On 21 March last year, the Minister for the Cabinet Office and I updated the House on proposals and next steps for establishing a big society bank that would act as the central initiative for growing the social investment market in the UK, helping provide a third pillar of finance for the social sector, alongside philanthropy and the state. This is an important element of our strategy to help the sector become more resilient and effective.

The big society bank formally opened its doors to the public on 4 April as Big Society Capital. The new institution has been capitalised with the first tranche of dormant bank accounts and Merlin bank money, and we will thus have met a coalition priority

“to use funds from dormant bank accounts to establish a “Big Society Bank”, which will provide new finance for neighbourhood groups, charities, social enterprises and other non-governmental bodies.”

Today I would like to update the House on how Big Society Capital will work and progress made over the last year.

Big Society Capital (BSC) is the first social investment institution of its kind anywhere in the world. We are keen to support more social enterprise, whether it be new mutuals, social organisations delivering public services or community groups taking over assets. The purpose of BSC is to make it easier for these social entrepreneurs to access the capital they need. A new initiative is needed because the mainstream financial institutions are not yet providing that capital. BSC will build a bridge between mainstream finance and the social sector. It will do this by helping to grow the embryonic market of social investment—money that is prepared to blend financial return with social impact.

BSC will be capitalised using the estimated £400 million in unclaimed assets left in dormant bank accounts for more than 15 years, alongside £200 million equity investment from HSBC, Barclays, Lloyds TSB and RBS.

In line with the social investment strategy that we published in February last year, BSC has been set up with four core principles:

Independent from Government;

Transparent;

Wholesaler;

Self sufficient.

BSC will not be making grants. It will always invest because it needs to cover its costs and the mission is to prove and develop the concept of social investment. The wholesale function means that it will only invest in front-line organisations through intermediaries such as Big Issue Invest, Charity Bank, the Private Equity Foundation, and Bridges Ventures. There is widespread consensus on this positioning. If we were to set it up as a retailer, then we would distort the market and undermine the very intermediaries that we need to grow it. BSC will act as a cornerstone investor looking to support innovative methods of tackling social problems, such as social impact bonds, and encourage others to co-invest, significantly increasing the amount of finance available to the social sector.

Ahead of BSC opening we made early proof of concept investments to build the pipeline for the new organisation. To date, seven in principle investments totalling £7 million have been agreed, including: money to help the long-term unemployed set up their own businesses; two schemes supporting vulnerable young people to get into employment; an affordable housing fund; two community energy projects; and the development of the world’s first ever social stock exchange.

All of these investments will provide jobs and help disadvantaged groups or communities, supporting economic and social recovery.

Many local voluntary organisations were set up to complement statutory services, as Nottingham Community and Voluntary Service reminded me when I met its representatives last week. If the predominant funding source for the voluntary sector is now to be public sector contracts, will not thousands of valuable voluntary groups throughout the country be left high and dry, showing once again this Government’s utter contempt for the big society that they purport to champion?

I think the hon. Lady missed my point. We are developing three pillars of funding, with the encouragement of high levels of giving, including a very generous tax incentive introduced by the Chancellor in the previous Budget; a new source of funding, social investment; and the launch of the world’s first social investment bank within a few weeks. But, yes, we want to do more with the sector to help us deliver public services, so, yes, we will be opening up new opportunities for charities and social enterprises to help us do just that.

A survey commissioned by Charity Bank has revealed that more than 20% of charities have suffered from the cancellation of contracts with businesses and Government bodies in the past year. Does the Minister agree that the Government’s refusal to recognise the needs and benefits of charities and voluntary organisations in policy formulation is preventing such organisations from getting vital funding to which they are entitled?

The hon. Gentleman makes an important point. Any commissioner in the public sector needs to engage with stakeholders in communities before commissioning services—not least in the voluntary and community sector, whose stakeholders tend to have, on the whole, a much better understanding of the needs of the people we are trying to help.

Five months ago, the Prime Minister told me here that he would look at the funding gap arising from changes to legal aid funding for advice services such as the citizens advice bureaux in Wiltshire. Does the Minister consider that he has yet found lasting funding arrangements to sustain that voluntary sector service in future years?

We know that the charity advice sector is under a lot of pressure; that is why we found the money for a £20 million fund to provide immediate support for the most vulnerable organisations and why we are undertaking a serious review of the longer-term issues facing the sector. We will be announcing the findings of that review later in the spring, so the hon. Gentleman may not have to wait very long.

Will the Minister join me in congratulating the work of bodies such as Voluntary Action Leicestershire, which are advising the voluntary and community sector so well in Leicestershire, including my constituency of Loughborough, on how to find alternative funding models and how to do things differently given the changed funding environment?

I am certainly happy to do that. Such organisations play an essential role in providing support for front-line organisations. That is why we have found £30 million of funding to support organisations as they improve those services for the front line through the transforming local infrastructure fund.

Most voluntary sector organisations receive no public funding at all, but those that do cannot be immune from the need to reduce public spending. That is why we are taking active steps to help the most vulnerable organisations, to encourage more giving and social investment, and to create new opportunities to deliver more public services.

Given that the most recent report by the National Council for Voluntary Organisations shows that, according to the Government’s own figures, charities are facing cuts of £1.2 billion in public money per year, does the Minister agree that the Government need to do more to support the voluntary sector in constituencies such as mine, Feltham and Heston, as we turn around what the NCVO has described as a “toxic mix of circumstances” affecting our charities?

As I have said, almost 80% of charities receive no money from the state, but we have made it clear that those that do cannot be immune from cuts. The Labour leader himself has made it clear that he could not have protected them from cuts at all. We should remind ourselves that the cuts are necessary because of the actions of the last Labour Government. This Government are taking action to protect the most vulnerable organisations, create new sources of funding and open up new opportunities for charities and social enterprises to deliver public services. All they hear from the Labour party are empty words.

It is a pleasure to serve under your chairmanship for the first time, Dr McCrea.

I follow convention in congratulating the hon. Member for Wigan (Lisa Nandy) not just on securing the debate, but for the way that she presented her case. We served together quite happily, I think, when considering the Public Bodies Bill. I am not surprised that she has been pursuing this matter forensically for many months, through the Education Committee and this debate.

I will do my best to answer the questions that I can. The hon. Lady will know that I cannot answer them all; in fact, I cannot answer the majority and I cannot speak for the Secretary of State for Education. I am certainly not going to respond to allegations about any destruction of information or materials, because they remain just that.

I am grateful for the hon. Lady’s clarification. I was wondering what the piece of paper that was thrust into my hand was. It is a long list of questions and we will do our best.

In some ways, the hon. Lady was challenging the Government on their important commitment to transparency and, because I feel proud of the Government’s direction of travel, it is important to put this debate in context by mentioning some things that we are doing to improve transparency, including in the Department for Education. The Secretary of State mentioned, in evidence to the Select Committee, increased transparency about schools performance.

Information is power and we are giving people more power. For example, the Government are now publishing details of ministerial, special adviser and permanent secretary meetings with external organisations; details of hospitality and gifts received by Ministers and special advisers; senior officials’ salaries; and detail on Government procurement card spend. We are also publishing information on many other items of public interest, such as hospital infection rates, crime maps—which have been an enormous success with the public, with more than 430 million hits since their launch—and data on general practitioners’ performance. More than 7,500 data sets have so far been published through the combined online information system on data.gov.uk, more than any other comparable transparency service in the world.

The information published enables people to see all Government expenditure, browsing by date, spender, recipient and amount. All Government contracts over £10,000 are to be published to ensure openness and fairness.

The whole Government accounts were published in November 2011 and each Department has published a business plan, setting out how it will achieve its reforms, how much money is being spent and what it is being spent on. Reports against these deliverables are published monthly on the No. 10 website.

Transparency does not just extend to central Government. For local authorities, there is increased local accountability and transparency of councils. We can see, down to the last £500, what is being spent in our name by our local authorities, including salaries, names, budgets and responsibilities of staff paid more than £58,200. There is detail on councillor allowances and expenses and we can see organisational charts, pay multiples, copies of contracts and tenders to businesses, which are important to the voluntary and community sector.

The point that I am trying to make—I will give way after doing so—is that this level of transparency is unprecedented and today’s debate, which challenges the Government and questions our commitment to transparency in some ways, needs to be seen against this background. So much of the long list that I read is self-evidently good and in the public interest. Why did it not happen before? The hon. Lady and other Opposition Members may have an answer, since they were in power for 13 years.

The Minister has read a long, impressive list of things that have been published under the Freedom of Information Act. Does he agree that it is extraordinary that guidance of such central importance to decisions made across the Government is not on that list? Will he commit to publishing it immediately?

I am getting to the meat of the debate, which raises important issues about freedom of information requests and private e-mails. That is a complex new matter.

The hon. Gentleman says it is waffle, but I am proud, because in less than two years we have achieved all that I mentioned—which is more than his party did in 13 years in power—in giving people information about what the state is doing in their name. I do not describe it as waffle; it is hard information that is in the public domain now.

This debate is about the use of private e-mails and their relation to the Freedom of Information Act. We have to recognise that this complex issue has been the subject, as the hon. Lady says, of a recent decision by the Information Commissioner, published on 2 March. In his decision notice, the Information Commissioner makes it clear that at the time the Department for Education received the FOI request, there was no guidance in existence. This was a new area that had, perhaps, not been anticipated. The commissioner acknowledges that the full implications of the FOI Act in relation to this issue may not have been well understood at the time. He states in his decision notice that he

“would say first of all that he acknowledges that this is a novel issue and one which may not have been anticipated when the Freedom of information Act was passed…Given the unique role played by special advisers it is not always easy to draw a clear line between official information held by a public authority and party political information.”

It is clear that the Information Commissioner’s decision notice raises important issues that the Government are taking seriously and considering.

For reasons that I am sure hon. Members will appreciate, a time period is set out in the FOI legislation within which the Government will consider whether to appeal or release the information. I cannot answer the hon. Lady’s question about whether any decision has been taken. The Government have 28 days from the date of the decision notice to decide whether to appeal. If there is no appeal, the Government have a further seven days to release the information or assert a relevant exemption. Therefore, I am sure that hon. Members will understand that it is not appropriate for me to comment on the decision while such consideration is under way.

The hon. Lady has asked me to make public the advice given by the Cabinet Office to the Department for Education on FOI and private e-mails. She asserted at the start of her speech that she had not received any answers on this, but in fact she has, although it is not necessarily the answer that she wants. In a written answer from the Minister for the Cabinet Office, she was informed that the Department will not publish any guidance on private e-mails and the Freedom of Information Act given to the Department for Education, because

“Information relating to internal discussion and advice is not normally disclosed.”—[Official Report, 6 February 2012; Vol. 540, c. 63W.]

That has been so for a long time and we will stick to that line, because the Government do not disclose what is effectively internal advice. Doing so would prejudice the conditions under which such advice was given. That is a long-standing convention, and it is entirely respectable for the Government to stand by it. Today’s debate has not changed my view and, I am sure, will not change the view of the Minister for the Cabinet Office and Paymaster General. We both believe, as Ministers before us have believed, that advice between officials and Ministers should remain confidential.

The hon. Lady intervenes from a sedentary position. The answer to that question is that we will not disclose the advice or the manner in which it was communicated—we would not normally disclose that, and we will not do so now.

The more substantive issue is what happens now, in that the Information Commissioner has given a view and the Government must respond. The hon. Lady asked when the Cabinet Office will publish its guidance. I have made it clear that the Government are considering the Information Commissioner’s recent decision notice and his guidance, published in December, and will publish their guidance as soon as it is ready, but the issues are complex and require detailed consideration. [Interruption.] The hon. Lady laughs, but we must get it right: the question is new, it is complex and it was not anticipated at the start—it needs to be got right. The Cabinet Office is doing that work, which is well under way. When our guidance is ready, it will be issued.

The debate is valid and raises important issues that the Government are considering and taking extremely seriously. I do not recognise what the hon. Member for Gateshead (Ian Mearns) said about the Secretary of State’s apparent flippancy in Committee—I read the transcript; I was not there—but, given that in that part of the inquiry he was being interviewed under Paxman-like conditions by the hon. Member for Wigan, his replies were serious and to the point. However, important issues, which we are taking seriously, have been raised and I ask hon. Members to allow consideration to take place in the appropriate way. Within the time frame set in tribunal rules, the Government will decide whether to appeal or to release the information originally requested, in response to the Information Commissioner’s decision notice of 2 March. The Government are also considering the guidance issued by the Information Commissioner in December on freedom of information and private e-mails, and the Cabinet Office will issue further guidance to Departments in due course.

I am grateful to the hon. Member for Paisley and Renfrewshire North (Jim Sheridan) for recognising that my friend and colleague, the Minister for Further Education, Skills and Lifelong Learning, my hon. Friend the Member for South Holland and The Deepings (Mr Hayes), lives in the real world. Some have doubted that in the past, so it was very helpful of the hon. Member for Paisley and Renfrewshire North to confirm that truth. However, he was entirely wrong to not congratulate my hon. Friend the Member for Congleton (Fiona Bruce) on securing the debate. I do so, and congratulate her also on how she presented her concerns. She always speaks with a great deal of personal conviction that is often rooted in real experience, and she did so again today.

I was disappointed that so many Labour MPs appeared to come here to frame the debate as the Tories bashing the unions. That is not the language I heard at all. Hon. Member after hon. Member stood up to recognise the valuable role of the unions, as I do too. No one in the Chamber needs a lecture about the value of good industrial relations, or the cost of bad industrial relations, and various Opposition Members spoke powerfully about that. For the avoidance of any doubt, the Government are not proposing any change in statutory entitlement to paid time off to carry out union duties. I am grateful to my hon. Friend the Member for Harlow (Robert Halfon) for pointing out that that goes with the grain of Lady Thatcher’s position.

In the context of the public sector, there is legitimate concern about the level of contribution from the taxpayer, about the issue of balance, which was raised by my hon. Friend the Member for Congleton, and—critically—the issue of transparency, on which my hon. Friends the Members for Witham (Priti Patel), for Plymouth, Sutton and Devonport (Oliver Colvile) and for Selby and Ainsty (Nigel Adams) spoke strongly. That is what we are debating this morning.

I start with the law. We recognise clearly that the Government have a role in facilitating the conditions for a positive relationship, including balancing the needs of the employer with those of the employee. That is achieved largely through the Trade Union and Labour Relations (Consolidation) Act 1992. As the title indicates, the Act brought together a variety of legislation that had been introduced and amended during the previous 20 years—a much more turbulent industrial relations climate. The Act covers a wide variety of issues, including recognition of unions in the workplace, the responsibilities of the employer and union representatives and, of course, industrial action. The extent to which the Act addresses trade union funding is in the context of union keeping of financial records, use of membership subscriptions for political purposes and, in the context of this debate, paid time off to carry out essential duties.

Aside from one or two specific instances, the Act does not distinguish between the public and private sector. The statutory framework recognises that there will be essential business that underpins the union’s formal role and helps to facilitate good industrial relations in the work force. The Act therefore provides for time off to carry out that business. In doing so—this is important to the debate—it distinguishes between duties and activities. Duties are the essential tasks that union reps must carry out. They could include collective bargaining negotiations, formal engagement in statutory consultation on collective redundancies, accompanying an individual to a disciplinary hearing, and can also include health and safety responsibilities. Activities include attending union annual general meetings, executive committees and workplace meetings to discuss the outcome of negotiations.

There is a statutory entitlement to paid time off to carry out union duties, but there is no such entitlement for union activities. However, some employers, including in the public sector, extend paid time off to activities as well. There is no right to time off for trade union activities that consist of industrial action. The amount and frequency of time off, whether paid or unpaid, is for negotiation between the employer and the union and depends on what is reasonable, taking account of all the circumstances. There is no statutory minimum or maximum. That ensures the necessary flexibility to accommodate the wide variety of different work forces and different day-to-day circumstances within those work forces. By that I mean that what is reasonable today may not be reasonable tomorrow if the circumstances have changed.

An ACAS code of conduct underpins the legislation. The code is comprehensive and, among other things, emphasises the importance of clear procedures and record keeping, as well as general considerations in determining what is reasonable. They include the size of the organisation and number of workers, the need to maintain a service to the public, and the need to ensure effective representation and communication with workers with a range of needs.

As I said earlier, at the heart of the framework is the importance of good industrial relations in maintaining an effective organisation. A reasonable amount of paid time off offers value for money for customers of an organisation and users of their services. For example, it can minimise working time lost due to disputes and accidents at work.

Some hon. Members mentioned the union modernisation fund. The latest round of projects is currently winding up and will be completed by early 2012. No further rounds of the UMF are planned, and no further funds will be committed to it. It is important, however, for Government to ensure that public sector employers manage the paid time off they grant their union representatives effectively to deliver the benefits I have mentioned.

I was asked about the proposed consultation in relation to the civil service, which was announced at our party conference. In answer to my hon. Friend the Member for Cannock Chase (Mr Burley), we have already announced that we will be consulting with the civil service trade unions on the following areas: reduction in overall facility time across the civil service; ending or limiting the practice of 100% of civil service employees’ time being spent on trade union duties and activities; ending paid time off for trade union activities, as opposed to duties; and reporting, developing a common system for reporting and monitoring across the civil service. That is the framework of the consultation, which I am assured will start imminently.

We will seek to review and rebalance the amount of paid time off provided to undertake trade union duties. The current level of facilities time offered to trade unions across Departments is very generous, and is certainly significantly more than that allowed in the private sector, or indeed in the wider public sector. While recognising the importance of effective representation in the workplace, we firmly believe that trade union facility time arrangements in the civil service are in urgent need of modernisation to reflect modern working practices. The consultation is focused on the civil service, where my responsibility as a Minister in the Cabinet Office lies, however other colleagues who have responsibility for these matters in the wider public sector have been asked by the Prime Minister to review the position in their sectors.

As previously published, the Government will deliver 30,000 national citizen service (NCS) places in 2012.

I am very pleased to be able to provide information about the location of national citizen service places available during summer 2012. Further places will be available in the autumn.

The places are listed by local authority, with the names of the organisations providing the places. NCS places are available in 95% of English local authorities.

The social action fund exists to scale up projects that have proved their ability to inspire people to take social action. We recently announced the first investments for the fund, which are worth £9.4 million and have generated a further £9 million in match funding. We believe that those combined investments will generate more than 200,000 volunteering opportunities.

A registered charity in my constituency, Fourtwelve Ministries, which runs the Carpenter’s Arms residential rehabilitation centre and a food parcel handout service, was recently turned down for funding by the Social Investment Business, which administers the social action fund. One of the reasons given was that it was part of a Christian charity. Can the Minister assure me that the Government fully recognise the role played by Christian groups in delivering social action projects?

Yes, I can, but I should clarify one point. The charity was not turned down for the social action fund; it was turned down for another fund.

We all know from our constituencies that many churches and faith groups are very active in generating opportunities for people to become involved and give time to help others, and the social action fund is open to bids from faith groups that make social action possible. In the first round we invested in the Cathedral Archer Project, a Christian group in Sheffield that is enabling homeless people to volunteer to help other homeless people.

A recent report by the National Council for Voluntary Organisations showed that, according to the Government’s own figures, charities face cuts of over £900 million. Does the Minister agree that the £20 million managed by the social action fund is a drop in the ocean in comparison with what charities need?

Let me make two points. First, the sector would have faced cuts under any Administration, as the leader of the Labour party has made clear. Secondly, the £20 million social action fund exists to do something very specific. Its purpose is to scale up successful, proven projects in order to inspire social action.

Big Society Capital is all about trying to make it easier for social entrepreneurs to access capital. We think that we are making good progress, moving swiftly through the Financial Services Authority authorisation and EU state-aid approval processes, and we are confident that Big Society Capital will be open for business by spring. In the meantime, the interim investment committee, which made its first investment in July, will announce its next investment shortly.

My hon. Friend knows from his lengthy experience in the area that we have fantastic social entrepreneurs in this country, and we want to make it easier for them to access capital, but, as he points out, some of them need more help to become more investment-ready. That is exactly why we have set up a £10 million investment and contract readiness fund—to provide grants for organisations that want to attract investment but know they need more help to become more investment-ready.

Among the Public Administration Committee’s many criticisms in its report today, it rightly highlights that Ministers cannot expect the big society bank to provide the solution to the funding crisis that their cuts are causing for hundreds of charities. Given that the report goes on effectively to accuse Ministers of being out of touch and not providing effective leadership to tackle the problems that charities face, would not now be the perfect time for yet another one of the Prime Minister’s big society re-launches?

I am not going to take any lectures on leadership and Big Society Capital from the Opposition, because they talked for 10 years about setting it up but did not actually do it. The hon. Lady knows that we have taken a great deal of action, not least by putting in place a £107 million transition fund to help the most vulnerable organisations. If she is talking about cuts being made locally by Bolton council, she will know that the reduction in its spending this year was only 7%. The questions that she has to ask Bolton council are: “Why were you so badly prepared for this situation?” and: “Why did you block a proposal from Conservative councillors to create a fund to support local voluntary organisations?”

I beg to move,

That this House endorses the nomination of Andrew Dilnot CBE for appointment as Chair of the United Kingdom Statistics Authority.

The motion is in my name and that of other Ministers. All Members will know that this appointment is a very important one. Without reliable and independent statistics it is impossible for the Government to make good policy, or for Parliament, the public and the media to hold us to account. The quality of statistics in the UK is recognised to be very high, and all Members will agree that it is essential that we maintain that position.

The UK Statistics Authority is at the heart of the system for maintaining the quality and credibility of official statistics. The Statistics and Registration Service Act 2007 established the authority to provide independent oversight of the statistical system. Therefore, the credibility of the chair is central to the whole operation of statistics in the UK.

Before moving to the specific candidate whom the Government have proposed for the post, I should like to acknowledge two very important contributions. First, the current chair, Sir Michael Scholar, has done outstanding work in establishing the authority as a credible and effective body, and I should like the House to record our thanks to him, not just for the work he has done since 2008, but for staying in post until the Government secured his replacement. I am sure other Members would like to place on record their thanks for and appreciation of his good work.

Secondly, I thank my hon. Friend the Member for Harwich and North Essex (Mr Jenkin) and the Select Committee on Public Administration under his chairmanship for their constructive engagement in the whole appointment process. In particular, I welcome the contribution that the hon. Member for Luton North (Kelvin Hopkins) was able to make as part of the panel that selected Andrew Dilnot.

Two particular qualities are essential for the chair of the UK Statistics Authority: independence and a passion for statistics. The Government believe that Andrew Dilnot is superbly qualified in both respects. First, on independence, Mr Dilnot has repeatedly demonstrated his commitment to independent analysis and a willingness to stand up for his views. Members on both sides of the House—to varying degrees, I suspect—will have appreciated, and been challenged by, the sharp but fair analysis that the Institute for Fiscal Studies published under his leadership of Budgets produced by Governments of all parties.

More recently, Mr Dilnot chaired the independent commission on long-term care, which tackled, as I am sure all hon. Members agree, one of the most important and intractable policy problems that we face with great rigour. I am sure he will display the same qualities if appointed to this new role. Although that might on occasion lead to discomfort among my ministerial colleagues, I hope that Members agree that Parliament and Government are best served by a credible, senior and independent advocate of the proper use of statistics.

Secondly, on Mr Dilnot’s passion for statistics, he is an acknowledged leader in the field of statistics and, frankly, is second to none in that regard. He is the author of what his biography assures me is a best-selling book about statistics, and was the founding presenter of BBC Radio 4’s series on statistics, “More or Less”. He is currently chair of the statistics users forum of the Royal Statistical Society, and has held a range of academic and advisory positions that require a detailed understanding of statistics and their use and misuse. In short, it is hard to imagine a better qualified candidate.

To sum up, it is essential that we appoint a new chair for the UK Statistics Authority who can continue to develop it as an effective guardian of good statistics. We believe that Andrew Dilnot is an excellent candidate. I welcome the report from the Public Administration Committee on his pre-appointment hearing, and its conclusion that he should be appointed. I therefore commend the appointment to the House.

I am obliged to you, Madam Deputy Speaker. In fact, I was just making my final point, so if I may, I will complete that sentence and finish my remarks there.

I was saying that we would see contracts going from the public sector into the private sector, on to the third sector and then back again. There would be dynamism in the sector, which would mean that sometimes contracts would be lost by social enterprises and go back into the public sector or the private sector, and then be regained again. With that, I will not seek to catch the Chair’s eye on Third Reading, which I am sure you will be pleased about, Madam Deputy Speaker.

May I start by adding my voice to those who have congratulated my hon. Friend the Member for Warwick and Leamington (Chris White) on the way in which he has led this Bill? I have said that on every occasion and I mean it. I thank him in particular for reminding the House, in what was a statesmanlike response to the shadow Minister, of the importance of the cross-party support that has built up over some years behind this agenda. That is essential if we are to make further progress.

I was delighted by the contribution of the right hon. Member for Salford and Eccles (Hazel Blears). She may have been described as unhinged in the past, but she was perfectly hinged today in her comments. She made it clear that, whatever her frustrations with the Bill, she recognises that it is a start and is happy for it to progress.

The hon. Member for Harrow West (Mr Thomas), my Harrow neighbour, is entirely right that we must not lose momentum. This agenda is more important than ever. We have a highly risk averse public sector system and a traditional business sector that is too stagnant in many areas. They must take this opportunity to create space for the change makers and the people who have the vision to stand up and say, “We see what you are doing. It can be done better.” This is exactly the time to do that. I have a lot of sympathy for the thrust of the hon. Gentleman’s remarks, which was about encouraging the system to go further. What he neglected to mention, in complaining about the playing field not being level, was who has tended the playing field for the past 13 years.

The hon. Gentleman also forgot to mention that it was a Labour Secretary of State for Health who reversed policy and made it clear that the NHS was to be the supplier of choice—a statement that sent shockwaves through the social enterprise and charity sector. I am glad that we are back on track and giving new momentum to the message that we must diversify our base of public sector delivery partners and that we must create more space for the change makers who are prepared to challenge the system.

That message is being recognised in some bizarre places. I wish that the hon. Gentleman had been with me this time last week in Brussels—I could have done with the company. I was at a conference where 800 people gathered from all over Europe, summoned by President Barroso and Commissioner Barnier for the launch of their social business initiative. Here we are in the middle of the greatest crisis facing the eurozone and the Commission is taking time, with leadership from the top, to state the importance of the whole area of social enterprise and social entrepreneurship. Speaker after speaker came to the podium to congratulate Britain on its leadership in Europe on this agenda. We must not lose sight of the big picture. We have the opportunity and the need to keep the momentum going.

I differ from the hon. Member for Harrow West on his view that simply legislating to require the Government to produce a statutory document will be transformational. We had a good debate on this matter in Committee, so I will not labour the point. However, I am extremely grateful to my hon. Friend the Member for Bury North (Mr Nuttall) for quoting what I said on Second Reading. I agreed with every word of it—I was on good form that day—and I stick to it. My hon. Friend the Member for Warwick and Leamington usefully reminded the House that we have had action plans before, and it is about not the publication of a plan but delivery and action.

The hon. Member for Harrow West bemoaned the lack of a strategic framework, but I would argue that in fact the coalition Government set a strong lead and set out a very strong framework in the agreement for government, which contains an explicit statement about our commitment to support the creation of mutuals and social enterprises and encourage them to play a bigger role in public service delivery. From that, a flow of action is increasingly evident in various areas, which I will summarise briefly.

Will the Minister acknowledge that it was in fact the previous Labour Government who introduced the legislation that enabled social enterprises to be established in the health service, and who provided significant financial support to get them off the ground? That was a Labour initiative. There are organisations such as Six Degrees, Unlimited Potential and the Angel health centre all across my city now, and they are providing excellent services. That was an initiative of the Labour Government.

I am very much prepared to accept, as I have in public on many occasions both in the House and outside, that we are building on some excellent work, to which consistency is fundamental. The point that I made earlier was that it was a Labour Secretary of State who sent a very mixed message to the market by giving an explicit statement that the NHS was to be the supplier of choice. I am delighted that there now seems to be cross-party support again for a message that is more positive for, and supportive of, social enterprises and charities and the opportunity for them to deliver public services.

The hon. Member for Harrow West mentioned the Work programme, and he is right that it is early days. There is certainly some frustration and cynicism out there in the social sector, and I am listening to it and liaising closely with the Minister of State, Department for Work and Pensions, my right hon. Friend the Member for Epsom and Ewell (Chris Grayling), on it. However, we cannot lose sight of the fact that under one of the most important of the Government’s programmes, deliberately structured as a payment-by-results system to incentivise primes to work with organisations that have a track record and a good opportunity to deliver results, we have 300 social enterprises and charities in the supply chain. Depending on their delivery, I believe they are set to earn several hundred million pounds over the life of their contracts. That is definitely a step forward.

The Work programme is not just about encouraging different suppliers of existing services. We are trying to get the system to think differently about how services are commissioned, so we are working with four local authorities on troubled families with multiple problems. I think we all know from our constituencies that the state has historically not done a very good job of supporting such families. We are encouraging those local authorities to consider working in a different way and structuring a more holistic service based more on prevention and an openness to working with different suppliers under a payment-by-results contract. We hope that will lead to four new social impact bonds, to encourage social investors to come in and share some of the risk and return.

That action and activity is intended to break down what the right hon. Member for Salford and Eccles and others know is a tremendous aversion to risk in the system. No one can pretend that that is easy, or that publishing a strategy document or even Government guidelines will instantly break down the culture of risk aversion in the public sector. She rightly talked about the need to support commissioners better, because they are operating in systems that are tremendously averse to risk. I have sat around tables with commissioners who get what we are talking about and want to make progress and work more with social enterprises and charities to restructure services. However, I have had queues of people at the door saying, “You can’t do that.” I am sure she knows—she has been there—that the more we consider the matter, the bigger the challenge gets.

We are thinking afresh about how we support commissioners, and the Minister for the Cabinet Office has talked about our plans to set up a commissioning academy to try to support commissioners, develop more intelligent commissioning and raise the status of the profession and the qualifications in it. We want to develop learning resources that build on the best practice that is being developed around the system, and that is a serious project.

The Bill will add value to that process—perhaps not in ways that every Member would like, because we all know that politics is the art of the possible at a given moment and that there are compromises to be made, but we are on a journey. The Bill will complement the best value duty, which Opposition Members did not mention but which my hon. Friend the Member for Finchley and Golders Green (Mike Freer) brought up. That was an important piece of guidance from the Secretary of State for Communities and Local Government to local authorities, setting out an expectation that commissioners should consider the overall value of service provision, including economic, environmental and social value. That covered the full procurement chain for services and goods, and was a very clear new piece of guidance.

We believe that the Bill will complement that useful guidance by sending an additional signal to commissioners outside local authorities that, where it is relevant and proportionate, they should consider social value at the pre-procurement phase when they are considering commissioning services. That is how we can balance out the areas in which we think the biggest impact can be made now and our desire not to impose too many disproportionate duties and burdens on people who are doing already very difficult jobs. That is where we are comfortable with pushing the agenda forward.

I am grateful to the Minister for his clarification of the guidance from my right hon. Friend the Secretary of State for Communities and Local Government. Guidance is fine, but from memory I believe it is still open to a local council tax payer or resident to challenge a local authority’s accounts if they believe that the local authority has not achieved best value. We need to go beyond guidance and ensure that the legislation all lines up.

I accept that point, and to some degree that is what we are doing today. We are moving forward on that. My hon. Friend mentions the concept of the right to challenge, which had not previously been mentioned in the debate. Again, we are moving forward on that, because we are moving into a world in which there will be much more information about what commissioners are doing and how public money is being spent. Through the Localism Act 2011, which I am delighted to say has completed its passage through Parliament, the right to challenge is now set in statute, with regulations to follow shortly to clarify how it will work. That is progress on the journey that I have described.

Will construction be covered by the clause on social value?

I have nothing to add to what I said in Committee. The Bill is reasonably clear about where it will apply.

The right hon. Member for Salford and Eccles mentioned B4Box in her constituency. The position will be enhanced by the new best value guidance, and there is nothing to prevent the local authority from working on the basis that she described. I am grateful to her for bringing Aileen in to talk about the matter. Aileen is doing it. There is space in the system for her to do it. She and I would probably agree that we need to send a stronger signal that it is okay, but it is okay and people are doing it. The best value guidance from the Secretary of State moves things on further by sending a signal of permissiveness.

I have always made it clear that the Government have from the start supported the principle of the Bill because of the value that it adds to the process, and it goes with the grain of what the previous Administration were trying to achieve. The system, risk averse as it is, is getting a consistently stronger signal about the need to take account of wider social value considerations when spending taxpayers’ and constituents’ money and to be more alive to opportunities to commission intelligently. Lots of examples have been cited in our debates of fantastic organisations, such as Create, that are adding value to our communities. I cited that example in my Brussels speech because in many ways it embodies exactly what we are trying to encourage.

We can do more. The hon. Member for Harrow West goaded us to come up with more ideas to support social enterprises in this movement. I have talked about the need to open up new market opportunities to help these enterprises grow and to help more people, but the Government can do more to make life simpler for the social entrepreneur. I shall come later to the question of definition but these are businesses first and foremost, and the guidance and requirements that we place on people trying to run businesses in this country are ridiculously disproportionate. A rigorous process is under way. It cannot be undertaken lightly and it does not lend itself to soundbites. It is a rigorous process of going through each subsector of the economy to look at the regulatory burden and to discuss with the players in those sectors what we can remove and what is no longer proportionate or necessary. That process is well under way.

We can also help social enterprises with the increasingly important question of how to measure social impact. That is their currency. Many of us know that the money providers, whether private or public, are increasingly demanding that social enterprises, charities and, I hope, other organisations measure and communicate their social impact and social value, which is their unique selling point. Many of us are also aware that arguably there is too great a profusion of initiatives in this area and of the risk that this will only confuse the landscape. I want greater coherence and consistency not least so that we, as funders, and other stakeholders can agree on what is worth measuring and how it can be measured affordably by all organisations.

This is a really important point. There is a plethora of ways to measure social value. I mentioned in Committee an organisation called Connectives, which has moved on from the social return on investment transactional model towards a much more in-depth assessment of what social value means. Is the Minister prepared to meet the two female accountants behind Connectives to explore their ideas?

I would be delighted. I thoroughly enjoyed the first meeting that the right hon. Lady invited me to, and I am sure that this one will be just as informative. I also thank her for reinforcing my instinct that the Government can take a lead in trying to make life simpler for all parties, not least in our role as a major funder, and to help people to reach greater coherence and consistency when working out what is worth measuring and how it can be measured by all organisations, not only those with the deepest pockets.

My hon. Friend the Member for Warwick and Leamington (Chris White) is bathing in the warm glow of the House’s approval and he deserves it, because he and his Bill have reached a milestone that very few people pass. He is to be very warmly congratulated on it. I have been in his position, so I know how frustrating the journey can be and how much patience is required—he has demonstrated all that. I would particularly like to congratulate him on the way in which he has worked with stakeholders outside this place to bring them together and keep them together on this journey. I know that it has been deeply appreciated.

My hon. Friend can take some comfort from the fact that I believe sincerely that the Bill has not been gutted—far from it. It has been focused on what is most important and valuable right now, which is sending a much clearer signal to those who are doing the very difficult job of buying services on our behalf. At the critical pre-procurement phase—the importance of which is so often underestimated and at which those buying are thinking hard and consulting about what is needed and about what they are buying, shaping the market of potential supply for that service—they should receive a clear message from us that we expect them to consider social and environmental value, when relevant and proportionate. That is a very useful addition and complements the other initiatives that are all pushing for space, not least the best value guidance from the Department for Communities and Local Government.

I am delighted to stand at the Dispatch Box on behalf of the Government to congratulate my hon. Friend, to confirm our support and to wish him every good fortune in the other place. If he succeeds, his name will be on the milestone of a very important journey that will help to unlock the entrepreneurial energy that wants to be part of this process. We will then be able to deliver what we all want: better public services for the people we serve.

Review of the Charities Act

I am today announcing that Lord Hodgson of Astley Abbotts has been appointed to undertake a broad review of the legal and regulatory framework for charities. Under section 73 of the Charities Act 2006 a person must be appointed to review the operation of the Charities Act 2006 within five years of enactment. The charity law review will not only consider the operation of the Charities Act 2006, but will also consider whether further changes are needed to ensure that the legal and regulatory framework for charities is clear and effective.

The terms of reference for the review are broad. They include issues that the review must cover as set out in section 73 of the Charities Act 2006, issues that the Government believe should be addressed, and issues that the charity sector has asked to be considered. The terms of reference for the review are available on the Cabinet Office website at: www.cabinetoffice.gov.uk, and I have arranged for a copy to be placed in the House Library.

Lord Hodgson will set out, in due course, how charities and other stakeholders will be able to engage in the review process.

The aim is for the review to report in June 2012, and a copy of the report of the review will be laid before Parliament.
