Commons ChamberI am sure colleagues have enjoyed the bevy of sport over the weekend, especially the tennis, but I think we would all want to congratulate the Lionesses on winning 3-0 against the Cameroon and, of course, on reaching the quarter-finals, where I hope they will quickly dispose of the Norway option to get to the semi-finals.
The use of children’s rights impact assessments is widely promoted across the Department and wider Government, and our assessment template is designed to help staff to give due consideration to the UNCRC when making new policy and legislation.
May I first take a moment to congratulate you, Mr Speaker, on serving 10 years in the Chair? That is worthy of recognition.
Will the Minister give some indication of when the results of the consultation on the restraint of children will be published? The consultation closed in January 2018, having commenced in 2017. When is it going to happen?
I thank the right hon. Gentleman very warmly for what he has said.
Education is, of course, a devolved matter, but it is also true that funding per pupil is slightly higher in England than it is in Wales.

The free schools programme has added enormously to diversity and innovation in our school system, which is why it is important that we continue to expand their number, through our plans for another 110 or so over the next few years.
This has been described as new money. In areas such as mine in Wales, where we have no grammar schools—proudly—and no selection, will the Government’s announcement bring a consequential that we can spend on all our children?
This is all part of existing capital funding. I mentioned earlier the much larger figure of which this is one part.

Commons ChamberThe early intelligence that we are gathering about the autumn term is very encouraging. More than 216,000 parents have received eligibility codes for this term and more than 90% have found places. Independent evaluation of the early delivery areas found that a quarter of mothers and one in 10 fathers had increased their working hours. Providers are willing and able to deliver the offer to working parents.
We carried out detailed work using Frontier Economics, which reported in July 2017, and we have increased the funding to £4.94 on average from £4.56. I have met a number of nurseries that seem to be outliers that, unlike most, are unable to deliver for that price. We have asked them to supply detailed information to find out why that is. Is it because they are not working to the ratios that others are? Is it because they have high property costs? We would be keen to see that detailed information and to find out why they are outliers, so that we can work with them to ensure that they can deliver within the money, as the majority of providers are doing.
Constituents of mine who use or work in nursery facilities on both sides of the England-Wales border report the capacity issues that my hon. Friend the Member for Liverpool, Wavertree (Luciana Berger) has just mentioned. The Minister says that 90% have found places. Will he tell us how many of that 90% have got the full 30 hours?
Well, it is certainly up to them. The evidence that I get when I visit nurseries up and down the country is that many parents are actually taking extra hours and paying for the wraparound hours. When I was at a nursery in Wolverhampton two weeks ago, parents there told me that they already had their children in the nursery and were having trouble finding the funding for that, but that when their children turned three in January, they would then get access to the 30 hours funding. So the vast majority of parents are accessing the full 30 hours. Also, they can mix and match between childminders, nurseries and other voluntary sector providers.

Order. Self-evidently Mr Dakin’s debate has given me a challenge. At least 13 Members want to speak; I must call the Scottish National party spokesperson at 4 pm, and there are the Labour party spokesperson and the Minister to get in, so there is a limited time. Given the enormous Opposition interest, I think that Opposition Members in particular will have to restrain their comments severely.
Order. I am going to call Norman Lamb next, but self-evidently a number of hon. Members wish to speak. To get them in, I will have to impose a time limit, which I will announce after Norman Lamb has spoken. The hon. Member for Glasgow North West (Carol Monaghan) has graciously said that she will cut short her remarks, so I intend the Front-Bench speeches to start at five past 4, and I ask hon. Members to bear that in mind. I will set the time limit once Norman Lamb has finished his hopefully reasonably brief remarks.
I am conscious that the restrictions from the Chair dictate that other people need to get in, so I will resist the temptation there.
Let us recognise that sixth-form colleges across the country have a very good record of delivering high academic standards. For some reason, it appears that the Government have a negative view of them, and are prepared to see them wither and die in some cases. That is a big mistake. Let us recognise the fantastic performance of sixth-form colleges across the country. Paston is not unique in that regard. Let us make sure we preserve them and give them a bright future.
I am going to have to impose a limit of three minutes for the moment, which should just about get everybody in before the Front-Bench spokespeople begin their deliberations.
I congratulate my hon. Friend the Member for Scunthorpe (Nic Dakin) on securing this debate. In Plymouth, the education funding cuts for 16 to 19-year-olds are taking a real toll on many of the most vulnerable and poorest in our community. The excellent work of sixth-form teachers and of the excellent City College Plymouth is being slowly undone by Government decisions to reduce funding. Having spoken to teachers and lecturers in Plymouth, I am concerned that funding is insufficient to give our young people the depth and breadth of study they need, especially those from the poorest backgrounds.
A lot of investment has been put into STEM subjects and training people for the marine jobs that Plymouth excels at, especially at City College Plymouth’s new STEM centre, but overall cuts to education funding for 16 to 19-year-olds are reducing the range of subjects across the city. As the son of a teacher, my starting point is that I want the Government to interfere less and to fund education better, and the latter certainly applies in Plymouth. Plymouth has a diverse tapestry of education, with every type of school, from nurseries and 19 free schools to private schools, FE colleges and academies. They have all shared concerns, privately or publicly, about the impact of education funding cuts on life chances, especially for those from the poorest backgrounds. Curtailing the breadth of study reduces their life opportunities.
The context of our education debate has changed. We need to look carefully at what the post-Brexit environment will mean for education. I would like the Minister to comment not only on the validity of the cases that hon. Members have made, but on how we can make true the rhetoric that I hear from Ministers about how Britain is to be a place of education, aspiration and skills. If the Government continue to cut education funding for 16 to 19-year-olds, we will produce less home-grown talent and will find it harder to attract international students to study from ages 16 to 19, as City College Plymouth does. Nor will we be able to fulfil the potential of the post-Brexit skills environment, which I hear Ministers talk about so positively.
I urge the Minister to look not only at funding schools and FE colleges properly, but at pay rates in the public sector, especially in education. An awful lot of excellent people are going above and beyond—I have seen that at first hand in Plymouth—by doing unpaid hours and working extra to support our young people, especially in areas where funding for special educational needs and expanding horizons has been cut. Will the Minister look at how Brexit will change those environments? Will she make sure that she does not forget about the far south-west, where our education funding is already among the lowest in the country?
I have, and I am grateful to my hon. Friend for that intervention. There is a huge reconfiguration of training going on, and it has not been properly thought out. That puts additional burdens on colleges. He is right to highlight the point.
There is also confusion about students between 16 and 18 who do not hold a GCSE grade A* to C—or 9 to 4 with the changes that have come in this year—in maths or English. In future allocations, these students have to study maths and English as a condition of funding. Therefore, on top of other funding pressures, there is a risk that colleges will fall off a precipice. That is where we are at, and that is why there are so many Members here today. In May 2015, the Skills Funding Agency suggested that there were around 70 financially unstable colleges.
In the few minutes that I have left, I was going to talk about area-based reviews, but the former Minister, the right hon. Member for North Norfolk (Norman Lamb), spoke very eloquently about the issues we have had with them up and down the country. In Greater Manchester, the process was ably led by the Conservative leader of Trafford Council, Sean Anstee, but these area-based reviews really had no teeth, because colleges have gone away and done their own deals with the Department for Education, even though we have gone through a huge area-based review system up and down the country. The Minister really needs to get a grip on this issue and take a good look at it, as well as taking advice about it from fine council leaders and councillors up and down the land who have struggled to do the right thing but found that the review process just did not work out.
In conclusion, post-16 education faces a perfect storm: low levels of funding per pupil; no acknowledgement of inflationary or cost increases by the DFE, as was ably pointed out by my hon. Friend the Member for Scunthorpe; the unknown impact of the apprenticeship levy; the maths and English funding condition; and a costly and potentially failed review of post-16 education. If we truly want to meet the challenges of Brexit and address the problems it will create for our economy, we must face up to the country’s skills shortage. We cannot do that by undermining our post-16 sector.
I pay tribute to every Member who has contributed today. I am afraid that I have not got round to mentioning them all, but all of them—from all parties in this House—have ably stood up for their colleges; well done to them for that.

As Members can see, a number of right hon. and hon. Members want to participate in the debate. I intend to call the Front-Bench spokesmen at 10.35. I hope that Members will show self-restraint so that everybody is able to take part.

Again, the hon. Lady takes the misleading figures from the National Union of Teachers, which is conflating the cost pressures that all of the public sector is incurring over this year and the next three years—amounting to 8% in total—with the national funding formula. The national funding formula is good for schools in the hon. Lady’s constituency. I hope very much that her local headteachers and she herself will support the new national funding formula, because it is fairer, and fairer for her schools.
I am sure that, when a bill has to be paid, the headteacher is not looking for the reason why it is becoming more difficult for them to do that. Certainly—
If the hon. Gentleman does not mind, I will not, given the time. Government and Opposition Members have said that this is about the overall picture. It seems extraordinary that substantial sums of money should be taken away from schools in deprived areas through the formula funding when other cuts are being imposed.
I agree with what my hon. Friend the Member for Wythenshawe and Sale East (Mike Kane) said from the Opposition Front Bench. The figures from the NUT and other unions should not be rubbished by the Government, but looked at, because they give an overall picture of the cuts that there have been over a number of years, starting as long ago as 2013 and going through to 2020, and possibly beyond.
Let us look, for example, at Ark Burlington Danes Academy, which is a very successful academy with 67% of pupils on free school meals. By 2020, it will have lost 18% of its budget. Hammersmith Academy, which is a new-build academy with 61% of pupils on free school meals, will have lost 25% of its budget. Wormholt Park Primary School, which has 59% of its pupils on free school meals, will have lost 16% of its budget. As the Minister can readily tell, those schools have very deprived intakes and they are losing unsustainable amounts of money.
In addition to the cost pressures, which cannot be separated out as the Minister would like, what will happen if we have the misfortune of the Government continuing this after 2020? The NUT has pointed out that, according to the Government, several schools will still be overfunded. Will they be restricted by not having inflation increases thereafter? What are the plans? In my constituency a number of schools will still be said to have, once the floor is imposed, funding that is 10% above what they should have, and in one case, 31% above. How are those figures in any way realistic or sustainable for schools to cope with?
Given the amount of time that the Minister has been in the job, he ought to appreciate the absolute sapping of morale, particularly among teaching staff in these areas. It is absolutely right that London schools are a huge success story, but like the rest of the country, we have been through a lot of trauma, with the loss of Building Schools for the Future. Without going into the politics of it, there has also been the way in which academies and free schools have been introduced, and the imbalance of resourcing going to those schools rather than to community schools.
My hon. Friend the Member for Dulwich and West Norwood mentioned English as an additional language, special educational needs, deprivation and turnover. In particular, the effects of the Government’s housing policies mean that not only has there been this extraordinary churn, but families are regularly being thrown out of London and they then have to commute hours back with their children every day. Schools are seeing a huge turnover of pupils. Those things cannot be coped with easily. Schools need additional resources and we do not need this destabilisation.
I will continue doing the school gate meetings, even though the consultation has closed, because what has happened has awakened an appreciation of the overall attack on school budgets under this Government. It is unprecedented—it has not happened for at least 20 years or perhaps longer—so I echo what Members on both sides of the Chamber have said. Nobody wants the funding not to increase or the funding gaps not to be addressed in schools that may have been historically underfunded for a number of reasons. That is certainly not the fault of London education authorities, which have always—going back to the days of the Inner London Education Authority—prioritised funding for inner-city schools. However, the problem will not be addressed by substantially reducing the funding and resources of schools in London, which have done a fantastic job over the last 10 to 20 years in changing the mood and the climate. The Minister should wish to emulate that around the country, not drag London down.

Thank you, Mr Hanson; I want to respond to all the points that were made in the debate.
We launched the first stage of our consultation on reforming the schools and high needs funding systems in March last year. We set out the principles for reform and proposals for the overall design of the funding system. More than 6,000 people responded to that first stage of our consultation, with wide support for those proposals. I acknowledge the support that the hon. Member for Wythenshawe and Sale East (Mike Kane) has given to the principles of this formula.
We have just concluded a 14-week second stage consultation, covering the detailed proposals for the design of both the schools formula and the high needs formula. Our proposals will target money towards pupils who face the greatest barriers to a successful education. In particular, our proposals will boost the support for those from disadvantaged backgrounds, and for those who live in areas of deprivation but who are not eligible for free school meals—those ordinary working families who are too often overlooked. We are also putting more money towards supporting those pupils in both primary and secondary schools who have fallen behind in their education to ensure that they have the support they need to catch up.
Overall, 10,740 schools would gain funding under our proposals, and the formula will allow those schools to see those gains quickly, with increases of up to 3% per pupil in 2018-19 and of 2.5% in 2019-20. Seventy-two local authority areas will quickly see an increase in their high needs funding, and no local authority will see a fall in its funding.
As well as providing those increases, we have listened to those who highlighted in our first stage consultation the risks of major budget changes for schools. That is why we have proposed to include significant protections in both formulae. No school would face a reduction of more than 1.5% per year or of 3% overall per pupil and, as I have said, no local authority will lose funding for high needs. The proposals will limit the otherwise quite large reductions that some schools, including many in London, would see as the funding system is brought up to date.
The real-terms protection of the core schools budget underpins these proposals. As a result, we are able to allocate some £200 million to schools in both 2018-19 and 2019-20, over and above flat cash per pupil funding. That will combine significant protection for those facing reductions with more rapid increases for those set to gain under the fairer funding formula. High needs funding will see an equivalent real-terms protection.
London will remain the highest-funded part of the country under our proposals. Schools in inner London will attract 30% more funding per pupil than the national average, which is right. Despite the city’s increasing affluence, London schools still have the highest proportion of children from a deprived background and the highest labour market costs, as has been acknowledged in the debate.
We are using a broad definition of disadvantage to target additional funding to schools, comprising of pupil and area level deprivation data, prior attainment data and data on English as an additional language. No individual measure is enough on its own. Each factor reflects different aspects of the challenges that schools face, and they work in combination to target funding. Where a child qualifies for more than one of those factors, the school receives funding for each qualifying factor. For example, if a child comes from a more disadvantaged household and they live in an area of socioeconomic deprivation, their school will attract funding through the free school meals factor and the area-level deprivation factor—the income deprivation affecting children index.
The additional needs factors in the formula are proxies for the level of need in the school. We are not suggesting that the funding attracted by an individual pupil must all be spent on that pupil, but that schools with high numbers of pupils with additional needs are more likely to need additional resources. Using the proxy factors helps us target funding on schools that are more likely to face the most acute challenges. I will give way to the hon. Member for Dulwich and West Norwood (Helen Hayes), who introduced the debate, if she wants to come in on that point. If not, I will press on.

Before I call other right hon. and hon. Members, we appear to have an abundance of time, but I intend to call the Opposition Front Bencher at 10.35 am. Five right hon. and hon. Members wish to speak, so I hope that you can self-regulate in that 45 or so minutes.
It is a pleasure to serve under your chairmanship, Mr Hanson. I congratulate the right hon. Member for East Devon (Sir Hugo Swire) on securing the debate. He said recently in the Exmouth Journal that he would raise his concerns in Parliament, and it is good to see politicians keeping their promises—he has certainly done so today.
Under this Government, schools are facing their first real cuts in 20 years. My right hon. Friend the Member for Exeter (Mr Bradshaw) summed it up. We have to look at the big picture, because many rural schools are affected. We had a similar debate about the Minister’s county of Sussex, which is very poorly underfunded, a few weeks ago, and Members had exactly the same concerns. Their hopes were raised by the proposed introduction of the manifesto commitment of a national fair funding formula, but up and down the land most people’s hopes are being dashed. We must put this in the context of what was announced in the Budget: £3 billion will be taken out of our education system by 2020. That is an 8% cut. In my constituency, it is an 11% cut, so no matter what we do with the fair funding formula, it will be insignificant, given the situation that schools face.
The Institute for Fiscal Studies initially predicted the real-terms cuts of 8% that I mentioned, but the Office for Budget Responsibility predicted sharply rising inflation over the course of the Parliament, so the cuts will get even worse. The right hon. Member for East Devon spoke eloquently about fairness, but nothing is fair about that. The funding formula was supposed to redistribute a sum of money to help schools where help is inadequate and to provide our children with the excellent education to which they are entitled, as pointed out by the hon. Member for North Devon (Peter Heaton-Jones).
The National Audit Office has said that the Department for Education is expecting schools to find a total of £3 billion in savings over the course of the Parliament, but the Department has failed to communicate to schools how to do that, given the pressures pointed out today, such as the apprenticeship levy and rising costs and national insurance costs.
The Opposition support the principle that all schools should have a fair funding formula, but the answer is not simply to take money away from some schools and to redistribute it in different budgets across the country. The solution is to invest in education and to help every child to receive an excellent education, as pointed out by the hon. Member for South West Devon (Mr Streeter). He talked about an education oasis so, with an Oasis reference and my being a Mancunian, I should ask him not to “look back in anger”. He spoke with passion about his concerns and the consequences of Government action. A whole range of both Conservative and Opposition Members are extraordinarily disappointed.
Given cost pressures, inflation and an increase in pupil numbers, schools budgets are facing real-terms cuts. There has already been a sharp rise in the number of secondary schools that are in deficit, reaching nearly 60% of the total in 2014-15, according to the National Audit Office. According to the North Devon Gazette, only three schools in Devon are set to gain extra funding under the proposed national funding formula, as announced by Secretary of State. The changes to education funding have been branded “ridiculous” and “a shambles” by Devon headteachers. The hon. Member for Newton Abbot (Anne Marie Morris) rightly pointed out that the Government are simply not listening at the moment, and while they are still in consultation, we have to plead with them to start listening.
Michael Johnson, the headteacher at Chulmleigh Community College, said he had received calls from other headteachers who simply did not know what they were to do. He said:
“Early indications are that all or most Devon secondary schools will receive less through the new funding formula.
I have had other secondary school headteachers telling me today ‘I don’t know what I am going to do now’.
Nationally, this formula offers the same money for more children and we have now got increased costs that we have had imposed upon us.
With the limited information available to us at this time, we believe that most secondary schools in North Devon will not be better off and will continue to face budgetary shortfalls.
So far, this exercise looks to me like the same budget has been through a hot-wash to present it differently. It looks like a shambles to me.”
That is a headteacher in one of our schools.
Mr Glenn Smith, the principal of Honiton College, said that Devon is one of the lowest-funded education authorities in England:
“Whilst the announcement in the…2015 Autumn Spending Review of firm proposals for the introduction of a new fairer national funding formula from April 2017 was most welcome, this promise of ‘jam tomorrow’ has since been delayed by 12 months and we still await further information around the detail, timing and implementation of any such policy.
Meanwhile the legacy of an unsatisfactory funding settlement has been further worsened for schools by rising expenditure demands owing to national policy decisions beyond our control, notably those associated with staffing costs.”
Mr Smith sent a stark warning to the Department that harsh cuts in Devon might see some of the smaller schools not able to produce a balanced budget, in effect putting them into special measures, so they might therefore be lost altogether. He worried:
“Maybe, when some Devon schools start to buckle under the increasing financial pressures, the government will start to make education a priority once more.”
The right hon. Member for East Devon said that we should not be too political, although he was critical in quite a party political way of the Tony Blair and Gordon Brown Governments. Mr Smith of Honiton College, however, said:
“Tony Blair’s top three priorities for government were: Education, Education and Education—God knows how far down”
the importance and fairness of education policy have gone. Schools did extraordinarily well under that Government: schools were rebuilt and they got more money than they had had in a generation.
I was beginning my teacher training in 1997, and I spent most of the time going around with buckets to collect the rain. By the time I left education, 10 or 15 years later, after the Labour Government, if the roofs had not been rebuilt, it was only because the school had been rebuilt. The only thing going through the roof were standards and attainment, so Labour Members will not stand for any lectures about our record.
On top of that, the hon. Members for Newton Abbot and for North Devon rightly pointed to the requirements for special educational needs in Devon, where there is a particular problem. “Schools Week” has done an analysis of local authorities’ high-needs budgets, which are given a set amount by the Government depending on how many special needs pupils each council caters for. Many heads are already struggling to cope.
Devon faces a £4.5 million shortfall this year, and the council is proposing to move £55 per pupil from its schools block funding—the money for pupils in mainstream schools—to its high-needs budget. Lorraine Heath, headteacher of Uffculme School, said that the reallocation would cost her school £56,265,
“which I have not budgeted for”.
That was her reaction. She said that the only way to meet the cut would be to reduce staff numbers and to increase class sizes.
In conclusion, may I praise the Devon MPs who are holding the Government’s feet to the fire on the issue? They are standing up for their constituencies and their county. I also remind them, however, that it is their party’s Government who are doing this.
Before I call the Minister, I remind him that the right hon. Member for East Devon (Sir Hugo Swire) should have a couple of minutes to speak at the end of the debate.
The first thing on which we can all be agreed is that we are delighted to see the Minister back in his job. At one point he had an enforced holiday from the Front Bench; his proper place is on the Front Bench, doing what he is doing for education. It may not seem like it, but he can be assured that he is largely among friends this morning.
The Opposition spokesman referred back to the halcyon days of the Governments of Mr Blair and Mr Brown. I gently point out to him—he was not in the House at that time—that Devon certainly did not prosper in terms of schools funding in those days. He talked about how a Labour Government stopped water coming through the roof. Unfortunately, they did not stop the economy going through the floor. We are picking up the pieces, and, as I said at the beginning, we must be realistic as to what we can afford, given the appalling legacy we inherited.
I think the debate has been constructive, thoughtful and indeed insightful. I agree with the Minister that we all have the same eventual aim. This is an extraordinarily challenging time for the United Kingdom, given the great educational achievements of Asia, for instance, especially in mathematics and science. If we are to turn out a generation of British people who can compete in a highly competitive world, we will have to do that better. That is informing the Government’s thinking, but we must ensure that that is fair as well as ambitious.
I say to my hon. Friend the Minister that west country Members of Parliament have a history of being fairly independent-minded, and I think he will have learned from this morning that that tradition continues. Indeed, there are those of us who will be looking carefully at the Government’s proposals to see whether we can back them in terms of representing the best interests of our teachers and constituents.
This is one of the rare occasions in Parliament on which we want to hear more of the C-word—that is, of course, consultation. If the consultation is genuine, the Minister would do well to meet the Devon Association of Primary Headteachers—we would like him to come to Devon, or we can bring them all here—to hear at first hand how the changes will affect us in the county of Devon. With that in mind, I will end a few seconds early to give the Minister extra time to go back to his Department, consult his officials and come up with a deal that is fairer for the people of Devon.
We have about 30 seconds until the next debate and I hope that the Minister for that debate will arrive shortly. May I say it has been a pleasure to listen to the debate? As a former resident of Plymouth and an employee of Plymouth and South Devon Co-op many years ago, I found it interesting to hear the debate.

Friend’s interest as a north-west MP, and I am happy to tell her that under the new modern slavery offence, eight charges were laid in the north-west region and eight offences in the Mersey-Cheshire region, plus other offences under older legislation, in the past year. Only last month three people were convicted of modern-day slavery and human trafficking in Liverpool and were sentenced to a total of seven years and three months’ imprisonment.
Many of the prosecutions were the result of the European arrest warrant playing an important part. Will the Solicitor General, with the Home Office, ensure that the European arrest warrant remains a useful tool, whatever the outcome of Brexit negotiations?
The right hon. Gentleman is right to note the huge importance of the European arrest warrant in streamlining the process. That, together with other tools to encourage close co-operation not only between countries in the EU but more widely abroad, is a vital means by which we can deal with what is an international crime.

Commons ChamberMy hon. Friend makes a valid point. This is a double whammy for some workers; not only are they losing out because their employers are altering their terms and conditions, but they are losing these valuable other hours. Many of these workers absolutely depend on being able to work extra hours and overtime.
B&Q, like so many companies nationwide, has made all employees sign new terms and conditions under a variation of contract. Those new terms scrapped double time for Sundays and bank holidays, as well as seasonal bonuses and other allowances that staff relied on to top up their income. These pay cuts were much greater than the gains of the national living wage, which is why so many employees are losing out.
Would my right hon. Friend think it a good idea for the UK Government to make a register of the companies that have undertaken such action, and bring them to a round-table meeting to explain that the purpose of the living wage was to improve, not reduce, people’s expenditure power?
I would indeed. Part of what we are doing today is asking the Government and the Chancellor to address these issues. There are strengthened penalties for employers who do not pay the national living wage, but I suggest that alongside those should go penalties for employers who deliberately circumvent the national living wage in this way.
My hon. Friend the Member for Mitcham and Morden was grateful for the fact that her speech during the Budget debate last month offered a great platform to get this issue the recognition it deserves. She was especially grateful for the interest shown by the Minister for Small Business, Industry and Enterprise, which doubtless brought further attention to this issue, and I am pleased to see her here. My hon. Friend’s speech highlighted how illogical and unfair it was to claim that Britain was getting a pay rise while hard-working employees across the country were being hit by such pay cuts. She reminded the Government that the week before, the Prime Minister and the Chancellor had been unwilling to promise that nobody who works on the shop floor would be taking home less money after 1 April. Last year, the Chancellor said he was committed to a higher-wage economy. He said:
“It cannot be right that we go on asking taxpayers to subsidise…the businesses who pay the lowest wages.”
He promised that the change would have only a “‘fractional’ effect on jobs”, and that the cost to business would be
“just 1% of corporate profits.”—[Official Report, 8 July 2015; Vol. 598, c. 337 to 338.]
That was a cost he offset with a cut to corporation tax.

In the context of fiscal restraint, ensuring that we have a sustainable model for our higher education system is crucial. In this respect, the measure builds on successive reforms since 2010 which have delivered a higher education system that safeguards social mobility and delivers for students and taxpayers. Indeed, the OECD has commended the reforms in aggregate for the sensible balance they strike between the interests of taxpayers and students. Its director of higher education has said that England is
“one of the very few countries that has figured out a sustainable approach to higher education financing.”
Very recently, on a trip to London, he added that England
“has made a wise choice. It works for individuals, it works for government.”
I am grateful to the right hon. Gentleman for making that point. If he reads page 35 of the Conservative party manifesto, he will see a clear commitment to continuing the funding reforms that I have just described and ensuring a fair balance between the interests of taxpayers and students. There are also many other references in the Conservative manifesto to the need to achieve budget deficit savings.
Let me start by beginning to address the questions about the scrutiny of the regulations that were raised by the hon. Member for Blackpool South (Mr Marsden). The regulations were not sneaked in, as he suggested. In fact, the policy was first announced in principle in the 2015 summer Budget, nearly six months ago. It was in fact included in the Chancellor’s summer Budget speech, one of the most closely scrutinised events in the parliamentary calendar. The decision finally to proceed was made as part of the spending review in November 2015 and the instrument was laid before the House on 2 December. A comprehensive 80-page equality analysis was published the next day, in line with an earlier commitment I made voluntarily to the House. I shall say more about that later.
The regulations were made under powers granted to the Secretary of State by the previous Labour Government, under the Teaching and Higher Education Act 1998. Rather than using some obscure and arcane procedure, as hon. Members have suggested, we are following the very parliamentary processes that the previous Labour Government created for this purpose. Labour asked for a debate on the regulations on 9 December and the Government tabled a motion that appeared on the Order Paper on 5 January, referring the regulations to a Delegated Legislation Committee. Labour did not object, and the regulations went to such a Committee on 14 January. To put it simply, the processes were put in place by Labour when they were last in government and they did not object on 5 January, when they had the chance. I now welcome the opportunity to debate the issue further in this Opposition day debate and I note that the other place will also have a chance to consider the instrument following the tabling of a motion by the noble Lord Stevenson of Balmacara on 13 January.

Commons ChamberIt is great to hear another example from the UK’s successful automotive industry; it is one of the brightest stars in the constellation of British business. We encourage the effective use of land by reusing brownfield land. Local planning authorities, through their local plans, need to respond to market signals and set out a clear strategy for allocating land suitable for development.
T3. Following on from the question of the hon. Member for Shipley (Philip Davies), it is not just USDAW members who are opposed to changes in Sunday trading. Last week, for example, the British Retail Consortium said:“There is a strong consensus across the industry that the proposal to devolve these decisions to a local level, rather than them being decided nationally, is a matter for concern.”Will the Business Secretary truly take account of the consultation and, if business, workforces and the public say no, not make those changes?
As the right hon. Gentleman will know, the consultation is about to close and we will carefully look through its responses, as we always do, but I am sure the right hon. Gentleman agrees with choice, so that local authorities can decide if it is the right thing for them. If, for example, there is a local area with higher unemployment than elsewhere and the local authority thinks the changes will help to create jobs for local working people, that will clearly be a good thing. There was a time when the Labour party was the party of working people; what has happened?
