Lady is absolutely right that people should have the opportunity to see justice done, and justice is done not simply by getting an injunction—important though that may be—but by ensuring that an abuser hears the clang of the prison gate in appropriate circumstances and if that is what the court orders. I do not know specifically what happened in that case, but I can say that, under the victims code, individuals have the opportunity to raise issues with the CPS. Supposing that they were seeking to drop a case, there is now a victim’s right to review—to say to the CPS, “Look again at this.” Equally, there is the opportunity for court familiarisation visits or special measures applications. That is all about ensuring that, where they want to, victims have their day in court and see justice done.
My understanding of the law presently is that if someone is driving a motor vehicle and they kill an individual, their blood can be taken without their consent, but the blood cannot be tested unless the defendant gives their consent, and if the defendant refuses to give consent, that is accepted as guilt in the eyes of the law. That meant that Claire, the mother of six-year-old Sharlotte-Sky, who tragically lost her life in Norton Green due to John Owen, who was on drink and drugs, waited over a year before she got her day in court and justice. Will the Lord Chancellor back my campaign for Sharlotte’s law to be introduced?
My hon. Friend has been a doughty champion on this issue and he continues to raise it. I suggest that he and I have a conversation in due course.

Commons ChamberWell, criminals do deserve to be behind bars, which is why I am proud of the fact that when it comes to rape, which is an appalling crime that robs innocence and destroys lives, we have ensured that criminals convicted of that offence get prison sentences a third longer than they did in 2010. I am pleased to be able to record that the numbers convicted of that appalling offence, in the last 12 months for which figures are available, are 10% higher than under the Labour Government.
I express my sincere condolences and deep sorrow to the family of my hon. Friend’s young constituent. As he knows, the provisions in the Police, Crime, Sentencing and Courts Act 2022 fulfilled our long-standing commitment to increase the maximum penalty from 14 years to life imprisonment for the offence of causing death by dangerous driving. The Department for Transport is considering the publication of a call for evidence on motoring offences. While work is continuing as to its precise scope and timing, it is expected to include aspects of drink and drug driving and the failure to stop and report, with the opportunity to raise other matters. I encourage my hon. Friend to write to me and the Secretary of State for Transport, and I would be happy to discuss these matters further.

Commons ChamberI am aware through my office that I have gone viral on Twitter for the fact that, unfortunately, we have criminals who blight the great constituency of Stoke-on-Trent North, Kidsgrove and Talke. I referred to the scumbags who fly-tip, the scrotes who deal drugs and the savages who create their antisocial behaviour. I am not apologetic for calling out this wrong behaviour and for launching a safer streets petition for Tunstall, Cobridge and Smallthorne to get additional CCTV, new alley gates and better street lighting to help make our streets safer.
Despite some of the glares that my hon. Friend the Member for Aylesbury (Rob Butler) has been giving me throughout this debate to ensure that I stay on message, and the pressure that I can feel from my hon. Friend the Member for Barrow and Furness (Simon Fell), I am proud to stand up and say that I am in full support of the Bill in front of us today, because, despite my rough exterior at times, I am a pragmatist at heart. Ultimately, the overriding evidence is clear that something is not working and that that is undermining the very thing that we want to achieve, which is reducing reoffending, helping people to restart their lives and bringing crime down in our local communities. The Bill is a very simple, very basic mechanism that provides some help with that process. I would find it bizarre if anybody had any opposition to the Bill. My hon. Friend the Member for Workington (Mark Jenkinson), who initiated the Bill, is certainly no wet; in fact he is very dry. Even though his neighbour, my hon. Friend the Member for Barrow and Furness, is a little damp, he is obviously very sound on these issues, so it is absolutely correct that we stand up and support him.
It seems very wrong to me that someone is not able to access any support services within a matter of hours of leaving prison, which could be hundreds of miles away from where they call home and from their support network of family and friends, who are good and trusted people who could guide them on the right path. It is completely abhorrent that someone should be left in such a vulnerable state. We are talking about people who will be suffering from drug and alcohol addiction. Their crime will have fed into those habits. Ultimately, these are people who need the right support and guidance, which links in with the fantastic legislation introduced by my hon. Friend the Member for Harrow East (Bob Blackman) that supports some of the most vulnerable people in our society. It is right, as he said earlier, that prison governors should use the discretion that they will be given to plan someone’s release, to plan support and to engage with the Probation Service much earlier in order to ensure that the said individual will be able to leave for a caring and nurturing environment.
As my hon. Friend the Member for Aylesbury said, if we can achieve even a small reduction in reoffending, it will mean a lot less crime on our streets and a lot less police time being wasted on, in some cases, small and minor crimes. The police have major matters to deal with, such as those involving county lines gangs—those at the top end who are making the real money—and grooming gangs, who are difficult to catch, requiring hundreds of police to work thousands of hours to find out who is operating in our areas. There is also organised criminal activity such as theft and burglaries, white collar crime and online scams. All those things take an awful lot of police expertise and it is absolutely right, therefore, that we try to find a way to help people who have come out of prison. As my hon. Friend the Member for Barrow and Furness said earlier, it is perfectly reasonable, and common sense at its best, to release someone a day or two earlier than scheduled—we are not talking about weeks or months—so that we avoid the things that we have been talking about. I would like to believe, Mr Deputy Speaker, that common sense always prevails in this place, although my mother says that I lack that at the best of times.
Overall, this is a strong piece of legislation. I am glad that it has cross-party support. I hope that it will go through speedily and unamended in the other place: the quicker that we can get this on the statute books, the quicker that we can act.
I thought that the article that my hon. Friend the Member for Loughborough (Jane Hunt) read out was incredibly powerful. I am not known for openly praising the BBC, but, still, let me give credit where credit is due. That story was of a 17-year-old boy—he is a boy at 17 years old—who was clearly vulnerable, who clearly felt alone, and who had no support network. He had fallen in with the nearest person he could find, but, sadly, that person was someone who should have been avoided. Therefore, through no fault of his own, that young man ended up back in prison for three months.
Let us not forget that it costs an awful lot of taxpayers’ money to look after an individual sitting in a prison cell day in, day out, when they could be out contributing to society and getting the education they deserve or a job with a salary that pays back into the system, giving them the self-confidence, self-worth and self-belief that they can go on to achieve many great things. It is frightfully important for us to remember that. The article made it plain and clear that this is a good Bill. I am grateful to my hon. Friend the Member for Barrow and Furness and I wish him all success in getting it passed.

Commons ChamberThe right hon. Lady raises an important point about probation, which is an incredibly important profession. It can be an attractive career for many people, with a real, strong sense of public service and wanting to help our whole society. We are recruiting at the moment. We need more people to join the probation service and are keen for them to do so. I hope that she will join me in encouraging that.
I think that the right hon. Lady mentioned the extended use of police cells. I want to reassure her and the House that this is not about long periods of time. It is about one or two nights for an individual. In most cases, it is one night and, the next day, that individual would be prioritised for reallocation to a prison.
Mr Speaker, you will be aware that, in Stoke-on-Trent North, Kidsgrove and Talke, we are keen to see scumbags locked up for a longer period of time. But, unfortunately, at this moment in time, 12% of the prison population are foreign national offenders. What is the Ministry of Justice doing to get those people out to serve their sentences elsewhere?
Foreign national offenders are a significant minority of the prison population and it is important that we have a good process to remove them. As my hon. Friend will know, in the Police, Crime, Sentencing and Courts Act 2022, we changed the law to enable removal at the nine-month point rather than at 12 months. Of course, we have also signed the agreement with Albania, and we are keen to sign similar agreements with other countries in the EU and the wider world.

Commons ChamberI can reassure the hon. and learned Lady that the email she speaks of was not an official Ministry of Justice or HM Prison and Probation Service email; it was from a network of staff. It does not constitute official advice. The Department is looking again at how internal communications are done. Most importantly, she will be aware of the Deputy Prime Minister’s move to ensure that in future the default assumption is that if you are a transgender woman with intact male genitalia, you will not be placed in the female estate. That is an important part of the reform package.
Last June, six-year-old Sharlotte-Sky was killed as she was walking along the pavement near her home in Norton Green. Her killer, John Owen, had been drinking, was on drugs, was speeding, was not wearing a seatbelt and was on his mobile phone. He got an insulting six years and four months in prison. Will the Lord Chancellor meet Sharlotte’s mother Claire and me to urgently discuss sentencing guidelines, to ensure that justice is truly served next time?
May I express my condolences and deep sorrow to the family of my hon. Friend’s young constituent? He will know that we have increased the sentencing for driving offences, but I am happy to look at the matter again with him and meet his constituents.

Commons ChamberOur landmark victims Bill will improve support for victims and help to give them confidence that if they report a crime the criminal justice system will treat them in the way that they should expect. We have increased the funding for victim and witness support services to £192 million by 2024-25—quadruple the level in 2009-10. With this funding we are increasing the number of independent sexual and domestic violence advisers to over 1,000—a 43% increase over the next three years—and introducing a 24/7 support line for victims of rape and sexual violence.
Last June, a six-year-old girl was tragically killed when a car hit her and her father as they walked along a road in Stoke-on-Trent North. The victim’s mother has had to wait over a year, suffering in silence, because the defendant took so long to give permission for his blood sample to be tested. If a person has done nothing wrong they should have nothing to fear. That is why I am campaigning for an amendment to section 7 of the Road Traffic Act 1988 for blood testing to take place without permission, required where loss of life has occurred, to give victims the answers they deserve and need quicker. Would my hon. Friend support such a change?
I am grateful to my hon. Friend for raising this terrible tragedy in the House today. The impact on the family is unthinkable and what has happened is just awful. He will recognise that the measures introduced in the Police, Crime, Sentencing and Courts Act 2022—with his support—came into force last week, tightening the offences and reflecting the culpability of offenders and the devastating harm that these crimes cause, as well as introducing a new offence of causing serious injury by careless driving. The Department for Transport is about to launch a call for evidence looking at motoring offences, and I know it is keen to engage with my hon. Friend on that.

Commons ChamberI am not aware of the specifics of that particular case. I am happy to meet or correspond with the hon. Lady if she wishes, but it is the case that people who have been convicted of a prior criminal offence are not entitled to compensation through the criminal injuries compensation scheme.
My hon. Friend will be aware that one of the best ways to reduce reoffending is education and work. When I speak to people in Stoke-on-Trent North, Kidsgrove and Talke, one of the things they want to see from people who are currently in prison who may be looking to leave is them not only gaining level 3 and level 4 qualifications, but getting out and working and earning money, whether that be through picking fruit and veg, or digging up roads. Can we see how that can be done through the Ministry of Justice?
My hon. Friend, in his usual forthright way, is quite right and cuts to the heart of the issue. We believe there is a simple formula for success after prison: giving people a job, a house and friend. If we think about it, those three pillars are the foundation of success for most of our lives and so it should be for prisoners, too.

Commons ChamberI welcome my hon. Friend’s commitment to this campaign. I am pleased to hear about his energetic efforts in this sphere and I wish him well. Decisions on priorities are, of course, a matter for individual forces, but I am sure he will want to work with his local force to achieve the laudable aims that his campaign represents.
Pet theft is a shameless and disgusting act that harms families across our country. Scumbag Malachy Doherty of Tunstall was recently sentenced to 27 weeks in prison for stealing Labradors Denzel and Welly. Twenty-seven weeks does not seem long enough to me, so does my right hon. and learned Friend agree with the people of Stoke-on-Trent North, Kidsgrove and Talke that, as part of the pet theft taskforce, firmer punishments and vets checking microchips at the first visit will be ways to help prevent the heartache felt by many victims’ families?
My hon. Friend always speaks with vigour on behalf of his constituents, and I wholeheartedly agree with his revulsion at this appalling type of crime. We share his deep concern, which is why the sort of ideas and proposals he outlined are very much at the forefront of Government thinking.
I am grateful to the hon. Lady for raising that matter. It is an extraordinary fact that 10 years ago stalking was not even an offence, but it was made an offence in 2012. I, together with my hon. Friend the Member for Gloucester (Richard Graham), had a campaign to double the maximum sentence so there is a maximum sentence of 10 years imprisonment. But it is not enough to have the punishment; we have to make sure that these matters get before the courts as well, and that is why I am grateful to the police and the courts for prioritising them. Those who stalk should know that they will be punished properly.
I thank my hon. Friend for raising an issue of genuine and widespread public concern. He will note that the phraseology in the Bill talks about memorials, which of course would include memorials such as the one to Sir Winston Churchill. The important point is that we can now move away from the court determining on the mere cost of repair to criminal damage to look at the overall cultural and emotional value of statues like that one, and indeed, ordinary “unvisited tombs”, to quote George Eliot, of people who have a great value to the local community and to their loved ones.

I congratulate my hon. Friend the Member for Dartford (Gareth Johnson) on securing this incredibly important debate on an issue that is very emotional for the people of Stoke-on-Trent North, Kidsgrove and Talke. The Minister has heard me time and again talking about it, whether it be chuntering in the voting Lobby or in meetings, or talking to him personally about my views on what we should do with some of the most violent criminals and offenders in our country. Personally, I have a policy of, “Lock them up, throw away the key and forget about them,” but I appreciate that we live in a society where perhaps that is not always going to be the case.
However, I will raise one particular case in my constituency, which happened very recently and is extremely high profile. It is a very sad story of how women in particular in this country are the victims of some of the most horrific crimes. I am here to talk about Kimberley Deakin, a 29-year-old who lived in Burslem. She was brutally attacked and murdered by a scumbag, whose name is Lewis Crofts, in a cold and calculated manner, to the point where this young lady, dying on her doorstep, had to call for a neighbour to come and save her child—a very young child, not far off the age of my own daughter. The hurt and pain that this case has caused the local community is palpable. It was such a brutal and premeditated attack, and the murderer showed absolutely no remorse. In fact, he only changed his plea to guilty three days before going to court. When he was arrested at Stafford services, having just bought another bottle of vodka and some cigarettes, he said:
“I have done what I have done. It is as simple as that”.
The attitude of that individual!
The judge did take a very stern view of what had happened, and handed down a life sentence with a minimum of 16 years 9 months inside, but I am sorry: the people of Stoke-on-Trent North, Kidsgrove and Talke do not believe that 16 years 9 months, no matter how long that might be, is enough—life should mean life. We are left baffled. When a crime as calculated, as cold, as chilling as that has taken place, there should never be an ounce of an idea that this person can ever see and smell freedom again.
While I appreciate that that case is one of many that will bring about much deeper legal contemplation over sentencing, probably by people far more educated than I on this issue, it is a really important issue to raise. The attack has left behind a broken family, mother and father, uncle, friends, families and Ava, the daughter, who sadly will no longer grow up knowing her mother. I know that across the House, we as Members sadly come across this type of case far too often in our constituencies, in our local newspapers and in the correspondence that we receive. I wanted to be here to speak up for Kimberley, her family and friends. When I saw Natalie Neale, a friend of Kimberley, she said that no amount of time would be suitable for this scumbag in order to pay back what he had taken.
This wretch has robbed a child of her mother and cut short a young life. The idea even of his being released at the age of 50 horrifies and mortifies me. I appreciate that this is an individual case, and I give full praise to the current and previous Attorney Generals, who have always encouraged Members of this House from all parties to write to them if they feel that an unduly lenient sentence has been passed. I will certainly be making those representations to the Attorney General. There will always be a hole in the heart of Kimberley’s families and friends. Their lives have been ripped apart, but the man who caused that could potentially be free to walk if, obviously, a probationary board felt he was able to.
In my opinion, this Government should go further and do more on unduly lenient sentences. When people hear a judge issue a sentence of even five, 10, 15 years or life, they want to see that time served. I appreciate that there are technicalities of good behaviour, and that certain things may be handed down in a sentence that prisoners can work towards, such as education, or therapy for an alcohol or drug addiction, but unfortunately it baffles constituents when they see five years end up being two, or 10 years end up being five. They want to see justice served.
I know that this Minister is incredibly patient when he listens to colleagues such as me ranting and chuntering from the Back Benches on this type of stuff and I know how seriously he takes every type of case that is brought forward. I want to use this opportunity to say to Kimberley’s loved ones that they have an ally in me and in the Stoke-on-Trent North, Kidsgrove and Talke community. As for Lewis Crofts, the longer he is locked up, the longer that we never see that man walk on the streets. I hope he spends the rest of his life in prison until he passes, because as far as I am concerned, he forfeited his right to be a citizen of this country—he forfeited his rights in full—when he decided to take away the life of a young woman and steal a child from growing up with her mother.

That this House has considered the matter of desecration of war memorials.
It is a pleasure to serve under your chairmanship, Mr Davies.
“Every war memorial in every village, every town and every city across our country is sacred and serves to remind us of the immeasurable gratitude that we must afford to our armed forces, both past and present.”—[Official Report, 23 June 2020; Vol. 677, c. 1215.]
Those are the words I spoke in the House of Commons on 23 June 2020, with my hon. Friend the Member for Bracknell (James Sunderland) by my side, as we submitted our private Member’s Bill for a specific law to punish the desecration of war memorials.
A lack of comprehensive reporting of vandalism of this nature means that it is difficult to ascertain the exact number of incidents each year, although the War Memorials Trust does an excellent job of documenting them. My hon. Friend and I came together after images were beamed across the nation of a hooligan standing on the Cenotaph and twice attempting to set alight the Union flag on 7 June 2020.
Mr Sang has since pleaded guilty to attempted arson. For that, he received a two-year conditional discharge and a fine of £340. I am sorry to say it, but the punishment simply does not fit the crime. It is a slap in the face of our brave and gallant men and women from not just the UK but across the Commonwealth, who gave their lives in the face of tyranny. The Cenotaph is a symbol of the nation’s gratitude for the sacrifice of their tomorrows for our todays.
When I saw the hon. Gentleman’s name down for this debate, I was keen to come along to participate and support him, and I sought his permission to do so. Does he not agree that the desecration of the Churchill memorial in Parliament Square was disgraceful? Our sincere thanks must be given to the couple who took the time to try to clean it with water and soap as a mark of respect. Does he also agree that the message must be strong not only in this place now, but in the legislation put forward, that if people vandalise, whatever their reason, they will be prosecuted? They should be prosecuted heavily and made to do community service, as well as paying any fine.
I am delighted that the hon. Gentleman was a co-signatory—a sponsor—of the private Member’s Bill. I completely agree that what we saw happen with the Churchill statue was wrong beyond all measure. If only I could play the video of the Churchill statue filmed by my hon. Friend the Member for Ashfield (Lee Anderson) as he was standing outside. Clearly, were it not for Winston Churchill, swastikas would be flying above this very building and we would be living in a very different country. We owe Churchill a huge debt of gratitude for bringing together a nation, the Commonwealth and our allies to fight the tyranny and racism of, sadly, those who ran Nazi Germany.
The image of the Cenotaph is beamed into our homes and around the world on Remembrance Sunday, with Her Majesty the Queen, her family, our political leaders, Commonwealth representatives, heads of faith communities, and past and present armed forces personnel standing in silence to pay respect to the glorious dead. Rightly, therefore, many across our nation were sickened and angered by the actions of Mr Sang and the unduly lenient sentence that followed. That has only emboldened my hon. Friend the Member for Bracknell and me to seek justice for our glorious dead.
We were shocked to learn that the law was severely lacking in this area. Although there is provision in existing legislation to hold criminals to account for damage to property, and offenders have been successfully prosecuted, relatively few are held to account for the severity of the aggravating circumstances that come with criminally damaging something as sacred to the nation as war memorials.
For damage to war memorials, my hon. Friend’s and my Bill proposes exemption from the £5,000 damages threshold under the Criminal Damage Act 1971; removal of a maximum fine in favour of an unlimited fine; and establishment of a maximum custodial sentence of 10 years’ imprisonment. It is important to stress that we are not calling for every offence to be met with 10 years’ imprisonment; we are enabling our judiciary to use their discretion to decide whether the offence is worthy of being moved to a Crown court, without the £5,000 threshold barrier blocking its way. Let us join our friends in Australia, the United States and Canada by paying the respect that we owe to those who died in the freedom fight against tyranny.
My hon. Friend and I are very grateful to the Home Secretary and the Lord Chancellor, who have worked closely with us. We were delighted to see the intent in Government to create a specific law in this area in the sentencing reform Green Paper. We are therefore seeking from the Minister a cast-iron guarantee that this proposal will progress unamended into the Green Paper and any legislation, and that it will be made law as soon as possible. If we are given that assurance and see it in black and white, we will withdraw our private Member’s Bill on Second Reading to enable the Government to pick up the baton, and to give them the space to pass this legislation in haste.
The price of war is immeasurably high. I saw that at first hand when a young man from Stratford-upon-Avon, Private Conrad Lewis, lost his life in Afghanistan in 2011. The pain felt by his friends and the community stays with me to this today. Those of us who value freedom of thought, speech and expression know that we can never repay the debt that we owe to these men and women. All we can do is immortalise their memory and display our gratitude for their sacrifice.
In the constituency of Stoke-on-Trent North, Kidsgrove and Talke, which I am honoured to serve, I witness every year the importance the community places on remembering our past and present armed forces personnel. In Kidsgrove, the Royal British Legion, on its own initiative, has set up a beautiful war memorial garden that is used all year round. Every November, thousands of members of the community line the streets and come together to lay wreaths and remember our fallen. In Smallthorne, the superb veterans breakfast club at The Green Star pub, run by Martyn Hunt and Paul Horton, serves all veterans across Stoke-on-Trent as a way of bringing our heroes together to share their stories and lend support to one another.
In Norton Green, the local community came together when the local church, with the names of their fallen, was sold to a local developer. The residents’ association took it upon itself to create a memorial on the village green. Working with Stoke-on-Trent City Council and the Ministry of Housing, Communities and Local Government, it now has a symbol of great importance at the heart of its community. Councillor Chandra Kanneganti and I hope to do that with the residents’ association of Goldenhill and Sandyford.
At Chatterley Whitfield colliery, the Chatterley Whitfield Friends, made up of former miners on the site, have created a beautiful memorial to remember those who lost their lives not only abroad but at home while bringing much-needed coal to support the war effort. In Ball Green, local councillors Dave Evans, James Smith and Carl Edwards are looking at helping to contribute funds to restore the memorial in that former mining village. Last but not least, in Butt Lane we have the Reginald Mitchell peace garden. Thanks to Councillor Kyle Robinson, the memory of Butt Lane lad Reginald Mitchell, who invented the Spitfire, which won us the battle of Britain, will never be forgotten.
I am proud to have family who served their country to protect our liberty. My great-great-uncle, Alan Gullis, who lives today, is a D-day veteran, and my grandfather, Terrence Gullis, served in the Royal Marines during the Suez crisis. I remember growing up and sitting on my grandad’s knee, listening to his tales about life in our armed forces, hoping one day to serve, but sadly unable to do so due to being deaf in my right ear. I also remember the exciting trips to the D-Day Story museum in Portsmouth with my dad, Malcolm, and touring the D-day beaches across France one summer.
Damage and desecration of war memorials is not about the financial cost to repair them. It is about the harm done to a community and nation, which no monetary value can ever be put on. Memorials stand in great, solemn, eternal remembrance of the glorious dead. We cannot bring back those lives or erase the grief of families and communities. The very least we can do is ensure that memorials are adequately protected and punish those who would do them harm.
