As someone who supported Brexit, I welcome the statement today and the fact that the Government are going to monitor and identify ways in which we can make our economy more dynamic, more innovative and more competitive. But as a Unionist, I have concerns about the statement. The regulatory freedom that is being sought cannot apply to many aspects of law in Northern Ireland, and Northern Ireland will still remain under the dead hand of EU regulation, which will smother innovation and entrepreneurial dynamism. Will the Minister give an assurance that, in order for the freedoms that he is announcing today to apply to the whole of the United Kingdom, the Government will make every effort and take every step to remove the dead hand of the protocol?

I am grateful to the right hon. Gentleman and share a lot of his views on this matter. It is fundamental that the benefits of leaving the European Union are for the whole of the United Kingdom. I am pleased with the Bill that my right hon. Friend the Foreign Secretary has introduced, and I hope that it will go towards ameliorating the problems that have arisen. Our single united country cannot be ruled by the dead hand of the Brussels bureaucracy, as we voted to leave as a single nation.

I very much agree with my hon. Friend. Indeed, the Commission President will be meeting the Prime Minister tomorrow, and I will be meeting Michel Barnier, to act on that constructive spirit. Both sides have committed to the timescale.

I am conscious that the House is now in a different place, but many Members will recall that it was often said it was impossible to reach an agreement before, indeed, the agreement was reached.

I welcome the fact that the Government are determined to bring this process to an end by December 2020, and I hope that that does concentrate minds in the EU. If the EU and the Government cannot come to an agreement by then, what are the implications for, first, the future arrangements and, secondly, the current withdrawal agreement, especially the provisions in Northern Ireland?

First, I believe we can and will do this, and, as I have indicated to the House, so does the EU, because it has committed, in the political declaration, to doing it. Secondly, a number of issues are addressed through this Bill: citizens’ rights, which the hon. Member for Brighton, Pavilion (Caroline Lucas) asked about in relation to her constituents, are protected through this Bill. People used to talk about a no-deal outcome, and one thing this Bill does is secure the protection of the 3 million EU citizens within our country, who are valued, and of the more than 1 million UK citizens there. The right hon. Gentleman has concerns about the Northern Ireland protocol, and I stand ready, as do my ministerial colleagues, to continue to discuss issues with him. We will debate that in more detail in Committee tomorrow, but, again, the Northern Ireland protocol is secured through the passage of this Bill. That puts us in a very different place from where many of the debates were in the previous Parliament in respect of concerns about no deal.

Does the hon. Gentleman accept that for many people listening to the argument he is making, this is not a case of a fear of jumping over the cliff but more a fear that those opposed to leaving the EU want us to have our feet firmly stuck in the mud of the EU for ever, and that is the reason he wants a further extension?

I thank the right hon. Gentleman for that intervention, because it gives me the opportunity to say that that is absolutely not the case. We accept that we are leaving the European Union in three weeks’ time—end of—but that is not the end of Brexit because we will have considerable discussion in this place, and the Government will be involved in negotiations for some time to come, on the future relationship.

The future relationship is the concern behind new clause 4, because we have consistently sought to oppose any proposals that risk damaging people’s jobs and livelihoods. That is why we voted against the deal proposed by the previous Prime Minister, the right hon. Member for Maidenhead (Mrs May): the current Prime Minister may have voted against her for different reasons. It is why we also voted against the deal proposed by the current Prime Minister in the last Parliament.

Since its introduction in October, this Bill has only got worse—in our view, much worse. It grants expansive powers to Ministers and severely diminishes any role for Parliament in the crucial period ahead. It removes our role in approving the Government’s negotiating mandate and voting on the final treaty. Protections for workers’ rights have been ditched, confirming that the TUC was right to dismiss previous Government promises as “meaningless procedural tricks”. The new Northern Ireland protocol undermines the UK’s internal market—something that the Prime Minister had promised his former allies faithfully that he was committed to protecting. Shamefully, the Government have removed the requirement to negotiate an agreement with the EU on unaccompanied children seeking asylum.

The Government have not only removed any role for Parliament in deciding whether to extend the implementation period but are now specifically prohibiting Ministers from agreeing an extension through clause 33, as the Secretary of State pointed out. So no deal is back on the table, as I think he confirmed in his response to my right hon. Friend the Member for Leeds Central (Hilary Benn). It is that risk that new clause 4 attempts to address. We do not plan to press it to a vote this evening, but it is intended to provide an opportunity for the Government to come back to this House with their proposals, perhaps on Report, on how we avoid the catastrophe of no deal at the end of this year.

It is a reflection of the unfortunately polarised discourse on Brexit, reflected in some of the comments earlier, that new clause 4 was described in some sections of the media at the end of last week as an

“attempt to delay leaving the EU by two years”.

It is no such thing. We recognise, as I said, that the general election result means that we are leaving the European Union on 31 January, but what happens thereafter is crucial to our economy, to jobs and to people’s livelihoods, whether they voted leave or voted remain.

I thank the right hon. Gentleman for his intervention. He will not necessarily take this as a compliment, but Tony Benn could have made those points, because they have run through the arguments of both Conservative and Labour Members who support leaving the EU ever since we joined in 1972.

Not only is it better that those decisions be taken here, but it is often assumed that the EU is good for the economy and the protection of trade union and environmental rights, yet quite a lot of evidence runs counter to that. I am not an expert on fishing, but the discard rule has been an environmental disaster in the North sea. I understand quite a bit about trade union protections and legislation and I never get a satisfactory answer from my side about the Laval and Viking decisions of the European Court of Justice. Not only do they undermine the minimum wage and the nature and definition of a trade dispute; they are effectively unchangeable, as we in this country cannot change laws made by the ECJ. That is what is fundamentally wrong with being a member of the EU.

I have no doubt that there will be changes when we leave the EU—people will be able to claim there has been a negative economic change there or a positive one here—but that happens all the time. Where has our paper industry gone? Has it been helped by the EU and its regulations? What about our agrochemical industry? It was essentially destroyed by European legislation, but I do not hear people in this Chamber arguing against the EU in that regard. It is accepted—I do not know why—that the EU will always be good for these things.

If new clause 4 were to be put to the vote, I would not join my colleagues in support of it. I agree with what Labour Front Benchers have said—that we should use the debate on the Bill to improve things—but going over the debate we have been having in this Chamber since 2016 will not do that. I have no idea—I have not counted up the time—but my guess is that we have spent as much time in this Chamber discussing the 2016 referendum, at which we committed to giving the people the choice, as we did debating both the Lisbon and Maastricht treaties put together. I understand, however, that Front Benchers do not intend to put the new clause to a vote. I hope they can be more constructive as we continue this debate.

The Democratic Unionist party will be supporting clause 33, though tomorrow we will be tabling amendments to the Bill, because, although we accept that it is essential to get out of the EU as quickly as possible, we believe that the terms of the withdrawal agreement are detrimental to Northern Ireland. The purpose, however, of any amendments my party puts forward will be to assist the process of leaving the EU and to ensure that the whole UK leaves. That is not the case with new clauses 4 and 36, which are designed to extend the period for which we stay in the EU and would make it much more difficult to have a clean break.

Have we learned nothing from the tactics the EU has used over the last few years? The longer the period, the more it can hold back, and the more demands it can make. We have seen that time and again.

The last Parliament made it clear that it would not give the Government the support that they needed to move forward with a deal. The EU dug its heels in deeper, and did not try to be accommodating. What is important about clause 33 is that it draws a line, sends a signal and makes the position very clear. It says, “Here is the deadline: now get on with the negotiations.” No clearer message could be sent to those who are negotiating on the EU’s behalf.

Indeed it is significant that, although we were formerly told that a trade deal could take years to negotiate, the language is suddenly changing because the arithmetic in the House has changed and the Government’s will is different. We are now being told, “Well, it might not be as difficult as it was for Canada and Japan. After all, we are starting from the same place, and we have a lot of the same regulations”—and there are a number of other reasons why the negotiation might be easier than we were previously told that it would be.

I suspect that the right hon. Gentleman is referring to the comments of the EU Trade Commissioner. He made those comments in the context of a decision by the British Government to retain close alignment. The difficulties occur when we disalign.

Of course that will be the opening negotiating position. He is not going to say, “Yes, and by the way, we do not have to have close alignment.” There will still be a desire on the part of the EU to keep us as close as possible. However, one way of ensuring that we get a deal, and get the kind of deal that we want, is to make it clear that we will not engage in protracted negotiations. We must say, “We will not allow you to use all the tactics that you have used before. You must come to a conclusion. If you want access to our UK market—and you need access to it because you sell more to us than we sell to you—and if you want the future trading relationship and the co-operation that the Government have offered time and again, you must reach a deal quickly.”

Has the right hon. Gentleman noticed, in the three and a half years of these endless debates, that the Labour and Liberal Opposition have always tabled proposals that strengthen the EU and undermine the UK? Has he noticed that they only ever put the EU case, and never put the UK case?

That was the whole point of extending the implementation period, to allow that tactic to be used, even in this Parliament, with different arithmetic. It is one of the reasons why I think the Government are right to draw a line and say, “We have a year in which to do this. Now let us get on with it, and let us get the deal.” I just hope that during that period, the Government will also be cognisant of the fact that the protocol on Northern Ireland is damaging to the Union, and will seek to ensure in the negotiations that that protocol is weakened and the differences between Northern Ireland and the rest of the UK are changed, so that we leave the EU along with the rest of the United Kingdom and on the same terms.

The right hon. Gentleman has talked about our huge trade deficit with the European Union and how vital a free trade agreement is to the EU—how much more in its interests such an agreement is. I understand that our current trade deficit is more than £92 billion a year. Is the right hon. Gentleman cognisant of that figure?

That is one of the reasons why it should not be too difficult to secure a trade deal. After all, in whose interests is that? It is in the interests of workers in Germany, France, Italy, Spain and other countries all over Europe to have access to the UK market. Our market is lucrative for them. We hear all this talk about why it will be difficult to do a deal, but why would EU negotiators, now that they know there is a different will in the House, want to turn their backs on the UK market? Why would they not want to have the ability to sell goods to us, and to sell them on good terms? They will not want to erect the barriers that people said they were likely to erect.

This is the right thing to do, tactically and politically. The Minister has said that it is necessary to deliver on the commitment that his party made to the electorate during the general election, but let us go back further than that: it is necessary to deliver on the referendum result of 2016, when we promised people that we would leave. I think that the delay has been long enough, and people are frustrated enough, so this is the right thing to do politically, but I also think that it is the right thing to do from the point of view of industry, and economically. We have heard time and again that investment decisions are being delayed because of uncertainty—that people need to know what the future is likely to be, so that we can then see a bounce in the economy. Let us not push this further down the road. Let us make sure that people have certainty as quickly as possible.

Does the right hon. Gentleman agree that, throughout the general election, the mantra of the British people was “Just get on with it.”? Indeed, the outcome of the election was a mandate to the House to get on with the exiting of the European Union, and the new clause flies in the face of the outcome of the general election that we have just had.

Let me conclude my speech, Sir George, by issuing a word of caution about clause 33. While a deadline of December this year can put pressure on the EU, it can also put pressure on the Government. As we in Northern Ireland have learned, the pressure on the Government from the 31 October deadline led to concessions that were not good for, at least, our part of the United Kingdom. This is where Government will and determination are important.

Equally, the deadline that the Government have imposed on themselves could be used by EU negotiators to make demands. Those negotiators could say, “If you want a deal by that stage, here are the things that we want from you: we want you to make concessions on fishing, on level playing fields, on payments and on a whole range of other things.” That is the only word of caution that I will issue. Deadlines put pressure on both sides, and come December this year, whether the Government are prepared to stand firm in the face of their own deadline and not be pushed around will be a test of their will.

I beg to move amendment 5, page 9, line 36, leave out from “Crown” to end of clause and insert

“must by regulations make provision—

‘(a) implementing article 18(4) of the withdrawal agreement (right of eligible citizens to residence documents proving legal status), including making provision for a physical document;

(b) implementing article 17(4) of the EEA EFTA separation agreement (right of eligible citizens to residence documents proving legal status) including making provision for a physical document; and

(c) implementing article 16(4) of the Swiss citizens’ rights agreement (right of eligible citizens to residence documents proving legal status).’”

This amendment would mean that EEA and Swiss citizens residing in the UK would automatically have rights under article 18(4) of the withdrawal agreement (and equivalent provisions in the EEA EFTA and Swiss citizens rights agreements) rather than having to apply for them, and would have the right to a physical document proving their status.

The Democratic Unionist party has been supportive throughout the process of delivering on the result of the referendum of the British people, and we have defied and opposed the procedural chicanery and political machinations that have gone on in this place to try to undermine that result. The irony is that today, which should be a day of rejoicing for us because the Prime Minister has come back with a deal, we find that Northern Ireland, and Northern Ireland alone, will be left within the clutches of the European Union, by being a de facto member of a customs union and tied to European regulations.

The Government have put forward two defences for their position. The first is that there will be no border down the Irish sea—there is no border down the Irish sea. But let us look at the facts. As a result of the customs arrangements, every good that is exported from GB to Northern Ireland will be subject to a customs declaration. Movements will be subject to checks. Unless it can be proved that the goods are not going outside Northern Ireland, duty will be paid. Only once it has been proved that the goods are not leaving Northern Ireland will that duty be paid back. On top of that, all the regulations of the European Union will be imposed on Northern Ireland. If anybody tells me that that does not represent an economic customs legal border—a hard border between Northern Ireland and the rest of the United Kingdom—I do not know what a hard border looks like.

During debates in this House, I have heard it said that if an extra camera were to be placed on the border between Northern Ireland and the Irish Republic, or if one additional piece of paper had to be signed, that would be a break in the Good Friday agreement because it would represent a hard border between Northern Ireland and the Irish Republic. On the one hand we can have all those checks between Northern Ireland and GB, and that does not count as a hard border, yet on the other, one camera on the border between Northern Ireland and the Irish Republic does count as a hard border. That shows how false the argument put forward by the Government is that they have not accepted a hard border between Great Britain and Northern Ireland. What are the implications of that? First, it means that we are cut off from the country to which we belong and, secondly, that our economic relationship with our biggest market will be damaged.

The second argument put forward by the Minister today is that we can get out of this—we can vote against it. But in Northern Ireland there is a mechanism for dealing with sensitive issues. It is enshrined in an internationally binding agreement. That mechanism, because of the sensitive nature of politics in Northern Ireland, states that any controversial issue has to be decided by a cross-community vote. That part of the Belfast agreement, which is so sacrosanct in this House and to those who negotiated it, has now been torn out.

The right hon. Gentleman is making a powerful argument, which we have heard. In the limited time available, may I ask him to turn his attention to the amendment tabled by my right hon. Friend the Member for West Dorset (Sir Oliver Letwin)? If he is concerned about a hard border, he must recognise that the door may be opening for a hard border and a no-deal Brexit to emerge.

First of all, the hard border is there. I have made the argument. I defy anybody to tell me that if we have to fill in a customs declaration, we have to search lorries and vans coming into Northern Ireland at the ports and we have to pay taxes on goods that come from Great Britain, that is not already a hard border.

Let me return to the issue of consent, because it is important. The Minister dismisses Unionist fears by saying, “You can vote your way out of it.” The mechanism for voting our way out of it is led by an international treaty. Why is it not going to be adhered to? Because the Government, the EU and the Irish Government know that that would be an effective way of Northern Ireland doing the very thing that the Minister said we would be able to do. Remove that and you remove the ability of Northern Ireland to take itself out of this arrangement. And of course we only get the chance after four years! We are put into it without any consent at all.

Does my right hon. Friend agree that in Northern Ireland, at the moment and for the past 1,000 days when we have had no Government, there has been a majority—not just a simple majority, but a significant majority—of parties and people who want to get back to work? We are being held and blackmailed by a minority party, Sinn Féin, yet this Government have defended that minority veto for over 1,000 days, meaning that there is no Government in Northern Ireland.

That is the irony. We have to avoid having an Assembly because the voting mechanism of the Belfast agreement must be adhered to, but when it comes to getting out of this arrangement, which has severe consequences for Northern Ireland, the Belfast agreement mechanism does not have to be adhered to. Either we avoid a hard border or we have a hard border. Either we adhere to the Belfast agreement or we do not adhere to the Belfast agreement. The agreement the Government have signed turns all those things on their head, and that is why we will oppose it.

I am sure hon. Members across the House who have defended their constituency interests, whether the fishing industry in Scotland and Cornwall or the rights of workers in their own constituencies, will understand why we will not give in to this agreement. We believe it will cause damage to our part of the United Kingdom and lead the focus of attention away from London towards Dublin. Let us not forget that we will be tied in to an arrangement where the laws for Northern Ireland will be made in Brussels. The British Government will have no input. The Stormont Government will have no input. So where will the focus of attention be for industry, lobby groups and politicians in Northern Ireland? Dublin. We will move towards a united Ireland.

I was asked what the DUP would do in relation to the Letwin amendment. All I can say is this: we would be failing in our duty if we do not use every strategy available to try to get guarantees, changes and alterations that will safeguard the interests of the United Kingdom, the interests of our constituents and the interests that we represent.

I have consistently said that the Prime Minister will obey the law, but we do not want to get to that position; we want to get to a deal position as early as possible, and that is what we are trying to do. That is what we were mandated to do by the British people in the referendum, and it is what previous laws have instructed us to do.

The Prime Minister hit the nail on the head last night when he described the Act in the way he did, because the fact is that he has two choices: to go in all sincerity and negotiate a deal, which we know would be voted down by those who do not want us to leave the clutches of the EU; or to crawl to Brussels begging to be allowed to stay at the cost of £1 billion a month. Does the Minister agree that if there is such distrust in the Prime Minister, the courageous thing to do would be to hold a general election and allow the people of UK to decide what they think of this humiliating piece of legislation? If it was not for the fact that the scaredy-cats on the Opposition Benches are running away from the electorate, they would be calling for an election today.

I should thank the right hon. Gentleman for what now appears to be a cross-party consensus that we should have a general election. It is good to see other people—even hon. Friends on the Opposition Benches—saying that they would support an election. A general election will lance the boil that has been festering here in the Commons. We are a divided House, and we are divided not just on normal party lines; crucially, we are also dividing ourselves against the nation. That is only going to be resolved by delivering Brexit or by going back to the nation and saying, “What do you want?”

My hon. Friend is quite right: holding a second referendum would create enormous uncertainty that would undermine the strong economic achievement of the Government and of our businesses. It would essentially take us back to square one and result in more delay at a time when the public simply want politicians to deliver what they promised.

After the talks with the Labour party leader yesterday, the Chancellor said this morning that a second referendum is more likely. Are we seeing the start of yet another U-turn from a Government who have abandoned all their promises on going forward with no deal, having no border down the Irish sea and ensuring that we leave the EU on 29 March?

In respect of the second referendum, as I said to my hon. Friend the Member for Corby (Tom Pursglove), it is Government policy to honour the 2016 referendum. That is what we have been tasked to do, and that is what we are 100% focused on. The second referendum is a red herring, frankly. It is not something that we countenance. We want to deliver on the 2016 referendum.

I will vote for the single market, if it is presented in a proper way, and I would have voted for the motion in the name of my hon. Friend the Member for Yeovil (Mr Fysh) last week, had he not at the end added a gratuitous sentence ruling out a customs union. If we can get a majority for the single market, I will vote for it again.

I accept that if we pass a motion for the single market, or the motion for common market 2.0, which no doubt my hon. Friend the Member for Grantham and Stamford (Nick Boles) will move later, my motion will be subsumed, but I am not confident we will pass a motion for the single market, because although the Scot nats are attracted by freedom of movement, many of my right hon. and hon. Friends are provoked into voting against it for that very reason. Similarly, common market 2.0, which I would settle for, is probably too ambitious. Mine, then, is the fall-back position.

I hope that my hon. Friend votes for my motion, but I cannot understand the Scottish nationalists. Voting for my motion is no threat to their position; indeed, it is an insurance policy—this goes back to how I started—to make sure that we move forward and that the House of Commons gives the Government a mandate that we can then ensure they have to follow in mapping out this nation’s future. In the long negotiations over the next two or three years, questions of regulatory alignment and freedom of movement will start coming into the negotiations again; that we have committed ourselves to a permanent customs union will not compromise any of those discussions.

I have not the faintest idea why Members of the Democratic Unionist party are not supporting motion (C). If we pass motion (C), it will mean we have no tariffs or certificates of origin and that the Irish border question is pretty well solved—we will be 90-odd% of the way to maintaining the Belfast/Good Friday agreement. It would be of huge benefit to the Irish economy and Irish security and mean that the DUP’s objection to the Irish backstop—that Northern Ireland is being treated differently from the rest of the UK—vanished Pass motion (C) and it applies to the entire United Kingdom.

As I am referring to the DUP, I will give way to the right hon. Gentleman, but I am a Unionist. He thinks the Irish backstop is not a Unionist proposition. Motion (C) is a Unionist proposition and does no harm to the DUP’s position.

I am glad to hear that the right hon. and learned Gentleman is a Unionist, though in supporting the withdrawal agreement three times he has shown that he does not respect the views of the people of Northern Ireland who believe it puts the Union in jeopardy.

The customs union alone does not resolve the issue of the border between Northern Ireland and the Irish Republic in the terms in which the EU has expressed it. The single market rules are equally important in its argument that there would need to be regulatory checks—though of course we know, from its no-deal preparations, that it does not matter whether we are in a customs union or a single market, or neither, because it does not intend to put checks on the border anyway.

I agree that to have an open border—unless we invent these magic X-ray cameras whose discovery some of my hon. Friends think is imminent—we will need to be in a customs union and have some degree of regulatory alignment. In the case of the Irish border—and, I think, of Dover—a customs union gets us 90% of the way. As I say, it is not the customs union that is inconsistent with the right hon. Gentleman’s aim and mine, which is a totally free-moving, frictionless—to use the Prime Minister’s phrase—border at the channel in England and in Ireland, with the same arrangements applying to both. He cites the fact that unfortunately the withdrawal agreement has the Irish backstop in it. Motion (C) makes the Irish backstop irrelevant and superfluous. It will never feature if we pass my motion (C).

Many have lauded today’s exercise, but this is a hurried discussion about a wide range of possible solutions, and yet the House once claimed that the five days, and all of the Committee scrutiny, questions and statements, needed to put in place the Government’s proposal were not enough. Of course, people say, “It’s not our fault. It’s the Government’s fault”, but let us not pretend that we will reach a conclusion on these issues after any significant debate or scrutiny.

The DUP judge all the options on two grounds. First, do they deal with the toxic issue of the backstop? Secondly, will they deliver on what people voted for in the referendum? The customs union option, which we have already debated, would not deal with the EU’s objections—in the terms in which it laid them out in the withdrawal agreement—to the problems along the Irish border. Equally, the proposal in the name of the hon. Member for Grantham and Stamford (Nick Boles) would not deal with the issue, because the EU has made it clear that where there is uncertainty about the future relationship—whether we stay fully in the single market or whatever—it would require the backstop to be in place. Indeed, the withdrawal agreement makes it clear that even if the backstop were to be removed, it could be applied in whole or in part depending on how it judged the settlement.

Does the right hon. Gentleman also recall that being in a customs union is not a frictionless state but would require physical movements, certificates on every consignment, export declarations, import VAT, up to 200 million transactions per annum, and so on, which is not frictionless trade?

For those reasons, the solutions before us do not deal with the backstop.

Some people would say, “Well, of course, there is no solution, other than staying in the EU, that deals with the backstop”. I do not accept that, first, because of current practice, and secondly, because of what the EU has itself said about what would happen in the case of a no deal: it has argued that it would not need barriers along the border between Northern Ireland and the Irish Republic.

I agree that in addition to a customs union we would probably need some modest regulatory alignment to ensure an open border in Ireland and at Dover, but the regulatory alignment would be the same for the whole of the United Kingdom. I thought the DUP’s objection to the backstop was that it would put in place different arrangements for Northern Ireland from the rest of the UK and therefore place a barrier down the Irish sea. Motion (C) avoids that.

I said there were two criteria: first, would it deal with the issue of difference between Northern Ireland and the rest of the United Kingdom, and, secondly, would it deliver what people voted for when they voted to leave the EU? Of course, if we stayed in the customs union, or a customs union arrangement, with the degree of regulatory alignment required, that would not deliver what people voted for.

On the motion for a confirmatory public vote, the option emerging today is for the people to be given a choice between a deal based on whatever compromise solution comes from this remain Parliament and remaining, but that is not a choice as far as the vast majority of people who voted to leave the EU are concerned: remain or half remain. People voted the first time to leave, and the idea that we give people such a choice is not acceptable. On the SNP motion, its Members have made no secret of where they stand. They want to stay in the EU and to provide for that situation. For those reasons, we would not vote for the SNP motion either. We will not support any of these arrangements tonight because they would not safeguard the Union and they would not deliver Brexit.

Absolutely. If there is one thing that we can achieve this afternoon by supporting this motion, it is categorically ruling out no deal. The motion is a revocation backstop. It stipulates that if within two days of exit day we have no agreed deal and Parliament does not positively approve no deal, the Government must revoke the article 50 notice, and we will stay in the EU. But it is important to understand that revocation does not mean that we could never notify the EU of our intention to leave again. That is incorrect, as Members will see if they read the decision of the Grand Chamber in the Court of Justice of the European Union on the case that I and others brought.

I will in a moment, but I just want to make this clear: the motion has been carefully drafted by myself and a team of lawyers to give the Government a clear and unequivocal instruction, and it is the only way to make the Prime Minister hold to her promise that she gave this House on Monday when she said that

“unless this House agrees to it, no deal will not happen”.—[Official Report, 25 March 2019; Vol. 657, c. 25.]

This motion would achieve that. It is the culmination of cross-party work that commenced with a group of Scottish parliamentarians, including myself and other SNP parliamentarians, two Scottish Greens and two Scottish Labour MEPs and the English QC Jo Maugham, who has helped me draft the amendment. We fought the British Government all the way to the Court of Justice to establish that if the United Kingdom got into the kind of mess we are now in, it would have the right to unilaterally revoke article 50. It is important that the instruction is clear and unequivocal, because if Parliament gives the Government a clear and unequivocal instruction then, if the Government fail to follow that clear and unequivocal instruction, because it is clear and unequivocal, we would have a range of political and legal remedies to make sure they did what the democratic vote of this House was to do.

I thank the hon. and learned Lady for giving way. I wanted to give her an opportunity to correct something. She said this motion had all-party support; it does not have the support of the DUP because of course we believe that, through the referendum result, the people of the United Kingdom have said what they wish, and we do not want to revoke that decision.

The right hon. Gentleman will forgive me if I sometimes forget that the DUP is not part of the Government, because it very much feels like that. I am very happy to say that I can live without the support of the DUP.

This is a cross-party motion, except for the DUP, and it continues the cross-party working which got the judgment from the Court of Justice; and today is about cross-party working to try to get us out of the mess we are in.

My hon. Friend makes an important point, although I think it is for another Department to answer. We will be having a meaningful vote on a deal that ensures that we need not have those tariff barriers between ourselves and the EU. That is one of the many reasons we should support the deal.

It will not be lost on many listening to this debate that those who are condemning the Prime Minister for not getting a deal are the very ones who have made it difficult for her to get that deal because they have insisted she rule out no deal as an option. Will the Minister give an assurance that regardless of what the Prime Minister comes back with, she will not accept the diktat of Michel Barnier on Friday, who said that the UK can leave but the one thing that cannot happen is Northern Ireland leaving the EU unless the EU gives us permission?

I say simply to the right hon. Gentleman that it is very clear that the UK as a whole will be leaving the EU. Whatever the outcome of these negotiations, that will be the case: we will leave the EU as one United Kingdom.

I really must make progress, because other Members want to speak. [Interruption.] I am grateful to the hon. Member for Stirling for pointing out, from a sedentary position, that all those people have said that they will support the Prime Minister’s deal. In fact, they were all approached by the Prime Minister and told, “It is my deal or no deal: ask your MPs to support my deal.”

I was contacted by a number of businesses in my constituency, and I also went to see a number of businesses and civic organisations that were brought over at the request of the Secretary of State for Northern Ireland. Yes, they all wanted us to avoid no deal, but when they were asked what they really wanted, none of them said, “The Prime Minister’s deal, as I read it in Hansard.” All of them—with one minor exception—said that if they could have what they wanted, we would not be leaving the European Union. If the Government were listening to the concerns of business, we would not be leaving the EU, and if we had to leave the EU, we would not be leaving the customs union and we would not be leaving the single market.

Let me make it clear, incidentally, that the Secretary of State for Exiting the European Union has explained to me why he has to leave. I accept that, and I take no offence from the fact that he is not able to stay until the end of my speech.

I want to refer briefly to the backstop, but only briefly. The backstop is there because the Government have not yet fulfilled the obligation to which they willingly signed up in December 2017 to come up with a solution to the border question that would honour the Belfast agreement while also meeting their own unilateral red lines. It is no surprise that the Government have not yet come up with that solution, because it does not exist. The Minister of State, Northern Ireland Office, the hon. Member for Weston-super-Mare (John Penrose), admitted that from the Dispatch Box just over two weeks ago.

What everyone is calling the backstop would be better described, as it was yesterday by the former Taoiseach Bertie Ahern, as a safety net. It is there to make sure that whatever else gets dropped in the chaos of Brexit, the Belfast agreement will not, in any circumstances, be allowed to fall and smash on the floor. It is not a backstop; it is a peace process guarantee. I defy anyone to say that they want the peace process guarantee to be time-limited, or to suggest that any party to the peace process would ever want to walk away from it unilaterally.

The hon. Gentleman has cited the Belfast agreement, and has talked of its falling and smashing on the floor. Will he at least do us the courtesy of reading it? There is no suggestion that, deal or no deal, the institutions contained in that agreement will be broken. There is no suggestion that the ability of Northern Ireland citizens also to have Irish citizenship will be taken away from them. If the hon. Gentleman is going to make claims, he should at least get them right.

Yes, I have read the Belfast agreement, and with all due respect, if it comes to any arguments about interpretation I would sooner take the interpretation of the former Taoiseach who helped to write it than that of someone who fought tooth and nail for it to be rejected.

I asked Mr Ahern a question that was designed to show the idiocy of some of the suggestions from Conservative Members about how Ireland should be responsible for sorting out Britain’s mess. Many people in Ireland seemed to think I was being serious, which I think is an indication that our friends in Ireland, and even people in the United Kingdom, are so flummoxed by this shambles that they cannot tell the difference between the truth—the reality—and complete parody. It is no wonder, because the reality is that we have had a Brexit Secretary who did not know that lots of boats were going in and out of Dover, a Northern Ireland Secretary who did not know that people in Northern Ireland vote along traditional Unionist/Nationalist lines, a Trade Secretary who cannot name a single country that will give us a better trade deal outside the EU than we have inside it, a Transport Secretary who could not organise a traffic jam, and a Prime Minister who— well, where do we begin? We could begin with “a Prime Minister who ran away from Parliament on 10 December, and then came back and told us that we must hold our nerve.” Mr Speaker, Scotland is holding its nerve.

May I welcome the assurances that the Secretary of State gave in a very clear way from the Dispatch Box at the beginning of this debate? The first is that the Government will stick to the 29 March date for leaving the EU. It is important to do that from the point of view of giving the Prime Minister the leverage that she needs in the negotiations. I know many Members have pooh-poohed this today, but many ordinary people outside wonder what kind of idiots we are here in this House if we think that it is wise to send someone in to negotiate and, at the same time, say to them, “And by the way, you’re not allowed to walk away from those negotiations”. Ordinary people on the street understand the importance of that, and to give the Prime Minister the best chance, we have to stick to that particular date. That also removes the element of uncertainty. If we leave this open-ended, businesses will not get the certainty they require because they do not know what the future will be. Indeed, the shadow spokesman, when he talked about extending article 50, spoke about going to the beginning of July. That is another date. We either decide we have a date, or we do not.

I was also pleased that the Secretary of State said that the Government are seeking an alternative, especially an alternative to the backstop. I know that the right hon. and learned Member for Rushcliffe (Mr Clarke) said that the backstop is of no consequence, but it is of great consequence. As the EU confirmed this week, the backstop would lead to Northern Ireland having to be regulatory aligned with the rest of the EU and part of the customs union. It has spelt out the consequences of that. It would mean systematic checks on trade between Northern Ireland and Great Britain at ports and airports. For me, that rips up the Union, it hurts the Northern Ireland economy and it is certainly of consequence.

That could all be solved if the whole UK stayed in the customs union and had the same regulatory alignment. Why does the right hon. Gentleman not accept that?

The whole point is that Northern Ireland would be treated separately from the rest of the United Kingdom. That damages the Union.

The withdrawal agreement limits our ability to have a future trade arrangement that suits us because, as the EU has made clear, that agreement will become the basis of the future trade arrangement and that includes keeping us within a customs union and the single market. I do not believe that that is good for the United Kingdom.

People ask, “What is the alternative?” and they say that the EU will not move because there is no alternative. First, saying that the other side are not going to move so we have to give in to them, is the wrong way to approach negotiations. Secondly, there are alternatives; there are alternatives in place. We collect taxes every day across the Irish border. Michel Barnier has promised us and the Irish Government that, in the event of no deal, he has alternatives. He has a study group working on it. He will have paperless checks and decentralised monitoring of trade—the very thing we have said is possible. Also, on the political declaration, the EU has said that there are particular alternatives along the Irish border that will be included in those discussions. My answer to the EU is that, if you have something in place at present, if there is something you will put in place in the event of no deal, and if there is something you have promised to discuss in future, put it in the deal now and then we can move on.

There is an alternative—a good alternative that will benefit everyone. It is the Malthouse compromise: a future trade arrangement that is tariff and quota free, which will suit business; a protocol that will guarantee there are no checks on the Irish border, which will suit the Irish Government; and trade facilitation measures, which are already in place and which the EU has already said it will consider and put in place. Regulatory equivalents for meat products and so on are already in current trade agreements and there are guarantees for citizens who are living in this country from the EU. All those good things should be included.

I will make a little more progress, then I will happily take further interventions.

The withdrawal agreement addresses many of the key issues that Members, including Opposition Members, have spoken about. For example, it protects citizens’ rights: it protects the 3 million EU citizens in the UK and the 1 million UK citizens in the EU. It provides a financial settlement that honours our legal obligations. Not to do so, as Opposition Members have often pointed out, would undermine our international position. It guarantees an implementation period that means that businesses will have one change to make as we enter a new trade deal, as opposed to two. Most importantly—this is an issue on which the Opposition rightly have a proud record, because they played a key part in the peace process in Northern Ireland—the withdrawal agreement enables us to preserve that hard-won peace and ensure that the commitments that were made in the Belfast agreement are honoured.

Does the Secretary of State realise that the withdrawal agreement and especially the backstop arrangement, which would forcibly remove Northern Ireland from the rest of the United Kingdom because laws would be made in Brussels rather than in Westminster and the Northern Ireland economy would be cut off from trade deals that the United Kingdom entered into with the rest of the world, have put in jeopardy the fine balance in the Belfast agreement? That is not helped by the Secretary of State’s reported comments to the Cabinet yesterday that a refusal to vote for the withdrawal agreement would be likely to lead to a referendum on a united Ireland.

I recognise the genuine concerns the right hon. Gentleman has about the backstop. I will come on to address some of those concerns, although I readily concede that I do not expect to address all of them with the areas of movement I cover today.

This is about assessing the balance of risk. The backstop does not cover 80% of our economy, as the services economy is outside it. Many in the business community in Northern Ireland see huge benefits in the certainty that is offered through the withdrawal agreement. Indeed, it is not our intention to enter into the backstop, not least because many businesses in Northern Ireland will have access to both the EU and UK markets. That is one of the attractions, and it is actually one of the reasons why Labour’s sister parties in the north of Ireland—the Social Democratic and Labour party—and in the south actually support the withdrawal agreement, as well as because it will secure the commitments on peace, as I mentioned.
