Just to be clear, we will leave on the 31st and we are prepared to leave on the 31st—that adds information, rather than detracts—and we will abide by the Court decision.
This morning, a Cabinet source was quoted as saying that the reason the Prime Minister is removing the level playing field protections on consumer, workers’ and environmental rights is that the Government know they would
“seriously restrict our ability to deregulate and do trade with other countries.”
That is the real aim of the Government’s Brexit proposals, is it not—to deregulate our economy and cut back rights?

My hon. Friend is quite right. The Government would have to lay a statutory instrument and the House would have to debate and vote on it.
Does the Minister not accept the irony—some would say hypocrisy—of the Government saying the public can have a vote neither on whether to agree the Prime Minister’s deal or remain nor in the European elections but that the House can vote three times on her deal?
And Labour Members are urging the Cooper-Boles amendment. It has been rejected twice, yet they still seek to bring it back to the House. That is how the House of Commons is operating these days.

Commons ChamberThe UK has a tradition of exceeding EU standards, so we do not need to follow EU rules to continue to lead the way. It is a matter for Parliament to decide, and the Prime Minister has signalled her intent to give Parliament more control on these issues.
The Secretary of State needs to stop playing games on this, because he knows that even if commitments on workers’ rights and other rights are put into primary legislation, once we leave the EU they can be overturned by a future Tory Government, and for years we have heard from those on the Conservative Benches about their aspirations to deregulate the labour market and make it easier to sack people. The single market is the only way of having a binding guarantee on workers’ rights; will the Secretary of State accept that?
I think the person playing games, with respect, is the hon. Lady, who is ignoring the fact that in a number of areas we exceed the European standards. For example, on maternity leave the UK offers 52 weeks, 39 weeks of which are paid, whereas under the pregnant workers directive just 14 weeks are paid. I do not accept the paucity of the hon. Lady’s ambition: the UK should be looking to go beyond that and provide better workers’ rights than she seems to be seeking.

Commons ChamberThe Secretary of State will know from his discussions how concerned the Welsh Government are about the prospect of a no-deal exit—the Prime Minister was told that last night. The Secretary of State will also have seen the comments from the chief executive of Airbus this morning, and his stark warning about no deal. Will he therefore take this opportunity to condemn the comments of his Conservative MEP colleague David Bannerman, who described Mr Enders’s warning as
“a German CEO putting EU interests first before his own employees”?
I take very seriously the warning from the chief executive of Airbus, but I remind the hon. Lady that he supports the Prime Minister’s deal. Many in business regard the deal as the way of delivering certainty through the implementation period. There is a lot of positivity with Airbus. If I look at the work that my hon. Friend the Member for Filton and Bradley Stoke (Jack Lopresti) has done to champion the “wing of the future” at the research and development centre there, I see that there is huge opportunity. What the chief executive and others in the business community are clear about is that they want a deal in order to avoid the uncertainty of no deal, and that is why they are backing the Prime Minister.

Commons ChamberAs I am sure that you, Mr Speaker, and the House recall, the hon. Gentleman voted to trigger article 50. He himself voted for it, so if he is now saying that he has changed his mind, perhaps that is the sort of uncertainty about which the financial markets have expressed concern. They look to the House for a response that will deliver them certainty for their investment and see Members like the hon. Gentleman changing their mind.
Today marks exactly 900 days since the outcome of the referendum in 2016. The Secretary of State says that there will be no article 50 revocation, but if between this morning and this afternoon the Prime Minister can change her mind about us having a vote tomorrow, why will his Government not allow the people to have a vote in a second referendum?
One would have thought, after 900 days, that we would be clear as to what the Labour party’s policy is. It is still unclear as to whether the Leader of the Opposition thinks that we can stop Brexit or not—he said it could not be stopped and then his shadow Brexit Secretary, the right hon. and learned Member for Holborn and St Pancras (Keir Starmer), said that it could—and he was unclear as to how he would vote in a second referendum. It is unclear today whether he would actually seek to revoke article 50 and go back on the manifesto commitment that he gave.

I thank my hon. Friend for her intervention, which I think covers a point that we looked at before. Certainly, the petitioners say that they have real concerns and that there should be a provision to stop Brexit. I am summarising what the Government have said, and I am sure that the Minister will address more fully some of the points that have been made.
The Government say:
“We have already carried out very significant ‘no deal’ preparations and have been publishing a series of notices so that businesses and citizens have time to prepare.”
They say that their objectives are
“to minimise disruption and to prioritise continuity and stability, including for businesses…as well as for EU citizens”.
They will
“continue working closely with industries that are most affected by ‘no deal’ plans and implementation”
and
“continue to apply highly automated, risk based and intelligence targeted customs controls when the UK leaves the EU.”
The Government say that the Prime Minister gave a “clear commitment” to EU citizens when she said:
“I couldn’t be clearer: EU citizens living lawfully in the UK today will be able to stay.”
Notwithstanding those confident assurances, I suspect that the petitioners will not feel confident that their concerns will be addressed sufficiently. I have no doubt that they would wish me to press the Minister on their behalf to fully address their concerns today, and recognise the fears that they have for the future.
Bearing in mind what has happened with the Home Office over the Windrush scandal, many constituents who are EU citizens have come to me, saying that they are very concerned about how the new scheme might operate. Does my hon. Friend share my concern that the Home Office is neither resourced nor ready to deal with all of the settled status applications?
I do indeed share my hon. Friend’s concerns, especially as in preparation for this speech, I looked on the website to see the proposals. It all looked fine until I came to the bits that said, “More information will be posted.” We are getting very near, and for those who are in the position of having to apply, it must be a real concern that the full information is not yet available and the process has not begun.
The petitioners have raised their concerns, and the petition continues to attract signatures even as we speak. Those concerns are “deal or no deal”; whether an agreement with the EU has been reached before the deadline; the impact of no deal on businesses; the impact of no deal on the border between Northern Ireland and the Republic of Ireland, and what that means for citizens; and the impact on EU citizens. As I have said, the petitioners say that if no deal has been reached, and their concerns have not been properly dealt with and safeguards have not been given, Brexit should be stopped. I have not gone into the technicalities of what constitutes a deal, how it is reached, meaningful votes, or whatever. My job today has been to give the petitioners a voice on the very real issues that concern them, and I hope that I have done so. I have therefore moved e-petition 219905 on behalf of Ciaran and over 110,000 petitioners, which states:
“If there is no agreement to leave the EU then Brexit must be stopped.”

If we were to go on to World Trade Organisation rules when we leave, we would be trading under the same terms as the USA already does with us. Tariffs would average only 3%. Some tariffs on exports would be higher, but some goods would still be exempt completely. The WTO has about 160 members, accounting for 90% of world trade. We would still trade regardless of whether we leave the EU on WTO rules or with a trade agreement. We are the world’s fifth largest economy. We are one of the five permanent members of the United Nations Security Council. We have the best universities in the world and the most resourceful and amazing people. The UK will always succeed. I am confident we will prosper.
I agree with my hon. Friend. I hope that the leader goes on another holiday, so that we have an opportunity to choose another leader for the country.
Does the Minister believe that a no-deal scenario, with all the chaos that it will cause, is a viable path for our country? If not, should not the public be given a say on the deal that cannot be reached? It has for some time been clear to me, and thousands in my constituency, that the Government do not have the answers, so ultimately the people should be given the opportunity to vote again.
Given that voters found out only last Wednesday what they apparently voted for in 2016, the only proper democratic course of action is to put the Prime Minister’s proposal to the public by way of a people’s vote, and to see whether they want to accept that or remain in the EU. Does my hon. Friend agree?
When we went to the ballot box on that fateful June day, there was only one question on the ballot paper: “Do you want to leave the European Union or not?” All those people arguing that it became a proxy vote on immigration—I agree that it was—and about all the other associations with the vote should remember that. It was not a sensible way to run a referendum that I did not agree with in the first place.

In the event of no deal, the EU’s free trade agreements will cease to apply to the UK. How many of those 37 free trade agreements have the Government successfully agreed with our partners to retain and carry over in the event of no deal?
We are currently in negotiations with all those individual partners so that we can do exactly that.

Commons ChamberDuring the implementation period, for the whole of 2019, we will apply the agreement reached at the Fisheries Council in December 2018, where we would be fully involved in that agreement as a former member state. For the 2019 negotiations, which apply to 2020, we have agreed a process of bilateral consultation between the UK and the EU ahead of negotiations with coastal states in the Fisheries Council. From December 2020, we will be negotiating fishing opportunities as an independent coastal state.
In my constituency, there are three universities and tens of thousands of students. We could remain a member of Erasmus+ when we leave the EU. Will the Minister confirm that we will do so?
The Prime Minister has set out that she believes there are great opportunities to continue to co-operate together on education and culture. We will of course need to look at what the next stage of the Erasmus+ scheme covers, but we see enormous benefits from it for students from the UK, so it is an area in which we are likely to seek further collaboration.

Commons ChamberThe latest figures from the Commission show that the UK has the second highest number of participations in Horizon 2020 out of all countries, with 8,056 participations to date, which is 12.6% of the total. Higher and secondary education organisations are performing particularly well, ranking first for participations and agreed funding. The majority of mobile EU students who study in Europe choose to do so in the UK, and 2017 data on applications for full-time higher education indicates that the number of international students who want to study in the UK is higher than it was in 2016. Although there was a slight dip in EU student applications in 2017 versus 2016, EU-domiciled applications were still higher than they were in 2015, 2014 or 2013.
Will the Minister confirm that the Government will seek to secure an early agreement with the EU on arrangements for underwriting Horizon 2020 and Erasmus+ bids for their full duration, up to the end of the programmes?
I refer the hon. Lady to the positive news in the joint statement that was agreed last week, which reflects the fact that we have agreed to work together on these matters. For the length of the Horizon 2020 programme, up to 2020, we will continue to be able to bid into the scheme.

Commons ChamberI had a discussion just this week with the Flanders chamber of commerce, and it recognised the important issue of bilateral trade between Belgium and the UK. I am pleased to say that it fully realised the need for frictionless agreements once we leave the EU, and of course this Government are committed to that.
The Prime Minister has said that Britain will not remain a full member of the customs union, but this morning the Chancellor said it is
“clear that we can’t stay in the customs union”.
Which of them should we believe?
It is clear that if we are to seek free trade agreements around the world, we will not be able to remain in the customs union as it currently stands. Having said that, we seek arrangements with our EU partners that will enable us to construct customs arrangements that are as frictionless as possible, for the benefit of both the EU and the UK.
