Commons ChamberDoes the Secretary of State agree that we have already had a vote, and that was on 23 June last year? The British people decided to leave the European Union. Does he agree that one of the things we can now look forward to is being able to do trade deals with a number of countries throughout the world, which we are now constrained from doing as members of the European Union?
My hon. Friend makes exactly the right point: we are able to make trade deals once we leave the European Union, and that will give us enormous benefits, because as the European Commission itself admits, 90% of world trade will be outside the EU, not within it, in the coming decades.

Commons ChamberI hear what the hon. Gentleman says. As I have said before, these issues are serious and important, and people hold their views passionately and with good reason, but the simple truth is that the Government have been very plain about what they intend. They intend to guarantee the rights of both British and European citizens and they will do so as quickly as possible.
I am delighted to hear what my right hon. Friend has had to say about prioritising the negotiations as far as EU and British citizens are concerned. He has said that the negotiations could take up to two years, but there is no reason at all why an agreement on those citizens should not come a lot earlier. Will he give a guarantee that, once an agreement is reached, it will be made public to put out of their misery all the people who are going through this trauma at this moment in time?
My hon. Friend makes a good point. It may well be that we need treaty change to put in law the guarantees that we want in place, but I aim to get all the member states, the Commission and the Council to commit—even if it is in an exchange of letters—so that everyone knows what their rights are and what their rights will be, which, therefore, deals with the issue that has quite properly been raised: people being afraid of things they should not be afraid of.
I thank my hon. and learned Friend for raising that point, which is important. Many of us have listened to EU nationals, who contribute so much financially and culturally and who would be a loss to this country—to the whole of the UK. Therefore, I am not sure why the Government cannot give us what we seek.
As the hon. Gentleman knows, I feel very passionate about the fact that EU citizens living in the United Kingdom should be allowed to continue doing so; they add so much to our economy and culture, and it would be a human tragedy if they were forced to leave. However, I suspect that hundreds of thousands of Scottish people are living in other EU countries. Does he not believe that they too ought to be given the same guarantee at exactly the same time?

Commons ChamberIt is to create a customs agreement; it is in order to enable us to develop free trade agreements with that huge portion of the world where there is very fast growth and we have a strong market presence. Some 40% of our trade, or as much as we have with the EU, is with areas where we do not have free trade agreements. So this is a very large area and it is growing, sometimes twice as fast as the EU is. We are taking this approach for the future opportunities. People often talk about the implications of the referendum for young people, but the biggest implication is the prospect of jobs in the future, many of which will come from global markets, not just European ones.
A lot of the politicians in EU states say that they are against torture, but do they not recognise that the fact that they are not willing to come to a deal with my right hon. Friend about EU citizens being allowed to stay, live and work here and British citizens being allowed to stay, live and work in the EU countries is a form of mental torture and trauma that they are perpetrating upon them? Will he redouble his efforts to get this deal done as quickly as possible and to make the announcement as quickly as possible? If only one or two countries are holding out, for whatever reason, will he be prepared to name and shame them, so that their citizens here can bring pressure upon them to get that deal done?
I will certainly do the first half; I will certainly redouble my efforts, although they are pretty intense in any case, to ensure that this happens quickly. My hon. Friend is right that we are talking about just a few countries. I suspect their reasoning is the communautaire reasoning of not starting anything before the negotiations start, and I hope this will be rapidly resolved thereafter.

Commons ChamberIt is a pleasure to follow the right hon. and learned Member for Beaconsfield (Mr Grieve), who, as ever, made some cogent points about the importance of process. I completely agree with him that the Government must lay out a process by which this House can begin to have a say in the proceedings and on the final deal.
I stand up today to talk with passion about the biggest constitutional change to this country in my lifetime and in several generations. I regret that I do not believe that we will reverse this decision, but I will not be supporting it. That is not because I do not recognise the result of the referendum. I cannot walk blindly through a Lobby to trigger a process without a shred of detail from the Government. There has been much talk of the Prime Minister’s speech—made not in this House, but elsewhere—but no White Paper and no detail. After seven months, it is really shocking that the Government can come to the House today and say so little.
There is still no real guarantee of parliamentary oversight. Although there was a vote to leave, there is a lot more detail below that decision that the House has a constitutional role to play in delivering. There is no certainty for business, as we stand here, and businesses in my constituency are very concerned about their future. There has been not a word of succour for EU citizens resident in the UK, an issue I have raised with the Prime Minister. There has been no answer about how the many regulations that will need to be transposed into our law will be dealt with. I suspect that we will see an explosion, at speed, of quangos. This is the same Government who wanted a bonfire of the quangos.
In the short time that I have, I want to focus my comments on EU citizens resident in the UK. At the last census in 2011, around 10% of my constituents were born in other EU countries. That was the case for about 27,000 residents across the Borough of Hackney, and the percentage is similar across London as a whole, where 841,000 people were born in other EU countries. If we look at student numbers, we see that 31,000 students from the EU were accepted in 2016, up 22% from 2010. That is a significant bunch of people who are contributing to our economy.
We cannot get figures for everywhere in our public services, but 5% of NHS staff UK-wide are from other EU countries. In 2015-16, nearly 11% of staff who joined the NHS were from European Union member states other than the UK. That has gone up from nearly 7% in 2012-13. That demonstrates that there is a big gap between our skills in this country and the skills and talents that we need to fill those jobs.
Let us look at the tech sector. I am proud to represent Old Street and Shoreditch, which is home to a burgeoning tech sector. Approximately 184,200 EU nationals work in tech. There are already issues with visas in this sector, because it is such a modern and emerging global industry. Often, jobs do not have titles—they do not exactly exist, in official terms—and there are real issues about where we get that talent from. Cutting off overnight the stream of EU citizens, who may be asked to leave this country, is a real issue.
Overall, 3 million EU citizens live and work in the UK. Those people pay more in tax than they withdraw in benefits, and they contribute at least £2 billion annually to our economy. A recent poll by BMG showed that a majority of UK residents believed that EU citizens’ rights should be guaranteed, with 58% agreeing with that position, 28% disagreeing and 14% saying “don’t know”. My hon. and learned Friend the Member for Holborn and St Pancras (Keir Starmer) talked about the human misery that this is causing. I have had people ringing my office in tears because they are worried about their future. When I am on doorsteps talking to constituents, they cannot hold back their emotions, because they are fearful about what it will mean. What about the woman who wrote to me recently—a Dutch woman with a British partner and British children, who has spent 20 years in this country but does not know her future? What about another woman who is worried that, because she is a freelancer, she will not be able to stay in the UK?
Changing this issue would not require an amendment to the Bill; the Government could agree to it straight away. We should be very wary of turning on foreigners in our midst at this time. Instead, we should give them succour. The Government should do so in the next few days, allowing such citizens to stay and continue to contribute to our country and setting in train the process by which they have to do it. If we do not do so, we should look very closely at our tolerances in this country.
The hon. Lady is making a very powerful point. I actually think it is tantamount to torture not to tell people from the EU living and working in this country that they can stay, as it is for British people living and working in the European Union. Does she not believe that both sides ought to get together as quickly as possible and put people out of their misery by telling them that they are allowed to stay, to live and to work in the countries where they currently are?
I agree with that position, but I believe the Government could go further and make a unilateral declaration. These people live in our midst, they are our friends and our neighbours, they work in our public services, they are contributing to our economy, and I believe that people who are exercising their treaty rights today should be allowed to stay. They have made their lives in this country with every expectation that that would be the permanent position, and I think it would be magnanimous of the Government to give way now.
This is an historic day. I participated in the campaign and fought hard for us to leave the European Union. I was too young to vote in the first referendum in 1975—[Interruption.] My birth certificate will be available for viewing later. I was too young, so this, 43 years later, was the first referendum on Europe in which I had an opportunity to vote. My hon. Friend the Member for Stroud (Neil Carmichael) said that when someone is jumping out of an aeroplane, they should make sure that the parachute is working; I prefer the adage “if at first you don’t succeed, skydiving isn’t for you”.
On this occasion, the British people knew exactly what they were doing. It was a hard fought campaign. We heard all the arguments for remaining, which were characterised as “Project Fear”. I am really pleased that the vast majority of what was predicted has simply not happened.
The hon. Gentleman says that the British people knew exactly what they were doing. I have great respect for him, as he knows, but the International Trade Committee, on which he and I sit, has had sitting after sitting trying to work out what it is all going to mean. I am amazed that everybody knew everything before, given all those sittings. I find those two ideas rather incongruous.
It was said that a number of things would happen when we left the European Union. I suspect that the reality is that many were somewhat surprised that the British people had the guts: despite what they were told was going to happen, they still decided to vote to leave the European Union. I remember the then Prime Minister appearing on television and saying that if we voted to leave, we would also be leaving the single market—he actually said that on the “Marr” programme just a couple of weeks prior to the referendum on 23 June. As Prime Minister, he said that, so we needed to take heed. People knew that. He said it to frighten people into not voting to leave the European Union.
I will make a bit more progress if I may.
Despite all those threats, the British people decided that, in their considered opinion, they wanted to vote to leave the European Union. About 57% of my constituents voted to leave—all the Lancashire constituencies, in fact, voted to leave the European Union. In the north-west of England, on a 70% turnout—not a thin turnout— 54% decided to vote to leave. That reminds me of the referendum on Welsh devolution. The turnout was 50.1%, 49.7% of whom said no and 50.3% of whom said yes. And what did we do? We did not shout for a second referendum. We did not even call for a recount. Is it too late? The fact is that we accepted the result on a thin turnout and a very close result indeed, and that is what is expected of us on this occasion.
I condemn the pamphlet that was sent to every household in the country at the cost of £9.3 million. I was one of the people who did not send it back to No. 10 Downing Street without a stamp; I kept it as a souvenir. The back of it read:
“This is your decision. The Government will implement what you decide.”
Therefore, if we believe in democracy, the onus is on us to accept the verdict of the British people—52% versus 48%—and give the Prime Minister the power to trigger article 50.
I fully recognise the trauma felt by many European Union citizens who live and work in this country, thinking they could be asked to leave. The idea that we will round up EU nationals and put them on the next Ryanair or easyJet flight back to whichever country they came from is bonkers. That would be quite despicable, and we ought to clarify as quickly as possible that we will not ask that of them.
EU citizens are a vital part of our community. They work in our communities. Many of us are married to them, and they are our friends, families and colleagues. Does the hon. Gentleman agree that we should give these people, who have contributed so much, legal certainty, as soon as possible?
I totally agree with the hon. Lady. I also have cognisance of the British people who happen to live in the south of Spain, or who work and live in Madrid, Frankfurt and various other parts of the European Union. They are going through the same trauma that EU citizens are going through here.
Will the hon. Gentleman give way?
I will not because I do not have time.
As I understand it, the Prime Minister has already made it clear that as soon as the rest of the EU says yes—whether President Juncker or someone else makes the decision—regarding British citizens in the EU, that is exactly what will happen for EU citizens living here. It is cruel and inhumane for the Commission to say that it will not clarify its position until we trigger article 50 and the negotiations begin, as if human beings should be pawns in the negotiation. If that position is kept up, I ask the Government to ensure that this matter is the first thing negotiated in the process. As soon as the agreement comes, we should announce it straight away and we should let people know our exact intention, not wait until the two-year process is finished. That is the humane thing to do. The prospect of Germany, which has taken in 1 million refugees from the middle east, rounding up British citizens and sending them home is a remarkable thought and it would be a remarkable sight. The situation must be clarified as quickly as possible.
In conclusion, I believe in democracy and I actually love Europe. I love my European neighbours and I visit on a regular basis. I am a member of the Council of Europe. Indeed, I was at one of its part-sessions in Strasbourg last week. But the British people have voted to leave the European Union. It is a simple choice. Those who are going to deny the verdict of the British people appear to love the EU more than they love democracy, and that is a dangerous thing.

Commons ChamberMany businesses in Wales are wondering how EU directives that have been signed but not yet enacted—some may not be enacted until 2017 or 2018—will impact on them. At what stage will the Government say that directives are no longer applicable in the UK?
My hon. Friend makes an important point, which goes to the heart of the previous question about maintaining stability and confidence. We have said in terms that the great repeal Act will put into domestic law all the acquis as it exists at the point at which we depart. Everything that is in European law at that point goes into British law.

Commons ChamberWhat I said—and I apologise to the right hon. Gentleman if I misled him—is that I am seeking to get the best possible access. That does not necessarily mean being a member of the single market. As listed earlier, plenty of countries have that access without making the sorts of concessions that we have had to make as a member of the Union.
It is good to see the three Brexiteer Cabinet Ministers sitting together in the Chamber, working for one nation, with one referendum and one clear decision, despite the fact that some people, including Tony Blair, who famously offered us a referendum and then took it away, have said that there is a chance that we might remain a member of the European Union. Will my right hon. Friend make it absolutely clear that we will be leaving the European Union in its entirety? When does he envisage us getting our hands on the Brexit dividend—the membership money—so that we can spend it on our priorities?

That this House has considered the effect of the EU referendum on Gibraltar.
It is a pleasure to serve under your chairmanship, Mr Evans. I declare an interest: I am the chairman of the all-party group on Gibraltar. I have visited Gibraltar several times, funded by the Gibraltar Government, and I hope to visit again in September for Gibraltar’s national day. I also declare that I was the parliamentary lead for the Brexit campaign for a large part of the south-west of England, so, naturally, I was delighted by the result a month ago. Once again, we will be a free, sovereign and independent people, and that includes Gibraltar.
I welcome and congratulate the Under-Secretary of State for Exiting the European Union, my hon. Friend the Member for Worcester (Mr Walker), on his new position and I am sure that his father would have been very proud to see him occupying it. This is an historic occasion, as it is the first time that a Minister from the Department for Exiting the European Union, or the “Brexit Department”, has responded to a debate in this House.
Of the 23,000 members of the electorate in Gibraltar who were entitled to vote in the EU referendum, 96% voted to remain; there were 19,322 votes to remain as opposed to 823 votes to leave. Admittedly, that is slightly less than the 98% of the electorate who voted to remain British, but it is very impressive all the same. For perspective, however, that result in Gibraltar has to be seen in the context of the whole UK, where there were 17.4 million votes to leave, and as the Prime Minister has said, “Brexit means Brexit”.
Of course we recognise and understand the uneasiness, nervousness and fear that many people—including a large number of people in Gibraltar—are feeling at the moment. When the Chief Minister of Gibraltar spoke to the all-party group a couple of weeks ago, he described grown men being reduced to tears by the referendum result. However, I am told that the report in the Financial Times that Gibraltarians would like another referendum on their membership of the EU was not accurate.
Those feelings are obviously due to both the historical and very difficult relations with Spain—for example, Franco closed the border in 1969 and it remained closed until 1985—and to the ongoing and ridiculous posturing by Spain. Spain has attempted to bully Gibraltar with totally unnecessary and antagonistic border delays. Also, as I have said in this Chamber on several occasions, I am sure that Spain’s ongoing war of attrition against Gibraltar, including the foolish and dangerous games that its security forces play by entering British Gibraltarian territorial waters and airspace without permission, is deliberately provocative and I fear that one day it could result in a terrible and tragic accident.
Order. So that Members know, I intend to call the Front-Bench spokesmen to wind up no later than half-past 10.
It is a pleasure to contribute under your chairmanship, Mr Evans. I congratulate the hon. Member for Filton and Bradley Stoke (Jack Lopresti) on securing the debate, which is necessary in the context of what is being called nervousness. I am looking forward to hearing from the Minister, and I congratulate him on his new role. I look forward to enjoying many a debate with him in Westminster Hall. I do not know whether his title is hereditary, but as his father was also a Member of Parliament, I congratulate him on continuing that line.
May I begin by talking about this concept of nervousness? My constituents in Hornsey and Wood Green voted similarly to the Gibraltarians. One of our polling stations, in Highgate, had 90% turnout, which was above Gibraltar’s 83.5% turnout, and 75% of people in the Haringey local authority area voted to remain in the European Union, so I understand why there is a sense of nervousness and why this debate is necessary.
On a more practical note, I am pleased that the Foreign Secretary met the Chief Minister of Gibraltar, Fabian Picardo, in London on 16 July and reassured him of the Government’s
“steadfast commitment to Gibraltar, and…intention to fully involve Gibraltar in discussions”
on the UK’s future relationship with the European Union. The Foreign Secretary also emphasised:
“The people of Gibraltar have repeatedly and overwhelmingly expressed their wish to remain under British sovereignty”—
that is clear from the earlier referendum—
“and we will respect their wishes.”
In the spirit of working together to get a solution following the 23 June vote, Opposition Members will want to work carefully and closely on the detail of what it will mean for Gibraltar to leave the European Union.
To pick up points made in the debate, the hon. Member for Strangford (Jim Shannon) talked about a proper conversation with Spain. It would be welcome to see at some point a sense that the trilateral conversation is happening again. I know the situation is fraught, but it is important to talk and have discussions, yet the tone is crucial, so I hope Members here will be helpful in that regard. We must remember the geography of Gibraltar and the fact that so many people from Spain are intimately involved, with up to 12,000 residents from Andalucia crossing to work on the Rock on a daily basis. We want to get towards a practical discussion about what the new reality means on a day-to-day basis.
The hon. Member for Bromley and Chislehurst (Robert Neill), in his usual way, gave us five points to think about—it is always helpful to outline them in that way. Of course, freedom of movement is the big one and it is one of the most significant things we will have to think about nationally as well. The second is dependency and trade links. Like the City of London, Gibraltar has very much a services-based economy. The hon. Member for Morley and Outwood (Andrea Jenkyns) quite correctly suggested the Moroccan market, which is something we need to look at carefully in considering the possible ramifications for the technicalities of leaving the European Union—I wish it was all just technicalities and that there was not the dampening effect that we currently see on our economy.
On the principle of full involvement in negotiations, once again, somehow we need to get the trilateral conversation going again with more energy. I look forward to the Minister commenting on that—where he thinks we are at and where we need to go—and re-emphasise the importance of the tone of those discussions. I would also be happy to hear what he thinks about the free trade agreement between the UK and Gibraltar—a kind of mini-common market. The important thing is that we keep all options on the table and continue to talk, and that people do not feel as though there is a big gap, but that we keep the energy going around our common economic and prosperity agenda.
Finally, the hon. Member for Bromley and Chislehurst quite rightly raised the issue of Ministry of Defence personnel. We would not want there to be any nervousness or inject any sense of questioning into that relationship, particularly as regards the families based there. Certainly we on the Labour Benches want to see continuity, not massive change. It is far too early to talk about any change in that regard, but it is quite correct that he raised that today, so as to reassure the families and communities.
We are committed to working through these issues as they come up. It is clear that 24 June was not a fist-pumping moment for the hon. Member for Hornsey and Wood Green. It was not independence day for us in Hornsey and Wood Green—I had people crying on my shoulder when I went to the local shop to buy a pint of milk. It has been quite a difficult time. Indeed, today I have my first meeting of the all-party group for the European Union post-23 June. However, what is important about the House of Commons is that we debate and talk about things and keep all options open while maintaining a sense that our economy, prosperity and trade relations are extremely important in that regard, as is the sentiment around how we will cope, post the referendum vote.
In welcoming the Minister to his new role, like everyone else here today, may I remind him that it is customary to leave a minute at the end for the proposer of the motion?
