Written StatementsThe Government are today introducing the Transport Strikes (Minimum Service Levels) Bill. This meets the Prime Minister’s commitment to introduce this Bill within her first 30 days of Parliament sitting and delivers on a commitment in the 2019 Conservative party manifesto.
The Bill paves the way for the introduction of minimum levels of service on transport services, like those already seen in other countries, including France and Spain. The Bill will ensure that specified transport services—which could include, for example, rail, tubes and buses—will not completely shut down when unions impose strikes. This Bill will balance the right to strike with ensuring commuters can get to their place of work and people can continue to make vital journeys to access education and healthcare during strikes.
The Bill sets out the legal framework for establishing minimum service levels. It will allow relevant employers and trade unions to negotiate and reach agreement between themselves on minimum service levels referred to as minimum service agreements (MSAs), provide for circumstances in which the MSA can be changed and include enforcement arrangements to ensure parties follow due process in their negotiations.
The Bill also provides for an independent determination process should employers and unions fail to reach agreement on an appropriate minimum service level after three months, whereby if an agreement has not been reached the Central Arbitration Committee will determine the minimum service level.
The Bill also includes a power for the Secretary of State to set interim minimum service levels by regulations which will apply where neither an MSA has been agreed nor an independent determination reached. These regulations will also be consulted upon and will need to be agreed by both Houses of Parliament before they are made. Under the Bill there will also have to be a minimum three-month gap between these regulations being made and their coming into force.
The specific details of how minimum service levels would apply to transport services will be set out in secondary legislation following appropriate consultation. A minimum service level would only be applied to an individual transport service once that secondary legislation has been agreed by Parliament.
The provisions of the Bill extend and apply to England, Wales and Scotland. The Bill’s provisions relate to the reserved matter of employment rights and duties and industrial relations, and the subject matter of the Trade Union and Labour Relations (Consolidation) Act 1992, and do not engage the legislative consent process.

Commons ChamberMayoral combined authorities across the north of England each received a share of £5.7 billion over five years from the city region sustainable transport settlements to transform their local transport networks. That builds on nearly £33 billion of central Government spending on transport across the north since 2010 as well as the £96 billion committed to the north and midlands through the integrated rail plan.
I welcome the Secretary of State to her post and thank her for her answer. Doncaster Sheffield airport is a strategic asset not just for South Yorkshire but for the wider north and an important part of our national transport infrastructure, but it is about to close. She has received numerous meeting requests from both the Mayor of South Yorkshire and Members across the House along with specific concerns about how closure would diminish our civil contingency capability, potentially with severe consequences. Will she agree to an urgent meeting to sit down with the Mayor and Members of Parliament from across South Yorkshire so that we can work together and do everything we can to keep DSA open?
The Government are incredibly disappointed that air operations at Doncaster Sheffield airport are expected to close from the start of November. We recognise that that will be difficult news for those who use the airport as well as businesses and people working there. Of course, it was ultimately a commercial decision made by the owners of DSA. I have held several meetings with both local leaders and the Peel Group to encourage them to work together towards a solution for the site that will benefit local people and the region’s economy.
I welcome the Government’s recent commitments to accelerating infrastructure investment and in particular the comments about Northern Powerhouse Rail. Will the Secretary of State encourage spades in the ground for the Ferryhill station project, which is progressing, and meet me and others with regard to the work already being done to put plans in place for the Leamside line and the opportunities to bring it into the full Northern Powerhouse Rail project?
My hon. Friend is a doughty champion for all transport infrastructure in County Durham, having been so before and indeed now that he is in the House. I will ensure that he can sit down with our rail Minister to discuss in greater detail the investments that we are making. The growth plan, which the Chancellor set out a few weeks ago, sets out clearly why transport infrastructure is critical to helping our economy to grow. We have a broad range of projects that we are both accelerating and continuing with the investments that we have committed.
Further to the question from my hon. Friend the Member for Barnsley Central (Dan Jarvis) on the closure of Doncaster Sheffield Airport, this is an incredibly urgent and serious issue. I am not sure what meetings the Secretary of State is referring to, but will she now agree to meet local leaders?
I have asked my officials to meet the Mayor of the combined authority in the very near future to continue the discussions we have already had, but, as I say, this is ultimately a commercial decision by the airport owners. We want to work with them and the authority to find the right solutions.
I welcome my right hon. Friend to her place. May I urge her to continue the work of the former cycling Minister and Active Travel England, who were enthusiastic supporters of the improvement and upgrading of the cycle route between Newcastle and Hexham, and ultimately to Carlisle, to a cycle superhighway? This has the treble benefits of increasing commuting capability, cutting cost of living, and creating both active travel and a tourist destination.
My parliamentary neighbour is nothing if not a champion for all things active travel. I would be very happy for him to sit down with the new cycling Minister to discuss that in more detail. I agree with him absolutely that we need to look at such important cycleways, which offer a series of new economic opportunities, and get those spades in the ground as quickly as possible.
I welcome the new Secretary of State and the entire ministerial team to their place. We look forward to shadowing them. I am afraid that we are not off to a great start, though. The Prime Minister promised to protect Doncaster Sheffield Airport during her leadership campaign, and she gave a promise to the hon. Member for Don Valley (Nick Fletcher), who I do not see in his place this morning, at her first Prime Minister’s questions to do what she could to protect the airport. This is not just a commercial decision. The Mayor has written to the Peel Group this morning with names of potential bidders and a reiteration of financial support to keep the airport running. Will the Secretary of State agree to meet the Mayor and Members across this House, and consider using her powers under the Civil Contingencies Act 2004 to keep this strategic asset running?
Department for Transport Ministers and officials have been clear throughout that the Government support our regional airports and that they provide a vital contribution. Throughout the period of review carried out by the Peel Group, Transport Ministers have been working together—I am very pleased to hear there are new proposals on the table—with the local authorities and the Peel Group to find ways forward. On the issue the hon. Lady raises relating to the Civil Contingencies Act to prevent closure, I have looked at that in some detail. While all things under the Act are owned and determined by Cabinet Office Ministers, I am not persuaded that the closure of DSA could be undertaken under that Act.
What did the Prime Minister mean when she said she would protect Doncaster Sheffield airport?
As I say, we continue to show that support for our regional airports, but at the end of the day this is an airport held in ownership by the Peel Group and we want to continue to work with it. As I said to many colleagues, we continue to provide the technical support from DFT officials that may help to find a solution, but at the end of the day a solution is offered and accepted, or not, at that level with the Peel Group.
The Department regularly reviews the impact of labour shortages on the transport industry. Currently, there are currently 54,000 vacancies in the transport and storage sector, so my officials are in frequent contact with Home Office colleagues to ensure that the needs of the transport industry are reflected in their next review of the shortage occupation list.
Despite issues remaining for many, the HGV driver shortages, exacerbated by Brexit and covid, have marginally improved and drivers are now receiving the higher pay they rightfully deserve, although working conditions remain an issue. Many of the recruits are coming from the bus driving sector, which is causing significant driver shortages, cuts to timetables and service cancellations across the UK, and which is having an impact on passengers and net zero ambitions. What recent discussions has the Secretary of State had with the Home Secretary on expanding the shortage occupation list to include bus drivers?
The newly established transport employment and skills taskforce is already taking steps to identify and address the shortage of skills and jobs across the transport sector that we face now, and it is thinking about how we tackle this for the future. We are supporting new HGV driver training through apprenticeships and we are working with the Department for Work and Pensions to support jobseekers to become HGV drivers. We want to make sure that we grow this pool. This is a challenge not only in the UK, but across the world, and we want to make sure that we are at the front end of bringing these new young people into this industry.
I regularly discuss fuel prices with Cabinet colleagues, particularly those in the Department for Business, Energy and Industrial Strategy. Our Departments are working with the Competition and Markets Authority, which is currently looking at fuel prices. We will continue to work together and with representatives of the fuel industry on this issue to ensure that motorists are paying a fair price at the pump.
Rural constituencies such as mine in Broadland, where public transport is limited, are disproportionately affected by high fuel costs. It is sometimes overlooked that people also have limited choice as to which forecourt to fill up at. I am struck by the effectiveness of the price-comparison requirement in Northern Ireland, which is used to get consistently lower forecourt prices; are we considering that policy in England?
I agree with my hon. Friend that we need to focus on the challenges in rural areas, including my own constituency, which is why we asked the Competition and Markets Authority to conduct a thorough review. He is also right that although the price of fuel in Northern Ireland has historically been lower than the rest of the UK for several reasons, we absolutely consider the fuel price checker provided by the Consumer Council in Northern Ireland—along with cross-border competition with petrol stations in Ireland and lower overheads—to be part of the reason for those lower costs, and we are considering that possibility to help us to assess our own.
The hon. Member is indeed Northern Ireland this morning, as he sits alone on his Bench, and we are always pleased to hear him raise such important issues. Questions of finance are, of course, for the Treasury, but I will make sure that point is raised with Treasury colleagues.
I recently addressed the 41st International Civil Aviation Organisation triennial assembly, where I set out the key challenges that aviation faces and urged action, particularly on Russia’s violation of international law and on tackling climate change. It was a historic moment in two ways. First, in a triumph for those who respect the rules-based international order that ICAO and the wider UN system is built on, Russia was voted off the ICAO governing council for the first time in its history. Russia has shown a blatant disregard for its obligations under the treaty governing international civil aviation—the Chicago convention—and it is right that it no longer has the privilege of serving on the council.
Secondly, the assembly agreed to a new climate goal of net zero international aviation emissions by 2050. This is a historic milestone, not just for the future of flying but for the wider international commitments that we have all made to meet the Paris agreements. Now, the real work begins to put in place the measures to achieve that goal, including the technology, efficiencies and clean fuels that are central to our jet zero strategy.
My constituents in Blaydon are hugely concerned about the availability and reliability of our local bus routes. We were pleased to be granted funding under the bus service improvement plan programme, but will the Secretary of State assure me that Transport North East will receive that grant? If so, when?
The hon. Lady raises an important point. She will have heard earlier much discussion of the investments that we continue to make in buses. I am happy to ask the Minister who oversees the portfolio to discuss that with the hon. Lady in more detail.
I look forward to continuing to extend the work that my predecessor set running to build that relationship, improve the workplace environment for our seafarers and to ensure that the terrible decisions that were taken by P&O cannot happen again.
This issue is important to me personally; we will be continuing to work through it at pace and, as soon as parliamentary time allows, make sure that we bring forward the legislation we need.
It is welcome that the North Hykeham relief road, championed by myself since 2004 as a requirement for my Lincoln constituents as part of the eastern bypass, was highlighted by the Government as a project for accelerated delivery in the Chancellor’s mini-Budget. However, the welcome £110 million DFT funding is still £80 million short of the estimated total cost of the scheme. Is consideration being given by current DFT Ministers or officials to upgrading the £110 million by inflation?

Written StatementsThis statement confirms that it has been necessary to extend the deadline for a decision on the A47-A11 Thickthorn junction development consent order made under the Planning Act due to the national mourning period.
The DCO would authorise works for the improvement to Thickthorn junction and related works linking the A47 to the A11. The proposed development is situated within the administrative boundaries of Norfolk County Council and South Norfolk District Council. The Secretary of State received the examining authority’s report on 20 June 2022 and the current deadline for a decision is 20 September 2022. The deadline is now extended to 14 October 2022.
Under section 107(1) of the Planning Act 2008, the Secretary of State must make her decision within three months of receipt of the examining authority’s report unless exercising the power under section 107(3) to extend the deadline and make a statement to the House of Parliament announcing the new deadline.
The decision to set new deadlines is without prejudice to the decisions on whether to give development consent for the above applications.

Commons ChamberIt is an honour to follow my near neighbour, the hon. Member for Newcastle upon Tyne Central (Chi Onwurah), who always speaks wisely on all things engineering and technical. I long to be as knowledgeable as she is.
I wish to thank the Secretary of State for taking this difficult decision to bring the east coast main line back into public control while we find a long-term, sustainable solution for the train line that takes me and my constituents up and down the length of our great nation, week in, week out. As he knows well, I am the MP for the northernmost English constituency, which lies some 350 miles north of us here, and so I am well aware of the crucial importance of good transport infrastructure to ensure business investment can flow into my constituency. That will help to grow strong, long-term successful businesses, which create great jobs for my constituents. This is one of the most vital investments the Government can make.
I have talked endlessly, and partially successfully, about why dualling the A1 from Morpeth to the Scottish border—[Laughter.] I heard that! I have talked about why that is so vital for economic growth and inward investment. Indeed, the Department for Transport based its financing decisions on that economic development model, which was so important to justifying why a rural county needed to address 40 years of lack of road investment. The Secretary of State has listened patiently to me over many years and has supported driving forward that investment. Obviously, we wait with bated breath for the sight of diggers, as they get closer in the months ahead. The Department can be assured that my constituents and I will not rest until the whole road is invested in, because that is a crucial way of linking up north Northumberland to Edinburgh, Newcastle and the rest of the UK.
It is not only road investment that is vital; the east coast main line, linking Edinburgh to London, is an efficient and speedy service, and it has two key stopping points at Berwick-upon-Tweed and at Alnmouth, which is Alnwick’s railway station. With recent and continuing improvements in parking provision at both those stations, we have seen substantial increases in usage by my constituents, who travel north and south for business, study and pleasure. It is a crucial rail transport link for my constituents, of all ages, so it is of the utmost importance to me that this train line is run sustainably and that the long-term security of the east coast line’s investment in rolling stock and the management of fares to ensure a competitive and effective train line is assured.
With the Ministers here, it would be remiss of me if I did not highlight the continuing campaign by my constituents to reopen the Belford station, which sits between Berwick-upon-Tweed and Alnwick, to create more opportunities for investment in that 1,000 square miles of rural constituency. Good rail links bring investment and economic growth, and we must continue to be able to invest in the line.
I remember our nationalised railway systems of old; one of my granny’s Sunday afternoons involved seeing whether we could get a train that went somewhere and could get us home in time for tea—it did not always work. The Labour’s party’s vision for train provision, which does not put the customer at the centre—
I am sure the hon. Lady remembers British Rail, because we are still travelling on some of the 125 rolling stock first introduced by British Rail.
It is not so much the rolling stock that I remember as not necessarily getting back for tea because the train just did not go—that used to cause my grandmother and I some disconcertion. The railway timetables were more an idea than a reality a lot of the time. That is a childhood memory, and the Labour party’s vision for train provision, which does not put the customer at the heart of all policy, will not work. The customer pays the fares and must be at the centre of those decisions. So I believe the Secretary of State has taken the right, difficult decision to use his operator of last resort powers to get the London North Eastern Railway—that lovely brand, which I believe is on a poster in one of our bookshops in Alnwick—up and running to ensure that my constituents and I can rely on it and we invest for Northumberland, knowing that our train service will be sound.

Commons ChamberThere is no other franchise today in the same position. We are seeing some changed patterns of ridership on the railways. For example, people are choosing to travel to work three or four days a week and work from home one day a week, and we are doing careful work on what that means for the future. As I said, my hon. Friend the rail Minister is working on that very issue and any implications for the future of franchising. The reality, as I keep saying, is that this railway has continued to deliver a higher contribution to the taxpayer and a higher level of customer satisfaction than it did prior to 2014.
For the residents of Berwick-upon-Tweed, the east coast main line is critical infrastructure, until the Secretary of State manages to dual the rest of the A1 all the way through. Can he confirm that there will be no disruption and that my constituents will be able to continue using what has always been an excellent train line?
I can give that commitment. I hope that it will become an even more excellent train line, though passengers may be tempted away, as tomorrow I will do the formal opening of the last link of motorway-grade road between London and Newcastle—something that should have happened a long time ago but did not happen in the 13 years when the Labour party was in power. It is this Government who are bringing better transport services to the north-east.

I thank the hon. Member for Houghton and Sunderland South (Bridget Phillipson) for giving me the opportunity to talk about a different aspect of transport investment in the north-east—that of mostly rural Northumberland.
I thank the Minister for the work that his exceptional team from Highways England is doing. It is rolling out £300 million-worth of investment in the first stages of dualling the remaining part of the A1, which has been untouched by Governments of every colour for many decades. It is very exciting work. I was with the team on Saturday to see the plans for the detailed work that is going on in that rural territory—the farms there have not had a change to their transportation network for so long. I commend the Minister and the team, which is putting a huge amount of work into local communication so it understands how best to create a modern, 21st-century dualled road through Northumberland. It will ensure that livestock can cross that bigger, busier road and that it does not cut through the middle of farms inappropriately. It is exciting to see that activity going on. Doom-mongers in my constituency still say to me, “It’ll never happen in my lifetime,” so it is exciting to be able to direct them to the maps and show them the farms that will see that investment.
We are doing only about a third of what remains of the last stretch of the A1, which, as its name suggests, should be the first road all the way through to Scotland. As the economic case becomes clearer, we will continue to press for dualling to ensure that people are able to drive from London to Edinburgh, through the constituency of the hon. Member for Berwickshire, Roxburgh and Selkirk (Calum Kerr), on a modern, dualled and, in large part, four-lane motorway—although not in Northumberland.
The hon. Member for Houghton and Sunderland South talked about having an integrated transport system. It is important to understand that we all have to have cars in rural Northumberland because the bus networks are almost invisible, except for those between one or two of the more major towns. That is a real challenge for families, which often need two cars if two members of the family work in different parts of the county or if one commutes to Newcastle or up to Edinburgh.
We want investment in the train network to continue to grow. The train networks in the north-east are pretty much as good as they get. I think all of us who use them weekly are reassured that we get to and from Newcastle and Berwick, and down to London, in a timely fashion, but it is difficult for my constituents. We are trying to develop a better conversation with the Department for Transport about how we can extend the platform at Belford railway station—it is in the middle of my constituency, which is nearly 70 miles long—so trains can stop there. That would open up opportunities for house building in that part of my constituency and help communities to grow. It would also ensure that more people get on to trains and are not stuck in the commuting networks, clogging up the city centres, which Opposition Members are here to stand up for and defend.
Those are the points that I want to put into the mix. I thank the hon. Lady for giving me the opportunity to talk about the Northumbrian model, which is different from the city models. After so many decades, the Department for Transport must continue to remember that rural Northumberland is a key development opportunity. We have an enterprise zone in Berwick and a growing aeronautical sector in Amble, and we want to ensure that the transport links work so we can continue to grow and invest for the future.

Commons ChamberThere is no complacency whatever from the Government on the use of drones. As I have said, there is a prison sentence available, and obviously I will keep the situation under review. It is also important to find out the facts behind certain incidents. It is now thought that the incident reported on 17 April was not a drone incident.
Could the Secretary of State update the House on the state of investment in our roads in the north-east, particularly the A1?
No. That is a most interesting matter, but a little distant from the matter of drones. Save it for the long summer evenings that lie ahead.

Commons ChamberMy hon. Friend is absolutely right. The Bill was introduced by a former hon. Member for Cheltenham in an earlier Parliament, but it was not debated. We have taken it on and amended it. This will not be a blanket ban for pavement parking. In medieval or older town and city centres with Victorian terraces and the like, popular ownership of the motorcar was never envisaged. To make the carriageways wide enough for emergency vehicles, bin lorries and other large vehicles, it is important to ensure a balance is struck between allowing the free movement of vehicles and securing the free movement of pedestrians.
The major difference in the Bill is that clause 3 sets aside specific provision for the Secretary of State for Transport to provide regulations and guidance to local authorities about who to consult—who are statutory consultees—and how to consult before it is introduced. It is not a blanket ban and nor is it an automatic obligation for local authorities to make use of the purposes set out. It will be up to the local authority, working in concert with local councillors, communities, freight transport associations, road haulage associations and the emergency services, to decide precisely where it is either appropriate or inappropriate to permit or to prohibit the parking of motorcars on pavements. This is not the dead hand of the state. This is not a licence for pettifogging officialdom, and nor is it a cash cow for local authorities to try to get in a bit of extra revenue. It will be proportionate and it will be sensible.
One thing I did not know—I am pretty certain that hon. Members know this, but it was a gap in my knowledge—is that organisations such as the RNIB and Guide Dogs will offer a service to people in all our communities to devise a safe and secure route to the shops, to work, to church, to school or to wherever. If, post consultation, and on the presumption that a local authority has decided to avail itself of the powers in the Bill, the trigger is that it would mark out in some way—through signage, line painting or whatever—where pavement parking is permitted, de facto, and anything not marked would not be allowed. It would allow the good folk at the RNIB, Guide Dogs and other charities to devise routes to give people certainty that when walking from A to B they will not meet a parked car. I hope that addresses my hon. Friend’s important point.
Is it not important to empower our councils to make decisions in accordance with their own landscapes? I, for example, have a medieval walled city in Berwick and a cobbled town in Alnwick. Interesting work has been done in many French towns. In some, parking is permitted on one side of the street for two weeks in the month, and then for two weeks on the other side, which means that emergency vehicles can always get through. The communities have adapted, there is a rigour to it and people do not break the rules because they understand that they support the flow of everyone who needs to use the pavements and roads.
I am incredibly grateful to my hon. Friend, who has given me an awful lot of support on the Bill and is a huge supporter of Guide Dogs. She makes her point well. Through local consultation and accommodation, these things can be resolved so that nobody is disadvantaged and social inclusion and mobility can be put at the heart of everything we do.
It might be helpful if I mention some of the organisations supporting the Bill: Guide Dogs; the Local Government Association, which is fed up with all the conflicting guidance from different Departments and geographically narrow traffic regulation orders, which cost between £3,000 and £3,500 but which are not really doing the job; the British Parking Association—it might just be a drive to get more customers into its car parks; the Campaign for Better Transport; Age UK; Living Streets; the National Association of Local Councils; Whizz-Kidz; the RNIB; Sense; Civic Voice; Cabe Design Council; Keep Britain Tidy; Transport for All; the Macular Society; the National Pensioners Convention; the National Federation of Occupational Pensioners; Deafblind UK; and SeeAbility. That level of support, from organisations that have thought about the Bill and decided to support it, indicates the wide range of potential beneficiaries.
