Thank you, Mr Evans. I will not take up my share of the time for the vast array of Labour MPs sitting here! I know that many hon. Members want to speak, so I will just say a few words. I am sorry that so few of my colleagues are here and that our Front-Bench spokesperson will presumably put the case that this leaflet is a wonderful way of spending public money. I am clear that the people who signed the petition feel very strongly that it is a waste of public money and, indeed, that many of them, as I think has been said, were remainers. Many people just felt that this was not fair.

We went through the process and got legislation about referendums, and one aspect of that is that there is a campaign on each side. Each campaign is formally accepted, designated and can spend certain amounts of money and do certain things. They are the people who should be putting the arguments back and forth, apart from all the discussions that are going on anyway in our pubs and supermarkets. I think it is quite shameful that the Prime Minister has seen fit to go against what he would always personally argue about being fair and the British system of doing things—how we do things in this country.

I am grateful to the hon. Lady, who is a fellow member of the Committee. Will she recall that, last summer, we fought valiantly to stop the Government taking powers to limit the application of section 125 of the Political Parties, Elections and Referendums Act 2000, which would have allowed the Government to carry on campaigning in this manner in the last 28 days of the campaign? Is it not now clear that they were presenting excuses to us as to why they needed those flexibilities? It was simply so that they could carry on exploiting the system, as they are planning to exploit the system and possibly even breach section 125 by keeping up their websites for the entire campaign instead of taking them down for the last 28 days.

The hon. Gentleman is absolutely right. He and other members of the Committee feel so strongly about this matter that they are prepared to take very strong action if we do not get agreement from the Government to take the websites down. What is even more amazing to the public is this. When they talk about “the Government”, it is the Cabinet, and the Cabinet is actually split on this matter. If the Government were really being fair, two thirds of the leaflet would have been from one side and one third would have been from the Brexit side.

Is not the situation even worse than that? The official policy of the party of government is neutrality.

I do not normally look at the detail of Conservative party policy, but I am very pleased to hear and to repeat that. I felt very angry when the leaflet came out. I looked through it and saw all the so-called facts that we can go through and spend a lot of time pulling to pieces, but when it comes down to it, I have great confidence in the common sense of the British public. I think they will already have seen through the leaflet and seen it for what it is—full propaganda. Then, of course, we wake up literally every day to another shock-horror dreadful scare story. The stories become more ridiculous every day, today’s one being just about the most ridiculous possible—that we are threatened with war. In fact, it is absolutely shameful, because there are some people in this country who believe Prime Ministers and who will be slightly worried about that. It is absolutely shameful that the level of debate from the leadership of this country is so trivial and ridiculous that they come up with scare stories such as that.

The hon. Lady should not believe that we have heard the worst—we have not yet got to plague and pestilence or the imminent asteroid impact that will happen if we vote to leave the European Union. Is this not more than a question of money or even fairness or the rubbish content of the leaflet itself? Is not the real importance here the fact that it may, if there is a very tight result, call into question the legitimacy of the result itself? Does the hon. Lady agree that those who believe that they should win the referendum at any price might want to consider what “any price” might look like?

That is a very important point. The one thing that we all said when we were debating the details of the referendum Bill was that the referendum had to be seen as free and fair. At the moment, I do not have confidence in its being free and fair, and I do not even have confidence that if, nearer the time, it looks like those who wish to leave are winning, something will not happen to make it even less free and fair. I genuinely have that concern, and it is a shocking thing even to be thinking as a democratically elected Member of this great House of Commons.

I refer hon. Members to my declaration of interest as a director of Grassroots Out Ltd. One thing that seems to be causing great confusion in the country is the statement on the back of the leaflet about needing to register to vote in order to participate in the referendum. Does the hon. Lady agree that Ministers need to do more to set the record straight? The fact is that if people are on the electoral register, they are registered to vote; it is wrong and misleading to suggest otherwise.

That is a very important point. I hope the Minister will clarify how the Government will do more to reassure people that they do not have to re-register if they are already on the register, because many people are worried about that.

While we are talking about all the different scare stories, I have been thinking about the way every time the Prime Minister speaks or some of the remainers speak, they challenge us on which international figures support our leaving the European Union. I just have this vision that the Prime Minister will do something so that one morning we will wake up and hear on the “Today” programme that President Putin has asked us to stay in the European Union. That is the level to which I think we have got.

For a moment, I thought that that “Ride of the Valkyries” ringtone meant that the remainers were coming late to try to save the day. Has the hon. Lady not noticed a certain inconsistency in the Government’s position? They try to frighten us with the fact that President Putin, evidently, would like us to leave, whereas it is regarded as praiseworthy that the President of communist China wants us to remain. It seems to me that there is an element of cake and eating it at the same time.

Fortunately, the people who will ultimately decide are our constituents. There is one vote for everyone. We are all equal here. Everybody will have their say and, I hope, we will not be relying on President Obama or on any other President.

It is worth remembering that it is not the first time that the United States of America has misconstrued its own interests. President Roosevelt did not want Churchill to fight Hitler. He wanted us to make peace with Mussolini. Ronald Reagan pleaded with Margaret Thatcher not to take the Falkland Islands by military force but to do some kind of shared sovereignty deal with a south American dictator. Our allies may be our allies, but they are not always right.

Indeed, President Obama was quite wrong. When I was in Washington last weekend, we met a lot of senior Democrats and Republicans who said to us quite publicly, behind the scenes, that the UK leaving the EU would really not make any difference whatever to the United States. That is what the ordinary political person in America thinks. However, the vast majority of the American public do not even know what the EU is, so what President Obama said is not too worrying.

It annoyed me so much that one of the facts in the leaflet is:

“The UK has secured a special status in the EU.”

I have read a lot about that and have been through various documents, and I would love to see where that wording is actually included in the renegotiation document by the Heads of Government.

The renegotiation is not legally binding. The hon. Member for Stone (Sir William Cash) has done a lot of work on that in the European Scrutiny Committee. We cannot be confident that the aim of ever closer union will, in any way, do anything other than to take the renegotiation into account. It is so ridiculous that that has been put in, and I want the Minister to respond to that point.

I raised that point with the Prime Minister and asked him whether he could cite a single occasion when ever closer union was the sole basis for legal judgment. He wrote back to me admitting that there was not an example.

That “fact” is therefore completely untrue. Although I do not want us to spend more public money, we really should produce another leaflet pointing out all the things that are wrong in this one.

It is a question not only of whether the renegotiation is legally binding, but of whether it is legally binding and irreversible. It is not.

I always bow to the hon. Gentleman’s wisdom. I will not go through all the facts in the leaflet because I am sure that everybody would like to mention particular points.

When someone writes the history of this Administration and, particularly, of this Prime Minister, the way the Prime Minister has behaved on this matter will go down as very sad. It is eating into the kind of country the UK is. He should be ashamed of what he is doing. I just hope that, in some way, the response here and from the public will make him realise that he is clearly showing the country that he is deeply frightened about what will happen on 23 June. If that is the reason that all the scare stories are coming out, I am pleased. On 23 June, I want the Great British public to speak out, get out to vote and take us out of the anti-democratic EU.

Absolutely, and in which of the two alternative models can we more influence other European countries? We have one model in which we can express our view and, with a democratic decision of our own Parliament, pursue a policy to try to enact that view. Alternatively, we can take the view that we will have more influence by submerging our voting power in a collective pool of voters, with a construct made up of legislatures and commissioners appointed by the 27 other member countries as well as by Britain. We can be outvoted time and again by an overwhelming majority of other countries’ Parliaments or commissioners and have our views totally disregarded.

It is understandable that people on the other side of the Atlantic who on two occasions, against their initial inclinations, have been forced into a conflict originating on the continent of Europe as a result of German militarism would prefer that Britain remain part of an organisation that they know can spell trouble for the United States of America in the future, just as it has in the past. However, they are making a fatal miscalculation if they think that we will be better able to keep the Governments of the remaining parts of Europe on some sort of track of common sense and reliable policy making by being outvoted by them at every turn. We need a system in which we can make our criticisms, and if those criticisms are not accepted we can go on making them and formulate policies to try to mitigate the effects of foolish policies that others might adopt.

I must say that the developments we have seen in the past couple of days are frankly very worrying. First there was the use of intelligence chiefs to say publicly that we would somehow be less safe in our intelligence sharing if we left the EU. At least one of the two intelligence chiefs concerned told me privately that we would be no worse off. We have seen that before—we saw the same operation when Downing Street tried to get a large number of retired military figures to sign up to a letter. Several of them did, but quite a lot of them refused. One of those whose signature was attached had not agreed, and Downing Street had to apologise to him. Another who had reluctantly agreed said that it was nevertheless unpleasant that he felt pressured to sign and that it was not the sort of letter he would have written himself.

Let not the Government turn around with innocence in their eye and say, “Good heavens, the very idea that we would try to manipulate senior figures or public opinion is outrageous.” The reality is that they have been caught doing it before. For that reason, they probably did not do it directly with the two intelligence chiefs, but we all know the Foreign and Commonwealth Office’s official line on Britain remaining in Europe. No. 10 would not have to do a great deal to persuade a former senior diplomat—later the head of an intelligence agency—to put forward a line amenable to the Government’s standpoint.

Does the right hon. Gentleman think that many of the people who are being asked to do things on behalf of the Prime Minister—or indeed the Prime Minister himself—are looking towards a future job with the European Union, perhaps when they retire from whatever they are doing at the moment?

I would not like to attribute any particular motivation. It may often go no further than the fact that for someone with a long and honourable record of public service, who is used to serving democratically elected Governments, it is very difficult to refuse a request from high up in the political establishment—possibly from the Prime Minister or the Prime Minister’s representative—that they should speak out in support of Government policy. Let us put it this way: to refuse might be deemed ungrateful and against the ethos of civil servants’ obedience to Government rule. One does not have to look for base motives; one can simply say that it would take a special sort of independence of mind for someone to tell the Prime Minister or his representative that they were not going to help out in his hour of need.

It certainly seems to be an hour of need, because the reality is that the campaign seems to be getting more and more desperate and unscrupulous. Everything the remain campaigners do seems to be unavailing in shifting public opinion. The further they dig themselves into holes through dodgy tactics, the harder it becomes to defend them. I revert to what I said at the beginning: it appears that no Back Bencher is willing to attend the debate and speak up in favour of the Government’s tactics in producing this one-sided leaflet. These things do not happen by accident.

It is a pleasure to serve under your chairmanship, Mr Stringer. I congratulate my hon. Friend the Member for Sutton and Cheam (Paul Scully) on such a brilliant introduction to the debate, and thank the many Members who have already spoken so well and so clearly. I shall not speak for long.

I have a copy of the leaflet—I sent mine back to the Prime Minister personally. As I said in an intervention earlier, I am delighted that I have the opportunity to speak about it before war breaks out and I am summoned. I am an ex-serviceman, my uniform is still hanging in the cupboard and I am ready to serve again, but I hope that we do not have to use armed force against our European allies. If they are allies and the EU state is so wonderful, as the Prime Minister and others believe, it is simply beyond me as to why one country’s leaving should cause war and genocide. The argument just does not stack up. As the hon. Member for Vauxhall (Kate Hoey) and others have said, it is shameful that the Government are using such language.

When we hear from the Minister later, I am sure we will hear what we have heard from him before: a lot of—well, I cannot think of the appropriate word because he and I so fundamentally disagree. I wish this could be a light-hearted debate, I really do. I wish a sense of humour could be injected—although occasionally it is because the arguments for staying in are so farcical—but this is all about our country and its future. It is not about individual politicians or political legacies; it is about the future of our country and the freedom of the people who live in it. It is as simple as that. It is about our right to our own destiny and to guide our country in the direction we wish her to go.

On the back of the leaflet it says, “Protecting jobs”, and next to it is a tick. Tell that to half the members of the EU. They have huge rates of unemployment and are crippled by the euro and bankrupt. Italy was run by bureaucrats for a short period. Could that happen to us? The same people advised us to sell off the pound and join the euro. What an absolute disaster that would have been! One of the main reasons why our economy is potentially strong now is because we retained the pound. The leaflet also says, “A stronger economy”, with a tick. Again, tell that to the millions of people who are struggling to find work. It says, “Providing security”—security! Look at the evidence: civil unrest, terrorism, uncontrolled immigration and the rise of the left and the right. That is just what everyone feared all those years ago and, as has been mentioned, why so many millions died to keep us free. The EU is creating that same fear again because none of this makes sense.

I am staggered. I find it very difficult to comprehend how my party is in league with left-leaning parties, except for a few honourable exceptions. That is not to defame anyone for being on the left, right or centre, but it seems to me that the socialist-leaning parties want the EU to survive because it is a bureaucracy. Bureaucrats run it and are paid God knows how much money, with pensions, huge offices and secretaries—the cost is astronomical—and they are unaccountable.

The hon. Gentleman mentioned EU pensions, which is something that really bugs me. There are all those Members in the House of Lords who have worked for the European Union as commissioners and so on and now have big pensions—really, they are signed up to never bringing the European Union into disrepute. Does he agree not only that should they have to declare an interest, which they do not, but that they should not be allowed to take part or vote in anything to do with the European Union? They are deeply committed to it because of their huge pensions and if they say anything wrong they might get that taken away.

I agree with the hon. Lady. It certainly seems from those who have contributed to the debate so far that people are easily manipulated, or bought, or whatever. If the allegation is one of corruption, perhaps that is a bit strong, but certainly for ex-servicemen to speak out as they did is most unusual. Generals and highly respected people who have served this country should not be politicised. They should never have been asked to write that letter on behalf of the Government. It was an absolute disgrace. I have since spoken to one of the signatories, who shall remain nameless, and I have to say that I do not think he is particularly proud of signing that letter.

Let me return to the document. Interestingly, it has seven pictures. It does not have very many pages, but it has seven pictures: a calendar; a gentleman working on a bit of engineering; a basket of food; a ship; a “UK Border” sign; a family in the kitchen, washing up the breakfast, lunch or dinner; and a family walking down the street with a baby. You could not make this up. If the argument to stay in is so strong, why are these pages not full of facts trying to persuade people to stay in? The fact is that the Government do not have sufficient facts to fill this tiny, shabby leaflet.

I thank my hon. Friend for that very important point. Does she not squirm at the fact that her campaign to remain is called “Britain Stronger in Europe”?

It is not. It is called “Labour In for Britain”. I am part of a Labour campaign. As far as I can see, the leaflet is entirely legal. It has been issued by the Government well in advance of the last 28 days of the referendum period, when section 125 of the Political Parties, Elections and Referendums Act 2000 will apply and restrict publications about the referendum by bodies or persons that are wholly or mainly publicly funded. The leaflet represents the official view of the Government on the biggest decision that this country will make in a generation and which will impact on this country and our neighbours for decades. In my view, it would be unacceptable for the Government not to have a view on that and not to share that view with the people of this country.

I return to what I said earlier: there is clear evidence from the independent polling research— its methodology has been published by the company concerned on its website—that more information is wanted by the British public. That research finding bears out what I and, I suspect, many other hon. Members on both sides of the House are finding anecdotally in conversations with constituents. I now spend time virtually every day signing replies to Members of Parliament, who have enclosed letters from constituents saying they feel they do not yet have enough information on which to make an informed decision and would like to have some more.

I hope that people will look carefully at what the Government are arguing, that they will look at the arguments put forward by the two campaign groups, once they have been designated, and that they will come to a decision about what they believe to be in the best interests of the United Kingdom as a whole. That is how the Government are approaching this matter.

The Minister will try as hard as he can to bluster, but the reality is that the public will see through it and realise that this leaflet is deeply unfair. On one fact—

“Over 3 million UK jobs are linked to exports to the EU”—

the Government have deliberately conflated trade with countries in the EU with EU membership. He knows very well that it is not necessary to be a member of the EU to trade with the EU. With this leaflet, the public know that the Government—the Prime Minister, in particular—now realise they are on the wrong side of the argument and will lose on 23 June.

I think the hon. Lady really wishes that the Government should be neutral in this debate. The Government are not neutral. We are advocating that the British people should vote in favour of continued membership of the European Union. The Prime Minister, the Foreign Secretary, the Chancellor, other Ministers and I consistently said that, when the time came for the referendum to be held, the Government would express our view clearly and make our recommendation known, so we are delivering on what we have said to the British people.

As regards the hon. Lady’s question about one particular element in the leaflet, the footnotes that support each of the statements have themselves been published online by the Government, and she and other hon. Members are welcome to check the source material.

On the contrary, my right hon. Friend the Prime Minister secured a deal that has brought some significant reforms to the European Union. I would advise my right hon. Friend to look at the reaction in many European capitals, in the media across Europe, and in the European Parliament, which has very largely been one of considerable surprise at the degree to which the Prime Minister of the United Kingdom was able to secure reforms. In some cases, that commentary involved a fair measure of criticism of other Government leaders for conceding what was believed to be too much.

I would be very happy to have a referendum as I have wanted one for years, but why did the Prime Minister ignore the views expressed in the letter from the leaders of the three Assemblies and Parliaments in the United Kingdom? Did that not show huge disrespect?

First, the letter was not ignored, and we certainly took account of the views of the devolved Administrations even though we decided in the end to disagree with their recommendation. I want to come to that point at a later stage in my remarks.

The date is just one element of the order, but clearly the most important, because the remaining elements largely flow from it. I will therefore explain the Government’s thinking on the date and then turn to the rest of the order. There must be enough time for a full, serious and considered debate that allows all the issues to have a full airing, and the campaigners must have enough time to put their case to the British people. On the other hand, although this may grieve some hon. Members, the campaign cannot continue indefinitely. The vote should be timely, while the issues are live and the details fresh—and we should also be wary of testing the public’s patience. Several prominent campaign groups are already active on both sides. Following the Prime Minister’s announcement on the outcome of the renegotiation, the debate on the referendum question will now begin in earnest and is already starting to gather real momentum.

The Government selected 23 June because we needed enough time for a proper airing of the issues, and we thought that any sooner would risk curtailing that debate, but to go any later would test the patience of the British people. School holidays in Scotland begin on 24 June, and from then people will be travelling and enjoying their summer. Later than 23 June would mean, in essence, waiting until after the summer holiday period had concluded in all parts of the United Kingdom and in Gibraltar. Frankly, I think that the British people would have found it very difficult to understand if we had asked them to wait seven or eight months after the conclusion of the renegotiation before they could have their say.

Any executive decision by any public authority might be at risk of judicial review, but criteria for the Electoral Commission are set out in PPERA and they will guide the commission in making its assessment. I am sure that the commission will want to explain its verdict when it is published. There would have to be a pretty overwhelming case for a judicial review application for it to succeed, but such an option is available.

The Electoral Commission’s initial guidance for campaigners on this issue was updated on 5 February, so potential applicants have had plenty of notice. The commission has also now published the application form online. I remind the House that the lead campaigners, once designated, will receive a number of benefits, including a higher spending limit of up to £7 million, a free delivery of mailings to every household or every elector and, assuming that campaigners are designated on both sides, access to a grant of up to £600,000 and access to a broadcast.

The second additional element in the regulations is the referendum period—namely, when full financial and campaigning controls apply and, in particular, when spending limits are imposed on campaigners. The referendum period, as set out in the regulations, is a full 10 weeks and will not overlap with the designation process. That was the approach recommended by the Electoral Commission. The referendum period will, under the regulations, start on 15 April.

The Minister may be coming on to this, but will he clarify very clearly and succinctly how this will affect Government spending? I do not mean the Government, but the Cabinet members who support staying in as opposed to those who do not. How will that work for them?

The limits on what the Government can do are set out in section 125 of the Political Parties, Elections and Referendums Act 2000. The hon. Lady will recall that that provision was the subject of significant debate when the European Union Referendum Bill was going through its stages in the House. The so-called purdah restrictions remain those set out in the 2000 Act. In addition, in requiring the Government to publish particular items of information, the European Union Referendum Act states that the Government must do so at least 10 weeks before the date of the referendum. Those are the restrictions that she asked me about.

Finally, the regulations set out the periods for reporting donations and loans received by registered campaigners, and set the deadline by which the reports must be submitted to the Electoral Commission. The purpose of those arrangements is to ensure that sources of campaign finance are visible and public before the poll, so ensuring that the campaign is transparent.

The decision before us is a simple one: when should the British people have their say? We believe that 23 June strikes the right balance: it gives time for a substantial campaign, without testing public patience. There is time for campaigners and political parties to make their cases, and for the British people to decide. I commend the regulations to the House.

As a number of us have said, mid-September is often a good time for a referendum. It gives us the summer days to campaign and engage, and the longer nights to chap on people’s doors. It is to be hoped that people will also form their own groups in an organic way. Mid-September is probably a good time, but we would certainly not opt for 23 June.

Let us give this a little bit of time. I urge all Members to listen to the social democratic case—as someone described it earlier—that was put by the First Minister this morning not so far from here, at St John’s Smith Square. Let us look at what membership of the European Union does. The United Kingdom could stand on its own two feet and be successful as an independent member state outside the European Union. We absolutely reject the “Project Fear” scare tactics: they do nothing for the case for staying in, and nothing for the case for going out. I hope that we will all bear in mind the 20-point lead that the no campaign squandered in Scotland, not just because of the positive case that we put, but also, to an extent, because of the fear tactics that those campaigners used. I hope that the Conservatives will learn the lessons of that referendum.

I know that the hon. Gentleman and I are on different sides, but I agree with him that this should be a positive campaign. May I return him to the issue of what I consider to be the hugely important letter that was signed by the First Ministers of the three home countries, all of whom had different views on the European Union? Does it not shame the Government that they showed so little respect—for respect is the word—by simply throwing that letter away and implying that it meant absolutely nothing?

The hon. Lady and I will find ourselves on different sides, by way of a respectful debate. She has made a very valid point. The issue was raised by three First Ministers, including the Labour First Minister of Wales, and was agreed on by the First Minister and the Deputy First Minister of Northern Ireland, who, as we all know, do not necessarily agree on everything, but managed to come together on this particular issue.

There will be people who want to disagree—don’t worry.

I will just turn, if I may, to the immigration emergency brake, which again is questionable. I speak here with a tinge of sadness, because I think the Government have framed this part of the debate in the wrong manner. Let us first of all be clear that the emergency brake access to in-work benefits will last only four years, with the EU, not Britain, judging whether the emergency brake is declared. Not even here do we have control. It is also unclear what happens after the period expires. In addition, access to benefits would gradually be increased, meaning it is moot how much of a deterrent to immigration a brake would actually be.

My sadness—I have said this many times in this place —is that I believe the Government are wrong to couch the debate in these terms. It feeds into a negative narrative about immigrants. It ignores the fact that almost all—the vast majority—immigrants from the EU come to Britain to work hard. They are not looking for benefits. It ignores the fact that large-scale EU immigration cannot be stopped, in all truthfulness, while we adhere to the EU’s founding principle of freedom of movement, particularly as the rise in the national living wage picks up speed. Let us have real honesty about this debate. I am fed up with listening to politicians focus on benefits and play to the gallery. It is absolutely wrong to do so. It feeds a negative narrative. The vast majority of immigrants —let us make this absolutely clear—come here to work hard and we should acknowledge that fact, so let us have clarity about the emergency brake. After all, it can only be used by the EU backseat driver, and we all know how dangerous that can be.

There are massive holes in the two key planks of the Government’s renegotiations. Is that important? For some, it will not be. I say it is important, because while the general view may be that we are standing still while inside the EU, we are in fact standing still on a conveyor belt towards ever closer union. Let us be absolutely clear about that. Indeed, the lesson of the eurozone crisis is that the EU usually finds a way of achieving what it wants, ever closer union, even at the expense of violating its commitments. As Mr Juncker once said,

“when it becomes serious, you have to lie”.

Those are the words of the President of the European Commission.

The EU is developing all the trappings of a nation state: a currency, a body of law and a diplomatic service. It makes no secret of its ambitions or its determination to succeed, even if this results in a democratic deficit with its own peoples. We only have to hear what has been said by some of the key people in the EU. Mr Juncker has made his position very clear:

“if it’s a ‘yes’, we say ‘on we go’; and if it’s a ‘no’, we say ‘we will continue.’”

Angela Merkel has made her wishes clear:

“we want more Europe, and stronger powers to intervene”.

Martin Schultz, President of the European Parliament, has been particularly blunt:

“the UK belongs to the EU”.

Mr Barroso, the former President of the Commission, has cast light on the EU’s integration process:

“they must go on voting, until they get it right”.

If things do not change, the UK is captive on a journey to who knows where. Looking into voting at the EU’s Council of Ministers, academics based at the London School of Economics—there has been very little research on this—have shown that, in recent years, Britain has voted against the majority far more often and been on the losing side more than any other member state. It is not as though it is even getting better within the internal structures of the EU. The British people never signed up to this and it is therefore right that they are finally having their say in a referendum. Do the British Government truly believe that they can muster sufficient votes to stop this inexorable vote towards ever closer union? That is one of the key questions Ministers should try to answer today.

The hon. Gentleman mentions various eminent and well-known persons in the EU. Is not one thing that binds them all together in relation to this debate the fact that they are not elected? We in this Parliament had no say in who they are and we cannot get rid of them. The hon. Member for Gainsborough (Sir Edward Leigh) mentioned Enoch Powell. Tony Benn said that if we cannot get rid of the people in an institution, it is not democratic.

The hon. Gentleman is absolutely right. If we withdrew, we could eliminate the net loss of our contribution to the budget—some say £19 billion, others £14 billion, but either way it is in the billions—and still subsidise regional and other policies, and tailor them to our national and regional needs.

I turn now to the sham of so-called “social Europe”. It is used as a lever to persuade social democratic and socialist parties to say yes to the European Union, but when it comes to the crunch—this would not necessarily impress Conservative Members and certainly not Labour Members, I hope—the EU always finds in favour of employers. Free movement is not about being benign; it is about bidding down wages, ensuring that wages are kept down and profits kept high. It is part of the neo-liberal package of measures that is being driven by the European Union.

In the case of Greece and other southern European countries that have had bail-outs, one of the conditions for bail-out is to put a brake on collective bargaining: “You’ve got to calm down your employees, especially in the public sector. We’re not going to give you the bail-out unless you cut back on collective bargaining.” That is hardly “social Europe”. What about the rights supposedly involved in the charter of fundamental rights? Then, of course, another condition of bail-out is forced privatisations, and we have seen fire sales of public assets in these countries. All these things have damaged social welfare in those countries.

The biggest problem of all has been mass unemployment, falling national output and falling living standards. Greece provides the most extreme example, but other countries have suffered, too. Greece has seen its living standards cut by 25%, and its unemployment is at 25%—50% among young people. Across southern Europe as a whole, youth unemployment stands at 40%. It is nonsense—it does not work economically. The idea that is all about “social Europe” and that it is beneficial to workers is, I think, complete nonsense and simply not true.

I shall be very brief, because I know that many Conservative Members wish to speak. I am disappointed that so few of my own colleagues are here, wishing to defend the European Union and to speak against the sovereignty of this Parliament, but they are not here, so I shall say a few words.

Actually, what I really want to do—because we are talking about Parliament, and about great parliamentarians —is quote some of the things that were said in the House by one of the greatest parliamentarians, sadly now dead, the right hon. Tony Benn. They follow on from what was said by the hon. Member for Stone (Sir William Cash)—and I agreed with every word of it. This is not about technicalities and “wordsmiths”, as the hon. Gentleman put it, and it is not about bureaucrats. It is about, fundamentally, our belief in our country, and our belief in our country’s ability to run itself.

Let me first quote from a letter that Tony Benn wrote to his Bristol constituents on 29 December 1974. I am not sure whether you had been born yet, Mr Speaker, but I think you probably had been. Tony Benn wrote:

“Britain’s continuing membership of the Community would mean the end of Britain as a completely self-governing nation and the end of our democratically elected Parliament as the supreme law making body in the United Kingdom.”

So he was showing some foresight back in 1974. The following year, he made a speech during a meeting at which the Cabinet was discussing the Labour view on how Members should vote in the 1975 “leaving” referendum. As we know, the party was very split at the time. He said:

“We have confused the real issue of parliamentary democracy, for already there has been a fundamental change. The power of electors over their law-makers has gone, the power of MPs over Ministers has gone, the role of Ministers has changed. The real case for entry has never been spelled out, which is that there should be a fully federal Europe in which we become a province. It hasn’t been spelled out because people would never accept it. We are at the moment on a federal escalator, moving as we talk, going towards a federal objective we do not wish to reach. In practice, Britain will be governed by a European coalition government that we cannot change, dedicated to a capitalist or market economy theology. This policy is to be sold to us by projecting an unjustified optimism about the Community, and an unjustified pessimism about the United Kingdom, designed to frighten us in. Jim”

—I think that he meant Jim Callaghan—

“quoted Benjamin Franklin, so let me do the same: ‘He who would give up essential liberty for a little temporary security deserves neither safety nor liberty.’ The Common Market will break up the UK because there will be no valid argument against an independent Scotland, with its own Ministers and Commissioner, enjoying Common Market membership. We shall be choosing between the unity of the UK and the unity of the EEC. It will impose appalling strains on the Labour movement...I believe that we want independence and democratic self-government, and I hope the Cabinet in due course will think again.”

On 13 March 1989, he told the House of Commons:

“It would be inconceivable for the House to adjourn for Easter without recording the fact that last Friday the High Court disallowed an Act which was passed by this House and the House of Lords and received Royal Assent—the Merchant Shipping Act 1988. The High Court referred the case to the European Court…I want to make it clear to the House that we are absolutely impotent unless we repeal section 2 of the European Communities Act. It is no good talking about being a good European. We are all good Europeans; that is a matter of geography and not a matter of sentiment.

Are the arrangements under which we are governed such that we have broken the link between the electorate and the laws under which they are governed?

I am an old parliamentary hand—perhaps I have been here too long—“

He was here for a lot longer after that!—

“but I was brought up to believe, and I still believe, that when people vote in an election they must be entitled to know that the party for which they vote, if it has a majority, will be able to enact laws under which they will be governed. That is no longer true. Any party elected, whether it is the Conservative party or the Labour party, can no longer say to the electorate, ‘Vote for me and if I have a majority I shall pass that law’, because if that law is contrary to Common Market law, British judges will apply Community law.”—[Official Report, 13 March 1989; Vol. 149, c. 56-8.]

That was very, very apt all those years ago, and it is even more apt today, which is why I absolutely believe that this House must be sovereign. The Prime Minister’s negotiations have failed to take account of any of that. When we are given the referendum, the people will finally have a chance to say no to this undemocratic, anti-democratic system—a system that is opposed to the democracy that we want in this country.

This has been a very long debate, and I have sat through the whole of it. I counted 14 speeches in total, not including the winding-up speeches, and it started with that of the hon. Member for Basildon and Billericay (Mr Baron). The speeches were all passionate and eloquent, and we have heard some very strongly held views. The last Back Bencher to speak was the hon. Member for North East Somerset (Mr Rees-Mogg), who is always eloquent and entertaining—so much so that, on occasions, I find myself nodding along, even though I do not agree with a single word he says.

It is depressing that we have heard a rehash of many of the same, often ill-informed, myths and stories about how Britain no longer has control over its own sovereignty, having yielded everything to Europe. What I found most disappointing is that, for people outside Parliament watching the debate in the Chamber, the speakers have largely been older, grey-haired men in grey suits—

I said “largely”.

I do not believe that that represents the country we are here to serve or the views of the people outside Parliament. It has been yet another debate—I am sure there will be many more up to the referendum—in which members of the Eurosceptic right wing of the Tory party have been able to grandstand, while positioning an ice pick firmly in the back of their own Front Benchers and lining up to rubbish their own Prime Minister’s negotiations. Two of my Labour colleagues have joined in enthusiastically, but given that over 96% of the members of the parliamentary Labour party, including every member of the shadow Cabinet, are members of the PLP pro-EU group, it is absolutely clear that Labour is a pro-Europe party and that it is campaigning actively for a remain vote in the referendum.

I am conscious that the debate has been very long and that we have heard an awful lot from one side of the argument, but I want to be respectful of the House and to give the Minister time to sum up, so I intend to be brief.

Right at the beginning, the hon. Member for Basildon and Billericay said that the electorate got very exercised about our sovereignty. Not in my experience: people in my constituency are concerned about jobs, youth unemployment, housing, the bedroom tax, tax avoidance by large companies and, yes, immigration, but the people I speak to never talk about the sovereignty of the EU, EU bureaucracy or Britain’s rebate. That just does not happen on the doorstep.

I welcome the hon. Member for North West Durham to her new responsibilities. We miss her predecessor, but during her time in the House she has shown herself to be interested in and committed to European issues. I am sure that we will debate European matters across the Committee and across the Chamber on many enjoyable occasions. I will try to answer her questions briefly.

As I said in my opening comments, the plan is deliberately intended as a high-level statement of objectives and principles that should inform the whole range of external policy activity that the EU and its institutions undertake. Other documents, most obviously the annual reports on the EU’s human rights work, are worth looking at. The External Action Service will report on missions to particular countries and it will sometimes report to the European Parliament on the EU’s interaction with a specific third country. In those reports, hon. Members will see human rights issues being raised in accordance with the principles set out in the action plan. There are quite a lot of different documents, such as the EU’s human rights guidelines and a recently adopted EU framework policy on transitional justice, which add up to a more complete picture.

On the question of who will monitor this work, the EU institutions and the representatives of member states in Brussels—the permanent representations—have an important role in trying to ensure best value for money at all times. The European Court of Auditors plays a crucial role in monitoring that, as it does every other aspect of EU expenditure.

When I visited the Court of Auditors late last year, I was told that I was the first British Minister they could remember ever visiting the place, which I thought was rather a pity. What impressed me was that the Court of Auditors had a very clear objective to shift its focus from measuring inputs into particular programmes to looking at outcomes and focusing much more on whether the declared objectives of a particular EU programme have been achieved, rather than on how much money might be going into something and whether it had been spent on this particular line rather than that particular line.

I mentioned in my opening comments the European instrument for democracy and human rights as one of the external funding instruments. Precisely because human rights work is meant to be mainstreamed in everything the EU does in terms of its foreign policy, it is not possible to abstract a dedicated budget for human rights work alone. For example, what the EU does in relation to Saudi Arabia or Iran will include a human rights element, but it will include other things as well. The pre-accession funding programmes that are available to Turkey and to western Balkans countries that are moving towards membership, and some of the partnership funds to some of the eastern European countries from the former Soviet Union, will also have a human rights element as we try to encourage those countries to build functioning democracies and entrench the rule of law and human rights in their political culture.

I turn briefly to the three specific items that the hon. Lady raised. In fairness, even with the recent restrictions on legal aid, the United Kingdom’s legal aid system remains one of the most generous anywhere in Europe or the democratic world. What the EU is trying to focus on here is the fact that there are too many countries in which it is impossible for defendants to have access to an independent lawyer at all, and where everything that we take for granted in terms of such statutes as the Police and Criminal Evidence Act 1984 or the rules of procedure in court are simply not available in the way that we would understand them. As part of the consular casework that I have dealt with, I have had British citizens, through their families, complaining that they have sometimes not had any opportunity to understand the charges being brought against them in court. That is the sort of issue that this policy is designed to address.

When it comes to anti-discrimination work, the reality is that such work has to proceed through persuasion, good practice and peer group pressure within international organisations. If, for example, we look at the way in which the United Kingdom Government first drove forward preventing sexual violence from being used as a weapon of war, placed that on the international agenda and then used our membership of the EU and of the UN to get other countries to take this issue up and make it a priority, that demonstrates one particular way in which this approach can work. We certainly see the EU’s action plan as complementing our own bilateral efforts to increase women’s political participation around the world, from the middle east to north Africa to work with indigenous groups in Latin America.

On the question of counter-terrorism, again we see the EU action plan work complementing what we seek to do under Prevent and other United Kingdom programmes. There are many countries around the world that face a genuine threat from terrorism but that also do not observe the standards in terms of human rights and due process that we would expect from our own police and judicial systems, so part of what we do bilaterally and part of what we do through EU activity is to have a dialogue with those countries and discuss how it is possible to combine effective action against terrorism with respect for the rule of law and for human rights. That is an issue that Members from all parties in the House have raised in the context of Colombia in debates in this House. It is an issue that we raise in our dialogue with Russian authorities, who face a genuine terrorist threat in the north Caucasus but who tackle it in a somewhat different way from how we might tackle terrorism here.

I apologise for being late to the Committee, Mr Rosindell. The Minister is well up on how the EU works; I know that he is an expert on all this, so it is good to hear him today. If I have missed this point, please tell me. I am interested, as was our European Scrutiny Committee, in whether he really feels that this scheme is absolutely the right way to spend the money that will be spent on it. Is he confident that that money will be well spent? That is one important issue. Secondly, within all the bodies in the various parts of the European Union that have drawn up the action plan, who actually makes the final decision that a certain amount of money will be spent on a certain part of the overall strategy?

To take the second question first, that will depend in part on which spending programme we are talking about, because the decision-making procedures may vary a bit accordingly. The senior-level people in the EEAS and the Commission would have responsibility in the first place for drawing up proposals and allocating funding from the budget agreed by member states under the various headings of the European Union annual budget and multi-annual financial framework. Those positions by the institutions are subject to oversight by the European Union Political and Security Committee ambassadors in Brussels, and ultimately by Ministers in the Foreign Affairs Council and the European Council.

Decisions on foreign policy are taken by unanimity, as the hon. Lady knows, so every member state has a veto, but what would happen is that a paper might be brought forward by the High Representative on foreign policy that would describe the European Union’s external actions in relation to a third country, let us say for the sake of example Pakistan. There would probably be a human rights element to that, and there would be an indication of the spending that would be involved to fund the programme. Then the member states could agree or disagree. There would be a process of negotiation, and then the final plan would be signed off.

Clearly, subsequent monitoring and auditing will be important. To answer the hon. Lady’s first question, I am always looking for ways to extract better value for money; that applies as much to UK domestic spending as to EU spending. It is a duty on any Minister in any Government. There are always improvements that can be made. Often, when I have had to deal with auditors’ reports on some of the common security and defence policy missions, I have said that we need to bring pressure to bear to deal with the shortcomings revealed by the auditor’s report. I think that the European Court of Auditors, at its best, acts in the same way as the National Audit Office and the Public Accounts Committee here. That is the principle—we should always be looking for ways to improve matters—but by and large, I think that this area of EU activity amplifies the human rights work that the UK would be trying to do bilaterally.

Clearly, the report said there was no fundamental reason why the Chagossian people should not return to the Chagos islands. Does the hon. Gentleman agree that given the injustice, money should not be the reason for not giving these people the right to return? Money should not be an issue in this case.

It is delightful to have you chairing this particular debate, Mr Rosindell, as I know you have been involved with this issue in the past.

I pay tribute to all the members of the all-party group, who, over a period of time, have really tried to keep this issue in the spotlight. In particular, I pay tribute to the new leader of my party, my hon. Friend the Member for Islington North (Jeremy Corbyn), who chaired the all-party group for many years through thick and thin. He has done a huge amount, and I know that he would like to have been here today, but I do not think he can be.

To me, it is unbelievable to think that what we did to those people 50 years ago could happen today. We would not have let it happen, and the fact that it did and that they are still waiting for their human rights to be restored so many years later is shameful for all of us. Now is the perfect time to get this return-fare package, 50 years on, particularly with the negotiations with the United States coming up next year. We just have to be absolutely firm: this will not be renegotiated unless we have a fair return for all the islanders.

I have already spoken about the cost, and I congratulate the hon. Member for Caithness, Sutherland and Easter Ross (Dr Monaghan) on securing the debate and on outlining the history of the situation so clearly. Anyone who reads the history cannot be anything other than moved by the injustice of what happened to those people. We now have an opportunity, 50 years on, to really make their return happen. Money should not be the issue. It is there, and if the Government were to work with the people themselves on how they want this to happen, once we have made the decision that it is going to happen—I hope that has now been accepted, with the report from the independent study stating that there is no reason whatever why they could not go back—we have to make it happen as quickly as possible.

However, we have to work with the Chagossian people to make sure that when they go back, they do so under terms that they are happy with, and that they will not be misled again or sign up to all sorts of agreements that afterwards cannot be carried out. I am very supportive today of that return happening, and I again pay tribute to all the Chagossian people, who have shown such dignity over many years about this dreadful thing that happened to them 50 years ago.

It is a pleasure to follow my constituent and fellow diner at the wonderful Kennington Tandoori in Vauxhall, the right hon. and learned Member for Rushcliffe (Mr Clarke), although he knows I do not agree with very much of what he said.

Today I am here to speak on this particular Bill. I agree with the right hon. Member for North Shropshire (Mr Paterson) when he said that this is a good day. This is a great day for democracy. Having sat through and spoken in two referendum debates, I am feeling great today, because I am actually going to be with the majority of my party. A small number of very good members of my party, including my hon. Friends the Members for Luton North (Kelvin Hopkins) and for Dudley North (Ian Austin), argued strongly that support for the right of the British people to decide our future relationship with the EU should have been in our manifesto. If my party had done that, perhaps the election result might have been slightly different. I am very pleased that those on my Front Bench are supporting the Bill on Second Reading. This is a very important day for the British public.

I want to talk about a few aspects of the Bill. The most important thing about this referendum Bill, when it finally leaves this Parliament, is that it gives every single British person, in all of the United Kingdom, the clear feeling, understanding and belief that the referendum will be free and fair—that it is really going to be an opportunity for their views to be heard, and that the vote will mean that they have really been listened to. My concern is that some elements of the Bill could mean that in the end, with the result, they will feel they have not had a free and fair vote.

The first such element has already been alluded to, and I strongly support those on both sides of the House who believe that the purdah aspect is just wrong. I do not believe it proves to the British people that the Government want a free and fair vote. We have to change the purdah situation in the Bill. Any common-sense view would be that it cannot be right to change the purdah restrictions.

So, the question of purdah is really important.

The second issue is one where I am not in line with some members of my party. Although there is a real debate to be had about votes for 16 to 18 year olds, I do not think that introducing them at a referendum is the right time. If we are going to change our constitution on the right to vote and bring the voting age down, we must ensure it is seriously thought through and cannot just be brought in glibly for a referendum. It should be discussed in this Parliament and a decision should be taken for the next general election, but the referendum is too early for it, so I am not in favour of changing the voting system. I support the Bill on that point and absolutely on the non-rights of EU citizens, other than those who are mentioned, to be able to vote. It would not make any sense at all, and would alienate millions of British citizens.

So, I am very clear on that question, too, and glad that my party also supports it.

On the wording of the question, the Scottish Nationalist Member who spoke earlier, the right hon. Member for Gordon (Alex Salmond), talked about the Electoral Commission. We seem to want the Electoral Commission when we support what it says, then, when we do not support what it says, we do not. On the question, the Commission was very clear. It said that a fairer wording would be:

“Should the United Kingdom remain a member of the European Union or leave the European Union?”

That is very simple, very clear—and not seen as in any way biased. If that were the wording, people would have a vote either to leave or to remain. That has to be looked at, and I know the Commission is continuing to do so. I hope it is one of the provisions that is changed in the Bill.

I tried to intervene on the Foreign Secretary, because I am concerned about funding and about the money for the two campaigns that ultimately will be formed. How do we ensure that the biggest funder of all—the European Union and the European Commission itself—is absolutely clear about what it can and cannot fund? We already know that many of our institutions in this country, including the BBC, get huge amounts of European Union money. It will be absolutely disgraceful if the European Commission is allowed to continue to pour in money which is used for propaganda—that is certainly how it will be seen during the referendum campaign—in our schools and our educational institutions generally. That is a really important issue, and I hope that both Front Benchers cover it when they make their winding-up speeches, because it has not been covered anywhere.

I am very grateful. The hon. Lady raises the spectre of the European Commission intervening. Is she worried that the European Parliament might produce reports prior to the referendum which are extremely biased, as the Westminster Parliament did prior to the Scottish referendum? Might José Manuel Barroso turn up on the “Andrew Marr Show” making ex cathedra statements on behalf of one side of the referendum? Do those types of things worry the hon. Lady?

If I can decipher that, I know the European Parliament does not actually have that much power; I am much more concerned about the unelected Commission, which has the money and spends our money after we have given it to the EU, in the way that it decides is best. I am very concerned about that and I hope it will be looked at.

I do not want to go into the arguments now, because I want to see the referendum campaign get out to the grassroots of the whole country, and to see the kind of campaign that we saw in Scotland on an issue where there were genuinely held opinions and great campaigns. I look back at some of the images from the campaigns in the 1975 referendum. We saw political leaders—including one of my great mentors and a person whom I am very fond of, Peter Shore—and some wonderful debates, all around the country. We have to have that and ensure that everybody feels they are involved. I hope that my party will allow a completely free vote, including for shadow Ministers and other Members, so that everyone has their own say. This campaign is not about politicians or Members of Parliament; it is about the British people, who for all that time have felt ignored and not listened to, and who have seen the European Union change radically since the day in 1975 when many voted to stay in the European Community.

I want to say one other thing: can we please distinguish —the BBC and the media have to distinguish—between people who say they are anti-EU and being anti-Europe? The two things are completely different. It is so annoying to hear supposedly educated journalists, who are supposed experts on this issue, talking all the time about Europe and saying, “So, you’re anti-Europe?” No, I am not anti-Europe. I am anti the unelected, absolute dictatorship that we have from the European Union. That is not being anti-Europe, and we have to distinguish between the two. That is important.

I want to get in one other thing in the last 30 seconds available to me. I have said this so many times to the Prime Minister that I am sure he is fed up hearing it, but it should be conveyed to him. Could he—and my shadow Front Benchers—please stop talking about “Britain”? “Britain” excludes Northern Ireland. Northern Ireland is part of the United Kingdom, and its people will have a hugely important say in the referendum. We must talk about the United Kingdom. It is the United Kingdom of Great Britain and Northern Ireland. And on that note, I say, “Support this referendum.”

I congratulate the hon. Member for Ellesmere Port and Neston (Justin Madders) on making such a good maiden speech. He will clearly be a strong and eloquent voice for his constituency and he is very welcome in this House.

I rise to speak in favour of this Bill, and I do so as one who believes that it is significantly in Britain’s interests to remain a member of the European Union, and that it will be even more in our interests as a result of the reforms the Prime Minister has now started negotiating.

I have huge respect and admiration for the hon. Member for Vauxhall (Kate Hoey), but she said she objects to being called anti-European, which is fair enough, yet she then went on to describe the European Union as a dictatorship. It is a collection of democracies who come together in their mutual interest. Each of those countries is a democracy and to describe the institution as a dictatorship is an inflation of language of the type she disapproves of when she is accused of being anti-European. I do not think that is how the debate should be conducted.

I certainly think the European Commission dictates what it wants to do and, with majority voting and all that goes on within the institution, we in this Parliament have very little or no say in how the money is spent and what it does.

Our Government are represented in the Council of Ministers and the Parliament; that is the democratic check. It can of course be improved—nobody is saying that the EU is perfect—but there are many institutions that need improving. Indeed, Parliament needs improving, but that does not mean we should give up on the many and manifold advantages of parliamentary democracy. That is the attitude with which we should approach the EU.

I am also in favour of the Bill because I am happy to take on in friendly public debate those who want to cut our close ties with friendly neighbouring democracies, and because I believe it is appropriate to have this debate now. The subject of Europe is a curious one in British politics. For a small number of people—some of whom have spoken today—it is an all-consuming passion. For the vast majority of the British people, however, it rarely features in the top 10 things they want Governments to get to grips with.

I will be happy to play a part in persuading the British people that the risks of turning our back on our democratic neighbours massively outweigh the benefits, but I will do this in the spirit of removing a cloud that has hung over politics for too long. Having the in/out debate always hovering around adds an unnecessary level of uncertainty to our national debate on many subjects, and it leaves the rest of the world, particularly our friends, unsure about Britain’s view of its own place in the world.

It has been clear for some time that we are going to need a referendum to clear up this uncertainty. It has been 40 years since the last one. The world has changed, the UK has changed, the European Union has changed. So let’s get on with it. Let us focus the British people’s minds on the choice before us, and see what they say.

My right hon. Friend is perfectly correct. People in this country wanted to join a common market and wanted an economic and trading entity. Many who voted in that referendum believe that by stealth they were sold a pup by being sold into a very different entity on which they were never allowed to give their opinion. That is why we should celebrate what is happening in the Chamber today. We are allowing those people to have a voice, which they have been denied by Governments of both political complexions for many years.

Our legal system and the American legal system are based on a very important principle, the principle of the presumption of innocence. That has not been extended to Shaker Aamer. What is more, in his case, although we are not in a position to make the judgment ourselves, a great deal of evidence, from how he was picked up on the basis of a ransom through to the statements of the US authorities that there is no case against him, shows a probability of innocence, yet this man has faced 13 years in the most unbelievable circumstances.

I make the point about innocence because it is one thing for a terrorist or soldier to be subjected to this sort of behaviour, involving the sort of treatment that the British Government gave up in the early 1970s after using it in Northern Ireland because it was deemed to be torture. In fact, what is going on is much worse than what we gave up and deemed to be torture. However, that is the basis on which Shaker Aamer is being held. The same sort of torture led the American Government to conclude that there were weapons of mass destruction in Iraq, as they tortured someone else 83 times until they eventually said, “Yes, yes, I give in.” That means that, even if there were confessional evidence against Shaker, it would be completely untrustworthy; indeed, it would be thrown out, as Clive Stafford Smith of Reprieve has said. From the point of view of basic humanity, for somebody who is innocent to be put through that is probably 10 times as bad as it is for somebody who is guilty, and it would be bad for them, too.

Our understanding is that Shaker has been a representative in the disputes in Guantanamo, which may make him more of a target. In addition to his own torture, he is said to have witnessed the torture of others, which may be why his release is being withheld. He is the last British resident being held there.

I join the hon. Member for Hayes and Harlington (John McDonnell) in asking the Minister to give an account of the Americans’ explanation of why they have not released Shaker. If they have not done so because he would embarrass them, that represents a doubling up of the guilt on their part. Frankly, this will come out into the open at some point.

The colonel who headed the unit of American military lawyers who both prosecute and defend people in Guantanamo told them at the beginning of their military commission that they should be wary of any techniques and tactics that they allowed to be used, because, in his words, in America there is no such thing as a secret, just deferred disclosure. That is eminently true in the case under discussion. The more rapid that disclosure, the better for every country.

I can understand to some extent why, in the immediate aftermath of 9/11, we dropped the moral standards by which we ought to abide—that was wrong, but understandable. I do not understand, however, the continued attempt to cover things up a dozen and more years later. For that reason, too, Shaker ought to be released.

I do not want to take up too much time, so I will finish by simply saying that the west has had a moral slough of despond after 9/11. We have abandoned our own standards and fallen short of the ethical standards that we should uphold. It is now doubly incumbent on us to act to ensure that those who have suffered as a result are released to their families as rapidly as possible, before their health is completely destroyed, which is what Shaker Aamer faces. It is also important to our own nations and citizens that we confess.

What does the right hon. Gentleman think this tells us about the so-called special relationship between the United Kingdom and the United States? When our Prime Minister meets President Obama, it is unbelievable that we cannot get a straight answer about a citizen of our country being held by the US.

It may say two things. The first—it saddens me to say this—is that President Obama may not be in complete control of his own country. After all, he promised to close down Guantanamo early on but then did not do so, at great political cost to himself and, indeed, to his moral standing. Secondly, when it comes down to it, America puts its own interests far ahead of those of any other country. That is the doctrine of American exceptionalism, which in one sense is understandable because it is based on freedom, but in another sense it leads to the almost colonial treatment of its allies. If that is the case, it is deplorable. As America’s longest-standing and strongest ally, we should expect special treatment, but we have clearly not been given it in this case.

It is a pleasure to follow the hon. Member for East Worthing and Shoreham (Tim Loughton), as I am also a member of the all-party parliamentary group for Tibet. I congratulate my hon. Friend the Member for Leeds North East (Fabian Hamilton) on getting this timely debate. I will not go into the individual cases that he carefully and properly raised. An important aspect of today’s debate is that we get the names of those brave Tibetans who are being held in custody or have been imprisoned for long sentences out to the rest of the world, and that has been done well this morning.

Looking through Tibet Watch’s excellent booklet, “Broken promises”, I was reminded of how we were all were duped—or how many people were; I feel personally that I was not—into feeling that if China got the Olympics, it would make such a difference and China would do all these wonderful things, changing its whole attitude to human rights. We went along with that, but what has happened? Not a single thing has changed in relation to Tibet. Indeed, as has been mentioned, things are getting worse by the day.

I, too, had the privilege of hearing from the gentleman at yesterday’s meeting who had recently been to Tibet. It is clear that the Chinese Government are making a huge attempt to rapidly change the face of Tibet—not just to change civil liberties and human rights, but to change the physical structure of Tibet. Some 13 million Chinese tourists visited Tibet last year, and we are seeing a concentration of Chinese people who are given money to go and settle in Tibet. The Chinese Government want to eliminate every last sign or vestige of Tibetan culture and the history of that wonderful country. We must be clear that none of our warm words about working closely with China seems to be having any effect whatever. I will be interested to hear what the Minister says about that.

I want to go into a little more detail about something that the hon. Member for East Worthing and Shoreham mentioned. I am also concerned about the Confucius institutes, of which I think there are now 24 in the United Kingdom. These are Chinese Government-funded cultural centres that are set up at universities all over the world, although the UK has the second highest number after the United States. Several universities in the United States and Canada—including the university of Chicago, Pennsylvania State university and the Toronto district school board—recently pulled out of relationships with Confucius institutes because of accusations and proof of discriminatory hiring practices and censorship of certain topics. In order for a university to receive Chinese money, the Chinese do not want any mention of Tibet or any criticism of anything that is happening.

I was privileged to hear recently from an American professor at a meeting in Parliament about how China’s influence on an American university is threatening freedom of speech. If we cannot have freedom of speech in our universities, we really are on a slippery slope. It is worrying and sad that one of our most famous universities, the London School of Economics, has been reluctant to give out information on how much money it has been getting from China. It is only through journalists’ use of freedom of information requests that we have discovered the exact amounts given out. It has been revealed that the LSE

“has received £863,537.91 from the Chinese state for housing a Confucian Centre and a further $33,000 for teaching Chinese government officials via BHP Billiton, a mining conglomerate.”

If China has 25 of these cultural outposts right at the hearts of our main universities, that funding will extend to several million pounds. Of course that may sound wonderful—isn’t that great: universities that are suffering from a shortage of resources are getting money directly from China? The danger, however, is that no matter how much the university hierarchies say that that will not influence or affect what they do, the reality on the ground is that it does. In fact, they are taking what could be said to be Chinese gold in return for getting out Chinese propaganda—sometimes subtly, sometimes less subtly. I really believe that our Government should be investigating this and making sure—[Interruption.]

There is a serious issue. We are seeing Chinese developments coming into this country, into London, and the big money coming in to build tower blocks and hotels. On the subject of hotels, let me say how shocking it was that InterContinental Hotels went ahead and built one in Lhasa that employs Chinese people and is part of efforts there to destroy Tibetan culture. Tibet groups across the world are trying hard to organise some kind of boycott of InterContinental Hotels, because of what the company is doing in that part of Tibet. We must get to the bottom of the money that is coming in

There have also been incidents, such as the ones we heard about only yesterday, which happened recently in Sheffield, where there are substantial numbers of Chinese students. Many of those students are very political indeed, and we heard about the example of a shop owner who had put a Tibetan flag in the window. I do not think it was a huge flag; nevertheless, they were threatened that if they did not take it down, things would happen. In fact, the windows were broken, which was reported to the police, but the attitude was, “Well, this was just students being a bit silly.”

The reality is that this is not students being a little silly. What is happening here is coming from the very top in China. I am very worried indeed that unless we face up to it early, China will do in this country and other parts of Europe what it has done in Africa, which is to go in and simply use its money as a way of getting its message across and its way of doing things. That relates directly to Tibet, in the sense that Tibet is the issue in this country that gets the most publicity in our universities, and yet many of our students are being stopped from getting their message across because of the worry about China.

I would add that South Africa recently refused to give His Holiness the Dalai Lama a visa, which meant that the conference of all Nobel prize winners had to be cancelled—it is now happening in Rome, in Italy, this week. Meanwhile, the Chinese Government, having put pressure on South Africa, immediately thanked the South African Government and more or less said, “We will now do something for you, as you were so kind as to stop the Dalai Lama visiting.”

We are getting to the point where I want to ask our Government, “What dreadful thing would the Chinese Government have to do in order for our Government to start standing up to China?” What would have to happen for us to start calling in the Chinese ambassador and doing things that make a difference, such as saying, “I’m sorry, we might need the money—the investment is great—but you, China, are fundamentally a pariah state and we’re going to treat you as such”? Unless we start standing up to China, as the European Union or as a country, it will not buckle to anything other than force, in terms of what we are saying—I am not suggesting we invade China, but I am suggesting that we start to mean what we say.

Warm words have come out of all Governments, including this one and the previous one. We were the last country not to recognise that Tibet was part of China, but David Miliband, the Foreign Secretary in the previous Government, changed that, telling the House that it would make a great difference and that China would start behaving better. Of course that did not happen.

China has a terrible human rights record not only in Tibet, but all over China. I want the Minister to outline clearly what more the Chinese have to do to people in Tibet and through their influence in this country before we as a British Government say, “Enough is enough.”

I congratulate the hon. Member for Leeds North East (Fabian Hamilton) on securing the debate, particularly given that it is international human rights day. I pay tribute to his expertise on these issues, which he spoke about so eloquently. Of course, he has two advantages over me: one is that he has met His Holiness the Dalai Lama on a number of occasions; the other is that he has actually visited Tibet—something that I have yet to do.

The subject commands such interest right across the House that it deserves rather more than an hour-and-a-half Westminster Hall debate, and it would be good if we could return to the subject. I will try in the time that remains to answer all the points raised, but if I miss any out, I will undertake to write to hon. Members.

So as to avoid any misunderstanding, I will restate the Government’s policy on Tibet. As my right hon. Friend the Prime Minister outlined in Parliament on 8 May 2013, our position on Tibet is clear and unchanged from that of the previous Government: we regard Tibet as part of the People’s Republic of China. We do not support Tibetan independence.

We have a strong relationship with China, and we understand that, for China, Tibet remains a sensitive issue. The Chinese Government are well aware of the United Kingdom’s position; in fact, the Prime Minister reaffirmed it with Premier Li during the UK-China summit in London in June. Those high-level discussions form part of a broader engagement with the Chinese Government, in which we seek to ensure that all citizens, including Tibetans, fully enjoy their rights under the Chinese constitution.

We welcome the significant economic investments the Chinese Government have made in Tibetan areas, leading to improvements in the standard of living, health care and life expectancy, as shown in the fact that the area’s gross regional product is estimated to have seen average annual growth of 8.5% over the last 50 years.

We welcome President Xi’s public commitment to ensure that, by 2020, China is ruled according to the law, respecting and protecting human rights. We would expect that to apply to Tibetans as much as to people in Shanghai, Wuhan or Beijing. However, as the Chinese Government have acknowledged, proper implementation will be key, so we, along with our EU partners and the United Nations, will follow those matters closely. Importantly, we have shown clarity and consistency in our position on human rights in China. That happens through the UK-China human rights dialogue, which the hon. Member for East Londonderry (Mr Campbell), who is no longer in his place, mentioned. The UK is one of a handful of EU member states that engage with China in that way. It happens also through our Foreign and Commonwealth Office human rights report and its quarterly updates; through our work at the United Nations Human Rights Council in Geneva; and through actively pressing for an EU-China human rights dialogue.

Hon. Members rightly raised some individual cases. During the UK-China human rights dialogue in London this year, we raised more than 20 individual cases, a quarter of which related to freedom of expression. The hon. Member for Leeds North East spoke about Dhondup Wangchen, and we have raised his case. He was of course arrested in 2008 for filming a documentary recording the reactions of ordinary Tibetans to the Olympic games.

Ethnic minority rights remain a concern; my hon. Friend the Member for East Worthing and Shoreham (Tim Loughton) has consistently raised that issue in relation to Tibet, even when he was a Minister. As he pointed out, cultural rights are incredibly important in all societies and should be actively protected in all countries. We have discussed ethnic minority issues with China on numerous occasions, including during the UK-China human rights dialogue in May and during China’s universal periodic review in October 2013. We would like further progress on promoting freedom of religion and belief in China, particularly in minority areas. We regard freedom of thought, conscience and belief as a universal human right and, as such, it is a priority for the FCO across the world.

The hon. Member for Leeds North East raised a number of questions. We continue to encourage dialogue and we raise human rights concerns. We work through the EU, and the EU-China human rights dialogue happened only last week. We encourage proportionate security responses in China, as, indeed, we do everywhere else. As to scholarships, we have a big Chevening programme in China, which I have been actively promoting. Tibetans have taken places on the Chevening scholarship programme in the past and are welcome to apply again. We commend the work of non-Government groups in the area of cultural exchanges. I think the British Council could probably do more, and I will ask it to consider what more it could do. The point about the BBC is an issue; it comes just as we have got rid of responsibility for the World Service. It is bombarded with requests relating to where it should broadcast around the world. Matters to do with where to broadcast, and programming and radio, are best addressed to the BBC.

We share the concern of the hon. Member for Leeds North East about the conviction of Tenzin Delek Rinpoche, and about his health. We have raised the matter in Beijing, and I urge consideration of parole on medical grounds. The shadow Minister, the hon. Member for Bristol East (Kerry McCarthy) raised the issue of immolations. We had a spate of questions about self-immolations about a year ago, when there was a series of them. It is not something that we should take our eyes off. We urge the Chinese authorities to ensure the protection of their citizens’ constitutional rights in line with the international frameworks to which China is a party. The development of civil society and the application of human rights under the rule of law are essential to China’s long-term prosperity and stability, and it is with deep concern that we note that at least 130 Tibetans have attempted self-immolation, often fatally, since February 2009.

The hon. Members for Vauxhall (Kate Hoey) and for Bristol East talked about the InterContinental hotel in Lhasa and our advice to British businesses about investment. We encourage all British companies to be aware of the human rights risks in the countries where they propose investing. Our overseas business risk guide for China provides information on key risks, including human rights risks, that UK businesses may face when operating in China. Last September, we were the first country to publish a national action plan on business and human rights, setting out our commitments as a Government to implementing the UN guiding principles.

I want to deal head-on with the question raised by the hon. Members for Cheltenham (Martin Horwood) and for Vauxhall about whether there is a binary choice between human rights and investment in doing trade with China. I utterly reject that. I do not think that there is such a choice, and I do not apologise for this Government’s desire to rebuild the economy as part of our long-term economic plan to attract increasing inward investment from China. That is critical to renewing our national infrastructure. Bilateral trade is as important to companies in my constituency as it is to the constituencies of the hon. Gentleman and the hon. Lady. I do not think that we have anything to apologise for on that. We are robust in maintaining a dialogue with the Chinese Government on a range of issues, and Tibet is of course one of those.

We work increasingly closely with the Chinese Government on various issues. We are both members of the UN Security Council, and we work together as part of the E3 plus 3 process on Iran. The hon. Member for Bristol East mentioned climate change; we have invested an enormous amount in our relationship with the Chinese in relation to combating climate change. It would simply not be possible, as she pointed out, to reach any kind of meaningful global deal at next year’s COP 21 in Paris without a constructive approach from Beijing. We need to work side by side with the Chinese on global challenges of the moment, such as combating Ebola and—this is timely—today’s London summit, hosted by the Prime Minister, on ending the online sexual exploitation of children. Our relationship with China is dynamic and must be carefully balanced, but I utterly reject the point that we are in some way subjugating our principles on human rights because of Chinese money. It is not the case at all.

I want to reiterate the Government’s position on His Holiness the Dalai Lama. The Dalai Lama is recognised worldwide as an important religious figure and esteemed Nobel laureate, having been awarded the peace prize in 1989. Given that he has stated publicly that he does not seek Tibetan independence, we encourage the Chinese Government and Tibetan interest groups to seek a peaceful resolution to their differences through a resumption of dialogue. Dialogue with non-governmental organisations and interest groups is something that the British Government undertake as a matter of course in every country that we engage with. As part of that, I met a number of Tibetan groups in June, and my officials consulted them ahead of our human rights dialogue in May. We will continue to use broad-based engagement as an integral part of promoting our values around the world.

May I write to the hon. Lady on that? I want to conclude.

Our long-standing position remains that we do not support Tibetan independence, but we believe that Tibet’s long-term stability is best achieved through respect for universal human rights and genuine autonomy within the framework of the Chinese constitution, so we continue to engage actively and constructively with the Chinese Government as they work to improve human rights and the rule of law across China, including in Tibet. I thank the hon. Member for Leeds North East for this opportunity to re-state the Government’s position, and other hon. Members for their remarks today. I am sure that they will keep questioning the Government, as is their duty and right. I in turn will, as I said, undertake to write to them to answer the questions I did not have time to address in this morning’s extremely good debate.

Like my hon. and learned Friend, I was first elected to Parliament after a career at the bar—the legal bar—and a career in local government, at the coalface of dealing with people’s everyday problems, and one of the things that struck me was that the risk we all have to avoid is precisely becoming part of that village mentality. It is never something we seek to do when we arrive, but, almost institutionally, that can happen. If we believe in representative democracy—as I trust everybody in this Chamber does—then one of the great challenges is to make sure there is a reality in the discussions we have here and the way we approach our decisions and a trust in the people who send us here. We do not sit here possessed of some greater wisdom—to use the French, some trahison des clercs—that enables us to ignore the views of our voters, who make the wealth that pays for us and for all Government spending. My hon. and learned Friend is entirely right in that. Legitimacy requires connection, and sometimes a bit of humility on the part of elected representatives to say, “This is an issue so fundamental that it is a matter for the British people.”

We have given referendums in a number of cases, and they are now an established fact of our constitutional scene. My constituents have had a vote on whether they should have a Mayor of London and whether there should be a different form of voting system for electing this House—I am glad to say they came to the right decision on that—and it would be pretty bizarre if they were not able to have a vote on what powers should reside in this House as opposed to residing elsewhere. I suggest this is the most obvious case for a referendum one could imagine.

The hon. Lady, whom I have known for many years as a fellow London MP, is infinitely better in touch with her voters than the leadership of her party. I have to say—and I do not mean any discourtesy here—that I am rather glad she is not part of the leadership of her party, because she would be a much greater threat to us than the current leadership is. She is absolutely right. What I find, representing a London constituency, is that people often forget that Londoners, who are part of a cosmopolitan, diverse and open city, none the less believe it is time for us to look again at our relationship with our European neighbours. The hon. Lady is absolutely right; her analysis is spot-on.

Thank you, Mr Deputy Speaker. That was unexpected. I do not usually get called first, but of course not many of my party colleagues are present today, which is unfortunate.

I congratulate the hon. Member for Bromley and Chislehurst (Robert Neill) on bringing this Bill forward. It is a pity that we have had to introduce it again, because it went through this House very clearly before and I am afraid that the public do not understand the intricacies of parliamentary procedure that allowed it not to complete its passage. I hope that this time, whatever the views in all parts of the House on the issue, we will allow the Bill to reach its final stages, because this is a question of trust and of the public, who are already alienated from politics and politicians, seeing how we behave in this House today.

I looked back over what I said in the previous referendum debate and I do not have a huge amount to add. I do not understand how anyone can make a reasoned case for not supporting the Bill, including on Second Reading today.

Interestingly, the Deputy Speaker gave the hon. Lady the honour of making the second speech today, which just shows the high esteem in which she is held in this Chamber and outside. Does she agree that the fundamental issue is that we should trust the people? It is beyond me why certain political parties just do not grasp that fact.

I, too, think it is a question of trust. We know how all the parties have let the public down on promises made in the past about referendums on Europe. I always feel confident that when I am in a minority among my Labour colleagues on this referendum Bill, although some are here supporting it, I am not in a minority among Labour voters in the country. I am very confident that my party will have a change of mind on this issue, even between now and the general election. I think that the Liberal Democrats, who usually change back and forward—[Interruption.] I have the greatest respect for the Liberal Democrat Member who is here, the hon. Member for Birmingham, Yardley (John Hemming), although I do not think he is formally representing them. If he is, I am sure he will have a different view on this. It is important that the public feel we are really listening to them.

I was about to say that I do not want my party to be the only one going into a general election not supporting a referendum, and I feel that the Liberal Democrats will definitely have this measure in their manifesto, too. I am not a friend of the right hon. Member for Sheffield, Hallam (Mr Clegg) as such, but I imagine that it will be in their manifesto. The Labour party could be the only party going into the election not supporting it, and that would be very wrong indeed.

I wish briefly to discuss some of the issues that will arise if the negotiation happens. I am a bit of a cynic about these negotiations, because I do not feel we will be able to negotiate very much, as the establishment within the European Union does not want the changes that we wish to see. If we end up still part of the agricultural policy and the fisheries policy, and if we still pay billions of pounds into the European Union and get a small amount back, I cannot see that the negotiations will have succeeded in doing anything other than tinker around in a few places, so that somebody can come back from Europe and say that this has been a success.

My hon. Friend is far too young to remember the 1975 referendum, but I recall it well. We did have a negotiation then, but can anyone in this Chamber remind me of what the difference was after the referendum, following those negotiations?

What my hon. Friend says is absolutely right. The European Union has a mechanism for making sure that any real changes do not happen. We will be in a minority, even if we get one or two other countries to support us, and such changes just will not happen.

Yes, indeed. I was going to mention that, because I feel strongly that if we go in to negotiate, we have to be clear what the ultimate end is. By that, I mean what we will do if we do not get what we want. We cannot go into negotiations without it being very clear that if we do not get what we want, we will be prepared to leave the European Union; that is the right approach to take.

As the hon. Gentleman mentioned it, I should like to discuss Scotland a little further. Some people say that it is not the right time for a referendum, that a referendum is a diversion, it is not going to be good for business, and it will create anxiety and too much hassle, but I say let us just look at what happened in Scotland. Whatever someone thought about the final decision and whether they supported it—I was delighted that Scotland voted to stay part of the United Kingdom, but this applies even to those people who were on the other side—everyone accepts that there was a huge uprising in public interest in an issue. Real debate and discussion took place, and there was a feeling that, at last, ordinary men and women were able to come out and talk at public meetings and discuss things, even out in markets and on the streets. That had a hugely galvanising effect, and I think it will have a galvanising effect in the general election in May in Scotland and there will be an even bigger turnout than usual.

Is not one of the differences that in Scotland the issue was absolutely clear-cut and people had a lot of time to work out what they were voting on, whereas here the issue is not clear-cut? Some of the Labour voters to whom my hon. Friend referred may want a simple in/out referendum, others may want a referendum depending on the outcome of the negotiations, and some may not know what the negotiations are for. Surely this is much more complicated.

I thank my hon. Friend for that, but I think the people of this country have had 40 years to think about how they see the European Union. Let us remember that this Bill is not about whether we are for or against the EU; it is about giving the people the choice. This is the point that the Labour Front-Bench team needs to answer. If this Bill goes through Parliament, the referendum would not happen until 2017; I think it should come a lot earlier. I am concerned that Labour Front-Benchers are not able to say that we will support a referendum.

I thank the hon. Lady for her remarks, and I think Conservative Members agree with everything she is saying. We are pleased that Gibraltar is going to be given the right to vote, but does she agree that those in the armed services, who are scattered around the world, should be given the right to vote in a special way? They cannot vote if they are not in the United Kingdom, so it is important that they get a direct way of voting. Does she also agree that EU citizens who are not British should not be voting?

A lot of technicalities have to be worked out, which is why it would be important to start planning as soon as possible for a referendum and why it is important that the Bill goes through. I would probably agree on both of the points the hon. Gentleman raised, but they can be further discussed.

I had better get on, because I know that a lot of people wish to speak. I might give way once or twice more, but I have not got a lot more to say.

I have just received a letter, dated 13 October, from the Minister of State, Department for Transport, the right hon. Member for South Holland and The Deepings (Mr Hayes) about the proposed ports services regulation. This measure has emerged since the last vote we had on the referendum and it is a classic example of how the European Union creeps further and further into all parts of our life; when people voted 40 years ago nobody thought they were going to be voting for this to happen. I am sure that he and our officials have done their best in negotiating to try to get the regulation changed as much as possible. Indeed, the letter says:

“The Government has therefore worked hard to ensure that the text of the draft Regulation was crafted to protect UK interests.”

That follows on from saying that we were against it. I believe there was unanimity on that; among a lot of trade unions and across all parties it was seen that this was not in our interest. The letter states that we did not see any merit in regulation but we knew that

“legislation was sure to proceed in some form with majority support.”

So here we are, sitting in the British Parliament, supposedly making our own laws, yet time after time we find that things come through that we have no say in changing. We might alter one or two words, and we might be able to come back saying, “This is a little better than it was,” but fundamentally if we want to regulate our ports, we should be deciding it, not the European Union and the Commission.

As a Member of Parliament who represents a port, I thank the hon. Lady for giving way. This is an example of how the single market is used as an all-enveloping pretext for Community action at Community level, whatever is the case, even though it is very difficult to argue that there is a single market between the ports of Harwich and Felixstowe and those of Marseilles or Piraeus, which is the basic premise of the argument behind the directive.

I am sure that all hon. Members could come up with different scenarios, but the fundamental principle is that we are losing control of our own country and of what we want to do in our own country. It is very simple and I genuinely cannot understand why people cannot see that we are losing control of what we want to do here. Of course, we want to co-operate with other European countries. I want to co-operate with all sorts of countries. I would like to see our Commonwealth countries much more involved in what we are doing, as we have treated them scandalously over the years. That is why, if there were a referendum and if we chose to leave the European Union, I would feel quite confident about this country. I want to get our confidence back. I do not want this doom-ridden approach that suggests we have to be part of the European Union because we are only a country and we need it desperately. It needs us, too, and I have confidence that if we were to leave the European Union we would be quite capable of having a prosperous future.

My hon. Friend makes a good point. The European Union needs us much more than we need it. Our trade balance shows a gigantic trade deficit with the European Union. We effectively export 1 million jobs because of the £1 billion a week deficit we have with the rest of the European Union. That is the reality.

Yes, that is the reality and that is what we need to get across. The media must be much more unbiased in their reaction to the European Union. Some of us have spent some time meeting up with the BBC to try to get it to have a much better attitude towards the European Union, because it seems to take the attitude that anyone who speaks out in any way that is critical of the European Union is somehow swivel-eyed—I think that is the word that is usually used. If we have this referendum, the BBC must be clear that it is completely unbiased and will give fair representation to both sides.

I find it very strange that Labour has a policy that if anything extra goes to Europe we would have a referendum. That seems to me to be a bit like shutting the stable door after the horse has bolted. Of course, I supported the policy when it went through and it is good that we got it. At least something changed about our relationship with the European Union, but there are still things happening at this minute. It comes in little bits—drip, drip, drip—and there is no one big thing that can lead us to say, “Ah, we need a referendum on that.” It is a slippery slope, and the process is getting faster every week.

That is the million dollar question. We all admire the hon. Lady for her courage and her clear exposition of why we need a referendum, but the question that I think many people will be asking is why, in her opinion, her leadership is not doing the obvious, logical, clear and democratic thing and offering a referendum to the British people by a set date. Is it because they fear the result? What is the reason?

I generally do not know the answer. Perhaps we will hear it from those on the Front Bench today, but the reality is that if we had that referendum I would not fear the result. I have confidence in the British people and would accept the result, whichever way it went. What is not acceptable to me is that we have had so many changes to what people originally voted for in which none of us have had a say—we can go through the list. The people of this country did not vote to have unlimited access for those from every European Union country to come to our country. They did not vote for many of the things that are happening, and that is why it is such a basic point that we need a referendum.

On the subject of the European Court of Justice, I was once a Home Office Minister and I went to Europe many times for work in that area. We had a say then and were able to stop things. Now we cannot, because of how it works and the majority position that has to be taken. I would be very concerned, given that we had the chance to opt out of the 35 EU police and criminal justice measures, if the current Government opted back in. That would be a retrograde step. I do not accept the argument about the arrest warrant. In one or two cases, it has been very helpful, but I see no reason why, living as we do with our neighbours, we could not have agreements with individual countries to get people back when we need to. Some of the terrible cases that have happened show the power of the European arrest warrant and once the process has started, no one can really stop it. We saw that recently in the terrible case involving the young baby. It would be shocking, given that this is a Government who are meant to be Eurosceptic or Euro-realist, if they were to opt back in in a few weeks. Our criminal justice system would then for ever be part of this European way of doing things, which is not the British way of doing things.

I want to end by appealing to my own party, though there are not many of them in the Chamber to appeal to—[Interruption.] It is about quality, of course, as my hon. Friend the Member for Harrow West (Mr Thomas) says from the Front Bench. I have great respect for him. I assume that the position today will be that my party will abstain. Abstaining is not to me a good way of dealing with controversial issues and I am disappointed that the official line will be to abstain. Of course, a few of us will vote for the Bill, as we have before, but I want to put out a warning that although when we talk to people this issue might not immediately rear its head, when we talk to them about the European Union the one thing they will say is that they have not been listened to and that they have never been listened to. They want to be listened to and that is why this referendum Bill is crucial if we are serious about bringing about a bit more trust between the public and politicians. I hope that it will get the support of the House.

On a point of order, Mr Deputy Speaker. I want to raise that rare thing, a genuine point of order. In his opening remarks, my hon. Friend the Member for Bromley and Chislehurst (Robert Neill) suggested that there might be attempts to frustrate the progress of the Bill through the House. One of those ways would be to prolong the debate on the Bill that is currently at the front of the queue in Committee. Will you confirm to me, as a member of the Speaker’s Panel of Chairs—I suspect that a nod from the Clerks will help—that it is in fact perfectly possible, should we choose to do so, for this House to set up a second Committee to consider the Bill?

I thank the hon. Gentleman for his intervention, although I am not yet a Privy Counsellor, and am unlikely ever to be so—but there we are.

Not just Labour voters, but leading figures in the party have historically taken the Eurosceptic view. Hugh Gaitskell, the former leader of the Labour party, opposed Britain’s membership of the Common Market, and I was pleased he did so. Subsequently, we had magnificent leaders who took the same view. My great friend the late Baroness Barbara Castle remained a strong Eurosceptic to the end of her life, as did the late Tony Benn, a great personal friend as well as a great politician. So there have been many Eurosceptic socialists—including, even, Lord Healey, the Labour Chancellor until 1979. I attended a Eurosceptic dinner in the City with figures from various parties, and that was the only time I ever met Lord Healey. So significant figures of great intellect, political judgment and commitment to democratic socialism have taken a similar view to mine.

I have not changed my view since 1975, because our relationship with the EU has become worse, rather than better. We only have to look at the economic catastrophe that is the eurozone to realise how bad it is now. We have to shake up the EU; there is nothing to be gained economically from our remaining members, but then that is a matter for the British people, as and when they have their referendum—hon. Members will guess which way I shall be voting. In previous referendums, political leaders across Europe have sought to persuade their people to vote in a particular way, and they have refused to do so—for example, the French people on the proposed constitution. The Socialist party in France supported the constitution, and it had a referendum among the party membership, which also supported the constitution; but the socialist voters voted the other way, and they lost the referendum. The same happened in Holland, and of course the EU had to withdraw the constitution and replace it with the Lisbon treaty, which was similar, but called a treaty, rather than a constitution.

We have seen others referendums—for example, in Norway and Sweden—on various aspects of the EU, and each time the political leaders have tried to drive their voters in a particular way, but they have refused to be so driven. Now, about 11% of the population in Sweden want to join the euro, and the same proportion in Norway want to join the EU. When the people are asked, they often take a view that upsets the political classes, but in the end, we are democrats and have to accept that view. Regrettably, I had to accept the 1975 view, even though the resources put into a yes vote were massive. The common market threw bucket-loads of money into a massive advertising campaign; every corner shop had a picture of Harold Wilson with his pipe and Gannex mac saying, “Vote yes”. I was part of the no campaign, and we had pathetic resources—a few bob from the trade union movement and not much else.

Does my hon. Friend share my concern that already the EU, in the form of its establishment Commission, is putting huge amounts of money into supposedly educational publicity that actually promotes the EU, and that if we have a referendum, it is important that the EU not be allowed to use our money to campaign in that referendum?

Of course, the EU propaganda machine knows no bounds. We see little blue-and-yellow stickers on almost everything, saying we have had lots of money from the EU and glossing over the fact that we are massive net contributors.

More worryingly, the European Scrutiny Committee, of which I am pleased to be a member, has looked at the BBC and is seriously concerned about its bias. I am a passionate believer in the BBC and public service broadcasting, but the Committee has produced two eminent reports demonstrating the BBC’s pro-EU bias. It must be neutral in the referendum campaign. It must give an equal voice to all sides and ensure the debate is fair. We cannot just have a tiny minority of sceptics, with the enthusiast view put very strongly.

I have said it many times, but I am a lover of Europe. I go there for my holidays every year, I try to speak one or two European foreign languages, I love European culture, European literature and, above all, European people—I am a Eurocentric person in every sense—but the EU is a political organisation with a particular political view. I have spent my life campaigning for democratic socialism, and I think that the EU is not just anti-democratic, but anti-socialist, which might encourage some Conservative Members to vote for it, rather than against it. Nevertheless, I think it is actively anti-socialist, and has been so for a long time, which is why I oppose it. I want to see countries in Europe free to develop their own economies as they see fit, and if that happens to be a socialist view, or a neo-liberal free market view, so be it; the peoples of those countries should be able to choose how to govern themselves.

My view on the EU has got stronger over the years, as we have seen the disaster of the eurozone. Thank goodness my right hon. Friend the Member for Kirkcaldy and Cowdenbeath kept us out of the euro. Had we pinioned ourselves inside the euro, with the parity operating at the time—€1.60 to the pound—by now we would have seen a catastrophe in our economy of the likes of that in Greece or Spain, although I think we would have got out by now, perhaps because we are more sensible, and possibly other countries would have done the same. I think that the euro will eventually unravel, and when countries can adjust their currencies to appropriate parities and run their economies properly, we will see some recovery, but not before.

We have evidence of a triple-dip recession and that the eurozone is dragging down the rest of the world economy, including our own. However, we have done better than others because our currency has been able to depreciate substantially since the creation of the euro, and particularly since 2008, which has protected us from the ravages affecting the EU. If our unemployment figures were equivalent to those in Spain, we would have 7.5 million unemployed. Imagine that! I do not understand why Spain has not seen a bigger revolt. Nearly 500,000 people have left Spain to go and work in south America and elsewhere because their own country cannot sustain them. It is even worse in Ireland. It has allegedly recovered—I am pleased about that, for the Irish—but it has overcome its unemployment problem by exporting 300,000 people. The equivalent number in Britain would be 4.5 million. Imagine if our economy had failed so badly that 4.5 million Britons had to go and live abroad to get work. That would be a travesty and utterly shameful. I look forward to the time when we establish sensible economics across Europe and that sort of thing does not happen any more.

Most seriously, Germany is now in real trouble. It has long benefited from an open market for its motor cars and other manufactures and from the consequent substantial trade surplus with us and other EU member states. It has squeezed the life out of the economies of other parts of the EU, and now it cannot sell its cars any more, so it is affecting the German economy too. We need a completely different approach to organising the economies of Europe—not the EU, but Europe.

We once had a model that worked. Between 1945 and the 1970s, we had a world, designed at Bretton Woods, that actually worked. Working-class living standards rose at a rate unprecedented in modern history. We saw the creation of welfare states and growing equality. The world I grew up in was wonderful, although it could have been more socialist and more left wing, but we have gone backwards since then across the whole of Europe. It is only because of the vestiges of what was created in the immediate post-war world, sustaining people through welfare states, that the Governments of Europe are getting away with what they are getting away with. We need to see a world in which we start to recreate those things that we have lost. We need to re-establish a more sensible world in which we all have jobs, we create growing equality across Europe and indeed across the world and we have good international relations on bilateral and multilateral arrangements, without being governed by an anti-democratic, non-democratic and bureaucratic organisation called the European Commission, which runs our lives. I support the referendum, and as and when it comes, it is likely that I shall vote no. I will, however, accept the decision of the British people because I am a democrat.

I am moving towards my conclusion and am conscious that others want to speak.

Let me be absolutely clear: the idea that the Prime Minister can unilaterally secure significant renegotiation is unrealistic, to say the least. The only way we are going to have significant renegotiation is through an intergovernmental conference, which will require Chancellor Merkel, the French President and others to agree to the process. What will happen if we get to the end of 2017 and the Prime Minister of the day has failed to secure those renegotiations? Will we have a referendum or not?

My hon. Friend says yes, which is a reasonable position if she simply wants out of the European Union. I disagree with her, but it is a legitimate position. What we should not have is the duplicitous behaviour of some Conservative Members. They claim that they want to put this to the will of the people, but the reality is that they just want to leave the European Union. This has nothing to do with trusting the British people; it is all because the Conservative parliamentary party cannot trust its own Prime Minister.

Finally, there is no clear reason for having a referendum in 2017. It will simply cause economic instability and constitutional chaos, and distract us from the important work that needs to be done on rebuilding our economy. I do not support this Bill and do not wish it a good wind.
