right for Scotland, which was debated in this very Chamber in July 2018 and endorsed by the House without opposition. I know that many Conservative Members did not really support it and thought the better option was to ignore the debate and pretend it was not happening, but it did happen and it will happen again.

If the request from the First Minister of Scotland and the request from the Scottish Parliament are denied and ignored, it will be inconsistent with the claim of right for Scotland. It will mean this House does not agree that it is a matter for the Scottish people to determine their own form of government. That would be a very serious position, because it would mean this Parliament is advocating that this United Kingdom should continue to include parts of this island even against the wishes of the people who live there. That would undermine the fundamental principle of consent on which this constitution has so far been based.

We would no longer be talking about a Union of equals, or a Union at all; we would be talking about the subsummation of Scotland as a territory into a wider political territory known as the United Kingdom of Great Britain and Northern Ireland. That is a different constitutional position. If people want to argue it, we are happy to take them on and have that debate, but at least be honest about it.

The most important people in all this are not those who voted for the Government or for the SNP in opposition. The most important people in this debate are those who voted for neither. Many people, including in my constituency, put their faith in the capacity of the United Kingdom to reform itself and to give voice and expression to their needs and fears within this Union Parliament. They voted in significant but not overwhelming numbers for the Labour and Liberal Democrat parties in particular, and many of them are now asking themselves whether, indeed, the type of society they wish to live in can be delivered by this Union Parliament and this Government, or whether it would be a better course of action to consider Scotland becoming a politically independent country capable of setting its own priorities and giving vent to the aspirations of its own people.

They have not yet made that decision. They are on a journey and the debate, my friends, is wide open, but one of the key things that will focus that debate is the attitude and reaction of this United Kingdom Government. If the Government decide to keep their head in the sand and to pretend that this did not happen north of the border, if they pretend it is business as usual, if they use their 80-seat majority to railroad stuff through Parliament, if they drag Scotland out against its will, if they refuse to give Scotland a say and if they refuse to make any accommodation, they will become the best recruiting sergeant for the cause of independence in Scotland. We look forward to explaining to the people of Scotland the consequences of the Government’s actions.

We will be voting against this miserable set of proposals because we have not voted for them, the people we represent have not voted for them and the Scottish Parliament will not consent to them. These proposals are wrong and they do not represent the aspirations and the character of the people of Scotland. That, in the long term, will be represented much better by Scotland becoming an independent European nation in its own right.

Thank you very much, Madam Deputy Speaker, for setting me up in that regard. May I pass on formally our congratulations on your election as Deputy Speaker?

I wish to introduce Northern Ireland into the debate, given the fact that it has been so central to the Brexit process so far. There are still so many unresolved issues and questions and it is important that we reflect on them as the Bill passes Third Reading, because there is still a long journey ahead.

Before I do that, I wish to make some general comments and to share in the concerns expressed by many Opposition Members about where we are with the Bill. There is uncertainty as to whether a trade deal can be done in the next 11 and a half months; there is the risk of no deal; there is the nature of the future relationship to consider; and there are issues of the parliamentary scrutiny, or lack thereof, of where we go from here. Of course, there is also more general regret about the Brexit process, which is going to leave the UK in a worse position overall in terms of the economy, society, security and the environment. That is particularly true of my own region of Northern Ireland.

I wish to focus on the unresolved issues. Brexit throws up a unique set of challenges for Northern Ireland, because, perhaps more than any other part of the UK, we are part of that wider network—that integrated framework across these islands. We are interdependent in terms of our trade and our society, both north-south on the island and in the wider whole-UK context as well. The problem of Brexit is that, whatever way it falls, it entails some degree of new barriers, borders or friction. In the context of Northern Ireland, that creates a sense of win and loss, in terms not only of the economy but of wider society and the emotional and psychological impacts. We also need to be acutely aware of the potential political ramifications in the medium to long term.

That said, we saw this week the almost remarkable situation in which, across the political divide in Northern Ireland, we had all the parties coming together behind a common set of amendments, which were also backed by—and, indeed, in many respects driven by—the local business community in Northern Ireland, which has itself come together in an almost unprecedented way because of the huge importance of the issues before us. I remain very much convinced, as do my colleagues in the Social Democratic and Labour party, that Northern Ireland’s place is as part of the European Union. The Democratic Unionist party comes from a leave, pro-Brexit perspective. Regardless of how we reached this point, we all share the desire to ensure that we have the seamless, unfettered trade between Northern Ireland and Great Britain that was the theme of the amendments, to protect the wider UK internal market and to ensure that the GB-to-Northern Ireland interface can be managed successfully.

Several wider points need to be made about the context. First, we should not see emerging—or indeed being forced on us—a choice or a trade-off between some sort of border or interface on the island of Ireland and a border or interface down the Irish sea. We want to avoid both those possibilities, but there will be a huge challenge in the way things have fallen in that respect. Indeed, the Assembly has almost been set up with this choice to make in four or eight years’ time: whether to maintain ongoing regulatory alignment for goods on an all-island and European basis, or align with the rest of the UK. It is not a choice that anyone particularly relishes and it builds a degree of instability into our political structures. Members will be aware that talks are ongoing back in Belfast as we speak to try to restore the Northern Ireland Executive and Assembly—I pay tribute to the Secretary of State for Northern Ireland for his work in that regard over the past months—but Brexit adds a new layer of complexity to that wider context.

The focus of the debate and the amendments has largely been the interface between Northern Ireland and Great Britain, mainly because that is much more under the control of the UK Government. However, the process from Great Britain into Northern Ireland—and, indeed, beyond into the European Union—is just as important, if not more so. I think that those plans were not tested so much through amendments because that work depends on the outworkings of the future free trade arrangement. In that regard, it is worth stressing that a free trade agreement—even one that is very far reaching and inclusive—is not the same as the arrangements we currently have as part of the European Union; it is not the same as a customs union and a single market. A free trade agreement is a qualitatively different concept. We currently have a free trade arrangement through which we can access trade agreements with the rest of the world, and that is what we are giving up for an untested future.

There is ambiguity about where Northern Ireland will sit with respect to these future trade relations—whether we are part of a wider European Union framework when it comes to goods, or whether we are part of the wider UK trade policy. There was a time, particularly under the proposals of the former Prime Minister, when Northern Ireland could have had a foot in both camps, and the business community was embracing that. The danger now is that Northern Ireland could be marginalised and peripheral in both UK and EU trade terms, with local businesses facing considerable ongoing economic costs. In particular, there may well be barriers to accessing certain markets or attracting investment, because people will just see Northern Ireland as a complicated place and think that it is too difficult to engage with us. Our economy, which is already struggling from a low starting point, will continue to be marginalised.

As we look to a future relationship, it is important that we bear in mind the importance of integrating goods with access to labour; I am particularly thinking about ongoing freedom of movement and the service economy. It is very difficult to uncouple the four freedoms of the European single market. We need some degree of new deal for Northern Ireland because local businesses are going to face considerable economic costs. There will be a need for financial support as mitigation, or to support the transition as local companies adjust to the new arrangements and the new market frameworks.

Let me return to what happens as we look ahead to the next phase. There is a gap between: the rhetoric, declarations and promises of the UK Government and Ministers, particularly the Prime Minister; what we have been told by a range of different experts; and the reality of international and European law on customs and regulatory matters. That is an ongoing challenge which needs to be addressed, but Northern Ireland businesses want to see the commitments to unfettered access being honoured. We want to ensure that there is no discrimination against Northern Ireland goods, and it is important that we assess on an ongoing basis the economic impact of the Northern Ireland protocol.

My final point is that there has been a lot of focus on the joint report as being the almost magic solution to every unresolved question at this stage, as well as on the free trade agreement and negotiations. Given the very particular circumstances faced by Northern Ireland, my appeal would be for Northern Ireland representatives to be integral to those discussions and for there to be a proper feedback loop to the Northern Ireland Assembly, Executive and whatever democratic structures we can put in place back in Northern Ireland.

Some hon. Members appear to think we are still in the Christmas pantomime season; we are not. Just saying that does not make it clever and does not make it right. All the Conservative Members who think they are about to vote to get Brexit done must know what lies ahead. They know—they must know—that trade negotiations take time. They must know that even if we are in alignment now, the Government’s stated intention is to diverge. So be in no doubt: trade negotiations will take longer than the precious few months that the Government have allowed. Getting them done at historic speed does not look very likely when the EU itself has already warned that it will take longer than that.

Whoever’s responsibility this is, the Government with this Bill—clause 33—have boxed themselves in so there is absolutely no get-out. As my hon. Friend the Member for Sheffield Central (Paul Blomfield) has said, clause 33 is a gimmick, but it is a gimmick at the expense of the people of the United Kingdom. At the end of this year, if we are just days away from agreeing a trade deal or a few weeks away from sorting out the arrangements for moving medical devices or airline parts between the EU and the United Kingdom, it will make no difference: this Bill has bound the Government’s own hands. There will be no extension, and that is why we call it a cliff edge.

We did not need to be here. This Opposition have accepted that Brexit is happening on 31 January. [Hon. Members: “Hurrah!”] Triumphalism is not terribly seemly in this circumstance. We also did not need to be in a position where we are letting down child refugees. Let it be on record that the Opposition stood up for child refugees. We stood up for child refugees in trying to hold the Government to their own commitment to Lord Alf Dubs. They have no mandate for doing this. It is mean-spirited and morally as well as politically unjustified. I hope in the other place that their lordships will restore our amendment, which is actually about restoring the Government’s own commitment that the Prime Minister himself agreed should be in the previous version of this withdrawal agreement Bill. I hope they will restore it, and that we will stand up for child refugees in that House and in this.

I come to the maiden speeches. My hon. Friend the Member for Putney (Fleur Anderson) showed the people of Putney that they made an excellent choice. She clearly already knows and loves her constituency and understands the lives and values of her constituents. She has already been a strong voice for them this afternoon. She covered an enormous amount in her first speech, and I salute her ability to do that with clarity and great voice. I am already delighted to have her as a colleague, and I look forward to working with her. The hon. Member for Ruislip, Northwood and Pinner (David Simmonds) also made his maiden speech, and I congratulate him as he also showed his care for his constituency and his clear commitment to represent his constituents and their values in this place.

To the Government and to the Prime Minister, the Opposition say: this is now on them. Despite the lack of provision for scrutiny in this Bill, we will still use every tool we can to scrutinise the progress of the negotiations on the future relationship. Obviously, Conservative Members believe this is a great future. If that is a great future, I will happily stand here and be corrected.

Thank you, Madam Deputy Speaker. It is an important point. In the election in December, the people of Scotland stood by the Scottish National party on the basis of our right to choose. We will not accept being taken out of the European Union, and I say to the Prime Minister, “Respect democracy. Respect the election result. Respect the right of the people of Scotland to choose our future.” We will have our referendum, Prime Minister, and Scotland will remain an independent European country.

On a point of order, Madam Deputy Speaker. You may not be aware that Hitachi at Newton Aycliffe, which employs many of my constituents, has today announced that it is making a third of the workforce redundant, meaning that 250 jobs are to be lost. The company says that the restructuring is not being taken lightly, but reflects the need to remain competitive and put the factory on a more sustainable footing for the long term by winning more manufacturing orders in the future. The lost jobs could be the thin end of the wedge, as the announcement could have a knock-on effect on jobs in the supply chain. Do you know whether the Government intend to make a statement on the job losses and on the action they plan to assist the company at this difficult time?

I have heard the hon. Gentleman’s point of order. I deduce that what he is really saying is that he wishes to bring a Minister to the Dispatch Box to answer his eloquently made point. I suggest that, at the beginning of next week, perhaps by way of an urgent question or some other means, he will find a way to ensure that this important issue, which I am sure the House appreciates matters enormously in his constituency, is discussed properly in the Chamber.

I am going to be brief, as I know many others want to get in, Dame Eleanor. I wish to compare a couple of these amendments and say a few words as to why this Bill is a very bad one. First, let me say to the hon. Member for Aberavon (Stephen Kinnock), who is, sadly, no longer in his seat, that his is a genuine attempt to find a way forward. I have just been reading it, having just looked at it, and it is intriguing. He is specific in one of his amendments, saying that the purpose of the letter to extend would be to

“include provisions reflecting the outcome of inter-party talks as announced by the Prime Minister on 21 May 2019”.

As I say, this is a genuine attempt being made by those who really do think that this House stands in serious danger of being perceived by the public more and more as having taken the position that nothing will satisfy it and that the only thing that it wants at the end of it all is to defy the decision taken at the time of the referendum. That is very much the opinion growing out there, and I was intrigued when the hon. Gentleman made the point that we in this place are now being perceived as a Parliament opposed to the people, not a Parliament to represent them. The people voted to leave, whether we liked it or not, and now this Parliament seems set on a course to obfuscate and delay that, with a view to overturning it eventually.

There is no question in my mind about the hon. Gentleman’s legitimate observations—we get on very well and play football together, so I am slightly in favour of him anyway—but although he said the talks were good, the problem was that at no stage did his Front-Bench colleagues conduct them in a genuine sense. The truth was that they probably never intended to agree anything with my right hon. and hon. Friends who were in government at the time. I had a whispered exchange with the Father of the House, and he made the point that one reason for that was probably that they were under attack by the second-referendum crowd, who were absolutely opposed to any idea that the Opposition could strike any kind of agreement with the Government that would do away with the idea of a second referendum and therefore the opportunity to vote down the original referendum result. That lies at the heart of it. There is a deceit in all this. As I said earlier, I genuinely believe that the hon. Gentleman was genuine in his view, as were many of those aligned alongside him in that regard, but I do not believe that to have been true of the Labour party Front-Bench team—in fact, throughout all this they have played fast and loose.

When I come to the proposition with which the Bill is concerned, I come back to why I think it is a bad Bill. For all the talk about not wanting to have no deal and wanting to have a deal, although some of those who propose this measure voted for the previous Prime Minister’s deal, if every one of them really wanted any deal rather than no deal, they would have voted for that deal. Strangely, they found themselves voting against it at the time.

I noticed the laughter from the Scots Nats at what my right hon. Friend said. In view of the very good sense that he was speaking, I invite the House to consider this. Is it not the case that under the withdrawal agreement, during the transition period, decisions will be taken by the Council of Ministers to impose obligations and laws on the United Kingdom without our even being there, without any transcript, without any Hansard and almost invariably by consensus? Is not the whole thing a massive racket, the object of which is to put us in a state of subjugation—

My hon. Friend makes an extremely important point, which goes to the heart of the crucial issue about our democracy that the hon. Member for Glasgow North (Patrick Grady) raised from a sedentary position. One of the features that many of us found most objectionable about the withdrawal agreement was precisely that for a long and unspecified transition period that could have stretched on for many months—it was not clear what would end it—we would be under any new law that the European Union wished to impose on us, with no vote, voice or ability to influence that law.

At the moment, as a full member, we have some influence. We have a vote, and sometimes we manage to water down or delay something, but in the transition period we would have none of those rights. Any of the existing massive panoply of European law could be amended or changed by decisions of the European Court of Justice, and that would be binding on the United Kingdom. This is completely unacceptable for a democratic country—that, when a majority of people in a democratic referendum voted to take back control of their laws, their Parliament then says, “No; far too difficult a job for us. We don’t want to participate in this process. We don’t want to take control of your laws. We want to delegate most of them, in many fields, to the European Union and have a foreign court developing our law for us in ways that we might find completely objectionable.” None of the amendments that I have just been mentioning, in the names of my hon. Friend the Member for Gloucester (Richard Graham), the hon. Member for Aberavon (Stephen Kinnock) and others, intending to find a compromise, tackles this fundamental obstacle to the withdrawal agreement and to the idea that we can somehow negotiate our way out of the European Union if it does not think we just intend to leave.

I am very grateful indeed to the right hon. Gentleman for taking an intervention. May I take him back to something that he said, because it is really very important? The right hon. Gentleman and many of his colleagues have claimed—in the referendum, subsequently and tonight—that they are going to take back control of the borders. May I just ask him how he intends to take back control of South Armagh, and would he like to come to Crossmaglen and explain why it is all right for us to go out without a deal?

In conclusion, these amendments do not fix the Bill. This Bill is extremely damaging to our democracy, undermines our negotiating position and would therefore achieve the opposite of what many of its proposers say they are trying to achieve.

My right hon. Friend says that I have made one serious point, but he is in serious trouble. Every time he gets up and starts interpreting his Bill, that is likely to be taken into account if there is any judicial review of any of the provisions, as enacted. As all Ministers ought to know—he is the Minister in charge of this day and the various other things that he seemed to have assumed—every time he opines on the question of interpretation, the interpretations that he is making in in a rather fulsome manner could be used as a means of interpreting what is meant by the Bill. He ought to be a little more cautious, but I have waited until this point to say so, because he has said quite enough to put himself in serious difficulty on that account.

Having said that, with regard to new clause 4, any motion brought forward under clause 1(1) in the form set out in clause 1(2) may be amended in line with clause 1(3) only to include a date. In a nutshell, new clause 4 would prevent further amendments to Standing Orders and so on.

Moving on to new clause 5, because I want to get my points on the record—

No. When Third Reading is likely to occur is not up to the Chair, but to the House. Based on how things are going at present, my estimate is that a Third Reading debate will not occur, because the Committee stage is likely to take up all the available time. However, that is entirely up to the House. If the people who still wish to speak do so for a short time, we will have a Third Reading debate. If they speak for a long time, we will not.

With respect to you, Dame Eleanor, the Bill’s stages have been truncated. You know what I am talking about. It has been rushed through. Not only is the Bill an abomination in its own right, but it is gravely unconstitutional and offends Standing Order No. 14 and so many other conventions, so I am not going to fail make the points that need to be made. I am so sorry, but I these points must be made. It is only 9.8 pm and we have until 10 o’clock, so although I have great respect for you, Dame Eleanor, I am going to make my points. Furthermore, they are matters that are germane to trying to sort out the rubbish that this Bill is generating for the British public. That is my point.

New clause 5 relates to the amendability of motions. Any motion brought forward under clause 1(1) in the form set out in clause 1(2) may be amended in line with clause 1(3) only to include a date no later than 22 May 2019. The new clause would prevent further amendments to the Standing Orders or to the business of the House of Commons and would impose a maximum duration on the extension period. Given what I said earlier to my hon. Friend the Member for Camborne and Redruth about how this Bill would otherwise cost £90 billion, I think we would be doing a great service not just to the House, which is pretty chaotic these days, but to the taxpayer and our constituents by restricting the length of the extension period. If the extension went to five years, according to the potentiality of this Bill, it would cost £90 billion—that is just a statement of fact—which is a very good reason for voting against the Bill.

New clause 5 would place a maximum duration on the extension period, which would be an enormous step in the right direction. In fact, it would be a fundamentally vital provision in the context of this Bill.

New clause 7 deals with the question of European elections, another hot potato:

“No extension of the period under Article 50(3) of the Treaty on European Union may be agreed by the Prime Minister if as a result the United Kingdom would be required to prepare for or to hold elections to the European Parliament.”

I would have thought that many Members would be delighted to support this new clause. I am doing the Government’s job for them by seeking to impose a restriction. I see the Minister slightly nodding his head, which I think means he might quite like this amendment. The bottom line is that, yesterday, I heard the Prime Minister say that we would not want to have European elections.

In my nine years in the House, I have not experienced such an extensive Adjournment debate, and I am very grateful for it. I congratulate my right hon. Friend the Member for Gainsborough (Sir Edward Leigh) on securing it.

The issue of the backstop reflects our commitment to avoiding a hard border on the island of Ireland. I know from history that my right hon. Friend has experience of trade matters. He was an Under-Secretary of State, as I am today—he was an Under-Secretary in the Department of Trade and Industry—and he speaks as a lawyer, so he has considerable expertise in many of these issues. I should also point out that he has engaged with my right hon. Friend the Prime Minister on precisely this issue of the conditional interpretative declaration. I shall say a few words about that later in my speech.

I am grateful to my right hon. Friend, as are the Government, for sharing his thoughts on a mechanism that was not previously known to me. I read his letter with due consideration, and I have done my own research in addition to that with my team in the Department. We have our own views on the strength and plausibility of this mechanism.

As the House will recall, Members sent a clear signal to the Government, and to the country, that a deal could be supported, but that that support was conditional. In the only positive expression of its desired means to achieve our exit from the EU, the House asserted that to secure support for the withdrawal agreement, legally binding changes to the backstop would be required. I must stress that the Government are entirely convinced that that is the question that we need to address, and on which we need to make some measure of progress.

My right hon. Friend highlighted one possible means by which a change to the backstop could be secured. We are still committed to legally binding changes that would deal with the concerns about the backstop that have been expressed by Members on both sides of the House. As for the substance of the changes that we are seeking, we are still looking at various means: we have not necessarily taken one route or another.

I note that the Opposition Benches are entirely empty, but, as a courtesy to the House, I will address those empty Benches.

I thank you very much for those tips, Madam Deputy Speaker. I was just making a rather flippant observation; I do not think I have ever seen entirely empty Opposition Benches.

Clearly the Government and the Prime Minister have set out three possible routes—three ways in which the backstop can be addressed. Members will know those three options, but for the sake of the record we should recapitulate. The first was whether the backstop could be replaced with alternative arrangements, and those arrangements are expressed exactly in the political declaration. They are arrangements that will avoid a hard border between Northern Ireland and Ireland, and this process has been constructively led by my right hon. Friend the Secretary of State and he has been engaging with MPs across the House on that issue.

My right hon. Friend the Secretary of State has also discussed alternative arrangements with the ongoing alternative arrangements working group in Brussels and with Mr Barnier. The Commission has changed its language over the last few weeks and is beginning to engage seriously with the proposals we have suggested. Although the Commission has expressed some concern about the viability of alternative arrangements, I would suggest that it is more flexible and open to these alternative arrangements than has been the case hitherto.

Order. Having just come into the Chair and counted how many Members wish to speak, I am somewhat shocked. Mr Deputy Speaker said that five-minute speeches would be about right because he had an indication that a large number of Members wished to speak. Something must have been said of which I am unaware that has made nine Members decide they have nothing to say after all. I do not know whether the right hon. and learned Member for Holborn and St Pancras (Keir Starmer) will consider that a victory. Members might be a little surprised that the hon. Member for West Bromwich West (Mr Bailey) spoke without interruption from me for 10 minutes instead of five. I calculate that if Members speak for approximately six to seven minutes, everyone who wishes to speak will have the opportunity to do so. It is nice to see the House behaving so well and so honourably. I hope that it will continue to do so and that I will not have to introduce an official time limit.

It was not in the national interest to resist the meaningful vote. It was not in the national interest to resist any disclosure of impact assessments, which had to be forced. It was not in the national interest not to disclose legal advice that was relevant but not, in truth, confidential. And it was not in the national interest to pull the vote and prevent what needs to happen next.

I have been consistent in arguing for my proposition. We have tabled amendments before the House time and again, and they have been voted down time and again through blind loyalty. Instead of a Prime Minister and a Government who are prepared to work across the House for true consensus, what is happening now among Government Members was utterly predictable at 10 o’clock, when the result of that snap election came in. At that moment, the Prime Minister should have realised and thought about the long-term prospect of getting a deal through, and that meant working in a consensual way, taking on board the proper points that have been made by Opposition Members. That is what acting in the national interest is all about.

That this House has considered the matter of the Cabinet’s decision to accelerate preparations for a no-deal outcome to Brexit, following the Prime Minister’s failure to allow this House promptly to express its view on the Government’s deal, in the light of the significant public expenditure involved.

On a point of order, Madam Deputy Speaker. Last night, a man sleeping rough on Parliament’s doorstep died. This is the second time that that has happened. I know individual MPs and staff do what they can to help people, but I wonder whether you are aware of any strategy that Parliament might be seeking to put in place to support people who are homeless. I also wonder whether there has been any indication from Ministers that they will be making a statement on this tragedy and on their failure to address the crisis of homelessness that we see every day in our communities up and down the country.

I thank the hon. Lady for her point of order and for bringing to the attention of the House the tragedy of the loss of life of someone who has been homeless and sleeping rough here. I am sure the whole House will join me in saying how sorry we are that something like that has happened. She has asked me whether I am aware of whether Ministers are likely to come forward with plans to deal with homelessness. I understand that the Secretary of State might well be coming forward with such plans, but I have no formal indication of when that might be or in what form. The hon. Lady has made some very important points, and I am sure that those on the Treasury Bench have heard them and that the Ministers with responsibility will come to know very quickly about what she has drawn to the attention of the House—if by no other means, I will make sure that they know about it. I have every confidence that Ministers will take into consideration what she has said this evening in making future plans.

I am afraid to say that the hon. Gentleman is mistaken, because the analysis he is referring to looks at the Chequers proposal and does not look at the Government’s deal. He is wholly wrong and he needs to go back to school and do his homework.

The Government’s Brexit deal will damage our NHS in Scotland, and make it harder to attract and retain the social care and health service staff we need. It will sell out our fishermen and put us at a competitive disadvantage with Northern Ireland—and the Prime Minister knows it. That is why our voice must be heard; this House should vote this week—[Interruption.]

I am not surprised, because the Conservatives have form: when Ted Heath took us into the European Union, he sold out Scotland’s fishermen and every Tory Administration since have done exactly the same—and, guess what, they are still selling out Scotland’s fishermen.

Running down the clock to threaten a no-deal Brexit is neither acceptable nor realistic. There is no majority in this House for such an outcome. It is crucial that a no-deal Brexit and the Prime Minister’s deal are ruled out now. The Government must start listening to the Scottish Parliament, stop wasting time on their deal, which is going to be rejected, and pursue a better way forward. The SNP is clear that that means there should be an extension to the article 50 process, and we will join those from other parties in trying to secure such an extension.

We have always argued that the best option is to retain EU membership. We support a second EU referendum. Failing that—the best option of continued EU membership—we must stay in the single market and the customs union. I repeat that there are options that this Government are ducking and diving. [Interruption.]

I am going to make progress, and I am not going to take any more interventions, as I have been generous with my time.

Yesterday, the Prime Minister told us she was planning for a no-deal Brexit. Prime Minister, there cannot be no deal; it must be removed from the table. It would be economically catastrophic. This Government must remove no deal from the table, instead of using it as gun to hold to MPs heads. We were promised “strong and stable”. The people were promised that we would take back control. This is a party and a Government completely out of control. I look around this Chamber at colleagues and friends, and perhaps some who would call themselves foes, but in common we came here to serve. I came here to serve Scotland—my people and my country. It devastates me to see the will of my people disregarded by this UK Government. It angers me to see my Parliament in Scotland—our Parliament in Scotland—our First Minister and her Cabinet locked out by this Tory Government from decisions that will affect the rights and lives of people right across our country. It is not right, and Members from other parts will feel the same. I know that England and Wales voted to leave, but what about the rest of us who voted to stay? So much for the union of equals that we were promised.

The Scottish National party will work with others to protect all of the UK from Brexit. That is the right thing to do. We will work constructively in the House, but our first priority as the Scottish National party is to stand up for Scotland. It is becoming ever clearer that Scotland is being hampered by its continuance in the United Kingdom. We do not co-exist in a partnership of equals. With every day that passes, the Government are making the case for Scottish independence. The UK Government’s behaviour over the continuity Bill, exposed this week by the UK Supreme Court, shows the utter contempt with which they are treating Scotland. With the UK Government’s approach to Brexit in complete and utter chaos, it is no wonder the Scottish Parliament does not trust Westminster to prepare our laws for life after Brexit. Of course, when there was the outrageous power grab of the powers of the Scottish Parliament, not one Scottish Tory MP stood up to defend the rights of our Parliament, for which the people of Scotland voted in 1997. They voted against Scotland’s interests: history repeating itself once again.

We get from the Government empty, meaningless words—that is all we can expect from them—and now those words are not worth the paper they are transcribed on, as promise after promise is broken by the UK Government. It is time we had our say and got our answers. I am sorry he is not present, but let me put it to the Leader of the Opposition again: table a vote of no confidence in this Government. We are with you. It is clear today that the gimmick motion has failed, but I say to the Leader of the Opposition: table the correct motion and do it today. The SNP stands ready to end this farce—to end this shambles. We are ready to defeat this Tory Government and a damaging Brexit. This Tory Government want to put Scottish workers on the dole through Brexit. The question for the Leader of the Opposition is whether he is prepared to stand up—[Interruption.]

A failure to table a motion of no confidence will be a dereliction of duty. We now need to call time on this Government. The Prime Minister’s time is up. The Government must go. We cannot allow the Conservatives to drive us off the cliff edge. The Leader of the Opposition cannot also seek to run down the clock to buy himself more time. He claims he wants an election; well, if he wants this Government out, he should listen to the other Opposition parties. We will support him in a vote of no confidence. Now is the time for courage. Now is the time for all of us to stand up for our communities. Now is the time for the Prime Minister to stand down, and for this Government to stand aside and let the people decide.

The hon. Member for Chelmsford has directly and, I am sure, inadvertently misrepresented the position of the two SNP Members of the European Parliament, both of whom are personal friends of mine. I can absolutely assure her that they have made their position clear that they are against this deal. Indeed, one of them was my co-litigant in the article 50 case. I ask your assistance for the third time in a week, Madam Deputy Speaker, about how I can go about correcting misrepresentations of the facts about Scottish politics coming from the Government Benches and the Benches behind them.

I appreciate that the hon. and learned Lady has very cleverly made her point into a point of order by asking my advice. I say to her that, of course, she does not need my advice, as she has just taken the opportunity of her point of order to put her point on the record. It is not for me to judge whether the hon. Lady or the hon. and learned Lady are correct in their interpretation of something that has happened in another Parliament, but I am satisfied that both points of view have been put to the Chamber.

Further to that point of order, Madam Deputy Speaker. As I think you know, I have the greatest of respect for you, but it occurs to me from what you have just said that the hon. Member for Chelmsford (Vicky Ford) can just come here, as she has done, make stuff up and then nothing happens. There has to be consequence for that. [Interruption.]

Order. Nobody can come here and “make stuff up” that is not correct, but this is a debating chamber, and there are opinions on both sides of the House. One could be forgiven perhaps for being confused over the SNP’s position on these matters, because no doubt the electorate are also confused. They were told in 2014 that there was a vote to listen to the Scottish people. The Scottish people duly spoke and said that they wanted to be a part of the United Kingdom, and now the position appears to be to no longer listen to the Scottish people and to ignore their views.

On a point of order, Madam Deputy Speaker. I ask for your guidance, because I think it is important that we are all honest in this place. If anyone looks at the record, they will see that what I did say was that we are wasting money on no deal that should be invested in frontline services. The Secretary of State has a duty to make sure that he is correct.

I am grateful to you, Madam Deputy Speaker, for your clarification. I am very happy to stand by that clarification. I thought that the substance of what the right hon. Gentleman was saying—I realise that there was a lot of confusion over his speech—was that he was not in favour of spending money on no deal preparations. I thought that was the kernel of his point. Perhaps he is in favour of spending money on no deal preparation.

Let me explain it this way: we can never say that people do not have the right to reconsider a proposition in a democracy. On the other hand, we cannot have a referendum every month or every year, so we have to set tests for whether it is legitimate to have a second referendum. I would set three tests. First, the information on which the initial decision was taken needs to have substantially changed or to have been shown to be wrong—I think that test is met. Secondly, a significant number of people have to have changed their minds—enough to create a different result. That test is met. The third test is whether the elected Parliament is incapable or unwilling of discharging the mandate from the referendum. When we get the chance to vote on it, that test, too, will have been met. It is now possible that having a people’s referendum is actually the only way to get out of the current impasse and crisis.

Let me turn to the official Opposition. I am being completely non-sectarian. I do not just want to work with the Labour party in defeating this Government; I am desperate to do so. I am really concerned by what has happened over the last 24 hours. Earlier comments suggested that the mis-wording of Labour’s no confidence motion to include “the Prime Minister” but not “the Government” is somehow a mistake or an ineptitude. It is not. It is a deliberate attempt not to put the question, so that it now languishes on the Order Paper with the same authority and effect as 1,900 early-day motions that are lying around.

I say to the Labour Front Benchers: you need to do something to dispel a growing concern, which is that Labour Members are not effectively taking on the Conservatives because they are not actually disagreeing with their policies all that much and would be quite content to see them go through. The Labour party needs to lead. It is the biggest Opposition party in this House. It needs to step up and co-ordinate the opposition on the Opposition Benches, but also on the Government Benches, and to defeat these proposals. Please do that and we will be your willing accomplice, if you ask us to be so.

There has been a lot of talk about the fact that Scotland, for the time being, remains part of the United Kingdom. I respect the 2014 referendum result. Scotland does remain part of the United Kingdom, and we have every right to argue in this Parliament for the benefit of our constituents within the United Kingdom, which is why we are desperately engaged in a process of trying to save this country from itself—from the worst act of collective self-harm in history—by stopping this ridiculous process of Brexit. But know this: we will not go down with the ship if it does not change direction. We will use our right of self-determination as a lifeboat to escape from this catastrophe. And when the time comes, if this process unfurls the way the Government want it to, you will be the greatest champions of Scottish independence, because the people of Scotland will take their opportunity to chart a different course and become a proper European nation at the heart of Europe.

On a point of order, Madam Deputy Speaker. We have very little time for this important debate, and I suspect that at any stage you might limit our speeches, yet the debate seems to be turning into an internal, navel-gazing exercise by the SNP about what it has and has not achieved at Holyrood. Can we get back to the subject of the debate, which is the future relationship between the UK and the EU?

I understand the right hon. Gentleman’s point, but the hon. Member for Glenrothes (Peter Grant) is setting out the context of his remarks. What he says is, of course, not a matter for me, but if he exceeds the parameters of the debate, I will stop him and insist that he stay within them. At the moment, I think that he is erring a little but will soon come back to the main purpose of the debate. I am also certain that he, appreciating that a lot of people wish to speak and that his speech is not time limited, will not take an awful lot longer.

Thank you, Madam Deputy Speaker. It goes without saying that I will at all times respect any judgments made by you and by any other occupant of the Chair.

I have said all along that I think that the people of England have made a catastrophic mistake, but sometimes democracy means that people must be allowed to make mistakes and then to sort them out. I rather think that the Government could have made a better fist of sorting out the mistake than they have over the last two years, but we shall see how that pans out.

On a point of order, Madam Deputy Speaker. The hon. Gentleman is misinterpreting the British constitution. There are Scottish Members of Parliament here, representing our constituencies and representing Scotland. The hon. Gentleman is suggesting that there is no sovereignty of this place over Scotland. While we still have MPs in this place, this place is sovereign. The hon. Gentleman is out of order, and he is not telling the truth to all the people who are in the Public Gallery today.

I am grateful to the hon. Gentleman for correcting his language. “Misinterpretation” I can allow. Of course, the matter of sovereignty is subject to many interpretations—indeed, volumes have been written about it—and it is not for me to judge whose interpretation of the meaning of sovereignty is correct, but the hon. Member for Glenrothes (Peter Grant) is not out of order in what he is saying.

Thank you, Madam Deputy Speaker. I am happy to refer the hon. Gentleman to the good reporters of Hansard, who, as we know, never make any mistakes when they record the decisions of this Parliament.

It was disappointing that the exchanges between the two main Front Benchers tended to go into the nitty-gritty of customs and trade. It may be understandable, because that is where the battle lines have been drawn recently, but our relationship with the European Union is fundamentally about people.

Once again, the Front Benchers have not spoken enough about the millions of people who are currently living in one another’s countries as a matter of right, and who are seriously concerned about what their future will be. They have not yet spoken about the fact that in a few weeks, many of our great universities will welcome further waves of ambitious, talented young people from Europe and from other parts of the world who will feel that they are coming to a place that is less welcoming than it was a few years ago. The Government can deny it, and the Minister can shake his head, but people from other European countries who live here believe that they are less welcome now than they were before. Racism has been emboldened since the referendum in a way that it was not before.

I accept—I have accepted it for a while—that there is very little that is likely to happen that will prevent Brexit from happening. I am still hopeful that it can happen in a way that respects the will of the peoples of the four nations. I want to live in a country that sees itself as an equal of all others. I want to live in a country that is not only attractive to workers, students and visitors from all around the globe, but that welcomes them all with open arms and open doors. I will continue to live in such a country. At some point in the not too distant future, a decision will be taken as to whether that country remains part of the Union represented in this Parliament.

I note your comments, Madam Deputy Speaker. Key in the motion is the issue of the single market, and the hon. Gentleman knows that I fully support our remaining in it. He will recall that the Brexit Secretary said that we would get the “exact same benefits”, but that is patently not going to be the case. I totally agree with what the hon. Gentleman was saying, as I too have been to see those Treasury papers, and they are clear that we will be worse off in every scenario. That is not the “same benefits”, be they for citizens, for our businesses or for our country.
