I beg to move,

That this House approves, for the purposes of Section 5 of the European Communities (Amendment) Act 1993, the Government’s assessment as set out in the Budget Report and Autumn Statement, combined with the Office for Budget Responsibility’s Economic and Fiscal Outlook and Fiscal Sustainability Report, which forms the basis of the United Kingdom’s Convergence Programme.

The legal requirement to give the European Commission an update of the UK’s economic and budgetary position—our convergence programme—means there is a welcome opportunity for a wider economic debate, should we want one. [Interruption.] Clearly, since last year’s—[Interruption.]

Clearly, since last year’s convergence programme debate there has been a momentous change in the UK’s relationship with the European Union. The article 50 process is now under way and the United Kingdom is leaving the European Union. There cannot, as some suggest, be any turning back from that. In accordance with the outcome of the referendum, we are leaving the European Union and will make our own decisions, take control of the things that matter to us and seize every opportunity to build a stronger and fairer Britain.

Given our decision to leave, some Members might find it odd that we are debating the UK’s convergence programme here today. It is right that we should do so, however, because we continue to exercise our full membership of the European Union until our exit and because to do so is a legal requirement that we must take seriously. I should, however, remind the House that the content of the convergence programme is drawn from the Government’s assessment of the UK’s economic and budgetary position. This assessment is based on the spring Budget report and the Office for Budget Responsibility’s most recent economic and fiscal outlook. It is that content, rather than the convergence programme itself, that requires the approval of the House.

I should also remind the House that although the UK participates in the stability and growth pact, which requires convergence programmes to be submitted, we are required—by virtue of our protocol to the treaty opting out of the euro—only to endeavour to avoid excessive deficits. The UK cannot be subject to any action or sanctions as a result of our participation.

On a point of order, Madam Deputy Speaker. You may remember that I have previously raised the issue of having time to debate in the House the Government’s rape clause and two-child policy. The last time I raised the matter, the usual channels came back to me and assured me that time would be made available in a delegated legislation Committee for the rape clause to be debated. The final list of DL Committees has appeared in the Whips Office, and as far as I know there will now not be time, with the proposed election, for the rape clause to be debated anywhere in this House.

There are no third-party referrers in Scotland because the NHS and women’s organisations think that the guidance is not sound and are refusing to co-operate with it. Is there any recourse for me to raise this with the Government ahead of the election, to ensure that these very important issues get debated?

It is indeed, and I will come on to that in a moment.

The NCS in my constituency is already oversubscribed for the summer placements on this year’s programme, and the young people who have been involved are a credit to my constituency.

The Gateshead millennium bridge is a magnificent feat of engineering, and it truly is an iconic landmark. On the Newcastle side of the bridge is a glass structure upon which the words “Gateshead millennium bridge” are emblazoned. On the Newcastle side of the river is a little piece of Gateshead in a foreign land that will be for ever Gateshead. A bridge that has, by its very nature, managed to secure a foothold for Gateshead on the Newcastle side of the river is an impressive achievement. Some Members will appreciate the importance of that to those of us from the Gateshead side.

I also continue to chair the governing body of one of my local primary schools, Kelvin Grove. The school, in the heart of Bensham, Gateshead, was rated good by Ofsted only a couple of months ago. Gateshead has an array of cultures within its population, and a significant proportion of students have English as a second language. At the last count, a total of 27 different languages were spoken by pupils at that school, and I am sure Members will agree that, although the mix of languages poses difficulties and complexities for the learning environment, there is no doubt that such diversity also has a significant positive effect on the education of all our young people in that neighbourhood. It is a great place to live in many respects.

There are further funding cuts to education, persistent problems in the NHS across the country, which we heard about over the winter, and the localisation of business rates. That localisation will have a negative impact on regions such as the north-east of England, where the 12 local authorities will lose some £300 million whereas Westminster, if we believe the figures published last year, will on its own gain more than £400 million, so we can see how it will have a different impact in different parts of the country. With all that happening, my constituents have little hope of benefiting from some of the measures of prosperity that we are told other parts of the country are currently enjoying or will enjoy. The Prime Minister pledges to have a country that “works for everyone” but, sadly, our definition of “everyone” varies somewhat, because the impacts of what is going on are very different in different places.

I have highlighted and will continue to highlight some of these injustices in this House and to anyone else who can understand what I am saying, but now I wish to take the opportunity to highlight some of the great things happening in Gateshead, despite some elements of Government policy that are having a detrimental impact on us. With colleagues from the Select Committee on Education, I had the pleasure of visiting Gateshead College in my constituency a couple of weeks ago. Despite significant cuts to funding for further education, Judith Doyle, the principal, and her team have ensured that Gateshead College remains one of the best further education colleges in the country, and only last year it was rated as “outstanding” by Ofsted. It is imperative in communities like Gateshead that we have institutions that have the ability to train our future workforce, in an environment that gives our young people the best opportunity to succeed going forward into their working life. Gateshead College, with its rich and diverse offer, is a fine example of this, and I am proud to have it in my constituency and to represent it.

Turning back to local government for a moment, significant cuts to the revenue support grant have forced local authorities to come up with ever more creative ways to plug the holes in their budgets and help grow the local economy. I was delighted to see the Under-Secretary of State for Business, Energy and Industrial Strategy, the hon. Member for Hereford and South Herefordshire (Jesse Norman)—visit Gateshead earlier this month to open the new £18 million Gateshead district energy centre, which uses cutting-edge technology to recycle heat from the energy generation cycle, using it to heat homes and businesses and water throughout the centre of Gateshead. It is hoped that the scheme will provide local homes and businesses with affordable energy, as well as making Gateshead an attractive place for new businesses to invest, taking advantage of the lower energy costs. I hope that all hon. Members will join me in congratulating Gateshead Council on taking the bold step to self-fund the entire project, for the benefit of local residents, businesses and employers.

In Gateshead, my constituents are very fortunate, as we have a fantastic hospital trust, operating out of the Queen Elizabeth hospital, which provides excellent service and care for all of its patients. I wish to place on record my thanks to not only the staff at the Queen Elizabeth hospital, but all staff in the NHS across Gateshead and the north-east for their unreserved commitment and dedication to ensuring that every person of every background is afforded the care that they very much deserve. Colleagues will be aware that I, too, have had to use the services of the NHS in my constituency, and on a personal note I would like to place on the record my thanks to my GP, Dr Ruth Bonnington, and my physiotherapist, Shane Ryan, for greatly accelerating my recovery from the slipped disc I suffered some weeks ago. Without their care and attention, I would not be here to make this contribution today.

Finally, I wish to pay tribute to the outstanding work that the voluntary sector does on a daily basis to help my constituents who often have nowhere else to turn. Whether it be in dealing with benefit sanctions, homelessness or illness, organisations such as the Gateshead citizens advice bureau, Barnardo’s, the Trussell Trust, the Gateshead food bank, and many more organisations and individuals across Gateshead, put their lives on hold to ensure that those most vulnerable in our communities receive the help and support they most desperately need. They are the real unsung heroes in our communities, and I would like to thank them for everything they do.

The north-east has a proud track record of donating to charity, despite the relatively low incomes people live on there. Our record on donating to things such as red nose day or Children in Need shows that we often exceed the national body’s expectations. Despite low incomes and indeed poverty, we have very successful food bank collections. The points are often overflowing with food, which has often been donated by families who are struggling themselves. Sadly, despite the generosity of my constituents and others across the north-east, organisations providing often vital support to those most in need continue to find themselves short of resources. So as much as my constituents already give, I ask them from the Floor of the House of Commons to carry on and give more—it is needed.

As I open the debate, I look forward to the speeches of hon. Members from both sides of the House. Before I finish, Madam Deputy Speaker, may I wish you, the staff of the House and all hon. Members a very happy Easter?

I would dearly love to give the right hon. Gentleman good news about Stanmore station, especially as he uses it regularly. The sad fact is that a planning application was made by a private developer for a site alongside Stanmore station. The developer offered £1 million towards providing a lift. Harrow Council’s planning committee, in its infinite wisdom, decided to turn it down. It did not want the £1 million, so the developer, not unreasonably, took it away as part of their offer, but they still got their planning application for the flats alongside the station, which has received lots of objections from residents.

Madam Deputy Speaker, I realise that I am transgressing your informal time limit, but, having given way a couple of times, I will conclude on three quick issues that are of particular concern to local residents.

First, Harrow Council introduced the unwanted garden tax at the highest level in London—the highest garden tax in the country for garden waste collection—and has now increased it even further in this year’s budget. It is rightly objected to by residents all over the Borough of Harrow. Secondly, I am delighted that progress is happening, albeit slow, on the redevelopment of the Royal National Orthopaedic hospital, which I have been campaigning on for an extended period.

The final issues are of education and the police service in Harrow. I have registered with the Secretary of State my concern that the proposed new fairer funding formula will discriminate against schools in Harrow, as 17 schools in my constituency will actually lose money, not just in real terms. That is completely unacceptable. Equally, the concern about police funding is that the new proposals for amalgamating boroughs will mean that Harrow, which is the safest borough in London, will lose police and therefore be at greater risk of crime. That is also completely unacceptable, and I trust that we will put it right.

Madam Deputy Speaker, I wish you, the staff and everyone else involved in running the House a very happy and peaceful Easter. I look forward to coming back after the recess suitably refreshed. I apologise in advance that I am unlikely to be here for the wind-ups and the reply from the Deputy Leader of the House; I have to use the national health service for a long-awaited medical appointment that has to take precedence in these circumstances.

Madam Deputy Speaker, I thought for a moment that you were going to adopt the Conservative manifesto. Fortunately, you have resisted that temptation.

The shadow Minister makes his point, but I have addressed in the round the Budget that the Government have put forward. I have explained the bits I enthusiastically embrace and talked about the difficult decisions we have had to make. However, the truth is that the Labour party is incapable of putting forward a credible package.

The hon. Gentleman can make up as many false “facts” as he would like, but the fact of the matter is that he is making them up. He should concentrate on his own manifesto. He still has not answered the question about the £500 billion in the Government’s national infrastructure plan. Where are the Tories getting the money for that from?

As ever, Madam Deputy Speaker, I will be very mindful of your advice, and I will curtail my speech.

The truth is that Budget week is the week for difficult decisions. The Government set out their priorities—the media will always pick apart whichever bits they want to—but they have to put in place a package that strikes the right balance, and I commend them for doing so. I know the Minister will have taken on board the concerns that I and other hon. Members have raised. However, the contrast between a credible, serious Government and a leader of the Labour party and an Opposition who have abdicated responsibility for coming up with a credible alternative is palpable for all to see—everyone inside this House, but also the public at large.

The shadow Chancellor will recognise that he should be doing the same as me by defending London’s honour to a certain extent. Surely he recognises that if the significant amounts coming into our capital city were not invested here, they would go to another global capital, so it is not a case of money coming to London rather than another part of the UK. It is also the case that many of the cranes in my constituency—and, indeed, those in his constituency near Heathrow—are engaged in infrastructure projects involving large-scale investment. Such projects are producing huge numbers of construction jobs and are contracting well beyond the capital city. A lot of investment goes on here in London, but it has a benefit well beyond the capital city—

Don’t worry, Madam Deputy Speaker; I was enjoying that.

The reality is that this is Government investment, and those figures are just not acceptable. Investment of £5,000 per head in London compared with £400 in the north-east is an unacceptable level of inequality that has to be challenged. The right hon. Gentleman is usually fair, so I am sure that he would accept that, no matter how much we are both champions for our capital city.

While the shift in rhetoric is welcome, it must be backed up by meaningful action, and that is where the revised charter still falls short. It is good to see the Chancellor taking on board Labour’s recommendations and ditching the surplus target. In doing so, he has held out at least the possibility of lifting some of the burden of the austerity measures that have led to crises in health and social care. I deeply regret, however, that he failed to take that option at last year’s autumn statement.  His failure to act on both NHS and social care funding has contributed to the worst funding crisis in the NHS for decades and a social care system pushed beyond breaking point.

An image can sometimes capture the plight of a particular situation. A couple of years ago, it was the image a child’s body on the shores of the Mediterranean that brought to our attention the plight of people in the refugee crisis. Last year it was that photo of a child in an ambulance, covered in blood and dust after being pulled out of the debris in Aleppo. Two weeks ago, the image that put the NHS crisis into focus for me was that of a child below the age of five, in a hospital corridor, being treated on two plastic chairs that had been pushed together. That is unacceptable in the sixth richest country in the world, and it is the result of a failure to address underfunding in the autumn statement.

I have written to the chair of the Office for Budget Responsibility to ask whether it will look into providing an assessment of healthcare funding against expected need. In the last month, the British Red Cross has described the ongoing situation as a “humanitarian crisis”. The Government’s response has been to play down the situation, despite the volume of continuing complaints from frontline NHS staff. I strongly believe that this is leading to widespread public distrust of the Government’s presentation of funding and support for the NHS and social care. It makes sense to attempt to provide an objective assessment of the real needs of the NHS to help to prevent the real-terms funding cuts that have taken place under this Government. Let me say to the Chancellor again that he can and must take action now to ensure that both health and social care are properly funded in this period of crisis.

I am afraid that the charter represents only the smallest improvement on the previous dire fiscal policy. Unbelievably and, I think, contrary to all advice, it still attempts to keep investment spending within the spending control framework. That has already been criticised by experts from the Institute for Fiscal Studies. Keeping the investment spending cap inside the overall spending cap means that every pound delivered for investment comes at the expense of possible spending on public services. At a time when the capital costs for the Government are close to their lowest in history, that choice makes little sense. As we face Brexit, the challenge for us all is to think boldly about how this country can respond, and the amended rule falls far short of that.

Small Charitable Donations and Childcare Payments Bill

I beg to move amendment 1, page 2, leave out lines 1 to 6 and insert—

“(a) in the heading after “small”, delete “cash payment” and insert “donation”;

(b) in sub-paragraph (1) omit the words “in cash”;

(c) after that sub-paragraph insert—

“(1A) The gift must be made—

(b) by cheque;

(c) by electronic communication; or

(d) by a contactless payment.”

(d) in sub-paragraph (3) after the definition of “cash” insert—

“cheque” means a written order instructing a bank to pay upon its presentation to the person designated in it, or the to the person possessing it, a certain sum of money from the account of the person who draws it; “electronic communication” means a payment made via the internet or text message.”

This amendment would extend the range of methods by which payments can be made under the Gift Aid Small Donations Scheme.

With this it will be convenient to discuss amendment 2, page 2, line 6, at end insert—

(c) by a comparable method prescribed by the Treasury by regulations.”

This amendment would give the Treasury a power to prescribe by regulations other methods of payment comparable to contactless payment in the future.

Opposition amendments 1 and 2 relate to the types of payment eligible for the gift aid small donations scheme. Amendment 1 would extend the range of payment methods to include cheques and electronic communications—that is, texts. The Bill itself extends the methods to include contactless payments. Amendment 2 would give the Treasury powers to prescribe by regulations other methods of payment comparable to contactless payments in the future. I will keep my remarks on these two amendments relatively brief as we had an extensive debate on this issue in Committee, although I did not push it to a vote.

Currently, cash donations under £20 are considered eligible for the scheme. The Bill brings contactless payments into the scheme, and we support that measure. However, the charity sector has said that it would be more beneficial for other types of payment, particularly cheques, to be eligible as well. When this was discussed in Committee, the Minister said that amending the Bill in such a way was

“contrary to the stated policy intention of the scheme.”––[Official Report, Small Charitable Donations and Childcare Payments Public Bill Committee, 18 October 2016; c. 10.]

I want to take this opportunity to disagree.

The intention of the scheme is to allow charities to get a gift aid-style top-up on donations made in situations where it is infeasible, but not impossible, to get a gift aid declaration. I would argue that donations made by text are a prime example of such a situation. The Minister has said that receiving gift aid declarations on donations via SMS is a straightforward process: the donor simply needs to reply to a follow-up text message giving their name and address and confirming that they are a taxpayer. It might be straightforward, but people tend to be wary of disclosing personal information. I certainly would not feel comfortable sending my address and other details to an unknown number.

The hon. Member for Amber Valley (Nigel Mills) helpfully alerted us to paragraph 1.8 of the Treasury consultation “Gift Aid and Digital Giving”. I am sure that the Minister has had time to check it out, but I can remind her that the document states:

“Individual donations online or by text are often small. In these cases for the donor it may not seem worthwhile to go to the trouble of filling out a Gift Aid declaration for a small additional amount to go to the recipient charity.”

It is therefore clear that getting a gift aid declaration via text is not as straightforward as the Minister would have us believe.

Similar situations can arise with cheques, as detailed in Committee by my hon. Friend the Member for Redcar (Anna Turley). Elderly people in particular often send cheques in the post, making it impossible for charities to track them down and get a gift aid declaration—it is probably not worth it if it is a small amount. Amendment 1 would simply allow such donations to be eligible for the scheme. I hope the Minister will offer some movement on this area as I simply cannot see the logic in saying that extending payments in that way would somehow encourage charities to move away from traditional gift aid claims.

Amendment 2 would allow the Treasury to make regulations to tweak the legislation to allow types of payments similar to contactless payment to come under the scope of the scheme. It was argued in Committee that technology is moving forward at an incredibly fast pace and that next year people might be using a new type of card or gadget to donate to charity. The Opposition are convinced by that line of reasoning and the amendment would simply give the Government the power to make changes to allow Oyster cards, for example, to come within the scope of the legislation without having to create a brand-new Bill. It is not often the Opposition’s desire to give the Government more powers, but it would be worthwhile in this scenario.

In conclusion, the Opposition strongly support the move to include contactless payment, but we do not see the logic in singling it out when the sector is saying that other payment methods would provide a greater boost to the scheme. I look forward to the Minister’s response. I will be pushing amendment 1 to a vote should she not see fit to accept it.
