Commons ChamberI will open my remarks by paying due regard briefly—I know that the House will have a longer time to do this—to Jack Dromey, the late, departed, much missed Member for Birmingham, Erdington. Jack believed wholeheartedly in policing and he always believed in cross-party working. He was a friend of mine and, like many people, I am very deeply saddened by his loss. He would have been here tonight very much contributing to this debate, so he is much missed. I know that the House will have longer to pay tribute and I know that my colleagues will join me in those comments.
When we worked on policing, we did so with my hon. Friend the Member for Dudley South (Mike Wood), my good friend, to effectively raise the precept from its ceiling to provide greater resource for West Midlands police. As a result, band A, B and E properties in my constituency will pay a direct precept of £217 each year to the Labour police and crime commissioner for the west midlands. As a Conservative, I am not proud of that. I do not want to see tax money going in that direction, with such a high rise in taxes. In fact, £13.7 million has come from Solihull alone.
The reason why the departed Member for Birmingham, Erdington and my hon. Friend worked together on this was that we knew that there was a situation—as the famous note said, there was no money left—in which there had to be a series of financial savings across many parts of Government, and we wanted to help with the rebalancing of that. The agreement that we made at that point does not match what we have now seen—frankly, it was not about inflation-busting rises every year in order to more than make up for any previous deficit.
I pay tribute to my hon. Friend for securing this debate. In Wednesbury, Oldbury and Tipton we are losing all three of our police stations. People up the road in Aldridge were promised a consultation—indeed, my hon. Friend the Member for Aldridge-Brownhills (Wendy Morton) has been fighting hard to make sure that that police station is safe. My hon. Friend just talked about the agreement; does he agree that a key part of that agreement is the principle that there will be consultation and that it is utterly disgraceful to disregard it in the way that the PCC has?
It is an absolute shambles, frankly. The announcement was originally made in a press release and, basically, the same insult has been followed through. We all knew what the result was going to be as soon as the PCC election was decided. Lo and behold, here we are with a PCC in the West Midlands who has been elected through Momentum. If we look around the Chamber, we can see that it is Conservative Members whose local police stations are being closed. I absolutely agree with my hon. Friend, and although my hon. Friend the Member for Aldridge-Brownhills (Wendy Morton) cannot speak in tonight’s debate, she is also a fervent defender of her local police station.
We hoped that the money that we agreed to would be adequately spent. Let us have a look at it for a moment. More than £20 million has been spent on Lloyd House, the PCC’s head office—that is a lot of wallpaper, is it not? When the previous PCC’s original decision about the police station was announced, without consultation, there was more than £100 million in the reserves. That would keep my local police station going for more than a century. The £20 million-plus that has been wasted—well, not wasted but spent, or I suppose they would say it has been invested; I would say, “Nice comfortable chairs—£20 million”—would effectively keep my local police station open for 40 years. Despite the Metropolitan Borough of Solihull having contributed £13.7 million in precept allocations in this financial year, we are about to be robbed of our main police station.
I am hearing loud and clear that we have a police and crime commissioner who is failing constituents not just in Solihull but throughout the West Midlands—he is certainly failing the constituents in Stourbridge. Does my hon. Friend agree that the consistent problem with the police and crime commissioner is that he is continually closing police stations and not reopening them, which was the promise? He certainly promised to me to reopen the police station in Stourbridge and that has not yet happened.
It is a familiar story from my hon. Friend. I will come on to the promises that have been broken over this period.
Let me be absolutely clear: I stand against the proposal to permanently close Solihull police station. The plans will leave my constituency without an operational policing base. I know that my constituents stand with me in opposing the plans. Just before the Christmas recess, I launched a petition with my hon. Friend the Member for Meriden (Saqib Bhatti), whose constituency is also greatly impacted by the proposals. To date, more than 700 residents from across the borough have signed the petition. That is in addition to the 3,000 who signed the previous time the Labour police and crime commissioner came knocking. I put on record my thanks to my local residents and councillors and to my hon. Friend the Member for Meriden for supporting the petition.
I thank my hon. Friend for securing this debate. Does he agree that this is not an either/or situation? Constituents in the north and south of my constituency deserve adequate police resources. The Labour police and crime commissioner has taken a political decision to undermine the safety and security of residents throughout the Metropolitan Borough of Solihull.
My hon. Friend is absolutely right. Actually, the police and crime commissioner has tried to play my hon. Friend and me off against each other by suggesting there will be extra investment in the north of the borough and that that will somehow make a difference in the south of the borough. Everyone knows that the distances are large and the challenges are much different. Frankly, as I will come to say, 125,000 residents in my constituency and beyond, including in parts of my hon. Friend’s constituency, will be left without a major police presence.
Is my hon. Friend aware that the disgraceful proposal also includes closing the main police station in the royal town of Sutton Coldfield? The only people who support this appalling decision are the two Labour Birmingham city councillors. Is not the right answer to build a police hub to serve my town of 100,000 people, with all the relevant police infrastructure, rather than to replace it all with a front counter that is not open all hours? Will my hon. Friend join me in praising Simon Ward, the leader of Royal Sutton Coldfield Town Council, for his motion condemning the decision, and Janet Cairns, a councillor and community activist who has campaigned forcefully against the dreadful proposals?
I concur with my right hon. Friend. The royal town of Sutton Coldfield has been in the trenches with me over the last few years following this disgraceful attack on our constituents, which is completely unnecessary for the reasons I will now outline.
I accept it is easy to speak against a police station closure, so I hope Members will allow me to outline what I believe to be the legitimate reasons why Solihull police station must remain open. First, it primarily serves the south of Solihull borough, which includes my constituency and some of the villages in the constituency of my hon. Friend the Member for Meriden, including Dickens Heath, Dorridge, Knowle and Hampton in Arden. We are talking about a population of around 127,000 residents. The fact that an area with such a dense population is going to lose its only operational police base is nothing less than a scandal and a travesty.
It is also important to remember that in 2015 the previous Labour police and crime commissioner closed Shirley police station. My hon. Friend the Member for Stourbridge (Suzanne Webb) and I were told that, magically, there would be a police presence, and what has happened? Absolutely zilch.
My hon. Friend has alluded to the previous police and crime commissioner closing various police stations in Dudley borough, including Stourbridge, Kingswinford and Netherton among others. When he announced that Brierley Hill police station would be closing in the next two or three years to open a new police station in Dudley town centre, moving our only remaining police station from the centre of the borough to the far corner of the borough, he promised that a meaningful police presence would remain in Brierley Hill town centre. Does my hon. Friend agree that it needs to be a proper police station with officers operating out of it, not just a locker and an office?
I completely concur with my hon. Friend, and we are in a similar situation. Frankly, cars will have to come from Tally Ho and Coventry, which is far too long a response time for my constituents.
In response to my constituents’ rightful frustrations, the police and crime commissioner stated in his estate review that
“locations for public contact offices in Solihull and Sutton will continue to be explored”.
That is very big of him. There is absolutely no commitment to give Solihull a public contact office. A number of questions have been raised as to what a public contact office really means. Reference has been made to it merely being a desk in a library with someone wearing a bit of hi-vis. For 127,000 people a desk in a library, 9 to 3, hi-vis—that is it, done. It is absolutely ridiculous, a travesty and a disgrace.
How can I honestly encourage my constituents to report crime, particularly crime of a personal and sensitive nature, to a police desk in the middle of a public space that is open only at certain hours and where they do not know precisely to whom they are speaking? What if one of my constituents suffering from physical and emotional abuse does not, for whatever reason, have access to a telephone and wants to seek refuge in a secure policing environment? That will now not be available anywhere in my large town.
As my constituent Mr Thompson of Compton Close—not the other Mr Thompson—put it brilliantly:
“We have already suffered the closure of the Shirley police station. It’s clear this next step is unacceptable to all Silhillians. Solihull residents deserve more than the muted ‘desk’ to take concerns. We deserve and should expect a local Police station with officers to respond directly to our needs.”
The police and crime commissioner tries to defend this cruel decision to close Solihull police station by using the usual line from the Opposition Benches, which are empty tonight, that West Midlands police has suffered from cuts and austerity. In a press release, he stated that once again—
“a decade of reckless Government cuts.”
Home Office data on direct money shows that from 2018-19 to 2021-22 it has gone up from £442 million to £694 million—an uplift of £250 million in four years. So, in light of the substantial increase in direct subsidies from the Home Office, straight into the PCC’s office, we have to ask ourselves why on earth he has decided to put forward plans to permanently close our police stations, when funding is proportionally higher than it was many years ago.
I would also draw the House’s attention to the fact that, as a result of more Government funding to the Labour police and crime commissioner, West Midlands police has managed to recruit hundreds of new police officers. Indeed, it admits in a statement that since the general election, this Conservative Government have managed to recruit 867 police officers across the west midlands. With the hundreds of additional police officers on the beat across the west midlands, particularly in Solihull, the PCC clearly forgets that we need adequate space to house those new officers. By closing Solihull police stations and those of my hon. Friends, and other stations across the west midlands, the PCC is drastically reducing the size of the constabulary’s estate just as the police force is growing, which means fewer desks, less officers and a reduction in the number of cells.
I am sure hon. Members know just how often we are contacted by our constituents about the levels of crime in our areas. I am contacted daily by constituents about the concern that exists about the substantial rise in crime across Solihull, which has been going on for many years. In particular the fear of violent crime, knife crime and burglary is a real concern to my residents. In December 2019 we had the murder of 21-year-old Jack Donoghue outside Popworld; he was simply enjoying a night out.
Lockdown has created difficulties in assessing crime statistics. However, despite our not having the full crime statistics for 2020-21, I can confirm to the House that of those that are already reported, 666 individual cases of violent crime have been reported in Solihull in the last year alone. That is already a massive increase on the data for 2020, when we had 574 such incidents. Undoubtedly, West Midlands police has a reputation—a very unwelcome reputation—for suffering large-scale knife crimes. What is the answer, I ask? Well, the answer of this police and crime commissioner is first to stop stop and search; that is a great way to stop knife crime. And the other one is to close our police stations, despite the huge uplift in moneys that come, not only from the precept, but from central Government.
My constituents deserve better. They deserve permanent policing. Theirs is a large town, a vibrant town, a town with many older residents who need the safety and protection that is the very basic that we all ask for ourselves and our society.
It is no secret that I have always been sceptical about the role of police and crime commissioner. In the financial year 2019-20—and who can blame him, frankly—the West Midlands PCC’s office spent £437,000 on salaries for the PCC, his deputies and the senior statutory officers alone, money that I believe should instead be spent on frontline national policing.
To conclude, if we are not going to get rid of the role of police and crime commissioner—and I would be absolutely delighted if we did—we have to fold it into the role of the Mayor of the West Midlands, someone who actually knows what he is doing and is not an ideologue, and does not think that the cure for knife crime is less stop and search.
My hon. Friend is making a brilliant speech. I agree that there is some scepticism about police and crime commissioners, because when we set them up, earlier in the period of Conservative Government, we were very keen that police and crime commissioners should stand up for the public, so that they were really well represented when the police made decisions. Is not that the great failure this time, in his patch and in mine—that the police and crime commissioner is not reflecting the heartfelt views and opinions of the people that we represent?
My right hon. Friend has obviously been reading my speech.
My final challenge to the police and crime commissioner is this: prove us wrong. Prove that you are not partisan. Prove to us that you are committed to your job—that of protecting the residents of the west midlands. And by so doing, acknowledge that you have had the uplift in money, you have had the extra precept, and do not close our police stations.

Commons ChamberAs ever, my hon. Friend is making a thoughtful and compassionate contribution to the debate. I agree with the tenets of the Bill and I slightly disagree with some aspects of her speech. We need to take confrontation out of the break-up process. I certainly agree with her that we need to signpost people towards relationship counselling services. In effect, as part of the trade-off in allowing a more simple, streamlined divorce process, we need to support those who wish to make a success of such counselling.
Absolutely, and that is very much the thrust of what I want to say today. The Government need to do much more to help to strengthen family relationships.
It is a pleasure, as always, to follow my hon. Friend the Member for Congleton (Fiona Bruce). She made a heartfelt speech. I know that this is a matter on which she feels very strongly. It is an issue to which I myself have given considerable thought. It is sensitive and important, particularly for those who have a faith and regard marriage as a sacrament as well as a legal contract.
I look at this issue from the point of view of someone who happens to be a practising Anglican, as someone who has for 25 or 30 years been a practising lawyer—not predominantly in the field of family law, although I did practise family law to some degree in my earlier days—as someone who served as a councillor in a local authority, and as someone who has the honour of serving as Chair of the Justice Committee. I have had the chance to see the issue from a number of points of view and I have come to a different conclusion from my hon. Friend. I do not say that with any disrespect for the strength or genuineness of her feeling; I am just persuaded, on balance, that the Secretary of State is right and that the evidence points quite clearly to this being an appropriate and necessary reform.
As Chair of the Justice Committee, I have had the opportunity to engage with leading members of the judiciary, particularly, in this context, with those of the family division. It is the overwhelming view of family practitioners, including solicitors, barristers and senior judges, that the current arrangements, which require fault to be used as a proof of irretrievable breakdown, do not work satisfactorily and do not achieve what is ultimately the necessary objective of enabling people whose marriage has sadly broken down irretrievably—I suspect that none of us want that to happen when we embark on a marriage, but it does happen in some cases—to leave their marriage with a measure of dignity and to do so in a way that enables the important issue of financial fairness to be resolved, and, in the case of children, to enable civilised and caring arrangements to be made for them and their children. That, ultimately, must be the chief and principal objective.
My hon. Friend gets to the heart of the matter: the fault aspect. What persuades me is that the requirement to assign fault can itself be a polluting element within the divorce or separation process. It may actually make what could be a more amicable separation more poisonous and more difficult when it comes to discussing other matters such as finance.
I agree and that was certainly my experience as a lawyer. That is the experience of the majority of practitioners and the majority of the judiciary to whom I have spoken. When I started my practice at the Bar, the Divorce Reform Act 1969 was comparatively recent and the law was developing. There was an issue then and it has remained a constant. There is an underlying risk of tension and antagonism in the course of family proceedings, which spill on from the divorce itself into the proceedings thereafter, which, for the future, are very often much more important. I very much take on board the point my hon. Friend the Member for Congleton makes about the value to society of stable marriages—indeed, the value to society of stable relationships of any kind. If I thought that the Bill would seriously harm that, I would take a different view towards it, but I do not think that and the evidence does not suggest that that is the case either.
As an Anglo-Catholic, I take the hon. Gentleman’s point about the sacrament strongly, but I do not believe, in societal terms, that it makes very much difference. In truth, many marriages are not in entered into in a religious context. The weight that is placed on the sacrament, even with those of faith, may vary. Perhaps it should not, but I think that is the reality. For those for whom it is important, it will be a difficult personal decision, as it has been for friends of mine for whom the end of their marriage was very difficult indeed. None the less, they thought it was appropriate to recognise what had happened and to make a break. It is a profound point for those of faith, but I do not think it is an argument against the Bill, as I think the hon. Gentleman agrees.
We also have to bear in mind the suggestion that there might be manipulation of a vulnerable party. I take that seriously and it has been raised by a couple of constituents of mine who think carefully and closely about these matters. However, my experience and all the evidence seem to suggest that the greatest risk of manipulation and pressure being put on a vulnerable party is during the period when the marriage has broken down and people have to wait perhaps for two or five years, especially if, as hon. Members have observed, they are obliged for financial or childcare reasons—or a mixture of both—to continue to live under the same roof. That is the point at which the vulnerable party is often most at risk.
It is perhaps significant that the study, “Finding Fault?”, points out that, at the moment, the system is to some degree “manipulated” by fault being used as a ground to speed up divorce. It is not that the marriage has not broken down, but that it is quicker for someone to get divorced if they allege fault than if they wait two or five years. That can have perverse consequences: people have to say hurtful things against the party with whom they are still living and attempting to bring up their children, so that they can speed up the divorce that they both know is inevitable. I cannot see how that benefits society or, for those of us to whom this is important, a Christian ethos for that family.
My hon. Friend is absolutely correct and makes another persuasive point, because it means that a divorce is based on a lie. Frankly, we should not have any lies in a legal process. Years ago, I remember reading Evelyn Waugh’s “A Handful of Dust”, in which a character has to abscond to Brighton, seemingly with a woman, to provide the grounds for a divorce. This stuff is from 40 or 50 years ago and is nonsense. We need a bit more honesty in the process.
I take my hon. Friend’s point. My pupil master, when I started at the Bar, had practised in divorce work under precisely those arrangements prior to the 1969 Act. They used to get what was called “ordinary hotel evidence”, which was an affidavit from the chambermaid or the waiter, who happened to have taken breakfast in bed to a couple. That was a pretty demeaning way of having to go through a legal process and it was rightly got rid of, but at the time, people genuinely thought that that might undermine marriage. It did not, of course, but that is the sort of thing that we have all recognised we need to move on from, and this is just a further adjustment.
There is another serious point about the inability of a party who feels aggrieved by the behaviour of their husband or spouse, who might have left them, to have the ground on the record. With respect, that misunderstands the legal test, which has always been, and continues to be, that the marriage has irretrievably broken down. That is not changed by the Bill. The question of behaviour and conduct is relevant only as one of the facts that is relied upon to support the ground for divorce, which is the irretrievable breakdown of the marriage. Moving to a single approach to that—the service of the petition, or the application—simplifies that and does not change the legal test.
Although it is tempting to think that an aggrieved party can get their hurt and concern on the record, it is not relevant as a matter of law because there is no causal connection between the conduct and the ground for the dissolution of marriage, and there never has been since the 1969 Act came into force. It also has the detrimental effect of creating a much more antagonistic attitude, because, first, there is good evidence that people game the system and will exaggerate behaviour to speed up the divorce, and secondly, this clouds the subsequent relationship as parties work out the consequences of the breakdown for finance and families.
It is important that the financial protections for a vulnerable party are specifically preserved under paragraph 10 of the schedule to the Bill, which maintains the existing arrangements. For those concerned about this, it is worth noting that in making a determination on financial arrangements,
“the court must consider all the circumstances including…the age, health, conduct, earning capacity, financial resources and financial obligations of each of the parties to the marriage”.
The suggestion that the change in any way undermines the protection for a vulnerable spouse during a divorce is simply not borne out by that measure, which preserves in the Bill exactly the same test that we have in the current law. I hope that that reassures people who are understandably concerned about that point.
That leads me to my final point, which my hon. Friend the Member for Solihull (Julian Knight) rightly raised: we cannot really justify a legal process that encourages people to be untruthful. That is what is happening and what has been attested to by the judiciary at the highest level. The late, much missed Sir Nicholas Wall, the former president of the family division, spoke on this during his tenure in office. His successor, Sir James Munby, one of the most experienced family division judges of his time, has spoken very bluntly about a system that involved hypocrisy and a “lack of intellectual honesty”. To go back to my hon. Friend’s point, Sir James referred to the “‘hotel divorce’ charades” that had been played out in the past. If there is collusion, it is the collusion that is sometimes needed by parties to invent conduct to speed up the divorce rather than waiting two or five years. Somebody may, for whatever reason—because the marriage has been breaking down for a long time—already have a new partner and there may be a new family on the way. One may or may not approve of that, but it is a reality of the world, and we have to have a justice system that recognises it and enables the best outcomes for that world rather than creating an obstacle.
Lady Hale, the president of the Supreme Court, said that the system is misleading because, as she put it, the
“fact used as the peg on which to hang the divorce petition may not bear any relationship to the real reason why the marriage broke down”.
If we are going to tackle marriage breakdown, as I believe we should, we should put the emphasis and resource into intervening much earlier to prevent the breakdown and not to involve a charade, in some cases, at the end of the divorce arrangements. I agree very much with the observations on that from my hon. Friend the Member for Newton Abbot (Anne Marie Morris), who is not in her place. I would also make the case that if there is an area where funding can be made available to restore elements of legal aid, compelling evidence to the Justice Committee has suggested that early advice on family matters should perhaps be the highest priority for its use. I know that the Secretary of State is someone who will be driven by the evidence when he considers those matters.
The person who perhaps clinches it for me—this is important because of his background—is Sir Paul Coleridge, to whom I have already referred. For many years, he was a family division judge, who practised throughout his professional career in family division work. He is also a practising Christian. Against that dual background, he has come to the view that the law requires reform and that the removal of the fault requirement would be a positive benefit and an advantage. He supports the change on that basis. He said that nowadays, most regard the delays under the current system as
“an intolerable block on their ability to move on with their lives. So to get around the delay they invent allegations to satisfy the court and enable it to turn a blind eye to what is really going on.”
Sir Paul also tackles the issue of divorce rates. He says:
“Since 1970 the divorce rate has fluctuated”—
he practised for a great deal of that time—
“For some periods it has gone up and for other periods, including now, it has dropped. There is simply no discernible connection between the type of divorce process and the rate of family breakdown. The two are unconnected.”
I have been driven by the evidence to agree with him. I hope that we make much more effort to deal with family breakdown, but changing the process is not going alter that situation.
Sir Paul also says:
“We now have a system that drives people to lie to the court if they are not prepared to wait for two years or longer. That is wrong.”
That must be right. He ended what I think was a very thoughtful piece with the following remark:
“An intelligent process to end unsustainable marriage is good for the reinvigoration of the most important social arrangement yet devised for mankind.”
That is a broad and Christian view of the matter, and a socially and legally informed one, and I commend it to the House. It is the reason I support the Bill.

Commons ChamberMy hon. Friend raises a very important point. There is huge potential in this area, but we are already taking steps through telehealth and virtual consultations. We have in-cell telephony, which can be used in these circumstances. Digital hub services also exist, and the prison virtual learning environment includes a health application, so we have a virtual campus that can help people to address addiction issues. I think that there is much more potential in this area in the future.
Under this Government, the most serious offenders are more likely to go to prison and for longer, helping to protect the public and keep communities safe. Prison will be the right place for some offenders, but equally there is evidence that it does not work in rehabilitating others. I want to move the debate on from the old false choice between soft justice versus hard justice, and instead ensure we are focused on delivering smart justice. We need to think more imaginatively about different and more modern forms of punishment in the community.
I support the broad thrust of ensuring that sentences work, particularly for female offenders. Does the Secretary of State agree that at the same time we should look at early release and whether it could be recalibrated to improve prison discipline?
Incentives in the prison system are important to achieving good behaviour. Early release does help offenders to successfully make the transition from custody to living crime-free lives in the community. An additional early release scheme for certain offenders, home detention curfew, further helps to manage that transition and reduce future offending.

I most certainly do, and I am just coming on to housing, so I thank my hon. Friend for his astute intervention.
The report from the Prison Reform Trust makes it clear that there is a lack of services available to women on leaving prison, which contributes to their being recalled. A lack of secure housing for women when they leave prison is a significant factor leading to the recall of female offenders. Of the 24 women interviewed for the report, 22 said that they required help with housing on leaving prison.
If women leave prison and do not successfully secure somewhere to live, they are more likely to be recalled to prison. The female offender strategy highlights that from April to December 2017, 39% of women allocated to community rehabilitation companies and the national probation service were released into unsettled accommodation, with 18% released into homelessness. That not only puts women in a dangerous and vulnerable situation, but directly leads to them being recalled to prison. “Broken Trust” cites the example of a female offender released from prison without secure accommodation to go to, only to be recalled for breach of an antisocial behaviour order because she slept in a park. She was then released homeless for a second time.
How do we expect women to take positive steps to rebuild their lives after leaving prison if they are not given adequate support services such as secure housing? The relentless cuts made to local authorities by the Tory Government have resulted in a dangerous lack of housing for such women. Furthermore, without a secure home, women will find it more difficult to engage successfully with employment opportunities or maintain a healthy lifestyle. With 60% of female prisoners not having a home to go to on release, we know that is a real issue when they leave prison.
Data secured under a freedom of information request made by The Guardian demonstrates that between October 2016 and June 2018 there was a 25-fold increase in rough sleeping in England and Wales among those who have served sentences of less than six months. It is an absolute scandal that women are released home- less anyway, but even if a woman is found secure accommodation, it must be suitable and provide a safe environment in order to help her rebuild her life. Otherwise, female prisoners are likely to return to the potentially toxic settings that led to their arrest in the first place, such as environments with negative influences, including being surrounded by drugs and alcohol, which often leads them to a breach of their licence conditions and recall to prison. Using drugs is one of the six categories that the National Probation Service data present for recall of an individual to prison. In the “Broken Trust” report, an interviewee shared her experience of becoming homeless once she was released from prison:
“By the third night of my release, I was street homeless. My using got worse, I fell off my script even quicker this time. My life was just chaotic. I was doing whatever I could to survive.”
Earlier this week, the Secretary of State for Justice said in a speech that, as part of the Government’s rough sleeping agenda, they will invest £6.4 million in a pilot scheme to help individuals released from three prisons—Bristol, Leeds and Pentonville—into settled accommodation. However, I want to know what the Government will invest specifically in accommodation suitable for female offenders and their complex needs. If support services in the community to help such women find secure housing continue to be inadequate, women will be less likely to be able to break the cycle of criminality.
Another contributing factor to the high recall rate among female offenders is the high rate of complex needs and problems. Women under community supervision and in custody with an assessment are twice as likely as the men to have a mental health need, and 60% of women in the criminal justice system have experienced domestic violence. “Broken Trust” found that a third of those interviewed needed help with mental health, drug misuse and domestic violence. The report also showed that the relevant probation officers were unable to support them adequately, given their complex needs. Female offenders are much more likely to be vulnerable, so we need to ensure that there are services to assist them in rebuilding their lives, not only to help them but to make the community they live in safer.
Another issue that distinctly affects women recalled to prison is that female offenders are more likely than male offenders to be carers for children or other family relatives, and their recall therefore affects not only them, but their dependants. The length of time for which a woman can be recalled to prison can be just a number of days, but it will cause huge disruption to her and her family. Therefore, what provision is being made to ensure that the lives of those family members and dependants are not thrown into chaos?
The female offender strategy is clear that short custodial sentences are less effective in reducing offending than community orders, and that early intervention is key to reducing the number of women entering the criminal justice system.
I congratulate the hon. Lady on securing this important debate. There are too many women in prison, but does she welcome the Ministry of Justice’s move to reduce the number of shorter sentences available? To retain people’s faith in the criminal justice system, early release should be a privilege earned rather than a right automatically given. It is a two-way street.
I am coming on to that statement now.
I welcome the proposal by the Secretary of State to abolish short sentences, which would make a huge difference to women offenders, who are overwhelmingly sentenced to short periods in prison. I urge him to follow through on the proposal as soon as possible in order to create a more effective criminal justice system. Furthermore, there must be a greater focus on funding for early intervention services, which have been cut considerably because of constrained budgets.
It is a stark statistic that 60% of female offenders supervised in the community or in custody who have an assessment have experienced domestic abuse. It illustrates how important it is to make domestic abuse services available to women, either to stop them offending in the first place or to help them not to reoffend. In the Women’s Aid annual survey, those who run domestic abuse services reported that the largest challenge was funding for and sustainability of their services. That will obviously impact on their ability to help vulnerable women. The same report shows that one in five of all referrals to a refuge were declined owing to a lack of space. If the Government are serious about supporting women, there needs to be greater funding for those life-saving services so that refuges do not have to turn away referred women and so that they can be supported before they enter the criminal justice system.
Another report from the Prison Reform Trust showed strong links between women’s experience of domestic and sexual abuse and coercive relationships and their offending. Better funding for domestic abuse services and ensuring that the provision is consistent and joined up across the UK would provide stronger provision for women who are victims of domestic violence, moving them away from entering the criminal justice system.
Given the reports by Women’s Aid and the Prison Reform Trust of the patchy delivery of domestic abuse services for women, will the Government commit to adequate funding of early intervention services, particularly domestic abuse services, so that women are either supported not to enter the criminal justice system in the first place, or not forced to re-enter it? Early intervention services across the UK would have a positive impact on reducing the number of women in prison, thus reducing the recall rate. For example, last year the Welsh Labour Government—I am very proud that I am Welsh—introduced a framework to support positive changes for those at risk of offending, which will have a renewed focus on early intervention services to help stop individuals entering the criminal justice system and to keep people from offending. I can supply a copy of the relevant documents to the Minister should he wish to see them.
Lastly, one of the most important factors that would prevent a woman being recalled to prison is a successful working relationship between the probation officer and the individual. I want to put on the record my admiration for Napo, the union, which I know tries really hard to support the staff, as I know the staff try to support their clients. The report by Her Majesty’s inspectorate of probation into recall described the impact that a negative relationship with a probation officer can have on recall:
“Those who have a poor relationship with their responsible officer are more likely to breach, and the fairness of enforcement decisions may affect this relationship.”
The report also showed that there was limited access to appropriate, women-only provision for female offenders. Furthermore, as I said, it is widely understood that female offenders have more complex needs than male offenders. Probation officers must therefore be properly trained in how to support offenders with complex needs, and must be able to signpost them to services that have resources to help them. That will be possible only if there are adequate support services with a joined-up approach to supporting the service user as soon as they leave prison. That, combined with positive relationships between probation officers and female offenders, would see the number of women recalled to prison fall.
Given the shocking rise in the number of women being recalled, we have to ask whether this is the most effective way of helping women to break their cycles in the criminal justice system. I welcome the Secretary of State’s comments earlier this week, which echoed the view that it is particularly disruptive to women’s lives for them to be recalled to prison, given that they are likely to have dependants. I want assurances that his proposal to abolish short sentences will be introduced as soon as possible. The female offender strategy is clear that women in prison are complex. The support services need to be well resourced so that, when they are released from prison, they have all the help they need to prevent them being recalled. Responses from the Prison Reform Trust show that a lack of secure and safe housing for women once they are released from prison directly leads to their recall. It is an absolute scandal that we are releasing women who are likely to be victims of domestic violence and have complex needs on to the streets.
There must be more funding for local authorities so that the right support services are in place and we can offer a joined-up approach to support women. Furthermore, there must be more of a focus on early intervention, which will steer women away from entering the criminal justice system in the first place or stop them being recalled. Services must be better resourced so that there is no longer patchy delivery for women across the UK.
Finally, a successful relationship between probation officers and service users is key. Probation officers must have adequate training to help female offenders, who have a variety of complex needs. I want assurances from the Government that they will provide that desperately needed funding. That would demonstrate that they are truly committed to the aims of the female offender strategy. They must properly resource the relevant bodies so that women are supported to break their negative cycles in the criminal justice system.

It was a great pleasure to serve on this Committee. Despite the to-ing and fro-ing there was also a lot of cross-party agreement in the Committee; it must be acknowledged that there was some real working together.
The Bill opens up greater flexibility and will over time open up new technologies and the ability to deploy them in order to provide better access to justice. I had a fantastic briefing from the Ministry of Justice where officials went through all the things that will go live over the next few months and years in terms of accessing justice online. I was greatly encouraged by that. I pay tribute to my hon. and learned Friend the Minister who has piloted that and is a champion of it, and who has made real headway in that regard. It will make a real difference on the ground.
The delegation of judicial functions, as my hon. Friend the Member for Bromley and Chislehurst (Robert Neill) said, is a logical follow-on from the Briggs report. These changes will save £6 million. There will be greater access to justice and greater use of technology. I hope that that £6 million gets ploughed into some of the schemes my colleagues have spoken about. The Ministry of Justice does a fantastic job on what are, we must acknowledge, limited resources due to the financial situation we inherited.

It is with great pleasure that I rise to speak on Third Reading. This Bill has been a long time coming. The first suggestions of the Bill’s introduction date back to 2012, six years ago, and the precise measures in the Bill were proposed by the Chancellor in an autumn statement in 2015, more than three years ago. Since then, there has been a series of detailed consultations. I would like to pay tribute to the Justice Committee for its prelegislative scrutiny, particularly on the issue of discount rates. Perhaps the biggest tribute must be paid to all Members of the other House, who undertook a very serious series of debates, which led to a number of significant changes to the Bill that I hope all Members of the House agree are significant improvements.
Perhaps the most dramatic improvement is the Government amendment that ensures insurers pass on savings to their customers. A number of learned, hon. and right hon. Friends have expressed concerns that were we to achieve a situation in which the insurance companies paid out less to claimants, that would simply go into the insurance companies’ bottom line. We have therefore introduced through an amendment perhaps the most detailed and unprecedented reporting requirements incumbent on the insurance companies to the Treasury and the Financial Conduct Authority.
Will the Minister confirm that this is an unprecedented level of oversight, in terms of what the Government are challenging the insurance industry to perform for its customers?
Absolutely. It is an unprecedented move. The fundamental idea is that the insurance companies are operating in a competitive market, so this is not simply a question of how much money they take in premiums or how much money they pay out; it is also about attracting customers, and in order to attract customers, they need to compete with one another on price. If they were not to do so, they would in effect be running a cartel, and the information they give to the Treasury and the Financial Conduct Authority would provide exactly the evidence to display that kind of unfair practice. We are therefore guaranteeing that the commitment made by 85% of the insurance industry to pass on these savings to customers will be upheld. I give way to the hon. Member for Belfast South (Emma Little Pengelly). [Interruption.] Oh, no, she was not intervening on me. I apologise.
My hon. Friend makes a very good point, which has been made by the shadow Front-Bench team and others: dealing with claims management companies is going to be a central part of this. Consultation has taken place on this, and measures have been taken against claims management companies. A significant issue remains, which we are consulting on and trying to resolve—to be honest with the House, it is the fact that many of these calls come from foreign jurisdictions, so the challenge is trying to work out the best way to deal with that.[Official Report, 3 December 2018, Vol. 650, c. 7MC.] On my way into the Second Reading debate, I received exactly that kind of call, encouraging me to make a whiplash claim for a car accident that I had suffered. For a moment, I wondered whether somebody had not put somebody else up to calling me in this fashion and whether this was not some kind of fuss. Sure enough, however, this is continuing to happen.
Perhaps the company in question knew that the Minister was in for a bruising time in that debate. The absolute key to this whole debate is that this is about confidence in our legal system and in justice in compensation. The reality is that these phone calls and companies, which try to encourage people to make claims for any particular reason, are destroying confidence in that system. That is why the Bill is so necessary.
This is a really important point. At the core of our legal system there needs to be public trust and confidence in that system, and having an honest, proportionate, credible and calibrated system is absolutely central to the public continuing to have confidence.
With your permission, Mr Deputy Speaker, I want to make one slightly technical point relating to the Bill, and in particular to the injuries mentioned in clause 1(2) and (3). Subsection (2) states:
“An injury falls within this subsection if it is—
(a) a sprain, strain, tear, rupture or lesser damage of a muscle, tendon or ligament in the neck, back or shoulder, or
(b) an injury of soft tissue associated with a muscle, tendon or ligament in the neck, back or shoulder.”
Subsection (3) states:
“An injury is excepted by this subsection if—
(a) it is an injury of soft tissue which is a part of or connected to another injury”.
I wish to pause on that point for a second, because we wish to make it clear, as the Government, that when we refer to the question of something being “connected”, we are not referring to it being connected simply by virtue of it taking place within the same accident.
I have the following on a formal piece of paper here, so that I can make my Pepper v. Hart statement to make sure that this is clear for the judiciary. In subsection (3), therefore, we have excluded those soft tissue injuries in the neck, back or shoulder which are part of or connected to another injury, so long as the other injury is not covered by subsection (2). The effect of subsection (3) would be to exclude, for example, damage to soft tissue which results only from the fracture of an adjoining bone or the tearing of muscles arising from a penetrating injury, which would otherwise fall within subsection (2). It has been suggested that the words “connected to another injury” in subsection (3)(a) could mean an injury resulting from the same accident. There is therefore a concern that a number of soft tissue injuries that would otherwise fall under the definition of whiplash injury will be excluded, and so not subject to the tariff of damages, simply by reason of being suffered on the same occasion as a whiplash injury.[Official Report, 3 December 2018, Vol. 650, c. 8MC.]
This is absolutely not the intention behind subsection (3). Nor is it an interpretation that stands scrutiny. The effect of that interpretation would be to significantly limit the scope of clause 1, in a quite arbitrary way, based on whether a person happened to have incurred any other injury in the same road traffic accident. That is not the intended effect, and nor do we believe that the clause will be interpreted by the courts in this way, as it would not be the normal meaning of the word “connected” in this context. To clarify then: the words “connected to” do not, and are not intended to, extend to situations where two or more injuries are connected solely by their cause—for example, a road traffic accident.
The answer to both those questions is yes. An important concession was made in the House of Lords to extend the amount of time for testing, so that there is more time in which to make sure that the portal has been properly tested by, among others, the judiciary.
Part 2 of the Bill relates to the discount rate, and results from a very sudden change in the way in which compensation was paid to catastrophically injured victims. After 16 years in which the discount rate was set at a positive 2.5%, the last Lord Chancellor but one decided to reduce it to minus 0.75%, which radically changed what happens when someone is allocated a lump sum.
Let me remind the House of the formula that is applied. If, Mr Deputy Speaker, you were attempting to receive compensation for a projected 10 years of life, you were seeking £100,000 of care costs for each of those years, and inflation was, for the sake of argument, zero, you would receive only £1 million to cover you for your 10 years of projected life. Obviously, if inflation was higher, the real-terms increase in your care costs would mean that you would have to be afforded more, and the calculation that would need to be made in the awarding of the money would be how much of a return you could reasonably expect to receive for your money. If you could reasonably expect to receive a higher return for your £1 million, it might be possible to cover you for more years, and vice versa: fewer years would mean a lower return. The discount rate has been applied since the 1970s by the judiciary, and since 2001 by the Lord Chancellor, to enable the courts to calculate the fair rate to apply to a lump sum in the case of catastrophic injury. That sudden change from 2.5% to minus 0.75% meant that in the single year 2017-18 the NHS faced £404 million of costs. Projected forward at that rate, there are potentially not just hundreds of millions, but billions, of pounds of costs attached to the public Exchequer and through insurance premiums on the public themselves. Therefore, through the pre-legislative scrutiny conducted by the Justice Committee and the Government Actuary’s Department we have attempted to strike a proportional balance between the interests of often very vulnerable, catastrophically injured victims and those of society as a whole.
Is it not the case that the mechanics of the discount rate as it was constituted by the Lord Chancellor before the previous one effectively mean that claimants are estimated to be receiving substantially more than 100% entitlement, and that is not what the system is about? We need a system that reflects current investment strategies and current investment returns.
This is a serious issue. The intention of the award made by the court is to provide 100% compensation. In other words, the intent of the court is to make sure that catastrophically injured victims receive the sum of money required to cover their lifetime care costs or loss of earnings. The best way of doing this is through a periodic payment order, which is why we have asked the Master of the Rolls and his committee to look at the use of PPOs. Under such orders, the real costs of people’s care year on year to the moment of their death will be covered; that is how the PPO operates. There is no need to give people a lump sum and speculate somehow on how long they are going to live.
In all cases we would encourage people to make much more use of PPOs. It is true that victims often do not want to accept PPOs. They would rather accept a lump sum either because they believe they can invest it and potentially generate more money or because they feel that were they to die prematurely they could pass on that lump sum to their relatives, but that is not the intention of the award. The award is designed to produce 100% compensation for their care costs.

During my all-too-brief time working with my hon. Friend, he clearly recognised and was up-front about the real difficulties in the prison estate. Will he take the opportunity to tell the House the ambition he has for improvement, specifically work to be done in the 10 target jails, such as Hull, Nottingham—also under urgent notification—and Wormwood Scrubs?
We have chosen 10 of our most challenged local prisons in order to prove that we can turn them around. One of the problems over the last few years is that we are developing a situation in which people are beginning to feel that there is no solution to these prisons. I believe very strongly that these prisons can be turned around. That is why I have said repeatedly that if I do not succeed in turning round the 10 prisons for this pilot, I will resign. Why is it that I am confident that we can turn these 10 prisons around? Because the fundamental problems in these prisons are relatively straightforward. They are problems of decency, they are problems of drugs, they are problems of support and management on the wings. I believe that we have demonstrated in the best of our local prisons that with the right support and the right investment we can do that, and that is what we propose to do in those 10 local prisons, and what I would expect the House to judge me on doing over the next 12 months.

Is it not very important, therefore, that the law is clear and that it makes all upskirting a criminal offence, full stop—no ifs, no buts? You have described a situation where you could say that an image had been taken accidentally, but someone would still end up in a court situation. Would it not be much better if the law was so clear that every upskirting was an offence—so that you would not get all these people in—because we all know it? Is that not the case?
Assistant Commissioner Hewitt: Absolutely. We always seek very clear laws, which make our job a lot easier. Defences will always be run, and some of them will have some credibility, although I would guess that most will not in this sort of instance. For me, that is absolutely right. Having that clarity around an offence that we know is taking place—and, as I said, with the kind of access people have to their phones—is really important.
Equally, the other reason that I think that is important is that this does not sit in isolation; it is part of a continuum of sexual offending. Of course, it is not a contact offence, but it is part of that continuum, and it is absolutely right that we send a clear message that it is unacceptable to do any acts that are motivated by sexual gratification and have a victim on the other end. That starts with this, but it works through sexual assault and right into rape offences. We need that clarity, which will allow us to deal with it. As I say, you deal with it proportionately once you have the investigation.

Assistant Commissioner Hewitt: I agree with that entirely. As I just said, if you can reach absolute clarity in legislation, which makes it very clear where the line is and whether you have stepped over that line and that that is an offence, that is absolutely beneficial from our perspective. As we said, we can work out fairly clearly the kind of place where this happens. There has been lots in shops and supermarkets, on transport, and, as you say, at festivals, nightclubs and pubs. Having legislation that makes it very unambiguous for the people running those licences and events, so that they can be clear to everybody who comes into that place, is where we should aim to be. The more we hang things off and spread it, the harder it is to explain it to police officers and others.

Assistant Commissioner Hewitt: Yes. I introduced that concept of image-based sexual abuse, but that was just to make the point that there is a range of ways that people can offend using digital imagery. It was not to suggest that we ought to make this any less clear than it would appear to be. The one exception that I might make around that is whether there is a potential to add an element around distribution or sharing of that image, because, at the moment, the legislation does not go to that stage. As I said, there is some evidence that there are places where people go to upload these images. I think that is taking that offence to a further stage and is adding to the backdrop. That may be worth considering, but we should have absolute clarity about the core elements of that offence.

Assistant Commissioner Hewitt: I am not sure that I can answer that question, but I understand the point you are making. It feels to me that the intrusion of going in and under a garment—the skirt; I know you don’t have to physically—takes it to a slightly further stage than an image of somebody that is taken clearly outside their clothing. You are in the same territory, but I do think there is something particularly invasive about somebody being able to take an image up a skirt. But I understand the point you are making.

That this House has considered grandparents’ rights of access to children.
It is a pleasure to serve under your chairmanship, Mr Streeter. I am pleased to be able to bring this important debate to the House today, because the issue of grandparents being unable to access their grandchildren affects families right across the UK. I have received a significant amount of correspondence from my own constituents. They write to me after family breakdowns and changes in circumstances, seeking guidance on how to go about reaching out to their grandchildren or having legal access.
I adored all my grandparents from both my mum’s and my dad’s family and have fond memories of them from when I was growing up. It is a sad reflection on us that we have not managed properly to reflect in legislation the hugely important role that grandparents play in society. My own dad adores his grandchildren, Finley and Neve, and they adore him back, so whenever I am contacted by constituents, I naturally refer to my own family and simply cannot imagine how hard not having contact must be for everyone involved.
As many hon. Members will know, this is never a straightforward issue to resolve. Distance between grandparents and their grandchildren can come about in a number of ways: marital breakdown, bereavement and family disagreements, to name but a few. For the grandparents and the children from whom they are separated, it can be an incredibly distressing time. The issue has been discussed previously in the House in debates on private Members’ Bills, in Adjournment debates and, indeed, in conversations with colleagues on both sides of the House.
I heartily congratulate my hon. Friend on raising this important issue in the House today. Like me, he has received many communications showing the real emotional turmoil that many grandparents feel when they are estranged from their grandchildren. Does he agree that it is always an error when, as is sometimes the case, grandchildren are used as weapons in messy divorces?
I am grateful to my hon. Friend for his intervention. I agree that this situation can be very distressing, and it is obviously wrong for children to be used as weapons by anyone, in any situation. It is very distressing for everyone involved. Often, with the constituents who come to see me, I see only their side, their version of events, and not that of the children involved, but I can tell from my own family that it would be very distressing for the grandchildren not to see their grandparents. This is an issue that does not go away and that does not have a simple solution, no matter how much I wish that there were one. In debates such as this, it is important to remember that the rights of the grandchildren matter as much as those of the grandparents. Children should be given the opportunity to visit their grandparents if they wish to do so.
I would like to use the opportunity provided by the debate to praise the charities and organisations that aim to help grandparents who have become estranged from their grandchildren, often through no fault of their own. One such charity is GranPart, which operates in my constituency of Northampton South and aims to help grandparents in the county with advice and services that allow them to try to reconnect with their grandchildren, or at least to share their experiences with others and share best practice in order that people can try to reconnect with their own families. I have attended the monthly meeting and listened to some of the distressing stories of how grandparents have ended up losing contact with their grandchildren. Sometimes that is because arguments have gone too far; sometimes it can be due to families separating; and sometimes people never really understand the reasons why.
Some people have written to me to suggest that the situation could be changed with a few minor amendments to the wording of the Children Act 1989. That primarily means adding in a reference to a child’s extended family as well as to their parents. That minor change could ensure that grandparents were given rights to see their grandchildren that were similar to the rights of any parent in order to help to secure the child’s welfare, and ensure that grandparents were not negatively impacted by any change to a child’s family situation. However, I can envisage situations in which that could lead to conflict. In most families, the primary responsibility for bringing up children lies with the parents, and I would not wish to see parental responsibility confused in any way by giving additional rights to grandparents that superseded the role of a parent or, as my hon. Friend the Member for Solihull (Julian Knight) said, that could be used as a weapon in any disagreement.
It is a pleasure to speak in this debate. I congratulate the hon. Member for Northampton South (David Mackintosh) on securing it and on introducing it so well. This issue is clearly of importance to those of us who are in Westminster Hall today, and I believe that it is also of importance to other hon. Members who unfortunately, for whatever reason, have been unable to make it to the Chamber or, indeed, are preparing for the election, which two weeks ago none of us was aware of. This issue comes up at advice centres. It comes up at my advice centre back home as well.
I declare an interest—because I am of that age—as a doting grandfather. Looking round the Chamber, I am not sure whether everyone is a grandparent, but I know that you, Mr Streeter, have achieved that goal. When I held my eldest son Jamie in my arms some 29 years ago, I thought that nothing in this world could top the pride and love that I felt as I looked into that perfect little face. I was wrong. There was a little girl who made her way into this world and into a special place in her grandfather’s heart that had never been touched before. My little Katie is eight years old. When I thought there was no more room left in my heart, little Mia came along—she is just three years old—underlining the fact that there is nothing more enjoyable than time with grandchildren. There is also the fact that, as we all know, they can be handed back whenever they get a bit stroppy. That is one of the great advantages of being a grandparent.
The fact of the matter is that we are here today in Westminster Hall to debate this issue because we want to ensure access for grandparents. I am lucky; I have access to my grandchildren. I am very fortunate. I am also fortunate that most of my family and friends are in the same position.
I am absolutely convinced that the hon. Gentleman is a magnificent grandfather in many respects and an archetypal grandparent. This is a two-way thing. Both my grandmothers are still alive, and they are both 91 years old. One of them virtually brought me up from what was effectively a broken home. The relationship and bond that we formed is something that has carried me through my entire life. I cannot imagine anything worse than not having access. Does the hon. Gentleman agree that the right of children to have access to their grandparents is so important?
I fully and totally agree with that. I thank the hon. Gentleman for his intervention and for the words he put forward. I do not think anyone in the Chamber would not have the same opinion. There is something special about a grandparent’s relationship with their grandchildren, and I do not say that just because I am one. My mother is still living. She is 85 years old, and will soon be 86. As a great-grandparent, she dotes on the wee children. She always wants to hear what they are doing. That bond develops at a very early stage, even between my grandchildren and their great-grandmother. It creates a nice warm feeling. Unfortunately, there are many who long to see their grandchildren and are denied that opportunity. That is the reason for this debate today.
I am hoping to get away on a holiday this summer—probably for the first time—with my wife and the grandchildren. The memories made on that trip will be the stuff of dreams, because that is how dreams are made. The photographs will be special, and I will be able to spend quality time with them with no pressure. One way of ensuring that there is no pressure is to leave that mobile phone at home, because then you are incommunicado for a certain period of time. I can do that because my son and his wife are happy for me to be with Katie and Mia as much as I want.
I do not take that for granted, when I see so many grandparents shut out of their grandchildren’s lives, whether that is due to marital break-ups, a spin-off from the breakdown of a relationship, people moving away, or grandchildren being used as a tool against the grandparents. The guidance on access for grandparents to their grandchildren states that access should initially be sought through agreement with the parents or carers of the child, as the hon. Member for Northampton South outlined in his introduction. However, where such an agreement cannot be made, the grandparent can seek the leave of the court and, if successful, apply for a child arrangements order to agree access. That is all very well, but it is not as simple as that. It is not easy to do when parents are estranged, and unfortunately children are often used as a weapon, which is very painful.
As a grandparent, I can only imagine being cut out of my beautiful granddaughters’ lives. I would certainly do everything in my power to facilitate Katie and Mia visiting, no matter what, but if that was not possible and could not be achieved, I would have to go to court for access, which is expensive and soul-destroying when grandparents’ rights are so restricted. The hon. Gentleman made a salient point in his final few words about the pain that going to court causes not only to grandparents and parents but to children. They cannot quite understand what is going on or what all the arguments and fights are about, but they know that something is wrong and that they are the piggy in the middle, if I can use that terminology, being pulled from all sides. All sides may genuinely love their children or grandchildren, but access can be denied.
It is good to see the Minister in his place, and we look forward to his response. More must be done to support access rights. If that means enacting legislation to enshrine clearer rights for grandparents—that is what has been suggested by the hon. Gentleman and in interventions, and it is what I would look for, too—then that is what needs to happen. The Government enjoy the fact that one in four working families rely on grandparents for childcare, which saves the Government money in tax credits and childcare vouchers; it follows that grandparents should receive the benefit of Government notice and attention. That is what we are here today trying to achieve—that their rights are protected should the unthinkable happen. If today’s debate moves that process on and enables legislative change to come in the next Parliament, and if the Minister is able to respond in a suitable way, I would speak strongly in support. A nanny tax credit and such things are great, but it is clear that more support is needed for those who are not able to see their grandchild or grandchildren.
I fully support the motion and look to the Minister to ensure that, when the new Government are in place after 9 June, they take the issue on board and take steps to clarify further the rights of grandparents in the UK as a whole. On behalf of grandparents who do not have access to their grandchildren, I say passionately that that would be a step in the right direction.
