To ask Her Majesty’s Government what is their assessment of the effectiveness to date of the RAF’s Brimstone missiles in bombing Syria, and in particular in protecting the civilian population.

My Lords, the Brimstone missile offers the coalition a capability to strike moving targets accurately, with minimal risk of collateral damage. Between 2 December 2015 and 31 January 2016, RAF Brimstone missiles were used successfully on nine occasions in Syria to strike enemy vehicles. There have been no associated reports of civilian casualties and it is assessed that all targets were successfully destroyed or damaged.

Yes, I think that the kill so far has been two trucks and five mobile cranes. Does it really matter what type of bomb or which of the coalition partners drop it? It has been reported that some 40 civilians or more were killed in January and in the first two days of this week. Surely we are involved in a joint enterprise and, by long-standing principles of English law, we are all of us legally and morally responsible for the lives of those who are killed—innocent civilians, innocent men, women and children—by these bombs. What comment would the Minister have?

So far as we are concerned, as a member of the coalition, we take the possibility and risk of civilian casualties extremely seriously. As I said in my initial Answer, to date there is no evidence that UK strikes have resulted in civilian casualties. Three factors underpin that: our use of precision guided weapons; our adherence to very strict targeting and planning protocols; and, above all, the skill of our pilots and air crew. I think that it does make a difference whether it is the RAF or another air force taking part.

The real problem here is heavy bombers flying from Russia unloading unguided bombs in large numbers and killing almost indiscriminately. Does not that also have a dramatic effect in driving up the refugee numbers, which continue to destabilise Europe? Maybe—just maybe—we are not taking this seriously enough.

The noble Lord is absolutely right. There is no question that Russia is actively targeting civilians and is almost certainly in breach of international humanitarian law in the process. That has to stop. Russia cannot continue to sit at the table as a sponsor of the political process and, at the same time, bomb the civilian areas of the very groups of people whom we believe will form the backbone of the new Syria, once Assad has left.

My Lords, is the Minister able to give the House figures for the number of civilian casualties in Syria caused by the action of ISIL on the ground?

I do not have precise figures, but as the House will know the vast majority of civilian casualties in Syria have been caused by the regime itself and also as a result of Russian actions.

As my noble friend will know, the Royal Air Force turns dumb bombs into smart bombs by the use of technology. Is it not possible for the Russians to do the same?

It should be, my Lords. We lose no opportunity to urge the Russians to desist from indiscriminate bombing and to deploy precise weapons, as we are doing, and thereby conform to international humanitarian law.

My Lords, I apologise to the noble Lord, Lord Hamilton, for not giving way. The Minister will be aware that a number of Syrian refugees got into the sovereign base area on Cyprus where our air attacks go from without being detected. Can he assure the House that security there has been tightened up? Clearly there is huge vulnerability to terrorists trying to get at our aircraft and our aircrew before they can be in the air being looked after properly.

My Lords, do the Government agree that the European refugee tragedy is caused largely by the evil Islamic State which we, the United States and other allies could destroy on the ground in a few months? Is the reason we do not do so because we have lost our nerve after our disastrous invasions of Iraq and elsewhere? Has the time not come to think again because we clearly cannot solve the problem with airpower alone?

The noble Lord is right that airpower alone will not defeat Daesh. Indeed, military action alone will not defeat Daesh. We have to counter its ideology as well and cut off its sources of finance. We have set our face against putting British troops on the ground in Iraq or Syria. Prime Minister Abadi of Iraq has made it very clear that he wishes the action on the ground to be pursued by Iraqi armed forces, not western troops, and we respect that.

My Lords, the Minister spoke earlier of careful planning. Can he tell the House how many time strikes have been called off as a result of that planning to prevent civilian losses or casualties?

My Lords, the noble Baroness makes an extremely important point. There have been many occasions—I cannot give her a precise number—when a strike mission has been called off because it has been deemed too risky to the civilian population. We always err on the side of caution in that respect.

My Lords, the House is indebted to the noble Lord, Lord Thomas of Gresford, for tabling this Question because the impact of our actions in Syria on the civilian population must never be far from our minds. On this side, we have consistently argued for airstrikes against ISIL’s oil-exporting capability, thus depleting its sources of funding. Can the Minister update us on this? More than that, I remind him that the Defence Secretary promised a quarterly report on our activities in Syria and one must be due any day now. Will he come to the House and make a Statement when that report is published?

To ask Her Majesty’s Government what assessment they have made of the support available to serving military personnel with mental health problems, and what plans they have to establish a 24-hour mental health helpline for serving soldiers.

My Lords, the Ministry of Defence is absolutely committed to looking after the mental health of our Armed Forces and provides a range of community-based healthcare in line with national best practice. Out-of-hours care already includes the free 24-hour mental health helpline run by the charity Combat Stress, which receives funding from the MoD, and the Big White Wall, which is a 24-hour online community. There are therefore no plans to provide an additional helpline.

I thank the Minister for his Answer. Will he say whether the Government consider it satisfactory that serving Armed Forces personnel are currently having, and under current plans will continue to have, to rely on support from the charitable sector for urgent mental health issues which occur outside of Monday to Friday normal office hours? With the very best will in the world, those charities will not have access to the in-house mental health records, know about their situations or the medication that they are taking.

My Lords, there is no point in duplicating a service that already works very well. We work in close partnership with Combat Stress, which provides an extremely effective service, and, if necessary, signposts the individual to the right service according to need. There are helplines available for veterans as well, which we run on a 24-hour basis, but we do not see the need and there is no evidence that we should be looking at duplicating that service.

My Lords, do the Government accept that, as a result of operations over the last decade and more, there are many more potential and actual mental health problems among serving personnel? The Minister suggests that this can be helped by charities, but what information is given to serving personnel that these charities are available? It seems to me that there is not enough information available to serving personnel on this issue.

The noble and gallant Lord raises a very important issue. I do not believe that there is any shortage of information available. Personnel are given briefings and advice on whom to contact if they think they need help. These are reinforced by publicity material such as posters and leaflets in all unit primary care centres. Information is also available online on the MoD’s area of the GOV.UK website. Similar guidance can be found on the NHS Choices pages. I believe that there has been a significant improvement in the provision of this kind of information in recent years.

My Lords, when many of our young men, who are little more than teenagers, are being hounded by public interest lawyers, the Iraq Historic Allegations Team and the Iraq fatalities investigation unit, is it fully appreciated that they may have been under intense pressure in combat—even in a state of panic and mental stress—when they have been involved in individual incidents? Is this not what happens when we send young men and women to war?

My Lords, as someone who has returned to being a Defence Minister after a break of 20 years, there is no doubt in my mind that the Armed Forces have come a very long way in that time. They take the mental health of their personnel extremely seriously. As one would expect, the model adopted is one of best practice, prevention, early detection and the ready availability of evidence-based treatments. This applies not just during a deployment but pre-deployment and post-deployment as well.

My Lords, I am sure that the whole House would welcome the improved understanding of mental health issues in the Armed Forces, and, indeed, the improved provision for those who, sadly, develop mental health issues. But would my noble friend agree that most of the Armed Forces are not affected by mental health issues when they are serving and that there is a danger, by concentrating on this, that serving personnel are undermined because they feel that they are being pitied, rather than respected for the excellent work that they do?

I hope that service personnel do not feel that way, and rather that they feel well supported, but my noble friend is right. It is notable that incidence of post-traumatic stress disorder, for example, is extremely low in the UK Armed Forces in numerical terms. One can attribute that, in very large measure, to the services and support that are now available to Armed Forces personnel, both in this country and on deployment.

My Lords, my noble friend Lord Campbell-Savours is absolutely right: it is outrageous that we are chasing, many years later and in an open-ended way, the men and women who have tried to protect us. Can we not carry out an urgent investigation into firms of solicitors that I know use agents in Iraq—and no doubt will in the future in Afghanistan—effectively to ambulance chase to get cases? We are constantly seeing these cases, which cost immense amounts of money and cause mental anguish to our men and women, so they affect the issue we are talking about. We really need to get a grip on this.

As the noble Lord rightly points out, there has been extensive coverage and publicity on this very issue in the press in recent weeks, and I share his concern. The fact of the matter is, though, that it is not the Government chasing our armed services personnel. Every time a complaint is raised, we have a duty to investigate the complaint. It is not a matter of hounding Armed Forces personnel but rather of trying to get to the bottom of the complaint as quickly as possible. Indeed, many of these complaints have been found to be without foundation, but I share his concern about the behaviour of certain law firms.

I am sure that the Minister and many other Members of the House will be aware of the excellent work done by the organisation Combat Stress. In a well-researched report published recently, it revealed that there had been a fourfold increase in the number of veterans who had asked for help for mental health conditions over the last 20 years. Its research suggests that this will continue. The good news is that Combat Stress has treatments that work, but it needs additional funding to deliver them. Has the Minister’s department had discussions with Combat Stress about this need for additional funding and, if it has, what is the outcome?

My Lords, yes, we do have regular discussions with Combat Stress, with which we work very closely in partnership, as I have already indicated. It is interesting that, while the number of military personnel assessed with a mental disorder has risen steadily in the past couple of years, the level of mental illness remains broadly comparable with that of the general population. Although it may sound strange to say it, I think the rise could indicate good news rather than bad news, in that the more we address stigma in mental illness, the more we encourage people who need help to come forward. I hope that is attributable to the better services that are available.

Will my noble friend tell me when last we had a thoroughgoing investigation into what other forces do in this area? Is this not surely something about which we could learn a great deal from, and teach a great deal to, others who are concerned with what must be a universal problem among the major forces of NATO? A comparative piece of work might very well be valuable.

My noble friend hits on an extremely important point, which is why, in 2003, the Ministry of Defence commissioned the King’s Centre for Military Health Research, which is part of King’s College London, to conduct a long-term research study following a cohort of more than 20,000 members of the Armed Forces. That study continues with the same cohort. In so doing, comparative information is emerging about the performance of other armed services around the world. We can take credit for the fact that the incidence of mental illness in our own armed services compares very favourably indeed with that of some other armed services around the world.

My Lords, men and women seeking this sort of support require anonymity and are anxious about that, as, indeed, they are about quality. Therefore, will the Minister explain to the House whether anonymity is protected, how this service is regulated and when it was last quality tested?

The noble Baroness is quite right that anonymity is important to many people and, of course, record-keeping is scrupulously observed in that sense. At the same time, some people feel that it is important to identify mental illness when it occurs. That is why peer support among a unit, for example, features very large, particularly when armed services personnel are on deployment. Anonymity in that sort of instance is difficult to achieve by the very nature of the support that we wish to see personnel give to their peers.

To ask Her Majesty’s Government, further to the Written Statement by Earl Howe on 9 December (HLWS366) on the 2016 Uprating of the War Pensions Scheme, when war pensioners can next expect an increase in their pensions.

My Lords, the reason war pensions are uprated is to ensure that they reflect any increases in the cost of living. They are uprated annually in line with the consumer prices index—CPI—figure, which is the same measure the Department for Work and Pensions uses for uprating social security disability benefits and is in keeping with other public service schemes. Our approach ensures consistency with the measure of inflation used by the Bank of England. War pensions will increase when the annual CPI figure next increases.

The Government deserve credit for enshrining the Armed Forces covenant in law, and I am sure that the entire House endorses the words of the Defence Secretary, who said in the latest covenant report that,

“we have a duty to ensure that our servicemen and women are treated fairly”.

Yet within days of his making that statement, his department published a Written Statement entitled War Pensions Scheme—Uprating 2016, although there is no uprating, and in fact war pensions have been frozen for two years. Does the Minister agree that war pensioners should be treated the same as, say, someone like me, who is in receipt of a state pension, which, as a result of the triple lock, is guaranteed to increase every year? As the Defence Secretary said, we have a duty to ensure that our service men and women are treated fairly, and surely none more so than those who have been injured while serving our country.

My Lords, it is important to make it clear that despite its name, a war disablement pension is not a state pension but a form of compensation for disablement and/or injuries caused by service to the country. It is tax free and payable in addition to the state retirement pension. Payments are set at a higher rate than similar disability benefits and most war pensioners who have reached retirement age will be in receipt of both pensions.

My Lords, the war pensions scheme includes allowances related to employment, so the annual uprating should be related to earnings inflation and not price inflation. Will the Minister tell the House what it would cost the Treasury to link the war pensions scheme to earnings and not to inflation?

My Lords, I know that the Royal British Legion has come up with its own calculation. To answer the noble Baroness’s question, I am not aware that the Treasury has done so. However, the principles should be clear here. Under the Armed Forces compensation scheme and the war pensions scheme which preceded it, an injured service man or woman is assessed on their level of disability, and based on that assessment they are compensated for their deemed loss of earnings in civilian employment. After that, the guiding principle is that the real-terms purchasing power of the annual payment should be maintained, and it is therefore indexed to the consumer prices index, which, as I said, is the index applied by the DWP to all disability benefits.

My Lords, the Royal British Legion is very clear in saying that war pensions are losing value compared with military and civilian salaries. It is inexplicable that our injured and disabled comrades cannot have the same as others in society—the triple lock. Is it not a sad commentary that the Royal British Legion and others are correct in saying that, in this case, we are not all in this together?

My Lords, the triple lock applies only to the basic state pension. Members of the Armed Forces will therefore benefit from the triple lock once they reach state pension age, but there are broader issues to be considered here. One is that maintaining parity with social security disability benefits is in principle the right thing to do, but secondly, there is the affordability issue. As a Government and, I believe, as a nation, we have to stick with the long-term economic plan and we have to continue to live within our means.

Is the Minister not surprised that no Conservatives are rising to their feet to defend our servicemen? They are quite prepared to go along and lay a wreath and to go on marches, but when it comes down to it, the Minister gave it away: he said the word “affordability”. These are people for whom we must afford to uprate their disabled benefits, along with pensions; otherwise, we are really not honouring the memory of those who died for our country and served it so well.

As I have explained, we do uprate the war pensions scheme, in line with the CPI, which is exactly the measure used by the DWP for all disability benefits, so those people are not disadvantaged.

I had a past interest as the first chairman—I suppose that was my title—of the War Widows’ Association. Indeed, my noble friend Lady Fookes is now in the same position and has been very successful in that regard, as have other Members of this House. Can the Minister tell me whether the wonderful change, brought in by a Conservative Government, whereby war widows can marry again without losing their pension, is affected in any way, or will they still be able to live whatever life they choose as the widow of a war pensioner?

My Lords, a change was introduced. As from 1 April last year, those who are widowed and have a war widow’s pension can keep that pension whether or not they subsequently marry. However, regarding cases that fall before that cut-off point, it has been the policy of successive Governments that changes or improvements to all public service pension schemes should not be applied retrospectively, so there are no plans to reinstate war widows’ pensions for war widows who remarried between 1973 and 2005. However, from 1 April last year, those who have already surrendered their pension due to remarriage or cohabitation can apply to have their pension restored for life, should that relationship end.

My Lords, 210 years ago on Saturday, Lord Nelson was put in the crypt at St Paul’s. He always said that when he died, he would have “lack of frigates” engraved on his heart. We had some 220 frigates at that stage; we now have 13. Does the Minister feel that Lord Nelson might be a little disappointed by that, and when will he order new frigates to replace the ageing ones?

To ask Her Majesty’s Government what military action the United Kingdom is undertaking against ISIS in Syria and Iraq.

My Lords, UK forces are striking Daesh targets in Iraq and Syria, including command and control facilities, lines of communication, military equipment and defensive positions. We are also providing intelligence, reconnaissance and surveillance to support coalition operations in both Syria and Iraq. UK military personnel are providing specialist training for Iraqi security forces, including Kurdish Peshmerga.

My Lords, given that the war has already lasted five years, does my noble friend recognise that while bombing is important, it will never defeat ISIS unless there is a strong army on the ground? Will he therefore re-read the speeches made last Wednesday by the noble Lords, Lord Wright of Richmond, Lord Ashdown, Lord Owen and Lord Dannatt—and possibly my own—and recognise that the only hope of defeating ISIS is urgently to find a way to deploy the army of Assad and his allies? Otherwise, ISIS will survive and cause mayhem in the rest of the world.

My Lords, it may encourage my noble friend to know that I have re-read the debate held last week and I fully agree that Daesh has to be defeated on the ground. The most likely way to defeat Daesh on the ground is to bring about an end to the Syrian civil war, which would allow those keen to support a unified, inclusive and peaceful Syria to unite against Daesh. That could include Syrian moderate opposition forces, Syrian Kurds, or an army of internationally supported Syrian government forces. But we believe that such unity will come about only once Bashar al-Assad leaves the scene.

My Lords, when the Minister re-read the debate held last Wednesday, he may have noted that I suggested that if our Tornados and Typhoons are sent into action without adequate co-ordination and consultation, there might be a serious risk of collision with the Russian and Syrian forces. Can he tell the House what clearance has to be sought from what I understand is the joint flight clearance centre in Damascus, and how much co-ordination is there with the Syrian authorities before military action is taken?

My Lords, all UK and coalition missions are co-ordinated by the US-led Combined Air and Space Operations Centre in Qatar. The coalition has implemented safe separation measures for aircraft operating in Syria which reflect the provisions of the United States/Russia memorandum of understanding to prevent flight safety incidents over Syria. Those measures are kept under constant review, including in the light of the Russian jet incident with Turkey. Our own aircraft operate over Syria as part of the coalition campaign and are covered by those measures.

My Lords, the Minister will be aware that in 2008, the only way we stopped the uprising in Iraq and destroyed al-Qaeda there was when General Petraeus got the Sunni tribes fully on side to turn against it. We did that by bribing them and talking to them. Are we doing that now to ensure that they turn against IS, because up until now they have felt that IS is better for them than the Government in Baghdad?

My Lords, there is no doubt that the Kurds will need to be part of a long-term solution. I believe that they must play an important role in a political settlement for Syria. As part of that, they must recognise the importance of Syria’s territorial integrity and the parameters set out in the Geneva communiqué. However, I recognise the force of what the noble Lord has said about the lessons learnt in Iraq, and I am sure those lessons will not be lost as we go forward.

My Lords, although this Question is about Syria and Iraq, has my noble friend noticed that Daesh is forming very strong centres in Sirte and Derna in Libya, and elsewhere in the Maghreb? What attention are we going to pay to those areas, which may well turn out to be even more important than Raqqa as centres of operation for Daesh?

My Lords, as my noble friend will be aware, we are veering slightly off Iraq and Syria, but I can tell him that the presence of Daesh in Libya is causing us considerable concern and is the focus of attention across the coalition. Beyond that, I cannot say more at this stage.

My Lords, it would help if we could restrict the flow of ammunition to Daesh. We know that it is using ammunition produced by our allies and coalition partners. What steps are the Government taking to ensure that the supply chain is being broken?

A number of measures are being taken to ensure that smuggling of equipment and ammunition is blocked. The Syrian moderate opposition forces have been quite successful in blocking those routes, particularly between Turkey and Syria. More widely, there is an international effort to close down the sources of finance that Daesh has as its disposal. A lot of that work, I am proud to say, is being led by the United Kingdom.

My Lords, it is right to label ISIL as evil and murderous, because it is those things. But are we asking why it is? What research and studies are we undertaking to get into the mind of ISIL, so that we better understand its motives, and the many structures and layers of operation that enable it to recruit in countries as varied and diverse as Afghanistan and Britain, and to produce a blueprint to create a state? If we are to help rid the world of this ideology, we need first of all to know our enemy as well as he knows himself.

The noble Lord is absolutely right. The UK is leading international efforts to counter Daesh’s poisonous ideology. Our work with the internet industry, for example, has helped to stop the proliferation of Daesh propaganda. We announced at the UN General Assembly in September that the UK would host a new coalition communications cell. That cell helps countries that have previously lacked the means or knowledge necessary to deliver effective communication interventions against Daesh to do so. It is already helping to drive the coalition strategic communications to counter Daesh’s extremism and ensure, essentially, that no media space is left uncontested.

My Lords, does the Minister agree that we cannot destroy a negative ideology based on a harsh interpretation of medieval Islam by bombs and bullets alone? Is the Minister aware that the Muslim community and Muslim leaders have condemned Daesh, and will the Government work with them to ensure that their message of condemnation is carried to every mosque in the country—preferably in English, which is the language young Muslims best understand?

My Lords, this is a central theme of the Government’s counterextremism strategy, about which I spoke in last week’s debate. I fully agree with the noble Lord that to disrupt and defeat Daesh and its ideology requires more than just military action. It requires the disruption of its ideology in the ways that I described, and discrediting it across the world in the way the noble Lord indicated.

My Lords, my department has laid a single instrument for the Committee’s consideration today. These regulations are required as part of a package of measures to implement a new service complaints process and a Service Complaints Ombudsman for the Armed Forces.

The new legislation is designed to provide a streamlined and more effective internal redress system for our Armed Forces, and new, strengthened external oversight through an ombudsman. It will come into being on 1 January 2016. The new system is provided for in new Section 365B and Part 14A of the Armed Forces Act 2006, as inserted by Sections 1 to 3 of, and the schedule to, the Armed Forces (Service Complaints and Financial Assistance) Act 2015.

This instrument is intended to promote fairness in the new system by preventing conflicts of interest and ensuring that complaints are dealt with by those who have the right experience and knowledge to properly assist the complainant. It also covers procedural matters that provide essential safeguards and aspects of independence for our Armed Forces personnel.

The regulations include four important things, which I shall deal with in turn. First, as for the existing system, we have made rules on who cannot be appointed to deal with a service complaint; for example, because they are implicated in the matters complained about. The second important aspect of the regulations is that we have set out those matters that cannot be raised as a service complaint. This is not a new aspect to the complaints process. These are provided for in the regulations that cover the current system, and have been updated in this instrument to take account of the new process and of experience.

We are excluding for the first time challenges to decisions made in the internal redress system because under the new legislation the ombudsman will be able to review or investigate them. Similarly, the regulations exclude complaints about decisions made by the ombudsman. It is the ombudsman who provides external oversight of the complaints system so it would be contradictory for the complaints system to be able to overturn decisions of the ombudsman. Challenges to the decisions of an external ombudsman are best made in the courts.

A newly excluded matter, which I should mention in particular, is that we have decided to exclude complaints alleging clinical negligence or personal injury against the Ministry of Defence, so these have been added to the list of excluded matters. The redress system is not appropriate for deciding the complex, specialised medical and legal issues that can arise in clinical negligence and personal injury cases. It will remain possible, however, to make a service complaint if a person believes that we have not provided medical care when it was our responsibility to do so. As under the existing system, the regulations also exclude matters for which there are more appropriate alternative remedies. For example, challenges to decisions made at court martial are best decided through the appeals system.

The third important effect of these regulations is to set out when at least one independent person must be appointed for deciding a service complaint. The main circumstance is where a complainant alleges bullying or similar misconduct. This is the same as under the current system and it is there to provide an extra safeguard for fairness in such sensitive cases, and to give a measure of external oversight as part of the internal system.

The fourth main effect of the regulations is the setting out of the matters that must be reported to the Service Complaints Ombudsman when an allegation of a wrong suffered by a service person has been referred by the ombudsman to the chain of command. As with the Service Complaints Commissioner now, the ombudsman will be able to receive allegations of wrongs done to service personnel. For example, a family member of a service person will be able to approach the ombudsman with their concerns. The ombudsman will be able to refer those cases to the chain of command and to track what happens. The regulations will ensure that the ombudsman is kept updated on progress and is able to respond to queries, if raised, without compromising her investigative role.

The Joint Committee on Statutory Instruments has scrutinised this draft instrument and, in doing so, has brought to our attention three drafting points, which we will seek to correct at the earliest available opportunity. However, we do not expect that these points will affect the practical working of the regulations.

On the first point that has been raised with us, we accept that the definition of the expression “in writing” has been included unnecessarily in Regulation 2(1).

On the second point that the committee has brought to our attention, we will seek to provide further clarity at Regulation 6. This regulation provides for the start of the three-week period within which the ombudsman is to be notified of certain events in connection with the progress of a matter that has been referred by the ombudsman as a potential service complaint. It also provides that the ombudsman is to be notified of each event that is listed in the regulation. We will seek to clarify the exact moment of the day from which the three-week period applies and to clarify that the period applies separately to each event that appears in the list.

The third of the JCSI’s points relates to a provision in the schedule to these regulations that excludes a right to make a complaint where there is a right of review as to certain service police or prosecution matters. The committee has said that the regulations refer incorrectly to those rights of review being “under” the code in which they appear, rather than being mentioned “in” that code. Again, we will look to make the correction at the earliest available opportunity.

My Lords, I thank the Minister for introducing this instrument, which effectively—with, I believe, four other negative instruments—gives effect to the Service Complaints Ombudsman, established by the 2015 Act, which some of us were privileged to flog through a few months ago.

The concern goes back to the tragic deaths at Deepcut between 1995 and 2002 and the subsequent inquiry. The outcome of that inquiry was the creation of the Service Complaints Commissioner. That role was taken up by a splendid lady, Dr Susan Atkins, who, having taken up the role, declared it not effective, efficient or fair. I commend the Government for reacting to her criticism. My party has long been calling for the introduction of an Armed Forces ombudsman, so we welcome the Act and the instruments designed to put it into effect. Labour is determined that all members of the Armed Forces who serve this country with such professionalism and distinction should be saved from bullying, harassment and other inappropriate or illegal behaviour. Ensuring that this is achieved forms a core component of the Armed Forces covenant. Hence, we support not only this affirmative SI but the negative SIs that go with it.

Assuming that I receive appropriate assurances on all those points, I enthusiastically welcome the instrument. After the Deepcut tragedy and the issues of bullying, which even now one gets a little hint of but way back was all too prevalent, the Government have moved in the right direction—the direction we pressed for in our amendments in the other place—to a good position. I know that there is a very delicate balance in introducing an ombudsman in the military but I think we are quite close to the right place. It is important that the ombudsman is effective and properly resourced and that the intent is communicated to all service personnel.

My Lords, I am very grateful to the noble Lord, Lord Tunnicliffe, for setting out his concerns so clearly. I am the first to agree that he has raised a very important issue in relation to Regulation 3(2) and the need for clarity for service personnel. Clearly, there must be a fair system for checking whether a decision that a complaint is inadmissible has been properly taken. I agree that the effect of the regulations may not be self-evident to the casual reader. In my experience, that is not unusual, but it is certainly a real issue.

The regulations exclude a complaint being made about a decision by the relevant officer, usually the commanding officer, that a complaint was inadmissible because, for example, it was excluded under these regulations or it was made too late. However, such complaints are excluded only because the main regulations which set out the procedures for making and handling a service complaint provide instead for the complainant to go straight to the ombudsman, who can review any decision made by the officer to rule a complaint inadmissible.

There is a duty to make regulations to provide for this under new Section 340B(4)(b) of the Armed Forces Act 2006, which the noble Lord rightly mentioned. The provision is in the Armed Forces (Service Complaints) Regulations 2015, but these are part of a suite of regulations subject to the negative procedure so they are not being debated today. The noble Lord was absolutely right to draw attention to those regulations and to say that they should be read with the regulations we are now considering.

It is fully recognised that it would be difficult and unacceptable for service personnel to have to navigate the different sets of regulations in order to find out what they were entitled to do. To make things clear, there will be a joint service publication explaining the entire process, including how to make a service complaint and the right to go to the ombudsman. The aim in that regard has been to make the language as straightforward and accessible as possible. I can tell the noble Lord that the ombudsman will indeed be consulted and will provide advice. Moreover, I can reassure him that the current commissioner, who will in turn become the new ombudsman, has been closely involved in considering all the regulations and the joint service publication to ensure that the details of the system will be clear and will meet expectations. So I hope the noble Lord will be reassured that his point is well made and well received.

The noble Lord asked whether the ombudsman will be sufficiently resourced for implementation in January. The commissioner has assessed the likely volume of cases that will come her way in the first quarter of 2016 and has structured her new team to meet that expected demand. This year she has recruited an additional 15 staff, of whom 11 are investigators. The commissioner is pleased to acknowledge that the MoD has met her requests this year for additional resource to carry out the new role. The ombudsman is responsible for determining her own staffing needs. Having said that, her office will be keeping the staffing numbers under review as they gain experience of carrying out the new role. However, we believe that the ombudsman-to-be is satisfied that all is in place to handle the likely volume of cases that she will be required to consider.

I hope that that answers the noble Lord’s questions satisfactorily and that he will be sufficiently reassured to be able to give these regulations his approval. I am grateful to him for his general welcome of the instrument.

My Lords, we have had a detailed and extremely well-informed debate, benefiting, as ever, from your Lordships’ experience and expertise on defence matters. I congratulate my noble friend Lord Attlee on having introduced it so expertly. I congratulate also most warmly the four maiden speakers, each of whom in their own way has shown how maiden speaking should be done. Time has been tight but we have covered a great deal of ground.

I begin by reminding noble Lords of the context in which our discussions have taken place. We are living in dangerous and difficult times. The threats we face are growing in scale, complexity and diversity. In the past year alone we have seen a newly aggressive Russia using proxies to menace the borders of Ukraine. We have seen the Daesh death cult export the horrors it has perpetrated in the Middle East across the globe, from the beaches of Tunisia to the streets of Paris. We have also seen a great migration spilling across Europe’s borders and into the Mediterranean due to the effects of growing instability in the Middle East and Africa.

Such threats do not just pose a danger to us directly but undermine our entire international rules-based system on which our values of tolerance, the rule of law and freedom depend. Yet in the face of these dangers, we will not retreat to our shores. Instead, we will continue protecting our people, projecting our influence and playing a central role in supporting global security and stability.

Our strategic defence and security review, published last week, strengthens our defence in three ways. First, it gives us the means to match our ambition. This Government have prioritised defence and security over many other areas of public spending. We have made a commitment to meet the NATO 2% target. We have put in place £2 billion of the joint security fund, which will see the defence budget rising in real terms by 3.1% in this Parliament. On top of that, we are meeting our UN target by spending 0.7% of gross national income on development. Additionally, we are increasing our investment in our security and intelligence agencies, and in counterterrorism. That money allows us to take the full spectrum of measures needed to tackle the causes and consequences of the threats that we face: tackling the poisonous ideology of Islamist extremism; refocusing our aid budget to support fragile and broken states; and preventing conflict across the world.

However, our SDSR is about hard as well as soft and smart power. There will continue to be times when we need to employ armed force to counter aggression. That is why, in the past year, we have been acting around the world, whether policing Baltic skies to deter Russia’s expansionism or using our Brimstone and Hellfire missiles to degrade Daesh in Iraq. Following yesterday’s vote in Parliament, we will be doing more in Syria. We are determined to stand shoulder to shoulder with our allies and strike at the heart of the terrorist lair.

This brings me to my second point. Our SDSR gives us the might to deliver, at home and overseas. Our Armed Forces are now increasing, not reducing. We have an equipment budget that has risen by £12 billion to £178 billion over 10 years, and we are using it to establish a potent new expeditionary force. It will be able to deploy 50,000 people, rather than the 30,000 we previously planned. It will give us two new strike brigades and be equipped with: more F35s, and earlier; more Typhoon squadrons; nine new maritime patrol aircraft; new frigates and the two fully-crewed aircraft carriers; and more ISTAR and more cyber, along with £2 billion more on special forces. At the same time, we are guaranteeing our continuous at-sea nuclear deterrent by replacing our four nuclear submarines. Lastly, we will be keeping our capability on the cutting edge by launching a new defence innovation initiative next year.

Thirdly, our SDSR recognises that we must work with allies and partners to deliver our national security goals and tackle global threats. Of course, we have always worked with partners but, in the past, this happened far more by instinct; tomorrow, it will happen by design. At the heart of this new approach is our commitment to NATO, the cornerstone of our defence. As well as meeting our 2% commitment, we will be leading NATO’s new high-readiness Spearhead force in 2017 and at next year’s Warsaw summit, we will be pushing to ensure that the alliance delivers the military capability and investment agreed in Wales.

Besides NATO, the UK will be leading the joint expeditionary force of seven like-minded nations. On Monday, we signed a memorandum of understanding giving our forces the green light to train and operate together. We are also strengthening the institutions on which our rules-based international order depend, notably by doubling our peacekeeping contribution to the United Nations. But bilateral relationships are as significant as multilateral ones so we will be enhancing our special relationship with the United States; working with France as part of the combined joint expeditionary force, which stands up next year; and expanding our DA network, forging new friendships while bolstering our alliances around the world.

My noble friend Lord Attlee asked me a number of questions. First, he asked where we are with eLoran, an issue also raised by the noble and gallant Lord, Lord Boyce. As part of our work to improve the resilience of our precision navigation and timing systems, we are studying a variety of technologies. However, the need for a readily available and highly precise system with worldwide coverage is likely to mean that our requirement for resilient global navigation satellite systems will endure. I will write to my noble friend and the noble and gallant Lord if I can provide further information on that issue.

My noble friend Lord Attlee also asked me about the Vanguard class of SSBN and whether the intention was to run that on longer than originally intended. As set out in the 2010 SDSR, we have assessed that we can safely manage and maintain the Vanguard boats until successor submarines are introduced into service in the early 2030s. He asked me about extending the role of the Type 45 to include ballistic missile defence. As the White Paper sets out, there will be a programme of exploratory work around the BMD role for the Type 45, but it is too soon to speculate any further at this stage. My noble friend also asked about the new general-purpose frigates. As set out in the White Paper, the exact requirements for any general-purpose frigate will reflect other decisions taken as part of the national shipbuilding strategy to be announced next year.

My noble friend also asked about the two armoured infantry brigades and whether that means we will be down to two armoured regiments. The design of the armoured infantry brigades, so that they meet the Army’s revised structure as announced in the SDSR, is being considered as part of new work being undertaken by Army HQ, so is work in progress. He questioned whether the two infantry battalions which are to be reconfigured for defence engagement would have sufficient capability—I think he said they would not have the capability of even a light-role battalion. That is not correct. As current world events demonstrate, the ability to build the CT capacity and fighting power of regional partners will be a vital aspect of the UK’s future national security. The exact size and shape of these battalions will become clear as the concept develops, but these are exactly the kind of stimulating, challenging and relevant roles required to retain our most skilled and ambitious soldiers. As regards the 10,000 military personnel available to assist the civil authorities, my noble friend was correct in saying that this would be via well-established procedures for providing military assistance to civil authorities, with the military working in support of the police.

My noble friend Lord Fairfax, who I am delighted to see back on our Benches, made several very well-put points. I can tell him that the UK will lead a very high readiness joint task force from next year. The planning assumptions in the SDSR increased our ambition for the Army, and our plan is to deploy a war-fighting division as required. There is a strong emphasis in the document, as he will have observed, on innovation, and a substantial innovation initiative will be announced in the coming weeks.

If my noble friend Lord Lyell will forgive me, I will write to him about how the force of 50,000 will be made up, but it is important to emphasise that the Army is able to deploy a division now with sufficient notice, which could consist of an armoured infantry brigade, 3 Commando Brigade and 16 Air Assault Brigade, as well as forces from other nations. Joint Force 2025 is about improving capabilities to enable us to deploy a division from a wider range of Army formations more quickly.

I can tell the noble Lord, Lord Bilimoria, that there are no plans to reduce the numbers of Gurkhas in the British Army. The noble Lord, Lord Hannay, asked me about the provision of UN peacekeepers. The number of service personnel serving at present as UN peacekeepers is 291, of whom 276 are currently in Cyprus. Up to 370 additional personnel could be assigned to peacekeeping duties in South Sudan and Somalia, but I will write to him on the question of the baseline. However, as for equipment, I hope it will be a reassurance when I say that any UK forces deployed on UN duties will be trained and equipped, as normal, to the extremely high standards that we have always had in this country. The noble Earl, Lord Stair, questioned whether the figure of 82,000 includes the reserves. No, it does not. The reserves will be on top of the 82,000, with a total of 35,000. Manning levels have been increased—not by a great deal, but the corner has been turned.

A number of noble Lords devoted their remarks to matters relating to soft power. I will not elaborate hugely on what the SDSR contains on that subject, although I am the first to acknowledge the integral importance of UK development assistance to long-term security and prosperity. Our commitment to spend 50% of overseas aid on the states most important to national security will undoubtedly focus on south Asia, the Middle East and Africa.

The noble Lord, Lord Touhig, asked me about Special Forces numbers. It has been the practice of successive Governments not to comment on the size of the Special Forces, but I re-emphasise to the noble Lord that we are investing £2 billion in new equipment for Special Forces, which I hope will be an encouraging sign of the emphasis that we place on the role that they play for this country.

The noble Lord, Lord Chidgey, asked me about access to the World Service FM broadcasts. If I may, I will write to him on that topic, as I will to the noble Baroness, Lady Jolly, on both the World Service and the British Council.

The noble Baroness, Lady Smith, focused her remarks on morale and whether the Armed Forces are now large enough to cope with the tasks that are required of them. I simply say that, by deliberately planning for the Armed Forces to do more and improving their productivity, which is undoubtedly what we are doing, we will better reflect the current demands on the force, and we will configure better to meet the demands of multiple, smaller and more geographically dispersed operations. We have also built in the agility to reconfigure the force to respond to a higher priority challenge, should it arise. However, we are the first to recognise the risk of overstretch and of damage to morale, so her points were very well made and are well taken.

The noble Lord, Lord West, spoke about the 2% figure for NATO. The 1.7% figure that he cited is an external estimate of the defence spend for 2020-21, not now. I would say that comparing defence spending now with 2010 is not appropriate, because before 2014 we spent considerable amounts on operations such as that in Afghanistan. We now spend less, but with no impact on our capability.

The noble Lord, Lord Anderson, asked about funding for the military involvement in the Ebola outbreak in Sierra Leone. The net additional cost of Operation Gritrock in Sierra Leone was in fact met by DfID.

The noble and gallant Lord, Lord Boyce, perhaps understandably, spoke, as he sometimes does, about the size of the Royal Navy fleet. We will indeed maintain a destroyer and frigate fleet of at least 19 ships. We will look to increase that number by the 2030s. The fleet will be supported by a very capable and renewed tanker fleet, and a fleet of up to six patrol vessels will support our destroyers and frigates in delivering routine tasks and enhancing our contribution to maritime security and fisheries protection. Altogether, this means that not only will our fleet grow for the first time since World War II, but its high-end technological capabilities will allow it to provide a better contribution and to retain a first-class Navy up to 2040 and beyond.

The noble Lord, Lord Touhig, asked about the flexible general purpose class of frigate, which I mentioned earlier. Our plan to commence in 2016 a concept phase assessment for an additional light frigate, which may result in a different type of frigate that satisfies the requirements of the Royal Navy, will proceed shortly. We believe that if the design and concept is worked through, it will be attractive to the export market. A combination of the modern Type 45 and the new anti-submarine warfare variant, the Type 26, should be sufficient in the mean time to provide protection to the deterrent and maritime task group. It is envisaged that the general purpose frigate will be able to conduct a wide range of other maritime security-related roles around the world, and thus take some pressure off our high-end warships.

The noble Lord, Lord West, asked about HMS “Ocean” and bemoaned the fact that it is going to be decommissioned in 2018. This is not in fact a bringing forward of the decommissioning date; it will continue in service as planned well into this Parliament, but, as part of the SDSR process, the decision was taken not to extend the 20-year lifespan that she originally had. We need, indeed, her personnel to man the new carriers.

My noble friend Lord James spoke powerfully about the need for a capability for home defence. I can tell him that that is foremost in our thoughts; my right honourable friend the Prime Minister recently announced that up to 10,000 trained Armed Forces personnel would be available to assist in any major incident within the UK. The SDSR also includes our work to provide closer military border force co-operation and better maritime surveillance. It is important to understand in this context that we have a cross-government approach to meeting our maritime surveillance task; the Royal Navy and UK Border Force provide different capabilities, which are suitable in different situations.

The right reverend Prelate the Bishop of Portsmouth focused some of his remarks on the plan to reduce the civilian workforce. It is too soon to say how those will play out. Further efficiencies will need to be found beyond our existing change programmes; we will undertake a series of studies that will identify opportunities for more innovative and flexible ways in which to work, including through better technology and moving work to different locations. The reduction in MoD civil servants will include many personnel in change programmes that are already under way, including the final draw down of British forces in Germany.

The report has a great deal to say about the Commonwealth network from both a trade and a security point of view. My noble friend has not mentioned that, and it may be difficult to do so now in the last few seconds. Will he ensure that when we debate the Commonwealth on 17 December he, or a fellow Minister, will be properly and well briefed in that aspect, because it is central to the future of this country?

I share my noble friend’s emphasis on the importance of the Commonwealth. I shall ensure that his words are registered in the right quarters as regards our debate on 17 December.

Our message here is clear—the danger may be increasing but so, too, is our determination to counter the threats that we face. My Lords, with the leave of the House, I shall now repeat a Statement made earlier this afternoon by my right honourable friend the Prime Minister in another place on the national security strategy and strategic defence and security review. The Statement is as follows:

“With permission, Mr Speaker, I would like to make a Statement on the national security strategy and strategic defence and security review. Our national security depends on our economic security, and vice versa, so the first step in keeping our country safe is to ensure our economy is, and remains, strong.

Over the past five years we have taken the difficult decisions needed to bring down our deficit and restore our economy to strength. In 2010, we were ordering equipment for which there was literally no money. The total black hole in the defence budget alone was bigger than the entire defence budget in that year. Now it is back in balance. By sticking to our long-term economic plan, Britain has become the fastest growing major advanced economy in the world for the last two years and our renewed economic security means that we can afford to invest further in our national security.

This is vital at a time when the threats to our country are growing. This morning I was in Paris with President Hollande discussing how we can work together to defeat the evil of ISIL. As the murders on the streets of Paris reminded us so starkly, ISIL is not some remote problem thousands of miles away. It is a direct threat to our security at home and abroad. It has already taken the lives of British hostages and carried out the worst terrorist attack against British people since 7/7 on the beaches of Tunisia, to say nothing of the seven terrorist plots right here in Britain that have been foiled by our security services over the past year.

And of course, Mr Speaker, the threats we face today go beyond this evil death cult. From the crisis in Ukraine to the risk of cyberattacks and pandemics, the world is more dangerous and uncertain today than five years ago. So while every Government must choose how to spend the money they have available, every penny of which is hard-earned by taxpayers, this Government have taken a clear decision to invest in our security and safeguard our prosperity. As a result, the United Kingdom is the only major country in the world today which is simultaneously going to meet the NATO target of spending 2% of our GDP on defence and the UN target of spending 0.7% of our GNI on development, while also increasing investment in our security and intelligence agencies and in counterterrorism.

In ensuring our national security, we will also protect our economic security. As a trading nation with the world’s fifth biggest economy, we depend on stability and order in the world. With 5 million British nationals living overseas and our prosperity depending on trade around the world, engagement is not an optional extra; it is fundamental to the success of our nation. We need the sea lanes to stay open and the arteries of global commerce to remain free-flowing. So the strategy which I am presenting to the House today sets out a clear vision for a secure and prosperous United Kingdom, with global reach and global influence. At its heart is an understanding that we cannot choose between conventional defences against state-based threats and the need to counter threats that do not recognise national borders. Today we face both and we must respond to both. So over the course of this Parliament our priorities are to deter state-based threats, tackle terrorism, remain a world leader in cybersecurity and ensure that we have the capability to respond rapidly to crises as they emerge.

To meet these priorities we will continue to harness all the tools of national power available to us, co-ordinated through the National Security Council, to deliver a ‘full-spectrum approach’. This includes support for our Armed Forces, counterterrorism, international aid and diplomacy and working with our allies to deal with the common threats that face us all. Let me take each in turn. First, the bottom line of our national security strategy must always be the willingness and capability to use force where necessary. On Friday evening, the United Nations Security Council unanimously agreed Resolution 2249, calling on member states to take ‘all the necessary measures’ against ISIL in both Syria and Iraq.

On Thursday, I will come to this House and make a further Statement responding personally to the Foreign Affairs Select Committee. I will make the case for Britain to join our international allies in going after ISIL at its headquarters in Syria, not just Iraq. I will explain how such action would be one element of a comprehensive and long-term strategy to defeat ISIL, in parallel with a major international effort to bring an end to the war in Syria. But today I want to set out how we will ensure that our Armed Forces have the capabilities to carry out such a task, and indeed any other tasks that might be needed in the years ahead. We will invest more than £178 billion in buying and maintaining equipment over the next decade, including doubling our investment in equipment to support our Special Forces, and we will increase the size of our deployable Armed Forces.

In 2010 we committed to an expeditionary force of 30,000. Today I can tell the House that by 2025 we are increasing that number to 50,000. As part of this, we will create two new strike brigades, forces of up to 5,000 personnel fully equipped to deploy rapidly and sustain themselves in the field. We will establish two additional Typhoon squadrons and an additional squadron of F35 Lightning combat aircraft to operate from our new aircraft carriers. We will maintain our ultimate insurance policy as a nation, our continuous at-sea nuclear deterrent, and replace our four ballistic missile submarines.

We will buy nine new maritime patrol aircraft, based in Scotland, to protect our nuclear deterrent, hunt down hostile submarines, and enhance our maritime search and rescue. We will buy at least 13 new frigates and two new offshore patrol vessels. These will include eight Type 26 anti-submarine warfare frigates. We will design and build a new class of light, flexible, general-purpose frigates. These will be more affordable than the Type 26, which will allow us to buy more of them for the Royal Navy, so that by the 2030s we can further increase the total number of Royal Navy frigates and destroyers. Not one of these capabilities is an optional extra. These investments are an act of clear-eyed self-interest to ensure our future prosperity and security.

Secondly, turning to counterterrorism, we will make a major additional investment in our world-class intelligence agencies to ensure that they have the resources and information that they need to detect and foil plots from wherever they emanate in the world. As I announced last week, we will invest £2.5 billion and employ over 1,900 additional staff. We will increase our investment in counterterrorism police and more than double our spending on aviation security around the world.

I can tell the House today that we have put in place a significant new contingency plan to deal with major terrorist attacks. Under this new operation, up to 10,000 military personnel will be available to support the police in dealing with the type of shocking terrorist attack that we have seen in Paris. We will also make a major new investment in a new generation of surveillance drones. These British-designed unmanned aircraft will fly at the very edge of the earth’s atmosphere and allow us to observe our adversaries for weeks on end, providing critical intelligence for our forces. We will also do more to make sure that the powers that we give our security services keep pace with changes in technology. We will see through the draft Bill that we have published to ensure that GCHQ, MI5 and our counterterrorism police continue to have the powers that they need.

Thirdly, we will use our formidable development budget and our outstanding Diplomatic Service to tackle global poverty, promote our interests, project our influence and address the causes of the security threats that we face, not just their consequences. Alongside the strategic defence and security review, I am publishing our strategy for official development assistance. At its heart is a decision to refocus half of DfID’s budget on supporting fragile and broken states and regions in every year of this Parliament. This will help to prevent conflict and, crucially, to promote the golden thread of conditions that drive prosperity all across the world: the rule of law, good governance and the growth of democracy. The Conflict, Stability and Security Fund will grow to over £1.3 billion a year by the end of the Parliament and we will also create a new £1.3 billion prosperity fund to drive forward our aim of promoting global prosperity and good governance.

Building on our success in tackling Ebola, we will do more to improve our resilience and our response to crises, identifying £500 million a year as a crisis reserve and investing £1.5 billion over the Parliament in a global challenges research fund for UK science to pioneer new ways of tackling global problems such as anti-microbial resistance. We will also invest £1 billion in a new fund for the research and development of products to fight infectious diseases, known as the Ross fund, and £5.8 billion in climate finance to play our part in helping poorer countries switch to greener forms of energy.

Taken together, these interventions are not just right morally; they are firmly in our national interest. They mean that Britain not only meets its obligations to the poorest in the world, but can now focus our resources on preventing or dealing with the instability and conflict that impinge on our security at home, investing at scale to create the economic opportunities that lead to long-term stability across the world, and responding rapidly and decisively to emerging crises overseas. Acting on all of these fronts gives us greater influence in the world.

Finally, Britain’s safety and security depend not just on our own efforts, but on working hand in glove with our allies to deal with the common threats that face us all, from terrorism to climate change. When confronted by danger, we are stronger together. We will play our full part in the alliances that underpin our security and amplify our national power. We will work with our allies in Europe and around the world, as well as seizing opportunities to reach out to emerging powers.

History teaches us that no Government can predict the future. We have no way of knowing precisely what course events will take over the next five years. We must expect the unexpected, but we can make sure that we have the versatility and the means to respond to new risks and threats to our security as they arise.

Our Armed Forces, and police and security and intelligence services, are the pride of our country. They are the finest in the world and this Government will ensure that they stay that way. Using our renewed economic strength, we will help them keep us safe for generations to come. I commend this Statement to the House”.

My Lords, I thank the Minister very much for the briefing that I received, along with colleagues from the Labour Party, earlier today. I am sure that the final form of this document was a result of the events in Paris and, as with all reports, the devil is in the detail. The debate next week in the name of the noble Earl, Lord Attlee, will give us all more time to analyse that very detail.

This strategy points to a more forensic and measured analysis than its predecessor, which is welcome, and it is appropriate to the times we find ourselves in. I will concentrate my remarks on the interconnection between defence and the world, our alliances, personnel and cyber. It is a complete coincidence that the noble Lord, Lord Touhig, has covered much of the same detail. On Syria, my leader has made it clear that he is not a pacifist or a unilateralist, and he is concerned for security of the nation. He will be outlining the conditions under which we would support military action in the next few days.

It is pleasing that the Government see our defence and security as requiring such a strong commitment to our allies and to international efforts. There are few issues that we face that can be addressed without co-operation, from climate change to transnational terrorism to state aggression. It is the strength gained from working with our allies and like-minded states, in particular within the United Nations, NATO and, of course, the EU, that will allow us to overcome and address these issues.

Our soft power capabilities—the British Council, international aid, the BBC World Service and our diplomatic representation—are valuable assets for spreading British values. A recognition of their contribution to our security and defence is an important addition to the SDSR. Will the Minister confirm that there will be no cuts to the budgets of either the World Service or the British Council? I am sure the extension of deep country expertise to a wider span of areas that are vital to our security and prosperity will be welcomed at the FCO, but will the Minister point to how this dovetails with the possible cuts in the FCO’s budget, which officials have said may,

“imperil the UK’s diplomatic capacity”,

if they go ahead?

Moving on to personnel, today I will focus on the Royal Navy and get into the detail of the other services in next week’s debate. Last week I was delighted to visit, with parliamentary colleagues, the two carriers, “Queen Elizabeth” and “Prince of Wales”, in Rosyth. They are an awesome sight and a tribute to British engineering and co-operation between manufacturers. While I welcome their addition to the fleet over the next couple of years, they bring with them a challenge. Will the Minister confirm that there are plans to ensure that there will be sufficient personnel with the right specialities to run the carriers with the Astute-class submarines, destroyers, frigates and support ship configuration? In particular, what action is being taken to ensure that there will be engineers at all levels of seniority and speciality?

As a member of the AFPS, I have visited service personnel in their workplaces, met families in their homes and spoken to senior officers and other ranks. I have to tell your Lordships that morale is not universally high. There is concern about salaries and allowances. Will the Minister confirm the rumours that the annual increment system will change, as will overseas allowances, as a result of MoD cuts? I welcome the move to support a service woman or man to buy their own home. A supported family is critical to the well-being of a serving member of Her Majesty’s Armed Forces. Will the Minister confirm that the covenant will continue and, more importantly, that its implementation is being monitored by the MoD?

On cyber, it is important that cyber intelligence is shared, as many of our systems are shared with our allies and our partners. I am concerned about defensive cyber. Cyber threatens systems and, by its nature, much of today’s warfare consists of systems of systems, with millions of lines of code, all interconnected and interrelated. It is great that we are working with our partners and allies on this, but adding to the connectivity is a multiplier of risk. So I welcome the joint cyber group, but there is an urgent need for recruitment and training. Will the Minister tell us how quickly we can gear up for this joint cyber group as the need is immediate?

I should not finish without a nod in the direction of how the SDSR is to be paid for. I am aware that the Chancellor will unveil the CSR on Wednesday. The Liberal Democrat Benches welcome the commitment to 2% of GDP, but that is another issue where the devil is in the detail. Will the Minister tell the House what sort of efficiencies the MoD is expected to make—apart from selling land and property—that will have no impact on the smooth running of the department? If we are to believe today’s Financial Times, it will be paid for from the welfare budget and from cuts to police and in grants to businesses.

My Lords, I thank the noble Lord and the noble Baroness for their comments and questions. I particularly welcome many of the comments made by the noble Lord, Lord Touhig. It was regrettable that he felt it necessary to conclude his speech as he did, on a note of dissent. Nevertheless, taking his comments in the round, there is much to unite us, rather than the opposite. The noble Lord asked me a number of questions, as did the noble Baroness, and I will get through as many of the answers as I can.

First, on the Royal Navy, I would put it to the House—once noble Lords have had an opportunity to read the document, which is in the Printed Paper Office—that the Navy has benefited very considerably from the review. Full crewing of aircraft carriers, new offshore patrol vessels, new fleet solid support ships, 400 extra personnel, and a faster buy of F35 Lightning, to allow the carriers to embark up to 24 operational aircraft, are just examples of that. As for manning, the reorganisation of manpower within the Navy will ensure that sufficient people are trained and available to man and operate both Queen Elizabeth carriers. The requirement for each carrier is, I understand, a crew of 733 sailors. The planned retirement of HMS “Ocean” in 2018, combined with a rationalisation and reprioritisation of personnel across the naval service, plus the uplift of 400 extra personnel, which I mentioned, will ensure that sufficient people are trained and available to man and operate both carriers.

We will maintain our fleet of 19 frigates and destroyers. There has been no moving away from that commitment. We will also design and build a new class of lighter flexible general purpose frigates, as was mentioned in the Statement. I am sure that many noble Lords will welcome the fact that we are now committed to reintroducing maritime patrol aircraft. We will purchase nine Boeing P-8 maritime patrol aircraft—that includes the aircraft we need in the envelope—advanced high-altitude surveillance aircraft, and 138 F35s over the lifetime of the programme. The MPAs will be based at Lossiemouth; that is considered to be the ideal location for the most common maritime patrol areas. Further details will emerge in due course. It is likely that there will be 400 additional personnel for Lossiemouth, to ensure that the MPA capability can be properly serviced.

On the F35, we will bring forward the purchase of nine front-line aircraft, which will allow the second F35 Lightning squadron to stand up in 2023. That is about a 60% increase in front-line aircraft numbers by 2023, compared with our previous plan. We are buying our current tranche of 48 F35 aircraft earlier than originally planned, to maximise our carrier strike capability in the early 2020s. As I have said, we are committed to a total through-life buy of 138 F35 aircraft. Decisions on the precise details of subsequent tranches will be taken at the appropriate time.

I am conscious of the clock, so I will get through as many questions as I can. When will the strike brigades be ready? The fielding of the strike brigades will start from 2018, delivering an initial operating capability by 2021, and moving towards a full operating capability from 2025.

The £1.9 billion that we have set aside for cyber is a national-level investment towards implementing the new national cybersecurity plan. I am advised that I have more time than I thought, which is good. The national cybersecurity plan will include a new national cybercentre, a stronger active defence programme, more funding for training of the UK’s next generation of experts in digital skills, a stronger regulatory framework, a stronger cyber sector, and funding for the national offensive cyber programme.

In September 2013, during the coalition Government, the Defence Secretary announced that, as the noble Baroness mentioned, Britain would build both defensive and offensive capabilities, including a strike capability to operate in cyberspace as part of our full spectrum military capability. The national offensive cyber programme is a partnership between the Ministry of Defence and GCHQ, harnessing the skills and talents of both organisations. As for the deterrence of cyberattacks, it is our aim to make ourselves a difficult target, so that doing us damage in cyberspace is neither cheap nor easy. We hope to build global norms in that regard, so that those who do not follow them suffer the consequences.

On the 2% commitment, I hope noble Lords will accept my assurance that we follow the NATO guidelines as to what constitutes defence expenditure. Like other NATO member states, we make periodic updates to how we categorise defence spending—for example, to reflect changes in the machinery of government—but all updates remain, and will continue to be, fully in accordance with NATO guidelines.

I shall briefly cover the question that the noble Baroness asked me about pay and allowances. It is not our intention to remove incremental pay or annual pay increases for those serving. We have reviewed military allowances: the vast majority will not change, but we are making minor changes to a few of them, and removing commitment bonuses. Commitment bonuses were designed as a retention tool, but we have no evidence that they influenced people’s decisions on whether to stay or leave. The Chief of the Defence Staff recommended that we remove them, so we will phase them out.

The remaining questions I will write on—but on the subject of the British Council, the SDSR refers to it by saying that we will continue to invest in it. It does not give a figure, and I think we will have to wait for the spending review announcement to know what that will be.

I congratulate my noble friend Earl Howe on his presentation of a very substantial report, which the House will want to study. One thing that concerns me in it are the completely new elements that have come into our defence strategy. Drones, cyber and the interception of communications will play a much bigger part in the defence of this country than might previously have been the case. I am concerned about where we will be by 2025 or maybe—it may be better to look this far—by 2030. That is quite a long way away. My noble friend has already partly answered this but my concern is on how soon some of these capabilities, which in the present frightening state of the world are very desirable, will be ready and how the manpower challenge will actually be met.

My noble friend puts his finger on a central issue that we have been wrestling with over these past months. It is impossible to predict the threats that we will face in 10 or 15 years. We know that there are many uncertainties. The national security strategy sets out a quite different threat picture from that of 2010. In particular, the threat from terrorism has increased substantially and aggressive Russian behaviour means that state-based threats are more prominent. As the Statement said, we cannot choose between conventional defences against state-based threats and the need to counter threats that do not recognise national borders. We have to tackle both. We have attempted in this document, I hope successfully, not just to address the threats in order of priority but to plan for an array of capabilities that will make us much nimbler on our feet, more flexible and able to respond globally to any threat that materialises. My noble friend is right to put his finger on cyber and drones as new elements of this strategy. We must invest in these things but we must also ensure that the skilled manpower is there so that the equipment can be utilised to its best effect.

My Lords, I welcome the Statement as being better than the 2010 so-called strategic defence review. My welcome is therefore conditional. I have scanned through the document and much of it is filling in the gaps that were left some years ago, for instance, on the maritime patrol aircraft. May I ask the Minister a couple of questions? First, what is the difference between the rapid deployment brigades—I use “rapid” advisedly, because they will not be at full capability for 10 years—and 16 Air Assault Brigade, which was formed in 1999 after the last and only genuine strategic defence review, which was conducted by my noble friend Lord Robertson? If there is no substantial difference, why has it taken all this time over the last five or six years to decide to get the capabilities and to put them in effect for the future?

Secondly, is it not the case that the addition of 1,900 intelligence professionals at the centre will unfortunately be off-set if we reduce police numbers in the community, since the police act as a bridge between central intelligence—SIGINT and communications intelligence—and human intelligence, which is gained from trust by being in the neighbourhood? Finally, why does “innovation” not appear at any stage, particularly as regards cyber? Cyber now permeates everything from our weapon systems through our critical national infrastructure to central finance in London. The chief characteristic of cyber is constant entrepreneurial innovation and if we do not instil that at the centre of our processes, in procurement as well as in operations, we will fall behind in cyber. We are spending just under £2 billion there; the Chinese are spending $180 billion over the coming period.

My Lords, the noble Lord asked me three questions. The first was about the rapid deployment strike capability. The Army is able to deploy a division now with sufficient notice and has been able to for some while. During the time of the noble Lord, Lord Robertson, as Defence Secretary, he was instrumental in ensuring that capability. This division could consist of an armoured infantry brigade, 3 Commando brigade and 16 Air Assault Brigade as well as forces from other nations. This SDR is investing in improving the readiness level and upgrading the capabilities of the division, so that by 2025 we will be able to deploy a division comprising two armoured infantry brigades and a strike brigade, in addition to our high-readiness forces of 3 Commando Brigade and 16 Air Assault Brigade.

The noble Lord, Lord Reid, also mentioned intelligence and expressed a fear that this capability might be off-set by reductions in numbers in community policing. The SDSR document does not cover community policing, which is a matter for local forces, as he knows. We will no doubt be hearing news of that as the effects of the SR are made known. I cannot comment on that today but I can say that we will protect absolutely the counterterrorist police we need to ensure national security and that the funding for that will be ring-fenced. He also said that innovation was not mentioned. I will just refer him to part B of chapter 6 of the document, which is entitled “Innovation”, and is on page 73 and the following.

My Lords, can the Minister help to resolve a disconnect between the recent remarks of the Prime Minister and this document? The Prime Minister recently stressed the significance of the European Union for the UK’s national security in the context of, for instance, standing up to Russia, helping to stop Iran’s nuclear programme and tackling maritime piracy. But this document hardly mentions the European Union as such, as opposed to individual European allies. For instance, in chapter 5, “Project Our Global Influence”, you have to get to its seventh page before there is any mention of the EU. This seems to contrast with the Prime Minister saying a fortnight or so ago:

“The EU, like NATO and our membership of the UN Security Council, is a tool that”,

we use,

“to get things done in the world, and protect our country”.

One would have thought that would count as projecting our global influence, so why is there so little mention of the European Union?

My Lords, the noble Baroness should not read anything in particular into what she perceives as a paucity of mention of the European Union in this document. There is no doubt that our membership of the European Union adds value to our defence capability. We have only to look at the operation in the Mediterranean to rescue migrants earlier this year to see how the European Union came together. I was in Brussels last week at a meeting of the European Defence Agency, which is another means whereby member states can collaborate to ensure that we have such things as common standards in air-to-air refuelling, aircraft safety and a range of other areas. The European Union is a vehicle for co-operation, in parallel to our membership of NATO, and I would be the first to pay tribute to the work of its member states in protecting the security of Europe.

My Lords, I declare my interests as in the register. We should welcome this arrest in the decline in defence spending. We should also welcome the Government’s rather belated recognition of the damage that was done in the 2010 SDSR. But repairing the holes in our capability caused by that damage will take years and we need it today. In that context, for example, it is to be welcomed that the Statement says:

“We need the sea lanes to stay open and the arteries of global commerce to remain free flowing”,

but for that we need sufficient escorts. Does the Minister agree that it is not enough to say that we will not reduce our destroyer and frigate force from 19? Does he not agree that that force is far too small and that waiting until the 1930s, as the Statement says, is completely unacceptable?

My Lords, I think the noble and gallant Lord meant the 2030s. This has been a matter of very deep consideration in the SDSR process. The commitment to maintaining our fleet of 19 frigates and destroyers is still there, as I have said. The Navy needs eight Type 26 frigates to undertake the core anti-submarine warfare role and we remain committed to building those ships. We are taking more time to mature the design and drive down the costs before we cut steel on the first Type 26. Meanwhile, we will build two more offshore patrol vessels to ensure continuity of work on the Clyde and to provide more capability to the Royal Navy.

The concept of designing and building a new class of lighter, flexible, general-purpose frigate is, I hope, interesting to noble Lords. We are clear that behind that lies an aspiration to increase the total number of frigates and destroyers available to the Royal Navy. If we can produce something that is more generic—that is less high-spec when it does not need to be state-of-the-art high-spec—that should benefit the reach and capability of the Royal Navy in the round. It should also benefit shipbuilders in Scotland and the rest of the UK. We will publish a new shipbuilding strategy in 2016 setting out the detail of that.

My Lords, the noble Lord, Lord Touhig, is, I am sure, in complete harmony with his leader in the other place. But he does, of course, have one advantage over his colleague in that he has been a Defence Minister and has a deep knowledge of these matters.

My Lords, although the review is light on detail and timing, it is at least strategic and therefore sets itself apart from the exercise in 2010. In the light of events that took place across the channel 10 days ago, I do not think this is the time for picking holes in the review, although there are a few holes to be picked. It is a time, however, for us to assert to our enemies and adversaries, both actual and potential, that this country still has robust defences and that we are still capable of deploying those forces in the defence of this country and of our allies and playing our part in the international community. After all, we are the second military power in the West.

I will make two points about the review. In relation to the deterrent, I fully support the reinforced decision made today to order the four new nuclear submarines. Will the noble Earl’s department be a bit more robust in taking on the opponents of Trident who say that it does not address the biggest threats that we face today? Were it not for the deterrent, we would face even bigger threats to our national safety and security today—that is, nuclear coercion and blackmail.

Finally, the noble Earl has the responsibility with other government Ministers to ensure that the safety and security of the people of this country does not depend on the military alone. If further raids are going to be made on the budget of the Foreign Office, the World Service and the British Council, then huge damage will be done to the reputation of this country abroad, and to the safety and security of the British people.

My Lords, as regards the last points that the noble Lord made in his speech, we will have to wait for the spending review announcement. However, I take on board all that he says, particularly about the Foreign Office. We are clear that we must maintain the global representation that we have at the moment, if we are to support this country’s interests.

The noble Lord began by making some very welcome remarks, for which I thank him, about the strategic nature of the review. It is indeed strategic. It has been a two-year exercise. It included the lessons that we learned from the last SDSR. More importantly, it involved a deep analysis of the evidence base and wide consultation across diverse stakeholders both at home and abroad. We have tried to be truly strategic in identifying what we wanted to achieve in the national security arena, as outlined clearly in the national security strategy, and how we will achieve that in the SDSR.

Further details will emerge over the coming days, which will flesh out some of the high-level aspirations set out in the document. Unfortunately, I cannot release those at the moment.

We still have a global power projection capability second only in NATO to the United States. We should remember that. We have among the most capable troops and aircraft ships and submarines in the world. The Joint Force 2025 that we have designed is genuinely better equipped, more capable, more deployable and more sustainable than ever before.

As regards the deterrent, I welcome the noble Lord’s comments. The nuclear deterrent exists to deter the most extreme threats to our national security and way of life. Other states have nuclear arsenals. There is a risk of further proliferation of nuclear weapons. There is a risk that states might use their nuclear capability to threaten us or to try to constrain our decision-making in a crisis, or to sponsor nuclear terrorism. We cannot rule out further shifts in the international order that would put us or our NATO allies under grave threat. That is the rationale and the context for the substantial investment that we are making in the successor programme.

The document tries to make and refresh the case for the deterrent. We thought it important to do that, to go back to first principles and to demonstrate why this was something that we felt it absolutely right to include in the forthcoming defence programme.

My Lords, I thank the noble Earl not only for his Statement, but also for the statement on aid. In relation to the new prosperity fund, which countries will receive our main emphasis? Are we talking about the BRIC countries and, if so, how do we ensure that the prosperity fund does not get close to tied aid and is appropriately poverty-focused?

My Lords, the prosperity fund will be focused mainly on emerging and developing economies. They are becoming increasingly important for global growth. As the ODA document sets out, we will give greater priority to promoting sustainable economic reforms that are needed to continue that. The prosperity fund, which will be worth £1.3 billion over the next five years, will be aimed at things like the competitiveness of an operation of markets, energy, financial sector reform, encouraging Governments to look at ways of bearing down on corruption and, in so doing, to address the need to reduce poverty.

The fund is designed to give an additional boost to the opportunities for international business, especially, but not totally, for UK companies. We are planning a lot of other work on promoting prosperity, which is set out in the document. I am sure that the noble Baroness will find that of interest. I cannot be specific about the countries that we will target at this juncture, but I hope that that general description will be helpful. Africa is going to be a major focus for this, not least sub-Saharan Africa, maybe looking at ways that the energy market, for example, can be encouraged in that area.

My Lords, would the Minister agree with me that some of the language we are using in this debate reflects an assumption that the world is binary and divided into allies and enemies? The reality is that allies become enemies, and enemies become allies. In any strategic approach to the future, could we be assured that that possibility will be taken into account? I worked on elements to do with Iraq in the 1980s, and we can see what happened in the 2000s. Arms and resources that we sell to people who are rebels in Syria can then be used against us. Is that sort of strategic thinking about a non-binary, more eclectic world being taken into consideration?

The right reverend Prelate reminds us of a very important point of principle. As I hope he will find when he reads this document, running through it is a thread or theme that makes clear that government has to be joined up in all of this—much more joined up than it ever has been in the past. The way in which countries abroad are assessed as friendly, non-friendly or something in between is absolutely essential in our long-term planning. Having said that, we are very clear that we have our prime allies with whom we wish to collaborate, specifically when it comes to defence—not least the United States, France and, increasingly, Germany. However, it is possible for countries around the world to unite around a common objective, as we saw recently with the United Nations Security Council resolution, where all the members of the Security Council voted in one direction. That was a remarkable event in itself, and we should take our cue from that in deciding how to proceed further in the context of the Middle East conflict.

My Lords, one of the problems of SDSR 2010 was that so much depended on financial provision in 2015, which of course has not materialised. Could the Minister say how much of the £178 billion provision for buying and maintaining equipment over the next decade is guaranteed? Presumably, that includes the military equipment which is required for the two strike brigades which the noble Lord, Lord Reid, mentioned earlier.

My Lords, the figure of £178 billion is £12 billion more than we previously announced and is over 10 years, as the noble Lord rightly said. It will embrace a whole range of equipment, including equipment needed for the Army. It is not possible for me to define some of that equipment at this juncture, because we wish to leave our options open. But I hope he will take heart from the section in the report about equipping the Army with, for example, the new Ajax vehicle and the new MIV, as it is called. These highly flexible, speedy and capable vehicles will ensure that the strike brigades are supported, as they need to be, with the right equipment so that they can be deployed swiftly and effectively—sometimes, if necessary, at long range.

My Lords, I welcome this review. It starts to correct the devastation caused by the 2010 SDSR, but it does not resolve it. As the Minister said, the actual amount of extra money is not that huge, and certainly in the early years there is not very much at all. I am delighted that we are running both carriers and that we are getting some of the Sea Lightnings—I hope that is what we are going to call them—for the new carriers.

However, I have a couple of questions of concern, the first about the Trident programme. From reading the document, it looks as though the first replacement boat for Vanguard will arrive in the early 2030s. Running Vanguard on until 2028 was further than many of us wanted to go and was very high risk. Has advice been given that people are content to run Vanguard on for what sounds like another four to five years? That is certainly contrary to the advice that I thought we were getting in the Ministry of Defence some five years or so ago.

My other point relates to frigates. Very clearly, we do not have enough destroyers and frigates, which is a national disgrace. I am very concerned about timescales, and there is nothing in here about that. We really need to go out there and start ordering these ships and to work out a drum-beat for their delivery. The Minister talked about OPVs. I have not had a proper Answer to my Written Question, but can I assume that the three OPVs we are currently building will be run as well as the ones we have already and the two extra ones? If not, I have concerns about naval manpower.

My Lords, I am sure that many of us would wish that the Royal Navy was larger than it is, but we have had to look very carefully at what the Royal Navy’s tasks are and are likely to be and to configure the Navy accordingly. As regards the sufficiency of ships, we are advised by the Chief of Naval Staff that a 19-ship destroyer and frigate fleet, capable of co-operating on a global scale, is what is required. That fleet will, incidentally, be supported by a very capable and renewed tanker fleet, with two fast fleet tankers, four new Tide class tankers in the short term and three new fleet solid support ships in the longer term. A fleet of up to six patrol vessels will support our destroyers and frigates in delivering routine tasks and enhance our contribution to maritime security and fisheries protection. All this will mean not only that our fleet will have as many assets as it does today but that there will be high-end technological capabilities to provide a better contribution and to retain a world-class Navy up to 2040 and beyond.

As regards the Trident fleet, the advice we have received is that it will be both possible and safe to continue with the current Vanguard class submarines in service. However, as regards a successor, we need to get on with it. There is no doubt that we cannot countenance a delay in the construction of a successor, which is why we intend to move ahead with all possible speed on that front.

My Lords, I welcome this Statement and the full replacement of the Trident submarine fleet, and am conscious of what the Minister has just said about expediting the work on that replacement programme. Will the Minister confirm that each aircraft carrier will be able to conduct amphibious operations with its own helicopters, concurrently with its fixed-wing role? Will each carrier have the capacity to carry and deploy a Royal Marine commando group while deploying its fixed-wing aircraft?

My Lords, the intention is that the carriers will be able to operate in three configurations: first, carrier strike for mainly air operations, obviously; secondly, amphibious assault, with helicopters and Royal Marines on board; and, thirdly, what one might call a hybrid type of configuration, involving aircraft, helicopters and Royal Marines. These will be very versatile ships. They will be some of the most capable ships—if not the most capable ships—the Royal Navy has ever had. We need to make sure that the very large investment that we are making in them is deployed to best effect, and I think those varying ways in which we can use the carriers demonstrate that this will be a good investment.

My Lords, first, I strongly support what I can see of the new security strategy. There is one point I wish to raise. With the announcement in the Statement that we are going to take military action in Syria, can we be assured that this relates to, in the Prime Minister’s phrase, “going after ISIL” and will not include military action against President Assad? Do Her Majesty’s Government now recognise that the earlier decision of the West to provide a great deal of weaponry to the rebels against Assad has had four results: one, Assad is still there; two, we have had a four-year civil war; three, we have had a major refugee crisis; and, four, we have created the space for ISIL to be created?

The implication behind my noble friend’s question is that it is the actions of the West that have caused the migration crisis and the suffering in Syria. I respectfully disagree with him on that. It is Mr Assad himself who is the prime cause of the suffering in his country and the migration crisis. It is Mr Assad who has created the vacuum that ISIL has, unfortunately, filled very capably.

As regards the Motion that may come to the House of Commons on Syria, I have not seen a draft of it, but the discussions in government involve a Motion which would focus on ISIL. It is very clear that the House of Commons two years ago rejected the proposal that we should be involved in a war against Mr Assad. I think the UN Security Council resolution also points us towards a very clear and focused campaign to eradicate ISIL, which is a clear and present danger not just to us but to many countries around the world.

I think we must all be mindful of that precept. I hope we have been mindful of it in this document. It sets out what we see as the tier-one risks over the next five years. Clearly, were there to be such a major change in this country’s place in Europe or, indeed, such a major change in what this country consists of, there would be an obvious need to look again at some of the planning encapsulated here. However, I put it to the noble Lord that neither of the events that he has postulated invalidates the key strands of thinking in the SDSR set out here.

Terrorism is going to remain the most direct and immediate threat to our domestic security and overseas interests. Cyber threats to the UK are significant whether we are in or out of the EU. The risk of international military conflict is growing. Although it is unlikely there will be a direct military threat to the UK itself, there is a greater possibility, I put it to him, of international military crises that may draw us in. There is instability overseas. Since 2010, that has spread significantly to the south and the Middle East and northern Africa, as the noble Lord knows. The public health threats and the major natural hazards that the report identifies will still be there regardless. Therefore, I hope that the House will agree that we have looked in the round here not at a crystal ball but at an analysis of the threats that face us, analysing in turn what resources we need to address those threats.

My Lords, I support the counterterrorism strategy contained in the document but can the Minister confirm that the document takes into account the events of Friday 13 November? Can the Minister also confirm that the strategy will include extensive sharing of intelligence techniques and information, subject, of course, to national security considerations so that, when attacks are threatened from abroad, there is the greatest possible chance of their being detected before they occur?

I can give the noble Lord that assurance. We wish to see maximum collaboration with our friends and allies on the intelligence front. In the wake of the Paris attack, the question that we have asked ourselves is obvious: what are the capabilities that we need to counter such an event? We need the means to protect our transport systems, borders, critical national infrastructure and crowded places. We need systems that give us data in advance about people intending to come to this country so that they can be checked against our records. We need emergency services to respond to such incidents were they, God forbid, to occur. We need Armed Forces who are ready to provide support at very short notice in the event of a terrorist attack. Those are the questions we have asked ourselves over the past few months. The answers are contained in the report and I hope they will be reassuring to the House.

My Lords, my noble friend will be aware that in the national security strategy one of the greatest risks we face is from pandemic influenza or, indeed now, the spread of global organisms with antibiotic resistance. What he said about the availability of resources to support research in areas of infectious disease is extremely welcome. Can he confirm that will include support for that research in the United Kingdom at centres of world-leading excellence such as Porton Down and the research facilities being created at the Francis Crick Institute? Can he also say, in decisions yet to come and to be announced, that the public health capability in Public Health England and through local authorities will also be given, due regard in its ability to combat this particular great threat?

My noble friend, with his tremendous experience on this, knows that Public Health England will have to remain centre stage in the effort on major public health risks. However, I welcome his comments on the announcement around infectious diseases.

We are clear that the new £1 billion fund which will be rolled out over the next five years for R&D in products for infectious diseases—the Ross fund, which was mentioned in the Statement—will address the development and testing of vaccines, drugs, diagnostics, treatments and other technologies to combat the world’s most serious diseases in developing countries in particular. The Ross fund will more broadly target infectious diseases, diseases of epidemic potential, such as Ebola, neglected tropical diseases, which affect more than 1 billion people globally, and drug-resistant infections, which clearly pose a substantial and growing risk to global health. We look forward as a country to joining organisations such as the Bill and Melinda Gates Foundation, which has been so effective in tackling those issues around the world.

I speak as a former commissioner in Europe. This debate is outrageous. We ought to be discussing not how we are going to withdraw from Europe but how we can play a part in ensuring that our voice is heard. At the moment, it is not, because the Prime Minister is being ambiguous—we do not know where he stands. He will not say whether he is for or against. What is vital is how we make our views heard, not how we can withdraw. We should not have this attenuated debate, but a real one about the all-important issues. At the moment, that is being denied to Parliament, and that is wrong.

My Lords, I am very pleased to be the Minister responding to what has undoubtedly been an extremely worthwhile short debate on a topic that we all care about very much. I think all noble Lords will agree that Question Time is a valued opportunity for noble Lords from across the House to hold the Government to account, often in a very immediate way when we think of topical Questions in particular. That is why I begin by saying that I am right behind the noble Lord, Lord Hunt of Chesterton, in wanting to encourage a broad range of contributions at Question Time, and indeed in our work more generally.

I think, too, that this House sets itself apart from other legislative Chambers with its range of expertise and range of experience in numerous fields. It is through that expertise and experience that we best complement the work of the other place. It is undoubtedly important that we should always encourage as broad a range of contributions as we can to inform and guide our business. I think that is common ground.

Certainly, that is something that the previous coalition Government and we as the current Government have sought to do over the past few years. For example, we have expanded the opportunities available for Peers to ask Questions for Short Debate by introducing a slot for topical QSDs, which provides a fresh opportunity for a timely debate on the Floor of the House each Thursday, and by committing to set aside regularly a day in the Moses Room for five Back-Bench Members to ask QSDs. I am pleased to say that from where we sit that has been a success: no fewer than 104 Members of the House were able to ask QSDs in the last Session. We have also increased opportunities to serve on Select Committees, having supported the establishment of two net additional units of committee activity since 2012, four of which are devoted to ad hoc committees.

Turning to Question Time itself, I should perhaps start by making the point that we already hear from a broad range of contributors. Indeed, in the last Session more than 430 Members asked one or more Questions or supplementary questions. That is nearly 90% of our average daily attendance. Limiting Members to no more than seven Questions in a calendar year is another way in which we have sought to foster even greater diversity; indeed, 10 Members were caught by that limit last year.

Naturally, that does not mean that we should not look at what more might be done and I well appreciate the concerns that have been raised this evening. In particular, there is no doubt that we hear from some voices around the House considerably more often than others. There has been unanimity this evening that we should try to do something about that, and I will say more on that topic in a moment. Looking at the last Session, for instance, 16 Members made more than 25 contributions each at Question Time. Of the total number of questions asked, one in five were asked by the 20 most frequent contributors. I would just add that with three-quarters of the 20 most frequent contributors coming from the opposition side, there is certainly no danger that the Government are not being held to account. We certainly feel that we are. I also know, as we have heard in this debate, not least from my noble friend Lord Sherbourne, that some Members find it hard to succeed in tabling an Oral Question; others find it hard to intervene with supplementaries.

Some speakers this evening, including my noble friend Lord Sherbourne, were concerned that Front-Benchers tend to dominate at Question Time. I sympathise with that point—after all, 30% of the 25 most frequent contributors in the last Session sat on the Opposition Front Bench, and more than 10% of all questions were asked by the Opposition Front Bench. If we are to continue the practice of the Opposition Front Bench having a supplementary on nearly every Question—and I welcomed the comments of the noble Lord, Lord Hunt of Kings Heath, on that point—it is worth considering whether Questions themselves should only or usually be tabled by Back-Bench Members. For what it is worth, that was generally the rule when my party was last in opposition. The Front Bench was under standing instructions to defer to Back-Benchers other than in the most burning circumstances.

What changes might ensue from this? If we can make changes for the better, of course it is worth finding a way to consider those ideas. Several ideas have been raised today, which I will come on to. Before I do, I emphasise one thing, which is that noble Lords who want to change the way that things are done should feel empowered to propose it, and indeed it is open to any Member with a proposal to write to the Chairman of Committees, as chairman of the Procedure Committee, to look to take it forward, whatever it may be. I know that my noble friend Lord Trefgarne would welcome that process.

Well, clearly a conversation needs to ensue from that. I am grateful to my noble friend. I can tell him and other noble Lords that my noble friend the Leader of the House is always keen to facilitate the consideration of any new ideas. Some noble Lords this evening raised the idea of a ballot for Oral Question slots. If I understood him correctly, my noble friend Lord Sherbourne was against a ballot of Questions but in favour of a ballot of Peers. The noble Earl, Lord Clancarty, raised some cogent objections to the whole proposition.

The idea of a ballot has been raised frequently before, and my noble friend the Leader of the House facilitated a suggestion to this end from the noble Lord, Lord Avebury, at a Procedure Committee meeting earlier this year. However, there was no consensus within the committee at that point, as there appeared not to be in 2013 when, despite the agreement of the Procedure Committee and government support, the Procedure Committee’s proposal to allocate Questions by ballot was withdrawn by the then Chairman of Committees when it became clear that there was no support on the Opposition Benches for the change.

We see merit in the idea of a ballot for the allocation of Oral Questions if we can avoid the pitfalls highlighted by the noble Earl, Lord Clancarty, and the noble Lord, Lord Hunt of Kings Heath.

I welcome what the noble Earl has been saying. I have a suggestion to make. There is a problem in recess where clearly the queuing is always stacked in favour of people who live in London. If one wanted to pilot a different approach, why not pilot it during recess periods so that we could see how it worked and whether there were some more general lessons to be learned? It is just a suggestion.

I think that is a very creative idea. Worries have been expressed this evening about what rules apply during recess and what counts as a topical Question, as the noble Lord, Lord Berkeley, pointed out. However, I do not think that we are likely to find total unanimity on the idea of a ballot—as the contributions this evening have demonstrated—but if there is one message that has come through it is that we should think through this idea rather more carefully, as there might be some underlying balloting system that would work.

The benefit of the present system is that it gives the House four weeks’ notice of upcoming Questions. The one thing we do not want to do is add complexity to the system or reduce the notice period to, say, two weeks, as I think my noble friend Lord Sherbourne suggested. However, I am in favour of the principle of what my noble friend wants to achieve and I would not wish to discourage him from putting his ideas to the noble Lord, Lord Laming, as chairman of the Procedure Committee.

The pros and cons of the queuing system have been referred to. For clarity, I say that if there is a slot available, noble Lords do not have to queue; they can take that slot on the spot. But if no slot is available and one is to become available, as they do four weeks ahead of the period being considered, it is allocated on a first-come, first-served basis, hence the queue that tends to form. I fear that the noble Lord, Lord Berkeley, was lucky in the first instance that he referred to and slightly unlucky in the latter instance.

I thank the noble Earl as that has explained something which I have been trying to fathom. As I suggested, the Companion could be a little clearer about this, because if you are a new Member of this House, it is quite difficult to work these things out.

I am quite sure that that is a very good general point to make. I am not at all sure that new Members of the House receive enough guidance when they arrive—on a variety of issues, this being one of them.

My noble friend Lord Trefgarne favoured introducing a slot for a fifth Oral Question. As other noble Lords pointed out, that was trialled in the past—I think it was in 2002 to 2004—but not taken forward after that. It was also not supported in the Procedure Committee when its revival was proposed in the last Parliament. I agree with my noble friend Lord Attlee that, rather than adding to our proceedings, the perception was that a fifth Question tended to switch people off, and that the energy and momentum of Question Time, which I think we all appreciate, rather dwindled as a result.

Another point to be made here is that we now often have Urgent Question repeats taken in the slot immediately after Questions. I would be surprised if the House wanted effectively to take six Questions before starting on the day’s business. For similar reasons—and I agree with the noble Lord, Lord Hunt of Kings Heath, on this—I would not support extending Question Time to 40 minutes.

My noble friend Lord Trefgarne raised some issues about Private Notice Questions. As my noble friend knows, the system for PNQs has been considered several times without any changes being agreed. I certainly believe that there is a case for bringing forward the deadline by which decisions about PNQs are made. However, I am not sure that there is wide-ranging support for changing the decision-making approach as such, although I know that my noble friend is trying to put this forward for the Procedure Committee’s consideration. The key point here is that the decision on whether to grant a PNQ is one for the Lord Speaker. The Government provide the policy background to assist the Lord Speaker but do not have a say as to whether the PNQ is allowed—and that presupposes that the PNQ relates to a matter of government responsibility. The Companion states:

“The decision … rests with the Lord Speaker, after consultation”.

My noble friend Lord Trefgarne also raised the possibility of having Oral Questions on a Friday. We sit for only around five hours on a Friday if we are to rise at 3 pm, which is generally the time when noble Lords are keen to make tracks homeward. Fridays are a particularly valuable time for noble Lords to discuss Private Members’ Bills and, although it is worth a discussion, I am not convinced that people would want the time to be taken up by Oral Questions.

My noble friend Lord Sherbourne came up with the interesting idea of a countdown approach, with eight minutes per Question. Maybe it should be seven and a half minutes, if we are not to exceed the 30 minutes in total. I was very struck by that idea. The Clock already indicates the time taken during Oral Questions and the current system allows some flexibility in the lengths of those Questions, some of which run short of eight minutes as well as running over the seven minutes. My personal view is that there are some merit in the existing system over the one that my noble friend suggested, because it has flexibility built into it. We have to allow some measure of flexibility. It is always difficult for the Clerk of the Parliaments to judge this but in general he does it very well indeed.

The noble Lord, Lord Hunt of Kings Heath, proposed a general review. I am not personally averse to that idea, although we have reviewed the whole system of Oral Questions in a series of forums, including the Leader’s Group at the start of the last Parliament and in the Procedure Committee on repeated occasions in the course of that Parliament. We have also had several votes on aspects of Questions: for example the issue around reading out Questions in full. I would very much welcome a general conversation about this. I am not sure we need to go as far as having a formal, full review. We have had a number of good ideas put forward this evening and we could encapsulate those in a general conversation of the kind that I am proposing.

My noble friend Lord Trefgarne, the noble Earl, Lord Clancarty, and the noble Lord, Lord Hunt of Kings Heath, with whose points I very much agreed on this subject, bemoaned the tendency for supplementary questions to be over-lengthy. The Companion is very clear about this, stating:

“Supplementary questions … should be short and confined to not more than two points”,

and where they are not, the House should make its views heard. Again, I received with sympathy the suggestion of the noble Lord, Lord Hunt, that the Leader and Deputy Leader should perhaps be more proactive in the way that we guide the House on this issue. We can only urge noble Lords to respect the guidance in the Companion but, again, there may well be greater scope for new Peers to have this point impressed more firmly upon them. For that matter, Ministers’ replies to supplementaries should also be short and crisp.

Does the Minister not think that some survey of all the many tens of new Peers who have come would be a good idea? How else is he going to find out this information? There is a small group of people here. People may write in or read Hansard, but some signal needs to be given that we really want to hear what all the new people joining the House of Lords think about this.

Yes, I am sure that that idea deserves full consideration. I think we would all agree that it is getting to a stage where we must impress on all Members of the House, not just the new arrivals, that we have rules which are here for a purpose and have been carefully thought through over the years—and that it is in all our interests to adhere to them.

I wonder if I am alone in observing that the shouting at Members—and new Members, too—who are reading notes tends to lengthen the whole process rather than shorten it. If somebody has a good note and refers to it in a short, sharp question, that is surely preferable to those who waffle on without notes to guide them.

I totally agree with the point that the noble Lord makes.

What this useful debate has shown is that there are some changes which we could helpfully consider. But I would add that, regardless of what procedural changes we might wish to consider, we also need to look at how we can work together to enable more voices to be heard at Question Time. One of the concerns raised with me is that the Chamber of the House can feel an intimidating place in which to intervene at Question Time and that the louder voices are heard more often. That is something we all can change, if we are minded to do so.

Self-regulation is a cherished feature of this House and one that we should guard jealously. It means that we are in control of our own affairs and can work together to make our business work. That is a responsibility on us all. It is not just for the Leader, incidentally, or for that matter the party and group leaders; it is for each and every Member of the House. If we want to hear from a broader range of people—and from the debate today, I clearly sense that we all do—we need to encourage those who speak less to speak up. That means making sure that we allow those with particular expertise to get in when they seek to do so and look for ways of helping those from whom we hear less to take part.

One way would be to keep supplementary questions brief, to allow other noble Lords to get in, but more generally it is about making sure that being self-effacing does not mean not being heard. Fostering that culture could be the single biggest step that we could take to hear from more noble Lords and to make our Question Time an even better forum for us to showcase the contribution that this House can make to the world outside.

Although I welcome any further discussion with those who want to consider procedural changes, we should remember also that cultural change must follow in step if we are to really make the best use of the talent around the House. I look forward to working with those here today to make progress in that regard.
