Commons ChamberI am grateful for that question. I would like to put on record my thanks to my hon. Friend’s good offices for making that happen. Of course, there will be a very significant role for the wider community and the third sector to play in welcoming our Afghan friends. I recently visited an Afghan cricket team that had been put together by a local pastor. The whole community is quite demonstrably coming together.
The Scottish Refugee Council recently called for the UK Government to extend Operation Warm Welcome to Afghans who are still stuck in the asylum process waiting on decisions or who have previously been declined protection. Can the Minister confirm what discussions he has had with colleagues across Government on extending the programme in such a way?
I will, of course, pass that question on to the Home Office, but my expectation is that Operation Warm Welcome will run for as long as is necessary.
Absolutely; it did play a key role. It is a very valuable asset, alongside others, including the A400M, which also has a connection with my hon. Friend’s constituency. I have visited his constituency, where there are great skills in the defence sector. I was delighted to make that announcement and I am delighted to see that investment going into that part of our country.
What assessment has the Secretary of State made of the impact of the introduction of operational MGS—MOD Guard Service—employment contracts on levels of staff fatigue and security at UK military bases?
Whenever we examine new arrangements for services for our military, of course we examine all the impacts on security, accountability and indeed performance.

Commons ChamberI am so glad that my right hon. Friend asks that question, because it requires a very simple answer: absolutely. Unfortunately, as he rightly says, there has been a long pattern of delays with the project, but we are not going to take into service something that does not meet our requirements. It is a firm price contract; we need to have it right, and take it into service when it is right to do that. We are not going to obfuscate in order to do so.
There are reports in the media citing the leaked Government report on the procurement of Ajax tanks and stating that
“the problems were known to the army as early as 2017, but they”—
the MOD—
“didn’t admit them due to embarrassment.”
Does the Minister agree that it would be far more embarrassing, and a failure in the duty of care to our defence personnel, if the Ajax programme went ahead without finding the root cause or mitigating these serious defects?
I agree with the hon. Lady that we need to find the root cause of the defects—that is absolutely right—or at least, we have to first identify that there are defects and then make certain that we have resolved them. I think that would be a fairer way to put it, and that is what a lot of the testing is doing right now. On when these problems first occurred, I do not think awareness of them came from the Infrastructure and Projects Authority report. I have been aware from social media sources of a suggestion that the Army was aware back in 2017. That has not been my experience, having looked into it. The concerns over vibration are a far more recent occurrence.

Commons ChamberAbsolutely not. I can reassure my hon. Friend that, as he recognises, international programmes are hugely important to defence and we will continue to engage with our friends and allies. To name but two, Boxer and FCAS—the future combat air system—are international collaborations, and they are bringing thousands of skilled jobs to the west midlands, to the north-west and throughout the UK.
Transition to the mark 4A warhead is ongoing to ensure that we continue to have a safe, secure and available stockpile until the replacement warhead is available by the end of the 2030s. The replacement warhead is in its early preliminary phases and will come after the transition to the upgraded mark 4A warhead. It is too early, therefore, to provide a cost estimate at this stage.
On 15 March, in response to a written question by the right hon. Member for Ludlow (Philip Dunne), the Government confirmed that the UK replacement warhead for the Trident nuclear missile will be designed, developed and manufactured in the UK. Will the Secretary of State clarify whether this replacement nuclear warhead will use up any funds that would otherwise go towards conventional defence projects?
If the hon. Lady had listened to the previous answer, she would know that the current funding is being spent on transitioning to the mark 4A upgrade of the existing warhead scheme. We are engaged in the design and the process to get to the replacement warhead in nearly 20 years. Just like the rest of the nuclear deterrent budget, it is part of the overall budget. It was agreed in 2015 as part of the £31 billion for the Dreadnought programme. We continue to spend that, and I expect there to be a budget line to continue with the deterrent. As long as this Parliament votes, as it did in 2016, for that deterrent to exist, there will be a budget for it.
I recognise that this is an important issue. This is taking too long, so I look forward to reporting back to the hon. Gentleman with an update on progress.
We will continue with the Astute programme. As the hon. Lady points out, there were some delays in some of that programme. We will continue to manage the programme. The Astute submarines will be delivered by BAE Systems in Barrow-in-Furness. I visit regularly to make sure we try to keep it on track.

My hon. Friend is entirely right. I should be clear that, as I hope the integrated review made clear, the UK has an ambition to be a force for good in the world and that where terrorism threatens the UK’s interests or those of our allies, we will be present, building the capacity of partner forces and helping to remove that instability and insecurity around the world. What we have learnt over the past 20 years is that there are ways of doing that, and the vision we have set out in the integrated review is for a far more intelligent way of doing that: developing capacity, tackling insecurity and being a force for good around the world.
I am sure that we all pay tribute to the service and sacrifice of all those who served and of those who, sadly, lost their life. General Sir Nick Carter, Chief of the Defence Staff, said in a recent interview that although he respects the decision of the Biden Administration, it was
“not a decision we hoped for”.
Will the Minister confirm whether the MOD feels confident in the ability of the Afghan national security forces to defend the Afghan Government and their people without the current NATO presence in Afghanistan?
I fear that that question invites a reprise for all the answers I have already given, but, yes, the Afghan national security forces have the capacity to maintain peace within Afghanistan. The key is whether they are empowered to do so by a future Government in Kabul.

Commons ChamberI thank my right hon. Friend for his question. HMS Argus has literally just returned from giving assistance in the Caribbean; she has been helping the populations there deal with the initial outbreak and all the problems. She was involved in dealing not only with the covid outbreak, but with security and making sure that the borders and so on were kept from immigration pressures as well.
On the broader issue of the integrated review, I know I have come to this Dispatch Box on a number of occasions to say it was going to be on a certain date. It will be in the spring. Obviously covid has taken its effect. The No. 1 priority of the Government is dealing with covid and delivering a covid response. That does not prevent defence, with a multi-year settlement, setting out and driving forward, in conjunction with the Foreign Office, a plan to ensure that when the review is launched, everyone will be able to see it. I am determined that it will be done this spring, because it is important not just domestically, but for our international allies to understand the direction of travel on our defence.
There have been no discussions on this matter. British national overseas status holders who serve in our armed forces already have the option either to apply for British citizenship while serving or to settle in the UK on discharge. BNO veterans who have not pursued these routes and choose to apply under the new BNO route will be on a pathway to settlement in the UK and can then apply for British citizenship.
During the handover of Hong Kong to China in 1997, the existing immigration rules meant that only 159 of the 654 soldiers who had served in the British armed forces in Hong Kong and applied to live in the UK were successful at the time. With the opening of the new settlement scheme for British nationals overseas, many of those veterans are keen to escape the crackdown of the Chinese Government on Hong Kong. Can the Defence Minister confirm that he will defend their right to UK citizenship in any consultations on the matter with Cabinet colleagues?
The hon. Member raises a good point and a good question. These negotiations are ongoing at the time. We are very clear, though, that those who have served in the armed forces should suffer no disadvantage because of their service, and that of course extends to those who apply for BNO residency, should they be eligible.

Commons ChamberOver the past two years, we have made a real effort to completely redesign the mental health care provision for our armed forces personnel, both during their time in service and when they leave. I am delighted to confirm for the first time that this country’s armed forces will receive mandatory mental health training every year from 1 April next year. I pay tribute to the service chiefs who have led the way on this significant policy change.
The hon. Lady is making a brilliant argument for why we do not want to put borders between countries. Perhaps she could join our campaign to save the Union at the next referendum.

Commons ChamberAs co-chair of the all-party parliamentary group on human rights, my comments will be heavily focused on human rights. Perhaps not surprisingly, when I see a Bill come forward from this Government that seeks to achieve a derogation from the ECHR, I am sceptical about its intentions. This Bill is another example of the Government trying to get around our international legal obligations in a specific and limited way, and in so doing opening up a whole can of worms for our armed forces personnel overseas.
There can be no doubt that our armed forces carry out incredibly sensitive and dangerous work overseas, and they have our gratitude for doing so. They do not deserve to be repeatedly investigated for vexatious claims against them. The internationally agreed rules of warfare simply must be adhered to. That includes prosecuting war crimes and crimes against humanity when there is evidence to suggest that those serious offences have been committed in the course of armed conflict. Doing so not only upholds our commitment to the rules-based order but offers armed forces personnel crucial protection from torture and abuse themselves. It is hypocritical of us to demand of others that they should obey international law if we do not follow it ourselves, and the consequences for serving personnel on the battlefield are serious if we undermine our commitments to human rights.
I have considerable concern about the impact that clause 12 will have on our human rights obligations. In its current form, the Bill enables the Secretary of State to derogate from article 15 of the ECHR under certain circumstances, even though article 15 is one of the provisions of the ECHR where derogation can take place. I am concerned about the concentration of power in the hands of the Executive on matters pertaining to states of emergency, especially as the clause only places a duty on the Secretary of State to consider whether an overseas operation is significant enough to merit derogation. At the very least, additional parliamentary oversight is required before such a derogation is made, given the existing notification requirements to the Council of Europe for such a derogation to take place.
Our armed forces deserve protection but should not be above the law. Unfortunately, the Bill creates far too many unintended consequences for the UK’s reputation as a country that upholds human rights and the rule of law. I do not believe that the Government have adequately addressed those issues in the Bill as it stands, and it is for that reason that I will join my colleagues on the SNP Benches in voting against the Bill tonight.

Commons ChamberIt has been the longstanding position of successive Governments not to comment on the operations activity of the UK special forces, as to do so would put personnel and operations at risk. All military operations are overseen and scrutinised by Ministers, who are accountable to this Parliament.
An interesting angle for special forces. I am not sure we are going to put a special forces base in Angus. We absolutely want the best technology. We recognise that international partners can also bring that technology, and when we work together in partnership, recognising that British prosperity is as important as anything else, we can get a good result for our forces, who get the best kit. It is also good for our economy, so that we get the good jobs and skills that we desperately need around the UK and ensure that the science base is strong and able to compete post Brexit.
The current Government’s adoption of a “no comment” policy prevents any parliamentary scrutiny of the role of UK special forces in defence and security strategy, even when their involvement in operations becomes the subject of media coverage. Will the Secretary of State commit to a review of the “no comment” policy for UK special forces, and enable parliamentary oversight of their activities, placing them on a similar footing to MI5, MI6 and GCHQ?
As I say, it is a long-held policy of many Governments not to comment on special forces. They are accountable to me and to the law, and where we see any issues, Ministers will of course intervene. I will not commit to a further review; that is a longstanding policy. Our special forces do an absolutely amazing job saving lives around the world and protecting our citizens. They operate in the covert world to achieve that effect and make sure their lives are not put at risk.

Commons ChamberMy hon. Friend is right to champion the activities of the armed forces cadets and Air Force cadets in Clwyd South. It is amazing to hear what they have done to support their community during the coronavirus crisis, but also the cadets in his constituency and across the country have done an amazing job, through the commitment of their adult volunteers, to keep virtual training going throughout the pandemic, which has been hugely valuable to young people across the country.
Only today, the permanent secretary and other officials attended the Public Accounts Committee to answer some of those questions, no doubt in detail. The point to be made is that the MOD spends £41 billion overall, and we make sure, where we can, that that is spent not only on the men and women of our armed forces, but on industry and equipment capability, such as, in Glasgow, buying two warships—both the Type 31 up at Rosyth and, indeed, the Type 26—which I never seem to hear the SNP ever really welcome.

Commons ChamberYes, I can confirm that the Government regularly urge Saudi Arabia to sign the cluster munitions convention. I can also confirm that, in his statement in December, the Secretary of State welcomed the announcement that UK munitions would no longer be used.
I draw the hon. Lady’s attention to my previous answer about how we welcomed the Saudi Government’s commitment. We do not routinely hold records of other nations’ use, storage or location of UK-manufactured equipment, particularly items that were supplied decades ago under previous Governments.
