That this House has considered Government support for the economy and innovation in Northern Ireland.

First, may I say what a pleasure and privilege it is to serve under your chairpersonship, Dame Cheryl? I am particularly pleased to finally secure the debate. The Minister will be aware that I had secured the debate twice previously, and that it unfortunately fell twice because of the proroguing. I am glad to be here, particularly at this moment in time, to talk about the business and innovation community in Northern Ireland, which is such an important issue.

Absolutely. Even when I saw that the debate was scheduled, I thought that I had jinxed the entire thing, and that it certainly would not be third time lucky. However, it is, and I am really pleased to be here, because I am passionate about supporting the economy and businesses in Northern Ireland.

The issue is particularly important at this pivotal time for Northern Ireland and our United Kingdom, of which our businesses are very much part. I will touch on a number of issues relating to business, innovation and the economy in Northern Ireland, and I will raise questions and issues on particular elements. I am grateful to the Minister for being here to respond.

First, I want to paint the broader picture in Northern Ireland. Northern Ireland has an incredibly proud industrial and manufacturing history. We have been world leaders. Many companies that were created and thrived in Northern Ireland, and have been world leaders, will be well known to many across the United Kingdom and the world. Northern Ireland has contributed in a valuable way, including to the economy of pre-partition Ireland and of this United Kingdom. We have been world leaders in manufacturing and industry.

Many generations in Northern Ireland have worked, created, innovated and led the way. They have been critical to our economy and the tens of thousands of jobs they created, changing lives. The mighty companies of the past put Belfast and the rest of Northern Ireland on the map. However, as we are all aware, times have changed, and some of those huge, mighty industries of the past have faded away or are disappearing. This is common not only in Belfast and Northern Ireland, but across the United Kingdom and in many other countries.

However, we must build on our incredibly strong foundation to move forward. Having spoken to businesses, universities, and people in my constituency and across Northern Ireland, I believe there is a huge appetite to do that. It is often said that we stand on the shoulders of giants, and that is true when it comes to the economy and business in Northern Ireland. We have a bright and optimistic future if there is application, support and the right environment to help our businesses, economy and companies grow.

I thank my hon. Friend for that intervention, which was so good that I almost intervened on him. I absolutely agree. We have incredible companies. Politicians from all parties, but particularly the Democratic Unionist party, have always been proud to showcase and promote those companies, in London, the UK and across the globe. I have had the privilege and pleasure of accompanying many of those businesses on trade missions across the globe. I can see the huge interest in the innovation and creativity of those companies.

The Democratic Unionist party has often been referred to as the party of business in Northern Ireland. Some may disagree with that, and we do not always agree with business on everything, but one thing is clear: the Democratic Unionist party is a proud pro-business party. We recognise that supporting business is critical to supporting our economy, and growth in our economy is critical to getting new opportunities for young people and building a better future for them. We know that shared prosperity in Northern Ireland will bring shared stability. That is essential for Northern Ireland as it emerges from decades of trouble and division, and their legacy, which we still deal with; we know that growing the economy is key.

That is why, in 2007, when the Northern Ireland Assembly was restored, the Democratic Unionist party made growing the economy in Northern Ireland the No. 1 priority. We do so by building a coalition with all the other parties that agree that growing the economy is the best way to get a bright and better future for all in Northern Ireland, across all communities: Catholic and Protestant, Unionist and nationalist, and new and other communities that do not define in that way. We want everybody in Northern Ireland to succeed, and to have the best opportunities, and we recognise that one critical way of doing that is to have a robust, growing and strong economy in Northern Ireland.

My hon. Friend is making a very good speech. She mentioned large companies, but the backbone of Northern Ireland is small, family businesses. We have helped those in manufacturing with rates relief and other measures. Regarding innovation, we have the Young Enterprise programmes, which are coming through into small businesses to give them some initiative. I am sure she will also welcome that.

I absolutely agree. Later in my speech, I will come to the various aspects of our economy in Northern Ireland, and the particular issues, challenges and opportunities they face.

Northern Ireland is the smallest region of the United Kingdom, making up just 3% of the UK, but we still make a mighty contribution, and have a mighty story to tell. All of us here from Northern Ireland want it to play an even greater part in what is often referred to here as global Britain, but we would like to see a truly global United Kingdom agenda, in which every part of this United Kingdom is fully integrated and promoted and each region pulls its weight.

Does my hon. Friend accept that one of the downsides of the current withdrawal agreement is that although we are a major exporting region of the UK, we might find ourselves prevented from taking part in trade deals that the Government might strike with other parts of the world because of the way in which we are tied into the EU?

As a member of the International Trade Committee, I am very aware of the opportunities, challenges and barriers that full participation in international trade entails. It will come as no surprise to hon. Members to learn that I will mention the ‘B’ word—Brexit—later in my speech, and specifically the dreadful proposal for the Northern Ireland economy. My right hon. Friend’s points are valid; that constitutes a real and present risk to our economy.

Northern Ireland, just 3% of the United Kingdom, relies hugely on trade with the rest of the United Kingdom. Great Britain is the biggest market by far for Northern Ireland—bigger than the Republic of Ireland, the European Union and the rest of the world combined. Over the past 10 to 20 years, and certainly since the restoration of the Assembly in 2007, huge effort has been put into increasing our exports, and the market for our exports in other countries in the European Union and across the world, but Great Britain remains our biggest market, which we rely on hugely. Any barriers to trade with it would have significant impacts. I will touch on that later.

A factor that is discussed less often in this debate is consumer choice. Consumers in Northern Ireland rely hugely on the Great British market for goods, from the supermarket goods that we see in common high-street shops, to bespoke and craft products in smaller, family-owned shops. Many of those goods come from Great Britain, and there are real concerns about how people will access them. Many people today access goods through online marketplaces, such as Amazon, eBay and Etsy; that, too, gives rise to concerns about consumer choice and access. Many of the companies in those marketplaces are based in Great Britain, and many are very small producers; barriers might prevent them from posting their products to shops and consumers in Northern Ireland.

As a small region of the United Kingdom, we rely heavily on its economy, but Northern Ireland has a really strong case to make. As we have gone round the world trying to attract new businesses and, particularly, foreign direct investment to Northern Ireland, we have been able to showcase the fact that we have the highest skills in the United Kingdom. We have three excellent universities: Ulster University, Queen’s University in the heart of my Belfast South constituency, and the Open University, which does a huge amount of work. We also have high skills and a good education system. That is not to say that we do not have challenges—I have spoken about the challenges of trying to support every child to succeed in getting skills—but we are one of the highest-skilled regions in the United Kingdom.

We have relatively low staff turnover, which is very attractive to businesses moving to Northern Ireland, because they know that if they take those staff on, train them and invest in them, they will show loyalty. Indeed, I think we have the lowest staff turnover in the United Kingdom, which is comparatively unique. A company looking to come to the United Kingdom will also find relatively low set-up costs in Northern Ireland, as well as people who can support it through the process, and comparatively low recurring running costs.

We have a strong case to make, but of course there have been challenges. Over the past 15 years, the Republic of Ireland has cut its corporation tax time and again to make it even more competitive, knowing that our corporation tax rate is tied to that of the rest of the United Kingdom, and is therefore significantly higher. The Republic of Ireland has created tax incentive packages that I would describe as innovative, particularly to attract big US companies such as Facebook and Apple. We want to be able to attract those companies, too. Since 2007, working closely with Invest NI, Northern Ireland has had a very strong record; in fact, for some years, it attracted more FDI than any region of the United Kingdom outside London and south-east England. For a small region with the challenges that we had, that is a really strong story to tell. It is a story that we should be proud of—but we want more. We want to do better, and we need to do better, because we still have challenges and we still do not have the types of jobs that we want for our young people: high-value, stable jobs that young people with the right skills can move into, creating happy, healthy lives for themselves and their families with the prosperity that we want to bring.

My hon. Friend is right that it is not just jobs that we want, but good-quality jobs. Does she agree that when the Assembly was working properly, one of its successes was in attracting such jobs? Indeed, about 50% of the jobs attracted through FDI paid wages above the average wage in Northern Ireland.

I absolutely agree. Statistics released in recent days indicate that although we have had growth in the average wage, it has now slowed down, and there has been a slowdown at the high-value end of jobs. In Northern Ireland we have comparatively low unemployment, but those statistics do not necessarily show the whole story. My constituency of Belfast South has one of the lowest unemployment rates not just in Northern Ireland, but across the United Kingdom—but too many of those jobs are at the lower end. We need high-value jobs that pay people better, because there is significant in-work poverty. The best way to get out of poverty is with a well-paid job. People need jobs with stability to help them to support themselves and their family.

We also have persistently high levels of economic inactivity. Although people point to that inactivity, the reality is that right now we cannot just match it with jobs growth. We need good programmes to support people, regardless of why they are economically inactive. In Northern Ireland, we have a higher than average percentage of students, who are currently defined as economically inactive, but those are not necessarily the people we are worried about; we are worried about those who have been economically inactive for some considerable time. Even more worrying are people in families who suffer from transgenerational unemployment. They need the right support and skills programmes, at the right level.

This is not just about getting people entry-level jobs; we want them to skill up and make progress. I have heard House of Commons statistics about how many people go into an entry-level job and stay at that level for their entire career. Social mobility and support for people throughout their career, so that they can increase their wages and their family income, are essential to the shared prosperity to which we are committed.

Let me touch on a few particular aspects. I have already mentioned foreign direct investment. Northern Ireland’s economy is still very much one of small to medium-sized, largely family-owned businesses, as my hon. Friend the Member for Upper Bann (David Simpson) said. The Democratic Unionist party absolutely wants to support those businesses, but many of them are understandably reluctant to take risks in order to grow—people are content with the strong business that they have built not just for themselves, but for their children and family. We want to encourage those businesses because we need them to grow, but they should be able to take those risks in an environment in which they feel confident and positive. I will say a little more about family and small businesses in a moment.

I know that the Minister will have had meetings with Invest NI and received briefings. I pay tribute to the incredible work of Alastair Hamilton, who I worked with many years ago. He has done a fantastic job in very difficult circumstances, particularly in the past few years, to keep increasing foreign direct investment and high-value jobs. Since the collapse of the Northern Ireland Assembly more than 1,000 days ago, one of the small glimmers of light has been the fact that Invest NI has been able to continue to make jobs announcements, including in my constituency, and to create the opportunities that we really need. Under the framework set by the Northern Ireland Assembly, Alastair Hamilton and his Invest NI colleagues were able to continue going into the global marketplace, winning contracts and attracting companies to Northern Ireland. We want to build on his incredible work; as he moves on from the job, we are all thankful for the amazingly competent work that he has put in.

We are keen to continue to play a full role in attracting foreign direct investment. We can do so much through our regional organisations, such as Invest NI, but as the Democratic Unionist party has pointed out to the Government on a number of occasions, our sell in Northern Ireland must be fully integrated into what the United Kingdom does on a global scale. We want to be fully included in what is being offered, including trade fairs, engagement with countries, and trade missions. Some progress has been made, but we want more. I am sure that Members of Parliament from Scotland, Wales, the north of England and other regions also feel that, historically, their region has not been fully included and integrated in the sell of the UK Government. I have raised that issue on many occasions with the Secretary of State for International Trade, and with the Department for Business, Energy and Industrial Strategy. Progress has been made, but we want to build on it, and we want more of our companies to take part.

We know that innovation is the way forward. Northern Ireland will never be a low-cost manufacturer, but we have been, can be and will be high-quality, innovative and creative in our manufacture, industry and services, and in the skills that we bring to them. Investment in innovation is therefore very welcome. Some investment in research and development has been affected by constraints around state aid and other aspects of the European Union. As we move forward from that, we want a continuation of the investment in innovation, research and skills that we have had before.

The Government have spoken on this issue on a number of occasions, and I certainly welcome the very warm words that they have used. However, we would like concrete proposals on how Northern Ireland will get its fair share from any central programme to support innovation, research and development, and on how Northern Ireland can be more successful in bidding for central funds, to try to get the help and support that our businesses need to grow.

I have mentioned a number of universities, but as the Member of Parliament for Belfast South, I will of course mention once again Queen’s University, which does fantastic work in innovation; in fact, it is leading the way in a number of areas.

I am very conscious that we need to identify the potential growth areas. In what areas can Northern Ireland show unique creativity and innovation? In terms of the UK as a whole, what can we do to be particularly attractive to foreign direct investment and growing businesses? We have done huge amounts in areas such as cyber-security and finance.

I thank my hon. Friend for giving way again. An issue raised with me time and again is research and development assistance from Invest NI, because small companies are very much hands-on, so they do not have the manpower or staff to handle research and development. Maybe we could look at another way to deliver R&D.

Absolutely. The Northern Ireland Executive and Assembly were in a really good place to listen to businesses about their needs, and the challenges that they found when trying to apply for those types of funds––the red tape and other difficulties. In future, particularly post-Brexit, we will need a Government who are responsive to the question of how we can support businesses to grow in a way that works for them and their owners, because those owners have enough to do running those businesses, and focusing on what they are good at. The Government need to support firms in a flexible way, and give them the right tools and encouragement to grow.

I will briefly refer to our small and family businesses, particularly retail businesses on our high streets. I mentioned this issue last night in a debate in the main Chamber. As is the case across the United Kingdom, our high streets are under a huge amount of pressure, but unfortunately, we have not been able to access the same amount of support as other areas. I welcomed the Government announcement of additional support for high streets through the future high streets fund, but of course Northern Ireland was not able to use that money, because it went into the Northern Ireland block grant as an unhypothecated Barnett consequential, which meant that it was not ring-fenced for that purpose. As there is no Northern Ireland Assembly at the moment, there is no accountability; there is no way that elected Members and the people of Northern Ireland can push civil servants to spend that money on high streets.

We all know that our retail sector in our towns, villages, and small urban areas in cities is crying out for help; that is common right across this United Kingdom. Those areas are suffering from high business rates; they feel crippled by the bills that they receive. The shopping habits of consumers are changing, so small businesses are struggling. Very often, they are family-owned, and the owner actually works in the business. They need this help, but I met the head of the civil service to urge him to put that money towards retail, and there is no indication that that has happened.

That brings me to something that I have spoken about many times since I was elected as a Member of Parliament in 2017, namely that there is no Northern Ireland Assembly to listen to what the economy needs, and to do what it needs to do. That genuinely grieves me. The people of Northern Ireland, including our business people, are deeply frustrated. They want politicians to get back to work, to get back into the Northern Ireland Assembly and to start investing to grow our economy.

That is my challenge here today to Sinn Féin. There is no impediment to all the parties going back into that building tomorrow and sorting out our problems around the table, like adults, in the Northern Ireland Assembly. I speak for very many people across the community when I say, “Just get back to work and do what you need to do, because our economy needs to grow.”

My hon. Friend is making a very important point. We are talking about the economy, but peace and prosperity go hand in hand. Does she agree that the current EU withdrawal agreement, which she touched on, has the potential to damage local businesses further? Those businesses bring many of the goods that they sell on the high street from Great Britain, and anything that adds to the cost of bringing in those goods risks the ongoing presence of those businesses on our high streets.

I will try to move on as swiftly as I can. I was coming on to the next section in my speech, which is on Brexit. Your comment is probably a good indication that I should not speak for very long on Brexit, Dame Cheryl; despite the fact that I could do so, I will not do so.

I absolutely agree with my right hon. Friend the Member for Lagan Valley (Sir Jeffrey M. Donaldson). However, before I move on to speak very briefly about Brexit, I will mention business rates, because our smaller retail businesses and other businesses on the high street have been crying out for reform of business rates.

I was chair of the Finance Committee in the Northern Ireland Assembly just before the collapse of the Assembly, so I know that business rates were an issue that we were looking at, because Northern Ireland had led the way in rate support for small businesses. Unfortunately, however, since then, the rest of the United Kingdom caught up with us, and then moved past us, so our businesses are now suffering from business rates that are higher than those for small businesses across the rest of the United Kingdom.

The Democratic Unionist party wants fundamental reform of business rates; we recognise that there needs to be additional support for our small businesses. We are up for that challenge; we want to have that discussion; and we need a Northern Ireland Assembly back in action to do it. However, in the absence of the Assembly, I strongly urge the Minister to do what he can to listen to business, and to work within the regime that we have in Northern Ireland to give that much-needed support to small business.

I will very briefly touch on Brexit. A number of my right hon. and hon. Friends have already made contributions about it, and I will not repeat what they said, especially because I know a number of other Members still want to make a contribution about it. Nevertheless, it is absolutely right that any barriers between Northern Ireland and Great Britain—east-west or west-east—will create greater bureaucracy and disruption, and will threaten the economy that we rely on.

The fabric of that economy is complex. It encompasses everything from the large manufacturers and large businesses that have come in, to the supermarkets, right down to the business owner who runs a gift shop and brings in 10 or 20 pottery mugs, bowls or whatever it may be from a small supplier in Great Britain. When we work through all the detail, we can see where there could be significant additional costs and significantly more bureaucracy. These businesses may actually have problems in getting supplies. That is the difficulty for many, many businesses.

We have raised that issue, because the Democratic Unionist party will always stand up for what is good for Northern Ireland. What is bad for business—what puts up barriers—is bad for Northern Ireland. We know that, and we care about the people involved.

My hon. Friend touched on business rates. I understand that there will be a rate review next year in Northern Ireland; as a party, we should use our influence to try to do something for the retail sector.

I absolutely agree with my hon. Friend. However, I am getting a huge amount of pressure on my right from my hon. Friend the Member for Strangford (Jim Shannon), who is very keen to speak; I know that because he never gets to speak in Westminster Hall. So I will wind up.

In conclusion, I am passionate about supporting the economy in Northern Ireland, and I hope that I have got that across very firmly today. I am passionate about making Northern Ireland work. I am passionate about helping Northern Ireland to thrive. That must mean creating jobs, opportunities and a brighter, more prosperous future for all in Northern Ireland, across all the communities. We recognise that. I recognise that happy, contented people in this Union—in this United Kingdom—will not vote for the chaos, change and decades of transition that leaving this United Kingdom would bring. Members of our party genuinely care about the people of Northern Ireland, and we want our businesses, economy, industry and people to succeed.

For the purposes of clarity, it may be useful to note that termination of pregnancy and abortion is a devolved matter, so if the Assembly is restored that will rightly fall back to the Assembly. A devolved Assembly of the United Kingdom can amend or change the law regardless because these are devolved powers under the constitutional settlement of the United Kingdom. I am sure that the Minister agrees that legal clarity can be obtained on that issue if some Members remain confused or in doubt about it.

That is important, because the House will address some substantive issues tonight and we need answers.

The Minister rightly said it is now over 1,000 days since the Stormont Assembly and the Stormont Executive last functioned, which is outrageous. It is almost unrecognisable in terms of modern democratic governance.

If not for other factors, I would be talking tonight about the failure of the political system to reform the education of our young people in Northern Ireland. I would be talking about the failure to reform the health service, and the fact that the Bengoa report is now receding dramatically in the rear-view mirror of life. That is, quite frankly, tragic because it is letting down patients, as the health service in Northern Ireland now sees increasing waiting lists and other things that are unacceptable.

Mental health provision in Northern Ireland is grossly inadequate. If there is one statistic that ought to frighten Members on both sides of the House, it is that more people have died since the troubles through suicide than died during the troubles—that figure is dramatic but true. It is immeasurably sad, and we ought to dwell on that. It is a failure of politicians of all stripes in Northern Ireland.

I absolutely agree with the shadow Secretary of State about mental health, on which we urgently need more investment. Northern Ireland has a much higher need than the average across the United Kingdom, and it is only growing—of course we need investment in mental health across the UK.

The shadow Secretary of State says that the Bengoa report is disappearing—I refer the House to my entry in the Register of Members’ Financial Interests, as my husband is the permanent secretary at the Department of Health. Fortunately, the Northern Ireland Executive agreed the Bengoa recommendations. They are very high level, but that policy framework is currently being implemented. It is important for clarity to make sure that people are fully aware of that, but we need Ministers back because health and education are suffering enormously.

I think the hon. Lady and I are in agreement. Not enough is being done and the political decision-making capacity is not there. These things are outrageous and tragic in their own right, but of course the reality is that we also have two dates approaching very quickly: 21 October and the things that will move forward on the back of that and, of course, 31 October. I wish to talk about the two events that those dates touch on.

First, of course, is Brexit. As I said to the Minister, there is no part of this United Kingdom of ours that will be more changed than Northern Ireland. Irrespective of whether we have a deal on Brexit or a crash-out Brexit, either will transform Northern Ireland in a way that will be massively different from the effect on any other part of this United Kingdom. We need to dwell on that. I said to the Minister that the Secretary of State had said he would need to bring forward regulation and legislation to equip himself as Secretary of State, and the Government, with the necessary provisions. Even if we sit not just this Saturday but every other weekend day between now and 31 October, we are now some 14 days from that Brexit date. That is worrying and frightening.

We need to have some certainty about issues such as policing. We know that the previous Chief Constable warned that a hard border across the island of Ireland would create targets for would-be terrorists, and we know that the current Chief Constable has asked for more resource in the event of a no-deal Brexit. In any event, we know that, with the possibility of an increase in civil disturbances, almost irrespective of the type of Brexit, there needs to be some concentration on keeping the peace and on the questions relating to stability. We are simply not seeing that. I hope we get clear answers from the Minister on the timetable for when the Secretary of State will come to the House.

The Secretary of State and the Minister know Northern Ireland, so I do not doubt that they will recognise that there can be no hard border across the island of Ireland. The Prime Minister’s red lines are such that they must take that into account. In that context, the need for an Assembly and an Executive to be up and running is paramount. That really has to be a driving force. I accept that the Secretary of State is in Belfast today bringing the parties together—I do not simply accept that; I want him to be there—but I have to say to the politicians that the gap between them is so small. I need to say this through the House. I cannot recognise the principle that keeps them apart, out of the Assembly and out of the Executive when we look at issues such as health, education and the very important issue of Brexit. I hope the Minister can reflect on the questions that we need to address that will help to bring the Executive back into operation between now and 31 October, because we need the Executive there, irrespective of what takes place there—save for the Prime Minister having to write the letter, which so far he has been reluctant to say he will do, to ask for an extension. If he writes that letter, there is of course some leeway in the formation of the Executive, but frankly not an awful lot.

I wish now to turn to the question of abortion, which other Members will want to raise as well. I have two specific questions for the Minister. He talked a little around the issues, and I am not sure that we have had absolute certainty on them. If the Assembly does not meet before 21 October, the provisions of the legislation will come into operation. There has already been an exchange on what that means. My understanding is that, once the clock begins to tick on 22 October, the Assembly will not be able to annul the legislation. Will the Minister guarantee that, from 22 October, there will be a proper campaign to make people aware of how they can access safe and legal abortion for women in Northern Ireland? Such a campaign would guarantee that health professionals, and those who would give advice more generally, know that they have comfort in the law to give proper and adequate advice to women who seek that kind of advice. That is of fundamental importance during the interim period.

The second question may be even more important, and it has been raised, either directly or indirectly, by other hon. Members. Will the Minister guarantee that, if we move into this phase, come 1 April when the new regime moves in, there will be the provision of safe and legal abortion for women in Northern Ireland? That is the intention of the law as this House voted, and it is absolutely necessary that we have a commitment from the Government tonight not simply that the law will allow it, but that the Government will institute it, provide for those services and make sure that they are available. Women in Northern Ireland are entitled now to know that they have certainty about the direction of travel of this Government.

I do not intend to speak for long, because I know that other Members wish to speak, but may I simply say to the Minister that I hope he can answer some of these difficult questions tonight? Those he cannot answer, will he undertake to return to Members, both individually and collectively, so that we have proper answers on the record and we know where we are travelling both in terms of the formation of the Executive and, of course, on this very difficult, but very necessary, issue of providing safe and legal abortion?

Does my hon. Friend agree that this figure was challenged whenever it was put out? It was challenged the entire way to the court, and the court ruled that it is a defensible figure in terms of the laws in Northern Ireland. We may disagree very strongly on a number of matters. However, I can say very categorically that those people who strongly take a different position care just as much about women, but they also care about this issue. We should be respectful of that and the different views we have across this House.

It would have been one thing for this House to vote to impose abortion on Northern Ireland in the face of every Member of Parliament representing Northern Ireland voting against the measure, in the knowledge that the most recent abortion vote of any UK legislature on primary legislation was in the Northern Ireland Assembly in February 2016, when the people who should be making the decision voted not to change our law in any way. A national opinion poll last week showed that the majority of people in Northern Ireland do not want to see the liberalisation of abortion planned by Members of this House.

When I think about what will be imposed on my part of the United Kingdom from Tuesday, I am left utterly speechless. Between 22 October 2019 and 31 March 2020, the only law on this that will be in place in Northern Ireland will be the Criminal Justice Act (Northern Ireland) 1945, which is not engaged until the point at which a child is capable of being born alive. That effectively means that we would have a legal void in protections for the unborn until at least 21 weeks of gestation, and potentially up to 28 weeks’ gestation. It means that from Tuesday some unborn animals subject to research will have more statutory protection in Northern Ireland, thanks to the Animals (Scientific Procedures) Act 1986, than some unborn human beings. It is absolutely unbelievable that anyone would do this, and the Members responsible need to look at themselves very seriously. It is deeply troubling.

It also means that from Tuesday, quite unlike any other part of the United Kingdom, we will effectively have unregulated abortions, with all the attendant risks for women. The Government say in this report that they intend that the NHS will not significantly change the way it provides abortions until 31 March, but I find the emphasis that they place on this deeply disturbing. The Minister knows that; I spoke to him this afternoon about it.

Abortions need not come from the NHS. From Tuesday, it will be legal for private clinics to provide abortions in Northern Ireland. The Independent Health Care Regulations (Northern Ireland) 2005 place a statutory duty on the Regulation and Quality Improvement Authority to register and inspect independent hospitals and clinics that meet the stated requirement for registration, but those regulations are wholly inadequate. We must have legislation in place that protects people.

Currently, there are two conditions that would require an independent clinic to be registered with the RQIA: the first is that an independent clinic intends to carry out a prescribed technique or make use of prescribed technology; and the second that a medical practitioner working in the clinic is not otherwise engaged in providing services to health and social care in Northern Ireland. Abortion provision is not a prescribed technique or technology under the regulations, which means that only independent clinics that do not employ any doctors who also work for the NHS will be subject to this regulation. Again, a minefield of regulation.

Moreover, and this is of huge concern, this regulation will be quite unlike that pertaining to abortion clinics in England, where the activity of providing abortions is subject to abortion-specific regulation and the premises are subject to abortion-specific regulation and a series of abortion-specific required operating standard procedures. It is about the technical parts of the procedure. The Minister knows this; we talked about it this afternoon. None of those abortion-specific regulations will apply in Northern Ireland on Tuesday for at least five months.

Another important safeguard that currently applies in England but will not apply in Northern Ireland on Tuesday is regulation 20 of the Care Quality Commission (Registration) Regulations 2009, which deals with requirements relating to the termination of pregnancies. What is most shocking, however, is that the change in law means that from Tuesday there will be nothing to prevent someone without any medical qualifications at all from offering abortion services. With respect, I say that Government will thus cross a line that has never been crossed before: Government will potentially make backstreet abortions legal. This should not be about going back to the pre-1967 days, but it will be on Tuesday unless the Assembly returns by Monday. That recall is in process and hopefully can be achieved; if it can, this can be stopped, and the responsibility will lie with the Northern Ireland Assembly’s elected representatives, as it should.

Regardless of what one thinks about abortion, we cannot countenance this outrageous legislative framework for a day, let alone five months. In that context, I have a simple question for the Government and those in the Northern Ireland Office specifically: what were Government thinking when they agreed to the text of section 9 of the 2019 Act in the other place? They could have stood up for the women of Northern Ireland, as I am doing tonight, for the unborn and for babies alive in the womb, and pointed out that the safety implications of what section 9 proposed were just as inappropriate for the women of Northern Ireland as they would be for the women of England. They did not. This has to count as one of the most serious failures of governance that I have ever encountered. I say this honestly and respectfully to the Minister and to Government.

We debated the matter in this House and we made it clear—I said it myself—that the way in which it was done, and I understand that it was made clear by the proposers, with the date as it was, left inadequate time to deal with many issues that need to be in place. We have ended up with a period when the regulations will not be in place. Some Members have already acknowledged that. Does my hon. Friend agree that that is wholly unacceptable, sad and disappointing and that it should never have happened?

My father is from Northern Ireland and I have grown up in the shadow of some of the issues of Northern Ireland, given where I come from. I understand the issues incredibly well, and the problems that Northern Ireland has faced over the years, including with the Church and institutional abuse. There is a difference between talking about institutional abuse that the Church was a perpetrator of with Church groups and discussing whether we should file prescriptions for certain things with them. The point I am making is that there is no other health issue in this country that we would first discuss with Church groups, so why is this clinical, health matter being discussed with Church groups rather than clinicians or women’s groups? I ask the Minister to let us know. I am sure that the people who scurry along to the Minister with bits of paper can tell us which women’s groups the Government have spoken to—here we go. I will be fascinated to hear the answer.

Very often there are matters, including in healthcare, that touch on life and death, in which the Churches become involved—for example, proposals for end-of-life issues. Many Churches have come forward because members of their congregations are midwives and nurses. There is an absence of any reference to conscientious objection, which is common—for example, there is a case in the Republic of Ireland. There are legitimate reasons for members of congregations across the Church community to get involved, not just in the life and death issues, which they are also concerned about, as many people are on these Benches and across Northern Ireland.

I absolutely do not doubt that all sorts of organisations have people in their congregations, in this instance, or in their number who lobby them. Lots of women lobby me every day from Northern Ireland, from every constituency over there represented on these Benches, asking me not to forget about the women of Northern Ireland and asking me to stand and give voice to their voice. I totally understand why Church groups might also want to give their voice. But I have never heard a Secretary of State tell me that they have been discussing this particular clinical health matter with Church groups. I do not mind if they discuss it with Church groups, to be honest, as long as they also discuss it with women’s rights groups: Women’s Aid Northern Ireland, for example, who have very strong opinions on this, specifically in the cases of victims of domestic abuse, or the rape crisis centres in Northern Ireland. I very much hope that every single one of those women’s rights groups, equal to any Church group, was consulted. I look forward to hearing from the Minister how that was done.

I also ask the Minister how he would feel if he had to have an examination that he felt a little bit uncomfortable about—I will not embarrass him by naming some of them—and he had to get on a plane and go to Belfast to have it, and not just that, but to have any treatment. I ask him now to imagine that he had not had to go to Belfast and that he was in lovely Worcester, a fine place in the midlands, and that he went to the doctor to ask a question about something that was wrong—again, I will not embarrass him, but let us say something about his fertility, or because he did not want to have children any more—and the doctor told him that he could no longer continue the conversation because if he did he would be criminalised. That would never happen here. My husband went to have a vasectomy; if it had happened in Northern Ireland nobody would be criminalised for that, yet when a woman wants to talk about her fertility that is exactly what happens.

My right hon. Friend is entirely right. This is an issue that we are going to have to return to. When I read the reports before us this evening, the very first line told me that I did not really need to read the rest. The report was based on information from the Northern Ireland Office. That said it all to me. I say that with great deference to the Minister and officials at the back of the Chamber. As somebody who sits on the Defence Committee and who knows the reports that we have published on these issues and what the Government response has been, particularly from the Ministry of Defence, I can say that to rely solely on information from our good friends at the back of the Chamber is simply not good enough.

On talks, it is right that there will be an opportunity, which I hope is seized, for the Assembly to return on Monday. There has been some strange confusion or concern around this quest to have the recall of the Assembly, as though that in some way satisfies the Act. We cannot elect an Executive unless the Assembly meets. One can only follow the other, but it is high time that there was a return to devolution in Northern Ireland. Back in July, when we considered the amendments that are being discussed this evening, we could not have been clearer that, irrespective of the personal interests of Labour Members or the way in which they have campaigned on these issues continually—it is entirely their right to do so—to focus on two issues solely and not in any way to include other issues or aspects of encouragement would have one fundamental impact: it would prove to be a disincentive to the restoration of the Assembly. We need only look at comments made by a party leader in Northern Ireland today. When asked whether their party leaders would support the recall of the Assembly, the response was, “No, because we would lose out on the proposals that are due on 22 October.”

There are many at the moment who clearly have not been following proceedings in this House or the many, many things that my party colleagues have said over the last—sadly—1,000 days since the Northern Ireland Assembly and Executive last met. Does my hon. Friend agree that there has been a call for this? Some people have said, “Why now? Is it to prevent this?” Many, many thousands of people care really deeply about the issue on both sides; they are deeply concerned about it and want the Assembly to meet. However, does he agree that this is a point that I—we—have been raising in this House continually? The Northern Ireland Assembly and Executive need to get back now and start delivering the critical public services—health, education and other issues—for the people of Northern Ireland, because everybody in Northern Ireland is suffering.

I could not agree more. It was a great shame that back in July that disincentive was provided to the restoration of the Assembly, and we are seeing the outworkings of that.

Is it not bizarre that those who propose the changes in this legislation and who framed it in a way that allowed the Assembly to return failed to recognise that disincentive? Even this evening, when it is suggested that these devolved matters should be considered by a devolved Assembly, should it be restored, they are outraged. They are outraged by devolution, outraged by local democracy and outraged that people who are elected to represent their constituents in Northern Ireland, from whatever perspective, should have the ability to legislate on the issues that matter.

Although we did not gain much insight into the speech of the hon. Member for Walthamstow (Stella Creasy), I have just read a tweet from her alleging that there is some sort of conspiracy, that the Democratic Unionist party made an agreement with the Government, and that that is why this is not going to happen. Would the Minister like to take the opportunity to make categorically clear that that is not the case, that this is a sensitive subject that we all want to get right, given the mess that we are in because regulations are having to be made and there is not enough time in which to do that, and that we should all treat this issue with the utmost seriousness and without this type of nonsense?

The hon. Lady is right to say that this is a sensitive matter, and we should all seek to get it right. Let me make clear that we will take the action that is required by the law, and that means that more guidance will be published. We have already published guidance for healthcare professionals—on 7 October—to confirm the new state of the law during the interim period and their responsibilities. The guidance was published on gov.uk and circulated via the royal medical colleges. It also contains information for healthcare professionals in Northern Ireland about the funded abortion services in England that are available to women from Northern Ireland under the existing UK Government scheme. The healthcare professionals will be able to refer women to the service if the requirements of the Act come into force on 22 October.

The hon. Member for Rochdale (Tony Lloyd) asked about information on service provision. It is already available, and more information will be made available as we move forward with the process. The hon. Gentleman also asked an important question about the Secretary of State returning to the House. I can confirm that, as and when any extension of the Northern Ireland (Executive Formation etc) Act was considered or as and when any other powers were sought, the Secretary of State would need to come to the House in order to deal with that.

I note from the report that the immigration status of those who have been rescued and entered the system is not held. I want to echo the point made by my hon. Friend the Member for North Down (Lady Hermon) about aftercare. If this information is not held, as indicated in the report, how can we be sure that those who have suffered from human trafficking are being looked after on their onward journey and not experiencing problems with settled status and potentially being deported?

I want to come to the specific point about the information that the report does and does not contain. Clearly, as it sets out, there were concerns, given the small number of individuals involved, that to disclose their immigration status could result in some of them being identified. That was the reason the Northern Ireland civil service did not want to go further in disclosing that information. That said, the hon. Lady raises an important point: the aftercare should be there.

I do not intend to speak for long because I follow a hugely comprehensive, detailed and valuable speech from the hon. Member for Congleton (Fiona Bruce). Many extremely detailed issues have been articulated in an excellent way. Although this has been a relatively short debate, with few speakers, it has certainly not lacked detail and substance, and I welcome that. A number of important questions have been asked and I look forward to the Government’s response.

First, let me offer huge congratulations to Lord Morrow and the team. In previous contributions, I have indicated my dismay and sorrow about the situation in Northern Ireland, which has experienced 1,000 days without a devolved Assembly, but when we reflect on this Act, we realise that we have something to celebrate in relation to our Northern Ireland Executive. The Executive and the Assembly have often been criticised, perhaps with some cause, but the Act is an excellent example of Northern Ireland’s leading the way. It took a lot of inspiration and hard work by those behind the scenes, who lobbied and received a warm and receptive response from Lord Morrow. That team helped him to produce a private Member’s Bill that was an innovative piece of legislation which has led the way not just in the United Kingdom, but globally.

I welcome the fact that over the last few days and weeks there has been a significant investigation of human trafficking. I understand that there have been a number of arrests. That is a welcome example of the success of the legislation and the action of the police, and I commend the teams in the police and other agencies who work so hard to identify and to try to stamp out the absolute scourge that is modern slavery.

The report is, of course, very specific. It relates to the support that is given to those who come forward, or who are suspected of being trafficked. I will not go into too much detail—I had a number of questions to ask, but many of them have already been asked by Members on both sides of the House—but I want to touch on a couple of technical issues.

The report focuses on section 18 of the Act, which provides assistance and support for adults during the process of determining whether a person is a victim of trafficking. That process is known as the national referral mechanism, or NRM. It specifies a period of 45 days. As has already been pointed out this evening, the legislation very much led the way. At that time, the 45-day period involved some flexibility, with the understanding that it might be sufficient, but this matter has moved on. I want to focus on that flexibility, and on what consideration the Government have given to extending it and adopting a more needs-based approach to support. I understand that they are engaged in ongoing discussions about the report and about the possibility of a 12-month period, which would certainly provide more flexibility. Important questions were posed in the original amendment which requested the report. We should analyse the experience in Northern Ireland up to this point.

I agree with other Members that, unfortunately, the report is somewhat scant in relation to the information. There is a bit of detail in there. I accept the Government’s view—there are small numbers involved—that we do not want people to be identifiable from that, but I feel that there would have been a way in which to provide a great deal more detail and analysis of the situation without contravening anything or compromising anyone. This legislation pertains to Northern Ireland, so it is worrying if the Department of Justice and other agencies in Northern Ireland do not hold or analyse that data.

There has been a huge drive in public policy making, including in Northern Ireland. Northern Ireland has been leading the way on evidence-based and outcomes-based accountability. Government policy making is very much at the heart of that, and I argue that the policy development work of Committees and this House should be also be based on evidence. We have the potential to collect and analyse that valuable data and to evolve, amend or change the law in accordance with our experience over the past three years. References to the data not being held are, therefore, worrying. There is an old adage in public policy making and Departments that what is not measured does not get done. If the data is not being measured, how are we evaluating and analysing information relating to the evolution and development of policy?

The Act broke new ground, in that there was an awareness that we would have to assess, improve and develop. That was discussed at the time. The Act is a really good example of innovative policy work and legislation breaking new ground and taking risks. I welcome that because it is important, but we must also carefully monitor and measure. The most worrying thing is what happens to those people when they move off the system. The Home Office arrangements mean that every MP has a case load of people and we liaise regularly with the Home Office. We know how stressful it can be to navigate the system, and if people are told that they have to leave and are at risk of being lifted at any time and are unsuccessful in getting the right to remain. People who have come through terrible experiences may face that situation, but we do not know because apparently that data is not held by the Department of Justice.

I can only imagine the terrible and unfortunate circumstances in which people who were trafficked found themselves in their countries of origin or perhaps in a country to which they travelled and from which they were trafficked onwards. I can only assume that at the heart of each of those individual stories is a very tragic and unfortunate set of circumstances, perhaps going right back to their childhood. It is deeply worrying to think that some of them are being sent back and about where they are being sent back to. I hope that that is not the case and that, with a little more analysis, the Minister will be able to confirm in due course that they have the necessary support, that they are able to stay and that they are being protected, because it is care for the human and those people who have been through such difficult circumstances that is at the heart of this compassionate legislation. There are a number of questions for the Minister to answer.

I also want to ask about the guidance. I have had the benefit of seeing Lord Duncan’s letter to Lord Morrow in response to a number of queries. I know that they have been answered, so perhaps that letter could be placed in the Library for the benefit of Members who have asked questions. Although a number of questions have been answered, it is important to get additional clarity, particularly on the guidance given on the extension and the discretion involved. I understand that there is a very small number of cases. The Government’s argument is that they are dealt with on a case-by-case basis and that there is absolute discretion. I fear, however, that that discretion is not necessarily operated fairly or consistently; it depends on who applies it. It would be helpful if transparent guidance could be set down so that Members and others, including victims and members of the public, can be assured about the circumstances in which support can be extended and that the right support mechanism is in place. Many Members across the House would like that additional information, to ensure that that support mechanism is in place for these very vulnerable people if, indeed, the current legislation is not operating as envisaged.

I rise as chair of the all-party parliamentary group for gambling-related harm. The Minister alluded to the fact that legislation in Northern Ireland fails to protect problem gamblers. For example, there is outdated regulation. He mentioned FOBTs and how the gambling companies so “willingly” reduced the stake to £2 from £100, but the law in Northern Ireland would be that the stake could be 25p, which is a considerable difference from what those companies have done out of the goodness of their heart. Online gambling is technically illegal in Northern Ireland, so the online gambling companies are advertising illegally and making vast profits illegally.

Given the Gambling Commission’s reluctance to challenge these companies to make sure that they pay for their misconduct in Northern Ireland, there is something amiss and we need to act to make sure that people in Northern Ireland get the same protections as those in the United Kingdom. Shockingly, no gambling-specific services are currently commissioned by the Northern Ireland Health and Social Care Board, as a result of which there are no data on the number of problem gamblers in Northern Ireland. We used such statistics very effectively in the United Kingdom when tackling the FOBT problems, so may we have some clarity on what more we can do to bring gambling legislation in Northern Ireland into line with that in the UK, so that we can protect gamblers?

I thank the hon. Lady for giving way, and I apologise to the hon. Member for Swansea East (Carolyn Harris). I thought she had given way, but it was clear from her demeanour that she had not.

I want to raise the particular problem in Northern Ireland, which is that online gambling and gambling appears to operate under the regulation of the Gambling Commission but if something goes wrong with that, there is no body to complain to. I am dealing with a case where there is an issue with online gambling. I have tried to make a complaint, but I have been told by the Department for Communities and by the Gambling Commission that they have no remit over it. I have been told that they make the regulations under which these sites operate, but if there is a breach of those regulations there is nobody to complain to and nobody to investigate that breach. Does the hon. Member for Congleton (Fiona Bruce) agree that that needs to be urgently addressed, given the scale of the issues in Northern Ireland?

I do; in fact, as I understand it the oversight in respect of gambling responsibilities in Northern Ireland is completely unco-ordinated. The report admits that licensing responsibilities currently rest with a mixture of

“the courts, district councils and the Department for Communities.”

That is unacceptable.

This brief report on gambling law and policy in Northern Ireland was a demoralising read. That is no reflection on the good and caring Minister who presented it, but early in his speech he recognised the fact that in Northern Ireland this policy area has been left behind compared with elsewhere. That leaves me with great sadness. The report was meant to outline progress on six specific, enumerated areas. For years, little progress, if any, has been made on this hugely important matter that so devastatingly affects people’s lives. I am always a little thoughtful—I will not use the word “suspicious”—when a response to questions that are enumerated fails to repeat the enumeration, as in this case. It is sad, because we know from what the Assembly has done on human trafficking, which we have just heard about, that innovative policy and legislation in Northern Ireland are possible.

We all know from the many debates and discussions in the Chamber on gambling about the huge damage that gambling addiction can cause. It can destroy individual lives. Children and families suffer. The flaws in gambling law and policy have been debated at length in this place. We have taken positive steps in the form of reducing the stake on fixed-odds betting terminals from £100 to £2, following widespread campaigning. I pay tribute to the hon. Member for Swansea East (Carolyn Harris) for her leadership in much of that campaigning.

We continue to debate and consider this issue. The all-party group for on gambling related harm is currently conducting an extensive inquiry—it has been going for several months—into the harms related to online gambling. We have looked into how we can increase the support provided on the NHS for those suffering from gambling addiction, and we have looked at how to increase the amount of money provided by betting companies to support those suffering from gambling addiction. Of course, we need to go further, and there is no room for complacency, but it is entirely evident from the report that the lack of progress in Northern Ireland must be causing real harm there—and that in a place where I understand gambling may be far worse than it is here.

So, what are some of the problems? As we have heard, the fact that gambling in Northern Ireland is still governed by an order, passed under direct rule, that dates back to 1985 is quite remarkable. That legislation predates the invention of the internet and widespread access to mobile phones, which have revolutionised how individuals gamble in the UK. It is no surprise to discover that the legislation struggles to cope with how the modern gambling industry operates. That is especially evident with regard to FOBTs and online gambling. I, too, have heard that there is no clarity as to whether FOBTs are even legal in Northern Ireland, and the report itself states that

“the legal position of these machines is unclear”.

I, too, have heard that there is a strong argument that they are in fact illegal in Northern Ireland because they do not meet the definition in the 1985 legislation that states how slot machines are supposed to work.

The Northern Ireland Department for Communities estimates that currently around 800 to 900 FOBTs are operating in Northern Ireland, although in January the main trade association, the Northern Ireland Turf Guardians Association, estimated that there were 620. The differential is of major concern. The fact that the Department can only provide an estimate highlights a major issue: an inadequate understanding of the extent of this form of gambling—a form that we have recognised does such damage and that has been referred to more than once as the crack cocaine of gambling. I welcome the fact that some betting shops have voluntarily reduced stakes for FOBTs in Northern Ireland, but the people of Northern Ireland should not have to rely on the good will of operators to determine the way that gambling operates in the Province. The fact is that only the main operators—not all providers—are operating a £2 maximum stake. Consumers are not being given the protection they need.

It is obvious that the law in Northern Ireland is not fit for purpose any more. Indeed, the report says that the order of 1985 has become increasingly outdated, has not kept pace with industry and technological changes and contains no provisions that relate to online gambling. It needs to change as it simply cannot cope with the reality of how individuals gamble today and the operation of the industry. It is not protecting consumers who are vulnerable to gambling addiction. It is in desperate need of reform.

Not only is the law clearly failing, but support for those suffering from gambling addiction is clearly completely inadequate in Northern Ireland. The report makes for especially stark reading in this area. It notes that

“there are no statutory codes of practice in Northern Ireland, nor is there any statutory or voluntary arrangement with the gambling industry requiring any contribution to funding support services for problem gambling.”

This in and of itself is a major concern as it appears that the gambling industry is simply operating on trust in Northern Ireland, unlike in Great Britain. Relying on the gambling industry, as the report says, to implement socially responsible measures is simply unacceptable.

In reading the report, we also discover that

“there are no gambling specific services commissioned by the Northern Ireland Health and Social Care Board”,

as we have heard,

“and therefore the Board does not hold data regarding the number of people who are seeking treatment for problem gambling.”

I am informed that, in fact, only one of the five health and social care trusts operating in Northern Ireland hold data on the number of individuals coming forward suffering from gambling addiction. Is it any wonder that the significance of this issue has not come to light when no data is collected about it centrally?

Before I conclude, may I recognise that it is positive that, as a result of some local authorities calling on betting providers to adopt that £2 stake in their area voluntarily, that is happening? However, as I have said, these arrangements are not backed up by the force of law. People can still walk into some betting shops in Northern Ireland and place a much higher stake than £2. However, I do want to pay tribute to the campaigning charity CARE, which has worked very effectively with local councillors in Northern Ireland to achieve these positive council resolutions.

In England, in a really welcome step forward, the current Government recently announced that the NHS would fund 14 clinics for individuals suffering from gambling addiction, with one focused on children and young people. In Northern Ireland, there is not a single clinic.

We then read in the report that the trade association contributes only £24,000 per year to one addiction service provider—the Dunlewey Centre. I must confess that, when I read that figure of £24,000, I thought that a couple of zeros were surely missing, but apparently not. This is a drop in the ocean in terms of what is necessary in a jurisdiction that, according to statistics that I have been given, has a problem gambling prevalence of 2.3% of all adults in Northern Ireland. That equates to 30,000 to 40,000 adults in Northern Ireland today. The only figure produced in this report of people who have been helped is just 82 users at the Dunlewey Centre. There appears to be less than £1 provided for each person who is experiencing problem gambling.

The situation with gambling in Northern Ireland is nothing less than tragic—I do not think that that is too strong a word to use to describe the current situation. It highlights yet another reason why the Northern Ireland Executive need to return. I believe in devolution. I want Northern Irish politicians, alongside others, to solve this problem. I appreciate the huge difficulties between the parties in Northern Ireland, but what this report highlights once again is how real people are suffering owing to the lack of governance in place.

Northern Ireland, as I have said, has a high rate of gambling prevalence. It is possibly as much as four times higher than in England, but it has virtually non-existent support for individuals suffering from problem gambling and legislation that is not fit for purpose. This has to change—real people and their families, particularly their children, are suffering because of this sorry situation which has been allowed to develop. I sincerely hope that the Northern Ireland parties can get the Executive back, so they can act in this matter as well as in so many others.

Thank you, Mr Deputy Speaker. Of course, as I have said, the hon. Lady—my hon. Friend—has a particular and well-known interest in this, but the Members who brought forward the legislation are not here, and I think that is a fair point to make. It is important for my constituents out there watching this event to understand who really cares about these issues, and to see that we are left to mop up the political issues that Members bring before us.

I am sorry to say to the Minister that this report on the Executive Formation Act and gambling is utterly irrelevant. It says that there is no work done in this area. In 2016, the Department of Health, and then the Department for Communities and Local Government, commissioned a report on the prevalence of gambling. They found that the levels of gambling in Northern Ireland were slightly higher—about 2% higher—than in England, about equal with Scotland, and slightly higher than in Wales. That is not mentioned in the report. It did not talk about those issues of prevalence. It was about setting down a measurement of where the issue of gambling rests. We should be targeting issues that it has identified, such as how we cope with problem gambling—the actual figures.

Facts are stubborn things. The facts were recorded by the Departments, and that should have been reflected in this report. I do not blame the Government for bringing forward an utterly irrelevant report. They were asked to commission a report in a fit of pique by some Members of this House, and now they have rushed into bringing forward a report that is irrelevant because it has not even dealt with some of the issues that exist.

The laws that pertain to gaming and gambling in Northern Ireland are already very different from those that obtain in the rest of the United Kingdom. Indeed, this matter, as Members across the House have rightly said, ought to be left to the Assembly unless we are prepared to introduce a root-and-branch change to all gaming and gambling legislation in Northern Ireland and make it identical to the rest the UK. Let us look at where things would then be different. For example, in English high streets we see four or five competing gambling companies running the same shops, neighbour to neighbour, on the same street, whereas in Northern Ireland we see maybe one gaming or gambling shop in a street, and then several streets away there might be another one.

I have heard Members of this House demanding that that sort of thing should happen in England. The fact is that it happens in Northern Ireland by agreement among the betting shop owners. There are, in effect, only about three major betting shop owners in Northern Ireland, and they have made that agreement among themselves. Yet that is not reflected in the report either. Would we like to import what has happened in Northern Ireland, which is a good thing, to the rest of the United Kingdom, or would we like to import what has happened in England and have numerous betting shops lined along street after street in Northern Ireland? I think that my constituents, and all my colleagues, would object to seeing their streets having loads of these shops. We do not have the prevalence of these shops that England has. We have no Sunday betting at all. In England, people can bet seven days a week. It is not possible to go into a betting shop in Northern Ireland on the Sabbath and bet; we have that restriction. Will we just import those regulations into Northern Ireland and change Northern Ireland’s culture? That would be crazy.

Although some aspects of the legislation in Northern Ireland are perhaps positive, many aspects require reform. Does my hon. Friend agree that, although there is no gambling in shops on Sundays, given the evolution of gambling—for example, online and through devices—the situation has moved on, but our laws have not, and we now need and are committed to bringing forward new, fit-for-purpose legislation?

Yes. I will come back to that point, because it is very important that we change the law in that way.

I turn to the matter of FOBTs. It has been said in the House tonight—wrongly—that people can walk into any gambling shop in Northern Ireland and place a £100 bet. They cannot. Betting on FOBTs is now the same by agreement in Northern Ireland as it is in England, with only up to a £2 stake. Whether we would like to see that stopped altogether is a completely separate matter. The fact is that Northern Ireland’s betting shops regulated themselves. They recognised that this was changing, and instead of waiting, as they could have, until the Northern Ireland Assembly came back and continuing to rake in the funds that FOBTs would have given them, they decided to self-regulate and impose that restriction themselves. It is therefore not possible for someone to walk into a betting shop and place those bets.

People can, however, walk into an illegal club and place bets on FOBTs. They can walk into a pub that should not have FOBTs and place those bets. Most of those pubs and clubs are run by paramilitary organisations, but is there any regulation or policing of those matters? I understand that when the betting shop owners ring up and report those illegal clubs, dens and vices, the police say, “That’s too much hassle for us. That could cause major problems. We don’t want to run into the paramilitaries on those particular issues.” That is where the real problem lies, and that is where we should be focusing our attention and pushing to ensure that those illegal activities are stamped out.

The major contribution that betting shops make to horse-racing in particular in Northern Ireland is very different from how horse-racing is regulated here on the mainland. Horse-racing is regulated through a completely different system. The only reason we have a racetrack—one functioning racetrack—now in Northern Ireland is that betting shops have to pay a levy. Every single shop that exists in Northern Ireland has to pay, I think, £1,600 per year to the company that runs the racetrack. If we regulate betting in Northern Ireland in the same way it is regulated in the rest of the United Kingdom, racing will come to an end in Northern Ireland. That is a fact of life. As the betting shops will tell you, people bet more on athletics, football and other things than they do on horse-racing. The betting shops subsidise the horse-racing industry in Northern Ireland, and that would go.

Those are the facts. People can make their own judgment on whether that is a good thing, but those matters need to be addressed, and they are not addressed through this report. If we bring things into line with the rest of the United Kingdom, those would be the impacts. The big issue is illegal gambling. That has to be addressed, and the sooner it is addressed, the better.

My hon. Friend the Member for Belfast South (Emma Little Pengelly) put her finger on the key point: we have a largely unregulated industry. It is done by voluntary agreement. It is run by 35-year-old legislation. That is completely and totally unacceptable, and it needs to be brought up to date. But there is only one place competent to bring it up to date. It is not this Chamber—look who is interested. Let us not kid ourselves. It is the Northern Ireland Assembly. That is why the Opposition Members who pressed the Government to legislate should have realised how big a mess they were creating, because they are not addressing the real issue. That 1985 legislation is so antiquated that only the Assembly is fit to grapple with it.

That is why we would like the Assembly to be encouraged. That is why I encourage the Minister, as I did in an earlier debate in the House, to call a meeting of the Assembly tomorrow at 10 am and see who turns up. My party will turn up in total and other parties will turn up, but I bet that not one Member from Sinn Féin will turn up, because they have the Government and this House over the barrel. They do not have to turn up, and that is where the real disgrace lies.

Nationally, as my hon. Friend intimated, the issue is online gaming. Someone drunk can pick up a phone and gamble away to their heart’s content. They can lose their wage by playing with one of these toys or a gaming machine all night. Someone drunk cannot go into a betting shop and cannot be served alcohol in a betting shop, but they can drink away and play on a phone. Where does the money go when they play on this? It goes to Spain and other parts of the world, and the Government reap no benefit from it whatsoever. Unless the Government grapple with this issue, the companies that run online gaming are going to make the most out of gambling, and the taxpayer and the tax collector are going to receive zero.

The report touches on one other absolutely crucial matter, which is that there is no support for people who require treatment. The hon. Member for Congleton (Fiona Bruce) touched on that. It is a disgrace that there is no assistance. The Government are quite happy to lift the levy from betting shops, but put that levy elsewhere. That money should go towards the treatment of people who are problem-gambling. I will leave those thoughts with you, Mr Deputy Speaker.

I, too, thank the Members here for making the effort to be present. The hon. Member for Swansea East (Carolyn Harris) is always here when a debate on gambling is taking place, and the hon. Member for Congleton (Fiona Bruce) never misses an occasion to comment on these issues. The fact that there may not be as many here tonight does not mean that it is of any less interest to the people in this House. It is important to put that on the record. Those of us who are here are here for a purpose, and we are here to have our voice heard.

I am very grateful for the report on gambling, which has been produced under section 3(11) of the Northern Ireland (Executive Formation etc) Act. The report proves to be a sobering read about the state of the law on gambling, and the support provided for those suffering from gambling addiction.

I have had the pleasure of being with Peter and Sadie Keogh, who are working with a newly formed charity, Gambling with Lives. They were in Westminster earlier this year. I have known them for some time, and I have met them in my office. They are not my constituents; both Pete and Sadie are from Fermanagh in Northern Ireland. Their son Lewis tragically took his own life after a battle with gambling addiction. Therefore, their story is of critical importance. Their experience really brought home to me the dreadful reality of gambling addiction: the damage it can do to individuals and families. They have become diligent campaigners on this issue, seeking to help to ensure that others do not go through the experience they, sadly, went through.

I had the pleasure to attend that event to raise awareness. Does my hon. Friend agree that what was really striking was what a slippery slope there is? It very often started with very young people getting access inappropriately to these sites—it is a bit of fun to put £1 on here and £2 on there—and it really consumed their lives and ended up taking their lives in the most tragic of circumstances. Does my hon. Friend agree that we also need to look at how we protect young people with access to social media and the internet—virtually without regulation—from being sucked into these types of initiative?

The Minister agrees very clearly that those issues also need to be dealt with.

People cannot read the report and not realise that we have a significant problem in this area in Northern Ireland, but the past is the past, and there have been various reasons why gambling legislation and the policy have not been updated. We are where we are, and it is evident to me that change is badly needed.

According to the research published in 2017 by the Department for Communities, Northern Ireland has the highest problem gambling prevalence rate in the United Kingdom: 2.3% of the adults surveyed were deemed to be problem gamblers. This equates to some 30,000 to 40,000 adults in Northern Ireland, and it is proportionally over four times the rate in England, which at the time stood at 0.5%. As the Minister in the other place put it, the situation with problem gambling in Northern Ireland is “extraordinary”. What an understatement that word is when we look at the magnitude of the addiction.

I understand that we have no data on the number of children and young people who are addicted to gambling in Northern Ireland, but according to CARE—Christian Action Research and Education—if the figure is equivalent to what it is in Great Britain, according to Gambling Commission research, it would equate to about 2,360 children —the very point mentioned by my hon. Friend the Member for Belfast South (Emma Little Pengelly). Again, facts are facts. Northern Ireland is in a serious place, and that cannot be ignored. Each of those individuals matters. Those adults and young people have families, and they come from the different communities in Northern Ireland. Gambling addiction can wreak havoc on their lives at enormous cost. Despite the significant problem we have, we discover that no figures are collected by the Northern Ireland Health and Social Care Board on the number of individuals seeking help for problem gambling. Only one health and social care trust, the Southern Trust, collects data on the numbers seeking help in its area. Maybe it is time that other trusts did the same.

In addition, England has 14 NHS clinics for adults and children suffering from problem gambling, but Northern Ireland does not have even one. It is time that that was addressed. The Northern Ireland Health and Social Care Board does not commission any gambling addiction-specific services. It should, indeed must, because of the addiction levels in Northern Ireland, and perhaps the Minister could respond on that point.

In addition to the dearth of support coming from the agencies of the state in Northern Ireland, we also discover from the report that the Northern Ireland Turf Guardians Association provides only £24,000 in support to Dunlewey, which provides support for individuals suffering from problem gambling. That strikes me as a very low figure considering the enormous profits being made by the gambling industry. It is time to shake the sector’s tree and get the gambling industry’s hands out of its pockets.

I was very glad to hear that five of the biggest gambling operators in the UK have committed to providing £100 million over four years to support individuals suffering from problem gambling and for research in this area. I welcome those steps, which are good news, but I would like to ask the Minister several questions. I gave his parliamentary private secretary a copy of my questions in advance. I do not expect the Minister to have all the answers to hand, but I would like responses to my questions at some point in the future. Considering the fact that a number of those operators provide services in Northern Ireland, will any of that money come to us? We should have the benefit of it, because from what we read in the report it could really help to make a difference.

I had the privilege of playing a role in seeing an option for online gamblers to have a one-stop shop for exclusion from all gambling websites, through the new GamStop service. We debated the need for that five years ago during the passage of the Gambling (Licensing and Advertising) Act 2014. Given the increasing importance of the online gambling sector, now nearly 40% of the market, the need has become more acute. The Gambling Commission said that GamStop would be in place by spring of 2018. Some 18 months later, it is not yet fully launched. I am never critical of the Minister, as he knows, but I have to ask him what is going on. Despite reports last week suggesting that the roll-out of the scheme across the UK, with all gambling companies being required to sign up to GamStop, would take place in a matter of days, a Gambling Commission spokesman subsequently suggested that that reporting was inaccurate. Some clarity is needed on whether it is in place, when it will be in place and when it will be in action. I understand that as of last Friday over 97,000 people had signed up.

I commend the work of GamStop and the fact that it will be available in Northern Ireland. I hope that the Minister will indulge me in asking a series of questions. Can he tell us when GamStop is expected to be launched nationally? How will GamStop keep track of whether people in Northern Ireland sign up and whether the numbers are in line with expectations? If not, is it not time to set targets? How will people in Northern Ireland be informed of GamStop when it is finally launched?

That brings me to the concerning lack of regulation for online gambling in Northern Ireland. At the time of the 1985 order, the internet did not exist. Today, most of us cannot imagine life without the internet, but the regulatory framework in Northern Ireland completely ignores it. It is unbelievable that, as online gambling has come in, we have not moved on and responded to what is happening in modern society. That does not mean that online gambling is unavailable—far from it—but it means that it is available without regulation of any sort, and that worries me greatly.

The exception is section 5 of the Gambling (Licensing and Advertising) Act 2014, which makes it an offence to advertise unlicensed remote gambling in Northern Ireland. That means that only an organisation that holds a remote gambling licence with the GB Gambling Commission can advertise in Northern Ireland without committing an offence. We were told that:

“As a result, consumers here can be assured that they will continue to have the same protection as consumers in GB from the advertising of remote gambling.”

I hope the Minister will be able to assure us that section 5 has been effective and that there are no unlicensed operators advertising in Northern Ireland. I hope he can respond positively and, if not, I know that he will respond with the truth, as he always does. I appreciate that.

Could the Minister please tell the House how many times section 5 has been used against unlicensed remote operators? Again, I would be interested to know whether it has ever been used at all; I would certainly like to think that it has. The reassurance given previously related only to protections on advertising, but, given the lack of regulation in Northern Ireland, is anybody checking? If they are not, they should be. Tell us, Minister, who is going to check it? Who is going to make sure it is happening? Does the Gambling Commission review whether the advertising protections are the same as for consumers in the rest of the UK? Are we in Northern Ireland following those on the mainland? Maybe we are not. Maybe the Minister can tell us where we are.

It is not clear whether those licensed operators who legally advertise in Northern Ireland consider that they have any responsibilities to the people of Northern Ireland or whether they are required to provide all the responsible gambling protections to Northern Ireland gamblers that they are required to provide to gamblers in other parts of GB under the Gambling Commission’s licence conditions. Are there two rules? What is happening?

For instance, in the rest of GB operators need to conduct age verification of anyone wanting to gamble, and are required to promote self-exclusion and to have policies and procedures for customer interaction where an operator has concerns that a customer’s behaviour might indicate problem gambling, as they should.

Does my hon. Friend agree that this is at the heart of the difficulty in Northern Ireland, particularly for young people? These online websites advertise around sport, which many young people watch, but if they do not carry out that verification or do what they are obliged to do in Great Britain in Northern Ireland, there is no mechanism to investigate that breach. The Gambling Commission has no remit in Northern Ireland, and, as far as I can ascertain, there is no body to investigate any breaches of those regulations.

I thank my hon. Friend and colleague for that intervention. I believe that that is the case, which is why we are looking to the Minister to see what we are going to do about it. If we do not have the legislation in Northern Ireland that we should, as the hon. Members for Swansea East and for Congleton want and, I believe, every person in this House wants, let us get it in order.

The gambling report we are discussing today cites Northern Ireland industry groups “implementing social responsibility measures” and

“adhering to industry codes of practice and protocols”

to protect people who might be experiencing problem gambling. Again, that is a commitment in words if not in deed.

I have five questions for the Minister, and I have asked him some already. Will the Minister clarify whether these are voluntary measures for the industry, which would at the minimum be welcome, or, where we are talking about online gambling, they are a requirement of a Gambling Commission remote operating licence? If it is only the former, I would be grateful if he can be clear about the protections that Northern Ireland online gamblers receive as a result of section 5. What redress do individuals have if they feel they have been mistreated by the online betting companies but live in Northern Ireland? If there are player protections for online gamblers in Northern Ireland under the licensing conditions, are these clear to individuals who may need them? It is important that these questions are asked, and I ask them respectfully of the Minister. My constituents have asked me them, and they see possible legislation that does not do what it should or go as far as it should, as my hon. Friend the Member for Belfast South mentioned.

Much needs to be done to bring Northern Ireland legislation into the 21st century. Bring it forward from 1985—wow!—to today. I welcome the news reported in today’s Belfast Telegraph that the Department for Communities is planning to hold a fresh consultation on gambling law and policy in the near future. I wish the near future was this week or next month—this cannot happen soon enough. I should like to hear greater detail of what the Minister in the other place described as a “high-level strategic review”. What does that mean? Both steps are helpful. Where there is good work done, let us welcome it, and where there is other work that needs to be done, let us ask for it. Of course, we need a Minister in place to execute policy change.

I hope that the Executive and the Assembly will get back up and running, so that they can tackle this important issue. Consumers need to be clear about the law and the help and support they can receive in their communities from betting companies. Whenever I think of Peter and Sadie Keogh from Fermanagh, their lost son and the many others like them, I think we need legislation not tomorrow but today. Although it will not bring the Keoghs’ son back, they and others like them are very worried about gambling in Northern Ireland. Hopefully, I have given the Minister much food for thought and many questions to answer. I know that he is well up to answering those questions. The people of Northern Ireland want to see gambling legislation in place that actually works and controls the online gambling that we are all really concerned about. It cannot happen soon enough.
