Again, I point to the accessibility stats. There was a 68% increase in the number of passengers who needed assistance at stations, so it surely makes sense to free up people who are working behind glass and are unable to provide that assistance—people who may not be as utilised, because fewer passengers are purchasing tickets in that manner. Those people can then go and assist the passengers who need that help the most, which is at the forefront of these changes.

I very much welcome the announcement that Gillingham and Rainham ticket offices will be kept open, and I pay tribute to the fantastic staff in Gillingham and Rainham. Across the board, constituents have raised with me the needs of an ageing population and the elderly. I accept the need for innovation and adaption, but whether it is banking or seeking repeat prescriptions, services are going online, and the elderly are finding it difficult to access face-to-face services. Regarding transport and getting advice and support at public train stations, can the Minister please ensure that face-to-face provision is always available for our elderly residents?

Yes. I thank my hon. Friend for his question. I hope that these changes will lead to more face-to-face interaction, because those who work on the railway and provide such brilliant help, information and reassurance for passengers will be more likely to be in the places where those passengers are located. Southeastern is doing its consultation in stages—the current part is for the metro side of Southeastern, after which it will be rolled out further—but I can give my hon. Friend that assurance.

I thank the hon. Member for her contribution. Doing the right thing gives us heart, does it not? The work of Cats Protection and all the organisations that have campaigned for cats is to be commended, because it is excellent in keeping the issue in the public eye, which is really important.

I pay tribute to the hon. Lady for her work on this issue. I introduced a presentation Bill on the compulsory microchipping of cats, and we are waiting for legislation to come in. I thank the Government for that.

The second part of my Bill was on the issue of reporting after an accident. Of course the great majority of people in our great country would do the right thing, but it comes down to a basic principle: parity of esteem. People love their dogs and cats. We currently have legislation under section 170 of the Road Traffic Act 1988 that covers horses, cattle, asses, mules, sheep, pigs, goats and dogs, but not cats. People in my constituency and throughout the country ask, “Why not?” If the primary objective is to alleviate pain and suffering, we need to make sure we have parity for cats.

It is an honour to serve under your chairmanship, Ms Harris—I genuinely mean that.

It is a pleasure to follow a speech that I did not disagree with a word of. I congratulate Olivia, who is sat in the Gallery. This is probably one of the easiest legislative exercises in the whole of this Parliament: we simply add the word “cat” into legislation and achieve what has been set out in this debate. As much as we all love goats, we should not be differentiating between animals in respect of their value. We differentiate and judge things in this House on their meaning to our fellow citizens. To me, it is utterly bizarre that the law does not take into account cats, considering how many people in this country own cats and how important they are to our fellow citizens.

I hope the Minister, well-known animal lover that he is, will listen to this debate and look into doing something straightforward that will make a lot of people very happy. Although we struggle from time to time in this House, we have the opportunity to do something that will make people extremely happy.

My hon. Friend has made the point clearly that this change is easily done if we consider the purpose behind the legislation. The Government have put forward the argument that one type of animal is a working animal of financial value; does my hon. Friend agree that legislation to require people to stop and report should be designed with regard to the alleviation of pain and suffering, irrespective of what animal it is? That ties into the Government’s commitment to animal welfare. We can move forward and do the right thing. Does he agree that that principle needs to be behind the legislation?

I am probably going to agree with everything that everybody says in this debate. My hon. Friend makes a very articulate point. If it is the Government’s position that the change is not enforceable—in the sense that stopping and reporting if a car hits a cat is somehow not an enforceable legal responsibility compared with hitting another animal—I just do not accept that. In my view, there is not a logical argument in respect of the criminal-law side of this issue. I was a criminal lawyer for a long time and it is a straightforward matter to enforce reporting. There is no ambiguity.

Let me speak to and develop some of the points colleagues have made about criminal law, and what happens afterwards. I recognise Members present who have listened to what I have had to say at least two or three times previously. I think I am on my third or fourth time of trying to persuade the Government about my private Member’s Bill. I have not been successful yet, but I continue to live in hope. My nattily titled Pets (Microchips) Bill relates to Gizmo’s law, the campaign for which was begun many years ago by Heléna Abrahams in my constituency. In essence, the proposed law would do what has been articulated in this debate. It is a campaign for a legal requirement, which sounds like a grand statement, but it basically asks local authorities to do the right thing.

When a deceased cat is found, whether on the highway or elsewhere, the proposed law would require the local authority to scan the chip, if there is one—that relates to the point that my hon. Friend the Member for Gillingham and Rainham (Rehman Chishti) made about the Government’s commitment to the microchipping of cats, which would clearly help. It is a simple thing. People want to know what has happened to their pet—what has happened to their cats. I spoke today to Heléna, who works 20 hours a day in her job. She has set up a website for this purpose and works with local authorities to reunite cats with their owners. That is a wonderful thing to do, because it is about love, care, commitment and doing something for people who have no other way of finding out what has happened.

As the hon. Member for Gower (Tonia Antoniazzi) said, local authorities approach this matter very differently. Some just do not scan and do not make any effort whatever—I will not name and shame them—and some are better. We are simply asking for there to be a duty to take the cat and scan it. A pet food company has agreed to provide scanners for every local authority in the country that does not have one, so there is no cost to that. All they need is a fridge or deep freezer. The cost and time involved is absolutely negligible. There is no cost.

My Pets (Microchips) Bill and Olivia’s proposal are about care, love and doing the right thing. We sometimes miss those things in our debates in this House. This is very simple and straightforward. An amendment could quite easily be made to criminal law and could quite easily be enforceable. We can certainly trust our police and other law enforcement bodies to ensure that cats have parity of treatment with other animals, and we can legislate for that. On Gizmo’s law, I hope Members will support the Pets (Microchips) Bill, which would cost nothing but would do a lot of public good and make a difference to a lot of people’s lives.

It is a pleasure to serve under your chairpersonship, Ms Harris. I thank the Petitions Committee for allowing this important debate, which will be closely followed by many of our constituents. I also thank all Members who have contributed; they have all made extremely relevant points. I particularly thank my hon. Friend the Member for Gower (Tonia Antoniazzi), who eloquently explained the issue, and Olivia, who some time ago started the petition, which 102,000 people have signed.

We are a country of cat lovers. I have had cats since I was a toddler and have gone through very many. I have been in the position where my cat has gone missing and we did not know what had happened to her, even though we scoured the streets and she was chipped. I only found out what had happened a few years later, by accident, when I was at the vet’s with another cat, and the woman I was sitting next to, who lived near me, could remember seeing my missing cat dead on the roadside. It took me a bit of time to get to the bottom of it, but, like most people when their cat does not come home, I eventually came to the conclusion that it had come to harm. As an animal lover, I know the pain caused by losing a pet.

Believe it or not, one day I found a cat behind my bin. I took it to the vet and had it scanned, but unfortunately it did not have a microchip. I eventually managed to rehouse it with another member of my family, as I already had three by then and had been told I could not have any more. If that cat had had a chip—if it had been compulsory for it to be chipped—we very likely would have been able to return it to its owner instead of having to rehouse it, albeit with a very nice family.

Under rule 286 of the highway code, drivers involved in an accident involving a domestic pet are advised to make inquiries to find the owner. However, the wording of the rule is quite vague and covers a wide range of driving incidents. It is time to change that and include cats. It is true that many owners ensure their beloved cats are microchipped, but it should be legislated for. Will the Minister look into updating the legislation to ensure that drivers are aware of what to do if they collide with a cat? The vast majority of drivers would want to do the right thing in such situations, but the highway code offers little in the way of guidance.

My hon. Friend the Member for Gower mentioned the local authority resources that will be needed if they are to take on the responsibility of scanning animals and informing owners of the fate of their cats. I thank Cats Protection, which has done so much work to talk to people about the issue and raise owners’ awareness.

The point about local authorities needing resources for scanning absolutely needs to be looked at, but my hon. Friend the Member for Bury North (James Daly) mentioned the principle that local authorities should scan deceased cats so that they can be identified. How that is done across the country is a different matter, but the principle is that all deceased cats should be scanned so that they can be reunited with their loved ones; that is the change required, so that there is consistency and not a postcode lottery around the country.

I totally agree with the hon. Member’s sentiment that it should be put into legislation that it is compulsory for all cats to be scanned. That is the only way they can be identified.

I wonder how we can get around the problem about which we heard earlier—that 70% of cats who are scanned have not been registered with the microchipping company. The Government and the House should look at ways of encouraging registration or of doing microchipping differently, to ensure that it is not a waste of time or money. We must ensure that microchipping means that cats will be reunited with their owners, or that their owners will be informed of what has happened to them.

I was a little disappointed that, in their response to the petition, the Government say that they want to make roads safe for everyone. The reality is often quite different: road safety targets are non-existent; the road safety strategic framework has been delayed; and highway maintenance funding has been cut. After four decades of progress in reducing in road fatalities, since 2010 the numbers have plateaued. The Government are dragging their feet on measures to protect road users—human and feline alike.

We all know about the enormous pressures facing local authorities, and the cost of living crisis means that scarce resources are rightly focused on supporting struggling households. However, that means that if we are to be serious about this issue, additional resources for road safety, and particularly scanning, should be given to local authorities so that they can carry out the vital job of identifying cats and informing cat owners of what has happened. For that to work, there has to be some resource attached.

While we have the Minister here, I want to ask when his Department will publish the long-awaited road safety strategy framework. It would be good to see something about animal welfare in that, because it is so important to our constituents. I am also somewhat disappointed by the Government’s wider record on protecting animals, which seems to be one of delays and broken promises. Where is the ban on keeping primates as pets? Where is the action to tackle puppy smuggling? Where is the ban on fur imports? Those measures all have overwhelming public support, but this Government have been dragging their feet on all of them for too long.

I hope that the Minister will carefully consider all the points raised by Members today. The motivation behind the petition is one we all share: for beloved family pets to be better protected. We do not need more empty promises that are destined to be dropped or kicked into the long grass; we need the Government finally to take the wheel and deliver real progress to improve road safety for all users of any species, including cats. In particular, we need the Government to amend the Road Traffic Act 1988—I hope that they can do so by statutory instrument—so that no one has to wonder what has happened to their beloved cat, and that cats have the same protection as other animals.

It is an absolute pleasure to serve under your chairmanship, Ms Harris. As the hon. Member for Gower (Tonia Antoniazzi) pointed out, Britain is a nation of animal lovers, and Members on both sides have made heartfelt speeches. I want to acknowledge the work of my hon. Friend the Member for Bury North (James Daly), who has had to leave early, on Gizmo’s law and the private Member’s Bill that he introduced. I am grateful to Members who have spoken in this debate on the subject of making it a legal requirement for drivers to stop and report collisions with cats. I also thank Olivia, and the thousands of people across the country who signed the petition that brings us here.

As a Back Bencher, I spoke out in support of microchipping in Westminster Hall less than two years ago. I reassure right hon. and hon. Members that the Government take road safety extremely seriously; it is at the core of the Department’s agenda, and any death or serious injury on our roads is unacceptable. Our deepest condolences go out to the victims of road traffic incidents and their families. A focus of the Government is to make roads safer for all users; that will in turn help reduce the risk to all animals on them. We must all be clear about the heartbreak that the loss of pets—particularly cats, as we have discussed—cause people. For many, it is like losing a family member, as my hon. Friend the Member for South East Cornwall (Mrs Murray) said. Other Members reflected on how, during the pandemic, in what was a particularly difficult time, pets, especially cats and dogs, were particularly important to people’s mental health and physical wellbeing.

The Department is working on the road safety strategic framework, which—to give the hon. Member for Sheffield, Brightside and Hillsborough (Gill Furniss) some assurance —we hope to publish in spring this year. That framework will be based on a safe system approach, and we are considering what supporting indicators on casualty reduction might be appropriate. The key principle in a safe system approach is to recognise that people make mistakes and things can go wrong. The approach accepts that responsibility is shared, and that collisions can be the result of a combination of factors that can be mitigated. The road safety strategic framework provides the instruction needed to deliver a safe system approach effectively and efficiently. That approach has been accepted in many other sectors, including health and safety and public health. It is already adopted as best practice in other countries that have gone on to make further significant reductions in road deaths and casualties. While Britain has some of the safest roads in the world, we can always do more, and we intend to do just that.

Let me quickly address an issue raised by the hon. Members for Streatham (Bell Ribeiro-Addy), and for Sheffield, Brightside and Hillsborough: I have been advised by officials that primary legislation, and not a simple statutory instrument, would be required to change the law in this area. However, if that does not prove to be the case, I will write to both hon. Members to clarify further.

On stopping and reporting after an accident, is the Minister saying that the road safety review will specifically look at what parliamentarians have said today about adding cats to section 170 of the Road Traffic Act 1988? At the moment, it is not clear whether it will.

I am most grateful to the Minister for clarifying that the question will be taken back to the Department. The Prime Minister said in his speech in January that the Government would look at doing things differently—at innovation, and at trying new ideas. Will the Minister look at amending the legislation, so that it does not simply deal with the value of the animal or whether it is wildlife, and so that its aim is to alleviate pain and suffering and ensure parity? That would be in line with the Prime Minister’s commitment, and with what has been said today.

I thank my hon. Friend for bringing that issue forward. It is an important issue, and I will take it back to the Department and write to him about it.

As I have been saying, we are looking at the holistic, best-practice approach that has been adopted in other countries, and that we have adopted for public health and health and safety legislation, in order to both minimise the impact of road traffic accidents on humans, and prevent further injury and accidents involving animals. For example, not that long ago, when I was in the Department as a special adviser, we brought forward some road signage designed to protect small mammals. The change is something that the Government are prepared to look at, but as I have said, primary legislation would be required.

I would like to speak more broadly on this issue, because Members have brought up different aspects of the legislation, including microchipping, which I would like to touch on.

I absolutely take on board the hon. Gentleman’s point. Of course Manchester airport is a great success story, and a great international success story. I have been working with the airport management to help it expand its expertise internationally and will continue to do that.

What I would say to reassure the hon. Gentleman is that, as he will be aware, the Infrastructure and Projects Authority has indicated that the region of the country that will secure the highest proportion of Government spending on transport in the next few years is the north-west. That is right and proper—a sign of our continuing commitment to deliver improvements in the north of this country that are long, long overdue.

The Secretary of State is absolutely right: Members of Parliament have a duty to stand up for their constituents, and I will do just that. Can he confirm that the expansion of Heathrow puts an end to the daft estuary airport idea, and that the long-term provision of air capacity needs can be met at Gatwick?

The Airports Commission looked very carefully at the estuary airport concept, concluded that it was not viable and made this recommendation. I see no way how, off the back of an expanded Heathrow, an estuary airport would become a viable option, so I reassure my hon. Friend on that point.

In answer to the point made by the shadow Secretary of State, the hon. Member for Middlesbrough (Andy McDonald), that this measure has been pushed by the Labour Opposition, I say that success has many fathers and failure has none. I refer him to my private Member’s Bill of 2016, on the regulation of sales, ownership and illegal use of laser pens. The Bill was intended to make

“the sale, ownership and use of portable laser emitting devices with output power of more than 1 milliwatt unlawful in certain circumstances; and for connected purposes.”

At that time, having looked at the matter since 2014, I was grateful to the then Lord Chancellor, my right hon. Friend the Member for Surrey Heath (Michael Gove), and to my hon. Friend the Member for Scarborough and Whitby (Mr Goodwill), whom it is a pleasure to follow today. During that time, he was a Transport Minister and then a Home Office Minister, and I had discussions with him about addressing the misuse of laser pens. More recently, I have had discussions with Business Ministers, because the issue of the misuse of lasers goes across the Department for Business, Energy and Industrial Strategy, the Department for Transport and the Ministry of Defence. I have therefore spoken to and worked with a raft of Ministers to find a coherent strategy to address the misuse of laser pens.

My hon. Friend did indeed make those representations, which helped shape Government thinking. To add to the list of Departments involved in this work, I know that he would not want to miss out the Home Office. The Home Office has been engaged in this matter because, sadly, there is the potential for terrorists to take advantage of these simple devices with catastrophic consequences.

I am most grateful to my right hon. Friend, who is absolutely right. I did make representations to him and had discussions with Home Office Ministers. Lastly, I want to thank the current Secretary of State for Transport for the time he gave me and for fully taking on board my concerns.

I of course welcome what is proposed in the Bill. When certain individuals are recklessly misusing laser pens, we want to ensure that the legislation is clear so that the police and our Crown Prosecution Service can prosecute them, and the previous legislation, the Air Navigation Order 2009, did not provide that clarity. According to the Civil Aviation Authority’s figures, there were 20 recorded incidents in 2005 and 746 in 2009. In 2010, there were 1,500. In 2011, there were 1,912, and in 2012 the number was 1,571. If we compare that with the number of convictions under article 222 of the Air Navigation Order, we see that there were only 26 convictions from 1,500 recorded incidents in 2010. In 2011, when 1,912 incidents were recorded by the CAA, there were 48 convictions. In 2014, the number of convictions was 18, but there were 1,447 incidents. It is quite clear that the legislation to address, deter and bring to account those responsible for the misuse of lasers—those who take part in this reckless activity—did not have the necessary and desired effect.

The Bill, which will make the offence one of strict liability, meaning that the prosecution is not required to show intention, is absolutely right and proper. We need legislation to have the right deterrent effect, so the punishment needs to be commensurate with the seriousness of the office. Previously there was only a financial penalty, which was not the right way forward. Under the new measures, the penalties have been increased to include both financial penalties and a sentence of up to five years, which most certainly is the right way forward.

A body that has not been referred to yet is the parliamentary advisory council for transport safety, which wrote to me on 19 April 2016. Its letter reads:

“On behalf of the Parliamentary Advisory Council for Transport Safety (All-Party Parliamentary Group), I am writing with regards to your recent Private Member’s Bill on the use of laser pens.

Between 2009 and 2015, the Civil Aviation Authority recorded seventeen reports of laser pen attacks affecting air traffic control towers in the UK.”

That point is now being addressed in clause 2—clause 1 addresses the need for clarity in legislation by making the offence one of strict liability—and I am grateful that the Secretary of State has taken on board PACTS’s representations about infrastructure. It is a wonderful organisation and does excellent work to make transport safe for everyone.

Colleagues from across the House have referred to BALPA, which is an absolutely superb organisation. It wrote to me on 14 April 2016 and said:

“On behalf of Britain’s 10,000 airline pilots I am pleased to offer BALPA’s support to you in respect of your bill to regulate the sale, ownership and usage of laser pens.”

The letter goes on to make a point that many people out there will be familiar with, which needs to be made again. It states:

“The issue has become especially important in recent months with the attack on a Virgin Atlantic aircraft which resulted in the First Officer feeling unwell and having to return to base.”

We saw the reports in the media at the time. Any one of us could have been travelling on that plane, and we have citizens who use planes on a daily basis to travel between different parts of the world or internally within the United Kingdom.

For a long time, the legislation was not fit to address this menace, and it is right and proper that we see support coming from the Scottish National party, from Labour and from the Conservative party, all working together. At the end of the day, we all have a fundamental duty to protect our citizens. Safety in transport is absolutely vital, and the Bill helps to address that. On that point, I thank BALPA and our pilots for what they do. They are exposed to risks, but they still do a brilliant job. I cannot read out BALPA’s letter in full, but I am more than happy to share it with colleagues.

I am also grateful to London City Airport, which wrote to me on 18 October 2017 in support of the proposals to address the misuse of laser pens and with its own suggestions. One additional point that it raised was as follows:

“Another solution is to create a licensing system where an importer, retailer or consumer must obtain a licence especially for high-powered laser pointers. This will allow the Government to maintain a register of sellers and users. The licence can include a criteria relating to training or insurance, thus improving the users’ awareness of the safe use of laser pointers.”

Although this is not in the Bill, I am pleased that, following my representations to the Minister for Digital and the Creative Industries and other colleagues, in January the Government announced new measures to tackle the sale of unsafe laser pointers. My 2016 private Member’s Bill would have addressed the sale of laser pens over a certain output.

First, I welcome the Government’s announcement in January—no doubt the Minister will comment further on it—that they will strengthen safeguards to stop high-powered lasers entering the country, which is absolutely right and proper. As the hon. Member for Kilmarnock and Loudoun (Alan Brown) said, certain laser pointers of exceptionally high power have no legitimate purpose but are easily accessible in the United Kingdom and on the internet.

Secondly, the Government announced additional support to local authorities, ports and border teams to stop high-powered laser pointers entering the United Kingdom. Thirdly, they announced that they would work with manufacturers and retailers to improve laser pointer labelling. The Government have also looked at better policing of laser pointer sales by working with online sellers such as eBay. The problem is the same as with the purchasing of knives on the internet. We have to regulate the purchasing of laser pointers online.

Finally, the Government announced awareness raising of the risks associated with laser pointers, particularly among children, given that many do not know the dangers. We need to get the legislation right and, linked to that, we need to address the use of certain laser pens.

It would not be fair of me if I were not also to thank Heathrow Airport, which wrote to me on 4 October 2017 in support of my private Member’s Bill. The final paragraph of the letter said:

“We would welcome any improvements to the regulation governing the sale, ownership and use high powered laser pointers, such that only the legitimate sale, ownership and use of such devices is permitted. We would also support any improvements to the Air Navigation Order (2016) which make it easier for the police to enforce the legislation”.

That, to a certain extent, is covered by clause 1.

Finally, I refer back to the representations from London City Airport, and I hope the Minister will take this point forward. When I tried to obtain information on the number of incidents there had been, the difficulty I had in trying to find out the number of convictions under different categories of the Air Navigation Orders is that the Crown Prosecution Service does not keep a record of that. The numbers I gave earlier therefore related to article 222 of the Air Navigation Order 2009. The letter from London City Airport therefore said:

“However, I believe a more informed approach based on better data-sharing between the Metropolitan Police, the Government, CAA and…airports will bring transparency and clarity on the scale of the problem. This will allow the Government to implement solutions accordingly.”

That would ensure that all the different organisations were working together, and it would ensure transparency of the data that was available.

I have been looking at this matter since 2014 and—this is not often mentioned—I would not have been able to get a lot of the data, research and freedom of information requests if not for my brilliant researcher Barry Watts, who no longer works for me after four years in Parliament. He has now gone on to do other things, but the research we have is down to our brilliant researchers. I thank every colleague in Parliament, including some former Ministers who have spoken today, because whenever I met them, they were absolutely brilliant in understanding that very point.

We have talked about issues with regard to airports, aeroplanes, infrastructure and railways, but in 2016 the defence air safety occurrence report recorded 250 laser-related incidents in the UK in the past five years that put our amazing, wonderful military personnel, and their work, in danger. Concerns have been raised across the spectrum, and the Bill is the right way forward, but I also ask the Minister to look at how it works over the coming years. If the Bill needs to be reviewed, and if further measures need to be taken, I ask her to work with the organisations involved to see how things can be further improved.

I thank the Minister and her team for listening and for taking on board the representations that have been made to me.

The important thing about Cardiff Central station is that there is huge development taking place around the station. I have met the developers and local politicians, and I want to see there what I want in other parts of the rail network, which is a real integration of station development with commercial development. That should be an absolutely integral part of what is happening all around the station, not just in the station project in its own right, and that is what I want to happen.

Given the impressive growth and regeneration that Medway has seen over the past 20 years and will continue to see, I thank the Government for the £6 billion lower Thames crossing. Will the Minister confirm that the supporting local highways infrastructure programme will go along with the project so that areas such as Medway can fully benefit?

As my hon. Friend will be aware, the lower Thames crossing is a transformational strategic road project with enormous benefits to Medway and to the region as a whole. We announced the preferred route last year, and we are now developing it further. On the local transport side, it is worth noting that the South East local enterprise partnership has secured nearly £600 million of funding from local growth funds, supporting around 30 transport schemes in Kent and Medway, in order to support the area’s continued economic growth.

From what I have read in the newspapers, I suspect that there may be attempts to challenge the decision. However, such court cases usually hang on whether we have given a decision careful consideration. We have looked at the matter exhaustively and considered all the issues. We understand the challenges and the hurdles that we have to overcome. This is a rational, measured, thought-out decision about what is in our country’s best interests. Our elected Government are there to take such decisions and I hope that the courts will not seek to challenge that.

I welcome the Secretary of State’s statement. It showed respect for the work of the independent Davies commission, which had already rejected the bizarre, pie-in-the-sky idea of an estuary airport due to delivery, structural and environmental concerns. I thank the Secretary of State for making the right decision on the basis of the evidence and in the national interest.

I am grateful to my hon. Friend for his comments. The commission did a first-rate job of looking at all possible options, including the concept of an estuary airport. It came out with a clear view in the end. Sir Howard Davies recently emphasised his strong commitment to his commission’s recommendation. When Governments set up independent commissions and ask them to make recommendations, they should listen carefully; that is what we have done.

Following my conversation with the Secretary of State for Justice, I tabled a private Member’s Bill to prohibit certain high-powered laser pens. Will my right hon. Friend speak to the Secretary of State for Justice to see whether the Bill can be taken forward? As the hon. Member for Leeds North West (Greg Mulholland) says, access to certain types of laser pens needs to be controlled.

It is a pleasure to be here under your chairmanship, Mr Evans. I pay tribute to the hon. Member for Eltham (Clive Efford) for calling this important debate. I stand here as the representative of two communities—the one that relies on and is tortured by the Tonbridge line, and the one that is tortured by the Maidstone East line. On their behalf I voice my displeasure at Southeastern’s woeful performance, not just in the past three months, which—let us face it—have been particularly awful, but in the 10 months for which I have represented my constituents, and indeed many years before that.

I have had the great privilege of meeting some people from Southeastern, and only this week I heard that they believed they were still meeting their franchise targets. I do not know quite to the smallest detail how the franchise targets are met, but if their belief is correct it tells me something simple—that the franchise targets are wrong. It cannot be right that one in five trains is coming in late, leaving workers late for meetings, leaving families without a father or mother at home for dinner, and forcing people to change plans—and that that is still somehow acceptable in relation to meeting targets.

I share my hon. Friend’s concern about Southeastern’s performance. I have travelled by train for the past 15 years, but now, as a Member of Parliament, I do so every day; and it is the regular day in, day out delay, even if it is a few minutes, that means a lot to my constituents. If Southeastern cannot perform it should do as c2c does. After two minutes, if there is a delay, there should be automatic compensation for constituents.

It is a pleasure to serve under your chairmanship, Mr Evans. I do not want to repeat the points that have been made today but rather touch in my remarks on three particular issues that affect my constituents: the overcrowding of carriages; the reliability of the service; and the poor communication from Southeastern about the delays and overcrowding.

I congratulate my hon. Friend the Member for Eltham (Clive Efford) on securing this vital debate. As other hon. Members have said, Southeastern trains and the lines that run through our constituencies are vital not only for getting our constituents to work and bringing economic benefits—with delays causing a loss of productivity—but for people’s general quality of life. There is a historical under-investment in public transport in south-east London. My constituents rely heavily on these lines and have suffered for too many years. We know the particular problems associated with the London Bridge rebuild, but as other hon. Members have said, this issue predates that and has got far worse since Christmas.

I now receive complaints about late, cancelled or overcrowded Southeastern train services nearly every day. As a commuter, I know just how frustrating not only major disruptions but the disruptions and delays that happen every single day can be. Whether it is two minutes here or five minutes there, it is often without explanation and causes immense frustration to the people waiting, who cannot get adequate compensation and are not regularly notified. The 7.39 train this morning from Deptford was cancelled without explanation, forcing people on to other lines or tube lines such as the Jubilee line which are already crowded.

The hon. Gentleman echoes a point I have made before. If there are constant daily delays, and if Southeastern cannot get its act together—whether that is through trains with more carriages or ensuring that trains run on time—it should surely give up the franchise to someone who can do it.

I think that Southeastern has lost the chance it had to restore faith and confidence in its service. The franchise should be removed. I would like to hear the Minister’s view on whether that should happen now or in 2018, when the contract lapses. However, Southeastern has lost the opportunity to recover that confidence.

The complaints and the frustration have given rise to a number of community groups in my constituency. I think of the Charlton Rail Users’ Group and the Greenwich Line Users’ Group, which exist solely to represent constituents’ concerns about the inadequate performance of Southeastern and to lobby for better services. Those groups are concerned with the three elements I mentioned.

The first element is overcrowded carriages. In late 2014, as a local councillor, I met the then managing director of Southeastern trains with my predecessor, the right hon. Nick Raynsford. We were promised that there would be 12-car trains by January 2015 on the Greenwich line. They did not materialise. I believe that that was because they were put on the Lewisham line, which if anything is more pressured in terms of capacity constraints. It is essential that we get those 12-car carriages, because on many occasions at the moment we do not even have 10-car carriages; as my hon. Friend the Member for Eltham said, they are often carriages with eight cars or even less.

Southeastern, to give it its due, has squeezed out as much as it perhaps can in terms of enhancements via changes to the timetable. It now comes down to a question of rolling stock. There has been a delay in the Government’s announcement on rolling stock. I will be interested to hear whether the Minister can shed any light on what may be coming forward, in particular for the Greenwich line.

It is indicative of how Southeastern has planned the improvements to its services that even if we get those 12-car trains, some of the stations on the Greenwich line in my constituency, such as Woolwich Dockyard, will not be able to have those trains stopping at the station because the station has not been fitted in a way that allows 12-car trains to stop, or if the trains are able to stop, it will be with selective door operating to allow people to get on and off at those stations. I would like some assurance that if 12-car trains do come online, the people who will be put out by that problem will get fair compensation if they have to travel onwards to another station, such as Woolwich Arsenal.

I turn to service reliability, which, as Members have said, is extremely poor on these lines. By the magic of social media, I asked my constituents if they had any thoughts or comments in advance of this debate. I asked them to keep it clean, which reduced the number of responses. You could not make up some of the responses I got back. One gentleman told me that the 6.01 pm train yesterday on the Greenwich line was delayed for 30 minutes because of problems with the announcement system; passengers learn that from the driver via the announcement system. That is quite a common example of the bizarre things that happen. I was once on a train that had to stop and wait outside London Bridge because the sun was in the driver’s eyes. That sort of service just irritates people, frankly, when they are paying a lot of money for their train journeys.

I will finish on poor communication. I made the case long in advance of the London Bridge rebuild that communication about the disruption that would take place because of the Thameslink programme was inadequate. My constituents still regularly think that the Charing Cross line is going to be restored on the Greenwich line; it is not. I think there are good reasons why it should not be, in terms of increased frequency of trains and reliability, but some of my constituents do not know that. Communication in general is poor and needs to improve.

Turning to the future, I fully support the removal of the Southeastern franchise. There is a good case for Transport for London taking over these services in partnership with the Mayor. The way that that potential deal was announced a few weeks back was rather shabby and got mixed up with the election campaign, but there is general cross-party consensus on that. Some of us have been campaigning on it for a long time. We need to scrutinise that deal. In particular, we need assurances that in the years left to the Southeastern franchise up to 2018 it will not be allowed to let performance slip even further. It has an incentive, as part of the service groups, to perhaps bid for elements of Transport for London’s services once it is taken over in 2018. However, we need to know how Southeastern can be pressed in the years ahead, if it is going to lose its contract, to not let performance slip even further. I will be interested to hear the Minister’s views on that.

I will try to be brief and keep to your advised timing, Mr Evans.

I congratulate the hon. Member for Eltham (Clive Efford) on securing the debate and thank him for asking many important questions about infrastructure, compensation and penalties.

Like my hon. Friend the Member for Tonbridge and Malling (Tom Tugendhat), since becoming a Member of Parliament last May I have received a steady flow of complaints about the problems with Southeastern rail services on the line that goes through Maidstone East in particular, and on the lines from Faversham and Headcorn. Since Christmas, however, that flow of complaints has accelerated, reflecting a substantial deceleration in the train services and their reliability. Regular weekly complaints from people have now become daily complaints, as day in, day out, their trains to and from work are delayed, and not just by two or three minutes, which is irritating and causes difficulties for people, but often by half an hour or an hour, with train cancellations, too. Many major events have also completely kyboshed the services for hours.

Other hon. Members have shared the data so I will not go through those again now, but as my hon. Friend said, we are now seeing about one in five trains running late. What the averaging of the data obscures is how often it is the same train that somebody is delayed on, day after day, and how very often they are the peak-time trains. That is not to say that other trains do not need to be on time, but we know that people on peak-time trains are rushing to get to and from work and to get to meetings, appointments and other commitments. The statistics mean that people’s lives are being affected badly by this experience of the train service. They are unable to be as effective at work and are missing meetings. They have to leave earlier and get home later, which is affecting their family life. Parents are unable to get home to put children to bed. All these things that people build their lives around and make decisions about are being affected so seriously by the problems with the train services at the moment.

My hon. Friend is making a very powerful point about the delays and what they mean for people’s lives. Linked to that point is the fact that if somebody gets to the station and their train is delayed, when they do get on a train, it is packed. They cannot even get a seat, so it is also about the conditions they face. The argument to be made to the Minister and Southeastern is that there should be the extra carriage. I see that from Victoria to Gillingham on a daily basis. Capacity is a key issue, along with delays.

I appreciate that Southeastern and Network Rail have made some effort to communicate with Members such as me, who have been in frequent contact with them, urging them to give us explanations. They have told us about the problem at Dover with the sea wall coming down and how that has made things more difficult for them. They have told us about landslips because of the extra rail, signalling problems with the upgrades and problems with de-icing. The Minister may well cover that in more detail. We understand that it is not always easy to provide a good service and that things happen, but still, that is not good enough. We also appreciate that they are making efforts to improve the services, with extra drivers, more engineers and de-icing at milder temperatures. Those are steps in the right direction, but still, I am afraid that I do not have confidence on behalf of my constituents that these services are going to improve sufficiently to provide a reliable and acceptable level of service.

I say that having directly asked Southeastern and Network Rail just a couple of days ago, face to face, how good the service was going to be as a result of the changes they are making. They were unable to say. They were unable to say even what improvement they are aiming to achieve as a result of the changes. There was a bit of a shrug of the shoulders—“We’re trying”—and that is not just not good enough. Along with their warning that the problems with the sea wall at Dover might continue through to the end of this year and with London Bridge work continuing through all of next year, this will drag on for two years at best. My constituents need to know that they will get a better service within that time.

As my hon. Friend the Member for Tonbridge and Malling said, we also found it bizarre that, given all that is going on with the service—I appreciate that both Southeastern and Network Rail are involved, although that answer is not acceptable to passengers—we are told by Southeastern that it is compliant with its franchise. That suggests that something simply is not right with the way in which it is held to account.

Along with solutions to the short-term problems, we need to start seeing some plans for better service beyond the next couple of years. We are seeing enormous population growth across Kent—my constituency is part of that—and there is infrastructure there that is often 50 or more than 100 years old. It is simply not fit for the level of use that it is getting.

Although we have had High Speed 1, for my constituents that is largely a myth. They sometimes get trains that are called “high speed”, but after a short stretch of going at high speed, the trains just clunk along on the old infrastructure and are scarcely faster than the ordinary service, although they are more expensive. The high-speed service simply bypasses most of my constituents who commute on the Maidstone East line. Other parts of the country are getting High Speed 2, Crossrail and great investment. Given all this population growth and with the economy being so dependent on the productivity of all these people—their quality of life is an issue as well—we need to know that there is material investment coming down the line, no pun intended, in the train infrastructure, so that beyond the short-term problems, we will see an improvement in quality.

Will the Minister say what she is going to do to make sure that Network Rail and Southeastern get on top of the problems in the short term? We cannot let them continue all year and next year. We need to ensure better transparency for passengers so that they also know what is going on with performance. We need better communication and to know such things as the level of compensation that is paid out, as well as make sure that it is easy for passengers to get it. When possible, compensation should be automated.

I share the concerns expressed by my hon. Friend the Member for Bexhill and Battle (Huw Merriman) that although it feels as though nothing could be worse than it is now, if the franchise for the suburban lines goes to Transport for London, we must not see passengers further out lose out as a result. Finally, I would like the Minister to provide reassurance that work is being done on how to improve the service further out, given the population growth. We know that London Bridge is being refurbished —trains from my constituency do not go into London Bridge—but there is no confidence that that will be a magical improvement, so what is going to be done further out to improve the performance, reliability, speed and quality of the services for my constituents?

We are making good progress on implementing smart ticketing across transport modes and across England. On railways, some train operators are already using smartcard and barcode technology; all our major cities have smart ticketing schemes; and we have committed £150 million to support the vision of “Oyster for the north”.

The Minister will know that I have raised the issue of automatic refunds before and campaigned for their introduction in Kent, so that my constituents can benefit from refunds when their trains are delayed by a few minutes instead of the current 30 minutes. When will this scheme be introduced nationally?

First, I commend my hon. Friend for consistently promoting the interests of his travelling constituents. He may be aware that from next February, c2c, which runs trains throughout his neighbouring county in south Essex, is introducing an automatic compensation system, which will provide compensation after two minutes of delay for those customers who are registered and signed up to its system. That is exactly the sort of scheme I want to see nationally, so we will closely monitor the roll-out of this programme to see whether it can be rolled out across other franchises.

In the deal we got in October, we got our ports excluded from the majority of this unwelcome, unnecessary and undesirable regulation, and on other matters not included in that exemption we agreed that this House should make the decision. On Monday 17 November I announced £25 million to support community transport providers, and that fund will provide hundreds of new minibuses to community transport operators in rural and isolated areas. Those groups help keep rural communities alive and independent, and it is vital to do all we can to support local voluntary operators in those areas.

One reason why c2c’s franchise was awarded is that it came forward with imaginative schemes. What my hon. Friend has outlined is an important development on that commuter route, and I look to improve services across the whole of rail franchising.
