Commons ChamberIt is a pleasure to see my right hon. Friend the Member for Ashton-under-Lyne (Angela Rayner) in her rightful place as Deputy Prime Minister. It is also a pleasure to speak in this first King’s Speech under a focused and mission-led Labour Government. I wish to record my thanks to the constituents of Southgate and Wood Green for putting their faith in me to represent them as the first Member of Parliament for this newly configured constituency.
The legislative programme in the King’s Speech shows that the Government are determined to get cracking with the legislation needed for a long-term national renewal, and nowhere more so than in housing. The shortage of both private and social housing is a huge problem across the country. Families and children often wait for years in temporary accommodation that may no longer be suitable, and many young people are unable to afford a deposit on a new home whose price has far outstripped earnings in recent years. They are forced either to stay at home with their parents, or to live in precarious shared accommodation. Another scandal is the high level of no-fault evictions, which is adding to the pressures on local authorities to house homeless people. It is for those reasons that I welcome the proposed renters reform Bill, which will abolish section 21 no-fault evictions and strengthen tenants’ protections and rights to challenge rent increases, among other things.
I also welcome the proposed planning and infrastructure Bill, as we need to get on with house building so that people do not have their lives put on hold because of unaffordability. We need to build more houses in the right places, and ensure that there is no adverse impact on local services and that the design and specification are to a high standard. The types of houses built should conform with the needs of the local community, with more family-sized houses needed urgently. We also need more council houses. I applaud the efforts of Enfield and Haringey councils in building more council houses in my constituency, but more needs to be done. I encourage the Government to support councils in any way they can so that more council houses are built. To build more houses, we need a highly skilled local workforce, which is why I welcome the measures in the proposed Skills England Bill, which will identify national and local skills needs and ensure that they are being met.
I turn now to other elements of the King’s Speech. We all need to ensure that our communities are safe, which is why I welcome the measures in the proposed crime and policing Bill, which will give the police and law enforcement new powers to tackle antisocial behaviour and retail crime, focusing on attacks on shop workers and low-level shoplifting. Small and medium-sized local businesses, which are the lifeblood of our local high streets, are now seriously impacted by even low-level crime, so we need to make sure that they are supported and that law enforcement takes seriously all reported retail crime.
Knife crime has a terrible, devastating effect on the lives of victims’ families and friends, and I find it shocking and sad that the perpetrators are often the same age as the victims. That is why I am pleased to see that tougher sanctions will be introduced to ban ninja swords and other lethal blades, while tackling the gangs who exploit children for criminal purposes. It is also good to see that there will be support for teenagers at risk of being drawn into crime.
On a personal level, I am delighted to see that the tobacco and vapes Bill will be reintroduced in this Parliament. I had the privilege of serving on the Bill Committee earlier this year, and there is cross-party support and unity on progressively banning the sale of tobacco products forever. It was a joy to see the UK become a world leader in this area of public health, and I put on record my thanks to my hon. Friend the Member for Birmingham Edgbaston (Preet Kaur Gill) and Dame Andrea Leadsom for the excellent bipartisan work that they did to progress the Bill before it fell as a result of the general election being called. I sincerely hope that it progresses to Royal Assent this time.
The final Bill I wish to comment on is the draft equality (race and disability) Bill, which will enshrine in law the full right to equal pay for ethnic minorities and disabled people, and introduce mandatory ethnicity and disability pay reporting for larger companies. I sincerely hope that where there is any disparity, employers take the appropriate action to address their failings and close the gap.
The King’s Speech is an exciting beginning for the Labour Government, who are keen to make a real difference to people’s lives, including those of my constituents in Southgate and Wood Green. The starting gun for national renewal has been fired, and we have got off to a flying start. I hope that the pace of change continues and that we see positive, long-lasting benefits in housing, community safety, health and equality for all.

Commons ChamberIt is not unusual for the annual fishing negotiations to go into January. This year, there has obviously been the very special circumstance that the withdrawal agreement came late, but in 2014 access was suspended while negotiations with Norway continued through January. We would anticipate that these negotiations would conclude within the next couple of weeks, and then access for Arctic cod, should that be agreed, could be resumed.
We have engaged extensively with industry to support trader readiness for new requirements for exporting to the EU. For those importing to the UK, we established a phased approach to border controls for the first period of 2021. We have supported exporters as they familiarise themselves with new processes around export health certificates and customs declarations, and we have liaised closely with EU states, such as France, that are also getting used to new processes at the border. Finally, we have worked closely with ministerial colleagues in the Department for Transport to ensure the rapid deployment of the covid-19 testing measures required by France.
Further to that, may I ask the Secretary of State what measures the Government are taking to prevent more border disruption and costly delays for food and drink exporters when the volumes of trade start to pick up again in the coming weeks? What assessment has he made of the impact on jobs if there are delays and disruption at the border?
The sector that has had greatest difficulty in these first few weeks has been the fishing sector, principally because it is a very time-critical, perishable product, but there are also some smaller businesses selling smaller consignments in mixed, grouped loads. Overall, the system is working well. We are issuing around 150 export health certificates per day. The volume of lorries through the short straits is back up to around 6,000 to 7,000 per day—still some way short of normal levels, but nevertheless it continues to grow.

Every year, animal welfare charities such as Battersea Dogs & Cats Home, the Royal Society for the Prevention of Cruelty to Animals, The Kennel Club and Cats Protection, and many others carry out important work to rescue and rehome animals. It is clear from the amount of work they have to do that we need to discourage these acts of cruelty in the first place.
Does the hon. Gentleman agree that we will need to publicise and raise awareness of the maximum sentence once, as we hope, the Bill is passed and put into law, so that it acts as a deterrent to stop people even thinking about committing cruelty to animals?
I wholly agree with the hon. Gentleman on that. Part of the reason this Bill needs to be put forward is that the support from the organisations that specialise in animal care, such as those I have outlined, will increase the publicity of this much more. I invite all Members, both those here today and those who are not, and everybody watching on television, to support the case and make sure that this is well known.
We now have an opportunity to deliver a strong message to animal abusers that their behaviour will no longer be tolerated. When this Bill is passed, they can expect those tougher sentences. The increase in the maximum penalty for animal cruelty will be the first increase for such offences in more than 30 years, since another private Member’s Bill, from the then hon. Member for Ealing North, increased the maximum from just three months’ imprisonment and a maximum fine of just £1,000. I know that this House contains many hon. Members who have spoken up for animal welfare over the years, and I am sure we will continue to do so again. I hope that with the support of hon. Members from across this House this Bill will reach the statute book and make a real difference by reducing the instances of animal cruelty, as the hon. Gentleman highlighted.
Although this Bill will go some way to correct the deep injustices of cruelty to animals across this country, there are many aspects of animal cruelty that it does not address. I am sure Members on both sides of the House will speak about other areas of priority for animal welfare, such as addressing pet theft and the right to keep family and pets together no matter what the accommodation arrangements. At that point, I should pay tribute to my hon. and dear friends the Members for Ipswich (Tom Hunt) and for Romford (Andrew Rosindell), who is not in his place. I should also thank my hon. and dear friend the Member for Redcar (Jacob Young), whose kind concern, support for the Bill and help I appreciate.

Commons ChamberAnimal cruelty has no place in our society, which is why the Government are committed to increasing the maximum custodial penalty for animal cruelty from six months to five years. The Government are fully behind the Animal Welfare (Sentencing) Bill, which will provide one of the toughest sentencing regimes in Europe.
I sympathise with the hon. Gentleman, and we are all keen to do what we can to stamp out animal cruelty. Unfortunately, I cannot give any guarantees about the progress of parliamentary business, but the Second Reading of the Animal Welfare (Sentencing) Bill, which was introduced by my hon. Friend the Member for West Dorset (Chris Loder) who is currently in his place, will take place next month. The Government fully support the Bill and hope that it will become law very soon.
I welcome the Minister’s confirmation that we will have a five-year maximum sentence for animal cruelty. The RSPCA has estimated that there were more than 100,000 instances of animal cruelty during lockdown. That is a great concern, and we want to ensure that action is taken. Will the Minister confirm that there will be greater enforcement and steps towards prosecution, to ensure that those who commit animal cruelty are brought to justice?
Enforcement is, of course, a matter for local police forces, but what we can do in this place is to make sure that the right laws are in place to give them the tools that they need to stamp out animal cruelty.

I absolutely do. In our previous debate, I spoke about how nine primary schools in my constituency, as well as many thousands of homes, are within a one-mile radius of this development. That is unacceptable, so I agree with the hon. Gentleman. Also, a technology that has never been used in the UK before is not welcome in Washington and Sunderland West—or, probably, in any of our constituencies.
Surely a technology that is expected to release millions of tonnes of carbon dioxide during the anticipated lifetime of the gasification facility should not be backed by the Government. Indeed, that is a direct contradiction of the Government’s policies on climate change and waste processing. For every one tonne of plastic incinerated, approximately two tonnes of CO2 are released into the atmosphere, therefore contributing to climate change, whereas, perversely, one tonne of plastic in landfill releases zero CO2, so incineration cannot be and is not the solution we seek—it has to be more recycling.
My hon. Friend is making an excellent speech on an important issue. She just mentioned recycling. Does she agree that much more needs to be done to encourage more recycling so that we do not have, or reduce, the need to rely on incineration or landfill?
I absolutely agree with my hon. Friend. More recycling has to be the solution; it will never be landfill, and certainly not incineration. How does the Minister expect to meet the Government’s climate target of being carbon neutral by 2050 if planning applications for waste incineration continue to go ahead?
A recent study by Waste and Resources Action Programme Cymru found that 75% of commercial and industrial waste sent to incineration or landfill in Wales is recyclable. With recycling rates flatlining, will the Government consider introducing a tax on incineration, as promised in 2018, to address climate harm and encourage recycling rates? There is a precedent, as that is what the landfill tax aimed to do. Surely it is counter- productive to have a landfill tax to deter burying plastic, which causes no CO2, but not to have an incineration tax for incinerating plastic, which causes masses of CO2.
Another issue that neighbouring MPs and constituents might not yet have fully realised exists is that, due to the prevailing winds, the people to the east of our proposed site, in Sunderland and South Shields, may also find themselves harmed by the plant. I hope that this debate will help to alert a bigger audience across the wider area to the impending threat that is being discussed just a few miles from them.
Sunderland City Council is aiming to be carbon neutral by 2030—a target that will be totally scuppered if the planning application for Hillthorn Park is approved. The problem is the emissions from not just the plant but the 110 HGVs that will work around the clock to ship waste to it.

Why does the Environment Bill not include World Health Organisation targets for air pollutants or set clear targets to meet them?
Air quality targets are included in the Bill, but we already have an ambition in the clear air strategy. Reaching the target for particulate matter 2.5 is an absolute priority, but the actual target will be set in secondary legislation after expert advice has been taken on exactly how to do that. I met one of the heads of the WHO just last week, and she agreed that that is the right way of doing things, because this is tricky, and we must get it right.

The right hon. and learned Gentleman is right. I am about to embark on a tour of wetlands; Wicken Fen will be one of them. This summer we have seen some particular problems with a number of streams drying up, so we need a plan for water.
Is my hon. Friend aware of the 2018 report by the Intergovernmental Panel on Climate Change and the 2019 report by the Intergovernmental Science-Policy Platform on Biodiversity and Ecosystem Services that show that nature and climate crisis are inextricably linked? The IPBES report says that 1 million species globally are at risk of extinction. Does he agree that nature-based solutions are a fundamental way of stopping climate change and preventing the extinction of species?

Commons ChamberMy hon. Friend is right: people expect clear, honest labelling on their food, and if marketing terms are not used consistently, the Government should act. Clear labelling is important not just for pasture-fed livestock, but for organic food, which is trusted around that world.
Discussions on the spending review are already under way, particularly with the Mayor of London, and we are considering what more we can do to boost resources. Particulate matter is one of the key things we need to tackle right across the country. That is not solely about transport; it is also about domestic burning, and I am confident that we will bring forward regulations on how to reduce that.

Commons ChamberIt is already an offence to leave an engine running unnecessarily when the vehicle is stationary on a public road. Local authorities can issue fixed penalty notices to drivers who leave engines running after being asked to turn them off. Westminster Council is probably the most successful at this, but I encourage local authorities to use their powers so that more people stop idling unnecessarily.
What discussions has the Minister had with the Chancellor about the need to establish ring-fenced funding for local authorities to implement measures to protect our children’s health where they are disproportionately affected by toxic air in areas where they live, learn and play?

It is a pleasure to serve under your chairmanship, Mr Rosindell. I congratulate my hon. Friend the Member for City of Chester (Christian Matheson) on securing this important debate. He spoke passionately, and I know that he feels passionately about this issue. I am aware that there is great strength of feeling in Cheshire about it.
We have heard excellent contributions from Members across the House. My right hon. Friend the Member for Delyn (David Hanson) spoke about the excellent report that the all-party group for animal welfare has produced on sheep worrying. I hope that the Minister will take note of its important recommendations. The hon. Member for Henley (John Howell) talked about the international trade and the importance of working globally. My hon. Friend the Member for Islwyn (Chris Evans) raised the issue of bird eggs, which is very important as their theft causes huge damage. The hon. Member for Strangford (Jim Shannon) highlighted the importance of conservation and raised his particular concerns. It was interesting to hear the response from the hon. Member for Kilmarnock and Loudoun (Alan Brown), who talked about the approach to these issues being taken in Scotland.
People from across the country frequently contact me to tell me their concerns about the appalling wildlife crime in Britain today. Many have been mentioned already, including hunting with dogs, which is clearly a huge concern, hare coursing, badger baiting and raptor persecution. Last year, when I was serving on the Public Bill Committee for the Ivory Act 2018, we heard that the National Wildlife Crime Unit has only 12 members of staff to cover the entirety of its operations across the UK, and that includes administrative staff as well as enforcement officers. That level of resourcing is a great cause of concern. How can we expect wildlife crime to be tackled in our country if we do not put in place the means by which we can stamp it out? The unit’s financial future has been uncertain for many years, so will the Minister commit to guaranteeing funding for it beyond 2020?
I remind the Minister that, on Second Reading of the Ivory Bill in June last year, the Secretary of State said that, by October 2018
“we will be looking not just to ensure that we can continue to staff and support the officers who work in this field adequately, but to ensure that we go even further.”—[Official Report, 4 June 2018; Vol. 642, c. 98.]
Nine months later, we are still no clearer on the funding issue. There cannot be a repeat of the threat to the unit’s future, as happened in 2016, so we need clarity.
The six national wildlife crime priorities in Britain include poaching, the illegal wildlife trade and the persecution of badgers, bats and raptors. My hon. Friend the Member for City of Chester mentioned the persecution of raptors, and a new scientific study shows that hen harriers are disappearing on English grouse moors due to illegal killing. Natural England says that the analysis confirms
“what has long been suspected—that illegal persecution is having a major impact on the conservation status of this bird”.
I take the point, made by the hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) that raptor persecution is not limited to grouse moors. It is important that wildlife crime is dealt with adequately, wherever it takes place. Labour has committed to carrying out a review in government of the environmental and wildlife impact of grouse shooting. What is the Government’s position on that, now that we have seen the new analysis?
We have heard that, unfortunately, no database is kept of reported wildlife crime in England and Wales, although the RSPB keeps a record of bird crimes. Crimes are recorded in Scotland, and figures released last week show that the number of wildlife crimes north of the border has fallen by 11% to the lowest recorded level in five years. At the same time, Scotland has a conviction rate of 96% for those found to have committed wildlife offences, which is the highest rate since 2012.
I believe that even those figures are likely to be wildly unrepresentative of the true number of wildlife crimes committed across Britain. We know that such crimes often take place in remote, rural areas and are likely to go undetected. There is simply not enough specialist knowledge and training in our overstretched police forces, which pushes the burden of covering all UK wildlife crime on to the overstretched few staff at the National Wildlife Crime Unit.
My hon. Friend the Member for City of Chester, the hon. Member for Southend West (Sir David Amess) and my hon. Friends the Members for Crewe and Nantwich (Laura Smith) and for Ellesmere Port and Neston (Justin Madders) talked extensively about the concerns about the Hunting Act 2004. The fact that so many hon. Members focused on it shows that there are serious concerns about it, which the Minister must take very seriously.
On the National Wildlife Crime Unit, does my hon. Friend agree that, unless something is done about wild birds and birds of prey, their very existence may be threatened? Some species may become extinct if nothing is done.
We have just heard the new figures for hen harriers. It is incredibly important that these issues are taken seriously, recorded properly and acted upon if we are to stop that kind of wildlife crime.
I want to reiterate the commitment that Labour made on Boxing day: in government, we will strengthen the Hunting Act by closing the loopholes through a number of key measures. We will consult on reviewing sentencing to ensure that effective deterrence includes the use of custodial sentencing, in line with other wildlife crimes; strengthening the criteria for issuing research licences; removing the exemption on the use of dogs below ground to protect birds for shooting, as it risks appalling fights between dogs and wild mammals; and introducing a recklessness clause—hon. Members have talked about that today—to prevent trail hunting from being used as a cover for the illegal hunting of wild animals.
