It is very important that we are able to continue to mobilise the immense British generosity we see in cases like this, where people are willing to give to these appeals. Clearly, we are one of the leading nations in this respect in what we provide from taxpayers’ resources, but many individuals and families also make a contribution, which helps to make a serious difference on the ground. I have not seen in detail the Charity Commission’s comments, but all of us will want to continue to urge people to give generously and responsibly to these appeals.

That is an exciting way of looking at it—to adopt a real free-market approach, which allows companies to go out to prospect, as they did in California in the 19th century, and as Cecil Rhodes did when he went to South Africa. He found great acres of space and he made a claim and he dug and he dug and he dug, and he found gold, diamonds and platinum, and he put them into a great company, and he made millions—in modern money, billions—of pounds by doing that. That was not through state regulation, not through international bodies, not through the United Nations reaching an agreement to say, “You may do this,” or “You may do that,” but by enterprise, hard work and energy—by all those great British virtues of which we should be so proud. Why not say that of the oceans? Why not mount expeditions? We could launch one together, Mr Speaker, to try and find the lost city of Atlantis, which we would expect to have all sorts of valuables—metals, gold, excitements—in it.

We could have other companies, perhaps, doing more careful geological surveys to locate those metals—the rare earth metals. An interesting fact about rare earth metals is that they are not particularly rare. The Chinese sold them very cheaply to start with, but they became a monopolist and then they raised the price. In doing so, they showed absolutely classic monopolistic behaviour. Those metals are not particularly rare, although they are quite expensive to gather together. People could go off as a free-enterprise endeavour, without having to pay for licences and regulations.

Every pound that is spent on a licence is a pound that cannot be spent on exploration, or on exploitation of the asset once it is found. How relieved I was to hear from Mining Weekly about the speed with which the sea bed—the mighty sea bed—restores itself to pristine condition after someone has been down and done a little digging. That conjures up wonderful images. I was delighted to hear my hon. Friend the Member for South East Cornwall (Sheryll Murray) say that there is always a Cornish miner involved, and that they go down and dig, even at the depths of the ocean, to find valuable assets that we may be able to exploit for the benefit of the British people. That is a free-enterprise endeavour.

Interestingly, those who spoke in the debates in the early ’80s thought there would be a great expansion of activity at the depths of the ocean. Why did that not happen? Is it not obvious, Mr Speaker? The dead hand of legislation and bureaucracy came crushing down on those who wanted to be enterprising in their prospecting activities. So there was no equivalent of the Californian gold rush. There was no shout of, “There’s gold in them there hills,” or anything of that kind, of the undersea hills.

As we are talking about geology, it is worth mentioning that the great father of geology, a Mr Smith, started all his work in North East Somerset, in the village of High Littleton. Going down in a mineshaft, he saw the different layers of the earth and worked out—

Order. I am all agog at the racy and intoxicating oration that the hon. Gentleman is delivering to the House, but I have two concerns. First, if the hon. Gentleman leads a lengthy sojourn, either accompanied or unaccompanied, in the terms that he describes, he may be sorely missed in North East Somerset. Secondly, I feel sure that, ere long, notwithstanding the quite legendary eloquence that the hon. Gentleman has thus far deployed, he will turn his attention to the contents of the Deep Sea Mining Bill itself.

Because so many other Members are keen to speak in the debate, I shall keep my remarks short. I know the Benches are not currently filled, but people are waiting in their offices to come racing down into the Chamber the minute the Minister has said a few words, such is their excitement to talk about the details of the Bill.

The details of the Bill are of course crucial. Its worst aspect is that it removes the Secretary of State’s ability to repeal legislation. If there is one thing that I take particular exception to, it is the idea that legislation that was temporary and could be removed is now to become a permanent burden on our statute book. When we look, in the No Lobby, at the statutes of this great nation, we see one volume covering the first few hundred years of the existence of Parliament, and now we see a volume barely doing a Session of Parliament. How glorious it would be if more Bills gave Secretaries of State power to take them off the statute book—to deregulate. I would urge that the Bill should have a more deregulatory ambition, and therefore in the early stages of its consideration we should delete the conversion of the 1981 Act from temporary to permanent, because the temporary nature of legislation is one of the pious hopes that all legislators should have. We should wish our legislation to deal with a temporary problem and then restore the liberties of the British subject as soon as possible. That would be my first concern over the Bill and the regulations within it.

Given that enormous commitment to aid, will the Foreign Secretary applaud the efforts of others such as Michael Bates in the other place, who last weekend completed a 518-mile walk from London to Derry in aid of Syria’s children, raising more than £35,000 for the cause? Does not the record of aid and diplomacy achieved by the Government and the people in it suggest that the Government’s willingness to consider military action was expressed reluctantly, and alongside an enormous commitment—

It is not necessary to repeat the refrain “money resolution” so long as the content of the remarks of an hon. Member relates clearly to the purpose of the resolution. I have been attending closely to the hon. Gentleman’s expatiations and so far he has met the criterion. I do not want him to depart from the path of virtue as he nears his end.

Mrs Thatcher said that the 1975 referendum had been introduced as

“a tactical device to get over a split in their own party.”—[Official Report, 11 March 1975; Vol. 888, c. 306.]

Those are the words she used to describe the policy put forward by the then Labour Government, and I believe that they are completely appropriate to describe the policy now being put forward by the split part of this split Government—the Conservative part of the coalition.

I also congratulate my hon. Friend the Member for Basildon and Billericay (Mr Baron) on securing this important debate on parliamentary consent for arming the Syrian rebels.

Last month, I wrote to the Prime Minister to highlight what I believed were the very real concerns among colleagues and the public about the possibility of British involvement in Syria escalating, and I asked for assurances that prior to any decisions being taken to supply arms to the Syrian National Coalition, or any other groups in Syria, a full debate and vote would be held in Parliament, and that if Parliament were in recess, it would be recalled to facilitate this important debate. In addition, I wrote that I believed that the division and sensitivity the issue evoked, among colleagues across the House and the general public, dictated that the matter be subjected to full parliamentary scrutiny and debate before we potentially became further involved in another middle eastern conflict.

More than 80 colleagues on the Government Benches co-signed the letter, as they were concerned that this action could be taken without the consent of this House. The only precedent during this Parliament for the use of military intervention abroad is Libya, where a Government motion was carried after the intervention had started. I accept that events dictated that swift action was necessary in that case and that in some matters of defence time does not always allow for a parliamentary debate, but I do not believe that this constraint applies to the proposal to arm rebels in Syria. I point out that I still await a response from the Prime Minister to the letter.

On my specific concerns about arming Syrian rebel groups, I return to Libya and what has happened since the collapse of the Gaddafi regime during the Arab spring. Professor Michael Clarke, when giving evidence to the Foreign Affairs Select Committee a couple of weeks ago, stated:

“There is a lot of evidence that Libyan weapons are now circulating pretty freely in the Levant”—

the Levant comprising several countries in the eastern Mediterranean with unstable regimes or internal issues. He also made the following shrewd observation:

“Weapons never go out of Commission; they just go somewhere else. Almost all weapons find a new home once a war is over”.

That sums up two principal concerns of many Members: about the groups it is proposed be armed and about what control we and other NATO members would have over those arms once supplied. The evidence in Libya suggests that the new Government have little control over weapons stocks and that they have seeped out of their control, no doubt finding their way on to the weapons open market and into the hands of the highest bidder.

These concerns need to be addressed in a parliamentary debate, especially given that they are held by many groups and individuals outside the House. For instance, Amnesty International has stated:

“Unless the UK government can first ensure and demonstrate that such requirements are met and there does not remain a substantial risk of misuse for serious violations of human rights or International humanitarian law they should not supply any weapons or munitions to any Syrian armed opposition groups.”

It also points out that although it is clear that the Syrian Government are committing the majority of war crimes, armed opposition groups are increasingly resorting to hostage taking and to the torture and summary killing of soldiers, members of pro-Government militias and civilians.

As my right hon. and learned Friend the Member for Kensington (Sir Malcolm Rifkind) said, on 14 June the United States announced that it would supply direct military aid to the Syrian opposition. I would ask the question—

Last year, when I was in north-east Lebanon, I went to a village that had been shelled by the Syrian regime. I met a woman who had just come over the border. She had lost her children, her husband and her legs when she was hit by a Syrian army shell while fleeing from her village. Imagine being in a village in England with the Royal Artillery shelling the village, then being harried by the Grenadier Guards and 42 Commando the Royal Marines. It is unthinkable.

I totally accept that it is perfectly reasonable for a Government to do something without the consent of Parliament in an emergency, in order to maintain surprise or while conducting covert operations. However, we are not talking about Bosnia today; we are talking about Syria, and the House of Commons should be given a say.

I want to echo something that my right hon. Friend the Member for Wokingham (Mr Redwood) said earlier about public distrust. I agree with him, given the disastrous cock-ups in Iraq and Afghanistan. As a journalist and as a Member of Parliament, I have seen the way in which pliant officials in the Ministry of Defence and the Foreign Office have done the will—or what they think is the will—of their political masters. In future, if it is possible, we need the reality check of a Commons vote in order to create clarity and avoid the activities of some of the more pliant civil servants who will always play back what they think their political masters want.

It does indeed bear out the wisdom of experience.

We will not be sending in troops. We must stress that the vast majority of what we are calling for can only be brought about by Egyptians—we must not pretend anything else—but what we and other countries say does matter; how we are prepared to help in the future matters. We have to make those things clear to the Egyptians, even though it certainly does not involve the deployment of British troops.

On a point of order, Mr Speaker. I hope that the Foreign Secretary will stay in the Chamber for this point of order. I think that you will agree that we had the most heated and emotional Prime Minister’s questions of the Session this afternoon. The emotion might carry us all along, but there are lines that you insist we must not cross. It has been reported by those who were present, by people watching at home and by the press that the Foreign Secretary, in response to a question asked by my hon. Friend the Member for Kilmarnock and Loudoun (Cathy Jamieson), twice shouted the words “stupid woman”. I know the Foreign Secretary to be a man who has done great good in his job, and I would hope that, if this report is true, he is already regretting those comments. Would it be appropriate, Mr Speaker, for you to give him an opportunity now to apologise, to ensure that his reputation and that of this place is not damaged by such behaviour?

On a point of order, Mr Speaker. In spite of your valiant and heroic efforts to improve the conduct in the Chamber and the standing of Parliament outside this place, we hit a new low today. Prime Minister’s Question Time was an unedifying spectacle of distortion, evasion and obfuscation. May I again suggest that you hold a seminar, especially for the Prime Minister, in order to explain the precise meaning of the words “question” and “answer”, and the need for a link between the two?

I thank the hon. Gentleman for his point of order. Today, it will suffice for me to say that I thought it was a very unedifying spectacle. It was as noisy as, if not more noisy than, I have ever known it. I ask right hon. and hon. Members on both sides of the Chamber, as I have done many times over the years, to give some thought to the way in which our proceedings are regarded by the people outside this House whose support we seek and whom we are here to represent. Frankly, the behaviour of a very large number of people was poor, as the hon. Gentleman has indicated. Rather than dwelling on it further today, let us aspire, and take steps at all levels, to ensure that it improves in subsequent weeks. That is a responsibility of every right hon. and hon. Member, from the person most recently arrived to the longest serving Member, and from those who serve in a Back-Bench capacity to those who serve at the highest level, either in government or in opposition.

On a point of order, Mr Speaker. I have given the Secretary of State for Northern Ireland notice that I will be raising this point of order. Earlier today in Northern Ireland questions, I raised an issue about what she would be doing as a result of the outrageous and scandalous decision last night of the Parades Commission in Northern Ireland. That decision is causing enormous pain and tension to rise in north Belfast and across the Province, and there is the potential for severe trouble on our streets. In replying to my question, the Secretary of State did not address the point about her powers in relation to an application by the Chief Constable. I have to say, Mr Speaker, that in my view that was deliberately deceptive. It was absolutely outrageous, and it will not go down well with the people back home. The Secretary of State has a responsibility to do something about the outrageous decisions of the Parades Commission in Northern Ireland—

Mr Speaker, the situation in Northern Ireland today is extremely difficult and tense, and I have to say that people are very concerned about what might happen. For the Secretary of State to spend an entire Question Time without referring to her powers in this matter is unforgiveable, and it cannot be glossed over.

Order. I do not seek to gloss over anything, and I am sure that the Secretary of State does not, but I must say to the hon. Gentleman with great courtesy that he has now twice failed to withdraw the words that were disorderly, which I have most courteously asked him to withdraw. I must warn the right hon. Gentleman—it pains me to do this—that if he persists in his refusal to comply with my order to withdraw, I shall be compelled to name him, which I do not wish to do. I please ask the right hon. Gentleman, who has made his point, to which the Secretary of State will have an opportunity to reply if she wishes, simply to take back those particular words. I am not asking him to withdraw his whole contribution; he must withdraw the words “deliberately deceptive”. It is not appropriate to accuse any Member of this House of seeking deliberately to deceive or mislead it. The right hon. Gentleman will please withdraw those words now.

Mr Speaker, I have yet to hear any explanation from the Secretary of State as to why that glaring omission was made in relation to these important matters. I feel that on a matter of such import and importance, I am reluctantly not able to comply on this occasion. I stand over what I said, and I have to say that the people of Northern Ireland are in a very serious position indeed. The Secretary of State needs to do something to intervene in this matter, and she needs to do it quickly.

I made it clear, and I hope the House will accept that it was appropriate to do so, but I cannot engage in negotiation with colleagues whereby they agree to withdraw something if someone else does or does not do something. Therefore, very regretfully, after a display, I hope, of some patience and the proffering to the right hon. Gentleman of a number of opportunities to make good, I am forced to act.

I am happy to do so. I fully appreciate the strength of feeling of the right hon. Member for Belfast North (Mr Dodds), given the involvement of his constituency in the events of the forthcoming weekend. He will appreciate from the conversation that he and I had this morning that any powers I have to intervene to review the decision of the Parades Commission are triggered only as a result of an application by the Chief Constable of the Police Service of Northern Ireland, and I have not received such an application. If I did so, I would of course consider the exercise of my powers with the greatest care.

Given what has happened and in the light of the Secretary of State’s response, I wondered whether, within the context of the next 48 hours, she will ensure that the extreme frustration that has been exhibited today—I do not in any way challenge your ruling, Mr Speaker—is not played out on the streets of Belfast and Northern Ireland on Friday. We must maintain the rule of law and respect the integrity of all those involved in talks so that we can try to dissolve and devolve the position in Northern Ireland to a problem-solving exercise in which violence is avoided and people respect each other’s rights.

I am grateful to the hon. Gentleman. He is making his points more usefully than some of his Whips have done so far—[Interruption] but is he aware of the fact—[Interruption.] Tory Members should calm down. Is the hon. Gentleman aware that 40% of UK exports go to the EU tariff-free, and that business leaders in this country have said that it would be dangerously destabilising if a referendum were to go ahead. I apologise, Mr Speaker. There are many of us who campaigned for yes to Britain in the 1975 referendum campaign, but to paraphrase Goethe, that which thy forefathers bequeath thee, one must earn anew if one wants to possess it. There comes a point where one has to demonstrate the wholehearted consent of the British people to our membership of the European Union if it is to be valid for us and for them and, importantly, for the whole of the European Community.

It is. In answer to an earlier intervention, the hon. Member for Stockton South (James Wharton) said that Members of this House who propose amendments to the Bill would be misusing parliamentary procedure; he said that to do so would be a “misuse.” I seek clarification, Mr Speaker: would it not be perfectly in order for any Member of this House to propose many amendments to the Bill if it gets a Second Reading?

Many hon. Members in this place have made the case and raised their concerns about our relationship with the European Union over many years. I am pleased to stand here today and speak for them, for those who have dedicated countless hours to pursuing the cause of democracy in holding the European Union and our relationship with it to account. However, I am bringing forward this private Member’s Bill not just for me, the Conservative party and my colleagues: I am bringing it forward for the people as a whole. I therefore hope that we can drive it forward and make it a success.

My hon. Friend has a consistent and principled track record on this matter that I am sure this House recognises and appreciates. He makes a helpful contribution that reminds us of the historical reality within which we are operating. Over the years, many Members have warned us about what was happening in the European Union, yet those warnings have not always been heeded.

This Bill is about making good the central promise of our democracy: that we are the servants of the people and not their masters. We want to give the people a voice. I was born in Stockton-on-Tees, a town that I am now proud to represent in this place. I am also proud to be presenting this Bill, which will give not just the people of Stockton but the people of the United Kingdom—[Interruption.]

I am proud to represent the people of Stockton in this matter, but also the people of this country as a whole. It is about time we gave those millions of British people who want a say the chance to do so—from Stockton and beyond. This Bill would legislate for that and give them confidence that they will get their say and that it will be at the right time and in the right way. We have a chance to give the British people a voice through this Bill, and I commend it to the House.

It is a cross-party matter. My right hon. Friend the Prime Minister and I have made the position clear, so I do not think that the right hon. Gentleman needs to look at “a senior Tory source”. There is no Tory more senior than the Prime Minister. [Interruption.] Occasionally, one or two might think they are, but there are no Tories more senior than the Prime Minister and he has made it clear that the Government have a strong record of holding votes in the House of Commons on these issues when it is necessary to do so. We certainly would not want to pursue any aspect of our policy on this issue against the will of the House of Commons. That is neither feasible nor desirable, so of course we have made clear that there would be a vote. I have also made it clear that we would expect it to be before any such decision was put into action.

I would like to think that I heard the word “yes” in that answer, but I am afraid I did not. Nevertheless, and notwithstanding the unholy alliance between Iran and the Assad regime, how does it help the interests of this country to change yet another Arab dictatorship into another Islamist state, complete with weapons of mass destruction for al-Qaeda to use against us?

Indeed, and narcotics impinges on the human rights of people in Colombia and, unfortunately, of people here in the UK, Mr Speaker. Yes, we will give our full support—we are giving our full support—to the Government of Colombia. President Santos is a keen Anglophile, and we are very supportive as a Government of what he is doing in leading his country from the dark days of the past to a much brighter future.

I am glad to be able to tell my hon. Friend that so far we have opened six new posts and upgraded a further six posts, and over a five-year period, we will be opening up to 20 new embassies and consulates. That is vital in order for Britain to be well-connected in the world, and it is a sharp contrast from the withdrawal of British diplomacy from many areas under the last Government.

The Foreign Secretary said in answer to an earlier question that he would judge President-elect Rouhani on his actions. What specific actions will he be seeking from the Iranian regime and the newly elected Iranian President himself, in order for them to demonstrate in the months ahead a renewed commitment to resolving the nuclear crisis by peaceful and diplomatic means?

I thank the Foreign Secretary for his statement and for advance sight of it this afternoon. The House will be aware that on Saturday the Opposition, along with other Members of this House, called for the Foreign Secretary to address Parliament today, and we welcome his decision to do so in recognition of the depth of public concern that has arisen in recent days.

I begin my remarks by echoing the words of the Foreign Secretary and put on record the support and admiration of the whole House for the important—indeed, vital—work that is done by our country’s intelligence and security services. Theirs is some of the most important but inevitably least recognised work undertaken to protect the security of our nation, and it is right that we take the opportunity to offer our thanks and praise for their efforts. Our intelligence agencies’ work would be made more difficult if levels of concern about the framework under which they operate were to compromise the active support of the public for their efforts. In the light of that, I shall quote back to the Foreign Secretary his words in a BBC interview yesterday:

“if you are a law abiding citizen of this country going about your business and your personal life, you have nothing to fear—nothing to fear about the British state or intelligence agencies listening to the contents of your phone calls or anything like that.”

This assertion, however, assumes that the state is either incapable of error or incapable of advertent or inadvertent wrongdoing.

Surely, on reflection, the Foreign Secretary will accept that law-abiding citizens of this country also want to know and be assured of the fact that the agencies of government are themselves law-abiding. Back in 2011, the Foreign Secretary seemed to recognise the importance of this point when in a speech on the role of the Security Services he said that

“the need for secrecy places additional importance on the Foreign Secretary’s accountability to Parliament for GCHQ and SIS. This is one of the indispensable foundations of public confidence, and one that I will personally strive to strengthen.”

Today presents him with a clear opportunity to deliver on that pledge, and I hope that in his answers to my specific questions he will be able to do so.

The Foreign Secretary is right to assume that lawyers, some law-makers and the members of the ISC may be very familiar with the framework of legality and accountability, but the general public, for understandable reasons, are not. In the light of that, will he take the opportunity of his response to remind the House of the steps we in Parliament have taken to preserve privacy, and set out whether all steps taken by our agencies are, to the best of his knowledge, compliant with those laws? It is in this spirit, not of condemnation but of concern, that I would like to ask the Foreign Secretary some questions about the recent allegations first revealed by The Guardian on Friday of last week about the existence and operation of the so-called Prism programme administered by the NSA.

Let me first make it clear that the Opposition support the principle of information sharing across international borders with allies. Indeed, the people who want to do harm to the UK work across international borders, and those people working to keep us safe have to be able to work with allies across international borders if they are to tackle these threats effectively. But that needs to be within that established framework of both law and accountability. The Foreign Secretary is right to say that full disclosure on this issue is not possible nor appropriate, so let me focus my questions not on the specific operational aspect of the allegations, but on the broader legal and policy frameworks that would apply in these circumstances.

Earlier this morning, the Chair of the Intelligence and Security Committee, the right hon. and learned Member for Kensington (Sir Malcolm Rifkind), gave his account of the legal framework that would govern British intelligence agencies’ use of intercept data. He said:

“If the British intelligence agencies are seeking to know the content of emails about people living in the UK then they actually have to get lawful authority. Normally that means ministerial authority. That applies equally whether they are going to do the intercept themselves or whether they are going to ask somebody else to do it on their behalf.”

Will the Foreign Secretary confirm whether that account of the current legal framework is both complete and accurate?

In his statement, the Foreign Secretary has just stated: “Any data obtained by us from the United States involving UK nationals are subject to proper UK statutory controls and safeguards, including the relevant sections of the Intelligence Services Act 1994, the Human Rights Act 1998 and the Regulation of Investigatory Powers Act 2000.” Will he now set out the relevant sections of those Acts, and confirm whether this explanation means that any data obtained by us from the US, involving UK nationals, are authorised by ministerial warrants and overseen by the intercept commissioner, as set out by RIPA?

Specifically, what legal framework applies in the following two cases? First, when a request is made by the UK to an intelligence agency of an international ally for the interception of the content of private communications, will he confirm whether this process is governed by individual warrants signed by the relevant Secretary of State and approved by the intercept commissioner as set out in part I of RIPA? Secondly, will he address the specific issue of when a request is made by the UK to an intelligence agency of an international ally, not to seek intercept, but instead to search existing data held by that agency on the contents of private communications, and, in particular, the legal process that will be adopted in such an instance? In that circumstance, will he confirm whether this process is also governed by individual warrants signed by the relevant Secretary of State and approved by the intercept commissioner as set out in part I of RIPA?

Will the Foreign Secretary confirm that, with respect to intelligence sharing with allies, the UK Government operate on the basis of the assumption that information held by, for example, the US Government, has been obtained in accordance with the law of that country? If that is the case, what steps has he taken, or will take, to confirm that any processes currently in use by the NSA continue to adhere to this legal safeguard?

To conclude, all of us in this House have an interest in sustaining public confidence in the work of the intelligence agencies. Those agencies, each and every day, do outstanding work on behalf of and for the sake of us all. That is why Ministers and the ISC now have a heavy burden of responsibility to oversee and scrutinise their work, so as to reassure the public.

May I commend my right hon. Friend for his statement, for his personal grip and command over this issue and for the work that the security services do? I imagine that from the nature of the work they do and the people they are, our security services people are reticent about talking of their successes. At a time of heightened tension over international and domestic terrorism, will the Foreign Secretary encourage our security services wherever possible to put into the public domain the success stories in countering threats to our national security?
