I agree. Community support is important, and I will deal with that later on in my speech.

Our security personnel are on constant high alert. In my constituency, prison officer David Black was gunned down on the motorway as he travelled to work in 2012. That brutal ambush was carefully planned and carried out at the hands of skilled gunmen, who carefully targeted and shot him at high speed. Mr Black served Her Majesty’s Government in the Prison Service for more than 30 years and was awaiting the outcome of his retirement application. That is another mammoth loss, not only to his family but to Northern Ireland as a whole.

That is the distinct reality of the dissident republican activity we face today. They continue to generate support through illegal republican parades and protests. They are engaging with impressionable young men—a generation who have not fully witnessed the darkest days of the troubles. Having indoctrinated those teenagers, they send them out to engage in crimes, while maintaining a safe distance. In May this year, reports stated that a 10-year-old boy was cautioned after a masked colour party took part in a republican parade through Lurgan. It is extremely disturbing how young children are being exploited to try to progress a violent and brutal agenda.

I congratulate the hon. Gentleman on securing this debate. Does he agree that the cancer of paramilitarism must be eradicated from all quarters and that to do that once and for all there must be community support for the PSNI and also community involvement with it, working together with all community and political organisations?

I agree entirely. It is important that the communities co-operate and that information is fed into the security forces.

At the time of that parade, the PSNI was aware of possible illegal parades and made several announcements regarding such activity. It urged the public not to engage in any way and reminded everyone of the repercussions of doing so. However, its pleas to the public were ignored by some, and following that parade, the PSNI followed through with robust and thorough investigations. Last week, it reported that a total of 81 files had been forwarded to the Public Prosecution Service for consideration. I understand that 35 of those files were on residents of the Republic of Ireland. There is a widespread concern that when those files are passed to the PPS, the good work of the PSNI is undone. On occasions, the files that are passed to the PPS for prosecution do not come before the justice system. In cases where they do reach the judiciary, sentencing is often too lenient and therefore ineffective as a deterrent, especially to the said impressionable young men.

In August this year, following a number of co-ordinated policing operations, locally based police officers working in conjunction with specialists from crime operations branch recovered a fully constructed explosive device, firearms and components for other improvised explosive devices in a number of searches in the area. Just a month later, in September, the PSNI uncovered an armour-piercing direct-fire mortar. Along with that find, three men were charged with targeting a former member of the security forces, and a fourth man was charged with attempting to kill police officers. We have recently seen the use of that type of weapon not only in my constituency but in Iraq, Syria and Afghanistan.

In my constituency of Upper Bann, more firearms and ammunition have been recovered this year than in 2015; more people have been charged with terrorism-related offences this year than in 2015; and more explosives, including the vicious mortar, have been seized this year than last year. I want to put on record my admiration for the district commander, the chief inspectors and all the police officers on the ground for their resilience in working under these difficult and very dangerous circumstances.

The team of PSNI officers come under regular attacks in my constituency. Earlier this year, officers were on the receiving end of orchestrated, intense and prolonged violence when more than 100 petrol bombs were thrown and shots were fired at them during serious disorder in the local town in relation to the railway line. That railway line is famous in my constituency. It runs through a high-profile area of dissident activity and is the main thoroughfare from Belfast to Dublin, with trains approximately every 30 to 45 minutes. There have been numerous security alerts on the line, with more than 90 closures. This year, that has been somewhat reduced because of Translink’s work and that of the security forces. We all know that this is an attempt to lure police officers and forces of the Crown into the area so they can be attacked and their lives taken.

Such activity is simply not what the vast majority of my constituents want. They are trying to get on with their daily lives, but it is a stark reminder of how dissident republicans are holding the wider community back from enjoying the freedom and prosperity that Northern Ireland has to offer. I have met collectively the PSNI and Translink to discuss the impact that such closures on the line have on travellers on the railway and we are making steady progress.

The hon. Gentleman is being generous with his time. Does he agree that the interruptions to the Belfast to Dublin service add to the problems for Translink, which has received a lot of criticism from many travellers as a result of undue delays in travelling to Belfast or Dublin, which is having an impact on the local economy?

Indeed. That is my next point. Shoppers, travellers and people going to work are affected, and not all employers are as sympathetic as they perhaps should be in the circumstances when people may have to use buses for transport. It is a disaster from start to finish. It is unacceptable and affects the economy greatly.

The PSNI has received cross-community support—there is no doubt about that—for stamping out dissident activity where possible. With limited resources, it is delivering a high-profile response to tackling these criminals, but we cannot ignore the fact that they are maintaining a presence and continuing to build on their support network. In recent meetings with the PSNI it has said it is greatly concerned about that.

The dissidents have a strong recruiting process, including vulnerable teenagers, and even those who were involved in provisional activity are coming back to help to build devices. Not all have been built correctly. One day, God forbid, they may get lucky and take the life of a police officer, but we hope and trust that will not happen.

I will not comment on the specific case, but I will touch on the broader issue of justice. Before I do, however, I want to refer to the point made by the hon. Member for Upper Bann about a 10-year-old child being targeted. I am thinking about my own constituency and the fears about the drug-dealing scum in my town who use innocent young people, because they are cowards. They franchise out that activity to someone else—to an innocent. I would say to parents, to families, out there: be extremely vigilant. These people are not bringing someone into a cause but exploiting innocent young people, and we must do everything we can to protect them.

I know that the hon. Member for Upper Bann (David Simpson) will agree with me about this. There is supposed to be a direct correlation between those people who are actively involved in these activities, and drug activities. Both are equally insidious and both are a cancer in society that must be eradicated.

The hon. Lady makes a very good point, with which I agree.

I will briefly move on to the justice system. Justice is a devolved matter, and we treasure the independence of the judiciary, but I will make some observations. First, a review of the system is going on, but, as a citizen, I have observations on some of the choices that have been made, such as individuals being allowed to go to pop concerts. This is about confidence. I want a system that is independent, but it also has to be fit for purpose and reflect the demands of our broad public, who have made an immense journey. When we ask people to step away from paramilitarism and have faith and confidence in a system, whether it is the police or the broader judicial system, the system must be able to sentence; it must be able to process these things. I say this for people who are charged as well. I want them to have a good system that enables them to enter the process, understand and participate in it, and have their day in court. At the moment, I think there are huge question marks over its ability to deliver that. I know that the Minister of Justice in Northern Ireland is doing everything she can to deliver it. I implore my friends across Northern Ireland to make a positive contribution in seeking change in that process.

I want finally to mention what we are doing. On a personal level, I feel so honoured to serve as a Northern Ireland Minister in a Northern Ireland that is in a far better place. It is an exciting place to be. We talk about the terrible things that we have talked about today, but when the chief executive of Belfast City Council tells me that 82 cruise ships have docked in Belfast, when the city tour bus is going around Stormont and when we have thousands of tourists coming to so beautiful a place as Northern Ireland, we need to ensure that we have some balance. A small group of individuals are seeking to go back to the past, but I believe that the vast majority of good people desire to be in a different place.

From a resource point of view, we have put an extra £160 million in this year, and we have put £25 million into addressing paramilitarism. I say to colleagues in the House today and to other friends in Northern Ireland that if I can change things or help them on the path to greater prosperity and greater peace, I will do everything I can.

Does the Minister agree that the best way of tackling paramilitarism and criminality in Northern Ireland is to adopt the community-wide approach that was outlined by the SDLP during last year’s Stormont House talks, rather than throwing money at paramilitary organisations?

I understand what the hon. Lady is saying, but I can give her some comfort. We have ensured that £25 million is available specifically to counter paramilitary activity, and we are working with the Executive to deliver that. We look forward to seeing the report in the near future.

I beg to move,

That this House has considered the Police Ombudsman of Northern Ireland’s report on the murders at Heights Bar, Loughinisland.

I am pleased to serve under your chairmanship, Sir Roger, and I am pleased that the Minister and the shadow spokesperson on Northern Ireland are also here.

On 18 June 1994, an Ulster Volunteer Force murder gang burst into the Heights Bar in Loughinisland in South Down and, in a nakedly sectarian act, shot dead six Catholic men and seriously wounded five others as they watched a World cup football match. Those six men were Adrian Rogan, Malcolm Jenkinson, Barney Green, Daniel McCreanor, Patrick O’Hare and Eamon Byrne. Nobody has ever been held to account, charged or convicted for those murders and that single incident revolted the entire community I represent and in which I reside, some three miles from that pub in Loughinisland. The community was outraged at such a heinous crime.

Two of those killed were well-known family friends to me. Barney Green was aged 87, and one of his late brothers was married to my paternal aunt. His nephew, Dan McCreanor, was a cousin of my cousins. I pay tribute to the families, victims, survivors and their legal team.

In view of the fact that nobody has been held accountable, the families of the deceased and injured went to the Police Ombudsman with significant concerns. In summary, those were: that the police failed to conduct an effective investigation of the murders, including failing to keep bereaved families updated on the progress of the inquiry; that the police failed to discharge the state’s duties as required by article 2 of the European convention on human rights; and that there was collusion between the then Royal Ulster Constabulary and those responsible for the murders.

On 9 June this year, the Police Ombudsman published the report. At that time, I said that, more than 20 years on and five years since the release of the totally discredited original Police Ombudsman’s report, the damning disclosure in this report that security force collusion played a major role in the murder of those six innocent men has finally been made. Disgracefully, the protection of informants took precedence over the preservation of innocent lives and the devastation visited upon their families and the wider community.

On closer examination of the report, Dr Maguire clearly demonstrates that collusion was a significant feature in the deaths of the six men. I will illustrate that by directly quoting Dr Maguire’s report, in which he writes:

“It is my view that the nature of the relationship between the police and informants undermined the investigative process in a number of ways…This was a ‘hear no evil, see no evil, speak no evil’ approach to the use of informants, which potentially frustrated the police investigation into the attack and restricted investigation opportunities and lines of inquiry.”

I am grateful to the hon. Lady for allowing me to intervene. This is an important debate about a controversial issue. I should put on the record that my late husband, who died eight years ago with Alzheimer’s, was, at one time, the Chief Constable of the RUC and was enormously proud of his role in an organisation that had been attacked and lost 302 members during the troubles.

The report is very controversial. Will the hon. Lady confirm for the record that the Police Ombudsman concluded that the UVF unit was responsible for the murder of the six innocent Catholic men? I extend my deepest sympathy to the families of those six innocent Catholics who were watching a football match. However, the ombudsman concluded that it was the UVF and that the RUC had no prior knowledge or warning that could have prevented that attack on the Heights Bar in Loughinisland. Will she kindly confirm that for the record?

Indeed, the report says:

“Let there be no doubt, the persons responsible for the atrocity at Loughinisland were those who entered the bar on that Saturday evening and indiscriminately opened fire.”

However, the Police Ombudsman goes on to mention the lack of rigour in the investigation and the fact that vital evidence was destroyed: namely, the car that had been accommodated at Saintfield police station, which is no longer there. I accept what the hon. Lady said and will ensure that the families—people I know very well indeed—are well aware of her deepest sympathies to them.

We are discussing the most heinous crime possible. There were many in Northern Ireland. We send our sympathies to the families. I note the ombudsman’s quotation, which the hon. Lady read out, but will she confirm that there was no collusion over the act of violence that happened in the Heights Bar? The accusation of collusion is awaiting evidence. We believe that, if there is evidence, it should go to court and, quite rightly, be looked after, but we do not want to blacken the whole RUC and Police Service of Northern Ireland.

It is worth noting what Dr Maguire says in his report. He uses the Smithwick report’s definition of collusion, which includes “commission” and “omission”. I firmly believe that if there had been an accelerated inquiry process following the deaths of the six men, we would have been in a better position than we were at that stage.

For some unknown reason, the police did not put in significant rigour, given the fact that there was a UVF unit operating in South Down and given that there were preceding events, including the murder of Jack Kielty in January 1988, the murder of Peter McCormack in the Thierafurth Inn on 19 November 1992, the attempted murder of his cousin, Peter McCarthy, some weeks before that in that bar, and the attempted murder of John Henry Smyth, who was originally from Downpatrick but was resident in Castlewellan and who, sadly, has since died from natural causes. The report is particularly instructive and provides the wider context about the importation of arms way back in 1987. According to forensic evidence, one of those arms was used in the murder of my six friends in Loughinisland.

Dr Maguire’s report also states that

“Special Branch continued to engage in a relationship with sources they identified in intelligence reporting as likely to have been involved at some level in the Loughinisland atrocity.”

The report is particularly instructive, and it develops that concern at paragraph 5.67, wherein the Police Ombudsman describes that special branch

“established an intelligence asset that revealed that Persons A, M & K were leading UVF members in the area, with connections to the security forces. In addition, the intelligence identified a relationship between Persons A, M, K and Person I, who was a senior member of the UVF with links to East Belfast, but who reported directly to the UVF leadership on the Shankill Road, West Belfast.”

Paragraph 5.80 further states:

“My investigation has established that at least three individuals and their families, directly associated with the UVF unit active in South Down, were members of the UDR.”

That does not make very pleasant reading for me or my constituents but facts are facts, and these facts were established by an investigation that produced a report after much interrogation. The report goes on to inform us that in the year before the Loughinisland atrocity, persons A, M, K and I “were responsible for” the deaths I have already mentioned, including the murder of Martin Lavery in Belfast on 20 December 1992.

The indiscriminate brutal savagery of these murders stood out because of the nature of our community in Loughinisland. I live some three miles away, and I am talking about myself, my family, my neighbours and my constituents when I say that we are harmonious, integrated and peace loving—we always have been and still are. After the inquest on 28 January 1995, my party colleague and former councillor, Patsy Toman, who resided in Loughinisland and who arrived within 10 minutes of the shooting, received an anonymous letter on 14 February 1995. He gave the letter to the police after talking to me, and some of its details were quite explicit in relation to the names of those who may have been involved. Dr Maguire’s report tells us at paragraph 7.203 that the letter has been lost by the police and, notwithstanding its contents, no persons, certainly none of those named in it, have been charged before the criminal courts.

The Police Ombudsman further states:

“I am satisfied that on the basis of a sound intelligence case, Special Branch identified Persons A, M, K, I & B to the Loughinisland Murder Investigation Team as suspects on Sunday 19 June 1994.”

That was the day after the murders, yet Dr Maguire’s report tells us:

“On 24 August 1994 police received information that members of the gang, which police suspected had been responsible for the murders at Loughinisland, were informed on 21 August 1994 that they were liable to be arrested the next morning. Intelligence the following month stated that the source of this warning was a policeman. I have found no evidence that efforts were made by police to investigate this information.”

In view of the very serious issues raised by the report, I wrote to the then Prime Minister, the right hon. Member for Witney (Mr Cameron), on 10 June, and in a subsequent written response he stated:

“The Government accepts the Police Ombudsman’s report and the Chief Constable’s response and we take any allegations of police misconduct very seriously. Where there is evidence of wrongdoing it must be pursued—everyone is subject to the rule of law.”

On that basis, the then Prime Minister, the British Government and the current Chief Constable of the Police Service of Northern Ireland accept the report’s finding that collusion was a significant factor. It follows that those who were to be arrested in August 1994—probably the same individuals mentioned in the anonymous letter to my colleague, the then Councillor Toman, and specifically referred to by the designated letters in the Police Ombudsman’s investigation—should be brought in by the PSNI for questioning and reinvestigation. I am aware of those names, the authorities have the names and now, with the Police Ombudsman’s report, the PSNI has grounds under reasonable cause to bring these individuals in for questioning.

Last week I had a meeting with the Chief Constable, and I raised this directly with him. I will continue to pursue the matter on behalf of the families, the victims and the survivors because I believe that there must be truth and justice. If the past and the investigation mean anything, we need truth. In the same vein, the Police Ombudsman has a responsibility to follow through on his work that identified problems within the then police force and those officers responsible. If we are to have justice, truth and any form of accountability, resources must be made available to the PSNI and the Ombudsman’s office to act now on what is a relatively recent crime. Hopefully we will then have a better chance of prosecutions.

I express my deep appreciation to the hon. Lady for her tireless efforts on behalf of her constituents and their families. The manner and tone in which she speaks display the real commitment and compassion that she always shows to her constituents. Will she confirm that, despite the very controversial findings of the Police Ombudsman’s investigation into Loughinisland, the Police Ombudsman did not send any prosecution reports, or suggestions for prosecution, to the Director of Public Prosecutions for Northern Ireland? Was that a surprise in the light of the fact that he concluded that there was collusion?

A section in the report states that the current Chief Constable has sent the specific names of junior and senior members of the then RUC about whom there are certain doubts—I put it like that—to the Police Ombudsman for investigation. As I understand it, they are currently being investigated. I want to put that on the record.

My hon. Friend has compellingly set out how the report shows that there was serial dereliction on the part of a police service that was meant to be the guardian of people and the peace and the upholder of law and justice, but there was not only serial dereliction. In the many years since Loughinisland, when all these concerns have been voiced and raised, there has also been serial denial by too many politicians, including Ministers. Does she hope that the Minister today will strike a different tone from the previous Secretary of State in relation to these important matters?

I thank my hon. Friend for his helpful intervention. I agree that we want to move forward with this investigation, but we cannot begin to move forward to build a shared and inclusive society if issues from the past are not comprehensively addressed. How the Government respond to the report on the Loughinisland massacre is critical for legacy issues. The past has wider implications for public confidence and justice in Northern Ireland. The comments by the previous Secretary of State, to which he referred, insulted the people of Loughinisland, the families and the victims. I regret having to say that, but that is the position.

I look forward to a more helpful response today, but there must now be accelerated work on prosecutions, a British Government apology to the victims and survivors and their families, and provision of compensation for the victims, for those lost lives. That must be part of the urgent answer and solution to this tragedy in Loughinisland on Saturday 18 June 1994.

It is not for me to define “collusion” for the Ombudsman. There are many definitions, and we may choose a different one, but we accept fully the findings of the report—I shall comment further on that in a moment.

The Government accept the Police Ombudsman’s report and the Chief Constable’s response. We take any allegations of police misconduct very seriously; where there is evidence of wrongdoing, it must be pursued. Everyone is subject to the rule of law.

This is now a matter for the Police Service of Northern Ireland. The Chief Constable apologised to the families after the Ombudsman’s first report on this atrocity in 2011 and he apologised again on 9 June this year when the second report was released. He has given his reassurance both to the families and to the public that he fully co-operated with the Police Ombudsman’s investigation and that he will co-operate fully with any disciplinary or criminal proceedings against former police officers. It is very clear from the Chief Constable’s response that the Police Service of Northern Ireland remains firmly committed to apprehending those responsible for these murders and has appealed to the community for information. On behalf of the Government, I reiterate that commitment and that appeal.

We have judged our security forces against the highest standards of integrity and professionalism in the past, and we always will. As a Government, we have been more forthcoming than any of our predecessors in accepting where the state has failed to live up to the highest standards and in apologising when it is the right thing to do. Where it is warranted, we will continue to do so.

There have been calls for the UK Government to apologise for what happened on the fateful day of 18 June 1994. Of course the Government deeply regret that the terrorists who committed these vicious attacks have never been brought to justice, and we are sorry for any failings by the police in relation to this case. However, the Ombudsman’s report makes it very clear that those responsible for this despicable attack were the Ulster Volunteer Force terrorist gang who planned it and carried it out, leaving utter devastation in the aftermath and for many years thereafter. The report also categorically states that the police had no prior knowledge of the attack that would have enabled them to prevent it.

The Government will never seek to defend the security forces by defending the indefensible.

Will the Minister comment on the fact that the Police Ombudsman’s report refers to a lack of resources invested in investigating the UVF unit operating in that area of South Down, which had resulted in prior murders of people who lived in the locality? There is a feeling that if more rigour had been applied to that investigation before Loughinisland, maybe Loughinisland would not have happened.

As I have already said, the Government accept the findings of the report and so does the Chief Constable. What is important now is that we show compassion to the families and those who have lost, and that we pursue the individuals who carried out this atrocity. I am confident that the Chief Constable will continue to do that.

The majority of those who served in the security forces during the troubles did so with great bravery and exemplary professionalism. We owe them a huge debt of gratitude for what they did to uphold the rule of law and ensure that the future of Northern Ireland could only ever be determined by democracy and consent.

The report highlights the need to establish the legacy bodies set out in the Stormont House agreement. We all know that legacy issues in Northern Ireland have a continuing capacity to disrupt the political process and the economic stability of the people of Northern Ireland, and the current structures for dealing with these cases are not working as they should. We know for a fact, through many discussions with victims’ groups, that the current structures do not work for victims and survivors of horrendous atrocities such as that in Loughinisland 22 years ago.

The Government remain committed to establishing the legacy bodies set out in the Stormont House agreement: the historical investigations unit, the independent commission on information retrieval, the implementation and reconciliation group and the oral history archive. It is our view that they offer the best way forward for us to achieve better outcomes for victims, survivors and the people who suffered as a result of the troubles. We share the widespread disappointment that the “Fresh Start” talks last year were unable to deliver the new structures, but today I reaffirm the Government’s determination and commitment to do all we can to remedy that.

I am grateful to my hon. Friend for his welcome. Indeed, I very much look forward to working with the Select Committee. I note that he is tempting me into a broader area of policy in relation to airport capacity. He will know that the previous Transport Secretary made a clear statement on the timing of that, and, obviously, the matter requires further consideration.

May I add my congratulations to the Secretary of State and to the Under-Secretary of State on their appointments? Has the Secretary of State and his officials, working with Ministers in the Northern Ireland Executive, made any calculation of the economic damage to Northern Ireland as a result of the vote to leave the European Union when the people voted to remain?

I certainly recognise that there were differences of view on the EU referendum, as there were across the rest of the United Kingdom. Our focus now needs to be on what Northern Ireland can be, and on what we can achieve in terms of trade, jobs and new opportunities. It is precisely that positive agenda that I intend to take forward.

My hon. Friend is correct. We need to get our fair share of that in order to push this forward. I recently visited my local training centre in the Craigavon area. I have visited it many times, and in recent times it hosted a regional skills competition. I spoke to one of the instructors there, who told me of one young man who came to him—I think it was three years ago—as a trainee plumber. The instructor knew when he saw the young man working that he had something special. That young fellow lives in a village called Katesbridge outside Banbridge.

He is in his early 20s, and is a constituent of the hon. Lady, and he is the world champion plumber. He went through all the heats, he went to Brazil, he won the heats in Brazil, and he is now the world champion plumber. That is some achievement for a young lad from Katesbridge in—I emphasise this again—the hon. Lady’s constituency. For a young man like that who has come in and developed a skill, the world is his oyster. He can do whatever he likes and demand his price. That is what we want to see: more young people getting into those skills, including the basic skills. It has to be realised that, while parents want all their children to be Einsteins, brain surgeons, dentists, GPs and so on, that is not going to happen, but there is still a lot of money to be earned with those skills, which we lost during the economic crisis.

Lastly, I want to focus on the agri-food sector. I have come from the Select Committee on Environment, Food and Rural Affairs just now, and we had a very interesting debate. This sector plays a significant role in the Northern Ireland economy. It contributes £1 billion of added value per annum and has demonstrated a strong track record of export growth, employing over 100,000 people, but the outlook for our farming community remains grim. Dairy farmers have witnessed their incomes fall by over a third in the past year. The realisation is that they are producing milk well below the cost of production. Something more needs to be done to help them. They cannot continue on this ongoing basis of haemorrhaging money and cash flow.

My party wants the industry to bring forward supply contracts that minimise price fluctuations and seize a greater share of their profits along the entire food chain. Six years ago in Northern Ireland, we were doing approximately £60 million of food exports. This year, the figure will be £95.5 million. That is a clear testimony to the quality of our food and drink, which is an essential part of our tourism industry. Our industry target is £1 billion by 2020 and we are already well on our way to achieving that.

It is my understanding that that is the opinion of the Ulster Farmers Union, but everybody has their problems. I think that the National Farmers Union may have come out in support, but I am not sure; it could still be sitting on the fence. We do not know which way it will go. However, the Ulster Farmers Union has come out with that silly statement.

The year 2016 is the Northern Ireland year of food, and fantastic work is underway through Food NI. The hon. Member for South Down (Ms Ritchie) and I hosted an event on St Patrick’s day in this House. It was the second time that an event had been held in this House to promote Northern Ireland food, and it was a fantastic success. This week, the fancy London outlet Fortnum & Mason is promoting Northern Ireland produce to help local retailers. Today, a lot of VIPs and other invited guests have been there to sample some of that food.

I congratulate the hon. Gentleman on securing the debate. Does he agree that a large proportion of Northern Ireland’s agri-food industry is dependent on exports? In that respect, it is important that we achieve a direct export capacity to China, Taiwan and north America.

I absolutely agree—I think the hon. Lady raised the point in the Environment, Food and Rural Affairs Committee previous to this debate—and that needs to be achieved quickly.

It is humbling to hear all the success stories—sometimes, there are stories of not so much success—especially coming from a wee country that was deep in conflict for many years. To me, that shows a strong work ethic from the Northern Ireland community and the business community to keep trying. Our economy is settling into a reasonable state of stability, but we must acknowledge the unease of local businesses, farmers and investors as the referendum looms.

I am appalled by some of the scare tactics that have been put forward by those in the remain campaign. Membership of the EU costs £350 million a week. Combined with red tape, bureaucracy and many EU laws taking precedence over UK law, we have reached a point at which the costs have outgrown the falling benefits.

Nine years ago, devolution was restored to Northern Ireland. In that time, we all faced many local, national and international challenges. We faced up to them and overcame them. However, we cannot take our foot off the gas. The incoming First Minister’s five-point plan prioritised spending on the health service, creating more jobs and increased incomes, protecting family budgets, raising education standards for everyone and investing in infrastructure. That is what we are about and what we need to do to deliver for all the people of Northern Ireland.

I am pleased to serve under your chairmanship, Mr McCabe. I again congratulate the hon. Member for Upper Bann (David Simpson) on securing the debate. Like him, I congratulate everyone who was elected to the Northern Ireland Assembly on Friday and Saturday of last week. There is a major job of work to do, and I am sure they will get down to that as part of their preliminary work tomorrow.

I will focus my contribution on the role that tourism and the visitor economy can play in bringing prosperity to Northern Ireland, but first I want to echo the comments of the hon. Member for North Down (Lady Hermon) about education. Clearly, education, skills and training are directly linked to the economy. However, on 23 March, schools received a letter from the Minister saying that their budget would be at a certain level. It a major cut, which will have an impact on the delivery of the curriculum to many pupils throughout the schools sector. That will have an impact on our economy in the long term, which needs to be addressed as a priority.

Will the hon. Lady accept that, given how the block grant works, the only way more money can be found for education is through reform of the education system in Northern Ireland? I am talking about holding less money at the centre for Department-inspired initiatives and instead giving it to principals, and about showing less favouritism to certain growing sectors of education at the expense of other sectors, some of which are already working under capacity.

I thank the hon. Gentleman. I agree that there needs to be investment in schools and education. That is the priority, because investment in well-developed children’s education will lead to better outcomes for training and our economy.

Northern Ireland is undoubtedly a beautiful place, and our appeal has been strengthened by our growing position as a world-leading location for films and television. In that respect, tourism is an important revenue generator. In the year from October 2014 to September 2015, it brought total expenditure of more than £700 million to our economy. That helps to support jobs and gives communities new livelihoods.

As a co-chair of the all-party group for the visitor economy, I am anxious, as are many members of the group, for the Government to bring forward proposals to reduce VAT on tourism on a UK basis. That fiscal incentive would have a deep and generous impact on the Northern Ireland economy. We need only look at the south of Ireland, where VAT on tourism has been levied at 9% over the last number of years. As a consequence of that measure, about 9,000 jobs were created in the two years after it was introduced. We are part of the UK, which is one of only two of the 27 countries in the European Union that do not have a lower rate of VAT on tourism, so that immediately places us at a disadvantage.

The hon. Member for Upper Bann also raised the issue of Brexit. Obviously, I take a very different view from him and his colleagues in the Democratic Unionist party. I and my colleagues in the Social Democratic and Labour party believe that we should remain in the European Union and I give a little warning based on evidence direct from Danske Bank. This week, it said in the quarterly sectoral review for 2016 that the economic growth forecast for Northern Ireland had been revised down to 1.6% from 1.8%. Angela McGowan of Danske Bank was reported in the business press yesterday as having indicated that that was due to the threat of Brexit, austerity and slower global growth, which takes us back the global commodity markets. She said:

“The message remains that Northern Ireland’s economy continues to expand, but the pace of growth is slowing. While the continued reduction in the public sector jobs will weigh down overall growth in the short to medium term, by far the biggest risk to growth this year is Brexit which has lowered investment and growth in the first half of this year…but there is no reason the private side of the economy should not bounce back”

after the referendum, which I hope will produce a remain vote.

Those on the leave side have not produced any evidence on which to base their arguments, and they do not know what the far side of a leave vote would look like. However, I know that there will be a severe impact on our local economy. I firmly believe that there is a future for the Northern Ireland economy and for our young people, but that depends on several factors. One is staying in the European Union, otherwise we will close easy access to the 500 million potential tourists in the EU and block off one of our biggest areas of growth.

I once again congratulate the hon. Member for Upper Bann on securing this important debate. I hope that the Northern Ireland Executive will get down to work and ensure that new areas of growth can be tapped into and that new areas for visitors can be created. That can happen only in a context in which we are totally open for business and totally open to new markets. That means remaining in the European Union.

Too often the biggest barrier to exports of agricultural goods are health and inspection regimes in destination countries. One of our main efforts involves trying to develop the market to China and other countries and that is why the Department for Environment, Food and Rural Affairs has been working closely with Department of Agriculture and Rural Development officials and industry to collate information and to address any concerns from destination countries, hopefully cutting out the delays in gaining export health certificates for Northern Ireland suppliers.

Does the Minister agree that although getting an export licence and getting approvals for Northern Ireland food produce already takes too long, the wait for Northern Ireland farmers would become ever longer if we were to leave the European Union and had to renegotiate our trade relationships with some of our nearest neighbours within the European common market?

It is certainly in the interest of Northern Ireland farmers and all farmers across the European Union that they have access to new markets across the rest of the world. That is one reason why my right hon. Friend the Secretary of State for Environment, Food and Rural Affairs is, as we speak, in Washington lobbying hard for more access for UK farmers to sell their beef into the United States. We should recognise that the United Kingdom can do it, but if we do it alongside the EU in things such as the EU-US trade treaty we will gain more markets for our farmers and they will go from strength to strength.

I beg to move,

That this House has considered the effect of the UK leaving the EU on Northern Ireland.

I am glad to serve under your chairmanship today, Mr Crausby, and pleased to see the Minister in his place. I am grateful to have this opportunity to highlight in brief the effect that the UK’s leaving the EU would have on Northern Ireland. I believe that all of Britain and Northern Ireland benefit from being part of the EU, but there are special circumstances in Northern Ireland that require thorough consideration before the vote in June. To put it simply, Northern Ireland uniquely benefits from our membership of the EU, and would be uniquely hurt by leaving.

The most obvious issue, for which there is no parallel in Britain, is the land border that we share with the south of Ireland. Anyone who lives in a border county will know for themselves that talk of a hard border in Ireland is not an abstract, scary story, but a living memory. I was reminded of that last week when I attended the launch of the Irish4Europe campaign in London. It is a campaign group set up to encourage Irish people living in Britain to engage with the referendum. During the questions and answers, someone told us about growing up in Quigley’s Point in Donegal, and an attempt to smuggle 4 lb of Northern Irish butter into Donegal. It was foiled by the honesty of his grandmother, who when asked by the guard whether there was anything to declare lifted her coat off the back seat and revealed the 4 lb of butter. We laughed but the story is less funny in the light of an official report from the Cabinet Office that says:

“Northern Ireland would be confronted with difficult issues about the relationship with Ireland. Outside the EU’s Customs Union, it would be necessary to impose customs checks on the movement of goods across the border.”

To be clear, that warning comes not from me or my party but directly from the Cabinet Office. The same report says:

“Questions would also need to be answered about the Common Travel Area which covers the movement of people.”

I thank the hon. Lady for giving way. She will understand that I come from a different point of view. The Stormont Public Accounts Committee recently concluded that Brexit would have little effect or impact on the Northern Ireland economy. Secondly, the hon. Lady will know that the fishing industry in Portavogie, Ardglass and Kilkeel is clear that it wants a viable fishing industry free from EU red tape, the quota system, days at sea and EU legislation. They want to be able to fish the seas round their area—

Needless to say, I do not accept that proposition—for a simple reason. I understand and appreciate people in the fishing industry because I represent fishermen from two of those ports, but I also understand that it would be possible to argue better for reform of the common fisheries policy by continued membership of the EU. There are people in the fishing industry, and senior people particularly, who have told me that fishermen have asked public representatives to be particularly cautious. Many of the regulations about discards and the landing ban originated in London, in Whitehall, and not in Brussels. People must be careful about that point.

The hon. Lady is making excellent progress in her prosecution of the argument for remaining in the European Union. Upstairs, the Select Committee on Northern Ireland Affairs is conducting an investigation of Brexit. We have just heard from the Ulster Farmers Union about why, for them, the case for Brexit has not been made. Its members have worries about the potential for 40% of their trade to the continental European beef and dairy market to be damaged by a Brexit scenario.

That was a very helpful intervention, and that story has been articulated to me by farmers, and the farming community and its representatives, including the Ulster Farmers Union. They are concerned about the free movement of products, produce and people across the island of Ireland. The north’s greatest export market is the south of Ireland. It is also here in Britain, and the wider common market of the 27 countries. We all know how long it takes for an export certification to be processed. It can take several years. Just look what has happened in China. We are still awaiting a certificate in respect of Taiwan. As for the export of poultry products to China, that has not yet been resolved. The nonsense being perpetrated by the no campaign should stop, because it is scaremongering to farmers, farming communities, and particularly those whom I represent.

To go back to the Cabinet Office report, I stress that it does not say that either the British or Irish Government would want to impose custom points. It simply says that it would become necessary. It highlights how, outside the European Union, managing the border could quickly fall outside either Government’s control. No matter what the wishes of the two Governments were, the border would become a victim of differing policies between the Common Market and the exited UK.

My hon. Friend touches on an important point, because borderism would become inevitable. We are not free of it at the minute, even within the current EU context, as wedding car businesses in my constituency can testify. Once those pressures or issues arise, border controls and border differences are emphasised, and that has an impact on trade.

I thank my hon. Friend for a helpful and informed intervention. His constituency has a clear border with County Donegal, and he articulates a particular fear: our concern that customs posts will immediately be put up, and will carry with them a major impediment to and restrictions on trade and people’s betterment. Far from improving control of our borders, leaving the EU would make it harder for the UK to manage the only land border that it has with the Common Market. That is a risk that we cannot afford to take.

We must remember that the south of Ireland is by far the north’s biggest export market. The latest regional trade statistics produced by Her Majesty’s Revenue and Customs, released at the beginning of the month, show that a third of all exports from the north went to the south of Ireland, at a value of more than £2 billion. In the decades before the European Union made an open border possible, the hard border prevented north-south trade developing naturally, to the detriment of all communities in the north. By helping to open up the border, the European Union has enabled businesses to begin building a mature all-island economy that benefits and enriches everyone in the region.

I congratulate the hon. Lady on obtaining what is obviously a timely debate. She talked about reform being necessary, and I have heard her and her colleagues mention that before. Does she agree that, whatever negotiations the Prime Minister has done, and whatever reforms have been agreed, the deal will be that we have got what we have got and will have to accept it, with all its problems and faults, or else leave? She cannot have her cake and eat it—talking about reform after the debate has concluded and the referendum has been held.

The Social Democratic and Labour party and I strongly believe that we should remain in the European Union. If Britain were to exit, it would cause immense economic, social and political damage to Northern Ireland. Our political and peace processes were modelled on the European Union, when countries came together in a post-conflict situation. The European Union is good for political, economic and social cohesion. Already, we have had reforms to the common fisheries policy through regionalisation. There is nothing to prevent further discussions from taking place within the European Union, to enable even better deals on that specific issue.

I thank the hon. Lady for securing this debate. In the past two years, the Northern Ireland Department of Agriculture and Rural Development has received £635 million in EU funding, mainly due to single farm payments. Given the huge contribution of agriculture to the Northern Ireland economy, does she agree that that should be fully addressed by the Government before asking people to vote in the upcoming referendum?

I thank the hon. Lady for her helpful intervention. That is what farmers have been saying to me consistently. They want to remain within the European Union because there is certainty with the direct payments that they currently receive. There is absolutely no certainty in an exit about the type, form and nature of the moneys that those farmers would receive, because the UK is currently going down the road of austerity and cuts—we will probably hear about that later, in the Budget. I do not want to see the farmers whom I represent in South Down, nor those of my colleagues, subjected to such cuts.

I am grateful to the hon. Lady for giving way. Before she moved on to agriculture, she was talking about the political process. Does she agree that the cross-community support for peace won, and the role of the EU in the peace process in Northern Ireland, were essential in, and continue in subsequent programmes to be an essential component of, the peace process? The European Union has been positive for the peace process in Northern Ireland.

I thank the hon. Gentleman for his helpful intervention. All the moneys that have come out of the peace programme have brought people together, right across communities; they helped to build that peace and political process and that delicate, intricate network of relationships.

The same has happened with the Interreg programme. I look at those cross-border programmes. I look at what has happened up in the north-west, in the constituency of my hon. Friend the Member for Foyle (Mark Durkan), with district councils along the border there between Derry and Donegal; down between Fermanagh, Cavan and Monaghan; and also in my own area—the east border region—with the constituency of the hon. Member for Strangford (Jim Shannon), my own constituency, Armagh, Banbridge and Craigavon, with Louth and Monagahan. Those relationships have borne money for many types of cross-border project and have allowed people to grow together in mutual understanding, through the benefit of the European Union. I wish others who think differently would stop being naysayers in this debate.

Much has been said about the impact on farm subsidies. It is an area where our economy is hugely reliant on our ability to export to and work with the south. Farming makes up a bigger proportion of our economy in Northern Ireland than it does in England, Scotland or Wales, and our smaller population means that we have no other option but to export. That means Northern Irish farmers are especially reliant on access to EU markets, including the south, and farmers in Northern Ireland receive more than £230 million a year in support from the European Union.

The Ulster Farmers Union has made it clear—it has probably already said so this morning in the Northern Ireland Affairs Committee—that that support has been vital in keeping our sector sustainable through tough times. I am certain that £230 million a year is more support than we would ever be able to secure from the British Government, should we vote to leave the EU. My certainty on that comes from the years that I and my colleagues before me have spent fighting for the interests of farmers in South Down and other constituencies.

Both the Department for Environment, Food and Rural Affairs and the Cabinet Office have made it clear that there are no serious contingency plans in place for how support for farmers would be replaced should we leave the EU. Every penny would have to be fought for, in competition with all of Scotland, England and Wales. For others to suggest the contrary is totally spurious. No matter what they claim, the only way we can be certain that the support for farmers will continue is to vote to remain this June. Of course, we have already heard some politicians promise that their good relations with the British Government will enable them to secure even more support for Northern Ireland should we leave the EU. I ask those politicians: where have you been for the past five years, as we have seen cut after cut to services in Northern Ireland?

The damage to agriculture will come not only from the loss of subsidies, but from the instability and confusion that transitioning away from the common agricultural policy would cause. One need only look at the massive problems caused for farmers by the ongoing delays in getting payments out in the basic payment scheme. Delays in the payment of European support have pushed many farmers into debt and hugely undermined the sector. Imagine how much greater damage would be caused by the wholesale loss of European support. In contrast to the instability and uncertainty we would face outside the EU, if we work with our neighbours in the south and with the greater Common Market—to which we can export our products, and which could be fractured if there were an exit—we can build an outward-looking, sustainable agricultural sector.

I would like to conclude with a few words on the founding purpose of the European Union and what it means to us in the north. The European Union was founded to bring peace to a continent that had been torn apart by war and conflict, and to enshrine respect for human rights throughout the continent. The duty to build a lasting peace may seem far removed in the UK-wide debate, where the memories and sacrifices of the second world war grow more distant by the year, but it is something that we in Northern Ireland understand all too well. For us in Northern Ireland, the EU’s principles of co-operation, integration and reconciliation are as relevant today as they were 40 years ago.

The EU has been a practical as well as a symbolic partner for us. We should not take for granted the money that comes to us when we look at the peace programme and at the funding from Interreg. Our membership of the European Union also helps to guarantee the human rights protections that made the Good Friday agreement possible. Those protections have since been further embedded, post-Lisbon, through the EU charter of fundamental rights, made binding on all member states since 2009. I therefore regret the decision of the British Government to scrap the Human Rights Act.

The EU might not be perfect, and we do not claim it is. We want more democracy, more accountability and more engagement, but voting leave will not get us any of that. Ultimately, voting leave would send a message to the world that we are more interested in looking inward than engaging with our neighbours. It would send a message that we have lost faith in building a better Europe and a better Northern Ireland within an island of Ireland. That would be a disaster for us. I still believe that dialogue, openness and integration are the only means to a better society, both in Northern Ireland and throughout Europe. Those, for me, are the principles of the European Union. That is why I will be voting to remain this June and why my party and I will be encouraging others to do the same—not out of fear, but out of hope and anticipation for the future that we can build together.

We are all grown-ups, I hope, in this House. We all know the pressures that every Department across Whitehall gets on an annual basis from Treasury Ministers and other Ministers alike. Our farmers, with their direct payments from Europe, are often in a position to resist pressures from other Whitehall Departments. Take the idea, for example, that we would have let previous Labour Secretaries of State responsible for agriculture to get hold of that money en route to farmers. How long would it have lasted? This Government will continue to support our farmers, but I cannot guarantee that that would happen if Members from other parties in this House got into government.

The Government believe that being a member of the European Union makes us safer. Co-operation on security is at the heart of a successful security policy. We all remember the days of wrangling with Irish courts about deportation and bringing people back to the United Kingdom for trial. Not so long ago I recalled someone under licence, and they will be brought back under a European arrest warrant. It was straightforward. There is no more of the long wrangling that often saw people walk free. The co-operation that we have around the table in Europe on security issues creates trust, and at the heart of a good security policy is trust. I believe that remaining part of the European Union will allow us to develop that trust and build on it, and I also believe that we will be stronger. We are part of the European Union, and we are part of NATO, the G8 and the G20. All those organisations—all those unions and groupings—allow the United Kingdom to amplify its voice across the world stage. They allow us not to stand alone on many issues, which is very important.

The hon. Member for South Down mentioned the border. It is a fact that if we vote to leave the European Union, we will be outside the customs union. If we are outside it, the EU will require the remaining member states to make sure that there are safeguards to protect that customs union. That will inevitably be some form of barrier to trade, to small and large businesses in Northern Ireland. I met some small businesses in north Belfast only a few days ago. They effortlessly trade and grow their business across the border, and they effortlessly make sure that they have new markets in the Republic of Ireland. I do not think that the whole border will be shut if we leave, but I certainly believe that there will be extra barriers to trade that we do not need or that are unhelpful.

I will make a final point. People will hear the debate about guaranteeing our borders and sovereignty. It is obviously true that within the European Union we have arrangements with regard to our borders, but let us not forget that we are members of the UN. We have obligations under a succession of treaties—the 1951 Geneva convention relating to the status of refugees, the 1967 protocol relating to the status of refugees, the 1948 universal declaration of human rights, the 1984 UN convention against torture, which prevents us from deporting people to countries where torture or harsh punishment exist, and the 1989 UN convention on the rights of the child. All that means that were we to leave the European Union, we would still be obliged to take into this country a huge range of people under our UN obligations. That is an example of where our sovereignty does not 100% lie. Are we saying that we will then leave the UN? Is that the next thing—“Stop the world, we want to get off”?

We should remember that were we to leave the European Union, our borders would not be as easy for trade as we may like, and they would not be as open to the hundreds of thousands of tourists that come to Northern Ireland every year. Our borders would also not be so easy for our air flights to and from Northern Ireland, so that people can arrive in the south, travel up through for tourism and fly out of Northern Ireland. All that is incredibly important to remember.

I have to say to the hon. Members for Strangford (Jim Shannon) and for Edinburgh North and Leith (Deidre Brock) that I am a Unionist. Many of the reasons for belonging to the United Kingdom are the same as the reasons for belonging to the European Union. I do not say that the reasons are all the same, but the freedom to trade, the shared culture and the removal of barriers are things that, in my heart, make me a Unionist. I do not understand the Democratic Unionist party’s view that by putting in a new border we will somehow guarantee ourselves all those investments and good trade practices that are important, and also the ability to be stronger in Europe, rather than weaker on the outside.

We are unable to support the proposition behind amendment 1. We are not against the concept of moving towards greater independence for such appointments, but in the context of getting a political agreement that was not possible, as the hon. Member for Fermanagh and South Tyrone (Tom Elliott) rightly acknowledged. The Stormont agreement therefore gives the responsibility for making the appointment to the Office of the First Minister and Deputy First Minister. I listened carefully to what the hon. Gentleman said and would echo the comments of my hon. Friend the Member for East Antrim (Sammy Wilson)—East Antrim, not South. We have not yet redrawn the boundaries in Northern Ireland, although we are going to.

We have two difficulties with the proposal to use the Policing Board. May I say that having served on the Policing Board, I fully support it as an institution. It does a good job on the whole question of accountability in policing. Our objection is not on the basis that the Policing Board is somehow deficient, but the hon. Member for Fermanagh and South Tyrone revealed his true objective and motivation when he talked about the suitability of the Deputy First Minister to be involved in this appointment because of his alleged past in the IRA.

I have a lot of sympathy with what the hon. Gentleman is saying, but the difficulty I have is twofold. First, as my hon. Friend the Member for East Antrim rightly pointed out, we have three Sinn Féin members on the Northern Ireland Policing Board: Gerry Kelly, Pat Sheehan and Caitríona Ruane. At least two of those members have past convictions for IRA terrorism, so passing responsibility to the Policing Board does not resolve the difficulty the hon. Gentleman refers to, in terms of victims and survivors of the conflict in Northern Ireland having a problem with anyone from Sinn Féin being involved in the appointments process—a concern I have much sympathy with.

I depart from the hon. Gentleman on the second point made by my hon. Friend, on the question of the veto. The current arrangement that gives us a veto in the office of the First Minister over who is appointed is surely a far stronger safeguard to ensure that the people who are appointed to this very sensitive role are people that the victims and survivors community can have confidence in. If we go to the Policing Board, there is no such veto. Indeed, the political influence on the Policing Board is outweighed by the independent influence. I emphasise that I have nothing against the current structure of the Policing Board; I am merely making the point that if you want to exercise a degree of accountability on this issue and ensure that the people who are appointed to this very sensitive role are appropriate for that role, having a veto gives you the leverage to ensure that that happens, whereas if you pass it to the Policing Board you lose that veto.

For those reasons, we will not be able to support the amendment.

I am pleased to serve under your chairmanship, Mr Crausby. I rise to speak in support of amendment 7.

On Second Reading, I said that we must cast our minds back to the reasons for the independent reporting commission. This all emerged in the violence and terrorism of last year when two people lost their lives: Gerard Davison at the beginning of May, in the Lower Ormeau and Markets area of south Belfast; and Kevin McGuigan, somewhere in that same location. As a result of those deaths and the breakdown of relationships around the Executive table, we had negotiations on the Stormont House agreement. During those negotiations, the SDLP circulated papers to the three Governments and all parties on a whole enforcement approach, and a whole community approach. We believe that the answers and the solution must come not only from Government and from political parties but from the wider community. There must be a buy-in to a solution, to the eradication of terrorism, violence and antisocial behaviour and to an upholding of democratic principles. We also believe that, although “Fresh Start” was designed and managed to be a two-party deal, there should have been all-party work on the membership of the independent reporting commission. How can the work of that commission and its mandate, which includes the Irish Government and Dublin representatives, be reconciled with that approach by Sinn Fein?

During the Second Reading debate, I asked the Secretary of State to say precisely what new moneys would be made available to the National Crime Agency and the Police Service of Northern Ireland, when those moneys would be released and what the split between the two would be. That set some of the background for our amendment. Like the Ulster Unionist party, we feel that the credibility of the independent reporting commission would be enhanced if it involved the Executive more widely rather than just the First and Deputy First Ministers. We believe that it is not a Policing Board matter, which is why we have specified that the two members will be appointed by the Justice Minister in consultation with the First and Deputy First Ministers, subject to Executive approval, hence providing the transparency and accountability that are required in this particularly vexatious issue. All of us on these Benches are agreed on one point. We want to see an end to violence, paramilitarism and terrorism. Above all, we want to see the upholding of democratic principles of government and in the wider civic community.

I support our amendment 7 in this group.

I am grateful for that helpful intervention, as ever, from the hon. Gentleman. I am sure the Minister and the Government would not like to be accused of being inconsistent. We have to be consistent here. A consistent approach has to be taken to the eradication, once and for all, of paramilitary activity and all its criminality in Northern Ireland. The Minister will have read this Bill many times and when he carefully reads it again, he will know that the precedent has already been set. We in this House are the sovereign Parliament, thank goodness, and just as a show of sovereignty the Standing Orders are already provided for in several clauses. My amendments simply extend further Standing Orders, without any detail about the sanctions or the investigatory procedure.

On that, I will bring my remarks to a close, having warned the Minister that I will push my amendment to a vote at the end, with the help of volunteers to be Tellers.

A number of Members, including the hon. Member for North Down (Lady Hermon), who raises this issue again through her amendment, have asked questions about the content and policing of the pledge and undertaking. That was done on Second Reading by my hon. Friend the Member for Foyle (Mark Durkan), as well as by the hon. Lady, who has enunciated her views on the principle again today.

I shall speak to my party’s amendments. Amendment 10 refers to paragraph (e) in schedule 4 to the Northern Ireland Act 1998 and clarifies that Ministers are already subject to a requirement to act in accordance with all decisions made by the Executive and the Assembly. Amendment 16 deals with clause 8, inserting the words “others, including” in the reference to MLAs. The provision might seem small, but it is central to the whole-community approach that will be needed to tackle paramilitary activity. It would compel Members of the Assembly to work with civic society in Northern Ireland, reflecting our approach during the Stormont House agreement of having that community approach to ridding Northern Ireland of paramilitarism.

I agree with the hon. Lady that paramilitarism has been a scourge and a cancer in our society, right across the community, and we want rid of it, but we also believe that there must be adherence the best democratic principles within our elected institutions. Our reference in amendment 15 to the Nolan principles would ensure that this progress and political action on paramilitarism extends to MPs, councillors and all in public office. Having the First Ministers make their pledge orally at a sitting of the Assembly would publicise a cross-executive commitment to a society free from the blight of paramilitarism. In our papers for the Stormont House talks, we advocated a community approach, stating:

“Political parties ought to be showing coherent and consistent shared standards which recognise and repudiate nefarious paramilitary interests and involvements. This should reflect a shared approach which is about rooting out paramilitarism and its trace activities, not just singling out particular groups or given parties.”

Our amendments would clarify the terms of the pledge and undertaking and avoid further misinterpretation or a tension between different parts of the pledge and undertaking. As I have said previously, the duty in the Bill to

“support those who are determined to make the transition away from paramilitarism”

is vague and could be misinterpreted as supporting someone or a group that is determined to someday move away from paramilitarism. The SDLP is in favour of support for transition away from paramilitarism, but wants to ensure that that cannot be used to cover tolerance for paramilitary activity, for which there should be no tolerance. Combining what are currently two distinct precepts of the pledge and undertaking into one would reduce that risk.

I have direct experience of this issue. As a former Minister in the Northern Ireland Executive, on Tuesday 16 October 2007—I remember the date exactly—I cut off funding to the conflict transformation initiative following advice from the then Chief Constable, deputy Chief Constable and others that the Ulster Defence Association was engaging in criminality. Maintaining that funding would have been construed as supporting paramilitarism, not transition, however determined the UDA was to do that someday.

Like the hon. Member for North Down, we have concerns about the policing of the pledge and undertaking. Any progress on tackling paramilitary activity is undermined by any suggestion that there are no consequences for non-compliance. I note that the hon. Member for East Antrim (Sammy Wilson) was making soundings in our direction. I hope he will see fit to support our amendments on sanctions in relation to the pledge and undertaking.

We envisage that the Northern Ireland Commissioner for Complaints and the Northern Ireland Assembly Commissioner for Standards would receive any complaints relating to breaches of the pledge and undertaking. Both could avail themselves of the services of a pledge adjudicator on a case-by-case basis, if that was felt to be appropriate. The whole purpose of our amendments is to ensure best compliance and conformity with good democratic principles, and that we have a total move away from the scourge of paramilitarism that has been in Northern Ireland society for far too long.

We support amendment 6, which was tabled by the hon. Member for North Down (Lady Hermon). There is much merit in what she says. When we ask Members of a legislature to give an undertaking that they will behave in a certain way and abide by certain principles, surely there should be some sanction when they breach those principles and their undertaking. We are not asking hon. Members—neither is the hon. Lady—to prescribe what the sanctions should be. We merely want to ensure, as is our duty as the sovereign Parliament, that the Standing Orders of the Northern Ireland Assembly reflect the need for such sanctions. It is our duty to legislate for this element of the Stormont agreement, and we believe that what the hon. Lady has proposed is sensible and prudent. This is a question of not just the politics of all this, but public confidence in the Northern Ireland Assembly, its operation and those who are elected to it.

We talk about a fresh start. We have Assembly elections on 5 May. The Members who will be elected to the Assembly for the first time after that election will be required to make this undertaking. I think that that is the appropriate moment when the Assembly should be saying that we can have no more of a situation in which some people may have been ambivalent in their attitude towards paramilitarism in the past. Everyone has to be very clear about where they stand and it is important to have the undertaking. It is also important, for public confidence and for the accountability of our public representatives, to have a sanction. It is for the Assembly to prescribe that sanction, but it is for this House to ensure that the requirement for that is in Standing Orders. We will support the hon. Lady’s amendment.

I rise to speak on Third Reading of a Bill that basically addressed the independent reporting commission, the pledge, the budget and, through our various amendments relating to joint Ministers, the election. We have sought through Second Reading, through Committee and on Report to ensure that the Bill was strengthened, made more meaningful and made more robust. I hope only that the Government have listened and will bring forward appropriate amendments in the other place to deal with these particular issues.

So far, I have not yet heard from the Secretary of State. Perhaps she will drop me a line to say how much money will be made available to the National Crime Agency and to the Police Service of Northern Ireland, when that money will be released and what will be the split between the NCA and the PSNI, particularly in relation to the Independent Reporting Commission.

We tried to raise national security issues on Second Reading, and paramilitarism and criminality are to be addressed, but the Government have invoked and can invoke through this legislation national security, which means the protection of agents. That can impede the very work that we are trying to do. It also means both the Government and the paramilitaries will never be willing to ensure that the full truth about many of those issues is brought to light.

What we are saying, or what I am saying, is that there should be full disclosure of information to ensure that all those who were, shall we say, involved in paramilitary activities are made responsible to the due process of the law. I do not think anybody could disagree with that.

Let me deal with an issue that is not contained in the Bill, but to which reference has been made—the lack of a comprehensive legacy Bill. We have already heard the Lord Chief Justice speaking in Belfast this week about the issue of inquests, referring to the role of the Northern Ireland Assembly. We also heard references made today by the Director of Public Prosecutions to that particular issue. What we need to see—I hope the Government are listening—is a credible legacy Bill that is seen to be credible by victims and survivors alike.

Since the Eames-Bradley report, we have witnessed a dilution of the proposals on the past. I say again that national security cannot be used as a catch-all for lack of transparency or to suppress the truth that victims demand and deserve. I just hope that the Government have listened today, and that they will be able—I say this with a level of humility to the Secretary of State and to the Minister—to bring forward amendments in the other place that reflect what was said here today about the pledge of office, the independent reporting commission and the new clause and related comments put forward by my hon. Friends the Members for Foyle (Mark Durkan), for Belfast South (Dr McDonnell) and myself about the implementation and reconciliation group. I note what the Minister said about those issues, but I believe that in the months and years ahead, the Government—in whatever guise—will have to return to those questions and address them. They will not wither on the vine; they will still exist.

The Government are very clear that being in the EU makes us better off, stronger and safer. I do not think that we will be diverted by commissioning external reports about what may or may not happen. The United Kingdom knows exactly what being in the EU looks like, because we are in it now. The reforms that my right hon. Friend the Prime Minister has got will achieve that goal.

Earlier this week, a Cabinet Office report was published that stated that leaving the EU would result in the imposition of customs checks at the Irish border. Do the Minister and the Secretary of State accept the assessment of the Cabinet Office? What impact do the Government expect customs checks to have on Northern Irish exports to the south—and this is being positive?

Of course, as a member of the Government, I accept the Cabinet Office’s views. We should not forget that Ireland and the United Kingdom have a long-standing agreement, the common travel area, which would mean that certain barriers would not be in place. However, should we leave the European Union, we will be outside the customs union, and that will inevitably lead to some form of extra barriers to trade.

I was wondering when that subject would come up. I can assure the hon. Gentleman that there are a whole range of reasons why the relationship between the UK and Ireland has improved massively in recent years.

I have outlined the main features of this short, but important, piece of proposed legislation on Northern Ireland.

There is one area that is not in the Bill. Will the Secretary of State inform the House when the legacy Bill will come forward? Many people throughout Northern Ireland are grieving deeply and want to know when the proposals will come forward.

The hon. Lady raises a very important issue, which I was about to come on to. Sadly, I am not able to give her a date for the presentation of that proposed legislation, but, as I will go into, I am determined to work as hard as I possibly can to build the consensus necessary to enable us to introduce it. I agree with her: it is very important that we press ahead.

I must put on record my gratitude for the co-operation of Her Majesty’s Opposition in agreeing to a somewhat faster than usual passage of the Bill through the House. This should enable measures relating to the pledge of office, the undertaking and the extension of the time available for ministerial appointments to be in place in time for the new Assembly when it meets in May. It will enable the new independent reporting commission to be established as soon as possible.

I am very conscious, returning to the point made by the hon. Member for South Down (Ms Ritchie), that some important elements of the Stormont House agreement are not, sadly, in the Bill we are discussing today.

I am delighted to participate in this Second Reading debate. I offer my condolences to the hon. Member for Tewkesbury (Mr Robertson) following the bereavement of his staff member. I also offer my condolences to my hon. Friend the Member for Foyle (Mark Durkan) following his family’s bereavement last night.

In its generality, the Bill deals with trying to eradicate paramilitarism. Like my hon. Friend the Member for Belfast South (Dr McDonnell), I want to emphasise not only my party’s consistent support for political and economic stability throughout Northern Ireland and the island of Ireland, but, above all, our unequivocal opposition to all forms of paramilitarism, whether it comes from republican or loyalist paramilitaries. Paramilitarism, and what it fed and spawned, created not only instability but fear. It was like a cancer running throughout our society.

There were also other issues. The right hon. Member for Lagan Valley (Mr Donaldson) referred to the murder of six innocent men in Loughinisland on 18 June 1994. That is a night I will never forget, because two people who were murdered that night were directly related to relatives of mine—one was an uncle and another was a cousin. In that respect, therefore, I know the character of those people, and their only political act on any occasion was to register their vote. Never by word or deed did they undertake any form of paramilitary activity, but they died at the butt of a gun, and their bodies were strewn over a pub.

I would therefore say to the Secretary of State that her comments on 11 February were in some ways unfair, because at the moment the independent police ombudsman is undertaking, and near the completion of, another inquiry into what happened in Loughinisland on that night and why it happened. Were there elements of collusion between the then RUC and those who perpetrated those awful crimes on that night, robbing the community that I represent and, above all, that I live in of six good people and irrevocably changing our community, not because what happened moved people towards violence in any form, but because it left them in a state of fear, in a community that had never known any form of violence before? I urge the Secretary of State in that respect to be particularly careful, because her words on 11 February could be construed as trying to obfuscate that inquiry by the police ombudsman, which is near completion. That is the second inquiry, because the previous ombudsman’s inquiry was inconclusive and, in many ways, could be perceived as being deliberately inconclusive.

I am listening carefully to the hon. Lady’s comments, and I have huge regard for her. I would just like her to put on record this evening her gratitude to the RUC, which stood between the whole community of Northern Ireland and absolute mayhem through more than 30 years of appalling violence. Three hundred and two RUC officers paid the ultimate price with their lives. I am sure she would like to put on record her gratitude for the sacrifice and courage of the RUC through the awful years of the troubles.

I thank the hon. Lady for that intervention. We were always opposed to the murder of members of the security forces, whether those security forces were the RUC, the UDR or the Army. We saw what that did to those people and to their families. That murder and that paramilitarism against members of the security forces was totally unacceptable; we condemned it at the time, and we will always condemn it—we are very clear about that. Let me move on to other issues.

There is a clear need to ensure that economic stability is embedded in Northern Ireland, as my hon. Friend the Member for Gedling (Vernon Coaker) said when he referred to issues to do with corporation tax and the loss of jobs last week at Bombardier in the constituency of the hon. Member for Belfast East (Gavin Robinson), and other job losses. The most important thing is to ensure that existing economic stability in Northern Ireland is protected. What better way to do that, I say again, than through continued membership of the European Union, because we have a ready export market in the south of Ireland and are also able to trade with the wider Common Market? I ask the Secretary of State to reflect on her position in that respect.

Moving on to elements of the Bill, clause 1(4) deals with the independent reporting commission, to which the First Minister and Deputy First Minister can nominate two persons. I suggest that there would need to be a legislative input for the Justice Department, despite the character of the independent reporting commission. It could be argued that any Northern Ireland nominations should be made by the Executive as a collective body, or chosen from proposals made by parties. The issues that fall to the independent reporting commission brought the parties together in September last year, because they refer directly to the murders of Gerard Davison in the first week in May last year and of Kevin McGuigan in August. Both people resided in the constituency of my hon. Friend the Member for Belfast South.

During the negotiations—I am sure that the Secretary of State and the Minister will recall this—we in the SDLP circulated papers to the three Governments and all parties on a whole-enforcement approach and a whole-community approach on how to address the issues of paramilitarism. Despite fresh start being designed and managed to be a two-party deal, there should have been all-party work on IRC membership. How can the work and the mandate of the IRC, which includes Dublin representatives, be reconciled with Sinn Féin’s approach to Tom Murphy from South Armagh? I would like to press the Secretary of State on precisely how much new moneys are to be made available to the National Crime Agency and the PSNI, when those moneys will be released, and how they will be split between the National Crime Agency and the PSNI.

Clause 2(3)(a) deals with national security, which was referred to by the right hon. Member for Lagan Valley. Paramilitarism and criminality are therefore to be addressed, but unfortunately the British Government can invoke national security, and that allows for the protection of agents who have information, thereby impeding work on the resolution of many cases.

Clause 6(1) deals with institutional reform. Yes, 14 days before the appointment of Ministers is okay, but fresh start refers to a proposal that parties have to agree to go into the Executive before the programme for government is finally agreed. Have the Government contemplated any amendment to this proposition? The pledge of office for Ministers states that they must

“support the rule of law unequivocally in word and deed and…support all efforts to uphold it.”

How can this be reconciled with Sinn Féin’s view on the National Crime Agency? The NCA is a vehicle for the rule of law, yet in February 2015 Sinn Féin opposed a motion in the Assembly that proposed support in word and deed, and refused to endorse it at a recent meeting of the Policing Board. How does the new pledge address Sinn Féin’s approach to Mr Murphy? The same applies to the pledge of office for Assembly Members.

In the Stormont House talks, and in our submissions to those talks, we have made the point time and again that capricious or divided political messages on paramilitarism exacerbate the challenges facing people trying to move community transitions and graduations away from ingrained paramilitary interests. A genuinely united political stance from all parties in the Assembly is imperative if we are to enable statutory agencies and community groups to challenge ongoing paramilitary activity, which should be condemned outright from whatever quarter it comes. For that reason, the ministerial pledge of office and the undertaking by Assembly Members are welcome, but further clarification is required.

One element of the pledge, in particular, requires further scrutiny: the reference in the pledge of office and the undertaking by MLAs to their duty

“to support those who are determined to make the transition away from paramilitarism”.

Will the Secretary of State or the Minister provide some clarification on that? Rooting out paramilitarism is not an overnight process, and scope has to be allowed for transition, but that cannot apply to illegal or untoward activity by paramilitary groups, or manifest itself as respect or tolerance for different classes of paramilitary behaviour. As MPs representing Northern Ireland constituencies, we have seen many examples of paramilitary activity.

As I said in my intervention on the Secretary of State, I regret the fact that there has been no legislative addressing of the legacy issues that need to be dealt with—the victims and the past. I urge that such legislation be introduced and that, as my hon. Friend the Member for Foyle said, it is subjected to detailed scrutiny by this House, because we owe that to all the victims and all those who have suffered so terribly as a result of such heinous violence that was never asked for and never called for.

In the outworkings of all these agreements, we must try to achieve political and economic stability, because that is what we all strive for and all want to see. For the betterment of all our constituents and all the citizens of Northern Ireland, we must ensure that social justice is provided for and that inequalities that have been inherent across the community for some years are totally addressed. We must also ensure that we see the sustaining of existing jobs and the provision of new jobs through the building up of small and medium-sized enterprises, but also jobs through foreign direct investment. I ask the Secretary of State and the Minister to work with the Northern Ireland Executive to ensure that this comes about.

Absolutely, we will support any measures that deal with the legacy, as my right hon. Friend the Secretary of State has said. We cannot just release the money; we need all the actors on the stage to produce the solution. We need the victims, the PSNI, the courts, the Lord Chief Justice and the Executive to support the solution. If we were just to release money but nobody else was supporting the schemes or the coroners’ courts changes, for example, we would not necessarily solve the issue. We will look with all seriousness and all support at any proposals to solve the legacy issues.

The good news is that we have the Treasury’s agreement for the sum in principle, which is half the battle, as anybody who has ever been in government will know—£150 million is there. That means that the gap between getting the money and delivering it is simply a matter of getting an agreement between all the significant stakeholders in Northern Ireland. We are all determined to do that and it is one of our priorities. We are all trying to get there and we will work with all parties in Northern Ireland to try to do it.
