The hon. Lady raised that issue with me earlier today. I spoke to her three days ago about this review. I am on it, but as I said, I want to ensure that I balance the need to ensure that public expenditure is reduced with the fact that I want the Assembly up and running. I am not going to stand here and accept the premise that this Assembly and Executive cannot get up and running.

As I mentioned in Northern Ireland questions today, many of our MLAs are doing a fantastic job through their offices. It is important that we keep that representation for the general public.

It is indeed. There is so much more that they could do if they were in the Assembly, and we need to hang on to that over the coming weeks.

If Royal Assent is not granted by the end of October or as soon as possible thereafter, there is a risk that the Northern Ireland civil service will assess that the only way to continue to deliver public services in Northern Ireland is by exercising emergency powers under section 59 of the Northern Ireland Act 1998. Using those emergency powers would constrain the Northern Ireland civil service to spending 95% of the previous year’s budget, effectively delivering a significant real-terms cut to the funding of public services. Northern Ireland Departments would have to consider their current budget allocation against their identified priorities and their available cash, which could put at risk essential services such as those within the health service.

I thought that by implication I had covered that point. The likelihood is that anyone before the law would be able to lay claim to the statute, but the reality is that what my hon. Friend calls the other side—with their letters of comfort, among other things—are the last people who need to be worried about the present situation. We must not get hung up on the terminology. The people we have to protect are those where the records exist, but to whom letters of comfort have not been given—our armed forces veterans.

The right hon. Gentleman has made a good point about the letters of comfort. I have to say that the letters of comfort were given to republicans, but those who put on the uniform of the Crown forces are being pursued for doing their duty.

That confirms the very point that I was making, and it is why the main purpose of the amendment, although arguably it might be cited by people who are unlikely to be prosecuted, is to protect our service personnel, security forces and so on.

I would like to end—I really will end—by saying that I was encouraged in a debate in Westminster Hall on 20 May this year by the response of the Minister of State to points of the sort that I have made today. He said that I had

“mentioned the Nelson Mandela approach; I will come back to that point, because it is central to any potential action and solution”.

He said that a solution

“must allow not only the victims and the veterans, but the whole society in Northern Ireland, to draw a line.”

He said:

“There is not an exact comparison between Northern Ireland, which is a unique place, and South Africa, but there are many parallels. We must find some way of creating an approach that will allow people to get closure, truth and justice.”—[Official Report, 20 May 2019; Vol. 660, c. 248-250.]

That is what my amendment seeks to do, and I look forward to the Minister’s response.

I shall come on to exactly that point, but let me continue with this question of a hard border across the island of Ireland and the question of crashing out. The reality is that we know as well that there is not simply a threat around terrorism with that hard border, but there is also a massive threat to the economy of Northern Ireland and the movement of goods, including agricultural goods and manufactured goods, which is why the business community and the farmers union in Northern Ireland are both absolutely consistent in their view that that would be massively damaging to the Northern Ireland economy.

But there is a separate issue that the Good Friday agreement involves, and it is very different in the Northern Ireland context from anywhere else in the United Kingdom: the whole question of identity. Identity matters in the Northern Irish context: identity and respect for people’s different identities is the heart and soul of the Good Friday agreement, and we simply cannot allow that to be damaged by crashing out of the European Union—a crash-out Brexit.

That is not a difficult question to answer. The European Union would insist on a border across the island of Ireland. There is no doubt about that. There can be no question of Northern Ireland acting as some kind of back door for smugglers. I am old enough to remember the days when gates were left open on the border and cattle would wander across, by morning and night. Those days have not entirely gone, and we know that smuggling still takes place between Ireland and Northern Ireland, but the European Union would not allow the institutionalisation of any facility that made the smugglers’ lives easier.

The hon. Gentleman may very well be convinced.

I am also certain that, even if we were to prevail and that precious Union were to be maintained, it would open yet again, and one could not refuse it, a request for a second independence referendum in Scotland. I am saddened to say it, but I do not want to wake up to find myself a subject of the United Kingdom of England and Wales.

Does the hon. Gentleman accept that if this mythical hard border were put in place, the Republic of Ireland would be the biggest loser? The leadership of the Republic of Ireland knows that its economy would go down the tubes.

To my mind, it is extraordinary that the Prime Minister failed to avoid alienating the DUP in the position she adopted on Brexit. I would have thought it would be her top priority in the discussions. What clearly happened was a trust issue as much as a substance issue, in that things were said in private about the Government’s position on Brexit and the opposite in public.

On the specific issue the hon. Gentleman raised, I am sorry but I do not withdraw my contention that since 2010 the fact that the Government have been dependent on the DUP to govern, unofficially between 2010 and 2015 and officially since then, has understandably made that Government, at a prime ministerial level and possibly at a Secretary of State level, unwilling to exercise the kind of pressure for compromise that was exercised in the past. That is just a statement of fact. The progress in Northern Ireland was largely a consequence of the honest broker role that the Government in the south and the Government in Westminster played during that period, and the change in that dynamic here has undoubtedly had an impact.

A change in dynamic has made a difference in the south as well. In the south, Sinn Féin is now a serious political challenger to the two leading parties. This inevitably changes the nature of the relationship and inhibits the trust between the Government in the south and Sinn Féin that has been so important to progress in the past. It is not credible to deny that those massive changes in political dynamic have had an impact on the ability to get the parties to compromise.

I have enough problems expressing opinions on the state of politics in the UK without intruding on private grief in the south of Ireland. I am not really qualified to judge. I would say this to the hon. Gentleman though. There is no doubt that a massive factor in Sinn Féin’s unwillingness to participate in government in Northern Ireland is its unwillingness to make tough and difficult decisions because in the south of Ireland it wants to give the impression that such decisions are not required. If it participated in government in the north of Ireland, it would have to be part of making such difficult decisions.

We must have confidence in the police and the judiciary in Northern Ireland, and it is for Stormont to reform those institutions if they are not serving Northern Ireland well. I certainly hope—I hope hon. Members will join me in this—that Stormont will function fully again in the future.

That said, none of us wants former or current members of the armed forces to be treated unfairly when accusations of wrongdoing are made. I hope that we all support the idea of justice being done, and that includes fairness to our armed forces personnel, who are entitled to due process in answering allegations made.

Our armed forces have our gratitude for defending us and our values in traumatic and highly stressful situations. The then Prime Minister David Cameron made a statement to the House on 15 June 2010, the day the Saville report was published. He said that

“the conclusions of this report are absolutely clear: there is no doubt; there is nothing equivocal; there are no ambiguities. What happened on Bloody Sunday was both unjustified and unjustifiable. It was wrong.” —[Official Report, 15 June 2010; Vol. 511, c. 739.]

The hon. Member for Beckenham (Bob Stewart) talked about the yellow card—he has his yellow card here—and about the rules of engagement that had to be adhered to during any conflict. However, Prime Minister Cameron went on to quote the report’s finding that

“none of the casualties shot by soldiers of Support Company was armed with a firearm…in no case was any warning given before soldiers opened fire.”

I accept that there will be different views about whether some Departments are using those powers to their full extent and others are not. To coin the phrase used by the hon. Member for Ealing North (Stephen Pound), who spoke for the Labour party, we are being asked to tread down a primrose path in saying that this particular part of the Northern Ireland civil service is using those powers to its full extent and this one is not. Ultimately, this has to be something that is decided, led and ultimately arbitrated by the devolved Assembly and devolved Ministers. All of us feel this frustration, but it is becoming a rather circular argument if we say that we should be trying to push them one way or the other. We have to set those rules, but ultimately, if people are not happy with the way that they are being applied, provided that they are being used within the rules of the law that we have set in the EFEF Act it is then up to the Northern Ireland Assembly. I am afraid that it is as fundamental, as simple and as difficult a truth as that. The only answer is for the Northern Ireland Assembly to come back.

The Minister has said a number of times that he shares the frustration of what my colleagues have said tonight, but why will the Government not go ahead and call the Assembly? Those who turn up can get it moving and working for the people of Northern Ireland—why will the Government not do that?

I bring the hon. Gentleman good news. My colleague the Secretary of State has many, many talents and powers but one of them is not to “call the Assembly”, to use this sort of portentous phrase, which a number of us have been using so far this evening. In fact, the Assembly is still legally in existence. If MLAs want to turn up tomorrow, or perhaps the day after tomorrow, given the sad and tragic events that are happening tomorrow, nobody needs to call them to do so. They have a legal right to turn up, open the doors and do so. When they do turn up, they will be entitled to select a Speaker and then choose a First Minister and Deputy First Minister. It does not require the Secretary of State to call them. We have heard several calls this evening for a trial to see whether people would turn up and do that. If MLAs from any side of the community and from any political party are so minded, they can do that. I will leave it up them, of course, as directly locally elected politicians, to decide if they wish to do that, but they are legally entitled to do so.

I do not want to detain the House any longer. I am conscious of the passage of time.

You are probably not aware, Mr Speaker, that I managed to offend the hon. Gentleman in the Tea Room earlier, so I will point out that you allowed youth to win on this occasion.

Of course I have met all the party leaders and all the main parties in Northern Ireland. I do believe that there is a willingness to see devolution restored, and I want to see that at the earliest opportunity.

I treasure the thought of being able to speak until five to six—I know you did not say that, Mr Owen—but I am not going to do that today. I will be careful with my comments in the light of that advice.

I thank my right hon. Friend the Member for Lagan Valley (Sir Jeffrey M. Donaldson) for presenting a good case, as he always does, and the hon. Member for Beckenham (Bob Stewart) for putting the case as well. I also thank the Speaker’s Office for giving us the opportunity to highlight the issues in Westminster Hall. My right hon. Friend the Member for Lagan Valley and I are not just colleagues but good friends, and I also have an interest in the issues that he talks about. We always listen to his comments, which are well put.

My comments come from a personal perspective. In recognition of my role as an elected representative of the people of Strangford, I fully support what my right hon. Friend has put forward. As well as being the most beautiful constituency in the world—I have to say that, but I say it honestly—Strangford is home to a large number of veterans of the armed forces, the Royal Ulster Constabulary and now the Police Service of Northern Ireland, as well as prison officers and other service personnel.

My constituency has a tradition of service and I am always pleased to represent it. It is a wonderful place to retire, and historically, it has been viewed as a safe place in terms of the troubles for serving and retired personnel to live. For that reason, I am confident that I speak on my constituents’ behalf when I say that the role that has been played by the police ombudsman when it comes to legacy issues is simply not acceptable, and that the direction of his office must be quickly and completely changed. My right hon. Friend outlined that in an exceptional way.

Just over 17 months ago, I joined my hon. Friends and other right-thinking people in calling for the reconsideration of Dr Maguire’s position as the Police Ombudsman for Northern Ireland. That is on record. I also join my right hon. Friend the Member for Lagan Valley in condemning the despicable murders that took place at Loughinisland. Those responsible, whoever and wherever, need to be held accountable for their actions.

My hon. Friend knows that some of us in this House had loved ones and families who served in the Royal Ulster Constabulary and were butchered by the provos. Those families have never had justice. The people who committed the murders have never been brought to justice. It is disgraceful and totally wrong that the ombudsman is treating certain cases in a certain way—he should be impartial. Everybody is equal under the law. It is hurtful for those of us who have lost family members who served, and it is hurtful for those families who have to relive it.

Along with my hon. Friend and others, I would be concerned if any landmark reports that are available to the general public, or in the public domain, should in any way throw any slight on the determination of police. I believe that would exceed the ombudsman’s statutory powers.

Will the Minister acknowledge that the lack in re-establishing the Assembly is not down to this party? This party does not have red lines; one party is causing the difficulty, and that is Sinn Féin. Will the Minister acknowledge that?

I will quote the Labour party spokesman, who said yesterday that the existence of preconditions or red lines was frequently a facet of talks processes. The point is to get a process that allows us to overcome those preconditions. If we allow ourselves to be sidetracked in the first place by their existence, we will never get anywhere towards succeeding.

I do not want to provide a running commentary on the talks I have had with parties since the talks broke down in February between the two main parties. What I would say is that I have heard a willingness from parties that they want to get back into Government. That is why I believe that the best thing for the people of Northern Ireland is that we give those parties the chance to get back into devolved Government and provide the best conditions to enable that to happen—and the Bill is part of achieving that. It is important that we use this time and the powers in the Bill to ensure that public services continue to be run and there is no distraction from the parties coming back together and forming a Government.

As one of two former Northern Ireland Ministers on the Government Benches, let me say that I know how difficult the ministerial team has found it to get to this position with the Bill. The Bill is far from perfect, and it is very easy for us on the Government Back Benches—and for those on other Benches, and for the shadow Secretary of State and the shadow Minister—to tell everybody what should have happened. It would be very easy to criticise—and there was a bit of criticism from the shadow Secretary of State—but the Secretary of State is dancing on the head of a pin, because without a devolved Administration in Northern Ireland, the whole area around the Northern Ireland agreement is in a difficult position.

Nobody in this House—nobody who really understands the Northern Ireland political position—would dream of having a situation in which civil servants were empowered by the Bill to progress things in a way that people in any other part of the United Kingdom would find completely undemocratic, and that would never be passed by this House. To perhaps not dance on the head of a pin, this is as close as we will get to direct rule without direct rule.

Some of the political persuasions in Northern Ireland want that to happen. They want crisis. For their own political beliefs, mostly around a united Ireland, they want to make the whole thing collapse. We are very close to that. We cannot have a situation in which the Province is brought to its knees because one group of people want one thing and another group cannot accept that.

That intervention is spot on, in many ways. It cannot be on one group’s terms. The Good Friday agreement is specific that it must involve the groups coming together.

In the time I was a Northern Ireland Minister, I met people from all parts of the Province, from all political persuasions and faiths, many of them together in the boxing rings and around rugby. Not once was the Irish language raised with me during my time in the Province. It may have been raised with the Secretary of State, but it certainly was not raised with me. Myriad things were raised, including the difficult situation of the historical investigations, the health service, bridges, roads and lack of infrastructure—all being blocked because one group in the Assembly had a veto. I like to use the word “veto” because I think the public understand it better. To me, that is fundamentally wrong.

We have to ask today whether Sinn Féin want to be part of the process. If not, they should come out and say so. If they do not want the Assembly, Administration and Ministers in place, they should say so. If they do want the Assembly to sit—although it is difficult to see how it could, considering the previous comments by Sinn Féin’s political leaders—they should get into the room, sit down at the table and thrash it out like their predecessors did.

I dealt with the late Martin McGuinness. I never thought that I would get on with him. We were miles apart politically, but he was actually quite pragmatic. He wanted better things for his community—like some of the parties in the House who do not want to be part of the United Kingdom, but come here, thrash things out and are part of it. That is why I have always found the fact that Sinn Féin does not come here, take part and argue its case fundamentally wrong and undemocratic to its constituents.

I rise, rather reluctantly, to speak in this debate. We can all agree that, although it is sadly all too necessary, this budget debate should not be taking place in this House, and certainly that these matters should not be determined by politicians from Scotland, England and Wales. My sympathy is with the people of Northern Ireland who, in being denied their own devolved Assembly, have been let down by many of their representatives and the inaction of the UK Government.

The situation in Northern Ireland is not sustainable, as Friday’s court ruling over the proposed incinerator near Newtownabbey highlighted. In the continued absence of any Ministers, planning permission for the project was issued by a civil servant—a decision that, as we have heard, was overturned by the High Court, which found the incinerator to have been unlawfully authorised. I offer no opinion as to the rights and wrongs of the project, but the ruling is significant and underlines the need to re-establish the power-sharing Executive. The ruling affects today’s Bill because spending can only go ahead on decisions made by previous Executives. Failing that, these decisions have to be made by the Secretary of State, only confirming the state of direct rule.

During this moment, we need calm heads and something that has been sadly lacking in this situation: leadership from the UK Government. We need action now to address this stalemate. It has been 18 months since the people of Northern Ireland had the representation they are entitled to and, indeed, voted for. It is not appropriate that day-to-day decisions affecting communities right across Northern Ireland are being made in Whitehall, rather than in the elected Assembly in Stormont, but we are where we are. The people of Northern Ireland have been let down by some of their politicians, but we have zero desire to see them suffer unfunded public services too, so we will support the Bill in order to allow public services in Northern Ireland to continue without interruption.

The lack of progress to restore the Assembly is extremely frustrating. I hope that the politicians in Northern Ireland can find the strength and desire to get back around the negotiating table, find areas of compromise and work together to ensure that, as my hon. Friend the Member for Edinburgh North and Leith (Deidre Brock) hoped the last time Northern Irish budget matters were dealt with, this will be the last time that we in this place are forced to debate and agree issues that should be debated and agreed at Stormont. I should at this point thank my hon. Friend for the great work she has done in this role for the last three years. I am sure that I will be seeking her advice regularly in the coming weeks and months.

The UK Government have to accept responsibility for their failure to restore the devolved institution. I understand that there may have been other important issues for all Departments to prepare for—indeed for the Government themselves to disintegrate over—but the UK Government have failed and continue to fail the people of Northern Ireland. As a result of this inaction, not only have we had 18 months without an Assembly and Executive; we have had five months without any talks taking place.

The hon. Gentleman said earlier that the lack of an Executive was a failure of political representation in Northern Ireland. Would he accept that the DUP has set no red lines for going back into an Executive, but that Sinn Féin has ruled it out? Will he acknowledge that Sinn Féin is the road block here?

I will not be drawn into that argument. It takes both sides to get around the table and agree a way forward.

I hope that during her Third Reading speech the Secretary of State will outline what recent work has been carried out to bring the parties back round the table and what is preventing this from happening. Can she confirm that all the main parties in Northern Ireland have not only viewed the budget but been consulted on it and had their suggestions taken on board?

I want to comment on the necessity to fast-track this important Bill. We have not had an Executive in place since January 2017, so why could the UK Government not have taken the proper time to prepare for this budget? The explanatory notes state that the Northern Ireland Affairs Committee was not given the opportunity to scrutinise the Bill in draft. In addition, even though the budget has been discussed with political parties and businesses, it is unclear if the Secretary of State consulted civil society and trade unions. Over the last few weeks, the Government have shown they lack respect for Scottish devolution with a power grab that ignores the overwhelming vote in the Scottish Parliament. Their failure on this issue of crucial importance to Northern Ireland just proves that they do not care enough about devolution in any part of the UK.

As we debate this budget, it is hard not to notice the elephant in the room: the £1.5 billion survival money the Tories have given to Northern Ireland—care of the DUP—to keep the Prime Minister in 10 Downing Street. Given the current state of affairs and developments today, it could be time for a renegotiation. We have never opposed the funding that was provided to Northern Ireland, but it is completely unacceptable that it was not Barnettised, meaning that Scotland lost out on nearly £3 billion of additional funding.

One of the Secretary of State’s clear difficulties is with other parties having the confidence to engage with her, given her party’s relationship with the DUP. The DUP could bring the Government down on a number of votes. They have huge power and influence over the Government, and the Secretary of State, with all that going on, has to act as an independent partner in this process. That is difficult when their very survival rests with 10 DUP MPs who have called for direct rule. On Third Reading, therefore, I would be keen to hear what discussions she has had with the other parties on this issue and whether she believes that they have confidence and trust in the UK Government to act as an independent mediator that can help to restore the Assembly and Executive.

As I have said, this is a sorry situation. This will be the third Bill to allocate resources to Northern Ireland to be approved by politicians who should have no role in this process.
