Thank you very much, Mr Deputy Speaker. It is a surprise to be called so early, but I am absolutely delighted.

I welcome the King’s Speech and its focus on fairness and opportunity for all—quite the antidote to the last 14 years when things have been anything but fair. The UK now has the highest level of income inequalities in Europe and the ninth highest of 38 OECD countries. Inequality in wealth is even worse, with the top fifth of the population having over one third of the country’s income but two thirds of the country’s wealth. These inequalities in income and wealth are particularly concentrated in the north but also among disabled people and ethnic minority communities.

The impact of these inequalities on health has been described by Professor Sir Micheal Marmot in his latest report, “Lives Cut Short.” He wrote in The BMJ:

“if everyone had the good health of the least deprived 10% of the population, there would have been 1 million fewer deaths in England in the period 2012 to 2019.”

Poverty and inequality are not inevitable; they are the result of political choices. The choices of consecutive Conservative Governments over the past 14 years have led to not only our flatlining economy, but our flatlining life expectancy and healthy life expectancy. In deprived areas such as mine, life expectancy and healthy life expectancy are actually declining.

We also have growing levels of economic inactivity due to this ill health, and the International Monetary Fund has revealed that there is a causal impact from these health inequalities on economic growth. For every 1% increase in the income share of the richest 20%, growth is reduced, whereas increasing the income share of the poorest 20% increases growth. Ensuring a vibrant, stable and fair economy with sustainable growth will enable us to renew and restore our overstretched public services. With fair funding formula and public spending allocations based on need, there is an opportunity to improve health in areas, such as Oldham, that have fallen behind.

There are many Bills and initiatives that will make a positive difference to our lives and living standards, and these include the new deal for working people that will make work pay, ending the outrage of over 8 million working people living in poverty and 3 million children in poverty living in working households, transforming the lives of millions of people up and down the country, including in Oldham East and Saddleworth.

The new GB Energy company will not only support new quality jobs but provide cheaper, cleaner energy, reducing the energy bills of my constituents and millions of others. The children’s wellbeing Bill, with free breakfast clubs and 100,000 extra nursery places, will also help to reduce cost pressures for young families while making life a bit easier for families. Our plans to enable 1.5 million new quality homes to be built while at the same time ensuring legislation to end no-fault evictions will be a huge relief to tenants and mortgage holders everywhere.

Collectively, these measures will help improve the living standards of millions of people, but they will not happen overnight or for all people. Some 2.6 million working-age people are out of work because of an illness or disability. While many sick and disabled people want to work and will benefit from the extra NHS appointments and therapies, it will be many months before we see inroads into these waiting lists. Similarly, I would like to think that the attitudes of employers towards hiring disabled workers will shift quickly, but we recognise that is unlikely to be the case. And then there are other disabled people for whom the possibility of working is unrealistic.

Those who are disabled or who live in a household with a disabled adult or child are more likely to live in poverty. Over the past 14 years, disabled people have been absolutely battered by consecutive Conservative Governments. As the UN Committee on the Rights of Persons with Disabilities described, there have been systematic violations of their rights under the UN convention.

My hon. Friend is making an excellent speech. Six years on, that Committee did a follow-up report which found that things had in fact got even worse for disabled people, so does she agree that it is now absolutely right that a new Labour Government will change course?

My hon. Friend is absolutely right, and I am absolutely convinced that under a Labour Government we will see these changes.

I think it is important that we put on the record where we are at the moment. We need to ensure that the right to adequate social protection and social security is in place, and we know that is not the case at the moment. We must do better not just in changing the culture of the Department for Work and Pensions, but in recognising the extra costs, the fear and the poverty disabled people face and feel, because otherwise I fear that we will be seeing more deaths of disabled claimants.

Similarly, while I support the measures in the King’s Speech to improve our lives, that cannot happen soon enough for the nearly one in two children living in poverty across Oldham. Children living in poverty now will be affected by the experience for the rest of their lives. There is evidence that living in poverty changes the wiring of their brains. Many will not reach their first birthday. Shamefully, we have the worst infant mortality rate in northern Europe. There is no law of nature that decrees that children from poor families have to die at more than twice the rate of children in rich families. I welcome that the Secretaries of State for Education and for Work and Pensions have established the child poverty taskforce to deliver the cross-Government child poverty strategy, and I look forward to it reporting in the early autumn. We cannot forget the 1.6 million children across the UK with special educational needs. SEND education is in crisis and that cannot continue.

This Labour Government are a Government for everyone, and the King’s Speech is a starting point on that. I look forward to working with the Government to deliver the change that all our country needs.

On a point of order, Madam Deputy Speaker. Today, the Equality and Human Rights Commission, the country’s equalities watchdog, launched an investigation into the Department for Work and Pensions over its potentially discriminatory treatment of sick and disabled people within the social security system. This is absolutely unprecedented. The investigation has been escalated following two years of the EHRC trying to agree remedial action with the Department, following the section 23 notice issued to it by the EHRC regarding potentially discriminatory action against disabled people.

The EHRC will investigate whether the Department has acted unlawfully by failing to protect disabled people over a number of years, including by failing to prevent their deaths by suicide or other means. With a recess fast approaching, the next DWP orals over a month away, and discussions this week in the Chamber about the importance of a duty of candour for all public servants, has Mr Speaker been given information about when we can expect to question the Government regarding this?

Madam Deputy Speaker, here we are again—you were in the Chair the last time we considered this Bill. This House has now voted several times, including in our strong endorsement of the Bill on Second and Third Readings. We need to bring this process to a conclusion to get the Bill on to the statute book and to get the flights off the ground as soon as possible.

Lords amendment 1D says we should have “due regard for” the Children Act 1989, the Human Rights Act 1998 and the Modern Slavery Act 2015, but why stop there? Why not the Equality Act 2010, the Data Protection Act 2018 or any other Act? Why not list the whole statute book? The answer is because it is not necessary. Together, the treaty, the Bill and the evidence demonstrate that Rwanda is safe for relocated individuals and that the Government’s approach is tough but fair, is lawful, has justification and seeks to uphold our international obligations.

As I set out in our earlier debates, the Government respect the Supreme Court’s decision, and it was precisely to address the Supreme Court’s concerns that we brought forward the treaty with the Republic of Rwanda. We have also prepared an evidence pack on what has changed and how those concerns are being addressed.

I am struck by how reasonable Lord Hope’s amendment seems in setting up an independent body to assert that Rwanda is a safe place, as the Minister says. What could possibly be wrong with that?

I will address that amendment in a few minutes, but there already is an independent body: the monitoring committee is part of the treaty. I am not speaking to that amendment at the moment, but I hope to allay some of the hon. Lady’s concerns in a few minutes’ time and then to see her in the voting Lobby.

Having considered the lengthy and extensive exchanges throughout the Bill’s passage, the Government now invite Parliament to agree with our assessment that the Supreme Court’s concerns have indeed been properly addressed and to enact the Bill accordingly.

Once again, I am very grateful to my hon. Friend for his intervention. He has a tendency to repeat himself from time to time, as he admits, but he is right to do so. He has previously mentioned paragraph 144 of the Supreme Court’s judgment, which I can cite in full:

“in any event, the principle of legality does not permit a court to disregard an unambiguous expression of Parliament’s intention such as that with which we are concerned in the present case.”

It has been our joint endeavour to ensure that this legislation is clear and unambiguous.

On the treaty’s implementation, I reiterate that clause 9 clearly sets out that the Bill’s provisions come into force when the treaty enters into force, and that the treaty enters into force when the parties have completed their internal procedures. We will ratify the treaty only once we agree with Rwanda that all the necessary implementation is in place for both countries to comply with the obligations under the treaty.

The monitoring committee, as I told the hon. Member for Oldham East and Saddleworth (Debbie Abrahams), will undertake daily monitoring of the partnership for at least the first three months to ensure rapid identification and response to any issues. This enhanced phase will ensure that comprehensive monitoring and reporting takes place in real time.

The monitoring committee’s work is independent. Commitments have already been made that there will be an update in Parliament, which is one of the amendments in lieu that we agreed to last time. Today, the right thing to do is to push back on all these amendments, which are either unnecessary or wrecking.

I completely agree. Spending money on things such as flowerbeds and diversity staff instead of frontline police officers is the wrong priority. Former frontline officers such as Rob Potts, running for PCC in Durham, will do a good job of getting priorities straight.

Kulsuma Akter from Oldham was murdered by her estranged husband on a busy Bradford street in the middle of the day, in front of their baby son. Research has repeatedly shown that regular foot patrols—especially in crime hotspots—lead to reduced offending and increased public confidence, particularly if combined with community-based prevention. Greater Manchester police and West Yorkshire police want to learn lessons from this tragic murder. What lessons has the Home Secretary learned about reducing neighbourhood policing and the prevalence of such appalling crimes?

That is a tragic case, and we will study any findings by the Independent Office for Police Conduct very carefully. The hon. Lady mentioned hotspot patrolling; I mentioned in a previous answer that the Government are providing £66 million this financial year on top of the regular police funding settlement to fund hotspot patrolling, which may help in such situations. To repeat a previous point, local policing numbers have gone up by about 6,500 since 2015. Selectively quoting figures that are five years old does nothing to help public debate.

As I said in response to my hon. Friend the Member for Harrogate and Knaresborough (Andrew Jones) a few minutes ago, it is incumbent on political leaders—particularly those who aspire to the highest office in the land—to act quickly and from principle. I am disappointed that after the comments of Labour’s former Rochdale candidate became public, it took a number of days for the Leader of the Opposition to act. I would suggest that he reflects soberly on that; I am disappointed that it took so long, and on reflection, he is probably disappointed with himself as well. It might be useful if he said so publicly.

The figures from the CST are absolutely horrific. Antisemitism is absolutely unacceptable; hate crime, including Islamophobia, is absolutely unacceptable; but does the Minister think there is sufficient capacity within the police to investigate the full range of issues that are being raised? What is the role of the Equality and Human Rights Commission in preventing the discrimination that can contribute to this hate?

I think there is enough resource in policing. As I may have said once or twice before, we have record police officer numbers—a total of 149,500 or so was reached in March last year—so we do have sufficient resources. The police are prioritising this issue, and of course, they can work with the EHRC to take criminal action where the EHRC identifies examples of antisemitism.

I beg to move, That the Bill be now read a Second time.

Before I speak to the Bill, let me say that the House may well be aware that, tragically, there has been a death on the Bibby Stockholm barge. I am sure that the thoughts of the whole House, like mine, are with those affected. The House will understand that at this stage I am uncomfortable going into any more details, but we will of course investigate fully.

This Government are stopping the boats. Arrivals are down by a third this year, as illegal entries are on the rise elsewhere in Europe. Indeed, small boat arrivals are up by 80% in the Mediterranean, but they are down by a third across the channel. The largest ever small boats deal with France, tackling the supply of boat engines and parts, the arrest and conviction of people smugglers, and a 70% increase in raids on illegal working are having an impact—a positive one. We have signed returns and co-operation agreements with France, Bulgaria, Turkey, Italy, Georgia and Ethiopia. Fifty hotels are being returned to their local communities, and the initial asylum backlog, which stood at 92,000, is now under 20,000. We have sent back 22,000 illegal migrants, and the UK’s arrangement with Albania proves that deterrents work.

I will not give way yet, as I have just started.

Last year, a third of all those arriving in small boats to the coast of this country were Albanian. This year, we have returned 5,000 Albanians, and arrivals from Albania are down by 90%. But in recent years, some of the Government’s efforts to tackle illegal migration and deport foreign national offenders have been frustrated by a seemingly endless cycle of legal challenges and rulings from domestic and foreign courts.

The Home Secretary points to deterrence. He has often used the Australian model of offshoring detention centres as a gold standard. What are his comments, then, on the fact that Australia has recently shut down its offshore centre because of the high financial and human costs?

The hon. Lady raises the case of Australia. It had 55,000 illegal migrations by boats and that has trended pretty much down to zero—deterrence works.

As my hon. Friend will understand, I do not want to go into too much detail about all the operational procedures at this point, but I can reassure him that we are thinking about the logistics. Within Rwanda, there is a well-matured process whereby people can escalate their claims in a way that is completely consistent with international law. The Rwandans are very keen to demonstrate their conformity with international law, just as we are.

Four days before International Human Rights Day, it is shameful that we are seeking to disapply parts of the Human Rights Act for a certain group of people, and it make me feel incredibly sad. Does the Attorney General agree that the Rwanda treaty complies with international law, and can we see her written advice?

As the hon. Lady will know, the advice of the Attorney General—who is not in her place any more—is for Government. The Government have made it clear that this is in conformity with international law.

Let me make a small amount of progress and then I will give way to the hon. Member for Oldham East and Saddleworth (Debbie Abrahams).

I turn to the first issue of substance, which is Lords amendment 2. That would provide that the duty to make arrangements for removal applied to persons who entered illegally from the date of commencement of clause 2, rather than on or after 7 March 2023, as originally provided for in the Bill.

We acknowledge the position advanced by some in the other place and in this House about the retrospective effect of the Bill, but these Lords amendments go too far in resetting the clock. The closer we get to commencement of the Bill, the greater the risk that organised criminals and people smugglers will seek to exploit that, and we will see an increase in crossings as the deadline looms, which would only put more people at risk.

To guard against that, we have brought forward amendments in lieu to move the application of the duty from 7 March to the date of Royal Assent. The date of 7 March, however, would continue to apply for the purpose of the Secretary of State’s power to provide accommodation for unaccompanied children and for the purposes of the bans on re-entry, settlement and citizenship. That Government amendment in lieu has a particular advantage with respect to the concerns about modern slavery expressed by my right hon. Friends the Members for Maidenhead (Mrs May) and for Chingford and Woodford Green (Sir Iain Duncan Smith), but I will come to that in a moment.

Can the Minister tell me how many Afghan women have been able to avail themselves of the Afghan citizens resettlement scheme phase 3 programme? That is the Government’s position on a safe and legal route. As we have understood from various Westminster Hall debates, we are looking at a handful in phase 3. Everything else refers to what has happened in 2021. I also draw his attention to the recent horrific drownings off Greece. This included a number of Afghan nationals and people from Pakistan-administered Kashmir. What really is the point of these ineffective, supposed safe routes?

The hon. Lady and I share the same objective: to ensure that the schemes that the Government have established are operationalised as quickly as possible, so that people who are eligible—perhaps including the women she is in contact with—can come to the United Kingdom, settle here and find sanctuary. It is incredibly important that the UK is a beacon in the world for resettlement schemes. We have already supported more than 20,000 people under the Afghan relocations and assistance policy and the ACRS to come to the United Kingdom. I appreciate her point that the numbers in recent months have been lower than she or we would like. One reason is that there is so little capacity in the UK today to properly house individuals, and one explanation for that is that the sheer number of individuals entering the country illegally on small boats has placed an intolerable pressure on our social housing and the contingency accommodation that we have available. If we are to bring further individuals to the UK—as we want to do and are continuing to do—they risk being housed in hotels, which is an unacceptable way to house vulnerable people and, in particular, families.

The Minister is being generous with his time. We in the all-party parliamentary group on Afghan women and girls have hundreds of civilians who would like a “homes for Afghans” scheme. These people are waiting and have already volunteered. This scheme is ready and it is equivalent to the Homes for Ukraine scheme, so I urge the Government to take us up on it and make sure that the supposed safe routes are actual safe routes.

I strongly endorse the hon. Lady’s comments. The Homes for Ukraine scheme has been superb and we should all be proud of it—I took part in it at one point. If it is possible to create a comparable scheme for Afghans, we should consider that. I know that the Secretary of State for Levelling Up, Housing and Communities, who has responsibility for that issue, is considering it.

On the broader point about resettlement, the UK has a strong record in this regard. Of course, we would all like to go further, but since 2015 we have welcomed 550,000 people to this country on humanitarian grounds, mostly on resettlement schemes. We are one of the world’s leading countries for such schemes.

As I said, it is vital that stop and search is used judiciously, carefully, reasonably and proportionately, and that there is effective community engagement and scrutiny. There are today more layers of scrutiny and challenge than ever before on the use of that particular power—internal supervision, first and foremost; internal feedback on each stop and search, depending on the force; stop and search scrutiny panels, chaired either by a member of the community, or by police and crime commissioners; inspectorate observations; and internal force professional standards investigations when there is a complaint. That is why we are seeing higher levels of confidence and lower levels of complaint.

Will the Home Secretary commit to an independent evaluation of her proposals, with particular emphasis on the impact on confidence in policing among marginalised minority communities and on community relations?

What I hear from chief constables is that there has been much needed awareness of the impact on different communities. Therefore, in many forces, there has been an improvement in the way outreach has been conducted, and much more respect with communities and to communities that may be affected by the use of these powers. The 2021 inspectorate report noted that there had been an improvement in engagement and training by forces. We should welcome that.

I thank my hon. and learned Friend for that comment. As an important aside that relates to other issues he has raised, nothing in the Bill disapplies the Children Act, which will continue to apply in all respects with regard to the children we deal with in this situation. In answer to his particular point, we are taking this power so that in the very small number of judicious cases in which we set out to remove a child, we can take them from the care of the local authority into the responsibility of the Home Office for the short period before they are removed from the country. I have given two examples of situations in which we would use that power, and I will happily give them again. I know that my hon. Friend the Member for East Worthing and Shoreham (Tim Loughton) is concerned about this point.

The first situation is where we are seeking to return a young person to their relatives in another country. I think it is incredibly important that we keep the ability to do so, because that does happen occasionally. It is obviously the right thing to do to return somebody to their mother, their father, their uncle or the support network that they have in another country.

The other situation is where we are removing somebody who has arrived as an unaccompanied minor to another safe country, where we are confident that they will be met on arrival by social services and provided with all the support that one would expect. That happens all the time here with unaccompanied minors; I think the right hon. Member for Hayes and Harlington (John McDonnell) mentioned, drawing on his experience as a local Member of Parliament around Heathrow, that it happens regularly. It is important that we continue to have that option, because we should not be bringing people into local authority care for long periods in the UK when we can safely return them home, either to their relatives or to their home country, where they can be safeguarded appropriately.

Let me continue with the points I was making. I return to a question that has been raised on several occasions about our policy on the detention of minors. Let me say, speaking as a parent, that of course we take this incredibly seriously. We do not want to detain children. We have to apply the highest moral standards when we take this decision.

The circumstance in which we would use that power is where there is an age assessment dispute about an unaccompanied minor. It is easy to dismiss that, but it happens all the time. My hon. Friend the Member for Mansfield (Ben Bradley) was correct to raise his experience as a local authority leader. There are a very large number of such disputes: between 2016 and December of last year, there were 7,900 asylum cases in which age was disputed and subsequently resolved. In almost half of those cases —49%—the people in question were found to be adults.

Where there is a live age assessment dispute, it would be wrong for the Government to place those people in the same accommodation as minors who are clearly children, creating safeguarding risks for them. I am not willing to do that. I want to ensure that those children are properly protected. When I visited our facilities at Western Jet Foil recently, I asked a member of staff who was the oldest person they had encountered who had posed as a minor. They said that that person was 41 years of age! Does anyone in this House seriously want to see a 41-year-old man placed with their children? I do not want to see it, and that is the circumstance in which we are going to take and use these very judicious powers.

My right hon. Friend the Member for South Holland and The Deepings (Sir John Hayes) raised a number of important points in respect of his amendment on mandatory scientific age assessments. I can say to him that not only are those valid points, but the Government are considering carefully how we should proceed in this regard. The UK is one of the very few European countries that do not currently employ scientific methods of age assessment. In January, the Age Estimation Science Advisory Committee published a report on the issue. The Home Secretary and I are giving careful consideration to its recommendations, and I hope to be in a position to say more on Report.

With reference to amendment 189 and the contribution of Afghans, Sabir Zazai tells a story of when he was given a letter from the Home Office saying, “You are a person liable to be detained and removed.” More recently, at a celebration to mark his being awarded an OBE, he said he had received a different letter telling him he was being awarded this great honour of the British state. He said he would put those two letters on the wall next to one another, because they show that, regardless of the circumstances by which someone came to these islands, there ought to be nothing they cannot achieve.

There ought to be nothing—but this Bill pulls up the drawbridge. It makes this country smaller, it makes this country meaner and it makes this country crueller—for every Sabir Zazai, for every Abdul Bostani, for every person that the right hon. Member for Bournemouth East (Mr Ellwood) is outraged about. People can come here and make a contribution. They could live a dull, boring, ordinary life, they could be an OBE, they could be the First Minister of a country, but they have a contribution to make and they deserve to get to make that contribution without the UK Government pulling up the drawbridge and saying that they are unwelcome.

On amendment 189, which deals with Afghan citizens, it is striking that the Minister for Veterans’ Affairs said this afternoon that there are no safe routes for Afghans to come to this country. Those Afghans have protected many of us as citizens and protected our armed forces, yet there are no safe routes for them to come here. Does the hon. Lady not think that is an absolute disgrace, given the promises made to them in 2021?
