Commons ChamberI originally proposed a version of new clause 10 in Committee. I did not see it as an attempt to wreck the Bill; I genuinely felt it was an opportunity to close that loophole.
Order. We are obviously not going to reopen yesterday’s debate. We are discussing other amendments today.
The proposals appear to be linked, Mr Deputy Speaker. I thank my hon. Friend for that proposal and many others he has made, and for his much-respected work. We do not agree on every single item, but his record is one of which the Liberal Democrats and Parliament should be proud.
Let me put my position on the record. I believe, have believed and was brought up to believe that marriage is ordained by God. I believe that marriage is traditionally ordained by God to be between one man and one woman. I believe that marriage was set up by God for the creation of children. I believe that it was to link the biological needs of children with their biological parents. I believe that it was for biological complementarity. I believe that it was for gender complementarity, and that it was a gift of God in creation. That is why I have taken a traditional Christian and other-faith view on how marriage has traditionally been—for one man and one woman—which was the case long before we legislated for such things in this country and made them the law of the land.
Order. We are not talking about infertile couples. Unfortunately, we are on the humanist part of the Bill, and that is what we will discuss. Fortunately or unfortunately—depending on which way we look at it—we must try to speak to the amendments if we can. I hope, Mr Hughes, that you are not going to tempt many others down another track.
I will not, but with respect I want to say a word about humanism and speak to my new clause 18, which is in this group, on the difference between the church and the state.
Let me say to the hon. Member for Hackney North and Stoke Newington (Ms Abbott) that of course marriage is never only for the production of children. Many people get married without that intention, and it might be impossible for some. That is not the argument. In the theological tradition, one purpose of marriage is to have children, and that is not possible, biologically, between two men or between two women. Some churches believe that marriage is a sacrament or holds another special position.
We move from that position of faith to one where we legislate. My right hon. Friend the Member for Berwick-upon-Tweed (Sir Alan Beith) intervened earlier to make it clear that Methodists, Quakers, Jews and the Free Churches had to fight for the right to perform marriages in their churches. Now, places that have nothing to do with churches or faiths are licensed to carry out marriages—civil marriages became possible. The position of registrar was set up and people are able to have entirely civil marriages in a registry office. That is still the case. Marriages can be held in a place that is entirely civil—in a state-authorised location—or in a place of worship, which can also include the legislative provisions that the state requires.
In all my time in the House, I have argued that we should try to separate those two things. New clause 18 suggests a way of doing that, just as new clause 14, tabled by my hon. Friend the Member for Leeds North West (Greg Mulholland), does. I believe in the disestablishment of the Church of England. I am a member of the Church, but I believe in its disestablishment. Just as the Church in Wales has been disestablished, I have always believed that in England we should separate as much as possible the activities of the Church and the activities of the state. Marriage, therefore, between a man and a woman in a Christian or religious sense is different from marriages, partnerships or unions that are secular, or between people of the same sex.
I pray in aid the view, which has been quoted already, of the hon. Member for Rhondda (Chris Bryant). It was referred to in the Public Bill Committee and goes back to what he said in 2004. When he was asked whether he agreed with the proposition about same-sex marriage, which is at the heart of the Bill, he answered:
“I do not support that; I believe that marriage is an institution that is ordained of God and should be celebrated between a man and a woman. However, I also believe that two men or two women can have a relationship that in many ways mirrors that between a man and a woman but is not identical. Therefore, I believe that we should have in law separate institutions that reflect that reality.”—[Official Report, Standing Committee D, 21 October 2004; c. 68-70.]
That has always been my position too. We should give equal rights to gay and straight couples to form partnerships, unions or relationships that give the same pension rights and status, but are not the same as the traditional marriage between a man and a woman.
Colloquially, people talk of equal marriage, and I understand that. People who are in civil partnerships talk of being married, and of their husbands and wives. We are not going to be able to put the clock back, which is why new clause 18 talks about “civil marriage” and not civil union. Many of my Christian friends say that that is an unacceptable compromise, because the Christian view of marriage cannot be changed by calling it civil marriage. We have to wrestle with that issue and sort it out, because we could have civil marriage that is different from faith, Christian or religious marriage, and I think that people would reasonably understand the difference.

Commons ChamberThe Institute for Fiscal Studies is clear that the lowest 20% of income groups are being hammered by the Government’s various changes. How can the right hon. Gentleman justify disabled people being hit, as they have been, by a combination of the bedroom tax, the council tax localisation scheme, work capability assessments followed by their appeal, and having their benefit cut during that lengthy process?
Order. We are now on 17 minutes. I was working on speeches lasting no longer than 16 minutes per Member.
I was conscious that I was giving way too much so I will answer that intervention very quickly and move on. Many people with disabilities have had their benefits protected. For everybody there is now a scheme that will make sure they are reassessed—fairly, we hope. The so-called bedroom tax does not apply to people who need a live-in carer and other categories have now been exempted, not least because of internal discussions in the coalition which delivered that outcome. But I am very conscious that we need to do better for the people in the bottom 20% of income. I have argued that within my own party and in the coalition and will go on arguing it. We need to end up with a much fairer society than the Conservative Government or the Labour Government left us. We are trying to make that fairer society, which for us is a priority.
The priority is to make sure that we have a strong economy and a fairer society and that everybody has the opportunity to get on as they wish. To do that, the priorities are very much the ones that the Government have enunciated. Further priorities are social and affordable housing. For many the cost of getting their own home is prohibitive and homes to rent are unavailable. We need to carry on dealing with tax avoidance and the inequalities of wealth at home, but we should not think that the solution to all our problems is to become little Englanders or little Britishers and not to see our future as being within the continent of which we are a part, where we can trade, work, gain and make progress, and within the world of which we are also part.
It is good that the Queen’s Speech makes it clear not only that we will defend people who have been loyal to us, such as Gibraltarians and Falklanders, but that at the G8 next month we will argue for a fairer world, transparency and accountability, conflict prevention and bigger efforts to bring peace to those parts of the world such as the middle east, which have suffered for too long. Abraham Lincoln said:
“Always bear in mind that your own resolution to succeed is more important than any other”.
The coalition is resolved to help Britain succeed and become a strong economy again, and Liberal Democrats will play their part in making sure we do that as well as possible.

Commons ChamberThe hon. Gentleman is covering lots of bases. One of the issues that we face as a society is that young people can become isolated from contact with other young people, other than through the internet or texting. That is a real danger zone. They retire to their bedrooms and they are not seen from one night to the next. Their communication with others is limited. The exercise of parental and family responsibility, to ensure that youngsters are out and being monitored so that people can pick up signs that they might be led to suicide sites, is as important as dealing with the sites themselves.
Order. May I point out to Members, in relation to those last two interventions, that such interventions should come through the Chair? Instead, they have been focused on the hon. Member for South Antrim (Dr McCrea), whom we all wish to hear.

Commons ChamberOrder. Before the right hon. Gentleman begins his intervention, I counsel him that those who persistently intervene may get dropped down the list. I hope that the House understands what will happen if there are continual interventions from the same Members.
I hope that the hon. Member for Blackley and Broughton (Graham Stringer) accepts that, at the moment, at the other end of the building there is clearly no party with an overall majority. Indeed, everybody is in a minority. He is worried about having one period only for election and no need for re-election, but what would his alternative be that would end patronage and heredity in the second Chamber, if it is not something like this Bill?

Commons ChamberThe issue we are debating is very important, and I thank the Home Affairs Committee for its continuing work on it. I encourage it to continue monitoring the work of the UK Border Agency. I am also grateful to the Minister for his active engagement with this issue, and with me as a constituency MP when I have brought cases to his attention or to the attention of his staff.
My general analysis is somewhat different from that of the right hon. Member for Manchester, Gorton (Sir Gerald Kaufman), as I do not think that under the last Government we were anywhere near nirvana in respect of immigration and asylum cases. The situation is considerably better now than it was under the last Labour Government. This has been a huge and intractable issue for the Home Office over many years. I am grateful for the progress that has been made, but that does not mean that I in any way think the UKBA or the Government have fully addressed all the problems.
Although we are talking about the UKBA, what we are actually talking about is people. I shall therefore refer to some people. First, I shall mention the two people in my office who every day try to unravel the knots of other people’s family lives when dealing with asylum and immigration cases. Magali Tang and James Harper are wonderful public servants—working for me as an MP—and they are hugely valued by our constituents. When I last checked a year or two ago, I was either first or second in the league table of Members who brought Home Office-related immigration and asylum constituency issues to the authorities. I have no idea where I am in the league table now, and that does not matter, but I do know that a large volume of such work gets done. Some 40% of the work that comes before my constituency office is Home Office-related, and we try to give a good service.
Achieving that depends on the individuals at the other end of the process as well—on the personality of the account manager. I pay tribute to Claire Shacklock who previously did the job for us in Southwark, when Southwark was an area on its own, and I pay tribute to her successor, Helen O’Brien, who is the account manager in Lambeth, Bexley, Greenwich and Southwark. After the handover, it took a little while for us to get the communication established and working well. It is now working well, and her staff are beginning to understand what we expect and are beginning to deliver. That required us to be quite gruff with them, however. We had to tell them what they needed to do and make them understand the urgency of some of the cases.
I asked my constituency team to tell me the three key issues. The first of them was post-study work visas. This is what my team said:
“This route is being closed and so everyone has applied at once, and this has thrown the system into chaos. We have had between 15-20 cases in the last month of people who have been waiting around 3 months, when the published waiting time is 1 month. They are stuck as they can’t work and some people are losing accommodation/job offers because of the delay. Why did the UKBA not see this coming and what are they doing to make sure the backlog is cleared quickly?”
The second issue was reconsideration requests, which my right hon. Friend the Member for Carshalton and Wallington (Tom Brake) mentioned. My team said:
“Currently, when people make ‘in country’ applications for leave to remain and these are refused without a right of appeal, applicants can ask the UKBA to ‘reconsider’ the decision. This was always an informal process but it was accepted that in general the UKBA would reconsider a case once. It seems that a backlog of reconsideration requests has built up and now the UKBA are saying they are reviewing how they deal with these requests. What does this mean? Are they going to stop reconsidering cases”—
or define what a “reconsideration” is?
“If so, they need to say so to people clearly. In one case we had recently, a woman who had been told her reconsideration request had been received later received a letter from Serco saying that according to the UKBA, she had no basis of stay and should leave immediately.”
The left hand and the right hand were clearly not co-ordinated, which was very “confusing” as the Serco letter
“didn’t refer to her reconsideration request, which she felt was still outstanding. If the UKBA are going to stop reconsidering, they must surely explain this clearly to people, not just get Serco to send them letters telling them to go home.”
I hope it does not stop reconsidering; I hope there is a reconsideration process, and we know what it is and how it works.
The third issue my team raised was the UKBA website, which
“despite recent re-modelling, is still not well organised or user friendly, and constituents regularly report this to us. It needs to use clearer, non-technical English wherever possible and be better laid out. The DirectGov website is a good example of how a website can be user friendly, as is NHS Direct (medical advice online). There are always links saying ‘do you need help with x....if so click here…’, ‘was this what you were looking for?’…that sort of thing, and the English is very good and accessible. The UKBA website lags a long way behind these websites.”
It surely cannot be beyond the wit of Government, with all their technical advisers and expertise, to get that sorted out. Please can it be sorted out soon?
I would now like to make a few points of my own. As has been said, there are still a huge number of really rubbish legal advisers and solicitors. I am weekly, if not daily, rescuing people from having to pay considerable sums that they do not have for so-called advice, often bad, telling them to take action they do not need to take and that will not produce any positive results. That gives them false hope. They are also often asked to pay for a service that is never given because the case in question is either not dealt with at all or not soon enough to be of any use. Please can the Office of the Immigration Services Commissioner get a grip and do its job properly? It is still not effective. It does not clamp down on bad advice; it tackles only crime and maladministration. That is not good enough. I should not have to be perpetually writing to these so-called solicitors or so-called advisers saying, “I want the money to be given back to my constituent because you haven’t done anything.” That is a scandal and it needs to be addressed.
The problem of so-called bogus colleges is not as bad as it was but I am not persuaded that there are not still some that do not produce the service they advertise. I encourage the Government to continue to be relentless in such cases. I want to encourage more students to come to this country and I think the Government understand the benefits of that—the universities and colleges certainly do—but that cause will not be helped if bogus colleges continue.
My penultimate point is to ask whether we can please not send people back to places such as Sri Lanka if they are Tamils whose life and liberty are likely to be at risk? I still think that the Home Office is not sensitive enough in such cases and I want a review of cases where there are historic and current conflicts.
Finally, I would like to help people to see the good side of some of the work done by those people with us. On Saturday, I went to the wedding of Sheku Jalloh and Raphaëlle de Joffrey. Sheku came to see me when he was in his teens as a Liberian asylum seeker and refugee. He has now married a Swiss graduate whom he met here, they have settled down and they are a good news story. There are lots of good news stories—

Amendment 10, page 3, line 3, at end insert—
‘(5A) The Secretary of State may only grant financial assistance after a business plan for the proposed infrastructure has been approved by Ofwat and the National Audit Office.
(5B) The business plan must demonstrate that the company carrying out the infrastructure has adequate capital resources to complete the infrastructure project.’.
This issue is of significant interest to those of us who live in the Thames Water area. Some 20% of the population of the United Kingdom do, so it is not an irrelevant issue to people across the country who pay water rates. Specifically, I am talking about colleagues who have constituencies in Gloucestershire, Northamptonshire, Essex, Kent, Hampshire and Greater London, and the issue raises broader questions about how the Government and Ofwat, the regulator, deal with water companies, their financing and, specifically, the financing of major projects.
I shall make some preliminary comments that relate to all three amendments. I am grateful to the Minister and to the Secretary of State for engaging with the issue; I am grateful for the engagement on Second Reading; and I am grateful for the correspondence that I have had with the Secretary of State since Second Reading. I shall refer to that and read some of it into the record.
First, in parts of London and, certainly, in my constituency, one of the most significant current debates is about whether there will be a Thames tunnel, and Thames Water’s proposal is that to address the current system’s inefficiency and inability to deal with London’s sewage, understandably because the system was created in the Victorian era, new infrastructure—a main sewer, in effect—needs to be built to cope with current and future needs.
There is an ongoing debate, which I do not propose to get into today, about whether the current plan for the proposed tunnel is the right answer. In summary, sewage capacity is already being built to the east of London, in the Lee valley; and there is a proposal—the projected costs of which have risen to £4.1 billion—for a long tunnel, travelling from west London not far from here, along my constituency and ending up at the sewage treatment works in east London.
Some people say that the only solution is the currently proposed tunnel; others say that it would be better to have a shorter tunnel and some other forms of sewage alleviation. That debate is ongoing, but in the end decisions will have to be made. There is a whole planning process for deciding whether the tunnel will be built.
Secondly, there is a debate—in constituencies such as mine and in boroughs such as Hammersmith and Fulham, and Wandsworth—about where, if there is to be a tunnel, the main sites of activity should be. In the middle of Bermondsey, a very large site is proposed for drilling down to create the shaft from which the tunnel boring will happen, both west and east, at a place called Chambers wharf. In the first round of consultation, the proposed site was King’s Stairs gardens, by the Rotherhithe tunnel. That is a greenfield site, and the proposal was not at all popular. We have managed to persuade Thames Water that that is not a good idea, but there is a tale of unexpected, or unwished-for consequences, because having won a battle to save one site we then found that the company came up with another site next door, taking the pressure off one community but immediately transferring it not far away. That is a separate debate, and I do not propose today to get into the detail of where the sites should be. I see my constituency neighbour and colleague, the hon. Member for Cities of London and Westminster (Mark Field) in the Chamber, and many of us have a constituency interest—big and small—in where the sites should be.
The third issue—the issue of the Bill—is whether the Government should, if necessary, provide financial support to Thames Water for such a project, and if so, the terms and conditions under which it should be granted. Clause 2, which all my amendments would change, is entitled “Financial assistance for major works”. I shall not read it all into the record, as people can turn to it, but it proposes the insertion into the Water Industry Act 1991 of a new provision, section 154B, of which I shall read the first proposed subsection:
“If the Secretary of State considers it desirable to do so, the Secretary of State may give financial assistance in connection with—(a) the construction of water or sewerage infrastructure, or (b) the carrying out of works in respect of existing water or sewerage infrastructure.”
In further proposed subsections, there are various conditions, one of which is:
“Financial assistance may be given in any form and in particular may be given by way of—…grant…loan…guarantee…indemnity…the provision of insurance, or…the acquisition of shares in or securities of a body corporate.”
My first amendment, amendment 4, proposes:
“Financial assistance may only given under subsection (1) if the financing of the infrastructure is being secured by a group company which has adopted the equator principles.”
I shall come back to that.
Secondly, I want to test the Government’s reaction to amendment 5 and my proposal:
“Financial assistance must not be given to any company which has a debt to equity ratio of more than 65%.”
That precise figure is relevant, but there is a much bigger issue about what the financial past and present of a company should be if it is to receive Government support.
My third amendment, amendment 10, states:

The right hon. Gentleman is of course correct. He knows that as well as anybody, because it was his plan that the Government were delivering on. Liberal Democrats wanted devolution to London, but we were not sold on that model, which is why we still—
Order. May I just say that we need to get back to dealing with the new clause? We are having a history lesson in the Chamber. As interesting as that is, other people are waiting to speak. I am sure that the right hon. Gentleman now wishes to address the new clause.
I stand rebuked, Mr Deputy Speaker. I was tempted by the right hon. Gentleman, but I will not be any more. I will make a few more comments, and then sit down.
The next issue is how exactly the transfer of powers back to London will work. It is certainly right that, as the Bill proposes, we get rid of the London function of the Homes and Communities Agency, which is a quango, and transfer it to a democratically elected Mayor answerable to the 25 elected members of the London assembly. That is a good thing. It is also certainly right that the Government abolish the Government office for London. There is no need for a Government office for London as well as a Mayor, a London assembly and a Greater London authority. All those policies are heading in the right direction.
We now need to solve the further dilemma of how we strike the right balance between London-wide decisions, which are perfectly proper, and the interests of the boroughs. I understand that there is still some unresolved tension in that regard. My colleagues on the London assembly and across London think that, on balance, the Government are heading in the right direction, so today, although obviously the hon. Member for Lewisham East is entitled to make her case, we cannot support her. However, I do not want her to take that to mean that there are not further conversations to be had. Obviously the Bill will go to the House of Lords, and there will be opportunities to look at these things afresh.
I am hopeful that today’s debate will flag up the need to ensure—I am happy to have further conversations with colleagues about this—that the new architecture is the right architecture. I heard clearly what the Minister said about the Mayor’s power being subject to the two-thirds support of the London assembly, and I agree that that amounts to a requirement for a cross-party endorsement or cross-party veto. That will be a welcome control mechanism. I do not criticise the fact that the representatives, particularly the constituency representatives, should be able to speak for their constituencies, including for the borough councils within those constituencies, which is one of their jobs.

Please, if you can relate the matter directly to the motion, do that, then we can continue, rather than drawing other Members into a subject that we should not be discussing tonight.
On a point of order, Mr Deputy Speaker. I remain an officer of the group, and there is an issue about who should comprise the secretariat. There will be a meeting for colleagues in both Houses to discuss the matter, which will be reviewed. I hope that that will be an appropriate forum for discussing the way in which the group will be looked after, and that we can take the subject away from the wider debate to an appropriate place for people who have an interest.
I welcome the point of clarification, which certainly clarifies matters to the House. I thank the right hon. Gentleman.

May I say to the right hon. Gentleman and the hon. Member for Chesterfield (Toby Perkins) that the four major proposals on tax, finance and equality with which we went into the election have been delivered in the Budget? The only one that was not delivered was value added tax. The right hon. Gentleman knows that there is concern about its increase, but he has heard me say that I believe that, in the event, rather than making further spending cuts, it was the least worst option.
