It is a great pleasure to speak under your chairmanship, Mr Hood. I congratulate the hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) on securing the debate. I have fond memories of his constituency. Back in 1999, I stood in the first Assembly elections and managed to come fifth. The good people of his constituency were not ready for me then, but I enjoyed the experience and the fantastic countryside there.
The hon. Member for Carmarthen West and South Pembrokeshire has made the topic of this conversation deliberately wide, and Members have taken advantage of that. I want to mention one or two issues that perhaps have not been covered. First, I congratulate the Department for Environment, Food and Rural Affairs on its determined efforts to eradicate bovine TB in this country, which I know are appreciated by the farming people here. They do not bear comparison, however, with what is happening in Wales, where the farmers are almost despairing about what can be done to alleviate their problems.
I want to talk a little about financial services in rural areas. I have recently had the honour of introducing two debates in this Chamber on the closure of banks in rural areas, which is an important issue because rural communities want to attract not only tourists but businesses, and without banking facilities that can be difficult. I think that not just in rural areas or in Wales but more widely, the relationship between small businesses and banks has never been at a lower ebb.
Will my hon. Friend also reflect on the banks’ usual retort when asked about the diminishing number of branches, which is that online banking is a growing occurrence? In some parts of our constituencies that is not a reality because we have no broadband at all, let alone the superfast type.
I absolutely agree with my hon. Friend, and it is not only the absence of broadband. Sometimes, older people do not have the facility or the aptitude to take advantage of online banking, so we still need the face-to-face presence and advice that bank customers greatly value.
The issue also goes a little further. Today, I was sad to see that the number of complaints about banks made by small businesses to the Financial Ombudsman Service has gone up by 10% in the past year. It is only very small businesses that can use the ombudsman facility, so we have a number of such businesses being badly treated by their banks. For instance, not only are overdraft or loan requests turned down but the terms and conditions of such facilities are changed midway through. The Government once again need to sit down with the banks and say, “If we are all in this together and we are going for growth, you have to play your part.”
I think that the Government sometimes do not really understand the structure of business in this country. Whenever they trumpet support for business they talk about reducing corporation tax. That is much valued, but out of the nearly 4 million businesses in England only one third are incorporated, so the other two thirds will not benefit from the reduction in the tax, and the £100,000 reduction in capital allowances will particularly weigh on businesses that pay their tax through self-assessment—sole traders and partners.
On the role of independent filling stations, one operator in Sennybridge in my constituency has brought me evidence that the wholesale operation of the petrol supply chain is concentrated in a small number of hands, which could lead to difficulties with competition and access. He has sent information to the Office of Fair Trading, and I will send a copy to the Minister. This is a dangerous situation. Many of our independent filling stations have already closed, and if the process continues, a lot more could do so.
I am looking at the time, Mr Hood. The clock says that I have spoken for 11 minutes already, so I am not sure how much longer I have.
I commend the legislation introduced in England by the Government on small businesses’ right to buy. I point to two examples in my constituency. The Shoemakers’ Arms, a pub in Pentre Bach that was closed, has been taken over by the local community and is now flourishing. The community in Llanbadarn Fynydd have done the same with their village shop and filling station. Those are examples not of short-termism but of sustained success. They show what communities can do if given the opportunity.
I promised to mention the traditional makers of cider in my speech, so I will do so in the last 10 seconds. For goodness’ sake, do not let us push them out of business in trying to deal with alcohol abuse in our society.

I congratulate the Environment, Food and Rural Affairs Committee and its Chair on the report and their important work in scrutinising the CAP reform process.
I want to pick up on a few key issues in the Commission’s proposals that will be of great significance to farmers in Scotland, not least in the parts of Banffshire and Buchan that I represent, where farming has been a way of life for many generations and where food production is still absolutely the mainstay of the local economy.
I suspect that there is a good deal of consensus across the House on a couple of critical issues in today’s debate, the first of which is the need to cut red tape and reduce the administrative burden on farmers. In many respects, that is about fixing a major problem with the current CAP regime and is linked to the need for effective regionalisation and flexibility for member states. I hope that the Minister will consider in his comments at the end how we can start making decisions much closer to home and in the interests of our farming communities.
The hon. Lady touches on an important point. A common agricultural policy is needed, but considering the difference between farming in Finland and farming in Greece, we need to ensure that local decisions are taken on local matters within the umbrella of the CAP.
I agree entirely with the hon. Gentleman. Clearly, we have different climates and landscapes, diverse methods of farming and different ways of doing business in farming. Without prejudice to the common market, it is important that decisions are made in a practical way by the people best able to make them.
Member states will need flexibility in the process to tailor implementation to their own needs. Within the UK, all three devolved Administrations must be able to work around the challenges that they face in delivering sustainable agricultural development in some least favoured areas. About 85% of Scotland is classified as least favoured areas. That compares with much lower proportions in some other parts of the UK. I hope the Minister will offer assurances that he will press for greater regionalisation as the negotiations intensify and that the issue will not fall off the agenda.
The hon. Member for Thirsk and Malton (Miss McIntosh), the Chair of the Environment, Food and Rural Affairs Committee, quite rightly concentrated on direct payments in her remarks. I welcome the fact that the Government have moved away from the more rigid position of the previous Government, but I am still concerned about their direction of travel. I welcome the Minister’s remarks earlier on clarifying the Government’s position. I hope that he will listen carefully to the Governments of Scotland, Wales and Northern Ireland on direct payments and pursue a negotiating stance in Europe that reflects the needs and wishes of the whole UK.
It is worth remembering, as the hon. Lady pointed out, that direct payments are there primarily to compensate producers for the increased costs of operating in a highly regulated market and to enable them to meet the high animal welfare and food safety standards that we all expect. We need to acknowledge that that does not come for free. We need to accept the reality that, in the past few decades, farming has not been particularly viable as a commercial enterprise. If we did not support agriculture with direct payments, food production and land management simply would not be happening in large areas of the UK. Farming, especially in the least favoured areas, would have ceased a long time ago.
We cannot consider this in purely economic terms. The hon. Lady hit the nail on the head when she put food security at the heart of the debate. Brian Pack’s 2010 report, which was produced for the Scottish Government, highlighted not just the food security challenge, but the challenges of climate change, water supply, energy use and biodiversity as the starting points for CAP reform. In a global context of rapidly increasing demand for food and the need to manage our natural environment much more sustainably, the case for direct support for farmers is actually much stronger now than it ever has been in the past.
We also need to consider the future of direct payments against the historical backdrop of Scottish farmers receiving a disproportionately low share of pillar one support—a pressing issue for those Scottish farmers who want to export their produce. At present, pillar one rates in Scotland are only €130 per hectare, which is less than half the EU average, and well below the UK average of €229 per hectare. The UK needs to argue for its proper share of pillar one, not least so that it can provide a fairer allocation to Scottish farmers.

I am a member of the EFRA Committee, and I agree very much with many of the points made by its Chair, my hon. Friend the Member for Thirsk and Malton (Miss McIntosh). In particular, I agree with her criticism of the current direction of the reforms. The Committee is a broad Church, however, and it would probably be fair to say that I am less critical of the stance the Government have adopted, for the simple reason that all British Governments face the same problem on the CAP: ultimately, the policy is not their decision.
There are complicated negotiations between 27 member states, so our negotiating stance constantly comes up against opposition from other countries. That makes it quite difficult to set out a clear view of what we want to do; indeed, the previous Select Committee criticised the Labour Government for wanting to see everything in the long term done in pillar two, and for wanting pillar one to be phased out. The Committee said that it was unrealistic to suggest that in negotiations and that it was wrong for the Government even to have a vision of where they wanted to end up.
I disagree, and farm policy is a good example of what happens when we stop making decisions at a national level and subject ourselves to the spirit-crushing process of endless negotiations with 26 other countries. We end up with a poverty of vision right across Europe about what a good agricultural policy should look like, and I will say more about that in a moment.
I thank the hon. Gentleman for making that point, but does he not agree that if we are to have a common market and a trade in food between our nations, we need commonality and a common agricultural policy?
As I will say later, we need common objectives, but not necessarily a common policy. We also need clear state aid rules, as we have in other sectors. In that way, we can have a proper functioning single market and protect it, even though we do not have a common uniform policy across Europe.
The most important point about the proposals on the table is that they are a backward step for the CAP. The aim was to simplify it, and simplification has been the buzz word for many years, but the proposals will make it more complicated. As the Chair of the Committee said, we are effectively seeing a return to set-aside, with suggestions that 7% of people’s land should be set aside. At a time when food security, which should be a key objective of a common agricultural policy, is a growing issue, that is a step backwards.
I also object to the cap proposed on payments to farmers. If we want to encourage farmers to become less dependent on subsidies in the long term, we need to support consolidation and more efficient farms. A cap on payments would force farmers to break up holdings into collections of smaller holdings so that they still qualify for the subsidy, but that makes no sense. If we want a more efficient agricultural industry, why penalise the larger, more efficient farms?
There are some ludicrous things in the proposals. For instance, in an attempt to achieve crop rotation, there is some suggestion that farmers grow at least three crops to qualify for a subsidy. We can tell that the proposal was written by people who do not understand farming, because insisting on growing three separate crops will not necessarily bring the benefits we seek from crop rotation. For instance, somebody might grow cabbages, cauliflowers and oilseed rape to ensure they have their three crops, but those crops all come from the same brassica family, and are all subject to similar diseases, so a farmer who grew them would soon run into serious problems on their land.
What should a new CAP look like? We should start moving towards something that is about common objectives, rather than a unified common policy. The CAP should have key objectives, such as enhancing biodiversity, improving animal welfare and delivering food security. However, we should then give national Governments much more freedom to innovate, try new policies and adopt approaches that work in their countryside, rather than trying to have a uniform approach that works from Scotland all the way down to Greece, which is clearly difficult to achieve.
Allied to that, we would have a clear set of state aid rules that were specific to the agricultural sector, just as we have clear state aid rules for the single market in every other sector. Such rules would prevent, say, France from subsidising its farmers more than the UK Government and thereby putting our farmers at a disadvantage. Provided that we got those rules right, we could protect a single market in agricultural produce.
The key benefit of such an approach is that it would be more fluid. We would be able to hold the UK Government to account and say, “Why aren’t you trying this great new idea that is working so well in France? Surely, it would work here.” Instead, the best we can do now is to say, “How many meetings have you had with Poland to try to outmanoeuvre France?” That is not a good way forward.
When we make such proposals, people immediately think, “That’s a good idea, but it’s not realistic in the current time horizon.” I have heard that, too. Indeed, when I put these ideas to the Secretary of State last week, the answer was that they were ahead of their time, which is a flattering way of saying, “No, we’re not going to do that.”

Gentleman the absolute assurance that the Government are keen to see the reduction in tariff barriers that would allow developing countries to send more of their produce to this country. We believe in trade liberalisation; we believe it is good for both the developed and the developing world.
Despite opposition from the UK and other countries, the electronic identification scheme for sheep is now part of the CAP. In her discussions, will the Secretary of State ensure that penalties for non-compliance with this impractical scheme are kept to a minimum, before getting rid of it altogether?

Commons ChamberWhen we took office, we made it a priority from the outset to encourage the food and farming industry to produce more food sustainably and to think in terms of opportunities in emerging markets. Later this month, we will publish in an export action plan the results of our work with the agri-food industry in the intervening months, but there is absolutely no doubt that the emerging markets of Brazil, China, India and Russia, many of which Ministers have now visited, offer our food and drink industry the huge potential to grow its business.
The UK is already a successful exporter of meat and meat products, and that is a fantastic way of increasing employment in farming and food processing. I have recently returned from Kazakhstan, where there is a huge and unmet demand for meat and meat products. What is DEFRA doing to ensure that all potential exporters are supported, and that we promote the quality of British meat throughout the world?

Commons ChamberWhat is required for the pilots is access to 70% of the land, in line with the evidence from the randomised badger culling trial. We need access to 70% of the land. There is no element of compulsion on all landowners in the area, but 70% is needed as part of the limited liability company that a group of farmers would set up.
I draw Members’ attention to my entry in the Register of Members’ Financial Interests. Today—this very day—cattle will be taken from the farm for which I have responsibility to be shot, because they were found to be reactors last week. I welcome the Secretary of State’s courageous announcement following the incisive scientific analysis by David King, but will she also insist that farmers play their part in maximising biosecurity and following all the regulations on testing and movement, too, so that we can maximise the effect of the announcement?
I commiserate with the hon. Gentleman on the loss of those cattle. The front page of the Farm Crisis Network’s report brings home to anyone who has not experienced that what it feels like. One farmer said:
“I feel there is a constant dark cloud of uncertainty over me, causing stress, anxiety and fear.”
I am sure that the hon. Gentleman identifies with him. I assure him that all aspects of the bovine TB package, including strengthening biosecurity measures, will be available. It is a full toolkit to tackle this terrible disease.

I welcome the commitment in the White Paper to tackle water quality on a water catchment area basis. I notice that the Teme, Wye and Severn catchment areas straddle the England-Wales border. I ask the Minister to work closely with Ministers in the Welsh Assembly and other agencies to ensure that water quality is improved as quickly as possible.
I have visited that catchment area and know that there are serious issues to be tackled. We work closely not only with ministerial colleagues in Wales, but with the Environment Agency and the new Countryside Council for Wales. I assure my hon. Friend that cross-border issues will be dealt with to reflect the needs of catchments. We will work with all concerned to ensure that that is successful.

Commons ChamberThe six-day movement rule and the ban on on-farm burial are particularly burdensome to livestock farmers. Since their introduction the scientific understanding of these matters has moved on. Will the Minister commission a scientific review of the regulations with a view to their relaxation?
Both issues appear in the Macdonald report, to which I referred earlier and to which we will be responding early in the new year. The burial of dead animals, in particular, is controlled at EU level, and it is not entirely within this Government’s gift to change the rules.

Commons ChamberI congratulate the hon. Member for North West Durham (Pat Glass) on her contribution. I also congratulate the hon. Member for Wakefield (Mary Creagh) on securing this debate, but this subject does not lend itself to the kind of partisan debate that she was hoping for. Frankly, what we should be doing in this Chamber is forming a cross-party alliance of those who agree with this agenda. There are philistines on both sides of the House who do not agree with it—the climate change deniers and those who believe that environmental policies get in the way of economic development. There are also people on both sides of the Chamber who want to engage in a more consensual debate.
This subject does not lend itself to partisan debate because the political cycle does not match the cycles of the natural environment or the investment timetables that are necessary for the delivery of policies such as renewables programmes and broadband development. To prejudge the success or otherwise of the Government after 18 months, when it is far too early to decide whether the natural environment of the UK is better than it was under the previous Government, is frankly a poor partisan point that does not advance the debate.
My hon. Friend makes an important point about having a cross-party approach to the environment. In the last Parliament, the hon. Member for Ogmore (Huw Irranca-Davies) took two pieces of legislation through the House, the Marine and Coastal Access Act 2009 and the Flood and Water Management Act 2010, that had cross-party consensus and that led to real improvements in the environment.
Absolutely, and I am really grateful to my hon. Friend for making that point. It takes me on to another point that I wish to make, in response to the hon. Member for Scunthorpe (Nic Dakin), who is no longer in his place. He was bemoaning the lack of progress on the draft Groceries Code Adjudicator Bill, which has cross-party support.
I have to declare an interest, as for the past five years I have chaired the grocery market action group. I have been urging and seeking cross-party support for that Bill. When I started out I was entirely on my own, but I am pleased to say that both the previous Labour Government, latterly, and the Conservatives just before the general election came on board and recognised the importance of ensuring that we get fair dealing in the grocery supply chain. Although that is not directly relevant to our debate on the environment today, it is directly relevant to other matters that Members have raised, including recycling. On that issue and others, we should form cross-party support.
In spite of the very limited time that we have, I cannot allow this moment to go by without responding to the hon. Member for Penrith and The Border (Rory Stewart), since he mentioned the great nation of Cornwall and the investment strategy for broadband. It has to be said that there are more than 500,000 people in Cornwall, and its population may not be as dispersed as that of Cumbria. He may well be right that we will be paying Rolls-Royce prices for something that we could be getting a little cheaper, but if the policy is advanced in one rural area, lessons can be learned that will benefit other areas later.

Commons ChamberWe have only recently had sight of these new clauses. The water framework directive, which needs to be in place by 2015, deals with river catchment areas and so rivers such as the Wye and the Severn would have both a Welsh and an English context. Do these new clauses enable these bodies to work better together to achieve the desired outcome?
In large part these measures are designed to make existing flexible arrangements clearer, precisely to make more effective the sort of cross-border work needed in exactly the type of situations to which the hon. Gentleman refers.
As I was saying, the amendments are similar to the current provisions relating to the delegation of Welsh environmental functions in clause 16. The amendments delete those provisions and incorporate them in a slightly revised clause so that the delegation of functions is covered in concurrent clauses.
Amendments 5 and 8 to 11 will extend the definition in clause 1(3) of “eligible persons” to whom the functions of a body or office holder can be transferred under the general order-making powers of the Bill and to whom property can be transferred under clause 24 to include co-operatives, community benefit societies and charitable incorporated organisations. This issue was raised in Committee, not least by my hon. Friend the Member for Dover (Charlie Elphicke), at which point I made a commitment to consider how alternative models such as co-operatives and community benefit societies could be supported to deliver public services, where appropriate. It has always been the intent behind this section of the Bill to ensure that the reform of public bodies is effective by enabling the transfer of functions to a range of persons, so I am therefore pleased to be able to introduce these amendments.
In addition to the provision on co-operatives and community benefit societies, there is now an amendment to include charitable incorporated organisations. Although such charities are yet to come into being since being introduced by the Charities Act 2006, work is well under way and we have taken the opportunity to allow future orders made under the Bill to transfer functions to them. I would like to assure the House that, no matter to whom functions are transferred, it is the Minister’s responsibility to ensure that proper accountability mechanisms are in place, especially where the body is in receipt of public funds.

I listened carefully to the hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart). He is absolutely right that bovine TB is a terrible disease. I, too, have seen some appalling cases. To put the matter into perspective, the last figures I saw showed that 92% of farms are free of bovine TB, so it does not impact on every farm throughout the country. It comes and goes in waves.
My late father-in-law was a small farmer in Cornwall, and he was proud of the fact that there was never TB on his farm, despite it having a badger sett. He claimed that his purchasing policy when he bought in animals kept it free, but even I am not convinced that that was the case. I believe that it was the character of the surrounding area, and the fact that a wide range of farmers had high standards.
The Prime Minister told me in the Liaison Committee a few months ago that he agrees that he should spend more time with his scientific advisers, and I suggest that every Minister should do just that, but I also ask that everyone has basic lessons in how science works because the argument is not black and white. Anyone who presents it as such is wrong. The hon. Gentleman said that vaccination is not that simple. He is absolutely correct. Nothing in the debate is absolutely simple, and I will illustrate the folly of the Minister’s position by using the argument that it is not that simple.
Lord Krebs, a highly respected Cross Bencher in the other place, has reported, as is well known. His view is that the process that the Minister recommends has a serious flaw, and it would be foolish to ignore that view. The question is which of the extreme views is right. I do not believe that the hon. Gentleman was arguing—my hon. Friend the Member for North Tyneside (Mrs Glindon) was certainly not—that TB in badgers should be ignored, and he was not looking for a 100% cull. We must find a way forward. The question is whether the Minister’s free shooting policy can provide that way forward. My contention, based on the Krebs report, is that it cannot.
I apologise for being late, and I declare an interest in that I am responsible for a herd of bovine animals in Wales. That is not the Minister’s responsibility because we are discussing an England-only issue, but it is a herd that has been affected by TB.
The hon. Gentleman referred to Professor Krebs’s contribution, with which I agree. We must take a view on it. Does he agree that there is a balancing view from David King, a former chief scientific adviser to the Government, who carried out an overarching review of all the science, and came to a different conclusion from that of Professor Krebs?
Indeed. That is my point. The argument that the Government are relying on—that the free shooting policy will work—does not have universal support in the scientific community because, as an hon. Member who intervened on my hon. Friend said, it is not possible to measure that realistically. I am glad that colleagues from Wales have intervened, because that is hugely important. The evidence suggests that, to have any effect, a cull would have to take place over a minimum area—the suggested area is 150 sq km—and be conducted for four years. It is estimated that in the first three years, perturbation would be serious. The problem is, unless the policy is nationwide, how to manage the Welsh and Scottish borders, although I suspect that the latter is less relevant. It would be incredibly difficult to do something effective on the Welsh border. Unless we issue badgers with passports and do not allow them to cross the border, there will be a problem.
