The Westminster Foundation for Democracy does a fantastic job, and I think we know from what has happened in Ukraine—the appalling war perpetrated by Vladimir Putin—just how precious democracy is and how much we need to do to work with our friends and allies to protect democracy around the world. I do encourage colleagues from all sides of the House to attend the event tonight.

Commons ChamberI am very sorry to hear about the situation of young people at York Hospital, but I am pleased to say that this is an issue on which my right hon. Friend the Health Secretary has focused in her plan for patients. We are making sure that people can access treatment as soon as possible: we are delivering record staff numbers and record levels of funding.
Last night, the Labour party supported bringing down national insurance. Is he really—[Interruption.]

I am genuinely unclear about what—[Interruption.]

I am genuinely unclear as to what the Labour party’s policy is on our energy price guarantee. It was the biggest part of our mini-Budget. Are the Opposition saying that they want to reverse it and that they want to see people facing energy bills of £6,000? Is that what the right hon. and learned Gentleman is saying?
I want to see more jobs, more opportunities and more homes for local people in Cornwall, which I know my hon. Friend is working towards with her colleagues. I am delighted that we are bringing forward these investment zones, which will give those opportunities to local people.
I do not think I am responsible, but I am sure the Prime Minister will take that on board.
What we have done as a Government is act decisively to deal with the very severe energy crisis we are facing. [Interruption.] We are facing a severe energy crisis. We are also facing a slowdown in economic growth globally due to Putin’s war in Ukraine, and not acting is not an option.
I think the last thing we need is a general election.

Commons ChamberIn the hours since last night’s shocking news, we have witnessed the most heartfelt outpouring of grief at the loss of Her late Majesty the Queen. Crowds have gathered. Flags have been lowered to half-mast. Tributes have been sent from every continent around the world. On the death of her father, King George VI, Winston Churchill said the news had,
“stilled the clatter and traffic of twentieth-century life in many lands”.
Now, 70 years later, in the tumult of the 21st century, life has paused again.
Her late Majesty Queen Elizabeth II was one of the greatest leaders the world has ever known. She was the rock on which modern Britain was built. She came to the throne aged just 25, in a country that was emerging from the shadow of war; she bequeaths a modern, dynamic nation that has grown and flourished under her reign. The United Kingdom is the great country it is today because of her. The Commonwealth is the family of nations it is today because of her. She was devoted to the Union of England, Scotland, Wales and Northern Ireland. She served 15 countries as Head of State, and she loved them all.
Her words of wisdom gave us strength in the most testing times. During the darkest moments of the pandemic, she gave us hope that we would meet again. She knew this generation of Britons would be as strong as any. As we meet today, we remember the pledge she made on her 21st birthday to dedicate her life to service. The whole House will agree: never has such a promise been so completely fulfilled.
Her devotion to duty remains an example to us all. She carried out thousands of engagements, she took a red box every day, she gave her assent to countless pieces of legislation and she was at the heart of our national life for seven decades. As the Supreme Governor of the Church of England, she drew on her deep faith. She was the nation’s greatest diplomat. Her visits to post-apartheid South Africa and to the Republic of Ireland showed a unique ability to transcend difference and heal division. In total, she visited well over 100 countries. She met more people than any other monarch in our history.
She gave counsel to Prime Ministers and Ministers across Government. I have personally greatly valued her wise advice. Only last October, I witnessed first hand how she charmed the world’s leading investors at Windsor Castle. She was always so proud of Britain, and always embodied the spirit of our great country. She remained determined to carry out her duties even at the age of 96. It was just three days ago, at Balmoral, that she invited me to form a Government and become her 15th Prime Minister. Again, she generously shared with me her deep experience of government, even in those last days.
Everyone who met her will remember the moment. They will speak of it for the rest of their lives. Even for those who never met her, Her late Majesty’s image is an icon for what Britain stands for as a nation, on our coins, on our stamps, and in portraits around the world. Her legacy will endure through the countless people she met, the global history she witnessed, and the lives that she touched. She was loved and admired by people across the United Kingdom and across the world.
One of the reasons for that affection was her sheer humanity. She reinvited monarchy for the modern age. She was a champion of freedom and democracy around the world. She was dignified but not distant. She was willing to have fun, whether on a mission with 007, or having tea with Paddington Bear. She brought the monarchy into people’s lives and into people’s homes.
During her first televised Christmas message in 1957, she said:
“Today we need a special kind of courage…so that we can show the world that we are not afraid of the future.”
We need that courage now. In an instant yesterday, our lives changed forever. Today, we show the world that we do not fear what lies ahead. We send our deepest sympathy to all members of the royal family. We pay tribute to our late Queen, and we offer loyal service to our new King.
His Majesty King Charles III bears an awesome responsibility that he now carries for all of us. I was grateful to speak to His Majesty last night and offer my condolences. Even as he mourns, his sense of duty and service is clear. He has already made a profound contribution through his work on conservation and education, and his tireless diplomacy. We owe him our loyalty and devotion.
The British people, the Commonwealth and all of us in this House will support him as he takes our country forward to a new era of hope and progress: our new Carolean age. The Crown endures, our nation endures, and in that spirit, I say God save the King. [Hon. Members: “God save the King.”]

Earlier this week, I promised that I would deal with the soaring energy prices faced by families and businesses across the UK, and today I am delivering on that promise. This Government are moving immediately to introduce a new energy price guarantee that will give people certainty on energy bills, and will curb inflation and boost growth. The guarantee—which includes a temporary suspension of green levies—means that from 1 October a typical household will pay no more than £2,500 per year for each of the next two years, while we get the energy market back on track. It will save a typical household £1,000 a year, and it comes in addition to the £400 energy bills support scheme. It supersedes the Ofgem price cap, and has been agreed with energy retailers.
For those using heating oil, those living in park homes or those on heat networks, we will set up a fund—[Interruption.]
Order. I am sorry about this, Prime Minister. Can I just say that I do want a running commentary from Members giving me advice? I certainly do not need it.
I do not want to interrupt you, Prime Minister—it is up to you to give way when you feel it is appropriate—but I just want to let you know that the written ministerial statement has now been printed, and I hope it will be brought into the Chamber for everybody to see.
As I was saying, for those using heating oil, those living in park homes or those on heat networks, we will set up a fund so that all UK consumers can benefit from equivalent support.
As we both know, that is not a point of order, but it is certainly a clarification that the copies are now coming out. We are printing them as fast as possible to make sure that all Members have the ability to read them. It is with great disappointment that we are doing so, but that is a matter of fact.
Instead of taking the Opposition’s approach, we are taking an approach that is pro-growth, pro-business and pro the investment we need for our country’s energy security.

The hospitality industry is vital, and I will make sure that our energy plan, which will help support businesses and people with the immediate price crisis, as well as making sure there are long-term supplies available, will help businesses as well as helping individual households.
My hon. Friend is right: we do need to address the issues that businesses face. The package that we will announce tomorrow will do just that.
I am determined that we deal with the issues facing us as a nation. We do have problems with our energy supply, due to the appalling war being perpetrated by Putin in Ukraine. That is why I will take immediate action to deal with the energy crisis; my Chancellor will take immediate action to reduce taxes and make sure we are growing our economy; and our new Health Secretary, who is also the Deputy Prime Minister, will take immediate action to make sure that people are able to get appointments with their GP and proper NHS services.
I am determined to tackle the issues we face in energy, and I look forward to the Scottish Government playing their part by building new nuclear power stations.
Order. I want a nicer Parliament and that question was not a good example. I certainly do not want the word “corrupt” being used against the new Prime Minister. [Interruption.] I am sure that the hon. Member for Livingston (Hannah Bardell) will withdraw that comment.
As a country, we are facing a very serious crisis in energy, caused by Putin’s war in Ukraine. We are facing—[Interruption.]
Order. The hon. Member for Stoke-on-Trent North (Jonathan Gullis) is getting very carried away. I know that as a former teacher he will want to show better behaviour than he is showing at the moment.
We are facing very serious issues as a country, partly as a result of the aftermath of covid and partly as a result of Putin’s war in Ukraine. What the British people want is a Government who are going to sort it out, and that is what I am determined to do as Prime Minister: sort out the energy crisis, get our economy going and make sure that people can get doctors’ appointments. That is what I am focused on.

Commons ChamberI would like to update the House on our support for Ukraine.
It is almost four months since Putin launched this illegal war, bringing untold suffering to the innocent people of Ukraine. The United Kingdom has stood at Ukraine’s side throughout. We have led the charge in the G7, delivering six waves of unprecedented, co-ordinated sanctions that have caused a £256 billion hit to the Russian economy. The UK has pledged over £1 billion in economic and humanitarian support to Ukraine, making us the third largest bilateral humanitarian donor. And we were the first European country to deliver military aid, from armoured vehicles to multiple-launch rocket systems. This has spurred others to step up their support.
This united effort has been vital to back Ukraine, but we are approaching a critical moment. Russia is bombarding towns and cities in the east, and some outside Ukraine are questioning whether the free world can sustain its support and claiming that some are beginning to tire of this war. The people of Ukraine do not have that luxury. Our answer must be clear: we will never tire of defending freedom and democracy. Russian aggression cannot be appeased. It will be met with strength. We know what is happening on the ground in Ukraine. Evidence grows of heinous war crimes: the butchery of innocent Ukrainian civilians, rape, torture and abduction. We will ensure that these crimes are fully investigated and justice is done. Russian proxies are breaching the Geneva convention on prisoners of war, including with the targeting of British citizens. I utterly condemn these actions, and we are working, through the Ukrainian authorities, to secure their release and hold Russia to account. I am in close contact with my Ukrainian counterpart, Dmytro Kuleba.
Allowing aggression to succeed would only bring further conflict and misery, and the war would not stop in Ukraine, so we are committed to stepping up our commitment, maintaining the pressure on Russia’s economy, and entrenching our policy of containment and isolation of Russia. In the coming weeks, leaders will meet at the Commonwealth Heads of Government meeting, and at the G7, G20 and NATO summits. These meetings are an opportunity to stand with Ukraine and stand up for sovereignty and freedom. Ukraine can and must win this war. We will never backslide on our commitments, however long this conflict goes on. Our determination to defend our principles will outmatch that of the aggressors. The result of Putin’s aggression so far has been to unite the free world. We are stronger now than we were four months ago and Russia is weaker. We must maintain this unity. We must be relentless in delivering military aid at this critical time. This includes long-range weapons and other vital needs, and improving the quality of Ukraine’s military equipment for the long term to NATO standards. That is why my right hon. Friend the Prime Minister launched the UK-Poland joint commission in early April. We are working with Ukraine and other allies to shape its future defence strategy and deter future aggression.
We must also back Ukraine in negotiations. So far, Russia has shown that it is not serious about negotiations. We can never allow Ukraine to be pressurised into giving up territory in a way that we would never accept ourselves. Through the G7 and NATO, we are doing everything we can to strengthen Ukraine’s hand. We also need to make sure that our Baltic friends and our Polish friends are involved. Sanctions must be kept in place while Russian boots are on Ukrainian soil, and we must keep increasing the pressure. Today, I have announced our latest sanctions package. This includes Patriarch Kirill, the head of the Russian Orthodox Church, who has repeatedly abused his position to justify the war. It includes Russia children’s rights commissioner, who has orchestrated a policy that enables the forced transfer and adoption of Ukrainian children into Russia. And it includes four further collaborators in the breakaway republics, for their collusion in the occupation.
Although our immediate priority must be to help Ukraine win the war, we are also working to rebuild the country as fast as possible, with a new Marshall plan. At the Ukraine recovery conference in Lugano next month, we will rally the international reconstruction efforts, urging all our partners to bring ambitious offers to the table. I am working with Minister Kuleba on bringing new investment to Kyiv and to help reconstruct those towns in the region that have been liberated from Russia’s destructive occupation. Russia’s efforts to destroy Ukraine will only lead to it becoming a stronger, more prosperous and more united European nation.
We must also end Russia’s attack on global food security. The Kremlin is blockading Ukrainian ports, shelling civilian infrastructure and preventing Ukraine from exporting its produce. By driving up food prices and creating shortages, the Kremlin is punishing the world’s poorest and most vulnerable. At the same time, it is peddling lies and disinformation, claiming that the problems are because of sanctions. We are exposing those lies and working with our partners to unlock the export of grain and open the commercial shipping routes. We will stand with our friends in the Commonwealth and beyond who are suffering.
In the long run, there must be consequences for Russia’s actions. For would-be aggressors everywhere, Putin must not only lose this war but be denied any benefit from it. Any future aggression must be prevented and Russia must be isolated on the world stage. Ukraine must prevail, for the good of its people and to uphold the fundamental principles of sovereignty, self-determination, freedom and democracy. The UK stands with Ukraine for the long haul. I commend this statement to the House.

Commons ChamberWe have appointed Katharine Birbalsingh as chair of the Social Mobility Commission. She has taken on the soft bigotry of low expectations at her fantastic school, the Michaela Community School in Brent. We want her to help the whole country, including rural areas and places such as Broadland. Tomorrow, she will lay out her vision in a speech at Policy Exchange entitled “Bucking the trend: a fresh approach to social mobility”.
Does the Minister agree that her Government have levelled women down, with women’s real wages now £226 less per year than when Labour left office?
I do not agree with that at all. We are entirely focused on tackling the causes of the gender pay gap by making it easier for people to afford childcare, normalising flexible working and helping women to get into the top jobs, particularly in areas such as science, technology, engineering, and mathematics where they can earn more money.

Commons ChamberWith permission, Mr Speaker, I would like to update the House on the Northern Ireland protocol and to lay out the next steps. Our first priority is to uphold the Belfast/Good Friday agreement in all its dimensions. That agreement put in place a new arrangement for the governance of Northern Ireland and these islands composed of three interlocking strands: a power-sharing Government at Stormont on the basis of consent and parity of esteem for all communities; intensified north-south co-operation on the island of Ireland; and enhanced arrangements for east-west co-operation. So much of the progress we have seen in Northern Ireland rests on this agreement, and for the agreement to continue to operate successfully, all three strands must function successfully. These arrangements are the foundation on which the modern, thriving Northern Ireland is built. It commands the support of parties across this House, and we will continue to work with all communities in Northern Ireland to protect it.
As a Government, we want to see a First Minister and Deputy First Minister in place, and we want to work with them to make further progress. The basis for successful power sharing remains strong, as my right hon. Friend the Prime Minister laid out yesterday. However, the Belfast/Good Friday agreement is under strain, and, regrettably, the Northern Ireland Executive has not been fully functioning since early February. This is because the Northern Ireland protocol does not have the support necessary in one part of the community in Northern Ireland. I also note that all Northern Ireland’s political parties agree on the need for changes to the protocol.
The practical problems are clear to see. As the House will know, the protocol has not yet been implemented in full, due to the operation of grace periods and easements. However, EU customs procedures for moving goods within the UK have already meant that companies are facing significant costs and paperwork. Some businesses have stopped this trade altogether. These challenges have been sharpened by the post-covid economic recovery. Rules on taxation mean that citizens in Northern Ireland are unable to benefit fully from the same advantages as the rest of the UK, such as the reduction in VAT on solar panels. Sanitary and phytosanitary rules mean that producers face onerous restrictions, including veterinary certification, in order to sell foodstuffs in shops in Northern Ireland.
These practical problems have contributed to the sense that the east-west relationship has been undermined. Without resolving these and other issues, we will not be able to re-establish the Executive and preserve the hard-won progress sustained by the Belfast/Good Friday agreement. We need to restore the balance in the agreement.
Our preference is to reach a negotiated outcome with the EU; we have worked tirelessly to that end and will continue to do so. I have had six months of negotiations with Vice-President Maroš Šefčovič, which follow a year of discussions undertaken by my predecessor. The UK has proposed what we believe to be a comprehensive and reasonable solution to deliver on the objectives of the protocol. This includes a trusted trader scheme to provide the EU with real-time commercial data, giving it confidence that goods intended for Northern Ireland are not entering the EU single market. We are already sharing over 1 million rows of goods movement data with the EU every week.
Our proposed solution would meet both our and the EU’s original objectives for the protocol. It would address the frictions in east-west trade while protecting the EU single market and the Belfast/Good Friday agreement. The challenge is that this solution requires a change in the protocol itself, as its current drafting prevents it from being implemented, but the EU’s mandate does not allow the protocol to be changed. That is why its current proposals are unable to address the fundamental concerns. In fact, it is our assessment that they would go backward from the situation we have today with the standstill.
As the Prime Minister said, our shared objective must be to find a solution that can command the broadest possible cross-community support for years to come and protect the Belfast/Good Friday agreement in all its dimensions. That is why I am announcing our intention to introduce legislation in the coming weeks to make changes in the protocol.
Our preference remains a negotiated solution with the EU. In parallel with the legislation being introduced, we remain open to further talks if we can achieve the same outcome through a negotiated settlement. I have invited Vice-President Šefčovič to a meeting of the Withdrawal Agreement Joint Committee in London to discuss that as soon as possible.
However, to respond to the very grave and serious situation in Northern Ireland, we are clear that there is a necessity to act to ensure that the institutions can be restored as soon as possible. The Government are clear that proceeding with the Bill is consistent with our obligations in international law and in support of our prior obligations in the Belfast/Good Friday agreement. Before any changes are made, we will consult businesses and people in Northern Ireland as our proposals are put forward.
I want to be clear to the House that this is not about scrapping the protocol; our aim is to deliver on the protocol’s objectives. We will cement the provisions in the protocol that are working, including the common travel area, the single electricity market and north-south co-operation, while fixing those elements that are not, such as the movement of goods, goods regulation, VAT, subsidy control and governance.
The Bill will put in place the necessary measures to lessen the burden on east-west trade and to ensure that the people of Northern Ireland are able to access the same benefits as the people of Great Britain. It will ensure that goods moving and staying within the UK are freed of unnecessary bureaucracy through our new green channel.
That respects Northern Ireland’s place in the UK’s customs territory and protects the UK internal market. At the same time, it ensures that goods destined for the EU undergo the full checks and controls applied under EU law. That will be underpinned by the data-sharing arrangements that I have already set out. It will allow both east-west trade and the EU single market to be protected while removing customs paperwork for goods remaining in the United Kingdom.
The Bill will remove regulatory barriers to goods made to UK standards being sold in Northern Ireland. Businesses will be able to choose between meeting UK or EU standards in a new dual regulatory regime. It will provide the Government with the ability to decide on tax and spend policies across the whole United Kingdom. It will address issues related to governance, bringing the protocol in line with international norms. At the same time, it will take new measures to protect the EU single market by implementing robust penalties for those who seek to abuse the new system, and it will continue to ensure that there is no hard border on the island of Ireland.
I will publish more detail on these solutions in the coming weeks, and let me be crystal clear that, even as we do so, we will continue to engage with the EU. The Bill will contain an explicit power to give effect to a new, revised protocol if we can reach an accommodation that meets our goal of protecting the Belfast/Good Friday agreement. We remain open to a negotiated solution, but the urgency of the situation means we cannot afford to delay any longer. The UK has clear responsibilities as the sovereign Government of Northern Ireland to ensure parity of esteem and the protection of economic rights. We are clear that the EU will not be negatively impacted in any way, just as we have ensured the protection of the EU single market since the existence of the protocol.
We must restore the primacy of the Belfast/Good Friday agreement in all of its dimensions as the basis for the restoration of the Executive, and we will do so through technical measures designed to achieve the stated objectives of the protocol, tailored to the reality of Northern Ireland. We will do so in a way that fundamentally respects both Unions—that of the United Kingdom and that of the EU—and we will live up to our commitments to all communities of Northern Ireland. As co-signatory and co-guarantor of the Good Friday/Belfast agreement, we will take the necessary decisions to preserve peace and stability. I commend this statement to the House.
Our priority, as the United Kingdom Government, has to be peace and stability in Northern Ireland and protection of the Belfast/Good Friday agreement. It is vitally important that we get the Executive back up and running and functioning, and that we fix the very real issues with the Northern Ireland protocol.
I welcome the hon. Gentleman’s acknowledgment that there are issues with taxation, with customs, and with procedures and bureaucracy. Fixing those issues does require the EU to be open to changing the protocol. As yet, and I have had six months of talks with Vice-President Šefčovič—my predecessor had 12 months of talks—the EU has been unwilling to open the protocol. Without that, we cannot deal with the tax issue, we cannot deal with the customs issue and we will not sort out the fundamental issues in Northern Ireland. It is our responsibility, as the Government of the United Kingdom, to restore the primacy of the Belfast/Good Friday agreement to get the Executive up and running.
In answer to the hon. Gentleman’s question about legality, we are very clear that this is legal in international law, and we will be setting out our legal position in due course.

Those are not my words, but Margaret Thatcher’s. Respect for the rule of law runs deep in our Tory veins, and I find it extraordinary that a Tory Government need to be reminded of that. Could my right hon. Friend assure me that support for, and honouring of, the rule of law is what she and the Government are committed to?
I can assure my hon. Friend that we are committed to upholding the rule of law. We are clear that this Bill is legal in international law, and we will set out the legal position in due course.

Commons ChamberMy hon. Friend is right about the appalling reports that we have seen in the Telegraph and other newspapers of the use of rape in Ukraine. The Security Council has a role to play. Under our presidency of the Security Council, we have used it to call out Russia’s lies. We have also hosted President Zelensky, who has spoken to the Security Council. My hon. Friend is also right that we have concerns about an international security architecture that has Russia as one of the permanent members of the Security Council, where it has used its veto as a green light for barbarism. Part of our response has been working more closely with allies such as the G7 and NATO, because we simply have not seen enough taking place at a UN level.
I call the Chair of the International Development Committee, Sarah Champion.
The hon. Lady is right: this abhorrent policy is being used to terrorise women and children. It is being used to destroy communities and destroy their spirit. It is a deliberate act. We know that; it is what the Organisation for Security and Co-operation in Europe report on what is happening in Ukraine shows. First, we are working to collect the evidence through a number of bodies, including the Metropolitan police. We are funding the International Criminal Court to collect evidence. We will make sure that the perpetrators are brought to justice. More than that, we need new international agreement on making the use of sexual violence in war a red line. It needs to be regarded on the same level as the use of chemical weapons. That has not yet happened. That is why the UK is hosting a conference on this later this year, and we are working with international partners on this. The hon. Lady is absolutely right: it is appalling and abhorrent.
Of course we raise the issue of human rights with the Indian Government. Indeed, later this summer we will host a conference in London on the subject of religious freedom, led by my hon. Friend the Member for Congleton (Fiona Bruce). This is an important issue for us. Looking at the big picture, there is a huge opportunity for the United Kingdom to work more closely with India in the face of some appalling authoritarian regimes, particularly Russia, which has staged an unwarranted, unjustified invasion of Ukraine. It is important that leading democracies across the world stand up for freedom and democracy and work together.
The hon. Lady is absolutely right: we are working closely with our international allies. We committed extra billions at the spring meetings last week to help to provide food aid to the rest of the world. We are also restoring our humanitarian budget, as part of our aid budget in the United Kingdom, to help to deal with the crisis.
I am working very closely with my hon. Friend the Member for Congleton (Fiona Bruce), who is our religious freedom envoy. I am pleased to be hosting and attending the global summit to promote the freedom of religion in July, and we continue to make progress on implementing all the recommendations of the Truro review.
I congratulate my hon. Friend on the fantastic work that he is doing with the local community in Keighley and Ilkley. We are seeing people across Britain really contributing to the effort to support the people of Ukraine. We have now issued more than 70,000 visas to Ukrainians. We are working with Foreign Ministers right across Europe to ensure that we are completely co-ordinated, particularly with those Governments that are close by, like the Poles.

Commons ChamberThere have been years of effort and some fantastic people in the Foreign Office, including the leaders of the Foreign Office and the Foreign Office team, have worked tirelessly. What has changed in the past six months is that we have a new Government in Iran. I was able, when I went to New York in September and met Minister Amir-Abdollahian, to reset the relationship and be clear that we were serious about resolving the outstanding issues that Iran had, and the Iranians were clear that they were serious about resolving the outstanding issues we had.
I pay tribute to the fantastic Foreign Office officials, who have been tenacious in travelling to Tehran and getting this done in what are very difficult circumstances. As the right hon. Gentleman is aware, paying money to Iran is not easy with the intensive sanctions regime in place, even though this is very clearly a legitimate debt. I can assure him that we have humanitarian guarantees. What I cannot do is go into the details, because that is confidential between the parties, but I have had this thoroughly checked out across Government to ensure that we have those guarantees that the money will be used for humanitarian purposes.
On the subject of Morad Tahbaz, who I spoke to at the end of last year when he was in prison, we have secured his release on furlough. He is now at home. That was an important point that we pressed with the Iranian Government. I know from speaking to him that the conditions in prison were abhorrent and appalling, so he is now in better conditions, but of course we will continue to get him home, as well as other detainees who do not want their names released in public. The other point to make about Mr Tahbaz is that he is a tri-national with the United States, so we need to work with our US partners on this issue and we are talking to him.
In the spirit of what the right hon. Gentleman said about welcoming the detainees home, that should be our focus today. They have been through an appalling ordeal; I could not imagine what it would be like to be without my family or my mother for so long. We must give the families the privacy they deserve, and thank them for their tenacity through this appalling ordeal that should never happen to anyone.
I am hugely grateful for the extraordinarily welcome news that my right hon. Friend has brought to the House this afternoon. It is the most wonderful moment for many of us who have been campaigning. In particular, I pay huge tribute to not only the two hon. Members for Hampstead and Kilburn (Tulip Siddiq) and for Lewisham East (Janet Daby), but our friend Ann Clwyd, who spent an awful lot of time campaigning for this as well when she was in this House.
May I ask whether the Government have looked at some of the implications of the last time a ransom payment was made to the Iranian Government? That ransom payment was made by the US Government a number of years ago. About six months after they were paid, the Iranian Government took another six American dual nationals hostage and merely started the whole process again. Furthermore, sadly, the money paid was then spent on murdering hundreds of thousands of Sunni Muslims in Syria. Can my right hon. Friend assure us that that will not happen this time, that British citizens will be carefully warned of the dangers they face in visiting Iran, and that none of the payment will end up in weapons and ammunition to kill Syrians?
First, it is important to note that these are two parallel issues in our bilateral relationship, namely settling the IMS debt—a legitimate debt that the UK Government were due to pay—and settling the issue of the detainees. I am very clear that we need to work with our international partners to end the practice of arbitrary detention. In fact, we are joining a group with the Canadians and others to do just that, so we have a strong international response to countries using the practice of arbitrary detention to get their own way. I completely agree with my hon. Friend that we must end the practice, but we need to do so working with partners. That is a key point that we are discussing as part of the G7 Foreign Ministers track.
My right hon. and learned Friend is right that arbitrary detention is completely wrong. We are stepping up our efforts, together with our G7 colleagues, to work more closely together to challenge that type of behaviour internationally. Over the Ukraine crisis and the abhorrent invasion of Ukraine by Russia, we have seen the international community step up and democratic nations work together. We are determined to address all of those issues, including the issue of arbitrary detention.

Friend is right that; as well as the huge humanitarian crisis for the people of Ukraine, we are seeing the death of many Russian soldiers, many of whom have been sent to Ukraine under false pretences such as the claim that the Ukrainian people want liberation, which simply is not true. As we warned in advance of this invasion, President Putin has sent thousands of young Russian men and women to their death. That message is being received in Russia.
Of course, there will be an economic cost to these sanctions for British people, in their energy bills and in the cost of living, but that cost is nothing compared with the cost to the people of Ukraine of the horrific barbarism that they are facing or with the cost of allowing Putin to succeed. We know that if Putin does not lose in Ukraine, it will not be the limit of his ambitions. He has already been clear that he wants to see a greater Russia, which could encompass countries such as Moldova and the Baltic states. So it is vital that we throw everything at sanctions, and we help as much as we can with getting defensive weaponry into Ukraine, because this is a battle that Putin needs to lose.
We come to the Scottish National party spokesperson, Alyn Smith.
The hon. Gentleman is absolutely right about the importance of the BBC in communicating to the Russian people. The fact is that they have been lied to for years through disinformation via state TV, and we are now seeing Putin taking even more repressive measures to stop social media. One factor of this crisis is that young people in Russia are less likely to believe the regime because they have had access to social media. Putin is now trying to cut that off. We are working with social media companies to see what we can do. We have established a cross-Government information unit to communicate with the Russian people directly in the Russian language. Moreover, one impact of sanctions—and a reason why we have targeted banks—is that they send a message to the Russian people when they are forced to queue for money, when they cannot get on the tube, or when they cannot access the normal services that they have been accessing. I welcome the actions of corporates in Britain to withdraw their services from Russia. The message must get across to the Russian people that this appalling war is being fought in their name.
We do have to learn the lessons of the past 15 or 20 years, where we did not do enough to tackle Putin and Russia, we allowed the build-up of force and we did not respond strongly enough to what happened in Crimea and the Donbas. I am determined to do things differently. That is why the UK is leading not only on diplomacy, but on the toughest possible sanctions and the toughest possible support for the Ukrainian people in their resistance. I have already briefed the House on the Home Secretary’s roll-out of new centres to help Ukrainian people with visas. She has opened up a family route and a sponsored humanitarian route, and we continue to take that forward. We are open for refugees.
Today, on International Women’s Day, we see all the women trying to escape with their families, their children and their mothers and fathers to reach places such as Poland, which has offered refuge to some 1 million refugees, and Ireland, which has taken several hundred thousand. Here in the UK, however, barely 100 have been able to find refuge. That is a shameful lack of humanity in the face of the greatest humanitarian catastrophe in Europe since world war two. Does the Secretary of State agree that this paltry effort to offer refuge is a stain on our otherwise commendable effort on the crisis in Ukraine? Will she urgently work with the Home Secretary, shake up the Home Office and get this sorted?
As I have said, the Home Office has opened new centres for people to be able to put in their applications. It is running a 24/7 helpline and has a surgery for MPs in Portcullis House. I also point the hon. Lady to the fact that we are the largest donor of humanitarian aid, with £220 million. We also want to help people to settle in the region; many people coming from Ukraine want to settle locally and we are helping in that effort by sending our humanitarian teams to the region.
The hon. Lady knows that, in the Budget we are doing this year, we are restoring the aid budget for women and girls back to its previous levels and we are also restoring the humanitarian aid budget. However, it is a matter of policy that we do not publicly release equality impact assessments because they have a chilling effect and people cannot be honest internally. That is why we do not release them, but of course I am very happy to discuss the issue with her further.

Commons ChamberI thank the right hon. Gentleman for his statement of unity; a strong message is going out to Putin and around the world that the United Kingdom is united in our support for Ukraine. We can see that from the demonstrations and from the public concern and interest in this appalling act of aggression and invasion that has taken place.
Yesterday, I joined a call with the G7 Foreign Ministers. We agreed that the sanctions that we had put in place so far are having an impact, but we need to do more. We need to work in unison and act in unity. We also agreed to increase the supply of defensive weapons in Ukraine.
The right hon. Gentleman is correct: Germany has taken courageous steps. It has transformed its energy policy and its defence policy, and we have seen a huge rising of public opinion right across Europe. I also want to praise Japan, South Korea and Singapore, which have put sanctions on for the first time.
I and my Foreign Office colleagues are putting in calls to Foreign Ministries around the world. We are encouraging more countries to put on sanctions and to speak out at the UN. The right hon. Gentleman is right that there are some countries that are democracies which should be standing up against the invasion of a sovereign democracy, and we are making that point to them day and night. What we are seeing is that Putin is completely isolated. There is nobody else backing him up in international forums and there is a growing group of countries prepared to put sanctions on and to supply defensive weapons. We are leading the charge in bringing those countries on board.
On the specific issues that the right hon. Gentleman mentioned, we have a hit list of oligarchs and Duma members that we are working through to sanction as soon as we can. Foreign Office officials are working through the night. We have extra lawyers and have tripled the amount of people in our sanctions department to make that happen. We are looking at more sanctions on the energy industry and the technology industry. We want to see a total ban on SWIFT transactions. We are encouraging our allies across the world to back that. We also want to see a full bank freeze in the coming days.
It is vitally important that we maintain unity with our allies. There are many countries that are heavily dependent on Russian oil and gas. The UK gets only 3% of its energy from Russian oil and gas. The figure for some countries is as high as 90% or 100%; we have to reduce that over time, and that is what we are working on through the G7.
I am very pleased that the right hon. Gentleman has backed the approach we are taking. I want to continue to work cross-party to do all we can to support the brave people of Ukraine and to make sure that Putin loses.
I very much welcome my right hon. Friend’s commitment. She has been working literally through the weekend, night and day, to get these sanctions right and to get them in place. Will she join me in assuring the Russian people that the moneys frozen—the moneys seized—which are, let us face it, very often stolen from them in the first instance, will be held and returned to the Russian people when this criminal conspiracy that laughably calls itself a Government falls and they actually have a proper Administration to which it can be returned? Will she also join me in urging many other countries around the world to join together and create a single fund from which a repayment mechanism can be created for the damage done to Ukraine and the rebuilding of Russia in due course?
My hon. Friend is right. Our issue is not with the Russian people, many of whom are now protesting against this appalling regime; it is with Putin and his cronies. That is who we are targeting with our hit on oligarchs. My hon. Friend is right that that money should be protected. I will look into the idea that he puts forward.

Commons ChamberMy hon. Friend is absolutely right: Teesside is absolutely set to benefit from this deal. There will be a removal of tariffs on products such as steel and chemicals—no British product will face tariffs into Australia. The north-east is already incredibly successful in exporting 10,000 cars to Australia every year. The tariff on cars will be removed, allowing even more of our fantastic exports down under.
Tapadh leat, Mr Speaker. Some are saying that Australia has never before had such good luck in a trade negotiation and are wondering how this would have been different had the UK not been at the table. They suspect that Canberra is running out of champagne.
The reality is that in year one of the deal, UK farmers face the arrival from Australia of more quantities of beef, sugar, lamb, cheese and other dairy products than ever arrived in any year from the EU. To make up for the Brexit damage, we would need 245 such deals, which are very risky to farming. There is a feeling of unseemly haste with this deal. Incidentally, the EU would not create such risks for its farmers. With all that in mind, and given the need for scrutiny, will the International Trade Secretary appear before our Select Committee in the next week to 10 days so that we can have a good to and fro and investigate the issues before she signs the deal and Australia has her in handcuffs?
It is interesting that the Chairman of the Select Committee accuses me of haste. It is true that the EU is in the fourth year of its negotiations with Australia, just as it takes a very long time to negotiate any deal with any party. Fundamentally, the EU’s instincts are not to open up its markets. That has cost British business over the years, because we have not had access to Australian and Pacific markets on the same terms as others.
I assure the hon. Gentleman that I will appear in front of his Committee to answer questions prior to the signing. I am very happy to give him any kind of briefing. As he knows, he will get a copy of the signed trade agreement before anyone else—[Interruption.] I am afraid I cannot understand the hon. Gentleman’s gesticulations, because there is no sound. I think he is very happy that I will appear before the Committee—that is the message I am receiving.
As I have already said to the right hon. Member for Islington South and Finsbury (Emily Thornberry), in none of the 15 years of the transition period for beef and lamb access is the amount higher than that we currently import from the EU. It is extraordinary that the Labour party is happy with a zero tariff, zero quota deal with a landmass that is much closer to the UK, but afraid of a country that is 9,000 miles away. It seems to be one rule for its friends in the EU, and another rule for everybody else.
It might help if the hon. Gentleman went on a British Sign Language course.
I am pleased that our agreement with Australia will contain a strong labour chapter, and also a small and medium-sized enterprise chapter that will cut red tape on our fantastic SMEs that want to export around the world, cutting their paperwork so that they can get more of their fantastic goods, including, of course, food and drink companies.

Commons ChamberNext week we have the New Zealand Trade Minister, Damien O’Connor, coming to the UK, and we are working on a gold-standard agreement that will give us more access to Pacific markets at the same time as further deepening our economic relationship with a long-standing and trusted partner.
Happy birthday, Mr Speaker; I am sorry that I did not mention it earlier.
The UK has inaugurated the first ever G7 trade track to take forward the issue of free and fair trade. We need to make sure that the WTO is reformed to stop unfair trading practices and modernise the global trading system.
As I have said, the UK is always willing to listen to pragmatic suggestions about how we make the regime work better. For example, we have supported the abolition of export restrictions—many other countries have not—so that we can see goods flow around the world. The fact is that the real changes are being made by voluntary licensing, as we have enabled at the Serum Institute in India. We are part of the third-way work to roll out practical answers. There is no IP waiver proposal on the table that would actually deliver more vaccines to the poorest people in the world, which is what we want to achieve.
The difference is that you and I don’t count the years, Mr Speaker. Instead, we make the years count, and that is important.
It is really important that we have these trade deals and I support them, but I wish to express concern about the Australian trade deal. I declare an interest as a member of the Ulster Farmers’ Union. The Ulster Farmers’ Union and my neighbours, who are members of it, have expressed concern about the quality of Australian beef and the fact that it might impact adversely on the Northern Ireland beef sector and industry. We export most of our beef. Can the Secretary of State assure me that the deal will not impact on the Northern Ireland beef sector?
I thank the hon. Gentleman for his question. I have met the Foyle Food Group, for example, who were the first beef exporters to export to the United States when we got the ban removed. I know that there are huge opportunities around the world for high-quality Northern Ireland beef. Part of what we are doing with the Australian trade deal is opening up wider access to the Asia-Pacific markets, which have higher prices than here in the UK and in Europe and will bring more opportunity. I am very happy to have further conversations with the hon. Gentleman.

Friend the Chancellor of the Duchy of Lancaster gave a statement on this issue yesterday, and he is working hard with the Brexit business taskforce to deal with those issues. We also have the trader support scheme for Northern Ireland. I am pleased to say that freight volumes for Northern Ireland ports are at normal levels for this time of year, and there are no significant queues. Supermarkets are reporting healthy levels of supplies, but I certainly will pass on my hon. Friend’s issue to the Chancellor of the Duchy of Lancaster to ensure that it is resolved.
Let us head to Scotland to Scottish National party spokesperson Stewart Hosie with the first of two questions.
I had hoped that the right hon. Lady would have welcomed our announcement earlier this week on the action we are taking on forced labour in Xinjiang and making sure that Britain upholds its values when trading internationally. I would ask her to consider some of her previous actions, such as sharing a platform with Hamas and refusing to criticise Fidel Castro’s abhorrent human rights abuses. It is a bit much being lectured by a Labour Member on human rights, given her past record.
Can I just say to the Secretary of State that I expect better of her answer? That was just way off beam. In fairness, you are a much better Secretary of State than that, and I do expect better.

Commons ChamberAs I have said, of course in any trade deal that we strike we will take into account our high standards, to ensure that our farmers are not undermined, but if the right hon. Lady is suggesting a blanket ban on any foodstuffs that do not comply exactly with British farm regulations, she is talking about preventing developing countries from sending their foodstuffs to the United Kingdom. Is she saying—[Interruption.] She will understand that under most favoured nation rules we have to apply the same standards to every country that we deal with, so is she saying that she wants to ban Kenyans from exporting their products to us if they do not follow exactly the same farm standards as here in Britain? I want to ensure that our farmers are able to continue with their high standards, but I do not want to stop developing countries exporting their goods to us.
Let us calm it down a little with the Chair of the International Trade Committee, Angus Brendan MacNeil. There is no more calming influence than Brendan.
I know that my hon. Friend is a staunch advocate of free ports, especially one in Teesside, and I know he will have been delighted by the announcement yesterday from the Chancellor that there will be 10 new free ports across the United Kingdom by the end of 2021, bringing more trade, more opportunities and more growth to areas right across the nation.
We come now to Richard Graham’s question, but he is not here, so I call the Minister on this group of questions.
Both the Farmers’ Union of Wales and the National Farmers Union Wales are represented on the Trade and Agriculture Commission to ensure that there is a full voice for Welsh farmers on future trade agreements. Under the recent Japan deal, Welsh lamb is now going to be recognised geographical indicator, and we are fighting to get lamb into the US market. There are lots of opportunities out there for Welsh lamb farmers, which we are pursuing vigorously.

Commons ChamberWe are the first potential accession country that has had a meeting with all 11 chief negotiators. We will now go into separate discussions with those countries to prepare our accession plans. I hope to be able to formally apply early next year so that we can make progress and accede to this high-standards agreement, which will give British exporters access to the fast-growing Pacific market.
We are now heading up to Scotland to Angus Brendan MacNeil, Chair of the Select Committee.
I urge the hon. Lady to look beyond the EU—90% of global growth is coming from beyond the EU. Both Japan and the wider Pacific region, which is a fast-growing area, are vital for Britain’s future economy. Of course we want a deal with the EU, but that should not stop us doing advantageous deals with fast-growing parts of the world and working with allies to put forward the cause of free and fair trade.
There are huge benefits to the economy of north-east Wales, whether in digital and data, agriculture such as Welsh lamb, or areas such as manufacturing, where we have reduced the cost of bringing in car parts and agreed closer regulatory co-operation between Japan and the UK.
My hon. Friend is absolutely right. This deal has benefits and opportunities for all of the UK. It is a central part of levelling up our country, ensuring that every region and nation has those opportunities and gets jobs and growth into its local areas.

Friend is absolutely right; I would always seek the support not only of the House but of people across the United Kingdom, because we want every single trade deal we sign to benefit our businesses, our consumers and our country. However, if some doubtful people on the Opposition Benches do not believe me, there is protection, because under the Constitutional Reform and Governance Act 2010 system any trade deal can be blocked by this House. Of course, I would never consider putting forward a trade deal that would not command the support of the House, but there is always that protection for those doubting Thomases on the Opposition Benches.
Order. Will the Secretary of State get off the platform? We want to get through the list.
I think it is absolute hypocrisy to hear that type of argument from the Labour party. Until recently, they had a shadow Chancellor, whom the hon. Lady supported, who called for the lynching of one of my female colleagues and never apologised. Labour has never elected a female leader, despite having the opportunity time and again. The reality is that they would rather virtue-signal and indulge in tokenism than take real action to improve the lives of women.
Order. I think we ought to remember that we are dealing with international trade questions. That goes for Members on both sides of the House.
The reality is that those on the left of politics are always intolerant of anyone who does not agree with them but are prepared to defend anything from their own friends, such as the right hon. Member for Hayes and Harlington (John McDonnell). When is the hon. Gentleman going to condemn the right hon. Gentleman’s call to lynch one of my female colleagues?
Order. We have to remember that we actually answer questions, rather than keep asking them.

He is absolutely right: we need to make sure that, as part of our levelling-up agenda, this is a cross-UK phenomenon. We have growth hubs across the country. We are also working on mentoring schemes and on trying to ensure that investment is available right through the UK to help those start-up businesses get going.

Commons ChamberFirst, I welcome the right hon. Lady to her seat. It is great to see her in the flesh, even though we have had a number of calls over the last few weeks. I am committed to working with the Opposition to ensure that we get the best possible deal for all parts of the UK in the US trade deal. I can assure her that when we negotiate with the United States we will negotiate in the UK’s interest, ensuring that we have full freedom of manoeuvre and making our own sovereign decisions as a country. Of course, we are looking at a number of precursor agreements for the text we use in those trade negotiations, but my No. 1 priority is to ensure that we have our own sovereign capability to trade with the rest of the world as we see fit. One important benefit of a US trade deal and the trade deal we are looking to strike with Japan is that we need to be setting standards with fellow free market democracies and ensuring that we have proper transparency in our operations and proper setting of standards.
The Secretary of State really needs to think about the other Members who need to get in, so if she could shorten her answers, it would be helpful to all the Members who are waiting. [Interruption.] It is very good, actually.
The hon. Gentleman is correct to say it is very important that we have resilient trade as well as trade that benefits our economy. That is why our strategy is to strike trade deals with more partners, to ensure that our companies have more options and that we are trading with a wider variety of nations than we were before.

Let me put on the record my thanks to all the teachers across the country who are doing a brilliant job keeping our children educated using the latest technology. We are doing all we can to ensure that no child, whatever their background, is left behind during this crisis. We have already committed more than £100 million to boost remote learning, and we are funding access to IT devices and software, focused on the most disadvantaged.

I have only two minutes left, Mr Deputy Speaker, and I am afraid I cannot give way. Labour’s tax hikes would cost jobs and its war on enterprise would crush the very people who make this country great.
The past eight years have been tough, but Monday’s Budget marked a new era. It is about more jobs than ever before. It is about businesses succeeding. It is about wages going up. It is about people keeping more of what they earn. It is about people feeling better off in their everyday lives. This is a Budget for a confident, optimistic British future that puts more money in people’s pockets, frees enterprise to invest, and paves the way for a high- growth, high-aspiration post-Brexit Britain. I commend this Budget to the House.

Commons ChamberIn any case, we are setting up a parliamentary scheme so that we can work more closely with prison officers and give them the kudos they deserve, because they do an incredibly important job, often behind walls. As part of the reform programme, I want to see prisons reaching out more into the local community and working with local employers. As the shadow Secretary of State said, ultimately, the vast majority of people in prison will one day be on the outside and be part of the local community, so we need to work on that.
While we are putting in place the long and medium-term measures to get additional staff in to reform our prisons, we are taking immediate action to improve security and stability across the estate. That includes extra CCTV, the deployment of national resources and regular taskforce meetings chaired by the prisons Minister. He holds regular meetings with the Prison Service to monitor prisons for risk factors, and that allows us to react quickly to emerging problems and provide immediate support to governors, on anything from transferring difficult prisoners to speeding up the repair of damaged facilities.
Hon. Friends have talked about psychoactive substances, which have been a game changer in the prisons system, as the prisons and probation ombudsman has acknowledged. In September, we rolled out to all prisons new mandatory drug tests for psychoactive drugs, and we have increased the number of search dogs and trained them to detect drugs such as Spice and Mamba. We are also working with mobile phone operators on new solutions, being trialled in three prisons, to combat illicit phones, and we have specific powers to block phones too.

With this it will be convenient to discuss new clause 6—Staff to child ratios: Ofsted-registered childminder settings—
‘(1) This section applies to Ofsted-registered childminder settings.
(2) The ratio of staff to children under the age of eight must be no less than one to six, where—
(a) a maximum of three children may be young children;
(b) a maximum of one child is under the age of one.
(3) Any care provided by childminders for older children must not adversely affect the care of children receiving early years provision.
(4) If a childminder can demonstrate to parents, carers and inspectors, that the individual needs of all the children are being met, then in addition to the ratio set out in subsection (2), they may also care for—
(a) babies who are siblings of the children referred to in subsection (2), or
(b) their own baby.
(5) If children aged between four and five years only attend the childminding setting outside of normal school hours or the normal school term time, they may be cared for at the same time as three other young children, provided that at no time the ratio of staff to children under the age of eight exceeds one to six.
(6) If a childminder employs an assistant or works with another childminder, each childminder or assistant may care for the number of children permitted by the ratios specified in subsections (2), (4), and (5).
(7) Children may only be left in the sole care of a childminder’s assistant for two hours in a single day.
(8) Childminders must obtain the permission of a child’s parents or carers before that child can be left in the sole care of a childminder’s assistant.
(9) The ratios in subsections (2), (4) and (5) apply to childminders providing overnight care, provided that the children are continuously monitored, which may be through the use of electronic equipment.
(10) For the purposes of this section a child is—
(a) a “young child” up until 1 September following his or her fifth birthday.
(b) an “older child” after the 1 September following his or her fifth birthday.’.
New clause 7—Staff to child ratios: Ofsted-registered non-domestic childcare settings—
‘(1) This section applies to Ofsted-registered, non-domestic childcare settings.
(2) For children aged under two—
(a) the ratio of staff to children must be no less than one to three;
(b) at least one member of staff must hold a full and relevant level 3 qualification, and must be suitably experienced in working with children under two;
(c) at least half of all other members of staff must hold a full and relevant level 2 qualification;
(d) at least half of all members of staff must have received training in care for babies; and
(e) where there is a dedicated area solely for children under two years old, the member of staff in charge of that area must, in the judgement of their employer, have suitable experience of working with children under two years old.
(3) For children between the ages of two and three—
(a) the ratio of staff to children must be no less than one to four;
(b) at least one member of staff must hold a full and relevant level 3 qualification, and
(c) at least half of all other members of staff must hold a full and relevant level 2 qualification;
(4) Where there is registered early years provision, which operates between 8 am and 4 pm, and a member of staff with Qualified Teacher status, Early Years Professional status or other full and relevant level 6 qualification is working directly with the children, for children aged three and over—
(a) the ratio of staff to children must be no less than one to 13; and
(b) at least one member of staff must hold a full and relevant level 3 qualification.
(5) Where there is registered early years provision, which operates outside the hours of 8 am and 4 pm, and between the hours of 8 am and 4 pm, where a member of staff with Qualified Teacher status, Early Years Professional status or other full and relevant level 6 qualification is not working directly with the children, for children aged three and over—
(a) the ratio of staff to children must be no less than one to eight;
(b) at least one member of staff must hold a full and relevant level 3 qualification, and
(c) at least half of all other staff must hold a full and relevant level 2 qualification;
(6) In independent schools where—
(a) a member of staff with Qualified Teacher status, Early Years Professional status or other full and relevant level 6 qualification;
(b) an instructor; or
(c) a suitably qualified overseas-trained teacher is working directly with the children, for children aged three and over—
(i) for classes where the majority of children will reach the age of five or older within the school year, the ratio of staff to children must be no less than one to 30;
(ii) for all other classes the ratio of staff to children must be no less than one to 13; and
(iii) at least one other member of staff must hold a full and relevant level 3 qualification.
(7) In independent schools where there is—
(a) no member of staff with Qualified Teacher status, Early Years Professional status or other full and relevant level 6 qualification;
(b) no instructor; or
(c) no suitably qualified overseas-trained teacher working directly with the children, for children aged three and over—
(i) the ratio of staff to children must be no less than one to eight;
(ii) at least one other member of staff must hold a full and relevant level 3 qualification, and
(iii) at least one other member of staff must hold a full and relevant level 2 qualification.
(8) In maintained nursery schools and nursery classes in maintained schools (except reception classes)—
(a) the ratio of staff to children must be no less than one to 13;
(b) at least one member of staff must be a school teacher as defined by subsection 122(3) [Power to prescribe pay and conditions] of the Education Act 2002 and Schedule 2 to the Education (School Teachers’ Qualifications) (England) Regulations 2003; and
(c) at least one other member of staff must hold a full and relevant level 3 qualification.
(9) The Secretary of State may make provision in statutory guidance to—
(a) define qualifications as “full and relevant”; and
(b) define “suitable experience” for those working with children under two.
(10) If HM Chief Inspector of Education is concerned about the quality of provision or the safety and well-being of children in a setting he may impose different ratios.’.

Government amendment 28.
I wish to speak to new clause 10, which introduces paving legislation to allow Her Majesty’s Revenue and Customs to begin to set up tax-free child care, and amendment 28, which is a minor and technical amendment relating to the Legal Aid, Sentencing and Punishment of Offenders Act 2012.
First, I will comment on new clauses 6 and 7. As the House knows, we have proposals, on which we have consulted, for providers with highly qualified staff to be able to operate more flexible staff-to-child ratios, in line with best practice in leading European countries such as France, Holland and Germany. I highlight the fact that these proposals would be entirely optional for nurseries and are about empowering the front line.
The proposals received support from, among others, Sir Martin Narey, formerly of Barnado’s, and Sir Michael Wilshaw of Ofsted. I firmly believe that these flexibilities would allow nurseries to offer more choice of high-quality child care places to parents, invest additional revenue in attracting the best staff, and reduce costs for parents. However, as I made clear on the media this morning, it has not been possible to reach cross-Government agreement, so we are not proceeding with this reform.
That will not stop me working to make affordable, quality child care available to all. I am absolutely committed to this goal.

I thank the hon. Lady for her intervention. Perhaps in due course she could tell me why Canada, France and Germany insist on those subjects being taken to age 16, and why all those countries are doing better than us in the OECD PISA—programme for international student assessment—tables.
The Government are taking absolutely the right approach of strengthening the core, getting rid of modules from exams, making rigorous assessments, and encouraging students to take the E-bac. It is so encouraging that this year the numbers of new entries to these subjects have gone up. We are also offering proper apprenticeships to get people the proper work experience that they need to build a successful career. We will not create careers with more hot air; we will create careers through real learning in real subjects and real jobs.
