“Independent commission to consider proposals for reform of the IPP sentence
(1) Within three months of the passing of this Act, the Secretary of State must establish an independent commission to consider proposals for reform of the imprisonment for public protection (”IPP”) sentence.(2) The remit of the commission must include, but is not limited to, the consideration of proposals that—(a) would allow for existing IPP sentences to be terminated and for their replacement by arrangements appropriate to the circumstances of the individuals concerned; and(b) have regard to the interests of both public protection and meeting but not exceeding the original punitive intention of the sentence imposed.”

My Lords, first, I thank everyone who has made it possible to get to this group of amendments before the business at 7.30 pm. I repeat the thanks, in which I think all others joined on 15 November, to those families and individuals who have been campaigning but also to Members from across the House. I am deeply grateful for the commitment of people in every group of your Lordships’ House and, I have to say, to those who have stayed this evening on the eve of recess. I hope that, by the time that the Minister has responded, it will be possible to see at least a modest way forward. I shall speak very briefly to allow that to happen in good time, so that we can conclude this debate before 7.30 pm.

I am not quite sure of the meaning of a personal undertaking from me to ensure that the Government will find an opportunity. I hope the House will appreciate that I have personally put a lot of time and effort into this matter. When I see the Justice Select Committee’s report, that time and effort will not diminish.

My Lords, I am not sure this is protocol, but it might help progress if I indicate to the House that, in discussions with the Minister, we had come to an understanding that we were taking steps forward in a way that would start to unlock this problem. In what he has just read out, the Minister has fulfilled what he agreed with me, and I trust him. On that basis, I recommend to colleagues that we accept the offer of the Third Reading amendment and the commitments that have been made on both procedure and recall, and we move forward on that basis this evening.

My Lords, I cannot pretend to be wholly content, let alone happy, with what the Minister has been allowed to say today. It falls dramatically short of providing any sort of an answer to the final question I asked earlier: are we to keep these post-tariff detainees in effect endlessly and for life? It is surely no answer to my point to say that reversing the burden of proof is unlikely to make any difference. That is even less a reason to object to this amendment.

I repeat that I am very far from happy but, as the noble Lord, Lord Blunkett, said, we have at least got some assurances, for the first time, that Ministers will look again at the plight of these IPPs and make some improvements at least to the recall regime—hopefully the first step in a re-evaluation of the entire remaining IPP problem. The other consideration that now weighs on me is the point that has been made that the Justice Select Committee in the other place is now deep into its full-scale IPP inquiry and its eventual report must surely inform the Government’s approach. In the meantime, alas, it provides something of an excuse for the Government to do little of great note.

It is clear that there is huge support for Amendment 80 around the House. What is ultimately needed is political will. For my part, let us hope that the Select Committee will call for proper reform and for the political will to deal with it, and that that is now shown. Meanwhile, I confess that I am deeply disappointed, as will be the IPP prisoners and their families. As the noble Lord, Lord Blunkett, points out, I have no alternative but to not press my Amendment 80.

(1) Within six months of the passing of this Act, the Secretary of State must lay a report before both Houses of Parliament on the effectiveness of the arrangements for the resettlement and supervision of prisoners serving sentences of imprisonment for public protection (“IPP”) released on licence.(2) The report must include, but not be limited to—(a) an assessment of the factors underlying the rates of breach and recall of prisoners serving sentences of IPP released on licence, and what could be done to address them, including—(i) the effectiveness of the arrangements for the preparation of prisoners serving sentences of IPP to be released on licence, including the adequacy of information and guidance for prisoners on licence provisions, breach of licence and the risk of recall;(ii) the adequacy of existing probation service guidance on breach and recall;(iii) whether more use could be made of alternatives to immediate recall to custody including electronic tagging;(iv) the extent to which a failure to properly support and supervise prisoners serving sentences of IPP on release is contributing to the high proportion of this group breaching the terms of their licence and being recalled to prison.”Member’s explanatory statement
This, along with another amendment after Clause 115 in the name of Lord Hunt of Kings Heath, is a probing amendment intended to require a review of the arrangements for the resettlement and supervision of prisoners serving sentences of IPP.

My Lords, in moving Amendment 208A with its proposed new clause, I give my wholehearted support to the other amendments which have been laid, to which I have appended my name, and a strong encouragement that we build on the alliance that has been put together. I thank noble Lords and, where they have them, their staff—and mine—for the terrific co-operation that has emerged over recent weeks. I give apologies from the noble and learned Lord, Lord Clarke of Nottingham, who wished to be here but has a medical appointment. Members of this House will recall that the noble and learned Lord was Secretary of State for Justice when the IPP proposal was set aside and the 2012 abolition of that sentence agreed by the two Houses of Parliament.

At the time, I took the late and much lamented Paul Goggins to see the noble and learned Lord, Lord Clarke, to discuss what might be possible as a rapid wind-up of the consequences of the original Act, part of which is my responsibility and which I want to speak about in a moment. The noble and learned Lord has reflected with me on a number of occasions, as he did on that occasion with Paul Goggins, who had been a Prisons Minister and the Minister of State in Northern Ireland responsible for the prison service there, on the massive political challenges in getting agreement. I hope that this afternoon we can take a step in finding a way forward almost 10 years later, when so many prisoners still find themselves subject to the original imprisonment for public protection.

I thank the Prison Reform Trust, the Howard League and many others for their advice. I will take a moment to thank Frances Crook for her many years of dedicated commitment and service in the cause of reform. Frances, who retired at the end of October, will long be remembered as a beacon for her commitment and dedication. But in an area which is so unfashionable and difficult to gain the public’s attention in, you also really need the utmost stalwart tenacity to carry it through. I particularly want to offer my appreciation and thanks to campaigners, individuals and families for their understanding, determination and tenacity, particularly the campaigning group UNGRIPP: Shirley Debono and Donna Mooney have been with me for almost as long as I can remember in trying to put right something which, as I mentioned a moment ago, I had a hand in getting wrong. The remarkable coalition that exists inside your Lordships’ House and outside, should surely give the Government the cover and courage to take steps now that will put wrongs right and ensure that we have a journey—a road to travel—for the future.

I want to refer briefly, because I am aware of the enormous pressure on time for the Bill, to how we got here in the first place. Back in 2003, with the Criminal Justice Act’s provisions on sentencing, we thought—this was held across both Houses at the time—that the steps we were taking would be beneficial rather than ending up with the disaster, let me call it that, which has occurred over those subsequent 18 years. The intention was, first, to put right a wrong which existed with those who were on indeterminate sentences—they were not called that, but that is what they were—who had no route out because the therapies and courses, or the journey as I like to call it, were not present.

For many years I have been trying to help a prisoner called David McCauliffe, who was sentenced for the second time in his life, that time for seven years, and is still in prison. He was sentenced at the end of the 1980s for a crime that undoubtedly created unsafe conditions for the public at the time but fell short of rape or murder. He is still in prison today after 33 years. The longer he has been in, the more difficult it has been for him to show he is safe to be released. Many IPP prisoners find themselves in that position today.

The intention was that there would be a route for those caught in that trap, like David McCauliffe, to find a way forward. At the same time, there have been a number of incidents where people who were known to be unsafe—they had declared their intention to commit further heinous crimes such as kidnap, rape and murder—were allowed out without any clarity as to how their behaviour was going to be monitored, and they were not on licence. That is why, going back to the Halliday report of 2001, the good intention was that there would be mechanisms put in place to supervise and support—I emphasise “and support”—prisoners on release, to provide safety for the public and rehabilitation for those who were safe to be in the community. Both those elements went badly wrong with the IPP sentence.

First, we had not fully agreed with the Treasury for the resources to be put in place from 2005, after I had left the Home Office, which at the time had responsibility for what is now the Ministry of Justice and sentencing. Therefore, the resources were not available, and are still not, to do the job properly for those who needed rehabilitation and preparation for release. Secondly, we had not understood that, because those therapies and courses were not available, it was quite likely that cautious members of the judiciary would take a “safety first” view in applying an indeterminate sentence rather than a determinate sentence, which in some cases would have been a matter of two or three years, in the initial phases, rather than the 10 years plus originally discussed and envisaged. This was not applied as a mandated sentence because of the understandable requirement of the judiciary to have flexibility and be able to determine a sentence without it being laid down by Parliament.

So, here we are all these years on, with two strands having gone very badly, and the lessons that needed to be learned still in front of us today. I do not think any of us could have envisaged the impact—I certainly did not—of the recall provisions which were later strengthened and therefore made more draconian. This has led to a large number of prisoners finding themselves back in prison, sometimes for committing a crime that could be very minor and sometimes for a breach of their licence conditions. Out of the 3,000 people who are still in prison on IPP, 1,300 of them are there because of recalls. That is 100% up from 2016, five years ago. If we are not careful, that trajectory will lead to more prisoners being in prison on IPP on recall than are actually in prison for the original IPP sentence applied, which is a farcical situation and a tragedy for them.

More than 60 clinical and forensic psychologists, psychiatrists and criminologists have written to me, and I hope they will write to the Minister, setting out the trajectory from those early days, where the lack of therapies and courses led to caution and to the inability of prisoners to demonstrate that they were safe to be released; in other words, the failure to put the other mechanisms in place led to prisoners not being able to demonstrate their safety for the community. By not being able to do so, they spent so much more time in prison that the impact of that lengthy sentence and the hopelessness of not having an end date made their emotional, mental and psychological situation worse. The original sentence was supported by those who believed that the right kind of psychological conditions and help were essential to make them safe and, having undermined those conditions, we now have a situation where they are seen as unsafe; in other words, we have gone full circle, undermining the original intentions and, by doing so, having people in prison far beyond what was originally envisaged.

I am not basing it only on what I have called automatic termination. The scheme set out in Amendment 208G would represent a very different approach to management on licence and, for the reasons I have set out, that is not a form of management which we think provides adequate protection to the public. I may come back to that.

Amendment 208H creates a power for the Secretary of State to release an IPP offender who has been recalled to prison, so long as the Secretary of State is satisfied that it is not necessary for public protection for the offender to remain in prison. The position at the moment is that the Parole Board has a responsibility to assess whether offenders are safe to be released into the community, even after an IPP offender is recalled to prison. They can take a decision to rerelease from only 28 days after the offender is recalled. We believe that the Parole Board’s expertise in determining whether offenders serving indeterminate sentences are safe to be released is, as I said, an essential tool of public protection.

If I may, I come back to where I started, with the words of the noble Lord, Lord Pannick. Again, I am grateful for his kind words. I agree that there are certainly problems with the current system; we are looking at it. We believe that our IPP action plan has achieved significant results and we keep it under constant review. The noble and learned Lord, Lord Judge, in what I have learned to be his habit of putting his finger on the point at issue, asked, “Well, what is going to be done?” I hope that I have made it clear that I have listened to the debate very carefully, and that I have no doubt of the mood and the strength of feeling of the Committee. I am also sufficiently acquainted with the ways of this House to anticipate what might or might not be moved on Report as and when we come to it. I can say this afternoon that I will continue to work on this issue—a number of noble Lords know that I have been working on it already—and to listen to the debate, but for the moment, I ask noble Lords who tabled this amendment to withdraw it.

My Lords, there can be no disagreement that this has been a thoughtful and deeply impressive debate—the kind of occasion that does massive good to the reputation of this House. I hope, therefore, that the Minister’s words at the beginning and end of his response will give us some hope for the future. On a lighter note, I have to say that the noble and learned Lord, Lord Woolf, gave me so much advice when I was Home Secretary that I have difficulty remembering which bits of it I took and which I did not.

On this occasion, I have said already that we clearly have got it wrong, and we now have the opportunity to put it right. The House of Commons Justice Committee has not yet started its process; even with the length of debate on the Bill and the number of days that will be added, it will not have reported in time for us to be able to use this vehicle, and I see no other vehicle coming down the road. We have a chance and, given the Minister’s opening and closing remarks, we may have the opportunity to get this right. It would be admirable and most sensible if the Government were able to bring forward their own proposals before Report, through amendments, guidance and any further regulation by subsidiary legislation they are prepared to use, but if we do not get some movement in time for Report, I believe there is unanimity across all parts of this House that we will have to take action. When we do, I hope that we will have the kind of unanimity we have had this evening. I beg leave to withdraw the amendment in my name.

I did not hear the first part of my noble friend’s question but, on the point she mentions, we seek to capture data in an appropriate way. As I explained, we focus on the offence, so when the new offence of non-fatal strangulation comes into force, we will be capturing data for it and that will, of course, help the services that she mentioned to provide their work as well.

I commend the noble Baroness, Lady Newlove, on her continuing tenacity. Will the Minister clarify whether there is a timescale for ensuring that real-time, important data will be collated, and will it be held centrally, once the police services have got their act together?

My Lords, we are looking to bring in the offence of non-fatal strangulation as soon as we can. We waited to bring it in after Royal Assent to make sure that all the various services, including the police, are ready to investigate and prosecute it. Once we have the data, it will be used in an appropriate manner.

My Lords, I respectfully agree that the noble and learned Lord, Lord Falconer, should be congratulated on his work on the Mental Capacity Act. He described it as

“a vitally important piece of legislation, and one that will make a real difference to the lives of people who may lack mental capacity.”

I respectfully agree. I also congratulate the noble Baroness on hosting a very good briefing event on 17 June. I urge all Members of the House who are interested in this topic to look at the materials from that event, which are available on the Social Care Institute for Excellence website.

My Lords, along with the noble Lord, Lord Young, I was at the briefing that was just referred to. What disturbs me most now is the juxtaposing of the rights under the Mental Capacity Act and the rights of young adults to access their own funds. Surely, the 15 July round table that the Minister mentioned should be the jumping-off point for the consultation, if, as he has often said, his officials are working “at pace”? “At pace” surely means that, within the next three weeks, that consultation material could be put together.

My Lords, we are putting the consultation material together as quickly as we can. The noble Lord is certainly right that we have to balance the ability of young adults to access their own funds against the importance of the protections given by the Mental Capacity Act to young adults who lack the mental capacity to manage those funds or give instructions to others to do so.

My Lords, I congratulate the noble Baroness, Lady Fullbrook, on her maiden speech and look forward to clashing with her over the years to come. I look forward to the noble Baroness, Lady Fleet, making her maiden speech today.

The right honourable Member for Haltemprice and Howden, speaking on the Queen’s Speech, said that he was concerned about an

“illiberal solution in pursuit of a non-existent problem.”

He was talking about the Bill to which the noble Lord, Lord Pickles, has just referred, but he might have been talking about several elements of other Bills as well. As with so much, there are elements of each of the pieces of legislation that have been put forward in this Session of Parliament with which you can agree; other parts lead to very grave concerns.

Very briefly, I will mention the Police, Crime, Sentencing and Courts Bill. I have got no problem dealing with anarcho-syndicalists who misuse and abuse the privilege of freedom to encourage others to do things they would never otherwise have done. I think we need, however, to be absolutely sure that we do not put the police in an impossible position, where they are making impossible judgments based on changes in the law, which will either not be implementable, and therefore ineffective, or will cause the exact opposite of the problem that they were trying to resolve. I hope we will be able to deal with this in your Lordships’ House effectively, amending those parts relating to public order.

I want to concentrate, in the short time available, on the issue of immigration. The Minister referred to border officials having the resources. Tell that to the people, in the limited numbers that are currently allowed in, coming through Heathrow. Either the decision by the Home Secretary is because of incompetence or indifference or intent. It has to be one of those three, and if it is intent, then the lack of application of resources is causing not only major hold-ups but, in doing that, causing the likelihood of a greater spread of infection. If we cannot get that right in the months ahead, how on earth are we going to deal with the complex piece of legislation that creates two tiers of asylum seekers, in circumstances where we claim that we can send people back to countries that will not have them and were not aware of their presence in the first place? Having pulled out of Europol, no longer having the European arrest warrant, having disengaged effectively from working on organised crime across borders and detached ourselves as an island, it ill becomes the Government to then say that we are going to find ways of returning people to countries that will not have them.

We need a much more sophisticated approach. In the year leading up to the pandemic, 32,000 people were turned away because of the measures that were taken in 2003 to put immigration and security officials on European soil, enabling us to turn people back not just on Eurostar but at the border itself so they did not actually reach Britain. More of that effective work, across countries, tackling the criminals that the Minister quite rightly referred to in his speech, would be the way forward. I hope we will be able to do that in a way that, in reference to the speech by the noble Lord, Lord Green, does not counterweight the decision to welcome Hong Kong residents—27,000 to begin with, but possibly half a million over the five years ahead—by making it impossible for other people to make their way to this country and claim their international rights. That would be a great disservice to the name of our country as well as, by the way, to those we are welcoming from Hong Kong.

In essence, there is a great deal we can do in this Queen’s Speech that will be extremely welcome out there—the victims Bill is an obvious one, and the online safety Bill is another. But let us also be clear that, if we do not get the measures right, instead of the bluster and frippery that substitutes for clear thinking and positive action, then we will let people down. In making it possible to take practical measures, we build trust. When we tell people—as I know from my time in Government—that we are going to do something that in our hearts we know is impossible, we lose their trust. While the Government are riding high at the moment, in a few years’ time some of the measures that have been outlined in the Queen’s Speech will catch up with them, and people will realise that they have been misled.

My Lords, I am grateful to the Minister for his explanation. I have joined the Grand Committee’s consideration of this instrument this afternoon as much to learn as to contribute. Given the expertise of those few Members online, I am hopeful that I will be more enlightened at the end of this discussion than I am now at the beginning of it.

I very much appreciate the importance of raising the funds necessary to enhance the tribunal and court system. I understand entirely from the explanation given of the £724 million that has been raised towards the £2 billion total cost of the process. However, I am unclear about the exact cost of this particular process—that is, the procedure in relation to the restriction of funds and property. I would be really grateful if the Minister could clarify this small point for me in his reply. He was good enough to indicate that more money is raised from these charges than the cost of the service itself.

I understand why the list of tribunal activities that the Minister gave us in his earlier contribution should be free. It seems right that the taxpayer should pick up those particular examples because, of course, they relate to very personal issues, such as mental health issues, that require us as a community to fund them. However, it appears that what is actually happening is we are asking those who use the procedure that we are discussing this afternoon to enhance payments in order to subsidise precisely those kinds of activities. It would therefore be useful to know the true cost of this particular element of the courts and tribunals system and of the procedure that we are discussing.

I have no objection to aligning the fee between paper and online in the way that has been described, although clearly it will be an increase for the vast majority of potential users compared with the situation today. It would be helpful to know just how much that additional contribution of between £9 million and £25 million, which will come in next year, will actually make given the cost of implementing the procedure as a whole.

My Lords, I will keep my remarks short, in view of the amount of work to get through today. I congratulate the noble Baroness, Lady Newlove, who has shown the most incredible tenacity to get to this point. It is absolutely amazing, and an example to us all. Also, if I can say this without sounding anodyne or even boring, I congratulate the Government on picking this up. It was the right thing to do, and I am delighted. It opens the way for survivors of domestic abuse to seek justice and have a legal pathway to see their abusers punished. In later amendments, I will pick up on other areas where women are legally discriminated against very seriously, but for the time being, this is a fantastic move by the Government.

My Lords, in view of the pressure of time, I shall be brief, but I could not allow this amendment to pass without congratulating all those who have played such a significant part. The noble Baroness, Lady Newlove, has shown enormous tenacity. There are times in all our parliamentary, public and political lives when we suddenly realise that we can make a real difference to the well-being, and in this case the lives, of others. I congratulate her from the bottom of my heart. I pay tribute to those whom she generously paid tribute in her speech, and also to her co-signatories, my noble friend Lady Wilcox and the noble Baroness, Lady Meacher, who have stuck with this all along.

Unusually for these Benches, I congratulate, as my noble friend Lord Hunt did, the two Ministers, who have been assiduous in their preparedness to listen, respond and be flexible. This is the House of Lords at its best. Parliament is at its best when people listen to each other, where divides are narrowed and overcome, and where people of good will are prepared to find a way forward in the interests of the people whom we seek to serve in the country as a whole.

I have played a very small part in this, but I like to think that the Minister, as I said to him on another occasion, would not wish to put his parliamentary colleagues in the House of Commons in the invidious position of voting down such an important and critical measure. He certainly listened, as have the Government. Will we be able to do so on other issues?

Today there will be many votes. It should not diminish the importance of the Bill that we have continuing issues to raise, because this is a really important piece of legislation. I have one thing to put on the record on the statistics that the noble Baroness, Lady Newlove, gave us this afternoon. This is about power and domination, never about love. It is about people who are prepared to use their manhood for ill, not for good. It is about inadequates who then inflict their inadequacy on the people they claim to love. If we can put that message out to young men in particular, we will have done a very proud job of work this afternoon.

I thank the noble Baroness, Lady Newlove, for what she has done. Many people will have cause to thank her in years to come.

My Lords, this Bill will be remembered in years to come for the many important changes and reforms that will be introduced through it, but without doubt one of the most welcome changes will be the recognition of non-fatal strangulation in law and, we hope, the effective response by the criminal justice system. I say “welcome”; this particular amendment will be most welcomed by the most severely abused women who suffer this particularly horrible crime. As others have said, the noble Baroness, Lady Newlove, has done a superb job, supported by some pretty superb people, in steering the amendment to this point. She has said pretty well all that I would have said, and therefore I will be extremely brief.

The only point that has not been mentioned is that if we really want the amendment to achieve what it should achieve, which is the appropriate response by the police, the courts and so on, then training police officers so that they are aware of this stand-alone offence will be very important, and maybe a little training for doctors, although they should certainly be aware of what a strangulation looks like. Can the Minister say anything about that?

Like others, I say a tremendously sincere thank you to our Ministers, who have really listened. The noble Baroness, Lady Williams, has been a marvellous Minister in this House for a long time now, and we now have the benefit of the noble Lord, Lord Wolfson, as well as the noble Lord, Lord Parkinson. We are very lucky to have those Ministers in this House and I pay credit to them.

My Lords, I too welcome these amendments. However, if this law is going to be passed it should be accompanied by clear advice for the young. Having been guided around TikTok by a young, adult female, there seems to be something of a fashion for strangulation among young women. They say, “I like this”; they say that a boy who will not do it is a pussy, not sexy enough, not interesting enough and not man enough to do what the girl wants. Under those conditions, it is really important that the Government issue clear, unambiguous and easily found advice on the consequences that the introduction of this amendment would have for that sort of activity. I would be grateful if my noble friend would let me know what the Government’s intentions are in this regard, in writing if not this evening.

My Lords, the Committee has heard some extremely powerful and focused speeches this evening. I add my voice to those commending the noble Baroness, Lady Newlove, and the signatories of these amendments, and give my support to Amendment 137. Given what the noble Lord, Lord Lucas, has just said, I hope that the online harms Bill will deal with social media outlets that perpetrate the kind of messages that he enunciated.

The noble Baroness, Lady Newlove, and all those who have spoken, have done so with clarity and unusual brevity for the hybrid House; I will try to emulate that. I have two things to say. First, women police officers who have spoken to me are crying out for this focused and clear piece of legislation, as enunciated in Amendment 137. As the right reverend Prelate the Bishop of London said, they do not want a tick-box approach. They want to change the relevant form—124D—to be able to obtain the Crown Prosecution Service’s direction to take those who are perpetrating this crime through to a successful criminal prosecution. As has been said so often this evening, this is clearly about domestic abuse.

Secondly, why should this Bill be the vehicle to take this forward? There are two reasons. One is that it is self-evident from everything that has been said, the briefings that have been received and offline discussions, that everyone accepts that this legislation is needed and is needed now. There is no reason whatever to delay until another criminal justice or sentencing Bill which may take its turn after a forthcoming Queen’s Speech, somewhere down the line, where this amendment would have to be moved all over again. We would have to go through all the same campaigning, representations and speeches to gain something that the Government themselves have thankfully conceded is a necessary improvement to the law.

I have one plea for the Minister. He has taken to this House like a duck to water, but there is one lesson that those of us who have been around in politics know all too well: you do not ask your own colleagues in another House to vote down something that they know is eminently sensible and required, in some vain hope that they will forgive you for not having done it as quickly and effectively as possible because someone in the legislative committee of government—it changes its name from time to time—has decided that they do not want to have any further substantive amendments to the Bill. We all know that this would be arrant nonsense: the Minister knows it, and the noble Baroness, Lady Williams, who has been extremely helpful on this, knows it. I think that the noble Lord, Lord Marks, in his erudite speech, indicated that even the noble Lord, Lord Anderson, has changed his mind since Second Reading. I am glad if he has, because I was going to refer him to the excellent Second Reading speech by the noble Lord, Lord Young of Cookham, about his experiences in 1975.

All of us can coalesce and praise the Government and applaud the campaigners, particularly the noble Baroness, Lady Newlove, for what is tonight a unified approach to dealing with a horrendous crime, which has led to so many deaths and can be stopped from doing so in the future by a single agreement by government Ministers.

My Lords, I speak briefly in support of Amendments 137 and 138, especially Amendment 137. It has been introduced extremely powerfully by the noble Baroness, Lady Newlove. I do not think that any of us would be here at this stage of the evening, late in the Bill, if we were not absolutely convinced of the importance of a stand-alone offence of non-fatal strangulation, and of course the Government also recognise this.

Perhaps we could pause briefly to pay tribute to, first, those victims of domestic violence—particularly those affected by non-fatal strangulation—and their bravery in coming forward, to the campaigning groups that have been willing to take up the issue on their behalf, and to the parliamentarians, both in the other House and in this place, who have been willing to respond to it. In a dark time, it is good to celebrate the fact that something is working in our democracy in this kind of way.

The key issue this evening for the Government to face is not whether there should be such a stand-alone offence—I think everyone is convinced of that now—but whether or not it should be in this Bill. It seems to me that the Minister has to face two real questions put forward by the noble Baroness, Lady Newlove, and also very powerfully by the noble Baroness, Lady Wilcox of Newport, the noble Lord, Lord Hunt of Kings Heath, and others. First, if 80% of non-fatal strangulations take place in the context of domestic violence, is there any reason at all why it should not be in this Bill? That is where it belongs. Secondly, as was said by the noble Lord, Lord Blunkett, and many others as well, the police are crying out for something clear and associated with this Bill, because it will both raise awareness of this terrible form of cruelty and ensure that there is appropriate training in order to help the police to recognise it.

I very much hope that, when the Minister comes to respond, he will be able to look at these two issues in particular and agree that there is a proper place for this in the Bill.
